you know there's different hours for different grades and um if we are using our partners from 9 to 12 then what's happening with our classified people from 9 to 12 where are they going to be um I do not I just want to make sure we're not violating the contract to CSEA but also I have not heard anything about CSEA where they are in all of this you know um did we negotiate with him as to what their job duties were going to be or are they you know going to be working from home like the teachers are are they coming in um you know for that I'm sorry on my part that's my fault I should have followed up after we were well while we were going through what the teachers were going to be doing and I'm wondering now what is what is what was said for us what did we settle with CSEA for this covet you know because now that you're saying that our partners from aces are going to be doing this um they're going to do the children will be virtual with our teacher that's that's where the certificated part comes and we're covered but now the ones that are going to be helping them I think you I I understood that you said earlier that a staff from Asus was going to be doing that so what is classified going to be doing can I answer the question well I hope so please so I told you it's trustee Marquez that the the parents are going to be working with the teachers so there's no change to them and that's why we have not engaged with CSEA yet although Pera I'm sorry I didn't understand that I share with you if you remember we were talking about a Kinder example I share with you this afternoon that the parents are going to be working with the teachers so if the teachers are working from home the parents are going to be working virtually thrusting bookmarks they're going to be working virtually from their home they're going to be yeah yeah oh I I'm sorry I did not hear that or I didn't understand it but now I understand that the teachers are working from home and so the pair uh the classified staff will be working from home with the teachers correct so then they're at home and the people that are going to be with the students so that when they're doing work with them they're going to make sure that they're logged in and they're on the page talking to the teacher and then they're also going to be there for when they're doing the the packets you know it's like you know get off the computer and you're going to be working on this and that's when Ace people the a staff is going to help them with their packets and explain the instructions correct potentially we don't know yet potentially why do we not know that remember I talked to you about this earlier not about the potential oh I see can you explain it nothing okay you know we okay I see that I hand up from trustee Herrera Loretta so I'll go to trustied thank you um and then I hope to save some time and as Dr Bauer mentioned that this is going to be similar for Many Items moving forward so I won't repeat it um but some of us have the luxury of being at home with our children and you know being there to help them you know connect um and have the luxury not to send them anywhere um but many in our in our communities do not have that luxury they don't even know where they're gonna sleep tonight or where they're going to connect um so all those things right like as a as a trustee we get to um to look at that and you know continue to work with our staff and our staff need to look at all of that to ensure that all of our students get what they need and so this is one of the many puzzles that is needed in order to give our children what they're going to need in order to be successful as you know we've heard some of our parents you know um Don know what they're going to do don't think they can help neighbors that we heard about and so this will help provide that space and place um safe uh with you know the internet connection with the support uh that they'll need in order to be successful in their education um and so um you know I just want to remind all of us you know I know um some of us have the luxury of saying I don't want to go over there because I might you know get covered but and you know I want to ensure that our staff you know we're going to do oh and we're going to take all the precautions that we need to by state Vice County and directives in order to make sure it's clean in order to make sure that our staff have what they need um and I know things together will also provide that and all these other uh um organizations that that will be hired to to make sure that we have those resources for our schools so um you know might be different right and so I don't know what ilaria talked to the Lord is about but I do know that things are changing right and so just like we knew back in March things changed from one day to the next things can change back here too right so right now we might need places to just have people help kids log on and then we might go right back to a regular school year which we're all looking forward to having where you know our children can stay and do after school activities and art you know projects and sing and dance um so yeah we get to move with what we have um and so I just want to remind us that you know again some of us have that luxury to be like no our children going and you you know and some of us don't and so we get to do um the best we can in order for our children um our entire student population to have what they need in order to be successful um and so you know with that said um not just because we provide these resources every year but especially this year I will be supporting this item and other items moving forward okay trustee Quintero I'm unable to tell whether or not you have something so I'm just gonna call and you could tell me whether or not you have something uh no I well okay Dr Bauer the aces funds uh you already talked about that I was I I wasn't sure if you had clearly stated that this comes from State ments that they have to be spent with for yeah and you mentioned the list so I just want to make sure to clarify for those of that questions that this isn't some sort of like extra stuff we're doing it's funds that come from the state we have to spend them on support for our students with particular organizations okay so I do see trustee Chavez and trustee Marquez with their hands up but I also I want to let my colleagues know tonight um for for I'm gonna you know we'll have these two quick questions um but then I'm gonna call for the vote on these I really want to move through these items so certainly all of us has our opportunity to ask questions or you know Express whatever we need to but I am going to try to move through these items to get us you know get us get the action that we need so go ahead um first trusty Chavez I saw the interesting Marquez and then we'll call for the vote so the trustee just finished saying that this is what we need to help the students wouldn't the students be better served with more I.T support especially through this distance learning uh there's been a lack of so wouldn't the resources be better spent us supporting the teachers in that way and the students and the parents yes and this will help I don't know please let us know who you're directing your quest if you're asking a question um I don't I don't know if you're asking trustee or Dr Bauer who are you asking trustee Chavez no or just a general question statement and then the one who was next was trustee Marquez and then the other trustee jumped on but you asked a question about um wouldn't it be more beneficial for okay thank you for that clarification oh my God testing Marquez you have the floor yes and you know what maybe it would be better if we can ask trustee Quintero that we could see him so that he he has his hand up or not and not just jump in um and I I know I got I got a text from um one that's in the audience and said we can't tell if he's speaking or not and then he just Jim says he says no and then he starts talking so I guess they wanted me to bring it to your attention and I did but let me let me do my thing now um so you know I had hoped that some of these contracts because no matter what we say that contracts don't cost us they do cost us sooner or later down the line you know Partnerships always ends up costing the district and um very rarely do we have one where it doesn't end up costing but because they were not going to be students and they're all doing it from home um I thought that I would not be seeing some of these you know um some of these things contracts on on the list and um and Dr Bauer told me and I understand why this one is on but we have to pick and choose we can't have all of these after school programs back because we don't have kids you know um they're at home and we don't know how many we actually gonna have from the list that we were given about the homeless the special ed the you know the foster child foster child and you know all that list we don't know how many so those programs are costly you know they're over a hundred thousand and so I think that um when I hear um some of the speakers that they believe that it would be better spent you know uh instead of a contract going out given the status where we are that we have no money and stuff we can utilize that money um it used to be before that it was restricted and I don't think that's restricted now but um Having It upgraded or having more staff with I.T so there are support you know ready to go with all the teachers and all the parents that are out there or they're calling in like I can't log in I'm I'm the first ones to say you know I forget from one month to the other month I'm going oh like what was I supposed to do to get back on I do not use a computer on a daily basis and if the parents you know are having problems to remember because this is new to them then some of these contract funds should be able to be used you know are utilized best for other purposes like you know upgrading it or upgrading our our spots or but um I know that my granddaughter hasn't gotten a computer yet but I know the glitch there is that the principal is gone and the new one hasn't been gone you know hasn't gotten there but I'm just wondering now what kind of computer is my granddaughter going to get if she's going to be one of the last ones to receive it and here we are a few you know a few days before the you know we we start school so um again I had hoped to see less contracts of this kinds of nature here today okay thank you for your comments so I will call for the vote I will withhold my comments in the interest of time um and I'll call you as I see you on my screen trusty Chavez no trustee Marquez no trustee yes Quintero hi myself yes motion passes with three in favor trustee Chavez and trustee Marquez in opposition we'll move forward to item 5.02 approve YMCA TK Kinder contract is there a motion for this item motion to approve there's a motion on the floor and okay uh was trustee Marcus did you say can you yes I did okay a second from trustee Marquez uh Mr probate comment on this item Mr Gill because there's one I don't even okay Veronica when you begin speaking and we have the clock and the clock is ready so your time will begin when you begin speaking Veronica are you do we have her unmuted Mr Gill thank you all and I just wanted to really again Ask right because we're having those after school contracts and in the platform which was again it had some so many great strengths a lot to definitely um a lot that we can definitely work on not looking for prepaid for Perfection we're looking for collaboration with with parents um and with that um I just wanted to know about the this TK program and Kinder I know it's not new I understand that um my daughter has been served on that program and I definitely love this program but I do want to know how is it going to be enhanced in this virtual learning um this isn't a really crucial question right because um again we heard parents um again myself I'm going to be working and I don't know how I'm going to you know sit at TK student in front of a computer that you know with an IEP right so I really want to know how the enhancement is going to be with this virtually during the first semester um and thank you so much thank you Mr Gill next person no more okay thank you uh board members are there questions or comments on this item keeping in mind that my statement on the last one that I am going to be trying to move us along so um potentially idea not even potentially but likely we'll all have one opportunity to speak on most items so so try to get your comments in in while you have the floor and and do so you know efficiently all of us uh trustee Chavez I have the same question so this is the same type of teacher that is not credentialed certified or anything is that correct yes or no can I ask that to Dr Bauer yes or no doctor these are my teachers thank you okay anything else trust each other before we move it no thank you thank you um any other board members with questions or comments I have a comment okay I'm supporting this because um we have all agreed on the table that this is that we catch them young we can keep them or we can we can keep most of those kids and we have lost so many students I know we have dropped from you know from 10 000 last year to down to 8 500 you know ever enrollment of students that you know are enrolled and and I'm kind of just cringing to find out what my enroll our enrollment is going to be this year but um I'm going to support this because the earlier we get them the more chance we have of building up that enrollment so for that reason I am going to support um this 2K program thank you thank you any other questions or comments from the board if this is a quick one trusty Chavez I'll I'll go ahead and short and sweet and sweet it was that's why you you deserve a little more time okay so I'm not going to be supporting because I think that we should be putting the money in towards the I.T because teachers parents have asked for it and that's what I'm advocating for thank you that was short and sweet okay um I don't see anything else um and I'll withhold my comments as well so I'll call for the vote on item 5.02 trustee Chavez no trustee Marquez yes I trustee Quintero I and myself I've uh item passes four votes to one trustee Chavez in opposition um item 5.03 approve the think together Aces contract is there a motion for this item is there a second I'll second it um is there public comment on this item Mr Gill foreign [Music] okay Veronica when you begin speaking your two minutes will begin hi um thank you again uh board members and um I'm when I was looking at this contract um and you know and also the other ones again these are like great contracts for uh students after school programs however I do not see Chavez in the TK and Kinder I do see Travis but in this one I don't and I want to ask why um because I know that the 5.6 um also does not mention Chavez um so I'm not sure I know Travis is one of our schools that needs a lot of support and I want to make sure that we're getting that support to um the Mayfair Community really um so I want to know if later on um Travis Travis is mentioned later on on Behavioral Health but not again not on the after school program so um with what's up with Chavez San Antonio you know again they're mentioned on the TK but not on the regular one um and is this going to be virtually or on site or is that to be decided because we kind of need to know right as parents we have the right to know what is going to happen to our children and who are going to be selected to go if there's any that are going to go um so I definitely really ask for those kind of questions thank you also keeping it very short thank you very much uh Mr Gill next person this is Victor Vasquez Mr Vazquez when you begin speaking your two minutes will begin [Music] talking about opportunities to provide assistant after school programming I know that's not going to be like normal and I know with the staff and the leaders out there executing these programs that it will be in a creative way and in that sense and yes I I just want to clarify again too like yeah these might not be teachers but these These are certified uh students who and professionals that have to meet requirements educational requirements to even be considered to apply and aside from that they go through a process of us of training and figuring out how to work with the young people and I do agree just questions around like Chavez um and Lee Madison and all in our schools that you know I I'm are not some some need so just some questions around then and thank you so much for thinking about a creative way of providing services to students okay thank you uh next person Mr Gill ES hey Miss and they ask when you begin speaking your two minutes will begin yeah um I just want to say that um I'm really thankful for this program uh they are in my son's school and the director is a wonderful person who does a wonderful job I just want to say um I have a a question are they going to be getting paid Hazard pay if they are going to be um seeing kids on site because a lot of them don't get paid enough and they do a lot of work um that's just my concern if they are going to go back on site with kids I don't know what um Dr Bauer's plan is I know they're doing virtual but then I also heard that some of the schools will be open for uh child care so I want to know if this is why these programs are all getting approved because they're going to be collaborating and working for child care and if that's the case are they going to be getting Hazard pay and uh safety uh mask and all the other stuff to keep them safe that's all thank you thank you Mr Gill next person well no more comments okay thank you so are there questions or comments from the board trustee Chavez and then trusty Herrera yes the last speaker brought up some questions could uh those questions be answered and then I'll ask my my other question because those are also questions I have and community members have asked me hey you know the same questions that she just addressed um can they be answered now so do you do you wanna what are the individual questions I guess that you want to um she asked about Hazard pay so usually hazard has a thing that are if they are getting Hazard pay I don't know how much that is I don't know if it's you know one times one and a half or two times but wouldn't the money be better spent towards I.T or getting that better getting them the kids help and the parents help because we need the parents to help the kids log on and I think we should be putting more resources towards that because I heard in the last two meetings on the board meetings that they they needed help oh since last board meeting one parent said that six of them in the same apartment complex didn't have the computers and the connectivity did they get connected so okay so just so you can continue after this but just I heard two questions there so far um the hazard pay and then if the people got connected is that accurate uh yes but she also asked other questions so so for to start DR Bauer can you answer those two questions Hazard pay and connectivity for the six people can I also answer if it's okay that the schools that you don't see tonight is because though that contract was approved last July for example Travis and Madison and all of those are City year schools so that contract it's already taken care of just a reminder for everybody so the other thing is because they are their they employ their own people we don't get involved in those negotiations that those organizations have with their own employees that's not a responsibility so I I don't I can't answer that because I don't know how they work with their own people there are different organizations we are Contracting with the organization not with the individuals okay so these people are guessing are getting Hazard paid for child care and are and if that's the case are we paying too much for it is one question and um but I'm sorry can I in so the question Dr Barr just answered is that we don't know whether or not they're receiving Hazard pay because they're not our employees so however that contractor decides to compensate them that's that's what they decide to do with how they disperse their funds is my understanding are we overpaying is what I asked for child care because that's what it is it is child care we get a better that's my question is that rhetorical or is that uh no that's a question I said that's my question not a rhetorical question that's my question and is it directed towards anyone or just uh yes uh whoever can answer it the best well I I would disagree with the um statement that it's child care administration I mean Dr Bower I'm sorry well I'll just finish my statement now that I started I would disagree it's just like I would need Administration to answer it so I would disagree that it's child care I know that I are very familiar with the program and there is an element of child supervision certainly to the program but it goes beyond that unless they're doing something different but I assume that they're running the program in the same way so it is more than just child supervision or child care I wanted Dr Bauer to answer the question not the president thank you oh I thought you said anyone you when I asked you who it was to you said anyone you're not Administration I'm anyone but I will pose it to Dr Bower then thank you doing services and other activities um we have not talked about child care right now the only ones that we have uh talked about doing some other different things was City year and I mentioned them in my comments um the board is approving contracts with the different organizations to provide a full year of tutoring and other support um we do have a big question mark about when are we coming back on a face-to-face we don't know that each of these uh vendors have to deal with their employees the same way we all have to do our own negotiation with our own employees so I don't know how they pay all I know is that this is the contract that we have um these are funds that are allocated for Aces we cannot use them any other way so if we don't use them we lose them okay so I'm gonna did I see trustee Marquez with I just want to make sure we give everybody the opportunity I think that was like four questions trustee Chavez so let's see if we can maybe your questions can I get one more quick question quick quick now okay yeah go ahead okay so uh what was in a meeting with them parents that uh it was told to the employer parents that it would be child care thank you okay thank you trustee Marcus did I see your hand up yes you did um you know I'm going to make another comment because I've heard very many good things about you know this program um but again it's an after-school program and I did not expect to see these programs on here because after school and I don't know why but this one you know it's a million dollars they are split up it's you know it's a I mean it's 800 000 on this one and then 200 000 on the other so we're looking at a million dollars from our you know from our um lcat money I think that's El Cap I'm not sure no it's not El Cap okay um it's the from the Ace Program no yes this comes from the Ace Program so um if it doesn't come out from the budget and and Ace is putting in for it how much are we putting in you know we have to we have to have been putting our share in there and I just don't remember because I believe I asked this question a few years ago a couple years ago or maybe three years ago uh because I I thought that was a lot of money but then um is that a question for Dr Bauer Dr Bauer can you refresh my memory as to what our share of cost is for this program that right now we're looking at at a million dollars but it's coming from the ace because we applied for the AIDS right it's mostly Aces Aces after school programs Services right the majority of the funds I've I've been asking staff uh there is no this is 100 Asus program I just checked with Renee wonderful I I I thought that we were going to end up losing this because of the covet because the governor has said no kids back to school you know nobody goes back opens the school so I I thought it would lose this grant I'm happy to hear we still have it it's not costing us anything and for those parents that have said wonderful things to me about it I um I I want to congratulate them that they're still going to have it hopefully thank you thank you I think I saw your hand yeah never mind uh time wise I'll just pass okay uh trustee Quintero um again I'm not sure if you have anything so if you do let me know if not oh we talked about the this in a previous item so let's just move on okay I do actually have one comment um and so for now I got mixed up we're in 503 right yes correct just open up my item here well I don't need to open it um I just want to appreciate um this particular uh contractor for in particular the way present they present to us their expense allocation plan and what they submitted to us so it's very it's detailed enough in terms of how they will allocate their spending to what um full-time equivalents or or technology or or curriculum it it clearly spells it out so when when organizations that are that are working with us provide us with this information and the number of classes they'll provide or students they'll provide service to then that allows us to do a calculation to determine the cost per unit or cost per student or however it's it's being delivered and so I would I would request and and hopefully we're able to standardize some thing that looks like what we see here in the think together um documentation so that as as board member going forward as board members we won't have to ask these questions or or have these questions from the community um because it'll be clearly uh well hopefully we won't have those questions because like I said with this information here I was able to easily calculate the cost per unit and then compare that to the other programs to make sure that the services that we're getting are equivalent or roughly in the ballpark of you know what we should expect for an organization providing this type of service so um I guess that's a recommendation or a request if we can think about how we can standardize something like this type of documentation and put it into each request for our vendor so that we can see that and and do that type of analysis um so I'm going to go ahead and call for the vote on this one just in the interest of time um and I will call you as I see you on my screen uh so this is to approve item 5.03 trustee Chavez I broke it down 15 930 for nine months no Rusty Marquez yes myself I motion passes for in favor trustee Chavez in opposition item 5.04 approved the maximum healthcare staffing services man but it was an eye so you got it wait say that again I said you won't call out trusted Quintero that was an eye so you got it thank you I'm sorry about that sorry about that yes I mean I uh if you're able to work on that camera issue I'm assuming you've tried and you can't we've all had technological problems each every single one of us and so that's just we need to expect that going on forward um and so so that's I just want to make sure that I'm keeping you in this as we move along because I can't see what's happening um item 5.04 approve the maximum healthcare staffing services contract is there a motion for a 5.04 motion I heard a motion from trustee Chavez is there a second second Ed [Music] um I mean it doesn't matter to me so whatever you heard I guess okay so um is there public comment on this item Mr Gill yes there is one from that day who is it Veronica yeah Veronica when you begin speaking your two minutes will start great thank you so much um I was I thank you so much for putting this on the agenda um you know it's much needed especially for a special education students um they should be at the Forum um of all of our priorities um I also do want to mention um that we're going through all these questions and because of a lack of transparency and a lack of collaboration right if we were able to collaborate together if we were able to see more of what people are doing um here in the board and we were able to read more um you know put it more on the agenda I'm going through the agenda book but still it is not all the information is out there if we were able to see that then I don't think we would be spending so much time going over um all this items if again looking for transparency and looking for collaboration right um because our students such as special education need this they need it they need us to collaborate and unite and they need us to be not us because our parents we're very transparent they need you to be transparent they need the board they need the uh Dr ilaria Bauer they need um you know the staff to be very transparent on what is happening because without that we are now working together everybody's are all over the place and we can see it with this board meetings uh thank you so much thank you Mr Gillen next person no more okay so questions or comments from the board on item 5.0 I just lost my place zero four trustee Chavez um this is money well spent for the health for the students I'll be voting yes on this okay thank you any other questions or comments okay I see none and none for myself so I will call for the vote um trustee Chavez yes trustee Marquez yes hi trustee Quintero hi and myself I motion passes unanimously thank you item 5.05 approve the thing together TK Kinder contract is there a motion for this item to approve motion motion and second um is there public comment Mr Gill [Music] as okay Mr Vazquez when the clock is up and You Begin speaking your two minutes will begin uh yeah thank you so much um Dr Barbara for also answering the previous question um real quick yep these These are after school meets that uh I mean extra academics for the students need appreciate you all bringing it on and making it thoughtful of making them on site or virtual whatever is necessary with the flexibility that we will need moving forward and um because you know just to clarify like after school programs and this is this this is not necessarily about after school but overall these kinds of programs Provide support for a lot of the students who are probably going to be alone who might need a extra attention um you know I growing up my mom was a working mom uh we would we would spend enough time on ourselves alone and you know at times there's not a lot of adults or extra support that would help us uh with uh our academics and so I appreciate you all for doing this um and in general I appreciate the collaboration with SJ learn and I guess in some way right um but I think this is a good example of like how when I wouldn't say collaborate I would say as we think moving forward what are the ways that we can put a little nudge in our city budget uh and ask you know why why are we having to spend why do we have to pay you you know or why do we have to carry some of this weight when in reality they have a lot bigger budget than we do um but I think that's a different conversation and hopefully in the future we can think through that together thank you next person Mr Gill is [Music] okay dibsa when you begin speaking your two minutes will begin do you remember I would like just to say thank you for bringing this um item in here and I hope everybody um agrees to pass it why because as a parent of vanilla School District student as well as friends that have utilized and I'm gonna completely realized on this kind of programs especially academically it has been a great help for my for my students and for and for the their academic achievements um once again I think these are hard times people are gonna be needing the extra help especially the students that not only contact or real thing outside the world is their school and the people they get to see either be assume or in these cases if it is a if it is available for some of the students to be able to have a safe place to go and actually have school it will be even a greater impact so thank you very much and as I said I hope everybody passes thank you Mr Gill next person Veronica Veronica when you begin speaking your two minutes will start hi good afternoon again um and yes I also want to um just uh amplify again the voice of like this programs are amazing and um you know being a mother um that and that has been using those um the after school program and having to work long hours this has been really great on my daughter I know that it has supported her and her reading um but we also want to make sure that you know like somebody else said earlier I think um it was another speaker we want to make sure that how are we informing those Partnerships and making sure that those Partnerships are not costing us money right that um such as with the city how can we um because we are paying uh it might not be for this one but for other uh stuff how can we make sure that the city is actually creating those services for our students who are its constituents and its citizens right um so but thank you and moving forward we definitely need more programs like this um and after school as most of our students are alone in most of the time or don't have anybody to stay with them many adults and this kind this program's really put them um you know with people that care for them and that go beyond their you know just academics really um so thank you so much thank you Mr Gill next person no more public comments okay any questions or comments for the board on item 5.05 trustee Chavez um one of the comments that uh Victor said was when do you know we need all this costs start coming to us as an Ali-A we're supposed to be local educational agencies and I've always asked the question why did they allow the city and the county to start making the district schools pay for all these programs when it's their responsibility to help as well so we do have to be better advocates for them and on this one it's not as much money and this one I will be voting for thank you thank you um any other questions or comments trustee Marquez thank you um you know I am I also wonder why um why we can't you're cutting out why we're letting you're Frozen trustee Marquez if you can trustee Marcus if you can go back to when you said why we can't because you froze after that others come into our facilities without pain in um the the square foot of a of a place you know goes for a lot of money and that's Revenue coming in we really have to look at who's using our facilities and start bringing some of you from those who want to come into our facilities you know we don't we should be leasing or renting or whatever it needs we need to do but if um you know um I I'm just saying that I'm not comfortable with just letting people use our facilities when we're in such dire need for extra Revenue thank you thank you I don't know if that was a thumb oh go ahead testing my kids thumbs up is my way of letting you know that I want to talk so thank you I think trustee Marcus just had one final statement sorry about that I'm going to be stepping away to go to the ladies room if you don't see me here it's because I I you know I um I I have a problem and it's a medical problem and I need to you know deal with it so okay thank you for letting us know um trustee Quintero um yeah I'm I'm just perplexed at the [Music] um some of the issues that are being raised uh about the city and you know we saw the contract there it was an Aces contract and so they're basically the equivalent of another non-profit that's trying to bring over programming and we're just Contracting with them um so I don't see that as handing over our general fund money to the city or anything like that this is State money intended for a particular purpose uh with regard to reference to the county the Partnerships that we've entered into the county with the county uh have brought us resources money to pay for counselors and school psychologists and all that type of stuff so I'm not sure where this is coming from about us handing over tons of money if we continue to say that people are going to start to believe it if you're here as a board member and you continue to talk about how we're handing over tons of money that's irresponsible you need to actually identify what where do the resources that we have handed over if that's the case because what I've seen is our Partnerships uh with school Link services in particular have brought us uh a lot of money a lot of resources that we otherwise wouldn't have we've paid for staff to be able to lend support to our kids um and so yeah this Aces stuff with the city is is a contract and it's using State money that we wouldn't be able to use for any other purpose other than these after school programs and they happen to be another contractor they can provide that they provide those type of services for sports uh on a fee for service basis and um you know they provide great Services I appreciate the services they provide this is just another type of that service they provide so I just wanted to express my concerns about some of the comments that are made we shouldn't uh continue to pass along an idea that may not be true okay thank you um so I don't see I I the comment that I wanted to make is uh actually two things make me think of it number one is trustee Chavez and the previous item when she said this money well spent and then trustee quintero's comments right now um when I I wholeheartedly um support and agree with what trustee Quintero just said these services are are you know we talk about bringing services to our district and supporting kids and families and that's really what all these are and and and it's not just the numbers of the programs it's it translates into real life outcomes and I'll take this opportunity to to acknowledge a couple of things so my daughter one of my daughters is I mean they're both proud graduates of Alum Rock and they were both in some of these programs and I know for a fact that they got a lot out of them to the extent that this past week my daughter who's now in high school was published in the Harvard educational review for an article that she wrote and so and we we have many other Alum Rock students that have been recognized at National levels for thing accomplishments that they've had very impressive and so I don't think you know our teachers do a great job in the classroom but the supports that we provide to students beyond the classroom I think is really what helps us to create that whole student and um and it's shown in actual real life examples that we can see you know every day as we have Alum Rock students coming back with their accomplishments that they've done and I'm a believer that it's because of this this support that we're able to provide around students so I will be supporting this item um at this time I'll go ahead and call for the vote then on the item item which will be on 5.05 uh trustee Chavez they've been given the burden to us no no trustee Marquez Quintero hi and myself I motion passes four to one with trustee Chavez in opposition item 5.06 um approved the YMCA Silicon Valley Aces contract is there a motion for this item is there a second I'll second it there's a second motion and a second on the floor is a public public comment for item 5.06 Mr Gill none okay thank you are there questions or comments from the board on item 5.06 oh the question man okay um so I will we do have a quorum so I'll call for the vote as I see you on my screen trustee Marquez yes trustee Quintero hi myself I motion passes three in favor to absent from this vote I guess is that the proper terminology to use Mr Mr Ruiz I think that it's absent too absent okay okay so motion passes item 5.07 approve mou with the county of Santa Clara Department of Behavioral Health for schooling Services is there a motion on the floor so move I'll second it as a former uh employee of schooling Services the original the original version um is there any public comment on this item yes there is one okay who who is the person Mr Gill Veronica okay Veronica when you begin speaking the two minutes will begin do we have her muted Mr Gill or does she need to unmute yeah someone needed okay okay go ahead thank you um I am very proud of um this program and pushing it Forward I think this 100 000 might have come from the work that the community did um so congratulate to everyone in the community now as well as you all for passing the black lives matter um memorandum and uh again kicking uh not kicking positions sorry um ending the contract with the sros I was at sros that was a hundred thousand so this is what funds now into mental health and this is the programs that we need even more into uh with here our kids um you know and healing our communities definitely um and bringing this awareness of trauma right more into into our communities and what it is and how it affects us all so again uh shout out to everyone out there in the community and to the Board of Trustees that pass this um most likely this is funded from that contract that ended with the San Jose police department so thank you and and let's keep moving forward okay um just uh Mr gear is there any public comment any further public comments yes there are three more Vector Vasquez okay Mr Vasquez when you begin speaking your two minutes will begin yeah thank you so much um these types of health services are necessary for students glad to see that continued collaboration with the uh or County and just because we say we deserve more we want more we should work together to go get more for our students doesn't mean that we're done playing what's already happening there's no need to to feel that way it doesn't mean that it's alive the theme so far has been hey I don't want to vote on this because of money get some money that's not going to get us any solutions it's going to get a solution is keep keeping the things that we have going on keeping those Partnerships pushing for these resources from the city from the county from the state from wherever we need and uh being okay with saying hey you know we deserve better we deserve more right we deserve what other schools got and so I I just want us to one not think that that because we're saying that why are we having to pay a little bit to a city entity or someone so now that we're saying we don't want this no that's not true we want these services for our students would you think that we can work together to say hey City we want more funding County we want more funding and doesn't mean that it's not a good job that's happening it just means that we want more because we need it and we deserve it so that's all thank you thank you so much okay any other public comment Mr Gill [Music] then that's when you begin speaking your two minutes will start hi um I just want to say thank you for everybody that advocated for these kind of services I think that our students need um emotional and academic success right and these services will help them not only behave really but just overall with everything going on um it might not seem like a lot but it will do a lot with our kids um thank you to the county of Santa Clara Department of Behavioral Health Services for this and thank you everybody that Advocates and I see you guys all at the County Supervisors meetings ICU float ICU thanks I see you Veronica I want to thank you guys um because the more that we Advocate and um speak on behalf of our kids even if it's one or two three meetings we'll eventually be heard and I'm glad that we have this mou thank you for all the trustees that supported this as well um I know that a lot of you I spend your time in these meetings advocating as well so thank you and that's all I want to say thank you next person Mr Gill is dilzer okay dilsa when you begin speaking your two minutes will begin other than echoing everybody that just spoke I just want to say thank you to the dresses and thank you to the staff for bringing in and really thinking about where is the money needed right now and right now it's social emotional behavioral behavioral therapist why because our kids are going to crochet moment they're stress their anxiety and um their levels are at the roof our parents and our teachers as well so having this kind of programs coming in and supporting our students that most vulnerable students that we have allow us to grow and move forward this is moving forward this is actually doing our work together and understanding and having communication knowing exactly when and where to invest the money and what programs we need to be able to be successful so thank you everybody that brought it to the table I hope everybody approves it and let's keep on bringing this kind of items let's keep on bringing these kind of programs and let's keep listening to that Community because we know what we need we know exactly what children need to be successful so thank you for listening and for bringing this mou thank you next person Mr Gill none okay any questions or comments from the board on this item trustee Chavez and trustee Marquez I'm this I'm surprised it's only 100 000 because especially after this covet thing kids are going to really be needing this so if it comes to the board again uh for more money I would say you know I would be in favor of it and sorry for the short office break but I had to do what I got to do uh thank you hey thank you trustee Marquez yes um I just wanted I know that the parents don't get um the book I don't know if it shows the back up like we get it I don't know if it's online if the backup is online for them to look at it but this one is exactly what I had told you earlier every partnership is going to cost us I'm going to support this because it's at a hundred thousand and this program is going to cost us five hundred thousand dollars but they're paying 420 something for it um you know 4.2 uh I mean 400 and what was it 421 000 is what they're they're coming up with and we need to come up with a hundred thousand and it's a hundred thousand very well spent I don't mind doing these kind of Partnerships but when you know the cost is way up there and we have other things and bills to pay I have a problem with that so I I'm very happy to move forward in supporting this hey thank you any other questions or comments from the board trustee I just uh want to highlight the fact that you know these Services um are definitely needed in our schools um and you know redirecting um any funds that we can you know um like when the parents mentioned um in regards to uh closing up um and ending the contracts with the police um you know these are the kind of services that I look forward to continuing to support um outside of the classroom of course um so that our children can be ready to learn and that our teachers um can be there to teach our kids and not having to support them with additional um you know uh additional uh issues that our children um are facing with on an everyday uh life especially right now during this pandemic I think the stressors you know have right risen up for all of us you know we all have uh we're dealing with a lot more including our children so I'm happy that we're providing this resources and services and um yeah this is a great example of our school um our district collaborating with the county in order to provide these resources to our children um so I will be supporting that okay thank you um I don't see a thumbs up so I'm assuming you're good um I would just say as I mentioned as a number one as a former worker within this program I'm familiar with with how they function and it's now been um in existence for many years and over those years they've really honed in on some best practices and provided excellent services at many levels and as as a parent a former Alum Rock students who also um were were impacted by this what what this um what schooling services does is really not even just in like individual or group Behavioral Health type Services they they really build community in a lot of our schools and they bring families together they bring resources into the schools they they do many different things and I think it's a it's an excellent program that's that's proven over time and so uh to Echo what everybody I think is saying it's a this is a very good expenditure as far as I'm concerned and in turn especially in terms of how we're leveraging um the resources that we're offering along with the county so I will support it um at this time I'll call for the vote on this item um trustee Chavez yes thank you trustee Marquez yes hi trustee Quintero hi and yes for myself motion passes unanimously thank you everyone we can move forward to item 6.01 approved csba membership dues motion it is a motion on the floor is there a second second by trustee is there are the public comment on this item Mr Gill none okay are there any questions or comments from the board no trustee Marquez just to clarify [Music] um trust tickets at all the one that made the motion I mean I'm sorry the second bit whoa verification [Music] um so I actually don't remember who who moved and seconded motion I actually I seconded both we did at the same time so whether it's him or I have no problem with it okay so motion Chavez second team yeah okay um so trusty Marquez you had your hand up so this is an item on the agenda that it just really hurts my heart my I mean literally my heart to um you know to go with and um because we really don't have I mean we don't have no urgency csba is not going to be doing much you know it has slowed down everywhere um I think that we should table this and deal with it for the October meeting um because um this is an organization that has very little almost no representation but very little representation of Latinos at at the higher level um is um it's it has been in the 12 years I I have been denying and denying not not to join them we should be joining other people but because they're the only ones around um they really have us by the you know what and where they're forcing us you know to use them because we use their services legally and services for resources um but they they're their organization is is done in a matter where they're they keep us from you know from Excel getting into those positions that we want to get in there we're lucky to have um I believe um my colleague quindero I think he's still on the um I think he's he's still a part of them right now I'm not sure but um there's just very very little representation for us and knowing knowing its effect and its data and there's data all over it that our schools in California and 1001 schools the highest number of students attending those schools in California are Latinos they have a 5152 percent students in those and we are hardly represented up there for csba and it has been going for years and and in the manner of how it is done it's hard for us to get um to be up there when the decision makings are going you know are happening um they have gone against or has stayed out issues that have affected Latinos and right now you know just it doesn't come to my head right now but I'm sure Andres knows and he can help us out but um I I am hoping that my colleagues will wait till October meeting and then we can send the money I don't want to send money like right now you know they don't need it and um and it's a shame it's really really a shame because we have very little representation and it just drives me crazy that we have this this organization that does not um you know that it doesn't matter you know we've asked them can you change that I'll give you one example that really bothers me we have a small District let's say Orchard down the street in Downtown San Jose very small District right and we're over here at you know we've always been at 16 000 students you know fifteen thousand ten thousand we're now unfortunately at 8 500 students but that's still more than Orchard and yet they have the amount same amount of votes that we have and I'm like whoa you know there's something wrong with this picture let's let's redo how we get our representation up there okay thank you trustee Marquez and trustee Chavez I saw the interesting Quintero I disagree with what she said we've gotten a lot of information from csva I'm always on their website and finding out things that if you remember it was them who also in in with the county helped us when we uh elected the when we appointed Excuse Me Not Elected when we appointed the trustee so they've helped out in other aspects they're also the ones that do the Masters in governance class and there's I know that they've been helpful when the district has asked for information and they Supply it as well as some of the stuff that I'm going to be speaking on um the lawyers that on several different kinds of contracts um they put out all that information for school board members to help them so um even though you may want more representation because we have more students I think it's more Equitable that each school has the same boat because imagine if we were to get the same things that the other uh counties get of the other districts get and our boat counted just as much as them we might be getting funded more so I think it is Equitable thank you okay thank you trustee I think it was next yes uh and I agree with Chavez um I also believe that we get a lot from them um including all those things she mentioned and I'm really surprised that um uh the Lord has mentioned what she mentioned being that she's been one of these on here that's been the longest because our current president for the csba is chironen Cruz Gonzalez who uh if um she maybe looks at her bio represents a lot of our children you know latino children um so they do have representation um of the Latinos under the president um is shilonen who is Latina and I'm also having gone to the um Latino csba conference um you know I I saw us on there I uh a representation I'm not just at that conference but then later like I said um at that at the state level um so I will be supporting it um they've helped me a lot personally and you know um in my growth um as a trustee in this past year um so I've benefited from it a lot and I know that our future trustees will as well okay trustee Quintero you had your hand I uh I think everybody has made some good points but I do want to acknowledge um trustee marquez's comments um that the organization is is created in a way that it puts at a disadvantage certain communities and it gives an oversized voice oversized voice to rural communities that are heavily conservative I know that might really really excite some folks here but um you know we've stood right there and had some very very Frank conversations pleaded with some of our colleagues and they left us um so trustee Marcus does have a point that the structure of the organization had there's some very very serious issues basically the Electoral College uh here in California for school boards um however I know that doesn't negate the fact that we do get good services from them we did our agenda uh service from them and we do get information um the the legal uh defense Alliance I used to uh oppose our involvement in that because uh trustee Monica does bring up a good point they left us up they left us out on the lurch while we were being attacked and it was ultimately discovered that it was actually lies that some of the premise upon which the case was brought before us and we were including the case never even existed and so that was very disheartening that we were left out however um we stopped pain I think for a couple years and after that I know um the legal Alliance has paid off uh in the in uh some of the lawsuits that they've um launched against the state to go ahead and pull down some more money for districts in the areas of um students with special needs in other areas so once I saw that I was more supportive of them and that's um you know I was willing to get back on the legal Alliance so um I'm going to be supporting the csba motion if it moves forward but I did want to recognize acknowledge my colleague Monica's concerns that is there's an inherent um it puts us at a disadvantage uh in the way that it's structured and I've been there when we were at delegate assembly uh pleading with some of our colleagues and they kind of disregard us because it's right it's it's a body that's not reflective of the composition of State of California see thank you my comment will be that I actually um pretty much again Echo the comments of trustee Quintero I do I also feel um the way the the trustee Marquez said that she felt it when I re when I read this and as I've learned over the past couple years about the organization a little bit I'm I'm disappointed in many ways um that have already been stated but I also do agree that there is a benefit for us to to you know to be members and and it does make sense um for that but it's exactly how trustee Marquez said it's it's kind of hard to swallow because you know it's something that you know benefits you or at least I do um but it's like you know it's like kissing you in the front but stabbing you in the back kind of thing and so so you know I mean that might be a little extreme of an analogy but but anyway I will be supporting um this I like that space two very two very quick uh comments trustee Chavez and trustee Marquez and then we can call for the vote well I'm glad that you can get by sometimes um you have to take the good with the bad but we get more good out of this so that's why I'll be supporting thank you thank you trustee Marquez and then we'll call for the vote so you know um I'm not surprised when new people come on the board and they don't know or they've not read or gotten themselves informed about issues like this because this is purely political this is the one that is just totally political and uh here is what I the only example I can give right now is what happens to corporations that are manipulating you know taking over they're bigger than you know bigger they cut the government comes in and breaks them up because it's not there to the consumer these people we have no choice they have to give us top Services we can't go anywhere else because they're the only ones around they're the only ones that are they're big um I didn't get my training through them because I found out it was going to cost me eighteen hundred dollars when I first got on I have to pay them to train me then I got a call from a friend and said join naleo he goes naleo is having a training for all newly elected officials on what their role is really I joined naleo it's a National Association Organization for newly elected Latinos I got my training to that through them do you know how much that cost me zero I didn't pay for the flight I didn't pay for the ticket the hotels the meals nothing I did not pay for anything to get that service and and my colleague others will vouch to what my Leo's about so for me it is hard to swallow because they are the most expensive organization we have ever given this kind of where folks we're looking at almost twenty thousand dollars twenty thousand dollars and we weren't paying them what could we do you folks that are out there right now listening to this we could use that 40 000 for training and and we could start going with organizations that do not cost us this arm and a leg so okay so I'm gonna go ahead and call for the vote at this time thank you everyone for your comments it's going to be a no trustee Chavez yes trustee Marquez no interested hi trustee Quintero hi and I for myself motion passes four to one with trustee Marquez in opposition item 6.02 approved csba educational legal Alliance membership dues motion to approve by trustee Chavez is there a second second second by trustee Quintero as their public comment Mr Gill none okay is there questions or comments from the board on this item okay see none I'll call for the vote trustee Chavez yes trustee Marquez you didn't ask it a comments from from the board I did oh I didn't hear that and I didn't hear it over here you may have bleeped out I only heard and then I heard I'm going for the vote so it may have been a technical thing did you have a comment or a question yes I just want to tell all my colleagues on the board I'm very very can vote for something that is hurtful it is hurtful it it perpetuates what they are doing instead of standing up and taking a stand I'm sorry that's how I feel my vote is definitely no okay trusty Chavez can we go over there to their meeting and let I mean we've approve it but we go to their meet their meeting know that the thing with in one voice one loud voice then maybe we that we can get others to listen thank you trustee Quintero and then trustee after that just to clarify that I was not supportive of the legal Alliance uh uh for several years we didn't pay because of what they did to Alum Rock um leaving us out I've since observed that the alliance has taken up cases that have actually benefited Us in terms of bringing money to the district that we otherwise wouldn't have and so that's why I I feel that it makes sense to support that's why I'm supporting thank you trustee Herrera loera uh the only thing I I would add is um being the newest selected uh or Not Elected sorry not yet uh news appointed uh member here um I would love to hear about other uh resources out there Dolores I wrote down Oleo and I've heard of them but um I'd love to learn you know more from you since you've done to them many years um and also as you know trustees that we support our newer elected members to you know on board and to do their best um so thank you the Lotus for sharing that today that's the first time I hear that um and you know I will support this okay so now I will call for the vote I'll recall for the vote uh since we had uh comments trustee Chavez yes okay trustee Marquez oh trustee hi trustee Quintero hi and myself I motion passes four to one with trustee Marquez in opposition I'd um 6.03 approved csva gamut policy Plus motion from trustee Chavez is our second second from trustee Quintero is there public comment on the item none excuse me um no public okay any questions or comments from the board trustee Chavez um I actually asked the district if they were going to pay for it so that I can get some of the virtual learning classes this year and so there is a cost for naleo thank you okay trustee Marquez I think I heard you say you had to come I have a comment and if you are newly elected there is no cost for you after you have become a member for two years or what whenever they set the price yeah there is a cost nothing to what the cost of csba nothing to what the cost is for csba and they're having continuously training for everything in education and they're a national National Association they go out and get the funds so that all newly elected Latinos can go get all the training they want but for me I just want to say again you guys are part of the problem and not solution Shame Shame Shame thank you for the comment trustee Marquez um I actually would like to post or trustee did you have a question or comment oh I already spoke okay I actually like to pose a question directly to trustee Quintero um since I value his opinion on this so I I hear trustee Marquez speaking to the training aspect that naleo can provide and I'm I'm somewhat familiar with malayo but I'm I'm by no means an expert but with nalel would we in a hypothetical sense would we get similar or the same type of services as we would with csbm csba I'm assuming we would there would be things that would be lacking because otherwise it seems like we would have considered that um but I'd like to try to keep that all you're familiar with completely perplexes to how we're talking about allowance has the new gamut and correct or we we're on 6.03 correct yeah and I'm asking it just okay I am a huge fan um they are an amazing organization that um they have a very modest membership which is 100 bucks and they give you like 10 or 30 times that much in terms of training um and the information that you get so but they're not um csba so they don't focus on schools they do have tracks for school board members so if you go to their trainings they'll bring out experts and uh their um very well balanced in terms of the perspective that they provide uh so they'll have people from different sectors talking about different issues so there's opportunities for training um and uh even though it's a National Association Latino elected officials um there is people from all different backgrounds that join the organization and uh go and participate but they do not provide as far as I know uh agenda services and that type and then the the policy type of stuff that's very specialized in that csba provides for us like for instance next year could we find ourselves here again in a theoretical world trying to approve naleo gamut online as far as I know they don't provide those Services yeah I think that's the for me that's the that's the um you know that's the differentiator I I mean in spite of I what I feel a little bit disparaging comments by trusting Marquez towards me or towards us I still maintain my opinion that I agree with the sentiment behind what she's saying but I just functionally I I don't I don't think that we could get the same services from naleo that we get from csba but um so yes I'll be supporting 6.0 yeah any other comments or questions I don't remember if I skipped anyone okay trustee Chavez the uh item 6.03 yes trustee Marquez no trustee [Music] Quintero hi and myself I uh four to one motion passes trustee Marquez um in opposition um item 6.04 approved csba gamut online um motion motion on the floor is there a second second by trustee Quintero is there public comment on this item Mr Gill on 6.04 none okay thank you any questions or comments from the board trustee excuse me so we could speed these up well I'm providing opportunity for board to have questions or comments before we vote okay but certainly we're trying to expedite things as you might be able to tell um any questions or comments trustee Marquez you know um this is about getting um uh getting uh the lawyers it Andres just told us you know about you know how they left us hanging out there you know this is about what the [Music] um the csba attorneys do right or is this something different are you directing a question towards someone in particular or um when I don't direct it to someone I expect a super I mean the board member to either a superintendent or staff okay so either a superintendent or staff can you answer the the question was if it's pertaining to attorneys was that your question yes okay um staff or any board members can you answer the question for trustee Marcus I'm not sure of the question is this damn it damn it policy she wants to know if it's preparing you to lawyers clean them up for us pardon it's the policies that come to us every month to update they keep track of all the legal changes because there's so many changes and they clean it up for us if not then we'd have to hire uh Rogelio full-time to just keep track of every single change to the ad code to every other code that applies to us okay uh trustee Chavez that's what I meant take the good with the bad we benefit way more from this we save a lot more money by voting for this thank you okay so did you bypass me because I needed the answer so that I could make something and you let um trustee Chavez speak I'm sorry well the answer got answered and I didn't hear you say anything further but if you have more to say then then we can have another opportunity they didn't come back to me you didn't come back to me my point being my point being is that their attorneys that do all of this I want to know now from superintendent do we ever hire an agency to go over our bylaws to bring them to us to update them do we hire them we hire an agency or a group we have to bring them policies I I I'm going to add the policies or bylaws to come to us do we hire an agency that comes and do that for us the gamut no yes I'm talking about our budget here in the district office do we ever hire an agency to go through our bylaws or our policies and say this one needs to go this one is no longer applied or this one do we ever hire anyone to do that I think that since I've been superintendent trustee Marquez we have used gamut and when there is questions for example sometimes you have the each board member has a request and that's when Rogelio jumps in and supports us so that's kind of how it works for example there have been some board policies that we brought to you for your consideration and we're just following gamut right and you or any other board member says you know I don't like this I don't want this you need to bring back right and and we as Rogelio to kind of help us that that because we are not attorney so does that answer your question trustee Marquette so that's how you're answering it over your over your your your watch that's how you use it over your watch during the duration of my time that had been here and I've been here you know for you know three three turns we have hired people like that we are double paying because we pay our attorneys or we pay an agency but you know we pay them like we're gonna pay them now because the three the next the other the next four my colleagues are gonna vote for it so it is that kind of expenditure that is so repetitious that we have other people or we hire other people to come and fix our policies or fix our bylaws or update them or delete them or whatever it is and so for me that double cost or triple cost whichever you want to look at it it is has to stop at one point or another I'd rather it stop with csba and you know what Rogelio and your agency if you're our attorneys I'd rather give you guys some money to do that because I don't have a problem with that I do have a problem with an organization that does not do what they can for the greater need or the greater the Creator group that has be you know that is attending these Public Schools thank you Mr Mr Luis do you have anything that um you think could be of value to the conversation to shine some light or no if it's a it's okay if you don't yeah I mean my view on that is that again it provides a valuable policy service to school districts and you know the the issue is that they develop policies for grades K through 12.
sorry got it right under there all right uh move for the the balance um and seconded hey uh mr o'neal hi mr jabbar hi miss piercy i smith i and i vote i item 1117 make it a motion here i move this item can i get a second second okay but we skipped 10 okay oh brian sorry sorry sorry and you skipped 11 10. sorry i'm so anxious to get mine under there 11.10 um before okay bb 11 10 uh moved and did i get a second second okay uh mr o'neal i've seen mr jabbar aye miss piercy hi miss smith hi and i vote i now 1117 may get a motion i just wanted to uh point out the um again the tremendous work that we do with united way and the generous um grant that they give us uh so that we can continue um our anaheim innovative mentoring experience and it just proves um you know just the with a great partnership that we have and look what came out uh out of the summer and i'm looking forward to um hearing about the the uh the fall program and so just wanted to highlight that so uh calling for the vote mr o'neal hi mr jabbar hi miss piercy hi miss smith hi and i vote i 11 19.
and we do not I do not draft the policies Wholesales or from scratch we use the the gamut form of policies the base and then we tailor it to the specific districts operations so I understand you know board members concerns about cspa but gamut is is a very valuable service to the district I saw your hand I believe thank you Mr Ruiz yeah no I was gonna ask an aster Reese but let's go ahead and uh vote like we've used them a lot I think you know the money is well I mean the 3000 um before 45.
and i will second mr jabar yeah i just wanted to uh make sure that i know i had a conversation with jiren but uh wanted to make sure that this is only a short term uh to make sure that our staff are getting trained because obviously we're going to be using it um so if you want to take the floor and explain a little bit jaren yeah so basically absolutely trust me java so based on the conversation we have the last couple board meetings and and the teachers wanting additional support this is a perfect use of the learning loss mitigation funds to build capacity of our teachers and using the carnegie materials as you guys know you approve the three year but we're have the mass half math task force getting ready to start matter of fact i think carlos spoke with grant to finalize some of the aston members who will serve on that team as well as the math department chairs and other stakeholders that we talked about so whether we use it only for the one year or a couple years it is still important to make sure our folks are trained because we want them using the materials to their best ability and supporting our students so this is a good use of the funds it's the training that we feel is is going to be necessary to support our students and if we decide to move with a different textbook that's also fine the training is still going to be beneficial because it's still constructing the math and as you know with the frameworks being developed when we do go through a process three years from now regardless of whether we change uh next year or not uh the frameworks will be done so we'll have to look at a new text at that time to make sure it's aligned to the new frameworks so yeah this is our hope is to have the training done earlier on in the year because obviously they're working with kids starting yesterday right so this is gonna be an important piece okay i have a question because i i wanted to pull this one too because we are we are paying them hundred thousand dollars for their you know consulting with our teachers but i thought when we were discussing this that um they were going to give us more um time and help as a part of our going ahead and okaying this contract i thought that was going to be part of the you know their sort of their their offering for us to continue with their program but we're paying for it so if there is no other help coming forward other than what we're going to pay for no so this is paying for the professional learning the actual training of the materials the what they're what we talked about with them is they may serve periodically on the math task force to get the feedback from the teachers because as we recall the teachers have had some concerns with uh the materials so this feedback's gonna be important for them to get so they can respond or make the adjustments um if they're gonna want our business moving forward uh you know as we use their textbook after the frameworks or even for end of next year but this is a special training that we it's the right thing to do to be paying for the training because they're going to be spending hours working with math teachers on how to use materials and what it looks like connected to the standards okay well you remind me how many i because when i was looking at the exhibit it was i don't know how many teachers how many hours i mean was it like 40 hours or something like that you recall carlos do you recall tom i have to go back and look okay not on the first um no not not not on this one um see now this is where having your book with all the exhibits i could pull over to the i mean good old printed work i could go back and refer but right now i can't i don't know how to go back to that well i should have put it up on the uh i didn't think about that put it up on the screen in the back i could have gone back and forth huh all right next time anyway that's okay if you don't recall i was you know i just thought you know i can go back and look yeah i'm sliding down but it's taking me a while too yeah well hey that was them you know exhibit emma you know so it takes a while to get to it so that's okay um i don't need it anymore just i wanted to make that comment i mean have we you know i thought we had already paid for it but i guess not okay so this is a hundred thousand we're taking out of our code learning fund okay good remember survey was professional learning as well and this is obviously schoology the business learning this is also part of it and were you talking about the 210 math teachers for 40 days is that what you wanted yeah yes 40 years 200 teachers 40 days yeah that's a request okay okay thank you any more comments or questions i would like to be present to observe during the task force i'd like to learn uh just because i know that concerns come from different people who teach different levels of math and so i would like to learn absolutely absolutely thank you trustee smith i uh grant in fact reminded me to make sure that you're on the list so thank you grant thank you we have you okay all right thank you for bringing this item forward um call for the vote mr o'neal hi mr jabbar aye ms piercy aye ms smith aye and i vote i i'm moving on to superintendent and staff report any anyone wishing to shout out to uh eric greenwood and his team really uh yes doing some amazing work to really save the day for our kids and our teachers so eric thank you so much on behalf of the district and also thank you to all of our teachers and admins and classified everybody pulled it together and um it's another example of the obstacle is the way you guys we're so proud of you all thank you thank you superintendent anyone else wishing to give a report no no okay i'm getting lots of news okay board of trustees report mr o'neal you know under normal circumstances when we open up for a new school year is difficult process and we hear that there are issues that take place but they're always resolved and we move forward but this is a obviously a very difficult time right now a very different time and the the issues that were faced yesterday that mr greenwood stepped up and was able to really get in and resolve the technical aspects i i think that just goes to show the type of employees that we have not just in the technology area but throughout the district so um of going from the uh certificated staff to the classified staff to an admin i i say thank you so much for all that you do for all the thirty thousand almost thirty thousand students in the district thank you mr o'neal um mr jabar yeah i get my kudos before uh but i would like to reiterate that but i also wanted to take this opportunity to thank our latino health access partners who are doing some tremendous work in our neighborhood and as a result some of our parent leaders are actually being utilized as promotoris and they're doing some fantastic work there are unsung heroes uh going into neighborhoods and uh not only in the neighborhood but also during the testing they're out there doing some great work with our community so i wanted to highlight them i know i know the names but i don't want to mention the names and miss somebody and make somebody upset but as a group i want to make sure that all of them know that they're very much appreciated as a community i am also going to express my disappointment at the city of anaheim for not really taking covet 19 seriously as they should and not utilizing the funds in a way that they should be they have been utilizing it to support businesses but not our community uh uh in a way that they should they have done some little support but not as they should uh i think the you know i think it was trustee piercy who mentioned that you know in terms of internet connectivity uh it's not the school district that should step up it should be the city that steps up and takes care of this unfortunately uh hopefully we will be the ones to step up and take care of it and we'll have the city's partner other than that i wanted to thank all of you i think i mentioned the orange county register article it was a great article i know it was short but it showed the resiliency of our district and the way the work that we do and the caliber of employees that we have including our leadership so thank you all for all the work that you guys are doing appreciate it thank you mr jabbar miss piercy oh whoops i hit i'm muted myself okay it's a little hard to be you know going to a lot of different meetings but i have managed to sit in a few um i attended the csba's webinar that they had and that was interesting um a few of them were really interesting i actually sat in on the orange county department of ed's meeting that was really interesting and then i did the task force you know i listened in i didn't want to jump in and say anything but i but i did tune in to our opening of school task force to hear what was going on a couple of times and i did the same thing with our discipline committee task force that one i can join in because i'm a part of that group um and then i listened i mean i was part of the uh o'donnell webinar when he uh uh had a webinar talking about some of the things he's working on he does work hard for education unfortunately he hasn't gotten everything that he's tried for and then i also listened into a couple of principals meetings uh tuesday afternoon which was really interesting yeah [Laughter] let me tell you it was tough those principles i mean they didn't know what was happening it was just like good grief we you know and things kept changing and i mean and then we're already dealing with schoology and then we find out spectrum is out and aries is out and eric is trying to work with us and he finds out aries is out at the district i mean the district's wi-fi is out and he's sitting there so it's just it's been a real merry-go-round ride this week it's been difficult but our teachers and our staff have all really met up and i i have to say kudos to eric good grief he must not have gotten any sleep at all this past weekend because he you know no probably not brad's shaking his head because like somebody said he was working 36 hours a day and it was just you know and he kept working and it just kept things can happening and so it's just a kudos to eric because you did a great job wow and everybody because considering everything went pretty well i've talked to a couple of teachers and they you know they they managed you know and they had some pretty good turnout for their classes and you know some of the teachers who are not really technology adept still managed to get on and work so hopefully they'll all learn real quick let's hope tomorrow's a really good day so tomorrow is our first synchronous so we're supposedly okay i think hopefully all the the glitches of the the classes on a schoology are gone so i know i'll be hearing about it thank you miss piercy miss smith i i want to reflect on a trip my husband and i took in 64.
yeah is uh used well I mean we've every meeting we've had at least five different at least because you know uh the board policies and we've gotten it from there so I can't imagine what that would cost an actual attorney um to you know charge us for that so yeah okay I'll call from thank you I'll call for the vote trustee Chavez yes trustee Marquez I said no oh I didn't hear you sorry trustee Quintero all right and myself I four to one motion passes trustee Marcus in opposition item 6.05 approved board policy maintaining appropriate adult student interactions is there a motion on this item was that emotion trustee Chavez yes yes okay is there a second second by trustee is their public comment on this item sorry Mr kill oh there you go no public comment okay is there questions or a comment from the board on item 6.05 okay I don't see any so I will call for the vote um motion or to approve item 6.05 trustee Chavez yes trustee Marquez sorry I couldn't hear you can you repeat that trustee Marquez yes okay hi and myself I motion passes unanimously item 6.06 approved board policy Student Records second reading I have a question on that okay is there a motion on it so we can get to discussion motion by trustee Chavez is there a second I'll second it for discussion or question trustee Travis yeah um it when I read it it took out parents and to me that you're taking out parents rights and I would like to see that put back in okay so um so you're proposing I'm sorry I just want to make sure that I paragraph she's talking about okay um one second let me just flip to it uh [Music] on on the right after the the page of 606 the first page second paragraph towards the end of the sentence where it says you crossed out parents and child protect the student and his or her family that one on the third line of the second paragraph on the second paragraph it says the regulations shall ensure and then you crossed out parental so why would you cross out the parents that to me reads like the parents don't have a say in wanting the students records so I believe that that should be put back in yeah I remember this is gamut recommendation and this is the second reading and so it reads that way because sorry go ahead I'm sorry because these regulations shall ensure the rights of authorized person to have timely access to review Student Records while maintaining the confidentiality of students records consistent with state and federal law sometimes students don't live with their parents they live with a guardian so that's what this is trying to capture trusty Chavez so we if you feel that we need to add parents comma or other persons authorized this is this is a um you know that's that's uh that will capture I think what you're you're trying to achieve yes please so we will bring this for that third reading trusted because there's some edits okay thank you trustee Marquez yeah trustee Chavez you just paid a good deal of money to for you to fix something that they you wanted in there and they took out isn't this done from the gamut certainly is [Laughter] I mean I support.com and I think that perfectly illustrates what we were trying to say earlier but I actually had a question um about for for Rogelio about the let's see so the bottom of the first page top of the second page with regards to the immigration stuff on that page can you um just help us clarify what does this this language or who or what does this stipulate that we report to or not in terms of immigration status because it looks like it does tell us that we do have to report some things but I just want to be clear on just that I'm sorry it's like the bottom two lines of the first page and then the top paragraph of the second page I also have a question on the bottom fourth line so so if you could just clear up or or shed some light on our reporting responsibilities to immigration with this language so California law uh prohibited a California legislation a couple of years ago prohibited school districts from collecting and distributing uh immigration or nationalization status by students or families to law enforcement officials and others of course the immigration laws are enforced by the federal government and this Administration has been trying to tie the distribution of federal education monies including Title One learnings to school districts or to only those school districts that cooperate with ice and provide that kind of information so this District does not provide that information to anybody because it's state law this regulation just says that I'm sorry this policy is trying to reconcile both federal and state law in the event in the event that uh there is a definitive Court ruling that the local school districts have to compile that information right now uh the president's executive orders an injunction has been granted against them so this issue remains in reports right now but this policy is just trying to reconcile state and federal law for the time being and again the district does not collect or distribute information regarding immigration status about students okay thank you for that so this is basically if that you know that does end up going through then this policy would cover us so that we can receive funds yeah as a practical matter this will be in the courts for many many years okay okay thank you um any other questions or comments from the board Chavez so on the fourth I guess uh line from the bottom uh the last the last page of that same page the the page after the yellow one yeah bottom so it says all appropriate personnel share receive training regarding District policies and procedures for Gathering and handling sensitive student information so my question is if we pass this do we now have to make like a board study session or see how that looks like or is there a timeline that has to be done how is this going to be implemented so this is um I'm sorry one more question and do we have to have that in writing when we're going to do a higher uh that this is has to be followed thank you that's it two questions so the information is the implementation of this is handled through administrative regulations so once the board adopts the policy the administration issues the administrative regulation that contains the detail about how staff are to observe and Implement and enforce this policy whenever you hire somebody classified or certificated their employment is subject to them uh agreeing to be bound by The District's policies and administrative regulations and then for those staff who work in sensitive areas relating to document retention and dissemination services like an HR and business services yes they're provided some more direct training and Daniels desk annuals on how to handle uh sensitive documents and information one more question okay so on the agenda don't we have somebody who's supposed to collect all the documents if we voted in so is that now the district is no longer responsible should we pass it or is this District still responsible for making sure that this information is not uh given to anybody else the district is always responsible for that as an educational agency the district remains responsible for it even though we're subcontracting for somebody else to hold those records on this agenda book well I don't you know I'm not sure what you mean by subcontracting whether you mean like a digital or a database in the cloud but yes there are specific requirements under state law about Provisions that those kinds of agreements have to contain um relating to preserving the confidentiality of District information including especially personnel and student information thank you thank you you're welcome um so looks like I will go ahead and call for the vote on this item I had um 6.0 oh no I'm sorry this is a we're gonna go to a third reading on this I put third reading so that I can make those adjustments okay thank you so we'll move to item 6.07 approved board policy 1312 complaints concerning District employees is there a motion on yeah second reading is there a motion on this item approved yes motion are you are you making a motion to approve second a Emotion by trusted second by extra sneaking pero is there public comment on this item Mr Gill yes there are two okay um okay listen that house when you begin speaking the two minutes will begin yeah hello I think that can you hear me yes okay yeah I think you didn't get public comment for six point uh six because I had a question on that one um that was where my my hand has been up for that one I just had it's on the second page um and it's paragraph one two three four uh where it says the superintendent or designee may enter in a contract with the third party for digital storage management and with three Student Records or authorized um I just wanted more information on how this is gonna um what does that mean when it says um like a third party like that was my question for that point not for this one I just want to know like explain to me how that will work because it stays with uh parents uh permission right on the next the paragraph before that is safe they notify students hearing Guardians about the proposed program um well we get more information as parents on this and that's it for that one thank you um any other public comment Mr Gill you said there was another one I believe yes there is a Veronica okay Veronica when you begin speaking your two minutes will begin okay great thank you um and um this is on 6.07 and I wanted to um ask more on um oh gosh I lost it now um the complaint um and I know I'm sorry it is I believe on the third page on the second page and it says um the war prohibits retaliations against complaints um uh would that be able to be changed to the government the government or prohibits retaliation against complaints in fact you know if that could be added as well and um and it also talks about um the superintendent on designation form the complaint that the request May limited um I just wanted to ask also is there a different entity or one that is outside from the superintendent that can also follow up on the complaint or is that only designed to the superintendent or the superintendent person that um the superintendent decides to assign to that complaint um because it does not stay here if there is kind of like a like a private investigation or something like that just again to get away from biases thank you thank you next person Mr Gill um okay their questions or comments from the board yeah Christy Chavez and then trustee Marquez okay um the last speaker speak she wanted to change something and and at the end I'm sorry I I couldn't make out I guess the the internet wasn't working too good can you can you can you tell me what those questions were I couldn't hear it that well either can can we ask is that okay if she I did hear one that was um if we could change it from to change it to say the board of the Board of Trustees um there was a language change I believe let me got burning board governing board I think it was here if if she could if somebody could contact her I don't know who knows her um because it was a concern and if we didn't hear it I think we should be listening to what you know the speakers say but because of the internet challenge we don't always hear every comment maybe the secretary who's taking notes has it Maribel I heard the gist of it I think which was that governing board comment and also the one about the superintendent can you say it again Miss Maribel please she was saying something about the board what I got was a or prohibits retaliation to be added instead of it just being the superintendent as a designee so I I understood this she wanted to know who do we go to above superintendent for for a plane and our governing board instead of board is that what you guys got on your notes Miss Maribel yeah I'm not sure what she said I think that's what it was captured uh Mr Ruiz he had a comment or maybe clarification yeah I was just gonna say what member Chavez said accurately reflects the speaker's comments and I can answer those questions really quick the reference to board isn't mean it isn't meant to be limiting it's just trying to use a consistent term throughout the policies so we're just looking for uniformity on that the district acts through the governing board with respect to the superintendent or designee issue not every investigation against an employee can be conducted by the superintendent or her designee sometimes uh certain types of complaints require specific qualifications for which um very few if any people employees at the district may be qualified to provide and the most obvious area comes in uh Title IX complaints involving discrimination on the basis of sex Federal Regulations requires specific qualifications to perform those types of Investigations and then also uh investigations relating to financial misconduct that requires typically some type of forensic accounting background and capability so it's not always the superintendent who performs those investigations or reviews but the person who is selected performs them under her supervision the policies also provide that if the allegations are against or involve the superintendent then she has to recuse herself and the complaints go directly to the board and then the board oversees the investigation so thank you for that clarification can I ask a question yes okay so I'm not sure if I heard you right you've used the planks and financial misconduct so was she asking who do you go to for those two things is that what she was asking or referring to uh well indirectly she was she was questioning how would the superintendent if a complaint was against a superintendent how could the superintendent be responsible for that and then also um you know what types of safeguards are built into the policies to prevent retaliation uh against somebody who files a complaint so now I'm sorry I'm curious saying for information uh since she brought it up are we supposed to give her the information or can you give her the information I don't understand uh the line of questioning but should we provide that information to the speaker uh to the board oh uh I mean it's already built into your policies the way this works okay so for example if if there is a complaint against the superintendent the superintendent does not oversee the investigation that's handled by the board typically in consultation with legal counsel and in finding an investigator to conduct the investigation okay thank you thank you thank you so I don't see anything else or trusting Marquez did you have something okay so I'll call for the vote on this item which is 6.06 seven 6.07 thank you okay uh trustee Market I mean trustee Chavez I see you there I'm still making president Marquez and another reading me too I guess okay please um so that one will 6.07 will come back for a third reading thank you item 6.08 um uniform complaint procedures first reading is there any um is there I guess we don't need a motion on this thing I'm sorry a board president um we're we're bringing it for a third reading but I I I'm not clear about the changes and can I ask something uh real quick um I thought we were going to go through the entire um vote and then you didn't allow us to vote on it well because there's no vote on it because it was I it was going to come back for a third reading I think they had any changes I think they were my assumption was that either trustee Chavez and or trustee Marquez were going to suggest between now and the next meeting some modification but we can clarify that yeah my only thought when I and with all due respect is that we've had this board book for you know at least you know the sufficient time and so um I don't know just I mean in regards to our function here that we have you know we've had enough time to make any changes and that we go through the voting process and then go from there but I'm okay either way I want to make sure because we didn't get to vote yeah I think the difference is is that there was a question brought up by uh um a Community member and some clarification by Mr Ed Ruiz so I guess I can understand how that potentially could change the thoughts of any of the members here so apparently two of them it has caused them to have another thinking about it and so that's the reason why we didn't vote is because um I again I assumed they were going to come back with alternative language but we can clarify is that what the intent was from exactly fine I guess I just didn't hear from roquelio any issues but it's okay I was just confused thank you for clarifying we can bring it back no problem okay okay are we all good with that yes Okay so 608 is am I right on that I got kind of lost here yes you are okay 6.08 um is there a motion this is the first reading eight years 6.08 I believe yes the uniforms the first reading correct first reading on this so any questions or Com or I have a question okay a question is is this going to be on the website for alum rocks so that the parents can review that if they have questions at the next meeting when we do the other reading they then they're be informed I don't know if it's on there so if Dr Bauer can answer that Dr Bauer yeah the book is the same day that you received the book and it's available online and we also send it to a number of community stakeholders so the same day that education to the board is issued to the community okay so Mr President I want to request that it gets done earlier because um I find it hard to get it at the time that we get like this was two huge big books you know and I didn't go through the whole thing because they were too big they were too long you know um so I'm sure the community I'm requesting that we have this online at least two weeks or three weeks before the board meeting this section anyway well I think I I think you know where this resides is in gamut I believe which is online is that correct I mean we can find this on gamut which is online is that correct the current version well I want the community to get what we're going to be voting on or we're discussing on what we're discussing on but I don't want them to get it like when we get it because it's not enough time for them to go through it and understand it because they're going to have questions and they can reach out to me or to my colleagues and and say hey what did that what did that mean s to be put online at least three weeks before the board meeting thank you trustee Chavez I I think what she's saying is like what community has been telling me there's so much stuff to go through and there's not enough time to go through everything and I too have asked can we have it sooner and um because this was a lot of information I mean I went through everything but it was a lot of information and I'm sure the community was giving me Flack for it because they think that maybe we might have some control over it um as board members we don't but I have asked can we get it sooner and I know on the fourth of July when everybody wanted to go on vacation we got it a day earlier so um I mean it's possible it can be done and if we can at one day or one week would really help or whatever portion they do have put it up there and then as you're you know collecting all the rest of the stuff to put it up there then put that up later but you know at least so people can read thoroughly through it and I think if we do that that the board meetings will go quicker because people will have read it more and had more time to decipher what they read thank you Dr Bauer are you able to provide any clarification into that or if not that's okay too I just want to remind the boys that when you guys change the board policy we need to get the information from you so for example tonight if you know if this is going to be updated with your feedback we need it right away right and so we have a month less than a month to put together the book whatever book whatever size so I cannot promise to have this book ready by next week for September there's just no no way for us to do that we're gonna try hard to do it a day or two before that will push us a lot but I I'm being I'm being very realistic there is no way that we can have this book before September ready next week okay I think partner I think part of the um the question I think hold on I'm gonna I see I wanna see if I can clarify um for my understanding of this so I think part I want to ask Dr Bauer I understand that the the board book there's items that you know come in up to the last minute that we have to get in there all the way up to printing but I think what I'm hearing and what I actually had asked have asked previously too is and I don't know that this is possible but is there any way for the information that that we already have early on to be able to provide that um to board members and to community but I understand that if we're looking at it just as putting out one board book then obviously that presents challenges but is there a feasible way that the information that is available could be put out ahead of time and then the rest that we have to wait for comes out just as a normal does in the book I will last through I will defer to Rogelio to answer that I don't know if we're gonna were able to put partial information so that I don't know I know that by law we have to do it 72 hours before but having bits and pieces of the board book online or available uh Rogelio I don't know I mean that will be your answer to that yeah you would have brown act issues to the extent you just it gets distributed to all board members at the same time and with an invitation for comment um the other issue and that could be dealt with um by asking board members to respond with comments or revisions only to the staff person who is preparing these materials uh the other issue that you know comes to my mind is that the administration is constantly updating these policies and you've seen that over the last several months they brought several policies to you and that's because gamut updates their policies on a quarterly basis um and there was just a new round released in July that will probably be coming to you in September um but part of the process of revising the board policies to present them to the board is to First make sure that all the revisions are relevant to this district and its operations that's not always the case so there are a couple of logistical hurdles to that I just want to make sure that everybody is clear I believe that the question in addition to the policies the question the request from the trustees is to put information ahead like on contracts or presentations well maybe I'm I misunderstood okay trustee Chavez and then trustee Marquez I mean the things that aren't sensitive close up the ones that are centered those other ones but the like the the minutes put all that up online and then that way we can if we need to Adam we have it they need editing we have it there we can see the what they put and then we can check the Create TV and all of our recordings and then we could say hey that's not what I said or that or it confirms yes indeed that is what I said but if we can have it sooner than later it would be great except for time you know except for contracts that are confidential don't put that up but put the rest up thank you but I think we're all saying the same thing sorry one more thing interesting Marcus trustee bejerano and trustee Chavez I think we're all saying the same thing thank you thank you trustee Marquez and then trustee Herrera Loretta after that okay so go ahead and take a look Jessica um I think uh Dr Barbara mentioned that she would do her best to you know do it a day or two earlier I think the last month we met if we remember you know we're um talking about not adding on our staff more than you know they have it's the beginning of the school year and I know they're going to be putting out a lot of fire especially with what we have going on um I trust and I hope you know Dr Bauer that if you can give it to us you know ahead of time um and that you figure out a way that you do that um and you know as a board I don't want to add that burden at least this first month you know if we can maybe you know in October bring back an idea that'll work or you know look and see what can work um that we move that you know in October November maybe but um that this the beginning of the school year that we don't add um extra stress on on our staff um but thank you Dr Bauer for agreeing to get it to us a day or two earlier because even though I you know this time was three board books I do take the time to read them and it's been a lot you know it's been a hard week um it's been a stressful week um and if I can get it a day or two earlier that would mean a lot for me um and my family so thank you okay so we'll go with trustee Marquez and then we'll call for the vote on this to keep moving forward okay so what we put out here in this book is public information this request that I did you guys are totally overthinking and I only said put this put item 608 on on the you know up in the internet in our in the Alum Rock site for parents to review not after we make changes it's before we make changes because this is how it's coming to us and parents should read it how we're going to read it the first time so that if they need clarification if they say I don't agree with that I don't know why this is happening whatever concerns questions clarifications they have they I don't want them to have one or two days this is nothing confidential this is policies this is Board of Education policies it is online already at the state it needs to be here it needs to be here in the Alum Rock site and I'm only requesting to fully inform and give the opportunity to our community to read it so that when we all get to 6.8 and they don't have a book like we do they have already read it and they can follow what is the problem with that you know it's like is it's not giant rocket Sciences I just like just put it okay okay so we will call for the vote on this item I think that was a good discussion just really quick for the clarification for my minutes um who made the motion and who's second because I don't think I heard that I think it was trustee Chavez did you make the motion there's no motion and no second oh that's right there's none because it's the first reading first reading that's right thank you for that okay so actually we can move forward to 6.09 uh approve board policy comprehensive safety plan third reading um is there a motion on the floor for this item into a broom okay there's the motion is there a second I have some is there a second to the motion again okay uh there's a motion in the second on the floor is there uh public comment on this item Mr Gill yes yes okay [Music] okay Miss de Leon when you begin speaking your two minutes will begin Miss de Leon are you unmuted yes we can hear you foreign we can hear you yes um good evening everyone or good night everyone again my name is flor de Leon I am a part in a community organizer and committee group um regarding the safety plan that plan shall include parents to help strategize so we can work on to create a more uh positive learning environment for our students teachers community and staff and that is why we need an oversight committee to oversee the security of our schools and it is our responsibility to make sure schools are safe and welcoming for the students families and staff we need to create um we need to be created and change that way we have been working on the and working to a new one or uh where um everyone's Fields included and gives input we do not see the benefit of having officers in our school campus and we know implementing more programs in like uh Resurrection Justice in our schools will bring more benefit to our students and our schools uh Lots uh part and that committee we should have parents to from elac and D Lock foster care representation so we all can give input to make sure uh staff parents Community can support in any way and to make our schools a better place and I I think that that the people that work in the school should be part of this committee and I think we've been saying that we need to create it so maybe it's time for one of you to step forward and and having more conversations on how we can bring forward and making this committee a reality uh and just for security thank you thank you thank you next comment Mr Gill is Veronica okay Veronica when you begin speaking your two minutes will begin great thank you um and I just had um so two things uh actually three so the first one is if you do not understand or didn't get something that I said on a previous comment please don't mute me I'm right here don't try to guess five minutes trying to go to what I said it completely got it wrong thank you the second one on the second uh on the previous one I was I raised my hand for public comment because I have something really important to say which I'm not gonna waste on this but I hope that you go back and open the Forum The Forum comment for that because I have something to say but on this one I do want to focus again on that oversight committee or the um the community oversight committee that we need need to make sure that our families are being engaged in what our student safety is and we're not just leaving it up to um Dr Lydia Bauer which you know I believe she does a great job but then again when we have a collaboration with parents what they know their child and what their child needs it's a greater benefit for everyone completely and again we're starting to away from law enforcement because we're just if we keep on doing that we're sending our kids to prison okay how many of our students are graduating high school not many these are not news we all know them again we need an oversight Community oversight committee where it has all stakeholders not just Dr Eladio Bauer and her team we need more parents involvement and we always say about their involvement we're asking for something that will bring that okay we're giving you the tools you just have to really approve it that is all you have to do and we will provide you even with more information it is a benefit for all of you um so again I really urge you to somebody step up and you know break dust out of school let's bring our first Community oversight committee to this District let's bring it let's step up let's put our voice and power together and unite and collaborate and look for those Partnerships thank you thank you next speaker Mr Gill who is that one I'm sorry Kim Espinoza oh Mr Espinoza when you begin speaking your time will begin yes like the previous comments um I also do agree that uh we need more Community involvement and engagement and the best way to do that is to have a community oversight committee um you know our I feel like our district Prides itself so much in being Pioneers for a lot of great programs and I mean what what better way to lead by example by um you know engaging the community and saying hey look we have a community oversight committee we listen to our parents and our community and you know there's a lot of families right now at this um District offers um but you know what let's let's create another one um I I say the more parent involvement and the more comparing engagement even from even from like just teachers and the community at large you know it makes people it makes it it brings that inclusion piece the thing that we we I feel like a lot of places lack um excuse me and um yeah just to just to kind of continue on uh with this uh idea um sorry excuse me um I I I you know I I can't really express it enough I feel like this is something that we've been asking for for quite a while um and you know like I said we we definitely um are great pioneers we do a lot of great things in that district and I think we need more parent involvement through this uh oversight committee and also it's it's really hard to kind of see which positions are open for committees so I think you know in in the spirit of transparency there needs to be greater transparency in how more parents can become involved in these committees uh because oftentimes you have to search very very hard for vacancies uh thank you thank you Mr Gill next person next person is Anthony okay Anthony when you are unmuted you can begin speaking your two minutes will start um just just gonna speak I'm sorry can you speak up a little bit Anthony it's a it's a little bit muffled my bad that's a little better I'm just gonna say that you know personally I agree with a community oversight committee um just kind of going back to you know just brass stacks and facts uh it would be nice to have you know uh more parent engagement uh as well as you know um on the teacher side as well so uh yeah I think a community oversight committee would be a great way to move forward the work that y'all are already putting together in terms of these programs so uh yeah it might also expedite this process a little bit more so we don't have to be here till like 10 o'clock at night just gotta say okay thank you Mr Gill next person okay Mr Vazquez when you begin speaking your two minutes will begin um thank you so much so according to this policy this this policy is about making sure there's physical the students are free from physical actually there's not even a student it says campuses are free from physical and psychological harm but um part of like uh some of the reading it says that School site council at each district should develop a comprehensive safety plan that's a good start but I but I do agree with what the public is saying in terms of creating it and linking it to an oversight committee that could also think about how these resources are being utilized evaluated and also those Partnerships too that might come with the city or the county or otherwise so it's something to think about right parents have been talking about this oversight don't let the word oversight kind of get in the way of of the potential creating a uh parent and teacher and a lead effort where uh you know the safety of the students they start through a preventative um way and so that also it brings high expectations has some of these parents have been talking about um things like restorative justice things like Youth Development actually are designed to do the violence prevention the intervention and also to set high expectations in terms of how students are supposed to behave it's a way of holding people accountable but in the big picture it also provides an opportunity for the schools to really think about what kind of culture they want to build what kind of resources they have what kind of changes they want to make and so that there is a prevention right A lot of times when we look at things like bullying that you know might be highlighted in some of these safety plans it's not just bullying it might be racial tension Prejudice uh sexism it might be different things that at a site level it could be monitor level and intervene and at a district level create like an infrastructure for for our safety where we don't need to call law enforcement or have punitive measures thank you next person Mr Gill s okay missing their ass when you begin speaking the clock will begin well this is what sounds disappointing and it was I just wanted to give a comment on number four where it says reasonable accommodation to lactation to express mail uh or breastfeed a child um I just want to make sure that this is happening in all schools because I know that we have teachers that were using their classrooms to do this and their every school should have a place for them to feel uh safe to do this because a lot of the time you know kids want to open the classroom or or whatnot so I just want to advocate for that to make sure that every school has a room and it's not the bathroom or their classroom it has to be a room um and also on number nine when it says physical educational instruction um that they require 12 minutes when covet happened I understand everybody was cut off guard but our kids didn't have PE they didn't have any uh uh PE at all on Virtual so I just want to make sure that they that this will happen once the reopening of the schools happen that these kids get the extra exercise because a lot of our kids gained away and maybe encouraging some PE time um would be great also um I know everybody's talking about committees I also want to remember everybody that there are committees that are trustees uh did uh back in I don't know I think two years ago where the safety and wellness committee I don't know if they're meeting or what's going on but I know that there's also a budget committee I don't know if they're virtually meeting or not but these are committees that are already out there they're already formed and maybe we just need to get parents involved in them um and get these committees to start meeting so we can hear our parents uh once again I am here echoing everybody's uh comments about an oversight Committee of parents and Educators that is already there and it would be nice to have them in our district thank you Mr Gill next person no more public comments okay thank you uh any board questions or comments on item 6.09 uh trustee Chavez plans for doing uh a meeting with the parents and stuff yeah um I think we can just we're going off topic and all those points were good um I'd love to have that conversation with you Thomas or bring it as an action item or a information item for the next month um and then in regards to this I'm glad you know that all the parents spoke in regards to and I uh not opposed to an oversight committee um and I think it's a great idea I think we need to also um uh I'm glad one of the last parents mentioned that um you know there's already several committees that you mentioned a lot of them um and I would like to also highlight um in our uh board policy um the School site plans site Council citizen advisory committees that are a part of these plans um and so you know let's make sure to get involved in the Committees that are formed not to you know get away from bringing in new committees um you know that's a possibility but we do have current committees um I met with you know Adelante and my daughter's school this Tuesday there's a lot of um action items and a lot of decisions that are being made um including this comprehensive safety plan that is done there as well with input from the parents so um I agree it's very important to have input from the parents I myself never even thought I would have been uh trustee and I was a part of the school side councils putting in my input into these comprehensive safety plans so I just want to you know encourage parents I agree we need more parent participant us in our schools in our community so I look forward to having you you know more of you um in the school side councils and these different committees that are happening your help your support um and I look forward to bringing that item you know in regards to that question moving forward but I'd like to bring our attention back to this board policy any other questions on item 6.09 questions or comments okay I will call for the vote um trustee Chavez 6.09 Rob can you move on to the next one I'll give you my vote in a second okay trust me Marquez yes era hi trust me Quintero you go first and all that well after you yeah if you want I for myself trustee Chavez yes okay I believe that's unanimous correct nobody voted against this one okay that I think that that passes unanimously unless someone corrects me um and we'll move on to item 6.10 6.10 District records is there a motion for this item motion is reading oh I'm sorry information only first reading okay so is there any questions or comments from the board on this item 16. District records information oh so okay I'm not hearing any anything I was talking about earlier um Mr Gill do we have any public comment on item 6.10 okay Veronica okay uh Veronica when you begin speaking your two minutes will begin great thank you since uh we skipped 6.8 and again I wanted to make a comment on that especially on the breastfeeding I was the Teen Mom and do you know where I had to breastfeed even though my school district which is inside School District Union at that time um had me breastfeed in a file room in a file room that it was dark there wasn't light and I was around just files it was very uncomfortable it still didn't let me stop from breastfeeding from getting milk for my child and getting them food but that's where I was breastfeeding I was a 15 16 year old breastfeeding there okay trying to lactate I don't know if you've ever been there but if you have it's horrible now yes I I also agree we need to make sure that we have somewhere designated for our students and for our teachers because breastfeeding is the most beautiful thing and when we're expressing as a mother's milk um it is also and our children are not there it's still very you need a Sacred Space it is something sacred it is something that um from my as well from my ancestors we did right this is where life comes from as well for our children so it needs to make sure that it gets somewhere every school has its place a special place for mothers to breastfeed if students are encouraged if they're mothers they're or if they're not mothers they're encouraged to lactate and they have less space because it is not cool to again lactate in a defiled room okay and if it if I couldn't do it there guess what I was I was in somebody's car I lactating and I do not want that to happen to our students so please make sure to go back and add that comment to 6.8 because you didn't let me speak on it thank you Mr Gale anybody any other comments and Normal public comments okay thank you uh so we're still on 6.10 um any comments or questions from the board this is the first reading 6.10 yes we're back to the first it's playing ten it's like 10.
back to massachusetts there's an amish community recreation and i remember visiting that community in a one-room schoolhouse and reflecting on what life was like back then and to what it is today and i would say this is the first time in the history of our country that we've ever gone through something like this and from a one school room house or a school uh to what we're dealing with with technology and eric and orlando and all the people that are doing what they're doing it's beyond awesome and all i can say is that you're just wonderful human beings and you're one of the reasons this country is great thank you miss piercy i attended i'm sorry ms smith i was thinking miss piercy because i attended the uh the o'donnell webinar with you and i didn't see you but uh and the um the task force the covet task force uh with you as well uh i also attended um of course our rop meeting uh and then um the rop had a pd uh welcoming back their um their uh their teachers so they had a teacher training day and uh in trying to make it fun they made it a rock and roll theme and dana lynch was um i can't remember his name but he was like darth darth vader or something like dj darth vader or something like that they always do fun things like that um i attended uh the oh the white cap uh meeting the celebration at magnolia with our um it's called the c c s three square cs3 squared is that did i get it right okay um it was really an amazing um presentation uh our collaboration with cypress college dr schilling spoke and mr uh superintendent matt souda spoke and they even had dr um how do you pronounce his name uh hugh i'm tired uh but they had him speak um so they configurated magnolia high school into kind of like a a staging area um on that for that front white uh wide area lawn they had the stage and then they put the cars in the parking lot and they spaced them out so um so that there was a car uh that could fit in between even if they were in the back so that they could see the stage area um as the cars came in we um shouted and gave them a a root loop and uh they gave us props and um and then each student got a backpack and they told them not to open it until a specific time and they got swag in there and then when it was over they got to drive around to get their official kind of graduation picture taken but the amazing thing about it was that these students were um 30 strong i think and they they started with a hundred so they selected these 30 out of the 100 but they're incoming ninth graders getting college credit that's just you know blows the imagination how how our district collaborates um so well with our partnership so um it was a really fun celebration the parents got to got to be a part of it and so kudos to um cypress college they set that up and kudos to us for being available having that partnership and working really hard our staff working through the summer to make that happen and this is our cyber security if um i didn't mention that before so uh innovation boy uh we're doing it um i also attended uh um ron uh ross billings um funeral service um of course our beloved um uh jan billings husband um i learned so much about him he was a renaissance man um who was the first uh the first teacher ever to use a computer in his class so think about that and think about the significance of that and what we're using our computers today for um and just amazing when he left our district he um he taught in community college and he taught el students he also created software programs and traveled to i think it was saudi arabia and to teach it just his resume was just you never would know he's he's uh was kind of a quiet man uh but as i i spoke about him before he he literally built a castle for um his beloved wife um and it's an amazing house it's 312 carnation um there there's a book about it if you want to learn more about it um and if the board would um so agree i'd like to adjourn in the name of um ray chips his passing not too long ago of course the husband of susan stocks our wonderful administrator our hearts are so full of sorrow at his sudden passing and so if we could adjourn in his name um i would like that uh any um any agendas items um board of trustees just wanted to call uh attention to i believe it's a typo for the next regular meetings and it says thursday november 9 it's the 19th okay and madame president 14.1 is an action item oh oh it is thank you right yeah that's right what are you thinking that oh i also wanted to mention that um i did uh contact uh before we go on to this sorry i just remembered i did contact um those students i called them individually to thank them um i think it's really important that uh the students that talked about our um at the last board meeting that all wrote those eloquent letters i just wanted to reach out and let them know um that that we heard them and that their letters were just phenomenal so um just wanted to to point that out so moving on advanced planning um action item it's all moved okay move to second did uh mr o'neal hi mr jabbar hi miss piercy aye ms smith aye and i vote i thank you for pointing that out maybe we would have we would have lost that alrighty any suggested agenda items okay hearing none i'll call for adjournment um motion removed second okay move this secondary mr o'neal hi mr jabbar aye ms piercy aye ms smith hi and i vote i thank you everybody
10 thank you okay so I don't see any so we'll move forward to item 6.11 this is uh third reading I believe oh yeah for approval oh this is another third reading this is for approval um for campus security is there a motion on the floor questions motion to approve by trusted second by trustee Quintero is their public comment on this item can't hear you Mr Gill yeah okay um who's the first one Maribel Ruiz okay Miss Ruiz uh when you begin speaking your two minutes will begin thank you for giving me the opportunity to talk first of all I want to change to traffic arena for bringing this hiding to the board we would like to see the designated person from the Independent parent community Direct by parents to have a voice similar to a citizen Bone Comedy and we want a cloth where it is a specific that cops shouldn't be higher to be in our campus we don't want to traumatize our kids and I want to tell you something else I saw on TV a kids a special little kids who was hanker for the police by the police so I don't want to see that in our neighborhood in our in our community because that is enough with correlating with the uh trouble we have a job with money and everything so this is what I want to say today thank you very much thank you Miss Ruiz um who's the next person Mr Joe next person we have is dilzer okay deals are when you begin speaking your two minutes will begin do you remember once again children School District I'm sure that um when we say that's in me we talk let's talk about the parents let's talk let's bring the a committee that can work directly to make um these improvements I also Echo that we do need a class that says that we cannot have any more sros inside our school sites our school starting at Presence their school sizes of Education we could bring more counseling more research Justice we are just doing that right now and we are proving that when we are able to take care of our students emotionally and um in room practices that helps them know themselves in the culture where they're coming from it guarantees a school Success but when we bring cops to our schools we only increasing the school to prison pipeline let's continue to work in bettering our schools and making save our campuses where our children feel that they belong that they feel that they could be successful and where they see themselves being future teachers lawyers or anything they said their little Minds to and not as prison camps thank you have a really good night thank you next person Mr Gill when you begin speaking your two minutes will begin um I know that it says that um you want to make sure there's Lighting systems I would love to see more spotlights on Corners around the schools in case anybody you know walks by gives them life it also it works when people are walking and a lot of the schools don't have lighting around and a lot of families walk at night so that lighting is not only for safety but it's also safety of the community that walks through there around and District staff patrolling I think that we need to be a little bit careful with that because um not too long ago um you know uh one of our janitors was working in a school and the police was called um because he looked a certain way or I don't know if it was his color of skin and this uh employee was apprehended by the policing question in front of his family and it was very traumatizing so when we say District staff patrolling um we got to be careful on what that means because obviously we all know what happened there um and I know we all make mistakes but we have to be very careful when we call the police on our janitors because that's something that nobody wants I have to go through because they're doing their job next speaker Mr Gill flor de Leon Miss de Leon when you begin speaking your two minutes will begin can you hear me yes okay um again um good night everyone I know it's good good evening but my name is Flor Paran Community organizer and um I just want to say uh thank you to uh trustee Corina for advocating for the amendment of the um of of the of these and also for the other trustees that are supporting it too thank you very much for taking that in consideration and now more than ever we need to make sure that social emotional well-being of our students uh teachers and family uh have to be like a priority we need to be more involved in um in that Community like the committee that the uh we're requesting to form you know we need more community and we know that we have a group of uh of Escape holders like community members like organizations that are participating in this Coalition that is being created in Alum Rock and uh we have even lawyers we have people like really want to help and and find ways to bring more resources to our community and I think we need to work and and make sure we in a way uh I don't want to say take advantage but yeah why not take advantage of expertise of people that can contribute to make a a self-care place in our uh schools and also I think um last I um we need to include in this amendment and and including a no police should be higher class in this amendment there should be an an amendment about that like says includes a no police should be higher plus not police should be higher class in their schools and again we need more of those resources we've been mentioning and I hope that we can move forward and work in collaboration to make things better in our schools thank you thank you next person Mr Gill you're on mute Mr Gill okay Anthony okay Anthony when you begin speaking your two minutes will begin awesome uh I would just say that as a person who has taught in the district um you know watching students be dragged out by four police officers uh for you know basically throwing a temper tantrum has uh dampered the professional experience so yes it it would be wonderful to move forward with uh this sort of thinking okay thank you next person Mr Gill Mr Vasquez Mr Vazquez when you begin speaking your two minutes will begin uh yes um I would like to commend the board my trustee codina for bringing this item up and I encourage you all to um you know pass this this item especially given that you know we've talked about making a commitment or at least some that not to hire local local law enforcement um and it's it's written in bylaws um you know just hearing a story from the previous speaker it does remind me of of two things one um growing up in in Oakland uh one of the things that you know I went out of high schools Oakland has a whole Police Department or had and thanks to the community they no longer have but 10 years ago um one of the students was actually killed by the police officers that were hired by the school district in front of his girlfriend in front of his peers um and you know the community never forgot that um yeah that was a child um that was a student a former student um that's something that they they never forgot so the community actually put a greater emphasis to make sure that the situation never happened again and I'm thankful that to my knowledge has never happened in in San Jose and I hope that it never does and the same story that that was said by the teacher or the person before in the past is that you know we as a case manager these are some of the stories that we will hear that a student with autism special education somebody that was very poor someone that didn't even have a place to live at times um with a lot of stress and pressure and oppression sometimes yeah people would act up if you're living in that situation you know and even at times to avoid any confrontation with their teachers the police was being called you know and students would get actually and it's one of the schools in Alum Rock uh we'll disclose which one but but these are the stories that did happen in the past and I hope I'm thankful that the district's moving in a New Direction and I hope that you pass this resolution thank you next person Mr Gill he was Veronica hey Veronica when you begin speaking your two minutes will begin hi everyone thank you my name is Veronica I'm the mother of two Alum Rock students and I'm also a member of the reimbursement schools now Coalition it is apparent it's an ellenbrock parent alumni and a community Advocates or Community member um Coalition and in this Coalition we our main focus is to end the school to prison pipeline right our students are what are filling those jails our students are what filling those prisons our students are not filling the universities those four-year colleges right and so instead of having um we are a great path right now that yes we are not going to um join forces with law enforcement but we need to do better right we can we gotta Pat ourselves in the back and keep on going because our students are our main priority especially again those of low social economic status and um the special education students um and I also want to make sure that it gets written in the bylaws and that everybody does not question it it is something that we here see as the number one safety to protect our students and our number one thing is also to get those students into preparing to a four-year College even though we're just a k through eight right but we're not putting them out into prisons because a lot of our students are going to well it's called ranch right if you don't know what the ranch is you need to look it up but the ranch is just around our backyard and that's where our students a lot of them are going and we gotta make sure that that stops we gotta put a stop into there and we've got to encourage our students to be citizens that we want to see not the distance that the school person wants to put them this educational system was informed for us for the Latinos and for the African-American it was and we need to reform the system we need to abolish it and we need to build one that does support us so thank you again for supporting this and let's end this uh School depression pipeline thank you thank you Mr Gill next person Omar okay thank you are there questions or comments from the board on this item first I saw and then trust me Chavez I'm glad that this was brought uh and I'd like to highlight you know I know there's a lot of reading to do and some of our community members might have missed it but this is one of the main reasons why I brought it and I included the district shall not hire local law enforcement or Law Enforcement Officers to serve or act as school resource officers or on District campuses so I know we had um already voted on you know a couple months ago but for me it was important to put it in writing so there it is um also I just wanted to highlight um right above it where it states these strategies may include the creation of um and it's there um so I want to change that to these strategies will include not me so takeout may include will include the creation of and then we'll take out if we can take out of a school Watch program and put in will include the creation of a community oversight committee um and I know we're on the first reading so um I want to include that and um thank you everybody um you know we get to move forward I also want to highlight um as a previous Deputy probation officer because I'm currently a public information officer for the county um you know uh part of my job there was to uh dismantle our um our our juvenile halls and the ranch because our youth um there's no more crimes being committed no more gang violence no more um drugs and there's no more crimes so that's part of my job and part of my dream um to dismantle the you know Juvenile Justice um system that we have created um because our children are getting the resources and services that they need a Gateway level at a um their foundational age because So eventually when their youth um they know how to you know deal with conflicts deal with pressure deal with stress in a healthy way and so that is part of my dream um I'd like to uh report out that we have zero girls at the ranch right now um and that's part of the work that I've done with local judges and other community members the women's um uh Office of the women's policy um and many others have dedicated our lives for this so I do want to report that out you know I don't want any misinformation to go out um and there's like uh you know a lot of parents are there's still a lot of work to do um but there are leaders and there is work happening so um I continue to encourage community members and parents to be a part of that movement so we can get it to zero ongoing um thank you very much and then trustee Chavez after that who's next trustee Quintero next okay yeah thank you uh I um in support of the policy but I want to make sure that we're clear about um we're talking about um fences um security around the perimeters I also want just to go back and it's something I brought up before um about really looking at a way in which we can meet to both needs the security needs for our students that should be our first priority but also access to the community after hours because the community is being taxed or the fences that we're putting up and they're now being out walking paths um the blacktops are being taken away from them and uh I'm I find that kind of wrong I find that very wrong because they're we are all taxpayers and we're putting up money for bonds to pay for fences I want to figure out how it is that we can come to a a good solution to meet the security needs for our students but at the same time also make the facilities accessible after hours after students are no longer there so that the community can use it for recreation exercise that type of stuff okay thank you trustee Chavez this is not my comment but I'm going to comment right after I say this it's we're moving in on 10 30.
are we going to move the time in uh can I make a motion until three o'clock in the morning okay is there a second for three o'clock in the morning so um so 10 50. let's move it ten one five or ten five zero and five zero okay I'll second that um did you have a were you just gonna second that trustee Chavez no I was actually gonna ask for more time because we have a lot of items and I don't think we're gonna get done by ten five zero yeah I don't think so either so until one o'clock well right now there's a motion in a second on the floor already so um so the motion on the floor is 10 10 50 5-0 is there any other questions or concerns I mean concerns or comments about that uh motion I'm gladly amended it to 11 but I think that we really need to focus on on ending at a reasonable time we have people complaining about Windows 10 11 1 in the morning okay so motion amended to 11.
I'll I'll suck in that motion I guess if I need to um is there any other questions or comments about that motion okay so we'll put it to the vote with the members here uh trustee Chavez that's not enough time so that's no that's no trustee no myself yes trustee Quintero yes okay and just in time can you hear us so we have a break over there we have a you planned that didn't you we currently have a kid what item are we still on the same item no actually we have a motion on the floor to extend our time until 11 pm right now and there's two in favor to oppose so you're the deciding vote on this one at 11 o'clock that's it I I don't I don't believe we have enough time we don't know we still have closed sessions to go um I don't know if my colleagues um haven't said anything um tell her the second motion that I said to one well there's not a second motion right now there's only one motion on the floor until this one passes or fails I I got it I got it so no I'm not gonna vote for that I think we need more time and what's the second motion there isn't one yet emotion that we end at midnight okay there's a motion on the floor to go to midnight is there a second to that motion did I hear a second okay so I'll uh secede my or whatever I'll give up my second to Mr Quintero um so there's a motion and a second to go till midnight um is there any further questions or discussion on that proposal yeah I don't think going to midnight is gonna do it but um you guys three votes vote together all the time so it's whatever you guys say okay so any other questions or comments on this proposal okay trustee I'll call for the vote on this to go till midnight trustee Chavez no trustee Marquez no interest what was that yes okay trusty Quintero hi and myself I so we will go till 12 o'clock midnight thank you everyone uh so we were in the middle of board discussion I believe on item 6.11 um I think there's still discussion trust each other did you have any yes I did okay okay so I've been listening to the community and they've also the a lot of them said uh that they wanted input in the safety plan and since the committee hasn't met yet the safety and wellness I think that we should add that and see the plan before we vote for it what did you want to add okay did you hear what I said I did but I don't understand what what do you want to add to what so there was no plan laid out right we're just supposed to vote for a plan and also the community is asking for input into a plan there has been no uh safety and wellness we're not voting on a plan we're voting on The the item in 6.11 yes not necessarily a plan is my understanding and I guess in a broad sense you could say that it is yeah but in a broad sense without I think it would have been better if a plan would have been brought put in the book and then we we approve or disapprove of the item yeah to help us because I did talk to ralphelia about this and um I think it's the beginning of I think what I'm hearing Linda from the community as well they want to be a part of it so this kind of the beginning of Shifting that but we get to approve this before we get to that next step but maybe Rogelio you can help us with that a little bit yeah yeah this yes so this is a regulation that directs the administration to prepare the planet so this is this is what actually comes first once this is in place the Administration has to prepare the plan and bring it back and um the board vice president's uh request is that this be amended to include a committee or an oversight Community oversight committee to engage in that process as well correct okay okay I think I heard trustee mentioned earlier that this was a first reading but this this is not really a reading right this is right I'm sorry I was reading first reading and yeah it's not okay to approve I apologize for okay so I have a question on this one um for Mr Ruiz so can you explain the I guess the difference between the resolution that we passed for black lives matter that included the language for the sros and this particular item yep so happy to do that so the resolution is a position and a policy statement by the board once the board passes that resolution the way those principles become embedded into District practice is that they have to be incorporated into District policy and or regulations and this is this is in connection with that as well so this is what lives on um you know next year and in subsequent years okay thank you for that that makes sense uh my comments um are that uh number one I think that um I you know someone mentioned about the patrol I do have a I you know I have a concern about the part about the patrol like teachers would Patrol Gatherings and things like that I think that I'm not comfortable with putting teachers in that position um and I think it's um you know my position on this is not unknown I did support the resolution because it initially the resolution was for black lives matter which is something that I strongly support the SRO thing was rolled into that and you know I continue to believe that as I as we've talked about other things there's always room for improvement in things but I believe that The Narrative of for alum Roth that the sros are creating a school-to-prison pipeline I think that's a false narrative as based on the data that I have I've heard some anecdotal things tonight that are very concerning I didn't hear that um during the time we were looking at the proposal but I think those are very concerning things however I do um I continue to have concerns with creating a blanket um you know dismantling policy or whatever you want to call it I I do think that reform is more of what would be needed and So based on that you know I'm prepared to take you know public comment that will come or personal insults or attacks or whatever because I feel like I I have heard a a significant enough segment of our community that feels a little bit differently about safety for their children as it relates to sros so I do also represent those parents that have directly contacted me and and I feel the same way I don't mean this in a way to diminish the spirit of of the you know things that people have said I don't mean this in a way to say that you know we shouldn't continue to work on these social justice issues and you know Equity issues and all those things I just am not of the belief that there these things are mutually exclusive I think there's room for both things and to be reasonable about it to be um you know to approach this in a very thoughtful and logical way and for me the the absolute um you know the absolutism of this particular um thing is isn't just not something that I can um that I agree with and so and not only that I agree with but again I'm representing other parents that I have spoken to me um so I'm you know based on those things obviously I think it's it's going to pass and I will wholeheartedly support the efforts because I think in the whole or in the main it is a good thing I just um you know I've stated what I need to State about that so I will not be supporting this tonight so any other questions or comments uh trustee yeah right before um I just wanted uh in regards to the security you mentioned highlighted the security um I I just want to ensure um and maybe we should I should put it in writing um up here because I'm in agreement um I know that we we have currently over like overnight security and security you know overseeing our our um buildings for uh graffiti and um you know breaking of the our Windows Etc um so I just I don't see the language of I'm just serving as you know overnight and or weekends um and maybe I'm missing it Rogelio can you um is there anything because I want to make sure that like no Securities hired to do any of the you know uh functions that a police officer would do because I've seen that happen as well and I don't wanna I wanna make sure that that doesn't happen um no law enforcement entities or security entities taking on that um so I know I think we would have to add language about private security Contracting with private security firms um I know up here it says a superintendent or designation security plan that contributes to a positive School climate Foster social and emotional learning and student well-being and include strategies too and then it's based the one and the two and the three and four and it goes down um so I think in there if on the first one secure the campus perimeter and school facilities in order to prevent criminal activity um so I think here um we can just include in the beginning Rogelio what do you think about including there um and shall not work like as an SRO function just including those to ensure that they don't work as an SRO friendship in that beginning statement would that be okay yeah that would I think that would accomplish that purpose okay yeah so thank you um and that's the only other edit that I wanted to ensure to include thank you I'm sorry can you just briefly briefly clarify what um what you just did right there trust theater Lord I'm not quite sure I understood that edit okay so in the beginning where it states um on the super right under campus security the superintendent or does it mean shall uh develop so in there we're going to include um so it reads shall develop a campus security plan that contributes to a positive School climate uh Fosters social and emotional learning and student will being and include strategies too and include strategies too I'm just uh looking at my edits here um and will ensure the campus security will not function as an SRO okay okay thank you for the clarification trustee Marquez and then I think I saw trustee Quintero yep okay so um Karina have you taken this away and um this is just informational for me um when there are functions in the district if we ever get back after the covet policies in place what do you see there at a function to keep order I see our and I don't know why we're going backwards but I'm happy to tell you what I see I see uh let me answer your question I see your children getting along because they've had restorative justice programs emotional uh you know and uh social well-being counseling available um conflict mediators peer conflict mediators who are helping mediate conflicts then our children have the tools necessary in order to have uh you know schools that um that you know are peaceful that if there's ever an incident because I am a law enforcement you know even though I'm holding two functions right now with the county as a deputy probation officer and um a public information officer as a law enforcement I will tell you that if we have a person that comes onto campus you know um hopefully never um and I know because I know that's something that's been brought up you know that um let me stop you right there because my question was hold on hold on one second because you asked me you know the law enforcement you know you ask like what what do we see so I see if Karina what do you see at a function we're having where there's you know uh whether it's a dance after school you know whether it's uh Fiesta after school or during you know what do you see there for safety of of everyone there explain to me if we don't have security there what kind of security do you see because I I'm kind of I'm kind you know I'm kind of mixed up about and with that edit uh whatever are you saying that there would be security they just would not function as sros then explain that not function in SRO these these school resource officers are school resource officers please let me finish okay sorry you asked me not at the sros not to be there as sros then what are they going to be like uh are you asking about the campus security right now specifically yes because the campus security I I see that in my mind what what it's going to look like you know okay so I think we have the question so go ahead trustee oh you're asking about the campus security what we have them for is to ensure that our buildings are safe that are you know on the weekends nobody comes in and breaks in um yeah that's what that's what I see them continuing to do to ensure them so they're not in the capacity of like event type uh not in the capacity of sros because we have Community we have this community oversight committee we have parents involved my question was about an actual function happening at the school site you know put together by the staff and you know and people are going to be there the law requires that you have so many that's still in intact right I guess what I want to highlight is that they won't be there to arrest kids they won't be there with a gun is that still intact that if we have a function x amount of people being there we have to have security right so I I'm sorry but I don't know what the local ordinance is on that but yes in the past the schools have had some events where there have been off-duty police officers I don't know if that was required by ordinance or that was just the staff's desire it's an it's an ordinance but I I just wanted to know what it's going to look like when we don't have sros there um and we're having a function you know and um you know is there going to be people there to make sure hey oh those look like they're arguing or and go put a stop to it or oh those kids are taking off the ground they're not staying in the functions they're going to go bring them back or yeah those are those are good questions the Lord is you know and I can like feel like I mean there's a lot of fears that come up right like what happens when this happens and and I get it and I and that'll be a part of this oversight you know Community oversight committee that will sit down look at all these different things I mean I can't say here and like you know give you the answers I have many ideas I've seen many things I've been at Independence High School for seven years as a law enforcement person I really took off my law enforcement hat like you know I didn't wear any of the handcuffs or any of that because it wasn't needed now you know is it going to be perfect nothing's perfect but we got to try something different right we can't have police officers at our k through eight schools and there's no give me one second there's no need to go back right because we've already all uh voted on that specific item um but I'm happy you know to entertain and um I look forward to this community oversight committee to really sit down and break down all these different you know scenarios and the differences I did think I did see um trustee Chavez but I just want to clarify they're currently we're talking about a community oversight committee or I hear you saying it as if it exists and there does not it does not currently a community oversight committee does not exist so I understand that's um the plans of some and it may indeed happen but right now I think we should plan with what we know as a fact to to exist and that currently does not although you know it appears that there's some movement in that direction trustee Chavez you didn't have anything did I see trustee Quintero were you with anything or should we call for the vote at this point yeah no my question was answered um the concern was that there was going to be a blanket um prohibition on the hiring of security and what came to mind was uh the constant break-ins at Fisher and um we can't rely on volunteers or people to go out there with security so I'm appreciative of the fact that that was uh put back in place um I had expressed those concerns about large events um and uh not having Security in the past I'm willing to go ahead and try it out but this is not about the students but rather disgruntled individuals coming in apparent non-custodial parent trying to come in and grab their kid while the event's going on that's my concern um and so uh it was um you know let's let's go ahead and see how it goes I appreciate I Echo that um a thousand percent too just I'll say two last things for my comments and then we'll call for the vote quickly I agree with trustee Quintero for me it's not this is not about the the kids and I understand how some feel about that it's about those outside threats that that are in my opinion beyond the capacity of teachers and parents and an oversight committee to address and the second thing is there's I will say that there's a lot that I really do love in this and I appreciate you know trusted Loretta for the work that she's put into to doing this and and there's a lot that I like which is why I'm comfortable moving forward with it I just there's that one piece that I mean everyone or people know how I feel and I just that's the piece that I'm not comfortable with but um but I appreciate you bringing it and I like a lot that's in it so at this point um we can go ahead and call for the vote uh trustee Chavez know trustee Marquez yes Quintero hi and myself no so the motion passes three to two trustee Chavez trustees Chavez and bejarano um in opposition thank you everyone okay we will move to item uh what are we 7.01 yes okay so this is an item with regards to the solar energy this is an update and also um I don't know yes can you please place a limit on this item with 10 minutes max you know anything worth being said presentation should go fairly quick and then public comment and move on with it yes well public comment we have to we agree to the 20-minute thing so that will go as it goes um but so we can go ahead and go with public comment um and see how much time that leaves us and we'll shorten it based on that so Mr Gill do we have public comment on this item yes we have two okay who's the first person that has when you begin talking your two minutes will begin um good evening foreign I can request a table list for next month's meeting I know that it's only informational so since it's not an action item I would love for it to be tabled we have so many things to cast that are crucial uh to the reopening of our schools and passing along with these board policy stuff so I think that um there's a lot of action items that need to be passed um I have nothing against solar panels some foreign at the moment that we're in right now in the time uh this is a there's gonna be a lot of information for a lot of people and I want to also ask if there's any guest speakers speaking on this because there was a town hall done recently and it gave a lot more information than I usually get here at the board meetings and um there was like about four speakers that spoke about these solar panels and I see that you know there's a high interest in this and I'm for it I know the price is not going to go up anytime soon uh we're at our economy keeps dropping with covid-19 and a lot of people still um you know going through it and I think that right now I think a lot of board members mentioned today there's a lot of things that are really important right now that should be given the time and I think that one more month that we table this wouldn't hurt so that's my suggestion for this um thank you thank you next person Mr Gill man okay so um I will just so this is information only I brought it and it will be brief but um there's not an action item but it's [Music] there's part of a clarification we've moved we've already moved on to this now so Veronica has to say Well I'm we're moving on on this one so I will just give the update and then we will continue to move forward uh we provided that time I you know I apologize but we we have a midnight time and we need to get it to you so I just want to thank you on the table because it was requested from Community people and now you're stopping Community people from speaking so now I'm speaking so we provided public comments but I like to put a motion to table this and then vote it up or down second I have a second let's move on it okay your president never accepted the motion so don't can you provide a quick clarification on this that's happening right now yeah so on a on a motion to table you as the parliamentarian you have the uh the right to accept the motion or not okay so I do not accept the motion but I do people I want you to remember this because we are let's do for you I am fighting to hear your opinions and this is not important we have other important items on the agenda wait okay thank you so I'll give the report and I I disagree that I think this is important for the fact that it has the potential I have the floor trustee Marquez if you allow me to finish I promise to get through this very quickly but if there is a reason why we need to do this in my mind because everyone is continues to talk about bringing resources to the district we're we're in need of money and all these things this is an opportunity to get that so I think it is important I just want to tell everybody the report back Mr Gill can you mute um trustee Marcus's microphone please she's not respecting the fact that one member has this I hope they ask you to resign thank you very much they're more than welcome to do so they already have done so so this is uh this is a quick report um we did have that meeting as was mentioned um by in public comment you can find the PowerPoint from that meeting which has that information in the book for this month um you can go online to District 5 United and see the video that has presentations from the representatives from labor and from trustee Quintero as well thank you me Mr Estrada for allowing that um and the only the reason why I wanted to make sure we do this is because we voted on it last month to provide direction to staff to move forward but staff does not have Clarity on exactly what we um we wanted them to do so that's the only thing that we that I wanted to put propose here is that we have staff as which I think was the initial intent that we voted upon three to two to go out and look at the opportunities that may exist with regards to solar and simply bring those back to us as a comp report so that we can then decide whether or not we take action on it so that is all I wanted to do is to provide a little more clarity to staff in with respect to them not having to struggle to figure out what we voted on last month trustee Chavez that's all for my report trustee Chavez okay um I want to provide Clarity to the uh community this is a copy of when you have the District 5 meeting you used right here the Alum Rock Union School District logo the board did not sanction you to do that and the board did not sanction this trustee to do that either you just took it upon yourselves to act like the representative of the district as as the you win as you should have said that you were doing it as an individual not as the trustee of Alum Rock you did a panel and you did some people you asked some people there and he is not an expert in solar isn't an expert in solar either this man is an electrician none of these are experts in solar so why did you represent yourself as Alum Rock Union school trustee president as if the board asked you to do this so to me you're going Beyond uh you shouldn't have done this you should have stated in that this is what you were going or your intent and then get everybody on the board and say and have a vote if they want to hear it but you represented yourself as the spokesperson for NG so the community members were telling me why is he doing this isn't there policies or policies that he's violating and I said yes there is more policies that one you're not supposed to act as the representative and the spokesperson for NG NG represents NG they need to have a representative for their best interest tell me who's are you representing you're you stood there and represented the district like the trustees said it was okay for you to do that you are one person yes you might be the president right now and there's another trustee but you didn't get the approval you're acting like the past board members that they did in the other board things like this and to me you stepped Over The Line and oh thank you members said so and they when I heard this I wouldn't dare get on the board meeting on the District 5 meeting one because if I would have been there and this is what we are voting on now there's no vote uh when you put approve or it's not approved excuse me in the board book it says discussion and or action so you put it like that to make it vague you you could have put this is only discussion no it says information only there's no action on this item action right here it says in the board book action and in other cases we have taken a discussion and turned it into an action you did not you were not board sanctioned why did you represent yourself as that so A Lot okay so I've heard the questions and in the interest of time I appreciate those questions I'll respond very quickly because we gonna get done at 12.
you opened up a can of worms that along the community seen you and do this and later on heard about it and now there's going to be some kind of like what what were you trying to do you're you're you're actually separating the board by doing something like this we're supposed to be one board we're not supposed to be one trustee here one trustee there and follow an agenda that everybody else didn't agree on we're supposed to be in unity with one voice and you okay so I I appreciate everything you're saying I find a lot of it frankly ridiculous I did not make make any reference to NG at any point in that um you said it was a presentation it was in the book number two I have uh excuse me I have I have the floor now I allowed you time I have the floor to quickly Mr Ruiz does any board member have the ability to to individually go out into the community and inform the community and express their thoughts on any particular item yes okay thank you um so I see trustee Quintero and then trustee Marquez after that oh and and can I just add further clarification um Can a board member in public say they are a board member and they're speaking as a board member yes your board bylaws addressed this situation okay thank you trustee Quintero um and the interesting Marquez after that and then if we could just get that clarification on the direction from last month and move to the next item Mr President I think our colleague some of our colleagues need to go and give a little bit more training and then read the the bylaws it's unfortunate uh and then this is anger and yelling and screaming is just a little over the top um man you're taking his way back you're trying to make Alum Rock great again or what um it's just it's it's very disheartening to see this um we go out to meetings we give out our business cards and they have the logo of Alum Rock um because we're elected we don't stop being uh school board members once we you know walk into a meeting and so we have the ability to go and provide updates and inform the community that's exactly what I did and for our colleague Chavez to go around trying to make it seem as if there's some sort of Nefarious thing taking place it's just ridiculous this is us taking time out of our time to go and tell people what happened at the board meetings and to correct the record because there's a lot of misconceptions a lot of have truths unfortunately a lot of them happen to be motivated by I don't know why it's perplexing I could say it but it's unfortunate there's a lot of um a lot of distorting in the truth taking place uh and there was there was an expert on clean energy the gentleman happens to be a PhD from Stanford I'm not sure what better credentials you want to get rather as opposed to a a top tier of a worldwide institution um so yeah I'll continue I go out to meetings and I speak to the public and I let them know what's going on and I inform and I provide updates um and uh trust me I don't know has the logo there the same one that's on business cards during covid that's the equivalent of a business card so um yeah it's unfortunate that some of our colleagues are trying to take us down okay thank you Mr Quintero Mr I mean trustee Marquez and then I'll see if I can provide that direction to staff as requested and then we could move on trustee Marquez so it is ironic that um Andres is saying I don't know whether it's so hostile and anger and that is exactly what your character is and it's like calling the kettle black Andres you have that same temper you have that same temperament so I I don't know where you're coming from but as far as you um you know what what trustee Chavez said is totally true I am president of Allen Rock School Board and we are doing things here though then you started explaining and it the perception in politics is what counts doesn't matter how you meant it doesn't matter how it is it's the perception and if you ask the attorney that we have here and he is not going to be trying to cover you up or cover your you know what he'll he'll tell you he should tell you in politics it is the perception and the perception thank you is that you you are out there doing this and speaking for the board and I certainly didn't appreciate it for several reasons one of the reasons was that how many women did you have on your panel none how many people there was no panel there were guest speakers none how many people attended and were there women there none this is what's an all that's inaccurate there were numerous women and they provided comment there were comments from who women no they're not do not lie because there was one video you could watch the video I mean one woman there and that brought me back all the information and she has the video okay so tell you here so I understand for me you're nothing you have no respect for women you it is all about you you you that's why you get to mute me you get to just say I you know mute her please and you get to make a long comments as you want as many comments and you've been asked by the community we don't want to hear your comments you take you long and you don't stop it's all about you you you and I don't appreciate this because this is not a team you are not a team player you exclude yes the one woman you're gonna have on there has her hand raised right now to come to your protection to come for unless protection and to come to the superintendent protection but you know what it's okay because we all know out here and we've had women talking about this so what you did was wrong I do not appreciate it Shameless thank you very much thank you very much for your comments well take I take your comments um as they are intended and thank you for them and I'll call on trustee and then I will um try to provide the clarification and we'll move forward thank you I was sitting patiently and uh the fact that um she mentioned me um the only uh ones that I'm protecting that I'm coming to protect right now are our children um so on on behalf of our children um I'd like to you know reiterate that um you know let's just continue to remember why we're here and you know it's okay to disagree um but we get to move forward um I was not on that pad no Dolores I would love you know I was not invited so I'm not sure um what you meant by that I was on there but I did watch it later Ernesto and Andres and I do appreciate your time um because I know how much you know it takes away from our families and everything else that you took to go speak for district right so it is a part of our conscience as well as elected leaders representing our communities and informing them and so I appreciate you guys both taking that time to do that I did watch it later very informative so informative that um you know I heard some of our members in the community that um had opposed it last month now um are for it so um thank you for doing that and I look forward to hearing more about it um Ernesto and you pushing it Forward um you know for acting item in the future okay thank you so um the direction that I that we voted on last week I think or last month was to provide staff um we we asked them to bring us back um options that we might have in terms of looking into a solar program so that would be whatever type of payment um that or loan programs that they may have not loan programs but the ppas um or whatever options that we have that you would bring that back to us as a report so that we as a as a board could then look at the options and see if it makes sense and then make a decision at that time so is that does that provide enough Clarity um Mr Chang for um for what you needed in terms of direction from us on our vote last month okay thank you very much so we will move forward to item um can I make one more comment no we're moving on to the next item 8.01 approved 45 day budget research can you can you please respect the process trust me Chavez or please read it because I would say okay Mr um Mr Gill can you please mute everybody's microphones until um they are unmuted so we can move the process forward um I hear I've heard plenty of comments about wanting to make sure that we move the meeting forward but yet we're still continuing to drag so um item 8.01 approved 45 day budget revision uh Miss uh Dr Bauer do we have a report on this Mr Chang has the report okay Mr Chang uh can we unmute Mr Chang Mr Gill thank you um I do need permission to share my screen as well if you haven't done so you don't have permission are you able to there we go thank you okay um good evening board president uh Board of Trustees and superintendent Dr Bauer um this evening I'll be presenting the 45-day revision um but before I get into the presentation um I do like to provide some clarification on why we need to do a 45-day revision um in a normal um the budget that is being proposed by the governor um at the May revised is typically pretty close to the final budget that gets approved by by the state um sometime in June but this year was quite different um there was some major or drastic changes from the Navy Vision um to the final budget that the state finally adopted um so when they change their state level um that trickle that trickles down um to the district level as well um so those are the main reasons we're bringing you the 45-day revision um and as such um some of the topics that we'll be covering in this presentation uh will include uh key events and timelines um key assumption used um in building this year's 2021 budget and also the multi-year projection um some key changes uh from adopted budget for to the 45-day provision uh we'll also be going over the general fund multi-year projection and then lastly um next steps and some future consideration so some of the key events and timeline is going to be a rehash of what I presented back in June but I think it's uh beneficial to kind of go through that again to better understand uh why we're here um tonight two percent of 49 45-day revision um so first of all you may recall that uh back in May 14 2020 um Governor Newsom uh presented the May revision um subsequently after that on June 3rd uh 2020 um the Senate and the assembly um reach an agreement um on the 2000 2021 state budget uh which was significantly different from what the governor had proposed um and then on June 15th um the Senate and the assembly uh approved the legislative legislative version of the 2020-21 state budget might not um reaching a final agreement with the governor and then on June 22nd 2020 um Governor Newsom and his legislator uh finally recent deal on the state budget and then on June 25th um the district itself adopted its um 2000 2021 uh budget which is which was based on the main revision um as prescribed by the Santa Clara County Office of Education um and then on June 29th um the governor finally signed um the budget into um into place uh which then starts the timeline for the 45-day abbreviation um so that covers the key events and timelines at least with us to now um the first assumptions that we'll be going over is um enrollment and so this slides right here shows you the involvement projection that was used um back in when we adopted our budget um on June 25th um as you can see in 2020 2020 and 21 um you know we had a projection of 8934 and then 2021 22 8686.
um and then 2022-23 [Music] um so since then uh we've been keeping track of our enrollment date with student services to see um what are the trends um what numbers um we have and based on the July um 30th um data numbers that we had uh we have streams suggest that to kind of reflect um what is um more realistic at this point and so for 2020 21 um our involvement projection is at eight thousand to 527 uh year 21 22 um 8 216 and then you're 22 23 7916. um and again these are projections we won't know the true number um until actually uh next week when school starts and then also just kind of keeping tracking that uh over the next two weeks um to kind of um figure out how many students are are actually attending our our districts we've gone to a more conservative projection as you can see right here over the three-year period it averages about 424 student losses per year even though the first year see a a huge Spike of 663 for over a three year period um it's averaging about 425 the other assumption is the district's lcff um So based on the enacted budget for year 2021 lcfs funding will be based on 2019 uh 2020 p288 however there's no Cola um for lcfs funding you may recall that uh based on this is vastly different from the May revision where the governor proposed about a 10 cuts to lcfs so this was a huge relief for the district um in addition to um the the funding not being cut um by the 10 um some some provision has been placed for 2020 where the state would not be collecting Ada uh for this current year but however um to receive funding um districts still need to take attendance uh student attendance on a daily average on a daily basis sorry for a year 2021-22 um lcfm lcfs funding will be based on the greater of current or prior year um or actually current year or 2019 uh 2020 T2 Ada and this is actually a really good thing for the districts as well because uh for declining enrollment um typically is based on the current year or prior year but since the state is not collecting Ada for the current year they're going back uh one more year which is 2019-20 so this is a huge relief for the district as well um and then for fiscal year 2022-23 um lcf fund lcfs funding will be based on the greater of current Euro prior year um again all three years um do not have any Cola applied to um lcfs um we have one charter school um which is aptitude and we have to calculate that lcff separately from The District's funding um similar to um to the district for 2021 uh that lcfs is also based on 2019-20 P2 Ada um no Cola no attendance will be no Ada will be collected from the districts but attendance is still required um in year 21-22 um it's based on the greater similar to The Districts based on the greater of the current year or 2019-20 uh p288 and again no Cola and then this is probably the biggest difference from the districts um in year 2223 um Charter Schools funding uh is typically based on the current year uh they typically don't have any prior year protection um if they were a declining uh District the two previous years were aptitude um was um as a response to covet so they did get relief as well some protection um this slide shows the uh the difference between um on lcss from what we budgeted at adopted budget um versus the 45-day revision um so the first year in 2020-21 um you will see that the total um lcfs funding uh for the district and aptitude um is approximately 90 92 million dollars um based on the 45-day revision um lcff improved to 99.5 million dollars so a difference of about seven point uh almost 7.3 million dollars um in year 2122 um total lcfs funding at adopted budget was uh 89.5 million dollars um that funding improved um to 99.7 close to 99.8 million dollars um based on the the enacted budget and so there and in that year um there was an improvement of about 10 points close to 3 million dollars and then in the year 22-23 um at adopted budget uh we have projected to receive 87.2 and then in the 45-day revision um that number approved um to 89.5 the one thing that I want to point out here is that when you're comparing lcff funding um 12 cff funding um from year 2122 to 22 23.
you'll see that there's a significant drop um of close to about 10 million dollars in lcf on the lcsf funding and the reason being is that uh since Ada was not collected for the current year um we have a one-year two-year uh respite uh for year 2021 and year 21 22. um but then um in year 22 23 that's when they applied um the actual decrease in Ada um as we're collecting Ada for starting year 21-22 so the biggest probably point I want to make here is that you'll see a big drop off in lcfs funding uh from year 21 22 to year 22 23. um so that was for lcss um you may recall that um the the budget also included some cares act one-time funding from the federal government and there's various parts of money that uh districts were supposed to be getting and based on the adopted budget um the first part of money that I'll go over is the Esser money um the answer money was pretty straightforward and so at adopted budget uh we did include that money in there it's close to three million dollars is 2.9 um and so there was no need to make an abbreviation uh at the 45-day revision um one one note I do want to make here is that out of the 2.9 Million Dollars uh the districts do need to set aside approximately two hundred thousand dollars um that we'll need to send to the private school because they're entitled to um some of that money as well um with respects to the other pot um there's learning loss money one-time learning loss money that was allocated for students with disability um and at that point uh the the estimate was um 2.1 million dollars um but at the 45-day revision um the state budget did kind of divided that part into that money into two parts um and the two pot is the one-time Corona virus funds and then the second one is the gear funds um that total amount those two pots came out to about 2.2 million dollars so a difference of about a hundred and thirty one thousand dollars uh so we did make those revisions and this money specifically for special ed students and then the final part was the one that was that had a lot of unknowns um there was some um heated the battle between the governor and although the legislator how this last part was supposed to be allocated to districts um and so due to unknowns would not be not any of that money in the adopted budget uh until we had some clarity and that was based on the recommendation of the County office as well um but as we as the inactive budget came out um those funds came out to um a close to 884 thousand dollars um based on lcfs allocation another 720 thousand dollars for um lcff uh based on lcff uh for the corona belief funds and then lastly um the one-time money was was allocated based on the stubborn rental and concentration um uh formula and so those three parts comes out to a little 8.7 million dollars um and so if you're looking at the total funding one-time funding for the district um related to um the cares act um it came out to about 13.9 um million dollars close to 14.
um if you look at it in a total so that's on the um that's on the ex Revenue side so now we're going to go over the expenditure side in terms of the key assumption used um the first four bullet points here um just kind of General um our second column uh we're increasing that for all three years um the Persian Spurs rates uh were based on the enacted budget there are really no changes uh on that uh when you compare that to the main revision um the contributions were special ed programs uh will increase in the out years um and then be required to maintain a 30 contribution to routine repair or routine uh restricted maintenance account and we're meeting that for all three years some other additional assumptions that we built into the budget um starting in for year 2021 for the current year we built in a reduction of 30 certificated um FTE uh at approximately 85 000 average salaries um to align with decline enrollment um you may recall that the board also approved um resolution 42-1920 which was the elimination of classified staff um and that's approximately three hundred ten thousand dollars um and then you also may recall that um at the adopted budget because of the um because it was based on the May revise and the main revised was proposing those Draconian cuts um in order for the districts to be able to meet the three percent Reserve in year 2021 uh there was a plug there uh 4.2 for the districts to come back to determine what those reductions were but since now um the revenue had improved on both and on both lcff and um the federal funding uh we do not need to make the the 4.2 Cuts any longer um and then the last bullet here uh reflects a transfer of approximately 9.5 million dollars of expenditures from the unrestricted general fund to the restricted general fund uh to utilize pictures at one-time funding and the reason for this is that um all the cares act money um are classified as restricted and so for funding for budgeting purposes um they are budgeted on the uh restricted side of the general fund um however there's no Clarity uh yet in terms of um what those money can be used for and so most of the most of the the costs and the expenditures um from now until probably December is going to be incurred on the unrestricted side so until we we get some clarification from the state what this one can be used for um we identified an amount that we need to transfer from the unrestricted site to the restricted side to be able to utilize this one time funding a year 2122 we also included a reduction of 20 certificated ftes at an 85 000 average salaries to align with decline enrollment um and again due to the cuts um for year 2122 uh we also had identified that we needed to make 16.2 million dollars in cuts to be able to make the reserve but due to the improved revenues for lcff and cares act uh we do not need to make that uh cut any longer uh for year 2223 um be included uh 15.
certificated ftes again at an average salaries of 85 000 to align with projected declining enrollment and um and in that year we also identified that we needed to make approximately 22 million dollars to meet the reserve but that number has decreased to about 9.9 million dollars now um in the third year we still need to make the 9.9 million dollars enable to make Reserve uh but that came down from the 22 million dollars um and mainly the reduction of the amount that we need to cut was mainly due to the Improvement of lcfs and also the one-time money that we're getting from uh the federal government so with all those assumptions um this slides right here shows you the unrestricted general fund multi-year projection um we're projecting to start um the year with approximately 10.2 uh million dollars close to 10.3 and beginning balances um a total revenue of 80.5 close to eight million dollars um the one thing I want to point out and as a reminder the 9.5 and other adjustment in this column right here um is the expenditures that will need to transfer as I mentioned in the previous slide that will be transferred um from this unrestricted side to the restricted general fund um so that would reduce um the expenditure in uh that would bring the total expenditure in the unrestricted general fund to 81 uh million dollars um and with the with the Improvement of the lcff and one-time funding that we're getting um we're projecting to end the year um with approximately 15.7 million dollars um of pending fund balance um in year 2122 uh we're projecting the revenue to be 84 million um expenditures 89 because um that one-time transfer goes away and now the expenditures um kind of aligns back into uh the normal Pace um and as you can see here we're starting to also um use some Reserve so we started the year with 17 15.7 and we're projecting to end the year at about 10.5 um million dollars and so in year 2223 um as I mentioned earlier I mentioned earlier if you see the row that says lcff um in year 2122 you'll see that the districts is projecting to receive um a little approximately 99.7 99.8 million dollars and then there's a big speed drop off um in year 2223 for all those various reasons that I mentioned earlier um so that's going to be the major change in Revenue when you compare 21 22 um to 22 23.
um and then for total revenue it's a 73.4 million dollars uh total expenditure expenditure comes out um to about 80.3 um but I want to go back a little up a little um a little bit up um in this in this graph right here because as I mentioned in the previous slide that in the third year the districts will need to um by in three years will need to identify it approximately 9.9 million dollars in Cuts in order for us to make um the three percent requirement and so uh while while the the the Improvement in lcff and one-time money um did help the districts pay afloat um we still need to make identify Some Cuts over there over the over this year to be able to address the 9.9 uh million dollars um in the third year out on the restricted side of the general fund um district is projecting to receive um 53.3 in Revenue um and um projecting to spend um all of that in in the restricted side for year 2122 um total revenue of 41.4 um and again to spend down all that Revenue um and in year 22 23 um close to 42 million dollars in revenue and again um all those funds would be useful it's specified purposes and then on this slide right here just combine the previous two slides um just to show you the total general fund as a whole um again it's projecting to start the whole year the the year with about 10.2 um and then total revenue close to 140 million dollars uh with the total expenditures of 134 million dollars um and ending a year with about 15.7 um and then starting the beginning balance in year 21 22 uh 15.7 million uh with a total revenue of 125 million um total expenditure of 130 million um projecting to end the year with about 10.5 um starting um the year with 10.5 and beginning balances uh total revenue of 115 million dollars um again the 9.9 million dollar stack the districts we need to identify um over this year to be able to meet that shortfall in order for us to make the reserve requirement in year 22 23.
so next steps um you know the districts will need to submit the 45-day revision to scoey for their review um also something to keep in mind that negotiation has not yet settled with area and CSEA uh for last year uh 2019-20 and 2000 and current year 2000 2021.
um we're still waiting on the outcome of the new stimulus funds uh which is called the heels act um and so depending on the outcome of that the districts may get some relief um but we won't know for a while because uh as of today um we learned that the um Congress is off break until about September 8th um and then in in December is when um we will be bringing um the first interim report um to update the board uh with us with the district's budget and then just for information here I'm providing um some guidelines that the the is um is prescribing on how um The Learning loss mitigation fund should be used and the first one is to address learning loss or acceleration progress to close learning gaps through the implementation expansion and enhancement of learning support that began uh before the start of the school year and the continuation of intensive instruction and support in the school year um the second parameter is just extending the instructional year school year by making adjustments to the academic calendar increasing the number of instructional minute provided um during each year I mean each week or school day or taking any other actions that increases the amount of instructional time and services provided to People based on their learning needs um the third parameters is providing additional academic services for people such as diagnostic assessment of people learning needs intensive instructions for addressing gaps and core academic skills additional instructional materials or support or devices or connectivity or the provisions of in class and distance learning and then last parameter um is providing integrated people support to address other barriers to learning such as the provision of Health counseling or mental health services uh professional development opportunities to help teachers and parents support people in distant learning contexts access to school breakfast and lunch program or programs to address pupil trauma and social emotional learning um and just one last comment regarding this guideline is that I know they're pretty broad the state is still working on some cleanup um Trail build language that should be available in the next two or three weeks or so um and that will give some clarity in terms of what this money can be used for so we're anxiously waiting for some specific guidance on that um and with that I would be happy to take any questions if there are any Chief thank you thank you before we get to the questions I just want to check in so we have 30 minutes remaining um everything that remains on the agenda needs to be approved tonight with the exception of 9.0 oh sorry we need everything approved tonight um and so we my um proposal is that we we work to approve everything tonight these things have to be approved tonight um we do so by um moving closed session to a different day potentially Friday or Saturday or whenever we can make it happen and um and reducing the public comment time on these as we mentioned that we would do in the beginning if the time necessitated it so um quickly as possible um colleagues any thoughts on how we can go about Expedition raise your hand and then we'll just unmute you trustee I mean so um I think motioning this so that we can get that first and foremost [Music] um yeah and maybe uh I don't know I mean we have to do it uh limiting or to zero our comments and Publix we have to take public comment we can limit our comment okay I would say ours to zero unless what I would propose is one in one one minute public comment one minute us if any we don't have to say anything because people might have a question they need for the vote for their vote yeah uh so that's a proposal trustee Quintero it's just instead of talking about this just move on and run the meeting man well I got to get consensus on this um so are you in agreement with that trustee Quintero yeah let's move okay um so since we have consensus unless there's some big objection from anyone else we'll go with that okay I don't okay I don't know uh any questions or comments for or public comment one minute um per person on the item um for Mr Chang item number 8.01 and then if you if you have a question board members please be prepared and we'll go each one will get one minute if we need it Mr Gill public comment yeah there is one Veronica okay Veronica okay you have if we could change that Mighty Bell to one okay I'll just get going and I'll stop at one um good I thank you um yeah I just wanted to thank you Mr cabera for having this great um uh presentation and letting us know what we're looking for um and projecting a higher amount of numbers if so we are losing a lot a lot of students and a lot of that reason if you were out there in the floor talking to families you would have known that they are frustrated because our plan is not a sustainable plan to open our schools okay um and again it is all we're asking is for collaboration and unity or we're asking is we might not agree on the same things but we still want to be heard right we still want to be heard and making sure that um just being hurt that's all we're asking for really just we want to be heard as parents I don't want to pull my kids out of here because I believe Alan Rock can change and we will do better and they deserve it they deserve better so thank you so much um and and on my last comment I did somebody lower my hand by the way but thank you for limiting your time and thank you for your comment any other public comment Mr Gill and Maribel you can run the clock we'll just know even if it's at two we'll just know that when it gets to one that's the time no more okay thank you any questions or comments from the board trustee Marquez and the rest unrestricted restricted combined General funds on that page the assumptions or the prediction or whatever you want to call it right now is that in 2023 our budget or revenues are going to be almost 140 million am I reading um what slide are you looking at trustee Marquez the unrestricted restricted combined General funds yes um what was your question again I reading this correctly saying that in the your 2021 which is this year we're going to have 140 million dollars that is correct with that that includes that includes state federal um local Revenue like you know rental and stuff like that so it's it's a combination of all the general fund Revenue okay so then can you break down for me what's what's our budget with the enrollment of 8 500 students that is our that is our oh in terms of what there's different okay people we have Ada for 8 500 students what is the amount of money we should be getting so important thing here so for lcfs if you look at page if you look at page seven of the presentation you see them in lcff dollars um in the column 45-day revision based on an active budget the districts will project this project to receive um approximately 99.5 million dollars in year 2021 .
so this is most likely the last year that we're going to be this is the last year the last year it's it's echoing yeah you said this is the last year that what that we're gonna something looks like the last year that we may be looking at a budget of 99 million or do we expect that to be in 2120 21 22 as well um and again as I mentioned earlier um you know the the state did provide some respite um for districts that are in declining enrollment and part of the reason is that um you know the 21-22 year they'll be using uh the 2019-20 Ada um because they're not collecting Ada in the current year thank you trustee Chavez um on my one-on-one with the superintendent I asked her how come in the in the last page of this in the middle column that it said 19 million and so I said why are we going to get so much money that you and then the other years in comparison around seven million and I asked her if that was covet money and so the further the dialogue got um it we came to the conclusion that we didn't cut the 14 million dollars that we were supposed to because they said they they told the district that we couldn't play off staff and stuff so what we have coming up is major cuts for next year or something and so I asked the superintendent why aren't we making these Cuts now and are we just cooking the problem down the road with the can down the road and why aren't we adjusting for the money that we're not gonna get in the years to come it just to me doesn't make sense to pass this if you know you're going to be hurting a year or two from now thank you thank you uh uh Mr colvera is any brief response you can give to that or if not that's okay we can move forward not okay he should be able to move well I don't know if there was was there a question in there it ended on a statement about the question yeah so and and I think and I think the reason why we didn't make any immediate Cuts was there was so much uncertainties uh with what the state was proposing remember um in May the state was proposing some Draconian cuts um to the level of you know millions of dollars um just an LC effect alone itself but we learned that in about a month or so uh what the excuse me state was proposing and what was going to materialize uh was going to be significant difference so we don't want to take any immediate action um until we got all the information and now that we know for certain how much money we're getting in lcfs dollars um and also the one-time Federal funding uh we will will be able to project more accurately in terms of uh what the budget looked like over a three-year period And as such would improved funding on the lcfs and also the federal funding level we're projecting this year to end the year with about 15.7 million dollars um but that increase in fund balance is mainly just the one-time money that we're getting that's keeping us afloat um and so that one-time money is going to go away next year um and in the next year we're also projecting to end the year with about 15.5 um it's a third year out that that's presenting some some difficulties for the district mainly because of the drop in lcsf uh dollars because if you look at what we're getting in year 2122 versus 22.23 you'll see a 10 million dollar drop-off and so we'll need to identified where we need to make up the difference okay do any other board members have any questions or comments um trustee Herrera Loretta you have a comment it's you know about 11 41 now and so Luis I don't know Rogelio can give us Direction because it doesn't look like we'll be done until um midnight and I know there's things that we have to look at so um yeah and call the vote for this I think as soon as possible you might want to set a meeting to continue this meeting uh within the next 72 hours if at all possible or by Monday so that the rest of the business can be resolved okay so we could we could set a meeting tomorrow or Saturday to finish the balance of this agenda and to do closed session yes okay so that's an option doing a recess and keeping it open until Monday or I mean sorry real quick if you say till tomorrow could that be midnight like tonight continue at midnight Midnight no I'm talking about well I guess midnight after midnight is technically tomorrow and I'm not sure what that's within the spirit of the of the bylaw but Rogelio I had a question so uh Quintero look we have a total of um about four or five items can we not get through five items that's what I'm hoping two minutes if we stop talking and we just focus yeah so within five when we're in five minutes we'll let's revisit this and yeah trustee Marquez I did I did want to let you have this opportunity to quickly ask what you were going to ask right now I did I asked rogelia but um my colleague kept talking Rogelio if we if if we go on recess right now and leave it open until Monday to continue is that legal um it would have to be agendaized as a special meeting okay so we have some options so let's try to get to within five minutes and see if we need those options so um so any other comments or questions on this item um from the board members okay so um there's a motion to approve was there already a motion no right uh is there a second by trusted is uh trustee Chavez your vote to approve item nine I'm sorry 8.01 nope trustee Marquez no I have so many questions and We've ran out of time so I will not approve it can I ask a question in the middle of this vote about if if this does not get approved tonight what is the consequence and if we move it to that next meeting to have more time Mr Ruiz yeah I'll defer to Mr Chang is are you up against the deadline on this yeah the deadline is actually tonight okay so then I will vote Yes on this thank you for the clarification um trustee did you vote trustee Marquez I'm sorry yep I think I have too many questions that's right trustee on the uh Marquez I mean trustee Quintero I'm not sure man let's play chicken and see if our colleagues were relying on us to go ahead and vote for it now I'm gonna vote for do the responsible things okay so three motion passes three to two with trustees Chavez and Marquez um in opposition item 8.02 approved delegation of authority to approve bids and award contracts is there a motion to approve 802.
emotion is there's a second is there public comment on 802 Mr Gill which one are we doing 802 is there public comment Mr Gill none okay questions or comments for the board on item 8.02 okay uh one minute uh trustee Chavez and then after that trustee Marquez I'm gonna sign it yeah go ahead okay um one of the big things that happened with deltera and they're giving too much power and removing the board from any of these decisions to me looks like the same thing can happen again um I will be building no on this for the reason that wait I'm not done yet so for the reason that we should rethink this because as far as emergencies goes and the way the board policy is right now I think we should probably keep it like that because we already voted before to give her in other in the other last year on that meeting to give her that um go ahead if she stated that it was an emergency like the office that was an emergency according to the superintendent thank you okay thank you trustee Marquez yeah you want to tie me uh trustee uh Chavez sure let me just one second go ahead it started right now okay so for me I I don't know what the urgency is for this there's always there's there's always something behind why why you she brings this and the three of you will vote to give it to her but I want to know how how do we get that much authority to one person who has no background on what it calls for construction [Music] electrician I mean really you know this is clear clearly anybody can see that there's an agenda here behind and like my colleague just said that I forgot about what she had just mentioned right now the last time the agenda was to give her authority over emergencies and the first emergency she had was to renovate her office at a tune of a hundred thousand or ninety thousand you know and that was right after the cuts so we did a 14 million dollars so for me uh I I know there's an agenda here behind it okay so that's the time thank you uh trustee Marquez someone who does not have the quality the trustee markets your time is up please okay go ahead uh so in regards to this item um I sorry uh it's urgent need nowhere here does it say emergencies so it's an urgent need and you know the responsible thing to do for our children um is to pass this in regards to you know any urgent needs that happen um I you know I I want to make sure that our you know children I mean right now we don't have to be at the schools but when and if we go back that our children have a school to go to that our children have a classroom to go to that they have a plan um unfortunately um go ahead um you know there it's hard to get our schedules together when you know we're called like for right away sometimes it takes you know a week or two so um this is just for Urgent needs and so the responsible thing to do for our children is to approve that I trust uh it will um that our superintendent will make the right choice uh because even in the past when we had time to review elteras that still got passed so that's it thank you trustee Quintero two um I will uh I'll go in I see that there's public comment I'd rather listen to public comment and then we already asked for public comment oh oh okay they had you did not recognize them my phone's blown up by three people that were all upset trustee Quintero um yeah my point uh was that there's a lot of concern about Belterra well yeah the fact of the matter is that uh can we please mute her microphone thank you Mr Marquez Karen Martinez voted for those contracts and ex when when the when the superintendent explicitly uh um recommended not to do so and so for now to go ahead and uh start uh alleging all kinds of Nefarious activities and stuff that sort is kind of a like she said pot calling the kettle black okay I won't have any comments on this um Mr Ruiz just for a point of clarification um this delegation would not uh doesn't mean that a contract has to come back to the board for ratification under state law every contract has to come through the board for approval or ratification this would just the so just to be clear the delegation is if an issue arises before a board meeting before a time when approval can be given then the board is delegating that authority to enter into the contract but it still has to come back to the board for ratification all of your contracts include a termination for convenience provision which allows the district to terminate the contracts on 30 days notice okay and then quickly um for clarification when we did provide opportunity for public comment and there was none at that time do we still need to go back retroactively and provide further comment or in the interest of time can we move it forward or do we have to go with public comments no you can move forward if that's your election okay unfortunately I I I do want to get you have to get these things approved tonight as best as possible so um I'm going to go ahead and move it forward at this time so yeah um item 8.02 trustee Chavez no trustee Marquez please I'm you trusty Marquez trustee Marcus you need to mute yourself now I think okay you could just give a thumbs up or thumbs oh there you go okay I know translator I'm sorry I didn't hear you yeah I'm sorry the Lord spoke for me uh I yes okay uh myself yes trusty Quintero hi okay motion passes three to two trustees Chavez and Marquez um in opposition item 8.03 approved citizens Bond oversight committee appointment is there public comment on this item Mr Gill are you we're not uh we can there's none okay okay there's a motion to approve is there a second on the item five second okay second by trustee Quintero is there questions or comments about this item by board members trustee Marquez you have one minute this is for Rogelio so if um if we have the final say how is it we didn't have any information prior you know to go and enter help in the interview or sit on the interview or listen on the interviews and now they expect us to vote on this well you know it's it's within the power of the board to create its own subcommittees to to make a recommendation to review the candidates and make a recommendation to the full board I'm not sure what process you have used in the past for these types of appointments it was in the 12 years I've been here there's never been a process that has included the board to vote on it we just vote blindly because they give it to us and you're still referring to 803 right trustee Marquez the appointment of a cboc the appointment on that oversight committee position that became open okay trustee Quintero uh yeah we get the applications and we look at them and we can decided whether not only support there's really no interviews it's very difficult to get people to serve on this committee but I went out there and I looked for people while I was a member I still go out there and I encourage people to apply um so I'm very glad that this uh individual is willing to participate uh in this uh in this body okay thank you any other questions or comments from the board trustee Chavez I want to thank the person for stepping up if you want to be on the board because it is hard um I know that in 2018 I wanted to be on the board but um I guess the one who was the one in charge of the board because I was running in the same race that he was even though I was a business person and they kept asking for a business person didn't allow me so I think this process of coming to the board is better than uh the way it was before when somebody uh certain somebody wasn't allowing me to be on the board for the simple fact that he didn't want me running as a candidate thank you okay thank you I will just say um um you know based on public comments sometimes we may have disagreements of how we think about things but I also appreciate them this individual stepping up into the role um and I will support this um appointment because of all the reasons stated and I appreciate people stepping into these roles of of for accountability so let's call for the vote trustee Chavez oh wait uh oh there was no public comment okay trustee Chavez yes trustee Marquez abstain okay trustee Quintero I myself I motion passes four in favor one abstention um trustee Marquez so we're at 11 56 we said we would check in at this time to see if we need to come back on all these items we have a few left um yeah I move approval the consent calendar there's a ton of stuff in there that's important let's just knock it out right now well we need 01 and O2 but you're saying okay so to take it out of order you're saying consent yeah okay so there's a motion on the floor to approve the consent calendar there's a second on the floor is there any public comment on consent items okay who's the first one and have the timer for one I'm sorry who is it Brenda zendeja okay Miss and dejas when you begin speaking your one minute will begin hi yeah I have can you hear me yes in the previous uh two three items but I was never called I just wanted to state that um I did have a comment on the giving authority over the uh the bids I just wanted to know um but I think I guess you guys already voted on it so it's pointless to say what I'm gonna say um but I was gonna say that I was just concerned about when this happens what is considered an emergency because when you guys voted on letting the city use the buildings for emergencies they considered this covet testing center a pandemic emergency and went ahead and opened San Antonio for a testing so I just want to know what is considered an emergency to give a superintendent that type of authority okay thank you and you had another one at least right Mr Gill yes I have Veronica okay Veronica when you begin speaking your one minute will start great thank you um and I also have my hand up um earlier but I guess it was never called um but I also have a question about it was already approved um but what can we be more transparent on what we're talking about given her our power it might be already in there because I was reading the board book and it's still very confusing so maybe more details towards that um and I know that things that need to come through the bore still um just want to make sure that everything is again very transparent and accountable for um and also as well as with the committee um it's it seems really hard to get it in committees which is why we also need the oversight Community oversight committee to make sure that we are supporting being more transparent and more bringing more accountability to here and supporting you all and so we're not in a rush like we are right now thank you is there any more public call me Mr Gill none okay thank you so um there's a motion on the floor to pass the consent calendar is there any other questions or comments from the board on the consent calendar okay see none we could call for the vote on consent calendar trustee Chavez excuse me abstain okay trustee Marquez Jane trustee hi trustee Quintero hi and myself I can send calendar passes um so we are at midnight we have item 10.01 which is information only and 901 and 902 which we'll need to set a meeting but actually I just Dr Barrick and you take since we're already at 12 can you just take a brief second to give an explanation of the the item that passed that there were some questions about the superintendent um you know an urgent making the the Urgent decisions this has to do with things like um there's a major plumbing issue and we need to fix it right away and so we will go through our facility MRT director to go to the appropriate process to select um the board will have to ratify the contract afterwards I just gave that as an example okay thank you I mean I know that's brief but I hope it provides a little clarification for people so at this point we need to um Set uh time to do these last two so we're gonna have to have a special board meeting for 901 and 902 and then also closed session correct Mr Idris yes and it has to be within 72 hours no you set the time now then we're just continuing the meeting right now so if there's a motion to set them yeah emotions right now right now no I motion to set it right now um that's emotion anybody's seconds so can you can you clarify the motion um just so it looks like we might have some confusion go ahead I'm um we can just set it right now and continue the meeting yeah so her motion is to set the meeting for 1201 a.m on today's date which is now August 14th you're meeting regular meeting was on on August 13th then can you explain to me how we are going to post this this uh meeting to the community so when you so when you adjourn a meeting in this way under the brown act you do not have to repost uh immediately you have to repost within 24 hours of the adjournment and so um it's an interesting dilemma but it seems to work uh the superintendent could still post tomorrow and meet the and meet the requirements I'm sorry I wasn't done um do I need to set an end time on that no okay thank you okay so there's a motion on the floor currently to um set our new meeting for today's date are we okay with saying 1205 since it's 1203 right now yes yes okay I mean there's a second by trustee Quintero trustee Chavez and then trustee Marquez with questions yes to avoid this the next time when I said one o'clock to move it I didn't mean we have to go to one o'clock but to we I've avoided all this and just gone through it and then if we end earlier then one o'clock great okay that's it thank you trustee Marquez that's because your name is not Loretta okay she's running the meeting this does not sound good this does not sound good and I beg your different uh Rogelio I beg your difference I think you're wrong here that and I hope the people really come down on this superintendent this board member president and you for moving in that direction and allowing this to happen because really tomorrow you're gonna post it and it's after the fact I hope they hang you guys for this because this is not right and talk about not being transparent this is the epitome of not being transparent and I do not want to be part of that Quintero um yeah can we just move on man can you tell us where the five thousand dollars came from that's that we can if we can refrain from those kinds of things I know we're throwing things back and forth but what that does is none of us any good for just talk about hanging people I know for I didn't appreciate that either but you know I'm trying let's try to get this keep this professional as possible and get this done in a way that is legal that is just um Mr Ruiz are there any questions as to transparency I mean we're not in any Rush at this point right so are there any questions as to the transparency of this either in a functional way or in a legal way to you in your estimation well I mean you have a board by law that says that you know you should try to end your board if you should end your board meetings by 9 30 and you can extend once um that was yesterday technically um so you know it's technically it meets the requirements of the law but it you know it it does feel funny because it's really continuing one day into the next so I I can out just quickly follow up in your opinion what would be the the most um logical way where you know it's not questionable in the next audit or whatever um that we should go about this well the you know and I know that's a putting you maybe in a tough position but use your opinion you know I'm looking at the zoom uh screen here and you have 44 participants in this meeting so it seems like you still have a large segment of the public that's here and prepared and ready to to listen to all the other Open Session items um an audit would probably say well you didn't really match the spirit of your board by law even though legally you might might have been within your right to do that so um that's the risk or the challenge that that you face and items 9.01 and 9.02 Dr Bauer they need to be they have to be approved by when well 902 has part of Title One title two title three from that we need the 901 is the um the the bell times we have on the mou with area that we start at nine o'clock we should be fine we'll just bring it back okay I mean if we're going to do one I would say we should do the the other as well but if 902 has to be approved today if that's what you're telling me Dr Bauer then I feel like we don't have because that you say at risk of losing out money losing out on money is that right yeah I mean we we have a deadline too so I think for me the responsible thing although it is like the as Rogelio explained it I think the responsible thing is to move forward in this way trustee yeah I I would agree and I know there was a vote so um I think we should move forward and you know I think our parents will understand that you know we get to talk about our um the responsible thing is to talk about our children's um school bell schedule because I know our parents are waiting for that and they wouldn't want to wait till Monday to just because you know some of us wanted to you know have uh a point you know to talk about hanging us and stuff like that not appropriate like we are here because we want to make sure that um our children and our staff have what they need um and that our parents have what they need some of us have you know work schedules to coordinate with and um I think our community will understand that you know we had to continue this meeting today um and I'm more than happy to answer any questions to community if they have any questions yeah so okay so did did we vote on doing this already yes no I thought we did no I don't think we I don't think we voted yet I'm calling the vote I think I have to call for that but I just want to make sure before we do it doesn't matter but the only reason why I say that I want to make sure that there's no other questions or anything urgent from any other board members before we call for the vote that's the only reason I say that word no problem that's not a problem at all so I just want so no one has anything else so now we can you can call for the vote uh Vice President also trustee um Chavez who seconded so the vote is to start this can you are you open to amending it now um yes okay to move to start this meeting at 12 10 um in order to finish these items that are crucial to the operations of our district uh trustee Chavez yes interesting Marquez no hi trustee Quintero hi and myself I four to one motion passes with uh trustee Marquez in opposition so uh we will go with item 9.01 and um just for clarifications so now we're not on any clock right that's correct okay so item 9.01 approves start and end times for a school year um is there any public comment on this item Mr Gill and and for these we at this point we could return to the two-minute um time for public comment um since we're not on a clock do we have to go through any process of like calling the meeting to order or anything like that um no okay okay thank you okay um okay uh who was it oh Mrs when you begin speaking your two minutes will start the bell schedule yeah yes or no okay is that your remainder yeah I just want a clarification if the bell schedule is set for Monday and if it is is there can you guys just extend the meeting and do it today so we have that uh done that's all Mr Ruiz we can't provide any clarification on that at this time can we well you are hearing that agenda item so 9.01 right uh yes yeah tonight okay or there will be given some direction we'll be given tonight okay uh next person Mr Gill thank you Mr Luis Veronica okay Veronica once you begin speaking your time will begin great thank you once again we are doing this long night um and again I feel like we're this is what happens when there's no chance even right here right right now you didn't get what you just gotta approve why not um the bell schedule is something I was here for and I knew I needed to be here for but um if this would have been a conversation earlier our families would have been much better place we wouldn't have to rush this um really looking for that transparency in here and not only that knowing what's going on because you guys just go back and forth and don't answer really our questions I understand you can address the public but if there's a question that's being asked we we really want to be um [Music] so I don't know what's going on and so you need to be more specific and clarify do it for your questions do it for the parents okay it's out of respect that is it that is all I'm asking for and with the bell schedule it is it is unbelievable that we have to do this right we could have had this a long time ago if there was a collaboration in communication that partnership that we're looking for and it's really it's it um it is for you um I really like I try getting you know how many times I call the district [Music] sorry Veronica that's your time your two minutes is up so uh we can move to the next speaker Mr Gill this is Jocelyn Mars okay uh Jocelyn Miss merch um when you begin speaking the two minutes will begin I thank you for uh taking my comment but I am a little confused in that first of all just for the community this the bell schedule is strictly start and end times and lunch time uh that's all that gets approved by the board and it was agreed to in an mlu that our start time would be nine o'clock so that and then uh as far as I understand those Bills schedule the schedules that are being submitted after the teachers have had their input uh area goes over those with um instructional Services Barb Campbell and I will be already have an appointment to go over those on Monday afternoon um so I'm not exactly sure what it is that the board is approving tonight but again the minutes are set by the state the start time has already been determined there isn't a lot of discussion as far as or movement or flexibility on what those start and end times can be thank you Jocelyn um is there any other public comment uh Mr Gill no okay thank you um before we go to Pub uh trustee comments or questions uh Dr Bauer can you just give a brief description of this item and and why it's on here and what we're approving here are being asked to approve this is for when we come back that's why I said it was not a rush but you know I think that the question from the community was to get it clarified Jocelyn was right on point we start at nine o'clock um then we have to have here to the minister we all agreed on the mou so this is just for the future this is not for right now I I heard I also heard um Jocelyn mentioned that there's a meeting that she has coming up is but so I'm am I to assume that that is not to discuss this or this is still in in flux there's we already the schedule and that is part of that um every school needs to work on you know the specific one that's what the parents are gonna get that and that was why it was good that we were able to reach an agreement so part of that is that everybody starts at nine o'clock so how the minutes are going to be distributed the teachers and the school are working on that or they have already worked on that and letting the parents know these Bell schedules are for the regular when there's uh when we are face to face that it doesn't seem to be anytime soon right now and and have the teachers and everyone agreed to these if if we come back hours is that all agreed to as well part of the regular yeah of the regular CBA those those schedules that are if you're present tonight they're part of they follow the CBA this this is the stuff that we do um at the very beginning of the year every year okay um any other questions or comments from the board uh Mr Ruiz would it be appropriate to invite Jocelyn as an area representative to just confirm what Dr Bauer has just said because she said she was she had some confusion and I want to make sure we're all on the same page can we do that to ask her to provide a presentation in a sense about as a representative of area or not not appropriate no I was fine I think that's fine I think what the motion might be on this is just uh it would be a motion to approve this bow schedule once the district returns to in-person instruction that way it's clear to everybody but I I think it's fine to invite uh okay uh move to approve this bell schedule once we come back to our regular scheduled programming so there's a motion and a second by trustee Chavez I believe yes um thank you for those things so Jocelyn I don't know if you I would I'm inviting you if you want to just um if we can unmute her and I don't know if she has anything further or she can confirm whether what was stated has cleared up the confusion that she had thank you it absolutely does and just for your reference those that bell schedule that Dr Bowers referring to and the one that's included in the board packet um Miss Campbell and I have already gone over it together and we're all on the same page so yeah that's for in-person instruction thank you perfect thank you okay um so if there are no other questions or comments from the board then we can call for the vote on this item um trustee Chavez item number yeah nine is this 901 let me go back yes okay 901 yes okay trustee Marquez yes yes trustee trustee Quintero hi and myself I motion passes unanimously item 9.02 approved Consolidated application and Reporting System cars uh for the years there's a motion to approve by trustee Quintero is there a second second okay there's a motion and a second is there public comment on this item Mr Gill no no okay um are there questions or comments from the board on item 9.02 okay so see none I will call for the vote trustee Chavez 9.02 how do you vote Yes okay thank you trust me there wasn't I called for it there wasn't trust me Marquez got it I was hoping that you would hear me but I had asked for a little explanation from superintendent on what this item um oh I didn't hear but um I think it's we'll chalk that up to technology and say that if that you can go ahead and ask your question uh superintendent we didn't discuss this on our one or one correct no we didn't so um the cars may I answer this say it again so this is this is easy go ahead this is our application for Title One title two title three to get our federal funding that's what you are approving oh I see so this is cars the one it's a different uh acronym Dolores is different from what you're used to yeah all right okay so with that clarification I'll recall for the vote trustee Marquez did I hear you say vote yes yes okay trusty Chavez I'll recall for your vote Yes okay thank you trustee Quintero hi and myself I uh motion passes unanimously um we might as well cover item 10.01 it's information only um are there any questions or comments from the or is there any public comment on this item Mr Gill 10.01 there is one from Brenda's okay Mr dejas when you begin speaking your two minutes will start [Music] um I just have a quick comment um I just noticed that uh our vapa director resigned um and I wanted to see or suggest that if I don't know if you guys are gonna hire anyone or not um I don't know how vappa is working right now with the virtual but can we um make sure that someone that gets hired has the qualifications to because this this guy was amazing he did a wonderful job and I think it's going to be really hard to find someone that can fit his shoes um and I just want to urge you guys to find someone that is you know um credentialed in music and understands this because this is a wonderful program and um if you guys can't find anyone is there a way that that position can be put on hold and maybe use that money for um I.T or for another program I don't know this is just a suggestion I don't know thank you thank you any other questions or comments I mean I'm sorry any other public comment Mr Gill none okay thank you any uh questions or comments from the board on item 10.01 okay oh doc I mean trusty Chavez um she raised a question and it's my understanding that in the contract with the teachers they have to have music correct is that is this uh this is a question not a rhetorical but um is that a yes or no Dr Bauer please we're supposed to provide music Rusty Travis yes thank you any other questions or comments from the board thank you okay so um information only yeah so that we got everything right yes okay so at this point um yeah well so I was about to say um we'll recess to closed session um and before we do so we'll is everyone okay with taking a break a quick break before we head into closed session yes okay so we'll say um five minutes and then Mr Ruiz will come back to this room for any report or we have to come back to adjourn right and report back give me a report correct okay okay um so should we give a Time on the what time we're coming back Dr Bauer Do you have a an estimate of how long we this may be hopefully one hour okay so let's say will it say an hour and a half because that'll try to cover that hopefully part yeah um so that would be well remember we need to be able to let the public know if we come back earlier right so I was just being you know mindful okay so is it better to say at an earlier time is it better to say that than a later time of course I mean you guys saw the the agenda there so it's up to you guys I don't know um I'm open to any suggestions from the board at this point I think an hour and then if anything I'm going to snow that Day by then but I think it sounds reasonable trustee Chavez how long does the administration think it's gonna take she said about an hour and a half an hour yeah I didn't hear you because you're going in and out of the zoom meeting she said an hour she said an hour thank you okay so um why don't we say we'll be back the projected time to come back is one hour if we need to come back and notify that we're taking longer then we'll do so but in oh I'm a Mr Gill yeah um but well we can't like like I can't be in two Zoom meetings at the same time so if you guys close the um the meaning for closed session and come back then that's the only way you guys can't be in two years at the same time because that's is it the zoom doesn't allow me to do that just to let you know can you make board president the host for the um the host of closed session I it doesn't allow me because since I created both meetings since I scheduled them it tells me that it'll end the closed session meaning and then I can come into the Open Session allow me to open it up without closing the other one [Music] okay so then if we do have to come back and say that we need more time we'll just have to close closed session close the zoom and come back and then reopen the closed session Zoom correct why don't we just say an hour and a half yeah I agree yeah okay thank you thank you trustee Chavez so that is what 2 am yes yeah okay yeah so um take a quick break and then we'll we'll go recess oh uh Mr Ruiz you need to call for any public comment on closed session oh yes I'm sorry um so is there any public comment Mr Gill we'll give it a second any public comment on um closed session do I do the future boarded request now too or that's when we come back request for future board items you can do it now if you like okay so either public comment on closed session items or um requests for future board items is there anything Mr Gill it is one public comment okay who was the person Anika okay Veronica when you begin speaking your two minutes will start great thank you um and again thank you um everyone and like I had mentioned before um you know many of you do not appreciate my comments and that is okay but um I think we're here to make each other accountable and to make sure that we are here for our children um I do want to you know thank you all for keeping um up with it but we need a better system we can be doing this especially as children start to go back to school so if you can also put that into the agenda as how can we create a better system where we're not staying up at two three in the morning um with these meetings um and so that is something that we can as a whole collaborate and bring as a collective a resolution for um and so I want to make sure that it gets into the agenda that we can come up with a better system instead of uh putting just so many things into the agenda and according to um knew some you know he also specified not to put so many things into the agenda if I have for you know just to as an FYI if Also if anyone who wants to clarify but I really really believe that um please look for a solution and not just you but bring the bring us to support you with that solution um and again thank you so much for everything you all do um and and thank you for taking our comments into consideration and really moving forward with many of the actions that we have spoken about thank you thank you uh any other public comment or request for future board items there's another comment with hibiscus Mr Vazquez when you begin speaking your two minutes will start thank you um just want to recognize a couple of things so one last week we had a forum on displacement which is impacting our community and also impacting the school system as well there's a market rate development happening real near near our Alum Rock Corridor where 800 units of market rate housing will be created uh most of these are single or single apartments or Studios that are not designed for families or workers the average income will be 120 000 at least and I want to thank the four and District representatives for showing up and advocating for Alum Rock families if there's other opportunities that we can work together to stop this drain and this displacement of our families then I hope that we can do so the second thing is uh thank you for um also uh passing the resolution for prop 15 um again every time we have an opportunity I will encourage you to like let's work together and educating our community around this issue we know that uh individually you could also endorse so thank you trustee Herrera uh for being a personal endorser prop 15 and we know that we have a funding problem here and in addition to some of the solutions being proposed that this proposition can bring um you know a substantial amount of money to our schools we know that data says that uh districts were predominantly attend receive 23 billion dollars less Across the Nation than white districts and lastly you know I'm disappointed on the term lynching being used uh on the in this board meeting um I just a reminder that it carries real life impacts of white supremacy on Mexican-American uh and African-American community members it shouldn't be used towards anybody in in our community or on this board so I just want to just say that and I hope that we can reflect on that as well as it carries a value in racist history and it shouldn't be used on anybody thank you thank you I was waiting to see if you got to Mr Vazquez did you have a public comment on I don't know if that was to any particular item in closed session or I don't know if you were getting to a future item for the agenda that's what this comment is where I well if you do have a future I don't I was waiting to see if you got to it but if you do have a item of the things you said for a future agenda suggestion please send that to us um and that's it so any other comments on the closed session items or requests for future board items there is one Brenda Sanders okay and just as a reminder this is um comments on closed session items or requests to bring uh future uh agenda items thank you guys for staying up um this late also I do have actually a request for a future agenda item I have been collaborating with beautiful day and um they want to do a beautification day at Linda Vista uh the date is October 17th and um requesting permission to have this event it's on October 17th it's probably going to be today event and they just want to repaint a lot of the blacktop and um create some benches and spaces uh so when are kids to go back you know their school is beautified and I just want to put this on the agenda as soon as possible so I can get this approved and we can get this going and um thank you for your time thank you any others Mr Gill none okay uh just real quick just wanna um I reminder saying is we're talking about um future items right now okay so um if I can just request I know I mentioned the last meeting um and I know we had so many things so it's okay that it wasn't at the next meeting if we're able to um go over the different um programs that we have offered restorative justice social emotional uh well-being especially what that looks like during our um our current you know uh social distance learning um how we're providing those programs uh Dr Bauer we can just get you know kind of a overview yeah okay thank you thank you trustee Chavez I think I have a question for um Mr Reese um I remember that in the superintendent contract I think it said that we have to evaluate every June does that mean that we're two months behind in doing that no that was changed in the the new contract for the superintendent that was last approved by the board it has to be approved by the end of this month and that's an item in closed session yeah it's August now so hers has to be approved in this month the evaluation is by by contract it's supposed to be done this month correct can since oh man is there any way we can get it expedited on YouTube this is we're going to talk about this in closed session that's a closed session okay sorry thank you any other I think that's it right okay um so we will recess the closed session we will return at 2 A.M and we'll take a few minute break um if if I'm not in there I don't need to I'm not the host right nothing to do with that yeah that's right so go ahead and start if I'm not there um if we have a quorum just so we can Expedition it's gonna be a two and a half hour closed session no till 2 A.M that's what we said an hour and a half it's past it's 11 30 12 30 1 30 and 2. my math off two minutes oh I'm sorry this computer says 11 30.
foreign okay so everybody take a break if you need it and we'll see you in closed session thank you everyone excuse me can I ask you a question real quick what time did you say we were coming back I missed it 2 A.M that's what I thought yeah thank you thank you nope okay how do we get out how do we get out click it on the X at the top right hand corner right here where it says end on the bottom trustee Marcus it says end or or leave meeting oh the red the red one oh her says um leave differently you know it says leave sorry trusty Marcus I I thought you said the same thing as mine no mine said sleeve okay yeah just leave and then you go into the other one and then go in and click in the other one that I that I okay so in that email that I sent you all right foreign
