let's go [Applause] move your feet [Applause] is way too high [Applause] [Music] [Applause] wow [Applause] hey [Applause] go justice [Applause] let's go [Applause] 33 seconds vincent hey guys so amazingly enough this is the 13th year we're awarding the greg demarco memorial awards which means greg's been gone for more than 13 years um greg was an integral figure in wrestling in middlesex county and also in the state of new jersey if you've heard this before i'll i'll make it quick because i know we all want to get home um greg's clean well greg stark is a wrestling coach he's from long island started as a wrestling coach at madison township high school which is now old bridge high school left there coached at middlesex for a while and then came here to east brunswick high school and coached um and coached the bears so he coached in both places ironically um matt pazinko the assistant coach on the east portion side worked for greg at the festival at the camp um i'm sure coach and coach lango probably wrestled in the festival in the elementary division maybe but um greg used to run a nine-day overdressing festival at the ice skating rink in old bridge so it was indoor outdoor he he you wrestled it you wrestled in it and marion wrestled in it greg used to um be famous and it's on it's on his picture on the plaque here he was famous for always wearing a yellow construction hat because when he would walk around and somebody would come to the table with a problem we would always go see the guy in the yellow construction hat the guy in the yellow hat the guy yellow hat now the most important thing with frank greg's big claim to fame is when all you wrestlers and you go to like a summer tournament or a fall tournament or an off-season tournament and it says that they're going to use the madison system the madison system is named after madison township high school which is now oakbridge high school and it's a system where they make up the weights after the weigh-in they have to wait classes after the waitings are over this was greg's idea and he would put eight no more than eating a bracket he had this crazy bracket where everybody got three matches but this was all greg's idea greg greg was a man far ahead of his time and um he uh he so he started this madison system and it caught on so much that it's now used nationally and even internationally if you open up i don't even know if they still have like usa wrestling magazine but if you open up the back of usa wrestling magazine you can see tournaments like in bulgaria and it says madison system of weights will be used and that's all greg so um because he coached at schools because he was very friendly with our staffs we decided when he passed away that we really wanted to keep his memory alive uh and we established the greg demarco memorial awards if there's no team trophy involved we didn't want that it was mr pizinko and mr garnett we just wanted to acknowledge one wrestler from each team every year we've had one of greg's daughters here greg has three daughters we've had at least one every year so i'd like to bring out to the center senator matt his daughter corey his oldest greg used to tell me that this was his favorite order but don't tell your sister as i said that um like corey um was a you know she was a manager at madison she got involved in wrestling um i wonder if she was young today if she would actually wrestle and with all the wrestling that's going on with the girls but corey we're really glad to have you here i know that your sisters and one is in florida and the others in philadelphia and with all the quarantine and travel restrictions and everything else it was just too much for them to come so we're really glad to have you here um coach post come up so coach post from old bridge is going to present his great demarco memorial memorial award to levy vargas [Applause] [Music] his grip demarco memorial award to daniel max and then if we can get one picture with the five of you um [Music] so once again thank you all for your patience again this is something we've done every year now for 13 years we'll do it again next year when we're back at old bridge hopefully in a more normal setting and i just want to remind you that on behalf of the east brussels high school athletic department in the bears wrestling team thank you for your attendance and support here today please arrive home safely enjoy the rest of the evening and remember due to proven 19 protocols we ask at this time you

so just letting our public and staff and trustee know yes board president we have currently four people uh the next person is eddie bayenas welcome eddie as soon as you begin speaking the timer will begin thank you very much everyone for helping our students get back to school um i am a parent for from um miss sheppard middle school and i don't have a question but just a concern also about the illegal encampment of the homeless people in you know along the side of the road and the campus mr eddie that's that's the next item on the agenda thank you very much thank you mr monad yes next person is delia adelante welcome uh daily as soon as you begin speaking the timer will begin i wrote down everything thank you for it um so my question about my concerns are brought up to points is um now that we're moving into red tier there's been um suggestions now to move the students from six feet to 30 feet uh as far as in classroom size and has that been considered in the implementation at least until the end of the year or is that something that's going to be taken on in the fall and also um i noticed that it said teacher certified will be teaching the classroom so my question is are the students going to be having their own teacher or is it going to be for example at my daughter's school there's three first grade teachers one of them will be on site the other two maybe will do zoom if that's how the numbers correlate and uh i also have a concerned question about um letting my child going back on campus because i was one of the people who said i would but i also just got my first shot so um i probably won't be fully vaccinated you know i i have another vaccine coming in and the question becomes maybe some parents will be fine with sending their child once they've been vaccinated once the question is are you okay sending the child back later maybe later in april or early may if the parent gets fully vaccinated that is something to consider because some of the parents probably will want their child to go there back to school once they're fully vaccinated but it wouldn't be by april 12th thank you thank you yes next person is jocelyn mers welcome miss mercer as soon as you begin speaking the timer will begin can you hear me now yes apparently i was still muted for a while but um uh jocelyn murs president of the alum rock educators association and i have to say i was quite taken aback by the um the part of the motion that indicates that school will be starting in a phased-in approach beginning april 12th because uh the last i knew that was a negotiated item that had not been we had not come to an agreement yet so i do want to make sure that whatever you do commit to tonight is something that um you have the authority to do so without any agreement being in place thank you thank you mrs uh yes we have steven lynch welcome steven as soon as you begin speaking the timer will begin in your presentation you mentioned that hepa air filtration units are now in place in the classrooms i am one of the teachers in one of the classrooms the specifications for the unit supplied in in my classroom for is for about 435 square feet with a room of about eight feet tall my classroom is well over a thousand square feet with a ceiling of about 15 feet so the units that were purchased for this purpose are inadequate for the air filtration that uh is necessary so um if you want the kids to be breathing um [Music] virus free air you're gonna need better air filtration than you have provided thank you thank you mr monada we have no more uh speakers okay thank you so much now we'll go ahead and open it up to the trustees any questions comments concerns please raise your hand and now i brought some up and we talked um i i'll go ahead and if i don't see any hands up let's see i do uh mr pham okay uh you know in reference to the the the most recent public comment in you know is what he's is what he is stating fact you know uh what you know i guess question to to business business services can answer you know is uh what are the specifications of our hepa air filters dr bell yes i'm trying to see if colvera was in the the answer is yes mr pham we have followed all the specifications our mlt department has done all the measurements and and i know sometimes people see some things different but colvera do you want to add to that we have to follow uh the rules yes can you hear me yes yes yes those concerns have been brought up to us and our maintenance department is looking to that right now um and to provide any um other resolution if needed um if those if if additional systems are needed but our mot department is looking at is doing an analysis on that and will be getting back to me in terms of um if it's adequate and if it's not then what do we need to do about it okay thank you so much kovara thank you trustee yes thank you um so i first of all wanted to to thank all of our alum rock team the presentation that we received very clearly demonstrates at least to my estimation how we have navigated through this from day one and and i think particularly the work that's gone into preparing us for reopening whenever that day comes so i just really want to acknowledge that work it's it's it's a very heavy lift and and things change all the time as we know and so i i think that cannot go without being recognized i think that's that's great work by everyone the whole community um and you know speaking to also to how things change minute by minute i think the the change from red to orange just in my preliminary kind of looking into it i as was mentioned i think that does um [Music] provide some or does have some significant impact on on you know the way we end up going as a district the the fact that we're going from red to orange it uh you know it does have i believe significant impact on how we will navigate this um and so i i want to call that out that that again an overnight kind of change but it has a huge impact on what we're doing and what we'll be able to do um and i think you know in general just to kind of have this discussion i think that given all those precautions that we've taken and all the work that's been put in given the movement from red to orange given the interest by a segment of our parents and our community i i think you know it we it really is time to have a very serious consideration and put it potentially in you know into our staffs hands to to flesh it out and see what is what could this possibly look like um i think there are you know there's always risk and and you know trepidation by everyone certainly you know several of us on the board have been directly impacted by covid over the course of this you know people in our workplaces that have been impacted it's been a huge impact for everyone all of our students all of our parents but it it seems to me like given everything as the entire package it's time to really you know consider this and and and you know maybe get behind it so i'm i'm not quite 100 sure where i'm going to go with this but i do think given all the factors there's a significant argument to be made um for the for the recommendation put forth by staff tonight um but i'd like to still hear more comments from from my colleagues trustee travis and then trustee pham go ahead and take trustyfam first please trustyfam okay well you know i i too want to echo trustee baejorano's uh sentiments you know this is a you know the the movement from red to orange it's probably the best piece of news we've had in in over a year uh and you know it's certainly you know we're not out of the woods yet but it's certainly a move in the right direction the circumstances you know the circumstances on the ground have certainly changed you know the governor is you know the governor has laid out his priorities and in order for our district to take advantage of these you know the resources available made by the state you know we you know this is a you know we are always you know all all plans all have some degree of variability and i you know i get that but we you know we make decisions based upon the best available information we have at the time we make the decision so you know i i certainly you know i certainly hope you know um you know it is a time where we need to serious you know we need to seriously consider uh the needs of a significant portion of our community as well as you know you know our you know our ability to you know hopefully you know use this opportunity as preparation for for the fall too so i you know again think you know thank the administration and staff for putting this together and also you know uh whatever whatever actions this board takes i i certainly hope that you know let us all come together and you know try to make this work as best as possible thank you very much thank you trustee chavez okay we're here to do a job of one thing and one thing is to educate the students they've been out for over a year and i think if nobody else has another comment can we now vote thank you uh before we uh go into vote i think it's important to um highlight you know everything that we've been through right in the pandemic and um as a board president just want to assure that we know all the teachers have been working hard uh we haven't skipped a beat our children transferred to uh the social distance you know in a matter of seconds it felt like and so um just want to honor all of the staff and teachers for following through and ensuring that our tea that our children have the best education um and with that you know we know i know as a parent for my daughter the best education is in class for her at least she's that type of child um and so i am you know looking forward as a parent for her to be in class um and of course wanting to make sure that not only her but everybody the children the teachers the staff are all safe um and that their well-being is thought of first right and so with that said um i do want to um ask dr bauer i know i um asked a little bit about you know those that have decided to come back those that haven't yet um but one of the parents did bring up a good point are you open or are we open for families who are not ready to let's say their date is april 12th they say you know again i get my my vaccine a week later or two are we open to those things and bringing in students when the parents feel that it's safe for them to return are you different the the group that already said yes no i'm saying for example the mother who came on public comment and said i don't get my vaccine until april 28th and i want my daughter to start i don't know 14 days after that are we open to those even though she already said i want you know i want my child to go back to um school are we open to the parents changing their minds or pushing that date a little longer so would you please just allow us to work through those uh outliers potentially it's you know i i we always consider our parents and our kids circumstances to your point earlier point right that things happen i just want to make sure that we're able to you know move the system forward as a system right we will absolutely consider and and you know have consideration for each individual case but um as of right now you know just to be very safe and to be very prudent you know we we have to work around the number of people who said yes and we need to adjust yeah good and i guess that's just my point as the board making a recommendation right and making voting on a date today i want to just ensure that you know we're also open to that and so for me it's important to bring it up now before i vote on something that you know i understand and and and our goal is always to listen to our clients you know the the kids the families are the people we serve and we aim to always make it work for our families absolutely thank you just want to make sure we said that in public absolutely um because i as a parent i know how you know stressful it could be when circumstances change and so i heard that parent and i heard it in her voice and um it's just important to to think of those things as those of us that have younger children still that depend on us um great so with that i am ready to to make a vote um unless you see trustee vacarano with your hand up go ahead can't hear you for some reason oh okay sorry uh with regards to the comments that were just made so um you know obviously always there's outliers in any direction in any plan but my my thought is that when you know as a large organization when you create a plan to move in a certain direction and you begin to kind of roll that plan forward as this big monolithic organization um you and it starts to roll that way so we put out the survey we got the responses we got all that in my in my estimation that's kind of what you have to pretty pretty closely stick to because once you open the door for outliers to that we never know it could be a couple out loud liars or it could be you know 600 people that say actually i changed my mind and now all the planning that we did up into that point is invalid because now we have you know exponential amounts of people different so the the unknown of whether it's going to be two or three people or 600 or whatever is why for me it would be important to stick to the plan as it was provided the opportunity was provided to everybody um you know obviously there are instances that as dr bauer mentioned would take a kind of case by case um consideration but i'm i'm just a little wary of kind of a more open opportunity for people to change their mind um just just because of the the challenges that presents to the organization in actually implementing and getting things done in the short time that we have so that's uh one thing and then just the other comment that i wanted to make and i'm ready to to make a vote too after this is you know as the previous board president i came on to you know into my presidency basically when this started like pretty closely to when we all started getting the news i remember our first socially distance meeting in the boardroom when we tried that that was kind of a a hot mess at the time but we've all worked through it but the the weekend after everything went down a lot of our partners and staff met at the district office and and you know we were trying to figure out how we're going to feed people how are we going to get people devices how are we going to support our community all these things and it was a beautiful thing because everyone came together and there were still so many unknowns and so many challenges that we were all throwing out there and i think a statement that i made on that day i think still holds true and it's something that i will be thinking about as we move forward it's a statement that's commonly known but and i might misquote it but it's something to the effect of that we should not let the perfect get in the way of the good so are there going to be modifications that we need to make to hepa filters or to you know schedules or whatever sure there's going to be things that we need to fix it's not going to be perfect but we can be really good if we all work together and if we all you know try to be on the same page for the good of the students and the families in this district we can hopefully we can get to perfect but if we can do good let's not let the perfect get in the way of of you know being good for our family so that's all thank you thank you so much and uh but there are no others we'll go ahead and move on to the vote and i'll call you as i see you on my screen trustee veterano hi trustee chavez hi trustee pham hi board vice president quintero hi and myself i passes unanimously thank you we'll go ahead and move on to item 502.

the board will consider actions to address the issue of unhoused encampments next to the alum rock schools i have a report to give to the board regarding the work that that you asked me to do i have written two letters to the cd staff um they um their one that second letter was responded uh saying that they have done everything they could and that's what triggered my second letter uh and somebody from the water district reached out to me and this is particularly to the incumbent at madison because the madison encampment run it's located in the creek that runs behind madison and so right now the the main point that the city needs to do is to announce abatement of those the encampment at matson the encampment uh in front of shepherd and there's another one right behind fisher those are the main encampments in alum rock um i believe the city council was considering tonight some dr bauer yes look madam president um the city council is actually hearing the item right now as we speak and they're taking public comments so i know that there's a lot of folks on on today's meeting that we're interested in asking the city to do something right now at the city council meeting is where you can speak and they can hear you on this particular item about a buffer zone around schools is one of the recommendations so just want to make sure to mention that i was toggling between both meetings and i actually spoke about the item in favor of the mayor's proposal thank you trustee quintero and yes parents if you can do the same thing and jump into the other meeting it will be super important for the council to hear there was two there were two letters of support to our plea for abating the encampments around our schools is very specifically this is not to criminalize or to get anybody you know of um the services that they need this is about the safety of our students and our families who walk to school because um there's there's still a need for that so um father menchaca from our lady of guadalupe also wrote a letter to the mayor as asking for support for this in guadalupe gonzalez who is the president of the mayfair neighborhood association and who spoke during the board meeting in march on behalf of the situation at madison both of them wrote written statements to be able to support that consideration for the council tonight i'm very hopeful that the council listens and that they can see the real need that we have for those of us who serve students uh that whether it be schools or day care centers you know to be able to keep them safe by not allowing people who are in in a very difficult need to encamp nearby so that's my update thank you so much for the the parents that that came and spoke um for you know us to do something i will be hopefully bringing to the board another update uh very soon in the april meeting regarding this issue and i hope the council tonight uh supports the mayor's um recommendation because that's exactly what we need in alan rock thank you thank you dr barry is there some sort of action that you're um requesting from the board at this time just an update okay um any uh trusted chavez i see your hand up uh yes so are we gonna ask for an adoption of um or a modification to the municipal code when we asked the mayor about this and should we be asking the science excuse me the sign ordinance title 23 for example like a revised version of around the campuses when the students are in session or in class time say like a certain time frame like from 7 30 a.m to 4 p.m i know there's another um uh school district in watsonville that they cut off certain streets during school hours and they've been doing that for years um and i believe that it's a necessity to protect the health and the well-being of the children however um it can be charged and as an offense under certain california penal sections are we going to be working with him on all those things like say loitering signs for example or other other things that we could could be doing or asking for that's it thank you so i did request to have signage appropriately if the the city council passes a resolution and madam president i believe there are a couple of people who want to have public comment on this particular item um mr moran can you uh let us know if there's any um buddy wishing to address the board on this item yes we currently have three people okay four people now uh first person is jennifer doitery welcome jennifer as soon as you begin speaking the timer will begin good evening board president board members and dr bauer hopefully you can hear me yes my name is jennifer doherty and i'm a teacher at shepherd middle school i know at the last sporting meeting and this current ward meeting you're addressing the issue of unhoused people near our campuses i teach on shepherd campus daily and have witnessed the increase in camps directly across the street from our campus and the increase of overnight vehicles of people living out of their cars i understand the plight of the homeless and how difficult it is to afford to live in silicon valley because of the importance of school safety i have made multiple calls to the city along with setting photos about the illegal the illegal dumping that occurs daily along rough and ready road we strive for a safe return to our campus and need a safe passage for our students walking on campus students should not have to encounter this on our campus or in route to our campuses i wonder if the district can work with the city and create a no overnight parking zone or a permit parking area to discourage overnight camping i also wonder if the board and the city officials could have prioritized the school safety zone as a policy to ensure a clear passage for students i know in the tenderloin of san francisco they work with a group called safe passage who walk with students as they move to and from school to ensure a safe passage i look forward to hearing your continued work on this important issue and i would love to be part of that work thank you so much thank you mr moran yes we have next uh person is delia from adelante welcome daily as soon as you begin speaking the timer will begin hi um again the board um so i'm also part of my neighborhood association where i live and one of the people we work with specifically is terry mclaughlin from the santa clara county district attorney's office and her main task is she her area is the east side of san jose and she has always told us in our neighborhood association meetings that if you see homeless encampments and people set up along schools to let her know and she will get on everyone's case to get them away whether it's providing them housing or providing something working with the the homeless home san jose homeless organizations to remove them from around the school's areas so that way kids have a safe passage to the schools thank you thank you next speaker is michael photopus welcome michael as soon as you begin speaking the time we're over again uh hello can you hear me yes okay um i know we're addressing this the homeless in front of shepard okay and i know you got something in place but just out of curiosity okay this is a two-parter um will that include like over there by that by the freeway going down mckee where it's pretty bad homeless and the other thing is do you have a safety officer on site at shepherd that's my questions thank you mr monroe yes next person is brenda sendejas welcome as soon as you begin speaking the timer will begin hello board members good evening um i just want to speak on this subject i think the safety of our kids is priority and as this is a very sensitive issue not only for me but for the community when it comes to the unhomeless to the unhoused community i understand that we need to protect our children this problem has been going on for several years and we've had pods in these schools and i understand that there's protection for the abatements right now and that's what's being discussed right now at city council however we need to have a solution it's not just about removing we need to teach our kids how do we solve how do we have solutions it's not just about removing what we don't like or why is it unsafe how can we address this issue to support this community as well because they are humans just like you and me and a lot of them fell in the cracks of of the things that happened during covet 19. they were displaced from their other place so a lot of them have looked for other places to live and you know it's not easy um i visit several of these encampments and they're really nice people some of them i'm not saying all of them some of them do have mental health problems and do need that help so covet 19 is real right now and it is still an issue and a lot of them are not vaccinated and so we have to be mindful of that when we say that we have a problem or we have we need to have a solution and how are we safely going to give them a new location a new sanctuary for them to to be there because this isn't just about removing we need to have a solution and i would suggest that we work with the city and how we can safely do this for the well-being of our students and the unhealth community thank you mr moran next speaker is goes by a email address it's rufina diaz214 gmail.com welcome mufina as soon as you begin speaking the timer will begin um carlos or carmelina can you hear us yes we can maribel please stop the clock thank you is thank you gracias mr moran do we have anybody else he was the last speaker board president thank you so much now we'll move back to the trustees i saw trusteville hirano with your hand up before we move to public comment yes thank you um so first i want to thank all of our parents and and staff that um that have actively been taking part in in trying to get this issue resolved um you know i as a my i have a daughter that's about to graduate high school and seven years ago now i guess that she was starting a shepherd and at that time the issue was there and you know over the five years that i was at shepherd my my children were a shepherd it was an ongoing constant thing and and you know the staff there and and myself and other parents we always were looking for that balance between you know understanding the realities of living in silicon valley and the mental health issues and all the challenges that those people may have had but also the balance of the safety of our children and i was direct witness to children who had to walk in the street where there's no stop signs and there's no speed like it's a very treacherous kind of area and kids had to walk in the streets because the pathways were blocked with just people's belongings and stuff and so um i mean that was just one of the challenges but this is something the point there is that this is something that has been going on for six or seven years in that particular area i know when i was running for a school district and walking the neighborhoods at that time i i interacted with some of the people behind fisher and this was whatever two three years ago now so so you know this is an ongoing issue and i want to make sure that that we are very clear that this is not an anti-unhoused effort this is not a um you know unempathetic effort by the district we i know dr bauer has been consistently and constantly over a long period of time now sending letters trying to advocate for cleanups along the creek at matson and all the other areas so we have been trying to work with the city we have been trying to forge relationships with people to try to get this resolved and it's i mean as we know it's a huge issue everywhere the the comment about it being on the key that's i mean that's a huge issue that out there as well but i think to bring it all i guess to to one point is that as school as a school board are are we're in the business of trying to provide an education and a safe environment for children and families and so that's kind of priority number one of course we're we're concerned about our unhoused community and all the other community issues we got going on but we're charged with the education and safety of our of our families and so for me that is the priority and that's why i think we you know can need to continue the work that dr bauer is kind of spearheading in terms of building some relationships with people and putting pressure on the city because one of her letters mentioned that we you know for some time now have been providing services above and beyond to our unhoused students and families but our resources at some point get tapped as a district and so we have to go beyond that to to address this larger issue at least within these kind of proposed buffer zones that trustee quintero talked about last month and and that are being considered now so i'm encouraged by the mayor's commitment to to address this issue as it pertains to schools and i don't think anybody here is motivated by an an anti um unhoused sentiment or anything to the contrary i think we're trying to find solutions that work for everyone so those are my comments thank you trustee quintero trustee quintero yes can you hear me yes sorry about that i was having issues with my b button um i uh this is a very difficult uh issue um even more difficult for the folks that are that are living through uh you know being unhoused and so completely understand i've been uh when i my during my time with the city uh i had to work on these on these issues and you know um the the the fact of the matter is this is a very complicated situation uh and there are folks who automatically rise up and say get them out of here i don't want them in my backyard there are folks who say how dare you touch uh you know that encampment leave them alone you're horrible and so neither of those extremes is is correct um the fact of the matter is that um uh uh the situation has to be resolved it has to be dealt with uh it is un unacceptable that in our society we're allowing people to decay out in the streets um and so there needs to be a response obviously that's well beyond and way above our pay grade here at alum rock uh there are individuals who get the funding we get the resources to deal with that and they need to deal with that and so i'm very pleased to hear that the mayor heard the idea that i mentioned our last board meeting about buffer zones i'm i'm hoping that he heard loud and clear and uh he brought up the same exact proposal that is being heard today i do believe that there needs to be buffer zones around our schools around pathways where children walk to school or to daycare facilities uh because there are areas that have to be clear for our kids to go to and from uh to uh safely and so to and fro safely and um this isn't to say that people who are on house are automatically dangerous but but there are dangerous individuals living out there and let's be clear about it i'm not just going to go ahead and shy away because it's the uncool thing to do there are some people that have come after me in the past because i dare to mention that there is there is crime and there is significant amount of crime we just around this issue we went ahead and heard about individuals in the mayfair community who are chasti and who work they out of their heart out of the goodness of their heart they go out there they work to help the less fortunate to provide for the community and they are being threatened because of the fact that there was a cleanups in the in the creek in that area this is unacceptable that's obviously a criminal element um and so i'm not saying that everybody who's in houses involved in crimes there are individuals who fallen into a situation like many people who unfortunately are priced out and now have uh had to to moving into an rv many individuals who have kids in our school are in that situation it's it's not right it's unacceptable but there are also many individuals that choose to use rvs to cook methamphetamine to traffic uh particular women who are vulnerable and to commit other types of crimes and that's unacceptable to simply let that go unabated so as i mentioned you know obviously it'd be great to be able to say i have this amazing solution i would go ahead and you know make sure that every single city in the united states had it but i don't and it's well above what we have the resources that we have at this point all i can ask is that our areas around the schools have a buffer that allows kids to go to and from school safely because that is our responsibility and that is what i've asked and i'm hoping that the council uh adopts tonight um for those out there who have differences of opinion i welcome your comments and your concerns i still stand firm that uh we need to make sure that our kids are safe when they're going and they're coming back from school um and i appreciate all those folks who took time out of their day to come out and speak and if you have time please sneak over to see council meeting and make your comments heard over there all right those are my comments thank you for vice president quintero and i see your hand up i'm going to go ahead and say some comments before we go back to you at this time and all just i won't repeat any of any of the sentiments that have been said i agree with many of them and not all of them um the only thing i would add is calling on our city you know if you can go to that meeting please call on our city on our uh mayor you know to be able to focus on this work i heard some really great ideas from our community and i'm in agreement i think the unhoused folks need a lot of resources and services and you know this is a conversation dr bauer and i have had um in that you know obviously we don't want to just say take you know move everybody out of the way but we want them to get the resources and services including housing that they need and so uh with that um i do want to make sure that we put that uh pressure on our city officials um especially our mayor you know maybe instead of um you know getting involved with school uh situations and issues that he can focus on those things that are under his jurisdiction which is you know a lot of the unhoused population and the resources and services so please you know continue to make your voices heard we're always happy to help you but we only have jurisdiction on over certain things um you know always important to go to the city council and make your voice heard uh there as board vice president quinteto mentioned um and you know i also know that the mayor is raising funds you know for i think he mentions education i'm not sure um how that money's going to get to education but maybe you know that some of those funds can go to the unhoused community and so with that i'm going to go ahead and go to trustee beccarano and quintero i see your hand up if uh you still have something to say and we'll go after hirano thank you this actually is a question for dr bauer our staff and so given the previous um vote that we took in tonight's meeting and if we do or if and when we do just end up opening up and bringing some level of of students back for in-person instruction um obviously we're hopeful that there's some trajectory by the city and other partners to help us create these kind of buffer zones but if that doesn't happen either at all or by the time that we potentially would open do we have any plan or any thoughts or any um strategy as a district for how if at all we might be able to to kind of monitor or or you know be proactive in in that in those scenarios um and again knowing our resources i don't know you know the question came up about safety officers i don't think we have that ability at this time but the question i guess is do we have any thoughts and if not is it something we might entertain just kind of along with everything else kind of putting a little placeholder on if we need to and if we do open up to be prepared for making sure that children are safe going back to school so may i respond to that um for president yes please just so that i want to thank the parents who showed up and everyone every single person who spoke um kind of echoing trusted quintero this is a very complex situation and remember school districts have certain parameters that we we don't have the authority to do and a lot to fix this situation the only thing that we have been doing is to bring it to the forefront um trustee chavez and i had a very lengthy conversation back in the fall regarding this because i started sending my emails this is not this did not start right now we have been doing this for a long time and i just want to remind you that the shepherd staff and the maths and staff has been reaching out to the city for years um so it's the people who have spoken this is not a new thing or how come they're dealing with them just now because that is not the case we tried all the the steps that we're supposed to try um we i sent emails to the elected officials that needed to address the staff in the different departments that needed to address and i only received one response from somebody who's not even in our area it's not the person who's supposed to be looking at our area so it has been i can see the frustration in this in the parents and the community because of the lack of response we didn't even get a sorry we cannot do it because right because that that would be fine right but when somebody just doesn't respond does not address it it gets frustrating and that's where we were and when we were asked and pushed for lack of a better word to reopen the schools and when i was asked what are some of the challenges i responded correctly the resources and the on house those were the two challenges i think that we have a dress both of them in some way shape or form to your point trustee vegeta other than keep the pressure and keep asking uh i think that our communities the people who are also affected by these encampments have rights they have a right to have a peaceful and clean street you know and so people who are in charge of these other particular cases the county the city they have the resources to deal with that they have full departments and divisions to deal with that so thank you so much for everybody and i think trustee vegeta know the only thing that i can keep doing is pressuring if for whatever reason it doesn't happen tonight at city council i think that i cannot stop advocating for my children and my families that's what you hired me to do and that's my job thank you thank you and seeing uh know others we'll go ahead and move towards a german but before we do i just want to um highlight and remind us the board uh that that the last meeting we passed unanimously uh resolution uh denouncing hate crimes against uh the api community so just wanna um you know continue to remind the api community that we stand with them we stand against any hate crimes against them or anyone else um and with that i'll go ahead and adjourn the meeting at 9 18 p.m thank you and i'm president well i just wanted to adjourn in memory of those folks who've uh lost their lives in atlanta and in boulder colorado uh we've had uh you know significant loss of of life due to senseless actions uh the paletero in fresno was just shot in the head for no apparent reason this is a sickening um and so it's in memory of those folks who we've lost uh just wanted to ask if we're going to join in their memory thank you yes have a great night everyone

good evening i'd like to welcome everyone to our board meeting tonight if we could stand for the pledge of allegiance i pledge allegiance to the flag of the united states to the new public for which it stands one nation under god indivisible with liberty and justice foreign mr i'll take the role if i may mr roman geno mrs abreu mr capano mrs fredo mr garcia is he online dr pantaliano mr raincourt mr russo mr shelley here it's terrible here mr roman jean i just have to read a quick statement if i may the new jersey open public meetings law was enacted to ensure the rights of the public for the advanced notice of and to attend the meeting of public bodies that virginia business affecting their interest is discussed or acted upon in accordance with the provision of this act because i fought for the vet caused notice of this meeting to be published by having a date time in place thereof posted in the office of the borough clerk for the library for a wreck department the office of the board of ed and the office of school number three four five six in the high school on march 9th 2021 and notices look forward to reporters on the record march 9 2021 this is an official meeting regina so once again i would like to welcome everyone to our meeting tonight we're going to begin our meeting tonight i'd like to introduce mr stephen fogerty who is our board attorney from fogarty and harrah and mr ferdi fogarty is going to present um a school ethics uh report for us which is mandated each year by the state mr fogerty thank you mr army uh good evening everybody nice to be back with you and nice to be at a board meeting in person uh this is only the second one that i've had the privilege of attending in a year so it's uh good to be with you so i am going to present for you tonight um the requirements for the school ethics act and also the requirements for the code of ethics and so we'll begin by saying that with regard to your elected responsibilities as school board members there are two critical statutory enactments under title 18a which which are our education statutes that apply to you and the first is the school ethics act and the other is the code of ethics for school board members so the both of these are within the jurisdiction of the school ethics commission the school ethics commission is appointed by the governor they sit as a body and decide cases that come before them they also issue advisory opinions what's the difference a complaint which can be filed by anybody except the board of education so if the board of education felt that i as one of your fellow board members had committed an ethical violation you as a board could not file an ethics complaint against me it's not permitted any one of you could file an ethics complaint against me as an individual taxpayer or anybody in cliffside park arguably would have standing to file an ethics complaint but the board cannot bring an action against one of its own members if the alleged violation falls within the jurisdiction of the school ethics commission what falls within their jurisdiction prohibited acts under the school ethics act or a violation of the code of ethics for school board members and what's the difference if it's a prohibited act rather than a a violation of the code of ethics it's actually prosecuted by the attorney general and if it is an alleged violation of the code of ethics and i'm going to go through both of those with you tonight if it's an alleged violation of the code of ethics then it's prosecuted by the complainant the person that files the complaint so the difference obviously is a violation of the school ethics act prohibited acts far more serious than a violation of the code of ethics because the attorney general steps in and actually prosecutes that complaint um and the school ethics commission also gives advisory opinions so if you were to be concerned about whether you can vote on something whether you have a a financial interest whether you have a personal interest whether someone in your immediate family has a business interest and you're concerned about whether you should be able to deliberate over it whether you should be able to vote on it you have the ability to request what's called an advisory opinion the school ethics commission meets every month you get that request in by the 10th of that month the likelihood is you're going to get a decision by the next consecutive at the next consecutive monthly meeting they're really actually very good about issuing those advisory opinions and what do you say in the advisory opinion request exactly that i'm an elected member of the cliffside park board of education my uh my spouse has a financial interest in this company this company would like to do business with the cliffside park board of education can i participate can i vote on it they will tell you yes or no depending upon how direct or indirect those interests are so i'm gonna go through this pretty quickly obviously we i think we all know i mean you you you certainly know that the school ethics act is really intended uh to govern our conduct as uh as elected board members it's intended to make sure that we stay in our lane when it comes to the operation of our school district and you'll see that i'll be going through a number of cases with you tonight where board members perhaps step stepped outside of their lane and became involved in the day-to-day operations of the school district which resulted in there being a violation of the act so what acts are prohibited these are the the this is the conduct if you are alleged to have committed have committed a violation these are the prohibited acts where the attorney general becomes involved so if you have a business interest activities or transactions that are in substantial conflict with the proper discharge of your board member duties that would be a conflicting interest so what would that mean let's say for example that you had an interest in a private school let's say that there was a charter school in cliffside park let's say that those schools were competing for the same students that are going to cliffside park high school that would be a conflicting interest because you could not sit on the board and exercise your responsibilities as a board member and also exercise your responsibilities as a member of the board of that charter school or that private school that was that was competing for the same students taking advantage using your position to secure an unwarranted privilege advantage or employment for the board member family members or others when would that happen using your position to get a leg up for your child for example let's say that you have a son or daughter who's a who is an athlete in the school district and you use your position in order to move them up over junior varsity to varsity or in order to get them playing time on the ice if they're a hockey player that would be taking advantage using your position to get a leg up uh to get an unwarranted privilege or advantage and again that alleged violation would put you on the other side of a complaint that would be prosecuted by the attorney general's office and we're seeing far too many of those you know over the course of this pandemic for reasons i think that people are spending a lot of time at home they're spending a lot of time behind computers the number of complaints that have been filed with the school ethics commission with regard to allegations of wrongful conduct on the part of board members seems to have gone through the roof and that's because i think that we are spending a lot of time at home people are taking to social media they're expressing themselves of and about issues involving the school district they're getting themselves into difficulty as a result profiting from board service acting in your official capacity where you your immediate family or business organization which the board member has an interest has a direct or indirect financial involvement that would be expected to impair your judgment uh your objectivity your independence of judgment and so when would that happen if if in fact if in fact you acted in your official capacity and somebody in your family benefited financially as a result of that and if that were if that were to occur that too would be a prohibited act that would be a violation that would be prosecuted by the attorney general's office so conflicting employment you cannot undertake any employment or service whether compensated or not and i want you to focus on that compensated or not which might reasonably be expected to prejudice your independence of judgment in the exercise of official duties so what is the compensated or not volunteering volunteering so board members can volunteer provided that that volunteering that volunteerism doesn't become an excessive entanglement you're not supervising teachers you're not directing teachers you're not supervising students you're not being you're not a volunteer coach uh where you would exercise authority or supervision over students or direct uh uh employees in the exercise exercise of their responsibilities so you can raise money for a school play uh you can be invite you you can be involved in uh in uh in creating or building the sets god bless you you can do all of those things but you cannot select who's going to be in that play you cannot direct employees who are going to be supervising the the student actors who are in that play quick quote quote gifts or favors to listening or accepting any gift favor alone political contribution uh obviously that would be a prohibited act and the exception to that would be of course if you were running for the board and you were accepting contributions political contributions to your your campaign as long as you complied with our state's election laws that would be committed self-dealing using or allowing to be used your book your public office or any information are generally available to the public which you receive or require in the course of and by reason of your public office so what does that mean you find out that as a board member you become involved in discussions and there is going to be a construction project we are going to build a new school we're going to build an extension on a school uh you are going to install a new uh a new wiring you're going to enhance your wi-fi reception in your schools and you take that information and you turn that over to somebody else who's going to profit from that you turn that over to somebody that you that in your family that's with verizon or with a company that may be bidding on the project it's kind of like providing insider information uh to somebody uh so that they can profit from it and you directly or indirectly profit from it as well taking any action that's adverse to the board so representing an individual or somebody else coming before the board you have you have a neighbor who says uh you know i think that my son or daughter hasn't been treated fairly i want you to come to an iep meeting with me i want you to come to a meeting with me uh um you you are more articulate than me you're knowledgeable maybe you're an educator uh and i say to you gee can you come and represent me or represent my child before the board the answer to that is unconditionally and unequivocally you cannot do that you can represent your own children uh you can advocate for your own children you can do that as aggressively as you choose but even in representing your own children there comes a time when our supreme court says that you have crossed the line and committed a prohibited act and when does that happen when you are advocating for your own children and you are asking for some kind of money damages so you have come forward your child is educationally handicapped has an iep uh you can advocate for your child in order to get program and service changes but once you say to the board once you say to the administration of the board of education i want you to pay for private speech i want you to pay for a private school i want you to pay my attorney's fees uh because my attorney had to come to a meeting in order to advocate for my children once you cross that line and you're asking the board to reinvert to to pay you money damages that is a weapon you cannot be a board member and make that type of claim against the board so school ethics act very different here if there's a violation the complainant the person that files the complaint against you has to prosecute that complaint or hire their own attorney to prosecute that complaint and the school ethics act far more cases involving the school ethics act um i right now in in our office because these uh these cases are are covered under the board's respective insurance policies so board members have not board members if an ethics complaint is filed against you you are incredibly identified and held harmless and so it goes to the insurance carrier and then the insurance carrier refers the case to our office if uh we're on on the panel of approved attorneys and i would say right now i probably have maybe eight of these cases against board members in fairness our office represents 62 school districts eight cases doesn't seem like a lot but i will tell you this it's eight cases more than i've ever had in any other school year so insignificant benefits uh obviously if you are looking for reimbursement uh for aiden lua you know your children go to private school uh you file for aid in lieu of everybody else gets aided in lieu of that's an insignificant benefit you're not getting something that anybody else uh is similarly situated is not also a student inquiring for constituents that's not a quick pro quo so if you are representing uh the interests of uh of uh constituents in cliffside park um as long as you're not making any promises you're not getting anything uh in consideration for that you certainly can make an inquiry for information on behalf of the constituent and you can represent yourself in your immediate family again unless you are demanding money damages so let's talk about the code of ethics code of ethics very different uh these uh essentially are the guard rails for you what is your responsibility you've heard this said by others i have to repeat it your responsibility is to make sure the schools are well run not to run them and board members that have crossed the line and gotten involved in the day-to-day operations of the school district a board member who picks up the phone and calls the high school principal and says i want to talk to you about a problem that i see at the high school a board member that picks up the phone and calls a secretary to get information with regard to the budget a board member who says i don't believe what i'm hearing from the administration about a particular issue but i'm going to do my own independent investigation that is getting involved in the day-to-day operation of the school district that would be a violation of the code of ethics now you're promising to uphold the laws of the state of new jersey pretty simple and straightforward right what it means is that you're not going to ask your vote in a way that's arbitrary superintendent comes forward he recommends 10 people for tenure you say you know what i don't believe in tenure i'm philosophically opposed to it you can't vote no because you have an opinion that is contrary to what the laws of our state provide you'll make your decisions in terms of the educational welfare of children of course you're going to do that these provisions are not provisions where i see board members getting themselves into trouble but see this is where you see the overwhelming majority of cases coming out of the school ethics commission and the commissioner's office i will confine my void action to policy making planning and appraisal and i will help to frame policy and plans only after the board has consulted those who will be affected by them you are policy makers you establish governance you do not get involved should not get involved in the day-to-day operation of the district there it is no not intended for the schools you will see that they are well-run you have a superintendent a business administrator who are accountable to you you you you can certainly require that they be accountable to you but you cannot do a work around those individuals even if you believe you can do it better than they can you recognize that authority rests with the board that you make no personal promises take any private action they compromise the board what does that mean that means that us that we as individual board members we have no individual authority we don't have the authority to go out and unilaterally ask questions of members of the administration we don't have the authority to take an informal poll of how the teachers feel about something we don't have the ability to meet with the teachers union because we think that morale is bad and maybe that we can have a conversation that will that will improve it we have no individual authority our ability outside of this board meeting acting on on an agenda our ability to move out of here and have those conversations requires that you as a board by a majority of your whole board give me that authority you have to have a discussion you have to deliberate over it and you have to say you know what i think that steve you should go in and do an inspection of the high school with the business administrator and the superintendent because we really want to see whether or not there is any space that can be utilized in order so that in order that we can reopen our schools it would require the board to invest me without authority i couldn't take it on my own to walk up to to go into one of the schools and to make that inquiry when i go to the schools as a board member without you giving me the authority to do anything i am a visitor i am a visitor and i have to follow your school visitors policy i have no greater authority than anybody else walking into one of the schools unless you do give it to him if you give me that authority then i cannot retire you won't surrender your independent judgment special interest groups hardly ever see this as an alleged violation you will hold confidential all matters pertaining to the schools which is disclosed we needlessly either individuals or the schools i see this a lot this is information that comes to you in executive session you hear about a personnel matter uh you hear about a student disciplinary matter and then you go out of executive session and you disclose it perhaps intentionally perhaps unintentionally perhaps almost innocently it doesn't matter to the school ethics commission whether that disclosure is deliberate or inadvertent if it's inadvertent it goes to the penalty it doesn't go to the violation so what you see in all of these ethics opinions is where you fall on your sword you say i made a mistake i screwed up i'm sorry they say okay we accept that so we're not going to suspend you from the board but we're nevertheless going to find that you violated the code of ethics for school board members we're going to public publicly admonish you there's going to be a published decision keep in mind that every one of these complaints that that gets adjudicated becomes a public decision so that if you file a complaint against me and i have inadvertently disclosed confidential information and i apologize for it and i'm remorseful they say okay you're not going to be suspended but you're going to be found to be in violation and now you google me the first thing that pops up violation of the school ethics act and these never go away even if you're found not to have violated the school ethics act they don't go away i take great exception to that i voice my opinion about it uh suffice it to say that nothing has changed with regard to those decisions you'll vote to appoint the best qualified personnel available after consideration by the superintendent do you have to rubber stamp those recommendations no do you have to vote yes no you have the right to vote no you have the right to send the superintendent back to the world to come back with another candidate but what you don't have the ability to do is that you will work around them you don't have the ability to say you know what we want to go and review the resumes we want to see who else was out there and then come probably with your own recommendation you don't have the ability to do that you will support and protect school personnel in the proper performance of their duties pretty simple and straightforward what it needs is we as board members we lose we lose some first amendment rights when we get elected to the board you know before you're elected to the board you can pretty much go out and express your opinion and close up you can express your opinion about me and you can say something about me that's negative if it's an opinion you do have a good community i can't even sue you for defamation but as a board member if you go out and say something negative about me and i'm an administrator or i'm a teacher in your school district that would be a violation of the code of evidence because you are not supporting me and in the performance of my duties so where do you do that if you've got a concern about me there's something that you've heard about that you are concerned that i'm not doing my job or that i have uh i've done something unprofessional or that i have i have done something out of your community that you are concerned about then when you deal with that actually you advice notice to me the superintendent you have an executive discussion about that and then if if ultimately those concerns are substantiated then you have the superintendent take the appropriate action you'll refer all complaints to the superintendent um you won't take any action at a public meeting and that means very simply that if um a 100 people come out here and they are demanding that you as a board do something that that they're agreeing and they make the case and you think you know what they're right we should do something you cannot take public action until you refer to the superintendent for an appropriate resolution if the superintendent fails to respond uh if the superintendent can't resolve it or fails to respond then you can pick it up as a board so what are the key laws always refer the complaints to the superintendent code of ethics says you have to do that no exceptions no matter where you hear it it goes back to uh mr romanino for a resolution brain policy has been planned you have to be consulted with those affected by them otherwise that would be a violation of a code of evidence avoid giving orders to staff members and you avoid giving those orders whether you are a board member you're volunteering now there's a case where a board member walks into a school and uh there's going to be a meeting let's say this was the high school and and and not the uh the board and municipal building you walk into the high school uh you're not happy with the condition of the hallways you go into the uh into the restroom and you're not happy with those facilities and you come out and the buildings and ground supervisor is there or custodian is there and you say you know what you need to go and clean this place up uh you need to make sure that these hallways are in better shape that would be a violation of the code of ethics but you know what well-meaning lofty uh trying to improve the condition of the school certainly not looking to get yourself into this kind of difficulty nevertheless it can happen because you don't know who's going to file that complaint against you we've ran from refrain from referring our people for employment to the superintendent with a condition that they'd be employed it doesn't prevent you from sending a resume it doesn't prevent you from giving a a referral but does prevent you from using your position to get that person a job you have an issue with board policies procedures or curriculum regardless of the superintendent now i want to go over some cases from this past year that will highlight those prohibited acts and we'll also highlight the code of ethics for school building so this is the case coming to us at a madison school district and here we have a teacher who claims that the board president used her position to gain unwarranted advantages use her position to protect the preferential treatment for her children uh try to request an individual curricula uh try uh to get uh to try to get her child and enhance a program with a gifted and talented uh program in the district and that was the basis for the complaint how did this arise this part of this rise when this teacher was recommended for non-renewal superintendent recommends that this teacher tells his teacher that that he's not going to be renewed for the following school year uh teacher then claims that the reason for that non-renewal was retribution and retaliation because he wouldn't play ball with the board president ultimately he was not renewed he files this efforts complaint ultimately the school ethics commission found that these division backs to find that this was a violation but i want you to understand the context in which that arises so if in fact you are advocating for your children you want to make very certain that during that advocacy you never talk about the fact that you're a board member you never indicate that you as a board member uh uh have recourse uh if uh the requests that you're making are not granted you just want to make sure that you protect yourself in that process because you never know whether or not you're gonna have a disgruntled employee like this teacher who didn't get nothing was non-renewed probably for legitimate reasons um and the other thing is that with regard to the non-renewal this is a board president that did and was required to abstain from the deliberations on that teacher's contract once the recommendation was made for nomination this case coming out of randolph uh the vice president of the board made a speech during the fortune of the board meeting board member comments you know that you have the opportunity as board members during a portion of the meeting to express your comments maybe about things that were said by the public maybe about a presentation that was made by the administration suffice it to say you make that make those comments during the public portion of the meeting this board member land-based and parents who had formed an advocacy and were critical of the board's actions and the complainant said that the board member unfairly attacked the advocacy group and accused the group of uh threatening her and lying to influence an elected official the bottom line here is that what the school ethics commission said was that this board members before because she made those statements at a board meeting did that with impunity cloaked with the uh uh cl cloaked with the uh the protection that you have as elected public officials during a dually convened board meeting the result might have been different if it hadn't been a board meeting but but the takeaway here is that when you make statements of and about uh of it other than about people that members of the public that may come may come and speak to you when you make statements of and about uh uh presentations that may be made by the superintendent or the administration you want to do it here because if you do it here then you are cloaked with that qualified immunity the other thing that the ethics commission said here is that you know what we're not disability police you know we're not going to find a violation of the code of ethics of school for school board members because someone has been uncivil or inappropriate and let me just let me just digress for a moment because what does that mean that means that they don't have jurisdiction over that if you act badly if you uh your conduct is rude if uh your conduct is vituperative if something comes out from the public and you don't like what they say and and you say something to them that they find to be embarrassing or inappropriate doesn't make it any less offensive but the school ethics commission doesn't have jurisdiction over that who has jurisdiction over that you do so you as a board member you you as a board could could um publicly censure me you could pass a resolution saying that you didn't like my conduct that my conduct violated your rules of civility because you have jurisdiction over what each of you do and say at a board meeting but the school ethics commission will not exercise jurisdiction mount lakes so here's a board member that um makes uh the allegation has made several reactors and discriminatory statements about students at the lake drive school for the deaf so the mount lake school district has within its school district uh a school which is called the lakeside the lake drive school and is the school for hearing impaired children this board member during a public board meeting indicated that of all the hiv cases that they were looking at that the majority of those cases involved children that attended the hearing impaired school and you can imagine that the parents of the children who were hearing impaired when they heard that were not happy about it uh and this was one of those parents and so what the school ethics commission said was you know what we don't like what he said uh we're not we're certainly not going to condone like he said what he said was offensive and inappropriate but not a violation of the code of ethics for school board members monroe township here's a case where a board member is at a baseball name for her child there's a there's a parent of another child who is very enthusiastic he's loud he's annoying she obviously doesn't like his conduct conduct doesn't go so far as to include uh of being uh using profanity uh or uh uh being uh or or being uh using using appropriate language but suffice it to say he's loud and disruptive she has a board members on the policy committee she goes back to the policy committee and she says you know what we ought to have a policy that deals with parents that deals with the conduct of spectators at these athletic events because it's getting out of hand they work on the policy this parent thinks that that policy was really drafted and developed in in order to gag him and so he filed an ethics complaint against the board member and the school ethics commission said no not a violation because the board member was fulfilling her responsibilities as a member of a standing committee on the board and while she may have had mixed motives what she was doing she was doing as part of her elected responsibilities that is the takeaway here if you are acting as part of your official duties at a board meeting as part of a as a member of a committee or if you are if you are acting with the authority that the board has given you and delegated to you then in all likelihood whatever the allegations are going to conduct is uh you are going to be insulated from a finally that you violated before the audience is greenwich so here a board member inadvertently copied a parent in the district on a confidential email so what happens is you've got a teacher in the district who's also a parent they live in the community obviously if their children go to school there also a teacher in the school district uh that uh a teacher comes forward she's got a complaint about the way that her child was treated she comes before the board for a hearing the board hears the case the board makes a decision and then one of the board members issues uh an email he's not real happy with the way that the board uh uh with how the board decided the case he's not happy with the discussions that took place in executive session he sends a communication to the board president expressing his opinion and he hits reply all and guess who gets it the teacher the parent it is that reply all right we've all seen that commercial on tv where they where they they remind you of all the things that are wide-eyed and you wish you could take them back reply all is one of those things or using those drop downs you need to be careful of that as board members innocent unintended doesn't matter violation it is a violation of this of the code of ethics for school board members um the penalty obviously is is going to be mitigated by the fact that this was unintentional you can see him determining the penalty of reprimand the sec said all members of the board of education must be mindful of who's receiving their emails the inclusion of any member of the public on the same email as the board as the potential not only to violate the code of ethics it has the right it has the potential to violate the open public meetings act why the open public meetings act once you and i start communicating with each other and once there are five of us on that communication that is that is a forum it is a violation of the open public meetings act and why does that become a problem with this reply all because even though you didn't intend it if it goes to all nine of you that's a violation of the open public meetings act you've got to make sure that when you're sending emails that you do not send them to a number to board members that are constantly a foreign based out of bloomingdale acting superintendent files a complaint here uh against a a board member and basically the complaint is that the board member is not supporting him in the performance of his duties and why is he not supporting him the performance of the series because the board members at a public board meeting and he's hammering that super that acting superintendent about the budget hammering him i want answers to my questions how are we going to afford this uh where are we going to get the money for this line item how is this going to be accomplished and you know what the superintendent is ill-prepared to answer those questions however what the school ethics commission said is that the board member didn't do that in public did it at a board meeting legitimate questions to be asked about the budget and so found that it was not only not only found that there was no violation of the school letters but found that the acting superintendent uh that brought that complaint that he should have known about it and admonished the acting superintendent and find him a hundred bucks on top of it for filing a frivolous complaint again the takeaway it was done at a board meeting this curione pace done at a board meeting not done at a board meeting and look what happened here on social media this initially was a six-month suspension from the door removed him for six months and why he used his blog to relentlessly attack a preschool teacher who was employed by the district was a member of the union he was a member of the union's negotiations team and you can see what he did and close to the inaccurate information uh referenced her in a negative manner questioned her honesty referred to as debbie downer uh claim she didn't put children first called her ingredient i'll believe the explication but you see it there called her bully a union volley claims she had an irrational obsession with liberal politicians that she was all about attention seeking and feeling irrelevant all of this is on social media and then depicted a picture of the street where she lived on social media so while the school ethics commission tells us that they are not disability police you can only push them so far and so here what did they find to be the violation one that that he that this board member was not supporting an employee of the school district who is publishing inaccurate information uh about her and not only that was taking action that had the potential to prejudice the war how did this action have how did this conduct have the potential to board clearly this individual could bring a lawsuit against the board bring a lawsuit against the board because of the conduct of that board member so that has the potential to prejudice the war south orange maple wood so the reason i find is that obviously the concept is inappropriate this is a board member that got pulled over by law enforcement uh she's pulled over in a traffic stop uh and uh um she attempts to to leverage her position on the board to avoid the issue of summons threatens the police officer uh i'm not sure how uh one can believe that their position on the board of education could actually be used to leverage a police officer or not issuing a summons uh for uh uh for a traffic violation or for suspected uh for being under the influence but in any event the point is here the takeaway is here that she attempted this was all this was this was all this was all on a body cam so all of it was recorded uh and the point is here that she attempted to use her position to gain an unwarranted advantage so regardless of the facts you cannot use your position say i'm a member of the cliffside board of education and if you don't do this or that or there isn't this consideration i'm going to go back to the board and there can be consequences for you that will get you into trouble so hocus so this is about self-reporting and what does that mean you write a letter to the editor you uh um uh you allow yourself to be interviewed by local media and you express an opinion oven about the board's business unless the board has authorized you to speak for them you have an obligation to say uh i am stephen hogany i am a member of the cliffside park association and what i'm about to say is my own personal opinion i haven't been authorized by the board to do it you have an obligation to self-report that so the question that arose karen will is they were having a special bond referendum they were going out to the voters to raise money in order to put a stem lab into their elementary school and this board member was obviously supporting that referendum and she put a sign up on her lawn she went on social media she encouraged people uh to vote for the referendum and the question was did you have an obligation on that one song to say i'm a member of the jojoca board of education and the board hasn't authorized me to support the referendum so this was a commission said that's ridiculous that is absolutely ridiculous she does not have to self-identify more importantly what the school ethics commission made clear here is that as board members that we uh do not violate the school ethics act by going out and supporting the school budget you know when you go out and uh this april when the voters come forward and vote on the budget now the question the question that's often asked of me in this case answers that question do you have the ability as board members to say we hope you'll support our budget absolutely you have that ability now you don't have to say go out and vote and and end your sentence there you have the ability to say this is a good budget it's solid it supports our educational programs and we hope that you will support it when do you cross the line not when you express an opinion in support of that budget you would cross the line if we were using taxpayer money to advocate for the passage of that budget if you were saying to the administration create and send out flyers in support of the budget that would be a violation in this case posting the sign giving out the signs going on social media saying that you liked the uh the other comments was not a violation so student disciplinary matter comes before you and the superintendent is recommending a suspension to the school of more than 10 days the family comes before you they're represented by an attorney to have a hearing before the board you make a decision and in this case this board member from west windsor plainsboro forwards an email message to a member of his family and says oh by the way i just got out of a disciplinary hearing involving steve fogerty and the board put him out of school for 10 days and then a member of my family disseminates that email everybody the website you're in big trouble if that happens and why are you in big trouble not only because you have violated the confidentiality of an executive session you have probably also violated federal law under profa the individual privacy rights of that student you've probably violated state law as well as any number of other policies so you've also prejudiced the board because there is the potential here for a lawsuit because of invasion of privacy so board member violated the act by attending an emergency union meeting about the superintendent without approval of the board or the board attorney i think i got that wrong i don't have any authority for sure uh but uh it has the potential to undermine the authority of the superintendent and her ability to manage the day-to-day operation so what happens here the union's unhappy with me as your superintendent and they're sending emails to the board members uh they're sending uh they're they're putting something in the local newspaper maybe they want to take no confidence i've done something that they feel agreed by and so uh board the board president thinks you know what let me meet with the union leadership let me see if i can smooth things over and does that without the authority of the board that is in violation of the code of efforts it doesn't matter how long they need it so here uh a board member again during a public board meeting responded probably inappropriately to a member of the public with regard to criticisms that um the member of the public was making uh ultimately they got into an exchange exchange um they were rude comments uh no question but it didn't constitute a violation of the act again because it was said at a board meeting if anything was going to happen here would have it would have to be action taken by the willing willing board of education those are the cases from this year so again i'm going to leave you with what i think is the most important takeaway here and that is that as board members you must stay in your lane you must stay in your lane with regard to your policy making and your governments and ensure that you stay out of the day-to-day operations of the schools and before you pick up that phone or or or send that email to an administrator or an employee of the school district unless it is about your child and you are acting as a parent or as a guardian then you should think about that and not make that call and not send that email without talking to the superintendent first and you are finished with me for the evening so thank you any questions for mr publishers dr peggliano so the answer is that you have the right to express expression but you as a board member if you're going to express that without opinion um you should be doing it at a board meeting ideally not in public you should be having that discussion with an executive essential if you're out expressing an opinion in public about the superintendent i i think you run the risk depending upon the context in which you express that opinion and depending upon depending upon how um depending upon what that opinion is i think you can run the risk of a violation of the photographs and again what i want to emphasize here is that when you become a board member you you your first amendment rights um are abrogated you don't have the same right as a board member as you and i would have as a private citizen because you have the right to express an opinion even if it's if as long as it's not reckless as as long as that it's not made knowing it's false right i mean you couldn't express an opinion about me uh that was made with reckless disregard for its truth and falsity can you accuse me of a pride couldn't accuse me of a child abuse or being beating my spouse that would be actionable but when you ask me if you can express an opinion about the superintendent the answer the answer is yes you can express an opinion about the superintendent but if that expression of opinion undermines the superintendent they'll apprise the superintendent i think you're in trouble and if you've got contrary um advice about that i would respectfully ask you to follow my advice yes related matters we can say something forward school related business now the only exception to that would be if you went to the mayor council meeting and you wanted to express an opinion about something that they were going to do you're a board member and so you would have to say before you got up and made that statement i'm here speaking as as a resident of possible i'm not expressing an opinion on behalf of the cliffside park education that's the only difference but in answer to your question those lanes do not apply to you when you're talking about issues of significant public importance that do not involve us you want to talk about a zoning issue if you want to talk about uh about a land development or housing development uh if you want to talk about a rezoning of the downtown you're free to do all of that yes so you would have a direct financial interest and i would venture the opinion is simply identifying all sources of income or revenue that's why you're doing that and where it is derived from and also i guess to identify whether there are any potential conflicts so i don't think the disclosure gets you off the heart i think that if you are deriving a direct financial benefit then i think that that that would be potentially a problem and in your in that situation and i don't even know if that's your situation but but in that situation what i would do is request an advisory opinion i would put all those facts in front of the school ethics commission and i would say give me an advisory opinion as to whether this is substantial enough uh a direct enough interest that that it um would be a prohibited act i would ask that question but my my thinking is that would be a problem any other questions i think you're well thank you very much my pleasure appreciate it thank you thank you steve thank you take care steve thanks again okay so the next uh part of our meeting tonight is the presentation of our budget for the next coming school year i'm going to turn it over to mr alfano our business administrator well thank you mr roman gina for giving me a few minutes first and foremost i'd like to thank our board our staff our municipality and of course our taxpayers and supporting our budget and all our initiatives throughout the year um i asked respectfully uh and hopefully that our taxpayers will uh vote yes to the budget vote on april 20th and now i'll take a few minutes to just go over the essentials of our 2122 cliffside park budget the total budget is approximately 59 million dollars in total about 37 million will be our tax levy that obviously impacts the taxpayer we did some formulaic measurements just to give the taxpayer an understanding of the potential tax impact of this budget and on a home of approximately 365 thousand dollars in assessed value it'll probably cost our tax payer in the range of 77 per annum which is about six dollars and 42 cents per month given that we are going to engage in what we call our other capital projects which is driven by some of the surplus we have accumulated over the past year are we going to engage in a project our major project this coming summer of a gym upgrade uh gymnasium upgrade which will include replacing of our floor new windows and hvac and the potential after we get that formal bid which will be coming forth in april 7th will be the bid opening we can potentially do some other projects and potential replacement of floors and replacement of remodeling of our some of our restrooms and potential to do a another public address system installation at our school number four at least i go quickly i like to go over some of the key line items that drive our budget and some of the trend analytics over the last three years again one of the major line items we have is obviously uh includes our regular special education instruction that line item has increased approximately three percent year over year and that's kind of in line with our contractual output over the next three years our employee benefits we've got a benefit of those benefits which is essentially our medical our prescription dental and vision we actually went down year over year and that's mainly driven by that our medical is for the first half of this year is going to go down about four or five percent we got some relief and also the introduction of a new plan called the educated health plan which is a lower cost plan but not only helped our staff but also helped our bottom line here as a budget to our taxpayers our operations of our plant which essentially maintaining our buildings and grounds pretty much been flat year over year our administrative salaries which is driven by technology and principle and principles again is up to approximately three percent year over year our transportation costs of course of bus drivers and bus aides are pretty much flat year-over-year which is a good thing because our revenues continue to increase i'll go through that quickly when we get to the revenues our instructional support which is essentially driven by our child study team speech otp has gone up year over year that's always a challenge that's one of the line items that challenges us each and every year goes up at a greater rate than the cost of inflation uh we have no debt service which is good news we paid that off in july 2019 and our grants state and federal grants are pretty much flat uh year over year i'll quickly go through our revenues again we talked about our total uh our local tax levy which is approximately uh 37 million dollars we talked about the increase was two percent which is our allowable cap year over year we talked about the average home assessed value of 365 000 and the impact to the taxpayer approximately 77 dollars per annum 6.42 per month our miscellaneous income which is really driven by our transportation as i alluded to before we're fortunate enough that we have approximately about 23 buses approximately 23 drivers and 38 bus aides that generate revenue by that i mean not only do we transport over 300 of our special needs students throughout the county but we also piggyback students from other districts specifically fairview fort lee and palisades park so we generate revenues from those districts based on we're already taking our own students to the uh different locations in bergen county for our special needs population one of our bigger line items is our tuition line item that we receive from fairview uh that's been flat year over year it runs around nine million dollars 500 plus fairview students an average student we get about 14 500 per student and then another line item that helps us offset our appropriations our expenses year over year is approximately a million dollars and then we get that from our surplus and essentially we split our surplus two ways we get a dollars worth of surplus we split it between helping our helping offset our future appropriation future expenses in our upcoming budget year and also applying it to what we call our capital projects boilers hvac projects and again over the last seven eight years we've appropriated approximately 16 million dollars for those type of projects and this upcoming school year in the summer we a major project i alluded to previously is the high school gym upgrade another clean line item that helped us this coming year was that we received additional received additional state aid from the state incrementally it was up about seven and a half eight percent year over year which is significantly higher than what we usually see great help in balancing our our budget specifically around pre-school education aid which obviously is a line item that we struggle with and our challenge with year over year that goes up uh greater than the cost of inflation so net net our total budget approximately 59 million dollars nearly 37 million of that will be on the tax levy and again i asked respectfully that uh our our taxpayers uh vote yes to the budget on april 20th and again i wanted to thank obviously our taxpayers our board our staff and our municipality for all their support that's pretty much it mr romagino okay before we continue any questions uh from the board on the staff balance presentation dr patriano that's the expectation the preliminary timeline we had a pre-bid meeting today and we had about 12 to 14 contractors which is always good news uh obviously uh the more contractors you have the potential for the bid to come in where you expect it or lower competition breeds you know hopefully good news in regard to the bid opening the bid opening is on april 7th at 11 a.m it'll happen here hopefully we get those same 12 or 14 contract if they fill out all the appropriate paperwork then we take the lowest three bids and we send them to attorney review and then we will request from the board to award the lowest bid based on the attorney review and our architect and engineer reveal once that hopefully comes in within the expectation in regard to what we budgeted um in may we will hopefully uh start some preliminary work on the on the gym upgrade and then uh you know the timeline substantial completion timeline has us you know at the end of august obviously a lot of moving parts dr pantaliano but the expectation and the hope is that we can get it all done by the end of august uh we will have on we have initial pre-construction meeting we'll have ongoing status meetings that we will bring the board up to speed on hopefully there's no hiccups change orders stuff like that but it's a it's a rigorous project that uh will be a challenging you know 12 to 14 week uh timeline the hope is that we can get it awarded and there's no snap fools in the bid opening and then we can get it awarded in april and we can start some preliminary work in may which will give us a jump start on the uh on the timeline fingers crossed fingers crossed correct that's correct so the expectation mr katana was that if the bid opening goes well and we take it to attorney review and the lowest bid is awarded we'll we'll ask the board to award that bid sooner rather than later again once we get that bit awarded it initiates and engages ordering materials you alluded to it gets the timeline going earlier and if we can get the timeline started in may that gives us a fighting chance to get what we need to get done uh prior to september 1.

we also are recommending a percentage increase instead of a dollar increase because there's two ways to look at longevity one of the ways to look at longevity is to say okay we're going to give an increase and we're going to look at those you that have been here 15 years or more get this much those usually been here 10 to 15 years get this much etc but by just the thought process with longevity those that have been here the longest have the higher salaries therefore when you give three percent those with a higher salary get more money than those with a lower salary so in effect you've taken care of longevity there may be some cases where someone moved into the district and got placed higher because of experience and so they technically have not been in the district longer than someone else and got a higher percentage increase but given our turnover and we looked at the longevity of all the teachers all the employees actually in our district and of the 300 and i could be off a few numbers but roughly the 350 teachers we only had 45 that have been here more than 10 years and so we felt this three percent increase addresses the longevity issue and will put more money in the pockets of the people that have been here the longest because they're higher on the on the salary schedule so that's the reason for that recommendation before we move on any questions about that okay with the classified staff the the increase is 135 000 coming out of mno this is a key piece because obviously there's a number up there that's different than three percent if you remember last year part of the ccc um priorities was the fact that over time we had compressed the classified salary schedule and so what we were trying to do was quote unquote decompress that salary schedule so that the bottom end of the salary schedule the top end of the salary schedule started to expand a little bit so that as you had more responsibility in a position you would make more money okay so if i'm driving a bus this example i've used it's not to disparage anybody but if i'm driving a bus i have a different amount of responsibility and if i'm an aide on a bus therefore if it becomes so compressed that the the dollar amount to do either one of those two jobs is very close to the same then why would i take the additional responsibility so we went ahead and put the salary schedule into three bands and we went ahead and created the first band was an increase each level at 1.17 then the second band the increase was 1.20 and the third band the increase was 1.40 we're recommending that same process be applied again this year if we go ahead first of all we can't afford a three percent across everybody on this one so we'd have to make an adjustment but if you put three percent in to i'm using that just because of the consistency from with above you would turn around and recompress and undo all the work we did last year with the development of the salary schedule last year so therefore would defeat the whole purpose of what we did last year so we recognize that percentage-wise it's less than what others are being recommended but there's a different problem that we're trying to solve and we tried to address some of the other funding issues on down the road for the classified in a couple slides i'll present that questions on that okay it's about twenty five thousand per one percent for um uh for administration for the first two bullets that are up there that is mirroring what we did with teachers so this is not the same as what a brand new per a brand new person would get versus a person that had been here one year so the increases is [Music] calculated the same way to make sure that there's still a gap so we don't get people jumping to or over people that already been in the district and then we would provide all current staff with the three percent uh increase which again would address longevity we do believe we need to work on the substitute issue again even though we just increased it i think a year ago coming out of the pandemic uh the 125 roughly is in the ballpark where what several of our neighboring districts are doing i've heard 125 i've heard 120 about 135 so it varies depending where the district is but this would make us competitive as a reminder the 140 that was the piece that we put in place that if you were a retired employee from our district and you came back and subbed for us we would give you a higher rate again that's a a longevity issue and we're trying to honor those people that have worked for us we do not have a lot of them to be totally honest um but it's still we still want to keep that concept of 125 versus 140.

congratulations and i want to piggyback on the robotics part of it because saturday all the teams did that virtually well there was a problem north with some internet issues not our internet issues but with metronet and so principals and mr hyden worked to get those corrected they used the hot spots that we had to be able to do that there was some uh people that had to be very flexible because it ended up that they needed some more time because there were those issues so although we were allowed to go to state and go to virtual it had to be he had the technology to make it work and it wasn't anything to do with our system but it was outside but appreciate everybody working together and mr hyden who spent most of the day uh along those lines helping that out too and all the coaches and principals that needed to help with that and i have some other ones then i would like to continue because you were finished right mr mcginnis so i'm ready uh mr snyder has several things from northfield first of all congratulations to logan cox for making indiana high school coaches association academic all-state also congratulations to clinton thomason on scoring his 1000th career mercy positive throughout thanks for your leadership with our kitchen staff so mr daisy i believe that's all the recognitions that i really appreciate principals recognize those and all those people that have been recognized thank you now it's time for the public comment we have no public but we probably have somebody that's tuning in online or maybe not since they we we bumped it up an hour okay so no no comments moving on to consent agenda items approval of the minutes from our last meeting motion a second to approve the minutes from our last meeting all in favor say aye claims payroll only main difference in perils would just start and i filter in those um robotics coaching stipends and winter sports so those will be filtering in these next couple days all right second question second to approve payroll all in favor say hi financial summary just uh gave you the end of the month balance reports for february so you kind of see where we started out the year and that first column with the beginning balance then the february column shows what our beginning balance was in february and then that end column shows where it ended at the end of february not much change in what we normally see this time of the year so nothing of concern if you have any questions okay we'll move on excuse me uh uh personnel rick um yeah personal health recommendations i'd read all those words at once under employment we have dick lemming assistant track coach at northfield high school hillary moore junior high track coach at northfield and katie singleton temporary teacher at southwood high school under resignation we have kevin kling teacher at northfield and under leave we have employee number 120 and you see that that's been extended looks like the rest of this school year i moved to the hl report motion and second to approve the hr report has read all in favor say hi all right moving on oh you know what that's uh i started a new business but i wrote this heartland career center report man superintendent's report yeah i just want to two things though um and mr driscoll would not have known this but uh heartland kerr center today mr hobbs officer mr dupont and then mrs cordes actually presented at kiwanis today so i just want to recognize them obviously they did a great job and told them about a lot of the different programs are doing fantastic things there obviously and creating new programs and obviously with the building and a lot of things going on so that was good to hear an update i hear different updates but um of course our community service or our service pro service club was it's great to hear that i don't know if the other service club does anything like that but ours was great and it's always good so anyway congratulations to heartland and we appreciate all the work they do for our students and then also just want to mention again of course kobe 19 report our numbers continue to be really really low that's great and you saw that the map we are now blue yet to be blue or any color consistently or two weeks in a row and we'll have to wait until tomorrow to see if anything changes there but now that pretty much all of our events for the most part will be outside um that will change things too we will still have concerts and different things like that i know they are limiting the number of tickets uh for honors band and choir which is kind of unfortunate via last year that was the very first thing that was canceled uh that friday night so we're very uh thankful that we can do tonight when we get done here with the academic recognition banquet that was also canceled last year so it's great that we can do that and all the other things so uh just a quick update there so we can move on so we can go to our next event mr drake you have a curriculum report uh i hope everybody that's able to come tonight takes a minute to say something melissa ball she put a lot of time and effort into doing the banquet organized it and it looks really cool and so um and it's her first one ever so you know how you are you nervous that you're gonna overlook something so uh but it looks bad it's gonna be excellent and of course we're gonna hear from dr lisa streeter which would be lisa duncan from southwood um from what class i'm not really sure so she's she's more she's gonna share and so um i do want to let the board know that we've had one student return virtually um out of the 25 or so that we have and so um parents felt like that was better for the kid and so we worked it out we're going to transition them back and we actually have another family that's looking to do the same so excited to have him coming back rather than heading out so hopefully by next fall that's not even an option that would be very very good for everybody all right moving on to new business just one item there a recommendation to approve a calendar change for march 19 2021 was was to be an e-learning day but because of the number of day e-learning days we've already had uh we're going to look to make that an in-person morning day let's hope the snow is over by march 19.

okay anyone else any questions to mr alfano on the budget i just want to point out to the community members that might be um watching the stream tonight uh there is a newsletter that's posted to our website uh was posted today and along with that uh newsletter which explains uh some of the things that we've been able to do in the past as a result of the community supporting the budget and what we're looking to do uh do moving forward uh are outlined in the in this newsletter so if you get a chance please read it also there's a copy of a user-friendly budget for the public to review and that's also posted to our website so both are accessible to our public and feel free to visit our our website to look at those particular documents documents uh just a couple of items before we look at the consent agenda um i just want to do a quick update on our sports we are running right now volleyball uh wrestling indoor track everything seems to be going fairly well we're looking forward to uh baseball softball and outdoor track um i believe those start on or about april first maybe a couple days later than that so um hoping that um everyone stays healthy we're able to move forward and uh fulfill our obligation of uh giving our students the opportunity to participate in all of these sports uh throughout the rest of the school year i do want to make mention that our high school guidance department on march 18th last week we had a very successful uh college information night it was done virtually i want to thank our supervisor of guidance mrs casano for running that program for us just to mention also i mentioned this last meeting we are going to are getting ready to register uh pre-k students for this coming september the pre-k registration dates are april 27th and april 29th if a parent is interested in registering their child who will be four by october first they can contact school number five for registration materials we will also be registering new students in kindergarten for september so if you're currently in our pre-k program we do not have to register for september if you are new to the district then registration for kindergarten is going to take place uh after our spring break april 13th through the 16th uh parents who are interested can visit our website for more information but you can also call school number four for information on kindergarten registration there are packets that have to be filled out prior to uh parents coming in uh as a designated time also the opportunity to make appointments so those two um events are coming up later on in april i do want to congratulate our middle school students uh they do a great job with our newsletter which is called the uh perspective and it's posted to our website as is our high school newsletter um school newspaper i should say each month so as a community member as a parent uh if you visit our website there is a lot of information on our website regarding a lot of activities that our students take part in i am happy to report that our vaccination program within the district giving staff members the opportunity to be vaccinated is going very very well as vaccinations become more readily available which they are i've seen that more staff members across the board bus drivers bus aides teacher aides teachers are getting the opportunity to get vaccinated so hopefully by may maybe the beginning of june uh we'll see that the majority of our staff who want to be vaccinated have the opportunity to do so i did mention our budget newsletter i also want to make mention uh in your folder tonight um i gave you a copy of a draft budget you know that i mentioned our last a meeting that uh footside park is receiving as other districts are receiving ess er2 funding cliffside park is going to receive somewhere in the vicinity of two million dollars that can that has to be used for specific areas for example uh upgrading ventilation systems uh addressing learning loss of students counseling for students so on and so forth what i've done is i've shared this information with our staff i've received some feedback from our administration feedback from staff members um i'm welcoming input from our board this is only a draft budget this is not a final budget i'm giving you this budget to look over so that you can look at the items that mr alfano and i have kind of put down in terms of a draft budget to see where we can spend this money where it could benefit our students the most and where it can benefit the district the most across the board on at our april 21st april 21st work session um we will spend a little bit more time discussing this budget but in the meantime if you have questions if you have suggestions please email me call me and i can say to you uh that suggestion is great but it doesn't adhere to the guidelines or i could say you know what we never thought about that we're gonna try to incorporate that into the budget as an example i have budgeted 600 000 for summer school over the next three summers that would allow us to expand our summer school program from pre-k to 12 that not not only are we offering um courses let's say to middle school students who may fail a class but we're offering remediation programs to students who need remediation uh we're offering programs by teacher recommendation and parent recommendation to students who may have had learning loss due to covet so we're going to be giving many more students the opportunity to attend our four-week summer program esl students special education students across the board and um that budget is such to allow for the hiring of staff providing services but that's just one example and again this is these are just draft items so i did give you a copy if you have time you can look that over and we will talk more about that at a later date just a reminder uh to do your self-evaluation the board self-evaluation you can go to the new jersey school board's website log in and take that self-evaluation and then we get the results of that that will be shared with the board if you have any questions about logging in where the site is uh just contact me and i will um i'll help you along with that okay at this time i'd like to um see if there are any committee reports okay i know last meeting we did have a couple of them so i'm going to move on from there any questions at this point from the board before i look at the consent agenda about anything dr pangliano i love it is right uh yes uh we are looking at the elementary schedule uh we do have a couple of concerns one is if we extend the day for elementary uh the concern is feeding students uh how we would prob possibly provide lunch for them or do we have to provide lunch maybe we can provide a snack and then they can eat when they go home would increase class size which is something that we're determining how big a class may be based on how many students are hybrid right now so those are things that we're looking at so yes we have expanded middle school we have expanded high school in the sense that we've offered students the opportunity to come back for five days um but an elementary has been a little bit more of a challenge because of of lunch but we now that the governor not the governor not the cdc has recommended three fee it probably will allow us to put more students safely in class um luckily our problem has not been the schools uh i think that if you look at how many covert cases and this probably applies to many many districts it's not really transmission between two students in class it's primarily coming from the home uh so that's something we are looking at one of the things i am concerned about that we are also uh looking at is parents are on a schedule right now and i want to make sure that if we go to a different schedule it doesn't impact child care for some parents who may have made plans based on what's going on now so it is something we're looking at and hopefully by the next board meeting i'll be able to share more information okay no problem anyone else i don't think there are any questions from the public at this time so i'm just going to go to the consent agenda um i'll run through it pretty quickly uh on page two uh we have a high school esl teacher uh emma brooks who's asking for a leave of absence uh effective unpaid leave of absence effective february 26 through april 12th due to child care concerns uh anna aceta also is asking for an unpaid leave of absence uh due to travel arrangements effective march 1st and april 2nd and then we begin our uh spring break third resolution um accepting the retirement of brenda maldonado uh brenda has been a spanish teacher with us at the high school middle school she's been the world language teacher with us in the elementary school and she submitted her paperwork effective july 1st uh brenda has been on leave since the end of i believe it's october skipping down to a resolution of elizabeth layton who's a title one teacher at school number three has been on her unpaid leave of absence due to child care and she will be returning effective april 12 uh 2021 after the break uh tracy rembecki who's also been on a paid leave um throughout this year is returning uh effective may 24th and then um at this point we're not sure where tracy will be reassigned but she will be coming back to the district effective may 24th uh donna murtagh secretary of school six have requested an unpaid leave from march 18 through march uh if i 26th back up to page three uh resolution for a medical leave from ella to fanner who's a high school social studies teacher uh we'll be taking a medical leave uh honor about may 13th and her anticipated date of return is december 15th uh i'm sorry january 3rd 2022 uh hunley is due to our maternity leave uh krystal merkovic also a teacher at school number six uh is requesting a medical leave for maternity we believe it's a 12 dollar estimate because it just depends on how much subs are used next year that number could go up or could go down no i just want to say i think it's very important that we do raise the substitute pay because i know queen creek has raised theirs and i know there's discussion in other districts so to be competitive and to get good quality subs we need to do that yep that's that's why we really want to move forward across the board for everybody okay so i have a question though we do have a current a board member that that sat on the board that now he is um substituting so would he be considered somebody that came back i would say yes perfect i only got four more years i'll just make it i'm just gonna let it go so there is another compensation piece when i say certified stipends i just want to bring this to everyone's attention because this is all the stipends that go out to teachers so whether you're a coach or a department chair or grade level leader i mean we have lots of choir band a lot of different stipends it's all indexed off the base salary so if we increase the base salary it automatically increases the stipend now it's 2.4 percent but remember that's 2.4 percent of the of the stipend the stipend might be a thousand dollars so it's not like this is huge dollars across the district for all the ones that we have we would look at an increase of approximately uh sixteen thousand dollars and that would be taken out amino okay so those are the compensation increases so uh that go to the salary schedule at the same time we did have a conversation about some other ways and this is two part number one a desire to to address longevity and desire to thank our staff but also desire to stay competitive with other school districts we are hearing some of these ideas are being used in other school districts so the first one is to go ahead and give a covet 19 stipend one time only we would take it out of the rooftop fees or the donations we get for for uh new new homes in our um in our district uh this one-time stipend would be for all staff with the district on may 30th of 2021 obviously we were prorated on a higher basis so for some reason we hired you on may 1st or you're not going to get the same percentage increase as as if you were hired at the beginning of the year the one percent we went ahead and had a conversation of is it one percent versus a dollar amount and the issue with the dollar amount goes back to the longevity issue if i give 500 500 to the lowest paid employee percentage-wise is significantly more than 500 to the highest-paid employee and so therefore because ccc and uh or ccc was was uh uh really talking about this longevity we felt a one percent increase uh would do more justice to their request the substitutes however given the way the substitutes work we felt that for those subs that worked for us all this year we would give them a 200 stipend at the end of the year and then that's about five thousand dollars a little short of five thousand dollars so it's a way just to say thank you for it's been a very hard year we know it's been a very hard year we appreciate everything you've done for us this year and that's for all employees in the district and just a way to say thank you regarding the rooftop fees yes approximately how much do we collect for that and do we have any new agreements coming in giving all the building that's going on around here yeah so recently we and carly can correct me if i'm wrong on this but recently we have not collected very much because the the home building is not necessarily taking off like it is uh in maricopa we do have and there's a good uh possibility that at the april board meeting i'll be bringing two new agreements to you we are getting we i take that back we do have one new agreement which is archer medals and so we are starting to see people moving into the archery metals homes and so there's there's an agreement with that group but uh there's also been a contingent contingency that's been built up so these dollar amounts we feel are are conservative enough can give everybody a a thank you for what we're doing but also ensure that that those dollars are we don't drain the bank so to speak next thing we want to do again part of this longevity if you come back we want to thank you so in this case we're talking about a one-time only retention stipend that is allowed under essers 2 and s 3.

making march 19th an in-person learning day rather than being an e-learning day all in favor say aye uh we have no unfinished business no board policy anybody join us okay no comments for everybody we'll give them just a second to have the stream catch up it looks like we've passed the stream okay all right so we passed the public comment any items from board members i'm just extremely hopeful that we can have full attended graduation this year tickets reservations no but the calculations that i did quickly even with the still being in yellow everyone could have like 12 tickets approximately so if we get to the blue then it will open it up enough there we won't have to worry about that at all so and really 12 for each graduate um it's quite a bit i mean some are going to have more than 12 but you know you can pass tickets around too so but that hasn't nothing has been determined but i just looked at those numbers and you know taking 50 percent of you know the the gym would be a thousand of course then taking the number of graduates those are all rough numbers but i thought that's still really really good better than last year of having two but if we stay blue um then we'll we can be 100 so we'll be fine but that could change obviously between now and june when we have graduation but we're very confident it's not going to change but it could so i mean we're we're going to move forward with our proms also and those could change too but right now we're looking at doing those awesome any other items okay returned

so our recommendation would be that we would go ahead and give a percent stipend to all employees it would be given out at the end of the first quarter that's so if you were to join us in july but somehow walk away from us on august 10th you're not going to get it but it's a way to reward those that have come back um and again it's in essence the same uh a conceptual idea you will see the substitutes is a little bit higher and that's because next year we would anticipate that we have potentially have more subs working for us we had a number of subs this year that chose not to work for us because of cover 19. they want to work for us but but due to health reasons they felt in their best interest not to so therefore next year we would anticipate that that number may be back to what we would normally have and therefore you would have more people eligible for the dollars and that's why the the money goes up just a little bit on that particular retention bonus okay okay then we know we have a couple issues with student growth with our student enrollment and so what we're looking at we built this if you remember on a on a four percent loss and so this is one of those topics that quite frankly we all got to get in the same boat we all gotta roll in the same direction we currently lose 60 percent of the kids that live in our in our zip code which we're only one zip code for our school district we lose 60 percent of our kids to other schools charters neighboring schools we cannot afford to keep losing 60 that's not including the numbers we lost this year so what the idea is with this is as we all get on the page same page and talk about the benefits of our district and how good our district is and we try to maintain and get kids back into our district if we get back kids in the district we would go ahead and provide a one-time stipend to staff again it would go to all staff with the exception of subs it's based we're there are some details that have to be worked on but we're looking at based on a growth of the district enrollment by 200 as of the 100th day distributed at the end of the third quarter so going into spring break in march pro rated based on higher date and growth will be determined by the district as a whole we're not going to pit school against school okay what is the impact to us it's actually nothing unless we hit the number but if we hit the number we're on current year funding so we will get additional dollars for mno to pay for it so therefore it's not really impacting the budget per se if you don't get it and if you do get it you're going to get funded on current year funding if you continue to hold that number in future years then this is a a situation where you can theoretically manage that particular dollars so again uh it's one of those that if we if we all get in the same boat and row in the same direction and get more kids into the system then we'll all get the benefits of that um and i think it's something where we have to change our mindset because it's it's in my mind it's unacceptable to lose 60 of our kids to to neighboring schools agreed questions that's a great idea professional development this is one that we want to make sure we talk to ccc because there there may be some concerns about this or may not what we would like to do is use esser dollars to go ahead and provide three additional days for certified certified staff prior to the start of school so right now they come back four days we bring them back three more so a total of seven days those three days would be for hashtag for training only so as i told the leadership team the other day they're my days we're not doing anything but hashtag forward if we're if we're committed to hashtag forward then we're committed to hashtag four and therefore we're going to take time to take those brand new teachers and make them understand what the basics of hashtag forward are and we're going to take our veteran people make sure they understand and they can grow in their skill level the other four days would be for staff to prepare to school now i'm not going to give over all of those days because as an example we will have to train our staff on illuminate so there will still be some trainings that have to take place in the four days but there would be a freed up more time for them to work on planning for the start of the of the school year and so it is a way staff will be paid at their daily rate so again we want to honor longevity those that have the higher salaries their daily rate is obviously higher than those that have a lower salary we are also projecting that we would try to do this in 22 2223 2324 and 2425 this is a situation where because the money has to be spent by september of 24 you could do this in july of 24 and still be under the guise of what um essers3 asked for so it's a way to go ahead and push this out for four years to do significant training on hashtag forward and get everybody on the same page and implementing that particular movement even more so than we we are right now questions okay is that just certified staff at this point it's just certified staff yes this is just a reminder and i put this up here for a couple reasons number one i think people forget about this but number two there's a push down at the legislature that we let people know about all the different benefits that are actually picked up within their salary and so this year with the premium increase if for employees the district is picking up the hundred and seventy two dollars and eighty cents for the increase but just know for all eligible employees that premium cost right now is five thousand seven hundred seventy three dollars and eighty cents there are any number of industries that don't pick up employees i agree insurance so we just want to remind everybody that this is a benefit that the district is doing i can tell you in many other districts they are now moving to it's not a 100 pick up right i agree i know that correct um i think it was a previous slide it talked about insurance costs being a hundred thousand is this are these the numbers that get you to that hundred thousand yes well it's the 170 280 by the number of people that we have that gets you to the the 100 the sure just short of a hundred thousand the 577 three is what is that increase plus what we currently pay so right now we're we're paying roughly five thousand six hundred dollars a person on health health care next year it's going to be 573 based on that increase okay so what does that really mean for employees because this where it comes down to what what's the dollar amount so what i did because obviously everybody's somewhere else off the auditor general's report the average salary in the district for a certified staff member a teacher is forty five thousand five hundred eight dollars so if you did a three percent increase there they would see thirteen hundred and sixty five dollars and twenty four cents the one percent covet stipend some people say why are you putting it in here i think i'm getting it at may it's not gonna be in my salary next year you're right but we wanna show people what the dollar amount is compared to dave next year so this would be a benefit that they would receive the one percent stipend would would come in and and end of the first quarter the three pd days would increase there so you would see dollars in their pocket of a little over three thousand if we hit the one percent stipend then you would get an additional amount in march so your overall package increase for this year will be three thousand four hundred dollars it becomes a little harder with classified because they're all over the place not all of them work eight hour days not all of them work uh 184 day contracts some work 260 days 210 days so we just did an average and worked it off 25 so you get an idea but you would still see they don't have the pd days in there but if you put the increase for a middle band person which is the 1.2 percent increase you can see 800 if we get the 1 student growth they would get an additional dollars and so they would see a thousand and fifty if you look at administrative staff again they don't have the three pd days because they're working off of 262 days a year but if we took an average salary of 75 000 then that's what you're going to see the increase obviously in all these scenarios it's different for everybody in the district depending on where they're at but it's just to give you a perspective of what the dollar amount would mean for people so when you really look at the numbers in terms of an increase you're looking at for certified staff six point six three percent increase with the possibility to go to seven point six three percent increase if we hit the bonus for student enrollment administrative staff is five the classified staff again you see band one two and three so they're in the three percent range but the makeup of the two percent is designed to take care of those individuals that get higher that are higher paid and it's they're treated the same way as certified administrative again i'll say it again just so everybody's on the same page the reason for this if we gave them the same percentage increase across the entire classified staff we would undo the work we did last year and therefore we'd recompress the salary schedule and that was not what the request was last year so we had to honor that request certified stipends are 2.4 increase um so that that that's for the coaches and those people more questions on that nope so staffing in response to the instructional model which was again a big concern not only with ccc and with um uh with staff in general that the principals have heard about and and the district office has heard about we convened the committee uh like i told you to go ahead and take a look at that and at this point what we're recommending is that we would hire seven to 10 additional teachers so you know that 650 000 that's we use an average of 65 000 a teacher when we go to calculate what we think it's going to be obviously it could go down for some people up for another depending on year's experience and whether they have a masters etc but so that reflects 10 times 665 000.
⚗ AI-reconstructed · cite from original above
if we only hired seven then obviously that number goes down we don't know what the total higher will be because we're still working on what's the specifics of it we have a couple different issues that are out there including the fact that depending upon how many kids are in person next year versus how many kids are virtual could change this number so there's some details that we will work with those committees or over this fourth quarter to start figuring out what it looks like but that gives us a dollar amount if let's just say we commit to 10 so that everybody's very clear that implies that we can hire 10. if i can't hire 10 teachers then it's not going to be 650 000 so our commitment is to go ahead and hire so that we have a different instructional model it's probably gonna it has several different iterations we will bring it to you i don't want to comment now because people will lock into what i say but we have to look at the the different uh commitments when you talk about a reduction in class size this has a potential on a reduction in class size and so does it mean every single classroom is going to be smaller no just depends on what this model looks like but the combination of this change for what the instructional model will look like as well as the concern for those class sizes this is a step towards that and then you will see in a second that there is a commitment to bridge this concept beyond just one year this is not just a one-year fix okay this is this next one is just additional staff but again just on the uh additional teachers um on a previous slide we had the average teacher salary at 45 000 ish here we're talking 65 000 so that 20 000 difference are we talking about benefits and costs of employing my teacher right and all the taxes we pay in taxes and everything yes okay so your your uh state and federal taxes are what 20.
⚗ AI-reconstructed · cite from original above
and our contribution right so your contribution is 577. yeah and what they showed you on the ag's report was they're just base salary what's the average base salary in the district right okay so then we just were informed if you remember we got through the school safety grant a year ago we got additional counselors and and social workers in different schools we did not get one at harmon a counselor or social worker at the high school we were informed because there's a difficulty and this is i'm telling you this because this could create the same issue with us lots of school districts got sros and counselors and social workers but the money was never spent because there's not enough counselors and social workers and sros out there and so um we were caught off guard when we also got a letter that said congratulations you now have a counselor at harman it would be paid for out of the school safety grant at this point we have the position advertised we hope that we'll fill it but we're in the same battle everybody else is to fill positions we did not get funding for the social worker at at the high school however the counselors and social workers we know across this country coming out of the pandemic concerns with social emotional learning um it becomes critical and we need one at uh the high school so we're gonna try to find someone we'll we'll pay for out of medicaid funding okay again using different funding sources to address issues we will look to increase an instructional coach uh that will be shared between cta and and the alternative school again funded out of medicaid put a couple in there that are no cost but so that everybody's clear the change from behavior specialist to sel we just want to make sure that we um are starting to address the the concerns with social emotional and moving the the alternative school principal default full time based on how many kids we have gotten back into the system currently and the anticipated number we believe that's uh to our benefit which means we then have to go back and fill the the third uh high school ap position and then we would upgrade the the dean at the middle school to full time and the increase the psych intern position right now we're about ten 000 below what other districts pay in east valley so that would just bring our psych in term up to what other people are making or are paying excuse me we need as you remember was part of the esco we've replaced out a lot of our um hvac units and so now there's an increased workload for for those that have them where we're going more high-tech but they're still units that have to be maintained so we would recommend an addition of an hvac tech and then if we're going to go to a one-to-one initiative that increases the number of computers in the class or excuse me in this district and so therefore we would say we need to hire two more ittechs to help out with that load so that would be the staffing increases that we recommend any questions so what i want to do next is just show you how we plan to fund this so you have an understanding that there is dollars available to fund all of this so first of all we're going to put that same slide up that we talked about with the mno budget before the only difference on this slide is you're going to see if you added the classified the admin the sub pay raises you have an additional 225 000 if you add the additional staff that that i put in there you have an additional two hundred thousand dollars so if you remember the number before that was a deficiency was 2282 i believe so it's now 2.5 mil yes so if i look back if i look back to pages 23 and 24 for the pay raises you actually get a different number than the 225 to 225 000 you've got here because you've got 135 for classified 7500 men 12 000 for subs and the certified stipend of 16.
⚗ AI-reconstructed · cite from original above
so however you add it you don't get to that 225 what's the number what's the number you have well if you just you get to either 222 or 238 depending okay so a couple different things on that the the 225 was rounded but remember that with the stipend if you're talking about the mmo stipend that's not calculated in here because that's dependent upon us getting enough increased uh 200 students and therefore the increase in them on current year we're going to that this is assuming that this is just for the raises if you if if we go with the stipends the stipends are out of other funding sources and then the student growth one is is dependent upon us actually getting there so i did not calculate this because if we don't get there we're not paying for it therefore the number doesn't that sixteen thousand that oh the sixteen thousand i'm sorry i'm like i was thinking something totally different you're talking about the the coaches yes okay i'll have to go back and do my math i thought i had calculated those in there okay and then on the additional staff of the 200 000 is that the when you just went through the staffing slide it's for those that are in mmo so you had the two it techs you had uh right okay so just check them out again you're off by 4 000 on that okay okay and again in either in either case with those um you'll see that that uh we're essentially uh adjusting some of what we pay out but most of that's the same as the last one and that's going to get us the 2.5 million to cover [Laughter] because if that's the way it works we will change the numbers in a different way [Laughter] i do have a question though um just i was just thinking about that growth stipend um student growth stipend as far as numbers right population um i was just curious as to what what were you um and your team what's what what are you envisioning teachers and principals to what do you what are you thinking that they're gonna do to try to increase student enrollment well it comes from a lot of different ways if you remember we've talked a little bit about our kindergarten roundup and we have a system in place that goes ahead and chases after leads uh using the the new software uh but it becomes critical that all schools are on board so if we get a lead on an uh prospective family that will respond to those immediately that we're not delaying in our response and therefore they go ahead and seek a different option it goes down quite frankly and this is a very simple one we all know if i'm standing in line at safeway or fries and i say something negative 10 people here if i say something positive one person hears it so how is it that we sell the district on a day-to-day basis in our district and social media and what are we saying whatever we're saying highlights who we are and what we're all about it could be how do we communicate to new neighbors that move in what are the choices that are available to them when we start to look at and we're already doing it but we'll continue what's our what's our social media presence and when we start selling the stories like with the three employees that got the national awards from modern teacher that's why you will see as a general statement i believe a very positive portrayal of the district through social media and what kayla and marketing is is doing is let's highlight all the positives all the good things that are happening in our district so it becomes that so that we can change what's the what's it really look like in this district and we still have a whole bunch more to go i think sometimes it's very easy to get caught up in the day-to-day and forget about the overall picture just a simple one and there'll be stuff coming out of this in the next few months we have done 17 million dollars worth of work in under a year and it went to every single school site in the district and we did not go to our voters and ask for more money for it we are getting national recognition for that we're getting national recognition for modern teacher and so how you perceive your district what's that old saying if you think it can or you think it can't it will and so how do we do that so there may be some structural issues relative to to what we do with marketing but there's also just what is the communication of who we are and how we are and there's probably i use this word purposely more damage done by off-handed comments from people not thinking or they make a shot at the district because they're ticked about something and that was more harm and damage than all the positives that you're trying to push out we are in competition if people are not aware there's new high school charter school being built right off of garion and skyline queen creek is opening up their new high school offer rigs in ellsworth well that high school the charter is going to be open up this um uh in july the queen creek one is a year from july there's an elementary school going right on like basically the corner of riggs for queen creek if you want to look at high schools you got poston butte you got ala you got three queen creek high schools you got this leona group high school you got aj you got ben franklin you have combs in a very small area the competition that we have for any of our schools and if you think there's that many high schools the number of elementary and middle schools is even greater than that and if we want to compete then we need to compete and so i'm sure there'll be other things we talk about but those are some off the top my head but it is something that is is it a critical mass for what we do when it comes to talking about all the fantastic things we're doing in this district well i i 100 agree and i know i know it's a competitive environment and we do and there's no reason why that many kids who live right by our school shouldn't be going to our schools um so i agree with all that i just i was just curious what you meant by that because sometimes um anyways just we we all i'll say is that's just the tip of the iceberg i'm sure there's a ton of different things that we can do what i do know if we don't do anything then we won't meet the goal right but is that how it's going to be conveyed to the teachers as an encouragement well i'm assuming i'm assuming there's any number of people that are watching us on on uh youtube right now so yes it'll be conveyed the same way as it's being conveyed right now okay all right because i think there's tons of things going great and kayla and our team i mean we just need to make sure the community understands and knows what we're doing here dea this is just a summary obviously again this is just taking all the different things we talked about um uh within the presentation again i can't stress enough that 692 000 may go down yeah it may increase the amount we have available in daa if in fact the the dollar amount changes um in terms of what the state budget is so we're we still have capacity in d.a so when going back to talking about a conservative budget you still have capacity within daa of uh just short of or just over a half a million dollars for things that may come up over the course of the year if we look at the bond summary again we're starting to use more and more of the bond and in response to your question bob about the bond this starts to show you how we're spending it but again we still have uh a little over a hundred thousand left in the bond even even if we're aggressive in these kind of uh payouts server yeah no no no that that wasn't uh that wasn't meant to convey a split that was meant to convey that carl and i are still debating whether we do bond or essers we put it here so we didn't lose track of it but as the as the essers dollars come in we might make a slight change uh with that um with that but so that that split was just to say we're still debating whether we think it's an essers payment or a bond payment i put it here so we didn't lose track of it okay and then also the uh banned uniforms and the cta cameras we hadn't seen those numbers in the previously so these because they have been approved already if you remember we went out for the band i just wanted people to show us what the bottom right and i wanted the people to understand that that again we've we're trying to take care of as many different entities within our school district as possible and so that's why those were there but you've actually approved those already and we're moving forward with them in terms of proposition 301 here's where you're seeing we're going to take one percent out of bucket 11 and 2 out of bucket three again we would see an increase so these numbers the 209 and the 241 will actually increase once we see what the state's going to give us again what it means when you collapse all three buckets to one still has to be determined that's what the law is the new the new law that the governor signed requires but everybody's still waiting for the ag to respond to us as what does it mean but this is the dollars we have available and this is how we can afford uh this increase and still have uh uh extra dollars contingency in those two buckets bucket 12 is not there because that right now has to be dedicated to performance pay and so therefore when we were doing this the governor had not signed that bill and so we stayed away from bucket 12 because that's for performance pay we might come back to you once we get some direction from the ag and we might modify this particular slide but this is where we are as of last week so are we waiting for the governor to tell us how we need to do like how performance pay is supposed to be paid not so much the governor as the ag okay the governor signed it and the bill speaks to some components of it now school districts are waiting for the auditor general to say okay well we we read what the what the new law says this way so we believe that this new law in conjunction with existing law will allow school districts to do x y and z once school districts get that then there may some may some may be some modifications in any number of areas business so again this is a very conservative way that would allow us to do the three percent increase for a certified staff still allow for contingency and still allow for additional movement whether it be upcoming or future years based on what the ag reports so again very conservative the rooftop fees there was dollar amounts there and there's dollars to account for that esther's two you'll see that there's an essence um it matches 286 a couple things though again if we don't hire the 10 additional staff members then this changes and so when we when we start to take a look at that even as you look at this there still may be some changes we will zero out you must zero out esters one two and three as you go through them so we may have to do journal entries next year based on any number of different factors so if we only hired five teachers just to make it up well then we're gonna have to zero out that some other way so this is one of these cases where again the dollars may change or the the topics that you're using to spend the budget line items will change we'll bring you updates on that as we move forward but at this point our projections will be such and this is this is what was submitted to the state to get approval for our essers 2 grant it's actually a grant program through the state it was approved today it was approved this afternoon by add using these numbers and they know that these numbers may change but this is improved to us so we're going to move forward with this and then as things change we will make the entries in and apprise the state of what the changes are and again we'll bring it to you with some summaries uh probably more closer to us to december but maybe we'll do one in september we just have to wait and see how it plays out that same thing will happen with esther's three to be totally honest so the utility bills are are we seeing a decrease in our utility bills yes we should be yes we haven't tracked it i don't know what you guys are seeing any way we could pre-do it for the next year with some of this potential [Laughter] that's prepay see that's the biggest issue we had planned originally to take care of the debt service and pay that down sooner but we were told that we we're not allowed to use this money for debt services but then we've heard that others have and so we're trying to get clarification okay because if we can't then that's okay i mean there's i i think at the end of the day we'll find a way to spend the money so that's not a concern but but that could help us out uh relative to the payoff of that piece sooner then when you look at uh esther's three again a couple different things with this we're estimating six five um and 6.5 mil again that's an estimate we should have the correct number um upcoming but based on everything that we've been directed by ade that's where we came up with that number we just didn't pull it out of the air that was based on direction from ade but they're still working on the actual numbers as they get the dollars from the state excuse me from the feds but here's what we're trying to see when we talked about that bridge there's a way for us to take care of that retention bonus for the next four years and so there's a way to say we're going to now what if something happens and we get an unexpected cost we're not committing to retention bonus in 22 23 23 24 24 25.
