so kind of the new library hallway that whole week so they will have that dedicated Hall to themselves um so when they flow between buses we're super close to each other if they didn't have to cost it's all right there they're not living across yeah so their lockers will be starting kind of in outside around nine and then in that Science Academy but the thought is is they probably will not go to the locker maybe in the morning to put their stuff away honestly there's not much the kids are grabbing their own blockers like most of this they have their Chromebook and they're good to go so um so your adventure awaits that's what we told them when they got here uh we worked again today on Camp we'll be going out to Camp again this year uh so sixth grade will be going up for two days seventh grade will be going up two days eighth grade we're going out to wrap up so that will be the first full week of school you will be at candidates so I'm super excited to get that information out we had not just scale we've done some research too and talking to other conference schools as well as far as their policies uh at the other high schools across the the conference and things like that they can move to not allowing backpacks you know in the hallways in the classroom it's just a safer situation [Music] so students will be expected if they have a backpack or bed to put it in the locker and then take only what they need to class correct any other comments or discussion on the handbook I thought I said it will link two other minor changes I think um all right let's do one call Amy yes ⚗ AI-reconstructed · cite from original above
uh director Jesse did you want to say anything about that or uh same weekend how early does the Q Center do contracts for that kind of thing that you do is come to find it out we did not have a contract for next year already so what's prompt was and it remember I don't say in scramble mode but looking at venues that would work with the best interest of our school district we were able to secure Pinstripes for the next two years and then that gives us the ability to explore this Center and plan ahead and be a little more proactive than reactive if you will and the rest I forgot for Pinstripes was we did not want to land on a Friday night just to get something on Saturday to get students out earlier we didn't have half days we know how that would work they just wouldn't be attending so we tried to find something on a Saturday okay what is that is that is problem full access to the whole space or is there a special events as you can see in the contract I believe it will be the whole Space they're even giving us the contract yet because we're still working on that we're going to say we're proving that location just like I believe that would give us access to the bowling areas in different places within that venue okay that's awesome yeah sorry about that good catch any questions we did not get a motion or a second for that one oh sorry oh I said it though I just went right into Ted you want to talk yes yes a thief yes uh Hemphill yes Nolan yes a next emotion a second are required to discuss and approve the bid for concrete work for the high school edition so moved second so we went over these beds last month no these are these are new things came out uh this this month's they're coming to you and we talked about responsible bitter concrete bit was Ed Fogerty and you can see in your packet there actually were uh four different individuals who put in for the bid process thank you Dan uh we have Ed ferdy uh with many assists general contract and Eagle Concrete and Abby Paving but the lowest responsible bitter was at poverty so that is the recommendation that uh food moved forward with that bid so just to clarify we're doing it it's two two different bid packages for the Edition we wanted to get the earthwork the underground and concrete done first work through the permitting through Kane County get that situated get that started and then we'll have a bid package coming out probably next month for all the interior build out and the rest of it correct is this Ed Fogerty one that we've used consistently we haven't used them shells mcnuts very familiar with them and they're an excellent contract okay yep questions vote Yes a thief yes Hemphill yes Pappas yes Nolan yes a next emotion a second uh are required to discuss and approve the bid for excavation and site utility work for the high school edition same thing just part of that same preliminary bid package to get all that underground stuff done as soon as possible correct um yep oh yeah yeah they've done a lot of work in the district a thief yes and Phil yes Pappas yes vote Yes Nolan Dan you're up next yes sorry that's it for uh action items for information items director Polly will provide an update on construction and maintenance projects um so obviously that project's the the big one that we're working on trying to get out of the ground so to speak um working on the remodel that we're doing here on the other end of the building that's ongoing and we're attacked and that diligently to try to meet Dr magnet's deadline of ASAP we're trying to accommodate that um also in the process we've replaced a couple we've started a preliminary part of the HVAC updated Lilly Lake a couple classrooms there that had some equipment that's failed over the winter we wanted to make sure we adjust that so we added a couple rooftop units to address the knee over there and our staffs work in diligently to get buildings cleaned and waxed and Furniture taken care of we were lucky enough to get quite a few college and and high school seniors to work with us this year I think we're up to nine students working with us which is a great help most of them are working outside but we have some student painters in the high school which Mr podgorski has taken full advantage of um over there at the at the high school um and then we're gonna have it moving that crew down to Lilly Lake and working on getting some updates and some things done down at Lilly Lake and I think that's yep yeah we'll be working on yeah some flooring updates on the mobile units we're trying to be conservative but trying to make those you know nice spaces for those kids and staff so yeah update in some of the flooring and the mobile units and the dress and roof issues and stuff like that about the doors going into the classroom yep those are an ongoing maintenance item we've replaced an updated Hardware in a lot of those and yeah any other questions Dr manga no that's it free thank you next we have our Freedom of Information Act requests so we've had quite a few frame information access this month we've got five of them one is local Labs same one that consistently keeps sending us information unfortunately it comes from events SV which we are not sure exactly who they belong to so basically we say it's not from a secure email we have we asked them to submit with us a proper email we've yet to hear back from them so we continue to respond to them in that fashion uh second one is from Mr Davis uh looking for pension information as well as salary information benefit information for uh staff members that are IMF employees making less than 75 000 uh we denied that request due to it being unduly burdensome um it was just going to require us a lot of information we track over 75 but we don't generally track under 75 000 in terms of having a document to get to give out uh the third one was from Central Education Association cea looking for any and all contracts invoices and expenses related to the district's use of Embark and Otis we were able to comply with that request in part we were not able to give them all the contracts and those types of things so three years for the Embark and Otis so that was submitted to the cea um the fourth one again was Central Education Association looking for all invoices from our Law Firm regarding grievances on the internal substitution and course approvals again we were able to give it to them in part many of the things that we deal with from our legal opinion is not something that we can give we give out to other individuals is confidential so what we were able to give to them we were we did give to them otherwise the rest was redacted based on the foia laws that are established and the last one was NBC Chicago looking for judgment settlement agreements Insurance and financial costs for foia request challenges we've not had any foil foia request challenges in the last 10 years so we basically complied with saying we had no employer request challenges any questions that concludes our Open Session thank you all for coming have a wonderful night thanks guys [Music] and so move second yeah there you go we don't have Mandy it wasn't on my thing it wasn't your thing oh because Jeffrey just knows it is

Communications councilmember dish anything to report yes last night um both the 9.99 um Maiden Lane thank you is it Broadway is it where is it both that that project was the the conditional rezoning was approved and the site plan was approved and the annexation of the 11 Township Parcels to r1d was approved oh I'm sorry yes on first reading yeah I'm sorry and is there anything else that I'm forgetting nope that's it excellent mix Kelly anything to report yes and the interest of keeping the commission informed about the comprehensive plan process we want to let you know that the contract with our consultant team is executed and we've started to do initial data Gathering toward um a first phase which is typically an existing conditions uh to just gather GIS layers past plans other things along those same lines and additionally I wanted to foreshadow the content for these July 25th ordinance revisions committee meeting which will include a discussion of the commission work plan not to circumvent the consideration of the work plan by the entire body but just to revisit it to get a sense of priorities and also to understand which of the work plan items do fall under the realm of ordinance revisions to the to the name and to the point of the committee so we will be walking through that as a refresher to foreshadow bringing that again before the entire body and we will also be starting a discussion um which hopefully will be timely given your agenda this evening of drive-throughs uh getting advice on where the Planning Commission would like to see those if they would like to see them at all and walking through some other cities that have recently or in recent history approach this subject and how they've approached it if I could just jump in I want to I wanna point out two of those items for update the comprehensive plan and your work plan and I just want to uh I guess raise a flag that I think we need to be very careful in setting our expectations for our work plan over the coming year we're going to have a lot of work at this table and as staff and as a community going through the comprehensive plan process so I want to um I'm gonna I guess I just want to be clear that it's probably going to be a less perhaps aggressive work plan than years past while we are concurrently carrying on that comprehensive plan so I don't know what that means or how successful I'll be in reigning your desires in in that regard but I wanna I wanna um preface that thank you any other commissioner officers or committee Liaisons I can report that the ordinance revisions committee met on June 27th and discussed a number of things related to Transportation impact analysis requirements in standards um and that material will be coming to a work session near you soon I believe I'm actually forgetting now if it's coming back to orc before it comes to the to our position we agreed on some content to come to a regular session and there were some items that were larger picture that will have a longer discussion that are TBD okay yep great thanks for reminding me um any other officers or committee Liaisons okay uh and then there are a number of written Communications included in today's packet so we are at uh agenda item number six public comment uh so this is an opportunity for persons to speak for up to three minutes about an issue that is not wildfires have burned 25 million acres by far a record and we're still in mid-july floods and Pakistan killed 15.

here we go [Music] and the Pledge of Allegiance to the flag of the United States one nation under God Mr mcgibbon Mrs Ellen here Okay Google on the agenda that's an action item commentary okay Mrs lucky Burke yes Mrs Allen yes Mr mcgibbon Mr roster yes all right doesn't look like we have any um okay approve last month's I mean excuse me I'll make a motion to improve last month's minutes comments Mrs Lewis Bieber yes Mrs Mr mcgibbon was this Allen yes Mr ostrich with our esteem superintendent story Welcome to our first board meeting of the 23-20 course school year they're very proud and happy to say that we have an amazing team he's been working hard this summer to get prepared for an amazing school year so again our vision and mission statements are there in front of you our theme for the year is world of imagination and Mrs Cuevas was thinking of the Willy Wonka chocolate the golden tickets and the four golden ticket we've discussed are our plc's our a rating our A-Plus school and our work on our character building so we're super excited we're gonna focus our year-round world of imagination and the Bolton tickets that are going to get us to our A-Plus status that we are speaking enrollment update our current we currently have 572 kids with 31 pending whether it's pending paperwork or pending open enrollment preschool we have 26 students so a total of 598 with the pending students the total will be 632 and we ended basketball University student s were we would be two students shy of where we ended our kids are enrollment we have 58 students so that gives us class sizes of 15 students with four teachers with our three teachers who would be at 19 to 20 per class so again I want to thank our governing board and Mrs Cuevas persistence and we were kind of holding the line to see what our Kinder enrollments were going to look like because we knew we were going to need four first grade teachers but we went ahead and we didn't want to lose the good candidates that we had so we were able to secure that position so we'll be sitting nice in Kinder classes with 15 to 16 students and if anybody's ever taught kindergarten you know that's a that's a full load there without full-time assistance our first grade we have 60 64 teachers so when we talk about Continental having pride in trying to keep our numbers low I think it's critical and our primary classes especially to get the kids new students to Continental there's 27 brand new students coming this year who have either moved into our area or were open enrollment in Sahuarita and versus coming back to us in open enrollment we have 46 returning students seven on the wait list and one pending of the Open Enrollment kids we have 11 new students and three pending solo total of 50 Square the possibility and with the Open Enrollment students I did want to make the board aware that these returning students we have probably eight to ten students who I had courageous conversations with their parents in terms of attendance and tardies and behaviors of letting them know again that it's a privilege to be here and that we have a responsibility normal students who live in our laundries and we will be starting some of those students on attendance and charting contracts wait list they're the ones on the waitlist or no some of the ones that are ones that are named for the new students moving in prior to approving them um some of the ones that are returning are for that Basin as well so we're waiting for numbers okay we um also want to congratulate our team because we are completely staffed in our certified Realm so it's the first time I think in a while that we're sitting here at this meeting not having to specially waterproof certified staff on the first date or once school gets started um we have classified support staff still to hire we have field three parapro Physicians and four bus driver positions but we still have the following vacancies we need two preschool instructional aids for the after-school careful care programs one playground Monitor and four plus Strikers three to have resigned over the summer and I do have some slides specific to Transportation coming up we will continue to advertise interview and try to fill the current positions prior to the first day of school and as we mentioned we if need be will have a special board meeting Wednesday August 2nd before the breakfast to improve these visit special education again we currently have 84 preschool to eighth grade students enrolled to receive special education services three teachers including a new K2 and middle school teacher that we're very excited also for our new sped staff that's going to be joining us 13 programmatic assistants afterward approval and to support our kids students and we will work towards continuing to build a strong Special Education team to focus on strategies for Behavior Support inclusive practices and understanding disabilities so thank you Miss lettuce for all your work and Justina in HR and getting these positions filled and people Transportation update upward update Mr Nate has worked hard on the new platform that's in place and it's made positive and effective changes within the department buses started hearing maintenance services the week of July 17th and 28th and we'll be ready for day one Staffing we're going to start the school year four drive her short we lost three drivers over the summer to higher compensation at neighboring districts whether it is or Sunnyside but we really know that that's you know we can't afford to pay what you thought and so I decided in the larger districts are paying um without having it affect other people who need phrases as well so we're kind of in a little laundry there having to be creative we do have a plan and in place to be able to still bus all of our students and we will still be able to bless the high school students because we are also applying introducing the revenue so everything will be covered with creative relics and teamwork so this little thing for that and we have a special congratulations to Mr name he completed his bachelor's degree in business management through Grand Canyon University graduating [Applause] two percent College until graduates who will come on commencement in October October 19th his final business project was on the national school bus driver shortage so short from winning the lottery and being able to put money in to hire drivers Steve who are waiting to hear what other creative ideas you have and you will be starting his master's program in January 2024 so Stephen I just want to personally congratulate you for your hard work and your make nights and I know even when you were on the DC trip and helping us shop our own students you have homework and deadline you persevered and we're very proud of you thank you full facilities board projects you'll see there they're well on their way and you can see the estimations for completion of the weatherization project you can see our totals there so we're very excited that we are going to get this work completed and off the ground and we're in the process of getting bids these projects completed sooner than later AZ cyber security initiative so thanks to Mr Ferguson we've moved into the implementation phase of our veils multi-factor authentic authentication program and you'll see everybody with these cool little uh what are they called dongles dongles that gives you a number that you have to log into it reminded me of like your can you check your blood sugar something but we have these little dongles so um now we'll have a second layer of security when logging in so he's going to be working with the teachers one-on-one getting them um when using passwords so in addition we begin to implement the anti-fishing testing and training First Step as well and it's a threesome is offered by the trust so we're constantly working on improving our ability to recognize and avoid the efficient intense Grant approvals super excited Ada approved our character Ed matching Grant at 22 466 dollars for one year and we can resubmit for additional funds for year two the current foundation for leader in Maine has awarded Continental a total of 32 500.

and um I'd like to call to order the Border Health meeting for July 18th um this is being um by Zoom uh the first thing on the agenda is um citizen participation do I have anybody um I yeah do I have anybody that's interested in citizen participation but Bajaj you want to go first go ahead Mark go ahead Mark okay um thank you good evening Dr Sony to the Board of Health I have one question I want and I want all the board members to answer if they can or should they should answer I asked a couple boys all right what's the goal of the Board of Health or the town to look for in this group Mark I I didn't understand your question what's the goal what is this board supposed to be seeing from this group and what's the positive goals coming out of it I mean I'll start off I mean you know we're a pretty active board um especially under raja's guidance as our health director um you know where we have vaccine clinics we you know Raj is going to talk tonight about some other issues in town we have food inspections um um sewer and septic inspections that Raj does um quite a bit uh we talked um Rogers is also going to be talking tonight about mosquito spraying I mean it's pretty anything public health related um falls under the boardy and Raj and Raj I don't want to add anything there yeah that's that's the best thing that's the boilerplate eight issues things each member who gets them gets to the board they should have that they should have their own goals and why they are there and they should be able to speak out to the public the show to hear what their goals are as a member not just the issues of town but as themselves what they got put forth yeah I can take a crack at that Mark too so so personally I want to help the town um and given my background I thought that that would I would be uh probably a a better fit with the Board of Health than any other board and that is to to uh enforce the rules and rules and regulations related to um Human Health and Wellness um in the town as uh as Ed just mentioned and those were what I want to hear from other members yeah um I can um Mark I can also add um I'll Mira what um Ed and Jay said but also um just making sure that we're protecting you know the Public Public Health um like I said too like I'm Uno would like to see more done in the community which we are trying to do working with the community not you know like Disease Control and just promoting sanitary living conditions throughout or anybody else yeah can I can I add uh something to that so anyway um I'm Balaji I think I write to us uh uh from the citizen point of view but I'm also voluntary for the health board so what I want to add is like the Health Board concept is like you know health issues or like continuously evolving issue it is not something that like you know the standard policy that works forever so the board actually functions uh as a kind of a bridge between a continuously evolving policy as well as like uh you know trying to provide a very good a safe environment and sanitary conditions to the car Community there so that is the point of view like you know from the go uh the goal as you ask like the goal is like trying to bridge the evolving policies that is happening throughout the world are provided by the government and everything as well as at the same time the town may also come up with their own issues as well so it is kind of like trying to balance uh from both angle and provide a safe place this is the ultimate goal of the um the ultimate goal is uh something like that yeah Ron gave either one of you two um for myself I'll say that uh with my background in science as a uh as a chemist and experience in a couple of Industries um I figured that I was in a good position to help the town navigate some of the issues around chemical exposures in the environment specifically things like nianza and pfas so um that was one of the reasons the main reason that I volunteered Ron welcome back the original question mark I wasn't here what's your goal what's the goal for you as a member of the of the for the health at the town where we can see from you yeah just just to help the town out you know I wasn't supposed to be on the board this year but uh there was uh you know there were some extenuating circumstances and I told the board I wouldn't leave him hanging if they so I could help so that's all I've ever wanted to do I've lived here for you know a long time since 1996.

their foreign yes it's right around three million the money used to come to us and then we would just feed it back into Sarita now it goes directly to them and then we'll be getting reimbursed from and we'll probably go to about 1:00 same day as a reminder okay also I did send a board just a email basically stating a couple things that's going on in the community uh one was e not an equity but it was a leadership training out there that was initiated by a stakeholder in the community of Moni I thought it was just looking at it having a direct conversation with him I I thought it was a good opportunity for us to attend so does anybody plan on attending that I think it's August 3rd second and third second and third there you go I thought it was the third and fourth it's a second and third I believe it's a second and third all right I know I couldn't do it because I have an event on the fourth for my organization we we'll get clarity it's either second third third or fourth okay and I think it was like $99 I'm not sure if that is something that could be covered by our board training money that we have for each person if not we can find other ways if you so choose don't let that be a stumbling block for you not to attend okay and it's web based too it's web based if it's a second and third I could do it I just can't do it if it's the fourth okay and and the cost I'm not but about but the third you can't if it's just one day or whatever okay or the second or third I the fourth is the day I have a conflict so I was thinking when I was reading it for some reason I thought it was the fourth but okay I'll verify that for you verify that I I'll as soon as we get back to my office I can show then verify if it can be covered too by can be under under board training I plan on attending um VI web based so if you guys can attend please do so CU it sounds very good uh something that you know would add some definitely benefit to what we do here as leaders in this district and I plan to attend the Moni grand opening of The Pavilion on a week from Wednesday excellent excellent so we're trying to get out show our faces best we could you know I was able to attend a few different events throughout the community I don't want to get into all the details but if you can make it as I said in my email to you please show up and Cheryl you had sent me something if you don't mind I'll share with the rest of the board some other events that I didn't capture I didn't I didn't put it out until I talked to you okay I appreciate it so I'll send it out tonight time permits I did want to say I watched the um video that Mr gyo shared with all of us so I appreciated that thank you and then I did just ask the question if we have any type of parent lays on regardless of if they're bilingual or not and and I don't need the answer right now I know you guys are um looking for stuff but I was just thinking if we do we could marry the two until the need gets big enough to just have one that's bilingual yeah and I think uh we were going to have Miss Perkins look into that we are trying to determine what what are the needs are out there uh to investigate um the question great Alex thanks for sharing that with us too you're welcome okay any other updates the board okay administrative updates superintendent uh before we get started with what's on our agenda I wanted to just give a quick uh shout out here to some new members on our executive cabinet team we have Mr uh the Dr Eric meleno he is our assistant superintendent for personnel and culture he's here with us this evening and has been working with us since July one so thank you for there you remember uh Brian Johnson he's been in uh working with Ken alongside in the business department and our new member interim and then we'll be moving on to the assistant superintendent of Finance for next year do tra come no he's not a Trader he's I I was told he I was told we was getting a person that's going to save us like millions and millions of dollars this is this was him no welcome aboard can I do something for you know have to learn how to spell his name well either of their names he said we can call her call him Dr M I like we call her Dr K it took me a while to so we just shorten everyone's name around here yes welcome aboard thank you guys thank you welcome aboard joining the 201 you family welcome aboard go ahead doc so this evening I'm I'm really pleased that Mr holfield is here this evening he's going to uh be giving a presentation for the educator Rising students uh they were out in Orlando recently and we saw some pictures he sent those through and it sounds like a really exciting experience so uh Mr hfield do you want to present your team and tell us a little bit about the event first of all thank you for the opportunity to share to the board president vice president and Dr Cara and the entire cabinet uh I have exciting news we talked about two years ago about the need to fulfill a whole a gap in education and the need to grow our own teaching program the program launched with 18 students I am pleased and a proud principal to let you know we have 58 students going into next year that will be enrolled in Lewis University dual credit program with the inent to become teachers and the bulk of them would like to return to Creek mon School District 201u I think we ought to applaud these students say absolutely yes uh in addition we were able to grow uh the tutoring program for the summer just to give you a Capstone of that as a part of the tutoring program the students are compensated in addition to that they fulfill their workplace experience requirement and we are on target for next year to have students who will graduate with the education pathway endorsement attached to their high school diploma so that's also another commendable accomplishment that we have I want to take a backseat tonight because I want you to hear from the students and uh the parent that accompanied uh the students to Orlando for them to share with you before I move away uh I was honored at the ceremony this is a national recognition for a school leader Division I received the educate Educators Rising Champion award board in appreciation for my support and commitment to ensuring that the teaching profession outlives me so I'm appreciative for this and that the students were were in attendance because it's because of them that I'm motivated to push them to move forward at this [Applause] time at this time I want to introduce a couple of Scholars uh one Valeria Perez and then the next will be Casey Berkeley and then we'll have Miss hick Spears close us out her daughter is unable to be here tonight but she attended and her daughter has sent a little spill that she wants you all to hear sit back relax put your seat belts on and enjoy um hello my name is Valeria Perez and I competed in the category a Educators Rising moments when I decided to become a teacher um before I start I would like to also mention Miss Perkins who gave me the opportunity to work over the summer as part of the Educators Rising program working in over the summer in mon Elementary so can we please give her a round of [Applause] applause so no matter what school you go to you're going to get a teacher you like or dislike the funny thing about having a teacher you like is that they'll always surprise you one day I remember my first year of middle school I had a teacher she was strict but I liked her and one day during class she passed out a sheet of paper to all the students and asked them to write down what they wanted to be when they grew up I wrote down teacher and as she was skimming through all of the paper she noticed that someone wrote down teacher she then proceeded to ask the entire class wrote down teacher I raised my hand smiling from ear to ear saying me then in front of the whole class she told me don't become a teacher I was shocked by her response because why shouldn't I become a teacher I always thought it was because of a teacher's salary since I don't get pay much or so I was told but I never found a good reason so I just ignored it I I want to become a teacher because I believe children are the future teachers start kids start off as children and then grow up to be something completely different whether it's to become a teacher a policeman a firefighter or whatever they want to become teach children are also the future with many differences and what they want to become in life they grow up to be something completely different and of course there many skills that they grow up to have can also help us in the future and other jobs requires all the teachers I've ever had were kind to me helped me learn and made sure I felt safe those are the biggest teachers those are the biggest qualities of a teacher I like and want to have all the teachers I had were kind to me help me learn and make sure I felt safe helping kids learn and helping them get a good education means they can set goals for themselves find out what they want to achieve and of course what they want to be when they grow up funny thing your first teachers are your parents they teach you right from wrong and how to speak going to school you have your teacher who helps you learn and to help you out in the real world no one is perfect students have obstacles in their lives and hopefully your teachers will help you over will teach you how to overcome some of those obstacles my father got pulled out of elementary school to work in the fields but still graduate from high school I look up to him a lot since he went through so much and is still a great father he is my role model and someone who inspires me to be an even better person and hopefully I can give my future students that same encouragement to push them to be someone better and that they can accomplish anything if they set their minds to it any subject in school you may find boring but it can sometimes surprise you and you might even use it someday I know with my passion when I become a teacher I want to make a difference in my students lives and help them be successful in life thank you hello my name is Casey Berkeley and I had the privilege of of attending the national Educators Rising conference I competed in the children's literature K through3 category and my book is explore black history with Casey so I read the judges my book also at the conference we met with different scholarship um organizations such as the golden apple scholarship for Illinois which gives scholarship opportunities for students who want to be teachers in Illinois and come back to the school which I would love to have the opportunity to and the next one was the center for black black educator development which gives workshops and resource opportunities mentorship for student for black students who are aspiring to be Educators we also met with the national 2022 teacher of the year um he gave very inspiring words to us and most most importantly he told us to that every career starts with a teacher and to really pour into students lives and showed us the kind of teachers that we want to be we also had was attended the college fair it was really exciting to see all the colleges throughout the country and meet with them next was my book well I will read to you real course a short children's book explore black history with Casey written and Illustrated by Casey Berkeley a young Casey was talking with her mother about black history her mother suggested that they travel through the of the United States to visit black historical landmarks first they traveled within their home state El The Landmark was a safe house for the Underground Railroad slaves often traveled North for Freedom the safe house allowed slaves to rest before continuing their Journey next they drove to St Louis Missouri Casey and her family had a tour of the Old Courthouse this is where the historic Dread Scott F Freedom trial took place The Dread Scott case went all the way up to the Supreme Court where it was decided that black people were not Americans and did not have rights which was later overturned by the 14th Amendment then they drove to Memphis Tennessee Casey visited her na the national Civil Rights Museum at the Lorraine Motel this is also where Dr Martin Luther King was assassinated the exhibits Museum showed us a journey to civil rights in the middle passage which is how most African slaves were brought to America Next Casey visited Sunflower County Mississippi this is a cemetery where slaves were buried some included Casey's ancestors dating back to the early 1800s they took photos of the graves then Casey traveled to Atlanta Georgia they took a tour of the Ebenezer Baptist Church this is where Dr Reverend Martin Luther King preached his first sermon and where he was baptized also in Atlanta Georgia is Dr marlea King in K Scott king's tomb Casey thought about Dr King's fight for civil rights and paid her respects then they visited Charleston South Carolina they went to the old slave Mart Museum this is the first African-American Museum they spent their time reading stories from formerly enslaved people next was Greensboro North Carolina they visited the international civil rights Center inside were exhibits like the February 1st 1960 Sittin the greensbor S was the F was when four black students sat on all whites lunch counter and were not served because of the color of their skin so the black students sat at the counter and waited and protest protested silently this event was a hor a historic part of the Civil Rights Movement many people around the cth began to sit in and participate in nonviolent protests next was Hampton Virginia they took a tour of Hampton University which is a historic black University bucker T Washington was a student there then later became an educator and created schools in the South he also spoke with US presidents lastly Casey visited our nation's capital Washington DC Casey and her family went to the Frederick Douglas National Historic Site inside the Frederick Douglas National Historic Site you see items he used gifts from President Abraham Lincoln Casey Al took a tour of the home with her family next Frederick Douglas was a writer abolitionist and Was Born Into Slavery Douglas escaped slavery at the age of 20 and traveled to New York he later wrote a self-titled autobiography also in DC is Howard University which is another historically black University the first Supreme Court Justice th Good Marshall attended Howard University after weeks of traveling Casey went home she thought about what she learned the importance of black history in America and wrote about in her photo book which is also in inspired by true events and I edit some photos in the end thank [Applause] you hello everyone um my name is immani hick Spears and I am ala Spears's mom I'm going to read um something that she wrote and then I'll share my my experiences as well okay so she goes today I wanted to take a moment to express my heartfelt appreciation for the incredible experience we share together at the Educators Rising conference I want to share that I once spoke at the board meeting a moment ago and would like to say that this experience captivated my senses and ignited my already fueling passion for education I want to express my gratitude for the opportunity to learn and grow alongside my fellow R my fellow uh Rising Educators I appreciate how this experience pushed me beyond my comfort zone and allowed me to network with future Educators all ages from all over the country I am also grateful for the lessons I learned within the many breakout sessions held the sessions opened my eyes to different cultures perspectives and tunnels of Education I was able to engage in meing F small group discussions about the future of education and why this is a very important line of work the knowledge and wisdom gains will undoubtedly shape my future endeavors Endeavors I don't want to take up all of your time because I really could go on and on and in all caps on but I will hold my tongue because I feel you all get the point I should have reread this thank you so much for your time with profound appreciation and warmest regard she got that out of my email signature ala Spears so funny okay okay I'll proof read next time so um as you all can see she definitely the uh trip and in this whole entire experience because I know we're at the the end part where they competed at Nationals but this was like an entire process like from them actually um coming up with a concept that they wanted to write about in a book um figuring out what category their books were fall in um they actually had to you know write out their Pages they Illustrated their Pages them themselves um some of them at the conference though we saw was a little Fancy on the uh like they had it done professionally um but not only that so just going through that process of writing a book and editing and just you you know of course alela whined about it here and there cuz she had to rewrite you know keep going back over it um and then moving on to competing at the school level and then winning and then also competing at the state level at ISU and then winning again and then Landing um themselves at the Nationals of this year so that was all super exciting um but as a parent and educator myself um I was teacher and now I'm a case manager um and I'll be going into my uh my uh doctorial program hopefully January um but um just watching her go through this entire process has been so super impactful and so impressive um and my wallet thanks this board for actually being invested in this program because like uh Mr hollyfield said when she graduates next year she'll pretty much be done with I want to say like a semester of classes so that's going to save us money coming out of our pockets um by her already having these uh classes um completed um and then also too right we can preach education and the importance of Education all that we want to right but if we don't have the programming here already for them at this level right they shouldn't be waiting till college to be exposed to the field of education but if we don't capture them here then they not really invested right and I know a lot I I know you all feel the pressure too of what is the future of Education you know especially when a lot of people and including myself we've been told like oh no don't go into education you know you don't get paid look one of them I believe mentioned that you don't get paid well and oh you know it's a it's a a thankless job and all of that and so for them to actually be invested at this point in time and where their passion is clearly at a alltime high is where you want to actually you know uh make your investment because they I'm I can almost promise you they'll be back to the district you know so when we thinking of the future of education and and I think that is the most valuable way is growing your own is this investment that you all are making right now so thank you all for not only helping my wallet but also empowering the field of Education um so it will go on and live on forever so thank you all excellent as a final token we have brought back pins for all of the board members and we have a gift for Dr Cara and uh Miss Perkins that we will present on tomorrow thank you all for the time thank you [Applause] outstanding outstanding thank you hey Mr hfield are they are they thank you all Juniors or were some of them seniors that sop Juniors Andi wow excellent thank you excellent um do we have any any comments uh from the board any comments from the board Mr alfield thanks for all the hard work and the investment cuz it's it is amazing and we don't know where the future is at so I just wanted to tell you don't go into educate no joking No I um thank you for for um spearheading this and putting this together um thank you to the um parents who support it and I'm really proud of the students who are taking a challenge to go into um education it can be a thankless job but it can be a very rewarding job um and you don't always see the fruit the the seeds that you plant but you are planning seeds for the future I don't know how many times I've seen students that I just did not know if I ever got through to them and you see them years later and they say oh you did this you did that and I'm like really I didn't I didn't real you know no seriously but you it is a a a seed planning job and it can be very um beneficial um for you in fact one of my students does my taxes and you know so it it it does it is rewarding um but it you know it can seem thankless but it's not thankless anybody else well I would just like to say thank you as well uh do Mr hly hollyfield for your rigor for this initiative it's great it's outstanding it's outstanding growing these young Educators to be they already looking them as being Educators and thank you young lady for taking us through that Journey African-American history in such a short time and and the other young lady that says you know it's not about it's a passion there it starts right there and and also I would like to thank I I believe Mary you are in support here you're here in support that says a lot that says a lot okay and and the mom wow standing in the gap for your daughter and it starts at home and we're here as another stakeholder to grow our students to the dynamic and that's in our mission statement to be you know productive person in society and and you're talking about passion my my daughter is a teacher and she her and I was talking this past Saturday she got a promotion she the money is going to come okay don't worry about that the mone's going cup all right it's not all that bad so thank you again thank you thank you for all you guys do thank you all right doc back to you I think we're ready oh for business on to business we've got two um short items on here I've got Mr to be coming up the podium and sharing few things at last board meeting you just wanted a brief uh update on our life safety as well as uh security update so i' ask you to sh thank you Dr Kagan would these mics interfere with one another I got this one on speak into here that work um I need to work with Ken uh to familiarize myself with the status when he returns the last week of July um ideally we could provide a accurate update on the health life safety issues in the second meeting in August um as far as security I spoke with Mr Tobias and clear book bags will be Pro uh provided for all students districtwide an update on the Evolve detection system at the high school the grant has been completed we're awaiting award and approval and January is the implementation Target date provided that we can um provide training to all the people that are going to work with the evolved detection system regular safety meeting started in 2023 will continue this school year as schedul uh as regularly scheduled will so I got that information from Mr Tobias any any questions yeah I I just want to make sure I understand so our business manager assistant superintendent of business he's going to bring us back a more indepth update where we are with life safety then the next board meeting at the August uh August 8th meeting if if okay a regular or committee as a whole um at the regular meeting on the okay and we just applied for the security Grant but we would know for sure if we got it's not a certainty there yet right to is that what I hear you say to my understanding it's not certain it's not certain I think we would have an update um I believe in October um regarding the approval or the application process okay so I guess my question the furtherance of my questions are with the security so that is just dealing with the detectors right the grant for the detectors yes the Evol U are we looking to do any other things other than the detectors for the beginning of the year any procedures change or we feel good about starting the school year off the best we could we have done an enormous job last year with the uh institution of the district safety team meetings okay we had all of our uh building protocols that were put in this last year correct really I was yes good question good question any further questions comments now CC number 11 CCC Holdings this is for the addition okay okay all right no further questions or comments roll call please Madam Secretary okay um group is an i Mr swales I miss Zite sters I Mr alre I Mr gagos I Dr Hall I president Brown I motion carry any old business hearing none new business I have oh oh we had we had old business new new new we both have new business okay uh the the one that's the best the best looking person [Laughter] first I saw something this kind of comes under security but um more um Internet Security something to look into but I saw an article where the Minneapolis School District was U there's a ransomware attack on them and they held a hostage for a million dollars and his district decided not to pay it and then they released all his personal confidential information about staff and students and just something to look into you know what what protections were doing have we thought about it so this is PR something we have a solution that's talk about correct we are aware of U and there's actually a lot of it going on out there um our team has done a lot and you know our team has been going out and getting U additional uh certifications and credentials to up um their their knowledge base and so we have been working to um on efforts to secure that okay wow um my um new business I don't know if it's new business old business but we have a new scoreboard and I guess it's kind of been sitting for a while and the season is next month and I don't I would assume nobody knows how to operated it's not up what's the update on that if if you have if you don't I do not so I somebody raise their hand Jason do you have an update for us can't answer that or do you have a presentation no uh okay maybe when it's up in functional but it is being install schedule for installation is that next week Wednesday Keith um Julie is going to be coming out marking the ground near the scoreboard and then our own staff has went out and uh marked the irrigation lines uh for the additional pole that's needed for the installation great and then any update on the addition to the high school Jason do you want to address that sure um Keith you can chime in if you'd like um construction is going well um I've been in there a few times we've been working with the uh Architects and the contractor um currently working on Duck work and a lot of electrical um to be honest with you that's kind of where they're at in the construction phase Keith do you have anything to add no all masonary walls are up they drywalling uh it it looks good you know me the transformation within this past month is amazing there are still a couple long lead items which are going to be elect the larger electrical panels seem to be one of the only hold UPS you know we weed the rooftop units which we were really worried about those are up and but uh there are still some some Le time issues and like I said it's all on the electrical side uh they have the pans in but not the panels so once the panels come in they'll be able to set those and you wire all the wires will be pulled everything will be ready just just get them here okay so we had an initial date of completion to be ready for the fall of this year right and then we saw the delays come in and we pushed it back to the first of January right we were expecting the building to be completed in October which gave us PL plenty plenty of room um we decided to transition our students in January as a nice Breaking Point get it okay so those long lead items that we heard before about and this is pretty much a a bill bill has really been involved with the coolers the tower cooler chillers the chillers right are we good with that he said the Rooftop for our other projects not the high school but the ship dates are the last week of August and the first week of September for the other okay ship you know shipping from and then they they've changed those on us before that's that's what they'll tell you that what they'll put right are they been shipped from overseas I don't I don't know what the termination points are okay so that should not be a stumbling block or anything like that right and and with any of the other buildings we pretty good with Supply chains with the other buildings with material yeah you know floing was a a scare but we've got that pretty well wrapped up so yeah the lead time issues on the other seem like they're pretty good right now good okay good excellent good job all right any further topics on new business okay if not we do have a reason to go into close session and after Clos session we will not take any further action and we are going into close session for the appointment employment compensation discipline performance or dismissal of of specific employees pursuit to five Illinois compile statue 1202 C is and Charlie one I have a motion to go into close session move by now second second by Dr Hall any questions not roll call please Madam Secretary okay Mr swales I roup is an I Mr gagos I Mr alre I miss s stumbris i Dr Hall I president Brown I motion carry and to the public have a nice rest of your summer until

and uh you know to me the goal was really for us to have Raj direct us to what needs to be taken care of and then help him achieve his goals because he runs the day-to-day operations and knows the laws and knows how to enforce those laws so I've learned you know a ton from him in the last couple of years as as well as Laura because she's right under him and you know that's really the best way to do it so Raj is up to date on everything health related in the town he does an unbelievable job so if he says we need to address something he brings it to our attention it doesn't matter what it is it doesn't matter whether it's bacteria in you know in Ashland State Park or a hoarding case or you know anything else that's not going our way and then it's our job to to help him achieve his goal because that's what he does for work so I almost think it's a little bit backwards that you have people that are a little uneducated in the laws and then how they're specifically enforced which is what he knows so that's why I personally lead on Raj when I was chair I would make sure I asked him hey Roger you good with this exception or you know are they doing things the right way and he would you know he'd say yeah or no and mostly it was yes so I take my cues from him and I think that's what we all do thank you okay um Ed if you want you want to bring up your side of things well I mean you know one of the things I think which is really important which I've already done you know first of all you as you know I worked for the town for eight years um but I I love being on the Forefront of being able to react to what's happening in our community so we'll use covet as an example right I mean covet hit and you know the town manager no knows I'm a nurse and knows I can get things done and you know we we created the first covid like office in all of Metro West and we were the first town to be doing testing for our employees to make sure we could keep employees working um we were the first ones to get going with vaccines and joining I'm a collaborative you know things like that is why it's so important and into the town hall it members themselves brush it Laura you've got anything with simple goals and how things are going um Mr the Sony I can go whole day you know uh with public health from A to Z you know we'll have from every letter of the of the of the alphabet we there is something we do in public health you know so it's vast vast anything related to to the health of of the citizens of of Ashland that we're trying to address here you know so it goes a long list you know that we we are involved with everything that that Citizen's health is related to you know you're one of the hardest working ones there well thank you for that um I've been here almost nine years now and it's always different there's always something that I haven't encountered before and I really enjoy working with the public and it's it can be very rewarding and um it's very interesting and I'm enjoying working with Raj and the rest of the board so thanks for the question though and people who know me see me are calm into the town hall visit whatever again this is what I've been hoping to get for answers from other boards I asked the um the sustainability committee meeting the people of the same thing they gave you some answers and now this boys gave me great resulted answers or what the public should hear so thank you and that's all thank you Mark um so the next thing on the agenda everybody is the reorganization of the board I'd like to do a vote to table that to our next meeting um Ron um has not been able to get over to the town clerk's office yet to get sworn in and I think it's really important to not reorganize the board until we have uh um all the members at the meeting um yeah sorry um before you get into that I think that Balaji had a citizen participation participation question I mean it's not something like important or something I don't know if there's a time to ask I just wanted to know if there is a place website um like what are the things like like a completely covered under uh the Health Board like because I saw that the agenda there are multiple things coming out but I'm just trying to get a picture like how big is the umbrella for the Health Board and what are the activities that we covered well it's nothing important you couldn't tell me later on so nothing really Mr Balaji I'll brief you you know maybe tomorrow we can have a conversation you know yeah sure on the website we also have all of our regulations are posted on the website so that's always a good place to start all right uh anybody else before I will keep going all right um so can I get a motion to table um the reorg of the board yeah I'll make a motion to the table the reorganization of the Board of Health I will second it all in favor all right hi that's the next meeting um so the next thing on the agenda everybody is the housing cases uh Chestnut Place Apartments um dolbin management company um I'm gonna have Raj um give a quick update and I believe there are people there other people here from uh Dolby management yeah we got Nick Schmaltz Regional property manager and Mark Hughes the maintenance supervisor great okay uh Raj do you want to do a summary of this so we can move on with this uh yes Mr chair you know and we have a tenant uh Mr Rich you know who's from uh 14 join Drive number six you know so Mr chair you know what's what's been happening you know we have uh two Active cases you know at least two Active cases that one started March 30th 201 Drive Number Four and then one started in May 16th you know uh 14 joined up number six you know so my concerns was I was getting very little communication from from the management and I'm especially concerned with 14 join Drive number six uh when we got a call on this unit this was May 15 and the occupant mentioned that there is a severe roach activity and inspection was done same day uh we did find a Road and uh roach activity in the unit you know especially in the kitchen area uh in order to crack letter was sent next day since then you know I was in the unit yesterday I still have activity you know the problem is there is a immunocompromised child that lives on the property you know and it's been conveyed to the management uh I was out on June 21st to do an inspection and I've asked the manager her name is PJ to submit documents related to what was done and whatnot and I have not heard since from her you know I did another re-inspection uh last week you know uh that that was on the on the on the June 21st you know that we had activity I had inspection yesterday just to make sure I still find activity so this is almost we are talking three months you know and the the the documents are living with roach activity and when I went yesterday the ceiling has fallen there was an active leak in the kitchen you know that the management was addressing it but that's a separate issue but I'm very concerned with the activity you know there there's another person who reached out to us from the same building Unit Seven about the rose activity and when I was in the office in June 21st you know I happened to see one of the pest control report uh to my understanding multiple units in that building have activity to my to right now I want to ask the management of what they know how much units are out of their 206 units are infested or have activity and what they are doing about it you know and then my second question is on the dumpster you know this been going on for over two years this dumpster is very poorly managed you know and with my expertise and information you know this this roach activity is probably because of unsanitary conditions at the dumpster area that they didn't bother to address at all from past two years that I'm with the town and if if they want to start and I I'll come to the other issues you know that I have at the unit at the buildings okay so um so Jay do you have a question before I did I do um so I'm just looking at some notes Here Roger sit on the on June 21st um you requested the a report that the treatment had been done and I think you just said that you didn't get a report but you also um said that you asked for or it was suggested that the pest control company would give you a call did you not get a call no sir no communication either from the pest control or it was mentioned to me by the manager PJ that the pest control company will be in touch you know but no response from either management or or the pest control company past that you know yeah okay thanks you know and I I want to just ask a couple of questions too because I think it'll be easier for Nico um that can correct Nico is that no it's actually Nick but Nick okay um because I figured that way you can kind of address everything so from the letters that Raj sent you um it also looks like there's a problem in building 13.

no proposed changes to exterior of house located on this .85 acre parcel which is zoned r2b to family dwelling the second public hearing is for 2805 Burton Road and that will be for the Brighton Village site plan Amendment it is for Planning Commission approval it is a proposal to reduce the size of the indoor Gathering building by approximately 2 000 square feet adjust sidewalks and utility leads relocate barrier-free parking and make electric vehicle charging updates per the current edition of the unified development code on an eight Acre Site zoned r4b for multi-family residential thank you item 8 unfinished business so we have one item here uh 3945-3957 South State this is a continued public hearing for that site includes a site plan and special exception use a proposal to reduce the size of the existing building at 3949-3957 South State by 1384 square feet and add a drive-through Lane along the rear of the building the staff recommendation is approval so we'll begin with uh petitioner presentation followed by a staff presentation and then a public hearing good evening Brad Moore with Jay Bradley Moore Associates architects representing the owners who I have with me here today who will probably speak after me here's a aerial photograph of the place that you are discussing tonight it is at the extreme periphery of the city limits it is in an area predominated by vehicular use it is not in an area where there's any walkability there's no residential neighborhoods anywhere nearby people will come to and through this Corridor via Vehicles whether they're gas powered or electric and you can tell by the other businesses that are in this Corridor that that's the nature no one's walking to Costco certainly um we are asking to allow the owners to reconfigure the building at a substantial cost to add a drive-through which our leasing agent tells us is the one thing that they can do to change the history of the leasing efforts of the building as commissioner Juan Lee put it out this has been on the market for a long time but no takers and there would have been takers if a drive-through had been available the city does permit drive-throughs and this is critical to lots of different businesses whether they're pharmacies or financial institutions coffee shops many of them rely on the drive-through for a significant portion of their business if you want to click the next slide Matt we can look at the existing site which is comprised of two buildings there's a Jimmy Jimmy John's with the drive through on the western or front side of the building and then there is an unused building a shell of the building on the east side go ahead this is how the drive-through would be configured it would go along the north side of the building after removal of about 10 to 12 feet of the building go ahead this is just a diagram showing that we have plenty of room to stack cars in line waiting for a service at the window as I'm sure everybody knows cars nowadays even if they are gas powered seats operating when they're standing still um this will allow the stacking of the cars and exiting back out onto State Street go ahead this is the South elevation which remains basically unchanged on the side elevations you can see that the building is getting narrower getting skinnier but the length over the length of the building doesn't change and there's some existing photos of the building you can see on each end there's a there's a brick expansion Joiner control joint that's about where that removal would take place the rest of the site is going to remain largely unchanged it has permeable pavers one of the additions that will be part of this project is the addition of electric vehicle Chargers which there are none now so the city gains significant opportunity for charging electric vehicles I think Matt you can speak to the fact that there's we're proposing to put in more than is required um and I think that's everything other than the detailed civil engineering drawings that are there if anybody wants to review them but that's my presentation and I'll turn it over to uh Jack or Gary [Applause] good evening my name is Gary Schwartz uh 25971 Rain Street in Oak Park Michigan my family has been seeking approval from the city of Ann Arbor for a drive through for around two years we have been advised by our professional advisors that absent drive through this building will be almost impossible to lease we've applied out of necessity as you know this building has been unable to lease for five years when we started the process we were informed by the city that if you can get approval from the nearly dozen departments you can reasonably expect to have a drive-through a few departments made requests of us ignoring the fact that we already have site plan approval and asked that we make changes that simply have nothing to do with the drive-through we even agreed to place as Brad said new EV charges on our site we worked out the requests one by one to satisfy the city it was not easy it was not cheap it took us two years and cost us around forty thousand dollars in professional fees there are a few items I would like to note that may not have been discussed one the property is set far back from the street so it will not interfere with State Street whatsoever second we are asking for more than a 20 reduction in the footprint of the building in theory this will likely result in less traffic at the intersection than already approved under our current site plan as far as environmental concerns we are not a destination location the traffic to our site will be from the nearly 40 to 50 000 cars that go past the property every single day we are kitty corner to an airport whose environmental impact far outweighs any minimal effect our proposed drive-through could possibly have I drive an electric car every day more and more cars are electric many new cars have automatic shutoffs when they're stopped most importantly I'd like to note a few facts we are not near any residential neighborhoods this is exclusively a commercial area our proposed use is compatible with the surrounding properties and the current zoning a Costco is less than a quarter of a mile away from us which was approved by the city a few years ago the average Costco has 500 customers an hour the Ann Arbor Costco is more than average then I filled at my wife's car this past Sunday at a Costco at 9 00 A.M before the store even opened it was an hour before the store opened there were 40 cars in line um trying to fill up I cannot predict the future for our location but our location may not have may may have less than 40 cards even in a given day we don't know what it's going to be but we're not going to have 40 cars there at one point in time like Costco finally the city has been approving hotels right next to our property unlike our location the hotels are destination locations these properties are bringing new cars to the area that would not otherwise be there these properties are bringing new exhausts to the area which our property will not we relied on the city's representation that if we went through the two years of hurdles and satisfied each City department at Great expense to us we could reasonably expect approval from the city the Ann Arbor law allies for drive-throughs we really do not want to board up this building if the commission does not want to grant us approval I would ask the commission tell us what we can do what we can provide at the site to receive approval simply tell us what else would you like us to do thank you um so now we'll move to the staff presentation Mr Kowalski oh I'm sorry I didn't realize they had to hit me to wake me up I'm sorry I'm Jim Chacon as I run the collagers commercial real estate company in Ann Arbor I've been doing it for 35 years we're working on this site for many years with the owners trying to get anybody in there it's kind of a hidden sight back in there so we've tried office we don't have enough parking plus our office business right now is kind of in the tank so we've tried retail it's just it's just we've tried everything lower the price incentives build out whatever we can do so it's just a vacant building down there we think a drive-through would be great you see the Tim Hortons next door does well it doesn't create a lot of backup traffic plus we can stack more cars than any other ones down there so I think the best use is kind of a retail drive-through and I don't see any traffic problems because we can stack enough I know what some of the drive-throughs help they stack into the street but we have more cars so we can try and watch that one thank you thank you hi good evening my name is Jack Schwartz 4779 Collins Avenue Miami Schwartz's brother and I we want to thank you for the opportunity to to speak to the Planning Commission my father started this company 50 years ago my brother and I joined this company 35 years ago we are both proud graduates of the University of Michigan we're a small family-owned business and have been developing property in Ann Arbor for the past 30 years we are very pleased and have loved being a part of the Ann Arbor landscape we have worked with the Ann Arbor building department for all these years and take great pride in following the rules and regulations and the guidance that the Departments give us we approached the building department approximately two years ago to convert our vacant building into a drive-through we have no choice we have no choice we have worked through this with all the various billing departments to meet their requests and have successfully done so and received approval from every single Department to convert our building to a drive-through it's been a very labor-intensive undertaking many hours much cost as Gary mentioned our building has been vacant for five years this is going to be a reduction in the size of our building and it's going to be at Great cost to us but due to the high automobile traffic of this area it is our only viable option the building is located in close proximity to two new hotels and the third large hotel is going to be next to us and is in planning we are kitty corner to the city of Ann Arbor Airport [Music] is that me okay anyways there's no residential areas guys and we we really just want to do what we can do we're happy to work with the city there's garbage being dumped there's cars being left we're having vandalism problems so they can building okay thank you okay thank you guys thank you guys now we'll move to staff presentation Mr Kowalski okay good evening everybody um again just okay I think we're good is it my time up yeah okay um okay that was easy okay well assuming I asked you to be efficient that's the maximum efficiency right there but assuming you might want to hear a little bit more I'll go on um if you guys remember this was a proposal that was before most of you were probably here back in early June um we had a couple less members at that time so uh what's before you today as mentioned again is a special exception use as well as a landscape modification so there's two motions that are on your staff report that would both need to be voted on um I won't go through a lot of the details because you've already seen them through the petitioner's presentation um regarding obviously what's the modif the amount of modifications that are being done to the existing building um there's a slight reduction of parking spaces overall on the site about three less um as one of the applicants mentioned they are adding EV parking uh two more EV ready spaces that are required by yeah EV ready spaces that are required by code um and again so as part of the special exception use I did want to read through some of the special exception use standards briefly these are the these are also in the staff report of course um but just to re-highlight them for a planet commission as well as anybody in the audience and listening online um so through special exception use there's a series of criteria that um you have to address basically to Grant the special exception use um first one will be consistent with the general objectives of the city master plan again a staff's opinion the master plan land resettlement recommends commercial for the site well actually that's not Steph's opinion that's fact um the second criteria will be designed constructed operated and maintained in a manner that is compatible with the existing and planned character of the general vicinity again we look at the surrounding land uses of what uh immediately adjacent as well as in the State Street corridor um we'll be consistent with the general character of the neighborhood considering the population density design scale and bulk and the intensity and character of the activity um again if you look at the surrounding uses around there it's a pretty high intensity vehicle-oriented area again with obviously it's been mentioned no residential uses directly adjacent to this uh use will not be detrimental to the use peaceful enjoyment economic value or development of neighboring property or the neighborhood area in general um again the drive-throughs you know it's kind of hidden behind the building uh the building itself is set back from the street significantly uh it will not have a detrimental effect on that natural environment um the replacing a building with actually with pervious pavers so uh again that that although there is a slight overall increase in impervious surface on the site um stormwater detention system is uh we'll be able to handle that there's the modifications that are needed um are very minor and again with the addition of the porous pavers that are used throughout the site that is something that has been working on the site um because in the past we've had some concerns on that but it does appear to be working on the site so they're going to continue using those uh so that would have some impact again to the natural environment uh we're looking at again so it's what's before you regarding the landscape modification is that the code requires obviously Street trees to be uh placed within the right-of-way to count as tree trees um these trees are already in there they are in there as part of the previous uh proof site plan but code does require because the whole site is brought up to code right now because this is all one site so we as planning staff look at it as one site um so the code would again kick those Street tree requirement in there but it used to be a variance now it's a landscape modification so again that is supported by staff the the right-of-way is extremely narrow there between the curb and sidewalk there's utilities it's it's just impossible to put them in that area but again that's a separate motion that you need to approve uh one of the questions from follow-up uh last we had some concerns regarding the uh traffic of course and transportation I did follow up with the transportation engineer that reviewed this um she the study overall that they were required to contribute did it did not have the traffic concept the intersections within the roundabout um that was a question that was asked last time uh I asked to follow up on that that she just didn't those were not required by the trip generation here so it's not something that she would have um uh and that's something she felt was necessary for analyzing this her concerns uh regarding this were um initially just some of the pedestrian traffic that goes from if they're for whatever there may be from the sidewalk there is a and maybe I'm showing on some of the photos there is a delineated walkway that goes from the public sidewalk back well it goes past the Jimmy Johnson back to the building um they're going to also enhance the striping along that and that's really what um high intensity reflective striping is what the transportation engineer suggested just so again it minimizes any potential for conflict with the two driveways exiting in that area but um asking again through traffic generation uh one of the reasons that again she didn't request a more robust or require more robust traffic studies because she did not feel it was going to be a destination it was going to uh kind of just pull off the existing traffic in that general area um so we covered the Motions I think that it dresses and uh planning staff is recommending approval of the landscape modification as well as the special exception use and I believe I covered everything I have highlighted so I think that does conclude my report I didn't even need to be buzzed out thank you very much we'll move now to the public hearing so this is an opportunity for persons to speak for up to three minutes about the proposed um petition item will first call on individuals present to address the commission then remote participants to speak during this public hearing remotely pressed star nine of listening my phone or use the raised hand feature if viewing through the web link for phone access call 877-853-5247 enter meeting ID 977-6634-1226 City staff will select callers who have raised their hand using the last three digits of their phone number or by name if available for those accessing through the web link you'll hear an automated announcement that the host is allowing you to speak when speaking please move to a quiet area and mute television or background sounds so we may hear you clearly for either method of participation please state your name and address at the beginning of your comments is there anyone present that would like to speak at this time during this public hearing no we provide an extended time for the petitioner during the 10 minutes this would be for other commenters on it but during discussion though if we have questions then we can discuss thank you is there anyone else present who would like to speak at the time at this time thank you Garber again um first of all this special exception use is not a big deal tiny project um I spoke against it in June but if you approve it tonight that's fine it fits most of the UDC um criteria for approval with the exception in my opinion of 529 d1c they had a quote will not have a detrimental effect on the natural environment end quote I disagree with Mr Kowalski on this I think that adding pavement specifically for a drive-through will increase vehicle emissions from vehicle idling um Mr Moore is correct we many new cars do have stop start ignition systems but many people disable them or buy vehicles without them and there's a lot of older vehicles also um but I have to admit right now drive throughs are all the rage for restaurants Banks some retailers I live near a Starbucks that just remodeled to accommodate more drive-through customers Panera recently vacated its buildings on both Plymouth and Jackson roads in order to build new nearby Paneras with drive-throughs after you deny the U of M Credit Union seu in April which was the right call I spoke to Credit Union president Tiffany Ford who told me that something like 40 percent of customers of the Credit Union's Jackson Road branch do use the drive-through there in fact back when I drove a car I used that drive through my ATM several times myself um people hate to get out of their vehicles so yes drive-through approval will help the petitioner lease their building and get a better Roi so go ahead and vote Yes it's okay but consider this the city has twice rezoned this property and petitioned a request first in 2003 from research to office to enable more possible uses and then again in 2013 from office to C3 to accommodate their site plan they chose to build speculative retail on a sliver of property that has no visibility from State Street and next to no visibility and zero access from Ellsworth why did they do this on the Schwartz's can tell you if you're interested I'd be interested um but uh the question here tonight is should we should you help them out yet again um I suppose if you decide the seu proposal substantially meets UDC criteria if so I personally won't lose any sleep on nor should you but it's incredibly depressing to know that people are getting more and more wedded to their vehicles you can't really call them cars because they're mostly SUVs instead of less which is what we need is which is what the climate needs I don't know what to do about this frankly but Banning new drive-throughs in Ann Arbor as Minneapolis did would be one small step thank you is there anyone that would like to address the commission remotely there are no hands raised at this time thank you currently the proposed motions are it's proposed to take the proposed motions together is there anybody who would like to discuss that or be in favor of taking them separately okay so we're going to take the Motions together I'll read them now the first motion reads the Ann Arbor City Planning Commission after hearing all interested persons and reviewing all relevant information finds the petition to substantially meet the standards in chapter 55 unified development code section 5.29.5 special exceptions approves the 3949-3957 South State Street special exception use 3945-3957 South State Street for a drive-through facility this approval is based on the following findings it will be consistent with the general objectives of the city comprehensive plan of commercial uses in the area and the proposed use will not adversely impact traffic pedestrians bicyclists circulation or Road intersections based on the location the proposed use is consistent with other surrounding uses and traffic traffic impact am I seeing a typo sorry no okay um oh uses apostrophe traffic impact pardon me the second motion reads the Ann Arbor City Planning Commission hereby approves the 3949-3957 South State Street site plan at 3945-3957 South State Street including a landscape modification that allows existing trees just outside the right-of-way to be counted as required Street trees uh commute by commissioner Mills seconded by commissioner Lee we are now in discussion is there anybody who'd like to begin discussion of this motion these motions commissioner Hammerschmidt thank you I know we have feelings about drive-throughs at this table um I don't really have those feelings about drive-throughs I I will say I I mean hopefully you know Mr Moore mentioned it's not really a walkable area it's not pedestrian friendly very true hopefully eventually this area will be more walkable however I mean I think for me just hearing everything that we've heard tonight seeing where this is located I wouldn't want to see the building boarded up I wouldn't want to see it demolished to rebuild anything new that that's definitely not sustainable um it's been five years that you've been I'm assuming actively trying to lease this I'm I'm fine with this um and I will support this I do have a question though and I don't know who whose purview this would be under but would you consider if it's the petitioner allowing bikes to go through the drive-through because I feel like there are a lot of drive-throughs that you can't do that I don't know if that's a city thing I don't know oftentimes it's a condition of the underwriter of the insurance of the tenant because they have to insure that property and they and so if you find an underwriter that will do that that's fine but many won't because they don't want a bicyclist between two vehicles and someone's scrunching them yeah so it's really an insurance underwriting issue okay [Applause] well the answer is yes okay underwrite that apparently I'm just I'm just trying to think forward you know like and as more people die because the city gets more bike Lanes like depending on what what Lisa's here if it's something that you might want to ride a bike to being able to just like you know pick up a prescription at a pharmacy drive-through window could be you know without having to park your bike and lock your bike um might be something people want to do I don't know um okay well I'm sorry that it took you two years to get through approvals but I'm I'm supportive of this so I hope that something useful to the community will lease the space for you largely with what commissioner hammerschman had has to say I think oftentimes the scrutiny that I that I really pick up on for drive-throughs is the impact that it would have on pedestrian safety and where this is it's very unlikely to have that there would be queuing kind of at the at the sidewalk or that it would impact that at all senses place for drive-throughs within our city boundaries this is it um and I know similar could commissioner I'm curious what other people have to say I mean and I think that this is I'm glad that we are um contemplating again kind of our status on drive-throughs I would also add I think that a vacant building is not um a great neighbor and we have approved a number of hotels nearby and being able to walk um from the hotel to a place to dine um and well my children in the back will know that Mommy doesn't like Jimmy John's necessarily having another option um uh I I think that that would I think that that is a benefit um uh to the surrounding uses so um I uh I think that this is something that I'm able to support as well so anyone else who'd like to speak commissioner Lee uh sure um taking a look at this literally um again under the UDC is it consistent with the general objectives with the city master plan or comprehensive plan yes design constructed operated in a manner compatible with the existing and planned character of the general vincidity I believe so um again Belle Tire Quick Lube Zippy's Auto Wash Speedway um I took it the kind of uses here and it is consistent with that character uh this is Zone C3 Fringe commercial District um it does indicate very specifically here there's little interdependence of activities establishment can be a disturbed dispersed over considerable areas um good automotable accessibility is essential to the districts so um the use is permitted because of their lack of intense pedestrian activity the required contact with auto access would be incompatible in the downtown area I do think that it substantially meets the UDC prescribed special exception use will also be in support of this and then can just contextually speaking for those listening let's just I was running some very rough math here they are voluntarily saying that they're going to reduce their building by about 1500 square feet so if we have 15 triple net per square foot let's just look at it that way and they use an eight and a half percent cap rate they're literally saying I'm going to reduce the value of my building by three hundred thousand dollars so that that's basically saying I will I don't think this is going to lease for the next three years of rent um just from a valuation standpoint so this is not an easy decision for anybody to make so I did just want to kind of reiterate from a financial standpoint um this is because this is kind of a necessity given that it fits the UDC criteria both literally and contextually um yeah I will be in support of this thank you commissioner I was reviewing our notes from the last time this came up even though we didn't fully and exhaustively discuss it and um it is just simply a fact that approving this drive-through will not or well not approving this drive through will not make this a walkable area of town and it is not desirable to have a boarded up building if we if Ann Arbor wants to ban drive-throughs Ann Arbor should ban them but so long as they are in seu that suggests that there are contexts in which we think that they are not they do not pose a significant problem and those contexts are like this one contexts where there there will be very little conflict point with pedestrians so I think to be consistent with the way we currently treat drive-throughs which is that sometimes they are okay and other times they are not this would be the one that where it is which is what you said already commissioner Mills so I will stop talking any other comments okay I think we're ready to take a vote on the two motions taken together for 39.45 to 39 57 South State Street commissioner Abrams yes commissioner Hammerschmidt yes councilmember dish yes commissioner Lee yes commissioner Clark yes commissioner Mills yes commissioner Weiss yes those motions carry all right thank you thank you we'll move now to agenda item number nine regular business the Mosley Street vacation thank you I know a different I just want to say thank you we appreciate it and we'll work very closely with what the city's uh best interests are thank you thank you guys thank you uh the petition East Mosley Street vacation addressed 202 and 214 East Madison this is a staff initiated proposal to vacate one block of East Mosley Street between the Ann Arbor railroad tracks and South Fifth Avenue the road exists only on paper and bisects the parcels at 202 and 214 East Madison Street meaning it has not was never built or constructed the stop recommendation is approval and since this is a staff initiated proposal will move directly to staff presentation Mr Leonard I will be less successful city planner Jill Thatcher this evening whose petition this is but uh thank you for the introduction this is as indicated a proposed Street vacation my apologies there are a couple references in the staff report to an alley vacation it is a street the process is the same this is the first incident so I'm going to highlight the second the second instance of me getting caught in cupping and pasting previous step performance but this site uh is uh has was originally planted as a street as you can see from uh it is following my cursor mostly Street has was planted and improved for the portion and running a west from the railroad line to Main Street it was planted for the portion running East from the railroad tracks to fifth however it was never constructed you can see here from 1947 it was already being used as part of the lumberyard unsurprisingly that continued until 1979.

um so it looks like Building 13 and 14 are issues um not only um infestation but um smoke detectors other things that were addressed in the report um when I spoke with Raj when we were building this agenda um you know just so you know I mean one of I think the biggest concerns for us as a board and the town is the lack of communication back from the management company on what they're doing um and that's what's caused you to have to be at this meeting tonight because there listen two-way communication right is is going to solve have a lot of our issues but there's no communication back to Raj so the frustration level is kind of building because he's getting calls from the residents and you know what can he say I'm sending them letters I'm you know there's just he has nothing to go back with the residents with okay so and if we start with the communication um uh Raj going forward I'm happy for you to copy me on anything that you send to this property so that I can make sure that it's being communicating back to you um I was unaware that you know if PJ hadn't gotten back to you I was unaware of that or if you'd asked for the test company to get back with you um I was gonna wear that too so I can make sure that those things happen um I did talk to PJ before this call she has a special needs child so could not be on this call but um uh but certainly we could arrange some other uh time that probably she could be available but um she mentioned that the pest company would be happy to get on an on a call like this or a meeting and discuss what they're doing for this property there's definitely um you know we took over this property a year and a half almost two years ago so um you know there's been a a pest problem and so we're doing our best to try to to deal with it we did recently actually two times over the course of our term here we've um uh treated the whole property we did it once um you remember when that was we did it we did it in 22 the beginning of the year we just did it two other times we just did it twice double treatment basically and then we're seeing some positive results from that for sure um but it does take time um if if I were to address um the dumpsters a constant issue here uh just with um uh what residents will throw in there versus and and on top of that what we're getting a lot of illegal dumping um so we have we have companies come here every week to remove you know whether it's a mattress or a couch or that type of thing our guys are at that dumpster every morning trying to clean it up uh based on what they find there um and so it's a constant issue one of the things we're going to do is is um get a camera up there so we can try to you know catch who's ever doing this stuff and and either hold residents responsible or if it's outside sources hold them responsible and try to try to um uh diminish how much of this is is going on but we will continue to um try to stay on top of the cleanliness of it I will say Russia some of the pictures that you sent uh of the dumpsters themselves are those because the doors were open on the dumpsters is that was that part of that that is correct you know so that don't need to be closed all the time you know because that that's how we control rodents or anything going into the dumpster but I mean to my experience with dolphin and if you're seeing your guys go there every morning I have never seen those doors closed you know they're always wide open you know and that's one of the reason that we are here for there's so much infestation earlier with the mice and now with the roaches it's just the unsanitary conditions you know well can I say something on that and add you you've been a police officer in this town for what eight ten years okay we've had an issue with this long ago and anytime that we've had an issue we've taken care of it we've cleaned it up and we've done what we need to when back when Chrisley one of the managers was here I had asked you if you could help us out with other residents from the surrounding neighborhoods and towns if we get information on that to you to send a letter to these people to tell them to stop illegally dumping and I I get told yes police officers up here at night doing details we've done you know other than the cameras and we're trying to look into that now sure how how often um how often is your Waste Management Company picking up is it every week once a week huh every week no is it just once a week once a week yes is there a way maybe for the time being we could you could potentially up that to twice a week maybe that just might help um the amount of weight that we are disposing here in trash is 25 tons a month and that's not including the um the both area and we have people constantly coming up here dumping furniture and you know there's only so much that we can do right now we're filming it all though no yeah so it's not it's not overflowing so it's not really it okay yeah um so you know just so you know I'm no longer with the Ashland Police Department I'm with another department now um but I would I I'm gonna highly recommend um if um you could reach out to the new Chief Kara Rossi um and see if um she's willing she could put an email out to the department for them to actually do some extra patrols and work with them to potentially charge people with the illegal dumping but when I brought that up in in different cases here I get told that this was private property that it's a subtle matter between the property and whoever's doing it and you know this is what I'm getting I've been here for eight years and I've done I've dealt with quite a bit here with the trash I've gone over there on Monday mornings one of those five feet high all the way to the where the recycle one is I'm gonna look up what I'll do um um Nick is I'll I'll get your email from Raj um I'm gonna go through the law and I'll I'll highlight how where you guys can use some of Mass General law to help you out a little bit okay that'd be great I just want to comment on this uh Mr Mark's comment you know if you have it if you if you're okay with it uh right now you know we I'm not talking about illegal dumping I'm just talking about unsanitary conditions at the dumpsters they are basically two very different things and the management need to take responsibility to address that you know illegal dumping is one side uncleanness is very different thing so when I went there and Mr Mark was present on June 21st then I had a meeting with PJ I saw what a stagnant you know in in staff behind the dumpster there's stuff under the dumpster dumpster doors are open you know and when I went this Friday past Friday the conditions were same at that time I copied Mr Nick thinking copying higher management will help but nothing I went there yesterday at 3 P.M same conditions these are my concerns you know the dumpster in in staff from two months we are right in middle of mosquito Seasons they can be West Nile cases here Triple E I'm very concerned you know and they need to take responsibility not coming up with excuses you know to address that you know so I'm very strongly hire a company to come out you have to let me speak you know I you cannot just you you'll get your time to speak let me speak you know because this this is not today's issue this is the citation that I should I issued yesterday was the fourth or fifth citation I have given to the company you know and this will be going for two years and today they took all the time to send me emails about all other you know properties in Ashland you have to you have to solve your own problems you know you you should not be sending me pictures that hey this is happening at Ashland Commons I just got emails from the management from all other properties in in Ashland that this is happening at the sixth another place is two it might be but you have to solve your own problems I am not looking for what happening at other places you have a very severe approach issues in your units you know you should not be sending me proper property pictures from other properties in town that hey are you are you trying to compete with them on on unsanitary conditions appointed seeing those emails can I respond to them happening at other places in the town as well yeah can I respond to that though because because my staff has felt for a while that they're being targeted by you and that you have certain some sort of sort of a vendetta or some that they're being attacked by you and so I wanted to look at well what are other properties in Ashland look like and that's why we went and took those pictures and that matters to us because if they're doing exactly the same thing I want to make sure that they're being held responsible as well that's that's the point they are you know there's you can ask for me you know you can submit a public record request of where the cases are your your property have the maximum cases I have right now right but my point is don't look for excuses I'm not looking for that I am just looking that you provide sanitary conditions for the residents because okay I'm getting maximum calls from your units you know that that's that's all I'm trying to say here you know but did you ask so you also see the pictures we sent after cleaning up today so there's a lot of poison ivy around that place so we had to schedule it we scheduled hey I knew we were having this meeting obviously I want it cleaned up by then and we did clean it up by then I want you can recognize at least that we did did that right yesterday at 3 P.M there was nothing done you know yeah I just sent you I sent you pictures at the same time tonight showing the current conditions off that floor sorry I said you could probably eat off the floor right now not that it should have to be that clean but I mean great you know hopefully you keep it like that and bring bring this under control my my second question to you is you know now the kid who's immunocompromised do we deserve to be in a unit with roach infestation for three months do you have any answer for that no I do when we put out notices for Pest Control to go in and we tell residents they cannot be in the unit for three hours it's how is it our responsibility to make this kid leave when it's sick that should be up to his father or himself or someone to take him out of the apartment for three hours in the apartment that you're talking about there is a lot of animals exotic animals fish tanks and the roaches are attracted to moisture there's tanks in that apartment almost in on every wall and we do swear we spray it and we do tell them and we even move the the pest control um they for him on a we went from a Monday to a Friday for him so we're accommodating everything that he needs and why there is still activity there after three months you know that that's my question you know I saw activity there yesterday yeah part of the problem is that he's not preparing for these treatments okay this cabinets are empty but he's got all that moisture in there with all those pets and like um I I've been told that when they spray it's going to get worse before it gets better and it is I've lived here too I have the same problem and it does get worse before it gets better we are doing what we say we're gonna do and you know I mean we're spending thousands of dollars here to try to take this under control so how many units out of 206 units are infested by now you know can you give me a number or that the public need to know as well I cannot give you that number you want to know why because people do not call us and say they have a problem it said earlier that building 13 has issues a lot of those people do not let us know that they have an issue with with bugs and and you know just well as I do they travel on we had an issue with 13 number four there was you know really bad moisture in there all the time and the roaches go for that they liked the dampness they're going to live in that so as soon as we do know an issue we always go and treat treat that apartment and we've done like we said we've done a couple of uh property-wide treatments lately again spend fifteen thousand dollars uh property wide doing two different treatments to try to solve the issue so we're definitely working on it there's no doubt about that um and any time anybody calls us about it we try to uh help them well we put them on the list we and I and I I guess I would say what I said before I'm happy to bring the pest control company on a call like this or to meet with you specifically if that would help um I'm happy to I'm happy to facilitate that but sir I just want to know how many treatments are done for this particular unit where we are talking about 14 join Drive number six because I got two of the treatments in May I have nothing else after that so was there anything done uh after the May 2 treatments yeah okay well we just did two two treatments we did um there were three weeks apart on every unit in the on this property and um I mean I can tell you the date the last time it was six you can certainly put that together for you yeah we can get that together I wish that that was the case but after I'm June meeting on the 21st I have no communication from PJ that was told me that she'll be sending it you know but I have nothing so and I have asked her like you know if you have problems getting in accessing the unit that need to be communicated to us but I have none from from you guys you know till I that it came on the board matters so um and can you can you brief me what's going on with the 13 joint Drive Number Four that started on May 30th you know I have no information on that unit as well yeah all right on that unit you know just as I do it was all mold am I right please tell me what's the status of the unit you know this is four months you know we're talking about in that unit you know it was all mold in there right so we had to wait till the resident get out we cannot go in there I'm not going to risk my guys going in there and getting lung infections from the mold that was in there but are you totally okay with that Resident being living in that unit I mean you are not okay with your guys getting lung infection going into the unit to do treatment but you're totally okay for a occupant living there for four months after we are cited yeah you're totally okay with that sir no they but I I also want to understand when you go into when you go and meet with these residents you do understand that there's two sides to every story and there's responsibility on our side and the responsibility on their side do you understand that sometimes it's their fault just as much as it's our fault no they were cited as well sir and my question was Mr Mark's point that if you are so worried about going into a unit to do a treatment are you guys okay with somebody living there for four months and not do no nothing you know that's my question can you please answer that we did offer them another apartment we did offer to put them in a hotel they did not want to go because of where they work and we called you to let you know that there was an issue in that we called you to let you know that what the situation was and we try to get them out but we couldn't do it until recently until Monday I think was their last day yesterday it was their last day here and you know we we've tried to get them out I'm not going to risk myself or any of the guys that work for me to go in that apartment with the conditions that should have been dealt with when it was first looked at when we first looked at that place nobody what kind of expertise are we talking about that sir like that you you felt that it need to be condemned like what kind of expertise you're talking that that made you felt that it need to be condemned you know I'm not a health inspector but but I've been in the business for 35 years I mean if you think that this need to be condemned that doesn't work that way you know it it comes you know and I know your your team was not happy me condemning the unit I I'm a public officer it takes a lot of responsibility to condemn the unit I just don't go in and condemn a unit that dude that's not how it works you know so I'm gonna chime in here because we can be back and forth all night long right let's um Nick let's come up with a plan um right now let's come up with a plan um and how the communication is going to be um do you already have some ideas of what we're gonna do just and then we can come up yeah so what I would say the first thing I mentioned earlier I'm happy to Rasheed I'm happy to meet with you specifically at the property and we can talk about these things um but cop please copy me like you did last week on anything you're sending to this property I want to be obviously I want to be aware of it um I'll talk to PJ if PJ hasn't been communicating with you I'll let her know that she obviously has to if there's something you need she is to provide it to you um uh and then we'll go from there I'm not I'm not sure what else to add to that but um we'll definitely step up the communication Nick can we can we get a guarantee a minimum of two emails a week for now two Raj um Tuesdays and Thursdays on updates for now I can do that yep I mean what I guess specifically what you wanted I mean I think it's true I think even just you know an email you know three o'clock on you know Tuesday hey just so you know we have no changes since last week um this is our plan for next week whatever you know just so that we know that there's that that it's being addressed and someone's looking at it sure I'm okay with that and Mr chair you know I have one more point last point I want to close this conversation for this season we have no swimming pool from from the apartments you know and I have communicated to to the management uh there was issues with the pool last year they was trying to correct it but I have communicated that that we needed the application to keep the permit alive right and end of the season the permit is gonna lapse now if the permit lapse is going to be a fresh pool treated as new pool and it might not comply with the current requirements with the pool code so I just want to let you know Mr Nick we have not received any application for the pool for the Sami public pool we have on the property for this year you know and I just wanna so that you know that if if no application the permit is gonna lapse okay that means next year when I treat it as a brand new pool okay the um we talked to our pool company today and they were asking us about reimbursing them uh 640 for the pool permit so they are under the impression that they submitted that so we're trying to get from them a receipt of some kind if that's the case if they did that um uh I didn't realize if we weren't going to open the pool I didn't realize we still needed to apply for the permit um basically what happened is the pool needs as you said significant repairs um we got a contract signed for that and uh when the pool company went to the town for a permit um I don't know I'm not sure if you were involved in this or not but uh uh they were told that they need a stamped engineering plan for those for that work to get done so now we've been uh searching for that has taken us this long to find someone that we did get a proposal last week which we're going to sign that contract to get that stamped engineering plan uh and then once that is once that we have that plan the pool company will then go back to the town again uh to um get a permit for the work that needs to get done which most likely we've been done in September after the pool season's over um thank you you know but yes I was involved with the process and the Building Commissioner also you know uh okay in in that process but I just wanted to bring it your attention though I mean look to me the communication is not coming to you so I just wanted to make sure that you're aware right I mean we don't want no surprises next year that this this being not handled you know I just want to be making sure that you know that hey we we need the application you know and we will make sure I will check with uh Laura also tomorrow this was my understanding so far that we have nothing from that and will communicate with you with you thank you okay that'd be great so I I am Nick before you go I just want to open this up if any other board members have any questions or concerns they want you to know about anybody else wanna Ron you're muted Ron okay hi I'm I'm sorry hey Nick just a a quick comment um is there any communication as far as the residents are concerned that if you see pests this is a community-wide problem it's not an individual problem just because you don't you know if you if you see some insects in your place to really report it because that's going to be benefit everybody are there signs posted anywhere or is there any way to communicate with the residents that live there um you know that these things can be serious and you know you see a couple of bugs or you know one Mouse it means there's probably a billion more and it's not just your issue right yeah we do communicate with the residents however I will make sure that uh you know that we continue to do that and try to get them to report that that is a problem that we run into a lot at this particular this property where um residents aren't telling us right away when there's a problem and I don't mean all of them I mean some are very vocal obviously but then others um you know don't choose to live with it whatever and that sort of obviously makes the problem much worse yeah of course yeah it does there are times when it's a language barrier as well but uh you know we try to work our way through that yeah if and I could follow up on that too I it sounds like maybe communication about the dumpster and waste disposal and how that impacts the property and the sanitary uh both in and outside of the building um I it sounds like that that at least you should be communicating about that and also the importance of um letting you know if they see somebody from outside the facility that's that's dumping the trash um on your property and um it it if that's a problem it sounds to me like maybe you uh the camera the camera idea that you mentioned before is is certainly one way to address it as well as you know making sure that your own residents are following the policies that you uh that you set for the property and trash disposal as well as monitoring uh anybody from outside the property who is is misusing it right that makes sense and I think also uh we could probably use a little bit more signage on the dumpster that again is trying to get people to close the doors afterwards we will have our staff um you know check on that periodically throughout the day to make sure that that uh the doors are getting shut um but we can yeah absolutely the residents to do that as well yep yep um and I I you had mentioned it briefly before I think maybe for the time being it sounds like maybe a picture of the dumpster sent to Raj might be a good idea to just make sure if your management people know that that's part of the process for now then they might be a little bit extra diligent about uh keeping an eye on it absolutely um and then Nico I just have one more thing too um you know I would ask if you could personally reach out to the family um with the child that's immunocompromised um to see what else you could do to assist them in this matter sure I've actually met with uh with Richard Lynch one other occasion uh we went to his unit but I can certainly do that again okay and then I myself I myself went in and took care of any issues that he had um maintenance supervisor I went in there took care of everything that he needed done right but again you know this is communication that never got back to the Board of Health yeah yeah okay anybody else all right so I think we have a tentative plan everyone in agreement rise you're good with the current plans yes sir thank you great thank you thank you thank you tonight thank you appreciate it okay all right um everyone um next thing on the gender um that we're not doing it we're not doing board member committee assignments right now so uh Jay you're up next for remote Area Medical Update or thanks Ed so um the funding I'll start there is going well I think I read the minutes and it looked like uh last time we met we're about three thousand dollars short but um we're pretty much there we're only short about 200 so I think it's safe to say that we've got all of our funding um the number of volunteers especially General volunteers not not the professional staff is increasing and so I think that we're in pretty good shape we can still use more people um but but for right now what are we three and a half weeks out or so I I think that we're doing quite well Ram fails that we're doing very well too t-shirts um are going to be ordered pretty soon and Ed Hart has taken care of that they will have um the typical Ram logo on the front and then all of the corporate sponsors on the back they look they look pretty good um and Ed's done a great job he is also handling the advertising on the buses from mwrta and that I think began um yesterday and will run until August 12th so um that's going to be very good advertising for us to patients primarily Framingham State is all set with their accommodations for the ram staff and in fact we got um some Linens donated from the Metro West Medical Center which is a huge help because I'm not to get into the whole story but uh the ram staff will be living in dorms and so we needed to provide them with Linens um and so the medical center kindly donated uh Linens for that so that's good news just heard that today um in terms of follow-up care for the clinic we do have the Latino health insurance program that is handling the Lion's Share of that but the MetroWest free medical clinic said that they may may be able to help us out we're going to meet with them on Friday and see if they can do that um and Ed I don't know if you are I think that you were copied on that Zoom link um for follow-up but if not we'll I can talk to you about it later um we have two more meetings official meetings with ram before the clinic and um so I think we're in good shape Raj you said you're taking care of the food permits with um the Framingham Board of Health let me know if you need anything from me to to any info or whatever same with Steve Mitchell because as you know he's handling all the all the food service and um that's really it for the clinic and of course we have the vaccine clinic going on simultaneously and that if you've got anything to add maybe you don't um for that uh you know feel free but that's all I've got no no just um for the vaccine clinic everyone um I've reached out to the superintendent and nurse leaders of Premium Public Schools Ashland um Milford and Marlborough and we're encouraging them to get their staff to volunteer especially with interpreters um again anyone that's watching our meeting tonight if you're willing to volunteer for either the vaccine clinic or the ram Clinic we need licensed and unlicensed people and you can just go to remote area Medical's website to sign up to volunteer um okay thanks Ed and for you know regarding interpreters I'm just looking at the uh the numbers right now so we're doing pretty well for the clinic for interpreters so for example Saturday we've got seven um and let me just do a quick look sorry uh okay give me one second so and then interpreters for Sunday we've got six so if it turns out that we don't need that many ad I suppose we could ask some people to go over to the vaccine clinic um I think you're going to need more yeah I do too yeah but you know we've also got that you know uh the milagros's system that I think could be helpful too so I don't know we um I did ask for 15 that's kind of what we were shooting for for each day I just want to add on you know from the state we do have a language line you know that we can do phone interpretation in case of any need I I have one setup in my phone like I can learn that you know but I I will chat with them also that like of how many phones can be used you know sometimes in in our clinics when we don't have interpreter right in person uh we we use that and it's very effective you know it's almost like having a in-person interpreter you know so works very well so I will check with the state like you know how many lines can we use at one time or if there is any limit but uh that's a free service to to the town from from the state you know oh that would be great yeah and I'm sorry I do remember you you mentioning that so yeah if there was a way to allow another phone to access that I and I don't know whose it would be um probably wouldn't be mine because I I don't think I'll be able to uh run around doing that kind of but somebody's um on the medical side that would be we can do it from any cell phone you know but uh I I guess probably from our office we might have one or two cell phones for you you know just just to use you know oh okay you know so yeah and okay I'm gonna be personally there and third cell phone can be my personal cell phone you know so that we can use but that's just an idea that we we have resources like that you know that we can use uh for for help okay and and can you just remind me to the plan for the food permanently that's not going to take that long right no so I I did reach out to Mr Steve you know yesterday I I'll try calling him again tomorrow but they'll be taken care I did had a communication with the Framingham Health Department regarding that right uh early on but it should not be a problem you know that I I will 100 handle that that part of it okay great great and let me know if you know for paying for it and all that I uh if they invoice us I'll I'll get a chance Absolutely I'll ask for you know waiver on that you know fee but uh we will see you know I will ask them given it's a community event you know it's it's Framingham health department will be involved themselves given their part of the matter with share Services you know so we'll I'll ask them but I mean that's the season rest with Framingham but we'll we'll try you know if we don't have to pay for the for the permit just given it's it's a Framingham is involved with that this tool okay yeah that makes sense thanks okay all set Ed you're married so the next thing on the agenda um is the health director's report Raj thank you Mr Bowman so first on the childhood vaccine clinic uh we've been doing a little slow like a lot of kids are traveling you know uh schools are off uh but we should be picking up maybe you know end of July you know kind of August another good news on the vaccine clinic right Framingham is about to start restart their Clinic back you know they have things in place uh we're hopefully looking maybe in a week or so or they'll be able to start the clinic you know the plan to start it for two days in a week you know that that will definitely assist us as well as the Metro West area you know for getting some Loadout you know uh about the part-time public health nurse we have few candidates you know uh we should be starting the interview process uh I did talk to one of the candidates she had some questions upfront but if any board member want to be on you know of one of the interviews please let me know and Mr Berman if you have time given your expertise in in nursing or Barbara if if you have time you know so let me know and we'll plan or schedule it accordingly and other board members too I just asked because both of them have nursing credentials you know nursing side expertise uh both Hopkins and upper and Main Beach are unposted now uh that's good news you know given whether it was posted for almost a week you know but they are on posted now that means the residents or anybody can go swim and do any three traditional activities they need to do at the beaches couple of restaurant updates uh Madras Market on Pond Street we had couple of uh not okay inspections at the restaurant but that been sorted out now uh that they they are cleared they have passed the inspection last uh last week uh another thing at Mill Pond you know we have some issues again some activity infestation at the at the Mill Pond and we are working with the management I just wanted to bring this to the board's attention if any further things at the at the Mill Pond I I will keep the boat posted I know you know some of you might be aware there were some issues a few years back at the location so I just want to bring it back to board that we have we have some challenges there but nothing major but I'll bring it to board if needed housing case at 137 Pond Street uh we at the Town level we are in touch with the Aegis office uh regarding the situation there uh from last month there is no communication or any updates from from the occupants I guess uh the AGS office will be visiting town uh on August 9th you know to give us a presentation of of the current situation and how they can assist with us assist us with this case you know so I'll be updating the board after the meeting uh the mosquito control program they they have one more schedule spring on July 24th of this month if any residents want to have their launch paid property sprayed they can reach out to the central mosquito control program to do that with the arbor virus uh given given how we have the rainy season they're definitely concerns right we might might see some Triple E West Nile Virus activity hopefully not but given how rainy it is how bad it is you know we already at the state level we have two positive water samples so far for West Nile you know that that's a routine thing you know they do sample border from different locations at different points two samples are positive so far I guess one one was in City Town of Brookline and one was in Worcester area that that is unposted now uh it's open for recreational activities last thing was the how Street landfill we we have actually sent out uh requests for vendors you know to come service our hostage landfill uh and we have not gotten any responses yet uh I did speak with I did try calling Mr Jesse who who was the contact for the envato track company that we had from past few years who was monitoring you know and evaluating our landfill we have not heard from anybody yet you know maybe I if in another week I don't hear I'm gonna request dep that you know they give us some more time you know for for the for the report for this quarter uh but we are working on it you know so I'm a little concerned that you know nobody have reached out any company have not reached out or you know responded back to our request for for the Hall Street landfill and I'm open for adding questions now please I've got one for you Raj so just going back to the posting of the beaches um so I last Wednesday and I forget what that date was I went to Whitehall to kayak I was ex and this is the boat landing on 135.

until 2002. until 2018. and new today uh as noted uh this property has been acquired by the University of Michigan my understanding is their plans are to construct a new elbow field practice marching band practice facility at this site which is always fun to hear and as part of that we're trying to assist with some clean above land ownership records uh as noted it's never been used as a public right in a way there are no utilities it doesn't serve a significant pedestrian vehicular throughway in any regards there's no passage of the railroad tracks at that point upon vacation the property would revert to the ownership on either side of it it'd be split down the middle normally but in this case both sides that are owned by the University of Michigan so they would assume ownership of IT staff recommends that the Planning Commission recommend approval of vacation it will progress to city council for final consideration thank you Mr Leonard so now we'll move to the public hearing this is an opportunity for persons to speak for up to three minutes about the proposed motion we will first call an individuals present to address the commission then remote participants to speak during this public hearing remotely pressed star nine if listening by phone or use the raised hand feature if viewing through the web link for phone access call 877-853-5247 and enter meeting ID 977-6634-1226 City staff will select callers that have raised their hand using the last three digits of your phone number or by name if available for those accessing through the web link you'll hear an automated announcement that the host is allowing you to speak when speaking please move to a quiet area and mute any television or background sounds so that we may hear you clearly for either method of participation please state your name and address at the beginning of your comments is there anyone present that would like to speak at this time thank you seeing no one is there anyone that would like to address the commission remotely okay we're being told no so I will now read the proposed motion the Ann Arbor City Planning Commission hereby recommends that the mayor and city council approve the East Mosley Street vacation moved by commissioner Mills seconded by commissioner dish discussion of the proposed motion is there anybody who would like to begin our discussion commissioner dish I can't think of any reason not to say yes to this but I want to know if when an unbuilt Street goes on a vacation is it a paved vacation or an unpaved vacation how long did you Workshop that material [Applause] um I guess I have a question which is more just informational and curiosity which is what if this city said no well if this whole said no then um I suspect that there would probably be a lot of research probably by lawyers and to do what has been the history and use of that property um but I would not get that I can confess for a hundred years of history or 100 plus years of history but it appears that there never was any intention to build it out there could have even been some action that formalized the use of it for some other use than a street at this point trying to put together the title and deeds for the property we have not been able to locate that so if for some reason the city decided not to vacate it um at this point I think it's more of probably a tidy cleaning up of title search but I don't know but I think that a lot of lawyers would probably get involved to say what the traditional use of it has been what does that mean and so fingerly Lumber used that and the properties without any Lumber forever great thanks yeah commissioner Hammersmith sort of a follow-up to that that I was thinking of as we were going through this do you think because of that City on land said from a title perspective it appears to be a city street appears so there's no compensation to the city for vacating the city the city is uh when the city vacates property it typically does that it relinquishes the property to the surrounding Property Owners so it's an unpaid vacation okay it would be nice if we if the city could earn some money for that any other questions minimum we will be paid with the beautiful Dolphins mounds of the Michigan marching band great yeah the university could cover the staff time required to deal with the vacation any other comments or questions you made this last longer I'm sorry I think we're ready for a roll call vote that's Kelly thank you um the motion to vacate mostly Street commissioner White yes commissioner Mills yes commissioner clerk yes commissioner Lee Yes councilmember dish yes commissioner Hammerschmidt yes commissioner Abrams yes the motion carries thank you we're now moving on to item 10A Planning Commission annual organizational meeting actions the anniversary Planning Commission is directed to undertake a series of organizational measures on an annual basis to comply with provisions of our bylaws we'll begin with a staff presentation by Mr Leonard yes um this is an annual uh series of actions of the Planning Commission considers many of you probably recall it the first of which is there are three aspects to this one is the election of officers two is uh annual review of the bylaws and three is updating our appointments or Liaisons to various subcommittees or other boards and commissions uh all of that is articulated in the memo that has provided to you which features the second example of my lack of attention to detail um you will know before the nomination section that there is a line that says no current members are eligible for how many nomination to their existing officer position that's not true all the existing officers are in the first year have completed the first year of their position so they could be renominated for their position my apologies for that error uh there are three officers uh to the Planning Commission there's the chair the vice chair the secretary the process to do so is to accept nominations uh from the four often it is done in sort of a slate of officers it doesn't have to be that way in the event that there were multiple nominations we would um we will make sure that all opportunities for nominations for our slave officers have been exhausted and then we would start a voting process on those and likely the order that they were originally nominated and accepted for consideration if they're in the event that there are multiple slates of officers nominated um after uh nomination ideally those members will acknowledge and accept that they are willing to take that role and then we will take a vote after that to actually elect those people to those office offices in arcades because of the resignation of commissioner Gib Randall um we definitely need a new officer somewhere in there and so maybe we can go through that and then after a completion of that I can walk through action on the bylaws uh okay thank you Mr Leonard sure um I would like to nominate um or make a nomination I would like to nominate Lisa sovay for chair myself for vice chair and Donna weish for secretary are there any other nominations from the floor okay Mr Leonard that is soul nomination any any other nominations from the floor councilmember dish can I nominate people who I forgot to ask their permission I think um as long as they um they would need to affirm right now that they are willing to be nominated okay okay um I would like to nominate Sarah Hammerschmidt for a chair yeah okay you're welcome um Vice chairman to know White River secretary okay are there any other nominations let's vote these can be voice votes well don't we first need to get people's consent to be oh yes to have been nominated um thank you um yes we should get consent of all those people willing to serve and then we will take votes on those nominations okay so commissioner white do you accept the nomination as presented yes uh commissioner Hammerschmidt to accept the nomination as presented I'll accept it but I want to vote for myself do I we can't make you vote okay in any way you don't have to do anything um I also accept my nominated self-nomination so they did indicate that she would be willing to accept chair so um I would so um with that everybody would be willing to step up or maintain in their roles so the first nomination slave officers is commissioner uh survey for chair Abrams for meister and wage for secretary if the chair could conduct a Voice vote of all those approving that slate of nominated officers and just to be clear we're going to vote on both slates yep okay so it's definitely clear about the voting process here okay um you can't vote for both so in order for in order for a slave officers to be nominated the Planning Commission has to approve that vote to nominate them for that so if a majority vote in favor of the first slate then we will go to the next slate on sort of Newton new territory for me here but how I would suggest is that the Planning Commission is clear in approving the first nomination we take a vote Yes we as a Planning Commission would accept these candidates we would take a similar vote on the second and then if the if one of those is affirmative and one of those is not affirmative the affirmative one is going to proceed to a vote if they were both affirmative then I'm going to go in the order of that they were nominated and we would vote on the first slate of officers and the first time we get to a majority vote of a slate of officers that would be selected commissioner can I just make this easier on us I really appreciate your nomination um I think the only difference here is me and commissioner Soviet for chair correct if she is happy to do it I feel like I'm doing a lot um and maybe like the next term I could be something but I'm maybe I should withdraw my nomination just make it easier on us and just let's vote on the first it's late does that make sense so you will not accept in our nation I guess because I would vote against myself anyway so and I don't want to feel like I'm in high school okay well in that case may I nominate a difference like I need guidance here in terms of the procedure given that we close the nominations the intention is to provide a wide open opportunity for officers so I would suggest that we want to exhaust everything if all of you have a distinct a distinct candidate pool if you will before that opportunity for them to be raised okay are there any other nominations from the floor okay so um I would like to nominate Sarah Mills as chair Ellie Abrams as a vice chair and Donnell wedge as secretary are there any other nominations from the floor okay questions yes that's great um and we're doing this by slates because that is the you don't have to do a phenomenal way that we have done it so we could um we could move to individual nominations and then move the chair to the end so that it seems like we have agreement with our nominees or nominators that uh Vice chair and secretary have been accepted and so if possible could I suggests that we vote on those two offices and then vote on the chair that's acceptable to me is there anybody opposed to taking them individually Mr Lena you're making a expression so that would progress to a motion to elect commissioner Abrams to the role of Vice chair and commissioner whitech to the role of secretary correct and we are still accepting nominations for the role of chair yeah and also getting people's acceptance of their nomination so is there anybody else who would like to nominate anybody for chair Mr Lee so if we voted you guys that I can't nominate for example you for sharing I think you could yeah right I mean I think it was an excellent job moderating um so I don't mean to make this one no I I think you I think nominations are open I think anybody can nominate anybody for any role that they would like to commissionally I nominate Ellie Abrams per chair okay so we currently have three nominees for chair myself Lisa sove and Sarah Mills are there any other nominations um so I will say that I'm going to ask you if you accept they're not a digital question well I thought you were maybe anxious that I was moving on without getting your consent first commissioner Mills thank you commissioner's question maybe think of a slate that I would like to nominate if that's all right I know I would like to nominate commissioner Abrams for a chair commissioner Lee for vice chair and commissioner white for secretary I will make this more simple by letting you all know that I am going to decline the nomination for chair I'm I'm at capacity and already considered that and decided against it so thank you very much so commissioner Mills would you like to accept the nomination for chair Coke one more one more possibility one more possibility could we nominate commissioner Lee for chair commissioner Adrians for vice chair and commissioner white for secretary so then we would just be adding we would still be taking them individually and adding commissioner leave or chair we have three nominees for chair potentially I will ask for your consent in a minute um Lisa sobey Sarah Mills and commissioner Lee are there any other nominations for chair okay commissioner Lee do you accept this nomination up yes commissioner Mills do you accept this nomination I similarly have a whole lot on my plate um and so I would I'm honored it was my pleasure to chair during covid I I someday I wouldn't I I love being on Planning Commission to be honest it's weird but um someday again I'm interpreting that as they know thank you thank you thank you thank you for that was a no thank you and thank you for the comments I also will share that I have a someday like Sarah Hammerschmidt and Sarah Mills um but not today so so I would suggest we have two nominees for chair both have accepted commissioner sovay and commissioner Lee correct conditioner so they was uh uh nominated first I would suggest that uh we take action first on commissioner survey a vote of the Planning Commission um commissioner Soviet has been nominated commissioner sobey has accepted that role we'll have a vote on that if it's successful commissioner Sobe would become chair if not we would progressed to commissioner Lee the reason I am the reason for that order and in my mind is that commissary was nominated first also commissioner Soviet is a current officer of the Planning Commission I don't I'm not saying that I'm reading that from Robert's Rules but if if you would like more of that research I would need more time to determine that would anyone like to discuss or make comment on the voting procedure at this time okay let's proceed to a vote please okay so let's do an uh the motion would be to elect uh commissioner Solvay as chair all right the motion is to elect Lisa survey as chair of the Planning Commission moved by yeah yeah moved by commissioner white seconded by commissioner dish um all in favor raise a hand and say I I all opposed do you say um I I'm seeing that the motion failed that's about four Nays three threes that's correct uh so the motion fails okay so then I would suggest a new motion for uh to elect commissioner Elite as chair of the Planning Commission okay motion to elect commissioner Lee as the chair of the Planning Commission moved by commissioner white seconded by commissioner Mills sorry I'm confused both could fail and then what what situation are we in and then we would have to nominate someone else yeah we'd never denominate someone else a nominated Hank okay okay um okay all in favor please raise your hand and say all right sorry we need a motion and I yes did you get that next Kelly okay all those sorry the voice all those in favor say aye aye MC six eyes yeah please leave them raised the motion carries congratulations commissioner Lee traditionally you may assume the chair right now and I take my script with me [Laughter] um do we need to vote on myself as Vice chair and Kushner weish as secretary uh given the previous discussion my understanding is there seems to be agreement I think a motion to name both of those positions together they're like a mini slate okay so there's now a motion uh for myself Ellie Abrams is vice chair and Donna weish as secretary moved by commissioner dish seconded by commissioner Lee all those in favor say aye aye aye the motion carries we're now on to 10B thank you sorry for any confusion I added to that uh the next regular organization meeting is a regular review of the bylaws um you can take the Planning Commission in short can take two actions one is to propose changes to the bylaws and they if those changes are if any changes are proposed what staff will do is from this time and direction we will work with the city attorney's office to complete review of those present them back to you for adoption at which time you can take action on them for them to the city council for approval or you can say we're good we think the bylaws are perfectly okay in their current fashion um I'm going to run through some proposed changes that staff is proposing to the bylaws my apologies I think that these were added to your packet late due to some legislar lack of knowledge on my part so I have attached a set of draft bylaws with some proposed changes the first change is on page three which would add section 4.10 this was a new language that has been was adopted by city council I believe under Council rules commissioner correct me if I'm wrong um and it's being added to a series of bylaws where a border commission has a council liaison it provides for that council member and a representatives from the Planning Commission to review applicants for a position on the board and forward those recommendations to the mayor and Council for consideration it is still the mayor and council's action of course but it provides a administrative review process for feedback for those boards where a council member is a member or liaison as council member dishes sitting here we are that the second proposed changes on page four it is to fix a advanced agenda neutral terminology in section 5.10 the next change is a question not so much change and 7.9 this is also referenced also in 9.1 sub 3.

is that one of the um areas for posting it said Whitehall in the in the list but I want to make sure it's the right one because I didn't see any posting and I I thought that I would have expected that was that out of town sir which town was it that was hot guys that's Hopkinton it should be posted you know so but though this this is with the request uh Department it's not with us right but the state but with whatever times I have visited you know if the property was posted they will post it you know right where the entrance is usually they put like no swimming signs and all that I mean it just took contact with water kind of situation right like the Boating and all that happens still but it's just if you are trying to swim or you know have any what I mean that that was restricted you know yeah and so I I again I don't know what the date was last Wednesday but I think before that I saw that Whitehall I was expecting to see a post and it wasn't I know it's not us that's posting but just for what it's worth right that that's under us right so anytime any thing happens there we post it I mean we last time a couple of time uh Becca our conservation isn't helped like because she also looks into this matters right I mean we do that at Washington but the BTS are understood you know but I'll keep an eye you know and have communicate with them like you know yeah uh that hey this was the case okay thanks absolutely hey um Raj so um so what is it uh I'm sorry I don't have the history to understand what the uh the the uh outside uh third-party contractors for for 102 house Street are what it is that we're looking for uh could you go into that just a little bit briefly sure David uh uh the state DMP you know this this is way before I guess long time back you know they have asked us given you know concentrations of methanes and other gases you know that they they want us to monitor you know measure all that you know and provide them reports it's a mandatory requirement from dep that we have at the Town level you know so last time last year we have a company called Enviro track you know that that was doing this for us right but what has happened in in June end of June when we have not heard or you know we communicated with them they said they won't be able to continue with the town uh given uh the the person in charge have left you know there is a specific requirement that you need to have somebody with credentials LSP that need to be doing this right and with that company there was nobody else you know so we have gone out I guess uh five vendors you know to asking for bids you know for a three-year contract to to do that work for us you know uh so so far we have not heard anybody I can provide you more details about what it pertains to you know like uh what are we look uh from from dep uh but uh that's all we we are currently in the gentleman Mr Jesse again I mentioned you know he went to a different company and I today also I made a phone call to him and left a voicemail that he is can continue the work with for the town from that company will appreciate it you know so uh right now with earlier and right now we have to submit a report every three months like a quarterly report given concentration of the gases and all that stuff right uh this was I guess last year it was monthly even given the levels was low we requested dep to to make it quarterly and they accepted it given it's a good amount of cost to the town you know uh I guess the current uh contract stands at 16 000 a year it was almost the double before that you know so that many uh the town spent just to monitor you know the the landfill so besides I mean there are other repairs and all that that that's there you know more on that you know given given the details of of what what the EP asked for so thanks at what point are we would we be in violation uh how how long do we have to find a contractor uh so quarterly report means like you know we have to provide a report within uh you know July August September till end of September but uh given you know like no response I'll still reach out to you know the our our officer at dep just just updating him you know or asking resources right if they know anybody from the surrounding towns or you know they they might be working with a lot of folks you know uh on this that if they they can put it put us in touch with somebody that who can do this for us you know they do need some expertise work you know the like I mentioned it's something called LSP you know that that they need to write reports and monitor it and I'll I'll find out more you know but we do do have time but given you know it's it's a process you know if we have to bring a vendor on it takes a little bit of time at the Town level also to process you know getting all their information Insurance liability and stuffing right right yeah makes sense thank you um and and regards in regards to the mosquito concerns particularly with the weather being what it's been and you know a couple of Triple E cases in the state um as you mentioned is uh does the town have a strategy or a plan for like for communicating to the public the need to you know eliminate sources of standing water and uh those sorts of communicating those sorts of uh measures that could could help um I mean I know it's it's probably a pretty it's all mountain to climb in that regard but um but I haven't seen anything in the past so I I thought I'd ask yes sir so just just want to correct you know one thing that the case is for the water samples was West Nile actually you know not not Triple E just just you know yes we do send out stuff in our uh in our social media I guess there was a post last month that we sent out about mosquito control uh occasionally the Articles goes in a local newspaper and all that right we do have information on our website uh and yes again you know outrage we do it you know to to the extent possible yes we that we we have a post you know last last month or so you know around around the time when this started if that answers your question you know it does yes yeah yeah I guess maybe um I was thinking if if uh they could include something in the town manager's newsletter too that might be a good idea given again the really wet season and wonderful no we we're gonna do that you know uh and the other thing is why we proactively take you know like uh calls you know from Resident concerned about uh uh you know like uh some standing pools and all that you know that not taken care you know abandoned pools you know over past uh two years like we have dressed maybe three four of those schools that you know that was like abandoned you know we do have one case currently that we we are working on you know to get that pool filled and all that so like uh again coming back to Chestnut Hill Place you know that they had some standing water in the back of their dumpster that I was concerned you know so we try to address like you know only thing is I wanna add right like no these mosquitoes grow only in stagnant standing water you know if the water is Flowing then they cannot complete their life cycle you know but the standing water definitely concerns us you know containers you know tires and all that right no absolutely awesome great thanks all right so the next thing is the consent agenda um please do a vote on that and unless anybody has any questions so do I have a motion to approve the consent agenda as presented yes um I make a motion to approve the consent agenda thanks Barbara any discussion on the consent agenda okay all in favor aye great all right okay let's go through um so the next thing is uh discuss future agenda items uh looks like our next date Raj are we gonna need an August first date or can we push it out to August 15th yep you're muted Rush Mr Burman up to the board you know usually they do one meeting you know but we can uh aim for August 15 and I can let both know if there is need you know in between but uh up to you to decide I guess what I learned that sure so we'll plan a December um an August 15th meeting um and if anything comes up that needs we need a meeting we'll schedule one for August 1st and I know last thing is coming I wanna thank Dr Rohan you know to spare time again you know just I just want to say thank you sir you know I didn't do anything but thank you I'm sorry I didn't uh I didn't realize I had to do that again but that makes sense so sorry to the board this morning tomorrow night and uh next meeting thank you and I I want to thank Mr Balaji also to be present I as as we discussed on that day right I I send the meeting invitation to both Mr Balaji and Mr morais you know and we'll keep continuing with I mean I I thank you for for your support with with our work too you know so sure it's my pleasure it's my pleasure [Music] um so I guess I will do the most I will make a motion to adjourn oh Jay just seconded it um all in favor all right all right great thank you everybody um thank you for attending okay thank you for your support I appreciate it thank you okay have a good night

recently there have been some conversations about we have a pretty professionally engaged Planning Commission a lot of members are active in the development community in various ways we have Architects we have developers and oftentimes when those individuals are being are recusing themselves appropriately from a conflict of interest we can be challenged to meet the minimum six vote requirements I raised the question here we because of other code in the city not your bylaws other code in the city requires in the establishment of the Planning Commission that that sixth vote six vote majority is required to pass any decision on a site plan or a recommendation to city council one of the things that we could consider is modifying that to a majority of five votes that would be reducing that threshold in order to do that it would not only take an amendment to the bylaws but in order for those bylaws to be amended required ordinance change to the city code that also reflects that ability at that location as well um I raised that if it's something that the Planning Commission is interested in pursuing we could follow up with the steps to request that ordinance of the city council the city that would be the city council to determine it would be a request of the Planning Commission it is not part of the UDC but rather the administrative sections of the city code and the establishment of the Planning Commission on page eight I propose adding uh the timing of the extended at the destruction discretion of the chair for the 10-minute petitioner presentation we have that for public I think it's appropriate to add that discretion for petitioners as well um I embarrassingly thought we had already struck this provision but I would propose that we eliminate the five minute for neighborhood organizations uh speak we typically don't have that I can't remember the last time it's been invoked I think three minutes is adequate across the board for lad reports and commissions to provide adequate commentary on a petition except writing e-commat and public comment so eliminating that so it's just consistent and simple across the board again on page nine if the Planning Commission was interested in that we could pursue that a uh of five Commissioners what would be necessary for approval rather than six finally on page 11 a couple of I would say administerial proposed changes one is the most current version of Robert's Rules of Order that's something our attorney's office has already suggested I don't know why it makes a big difference but I don't have an objection to it and some softening frankly of amendment to our bylaws and review of the bylaws that say that the Planning Commission should review them on an annual basis but doesn't create any sort of I don't know expectation that we're not doing our duty if we choose not to those are changes that I proposed you could consider some of them you could consider none of them you could add additional changes for you as I said you could determine that the bylaws are appropriate in their current format and no adjustments necessary thank you Mr Leonard yeah commissioner Mills and then commissioner watch I actually was going to ask the question about what happens if we changed the sixes to fives and Council doesn't do anything but actually your um your change your proposed change to 14.1 yes makes clear that no matter what we change in this Council approve this this is not just an internal to us so um I I like this I think I like most of the change is the only one and I'm speaking for commissioner or like putting myself back in the chair seat once upon a time like it's nice that the chair has discretion and I think it's also nice to say you've had your 10 minutes like and we almost always defer like come back to them so I don't actually know that we need to add that in I think we're pretty nice and the way that we do this now is ample time so that would be the only of the proposed changes that I might not change I might not add in the explosive thing that the chair has discretion to extend the petitioner's time but I like I think the other ones clean it up um yeah thank you commissioner watch uh my questions are about what have not been proposed by Mr Leonard so is this an appropriate time to ask those questions great so I'm in section five uh ethics and conflicts of interest I am interested and I think I have made some note of this with you Mr Leonard in passing um a a little I think I I think I'd like us to vote on the recusals as opposed to the self recusal and part of the reason for that is related to why we are potentially proposing to go from six to five is because often now chair Lee has to recuse himself because his employer is a substantial real estate holder in the city and may be impacted by a zoning change and I know you all have conversation around that but at the council table the the council member acknowledges the um potential conflict and then the table votes on that conflict and then after a successful vote they are recused in our practice it's just a self-recuse one then they walk away from the table and there have been conversations where the expertise of the sitting commissioner would have helped substantially with the conversation but the sitting member recused themselves automatically and is by the bylaws so I don't know obviously this is on the floor right now I'm not asking anybody for answers but I do want to raise that as we come to these bylaw changes so that there is a a little more input from the from the table around that recusal and then it takes I think the burden off of the individual member from having to shoulder the weight of whether or not they think that recusal is necessary it did did I communicate clearly okay yeah that's and that's appropriate feedback if if it's desire to pursue these changes we can um I appreciate the reference to the city it's a council method that's something I would probably talk to the attorney's office about that sample language I don't know if there's reasons why this is better in the circumstances versus that but um we can definitely explore that to see if it's possible I personally would support that I don't know if anybody else wants to comment or ask a question about this commissioner Mills yeah I don't because my employer is not subject to zoning um like it does it rarely would put me in a weird position unless it's like my neighbor you know like that so but I'm curious like if it I absolutely agree with where you're coming from but if it also puts people who and there's multiple people who've had this being been in this situation but it sounds in a weird situation with their employer um which I don't know and and I think that so I'm not in that situation I'm just trying to imagine like both sides I can see like you not wanting to seem um suede one way or the other but I also like I don't want to force someone into um a situation that puts them in a really awkward position with their job that's actually paid well let me I I don't think commissioner Weiss is probably looking at that either I think what you're saying is if if I'm under you wouldn't want to be in a position where the planning person say no you should vote on this but the individual doesn't agree with that is that okay but let me so let me let me just bring both of those and continue to look at it when if we're going to present some revised by us to see if that if there's a way to address that I think that's fair because personal integrity might have a different threshold than your colleague at the table on it sure I I believe we could resolve that with an abstention so they could still participate in the substance of the discussion and then abstain from the vote because then they don't have the conflict and recently uh the chair of the independent police oversight committee resigned that position because their employer prohibits them from participating in any City based organizations and so they had to resign in order to do that so I would say we have a tool the tool is abstention but we don't use that tool at this table the person just leaves the table and I think your expertise I think the ex the gathered expertise of who sits at the table is what is helpful even if you choose not to vote in favor or against having you at the table to tell us or maybe let's be more selfish to tell me what I do not know is really valuable and and I am making this plea selfishly thank you this is not a tool that we use and I I like exploring that a lot yeah I will my yeah I don't know why it hasn't been used I I think that I have I don't have I I always thought that abstentions were challenging because if if there is a question of whether or not you should vote on it even participating in the discussion has a sphere of influence and so but they exist so I don't know the appropriate ways in which that but I that's a question that we can definitely discuss I will say that it's always been my understanding that we are discouraged from abstaining outside of this potential situation with the conflict of interest and instead actually voting no or asking for the information we would need so that we could make an informed vote Yes or no but so I think that's often why it hasn't been used here at the table um any other discussion about the um question around recusal I guess um I'd be interested in what kind of language uh would exist just because um is it something to the effect of notwithstanding the foregoing um in the event that planning Commissioners deem you know through a majority of votes uh just because there's you know I'm thinking practically right um let's talk tc1 for example my employer owns a property in tc1 that would benefit from a discussion it does say at 5.1 it's a member of the commission show abstain from discussion voting or otherwise acting in any manner where that member is involved in a conflict of interest so I'm just trying to think about like what language helps to override so I guess I'm interested to see how that like mechanically Works um and and really conflict of interest is not only the actual conflict but it's also the perception thereof so it gets very tricky um and it does like as a majority you compel me to talk about tc1 because of my again like and I have plenty of opinions about tc1 sure I live it um I want to make sure that the the public knows that I'm here as a civil servant not as anything to serve so it I am just kind of interested just because it does exceed more than just the actual conflict itself but the perception thereof so um I'd love to see the language this is kind of a complex topic so um and just how it would kind of negate some of the other elements of 5.1 and um really the entire section right so and in my world it's just I got to be better safe than sorry right and I just want to make sure that the public knows I'm really here just as a public servant so and not not really acting in a manner that sways one way or the other so um this is probably getting too complex but in other organizations that I have participated in or on the boards of um one way that we deal with conflict of interest is that you you name your you name it and you also declare your strategy for mitigating it um which is to say that you would find some way you know it just as a way of dealing with a with public perception which would be to be very transparent about your understanding of that conflict and what you plan to do to mitigate it and that allows a lot of flexibility Beyond just recusal so that might be some option although it's a little squishy I understand um commissioner White yeah and I think the the and not to put you in the cro the the focal point of this part of the conversation commissioner Lee but uh that is where we are I after doing the MSU Extension training on uh planning and participating on a board we had a whole section on recusals and they walked through scenarios and the best practice that the instructors gave was that the the planning board vote on there was a disclosure and then there was a vote and as I sit at the table we just declare and then withdraw and so I just wanted to come somewhere between those and a lot of the language in 5.1 is about individual not employer the employer one is in 0.5 and it's acting as an applicant or has a direct interest in the outcome and indirectly we might all have to recuse ourselves as zoning changes property values because we have it in you know or this as a direct interest in the outcome so it's just trying to clean up the language for the the point of you being on the board which is you bring in expertise to some of these conversations that we don't have or at least I don't have and I feel like that is missing now we could mitigate that in another way by knowing that there's going to be something where you're going to recuse yourself and we have a subject matter expert who is available to answer those kinds of questions but often at the table your lived experiences change how I perceive something I take almost to a person you all have said something that I hadn't considered and I I appreciated that and I think that makes me a better commissioner and it helps move our objectives forward so that that's my ethos I'm not trying to force you to participate in meetings that you don't think you should participate in thank you Mr Leonard do you feel like you have what you need to come back to us with a yeah some more information or a proposal yeah I yeah I think I'm gonna start a little bit um clean sleep with the attorney's office like how how can we sort of elevate this how can we provide more opportunities to get the expertise of our appointees without creating concerns I think that's the net goal that we're trying to achieve here yeah thank you I have a quick matter on the bottom of page three there's another instance of the use of gendered thank you language that we could change any other comments commissioner Hammerschmidt I have the if we okay so article 14 section 14.1 the first sentence talks about a vote of six members if we change the other sixes to fives does that one also need to change to five or does that stay at six um this one that one you could change uh I will add that oh no I'll I'll add that on my association bylaws um I'm the president of my Association uh there's like a higher standard I think of votes for amending bylaws so um I I don't know that but that this is just specifically to the amendment of bylaws so I'm just throwing that as an anecdote I just know if we wanted to be consistent if we were going to change it everything else has changed I'm just that would be good to discuss the five versus six yeah it has a topic before we do that generally also just say I I would all I mean it I would also be fine with just leaving out the 10-minute discretion of the chair thing I don't think we've ever I don't know I don't I don't think I've ever seen an instance where I'd want a petitioner to go longer and I'm wondering about the three-minute public participation discretion of the chair just to make them consistent like you wanted to do we want to delete the chair make send an individual speaking time I don't think it issue it does provide some flexibility if like if the Planning Commission wants to hear from another aspect or a follow-up question or something in that regard that otherwise you might be limited to but it's a fair question I I would my my initial reaction is I don't think that's broke okay not that I think the developer one is I was just trying to add some consistency I'll also add that I would be in favor of leaving discretion for public speakers but not adding discretion for petitioners agreeing with commissioner Mills essentially yeah yeah um does anybody want to discuss or make a comment on changing affirmative vote of six to five commissioner Mills just while we're at it there's one more place that hasn't been flagged that has six and this is about when you um uh let's see then it's 7.15 and this is closed sessions but I think that that may be linked to state law and so I just wanted like but I thought I'd flag it that's the only other one that I saw I will check that but that is my that I didn't find that I think that is a state law requirement to go into a closed session it is a higher threshold but I'll double check that okay councilmember dish I just wondered if staff either mixed Kelly or Mr Leonard had any thoughts about the implications of us reducing from um yeah six to five I was going to say five to six which wouldn't be a reduction I don't personally have any concerns with it a lot of very important actions are taken across the city with a majority vote at some point this was established to be a higher threshold presumably because of concerns about development activities um your discretion at this table is to say things meet or don't meet our ordinance it's not a it's not a discretionary PUD approval or the like um maybe the council would feel better knowing that when recommendations are coming they are coming with a higher and a super majority I don't know if that is a super majority but a higher majority of the Planning Commission than a simple majority I it for the sake of conducting business it's it seems reasonable that a nine-member commission um could forward or take an action with five of its members but I I am I'm not sure what my planning forefathers envisioned for for parents four four parents um commissioner should you have a follow-up or can I move to yeah so the only thing that I am the only thing that is sticking for me on this is that Planning Commission is now the final approval body for things that it didn't used to be or that it used to be and then that was changed and then we changed it we the council changed it back so Planning Commission once more is final approval on site plans where the you know proposal Accords with the existing zoning is there anything else special exception uses which we love um I yeah I it's it's hard for me to see why six versus five makes any difference commissioner White so thank you for actually making these changes because I feel like a lot of these changes are related to the things I've been raising at the table around the size and when we have recusals so I think they're all sort of interconnected which is we've had to send to council a couple um somewhat technical failures that were actual approvals at the table because they didn't meet the threshold and given we haven't changed our recusal rules we could have at any meeting up to two Commissioners who have to recuse themselves and I feel like that could having it have to be at six it puts a lot of pressure at the table um so that so I I think going to five is actually helpful given that we can't have alternates so this I started this conversation with could we have alternates because of the recusals we can't have alternates and the recusal policy hasn't changed so anyone can self-recuse which then has an impact both on petitioners has an impact on what we sent to council has an impact on our work schedule because things may get postpone and delayed so I just feel like it's all these Cascades because we're tight into this structure so the five actually feels like it provides space for us to get all of the work that is before us done and to do it in a reasonable way um at the table without postponement delay or sending technical denials which are our approvals to council it doesn't seem like it's hurt anything but it in the community there has been some manipulation of the failures at the table and talking about sort of projects that then go on to council because people aren't in the weeds with us on even though we voted five two or whatever the vote was a majority at the table but it still fails and so goes there as a failure so I think the five helps us with that and it feels like a good compromise since we can't have Alternatives and we haven't yet changed our recusal policy so if we changed our recusal policy then we might not need the five and we could stay at the six because more people could sit at the table so those are some of my thoughts of why I think it is helpful thank you any other comments for discussion commissioner Mills so just in terms of practical next steps like uh does it make sense Steph if we were to change it from six to five uh uh we could do that tonight forward should we do it tonight forward it on to council knowing that council's got to change something else but they have to actually approve this before any of this goes into action anyway does that make sense or should we how so that's one question and then I'm going to say the other one because I think that they're related my uh how long do you think it's going to take to get back information about um recusals like um and I know we have to review our bylaws now but is there anything that says that we can't come I don't I didn't read that we can't come back yeah so currently the bylaws require you review them once a year one of the proposed changes here basically says you should but you don't have to you shall not be slapped on the hand if if you don't if you forget yeah yeah um so as but so you you could you could always come back to it to your first question um it would not be appropriate to adopt new bylaws tonight wait the decision before you tonight is they're good as it is or we would like to pursue these changes and what I am hearing so far is sort of a combination of the changes that I proposed uh the one striking the discretion for developers seems to have some common support across the table to not include that potential change um I'm going to explore uh a revamping of the ethics and conflicts of interest to provide to explore a required Vote or action by the commission for a recusal how that might relate when that vote is at odds about what an individual commissioner is feeling or concerned about and I'm going to explore how and when abstentions are appropriate versus recusal all towards the goal of trying to bring as much expertise of our members to the applicable discussions as is appropriate so that's not changes that I'm going to present those are changes that I'm going to go to the attorney's office I'm going to say how can we explore this what are the examples let's look at the council rules how they do it what's appropriate what's not appropriate the motion I'm presenting to you would um task us with trying to accomplish that and bring back revised bylaws to you on August 15th then you would adopt them and recom that would be the action to recommend them to city council at that point if what I I am hearing support for shifting to from six to five what that means is I'm gonna pres on the 15th I intend would intend to present bylaws with that change to you but that is going to have to be a sort of staggered conditional action before those bylaws then progress to city council there's going to be a request from the Planning Commission to amend the applicable section of the administrative code to modify that so that these bylaws then may be forwarded is that bureaucratic enough so yes enough okay all right um I have two con two quick comments um one is did did we or staff consider uh majority of members present as opposed to a fixed number of Commissioners I did and I thought that taking an action it seemed to me like a five majority of the Planning Commission versus those present was appropriate we do have some boards that are present we recently for example had a Planning Commission or a historic district commission action that I think was like a group of three and it was a majority vote of three um I did think about that I thought going from six uh for whatever reason that was established when it was established to five was a reasonable um Improvement to some of the challenges that we've had lately without going to a position where if you had five people present that'd be a quorum for meeting and only three affirmative votes if that's something the commissioner was interested in I thought about it that seemed to just be a more extreme step I thought that the five was reasonable thank you um personally I also think that that's reasonable I think um acquiring a certain quantity of affirmative votes makes more sense than than the majority but I I wanted to make a couple comments just for the record I would support the change to five but I also think probably um 90 of the time we vote unanimously so um and which is maybe something to talk about another time maybe we need some more diversity of opinion up here but um so I think that this so I think this comes up when there are actually those very rare items that are difficult that we're really grappling with and I actually think in those moments the shift from six to five is very significant like to only have to convince five of us as opposed to six of us so I don't I I don't oppose the change I also uh note that at any time we can also change it back we don't have to wait till July we can at any time if we wanted to change it back so we shouldn't feel like it's too risky to do it but even if that ordinance were changed the bylaws could establish a higher level but because that ordinance that is a barrier from going the other direction right um I forgot the other thing okay so but we're actually going to make a motion to postpone we're not going to vote on whether to change the bylaws you are going to make emotion uh that is the first motion in the bylaws stanza of your staff report all right I would propose that the motion reads something to the effect of I move that the following changes are referred to the City attorney for review the proposed amendment included in the draft bylaws presented at this meeting with the following modifications foreign of alternative ethics conflicts of interest and recusal language as discussed and directed the modification of section 5.21 from him or herself to themselves the the removal of the proposed change to section 8.3 at the time for a developer petition at the discretion of the chair and [Music] modification of all votes from six to five where appropriate by law I would keep the amendment to the bylaws at a super majority okay personally following commissioner lease Okay so so to the extent what about closed session I do think that that's regulated by law but if if that were possible keep at it at a higher threshold as well I would okay so it would only be for the decisions and actions on site plans and recommendations to the city council and those are the two that were already yep I'm called out okay so those are my notes and if those are accurate somebody could move that second it and a Voice vote and what that would put task staff with is going to work on um refining these working with the attorney's office on the questions about recusal abstention and that balance and we would present a revised draft to you in on August 15th and likely again that would also be accompanied by resolution for the Planning Commission asking the city council to modify the boards and commission chapter of the ordinance okay moved by commissioner white just seconded by commissioner Mills all those in favor say aye hi any opposed was whites and Mills yes okay thank you okay so we're on to 10B the commission will vote on a meeting change for second regular session you've got one more item on the organizational meeting we got a update oh committees and appointments I'm sorry committees and appointments [Music] I think it was unanimous on the motion for the bylaws it was a Voice vote unanimous Voice vote no one opposed Okay the third opportunity for organizational Excellence is your designation to uh committee assignments and Liaisons uh I have put together a proposed but it's largely just uh what is existing assignments are um the comprehensive plan committee is Commissioners clarkish Hammerschmidt Lee sovay and weich the ordinance revisions committee is Commissioners Abrams hammerschmitt Mills and sovay the executive committee with the recent um uh uh election of officers would be Commissioners Abrams Lee and weich we have uh additional designees uh two committees no longer want you or exist thank you commissioner Hammerschmidt for your service both the center of the city initiating committee and the DDA affordability and economic development development committee have been dissolved so there is no longer a need for a Planning Commission liaison uh commissioner dish um continues to serve violently a double duty of liaison to the city council to the environmental as a city council member to the commercial environmental commission and the Planning Commission and maybe was willing to continue in that role commissioner Lee is liaison to the Transportation Commission and not appointed by the City Planning Commission but I do note that state law allows a single member of the Planning Commission to also serve on the zoning board of appeals for some continuity of those related petitions and commissioner Clark has applied to the zoning board of appeals I'm waiting on the decisions of those above as to where that goes so this would be an opportunity to make any adjustments to this uh things that jump out to me are um commissioner Lee if you want to continue in your role as liaison of the Transportation Commission given your new role as chair um if you do then I would welcome any changes or it could be adopted in its current form commissioner Lee uh yeah I recall that commissioner weich at some point expressed some interest in the Transportation Commission is okay okay legitimately thought I did not I was I was wondering why you were making eye contact with me yeah behind me okay never mind okay um no no I I like serving on the Transportation Commission it was my sub area of concentration in planning school so yeah is is the I do have to ask just like the executive committee um just as far I'm new to it so I have no idea what is like the additional time commitment to I think we meet once or twice a year perhaps sometimes not at all okay got it understood yeah I know yeah fair question most recently we have met to discuss um The Retreat a Planning Commission Retreat okay cool but it's very on vacation yeah [Laughter] that's really Gonna Keep on giving are there any other comments or proposed revisions to the committee assignments as proposed [Music] put on that I move the commissioner appointments reflected on the attachment as modified during discussion be approved moved by commissioner white seconded by commissioner Mills all in favor say aye the motion carries Now we move on to the meeting change for our second regular session in August from Wednesday August 16th to regular meeting day of Tuesday August 15th without objection that change will be made are there any objections we'll pause for clarification we often can schedule a round anticipated election dates we have confirmed that there will be no August elections so we can move from our uh flexed Wednesday date back to our typical Tuesday date I'm sorry to the chair could you is your microphone on it's hard to hear you um that also did happen oh there was a previous also we moved the previous week's working session from the 8th to the 9th Okay so so we are currently scheduled to meet Wednesday the 9th as a working session and and now Tuesday the 15th as a regular meeting yes and this is odd I'm just looking at a piece of paper that only has the move of the of the ninth meeting to the eighth I think that's from a previous huh or I don't know what you're looking at but it's the one that I found on the agenda but oh okay I'm sorry yeah that's what you have too right that's what it looks like okay yeah that's what it looks like it's moving but you have something else moving chair Abrams give us one minute you're right so the meetings the revised meeting schedule that was attached to this agenda item shows a move from August 9th to August 8th commissioner dish is correct so as a regular meeting correct thank you commissioner dish for catching that yeah I think it's correct in the agenda it's just incorrect in my script so I think I just misspoke so can I start over please may I please start again this is why I'm not chair yeah I just think it's the work session not the 15th right got it all right starting over 10B a revised City Planning Commission meeting you know that sounds great you are alive I've been doing audio chat okay you are good sir double check um [Music] and you are alive and unmuted good evening everybody large I'm going to call the order of 634 do a quick release the New Jersey public meeting tomorrow was imagined to ensure the right of the public to advance to this up and to attend the meetings of public bodies at which time a new business affecting your interest is discussed and act upon in accordance with these provisions and the Board of Education policies too Board of Education because notices Board of Education and any person who has requested individuals thank you what regions certainly here Mr midhaus miss high here Fullmer Erica here you're the foreign happy to welcome Miss Glenn Thornton back to Don Brooke she's going to take us through some training on to the gym so thank you thank you very much it's a pleasure to be back um inbound Brook you want to move down okay okay can you all see so I I'm coming tonight is really to talk about measuring student achievement what it looks like responsible for what the board's role is by looking at data for example so critically important the various kinds of data you may use to look at so why is it important there are a number of Assessments and there are a number of data points that Boards of Education can look at um number one the New Jersey student learning assessments those are required um assessments that are given to students once a year we had some time off due to covid but they were given again this year um there are all kinds of ways of measuring data and you can look for example to see how your district is doing on the New Jersey school performance reports every single district has a series of school performance reports that are posted every year and it looks at each School individually and there's a summary of the overall District as well and that's some place you can look at various kinds of data in addition to those standardized types of Assessments that are given in the school at the high school level obviously they're all the PSATs SATs acts that are given which are also standardized assessments that can be looked at how your students are doing and that's another way to look at it we know through research that boards that use data have higher levels of student achievement because it's a way to measure how well you're doing um and if you can identify through the utilization of that data and assessing that data where there are gaps for example it's very important that you then can use that information to help remediate and close those gaps for students you can identify where there has been perhaps a loss of learning or where a student hasn't been able to able to come to terms with that so you have to be cognizant of data you should use it but the one thing that I can't over emphasize is making sure that you're using data as a flashlight and not a hammer data should be used to help inform and improve not to punish penalize or disrupt okay and all too often sometimes districts board members may use data in a way that is not productive for the district you need to use it to help inform the instructional program to help your staff identify where they may need to do some professional development to become more Adept at the instructional techniques that they're using but again you want to make sure that you're using it as a flashlight to highlight where it is you may need to please Place additional focus and emphasis in your instructional program but you don't want to use it as a hammer um and that's something that you know oftentimes um sometimes superintendents get a little weary of sharing data because sometimes if it's not understood in the context in which in what's meant to be used um it can be detrimental okay so having reliable data make sure it helps you to have policies that reflect student achievement it helps you to measure what your goals are for your students it's a means though of holding everyone accountable for how well we're doing and where we need to improve further but again it should be used in a positive manner otherwise um provide opportunities to celebrate success where are we doing particularly well and let's make sure that we know that we're doing well in a particular area it also removes and depersonalizes decisions that may need to be made because it's based on hard quantifiable data it's not my opinion or your opinion it is what the data shows us needs to be done and so it can help depersonalize those decisions sometimes that's helpful especially with dealing with staff it helps you to make informed decisions around your budget where the needs are because it makes it very clear where there may need to be curriculum revisions or additional courses offered for example it makes it abundantly clear it's a way of involving the community to say you know here's what here's where we are here's where we're trying to go we need you to help us and here's how you can help us and making sure that they understand that as well it helps to evaluate the effectiveness of your policy in your programs keep in mind if you can't measure the success of a curriculum initiative in one year you know it takes time there's professional development involved students have to get accustomed to it staff has to get accustomed to it so know that sometimes you'll have to look at data you can't analyze a new curriculum at the end of the first year and say oh that was a disaster where oh it was a wonderful success because you have to look at it it over time to fairly measure its success okay it will help you to identify both the challenges and possible solutions to it okay two different really different types of data that you need to look at most of what I've just talked about is quantifiable data that can be measured it's hard data people like to talk about as being hard data whereas qualitative data is thought to be quote Soft Data or softer data that doesn't mean it's antidotes right it's other kinds of measurements of things Beyond academic skills that are important for 21st Century Learning and important for our students to be able to do okay so that kind of qualitative data comes from Gathering one-on-one interviews focus groups surveys for General observations over time but it's not my saying well let me tell you how my daughter did Mrs Smith's clients that's an antidote right it's true for my child but it doesn't make the true universally and it's not a large sampling it's one person's opinion okay and you can't just go on that which is not to say that my opinion is infinitely valuable to you however for Mrs Smith it probably has nothing to do with reality okay so you know what are the different kinds of Assessments of data you're going to look at there are learning reference tests there are Criterion reference tests for performance-based tests achievement test versus aptitude it measures what you've learned aptitude measures potential to learn for example okay disaggregated data with the upcoming of No Child Left Behind which was the first real Federal foray beyond the idea which proceeded nclb No Child Left Behind was the very first time the districts were required to disaggregate data to take the data and separate it by gender English language Learners low socioeconomic groups um all kinds of different classifications of students to better be able to identify if there were certain folks who perhaps from lack of opportunity to access courses perhaps it may be for example that the assessments were being given in English and in English is not your first language obviously much more difficult I just tell this antidote all the time because it makes me laugh I picked up one of my children from a High School exam it was Spanish that day I said well how'd the exam go she said my mom it wasn't in English okay that's from an English speaker so think how kids whose language first language is not English would feel taking an entire assessed battery of assessments on a regular basis can be challenging um looking at longitudinal data of a child over time so that you can see the growth and development and measure the progress is something that is very helpful and until this aggregated data was put into place by No Child Left Behind I was a board member at the second No Child Left Behind didn't exist and we would get the scores and we'd look at them and say oh 93 of the students achieve proficiency on whatever particular assessment there was in those days because we had a multitude of different assessments through the years and we all felt really accomplished until someone said to me that's great except for the if you're the parents of one of that seven percent of kids there's not so it and and no one ever said you know you need to look at every child but that is the point and now we have the every child's which followed No Child Left Behind it's really in the reauthorization that the elementary and secondary Education Act which has very specific requirements around it the same way no job right behind it and it does require have these data and they've actually expanded the number of subgroups that you have to measure now some districts don't have enough population and in New Jersey our group number for deciding data last time I checked was 20 students it was interesting because if you compare States and rate states based on their education for example with No Child Left Behind the end number for the subgroups right we had to measure in Florida for example when it was started was a hundred kids well based on that you don't have to do very much Division and it makes your District look much better in many ways on some of those standardized assessments but New Jersey who's always been number one or two in the country for Education trading with Massachusetts typically on and off through the years has an in-group of only 20.
