okay is there a second second it's been moved and seconded is there any discussion i have a couple of questions for discussion purposes uh when we talk and i don't know if it's dr mccord or miss betts which positions are included in the two percent of the ongoing increase so for that it's all regular scheduled positions with the scheduled work week minimum wage employees temporary employees supplemental pay employees and any substitutes would not be included in the two percent uh pay increase okay my second question is remind us of the positions that are minimum wage positions so in in our grading system in terms of of how employees are graded for purposes within our system not a grade in terms of a b c or d but just what level they're at all positions that are at the 101 which include assistant activity leaders crossing guards instructional assistants science resource materials clerk spirit store clerk keep in mind that all of these positions will receive an inflationary crease in january of 2022 pursued to statute and my last question is how will hourly employee stipends be calculated if they are eligible how are they miss bet you want to hit that one um you bet sure uh so um the calculation would be based upon their annual scheduled hours so specifically if they are a seven hour a day employee multiplied by their number of days for the entire year then we would take their hourly rate of pay reflective of fiscal year 2022 multiply those two together and then multiply them by 1.5 for the december payment and another 1.5 for the um june payment so it will be based on scheduled hours not actual hours so overtime hours or those hours that are over their schedule would not be um included in the calculation of their stipend thank you mrs betts any other questions miss wood yes thank you so the three percent stipend we didn't see that in this budget at all in this budget presentation and i i believe though you just said that that will be coming from the sr3 that's correct which you anticipate between 10 to 20 million dollars that's correct and we're saying that this will be 6.7 million dollars um that includes all employees who have been here this year going forward to basically give them a retention stipend as much as we can too that would be approved for contracts for next school year okay okay okay that are that are approved for contracts next failure okay so if we have 6.7 million dollars um if it's only 10 million dollars and we have 20 percent that must go to um what can i think of the word right now um okay so that would be two million going toward learning loss so the basically the remaining would go toward this um stipend that's correct if it's a 10 million dollar amount we're hoping that that's the low end of what we're anticipating that's the low end of what sr3 will be based upon the quantification of what was passed by the federal government uh it's anticipated that it would be a little bit over two times uh two but again um being cautious and not knowing exactly um but um but that's what we were led to believe again we will know for sure by the end of this month okay i appreciate that and i with this been a difficult year and difficult decisions all the way around but i also know that we've made commitments um in our strategic operating plan in the past year of um in in our in our overrides in different things to provide competitive compensation and we've made strides toward that and i think this is important even though recognizing that this three percent stipend is a one-time use of money i think it's as as much as we can offer in the best way that we can at this point and hopefully we can find going forward let's keep looking forward to be competitive in our salaries it's important i think we've set that as a standard going forward and i think we need to keep going forward with that so i appreciate this thank you thank you miss wood any other questions comments concerns i i was just going to say um i really i think it's important to be competitive but i am concerned that we're using one-time money i mean my experience on the board is that every year we've had to cut the budget except after we've passed an override and bond election those are the only years i have not had to cut the budget in order to get a raise included and sometimes that raise has been much smaller than this so i just want people to be aware we're doing our best hopefully as we go forward in the future i i hope the legislature will be more generous than i anticipate that would be very helpful that you know we need funding i know people get frustrated that we talk about funding but we need funding in order to pay people to have education and that's you know this is it's nice that we can give the stipend but um it's going to be challenging to keep that three percent as we go forward then we're going to have to figure out how we do that mr carr if i may just to make a comment to clarify you know i think the question that i've received is why are you giving raises when you've just announced that you're reducing employment um and and i've talked with both mr mcintosh and miss betts about this and rather than ask it i'll answer you can correct me if i say this wrong the reduction in force was driven by student and count student enrollment adm it's it's it's part of a formula of student teacher ratio if you will and with the effects and affects our budget it affects our classroom planning it affects you know all elements the compensation for those employees that that remain and and we we recognize how it looks to to some but is part of an ongoing plan we've done a compensation studies we've done benchmarks we've had strategic plans and we've spent the last two or three years trying to align our compensation to that to make sure that we are competitive one of the feedbacks that we received from teachers four years ago some of you know six years ago when all of us have run and over the last several years is my salary is not the same as those in neighboring districts we've spent a great deal of time and effort over the last several years to try and align salaries across the board to those competitive benchmarks that we have with our neighboring districts if we backtrack now we fall behind again and that creates a two three or even four year fix that we're constantly behind not knowing to ms humphreys point if future budgets or future allocations will allow us to fix that problem so as much as they seem related to some that they're they're actually two different drivers that drive it and one is we we have to align our our teachings our staffing two student numbers the other is we have to remain competitive with neighboring districts to keep the employees and and treat them fairly so i just i just want to make that point and i i agree um ms humphries with you i i'm concerned about using one-time funding not because we don't have one-time funding available but because it creates an expectation we're using one-time funds to stay competitive at some point to stay true to that we've got to make that permanent and we don't we don't know so we're trying to bridge that gap um and it's an imperfect bridge but it's a bridge that i'm willing to take to to try and treat the those employees who are staying as fairly as possible so i again not a question but uh a restatement of a conversation that i've had both with mr mcintosh and miss betts uh outside of this meeting oh i have another comment now that have you listened to you mr carr um in 2009 i was a parent that came to that meeting the school board meeting where the school board voted to a reduction in force and that was where i got involved because i thought you know i got to understand what's going on that reduction um they didn't give a raise so they could keep more people and it took us seven years to actually bring people up to where they should have been because of that it took us until 2015 until we passed the override and then so they got that raised in 2016.

um we did a one to seven percent raise to help those that had stayed in the district but had not received adequate compensation um so we had some leapfrogging going on um it's really important that we try every year to be um keep our programs the best we can but also keep our salaries as competitive as possible because once we once we slide back it's really hard to recover it's it's really hard and um that just shows because you know 2009 to 2015 that's a long time to wait for additional compensation and miss betsy i'd just like to go back just a little bit because you outlined two circumstances during the first rift period and the circumstances this period can you re-state the differences between those two i'm sure so back in 2009 and i was here in arizona in 2009 at the time it was a a huge decrease in the amount per student available for school districts and charter schools throughout the state of arizona so we were not provided the additional resources we needed to meet the needs of the students that we had in our schools and if i remember right in gilbert you all were still growing in 2010 we were right about plateaued out about plateauing at that point in time probably the peak and so at that point in time the reduction in force occurred and many school districts froze salaries without any increases and had to eliminate staff and so class sizes were increased resources were limited to our students so in this particular case the class sizes are remaining the same as they were in 2020 and the issue is that we lost the student so didn't have the same need for the number of staff to support the learning of those students and so but we we did receive an additional a dollar amount from the state regarding like the base level amount increased by inflation as an example so it was truly about the loss of students and making sure that we had the right number of staff to meet the needs of those students not due to a significant budgetary reduction i think that's an important factor is that we keep in front of us that the loss of students is what brings us to this point today if there is no other discussion and miss wood would accept and her second would accept i'd like to just restate the motion just to for clair clarification sake and it's moving to approve a two percent ongoing pay increase for all regularly scheduled employees excluding minimum wage supplemental pay temporary and substitute employees and approve a three percent stipend for all regularly scheduled employees to include minimum wage employees but excluding supplemental pay as a part of that calculation temporary employees and substitute employees where the stipend for the hourly employee is calculated based on an annual scheduled hours multiplied by the fiscal year 2022 hourly rate to be paid in two lump sums in december and june just so that that's read into the record and people understand who the groups are and that are included those that are not included and what the two percent represents and what the three percent represents uh do you accept that wording this would yes thank you and i i think you think you stated this dr santa cruz but just to be on just in case i didn't hear it the stipend is just for the three percent is just for the 2022 school year yes i'm fine okay so that was miss woods motion and the second she's accepted the verbiage and so with no additional comment or question we will vote on item 7.03 two percent ongoing compensation increase in the three point three percent stipend for fy 2022 those in favor please signify by saying aye aye those opposed the same motion carries five zero item 7.04 starting wages and salaries increase by inflation exempt for minimum wage except for minimum wage and supplemental pay dr mccord anything by way of introduction yes dr santa cruz governing board members in order to minimize salary and wage compression associated with beginning hourly wages and salaries it's recommended that the governing board approve starting pay inflationary increases for all positions except for minimum wage positions minimum wage positions will receive an inflationary increase in january twenty twenty two the legislator is the legislature is expected to approve a one point two three percent inflationary amount thank you dr mccord item 7.04 is on the table is there a motion so moved thank you miss humphries is there a second oh second thank you mr carr discussion dr mccord yes thanks dr santa cruz dreamcoater miss betts so do you feel that this continues i i feel like this addresses the concerns of compression that we've been trying and working to address does this address competitiveness with for our starting salaries for with our neighboring districts do you feel i think based on our compensation study it helps address it it doesn't no it doesn't fully address it and when i say that um again talking about budgets and surrounding districts they're growing they have more they'll have more money probably to put towards this but this will help us continue to stay the course and not fall further behind i guess is the best way to put it okay so i know that's important too exactly thank you can you could we have uh hear from mr mcintosh a little bit about the compression issue that we had those seven years i mentioned that we were finally able to dress some in 2015 and and especially with the minimum wage that's been over the last three four years can you talk about compression and what we've done to address that and why this is important to to address it as we go forward absolutely absolutely um at the end of the conclusion of our salary study we looked at every job within the district and um then those who participated in the salary study and pushed people into new ranges and gave them last year and addressed all of the compression that we felt was necessary at that time to dr mccord's point it helped us become more competitive it has been suggested i think by the the consultant what is it you have to go at least half bonnie of whatever raise you give to the entire employee group you have to increase those base rates by a minimum of half in order to stay um not to have the compression occur again actually a maximum of a half right a maximum of a half and just in case somebody doesn't understand that compression means that someone who's supervising might make the same amount as someone that is under them because of either the minimum wage increase that we've had over the last few years or prior someone coming in new to the district and getting a little more money and then people in the district not getting that same amount of uh increase correct prior to to last year's salary study and the implementation of those results we had compressed a whole bunch of job grades because the increase was provided to minimum wage earners was larger than the increase given to the staff within some of those in other positions so it compressed a whole bunch of jobs into what became the minimum wage jobs and then we had to to implement these the salary study results in order to push some of those jobs with higher responsibility outside of the minimum wage and and we were able to address this because of our increase from a 10 override to a 15 percent override correct otherwise we would not have had those funds and that's why we had the compression to begin with because we just didn't have enough funds to address it but without those additional funds given us by the voters we were able to do a lot um so i'm going to work on enrollment i hope i can find some people who want to come to gilbert public schools and hope we can do better thank you and i think the salary study has helped us and keeps us in prioritizing uh the fact that we need to continue to stay competitive stay decompressed moving forward and so that depends on on budget but of course that would be a priority as we move if i could just make sure and clarify to dr santa cruz correct the fact that that we are just talking about the base rate schedule right now to increase the starting salaries i just wanted to make sure it's clear that everyone's not going to receive inflation plus the two percent so i just want to make sure that's entered on the record that this is for those that we would be hiring in the future that would that the starting salary of any position would be increased by inflation because anybody that is ongoing would receive a two percent pay increase instead of that one point two three percent so i just wanted to make sure that that's in the record and clear thank you ms betts any additional commentary question then 7.4 is ready for a vote all those in favor of 7.4 please signify by saying aye aye all those opposed the same motion carries five zero we're at item eight which is adjournment of this brief board meeting is there a motion i'll move that we adjourn thank you mr carr that has been moved is there a second second thank you mr eugenie it's been moved and seconded all those in favor of adjournment please signify by saying aye aye those opposed the same motion carries five zero we thank you for your attendance both live stream and here in person we'll say goodnight and the board meeting is adjourned not at a work study there is no open call to the

oh this i i don't see closed captioning on my phone uh okay the transcript there that cold capture um okay why did i disable it good i don't know how to do that thank you good afternoon leslie i'm on my meeting okay denise yes hi good afternoon how are you today all right are we on yes we are okay well welcome to the human rights commission um denise this time why don't you uh handle the roll call okay we have um our chair leslie steinbeck president we have our vice chair um judah gerber president we have commissioner linda winkler president commissioner pamela dent president commissioner dilla doss president um president we have commissioner diana cass president we have council member elizabeth nelson commissioner aiden michael silva um we have commissioner you should gazi at one president and we have a quorum oh i'm sorry and i have one more person down here i have council member travis regina president we have a call thank you you're welcome well next it's time for uh public comment okay i don't have anybody who is called in presently i don't see anyone okay do we need um do they need a telephone number or anything from you but they are the telephone number is listed um on the link and let's see if i can pull it up again and since we are on it looks like we've got ctn on i think from our council meetings there's usually about a 30 second delay and so you may want to give a minute from announcing it sure and it should be on with ctn as well the numbers okay i don't see it on my screen i thought you i would but if you want to call in toll-free one two one three three or audio only if you want to just listen you could also use 877-853-5247 toll-free number one plus 206 337-9723 those the numbers okay but you see nothing i don't see anyone though then let's begin okay um agenda do we have any and we have a motion to approve the agenda still up second second um diana any discussion or changes um all in favor aye looks like everybody um minutes i think we need a motion to approve the minutes from march 10th meeting i move to approve the minutes from the march 10th meeting second high second discussion no one has a discussion all in favor and it's approved this might be a very short meeting um something i call topics in the works we got a call from the martin prosperity oh wait a minute no we've got a call of somebody who wants to present to us um and it's an interesting thing i want you to decide whether you want to see it this has to do with racially restrictive covenants um one of the things we've talked about in this in this commission in the past has to do with the historically um segregated and still segregated state of ann arbor and how government and business policies and practices have contributed to the segregation that we now see um a couple of years ago mount martin prosperity institute released a study that identified ann arbor as the eighth most social social um social economically segregated metropolitan area in the country um and there are reasons for this we've got a group in ann arbor that has been researching the history of this segregation by looking at racially restrictive covenants and what these are are d there's a code like codicils to deeds that say you know if you if you buy this property you have to promise not to sell to some group of people often that group of people but not exclusively of people of color and this was went on for years and years um so michael steinberg and others have been researching this and it's a the results are very interesting keita and i attended a presentation about it on in the moon we we attended it when it was presented to the planning committee we both thought it was so interesting we actually sent people a link did anybody i don't know if anybody actually looked at the link but it's it's worse thing but did you even be more worthwhile i think having them present to us because we could ask the questions and the questions are very important and very interesting is this something you want to spend take i think it'll take about an hour this is something you want me to try to arrange yeah everybody agree okay we'll do it then next thing um i should have done this during the during the minutes um during the agenda can i go back and ask the agenda be modified slightly to allow i should talk about among other things the um the thing that was on the agenda toward the end of this segment the town hall meeting issues around that can i can we talk about that first because aisha would like to leave early yeah hi everyone good evening unfortunately absolutely early um some of you may not know i'm actually expecting in about a week so i need to yeah so baby commissioners so i um i just need to get some rest honestly um so you know the may pack the michigan asian pacific american affairs commission they've just been having calls to do town halls from everyone really and i think it would be in our best interest if we do a town hall that we initiate on anti-asian american sentiment but also you know i mean another you know black man was just killed by the police i think we need to talk about racial discrimination in our in our community i know there's also been you know other incidences that have gone on talk about hate talk about bystander intervention um so it's something that i propose to be doing even though i cannot probably be as involved in planning it as i would like i can definitely help to bring in speakers and bring in other people that kiss us so that is that's my proposal is that we think about a town hall okay that's basically what's that so we um i was just gonna say i think it makes a ton of sense given that ann arbor has one of the highest percentages of asian population in the state yeah yeah exactly i mean i think we're the second highest community in the state and then in addition you know as leslie just mentioned we are one of the most segregated communities by race economic class in the nation so we call ourselves progressive and if there's if there is a commission that can take this on and that should lead this and that's also true of the asian population in in this city as well they are segregated right largely by choice to a large extent um but for good reason right so and i think you know we've been wanting to build our kind of a community engagement presence for a while and this would be a good opportunity to do that so i'm gonna help leslie kind of build a program i welcome any of you to also participate with that um think about speakers to bring in also i'd welcome ideas so i'll be sending out an email in the next few days and and we will invite each of you to to participate if you like yeah so think about think about whether you'd want to this is going to take a few people who are really interested to lead the rest of us um i i think it's a good idea and this would not be with maypac um but it it could be we could partner with city council for example we could come out i mean there are things there are people we could car partner with and there are asian groups we could partner with yeah yeah i mean maypeck has said that we'll co-sponsor we just can't do the work which i understand okay and then also you know city council members like travis and lynn song started talking about this pretty early on um so i think you know i don't want to speak for travis but i think that lynn is interested in helping us her and i talked about this the other day but i think that we should lead it we should lead it we're the human rights commission okay well aisha given that you're about to bring life into the world you might need some help on this and um i'm happy to assist and help lead as needed that would be amazing it would be amazing um i'll reach out to you bill up please do can can i just who would be interested in doing and being working on this what is this son just sort of leading the aiden ayden okay awesome that would be great and dilla yeah i can definitely assist where needed i think that a key component of this because the university of michigan is such a large part of our community i think it would be crucial to also outreach to the number of asian and asian american affinity groups oh that's great on campus invite their involvement and i would be happy to serve as a liaison in that sense um while dilip uh leads the charge on this as well i appreciate it dilip that would be great that would be awesome um i think first step is maybe thinking about some dates which we can do offline and then proposing it to the rest of the commission right right anybody else who wants to be in this this sort of lead team okay i can be i can be on that because i'm interested too diana did you want to say something yeah i was just going to say i can help oh good okay great okay we gotta we've got the beginnings of a plan that's good i should you also want to say anything else but about this um um town hall before we leave that subject for a minute uh i guess maypack is hosting a town hall in june june 17th gonna be more focused towards educators parents families we're gonna invite the state superintendent just kind of talk about the need for you know creating api parental advisory groups in every district but also the need to really integrate like bypoc history into into clickbank um outside of just asian americans but including asian americans yeah i'll definitely start carelessly go i was wondering if this one it might not be might not be well to have uh chief cox there for example um just man maybe the mayor and and because i think some of them really don't understand the city as well we've got we've got immigrants and we've got people who are simply recogni identifies asian americans yeah to clarify the may pack town hall on june 17th is statewide the one that we're going to plan will be city specifics but i think that would be an excellent opportunity to bring in the mayor yeah you know the lieutenant fox or sergeant mills other people who have reached out if they want to um but just just to draw that clarity that i think we should leave the charge on creating a town hall that's specific to our community and hopefully i'll set a precedent where we can we can do this more often when other incidences of hate and topics all right i'd also like to see us talk about about human you know about their protections and how to file a complaint yeah absolutely those kinds of things anything else before we leave this subject to the lead team asia i should you want to say something about your award oh i won the provost teaching award and i want to thank you all because it wouldn't have happened it was really without all of your involvement and your support and your willingness to really you know um to really just help students learn i really think and they learned a lot and i hope it benefited the community too we might have enough places for opportunity later on this year huh if you're yeah i'm teaching the class again so yeah hopefully another opportunity terrific anything else before you go i think i'm going to stay on for a little bit longer okay i'll check out when i need to okay well we certainly wish you well i mean thank you please let us know and i will announce it you know you know it's a boy right it is a boy yep boy weeks my gosh i know okay wild ride then let us go on to trespass um for the people who aren't here and don't know where how we got involved in trespass in the first place we got involved in trespass in the first place way before there was an independent citizens police oversight commission and we were asked to take it on because trespass was looking was being considered um was people were having a lot of problems with it there was the incident at blake transit center there was a sense that trespass was being used as a way to control people of color uh and youth and that it tends to entrap people in a pipeline of justice system where it may not be necessary so people were feeling it was being used too much we worked on it for a long time got to know much more about it than i think any of us ever wanted to know and then uh police oversight commission was established and there was a new police chief and a new city administrator so it's put on hold for a long time but it's and and lots of things actually were changed policies were changed um the way it was enforced just has been changed to some extent because of the work of um of uh ariane slay um but it's but we still had a lot of trouble with it one of the big problems we had with it had to do with the fact that it that once somebody was was cited for trespass they were automatically um banned from the property for a year and we thought that's in a lot of cases that is way too much and this is and and this was i mean it wasn't even a misdemeanor it was a citation and people were just automatically banned for a year and if they had come back before the year was up they then then they suddenly had a a charge so then it got became something that was on the person's record so it was it was kind of a penalty with no real due process um we got together to finish out the last of the kinks that we found in trespass while while it was in our while was under our watch and so we we joined with ikpa people so we have a joint group now that's been working on it and the one issue left is still what what is the banishment time what should it be we all agree it shouldn't be automatically defaulted one year one year is the longest time that the state allows however so we tried to make it for some of these people you know maybe they're drunk at a bar and they're told to leave so maybe 24 hours for some people is enough maybe it's longer so we've come up with possibly a five choices excuse my cat um and the business community is still thinking about it because it turns out once you start talking to people people use trespass in a lot of different ways and people like um organizations like the library for example half people internally have processes um try to deal with it themselves and they have a one day one week one month kind of plan for themselves internally they don't call police for trespass until they can't handle it anymore and so they really do need a year so we're thinking about that that's the last big issue that's up for grabs before we talk to chief cox about this and i just wanted you to know that it's happening and that this is something that pam and judah and linda and i have been working on and it is almost there and you'll hear about it when it's finally dealt with but that's what's happening in that place um a second thing i wanted to update you on is the crew report study group even though that's not yeah travis sorry but before we move on i i just want i had a question about the trespass work and um wondered if in your conversations you have reached out to um some of the domestic violence shelters in the area um i think my understanding is that at times trespass is also being used to keep individuals away from victims of domestic violence or other violence um and so that may be a key stakeholder that you would want to engage with as well right yes we have we we do know about that um and that is part of it i like having on housing like people who are um we know about it people they're using it to keep to instead of having to do go through a restraining order and so it's it's important there are things to think about nothing is easy one of the things we've learned to being on this commission is that it's easy to think you've got a solution for things and none of the solutions are quite as easy as they look people do have lots of different issues and that is why we are the things we're on sometimes i mean i keep wondering if they're taking longer than they should but we are taking care to do it right um so the crew update anymore anything else on trespass before we leave that subject crew update um if you remember the crew report and many of you read it um we have we've got four people on this commission that have been working with about four people on the police oversight commission and some other people that we keep pulling in to see if we can understand this report and see if there's a piece of this this puzzle all the things that are in the report that we can do that might help i know a lot of people here when we talked about you know um things that you think are serious human rights problems in the city a lot of people talked about the justice system inequalities there and that's one place where we're dealing with it with ikpak who can that can do something about it it's that's more of their uh mandated domain but a lot of the other justice things that don't have to do with the police are still ours so we're involved i sent you copies of the notes for the last two meetings we've got another meeting judy you might want to talk about where we we finally where we are now on that if you will if you want to where we are now in terms of i think probably we're zeroing in on things that we might want to be yeah we've been identified a few topics that we think could benefit from further uh study and and and either by the crew people or uh others doing that kind of work and one is uh probation so you know the the original crew study raised a lot of questions and it looked at um judicial decisions and sentencing but it didn't look at the whole system it didn't even look at the effect of probation recommendations and that that sort of thing so we're we are learning more looking into that uh and uh let's see i don't have the notes here but um in parole and parole the parole is more of a statewide thing but we're looking at that but there's less sort of local control uh and but those are decisions that have an impact on you know the same uh the offenders that we're that we're looking at um and what was let me see was there another thing that we're looking at right now um i think it was the michigan incarceration data um judah by the witch data michigan incarceration data yes [Music] right i mean that's a source of information about about the things that we're looking at yeah yeah yeah pam was there something else about that that you want to elaborate on no just that that was one of the topics we had agreed to drill down and focus on and give our attention to there were several topics but we felt obviously we couldn't address all of them and do it in in a concise definitive um helpful way and so these were the two that we initially discussed although there are others that we're not necessarily excluding or not focusing on just that these were the two that we felt we wanted to prioritize one of the things that's been really interesting about this is that um one of the reasons we started it is that didn't look like anybody else was doing it and it is something that we're you know that is in our our area um but groups all over ann arbor are working on pieces of this and one of the so now the question is what what can we do that other people aren't doing the crew group itself has a proposal in to do more to do a more system-wide approach the icpj is doing some things they've got a number of groups that are sort of trying to figure out if there's something they can do there's a county-wide group that they're just a number of groups that are taking little pieces of this we realize that no one was taking parole and probation and that that might be something we could do that no one else is doing and it's something that seems to be a a place where there's enough discretion that there's probably a lot of inequity and that we also looked at i mean these are all hot potatoes right so we looked at uh you know fines and fees and and um this is a huge revenue stream for the courts they it's they kind of live off of that so you know you have to be careful when you mess with someone's income stream but uh it's also a potential source of great in inequity uh in how this affects the lives of people who have to pay these fines and fees and so anyway it's it's one of those things that we're looking at and don't know that we can do anything about it but uh it's certainly worth worth uh further study talked a little bit too about mental health and the police and those issues and i don't know if everybody is aware of it but the city council just passed a resolution asking tom crawford to come up with a plan where the city police can somehow partner with community mental health or some group and have a way of responding unharmed said did i say that explain that well enough but that's another another area that is and and i know that the sheriff is also doing something about that so it's the whole another thing that's going on so there's there's lots of um crew-like activity what i want to say to you folks also is that um this is this is a group where we've got less than a quorum and that and it's important for us to stay less than a quarantine that we're not really uh we're not we're not posting our meetings because we're not deciding anything or doing anything and we're not all it's not just one group it's a lot of people but we're coordinating it but people on who are interested who are not who have not been members before can take them part in it and in fact like aisha's not going to be there on friday maybe somebody wants to come to our meeting on friday where we're going to be talking to ariane slay and john wright reisser reeser about parole and probation and an expungement and um deferment or deflection so somebody who wants to do that let me know and and you can be a part of this it's friday at nine nine to ten thirty so we could have one more person and and but there are a lot of ways that other people could be involved in this if they wanna be so i'm just just so you know okay the third thing we have to talk about fair chance housing i hope everybody knows that on april 5th fair chance housing ordinance was passed and we have lots of people to thank for that um first has got to be aaron tsuganama who came to us with uh a desire to have you know to to um integrate into the community to have a good life to change everything and have trouble finding a house um affordable housing and he came to elizabeth nelson who was good enough to really listen and see that he had a serious problem that the community ought to address and referred him to us even before she was a liaison and we're thrilled about that because we would might have never heard about it and um and of course linda and keita who worked so hard on this uh and on this uh ordinance and margie radaba who also was just just central to this um jennifer hall who was just enormously important she was on our housing commission and gave us a lot of information about housing that we didn't have this is our second ordinance about housing vote it's not something we've really ever done before this year housing ordinances having to do with fair access to housing um and then of course there was travis regina and elizabeth nelson who who who sponsored this for us and there were five other uh city council members who jumped in to co-sponsor um and then there were the 17 others who were the readers of this and you know and how it helped to make it uh something that will work in the community and be an effective ordinance now the burden is on us to enforce them and that means we've got to do something we have to do at least at least one thing and that is well the the ordinance goes like this it reads like this the city shall publish and make available informing applica uh information informing applicants of their housing of for housing of their rights under the ordinance describing your restrictions and requirements of the ordinance instructing them about how to file a complaint with the human rights commission and we'd like to include source of income in there because we've never published that and this is a good time to do both of them this is something the city does and we don't know yet who the city is city who's going to do it but we probably are going to have to help them somehow um and that's that's one piece i won't worry about that much because maybe they won't margaret is trying to give let us know who's going to do it and who needs to you know how we need to be involved if at all but the thing we really have to do is create a complaint form and create a process to handle these specific complaints that are somewhat different from the kind of complaints that we handled before similar and different linda has just worked very hard getting a an online complaint form on our website for regular complaints so linda why don't you start talking we're gonna do this for wait a minute i'm not taking full credit for this denise denise nick leslie okay i was one of many so but thank you she deserves the credit a lot of it um i think we you know we just need to sit down and come up with some both the paper form like we did with the non-discrimination ordinance when we first started taking complaints on that as well as an online form now that we know how to do that um i don't think it should take long i think a couple of us working together could do it um and we need to have a separate section on the website that would describe the ordinance describe uh describe the process and it's very similar to what we currently do except that the ordinance itself is different and so the form needs to be different but the complaint process is the same as what we do with the non-discrimination ordinance so who wants to help judah pam great that's fine three of us should be great should be plenty great great i hope mr nelson has her hand up excuse me yeah oh you want to be part of this uh well actually i i don't know the appropriateness of me being a part of it but i didn't wanted to make a comment i um i was in a meeting account i'm on urban county and uh fair housing center gave a presentation and i had exchanged a few emails with aaron shigenama about the enforcement process and sort of trying to imagine how it would happen and i had i was thinking about the fair housing center in terms of testing and uh aaron's told me well they told me that they wouldn't do that or that's approximately is what he told me and then i was in a meeting with and we had this presentation from fair housing uh and i asked that question and i said i it seems like something you could test for is it something somebody told me that you didn't um and i guess they don't have funding to test for it um so it would you guys are not in your head so maybe you know exactly what i'm talking about but i would i was interested oh okay because i was interested in the conversation about that because uh it does strike me that it's a difficult thing to prove and uh you know somebody like aaron i mean he kind of is like the perfect example and i'm sure that there are other people out there who um who are like him um anyway i i just that was my contribution i was just curious to talk about that and i guess my other question was if you're so you talked about um raising awareness about both the um discrimination and source of income and the fair chance ordinance because these two things are sort of close together um i i wonder is there any chance that like a complaint form could be like for both of them or is there are these unique and is fair chance unique enough that it really i was just curious well source of income is one of the protected categories on the non-discrimination ordinance right i mean we have to sit down and think about this but i think the ordinances are are different enough that it would just be too confusing to sort of yeah i don't think we could just add as another category so for instance in the nondiscrimination ordinance criminal record is not a protected class whereas in this new ordinance of ours you can't discriminate against somebody in housing because of your membership in um because you have a criminal record so it really is very distinct and i think you get into trouble if you tried to combine them so source of income falls in the non-discrimination ordinance category and and this criminal record falls squarely in the new ordinance category i think i'd have to think about it but yeah we have taken uh source of income issues on the regular form in the past it works pretty well but i understand what you what i think you're going for is to be able to say if if the complaint is about housing i i understand and and we have and and we probably should make that distinction somehow in the if we've got if we're not going to put it in the housing one but it doesn't fit in the housing one but we might be able to explain it somehow in in our on the web on the website you know have a section on housing and then talk about it there or something yeah or we want we might be able to add it in i just don't know i have to think about it travis um my question is actually for councilmember nelson um in your conversation was did you get any indication about how much funding would be needed for a program like that to test um no actually i should say that these presentations at urban county are sort of there's a very little q a and so i like didn't i it would have been awkward for me to press really hard i i actually got the impression that um the the i had sort of thrown her off like the the question was sort of like the presentation definitely implied that they that this was something that they would test for um and they i guess they do test for it it's just that they don't they don't have a stream of funding for it i i hear what you're saying travis because like that was a question that sort of popped in my head and i got the vibe i got was kind of if they had a serious situation like they probably would even though technically they don't have a funding stream for it they have done it for us in the past for some because there are some things that we have had where we've had complaints about where testing made more sense and they have offered to do it for us occasionally and um i don't think they actually carried about it ever but there was the history of this is that at one point the city was paying them a stipend to handle this kind of testing and and it it has i think that if we had enough if we had if we had reason enough we might be able to find a way we we might have to find a way to pay them that's interesting to pay for them yeah because you're right there are there are cases where where that might come in i don't think it's automatic and they're i don't know i don't think testing is automatically necessary but it we might find that it's necessary more than we think and they have to ask for money and leslie since this is this is pam since this is going to be fairly new for us yes um a couple of things come to mind either partnering with fair housing but also with hud and i say that because when i worked for the governmental agencies we had subcontracts to do certain investigations and i know that hud has monies in fact they pay to have this type of work done so i'm i'm thinking that we can explore options of maybe partnering with them should we start sustaining housing complaints and and maybe dual file it like the like complainants do if they file with the state and it's automatically dual file at the federal level if it's under the same um law i'm just saying maybe explore that as an option i think we should i think and and maybe generate the income necessary to do the testing i don't know what fair housing has done up to this point i think they just did something so since this is going to be something new for us um look into exploring a partnership even a contractual relationship with hud um to get the revenue to then do the investigation and then have them for example um approve it if you will for consistency and ensuring compliance from a legal standpoint um not only for our ordinance but for any laws that govern housing um just as an option i know it's still new and we're still massaging and working on all of the details but i think this is something that's gonna be long term it's something that the other government agencies do on a regular so why not us and it has potential to make fair housing money anyway because they they will they will prosecute if we can't help i don't know anyway i think that i think exploring a partnership of some sort makes sense at least if nothing nothing else we will find out how much it costs and see if we have to do something to get that money if we need it anything else about this how about the process linda do you think the process do you want to do you want to say anything about the process of handling it other than what has already and said of handling these oh oh well okay so once we have a complaint form and i guess even before we do we do need there are four of us who have been handling complaints under the non-discrimination ordinance when they come in i was hoping that if we ever have this strategic planning meeting we can revisit that and maybe figure out a better way to handle complaints in general so that we all have a crack at it it's rotating and everybody you know knows the deal um but for now it would be good to have you know two or three people who were kind of ready to handle uh any complaints under the fair chance access to housing ordinance it can be the same group or it can be you know a subset of that group or it can be maybe at least one person from that group who knows to deal with handling these complaints and then some other people so whatever you want to do yeah this is this is going to become law ten days after it's published um so we may be getting complaints in the next month or two i mean that that's possible and it's probably and the first complaints i'm i'm afraid are because people will be for people who don't know about it unless they publish things really quickly i don't know you know i mean for now if if pam and and judah are okay with it we could be sort of the starter the start a group if something comes in early on while we're in process um but other people should think about whether they they want to handle these complaints when they come in yeah i'm fine with that for now yeah okay okay uh then let's go on to conversion therapy and lyndon i think you know more about that now too where is it remem remember that we left conversion therapy with having having voted for a resolution and a um and a um an ordinance but no one was really happy with the ordinance because it didn't cover um outside providers especially those that might come over the internet for example um and so we went back to the attorneys and spent quite a bit of time i think we had a two-hour meeting with four attorneys and me um and linda but linda's an attorney so you're used to that five attorneys it's fine whatever it was it was amazing and we came up with something i said you want to talk about that for a minute um well so we were able to just basically broaden the the language on the under the the main prohibition which is just one line that should cover basically um all kids within ann arbor so which would mean it would apply to therapists in ann arbor treating kids in ann arbor as well as therapists outside of ann arbor treating kids in ann arbor so that's you know that's the language now it doesn't mean that enforcement would be easy if it was somebody in california who was zooming into somebody's house and in ann arbor but it's not out of the question either um according to ariane i think there are some other ordinances where where something similar like that is done so that was changed and then um so it's this new lawyer who's just recently been added to the city attorney's office he read the ordinance with fresh eyes and had a lot of questions and a lot of ideas and the other part that he that he talked about was um you look very carefully at the list of licensed providers which in the draft we were working with was tied strictly to the state's public health code i think it's called so which would mean that no providers that were not listened listed there would be covered by the ordinance so he raised all these questions so then leslie contacted that we looked at the trevor project model ordinance which we had looked at before leslie called the trevor project we looked again at the mo the ordinances in at least three of the cities in ann arbor none of them tied their provider definition to the state health code only we were in ours so we redrafted it using the trevor project model which was slightly more expanded i mean in the end maybe not so different from tying it to the health code but it covered people not only who are licensed but who are certified or registered but then the city attorney's office is concerned that this could be read to cover clergy as well and that raised first amendment issues for them we consulted with another first amendment expert who thinks it isn't a problem so we're going around and around on this and it may be and diana and i think i should might might not have time now but we were all going to get together one more time and figure this out but if nothing else even if we kept the definition that was in the ordinance that we approved there was a blank in it that needed to be filled in it it listed like four different sections of the health code and then there was a blank for adding other sections and we never did that so we need to like go back look at it see what's in the state health code you know make sure we're covering as many people as we can resolve this first amendment thing if we decide we don't want to tie it to the health code um and i don't know if you guys have any thoughts on it now but that's where we are i think we pretty sure we will be actually done done with it um ready to like run with it um next month the next meeting and so it'll come before you at the next meeting and you'll have a chance to approve it again okay but i think you'll get a you'll certainly get a little bit more coverage than we had before and that's right um i do i do think that the discussion has been relevant and i think that everybody is really working to try to do their due diligence so that we're not coming back with problems later which i think is really important um so i do appreciate that people are asking questions and are looking at it and and are thinking broadly um which is good even though it takes time and and these uh these ordinances have been under fire to some extent not not a great extent but enough that that we're being very careful i'm sure you thought of this but it does concern me that there would be an exception for clergy that could really swallow the rule if you if they're acting in a therapeutic way and then they you know it has a shield so anyway nothing nothing you probably haven't thought of but yeah well no i mean happy to talk to you about it um get another view from another lawyer all right later yeah okay i'd rather not accept it i'd rather i i think i'd rather have it say sort of providers that are certified under this law and not list them or exempt anybody because i think pam started out with explaining that some some clergy are also social workers or you know have the degree and could continue to do this i don't think it's actually done that often i think what they're doing is they're they're getting outside people who are lower level but look like they have a degree that would make them um [Music] look like they're experts in this field so i i don't i i haven't heard yeah it doesn't mean anything i mean it does come down to a first amendment uh question and religion and um city attorney's office had one view and someone else we know who does you know the professor in this has another view so you know okay yeah okay well you're gonna see it soon and it's really gonna happen just just win um okay now we are at resolution to support a resolution that is that has been passed by city council having to do with um what they i don't know there we go resolution uh this is the resolution that this is supporting is the resolution content condemning hate crimes hate rhetoric and hateful acts against asians and asian americans um this is a resolution that aiden drafted for us and everybody should have a copy and it should be the copy that you got today late but i that has the changes that people made so far so does everybody have that copy okay aidan do you want to say something about it yes absolutely thank you so much for the opportunity to author this resolution um my thinking in my process of authoring this was that i think that as defenders of human rights for our county we need to take a very stand a very clear stand in what has happened across the nation um and i think that additionally uh in support of city council's um resolution already we need to make it clear the human rights commission is here to serve as well um i think that uh in terms of public engagement um it can seem that we are a group to just process complaints when in reality we as we've seen through this meeting are able to do so much more than that um so in the bill um i gave some historical contacts similar to what city council did as well as state our purpose and that we are here to serve and also provide a very clear stance that that that type of hate has absolutely no home here is something that should be vehemently opposed any and all edits or suggestions comments are more than welcome um and again thank you so much for the opportunity thank you for doing it i think you did a great job any comments about the wording any anything you want to say or any changes you want to make oh i do have one knit i could pick um okay and again i don't know if this is in the original or in ours so you reckon ann arbor cannot be a pillar of progress if any resident feels that their human rights are infringed upon that's pretty tough someone might feel that their human rights are infringed upon when they're not actually infringed upon and then we lose our pillar status so i'm just well i i i agree with the point but the fact that someone feels infringed upon isn't the same as them actually being infringed upon i mean that's kind of what we do with our complaints we look and see is there any basis for the complaint not just complaint itself so any suggestion to make that a little more clear any residents human rights are infringed upon not feels that just get rid of the feels that how about that that would work for me um i lost it just a second oh here we go it's like one two three four the fifth where yeah and if any resident say that again would you change it to well i would just um if any uh where instead of feels that just uh if any residents resident apostrophe s human rights are infringed upon how about that if any residents human rights are infringed upon right yeah that work anybody else excuse me leslie um council member nelson has a hand up oh i'm sorry i'm not looking at those blue hands elizabeth thank you i i by my first read of it i just wanted to compliment aiden and thank him for this because one of the pieces of the resolution that um felt like it didn't have anything like backing it up was the part of it where it was like resolved that were like recommending that people file complaints in this way and report this in this way and so i'm really glad to see this and i just wanted to say that i really appreciate this and it's i love it it's great thanks great thank you for just saying that linda and thank you for doing it aidan um sorry okay um aiden i was wondering do we able to read the comments that were offered to change it and are you okay with the changes did you have time to look at the newer draft yes absolutely i reviewed the newer draft um i have no comments on the suggested edits um i think that you are all are very seasoned at this and any sort of you know uh guidance is definitely very appreciated okay thank you so much for doing the work on it it's so much easier just to edit something that somebody else has done and have to write it yourself so thank you that's right thank you we're just happy to are we ready to vote on it motion move we adopt the resolution diana all in favor all of us unanimously passed thank you so this will be attached to our um our minutes um and it's sent to city council before then and i will edit it so that the council knows that it was passed unanimously thank you i have um finished the uh agenda for today's meeting is there anything else that anybody wants to say we have we have um commissioner communications at this point phillip i think you had your hand raised um i should have brought this up at the minutes but the last uh meeting we had a presentation from uh disabled um community members and there was this were we going to have a joint meeting with the disability commission was that on the table i talked to the chair i'm glad you asked that i did talk to the chair of the disability commission um he was very he felt like he had really talked to public health already and was happy with it it was like the next day that it was announced that people with disabilities would be included so he was comfortable with that but we agreed that we would work together then we would find ways to work together so yes that's on the table we don't have any particular thought but if you can think of something that would be helpful because i think that this is an opportunity for us there is an opportunity for us we just haven't used it no ever maybe once but it's been whatever it's been it's been a long long time and and uh he's he's a pretty impressive guy the chair of the disabilities commission i'd be happy to work with him so think about you know keep in mind anything else well if that's true somebody excuse me leslie council member nelson anthony sorry councilmember nelson i just have a quick update that i um that actually is for the benefit of travis as well because he's following along with us um the early leasing ordinance that were that i brought up at the last meeting oh yeah um yeah at the last council meeting we postponed it because we realized that's just substituting the number was going to be problematic because we didn't have a clear idea of how what enforcement was going to look like and um what's the what's really exciting now so we've had discussion now with um the director of beyond the diag at u of m and also um gail rosen from student legal services to sort of think through and talk through how how we can create a system that will work um but the the real big piece that that i'm encouraged by because we've gotten a lot of pushback from the number 240 that that was seem to be like a real trigger for landlords um the geo is meeting with central student government later this week i don't think it was last week i think it's this week um to talk about that number and see if there's if there's a different number that would be sort of less shocking to people because a lot of the pushback that i've gotten is literally like well that specific number is crazy like you know yeah and so i i i've been having these conversations of like okay like is there another specific number we could talk about and so um it's important to geo and i think this is like a legitimate point right that um these numbers be um negotiated and talked about by the people who are actually harmed by them and experiencing them directly um before we just start tweaking them willy-nilly and so that that conversation is happening and i'm i'm really optimistic about us having that um a clearer path forward because the um the 240 was causing a lot of anxiety i'm glad you brought it up because we did talk about it and i and i did see the city council meeting and they they brought up all kinds of things that no one would have guessed that none of our people are i have to say some of it i was a little suspicious of like students going to semesters abroad like that we're going to craft policy that's in the interests of that particular niche that was like wow okay um yes elizabeth did anyone did they offer any real numbers that you can share or ballpark i think i i actually could probably share um geo was telling me that they did not feel comfortable going lower than 210 and so they were that was the ballpark i think that they were aiming for um so mm-hmm and 70.

have any we do not okay thank you next moving to item d1 student update dr kellis thank you madam president members of the board and members of cabinet um this evening we're going to continue to enjoy the extraordinary work of our dysart student leadership team um with some student presentations i also want to just take a quick minute to mention that next week is the national student leadership week and so it's just timely that some of our most extraordinary student leaders are right here in front of the board and are representing really over 24 000 students throughout the district so these three individuals demonstrate awesome leadership and they're here to present go ahead hello oh no hello okay hello board members community doctor kel's cabinet my name is louise i'm aubrey and i'm peyton and we are all students at valley vista high school yesterday we had our student leadership council meeting to discuss how we can improve student school culture and the student experience here at dysert we brainstormed many ideas including how we should use our leadership to spark lollipop moments to invite other students to become a part of the culture at their school we also just want to take the time to thank everybody that was involved in helping with our covid relief drive we raised four we raised enough donations for 4 800 families and 20 000 people and that's all we have to report thank you any questions from the board i i guess we can't ask questions but just give them a high five for all the good work that they're known thank you and next we have the superintendent update dr kellis thank you madam president members of the board and members of cabinet there's a lot going on in the schools as we are wrapping up the school year it seems like it's a a phrase that we would never say but we are excited about what is yet to come in fact the best is still yet to come and of course it forever will be our students are taking arizona state tests right now our our high school students have taken the act which is the new state test so a lot of happening with with assessments and then also with each of the school activities as they are wrapping up the school year i just want to echo what mr dean said earlier about the celebration of being able to have these events in person and last year we had a generation of students who left dysert with met with missing some of those traditions and this year we're so excited to be able to continue and restore those they're going to look a little bit different but to be able to have those traditional experiences is a celebration that's all i have to report thank you very much dr kellis now we have the governing board update okay um let's see i attended the asb well this is we're gonna do it this way i attended the second half of the new member orientation put on by asba i volunteered at the second covid vaccination event and i did not do the hula hoops with the be kind group i visited surprise and sonoran heights and i've attended two cip presentations and i also attended the parent advisory council so when we only have one meeting it seems like my list got pretty long so this one i know this is a little bit behind uh but i wanted to at least still thank the staff and administration over at countryside elementary for allowing me to come and read to their students and especially thank miss fish and miss judd's kindergarten class for allowing me to spend my morning with them i just truly love read across america and i was just so happy to be a part of that also attended mr monsoon um at valley vista high school and i just it's just a wonderful event to have our students be able to um raise money for charity um show their talent and it was just it was a fun fun event and uh congratulations to matthew lundberg who won mr popularity and mr monsoon for 2000 or 2021 so that was a fun night um attended march 20th the valley vista girls basketball versus hamilton where as we just celebrated um valley vista as usual took state like again um it's just amazing to see that team under um the direction of coach matakis and i always say like it's just a matter of time before she's snatched up by some college i i don't know why somebody hasn't done that already but i'm thankful it's a blessing we still have her um but congratulations to just such a phenomenal coach and team um and then just last week i believe it was participated in the heat wave thanks to dr acai i was nominated so kindly to be a part of that um but what a what a fun time i was a little bit nervous especially when they had to bring out the waivers and have me sign my life away that i'm not holding anyone responsible if i needed to go to the er for some reason because of the ghost peppers i did survive it but i'll tell you the whole premise of it is so creative and fun to get district staff involved and get to know our valley vista staff and the whole thing is run by fccla our culinary team mr dawson miss left miss morse um dsb live channel 55 it was such of i was just so impressed by their professionalism how organized they all were how fun it was the students were amazing um and it was just wonderful and and then to get to nominate at the end and see who the next the next people are going to be in the hot seat so it was just very fun and i was very uh thankful to be a part of it um so thank you all to them as well and that's all i have thank you okay so yes just just like miss grant said there's uh since our last board meeting we were able to our list seems kind of long but lots of opportunities to visit schools and stuff since then march 23 helped kristen cox of kingswood help deliver the national board certified teachers balloons to the newest folks that are national board certified i love doing this each year it's just an awesome experience to give them their nbct balloon march 26 attended xanadu junior and um i heard miss densmore in the back of us and i heard her singing as well as me singing that was lots of songs that were back from our error era error but it was a great night of listening to the kids sing and act from over at sunset hill so thank you very much uh mr uh basgard and carrie blunier and the crew for a fabulous performance and when ever i noticed with me but whenever i um sit through any of the plays or the musical performances and everything i i check for three things to see if the students are having fun with their part or parts or singing and you can see it of course when they're trying to scope out and look for their parents out in the audience that's one feeling i look for the other one is the parents when they bring flowers or whether when they bring something to commemorate or praise their kids with for the performance that they've been on stage and then also look at the teachers and the staff that have helped all of the kids get to the point of performing on stage and those three things you can't bottle it it's such a feeling that you get and to see those three different groups having the time of their lives as they are performing on stage and so it's just an awesome experience um march 29th classified and then the certified staff advisory councils uh march 31st attended the sunset hills bobcats roaring celebration and it's where the students for each grade they're called down to the office they are awarded for their great behavior it's with the pbis state school-wide behavior system and so even though the kids had the masks on and everything you could still see when their names were called the smiles were even big underneath the mask so that was awesome attended the laughter is the best medicine the play over at dysart high school on april 9th they still have a couple of shows this week there are three act plays and if you don't have the chance yet go over and you will laugh your stomach off april 12th parent advisory council lots of folks there and i don't know if it was because of serving breakfast but we had a big turnout of parents and teachers parents and principals and everybody there so it was a lot of great information to pass on and parents were also engaged and i'm looking forward to the dysart hero celebration next week should be a fun evening and anytime i just want to share because board members do receive like for instance when we went to uh read with read across america america we do get little thank yous from students and um for whatever we attend and so sometimes when i happen to be feeling down or whatever there was a packet that we received many years ago and it comes anytime i need a big pick-me-up and we had a packet of thank yous that each of the board members received and it was for i can't even remember what it was actually for and anytime i need something to pick me up i'll just pull these out and read them am i making a difference in the district and any of us are we making a difference and i think that whenever we see this stuff and hold on to it yes we are and it's not just the board members it's staff it's community members that um it the saying it takes a village to raise a child it does and it's everybody in this room and in the community so i just want to make sure that everybody knows that we thank you for everything that you do so these are precious to me and that's it it's enough so my update is finally finished off the spring training volunteering for the valley vista marching band we raised quite a bit of money and had a lot of fun um it was a lot of work but so glad it's over um the uh also in the read across america um i i forgot to mention this last time but i have been doing some some reading over at the rise therapy center for disabled adults and it's been so made such an impression on me because many of these adults are graduates of dysart and when they hear the word dysart their eyes just light up and they want to know about our buses they want to know if we they can get a sticker you know and it's just so much fun um to be with them and just to hear their experiences with dysart and how much they miss coming to school um and these are people that have graduated you know five ten years ago so um we've made quite an impression on them and it just really warms my heart and i would invite anybody to if you have some time to make a visit there and they would love for you to read to them so also xanadu jr and yes we were singing along with all the songs it was it was a great time just so impressed of how they pulled it all together um not just i'm so used to seeing you know high school theater performances lately um and seeing a you know something from with such diverse ages up there and how they coordinated all of that and it was just perfect and you know and we i saw it on opening night so uh it was just flawless very very good execution so thank you for that um also attended the valley vista mister monsoon um presentation awards whatever i don't know pageant it was so much fun um it's the second time i've seen that and it's just it's just such a a great experience to see um such a creative um pageant uh process that that helps our community so and that was it what do you think okay all right and then next we're gonna move to item e one and i do have a few items that i would like to make a motion on with that hold on one second all right so i would like to make a motion to approve the consent agenda items as presented with exception of moving items and 16 into action discussion seconded by ms jeffen don't believe i'm connected but i'm a yes i'm gonna close and relaunch this motion passes give me just a moment i'm not getting to the login page sorry yes finally all right moving on to item g1 dr kellis thank you madam president members of the board and members of cabinet mr dean will introduce this item madam president members of the governing board dr kelsey members of cabinet this evening we bring to you for first read as part of the routine and yearly monitoring of policies the second half of section 10 which is 10.35 to 10.69 i'm happy to answer any questions my only my only question is um dr keller she said you're going to work on the uh the wording just to ensure that the person observing the incident is the one that makes the report rather than having it delegated to someone else at school madame president miss pritchard by state law it requires that those who are mandatory reporters and have the most immediate knowledge of whatever allegation of abuse is the one who files the report so yes that is actually a requirement and needs to be clarified and so that will be made thank you any other questions thank you all right moving to item g2 dr keller thank you madam president members of the board and members of cabinet earlier this year the governing board instituted a a process for revising current governing board policies and aligning those to the current governance model and editing the the policies so that they are not a policy governance model which was uh part of a previous board action to eliminate that the board has had access to the revisions for the last two or three weeks and so they are presented here for the board to have further discussion about this would be a first read on sections one through eight of the policy the other sections from nine on we have had ongoing revisions throughout the spring and so that's why those are not included here for example of item number g1 which is introduced this evening and we'll continue to bring those other policies on our regular schedule starting next year we will start over again with section one and throughout the year we will revisit each of these policies as an ongoing monitoring system so with that i would be happy to field any questions on sections one through eight miss densmore do you have a preference on how we go through these policies as far as any questions i don't have any okay um i mean what about the rest of the board do we go through like each section at a time or just each person goes through all of them at once as far as order no one cares then obviously whatever i would just say go through sections section starts all over the place i don't have anything for one i don't have any discussion for one okay moving to two i have i have some for two okay um under 2.0 there was a highlighted area delegate operational and managerial functions of the district to the superintendent but what was removed was then decide the part where it says decide on issues as far as the board deciding on issues not delegated to the superintendent i think that should remain rather than being removed because i think that kind of still applies so i would just ask that that highlighted section remain you're looking at 2.1 oh my goodness 2.0 and i gotta find it again um what page do you know second page you find it in here under hire the superintendent did you find me oh hi the superintendent yes thank you under hire the superintendent so it used to say um decide on issues not delegated to the superintendent but it was rewritten to say delegate operational and managerial functions of the district to the superintendent so i just i like the way it it was before as far as the verbiage of it um because it using the word deciding decide on issues not delegated gives the board some discretion and time to actually discuss rather than just jumping right to delegating it so i just liked that it seemed more process oriented and that's why i liked it and president if i could just interject a comment that the role of the superintendent is the day-to-day operations the managerial part of running the district and so that's somewhat uh assumed um anything that is not expressly delegated to be decided by the board could potentially create some some question um if they're i'm just saying because there's so much that is involved in the operations of the district that it's not expressly stated in policy i'm okay with the recommended change but there could potentially become a challenge where is this delegated or not delegated there's no document that outlines every single duty and responsibility dedicated to the superintendent other than the managerial and operational responsibilities of the district since the we had the other the other verbiage before the decide on issues not delegated superintendent and they've gone through legal do you know if we ever had any challenge or any issue with the previous language i'm not a president spiritual not that i'm aware like i said i'm okay with the change um it's just a statement of clarification okay does anybody else have an issue with that i i don't because i know that the the purpose of the superintendent is to act as the ceo of the district and that does include the day-to-day operations so um you're okay with what it said before decide on issues not delegated that was our previous policy that it says wait because before it said do not excuse me decide on issues not delegated to the superintendent right and the superintendent is the one that is in charge of the operation so i guess i'm a little bit confused as to that's what we that was what that was the um how we were operating previously that was not my those weren't my words those were actually in our policy before now right so i'm just saying so yeah under the board has the direct responsibility too and so then anything so it's deciding on issues not delegated to the superintendent so if there weren't issues that were delegated superintendent then the board would have to discuss and and decide on those issues so it's just pretty brilliant what's that or choose to delegate right right so that option is still there but that's how that's our current policy deciding on issues not delegated i i do see what you're saying but i guess you know one scenario that's coming to mind is say for instance there's a there's a new um you know statute that that school districts need to start abiding by so we don't have a policy in place for that so that it would automatically default i mean if we leave the language in place it would default that the governing board was responsible for implementing that change when if it's operations related it really should default to the superintendent maybe just a thought it needs to default to the superintendent um the superintendent is the one that's in charge of the day-to-day operations i guess i'm um i don't know how else to say it um i mean our duty as a board is to hire terminate evaluate the superintendent create pass the budget and create policy so we're making policy changes so i guess with the superintendent he's the one that's in charge of the district unless there is something that i mean am i missing something i didn't think i was but uh well again this is the policy that we've all been operating under under those words so it's exactly the way it's always been this would i this would address anything like i guess i'm also thinking of over like last march when um the governor came out with the executive order and the board then had to decide we delegated then a lot of those decisions to the superintendent at that time it was something new nobody the kobe wasn't around i mean it was a new thing something came up so that wasn't necessarily delegated i guess and so we then had the information we could have decided to handle some of it on our own we could have delegated it we met we decided to delegate it to the superintendent um so kind of how miss stonesboro was saying it still could end up being that way but i guess it would just be if anything came up then we would be the ones to decide on delegating those issues everything else that's currently in place as far as the operations are already delegated as superintendent so this is deciding on issues not delegated and so how often do we have issues that do not that are not delegated as far as operations i don't know but obviously it worked for us forever however long this policy has been in place this policy has been in place since 2010 right yeah but we review it every year right and as far as i know we haven't had any changes since then i don't excuse me i still don't see the purpose in changing it i i get what you're saying that it's been in policy all this time but i think the new language clarifies everything that it makes it very clear um that this off of the operation and manager functions are delegated to the superintendent um i don't know if you know this dr keller survive the top of your head or like mr hicks who's from another district same with mr croto what do we know what other districts actually put into their type of delegation authority as far as what is delegated to the superintendent for him to do do we do what give you a district um mesa okay mesa is fine i don't care i don't know glendale no madam president miss um sourcing bill i i have some asba language um i can't tell you what district it's from i don't know if you know what district is that's probably most likely from deer valley it talks about school board operational goals their coding is section b a there's several bullets comments it talks about the governing board is responsible to the people of the district and therefore should be aware of opinions and attitudes community as representatives of the people who own and support the schools the board accepts the responsibility to identify community attitudes and opinions and district needs and to require short long range strategies and are responsible for the budgetary limitations of the district then it goes through some belief systems and these are not in law these are belief systems that are bulleted but i can tell you that they come from an asba template that is 95 percent of the districts in arizona use the these same bullets last bullet the board has far greater responsibility than merely to conduct the housekeeping of the district daily school operation involves executive and administrative functions better delegated to district employees so it's not worth the the same as we the language that is being proposed i think i mentioned in a response to the board on this question that there's a lot of language in here that is a carryover from dr janderson policy governance and part of the policy governance was that that aspect of delegation and that the board is responsible for apologize for using the term ends and that the means are delegated to the superintendent that's a very broad term to say all of the means are delegated to the superintendent and the ends are the responsibility of the board trying not to carry forward the policy government's language that was in place the date that we have on here around 2010-ish but to try and align it more with current language of the sba was the intent of the recommended change would we be okay with keeping both statements so delegate operational and managerial function of the district to the superintendent and decide on issues not delegated to the superintendent that's a good compromise that's that's fine okay um because i i just want to make sure that i i don't want to get us to get into the point of um having dr kellis to wait on an okie dokie from us for anything um that has to do with the operations so i'm okay with it to put both i mean because we may decide something that no dr kellis you do need to run that past us in order for us to approve it i'm i'm totally fine with that um but the operations of administration [Music] i mean that's why we have a superintendent that's why he has superintendents under our assistant superintendents under him because there may be a time that we as a board cannot meet together or um yeah it's just not it's not our responsibility for the operations of the district but there could be sometimes that just like you said miss densmore as far as some things that are not delegated i just don't know what um well school closures is one yeah so that's a big one for me um madam president just as a very quick note on that that the statute does outline opportunities where the the superintendent can close if there's weather but there's about four bullets all of those decisions then subsequently have to be ratified by the governing brain yes okay yeah i'm fine with putting leaving both of them in there that's that's totally fine anything else in section two i have a few more 2.8 um i know we moved dr collis you said you moved that to 2.0 as far as the all the redlining um so what does that do though for 2.8 madam president miss pritchard um there were some i some bullets on 2.8 that were had a red line uh-huh each of those red line bullets were transferred to 2.0 i see what you're saying okay so all those are they're all captured in policy just in a different section okay and then um 2.21 pull it up 2.21 board communication with the public i would just ask that perhaps we consider adding the verbiage suggested when we talk about see having the public they have to exhaust their opportunity with administration first any opportunities to resolve issues with administration first before they are allowed to contact the board and i just feel like i don't want to put anything on the community or stakeholders that would make them feel like they can't just come to the board if they have a concern we might suggest that they do but i don't i'd prefer that we don't say that that is like a you know a stipulation to coming to the board is that they have to go through administration first we can't really tell the community we can't make them you know we can't bind them to our policies and i wouldn't want to i would want them to feel comfortable coming to the board with anything any concerns that they have and then obviously the board would in our role know that i mean i personally respond to stakeholders but i also would forward the concern to the superintendent so any official former formal follow-up would happen at the district level but i wouldn't want anyone to come to me and i would i would never tell somebody i can't unless you've gone and exhausted all your opportunities with administration you can't come to me yet and i just wouldn't want to give that perception to the community before you answer that and i'm going to answer miss miss pritchard um i do the same thing as far as whenever someone does send me something i said okay well we have this guideline for solving problems whether it's curriculum whether it's what have you have you by chance exhausted those issues and i i do ask them that first and they said well no we haven't even we've just gone straight to the top i said okay because some of those issues can go ahead and be handled by the principal or if it's curriculum then dr polling i i would never tell anybody to say nope sorry you've got to start at the bottom i i'm like you i will respond to a comment and ask them by chance have you looked at the guide to solving problems because each area has the steps to take and if they haven't then then that's when i alert whomever um so yes i do respond to those just like that and tell them about that uh that guide now you can respond i'm sorry go ahead madam president ms pritchard the intent of this may be um unclear there are plenty of policies that strongly encourage and support board member communications with the community and with with people throughout the district and the throughout the community including those who have concerns and i would i've said this before absolutely you should be because as the board members that's your responsibility as we just cited in the previous is that you are the pulse of the community with regard to the district the reason i think that there may be some misunderstanding about this bullet is we don't have in policy all of the procedures for formal complaints we have procedures for formal complaints that would relate to this so the recommended change that i communicated to the board earlier this week that could satisfy that is that any community member who exhausts the opportunity of discussing a matter at the administrative level may appeal the matter to the governing board keeping it in the formal complaint process mode and not just day-to-day communications or i would absolutely expect that the board would continue and openly have those communications with anybody who wants to share concern this would not eliminate that by saying you've gone through the process of addressing your matter at each level and you're still not satisfied ultimately you can appeal your matter to the board yeah i think it still just sounds more um more like the preferred procedure and especially then if you change it to appeal it sounds more formal where i'm just thinking of a typical just person who maybe isn't you know into all the policies and procedures of the district that just wants to be able to reach out if they were to see this to me it would seem prohibitive it'd make it seem like okay i have to exhaust all my opportunities in one area first with administration to then make an appeal to the board in writing you see what i mean i just i wish there was a way that we can not make it sound so prohibitive by saying you must exhaust the other opportunities first ms pritchard it is a very formal process um trying to separate out the two situations of casual conversation versus formal complaints what i'm suggesting is that this addresses the formal complaints versus the casual conversation which absolutely the board must engage in on a regular basis so and and you're right with regards to appeal so should we have something in there that says exactly what you just said with regards to communication that we do receive um that has nothing to do with the formal formal keep because that's that's the procedure but as far as day-to-day communication um something that somebody has put a little tidbit in your ear that you need to respond to and then dr kellis are we really doing this and then that's that connection and i don't know if maybe putting that guidelines um guidelines for solving problems do we have that any place in policy well the thing is is like this um like i agree if it if we're in a formal process then yes it needs to be more formal and you use the word like appeal and things like this but the the title of this policy is just board communications with public so it doesn't imply that it is the formal go through the chain of command until you finally get to the board type procedure this is just board communication with public so that's why i'm thinking i don't want it to seem like it's going to stymie anyone from communicating with the board except the first sentence says the board welcomes your opinion and input from the public on all matters then it says structure noted for official specific business so the first line basically says that they we want the public or employees on general information or whatever so that takes care of what missouri simple is talking about and but structure for an official specific business is the guidelines follow um just perhaps i don't know if we can put this on the screen that's why it sounds contradictory because on here it says it welcomes it and then down here and says you must exhaust all the opportunity and then appeal to the board so maybe it should have a heading or something that's separate that says for formal um yeah just split it and have formal something down at the bottom and i think the there's also in there on that first blow any community member who exhausts the opportunity of discussing an official matter at the administrative level may appeal the matter to the board in writing there's the word official versus i think again encouraging but yeah taking that what that is um and it's almost like creating its own and then have that particular bullet point underneath it i mean um there in our policy policies excuse me someplace else it does um what am i looking for the actual formal process not just in board communications this list is someplace else okay so i don't know if we need to reference that over like for formal grievances or something like that would indicate there's a process where just contacting the board have communicating with the board in public we want to make sure that nobody feels like that's restricted like anyone can do that at any time but then make the note of for formal grievance procedures moving it over yeah you see we just want to make sure we're all on the same page as we're looking at their vision 2.21 the introductory paragraph the board welcomes the opinion and other input from employees and the public in general in all matters structures noted below for official specific business shama prevent shall not prevent communication between the board and all stakeholders but all such communications must be made in compliance referring to official business with arizona open meeting law to the extent applicable i mean it's it's wonderful and that we communicate with our with the community because there are some boards that it stops right there and it doesn't even come to them or it goes to another and that's just different boards across the state but just based on the suggestion that you made to add more language to this to clarify i it needs to be clear and miss pritchard mr sink bell you both gave some suggestions for some language could you repeat what you were suggesting i think tracy was saying about making kind of splitting it into like a separate bullet did you see a separate heading so to speak and then for for the formal process that's where the appeal would come in and also referencing policy whatever that policy is for um formal complaints formal complaints formal we'll rework this and bring it back for the second reading i think you also mentioned having the problem-solving guide maybe somewhere in there um yes possible mad president the district does have a problem solving guide that's on our website but just not in the board docs though that's um we can add that as a as a document okay as part of our procedures maybe two to have the difference between the two when you do tracy's separate bullet on that first sentence after matters it could be comma without restriction so then they know for sure like there's no restriction on any like but then it'll say but when you get down to the bottom where it's going to be the grievance procedure or policy then that's that's what's going to differentiate you're going to make it so vastly different no restriction up top but then you're going to come up with the exhausting the administrative level and the appeal at the bottom we will work on that okay i was going to say i could give you an idea and then i'll type it up and send it to you i guess yeah before we move on i don't have a question or addition to this or anything but i just have a a comment so the last piece of that introduction where it says all such communications must be made in compliance with the open meeting law i have seen some things recently not with our board but with a with a neighboring district um where community members are screen shotting uh responses from governing board members and they're posting them and there's more than two so there's so that in a sense could be a potential open meeting law violation uh it so i just we all have to be really conscious of that and careful about how we respond we can empathize but to provide an actual opinion we want to be really careful with that so just a comment that's a very valid comment too so i appreciate that you put that in there thank you just just for clarification on that though if someone else if as far as the law is concerned though if you respond to a stakeholder with your opinion or your thought regarding whatever and i i do that sparingly you know i did it a lot with covid you know people you know as far as making sure they felt validated and the points they were making but as far as um giving a strong a personal opinion i try to still maintain my board role where it could i could i could have a definite opinion but if it's in violation of for policy says otherwise it doesn't really matter what my opinion is so i forward it to the superintendent but that is a private conversation between me and the stakeholder to where as far as open meeting law goes if someone else takes it upon themselves to screenshot something and share it i'm not violate like the board member's not violent again because that's the other private person right dr carlos as far as our protection of someone doing that president miss pritchard you're correct that um you can communicate with an individual if they share that with others that may extend to other board members you are not talking about board business with another with another board member that is something that is circumvented but i think uh to uh madam president denmar's point you just have to be very conscious about it and be careful because that could come back if then one of the other board members responds to that post and then you have a conversation going so while a board member may be able to say something that's posted on social media it gets to others but there's not that two-way communication but once you start responding to those comments and it becomes a forum for communication between board members albeit through social media then i think you're in very very nice plus there are some folks that may send something to the board send it to a board member and then they get a response from one particular board member then they send it to another board member and it's almost like some may be on a fishing expedition and they're trying to get to the answer that they want oh i like your answer better than the other two or three so um it it can be very complicated but yeah you're you're totally right but i guess even if it's not a true open meeting love violation you know that you're going to be responsible for i guess i just i have concerns because it's going to change potentially if we had an upcoming uh item on an agenda that we're going to be making a decision on and voting on it potentially changes the integrity of that boat so that's where my concern is with it and i just don't want that to be challenged so all right yep agreed i just have a question on the word adding the word official as a community member i'm not sure it says a community member who exhausts the opportunity of discussion discussing or adding the word an official matter i think any community member who submits or writes whatever communicates with the board in their mind this is an official matter and now we're into what is official and not official and it's the same on 200 an employee who just exhausts the opportunity of discussing a matter and we're adding an official matter i think everybody's definition of official is different madam president miss grant the reason if the word official was put in there is because based on comments and feedback from board members about the the topic that you've hinted on this evening of not being able to speak openly with stakeholders this was intended to provide some differentiation i completely understand that any time a stakeholder communicates with a board member they may have that perception that that communication is official and that you're going to do something about it but that was the intent of putting the word official in there is just so that there wasn't confusion about what the board couldn't couldn't say to whom and when when i think it's different for employees because for employees there's actual policy that the apol the policy would apply to employees as far as that chain of command and the expectation that they work through right their supervisor and things where that doesn't apply to community members right that's why i don't understand why the word official in there for the public one well that one to me when i read it that way it was because official is um like a a documented concern that's going to require action i guess but again everybody's definition of official i think when somebody writes they they think that this is official i'm concerned about so what would you suggest changing the word to nothing the opportunity to discussing a matter just take out the word official that's all i just think that if you're a parent and you're writing to them this is important and if we i don't know that's just my yeah official wasn't my thing my thing was exhaust the opportunity so i don't care what we do with the word official that's i'm up for i'm okay with that changing matters i just i just want to say i i find it interesting that how this introduction summary changed the whole tone of this because i really initially thought of 2.21 as being restrictive on the board not on the community but now it seems like it's just kind of changed the whole tone of it but i don't know i mean can you tell can you share more about what the intent is is it really to restrict any any communication or or to guide the public or is it to guide the board madam president the intent here is to do both um based on previous feedback from the board about frustration over policy that was perceived to limit the board's communication this recommended language expressly states that shall not prevent communication between the board and stakeholders to put language in there that gives the board permission to speak to stakeholders but at the same time a board member cannot fix a stakeholder's problems cannot resolve concerns that needs to go through a formal process so communicating with somebody does not imply that you're going to fix their problems but what this is suggesting is that if somebody has a concern that they need to go through the administrative levels and exhaust those levels and then if they're still not satisfied with how their concern has been formally addressed then they can appeal that to the governing board there is sba language that probably takes up pages to explain what we're trying to explain in a paragraph and maybe for something like this policy that would be what we need i don't because if this is going to really speak to our community they may need more of that background and clarity than we would for like the employee section because they are aware they know and they work our policies all the time mad presidents pritchard to your point that you made earlier um this isn't a prevalent problem i don't know that we're there's something we're trying to fix here other than just the board's feedback that you want to be able to talk to your your constituents absent your comments on that point it would have remained the same as it was before okay i will still put the word i'll give the wording to louise yes we will we'll wordsmith this some more and bring it back with some recommended language um that splits it up so it's perhaps a little clearer it's two separate topics i just have are you done i just have one more comment on 2.21 no anonymous communication will be considered by the board for formal action i just think it should be no anonymous communication will be considered by the board period i don't know why we need to add um oh well i had a piece of feedback on that one that was that was because i don't want it to seem i just thought the other sounded somewhat cold that if somebody doesn't feel comfortable coming forward and reporting something and something that might be very significant i don't want them to think it's like if you're not going to put your name on it we're not going to do anything about it we don't care they can't i want to know like if somebody had a piece of information that was detrimental to students or our buildings or our programs or something i would want to know about that um but as far they would have to know that as far as official action or formal action we're going to need to be able to contact you do an investigation we meaning the district um doing investigation so if they want a formal action and something actually done then they're going they can't be anonymous because we're going to have to have some discussion so to me that was why i think it was important to differentiate that because i would never want someone to think that if i know this is happening but i'm not going to do anything with it because the board says they won't they won't have anything to do with anonymous complaints or information well i think that's wrong well i have to disagree um on that i just think that if if there is something really going on that they're concerned about they should be able to put their name on it now they could write to you and say i'm very nervous about putting my name on here because i'm concerned about my student or my child or whatever and go from there but anonymous people can just write whatever and then what are you going to do with it i mean you're going to read it and go oh and you're forwarded they you have no way of responding that i just i just think that that creates a whole another it's just like social media you people can just write whatever and so i just think put your name on it if you truly believe it or you can express hey i'm very concerned uh please don't share my name or whatever and i i agree with you i think that if i think you should stand by your words but not everybody feels that way and like that what i'm saying is if there is something of significance that someone and we used to have people come to the board all the time or email they're concerned about retaliation whether that's true or not i don't know but that's a real fear for that person and if they had a piece of information that the district should know about and if it meant not knowing it at all and having something again detrimental happening to students or staff or programs because we won't even hear it i would much rather say go ahead and give me the information but you have to know there's only so far we can go with it without your name and usually for me that is again validating their concerns thanking them for bringing it forward and then i forward it to the superintendent and they can he or she can decide you know they're either gonna maybe make contact with the school and say hey is this going on and yes or no and then if they know they can only go so far with it if they don't have names but i don't want anybody to feel disregarded i'd rather know the information than not than have them not bring it at all because they're going to be forced to give their name we just may not be able to do much with it i think that's the key right there you wouldn't be able to do much with it i'm okay with having the form for formal action um you know because different times we will get anonymous letters in the mail with information on it and of course there's no name down at the bottom of it but for formal action uh yeah we need to have i it say this i mean it doesn't sound like this is just with the public though we're talking about um communication with all stakeholders including potentially an employee who's exhausted you know um everything else i think in the in the case of a potential whistleblower situation i do think that we need to be able to accept anonymous communications from people um and whether that's for formal action or not but i i think that many businesses have those processes in place it doesn't mean that it's going to get that formal action but it's going to get a look and go okay you know i mean and you do what that what you need to do whether it's valid or not you i think that that i think that there's value in that i i'm okay with it as presented with the formal action yes okay anything else in 2.21 i'll send section two um i don't think i did i think that was nope i think that was it for me um 2.28 we were totally wiping everything out was this the this was with the informational liaison between itself and the various school board associations madame president sink bell that was moved to 2.27 oh thank you okay then i went too far thank you and that was it okay um i didn't notice this before so 2.27 um the district shall not spend money for memberships in an association that attempts to influence the outcome of an election um we don't i know that the asba has their own um i don't know what you call it i guess uh it's called friends it's a political action committee or friends of aspa so is that how they differentiated them the friends of asba is their political arm we and we don't pay for that you do not and if you wish to belong to the friends of asba that does um political influence or what um then that board member would need to um be a part of uh friends of asba and not have any association dues paid by the district you have to if you want to be a part of it you'd have to pay for it on your own i will say that on our first training that we did for the desert or for the school board with asba i heard a lot about bad bills from the leadership so i feel like the asba during that formal training was talking about bad bills going through the state house and senate um i feel like that needs to be drawn attention to because they were definitely trying to influence an election and an outcome with that madam president miss uh chaffin so the distinction um the district shall not spend monies for membership in an association that attempts to influence the outcome of an election as determined by state fair law elections don't include legislative elections are ballot ballot initiatives people in positions the november election november election thank you anything that's on the ballot um legislative actions i will say that across the state there is lots and lots of engagement from both district employees board members associations we call them the alphabets that all weigh in on legislative proposals okay ladies have anything else for section two okay moving to section three board uh superintendent relationship i have one on 3.2 um where it says the board views superintendent performance as identical to district performance so that the district accomplishment of board prescribed district goals will be viewed as successful superintendent performance i just like it rewarded so the district goals aren't identified as the only determinant that can be considered when discussing successful performance for example there might be things outside of the strategic plan goals that could occur and be part of concern when determining successful performance and the board shouldn't be limited in discussing those concerns and incorporating them into the superintendent's success so i know that the board's going to evaluate according to the superintendent's adherence of policies um but that's to me different than what this request is as far as rewarding it i just feel like it shouldn't necessarily just be limited to district goals and and that in and of itself it just seems very restricted it should be more of an open um discussion and address all areas of challenges or successes not just the ones limited that year to the district goals which paragraph are you on i'm sorry um i retyped it so let me find it in the actual um the last bullet so you're saying to leave the will in there no um so it just the way that's written saying that the superintendent's performance is going is identical to district performance so the district accomplishment of board prescribed district goals will be viewed as successful superintendent performance okay and i'm just saying that that's that it shouldn't be a superintendent's performance or evaluation discussion shouldn't be limited to whatever the district even though we're going to obviously be using just the policies um obviously how how well this superintendent um followed or implemented the prescribed policies and i know we have a strategic plan but let's just say there's a performance issue that isn't necessarily a strategic plan goal that particular evaluation cycle and we should be able to talk about other aspects of performance not just that particular strategic planning goal that year so i just feel like it needs to be rewarded to so it incorporates other areas that would lend to successful performance not just the strategic plan so if we you know like everyone met the 301 goals and so that meant therefore that's viewed as the superintendent's successful performance like in general there could be other things outside of whatever the strategic plan goal areas are that particular year but you're talking about adding other factors or it could be other things that would make his performance his or her performance successful or not successful and that'll kind of this discussion can kind of go into when we get to 3.4 might make more sense but um but yeah so well let me just let me just just briefly jump into that for a second because it might pull it all together so 3 4 talks about using the annual performance evaluation and the board and this the board the superintendent will mutually establish goals and objectives for the superintendent for the ensuing year and i was saying how i would like us to go back to how we used to do things to where the board during usually during a workshop would would meet with a superintendent it would be a public workshop where we would do superintendent goal setting and we'd talk about as a group okay these are the areas we'd like you to focus on um and again they're they're usually they're in align with our policies obviously but there might be very specific things that particular year that we want to work into a goal so that would be an example of how in 3-2 you know let's this is kind of dependent on three four so it shouldn't just be limited to strategic plan goals necessarily here because what if we ask during that goal setting that we want him to focus on other areas well all of that should be in general globally and we should look at all performance not just how the superintendent address certain strategic plan goals and say okay so those goals were met in the strategic plan therefore you successfully you have successful superintendent performance so what else would you want to add to it like well when i submitted it i just said you know this needs to be i'd like it to be reworded um i think the feedback i got was it should be discussed during the meeting so i don't have the actual verbiage that i would necess because i knew it would you know we were going to talk about it some more but um so i don't know that would have to be something i suppose that we would if that's what the board is interested in doing then we would have to draft it or bring it back the next time it was mainly my point it's mainly just the principle of it is what i was madam president if i may yes madam president members of the board this is a little bit of a complicated um item because it has ties to other well superintendent's contract specifically and in the superintendent's contract it states that the superintendent will be evaluated based on the criteria that was adopted at the time the contract was instituted so while the board could make that change it would not apply until a contract renewal in the contract was revised or that that then applied to the then language at the time of the renewal on a philosophical point the the difficulty of having it open we actually had this conversation a couple years ago here in this board meeting when we were talking about the superintendent's evaluation and what that might entail and i stated very openly that my goals will be the board's goals and there is some celebration of that that's a good thing because then that meant that there was understanding of where the superintendent's attention would be and that it was aligned with the board's goals i absolutely welcome feedback from the board we have to be careful that feedback isn't construed as becoming policy that feedback through an evaluation can't be a substitute for implementing new policy so as an example if um if the superintendent was directed through the evaluation to do something administratively that would be construed as a policy because it's the vote of the the board but it wasn't handled during an open meeting vote of the board to change policy so just some some clarification there that if there's feedback given to the board that absolutely is a point of excellent feedback and conversation but the expectation that then become what happens going forward in the district is very narrowly defined differently than than a policy and the board can only direct through policy through a vote of the board not through an evaluation thank you i think we might be talking about two separate things um but to that point though when the board gives direction in a board meeting as a whole and then votes on it that are you saying that all of those directives are considered a new policy because that's not how i understood it it would just be like directing the superintendent because the superintendent works at the will of the board so if the board um as a whole votes to have the superintendent take some action or follow through with whatever um that wouldn't necessarily be a policy change though oh man president pictured once the board votes and makes a decision at the policy per our attorney publicly votes right okay right i'm getting stuck on the word policies digest that a little bit more yeah i understand what you're talking about but as far as for him that would be um that would have to be some yeah but again um i submit to the will of the board i will continue to manage the operations and daily functions management of the district i welcome feedback but the board would necessarily have to determine is this something that is going to be a new administrative function and vote on it as a board to to enact that policy to happen well aside from that piece of it as far as board direction coming from out of a board vote during a public meeting being policy or how it's being worded that aside in regard to 3.2 again just and 3.4 and i haven't looked at your contract in a while to remember the to to understand the words that you're talking about or the verbiage you're talking about as far as changing the contract i'm not saying like once you um once you get those the goals that then mid way through the board should change them i know that's against the contract and no one would no one should ever suggest doing that to you um but i remember how was it that we used to do it before though where we would all come together at every year almost like any other employee evaluation where you talk about your goals for the year and you come to an understanding and and we used to come to the board meeting we'd we'd vote to adopt them um how is that not how are you saying that that's now against policy contract madam president richard so the um the language that existed in policy about the evaluation of the superintendent and to the point of section 3.2 they're somewhat blended 3.4 and 3.2 you're talking about the accountability of the superintendent of the evaluation of the superintendent and as far as my evaluation it shall be based on the language that was in place when the contract was initiated so you can make these changes here and say we want to open it up and go beyond what was um what was in place at the time but that wouldn't apply until the contract is renewed so at the time the contract renewed it stated that it would be aligned with the board's goals that was the the criteria so to expand that that would be something that would take effect when the contracts renewed well what about because it still makes sense though as far as they should be in line with the board schools and the district goals like i completely agree with that but i'm just saying every year it seems like because obviously in a three year superintendent contract things change in three years your focus for that particular year may not be the same focus you're going to have on your third year but it's the same contract so what i'm saying is if that language is just broad to where okay they need to align which again i agree they should but the specifics of that particular school year or the focus might be different i would welcome that as feedback so feedback meaning though that we we could come together because to me it's just for communication it's all about just making sure everyone's on the same page we're clear on what the direction is for the year what we want to look at um it's just healthy communication right and if the board changed the goals then my goals would change with the boards it's keeping that that synchronization together so that we're all going in the same direction we're on the same road going in the same direction which is very clear to everybody where the district is headed the superintendent and the board are going in the same direction these are the district goals either superintendent goals when we start adding or bifurcating these these two systems it gets confusing so then maybe a way around that are you suggesting that if we go back to come together every summer come up with our our goals or our focus then rather than just adopting or approving superintendent goals maybe that motion at the time would be adopting board and superintendent goals that would work because because my whole thing is just making sure i just looked i just liked all of us coming together and talking about okay based on the previous year this is the direction we all want to go in so whether we say okay we're kind of adopting new board goals that year along with the superintendent goal setting then that would work that would work i'll just give you a little um sneak peek a little teaser that at our next study session this is may 5th i believe we will be administration will be presenting to the board the areas of focus that we are going to be targeting for the next year about how we're going to be achieving the board's goals so we've been talking about finance we'll be talking about academics we'll be talking about eight different areas that we are going to be focusing on to achieve the board's goals which are the superintendent's goals but that are priority items so that doesn't mean that we have to change the board's goals to identify what those areas of focus are going to be and that doesn't mean that we're deviating from this policy that the superintendent is no longer aligned with the board's goals those are just how we're going to achieve the board's goals and the superintendent's goals that conversation is yes we've had that frequently i agree that in the past it's been a superintendent goal setting session right um but right now it's great that the superintendent's goals and the board's goals are the same how we're going to achieve those would be a wonderful conversation so can we can we build that into the policy it's just a matter of um uh when we do it i mean it sounds like you're doing it but you're doing it may where we used to do it in august after your or you'll have the formal one like whenever we used to have it what was it june or july no one i want to say it was july so why don't we can we put a pin in this for right now and just wait to see how what the focus and discussion will be at the may 5th as long as dr kalas is fine not moving forward changing this policy until then because if we add a date in here is what i'm saying is have it be part of the policy to where we will say bye we did for the board evaluation october i think it's when we used to do it so if we say by july of whatever or the calendar of the school year or whatever um well we can change our policies at any time so that's why i'm saying if we could just put a pin in this and just hold it for right now um uh we've already taken the shell and the shell knot and all that other stuff or fail you know what i'm talking about fail to and that verbiage um that we just hold it leave it as it is right now and see what the direction or the focus is going to be at the beginning of may when we come back for that work study session because we can go back and put in what we want and adopt it at the date that we make the change that's that's not the issue i guess because you may get your questions answered or aligned once we hear what administration is going to provide us and then we can work it in i think i have my answer now based on what dr kala said it sounds like it's the same type thing it's just sounds like they haven't scheduled for may instead of we used to do it in the summer after his evaluation because then it's like okay now we're starting for the next the next year so the only thing would be is just putting in like by june like before i think we had or by july where did you put where did you have that well i didn't because i asked for it to be rewarded yeah so three two and three four so if we want to wait and bring three back or if you want to just add in july it sounds like we're talking about the same thing i think we're talking about the same thing as long as we're not saying that the superintendent is going to be evaluated on the areas of focus yes ultimately it's the goals and as the superintendent making satisfactory progress towards achieving the goals is going to be the final question on the superintendent's evaluation and looking at our plan as a district and ultimate results if those results are not satisfactory to the board then it should be reflected that the goals are not being satisfactorily met yeah so if you're saying then we just bring them back and when in may or if we do it in july you're saying that we have to then say we're not just approving the superintendent goals we're approving the board's goals so they're both aligned and they're the same thing then we can do that and that says that that now that the superintendent's goals and the board's goals are the same so if any time in the next i'd like to say number of years in the next so many years that the superintendent's goals are the same as the board's goals if during those ensuing years that the board and we should revisit our goals on a regular basis to determine are they still relevant and that's why we decided we're not going to have a three year strategic plan we're going to have a working document and if those goals need to be tweaked or modified then automatically the superintendent's goals align with them immediately with whatever the new board goals are i just want the process back i want to be able to have that open conversation and we all come back then and we vote on accepting the superintendent goals and then if you want to add board goals at the same time that's fine but i like that open dialogue and process for clarity and every year and i just wanted to say something real quick for those that are tuning in um i have tuned in this is the only time we can actually discuss this when the five of us are in a public setting so um thank you for listening um but this is the only time the five of us can actually do this and we need to break it down and and go through things and so we do appreciate listening to us so thank you um so if we can add that if you want if we can add july like by july that we will have a superintendent board maybe superintendent and board gold setting rather where it used to just be superintendent goal setting and that'll be at the end after your evaluation starting the new year and we can then come back and then vote to approve them both aligned we will look at the language and bring back some proposal thank you somebody else has to do more of the talking otherwise i'm going to go into 3-3 that one was the one where um superintendent acts on own discretion if action is necessary in any matter not covered by board policy report such action to the board as soon as practic practicable practicable and recommends policy guidance in the future and i'm just saying that if there if there isn't something that is not if there's something not covered by board policy um again i'm just big on communication and openness so i'm just saying i mean if there's an emergency or something that has to be decided right away then that's why we hire somebody that you know is has the expertise to be able to make those on the spot decisions for the for the good of the district so obviously if it's an emergency that's different but if there's something that comes up that's not covered by board policy i'm just saying i'd prefer there'd be communication with the board um prior to just acting in their own discretion so um so i guess i would need to know what specifically you're talking about because again this the the board excuse me the board the superintendent is in charge of operations so where were you looking at for that i'm sorry was that the one two three fourth paragraph because i just copied and pasted it so i need to find it in the actual [Music] i think it's under oh thunder governing board under this the last bullet under governing board governing board yeah oh okay i'm sorry excellent and discretionary as soon as practicable okay so it's just to reflect communication if it's not already something delegated or something that you know is part of the management and operation of the district in general that's going to be in policy then it's just communicate unless it's an emergency then just communicate with the board i'm just big on communication with the board that's my biggest underlying theme is but i don't want anything to happen where again it's operational and he would he she superintendent would be the one to go ahead and complete the operation and not have to wait upon a board action unless we would need to ratify it at a the next board meeting madam president if i could just interject that there's some ambiguity in the language here because it suggests that it doesn't make the distinction between management and operational decision making and other things so there should be and i will be so bold as to say there should be cart blank authority given to the superintendent to manage and operate the the day-to-day functions of the of the district it would be literally impossible to operate and manage the district if decisions that are not included in policy had to be first reviewed with the board we make a thousand of those a day and the the difficulty in this policy is it doesn't say what decisions it's referring to i think the intent here is that those decisions are probably the the bigger item decisions but there's no definition of what's a bigger item or a bigger decision than just the day-to-day operations i think you're right i think that's what it is is that it's it's those unusual or there's bigger type things that are unexpected type things that you that you don't because again it's just so broad so yeah i guess i'm assuming that pretty much every operational type thing is in policy somewhere you know i'm just talking about if it's some some just unknown odd type issue that popped up you'd you would think you'd want to communicate it anyway you know with the board if it's unusual out of the ordinary i'm not talking about no-brainer every day-to-day issue i think you would be shocked how much is not in policy really there's nothing in policy that says that we need to get water to the students on the field during a an evacuation that's good judgment and some of those decisions are good judgment decisions that we make on a day-to-day basis on the spur of the moment and it's not policy to say that we do that okay so that would fall under something that you would if we change this then you would have to call the board and say can i give water to these kids out of the see when i read it i'm thinking that everything's pretty much in policy or inferred these are going to be some outlandish off the wall type something comes up that no one's dealt with before well then let's no one's dealt with it before let's all talk about it and figure out what we want to do unless it's an emergency but if you're saying things like that i mean i guess i would figure that would be under some student wellness policy that we have you know something like that but you know okay nevermind now if he took the credit card and went down and buy bought a circle k you know then that's outlandish way out and look appreciated and he would have to get permission from that one over there um yeah see he's shaking his head so and that's way out in left field so yeah okay any other topics for section three madam president if i could um appeal for a slight change in an agenda or in a a suspension of the agenda for a brief moment to extend the opportunity for the board to approve another agenda item because we have somebody who's waiting in the wings for a decision to be made yes if it's the board if the president could recommend that we um move to action item h1 and then we can return to this item motion we're just going to move item h1 item h1 dr kellis mr and and possibly h3 if we find it and i'm present members of the board um i would thank you for accommodating this request and i'm going to ask mr croto to present item h1 thank you dr callus madam president members of the board superintendent callous cabinet and guests administration is proud to recommend amber luna for the position of assistant principal at sonoran heights middle school for the 21-22 school year amber luna received a master's degree in educational leadership i believe that was from asu she's a sun devil she has six years of experience as an elementary teacher and one year as teaching and learning specialist with the dysart unified school district so we are proud to recommend her amber has joined us tonight so after your vote we will we will officially welcome amber are you ready amber yeah okay all right i will make a motion to on the recommendation to approve the appointment of the middle school assistant principal madam president could you uh restate it restate yes i will make a motion to approve the appointment of amber luna as middle school assistant principal seconded by ms grant okay motion passes [Applause] congratulations are we moving to item h3 if it uh appeals to the board if you would wait i need more calls madam president members of the board i'm going to ask uh mr ken hicks to introduce item h3 okay good evening madam president members of the board superintendent dr kellis colleagues and community members it's my pleasure to introduce miss jennifer shields partner with h heinfeld ameech um our county firm and ms maridel spidel our director of finance and also let me just also say thank you very much for moving this up a little bit but we have guests i appreciate that i would like to say that they work i also appreciate all the hard work that our staff has done in accordance with this audit i specifically like to say thank you to miss pedel and miss francie wolf balman our accounting coordinator back there they work so tirelessly and they are so skilled and know so much i'm very proud to work with them and appreciate all that they do if i could also say right before they begin um there was a bill passed in this legislative session that does require i think it goes at the end of the legislative session so it hasn't doesn't go into effect yet but it does require school districts to present their audit to the governing board and the governing board must accept the presentation by roll call vote and must send the audits to the arizona department of education um as you know we've been doing this for over a decade that we do present our audit to the governing board so it is something we're have no problem with and we continue to do so i will now introduce miss merida spadell and miss cherry and jennifer shields thank you thank you mr hicks madam president dr kellis members of cabinet everybody watching thanks for allowing me the opportunity and i appreciate the uh reorganization of the agenda i do appreciate that and i do recognize the fact that this is in fact the only time the board gets to discuss important items including policies so i also appreciate that as well so i will try to keep this brief just kind of in terms of audit summary the external auditors as you know were hired by the district through a competitive proposal process so the fiscal year 2020 financial statements was the fifth year of a five-year contract so this audit that you have before you tonight represents the end of that contract period um during this last year obviously there were a number of um changes and challenges and in fact this past year our audit team had very limited on-site field work i i believe last year we were working toward implementing new procedures to be able to do a lot of the work remotely so that was somewhat fortuitous if you will um but it actually was a little bit more required this last year during the the fact of the shutdown school closures limited staff on site so i just like to take a minute i know that mr hicks already mentioned the the number of staff hours that are put into the audit and in particular ms with bauman and miss spidel they both put a lot of hard work into getting a lot of the information remotely and having good policies and procedures in place governing the data that the district retains on computerized servers and whatnot made the process incredibly positive for both i think your staff as well as our staff so it was a very successful endeavor that being said we are looking forward to hopefully getting back out on site um in the future so um my my huge thanks to um staff so there are four different reports that are issued and you should have copies of all of them the first is the communication to governance there's a comprehensive annual financial report a single audit reporting package and then the uniform system of financial records compliance questionnaire and so i'll run through those briefly the communication to governance is required by professional standards for us to communicate certain information between the external auditors and the governing board and so up on the slides you can see there's quite a few just bulleted items i'll point out a couple of them and in particular i always like to point out that we had no difficulties that we encountered that we would need to communicate to the board and there were no disagreements with management about accounting policies or procedures or anything like that so those are very good and then of course our firm heimfield meech complied with all of the independence requirements that allow us to be your independent auditors the comprehensive annual financial report is the the district's financial statements so it's a very long report i have a copy of it in front of me it's i don't know 148 pages so you can you can read that at your leisure but also if you wanted to look at very specific information i've highlighted some different page numbers that you might draw your attention to the first and foremost is the fact that the district received an unmodified opinion that's what we like to refer to as a clean opinion and that's the best that you can do in terms of financial statement reporting and then there's some other information i've given you some page ranges management's discussion and analysis is particularly useful because it kind of tells sort of in story format and words what happened and what transpired over the last couple of years how is the financial performance of the district compared to the past um and then of course you've got all sorts of other information um throughout the rest of it there's a lot of tables and um figures in the statistical section which kind of presents like a 10-year history of financial information for the district as well and then the single audit reporting package this is um this is the report it's much smaller in nature and it has not very many um numbers but it has a lot of words so this is the the report that's required because the district is the recipient of a lot of federal dollars and i'm sure so last fiscal year for fiscal year 20 the district expended over 18 million dollars worth of federal dollars which is a very sizable chunk of course there's a lot of focus on federal expenditures especially as we look toward the fact that there have been quite a number of different bills that have been enacted at the federal level so a lot of additional federal expenditures are coming into the district last year the major federal program that we tested was the child nutrition cluster so the auditors are required to go through a process of risk assessment and we rotate the largest federal programs just a little preview next year we're going to be looking at things like esser and esg and things like that because those are brand new federal programs to the district and so there's no opportunity for us to avoid looking at those so those just it's kind of like an open book audit over here you know those are the ones that we'll be looking at for the subsequent year um this report also goes over any what we refer to as specific audit findings so there were no weaknesses in internal control over the financial statements that were required to be reported but there was one weakness over the child nutrition cluster so like your national school lunch and breakfast programs that was required to be reported and it related to a specific requirement that the federal government requires that the district perform procedures to verify that vendors are not suspended or debarred so that particular issue was written up and then also included in the report is management's response to that and what the corrective action plan is to remedy that deficiency so that's also included in the report um in terms of timelines um all of the reports were issued within the required timelines there's a nine month deadline so the financial statements that we're reporting on tonight are for the year ended june 30th and ultimately everything you can see there's some different milestone dates that are required for various reports and all of those were issued in a timely fashion so there's no concerns with respect to that particular piece of the audit and then lastly i'll just sort of introduce this and step aside and let ms fidel take over from here but the uniform system of um financial records is a compliance questionnaire that is issued by the office of the auditor general and she's going to cover a little bit more about the specifics and the purpose of it and go over what the district's responses are to that thank you ms shields man and president members of the board we are going to review next the specifics on the usfr results for the school district as mentioned the usfr covers various areas about 20 different areas where the uniform system for financial records outline specific procedures that we must follow as it relates to budgeting financial reporting student attendance reporting etc and so we are required to follow all of those procedures within the usfr manual itself and then the auditor general extracts from that specific questions that are included in the usfr questionnaire and so the materiality thresholds are not reviewed by the auditors in these instances i believe i mentioned that in previous years as far as it's either a yes or no and so they do review the process they review the question and then based on our procedures as a district they determine whether that answer is a yes or no other questionnaire so you'll note there are 176 total questions on the on the usfr questionnaire we did have 171 with yes answers and there were five instances with no one in accounting records which you can go into a little bit more detail one in payroll which included a personnel file and then three within student attendance reporting for a 97.16 percent yes rate and so i would like to point out that while we are pleased with this high percentage of yes as ms shields mentioned we do as the school districts the public school district have undergo significant audits as it relates to other areas and program areas for example our student attendance reporting is reviewed by ade in detail our nutrition programs are reviewed our federal programs could undergo program reviews and so while this just provides an overview of the usfr compliance there are other programmatic reviews that are done throughout the year for the school districts i just wanted to point that out so the next couple slides just go over in detail and we did provide these um for your review in advance and so if you have any questions i'd be happy to answer them but just wanted to highlight the this audit compliance summary the format we've taken over the last few years is providing you the question that's on the questionnaire itself what the auditor comments noted so what was that instance of non-compliance and give a little bit of background on it and then what district action have we taken so when we do receive the auditor comments we do within our finance department um dole all those questions out to the individual departments that are responsible for those areas and really get what their corrective action that they've taken to address those we also provide for historical reference five years uh past reference whether or not that's been a finding and so is that a continued problem that we need to address was it just a clerical error maybe in this one instance and so it helps us to address what the corrective action we need to take moving forward and this next page is just an ongoing um we had a total of three student attendance reports so that's the the three behind those and then as ms shields mentioned there was a child nutrition cluster finding in the single audit area and so it notes there are the district corrective action taken um that was done and so um at this point this just provides a summary context of the information and so i'd be happy to go over any questions we did provide this in advance and so if you have anything i'd be happy to answer those hi uh just one quick question well first off um thank you miss shields um it's great to see you again and then [Music] miss spidel the one that i just have just a question it's because of the child nutrition cluster and it's been no for five years and now it's no again so right am i reading that it's actually it was not a finding in any of the previous fiscal years and so this is the first time now i'm reading it backwards okay never mind um the one that was was was it the person no no no yes yes okay never mind i was looking at something wrong um student attendance there's always you're never going to get a perfect you are not last year i have five so i was happy with my three but still five minutes and i know we've had conversations in the past with it being um just really so decentralized and and being overseen by so many different folks at the individual school sites while our student information systems team has done a great job of setting just some parameters and giving reporting requirements for them it is sometimes a training issue which i know that they are still going through and addressing i know our system has started up again our school reviews and so those had to be put on pause this past year but they're going back out again to the schools and giving those sites where they identify need a little bit more assistance they're ensuring that they're getting the appropriate training yeah it's just hard to get perfect on student attendance so um but yeah i thank you for everything that you've um put into it and the extra training that is needed and um but to have um five no's out of that's that's a great percentage um and it takes a lot of work in order to do that too so thank you i have a question uh regarding the the payroll piece just to clarify the um for the two or the five personnel files reviewed the file did not contain the background investigation form that doesn't mean the background investigation wasn't done right it was just the form wasn't the proper place that is correct i think at that time our hr department was um managing the retention of that a little bit differently than they are now so now it is centralized in that one file but at the time it was located outside and so that doesn't mean it wasn't done it just is not retained in that one centralized location okay okay thank you there's a reason why they call it usfr do you suffer you suffer thank you very much thank you very much but we need to pass it we need to vote on it motion by tracy store stinkville motion or second invite me ocean passes thank you oh do we need to refresh then motion passes so are we resuming then g2 okay and we were on section three anything else in section three i'm not sure which one we left off on now um it was the 3.2 and the 3.4 is what we were discussing and talking about the date or not the date the month or the time frame yeah and then we went through three three i think we're done with those now i think we so we ended with three four so three two three four are going to be brought back and that's the last i remember yeah okay and then three five is eliminated right okay so moving on to section 4.

test i heard test one two three test okay we're gonna go ahead and start this meeting i'm gonna call the meeting um to order at six o'clock sharp i would like uh we need to adopt the agenda i moved to adopt the agenda second all in favor motion carries 5-0 let's go ahead and say the of the united pledge of america and to the republic for which it stands one nation indivisible with liberty and justice for all so uh do we have any questions on the uh meeting minutes if not i'll take a motion to a doc uh to approve them many minutes i move to approve the meeting minutes as presented second all in favor okay i motion carries five to zero so we have some current events i think we have to approve the uh the minutes from the special board meeting as well oh you're right okay there's two of them any questions on those nope all right we'll take a motion i move to approve the meeting from the special board uh meeting as presented second all in favor motion carries five to zero all right so superintendent report a couple different things to talk about and some recognitions first of all you'll see the enrollment numbers you're not seeing a comparison against last year because at this time last year was when cover 19 started and there was significant things going on and and so we didn't track uh attendance the the issue with the new system we have synergy is once you address at the end of the year take everybody out it it goes back and fills in the same number across the entire year it doesn't give you what your numbers were at a specific time so for the next um couple meetings you're not going to see a comparison like you've seen the past a couple of things i will say uh in terms of the numbers uh for the district at 43.94 those are the highest numbers we've had uh this year so that's a that's a positive uh in terms of enrollment number of families and kids coming back coming off of spring break in many cases just in looking at the numbers uh down on the grade levels it is the lower grades that are tending to get most of the kids coming back which is what we would anticipate proportionally to the number of kids that we're missing so that provides that the cohort numbers again because there's not comparison ours aren't as legitimate and then we have the elementary enrollment uh numbers uh what i like to do is i have a question are those um in person or are those online or is that a combination it's a combination it's all the students that we have in the district uh that are registered with us and then i'm talking about the preschool in kindergarten yes those are a combination of both for every single kid in the district they're enrolled with us and then we just designate them in the system as either virtual or in person but when we pull these numbers it's all of them um i would like uh three young men to come on up um these are from the wrestling team uh bubba tanima and i'm not sure if i said that right seth fernandez and cody owen and i'll explain a few things [Applause] just have you stand up right up here uh what we wanted to do is recognize these three gentlemen their coach mr miller could not be here tonight but the team as a whole uh finished fifth in state and cody earned second place in the 170 pound division seth won the state championship at 152 pounds and competed completed an undefeated season last year he finished second and he also placed at the state was a state placer his sophomore and his freshman year and bubba was a state champion in the heavyweight again an undefeated season he was also state champion last year as a junior and placed third as a sophomore and what we're trying to do is make sure we recognize those students that are outstanding uh in their endeavors we start a tradition with the girls cheer team of getting some something special for state champions so bubba and seth will have a little something special coming from us here next couple months we have to work on a few things with it but again our kids compete state locally nationally and this is an example of outstanding kids doing an outstanding job and we just want to take a moment to say congratulations and thank you for the job you did [Applause] okay i'm sure you're ready to sit down now [Laughter] good job guys congratulations we also want to recognize and we'll have them uh i don't know if they're here we may have had a commission a communication gap but we had the council of exceptional children's recognizes teachers related service providers and administrators for their excellence in working with students in special education programs the focus of the awards program is based on a commitment to inclusive practices for all students including students with disabilities our district was represented by four staff members who were selected as finalists and one who was selected as the winner the names and the wards are and i'm not sure if they're all here because i don't know how well we communicated that but renee adams is the cec outstanding general education teacher award winner she's a sixth grade teacher over at symington laura ridge i know it's here she was a finalist for cec outstanding administrator laura you can stand up see them dr brenda scepter was a cec outstanding related service provider finalist and the district district physical therapist and jess furman is a cec outstanding general education teacher finalist and she's a math teacher at the high school again not only our kids but our staff uh does amazing things every single day a lot of times quietly and out of the limelight so it's always nice when we're able to take a few moments to recognize them and thank them for for the outstanding job that they're doing so to those individuals congratulations and great job [Applause] and and that's all i have for tonight so we'll do a focus on students with the traditional academy mr green please oh okay thank you madam president members of the board dr wyman it's a pleasure to be here today i'm going to call up a couple very very special teachers up here kindergarten teachers let's give a huge welcome to ms gonzalez and miss allison while they're while they're coming on up i just want to share i think it's early childhood we all know how important it is raise your hand if you remember your kindergarten teacher raise your hand if that helped you develop a lifelong learn love of learning because kinder teachers are the best we love them and comes traditional academy happens to have two very phenomenal kinder teachers we're very grateful i could go on and on but uh we're gonna we have a little video so um you wanna go ahead and roll that and then i'll we'll let the kinder teacher speak a little bit great we need sound this is my first year teaching kindergarten here but my eighth year teaching kindergarten overall and i believe that having the students full day with a certified teacher is very beneficial to their education because it helps to build on relationships it helps the teacher get to understand who the student is and it helps the student understand who the teacher is also so being able to work with each other all day long helps and it helps build what we want to do in the classroom my first opportunity to be with the kindergartners all day um the last two years i had 52 kindergartners throughout the years 52 sets of parents this year having one classroom i'm really able to not only focus on the connections with my kids but also the families as well being able to have more time to make that phone call and share the positives or concerns that i might have for the kids and just being able to spend more time with communication is it is it important that you're here all day to learn is that important tell me more about that so here why is that important it's because you have to learn if you're gonna be some baby very good hi joseph hey tell us what you like about kindergarten i love to read oh great so you have a nice teacher and you love to read you love to read everywhere great thank you and how about you guys raise your hand tell me what you like about kindergarten elijah what do you like about kindergarten i love reading doing math and i think one of the greatest benefits i've seen with our kindergarten students having that one teacher for the entire day is that it's helped to build their endurance for the school day for learning it helps them build their endurance to be able to show their skills for learning from the time they arrive until the time they leave but then also those self-regulation skills that help them name their feelings and stay calm or problem solve with peers in the classmate but when there's that one adult with them from the start of the day to the end of the day that teacher can support them be aware when maybe that endurance is struggling and then find ways to support them so that they can stay focused on having a complete learning day with us all right well madam president and members of the board dr wyman i'm really happy to be here tonight to just say thank you for giving us the opportunity to be with these kiddos all day long not only is it so important to have that time to make those connections with our kids and our families but just having so much more time to be able to work in small groups work on one on one and meet with kids and conference about their goals and and just having that opportunity um the last two years having two different classrooms with 52 kindergartners they were with me three hours a day and if you count out recess and lunch and specials they really weren't with me all that long to be able to really work with them so although this year has been a challenge we have seen a ton of growth with these kids already so i'm really excited to see what happens over the next few years with these kiddos so thank you [Applause] so madam president board of them are members of the boards and dr wyman thank you for allowing us to be here and speak to you about the importance of a full day kindergarten and not only the full day kindergarten but a full day certified teacher with these kiddos a lot of times these kids come into us not having any education background as far as like preschool or anything like that so for us to be able to work with them and get them comfortable with school and teaching them that learning is fun and so that's one of the main things that i think is very important for us to be able to work with these kids all day long and like lisa said you know our scores have improved behavior is down as far as i know and so i think just having that one teacher who can really give them the support that they need to learn is is very beneficial thank you just go like this [Applause] oh i'm not done though i'm not done so um so yeah i really to reiterate what they said it's it's our district's commitment to early childhood and it's appreciated and the work they do um it's priceless and they do a phenomenal job strong instructional leaders but even more than that's the social and emotional the whole child they do a great job so thank you now i'm going to move on to a couple people i want to recognize and i'm going to start with i'm going to start with our volunteer but not not really a volunteer she's also an employee but just the definition of going above and beyond showing initiative and and it's a sense of pride in our school that we all really really appreciate so i'm gonna bring her up here and then read some things that'll make her blush so come on up cheryl tapia give her a huge round of applause dr duplicits you make this look easy like come on up here and then smile what do we say um okay so i've got a few statements i want to read um cta is blessed to have cheryl tapia as our volunteer and librarian she comes in to volunteer her time to help our students and teachers she helps progress monitor our students and assist teachers in any way possible cheryl has also played a key role in getting our library painted with a beautiful mural she's a great team player and an asset to cta i'm honored to call cheryl my friend and that's from a first grade teacher shaylene rosenbaum we also have this if you ask our students they would tell you we have a full-time librarian mrs tapia is available during the morning hours to return books to talk with kids about books or just connect with them as a caring adult cheryl has gone above and beyond the part-time librarian role her set her skill sets excuse me allow us to go uh to her for a number of duties and believe me we put her to work big time we know talent when we see it and we utilize it um progress monitoring the reading skills of our virtual students covering the front office so staff can eat lunch covering the front office when we need a substitute serving on our campus positive behavioral interventions and supports team that we have she's a member of that as well and um and she's taken the lead with the local artists that the other person mentioned which is a friend of hers but she got it all connected and made our library just beautiful maybe we can do a board meeting there sometime or come by and check it out we'll do story time for you i'm grateful for the professionalism and compassion she brings to combs traditional academy students staff and families so big round of applause to cheryl tapia okay so on our campus jeff is right we exploit talent and shauna scroggum is a delicious uh what do you call a cookie baker baker so you have a dozen of her specialty cookies which i'm sure your girls are happy for [Applause] um right i i told you i'm very loquacious um passionate about recognizing these people we we have one more now for photos does she stay up here we're good okay all right the the next person we want to recognize is one of those people that makes a huge impact and i when i say that in in all aspects in leadership in instruction um in influencing empowering and inspiring everyone to be great and that's really what good leadership is our curriculum and instruction department is the strongest in arizona maybe the world and she's a she she truly is a leader amongst them so casey bates come on up here and i'll embarrass you too okay i'll read a couple comments here come closer all right without a doubt i firmly know that our students academic success and growth at cta is a direct result of the collaboration casey has with our teachers she works along with us to implement quality instruction over the past few years casey has led us in multi-tiered system of supports or mtss data-driven discussions to better understand student growth and gaps she is a leader on campus by modeling heartfelt listening and mindful responses our campus professional development has been relevant and actionable as her teammate i value the lens she uses to view the whole child allowing us to look at all needs and strengths through her words and actions we feel the care she has for our entire campus whether it be her sustained positive attitude or sharing her freshly made caramel popcorn that was from miss thompson you can tell because it's articulately written beautifully written here's another one and that's oh where do i start to talk about how amazing casey is she is always there for us and willing to help in any way possible her knowledge as a literacy coach is top notch you can ask her anything and she has an answer to and or finds one real quick she always has a smile on her face and can brighten any room casey is always prepared for our professional development days and we love her treats too her dedication is inspiring i want to be like casey when i grow up that was that was from shaylan again and i'll share that um she empowers and inspires me every day and literacy is clearly her passion but she this is it's her passion and i think she probably dreams in strategies to get our kids to read her her skill level and her knowledge is through the roof but it's also her her willingness to share with us and always have an answer just today she she went and did a bunch of research and took a lead on something that just came out and she was an expert and she knew all sorts of stuff and was able to answer questions and if she couldn't she'd find out that's just every day we get with casey very proud of her and we we really appreciate you casey [Applause] madam president members of the board dr wyman it's been a pleasure thank you for allowing me to speak thank you so we have student of the this gathering was gonna be very inspiring and so and wow so far it has been i brought my own children just so they can be inspired as well by these students that we're gonna recognize tonight i think it's wise to always get your children uh some other people to to inspire them than just mom and dad so i'm happy that they're gonna see these kids get these awards but a quick uh update about our facility over there at banner ironwood is we're growing and i don't know if any of you have been there hopefully not right but if you have um we want to make sure that you guys are getting the best we're getting new equipment we're hiring new staff we're building out floors and extending walls so we can offer you guys the best care possible so i'm going to leave cards up on the table over here madam president let's see uh i know bob yes i just would like to give a brief update um i got on the board in january of 2015 and in 2017 18 and 19 i assisted asba by being a member of their finance committee i wanted to do it again last year but with the pandemic i'm not even sure if that if the committee met i volunteered again this year but they had enough people and they asked me to be on the scholarship committee so the scholarship committee met last week there were 13 applicants uh the scholarship awarded was for someone a senior with meeting certain qualifications that would go into education there were three of the 13 that stood out we narrowed it down to two and out of those two one had more financial need than the other and we awarded that person i don't think the announcement has been made yet so i can't tell you that person's name but i just wanted to let you know that aspa is doing good things for our students nice okay um steven nope lauren that would be no okay all right um do we have any public comments all right moving right along okay so now we need do we have any um questions on the consent agenda okay none no we're all good okay so then how come i wasn't invited to tennessee i've never been there well it's not been approved yet so you know well you can hop in your car and go okay that looks like a lot of fun okay so i'll need a motion i moved to approve the um consent agenda as presented a second all in favor aye aye aye aye motion carries five to zero now within this consent agenda personnel do you want to yes um we have uh as you know carla silveski is going to be retiring how much time you got left are you counting the days or what i see but we did we posted the position and then we had a committee uh interview and and you approved in the consent agenda um this is julie cook to to replace carla and we julie is here we want to give her a few minutes just to introduce herself and let you know who she is and she will be beginning july 1st but we're in a transition phase where she's kind of working with us and and we're kind of trying to figure out a way to make sure that uh carla can impart uh the vast amount of knowledge she has to uh to julie but we'll have julie come up and understand get used to coming up and speaking to us we could install a direct line to carla's house yeah that would be appreciated like a red line or whatever madam president matter of fact the board superintendent wyman members of the audience um first of all it's very hard to follow the show that just happened with all of your wonderful staff and students but we'll do my best first of all i just want to say thank you for your time and consideration tonight with your approval i am very excited about coming over to the j.o comes unified school district team as we know carla is a wealth of knowledge and i hope to absorb all of that in the very few weeks before she does decide to retire and do something fun but what i can say is the director of business services position offers a wonderful opportunity to me and i thank you for that i get to work with an award-winning team and i also get to be part of this school's ditches the school district's very very exciting future so i thank you thank you welcome aboard [Applause] okay so these next discussion items um action items most of them i think are just a review of what we did last yes we we presented at the 24th and now it's just a formal action to start moving forward you need clarification they should go right the first one just just so we're all on the same page for the very first one is the ffcra and if you remember the board approved the ffcra in january through april excuse me through march into march and we said we bring it back the only thing i can tell you with that approval uh the recommendation is approved to approve through june 30.

hmm uh good afternoon everyone welcome to our school reorganization uh team um meeting um want to welcome everyone back it feels like we haven't been together for a long time and so i am grateful that you are here today uh with [Music] um [Music] just wanted to just for uh for clarity and transparency i do want you to know that uh you know i have been sending out the emails about hey you know welcome or friendly reminder we're gonna meet again we're gonna meet again and i don't know if you had noticed on there um that i had put in there like hey if for whatever reason you can no longer be in this team uh please let me know uh so i do want you to know that we did have two parents that reached out and said that they can no longer participate in this um luckily um we're not we're not super smart all the time but luckily we did have the forethought to to have uh alternates for both our elementary uh parents and our secondary parents and we happened to have one from each level and so we reached out to the alternates that were next on the list and they both agreed uh to to be on and so just wanted to let you know just in case you saw some new faces and some new names uh we do have two parents that are joining us uh who are filling in for two parents that said that they are no longer uh they can no longer participate in today's in in this process anymore not just today but just any more period so just wanted to let you know about that um let me see here all right uh tonight uh we have um four objectives um give me one quick second we have some people saying that they can't get in um lika can you send can you send meg uh an email please yes thank you um okay so uh we have we have our objectives uh these are our four objectives for today we're going to recap our process that we have been going through so far we're going to revisit our purpose we're going to understand model 4 we're going to understand model three and then try to further define model three okay so if you look at our objectives uh there there are no uh choosing schools there are no this is what i like what i don't like uh tonight it's about understanding and get getting clarity about uh the two models that you all were able to influence um in uh in terms of which models we were we were looking at all right so let's start with uh we'll start with the recap um so way back last year not last school year but last calendar year we assembled this team of 12 parents and 12 staff members on the parents side we have six parents who have uh elementary students in our district we have six parents who have secondary students in our district on the staff side we have four members from our teachers union union we have four members from our classified union and we have four administrators uh this team assembled and started meeting in the month of november and so far believe it or not we have met a total of six times not counting tonight at the conclusion of our sixth meeting uh you all came together as a team and you made some recommendations for next steps those recommendations were shared with the board of education and subsequently the board of education agreed on the recommendations um that we put that you put forward really okay so let's look at what those recommendations were just again so we're all on the same page okay so recommendation number one is that was that we would that we would only focus on model three and model four and that we would discontinue model one and model two that was approved and that was uh accepted by the board of education uh for model 3 though uh there were quite a bit of butts right we've been calling them butts so well let's look at model 3 what would it look like for a tk5 what would it look like for a tk6 for model 3 what would it look like to have a tk what would it look like to not have a tka for model 3 what would it look like to have one middle school versus two middle schools and for model three what would it look like to have one high school uh versus two high schools for model four if you remember um we um we we could not we the we the district when we came with model 4 we came with model 4 as a 612 right this team recommended that the model be a 712 and so that's what we took to the board of education as a recommendation and again subsequently that is what was that is what was approved this team also said that for both models model 3 and model 4 that we wanted to reconsider the support staff that that we had taken to you all so let's reconsider that or let's rethink that or let's reimagine that um we also as a team you guys as a team um recommended that the timeline week remember we came with a five-year timeline uh it was recommended that that be accelerated um that there would be an accelerated timeline and the third one was considering should we implement in 2021 i'm sorry in 2021 2022 or should we wait one year and implement in 2023 so all of this went to the board of education and all of this was approved by the board of education okay all right so let's move on to our purpose so from the beginning uh we have been um telling you all that the purpose of this school reorganization process was to maximize our facilities and maximize our programs you have been this is not a strange uh slide for you you have been seeing this all along so you see that in 2002 2003 back in the day uh across our district we had 20 of our of our of our capacity open another way of saying that like if we flipped it around right another way of saying that is in 2003 we were using 80 of our facilities okay now in 2020 2021 which is the next column you will notice that we have 52 of our facilities open and available again uh another way of saying that is that right now in 2020 2021 we are only at 48 of our capacity in terms of our sites so less than half and then of course if you keep going down this this column uh due to um declining enrollment or projected declining enrollment you will see that those open seats continue to grow which means that the capacity and the use of our facilities continues to decline right continues to uh continue to to go down um i i want to just be super clear that this is not an azusa thing what you're seeing here in terms of declining enrollment is not an azusa thing this is a we are all in this valley going through this as well our neighboring districts in the valley um are also going through uh similar tough decisions and similar tough processes and they're doing that either right now or they have done it in the recent in the recent past and again we all live here in the valley we're all here and so we understand that this is going on there are districts right now in our right now our neighbors uh who have already made decisions uh to close down schools for the 20 uh 20 20 21 2022 school year so i just want to point out that this is not something that only azusa unified school district is going through um so as we start to get smaller and smaller and smaller in terms of our school sites then of course when we talk about maximizing our programs right that those those small numbers begin to affect programmatic things for example at the elementary schools we start to see a rise in combination classrooms the smaller you get the more you are forced uh to to do combination classrooms at our secondary schools um we have uh limited electives and limited uh choices uh we have to separate programs right from site to site to site and across the board large parts of our campuses are left uh empty and and unattended so that is why we are here right that that is why we have assembled this awesome team right to think about how we reorganize so that we can once again maximize the capacity of our facilities and maximize the capacity of our programs all right so now in the next slides we are going to be presenting model three and model four and now in our seventh meeting we are at a stage where we are starting to get more detailed right more into the weeds which means that when i hit next slide the model models are now going to include school names we want to preface this by saying that just like in the first phase of our work right we can point to it right you you have seen it with your own eyes you have witnessed this we are only bringing ideas forward that doesn't mean that they're the best ideas that doesn't mean that they are the final ideas that doesn't mean that those are the ideas are in cement and that doesn't mean that those are ideas are the ideas that we are trying to champion because none of that is true we're just bringing ideas forward and those ideas can be changed doesn't mean they have to be changed but they can be changed right you guys changed 6 to 12 to 7 12.

way better than 70. but i i the difference will be huge and like that really the key piece of it is trying to figure out how to make sure that uh there's compliance and that this is relevant to both ends like the students were really interested in enforcement and then i i brought a landlord into conversation with them and they were like kind of surprised that like they shared that concern because the landlords don't want to have an uneven competition like they want everybody to be abiding by the same rules so it's like this is important to everybody travis yeah i just wanted to thank you for that update elizabeth and i i know that um i talked to geo too and you know i know that they were really passionate about the 240 number but the the willingness to potentially negotiate down to that 210 i think would also um help to alleviate some of that argument that you know undergraduate students would be off campus by that time because that puts us more towards the end of march i think and so um there would still be like a several week period if not a month period for folks to be able to lock down housing for the next year and hopefully not have that really dramatic long period of time where folks are locked into a lease that they can't get out of um so thanks for your continued hard work on this thank you anything else motion to adjourn i move to adjourn second second on favor thank you bye now you

i delivered those signatures to county superintendents schools they dated stamped my forms and sent them to the county recorder's office to validate the signatures the county recorder's office was unable to validate 169 of 194 signatures because i screwed up whole pages of my petition are invalidated because of bad dates as you can see here on page 10 they're all good full signatures but nobody wrote the year they just wrote the date it doesn't say they had to there's no format specified but that's how it went that happened throughout on on any page where the date wasn't didn't include all three aspects um i was told that i could have learned this by reading the statutes the same thing happened whenever like i said there was a date discrepancy it's nearly 50 times throughout the pages another problem that's easy to see here is on page 3 of my position that's what i've got the first person writes the wrong date march 16th in this case and the other two people follow suit then someone realizes march 14th you know i'll continue with 14.

madam president under the elimination of policy governance anything relating to executive limitations was removed and there was such a large number of sections relating to school finance and other resources that the section was renamed from executive limitations to district source management or resource management so under resource management each of these subsections references statutory requirements relating to the operations of our of our basically the district budget thank you i'll open it up for a discussion on section 4.

we're really not it's not impacting us at all right now it's really more of something for our staff in the event something occurs we have had since uh since the last report where we gave you numbers i think it's only been one situation so we've not had any other situations that individual was able to telecommute so actually it didn't cost us anything i would anticipate knocking on wood um even if it's fake i would anticipate that this is really going to have nominal impact on us uh because uh we're not seeing the the the wave and and the vaccines uh but it's just a gesture to our staff to let them know that that uh we still uh value them and understand that this is difficult situation if they happen to uh uh a pickup cope at 19. so that would be the reason for the a recommendation to push through to june 30.

you guys changed five years to three years right those things you guys got rid of model one and model two so we are we we we want you to understand that what you're about to see is not cemented these are just ideas and these ideas can be influenced and will be influenced by you so again just to reiterate what you're about to see in no way shape or form means a final answer right or a final decision or that's what the district wants it is none of that and again i hope that you have seen throughout this process that this is malleable it's flexible and and we're just trying to get the best ideas uh forward lastly i want to remind you about a couple of things those of you in this room you are human right you are a human being with feelings and thoughts and ideas that's number one number two this is not easy right this is not an easy task and you you signed up on the dotted line and you took the courage and you took it upon yourself and we applaud you for that so when we unveil the models with school names it is normal to have a reaction right it's normal to have a reaction maybe there's a school listed that you work at maybe there's a school listed where your kids go to school maybe there's even a school listed where you went to school and so it is natural right to have reactions so we're going to give we're going to allow some space to to let let that reaction happen um and that reaction will vary from person to person maybe some for some of you it'll be a reaction of sadness maybe for some of you it'll be reaction of happiness maybe it's anger maybe it's fear um maybe it's defense um and again i just we we just want to acknowledge that we're all human and that again a reaction is normal we have appreciated this team's ability to remain as objective as possible as we move into as we have moved in through phase one and as we move into phase two um i know it's i know sometimes it's hard but the more we try to reach objectivity i think the better at the end when the recommendations come from this team the better those recommendations are lastly before we move on i want you to know that we are starting with model 4 for the only reason that it is the model that that you all have not connected all these butts to so model 4 is cut and dry it's a 712 model unlike model three where it's like k five k six one middle school two middle schools one high school two high schools tka no tka that one we're gonna have to spend a little bit more time on and so that is why we are starting with model four all right let's move on i'm going to give you some time just to to look at this and then i will start talking in a second okay so what what we're trying to do right now is understand model four we're not trying to decide which schools are best which schools are not best there will be time for that i promise you we will there will be time for that right now all we're trying to do is understand model four okay so we want to point out a couple of things first all right number one if you look on the right hand side of this the one with the yellow uh the yellow bar on top uh the first thing that you're going to notice at is that this is no longer a five-year plan this has been condensed down to a three-year plan so again right awesome to this team yay to this team thank you to this team your input and your insights that's already a decision that has been made and the board has accepted that recommendation that we're not going to take five years to do that so you will notice that now this has been narrowed to a three-year transition you're also going to notice in that same section with the yellow bar at the top you're going to notice that the first year is 2122 then it's 22 23 then it's 23 24.

but all those dates are invalidated those signatures because they're out of sequence again i had no idea this is my fault there were also a few disqualifications for people who turned out not to be registered at the address they listed or instantly couldn't otherwise be validated of course i accepted a few of those so ms duncan you will not be recalled by this petition because i screwed up but please note there are many people in this community who are not happy with how this district is being run or eager to sign the recall petition because they understand that you are a barrier to the board doing the work that it should be doing i got an earful i got you're full many see you as a protector dr dooley rather than a check to the power that he wields which is what the board should be i can't i can't at this time start a new position a new recall petition rather as important as i don't think it is i just don't have it in me maybe another community member will take it up in the meantime i will ask that you remember who you are serving and pay more attention to and give more weight to the needs and concerns of your fellow board members and less for those administrations thank you uh governing board report does anyone have anything to report all right superintendent are we sure well i didn't get a paper i got famous uh superintendent report thank you mr president um the decision about pima county uh is positive it allows the board to start working together again this has been a negative force for too long comments from me um [Music] please be aware while we're hearing and decline in codewood i'm always nervous about this want to believe good things but i i hear news from cdc and become a little apprehensive again um code is declining but as of monday arizona had 800 000 people that have had the disease with uh 675 cases on monday in the state alone so we can't ignore the fact that we have an active pandemic and it puts us all in jeopardy uh a statistic that i can't actually calculate quote because i just heard the last part they're also increasing school-aged kids i think 20 percent 20 or 200 that's why i don't want to make a big deal that god went up one week and it's happening because statewide schools are more open today than they were a month ago today and part of that's because of the slowdown kobe it's also partially due to the governor's executive order schools open after spring break so frankly as an educators administrator i enjoy the kids being here and to my knowledge we've had no cases in offal with school-aged children i hope that continues to be the case but it's something we're still going to keep an eye on when i think about next year and i plan for next year i want to think of next year as like the fall of 2020 yeah no yeah fall of 2019 i'm sorry i'd like to see the students and the staff have a normal year um we don't know that's going to happen um you've all heard the news that the johnson johnson um vaccine was shelved yesterday by uh fda and cdc and so we in some states are using a pfizer some are using moderna as we have we have a high percentage of our staff have had a double vaccination um we have been told i've been told by medical people that that's only going to be good about august so i don't know what's going to happen what they're going to say we're going to have more vaccines but something my whole point of this rambling is we've still got to keep our eyes on thing i think when we start letting our guard down and when we uh relax too much uh that's when we may have another uh exposure exposure of the pandemic we don't have that virus um we've had discussions and questions about the graduation venue as i mentioned this administrative function um mr rhythm and i've been talking about options for two or three weeks again the number one goal of these group at the high school or the 8th grade promotional high school graduation is to keep our kids safe we want them all to have a good experience we all want them to be healthy in the process we are considering two venues right now and the plan is to send a letter to parents next week however we do it we're still going to have to have social distance if we're inside we have the challenge of enclosed facility with a lot of people breathing it's going to be social distancing that will not be popular but we will have some type of system where each student is limited to a number of tickets uh so it won't be 600 people in the indictments auditorium if that's our inside venue for example um this is i thought we think this is the safest way to go uh i think it's just unsafe to have 600 people or 500 people are a large number of people uh in a public place um being potentially being exposed requirements for students regardless of venue and uh audience will be to be passed up and have social distancing so we will do eighth grade promotion the traditional way we'll try to do it today before high school graduation and uh we will advise people uh ahead of time so hopefully people are prepared for this process it's a big deal in kids lives we want to be successful um last evening questions asked about staff survey i did not have time to prepare for report today we did a staff survey uh we could go today yeah about about twenty two weeks ago they did about twenty items we have taken we've done some study of it and we will i will i'll make a report to the board may 12 14 after this thank you doctor may i have a motion to um approve the consent agenda [Music] awesome then we move on to personnel first item business is the certified employment for the year 2021 and 2022 of pamela della cruz uh pamela della cruz has been interviewed and referenced checks completed for the position of teacher in the ajo schools she is recommended for hiring as a special ed teacher and uh is this contention on her i didn't put that in the policy or in there okay and when i say on time it's very common for us to bring international teachers department to have them here maybe two or three weeks late but i'm thinking if someone's not here about october we're going to start looking forward may i hear a motion um about the hiring of pamela dela cruz i'll second it oh yes i did mr hopkins last week trying to drive up reds should we move on president i think he's home uh can you guys hear me yeah now we can yeah my left boat was an eye sorry okay did you hear this that we made a motion to accept pamela de la cruz yes i did and i voted eye on it okay what else set thank you eric next is um uh the certified employment of amanda uh r wyan uh has been interviewed in reference checks completed for the position of teacher of the aha school she has also been observed several times as a student teacher by the administrative administration excuse me may i hear a motion that we may hire amanda ryan i can never get that shake i'm sure as a teacher in the air aho uh unified school district [Music] all right um the next item of business approval of additional spring intercession employment marishu bellatran's name was left off the approved list for teaching 20 hours during the march 2021 spring break after the practice needed to pay uh miss belgium for the hours she worked so may i hear a motion that uh marissa maraschu burial tran can be employed for the 20 hours and given her compensation that she spent during spring break the next one is a classified resignation of the cafeteria worker maria mendez maria mendez submitted her resignation from the cafeteria effective april 9th 2021.

i didn't have anything i don't have anything either i'm just going to wait for miss jaffin to get back my president while we're waiting i'll just give some explanation of the process that went into these revisions based on the board's last study session where we received feedback that direction was taken into account and then we looked at current statute one thing that you will notice on all these policies that you will see a arizona revised statute reference and so we tried to identify any policy that did not have a statutory reference and either eliminated or group it under something that was related we divided this up among all the members of cabinet based on the areas of specialty and then we went back and looked at the asba policies the current policies the statute and then our practice and some of the things that we identified were easily re-allocated into other sections to better align them to the topics and then others were just good judgment decisions that were recommended so with that we can continue okay thank you do you any discussion or feedback on section four okay i think we're good to move to section five though all right moving to section five and that is support services i'll open it up for any discussion or comments i don't think i have anything in there either oh wait a minute was it can you clarify um the red line on superintendent and change to district and and what that means and president do you have a specific reference um i'm just going to throw one out um so uh section 5.2 when it speaks to pest control application madam president the feedback from the board of the last study session to redirect the policy governance which was very much ends in means and [Music] everything was worded pretty much in the superintendent shall not fail to blank blank blank and as we went through this there was the intent to take the language out that was consistent with the superintendent shall not fail anytime that that was there we put the the reference to the district shall and in this case this is an example where multiple times it says the superintendent may that was just changed to the district may to maintain the consistency from the changes of the superintendent shall not fail to whereas it says the district shall we made these changes here as well okay thank you okay yeah moving to section six and that is facilities development um not much in oh he left not much in his department here there kind of present also if i could just many of the changes that were more recently made throughout the year are now starting to show in these later sections so for example 6.2 naming facilities that was one that was more recently brought forward which the board had recently changed so some of these are still pretty fresh even though that they're being brought back again just a few months later okay get rid of that i'm guessing no one has anything on section six okay moving to section seven personnel that was pretty easy trying to give people some time to scan it just to make sure they don't have something so if you know you don't have something tell me i don't i don't okay okay all right [Laughter] all right um and i'm sorry that was seven right so we're on section eight meet and confer we're almost there no i'm good okay all right thank you yeah we did it going to information item g3 for the 2021 2022 dysart k38 online update dr kellis madam president members of the board members of cabinet this evening administration will present information on plans for addressing online instruction for students in grades k through 8 next school year and i'll let dr pauline introduce this item thank you madam president members of the board dr kell's cabinet it's my pleasure to present tonight with dana k director of pre-k 8 curriculum and instruction assessment we're excited to present dice arcade online tonight as you know throughout this covet year we have had remote learning options for parents at k-8 and we worked hard last summer to quickly pull that together so parents had an at-home option and in general between our schools we had anywhere from 15 to 25 percent of students in our schools select that option and so it's a sizable number about 3 400 students in all this year we're in remote learning and we made some changes to that remote learning as we learned and grew throughout the year and we want to come together to create a more distinct separate program that would be a more quality experience and then offer it to parents we do we do believe more families will probably be back in person learning in the fall we expect smaller numbers but that's yet to be determined so we'll give an overview and some specifics and we'll take any questions so it'll be a excellent program for students and their families to engage in online learning we will have a consistent schedule 8 15 to 3 o'clock across the district so that we can better coordinate related services and specials and whatnot and students will have their core classes plus art and pe and florida virtual will be the online particular resource all righty good evening madam president governing board members dr kellison cabinet super excited to talk about dysart k8 online it will be taught by dysart teachers their only responsibility will be to teach the online students so like we started earlier in the year they had both in person and online they will only have online students our goal is for teachers to teach only one grade level or content area so sixth seventh and eighth grade there may be one math teacher that teaches sixth seventh and eighth grade only their content dice rka online teachers will teach from a classroom and students of course can access their learning from anywhere and instruction will follow grade level pacing and small group instruction we'll go into more specific in just a little bit we still want these students to be able to participate in extracurricular activities so they can attend any before or after school activity or sport of their home or open enrolled school of course they must attend these in person so now for the exciting part what what would the day look like so really there's three parts to the day there is a huddle which will be required there's a live lesson which will be required and then there's dysart learning time so this is just a sample schedule but every day kids would attend for about 15 minutes to 30 minutes a huddle this is a time where kids that are online can get to see each other get to know the teacher and feel like they're part of a class as well as the teacher allowing time to talk about the goals of the week as well as the goals for the day the live lesson this is where the teacher will be teaching and we're going to designate 30 minutes for math 30 minutes for language arts and 30 minutes for science and social studies we realize that our students do need that interaction with the teacher and that learning from the teacher and so we're going to provide that opportunity of time the rest of the day they still get their lunch they still get their specials but the dysart learning time is the exciting part this is where students get to work online independently through florida virtual but the teacher will be calling certain students to small group instruction this may be to enrich or this may be to remediate and go over skills they may not have had so this is just what a typical day could look like i think we learned so much from this year and realized it's great for them to be online and be able to work by themselves independently but still be part of that class and also get that live teaching from the teacher so we felt like this kind of hit the best of both worlds moving on we know that some of our students were very successful online learning but some definitely struggled and we wanted to place some criteria in place for our k-8 students for next year to help more students be successful so the criteria that we have talked about is that the final grade on the report card is a passing grade in both math and reading for the 2021 school year so for students to be able to enroll in dysart k-8 online they would have to be passing both math and reading at the end of this school year students are being promoted to the next grade level and they're not being retained for the 21 22 school year um if applicable iep team approval so corey knows that teams would be able to meet and be able to talk about that kids with iep some of them would still be able to attend if it meets their needs and also passing grades quarterly in both math and reading to continue enrollment so again putting just things in place to what we learned and try to make it really successful for our students the next steps uh tomorrow april 15th we're going to go live and share that with ka parents via infinite campus and social media so everything that we're sharing with you about dice rk8 online will be shared with our families and then dr pulling and i are super excited about april 19th we're going to do a facebook live go into a little bit more detail about it and then we're going to open the enrollment process so that our families can join us if they would like so that's the end of our presentation any questions for dr polling wow you shifted that really quickly i have a question smooth move by the way nice lady um so in the back in the schedule why are science and social studies lumped together i feel like they should be two different sections instead of just 15 minutes on each or every other day sure so with um usually the k5 it usually winds up being where they teach a unit they finish the unit and then go to the next subject in the unit if it is the content it would probably only be that content that teacher may just be teaching that so again it's very flexible we also talked about flexibility in the k1 we may need some more time in language arts in the beginning of the year so just really depending on your class your kids your needs and your grade level so this is flexible yeah i'm starting an opportunity and it's really teacher flexibility a teacher can decide here's a schedule here's what i want to do they really have the autonomy to say here's what the unit needs here's what my kids need so these are just suggestions for the teacher okay i guess my concern is i've seen how it works when there's only three teachers there's a reading teacher a math teacher and then a science teacher and then they're supposed to do social studies the last half hour of the day and it never gets done so i guess that's my biggest concern [Music] is making sure that science and social studies have equal importance with the other subject levels absolutely and it would again this is just um a sample but we really wanted to outline that there needs to be dedicated time to every subject every day was our was our point in the way we did that we agree with you though on social studies thank you i have a couple questions um first of all thank you for the presentation i'm excited that there's some structure around it for next year um as far as the staffing like if so now and i'm glad too that teachers can just focus on online or in person rather than having to juggle both but what does that mean as far does that mean we're going to have like double the staffing which obviously we can't probably when hr did their enrollment projections for next year they projected based on the total number of students like i said right now we had 15 to 25 of students in remote learning so they did based on the total number and so the staffing the ratios are already in place for each school and so we would work with each school on the number of students they have signed up for online learning and then work with hr in a process to make sure that teachers that already in the school are assigned to those okay so it's not like it's going to be an impact to the budget okay no we're already staffed at our enrollment numbers what our projections are and we're staying with those projections that's good um and then just for clarification so other than if a student is called for small group um and then other than that hour and a half of live lesson are students pretty much on their own they would be that's that's correct and that's what parents are choosing this online learning for to be on their own they will they will follow through on the florida virtual curriculum as well as the teacher and that's why to me the huddle is so important because the teacher is going to set the tone for the day of the things that the students need to do as well as the goals for the end of the week of the things they need to accomplish and also things that they could do if they finished their work for the week so then and i i don't remember on the schedule was there something at the end like there was was there another like check-in later in the day there was a check-in right after lunch is the way we were doing it um because if what we found from this year is that parents really wanted that autonomy to have their day and be able to do the learning when they chose to do it did you guys consider having like a check-in at the end of the day just to have another opportunity for students and teachers to connect whether it be hey i want to make sure you're still you're still with us for the day or another opportunity to ask any questions before the day's done and teacher's not available anymore and that's why we did do the check-in right after lunch is what the team was thinking but as well remember just like any teacher there's email and there's definitely time before after school if a student needs help that the teacher is available to provide that opportunity for them as well so what's your feel on the fact because i know like through the online learning the biggest con other than florida virtual unfortunately i've i haven't heard a lot of good uh feedback from some people without that style that model um and so incorporating that either level of difficulty or just level of adjustment that just wasn't working for some students i know for some it was great um and the fact that then we were losing track of kids like kids either they there there was that learning loss because for some of them they either just weren't getting it on their own or they weren't um they weren't attending they're following a schedule they should how are we going to make sure that we're not having a repeat of this year where we're especially for the younger kids you know k8 that we're not going to have a repeat where these kids just kind of get lost or they're really not especially for two working like parent families where they're on their own i mean i suppose you're going to capture them because if their grades fall obviously they can't do it but once their grades fall it's too late as far as just kind of trying to set them up for success i think the criteria that we're putting in place is going to help that so the kids that were unsuccessful this year were saying you're not going to be in dysart k8 online which i think will help kids get back into the classroom as well as keeping that criteria in place for the whole year i think that the small group instruction will help catch those kids up with the teacher and i think what we've really missed too was these live lessons and really making sure that the kids are getting that teaching so florida virtual is a resource but teachers need to teach the standards and so this gives them an opportunity to engage students in that learning and then the florida virtual curriculum allows them to independently work after that do you feel confident that just that one live lesson just once a day is going to be satisfactory to me that's something we'll certainly monitor and see you know talking with teachers is that working how is it working and certainly the teachers are setting their schedules so we will work with them to make adjustments as needed okay thank you absolutely um just one question uh and had i believe you said that they need to be passing math and reading this year in order to do it for next year um we're holding true to that okay okay ma'am president missouri i would add a caveat to that but if the conditions in the world change and we have another [Music] form of pandemic or whatnot obviously would monitor and adjust but the intent here is that this is not a coveted relief plan this is an option for those who can be successful online and want that as a choice um i guess something i am concerned about is how flexible can we be with families who maybe enroll in the online k-8 say just for instance have a kindergartner and one of the parents is at home and then their life situation changes and where what the other parent needs to become employed something at home changes where they can't be home so are we allowing for opportunities to enroll in for in-person or do we cut them off at a certain point i i mean how do we manage that sure so what we were saying is that we were going to allow movement at the end of each quarter okay so right now they're they're kind of coming and going and it's been very difficult on the learning of the students and and the teacher but we thought if we can finish a quarter close grades and then we're going to give them three to four days to make their decision if they want to move from brick and mortar back to online or online back to brick and mortar so there'd be a three to four day window right after the quarter that they can move back okay and that's the only opportunity i mean if they had a family emergency though or what what what i'm sure there's offered yeah i mean certainly we would listen to and see what they what what was going on but with with the families what their needs are but we are trying to provide more structure so it's not so fluid i i i'm not exaggerating what we have families say we need to go out of town for two weeks want to switch to high school for two weeks then come back and it it was truly truly chaotic and this will be a much more distinct separate program and so it will be a significant move to go you know back and forth okay thank you you're welcome i do have another question um do we have intervention set steps set for students who are not passing their classes like so if you know student a is passing math and reading right now and they pass first quarter but they don't pass second quarter does that mean third quarter they move back to online or do we give them another quarter to bring it up how does that work i think we'd have to kind of work through that next year as well i it everything's so dependent on the student and the class and and what's going on and also other things that are going on their lives so i think there's definitely room for discussion depending on the student okay because i know that's been one of the concerns this year is um just students a lot of online students people who chose to be online are just failing and teachers are going i'm here i'm here i'm ready to help you and then there's no consequence there's no intervention or continuity and that child just is lost so yeah i guess that's another concern absolutely that's been a challenge this year for sure so what's the answer to that just the more structure and so again having enrollment criteria to get in and have a dedicated teacher and that teacher also has the support of the principal assistant principal social worker so it's still a team approach and yes there's interventionists available and it's more support but definitely just making it more structured and um and more supportive for students we feel like will be helpful at the same time we've had principals tell stories if they're going knocking on doors of these students have disappeared and they still can't get people and they make weekly calls and letters and our staff are making tremendous efforts to reach out to these students who have kind of ghosted us as the term that just came up and so we'll continue to make extensive efforts but for sure there are some students who have just for whatever reason or are not checking in and we cannot get a hold of them so how long do we go how long do we let them fail before we require them to go back to brick and mortar right now we're saying quarterly okay so if they fail first quarter second quarter we say no you've got to go back to school yeah correct okay yep yep so right after the quarter ends that next week they have that we're either go they either have the opportunity to move back and forth or that would be something that we will move them back and forth okay because right now i feel like i just kind of got conflicting answers you said they have the opportunity to go back and forth but i want to make sure that if a student fails for an entire quarter we're not just gonna let him keep failing second quarter and third quarter we are saying no you agreed to this you fail first quarter you are going back in person that is what our district is saying that's correct yes it's just president jeff and i think the the ambiguity there is with the two questions um madam president densmore asked if there's a life change in the family situation can they opt to move and the other is if they're failing they don't have that option they would be moved okay because that was my question is if they are failing if they are clearly failing if they fall to like a d or an f are we going to require that they go back to in person at the quarter change yes we're not just giving them the option saying okay it's all right that's correct okay yes i wonder do we have maybe um have you guys considered having like almost like a little contract that the student the parents all kind of sign like so they know right up front if i if i'm failing at the quarter i'm definitely moving back it's not even like a well we're conference about it like it's have you guys thought of that so what we have talked about is at the start of the school year having a parent meeting as well as a student meeting so that everyone's on board and understands this because it's one thing to have facebook live in april but we want to hit them right when school starts letting them know exactly what it's going to look like sound like so that we're all on the same page and we start off because we want all of our kids to be successful so yes it is in the planning stages that's good and just thank you to clarify um on miss chapman's question so if they fail first quarter and then they are required to go back to brick and mortar if they pass second quarter they're not allowed to go back to at home right they're required to stay in brick and mortar for the rest of the year yeah my feeling the goal is to get them back in school we do the vast majority of students are more successful in the classroom we've seen that this year so and just to ensure that we don't have to flip-flop our staffing model constantly right correct two correct so once they're put back into school um then they don't have the option to go back to online that's what you're saying for that year and president to the old adage never say never but that's that's the intent right okay cool thank you so much all right next we have item g4 the update on dysarts covid protocol and mitigation plan dr kellis thank you madam president members of the board and members of cabinet and our ongoing communication and shared dialogue with the board mr dean will introduce this item good evening madam president members of the governing board dr kellis and members of cabinet this evening we provide information to the governing board on our regular protocol updates that we have brought to the board the last meetings or so and we will start with asking for the slide to be advanced so the first piece that we would like to just um make the board aware of is a change in our school lunch protocol with southwest foods and and the change involves two pieces the first is that they are moving the milk cooler location back to its normal look it's let me rephrase that back to its pre-covered location and so um it has been placed back to its normal place as well as a change in the distribution of milk students now take their own milk from the cooler as opposed to having a milk set on the tray for them and so that's the first change in our school lunch protocol and then additionally again moving back towards a more normal feeding operation and that is that wrapped items will be placed on a tray rather than in a bag we everything had been put into a bag previously now will be placed on a tray again as we look to get back to some more assemblance of a normal operations um with food service and so that those are two changes the southwest has made that we wanted to make sure that we updated the board on let me go back to the very first page and that is the cases web page pause as the board is aware we have a um a case update page on our website it's dysert.org cases and on that site by school it lists the number of cases active cases at one given time we have been updating that page twice a week as of um today there were a total of six cases there are zero cases at the elementary school and the six cases are currently at the high school between the months of january and april we saw a an 84 percent decrease in the views to that webpage and between march and april we've seen a 43 decrease in views to that page what we are recommending this evening is placing a pause on continued case updates at this point in time for the last four to five weeks of the school year and we're asking the board to weigh in on on that recommended recommended pause and so we'll pause at this point in time to have dialogue regarding the recommendation so the school lunch i'm assuming everything that we're doing is probably in um aligned with the cdc guidelines or there's that that recommendation came from somewhere obviously or is that where did that come from madam president um remember pritchard so the the case web page that we have um was not a directive of the cdc um it was something that we did as a community effort to provide transparency in terms of the number of case active cases at our school as the board will remember we have quarantined many thousands and thousands and thousands of students as a precaution as it related to our case aspects and so yes you are correct that the protocols that we still have in place are aligned with cdc and or arizona department of health services maricopa county department of health services what we are recommending at this point in time because the case numbers have become so small is just pausing that and we've seen that small number for a number of weeks at this point in time our staff cases are i believe mr croto reported yesterday that we had zero staff cases and our student cases are anywhere between three four five and six in a given week and so rather than continually updating that piece we're just recommending just placing a pause on that page um and hoping that we don't have to return um to a time where the numbers um start to grow to the point where we would need to revisit starting that page again twice a week and i'm i'm so sorry the cdc question that was in regard to the food handling oh i'm sorry no that's my fault i didn't i you were supposed to read my mind yeah um no worries whatsoever so i just gave you a long answer that had nothing to do with your life what if i did have it it's one of my specialties by the way i'm interested in like why we're we can talk all day but the uh the the food handling thing is that something that they're saying we don't have to worry about all the excessive touching as much anymore because the cases are lower so the one thing that the cdc has come out um strongly and indicated is that um the the possibility of of getting covet 19 through transference of objects is very very low um and so certainly southwest food services would not have made that recommendation or made that change um had that not been in accordance with that okay and then the pause is it because is there just a lot of manpower that goes into updating that there is there's a lot of manpower we continue to collect the information we continue to provide that information to the county as we're required to do but yes um for the the number of cases that we have at this point in time um the the manpower involved is not um equal to the current task and obviously if if cases started soaring again we would go back to we certainly would yeah so any other um aspects of conversation as it relates either to um the lunch piece or um the the the web page uh pause madam president so with that with the web page pause um we will still have a web page we will still have a web page information yes the the web page will not go away um it will be updated to indicate that we have paused it due to a very low case number threshold um and yes our all of our information related to covet our covered protocols they will remain okay we do look forward by the way to the day when we can get rid of those oh yeah would it be possible just to have a generic email address so that if someone did have because i guess you know where i'm where my brain is is if someone is utilizing the the online services and maybe they're they're nervous about about going to in person if they wanted to keep up on that themselves could they email and get the information they they certainly could they certainly could they could also contact their site um their site would be yeah yeah their site would be able to provide that information as well okay so would you would you maybe just direct them to their school site yes and and that's a very easy um a very easy statement on a website yeah absolutely perfect any other conversation with the board on these two items we have one more um to quickly discuss let me rephrase that we have one more to discuss and that is masks this slide is titled incorrectly we did speak last time about masks during exercise but this is just masks in general and our recommendation is to continue the mask protocol to keep that in place through the end of the school year and then we would revisit this conversation for summer school and for next school year as well however with 26 days of school remaining it is our recommendation that we continue to stay in accordance with those policies that have guided us thus far and keep our mass protocols in place in light of the parents and individuals that went down to the state and the 11 000 signatures that they had presented how much pushback have we received with regarding the masks miranda president member sawyer think bill we have um received a few emails um either to the superintendent's box or to student services um we have responded to those by and large parents have understood that our protocols are remaining in place for the last few days of school the last few weeks of school those parents that have chosen not or or choose not to comply with our protocols through the end of the school year we offer them the online option um as well we are not denying any of our students to attend school we are providing options for them should they not choose to comply for the remainder of the school year okay because the air of the environment that was down there and you know parents have every right to withdraw their children but there were several that were down there the stating that um if their voices were not met then they were going to go ahead and withdraw their students from their particular schools we have not seen a large amount of withdrawals from our school system i would also echo that this recommendation to continue through the end of the school year is in line with district and charter schools throughout the state thank you however we will revisit um this topic um again as it pertains to summer school and heading into next school year since since you left it on the header you know the mask during exercise i just want to clarify that is for exercise and recess right madam president um specifically we spoke with our schools about recess and pe um and those were the two areas that of specific examples that we provided to our schools and certainly if students are exerting themselves during recess which we would hope they would do it's an opportunity for exercise then they should not be wearing masks during that time okay if they're not exerting themselves are they because i'm also thinking not just k8 but like high school their recess is like during their lunch time and they have free time whatever if it's during that time and they're not eating or they're not running around then even though it's considered recess is the expectation that they keep their masks on madam president member pritchard um we would hope that our high school kids were not running around during recess um as you stated you know during lunch um right exactly exactly we our high school administrators and our security guards do their best to to continue to ask students to comply with masks our high school students have done a tremendous job during the school year um we found very early that they were willing to comply with any of our requests so just so they could stay in school and so they have they continue to do that i've seen students in hallways playing the xylophone with no one else around no one within 10 feet of them and and they've had masks on and so um they've done a tremendous job with that i will tell you that we do have students when they're outside during lunch who take their masks off occasionally and and talk with with other students um our administration and security do the best they can to continue to try to police that yeah and that unless you're eating or you're yeah if you're eating drinking um otherwise it's on correct that would be the what the protocol would be okay i just want to clarify that and i do want because you brought up a good point and i i'm just very um gosh beyond impressed uh especially also at the maturity level as well at such a young age but you're right i've seen in the high schools where students wear their masks all the time and and i was at a game and um there were students who it was spirit line and and they were told obviously if you're exercising you don't have to have it up and there were times when they still wore their masks and i i asked my daughter about it afterwards and i'm like just curious i said so you know you could have had it down if you were getting you know it was hard to breathe whatever when you're exercising and she's like you know we talked about it but we just feel safer like we just prefer to like we're fine like to have it on especially if it's like little things that they're doing but i thought wow you would think that i i just think the maturity level of some of these kids and you figure freshmen can be what 14 years old even you know having the wherewithal to be like you know and if pandemic i'm going to do my part i feel safe it's kind of ingrained and i just i don't know that just struck me as very um like i said i just i was very impressed by our young students very good safety is definitely a priority for them and like you said they want to stay in school and they're doing their part so good for them any other questions as it relates to our code protocol update for the evening or answers we'll take answers to you'll take the answers thank you all right moving to item h1 no sorry all right moving to item h2 dr kellis madam president members of the board members of cabinet this evening mr croto will introduce this item thank you dr kellis madam president members of the board superintendent kelly's cabinet and guests tonight we're going to talk about revising our pay for performance our 301 plan for the 20 20 21 school year so the plan that you already have approved and actually revised once before uh we are in need of revising that again a little background on that on march 18th of this year governor doug ducey signed the senate bill 1165 into law that sb 1165 provided an emergency measure that exempts school districts from conducting performance evaluations of teachers and principals for this school year the 2021 school year in addition it states that a regular evaluation for effectiveness in the 2021 school year is not required for a teacher to be eligible to receive performance pay from the classroom site fund as a district i want to assure you that we have and will complete all evaluations by the time that the governor signed this we pretty much were 99.9 complete with all of all our evaluations anyway so we have gone forward and completed all our evaluations however in our current format we will not have the ability to calculate the effectiveness classifications for the teacher so that's the highly effective the effective the developing and the ineffective classifications so the problem is that currently our 301 performance plan allocates about 33 percent of the funding in the plan to all of our eligible employees based on their effectiveness classification the 301 committee got together which is comprised of our dea representatives administration and brought forth a recommendation to one of the following options for the governing board to consider to replace that 33 percent option one is that all eligible employees received 33 percent of the performance pay for the effectiveness component based on the passing of senate bill 1165 what does that mean senate bill 1165 gives the governing board the opportunity to say we're going to give them the 33 percent uh we does not need to be tied to their effectiveness classification or to an evaluation the governor signed that bill um we have the ability to do that that is option one option two is that all eligible employees receive performance pay based on their ratings in domains one through three of their final professional practice ratings report so of their evaluation there are a set of domains that each teacher is evaluated on we would score those as the following so if they received a distinguished in one of the performance indicators in the domain they would get three points proficient two points and so on we would add up all those totals divide by the total number and it gives us a percentage in those percentages the payout of the 33 percent would be as follows if they received a 75 percent to 100 percent they would receive a hundred percent of the allocated funds if they were in the category of 60 to 74 percent also 100 of the funds 26 to 59 percent 80 of the funds and zero to 25 percent zero percent of the funds um in anticipation of a question you may ask why are the first two categories 100 percent those are in line with the current effectiveness classifications if you look um on the plan that's already approved uh the highly effective and the effective both receive a hundred percent so the committee felt it was necessary to align um those percentages to the current um effectiveness classification payouts so that's why you see those percentages there um it's important to note here too that currently we have employees on the alternative performance evaluation cycle so they were three years of highly effective and they went to the alternative performance cycle if they are on that alternative performance cycle currently then they will receive a hundred percent in option two option three and that's coming before you is that all eligible employees receive the thirty three percent uh pay for the performance plan based on completing five sessions of tutoring students before during or after school between tomorrow april 15th and may 20th 21.

you could theoretically push it through to september because the american rescue plan does take this through to uh the end of september but then that would be the end of it but at this point the recommendation from administration is just through to june day into june okay any discussion on that you guys have any questions comments concerns no just thanks for bringing it back again i know that when we originally talked about it we were a little concerned about what you know impact it might have and so i think it's good that we are taking a second look at it with you know a better perspective several months ago okay so um let's go ahead and do a motion on that yeah so i moved to approve um the continuation of the extension of ffcra through june 30th 2021 as presented all second all in favor aye aye aye motion carries five to zero okay discussion and consideration of approval of the 21 22 salary schedule uh these would just be the salary schedules with the increases that we talked about the one thing i would make note of uh one i presented to you the increase for the class fight staff i did not move the decimal place over the correct amount and thank you to daniel watkins for pointing out the air so the actual increase on the support staff what they will receive is is higher is higher than what was presented um uh 1.7 2.0 and 4.0 is is what the actual increase would be which puts it in line with uh especially the the other two groups or the second two groups the second two bands puts it more closely in line with what uh the rest of the staff is receiving and the overall increase depending on what you do with some of the the stipend request would put them in line with the rest of them and still accomplish the exact same goals it doesn't cost any more the math was done correctly it was just an error of moving over a decimal place so i would recommend approval as presented anybody have any questions on that comments concerns nothing okay let's go for them i moved to adopt the 2021-2022 salary schedules as presented second all in favor aye aye motion carries five to zero 8.3 approval covered stipend uh it's exactly the same as was presented uh last time the couple things just so you're aware this is just approval of the concept uh given some of the things that are going on between hr and payroll what we'll bring on these on both 8.2 and 8.3 is uh next month you will actually get an agenda item that speaks to exactly what the dollar amount is for for every single employee based on both of these these situations and that's just in response to uh uh legal advice that we that you're fully aware of what the increases are but we wanted to prove it in concept first and then we'll go ahead and calculate the the actual uh dollar amount increase for everybody and that will be brought back next next month just just so you understand but otherwise it's what was presented so i recommend approval as presented okay any questions nope all right i'll need a motion all right i moved her through the one time covered 19 stipend for all staff as presented all second um favor motion carries five to zero um 8.4 approval of retention stipend uh the only uh component on this one otherwise it's it's as presented these are the very high numbers uh because we do not know who the to find out what this final staff will be that returns um and so this is this is assuming that everybody that received a contract back in february returns therefore if they return they would receive the stipend if individuals choose to to terminate their employment with us before the start of the school year then obviously the new employees aren't going to get this so this will be the high end number we would anticipate that the number will go down uh it's not going to be handed out until the end of the first quarter so we'll present at the september board meeting the actual individuals and how much they're going to receive and so we would anticipate the savings in here we just don't know what because we have to figure out what the final staffing situation is i do have a question i'm just thinking back have we done this retention bonus in the past i don't think so this is uh part of uh what the essers uh money the the federal funding has talked about has been designed and and was sold as a way for retaining staff given the the pressures and the stress that that staff throughout the country uh have been under with covet and so they specifically stated this would be a kind of uh good use of those dollars and so ourselves and many other districts are looking to do the same thing i was on a call today uh with superintendents from around the county and they were all talking about the same thing that many of the stuff many of the things we're talking about here are very similar to what they're doing the only difference is whether you can do a dollar amount or a percentage increase as a percentage increase more or less than us but but districts from around the county you're doing the same thing and quite frankly from the east valley also thank you any other questions no okay i'll need a motion um i move to approve a one-time retention stipend for all staff as presented second all in favor aye aye aye motion carries five to zero um consideration or approval of student growth stipend again very much what we presented on the 24th uh the biggest issues there are a few details that we're still working on which is the biggest one is one what's going to be the baseline data that you're going to choose to see the the 200 student growth uh we we are batting around several ideas again this isn't going to come out until the march uh next march um because of the 100th day so we'll have those details worked out and we'll share them as soon as we get them worked out we're not going to wait till march and then surprise everybody but there's a little bit of time to figure out all the specific details on this one okay any questions on that i'll take a motion so i moved to uh um approve the one-time approval of student growth stipend as presented second um okay approval of three additional hashtag for professional development days for certified staff for 21-22 school year again as was presented at the at the last board meeting this information has also been presented to uh staff uh both the ccc group and uh we had i made three presentations throughout the day on a week ago april 7th about this and unless the principles are hearing something that i haven't heard there has not been any concerns or questions expressed about this and so i think this is just an outstanding way to in with all pun intended to move us forward under hashtag any questions uh just this is just like this is only for the 2021-2022 school year and then if it continues it would just be something that would be approved every year right right we what we'll do is we'll monitor and see what the the federal funds are available and uh if we can we'd like to push it out for two or three years but as right now the approval is just for this coming year and then we'll address future years uh depending on money i just want to i don't have a problem if we wouldn't continue i just could yeah no no and that's good clarification okay nothing else i'll take a motion i move to approve adding three additional hashtag forward professional development days to certified staff contracts for 2021-2022 as presented 8.7 consideration and approval of additional days for instructional coaches for summer 2020 for the 2021.

i want to remind our team that one of the buts in this room was to consider instead of starting in 2122 should we wait till 22 23 okay that is still something that we need to decide as a team so just because it says 2122 doesn't mean that that's when we are going to begin this process okay this team ultimately might decide to wait until 22 23 to begin then in that case it would be 2223 2324 2425 but i want to point out that just because it says 2122 that does not mean that we are beginning in that school year which is next school year you will also notice on the bottom left hand side of of your of your screen right now where you see azusa high school and gladstone high school you will see that they are 7 12s because this is model 4.

and i hear a motion that we accept her resignation i'll second it hi mr cruz aye ms robertson hi number it's following classified employees are being recommended to receive contracts and work figuerino bethany maura we murali maria villa silva susanna leon and patricia uh may i hear a motion for the insurance of classified work agreements to the above employees for the year 2021-2022 one second mr hopkins duncan aye mr robertson aye mr president all right the next order of business is uh a broad action on level three staff grievance board review of any grievance that cannot be resolved at the administration level such requests shall be in writing and will be submitted within five working days following notification of the superintendent's decision any written request for appeal shall be submitted to the superintendent for transmittal to the board the governing board at the time of its choosing shall review the grievance and issue a response within 15 working days jesse green has submitted level 1 and level 2 grievances to the principal and superintendent mr green is now asking for a level 3 grievance to be reviewed by the board an executive board meeting was held on april 5th and again on april 12th regarding this level 3 grievance all right per attached policy gbk dash ee the board can make a motion to do one of the following affirm the superintendent's response to reject the superintendent's response and three modify the students the superintendent's response as follows and it says this is a board's import i have a i have something to comment on okay this is the question before the board do we uphold the superintendent's decision to withhold two days sick pay to this employee or not mr grain was initially denied sick pay because he did not provide medical documentation proving he was sick when he rightfully protested citing policy gcca which is based on arizona state law the administration then came back and denied him sick pay on the basis that they believe he was not actually sick on those days mr greene appealed that decision and now it is before this board and the board is being asked to ignore the initial reason for refusal to pay and decide whether or not the teacher was actually sick when he took sick days was mr green sick maybe maybe not but when he did not was denied pay for not providing medical documentation that was wrong and it should have ended there but instead the administration dug in they doubled down and at what cost to the district there's been meetings between superintendent and principal meetings between staff and administrators consultations with our attorney hours of this board's time all this to sanction an employee who maybe wasn't sick it's a ridiculous waste of time energy and taxpayer dollars and to what end has all this time and money benefited our students and our community not a bit it's harmed them it has distracted both the administration and this board from attending to pressing issues and it has sent a message to our staff that even if the administration is wrong they will try to find a way to win we are losing good teachers not because of budget cuts but because of the way we treat them it needs to stop these are professionals let's treat them that way i move that we reject the superintendent's response and do two things suspend the youth then suspend the use of section 12q of the employee agreement for the reason that it conflicts with policy gcca and that we pay mr green for his two days okay is that a motion that's emotion so spend you see uh 12q of the employee great agreement and pay mr green for two days and it includes rejecting the superintendent's report yeah anyone want to second that motion no guthrie now mr hopkins robertson yes [Music] does anyone else have a motion so that what's left is to affirm the superintendent's response and i'll second it you should go through robertson no glasses all right we go on to um let's go on to business then businesses approval of the governing board policy changes second reading though um conversations had during the january 13 regular session governing board meeting changes to g c h was submitted to arizona school board association for approval of copyright a screenshot of asba policy which is attached asba is also approving the deletion of policy gdch which is a duplicate of policy gcch a copy of an email received from asba approving the deletion is also attached i'm president yes i couldn't find some documents i fear i was unclear this is how we're asking for one vote on two policies and the second policy g-d-c-h is the elimination of that cause which is the repeat of policy gcch what we're doing is our history here in the district has been to allow staff to have and under bereavement five days of leave for death a family member we're talking about close sound they talk about first and second degree um this is not it goes on down the path to the in-laws and so on and so forth but the board policy was not aligned for the last 20 years probably more with uh the uh meeting for agreement the meet and far agreement said five days per death the policy says five days per year uh the gifts i got from the board and definitely from the staff was that they felt more support for staff with five days for hopefully no one has to use it than five days for family death i'll second it aye mr hoffman aye ms and the last item is governing board action does anyone have an item that they wish to be added to the agenda for the next meeting okay um i'd like to request an agenda item uh on our plan for increasing enrollment for next month including any ideas to maintain our enrichment activities such as art music and sports and the second thing i'd like to request is that another month has passed and the board has not been allowed to meet and discuss the employee complaint that we received months ago months ago how can we ignore this we need to meet an executive session with our lawyer in order to get advice about how to proceed with this and um i wanted to propose we discussed um formalizing the system of the survey that was just conducted i think it's valuable that we conduct that survey twice a year at the end of each semester i think it should go out to every teacher i think at the same time end of the semester we should be surveying all of the parents for their satisfaction you know it gives us more information and it gives the community anything else all right then i'd say that this meeting is adjourned at 5 59.

so only a few weeks left there this would be something additional that the teachers would need to complete in order to receive that 33 percent so with that that's covering that a little quickly i know you had it ahead of time i'll be glad to answer any questions or help in the discussion of which way the board would like to go mr croto you had already answered one of my questions and that was with the 100 um what of the three options um have these options um you know i know that they've come before the board tonight but um does the teaching staff know about these three options um madam president uh member uh sawyer sinkbill um yes uh on the 301 committee the way we comprise this every year we have a 301 committee from representatives from those groups so this plan went to that committee had the discussion and this is the recommendations that the committee has come forth with so i'm going to ask you which ones did they happen to lean towards um the committee is leaning towards option one obviously first and they felt that um you know it's been a very tough year our staff has done an amazing job with getting through the year and doing all that so option one was their first one and option two would be their second choice so um that is what the committee brought forward thank you for your honesty welcome i'm more partial myself to option two because it really is kind of more pay for performance since it is based off of their eval those are my thoughts okay what does it take to remain on the alternative performance evaluation cycle what needs to remain yeah as far as like is there some criteria to remain eligible for that particular evaluation cycle you said have being highly effective for three years will get you that option i'm just wondering and that'll always get you 100 of the funding or the and they have continuous evaluations still on that so they have to have a performance at a certain level in order to maintain that as they go through i would agree um with crystal my my preferences too only because i i i still think people should um you know have to they should be rewarded for their performance and i think it's something that keeps them motivated to do their best and um i just think that's a that's a fair and it's in line with what we used to do so i'm glad that i'm glad to hear that employees weren't necessarily looking into option three i'm thinking okay i'm dividing that out i've got a lump sum out by five hours it's like that's a pretty big hour lisa for what was it like 180 an hour or something that would come to so that's nice i mean because it's like that's um that's a little bit that's far off from what we're typical what we typically do so and with that it's also stressful at this time with just a few weeks of school left and they're trying to close it down and do all that so i would agree with you i just have a quick question and i probably already know is it state law as to the positions that are not eligible for this plan is that per state law madam president member grant yes it is state law um it's by funding codes and and mr hicks can do that but currently employees that are eligible have to be paid out of a 2100 code which all our teachers are paid out at but mr hicks can explain in more detail because he is a financial guru but yes there are laws that dictate who can and who cannot be paid out of the classroom site fund uh madam president members of the board uh mr croto sorry uh for interrupting that uh yes the classroom site fund was created when prop 301 was passed 20 years ago and in that was uh currently and we're still living under those rules is you have to be instructional you have to teach in the classroom so it's very limited right now there was a bill that was just past sb 1139 that was collapsing the buckets and it also expanded uh who was eligible so it included as mr croto was mentioning anybody coded to the 2100s as well so it added anybody that's in the student support services area and so from our usfr coding so it specifically references that so that means guidance counselors ots pt's sops psychs social workers are all now eligible if they'd like to be part of the plan i thought they were not i thought they were listed on the not eligible list yeah yes that is for the current plan that is for the current plan that you have adopted for this year moving forward starting next year's plan which we will probably intend to bring to you in a good governing board meeting in may those new rules will apply for the new plan but that plan is in development we will bring that to you for your input and for your approval in the future with the new bill changing now they'll be eligible i do have another question on the equivalent eligible out of the m o funds it says dean of students do we have a dean or are those like principals madam president mchaffin yes we do have teachers on assignment dean of students we currently have one in our district and that is at asante preparatory county we have staffing models if you remember that you approved a couple meetings ago for the new district staffing so it's based on the number of students in the school whether they receive no help for the principal a dean of students or an assistant principal and that's based off the staffing numbers staffing numbers are eight our student numbers sorry stu uh yes student number sorry thank you for the corrections student numbers population student population at the school i'm okay with either option one or option two um i i do agree with um that uh option three would be just a little too much uh to work on for the rest of the school year um and since there's no option four um yes option one or two i'm fine with more than five months and just so i understand option one that's just that's just giving the money no it's not tied any accountability or any criteria it's just everyone gets the 33 no matter what madam president remember pritchard that is correct um there's nothing tied to option number one can you remind me when the the funds are paid out from this madam president we believe that's july um we can look that up and let you know i guess where i'm going with that is if someone were to say not have signed their contract would they still be eligible to receive the 301 funds um madam president they are still eligible it's based off the year the past year so they are still eligible for these funds okay um i'm leaning towards towards option two as well i just i i think that option three is way too much to ask of of our staff at towards the end of the year um i agree that they've worked really hard and they've had a lot of things thrown at them and i just think that now is the time to kick their feet up a little bit and start relaxing and getting ready for summer you know after the after the test season anyway but um but yeah i would go with option two all right so i will motion to approve the revision for the district's pay for performance plan for eligible search certificated staff for the 2020 2021 school year with option two second do you need to reword that at all okay good perfect sounds good so we're at number four yes oh i think that's a sign we've been here too long okay make sure you have action discussions seven and eight added to your agenda yes all right we're on h4 moving to item h4 dr kellis thank you madam president members of the of the board and members of cabinet mr hicks will present this item good evening madam president members of the board superintendent dr kellis colleagues and community members i'm very happy to present on results-based funding here tonight now this will go pretty quick just because this is almost exactly like it was last year dollar amounts are changing a little bit so i'll hit on that and one other part but it is based on the spring 2019 test and so we didn't receive the funding or notification of it until about january and so we're bringing it here tonight but i'm not sure about funding for next year or if there's any statutorial change for next year's because they won't have a z merit to look at this and and provide this so this was legislation passed a few years ago that provided additional funding to those eligible schools the formula is on the next four slides and so really you get a dollar amount based on if you're in the top 13 percent or 20 percent if you're uh free and reduced school above 60 or just statewide so i just went through the first four slides um so it's just that easy and so this just shows the dollar amount so you can keep clicking um you keep clicking and there's also a component for alternative high schools so i just like to show this data just a little bit just to look it looks statewide here's how it breaks out this schools that are have zero to nine percent poverty or reported no free and reduced count so i did modify that a little bit for those that didn't apply and you can see they're getting the vast majority of the funding you can see the line break shows and then that's where money is redistributed based on if you're 60 frame reduced you can see that this is very highly correlated to socioeconomic status so schools where you have wealthy students get more money and schools were not don't and it's just reallocated coordinated at the six percent here's where our four schools dysart high school luke elementary and the 60 to 69 percent and surprise and dysart l in the 70s 79 so just like to provide that context over our results-based funding we received over eight hundred thousand dollars we'll click to the next slide um it does have uh very specific that the majority of funds must be used at the school cannot be supplanting and must be used for teacher salaries hires teachers for school leaders salaries classroom supplies and for other strategies portion of it could be used for expansion and replication of that school site as a quality model so we do not allocate all of it out to stipends for those people at the school or that were part of the school at the time we do reserve a little bit back for some replication and or classroom supplies in that sense go ahead and click to the next so here are the eligible positions teacher interventionist reading coach the principal assistant principal instructional assistant and paraprofessionals we do require the the criteria that you must have been employed in one of those eligible positions during the year in which the school generated the funding and is still continuously employed with the district so they still must be an employee of the district and had to work at one of those sites here is where there's a little bit of change last year um the teacher amount was 2000 and the reading the interventionist reading coach was 1750.
