this is from the bentley you can see that this guy still has its elaborate elaborate um second floor press tin and the first floor um i've got one other photo also that is not in the slideshow but it shows this really neat storefront with a cool spanish tile roof and these extended all the way across the four buildings in the university block on this building you can see where they've ripped off the stone molds squared off the windows made these larger actually maybe they didn't make them larger but they've replaced the the windows the two over two windows with um casements metal casements and then put in a new storefront so even by 18 1928 they were replacing storefronts on state street here's a picture of the same building in 1951 it was still the calkins fletcher drug company but again this is a yet another store front and you can see this one over here had uh one of those enameled steel storefronts that was fallit's bookstore but by let's see oops hang on this is the 1980s but the 80s fallout had taken over both and replaced it with one long storefront the way it is now it's one space on the interior of the two buildings here's what we're left with today there's a pretty simple metal storefront system there are double doors here there's a single door here that's proposed to be made into a double door this section of the building is for the shops downtown and it's not really a part of the application though i have a few concerns about that that i'll tell you about in a few minutes the um the application i should mention is to replace this awning with a new awning as a little sign on it replace this storefront unit up to here with a with a new one and keep this brick kick plate and these brick columns on the sides those showed up i think in the 1950s photo so they are nothing on this first floor is uh contributes to the historic character of the building because it's all post 1944.

come to the microphone to adjust the board hello everyone my name is uh mr chris keegan and i graciously accept the position of vice principal of clifton high school and i would just like to take this opportunity to thank you all thank you dr robertosi president jim smith members of the board of education mr doctor and the entire administrative team at clifton high school 12 years ago i began my educational career as a special ed teacher here in clifton and i had the good fortune of meeting so many colleagues parents students staff members who have all helped me in preparing for this role and i sincerely thank all of them my involvement in the clifton school district along with my educational training has given me a strong background to support both the students and staff of clifton high school whether i was teaching coaching supervising after school programs participating in various committees my goal was and will continue to be providing our students with the most supported positive academic experience available to them at clifton high school i'm fully committed to the clifton school district's mission in excellence in education and i very much look forward to joining the administration team here at clifton high school once again thank you so much thank you [Applause] a little shorter uh good evening president smith commissioners of the board of education superintendent dr robert tosie assistant superintendent mr tegen ms kucelevich my name is robert bertolini and i am thankful for you that you've given me the opportunity to return to christopher columbus middle school after spending the first 12 years of my career in clifton as a teacher and coach i feel as if i'm coming back home although the hawthorne school district provided me with an invaluable experience i always felt that a piece of my heart was left behind being able to seize this moment has brought about much happiness when the agenda was made public i was overwhelmed with the many messages i received from former colleagues it was these messages that reminded me what a wonderful family clifton was and continues to be as i thought about all the students and staff i worked with i knew without a doubt that this was the best decision i am looking forward to working with ms gaber the building principal many years ago we shared a vision of providing an environment for both students and staff where they're where they feel supported motivated and willing to learn and grow it is this vision that i look forward to perfecting from the bottom of my heart i thank you all for allowing me to be a mustang again have a great evening thank you [Applause] congratulations to you both [Music] uh next we have uh finance facilities we have f1 through f10 do i motion second motion motion by miss bassford second by vice president casper discussion seeing none roll call mr abadraba yes mr awad yes ms basford yes mr beltran yes mr canova yes mr daley yes dr danny yes mr casper yes doctor mr smith yes okay next we have uh board member comments joe i believe we start with you today i'm gonna keep comments short tonight but uh i do want to thank all the speakers that came out um and congratulate all the the appointments tonight um speaking to to some of the comments tonight september i know the government the governor removed the uh the virtual options so it sounds like we will be in person and i know that on monday dr robert tosi addressed the crowd and he did say that we would have more of a normal school session which i think all of us really want at this point um hopefully you know this other coven variant goes away or we don't have to worry about it and everything is the way it should be in september and i think that's where everybody is really hoping for um and uh for executive i i think you're very correct that uh we should have some consideration and coming out in these meetings we should we should at least read the crowd and see uh knowing what we have to go back there for and how long things are going to take we we probably should let some of those people speak first um such as consideration for the board something we could do um another thing though that uh i think can help with that is when we were virtual i feel like we had a lot more people be because we're flexible and i know me personally i have kids at home and if i wasn't sitting at this at this daisy maybe i would be home calling in um in a remote session so if if we can take that back to technology again and look further into i know we are looking into some virtual options but if we can look into the option of calling in or having some kind of virtual option where they don't have to actually sit and wait here for us they could do something at home and not have to worry about getting you know coverage for babysitters um i think that would be a good option for as well to address that thank you thank you mr daley thank you mr president i just briefly like to you know mr brisniak brought up about charter schools i'll be happy to discuss that with him i have a long history and have a uh of issues with charter schools the basic charter school that's in clifton it's basically a conglomerate and not a neighborhood school and i can go on and on but i am very concerned about charter schools getting unilateral approved improvement from the state board of education without local input and ignoring our board's comments and issues with these charter schools but we'll get into that later congratulations to our two new administrators we wish you all the best and thank you for putting up with us and staying here but uh great to see you and we wish you all the best in in your new positions also congratulations to our graduates i always one of the best joys of being a commissioner is sitting in the graduate at during that graduation and watching all those 700 plus students get up and receive their diplomas i do have some comments um i'm going to take a few minutes to address remarks that have been made here at boe meetings city council meetings and on social media about project graduation specifically those targeted towards our superintendent police officers and board members who had no role in the subterfuge concerning the wristbands provided to two students of chs by one board member the tone and demeanor of the remarks are offensive derogatory self-serving they only serve to divide and intend to purposely damage the good reputation of these individuals the institutions of the city and the city as a whole they are laced with false falsehoods innuendos and misinformation they serve no constructive purpose and are made solely to draw attention to those who have made those remarks to provide false versa a false facade and appearance that they are the champions of public interest and justice when in reality they are no more than character assassins and have no interest in the truth or facts there is no doubt that one boe commissioner and only one boe commissioner inappropriately provided project graduation bracelets to two students of clifton high school at the behest of one of the students parents without regard to the lawful obligations as a boe member for those who have been criticized the boe commissioners for not taking a stronger action against this board member we do not have the legal authority to do so this is reserved surely solely for the new jersey school board ethics board boards of education are prohibited by law concerning fulfill filing ethics complaints or charges against fellow board members and mr smith in his opening statement was clear on that and i hope all the citizens understand exactly what our position is here let me talk about the superintendent who has been maligned by some our superintendent is a hero through his strong leadership he ensured that seniors of clifton high school had a prom a full graduation and a project graduation to a class which has been denied full high school experience due to pandemic restrictions in the true spirit of ted kennedy's remarks that his brother robert's funeral i like the quote some look at things as they are and say why i dream of things that never were and say why not danny robertozzi embodies the spirit of this statement he not only secured the funding to make these things happen by convincing all board members that this was the right thing to do more importantly he rallied his staff to make this happen i can say with great deal of assurance that the staff did not do this because they had to but they did so because they believe in his leadership and vision for students i lived in clifton all my life i've never seen anyone in this town exclu extrude the leadership and vision of this man shame on those who attempt to disparage this man's character and what he has done for this community in a short time he has been here you are a disgraces community for those who've tried to disparage the superintendent the people continue the people who continue to look at the betterment of the city and decent people here who live in this city know better dr robertosi you are true to those of us who see clifton as a better place for us and future generations also project graduation i also like to recognize commissioner basford for stepping up and helping the commissioner organize it was uh it was a great effort on his part and i know you took a big role in helping make sure this project came off and i thank you for that let me talk about the police officers that were reliant they are there as police officers both the clifton police officers and those from east hanover i also often spoke about responsibility and education i've always talked about a three-legged stool the student the teachers the education community in the school district and the parent these are three important elements of the education of student in this as instance from what i've been told the responsibility of those children's safety especially the two children that drove up there the two students that drove up there is this responsibility of the parent should know better especially in this situation where we're all concerned about student safety in around graduation and other times too but it is a parent that needs to take full responsibility here and to blame police officers for not doing their job and basically i would think they'd have to overstep their bounds if they just went in and asked student or anybody else certain things they have parameters that they have to live under so to to be disparaging to the police officers is also out of line let's talk about board members there was talk about rules dr robertosi came to our board members and says i need the funding to do this i'll get it organized and we're going to make this happen at that point the board of education took over the lion's share and was in charge of the event rules made by other people and organizations were now not in place and we have there was no obligation upon the superintendent or anybody else to make decision otherwise the superintendent was in charge of the operation period nobody else the superintendent said board members can come so there was no violation or impropriety of any sort by any board member they've all asked the superintendent if they can attend and they did so and left so you're getting a picture unfortunately from the naysayers and those who not want to really be truthful about the situation [Music] that board members did something wrong superintendent didn't do his job and police officers didn't do what they were supposed to be that's all false facts bear out stay differently so i'm really perturbed about the tone and demeanor of those who want to be disparaging come on out and be constructive for a change quick character assassination quit tearing down the city of clifton on false and misinformation that concludes my remarks thank you mr daley dr danny um thank you i i will keep my comments brief as i did defend for my doctoral dissertation and um i did pass so it's just been a very very um you know say thank you thank you um i do want to say that in my school districts i have been with seven superintendents and um i have to say that dr robertosi is definitely in for the children and about bettering the school system and making the school system you know the greatest that it can really be so just you know to mention uh what um mr dailey was saying i'd like to say thank you to all the speakers it is a democracy i do want to apologize that we did take so long there i do think that we should have thought about um before we went in to let you speak knowing that there were so many matters and we might be back there for quite a while so i do apologize um i'd like to say congratulations to the administrators on their new appointments and congratulations to the students of the 2021 graduating class make clifton proud thank you thank you mr abu drabbo thank you president smith um of course congratulations dr danny it is no easy task to out after your doctorate especially when you have a whole plate full of things in front of you to eric thomasevich who will be leaving our district for bigger and better things as we see in our agenda congratulations to you this district will be losing an important role in within the administration um and uh wish you nothing but the best uh it's mr berlini mr keegan i know we took longer than anticipated i know mr berlin your wife was here uh please give her our apologies i know she wanted to be here to share in the joy with you uh congratulations to the both of you uh welcome back and hopefully in your new roles you can flourish even further in the district regarding executive session mr smith if we can i know that it was longer than anticipated because of just time out of our control unfortunately because we have to listen to our way to discuss the issues that we're on at hand i guess if we have something get louder i guess if we do have anything on executive session maybe we can start at 6 00 pm instead of 7 p.m at we can discuss it later but just ideas we could throw around um anybody happy 4th of july that just passed it was a it's good to be it was good to be in the park and see people after a year covet um and on that end i do want to thank all the speakers it is democracy at its finest where you are able to voice your opinion and you know discuss at whatever issues you want to discuss about i appreciate all the speakers coming to speak up and again it's great to hear from folks in the community i'm more than happy i've been talking to people about the issue at hand i am not shying away from it um i've been i have been going through a city with my kids at various points but what i don't appreciate is when the issue when the issue first broke out the first photo that came up where my father and my wife when i first got sworn in and this is not to um bring up another topic to put what's at the forefront in the bat on the back burner but when your wife is attacked i stopped and shot because her photo was in that picture i told my wife that person is lucky i wasn't even with her in the parking lot i stop and shop i'll leave it at that because nobody you got an issue with me take it up with me touch my wife touch my father touch anybody in that photo it's a whole new ball game to me that's not a threat that's a promise and if anybody's out there that she didn't wouldn't tell me who it is she said i know this person if i find out it's a whole new book game mr awad thank you president smith um first and foremost congratulations on our new administrators welcome to the family um as you can tell sometimes you know we have family issues up here but at the end of it at the end of the day i always love to say that no matter what storm you know comes our way arguments disagreements at the end of the day we will be one you know like dr robert tosi you know like to say one clifton you know we're gonna have our ups and our downs and you know i me personally my beliefs is to keep my chin up uh and keep on fighting for our students and for our staff and district um just one small comment i would like to say because you know just to piggyback on mr daley's uh great remarks also to mr um just said um you know after the whole project graduation incident um you know i just find it very interesting how my family and myself got dragged into this when i had nothing to do with it and i would like to address it that it is a racial issue that one person of color made a mistake it's automatically easy to tag the other person of color with no facts no evidence and personally i would like to say this live to the public is if you could find an ounce of evidence of my involvement or my doings or my sayings i would put my resignation up but i would like to pinpoint it back with if they are false for rumor spreading and trying to use their little crew to spread these rumors i would personally call that person out to resign and another thing for mr whittles i wish he was still here because i would like to discuss with him about what happened at project graduation because i find it kind of interesting and hard for me to understand after the breach has happened and you know the students were caught and you know the administrators did the proper thing by handling the situation he was in the parking lot for an hour hour and a half hanging out i just find it really really really really interesting after a breach has happened and supposedly they were short staffed and they didn't have the volunteers was it really such a smart idea to hang out in the parking lot for an hour hour and a half but standing up there puffing his chest and saying of all the wrongdoings that happened that night but does not want to take accountability for the mistake he also and for those you know that are so strong behind the screens of computers and phones you know threatening and speaking all this nonsense it's very disheartening or i know our community is better than that you know people make mistakes and they will be held accountable that's why we have law and order people will be held accountable for the mistakes they made but to try to twist and manipulate the words by dragging other people and threatening my pregnant wife and my family now that's a whole different issue i am a person that's extremely extremely vocal i am proud to say a muslim i'm palestinian born and raised in clifton my father and my family members all attended clifton i am someone that speaks up for oppression and for racism i am a proud person that supports black lives matters palestinian matters asian it doesn't matter sex race ethnicity i respect all lives and all backgrounds and that's why i will fight for especially for our students in a crazy world where we try to sweep things under the rug these students are extremely smart their phones that they hold their laptops that they have is infinite information we could try to manipulate and twist the words to mirror some image but they know what the truth is and it's out there and i know many many students see what's going on in this district dr robert tosi's leadership is extremely phenomenal and he is one of the many many reasons why i ran some people say that hey you got a free seat nobody ran but is that my fault nobody chose to run i chose to run is because i wanted a voice as a millennial 27 years old knowing the mistakes that happened in this district when i attended i wanted to represent and uplift our district but i find it really weird that i'm to blame that others didn't want to run that was their choice i did my petitions i did the due process and thankfully you know i got elected i might have got it handed to me but one day is going to come where i have to run my own election and i always said this to all these board members which i love the family members to me and i'll say this to the public if i was not to get reelected that is the public's choice and i accept it i'm not power hungry you know being in the seat is a privilege and i always always remember that my father always reminds me about that and when my time comes if i get it reelected or not i accept it i don't have that egoistic character where i need the throne i need to see i need the public speaking i need the attention that's not what i'm here for i will always be here for for the students thank you miss bassford i hope this works can you hear me okay good so on the agenda he said exactly g said g1 says executive session um if we knew that we were doing this ahead of time board members should have been notified that we were going to go in first we should have made a motion to suspend the agenda and go into executive session if there's information about robert's rules of water and yielding to the public i would like to see that information and shared with the rest of the board jim you said you got it from school board so i'm just curious to see what that says um executive session that long is not fair to this public body um if we we have to go back to the regular agenda and we're going to suspend the remote the remote um policy then we're going to institute three minutes on the agenda for public speaking and then five minutes later on in in the agenda um this all has to be brought back i i really want to um bring this robert's rules of order and this yielding back to policy i want to look into it and really dig into it deeper because it's just not fair to these people to sit out here for two hours and 42 minutes it's it's it's not fair we're a public school this is a public meeting that people should be heard when they should be heard we um i believe mr pacenti started the rule about public session starts at eight o'clock and then the people knew that we were speaking at eight o'clock so um we we are in uh a new new format so let's reconstruct it um board of education petitions anybody wants to take one out you only need 12 signatures you don't need 154 you need 12.

part of the application um that the applicant is not part of the application but he asked if he could add it at the review committee meeting on tuesday night would be to paint this first floor brick the the yellow brick that's on the kick plate and the side columns that's that's something that the htc has to approve because everyone knows that brick and paint aren't always compatible obviously the upstairs has been painted and the upstairs the upper floors are red brick not this blonde or yellow brick so if uh you are so inclined you should discuss it and add it into the motion if you think it's appropriate to paint this modern brick on the first floor this is looking at the left side of the building right here under the it's right here under the the awning on the south column here there's there's a there's there's a thing it was in the much earlier photos also you can see this thing bolted onto the wall they've just worked around it they've there's just there's just osb plywood over the entire facade where that giant fallen sign used to be we have no idea if there's anything behind it if there's any historic materials left or what era they might be from and then underneath that we have a soffit that's also just painted white here's what it looks like when you're standing underneath it the storefront used to come out level um or flush with the other storefronts along the block but at some point it was recessed a few feet nothing historic about it we certainly wouldn't let someone do that now most likely um but since it's here and it makes a very convenient place for a coffee shop to put some tables and it's not part of the proposal to pull it back out that would remain as is you can see the soffit up here there are there are six light cans that you can see here those are proposed to be replaced with new light cans with led fixtures inside um this little l it bumps out further and we don't know what it is i'm going to talk more about that in a second okay here's that bump so this is the the the edge of the the historic front of the building which is right here and then you've got this this box coming out um part of the proposal is to is to basically install over the top of this soffit area with a grooved cementitious board product just to make it look a little bit less cheap and make it make it nicer looking but there's not really anything in the proposal about any of the rest of this box up top except refacing the awning with new fabric so and there are also a couple of light tubes here that really shouldn't stay up there that used to shine through the espresso royale logo here but that's that's really not um that's that's that's actually considered inappropriate in the design guidelines so i'd also like to know from the applicants if those big tubes are going away permanently um lots of photos were provided by the applicant it doesn't make much sense until you really either study the photos or stand underneath it but then it sort of is clearer i do have a problem with the work ending right here where this other storefront to get down into the basement has its awning and its doors if the storefront unit is replaced it really needs to go all the way across i'm not so concerned about the awning but it's going to look pretty silly to have a nice you know fancy new storefront here and then these older doors that that don't match um kind of stuck on here so i would prefer that um that the entire storefront be replaced sorry okay and that this bump that we don't know why it's there and it extends over the right-of-way if that could just go away and just and the awning could be installed um in a more normal manner more traditional floor plan is in there shows the this drawing shows the double doors here that would be added these are double doors it's a little bit wider so i'm not sure which side the brick would have to be taken off of but one of the other and we've got a white awning with ann arbor coffee roasting i think is the name of the business it's a little too small for me to read storefront elevations uh it's just too light the tina green is the color which looks sort of like an aged copper but that's the color of this the metal storefront i think i've talked about the other work that's proposed um from the secretary of interior standards i already read number nine to you from the design guidelines the secretary of interiors guidelines for storefronts it's recommended to design and construct a new storefront when the historic storefront is completely missing maybe an accurate restoration using historic pictorial and physical documentation or a new design that's compatible with the size scale and material of the stark building new designs should be flush with the facade and be kept as simple as possible it's not recommended to introduce a new design that's incompatible in size scale material and color and from the ann arbor historic district design guidelines for storefronts it's not appropriate to install a new storefront that's incompatible in size and material with historic building and the district all right let me back up here a second there's also a window decal sign proposed but that's right here that's small and appropriate size easily reversible i really am a fan of window decals and window painting and uh staff believes that the proposed work is appropriate since both historic storefronts are completely missing thank you thank you thatcher commissioners raffles from the review committee will you please give your reports and recommendations okay i'll start um so once again um staff as has i in my opinion is um characterized the situation um very thoroughly and accurately um so the the um awning um clearly so essentially the the first story storefront starting with the yawning kind of weird wood kind of cladding and the soffit and the storefront not historically it's not contributing from uh to the historic character of the building and it almost makes sense to remove them um and i do i do um certainly um sport staff's opinion around just kind of coming in with a new storefront and frankly even like a new awning well but a new storefront and then kind of leaving the one old kind of worn out door there um so that that's just a question to post it to the other commissioners one thing we did discuss on the field so just noting that the applicant is talking about adding a the um once again that kind of cement just kind of party siding to the soffit just to cover up kind of add oh uh kind of freshen up the appearance of the soffit um however we did have a question around the wood the wood panel that's underneath the awning frame um and miss saturn if you can bring up a photo because it's in pretty bad condition you can see that it's there's water damage it's kind of pain is peeling off of it the uh layers are kind of peeling off so it's not really in the best of condition um so we did talk about hey what's going to happen there and in particular you know if if it's actually removed and there's historic material underneath what would the expectation be would it be to keep you to leave the historic material exposed or um if it's removed and there's like i said historic material and the applicant wants to add a composite sighting is that something that the commission would approve um but he did talk about the possibility of just keeping that wood siding there and just similar to the treatment proposed for the soffit just adding the new um party siding at the at that location you know obviously reinstalling the awning frame and then adding the new canvas awning so generally speaking the the proposal seemed appropriate um as proposed it's not taking away or removing any historic material and in fact it's going to refresh what's kind of tired but there i i did have a question around um if like i said if that kind of wood cladding um is removed from the wall surface and there's historic material that's exposed in my opinion it wouldn't be appropriate to necessarily go ahead and put some put the hardy siding over that yeah well there's there's some good historic photos that can be uh scrutinized and analyzed to see what might be under there uh if they do go that route but i agree with you that um the well i guess they they weren't um it wasn't really proposed in the in the application um and that's probably why because it's just uh kind of you don't know what's going to be back there um i'm i'm very curious to know what's back there but um it's i guess would be in my opinion that uh up to the owner yeah if they want to take that off or not it i i agree with you it's the wood that vertical wood that's um behind the awning is is not in great shape um but i i believe yeah the the word encapsulation came up uh at the review committee we're just well just put something on there um so so there's that and then backing up a sec i would just say like on the one hand this application seems very straightforward because it's just the modern replacement of an already modern storefront and from that respect i do think it is very straightforward where it gets tricky is the fact that you've got two historic buildings and one storefront that's that's divided in a very awkward way that when you're standing there on the site i it you can really feel it if you kind of stand where the two buildings meet and you kind of stand under there you can they've completely removed the the support that would be holding up that um the meeting of those two like the that the coins on the on the um on that one building as they come down you can see they almost meet like the jam of the door and then inside you can even see it in a photo is there's there's like a pillar inside that's obviously holding up a lot of structure there but it's it's a little awkward and so we've had i know that we've had applications even recently that have been two store fronts proposed at once but i believe they've always been very much respectful of two different store you know making it still look like two different storefronts this sort of looks like one and a half storefronts combined together into one storefront and then another little leftover bit and um so it is like without the awning there it would look very awkward with the awning there it really does tie it all together and you don't notice it from the street um but i think that uh you know moving forward and and uh it would be nice i don't i just don't think it's in the standards right that this sort of situation where um if there are multiple storefronts uh with a replacement then the replacement should somehow respect the symmetry or whatever of the fact that there's there's multiple historic structures above to be kind of in language with like this there's literally no conversation you know between the historic uh buildings in the modern storefront but that i think in this case that ship is sailed right because the um the the layout of the building i suppose or or the existing storefront that's there but i think what could be saved is just fixing the rest of the storefront that's there both the soffit and the um the actual storefront doors and windows thank you commissioner and commissioner ross with the applicant please donate your microphone turn on your video if possible and provide your name and address for the record david murphy ann arbor hi mr murphy um do you have anything you'd like to well how are you good yeah i actually have a few things to add here so since our meeting the landlord and the owner actually came to an agreement to replace the whole storefront from end to end so that we were able to accomplish [Music] secondly uh to kind of cure commissioner rocklin's curiosity about what's in that soffit i looked up there and because that storefront used to come out to the street it's actually just exposed wood from the old interior and there's actually electrical run through there it's insulated mostly modern materials other than the structure of the second floor [Music] so no historic brick work or anything like that remains up or is up there in the beginning so there was that um the third thing the tube lights uh those will be removed completely those will be gone and fourth the fiber cement actually in the application it was meant it may not have been clear but that same fiber cement material will run on the soffit and then up the wall behind the awning so i believe those were all the questions that i can answer at this time christopher thanks for that um i'm sorry did you mention the that little bump out part that's like okay yeah so i apologize i forgot that one um that we're willing to remove however where the access panel is to that socket area i wasn't able to see what was in there so if there are some gas lines that run through there and i imagine if the the gas lines or any other significant piece of the building is run through there we won't be able to but we will explore getting rid of that looks like we have just one additional color uh jason would you please on your microphone and state your name and address for the record sure hannah uh this is jason cooper i am the construction manager for the project in ann arbor michigan thank you do we have any other questions for the applicant mr fortner jill had mentioned something about painting the brick on the ground floor at the ends is that ours are you going to do that we would like to underneath the um this current storefront there are some um there's that newer modern brick that we would like to paint a white color um similar to the color above so the building matches and consists is consistent all the way down any other questions i had one you stated that you were you have since the application has been submitted agreed to replace that remaining portion of storefront and awning do you have any updated drawings or design information for the storefront and the awning itself uh no that was done today so we can get you something pretty soon though pretty quickly there's another commissioner kiana sorry about that um i don't have a very clear close-up photo of it but i just zoomed into one of the overall storefront street views and it looks like the historic brickwork just above the existing awning looks like there's a lot of paint peeling and i don't know the condition of that brick if you've looked at that at all and if any of that potential restoration work is included in the scope of this storefront replacement um uh not to my knowledge it won't be included uh at least within this application okay is it something that has been talked i'm just curious like is that going to be an issue with installation um so i'm looking at the photos i see what you're saying on the site it didn't quite look as bad as this photo depicts i didn't notice it as much we are working with the tenant and i think anything above that awning would be an owner issue that we'd have to address but um jason have you had any conversations with the tenant or owner about the brickwork above galloning uh no not at this time okay thank you uh commissioner ross did you have a question nice just to follow up on that on the last question and this is um towards miss thatcher um so if the the owner decided to paint the the brick area above the awning because it's peeling is that something that staff can approve or would that have to come back to the commission i would not have to come back because it's already painted okay if it was unpainted masonry it would have to go to the commission if it's already been painted it may be painted again without any sort of staff approval gotcha and then um just one additional questions minor to the applicant so the the um the hearty um siding that's proposed to kind of encapsulate the soffit and the wall surface is that going to be white as well or what just curiosity that'll be painted uh the similar color to that patina green oh so the the color of the storefront finish right yep okay any additional questions i'll move on to the public hearing portion for 324 south state street christian do we have any callers no callers i'll close the public hearing is there a commissioner that would like to make a motion on the application commissioner rockler let me find it i move that the commission issue a certificate of appropriateness for the application at 322 and 324 south state street a contributing property in the main street historic district to replace the storefront system with a new metal storefront system replace the canvas awning with same and include a new sign on the awning add a window decal sign replace the soffit behind the awning with cement board and replace the lighting with new 4-inch led recessed lighting the work as proposed is compatible in exterior design arrangement texture material and relationship to the rest of the building and the surrounding area and meets the ann arbor historic district design guidelines for storefronts and the secretary of the interior standards for rehabilitation and guidelines for rehabilitating historic buildings in particular standard nine and the guidelines for storefronts support move by commissioner rocklin seconded by commissioner white is there a discussion on the motion commissioner commissioner ross um just cut recommending a perhaps a friendly amendment to add the painting of the unpainted brick the buffer get the first story surface right i was my comment was going to be also about the motion because i guess it says the work as proposed but we've added a few things to the application here so i guess we could say um yeah but i guess what we've done in the motion is list all the things that we're doing so we can add at the end of the list here after four inch led recessed lighting we can say um painting the exposed brick on the first on the storefront level support now there's nothing in here about extending the storefront to include the entire width of the building um do we need to add that into the motion i think it would be a good idea okay so when we say it just says replace the storefront system after that to replace the storefront system including the entire width of the existing storefront support and also we should say we can put this in maybe at the end of after four inch led recessed lighting um oh well i don't know what do we do about removing that part that's over the public right away they actually there's not full agreement in removing that there's agreement to investigate it and remove if there's no essential systems do i need to put that in the motion i think it's fair if you guys leave that off because that's something i can just staff approve follow up on that anyway okay yeah so then the motion does everyone agree the motion is good as amended do we want to say something about removing the fluorescent lights yeah yes move existing fluorescent tube lights yes [Music] thatcher did you get all the i did thank you okay thanks for that and commissioner white well that's a good second promotion support thank you madam chair all right are we ready for discussion yeah i think we captured everything yes it sounds like all right discussion items i just want to if nobody has anything i want to kind of go back to commissioner rocklin's um kind of report in the beginning and kind of point maybe directly to our guidelines from secretary of interior standards for rehabilitation and this is i'd say directly relating to the storefront replacement itself and the design of the storefront replacement so if i read this new additions exterior alterations or related new construction shall not destroy historic materials that characterize the property there are no existing historic materials um the new work shall be differentiated from the old and shall be compatible with the massing size scale and architectural features to protect the historic integrity of the property in its environment we look at this one and i look at um not appropriate for store prints installing a new storefront that is incompatible in size and material with historic building and district i think this is compatible mostly in size and material but i would say i think the thing that i'm struggling with a little bit is that distinction that there are two separate buildings and we are not seeing any distinction in the storefront itself so i look at that guideline number nine in particular and see that there's um size scale and relationship that is a little bit off with the overall sort of difference between the two buildings and there's not really any any way that this new storefront design has addressed that um i think that it looks a lot nicer i appreciate that there's you know a change to to dress it up a little bit but it seems to be you know a replacement of maybe existing with pretty much the same existing design i do appreciate that the there's been you know a change to include the remainder of the storefront itself um that the one person that's being left off but i think that a little bit more could be done to make the the storefront replacement a little bit more compatible with it to design it in such a way that would maybe you know at least try to indicate that these are two separate buildings into separate storefronts um so so that's kind of i guess where i'm standing a little bit and i'd like to hear from other commissioners and see if they have any other thoughts or comments well one of the things that that's that was decided a while back and this is just a replacement and um was in the historic district and when they did do that it's done i don't think it's fair to the owner to have him change that now he's just replacing what's there commissioner rocklin um mr murphy question for you uh is is there a is there like a um a standard sort of window storefront size there that i know it's on the plans it looks very regular but is are you able to put that door where those two sets of doors let's say wherever you want them or do they have to follow some sort of grid layout on the storefront that you're using well they're um being replaced they're just being replaced in place uh the the two doors that are there are just remaining in the same locations and same widths okay i thought for i guess i just said assume that everything was getting taken down and then a new window frame and window and everything was getting put in so it is that's true that's correct uh but there is a um a short wall that's underneath this um storefront system it doesn't go all the way to the ground so that's the the three or five courses of brick there that we're going to paint i think that you're questioning the plan layout commissioner you just look at it and plan i i forgot about the the brick um you know the existing brick knee wall or kick plate or whatever you can call it there and so i mean it's easy to move things around and you know in plan but obviously in elevation there's existing pieces so that's that's complicating things but i just think that um chairperson epperson brings up a really good point and she read the standards and and you know it's i don't know i think it's we should talk about it because um you know and then uh commissioner white brings up another good point you know that they're just dealing with existing conditions a little bit now the existing conditions where you know maybe this is the time to fix it or maybe not but yeah i think that's it's worse than discussion yeah it's for me it's a gray area i was looking at those you know the not recommended or the not appropriate language you know normally we don't if something's been removed you're not you're not required to replace it um and but it is a potential opportunity to correct a wrong perhaps but it's not a responsibility necessarily but i think it at least a very appreciated compromise is to to extend that the full width of the two store two properties to at least make that a um you know kind of unified appearance and system um i did forget about that low brick wall as well because it thought oh maybe there's an opportunity to shift those doors somewhat just to imply a separate storefront but you're right um intrigued by this kind of thought process but i think it really comes down to reading the end of uh the standard for number nine which really talks about you know that new work has to be differentiated it needs to be compatible and the features need to protect the historic integrity of the property in its environment so i think that's what it comes down to for me is that the placement of the smallian or the placement of the doors moving it or not moving it will it really protect the historic integrity of the property that's what it comes down to for me the will it i don't think it does i don't think it does i think a door the door a storefront system that's been replaced and changed and moved with especially with the knee wall in there it's not going to do much for the building yeah i think what's what's above it is much more important at this point and i just uh jump in um so i mean just my opinion um and um my understanding of the standards well um so clearly the the storefront is um if if this building was kind of in its pristine condition if this applicant came or so if the owner came to us today with the proposal to install the storefront it would be looked upon as incompatible but there is kind of the question around okay if you have an incompatible element and you're proposing to remove it um kind of the thinking around with the standards um you can certainly put back something that's new and that differentiates it as new but it still has to be compatible with historic character of the building um so is this removing something that's incompatible and replacing it with something else that's incompatible versus something that's new and compatible but you know still is differentiated as new um so i i guess i feel a little ambivalent um about it i i i mean i i just uh kind of supporting earlier comments perhaps a good compromise is the fact that the owner is willing to extend the replacement um to include the little piece on the end um so at least there's some consistency but i guess that is just kind of a general question i guess i would have around like if if there's vinyl windows in a historic building and an applicant wants to remove the vinyl windows and come back with something that's equally incompatible i think i feel like i would say like oh no if like the whole point of this is is not to support incompatibility um but i don't know it's touching two quick points one commissioner ross is that unfortunately if somebody comes in and wants to replace a final window with a vinyl window they can do that with a staff approval right now it that it is allowed um the other thing is that i've already added just now as you were talking to my list of retreat topics in the future um helping assisting our design guidelines for uh storefronts that span multiple buildings i think we need to talk about it regardless of what happens today to give people better advanced notice and clear-cut guidance on what we're looking for mr brooklyn i think that if this application was asking to completely remove everything that you saw there in the storefront including the knee wall and replacing it then we would be in our right to ask them to replace it in a more compatible way but i think that since they that knee wall is there and they don't want to remove the knee wall so they're doing the best they can by removing you know by putting in something new and nice and encapsulating wood that's looking kind of shady so i guess that's where i'm i'm landing on this one measure camera this was probably a follow-up question for um the architect just for clarification the the other set of doors um to the let me get my directions right just to the south um immediately under the the named awning is is that opening does that brick knee wall is it getting modified to fit that new door double door or does that existing masonry size work with those two doors correct does that make sense it does not get modified so yeah here you go okay the elevation you can see where the ball stops yeah okay so that opening at the of the ground plane that works with those new doors it's not like you're cutting off of four inches or eight inches or whatever correct and actually i think um jill had stated that in her um explanation but that's yeah not true it's um that brick opening is the opening that we're going to use for the doors okay yeah so yeah so that knee wall is pure it's being retained completely yes thank you any other comments okay are we getting ready for a vote actually i just have one more note i just want to make sure that commissioners are okay with um just a statement that the new storefront would be replaced or do we want to see any additional drawings that would indicate what that storefront additional storefront replacement piece would look like maybe david or jason you could state whether or not it would be replacing kind much like the rest of it is that correct yeah that's absolutely correct yeah is the awning part of that as well it is not no just a storefront yep also the soffit the soffit will continue all the way correct and yeah the vertical wall okay storefront soffit and vertical so the portion of the awning that's indicated in the yellow color is that existing awning to remain or is that just is it going to be part of the new awning system but just differentiated from the coffee roasting business that's existing to remain existing to remain and that'll maybe it doesn't even align right now i can't remember or they're not attached right things so if that's another incompatibility that we uh no it's two separate awnings i think i believe even the the aluminum framing underneath is separated um i'd have to double check that but i'm pretty sure it looks like it is from the photos yeah at least there's three separate pieces on the um main proportion portion that you're proposing and then the other piece is also separate the uh the yellow piece is that also an aluminum frame or a metal frame it is yeah yeah there's one photo you can see a little bit and there's yeah you can see sky between i don't know is that maybe a question for the commissioners you know we talked about the storefront system being continuous but how do you feel about that being a separate just the reading of one and a half storefronts i don't know just a question let's vote up or down i think it's a good question jess i think that um it's the quirk of and how the next door store is and and i think we can talk about it at the retreat something that would be nice to figure out i guess because can i cause a retreat i agree with you it doesn't add to the compatibility at all but you can come to the retreat oh and i feel different welcome at the retreat so we love you right that that is a true statement commissioner foreigner yeah yeah i just say i feel different about the awning being an easily replaced attachment to the building than i do about the storefront you know being a part of the thing so i'm not you know the awning is going to change over time i'm not that concerned about the awning over that end piece as i am about the storefront being consistent right there's a different level of commitment so true yeah all right not just one another touch upon that good point any other comments or questions ready for a vote all of those in favor of the motion please say yes yes yes all of those opposed please say no motion carries your application has been approved please note that you must apply for required permits from the city before beginning work on your project thank you both thanks everyone thank you we'll now move on to item f5 711 west jefferson 7-eleven west jefferson is in the old west side historic district it's a two-story queen anne built in 1895 first occupied by john steinke a laborer house remained in the steinke family until 2010 when it was sold to the current uh actually not the current owner but one owner previous to this features a full with front porch would turn posts a two-story cross gable on the east side and textured block foundation there's a one and a half story barn on the property that is a contributing structure and it's the barn that we'll be talking about today in 2013 an application for a two-story rear edition was approved by the commission and constructed um so here's our barn the exact uh date of construction is unknown um the african seeking htc approval to alter the existing barn by adding a rear shed dormer altering the rear inside elevations by adding windows sliding doors and a person door replace four original windows infilling a hatch opening on the front with glass and fixing the hatch open replacing the rafters and re-roofing and installing insulation and re-cladding the structure this is the hatch door that i mentioned um up that's probably a hay loft door and then down below there are two double leaf doors leading into the barn you can see that it's got some pretty severe deterioration on the roof it's very wavy there are lots of gaps you can see light clear through the building when you're looking between the cracks this is the east side elevation you can see it has a single sash on the side here and then three windows up above there is no casing around them they're they're just sort of set into the wall that's the window on the lower level and those are the windows up above the this these vertical strips are unique to this elevation not sure why they're there at one point this whole building had asphalt shingles over as cladding over these boards i'll show you some traces of that in a second this is the rear or the south elevation it has two single windows with two over two windows there's one of those windows and there's the other and this is the west elevation you can see it has two windows that are about equal in size both with six lights and there's a person door here on the side very simple um the there are exposed rafter tails let's go up here in the gable first these boards are really wide they range from you know maybe 10 inches to maybe 18 inches this is serious old-growth wood and very unique to this structure there's a close-up of that gable window that's the lower one there you can see the the shingles the asphalt shingles that used to be on here they just peel them off around the door hinges but there's no sign of it anywhere else in the building except for lots of little tiny nail holes and there again this is the front double leaf door you can see the asphalt in there a couple of interior photos these are the stairs going up to the loft and here's a photo of the loft that was provided by the applicant the review committee didn't go inside it's it's it's presumably not safe on the upper floors this ceiling is severely deteriorated at these rafters on the roof um but you can see how wide some of those boards are there they're they're kind of incredible all right here's the site plan it does meet the setbacks for zoning there are the stairs uh where they are existing now these are the existing floor plans we don't have any proposed floor plans because um they've still got to figure out where to move the stairs to to meet headroom requirements and things like that this is the upper floor all right top is existing and bottom is proposed so um for the existing the i'll get to a profile in a second but the proposal is to basically sheath the exterior of the building with insulative panels and then use new old wood siding in wider widths and install it in a similar way in order to preserve the interior and basically the barn the way it is now but encapsulate it in new insulation and siding the proposal is for all of the windows to be replaced that is so that the building can meet energy code i did have a conversation with a one of the building inspectors about that this morning on a similar project and the applicant was explaining that at the review committee site visit um by insulating the building and re-cladding it and replacing the rafters and putting on a new roof it ends up about seven and a quarter inches taller at the ridge um the after it's redone and it's about 10 inches wider because of the width of the insulation and siding presumably i'm not sure the this window size is the same for both um but maybe this is uh i'm not i'm not sure where this extra panel came from down here but maybe the applicant can speak to that i'm not sure if these doors are getting lower or or if that bit of wall isn't it yeah i think you're right that is a beam that's showing on the profile thank you dave here is the uh west elevation we're going from the two windows on the person door to two pairs of sliding doors and five windows one of which matches the size almost but not quite of the existing window up above and you can see the dormer on the back here it's it's pretty shallow alright here's the dormer on the back here are the two two over two windows you can see the rafter tails they're exposed those windows would be completely removed and a person door and a new this shows a nine over nine window would be installed and then up above we've got a new picture window and side lights in the dormer finally the east elevation goes from three and one windows to three similar slightly different dimensions but similar windows and another one added near it okay here's the profile uh these the the the checkered areas are the new sips panels the new insulation panels um on top of the new wood rafters and new asphalt roof and and rafter tails then here we've got the existing wall this is this is where the wall is right now and then you've got these panels on the outside of it and the the new wood cladding on the outside of that this is the the cross of the window um here is a new header uh i think it's a new yeah it is a new header because it's set in from the old wall and then these are this is the front elevation so these are the double leaf doors on the left and on the right we have a new roll up overhead door this will be inside so you won't see it unless the doors are open so i don't really consider this to be a big part of the application but i appreciate that it was shown because they're proposing to reuse these doors and just re-hang them so that they're flush with the new wall this is a little bit better way to see it here's the existing wall with wood framing and siding and here's the new sips panels and then we've got the new siding on the outside there are window profiles in the packet there are a couple pages of them all right and from the secondary interior standards i have already read to you one two five i haven't read six six says deteriorated historic features will be repaired rather than replaced or the severity of deterioration requires replacement of a distinctive feature the new feature will match the old in design color texture and where possible materials replacement of missing features will be substantiated by documentary and physical evidence and i've read nine and ten to you from the secretary interior's guidelines for roofs it's recommended to design additions to roofs such as residential office or storage spaces dormers or skylights when required by the new use that they're inconspicuous from the public right of way and do not damage or obscure character defining features it's not recommended to change the configuration of a roof by adding new features such as dormers that historic character is diminished i don't believe that this dormer diminishes the historic character of this building at all from the guidelines for windows it's recommended to identify retain and preserve windows and their functional decorative features that are important in defining the overall historic character of the building such features can include frames sash muttons glazing sills heads hood molds paneled or decorative molding of interior and exterior shutters and blinds also recommended to design and install additional windows on rear or non-character defining elevations is required by the new use but that's a question for you commissioners to figure out are those side elevations non-character defining such designs should be compatible with the overall design of the building but not duplicate the administration pattern and detail of character defining innovation also not recommended is removing or radically changing windows which are important in defining the historic character of the buildings that as a result the character is diminished and including a new design that's incompatible with the historic character of the building from the guidelines for district or neighborhood setting it's not recommended to introduce new construction into historic districts that's visually incompatible or that destroys historic relationships from the ann arbor historic district design guidelines for residential accessory structures it's appropriate to maintain and restore historic barns and other accessory structures to match the historic materials and configuration to maintain and repair historic doors and windows on historic barns and garages to match the existing materials and configuration it's also appropriate where elements of historic outbuildings are deteriorated beyond repair to replace the elements in kind it's not appropriate to replace repairable original historic doors garage doors and windows and it's not appropriate to alter historic barns and sheds by using materials configurations and designs that do not match the existing or historic appearance for roofs it's not appropriate to add chimneys coupons or dormers where not appropriate and for windows it's appropriate to repair windows in somewhat good condition by installing new wood pieces or laying epoxy into sills jams and sash deteriorated parts should be replaced and it's also appropriate for windows to replace seriously deteriorated components that cannot be repaired with like material identical layout mutton size glass area and style size to the original insulated glass is permitted when sash replacement is permitted using interior and exterior muttons with a spacer bar that replicates the original window all right let me check my notes here and make sure i didn't miss something um so the wide board siding is a character defining feature of the barn and staff definitely has concerns that the siding um is going to be all new on the exterior of this building um it's it is encapsulating the historic materials and keeping them but visually it it can look almost the same but it it does not match in the way that the the standards and guidelines describe them as needing to match um uh the building also has has been neglected for many years which we certainly acknowledge and appreciate and can observe just from looking at it um it's definitely preferable to keeping the building standing now and refurbishing it in an appropriate way then letting it fall down and having the app the homeowner have to put up a replica of it but the extent of the alterations is substantial by keeping the front elevation as true as possible to the original i think that that work is appropriate though again the original siding would not be on the outside anymore um it's this is a tough one there there are there are a lot of there are a lot of individual items that i may be able to i might be able to overlook if there were one or two but um the extent of the changes and the loss of the historic cladding i think are are two very substantial obstacles to meeting the standards and guidelines that concludes staff's report thank you yes thank you commissioner rocklin and ross from the review committee please give your report and recommendation i'll let commissioner rocklin start okay um okay so i guess first of all just describing the location of the of the um the barn it's i think you can kind of tell but it's set pretty far back from the sidewalk i mean it's it's set about as far back as you can uh on this property but it's also you know right at the end of the driveway and it is it's very visible so it's it's both set back on and also very visible um particularly the front elevation you know like for sure the rear elevation is not visible from jefferson street maybe you could see it from fifth or something like through through another property or something but um and you know since it's wide in the front and narrow on the sides you can see the side elevations also but um but they're not um they're the the front elevation is certainly the one that you're gonna see more um i guess you know i was um i was very confused by this application um when i was reviewing it um just because i was kind of coming in with my own assumptions as to how i thought this building was going to be um uh rehabilitated and it was like inside out from what i was expecting so it took me a little while to um to actually realize what was going on here um and so um so yeah i mean the um i think that'll just be a real i mean we could go through standard by standard on this one i think and have a really long discussion as to um you know what what we should do and and how we can you know talk about this um this uh this design because it's really clear that the application you know there's a lot of thought um behind the application and it's it's not like random thought you know it's thought based in uh concepts and theory and and um you know and rigor um but it's it's hard to um to then uh say that i i feel like a lot of it as you heard in the staff report and i'm agreeing that it's a lot of it is actually clashing with the ann arbor guy you know historic guidelines so um i think it'll be uh an interesting uh discussion i i also i think that the um it's important to note that um and just one more confounding factor is that the the quote-unquote new cladding that you're that you will in fact see from the exterior will be salvaged from uh you know historic barns so that just even confuses things even more where it's um you know uh well is that new cladding it's salvage cladding so anyway to me that that that um it should be part of the discussion um i guess i'll just agree with miss thatcher's last point too where it's like it's it's um it's really great that the homeowners are you know moving forward on on a project here and so you know i'm i'm really hoping that we can we can you know support them in getting uh something done um you know whether or not it's this i don't know but i just want to throw that out there before the discussion that it it is great to see um you know some someone moving forward on this much needed uh property on the old west side historic district okay and and i'm i'm going to be really brief just to allow for time for discussion because that you know obviously that's going to be necessary expected um but just just a second um essentially commissioner rocklin and staff's um statements and and assessment of the situation um i mean it's a building that's clearly kind of catches your eye from the public right-of-way um it's definitely unique and and it's kind of sitting there with this really great sighting that's clearly character defining um kind of has it all and um i i yeah i have several issues with with um the work is proposed i think in a general sense i think the design intent is great um especially speaking with the architect and and understanding what he wants to do um so i'm not i i don't have i'm i'm not questioning design intent um what i am questioning is i i just don't think it meets the standards so i just i just think within and so our district there are some issues um as we are literally required um to apply the to apply the standards when we're looking at at applications so it's not necessarily saying oh no this is a bad idea this is a bad proposal the design intent is terrible it's just in my opinion a lot of the elements individually and as a whole are not necessarily in keeping with the standards so i i will be quiet so we can further discuss thank you commissioners with the applicant please unmute your microphone turn on your video if possible and provide your name and address for the record so um my name is chuck bolton i am the architect for the project and craig holland is also here you can see him he can say hello and sarah robbins might be there as well and um no doubt what we put before you is a bit of a challenge um but i'd like to also to add to some of the things that were stated that um puts it into a little bit of um a different perspective um first of all um just because i just sat through you know four other discussions of of buildings where you used words that occurred to these buildings in the past like maintenance upkeep freshen up modernize uh refresh what is tired um these are all of the things this building was never afforded this building was built for animals probably horses and wagons i don't know that i would call it a barn but that's okay um and and its maintenance was as minimal as possible as um you heard from jill they nailed asphalt siding onto it asphalt shingles onto it just to keep the weather out of it a little bit they really didn't care and i know that we all fall in love with these wood boards because i do too and i can't buy an 18-inch board today very easily is only really i think only one on the building um but the people who built it really did not look at it that way this was a straight-up utilitarian building inside and out but what's interesting is and then of course because of that and it hadn't had any maintenance um it doesn't it isn't afforded that current life of being close to being usable um so in order for us to use it for habitation we have no choice but to insulate and i'm basically left as an architect with two choices i can insulate it on the inside and in doing so i will destroy 80 to 90 percent of the structure i will have no choice i will encapsulate it nail into it cut through it shim it all those things the inside's not flat the boards are just picked from different places um and that doesn't seem like a very preservationist thing to do alternatively i can insulate it on the outside and when i do that i can salvage 100 of the building that isn't rod 100 now on top of that i can even salvage some of the stuff that is rotten because i take it out of the elements where it will decay even further and that is the siding i don't care if my interior siding has some rotten wood in there it's not doing anything and it will not continue to rot but if i leave it on the outside of the building it will continue to rot so i have to tear it off and replace it with something that's going to withstand the test of some time in doing that i meet the secretary of the interior standards for destroying nothing and in doing that i also meet the secretary of the interior standard for having the entire thing be reversible in the future you can take the panels off that is absolutely 100 true and i've done it numerous times to other structures that don't have to go through htc standards so i don't have to necessarily explain that to a group so i do contend that the um that the people who envisioned how these buildings could and would be salvaged over time never conceived of what i'm talking about because it wasn't on their radar and i've seen buildings that have been insulated on the interior timber frames and the like as a matter of fact some of you may know of one that just recently was removed from our world on scio church road between zeb and parker it sat there for the last 20 years and the interior was a timber frame and it was all insulated on the inside and i was asked on numerous occasions how can you save the timber frame and i couldn't come up with a way to do it because they goobered it up so badly there was nothing i could do and saving timber frames is something i do so um as commissioner rocklin said there's a lot that we could talk about here i i consider it to be a very interesting subject i i lament that some of the um the people who envisioned how we should go about saving certain old things didn't think about everything that we can think about today but um i just find it um troubling to throw all of this um fine material that would make for great finishes and be really beautiful on the inside um and to encapsulate all of that um in the name of standards that were written that really didn't foresee this kind of building so with that i'm happy to take any questions oh there was one very fine detail that keeps coming up that hay door on the front elevation it got raised up because it splits the floor system meaning it's half on the first floor half on the second floor that's kind of a dangerous thing for me to leave i'll have a hole in the floor and so we moved it up so that it um it can stay but i can't have a window that goes between two floors that's why it got moved but that's a detail craig is there anything you want to add thanks chuck i appreciate it and thanks to the commission for considering this structure i know this is a tricky one we purchased this house about three years ago in 2018 and just in the three years that we've lived there we've seen just innumerable damage to the structure just from the elements from we've evicted raccoons from this structure we've evicted uh stray cats from this is this structure we've had water damage we have shingles that fly off the roof in every single windstorm uh there is water pouring in whenever there's snow on the roof we've had roofers come to the building just to see if we could shore it up so that we could prevent the roof from caving in and no roofing company would take the job because they felt it was too dangerous without completely reinforcing the structure um and we really want to save this structure it's really important to us we we agree that it adds a lot of character to the neighborhood and we want it to be functional um and not just as a place where we store things that we don't care about because they'll inevitably get damaged um and we also think that the way it currently is i mean it sits you know there's a dirt floor and there's a there's basically no foundation it's just sitting on um cement blocks uh it's a it's a hazard it's a hazard to our family it's a hazard to our children uh we don't want them playing in it we won't let them in the structure um i wouldn't let anyone up in the loft space there's been so much water damage in the last few years i'm afraid that the floors are gonna rot through and and yet at the same time as we said in the you know in the application this is an incredibly charming building that we think deserves to be saved and repurposed for something that um will stand for for another hundred years hopefully uh or more uh so we i look forward to the discussion and happy to answer any questions so thank you for considering it and if i may add one quick thing just to make sure this point is really clear what is clearly demolition by neglect is not the current owner's fault things have not happened to this building for decades and these guys have only owned the house for a couple years um so i just want to make sure that's clear thanks chuck and there's one other thing that i also want to add is it there the wood is clearly rotting and i i know this because the wooden peckers love it the carpenter bees love it um they come and peck on this thing you know all summer i'll fall uh so this this will slowly erode um over time you know these these panels i don't think it was really actually accurately captured in the um in some of the photos i mean in the last rainstorm that we had a couple of weeks ago we had water on the interior of the building you can see along the lower panels i know [Music] david jennifer you were able to visit the building i don't know if you saw in the lower panels there as you walk around the perimeter there's clearly water damage all around the perimeter of the building and i suspect that that will just continue to seep upwards over over time in addition to the water that's coming in from the from the roof so yeah we we think that this is a safety issue but we also want to do as much as we can to preserve preserve the structure and ensure it's used thank you both commissioners do you have any questions for that mr rocklin there's no um there's no floor plans uh new floor plans as was noted but it can either of you just describe uh what the program like thinking floor plan wise like what's the program of each level that you're proposing um the first floor will be there'll be one sort of um gathering space and a storage space so it'll get split down the middle um the stair will most likely run north to south um where right now it runs east to west um and upstairs will be a little work area i mean nothing's very big in there and a small bathroom um will also be added so it'll be a workspace for a couple of people and a bathroom and call it a conference room sitting area downstairs a place to sit around a table it's an office for sarah that's correct it will be both both my wife and i work from home and even before the pandemic hit and uh we um we only have one proper office in the house so this will be a second office for her business and i talked about earlier by the way for using your first names uh david and i are friends but uh commissioner rock commissioner russ so apologies uh i have a question on the section detail so i don't know if you can bring that up jill so how will the sip stand alone from the rest of the structure will it be its own structure separated from the existing barn quote barn i'm not sure i completely understand the question it sits on top of the existing or replacement rafters i don't know that will salvage any of the rafters some of them are clearly not salvageable um but so there's no there is no substructure holding you're relying on the structure of the existing building to hold this sips in place no they'll be the sips roof panels will sit on the sips wall panels which will sit on the foundation the section the right the section you're looking at is to the overhead door so it doesn't show the sit panel the sip wall panel coming all the way down to the foundation because this is through the openings but if this section were just through a common wall section there would be a sip coming all the way down to the ground does that make sense yep and then the foundation you would mention hitting the energy code so i don't see insulation around the foundation the footings the force lab or the footings um i'm also getting guessing you're gonna add some water infiltration and drainage around the footings yeah so this this this is meant to be this isn't meant to be a construction drawing i just put it together to communicate to this group um it's very much putting the cart before the course to have construction drawings this early in the process so yeah all the details are not in here all right so i guess what i'm making sure that we're checking is that the existing structure would stand alone in quote inside of the sip perimeter yes so there'd likely be a ridge beam up at the top of the gable as well along the ridge of the no well if the raft we would there's a couple of ways of doing it structurally speaking in all cases you would not see a thing we can put a ridge beam inside the sips panels i'd be more likely to put um rafters in between the slips panels from eve to ridge and have them oppose one another just like the rafters do but more times than not when i do this i can the math is there that the sips panel will span from eve to ridge by itself without any additional structural support um and basically it's not a common thing that architects see in the 21st century but most buildings in the 19th century didn't have ridges at all meaning structural ridges yep so the the sip would have some internal bucking to it but it would still need a ridge beam running the length of the sip where they meet at the ridge correct possibly if i have too much thrust at the walls yes but i there again there are methods by which i can knit that together um but you would never see it okay yeah so i'm getting this is certainly the profile at the ridge making sure that it looks the same so to speak i mean it's not going to have the nice dip well we could we can build that but yeah that's really hard this is hard to do but be fun um okay that's all my questions any other questions from commissioners see anyone so again move on to the public hearing portion for the application so this is a opportunity for persons to speak up to three minutes about the application at 711 west jefferson street do you there is a caller no callers have indicated just a quick reminder if you would like to make any public comment on this application at 711 west jefferson and press star 9 on your phone looks like we have anyone so i will close the public hearing portion um would any commissioner like to make a motion on the application commissioner beason i move that the commission issue a certificate of appropriations for the application at west jefferson street a contributing property in the old west side historic district to alter the existing barn by adding a rear shed dormer altering the side and rear elevations by adding windows sliding doors and a person door replacing four original windows and filling a hatch opening at the front with glass and fixing the hatch open replacing the rafters and re-roofing and installing insulation and re-cutting the structure on the following condition that the exterior cladding matches the materials and dimensions of the existing woodward cladding as conditioned the work is compatible with exterior design arrangement materials in relationship to the house or to the structure and the surrounding area and meets the city of ann arbor historic district design guidelines in particular for residential accessory structures and roofs and the secretary of interior standards for rehabilitation and guidelines for real but rehabilitating historic buildings in particular standards one two five six nine and ten and the guidelines for roofs district or neighborhood settings and windows support move back mr beason seconded by commissioner white is there a discussion on the motion yeah so i guess right off the bat i'm wondering if the description of the motion of the work describes it differently um only because to me this is not it's not doing a this is adding a skin to an existing structure right it's adding a new build new structure in front of an existing structure um and while it's still replacing windows and adding sliding doors and windows too i'm wondering if that needs to be differently phrased because it i guess those openings are still being added to the existing structure so maybe it fits i'm thinking aloud too just on the motion just the phrasing of the motion i have certainly lots of other thoughts on how it fits in with the standards but should it be phrased differently which part of the motion right at the beginning um where it says uh to alter the existing barn by adding a new structure outside of the existing structure because it doesn't really mention that at all and i feel like that's a pretty significant component of this application yeah it says installing insulation and re-cladding the structure you could just describe it as install installing insulation exterior to the existing yeah we could even say in adding exterior panels structurally insulated panels encapsulating the historic structure existing here encircling closing the historic structure and that can well so jill that's kind of the thought process on the motion itself if bob would accept the yes amendment of it um jill do you think you have that then in terms of basic discussion we weren't too clear about it but yeah you weren't too clear about it i'm not going to be clear about it but i mean i've got i've got the the part about striking insulation and changing it to tips you know not um an acronym um reclining the structure uh you you wanted that we're putting in in an envelope putting the structure in an envelope that's exactly what we're doing yeah i was i was thinking about saying at the top where it says um a contributing property in the old west side historic district to alter the existing barn by adding a new structure to enclose the existing structure which includes a rear short rear shed dormer altering the side and rear elevations by adding windows etc etc and then when it gets down and then when it gets down to uh the phrase that says uninstalling insulation and reclaiming the structure maybe it says replacing the rafters and re-roofing well is it really replacing the rafters or is it is it sistering them and adding additional structure chuck can you answer that if i could unmute um to be honest most of the rafters are rotten through so we would be replacing them but we would be replacing them with timbers in kind um yeah okay so that's fine and then i would scratch the re-roofing because you're actually you're putting a new structure over it that's actually has new roofing on it yeah not re-roofing anything right replacing the rafters and installing a new roof yes okay with new roof no installing a new roof structure and new roofing how's that okay and then i think i think you would just scratch the and installing insulation because we tried to capture it at the beginning where we said to alter the existing barn by adding a new structural enclosure okay got it all right do you want to read it back um so after we struck installing installation we're also striking recladding the structure correct well it is actually part of adding a new structure to enclose the existing structure yeah and i think it's well the new structure will be clad on the following conditional material yeah yeah okay okay wait on the phone okay so we've got um contributing property to alter the existing barn by adding a new structure to enclose the existing structure by adding a rear shed dormer altering the site in your elevations by adding windows sliding doors and a person door replacing four original windows installing a hatch opening on the front infilling a head jumping on the front with glass and fixing the hatch open replacing the rafters and replacing the rafters on the following condition that the exterior cladding matches the materials and dimensions of the existing wide board cladding that's actually this was before the application was revised it now indicates on the application what the board width could be and chuck i'm not going to find that quickly so if you know it off the top of your head i'd love to hear it it's on the section drawing i think that's uh drawing six asics um the siding is i mean the sighting at that point obviously can be what we want it to be um i have sources for old materials i can pretty comfortably promise to get wood boards up to 12 inches and it it's the way it is written is that the boards would be unpainted as they are today um which i can source um the if we were to be able to source wider boards um that would be great but i don't know that we can um that that's just you know a shot in the dark um right no that's good um so that the exterior cladding matches the materials and dimensions of the existing wide board cladding no no less than 8 inch and 8 inches in width or no less than eight inches wide okay you good john i think so good are you good with that now discussion are you want me to dive into that now i can dive into that um so this is funny to me in a way in a weird way and funny in a non-comical sense but it's like all the standards i'm reading through each of the standards and right off the bat i was like well this is this does not meet the definitions of any of them but at the same time it meets all of them and it meets all of them mostly because the key words that it uses is about to re to be retained and preserved it doesn't say it has to be visible which is weird to me like if we have an historic building that has historic character and historic features it's just as that that those features have to be preserved and retained and oddly enough it doesn't say that they have to remain visible but it is what characterly defines this this structure is these these existing boards so if we're replicating those boards on the outside of it does it still look the same as it says still the same color and texture size scale relationship you know all that fun stuff so that that's where i'm resting on each of these standards um is that it all talks about the architectural features of the of the structure and how that has to be retained and preserved i'm throwing that out there right off the bat that's the first thing i was thinking too was looking that that whole list and i think thinking it was funny also because uh you know the one thing that i was stuck on was number 10 about being able to remove it in the future but we heard uh early on in the discussion that that actually uh i thought that was gonna be my roadblock uh for whatever reason and um it sounds like we've got assurances that in fact this type of thing can be removed um i think that it's can we try a little trick it's hard to it's hard to imagine but let's just say that we can imagine that that um that you could remove this in the future but i i just wonder about those standards like when they say all those things about preservation do they do they intend that as preserving it just for the occupants of the building or when it's in a when it's an exterior element does it mean that it's being preserved for the ex people experiencing that building on the exterior i mean we just are seeing the standards here in my head i've always thought well you're preserving it so that people on the sidewalk can see yeah that has always been kind of the the test and now that's being challenged um which is that's why this project's so interesting i think i think that there's if you look so if you just look at like the the the 10 there i think this is an interesting discussion i think if you if you drill down into some of the other you know more detailed recommended versus not recommended then we've maybe got some more uh direct conflicts in terms of window openings and that kind of thing but i'll let someone else chime in before we get to all that but it does save the building it's by doing what they're asking this saves the building if you if you want to take the wood off that you just put on there the building's going to collapse eventually yes it will i look at i think one of the big ones that stands out to me is number six uh the deteriorated historic features will be repaired rather than replaced where the severity of deterioration requires replacement of distinctive features the new features will match old and design color texture where possible materials i mean i think we're clearly at a point where most every single feature on this structure has deteriorated beyond a point of repair but there's still an attempt to repair and replace i think to a large extent um i think my my main question is to what extent do we feel like it is actually meeting the replacement of those features and i would say on some elevations i think it does a much better job than than maybe others particularly you know the the i think it's the north elevation where the entire facade becomes changed but i think there are still a lot of character defining features that are i think attempted to be maintained and rebuilt or repaired in a very similar fashion as much as possible commissioner yeah so right in the number six as well it you know it talks about um require when something is deteriorated it requires replacement of a distinctive feature the new feature our new feature is like this entirely new building around it and the new feature does match the old in design color texture and whatever possible materials that's what makes me laugh because it does so yeah i look at this and i'm like okay it kind of meets it and you know to me i had roadblocks right at the start same with the commissioner rocklin like ready to start going well no this this is by and large obscuring character to find new features um yeah that's threw me off we're trying to look through this thing that through the standards of course you can tell um so i guess just jump in you know frankly i'm not convinced that the building is or the i mean the elements in terms of the windows historic windows and the siding are deteriorated beyond repair like literally to the extent that all of it needs to go i'm not convinced of that so i i won't be supporting this project i i think it's a slippery slope um yeah so i won't be supporting this project i don't want to take up a bunch of time but i i yeah i think standard number two standard number six um some of the some of the uh guidelines i you know i think the i definitely do um appreciate the location of the dormer at the rear elevation um i i feel like we're just really trying to back bend into this um so i i won't be supporting it commissioner rocklin you were also inside could you speak to your to the deteriorating fabric you do you agree with commissioner ross were you able to observe i think that what was said before about um anything that's like i don't know 12 inches to grade has a lot of rot as you'd expect you know it's just like bare wood getting splash you know splashed on by rain for a century and a half or something it's that that part is certainly deteriorated which is sort of ironic because that's the the doors are the one thing that's talked about being uh you know preserved as is and move forward into the new structure but you know to me the the doors are probably the the most rotted out pieces i mean we weren't able to go inside so it's hard to say but i mean it it just i i can't picture how this wood that's existing is going to be any different than the salvaged wood that's going to be replacing it i mean how i that's why i'm sort of confused about sort of the the plan here and and why you know if if we're just cladding it with basically the same wood then why don't we just use the wood that's there as the cladding uh yeah i mean that that was confusing to me i i guess i it looked um i would be more worried about the structure i guess than the cladding um again we we couldn't go in so um it you know it varies and and it's on it's unfinished wood you know it's it's unfinished wood sitting out there in the weather it's old wood so it's actually held up you know way better than anything else you know today would would hold up but um yeah i mean i guess those are the two questions is like well why are we you know saving the doors if the wood's not good enough and we have to re-clad it it's a little talking out of both sides um with that can i address that yeah please the doors can be saved because i can take the doors off that they're they're just three quarters of an inch thick wood boards with a bat across the back i can take them off and mount them to a substrate that will be substantial enough for them to be used and not fall apart um it may be possible for some of the windows to be salvaged and put back in um i've had a difficult time getting the attention of the few people in the area who do that kind of thing to tell me if these are worked too far or if they can be made to be um if they can be salvaged but they are some of them the double hungs that are in there for example are wedged and nailed on an angle and the sills are rotten and you can see them and the the sash bottoms are rotten and things like that so it may be possible for some of them to be saved i then have to then fight through the energy issues and um those sorts of things with the building department um but the goal was to salvage as much as possible we're not trying to throw anything away without consideration um try to keep this as organized as i can a couple thoughts going through so um kind of big picture this discussion of you know preserving the experience from the inside versus the outside um you know i don't have the exact language in front of me but my understanding is that for the secretary of interior's standards and as the city of ann arbor's commission historic district commission our purview is the exterior not necessarily the interior um so how that plays into that whole discussion you know if that's a true statement maybe i just was assuming but um how that factors in uh check the way you describe the the salvaging and reuse of the doors is that is that possible as a method for salvaging the existing exterior siding i mean i i also had a question about you know what what is different about our existing siding versus someone else's old siding in terms of it's probably got some holes in it from woodpeckers and carpenter bees and it didn't look like it was going to be treated in any special way you know unless i missed it in the documents but is that something that was explored for the siding and then it looked like yeah all of the windows were going to be replaced maybe not custom sizes to match the existing um but was is that truly necessary [Music] from the photos i wasn't on site so some of them didn't look in so far gone but maybe maybe they are do they all really need to be replaced and if so do we need those to be documented for requirements for replacing existing fenestration or windows oh chuck i think you're muted sorry if i can remember everything that you said and if i don't please tell me um to take the siding off and to insulate outside the framing and then to put the siding back on unfortunately the siding is about a foot too short now because the building just got fatter um because the insulation is going to be roundly you know i put four and a half inch sips panels on it so i think jill originally said it was like 10 and a half inches whatever the overall thickness is i don't have i can't make those boards any longer than they are so i would have to now every board would need an extra 10 inches added to it or one board on every level would need an extra 10 inches somewhere um or you could use those boards to re-clad it not in the exact same pattern that it's already in yeah do you split they're going with additional salvage boards right and as i said before so when we so so that's the other aspect of this when we salvage material from an old barn those pieces that are rotten get thrown away and those pieces that were in places that are um that didn't get rotten uh can be reused in this case i also have a building that has i don't know i'll guess 20 percent all the bottom boards are pretty punky um i can't clad with those either on the outside because they will fall off they will they will fall off the nails um so i need sound material so that it can be clad for the next 50 years and i'm not sure if you were headed to this one jess but the i new material i think you might have been trying to say you know why can't we just like use new material or something and if you were saying that it's because the new the new wood we get of this size is farm raised and it's not going to last no i wasn't implying new material sorry if i stated in a confusing way connected to the wrong dots um no i want that old material yeah so but that is yeah i just trying to understand yeah right when it's salvaged from the old these old barns you know depending on the barn you might get 50 or 70 percent of the siding is good and sound just you know luck of the draw was on the right side of the building um they didn't have trees growing along it they kept their gutters on i mean a thousand reasons why wood does not rot plus if it's a tall barn barns are usually 16 feet tall this building is much smaller barns around here are 16 feet tall mostly i get 16 foot boards out well i don't need 16 total feet so i can cut the rotten end off so i can get to pretty sound material by sourcing it through these means that we have but i can't magically make the material on this building sound again that i can't do did i miss anything so i don't know if anyone else wants to continue the conversation about the siding but the window the condition of the windows that in the locations that either are being more or less maintained [Music] but they're getting replaced is that truly necessary as i said these windows were very much um for their day they were nobody was worried about making beautiful windows it was a building for hay and horses um they're okay sashes that have not been maintained at all um and and the entire window is all is within a three-quarter inch you know it's set within the studs and the three-quarter inches so it's not they're not deep they're not for the most part the jams are probably gone the sashes might be able to be salvaged and put into new gems and we can certainly look into doing that um and we'd probably then have to come back and talk to you about storm windows because i won't make i won't meet um my energy requirements more than likely and yeah i mean we talked about storm windows often i know and it's it's a judgment call as to um you know how compassionate the building department will be with the building like this because as we are challenging you you can rest assured we'll be challenging the building department too well i appreciate the your response i'm still trying to reconcile all these different pieces um that make up this project bill is it is it possible for me to share my screen for a second it's not right now we have two hosts already okay um see that the the downside of having these meetings electronically is i can't walk in and show you something um but i also can't put it in an application without a lengthy explanation that just gets complicated because it's not the same project but i can show you examples of where we've done exactly this um taken old frames old buildings um and clad them um and truly the only thing you do to the existing frame is put a screw in the backside of the framing that isn't seen and there's a whole lot of fasteners in the backside of every piece of framing in this building now that's the only contact that we have with it we literally wrap the building in black paper and then put the sips panels on so you could there's no adhesives there's no sticky insulation glomming onto the old building you can reverse it pressure rocklin um can you describe uh some of the like uh one one thing that's particular to the standards is if you have an existing window um then try and save the window if the window is rotted or beyond repair or missing or something like that then uh the historic opening is still sort of a character defining feature of the structure and we try and you know just preserve that opening uh as a way to you know keep keep just uh some some aspect of the historic property so um it it seems like you're sort of we're close to doing that but then in in a lot of um in a lot of the elevations like the even the existing openings are being slightly changed or drastically changed so can can you maybe can we look at the elevations and and talk about uh just the thinking there and and um you know what what the reasoning is so we can we can you know reference that to the standards and see see where it sits sure so this is the north elevation the intention was to keep it as similar as possible as i say the um the swinging doors do not change in size the um hay door just got moved up so it's not in conflict with the floor framing and then on the so the west side which i believe is the next one um if you could go back one well that is the west side the west side is into um craig and sarah's backyard and they wanted a relationship between um the yard and the interior uh so yes this one is changed more than the others um but you really cannot see this from anywhere um except the neighbor's yard to the east of this um you can't get a glimpse of this from the street the two public checks and check try to interrupt them it seems like that this would therefore require a lot more framing on the existing structure to make that big opening it would require some more it would require disassembling the existing framing oh no giant header across the top but the header the header that'll all be in the sips panel i don't need the interior framing for to do anything yeah so but if we let's say we open those bottom doors right those bottom doors would be open and the framing of the existing structure would still be there or it would be removed ah um where it would conflict with the doors the framing of the existing structure would be removed and therefore you would have to put in a new header and box it out on the existing structure uh no because there'll be no weight on the existing structure it just has to hold itself up so you'd still have to cut it and put a top plate in with jack studs right uh i'm not 100 sure that we have to do that well we can't just hang well it can't just hang there i mean no but i think so along with the rafters being rotten the suspicion is that some of the loft framing is also rotten um we can replace whatever is rotten with loft framing that's long enough to bear in the sips panel but that's all interior stuff but in the end i wouldn't i'd be altering that as little as possible it would be as quiet as it could be yeah so jill can you put your mouse your put it down at the bottom of the door so we've got yeah so right there and moving straight up uh what 16 inches on center for 20 inches on center we've got balloon framing for the existing structure that's running the full length all the way up to the top of the existing roof and all of those would have to be cut out in order to make this opening clear and wide regardless of where the sip is in front of it right right and where those are all cut we would have to put a a plate a header plate and jack studs to hold up the weight of the existing old structure from falling down completely so that is pretty intensive to me and changing this opening okay so that i think has some issues with the secretary of interior standards for oh what part is this basically it's in openings but it's um jill you didn't have the openings part in here but there's another segment that we have about openings door openings but john is it isn't this like if you build an addition in the back well you got to get to the addition so you cut a big hole in the back of your house so that you can get to the rooms in your addition i mean yeah but isn't that sort of like this here or yeah but except that we've got historic structure that we're trying to maintain and in my mind a large part of being okay with this because we're trying to encapsulate the existing structure is that we're trying to maintain as much of the existing structure as possible we're kind of like putting it in a shell to encapsulate it and take care of it but here on this elevation we're cutting out most of it yeah the overarching argument or case literally has holes punched through literally as holes fans yes yeah so and that's just a big opening so that's one of the elevations let's go to the other ones too before before we go to the other elevation i i think that i don't really have any issue i think with the big opening i mean it's big but um i get it because there's program that's calling for it i mean there's this you know program of like this indoor outdoor uh you know you're gonna be doing something inside and outside there and so you need a big opening um but i i'm a little confused as to why it it looks like we've got a a window up in the gable there and then we've got a new window in the same gable but it um it's like slightly moved maybe and slightly different size which means that i don't see a good reason for you know there's no program that i know of that makes that window be slightly moving and slightly different size yet you'll have to manipulate the that existing cladding that we're trying to save it's going to have to grow on one end and be cut on the other end um so i i don't get why that window isn't you know exactly the same rough opening as the existing it's am i muted nope you're good oh um and you're talking about the window i can't read the numbers the highest window on this elevation the highest winner in this elevation um the windows the new windows were selected from the list of standard sizes from the manufacturer um it is in the same place um maybe it's due to the trim underneath it in the siding that it appears to be different um the intention is that it is i mean it's a the window's centered and it's intended to be in the exact same place sounds good um it has a different size it is a slightly different size again because the manufacturer makes them certain sizes um and you pay for a window and a half when you change a custom size um and the windows currently um i keep trying to use my cursor to point to things it doesn't work does it uh though up the window um the high window currently doesn't have casing on it um when we case it i can cheat and hide a little bit of the boards that might not be there um so we can we can deal with the little bit of dimensional change is is the lower existing window it doesn't look like they're exactly the same size but comparable and that looks like it's got some casing on the outside is that in decent enough or salvageable condition that it could that could be used on the top floor you know like it's that's the up yeah the lower one might be able to move up like if we're gonna have to modify the window opening the frame opening somewhat anyway in the proposed design um i don't know it just seems like the loss of some of this material is if there's a way to keep some of it consideration but it also seems that the window casing around the existing structure is relatively inconsistent and makes me wonder about how much of it has fallen off um even though it looks it looks personally intentional it's kind of like cool little design features it's also it some of it just fell off i think it i think it fell off when they yank the uh asphalt shingles off because i think they nailed through it and split it all up because if you look at the rear elevation photographs there's no there's no apron underneath those sills but they're nail holes for that apron it was there um and corner boards are missing for the same reasons they got torn off because they got nailed onto and they split um they're they're the siding or the trim is three and a half inches and um well you know what happens when you put a 10 penny now through an old three and a half inch piece of wood i appreciate those more close-up photos of the windows actually that was helpful to see the a bit more of the condition of them thank you i just want to say i'm not a window expert in any way i leave that to the experts but from my perspective these windows are quite damaged i mean i could literally walk into this building and just gently push against them and they would literally fall out of their frames and and the the the the glass itself is quite thin um i i i don't know anything about the historical nature of glass you know manufacturing at that time to compare it to something else of a similar era but there is there's literally no insulative properties for these for the glass yeah i believe that most of the eighth inch pane of glass and a quarter inch pane of glass have the same insulated value and in this case in this case the it's putty glazed the muntins are definitely all pretty much rotten because they were very fine and most of the putty glazing is dried out indicate as i said in the beginning nobody's maintained this building for decades maybe ever the only other thing that i'll say is i i don't know if this is a consideration of the board as we go through these things but you know budget is a consideration for us and um you know there's only so much that you know we can spend to restore this building uh and it gets to a point where if it's simply too expensive we just we just don't have the capacity to do it so part of the considerations around this design were to stay within a budget that we felt would again restore the building to something that was both habitable and beautiful and also allow us to to do the work and ensure we could do the work in such a timely fashion so that you know more deterioration didn't didn't occur and again i don't know i know that that may not be part of the discussion here but i just want to just provide it as just for for context can we see the rest of the elevations that was i think fruitful discussions so the rear elevation was also where we were looking to you know people weren't going to see it the everyday door the swinging door would allow for that to occur it was the opportunity to be able to bring um windows that you can actually look out of the the four windows on the east the west side below the gable window are actually near the floor so they really do not afford a view the only place you can get a view is to the rear or the south um and that is why the dormer exists it's also for headroom and it's the only you know it's it's a respite to be able to see out um but this is the elevation that nobody can see you you yeah and then this elevation with the exception of offering the additional window to balance the first floor out which i guess officially we don't have to do the intention was to put it back as much as possible check the windows that you're the four windows you're describing on the west elevation um what are what's the so you said they're close to the floor yeah so if you could see my pointer it would be going underneath the sills of the four windows it's pretty much sitting at the floor pretty close like we assume that so if someone were standing next to them [Music] where like inside the building yeah on that top floor you'd see their knee so the benefit of having those four windows for light and air so i'm going to turn this around a little bit and i'm uh i'm going to go through the interior standards really quickly so number one through 10 in my mind are still being met even even though this is in a weird way a reverse phasodectomy which we've heard that term before this is like a reverse of that right so just cutting like keeping the building keeping the facade cutting down everything else we're like encapsulating everything and building around it um so one through ten in my mind are relatively they're being met it's a weird phrasing um so that's one part and then when we go to roofs uh we look at the roof part i think the part that um makes it a little strange is uh where it says in recommended at the end of it it says do not damage or obscure character defining teachers so we are obscuring a character defining feature but we're generally on the outside of it for whatever it's worth um it's not obscured from the inside no it's not and it's that's the proof part yeah but you know as commissioner keanu said it's like much of what we always have talked about here is that we're always looking at the exterior of our building i wish we had that that's kind of like in writing yeah is that in writing i don't know no you know it's a base assumption it is at the the state statute okay oh yeah so consideration of the exterior okay jennifer um and then it also talks about changing the configuration of a roof by adding new features such as dormer's vent skylight so that the stored character is diminished so in my mind that we're adding this dormer on the back of it it's it's not really going to change much of the historic character from the viewing parts of the building it does change it as dormers but we add dormers a lot and and those don't really reduce the historic character all that much all right then moving on to windows you know this is the one that that i saw the most which was uh designing and installing additional windows on rear or other non-character defining elevations um so the design certainly called for the the elevation that had very little or the most view has very little impact and very little change um but then on either side we've got a lot of change particularly on one of them with a large opening um which to me does affect kind of the character defining elevation of that view because we don't we don't see buildings flat right we we definitely see them in 3d and we know that there's edges and sides and so we as human beings walk around them and observe them not just as a flat elevation so that's a part of me where i'm not so sure that it it works so well on the i forgot which one has the big one the big opening the west or east or maybe it's not east or west at all right um district and neighborhood setting um you know i think the the proposed does not destroy the historic relationship within the setting it's just recreating something else on the outside of it that is just slightly bigger but it's in the same location it's not being moved so i don't think it does mat much in terms of district or neighborhood setting um going through the residential accessory structure component this is from the ann arbor historic district guidelines um yeah it you know that i think the appropriate part is maintaining it uh and then to match historical materials and configurations is the main takeaway that i see on that one and i've got just and i'm going to be quiet after this just you can't be quiet jennifer you have to talk so i'm looking at the technical it's technical brief preserve preservation brief number eight and you know so this is a little bit you know i have a couple of quotes here of course it's taken out of context because they're quotes from a larger free um and it it so it's entitled aluminum and vinyl siding on historically so of course it's not wood because it's not i guess i mean i guess these preservation briefs aren't able to kind of expect every kind of strange situation can that can pop up but in looking at this brief although like i said it's it's talking about adding new siding but like aluminum or vinyl something that's inappropriate in character it does talk about you know so it so the this brief does talk about um having issues with vinyl or aluminum siding because of the potential of damaging or destroying historic material and features so i i don't think we're saying that here but it does speak to the potential of obscuring historic material features and most important the potential diminishing historic character of buildings number one so it's speaking to obscuring historic material quote number two while this discussion focuses primarily on the historic character of individual wood frame buildings of equal importance is the context of the building buildings that comprise a historic district or neighborhood changes to the character defining features of a building such as distinctive clapboard and other wall surfaces and decorative trim always have an impact on more than just that building they also alter the historic visual relationship between the buildings and district oh number three almost done structures are historic because of the materials and craftsmanships reflected in their construction intangible and irreplaceable evidence of our cultural heritage to the degree that substitute materials destroy and or conceal historic fabric they will always subtract from the basic integrity of historically and architecturally significant buildings so once again it's speaking to concealing um character defining elements although rustic in character it speaks to the the siding speaks to the building speaks to the craftsmanship and speaks to the original use um final quote um once again is talking about aluminum file siding but it's talking about once again destroying or concealing historic building material and features and in consequent results of the loss of a building's historic character they are not recommended by the national park service such destruction or concealment of historic materials and features confuses public perception of that which is truly historic and that which is imminent imminent imitative sorry so um in closing i won't be sporting this project is it some elements um in particular the the dormer i think is is sensitively located but i i think it's a slippery slope and i think it it lies it does it doesn't meet the standards i comment on that good um that section of the briefs and actually many of the briefs are written about buildings that were built for people and almost all of the buildings you ever go in that were built for people have defining features that the brief did not discuss it has an inside surface and it has an outside surface this building does not this building has one surface i either need to cover the inside or the outside because in in the case of the the buildings that uh commissioner ross was referring to um you'd be covering the only exterior you'd be covering the exterior finish with these vinyl and or aluminum siding and the building was built purposefully with an exterior finish and an interior finish but these and that is where these secondary buildings accessory structures were never built that way in the first place so understood they don't compare very well in that regard and that's where since these briefs are written and most of them i i just quickly looked i couldn't find a date um many of these griefs are written in the 80s and they were really trying to save the houses and the main buildings that people have been tearing down for the last 20 years and they really didn't focus on all of the details and they have not been updated i feel like not to argue i feel like this one has been updated because it's talking about like energy i don't know that but in um yeah so just in any case the the inside and the outside part of it kind of matters because the all of the buildings even houses from 100 years ago they had interstitial spaces this building has none jump in with the thought um i think there's sort of two things that i'm dealing with one is the cladding and one is the the window plan if we just talk about cladding for a second um i think it's fair to argue that the cladding is a character defining feature i think it's also fair to probably argue that the cladding is deteriorated beyond repair um there's it certainly is more than obvious in in several places and then in other places you know without careful inspection it's hard to say but it could certainly be an argument if you were going to say i'm going to remove all of the cladding on this building and replace it with um wood that's going to match it as well as as possible that i think would match the standards because it says you know replace like with like whenever possible and so it is cladding wise it's kind of what we're going to end up with is like we didn't want to say re-cladding in the in the motion because that's not technically what's going on we're not re-cladding it's new cladding but in essence what we're gonna get at least looking from the sidewalk i think it's going to look like it's been re-clad um it's hard to say because we don't have any other examples of this and i've never really seen this done in my tenure here but if it's if it's salvaged wood from a barn that's at least eight inches wide then it'll probably look really similar uh so maybe i'm i'm okay with uh the cladding um to me i'm having a hard time understanding like what the plan was with the windows like historic windows are character finding features of this of this property and it just seems like new windows i i get adding windows for program but uh also just maintaining you know what is there out of just respect for what is there and and um if there's an existing opening let's you know i i'm just sort of it's hard for me to um to support all of the the new window openings um that that seem to be on the sides uh because you're gonna see the sides like commissioner beeson said um i i don't think it's a problem when it's driven by program and it and if if it's kind of restrained but um maybe we can well okay so i think the the project would be stronger if there were some less windows um can i add to that david nerd yeah yeah because my third point i can get back to some other time so let's talk about that i just want to i guess you know john started going through some of the guidelines there's a couple that i just wanted to add to that are specifically about the openings and the character defining features um so under windows not recommended removing a radically changing windows which are important to finding the overall historic character of the building so that as a result the character is diminished and then residential accessory structure is not appropriate altering historic barns garages and sheds by using materials configurations and designs that do not match the existing or historic appearance so to me those two things are very similar that this is an accessory structure and while two of the facades are being maintained very similar to what the existing facades look like the which facade is the west one that's adding the two new doors almost across the entire you know the whole facade is being changed that facade in itself was very minimal it is you know as commissioner beeson said you we are going to view this from multiple sides it's not just a flat on change that adding those doors and all those windows changes the reading i think to me of this as an accessory structure and makes it look more like a habitable space which you know it also is changing you know the historic parent appearance that the historic appearance is more um a little bit more subdued it does have some additional design details with you know the the vertical boards some of the the garage doors but there's an entire facade two facades that are being i think radically changed and that's you know beyond the encapsulating the existing structure which is another point that i can get to it you know after after you share your third point david but i think the opening configurations is the big one for me for a large part of this is that it is i think drastically changing the historic the character-defining features and historic appearance of this particular structure and it doesn't meet our guidelines in those end there is if i could add one quick thing there is the building code is becoming more and more demanding of egress windows from any space that the building department interprets as a place someone not a bedroom but a place someone might fall asleep and um the windows i have i'm no doubt i need to have egress windows from the spaces on the second floor um which means if they're if they're operable they have to operate smoothly open to 90 degrees there can't be anything sort of uh out of the ordinary about those the fire department will demand them um and to illustrate that i built a house brand new house a couple years ago and the basement had three rooms a garage a swimming pool room and a mechanical room and the building department said put an egress window in it to which i said why you're not going to fall asleep in any of those rooms they said put an egress window in so it is a occupiable building and so it has to have certain things occupiable buildings need to have in the 21st century for safety and it seems like there are plenty of windows provided yeah multiple facades for that that are existing or that are being added in a modified way that all right very similar to the casting opening and and and there are and again you know we can it's possible that we can look at that more closely um those windows the egress windows cannot be on the other side of an interior door they cannot every time you put a door in there has to be an aggressive window that might be true but we don't need like an 88 by 39 inch window right no of course so yeah so there's some play in terms of like the size and number of windows right and you know the building was built for for horses and and wagons they didn't really care about too much light yeah we get that you know and that's why i think of the of the all the facades picking the dormer on the side that is on the back side that meets our standards that's easy to go with the ones on the other sides though you know there are a lot of windows going on there that weren't there originally the west elevation particularly you know and i i can certainly accept the east elevation and just balancing them out although again still not potentially necessary but still it'll help balance it out and make it look good but it's really that west elevation that um yeah that's a big one yeah and that and that's the program for the client i mean that's how the building relates to their own yard yeah and i think uh commissioner emerson did bring up a really good point on that guideline and that to me is the guideline that i'm looking at the most now like not that i was trying to find roadblocks but it's like how do each of these guidelines fit and does it comply with each of the guidelines so um i think that's the one that um is still the big standout as she mentioned the residential accessory structure is the not appropriate component so i'm still a hang up for me too trying to think through it again but can you read it again yeah i'll read it again so not appropriate replacing repairable oh wait wrong one nope yep right one uh not appropriate altering historic barns garages and sheds by using materials configurations and designs that did not match the existing or historic appearance so it's got most of the same materials it's got some of them definitely the same configuration minus the rear roof um and it matches some of the historic and existing appearance except for the large significant amount of windows so i think it's the windows that really affects the overall um historic appearance you know if it didn't this is a subdued building right with not a lot of windows right so by adding lots of windows we're changing that appearance pretty quickly perhaps i can speak to the rationale as to why the windows were chosen in the first place i don't know if that would be helpful in context i understand that you know we're talking about something more technical than that but in terms of program i can speak to it if that would be helpful okay so what what you probably don't see in the um in the existing photos is that on the east elevation and on the south elevation um the structure is completely ringed by uh by trees from the neighbor's properties so when you have full foliage in those trees you literally will get no light into the building anywhere other than the west elevation and the north elevation though obviously there's a lot less sunlight coming from the north elevation and we only have that one opening where the um door is so you the only the only way you're going to get any direct light into that space um would be from those those windows on the on the west elevation it is totally shaded uh on both the east and the south by those trees which we have no control over obviously we're they're they're on our neighbor's properties it's likely you'll get shading on east and west as well based on the photos that we have um commissioner rocklin you were out there same with commissioner ross do you haven't noticed that i mean winter all the foliage goes down there are some evergreens around there but yeah i mean there's going to be reflected ambient light i understand the need to introduce as many windows as possible in order to open the four plate make it visible so you don't have to turn on lights during the day um you know i that all makes sense to me in a normal programmatic mindset of an architect right it does it completely does uh as you know our purview is really trying to identify how this meets the guidelines um these guidelines are what were put in place for us to make sure that we follow and adhere to and make sure that that's what we make our judgment calls on um so to me it's it's it's really does come down to the fact that the historic appearance changes you know it we have to kind of filter through to figure out what is it that uh as commissioner rocklin mentioned like what are the roadblocks uh what are the things that cause hang-ups uh and how those hang-ups actually allow us to say yes or no to it um and then is it a hang-up that is something that could be changed or adjusted so that we can get this through because our goal is to make sure that that that for the most part we're following the guidelines that we have historic uh integrity on what these houses and buildings and structures stick to and at the same time that homeowners still have the flexibility to make changes and keep them as livable structures um you know i think ultimately that's always been my goal on this commission is to make these structures so that we can continue using them as you know as chuck had mentioned right you know we want to make sure that this is live can last um so i'm looking at the guideline for the residential accessory structures i'm still hung up on the fact that it it does not match its existing historic appearance and to me the filtering has come down to the fact that it's got just a lot of windows and stripping it down would certainly uh make it look much more subdued uh but i still look at the whole rest of the guidelines in terms of standards one through ten roughly and i'm like okay well this it generally fits um but that's that's the one area that i'm still stuck on i'll leave it up to other commissioners to talk about too jill it was a long time ago since you gave our staff report but at the end of the report you i think summarized two um two items or general items that you were just feeling uh like um you you had questions on i wonder if that'll kind of help focus the discussion i think one of them was whether or not the east and west were character defining yes odds right okay yes that that was one um and the other was using new material as cladding on the exterior i would i would add and i didn't say this earlier that you really can't see the sides of this building the west side is behind the house when you're standing by the road and the east side is near some trees i'm going to very quickly share my screen here and there's a building relatively close on the east side yes there's the neighbor's garage correct you can you can see this this this is probably the best view that you would get of the west elevation and i don't have a better one of the east but i doubt that you would really be aware of the changes to the east elevation since they're pretty minimal i am concerned about just the drastic changes whether you can see them or not if they're character defining features the windows and doors but if you don't think that they are character defining features because they're nearly invisible to the public viewer um [Music] then i then i have fewer concerns about it because again you really can't see it from right away yeah good points um especially that last photo it really did show the adjacency with the house and how close it was at that corner if you go to the site plan you will see that the west face of the garage or the carriage house is almost coplanar with the east face of the house which means you have to be invited into the backyard to see that elevation well it's a little stylized but you can see it better i guess from the photograph and actually i'm not sure this has the addition but the um doesn't it doesn't um we didn't have a survey of the site but the neighbor's garage is really very close and of course it's natural to crop it out of your photographs without thinking um but i guess the best photograph was the one that jill showed at looking up the driveway um how little of that west elevation that you really can even see yeah i looked on google maps satellite view and and it shows very clearly how the house lines up with that side of the garage and the um and the neighbors garage is literally at our property line on the um on the west side you can't see it in this photo it would be to your right okay guys where you going are you going to vote are you going to ask for revisions are you going to do something else no one wants to say anything i guess um i'm still looking go ahead go ahead i think that i think the thing and you know i don't want to beat a dead horse so to speak about this barn but this the thing that i think i'm struggling with you know aside from the windows is we're talking about it's a rebuild basically you know it's in a demolition by neglect we would normally like to see you know as much salvage as possible or rebuilt in kind and in some sense that's happening but it's also obscuring and i keep i think coming back to the question that if if so much of the material is not salvageable such as the structure um all the rafters are being replaced the studs are basically they're going to be there but they'll be not doing anything the the siding itself we are trying to match you stated a couple times maybe we can use some of them the existing but you know likely maybe we can't is it important to encapsulate or is it you know if we're rebuilding why couldn't the zips be are the studs important to remain in place if those are all going away why can't it just be built within the same footprint we have the same um most of the same openings are pretty much there intact and or intact as much as it can be for your design if you're going to re use some of the siding you could still incorporate that within on the on the new plane yes i understand that would change the interior perception of the the barn being there and it's you know you know i guess preserved in this shell is is that the important feature that this barn is preserved in its shell even though we cannot see it and we don't know it's there except for on the inside and most of the original features are gone or is it important that this be rebuilt to be as you know similar in kind as possible with some of these modifications to openings being changed on the exterior and that we're okay we're comfortable with some of those those modifications so i think those are that's that's one of the big ques uh issues i'm having with reading these guidelines because i think there is a lot of obscuring of the existing material and that that's one reading but then we come back and we say oh no it's actually you know it's going to be there we're going to preserve it but we're going to put all this new stuff up over it and we have to do that because we have to rebuild the structure so it's getting in this loop that i'm i'm finding really difficult and i i understand the whole process and why and i think that you know i appreciate that the design itself is actually trying to stay as true to most of those things as possible um and i understand the need to make the adjustments and you know improve this this structure i think no i think we're all drawn to the fact that it's a really nice structure we want to it wants to be reused you don't want to get rid of it it has great character itself so i'm just trying to you know maybe nail down what are the really important aspects that we're reviewing this from is it really actually a rebuild and where's the news or does that matter i don't know well there's a new use the new use they're not using it now at all and the key thing is they would like to enclose it so they'd be able to use it and they want the windows there so they would have light i mean the thing about it is they can rebuild it as it's the same way but they're not going to use it because there's no insulation but i think it could still be if it's all being rebuilt if the studs don't have to remain you could still use the sips panels if we're saying that for our purposes it's the it's the size it's the footprint it's the cladding yeah those are the important features all the other structural elements have to be replaced is it important in our sense that those structural studs existing studs remain the rafters remain or is it that the the structure be rebuilt and the exterior be salvaged as much as possible exterior cladding trim casing windows etc yeah so this reminds me of the uh you know we had an application that was a complete rebuild of a of a garage right next to a giant uh apartment building children remember this it was like they just wanted to rebuild the thing in kind and when it was right next to it i was on the site committee we went looked at him we're like yeah this this this garage thing is just oh yeah what's what i think of the state state yeah state nation kingslayer children yeah and that was definitely one that was like okay well we're going to rebuild it they're going to rebuild it it's going to be the exact same footprint it's going to be all the same we're going to reuse as much of the wood as we can um and and and to bob's point too it's like well it's about the change in use so then we go really quickly about the change in use for secretary material standards number one we're given a new use that requires minimal change to its distinctive materials features spaces and spatial relationships so minimal change to its distinctive features and materials and spaces and spatial relationships might be new structure that sip with reuse of as much cladding as possible like how important is it that we keep this interior thing it's almost like how the japanese view these rebuilding of temples every you know 100 years well they're rebuilding the temple every hundred years and they say oh it's the same temperature temple whereas most you know european cultures would say oh no it's a totally different structure it's a totally different everything like no it's it's still built as uh you know it's the space that matters more than the actual structure that's a wonderful point john i know those temples they're rebuilt every 30 years 25 years um and um there's a whole lot of ceremony and ritual about them um and there's a moment where we all have to realize that particularly those of us who are architects who are somehow it's drilled into our head that we're building something that is permanent which is all hui um it's not permanent um and in even the the great structures of europe um who have had second and third generations of their life we as american people most of our buildings don't have multiple generations they've never had them um most of the buildings in europe have they don't call it preservation there they call it conservation how do you keep the entity in use because if it doesn't have a use no one will invest in it and we as a people are too young to get over that first generation use in a way and this is a second generation use so it's a challenge and it comes with compromises but then again f1 through f4 came with compromises too by the way well not one of them whichever one you didn't discuss um all valid points um when when commissioner epperson was speaking it um i've been sitting here thinking yeah are we over complicating things here you know it's like we're encapsulating the siding the structure some of the structure is going to get removed anyway and replace um if if this encapsulation idea was not even on the table and we were talking about recladding reciting we would be looking for in-kind material which is what's being proposed it would just be directly applied to the kind of the existing form and framework of the structure [Music] is that is that even necessary you know do we need that secondary envelope at this point um is that complicating things for the project for our review of it what's the difference i guess at this point and would we ever even see that saved material ever again you know like we're as the commission i see our role as preserving for the public good right is the public ever going to see that if we cover it up versus just uh replacing and kind that that siding and simplifying the process here and kind of going down the story line of how the public sees it what is it that the public sees now that draws their attention you know there's there's certainly the historic preservation people or people that just like old structures in the near the back of houses going oh cool look at this old building right and so how do we ensure that that is what we're keeping intact you know that's that to me is the size scale relationship character defining features part that we're trying to preserve so if we're discussing the difference between the encapsulation with the siding and kind or the current siding with some siding and kind replacements and the sips inside how much which how much impact would how much difference and impact is there from the public right-of-way does it matter i get well to me i guess like at this stage we're picking a date right now and to me it would also be like that sag in the roof it's like but no we're not going to replicate that because that's just not safe i mean we could but yeah anyway sorry but stick to your point commissioner ford yes i think you're right it's like what is the overall impact that we're trying to ensure that we're holding protecting but we have emotion right and we have to vote on it yeah i think i think we have to vote if anyone has any last comments suggestions that they would people need to reread the motion does anyone need additional time to think or is it just go oh let's go right all of those in favor of the motion please say yes yes yes all those opposed please say no no no no can you do it again and put your hands up when you vote then i can see how you absolutely all of those in favor of the motion please say yes yes i see three yes yes and bob and bob okay oh bob's a yes okay four yes boxiness and all of those opposed please say no [Music] there are three yes your application has been approved please note that you must apply for any required permits from the city before beginning work on your project thank you very much thank you if i could um i absolutely understand how challenging this was and i appreciate it i really do and um if there's i'd be more than happy to spend more time with you all if you have any interest in talking more about this and some of the nuances and you know maybe even affecting the city's guidelines a little bit and i apologize to absolutely every other group that's after us so i i appreciate the creative thinking of you know surrounding this project and for this project of course i want the structure to be reused i don't want to collapse on anyone and i want the homeowner to be able to use their property i just personally was not able to reconcile the uh the criteria with what was being proposed exactly so another retreat discussion i think yes can i join public public yes yes [Laughter] fairness to everyone else thank you both all right thank you thank you item f6 630 south ashley street miss thatcher will you please give the sex report all right this one-story concrete masonry unit building is a non-contributing structure in the old west side historic district there's more history in the staff report so the proposal is to completely remove this building and excavate the soil out of the entire lot and then backfill it with clean soil there is contamination under the building that's been identified since the 80s the first if you if you want to do an uh old news search of articles about this building it's a fascinating history we're not going to get into that tonight previous work that's been done here this is the front of the building here this is the the the front corner you can see a drive-through has been added the building was originally much smaller than this if you look back here on the side the original building is this this sculpted rock face brick right back here that's the original building and then this front part was added on and then the drive through was added on that's the original part and then a wing off to the side that goes to uh mosley was added on so all of this that you're seeing is is modern structure and because of that the building has lost its integrity and is considered to be a non-contributing structure regardless of the fact that there's parts of an old building buried in there somewhere uh this is just walking around the building now we're on mosley this is the neighbor's house to the west their parking area this is the back of the building that original bit with the sculpted block here we're looking at it from across mosley street this view is north east and that's the the large residential building that was built maybe five years ago across south ashley and these are the other neighbors on arm cleaners side of north ashley the dry cleaner has been there for since i think the 1940s um yeah armand opened in 1946 and has operated as a cleaners continually since then in the packet there was submitted a project summary from the michigan department of environment great lakes and energy about corrective actions that need to be taken at this site they go through a project description activities to date the extent of the contamination that you can see on this slide it has seeped off of the building and is underneath the building to the north and i'm hoping someone can talk a little bit about that i know that some remediation has been done there previously and it's also to the rear on these properties but has not yet reached those buildings there's um i threw this in here because there's some injection remediation work that's proposed as part of this project and i'd also like someone to speak about that a little bit but back to the preservation from the secretary of the interior standards um standard two is really the only one that applies it's about uh historic character will be retained and preserved um there is no remaining historic character in this building in in my opinion and in the opinion of the study committee that said that it was a non-contributing structure from the district or neighborhood settings uh of the guidelines it's recommended to remove non-significant buildings editions or landscape features which detract from the historic character of the setting i wouldn't say that the building detracts from the historic character of the setting but i think that the below-ground contamination severely detracts from the neighborhood setting because it's definitely having an impact on contributing historic structures that are nearby and that is something to be concerned about so if the building's demolished any new construction has to be approved by the hdc we don't know if there are plans or when that would happen at this time so really this application is to take the building away and eventually return it to a grassy corner lot the current property owners will still own the property it's not changing ownership at all and so again that would be a future htc application so i am going to leave my staff report there um and i do recommend approval of this application this this work really needs to be done and if you got into the staff report um i tried to make a pitch for why i'm not an environmentalist but this site scares me and um fortunately this is a non-contributing building so i don't think that it would harm the historic district to do this so thank you that's staff's report commissioner rocklin and ross are on the review committee you please give your report and recommendation i'll start um so yeah once again just agreeing with staff um the staff report on on the property and the project um i mean clearly uh clearly as as ms thatcher's noted the the building has been identified is not contributing i think it was initially contributing but then some some of the kind of funky additions towards the front kind of obscure encapsulate yeah original building all you can see is that kind of weathered concrete block or not weathered but that rusticated kind of concrete block piece that's kind of weirdly sitting in the middle of the current structure and of course um the issue with the environmental contamination um certainly the keeping it as is constitutes a hazard to to the adjacent residents um so yeah i i support staff's recommendation on this project i agree and i have nothing more to add uh commissioners do you have any questions for the review committee or staff apparently it looks like we have a couple additional support staff could you guys just please state your name for the record dan you need me sorry about that uh my name is derek delacorte i'm the community services administrator do either of you have any additional information to add to stash report um the the only thing i would add is we we appreciate the opportunity to be doing jill's job in the past for a different community uh it's been a long time since i've been in an htc meeting and i appreciate the work you guys do now the the staff report is it we have an enormous opportunity with eagle coming in uh million dollars of state funds to potentially finally resolve the source material issue at this site which i think is not only a benefit for the for the district and the adjacent contributing structures but huge benefit for the city and something we've been pursuing for a long time so we appreciate the opportunity to be here and dan can answer any technical questions out of the project thank you i will open the public hearing portion for this item at 630 south ashley street kristen do we have any callers you have a couple callers um as a reminder star nine to raise your hand no callers have indicated was the public hearing portion is there any commissioner that would like to make a motion should i have the right one over here um i move that the commission issue a certificate of appropriateness for the application at 630 south ashley to demolish the non-contributing dry cleaner building and remove the soil to remediate environmental contamination the work is proposed as appropriate for the surrounding area and meets the secretary of the interior standards for rehabilitation and guidelines for rehabilitating historic buildings in particular standard 2 and the guidelines for district or neighborhood setting alterations or additions support news by commissioner quijano second index commissioner white is their discussion on the motion i think this one's pretty straightforward and especially if you've read through the entire report it's pretty clear-cut already devoted all of those in favor of the motion please say yes yes yes yes all of those opposed please say no the motion carries your application has been approved please note that you must apply for any required permits from the city before beginning work on your project absolutely thanks dan for being here i appreciate it thanks derek long line night everybody thanks for hanging in there thank you sorry again find my script here okay item g new business there is no new business on tonight's agenda um meeting item h minutes uh we receive minutes from may 13 2021 you'll miss my cat oh okay that's all right m1 communications there are no communications to htc this month and then i'm in adjournment and now adjourn the july 8 2021 hdc meeting commissioners please they all have attended bullhead city schools school district school could you speak into the mic please since kindergarten including my oldest son who graduated from mojave high in 2020 i'm here to share i'm here today to share with you my wishes for our school for our schools regarding critical race theory at your prior meeting the board and unanimously decided not to introduce that ideal to our schools which i am very grateful for individuals who push crt to be part of our curriculum like to disguise it as part of our history to justify their narrative claiming children should know their history crt is now part of our history crt is an ideal not a fact born in the 60s that an individual success or failure in life is strictly tied to the color of their skin rather than a result of their effort dedication work ethic and merit crt advocates advocate for equity not equality which are two different concepts equality means everyone gets the same opportunities equity means everyone gets the same outcome equity isn't realistic to expect that same result the same result as someone who works harder than us is just nonsense and more so it goes it goes against the american values this great country of us was founded on america is a line of opportunity and anyone who works hard can live a fulfilled and successful life while many speak about the matter from information they have acquired from older generations books articles and such i know this for personal experience i was born and raised in argentina my parents moved my family to the states in 2001 right before i finished high school and without speaking a word of english i was a legal resident for about 17 years and two years ago on 4th of july 2019 i probably became an american citizen and i can assure you america is not only not systematically racist but the american people as a whole are not racist now to my pride and success story as i said my son andrew is 19 years old some of you board members have had the privilege of paying his educators he did not grow up in a privileged home he does not have wealthy parents that can put his pay his way through college to achieve some higher education and has been raised by me as a single mom and completely fatherless since he was 12 years old when the schools closed in march of 2020 he immediately went and got a job at the bohot city home depot he figured if he was not in school he might as well get a head start on his future his goal is to climb the ladder and become a home depot ceo he was recognized multiple times by his peers a man and managers for his hard work dedication and outstanding work ethic this past may just a year after he started with the company he was promoted to the kingman store as a department supervisor may i continue at 19 years old while many of his former classmates have chosen to drink party and do nothing to build their future those who push for crt and see me and don't know andrew would say what that that must be because he's white well here's a kicker to my story for those of you who don't know my son he is brown his biological father is native of south america the color of his skin is not stopping my son in any way shape or form from succeeding moving up in the corporate world and working hard towards a very bright and profiting future in america just like my sons there are millions of success stories throughout our country that prove america is not systematically racist that prove that it is the content content of your content of your character that determine where your journey leads you and not the color of your skin crt is nothing more than an idea pushed by disgraceful disgrateful disgraceful and radical people who want to destroy everything our country stands for history is history it happened no one is denying it but the injustices that took place at one or another point of our history has been rectified laws have been changed the constitution has been amended to guarantee each and every one of us equal rights and our children should not be told that they are at fault for what happened in the past or that they owe anyone anything for events that took place long before they were born now to morality and values those are taught at home each parent has the inalienable right to raise their children as they please the school's job is to teach academics english math geography introduction to traits economics history as it is and not as it's perceived by the school or how the teachers feel about it it is not the school's right to tell my children what to think or how they should feel about any societal matter but rather to think for themselves and that should be done in an unbiased manner whether it be racial religion religious gender identity sexual orientation orientation or body image teaching my children the rules of engagement while in school meaning to follow school rules sure society has rules and we must obey by them so children need to get used to following the rules but teachers trying to instill their personal views and values and my children absolutely not that is my jurisdiction not the schools i have my own views about race religion homosexuality etc just like many other views and values that affect our everyday lives and i pass down those i pass down those to my children it is my con constitutionally protected fundamental right as a parent to teach my children morals and values and i teach and i choose to teach them regardless of how the school other students and society feels about it and the schools have no business interfering as long as my children follows my child my children follow the school rules then that's as far as any teacher or school staff should be concerned about my children's values with that being said i urge the school board to draft and enforce strict policy for teachers and school staff that will not only restrict them from teaching crt but that will have severe disciplinary disciplinary action and i mean instant firing without warning for those who voice any personal views to students in front of students or even engaged if a student brings up any crt matters if a student brings up any societal matter covered by crt their only response should be that is something you need to discuss with your parents at home with people who are involved in your upbringing and nothing else should be said to that child why do i make such why do i make such an extreme request number one because this is a serious matter matter and should be taken as such and two because if we expect children to adhere to policy and face severe consequences if they don't i expect grown educated adults who are interested with the safety of our children to be held to a much higher standard teach teaching that america is systematically racist that white people are evil and oppressors of all the races and that not everyone has the same outcome in life because because of it it's an outreach of any school staff teaching our children that they are inherently evil which is a message crt crt gives that they're inherently destined to fail based on the color of their skin is child abuse and those who abuse children should be fired without warning when my son robbie was in the third grade and had attended diamondback i got a call from ms diaz who was the assistant principal at the time informing me that robbie's friend who was in another third grade class had brought to school a handful of ammunition and had passed them out to other students robbie being one of them ms diaz told me that the um the boy had done that what the boy had done was against school policy and was going to be taken very seriously that afternoon i got a call from the boy's mother telling me her son was facing expulsion that there was going to be a hearing for the superintendent to just make a decision and asked me if i would attend the hearing and advocate for her son of course i did the boy had brought ammunition to school not with an intention to hurt anyone which this was known by the school but because he thought they were cool and wanted to share show his friends at the hearing it was very evident that the school principal the assistant principal and the superintendent all knew that there was never an intention to cause harm this was simply an eighth eight-year-old boy showing cool stuff to his friends even so they were all very adamant about expelling the boy even after the mothers after the boy's mother approved by reading the district policy that the boy had not violated any policy because ammunition was not listed in the handbook there were guns rifles even granite launchers listed as items that would grant expulsion if brought to school but ammunition was not one of them my point with this little story is that once again if we expect children children who are just learning to exist in school and society to follow policy and face consequences educators should be held at a much much higher standard also i also urge the board to educate school staff school staff what crt is outlining in meticulous detail what subjects they are not allowed to discuss with students ignorance of policy is no excuse and those who violate policy should be fired immediately but the damage they could cause by not not knowing what they could or could not discuss cannot be reversed i was rather disappointed at the last meeting when one of our educators stood in front of the board in support of crt but based on her speech she was mistaking critical race theory with with critical thinking of course i want my children to be critical thinkers i'm very adamant about responding with well how do you feel about it when my children ask questions rather than just voicing my my views especially my when my older children ask me about politics i always respond with research the legislation you're asking about use the dictionary or i will explain the words that you don't understand the meaning and then you decide whether you think it's right or wrong good or bad bad or if you would vote for it and then we discuss our views but to hear an educator does not know the difference between crt and critical thinking is extremely concerning and it's something that should be addressed so there is no misunderstandings and irreparable damage done to my children our children it is also evidently important to address educators staff even bus drivers regarding crt content in light of the letter the superintendent wrote which we all were thrown off by yes at the last meeting she retracted herself she claimed that she did not mean what everyone understood that that was not what she meant that she was not in support of crt but that makes it makes it obvious that clarification of what crt is is needed and that the board must assure that everyone involved in our children's education is on the same page page regarding this matter we as parents trust you board members and school staff to protect our children from any harm whether it be physical mental or emotional i hope the board takes this matter seriously and takes the necessary precautions no matter how extreme they may seem to protect our children from any harm thank you thank you no other calls to the public no all right item 5.3 adoption of the agenda can we get a motion to adopt the agenda i know that we adopt the agenda second all in favor aye corey burgess aye jeannie borland hi amanda amen aye charlene diaz so moved item 5.4 superintendent reports dr stewart members of the board i have submitted the reports a building report financial information i don't have any particular updates other than relative to the budget that you were looking to approve tonight information came from the state this week regarding the legislature's adoption of a budget for this coming year the base rate per student per student count has gone up about eighty dollars a little over eighty dollars and uh the waiting for uh two categories of special education were raised so i did some calculations based on this budget and it's likely that we will well i will be bringing you a revised budget because there are other things that need to change but it is uh likely that the budget will increase by uh uh somewhat over 200 thousand dollars based on those increases so um i'm excited about us approving the current budget that's pretty solid for this year and uh and the opportunity perhaps to increase otherwise i don't have any updates and i'll answer any questions you might have any questions on the report i i had one on the i think it might have been the financial information when you sent over that on the pandemic liability yes what does that cover it covers if any parent or community member but particularly parents if they were to sue us as a district for their student contracting covid as a result of exposure at school this past year it was an add-on and you all had to vote separately you know as a separate thing it was 20 000 and we will get some of that back but they are continuing for another year especially since even with all the other changes the governor has not rescinded his declaration that we are still in an emergency situation and so we are still open for some liability um so but they caught they cut that cost back to ten thousand and even with that ten thousand in the budge or in the in the uh policy both the liability policy and the separate workers compensation policy each one of those increased by less than one percent for this coming year any other questions all right community truly cares about our educators and our staff thank you very much for stepping up like you do 5.6 board member updates do we have any updates from the board members at this time okay item 6.1 the consent agenda do we have any questions on the consent agenda any items we need to discuss individually then can we have a motion to approve the consent agenda as submitted i'll motion that we approve the consent agenda i'll second that all in favor aye corey burgess aye jenny borland aye amanda eamon aye charlene diaz so moved item 7.1 the employee handbook we got to discuss quite a bit in detail of the handbook we did make a few change recommendations for the changes in our workshop were there any additional thoughts or ideas we did want to have that committee for staff to bring some more recommendations for next year's handbook any other things to bring forward at this time then i'd like to move that we approve the employee handbook um after the corrections from the workshop second i'll second the motion all in favor aye corey burgess hi genie portland hi amanda amen hi charlene diaz so moved item 8.1 uh the budget approval dr stewart mr president and board members this is the budget that um that you that you approved for as a proposed budget a couple of weeks ago and uh nothing has changed in it this is just the process of formally approving adopting this budget to begin the school year i will point out to you that the tax rate for our district has dropped for this year about a cent and a half i'm sorry a little bit more than that about eight cents sorry um and um and that's a good thing you know and uh for our public in terms of expenses any questions on the budget all right and i'd like to make a motion that we approve the budget has submitted a second motion okay we have a second from charlene all in favor aye corey burgess hi jeannie borland i'm amanda amon hi charlene so moved item 8.2 policy k-l-r-b uh proposed revision this is a first reading this is a regulation so you can approve it it's only a policy that has to be read twice i'm sorry to interrupt um that's okay when we were changing the other regulations and policies and dress code things items that had to do with masks we missed this one and so what you can see is that we're essentially taking out all of the regulatory pieces of it and just leaving it as a voluntary thing that they may wear that they may wear yes any questions then at this time i'd like to move that we approve uh the regulation so this is regulation uh k that's k i that's k l isn't it kl that's an it's like oh it's an i yeah so this is k-i-r-b so i will move that we approve regulation k-i-r-b as submitted all second all in favor aye corey burgess can we do that if it's typed wrong you can make the change in the in in that in the meeting as long as you're identifying that it was a typo in the in the agenda yes it's fine especially since it's a regulation and not a policy legally we do not have to this is a side note but it will help you to understand legally we do not have to bring regulations and exhibits to the board for approval historically in the district we have done that and i think that's a good a good practice to consent to continue uh but i think in this case because it's a regulation you can make the change verbally so we have a motion in a second uh all in favor aye corey burgess hi jeannie borland i'm anna charlene diaz so i moved item 8.3 administration iga dr stewart mr president and board members we have for several years as a district engaged in intergovernmental agreements with colorado river union high school district and this year we have four that we are proposing and in fact have been approved by the high school board already this first one is administration and at this point the we have two positions that we share between the two districts one is the director of el nau programs hearing officer and the part of that that we share with the high school is the hearing officer duties that mr newzal does the other one is the warehouse manager position that we are the ones with the bullhead district is the one with the warehouse and so uh shipments for both districts come to the warehouse and and um our warehouse manager distributes uh those things and in fact also distributes mail twice a day to all sites and these percentages are based off of usage they are based off usage they match both the number of employees in the two districts and the number of students relative to each other any questions all right then i move that we approve the administration iga second all in favor aye corey burgess hi genie borland hi amanda amen hi charlene diaz so i moved item 8.4 purchasing iga dr stewart the purchasing iga allows both districts to uh to utilize economy of scale when we are requesting bids and quotes for items we get better prices the more items that we are quoting getting quotes or bids for and so this allows if both districts need to purchase certain items so let's say chromebooks i'll give that as an example so if both districts need chromebooks we determine how much how many each district needs add those numbers together and go out for a quote or a bid for that number and so we get a better price per unit when we do that once we've gotten that price each district then submits its own purchase order for their share of those items but in any of these situations both districts benefit from this economy of scale we've been doing this for a number of years and it's a good one to continue i recommend approval any questions then i move we approve the item 8.4 purchasing agreement i second that motion all in favor aye corey burgess aye genie borland hi amanda amen hi charlene diaz so moved item 8.5 technology iga dr stewart once again this is one of those situations where both districts benefit first of all by not having duplication of some services or having to pay for desire pay a hundred percent for uh some of the services that are tied to technology so licenses um in some cases hardware and those kinds of things you will notice in this one in this iga it's very clearly spelled out which items apply and that came at the request of the auditor general's office that we spell that out so you can see and and you can see that in some cases the percentages are slightly different simply because of the way we use those items neither district could afford i'll use the example of internet service neither district could afford the level of internet service that we that we use if both districts had to pay the hundred percent for that gyms as well i recommend approval any questions then i move we approve the technology second all in favor aye corey burgess hi genie portland i'm anna aymond hi charlene diaz so moved 8.6 transportation iga mr president and board members um this is a very valuable intergovernmental agreement for us it really demonstrates the the fact that we don't have duplication of services we have one one garage for working on all of our equipment as opposed to two we have a director and an assistant director as opposed to two directors or and two assistant directors and those kinds of things and these percentages are based on the service provided so one of the changes that you will notice is that for the head mechanic and the three mechanics uh instead of those being 50 50 we have data this year that twice the amount of time was spent working on bullhead city transportation vehicle vehicles and that's been very carefully logged this year last year we did it 50 50.

thank you so much thank you moving on to the trustees report anyone have anything to report or comment on this evening otherwise i'll go ahead and move on and let's see trusty fam okay well first of all i'm excited that we are we are set for the return of in-person learning on august the 17th what a milestone what a milestone uh i wanted to say a few things um first of all uh board vice president quintero and i have the great pleasure of visiting the lindale special education summer school uh it was a treat it was uh i i i am deeply impressed at the professionalism of our staff uh especially uh a special thanks to our special education director tony colonna who uh i tell you uh for someone who is working out of the central office i have seen few people who know all these students not just on first name basis but able to seamlessly intervene uh when the moment needs it i mean i mean i i you know i i went to lindale and that's where i first actually interacted with the disabled students and uh just like that come in and deal with a child a non-verbal child with autism in and out it speaks volumes of the uh quality of those who who serve our district and so i'm very grat gratified to be able to see our district provide such a valuable service to our students and not only that a free service our some of our neighboring districts like mount pleasant or georgian 890 we're providing this service for free for 3 000 students to to combat learning loss and it was such an experience to to see what album what our district is all about up close secondly uh i also had the privilege of attending the uh opening of the 50th anniversary of pride in santa clara county historical exhibit and uh lord uh let me know that uh i had a chance to meet principal montez of san antonio out there and it's a very it's telling that not only do we educate a broad cross-section of the people in our community but a broad cross-section of the community actually works to educate our children too so uh i really want to say truly it's a pleasure to see that you know we are literally uh a community a community run and supported school district and so it was a great thing to get to know our schools better get to know our staff better and also get to see some of our administrators outside the school setting and to talk about issue [Music] issues of concern they have so uh i certainly look forward as the school year as the school when the school year starts to reach out to our district school by school thank you trusted femme uh chelsea yes thank you um so just briefly one thing i i kind of wanted to acknowledge that um as you know we kind of at the end of this past month basically i've gone through half of the calendar year and so i was just reflecting on some of the work that we've done as a board and as a district and i knew we we've been meeting a lot and doing a lot of work but just to quantify that including so if we include tonight's meeting and the meeting that we'll have later this month on the 22nd that's 18 meetings that we've had board meetings here um in seven months so you know i typically it's a meeting per month but because of all the work that we've been doing together with our partners and community we've had 18 meetings in seven months and that's not including the all of the work that's gone on with committees and so you know that's just i think speaks to some of the results that we've seen recently for our district in terms of um learning retention for our students in terms of parent satisfaction i always say that there's definitely room for improvement in everything we do but the hard work that the staff has put in the community the board shows in the number of times that we've been meeting doing this work throughout the past just six seven months now and we still have a full plate ahead of us so i want to say that you know alum rock as a district is is doing the work and the results are beginning to show and um and so i'm proud of that and i want to thank our staff and our community for all of that hard work and i look forward to continuing that the other thing i wanted to mention is i had read an article this month and then i was able to follow up with a conversation with um some early education and and other colleagues in in the area about um the whole learning retention and socialization for youth and and you know we were just discussing some of the research that there is about the importance of students being in the classroom and being able to return back to normal um you know it's it's been so long that we've been on zoom or whatever it kind of feels like this is slowly becoming the normal but we need to remember that you know the importance of being in the classroom is key to our the success of our students that we've done as a district all of the things that we need to do to make sure that the children are safe we've taken all the precautions we have all the equipment and materials that we need to ensure that we opened up in a kind of like an opening light last year and we had my understanding is zero um zero cases of kovid during that opening kind of soft opening that we did last year and so now with you know again always room for improvement but with more and more people ideally being vaccinated i think that it's time that parents and we as a community begin to weigh the um the precaution that we all have with the importance of having students back in the classroom and and particularly you know from an early age from those you know our younger students it's important that they start off their educational career with that um in person real life face-to-face um experience and so you know we're in the summer and i know parents are are thinking about what's going to happen what's next and so i would obviously respect everyone's decision but i think it is time to at least safely begin to consider the importance of students being back in school as we all begin to return to back to what we knew as normal so that's it thank you everyone and stay cool because i'm hot right now in this room thank you trustee vegeta anybody else uh vice president quintero yeah um i also want to um yeah i won't belabor though so wargram fam already talked about our uh our uh our visit to lindale and to the uh to be we were able to observe some amazing work from the special ed department out there with a very very um you know amazing group of of staff and an amazing group of kids that are out there learning through different body golgi's were able to observe some of the strategies that they use to be able to help all children learn and so i was very very excited for that and to see that we are providing an enhanced service that not all not all other districts are providing and i think it's it's important to really that alum rock is going out there above and beyond other folks have chosen to for whatever reason um contract out this type of work lmroc has chosen to double down and invest in all of our kids to make sure that all of our kids have access to a quality and dignified education here in their in their home district so very very excited to see that in action uh appreciate the staff um principal kasturi basu and um and everybody who is out there uh the the summer principal whose name is keeping me right now but um i appreciate the the effort that they undertook to to give us a good um give us some good knowledge about what's going on out there i've also been able to observe uh alum rock's summer enhanced learning opportunities through the participation of my own kids and so my son's been participating in our summer programs and i have just been amazed at the strategies that have been used by our amazing uh teachers already that are there they happen to be our alumni teachers who are now teaching during the summer and um they're just employing different new strategies with the um with this summer program that has our kids really excited about learning and so really really i guess i'm using up that word excited it's a great program and i'm very very thankful that our district has gone above and beyond to go out there and make sure that everybody has access to um to to stem this the summer learning loss uh because we know that other districts aren't providing that to all of our kids to all of their kids and so that's uh that's what makes us special and i really really appreciate our mark for that for that reason and for a host of other reasons um i also am very very excited about the return to in-person instruction i myself will be returning to the classroom um and i will be the only instructor of political science uh in the classroom and offering that to our students um and for my respective institutions um however i am very very concerned about you know i'm going to continue to be cognizant and so while i'm excited about going back in the classroom i'm still going to make sure that we as a district continue to pay attention to state guidelines and uh public health department's uh recommendations we unfortunately have been hearing about the sydney australia going on three weeks of lockdown and so the fact of the matter is that while many many of us are really excited to get in there and in person we need to be very very cautious as we proceed by still maintaining our masks and doing what we have to do to keep ourselves safe um i am very very i'm i've been very impacted by the person like my son he's two years old and he spent half his life locked up in a home where we've tried to go ahead and give him um experiences by talking to him um his siblings uh his mother my wife we have all been attempted uh we've we've all been continuing to make up for that that thing that you can only get with uh person-to-person interaction or those interpersonal type of interactions and so um i'm very i want to get back in there but i'm also very concerned about the news that we're getting from down south and the stuff that they're going through and this may not be the you know completely end of it so it's not true not to go against uh any comments that have been made but i want us to be very cautious if we proceed um because um as uh dr poucher just mentioned earlier this week it's not maybe we're not completely out of the woods yet i'm hoping that we are i'm hoping that his words are wrong and that we can go ahead and move forward but let's proceed with caution thank you vice president trustee chavez anything you would like before we continue anything you would like to yeah yeah i just wanted to thank all of the alumni staff and all the teachers for all their work in helping um the kids do their learning all their efforts and their work is much appreciated thank you uh and with that um i'd like to just um start off with uh as uh quintero uh board of vice president guido mentioned um unfortunately we're not out of the woods as a county as we've heard um and just a reminder that if you haven't gotten vaccinated you can for free um and also i want to thank all of our staff for keeping our children safe you know as uh was mentioned earlier uh from trustee de gerano is uh we had zero zero uh cases um of covet in our schools since we opened so um i know and i trust you know our staff um are doing above and beyond then you know what is kind of check off the box to ensure that our children are safe and so with that um we know that our children ages 12 and under still can't get the vaccine um but you know that doesn't mean that um and and and we understand as as a district that we're not out of the woods so we're going to continue to keep the safety precautions in place and ensure that every child that comes back um when you all come back in august 17th um is what we're looking forward to seeing all the beautiful faces um and that you know everybody can be there um safely including my daughter and so looking forward to that date to see all of our children and also some of you know being in mexico and being from mexico i remember growing up and a lot of my cousins were like a little bit ahead in the math you know on my level and things like that and um in my trip actually this year i never realized that um their kindergarten is actually three years and so i say that because you know i think um i know for me you know i started in preschool in kinder but i know we count the k through 12 right it's k-12 then college et cetera um but it's so important to start our children early and so if we have the opportunity to put them in tk and preschool i'm so part of our district we continue to open up programs for our younger children the importance of having that foundation for a child um and ensuring that they come in and so know that you know we're gonna ensure that they're safe keep our numbers small um and all the other precautions um but the importance right and and i appreciate um trustee uh quintero's uh mentioned as a father right at the parents of having that time to learn those things that are so important um and i also know that you know parents like me with a full-time job and full-time you know i'm here with you all i probably would have had wouldn't have that time if i had a fusculated child so just ensuring that our children have that uh experience um as a foundation and inviting you all that if you have children that are young you know trust us with your children bring them in to ensure that you know they have these doors open up for them that when they start kinder and they go to first grade and go on to middle school and high school and college um that they're prepared right um unfortunately they say that um the government looks at uh the test scores of third graders to determine how many prisons will be built um and so that says a lot right if our children are not prepared by third grade if they're um you know not not ready to to to go on to that next level um there's decisions being you know done and so let's do our part you know um we'll continue to provide and look for after-school programs and enrich uh this full experience more than um you know a regular school day um but let's do our part and if you're like on the fences like should i send them will they be safe we will keep them safe um and do your part at home right let's continue to wear our masks let's get our vaccine if we can as adults or the 12 and over and do our part in the community but i look forward to being out of the woods and being in a place where like okay we're done um so with that we'll go ahead and continue here with our meeting um item 401 approval of csva membership dues move to approve move to approved by trustee second second by texas travis um let's go ahead and if you're all okay with doing public comment and then we'll come back to any questions and comments from the board uh mr chavez can you help us with any members of the public wishing to address the board on this item is on this item at this time we have no speakers okay thank you wait a couple seconds any now still none okay thank you uh coming back to the trustees any questions comments concerns on this item seeing none just a brief explanation for the i want the legal alliance allows us to go ahead and join in with other districts throughout the state that allows us to go ahead and push for um changes in legislation and stuff that sort or to go up against the state when they're trying to charge to short changes on uh funding and stuff like that sort through the courts and so it's paid back in tenfold uh in terms of the amount of money that we've gotten back because of actions that have been taken by csba yeah in the courts just wanted to give a good explanation thank you vice president okay um seeing no other hands we'll go ahead and move to the vote trustee pam aye trustee hey trustee chavez hi vice president quintero hi and myself i thank you moving on to 403 approval of csba gamut policy plus service second motion by vice second by chavez mr chavez is there any members of the public wishing to address the board on this item at this time we have no speakers okay in a couple minutes any still none okay uh coming back to the trustees any questions comments concerns before we move to vote casing none i'll go ahead and move to vote trustee fam hi trustee chavez hi vice president quintero hi and myself i all right moving on to 405 approval of out-of-state travel for 2021 national superintendent forum move to approve move to approved by trustee chavez second second by vice president quintero okay we'll go ahead and open it up for public comment at this time mr chavez do we have any members of the public mission to address the president at this time we have none okay i'll wait a couple seconds do we know still none okay thank you coming back to the trustees any questions comments concerns uh trustee vacarano yeah just a a request for dr bauer if you could just share um with us what the importance of you know these types of of events and and the benefit that the district gets from being able to you know have these different or have these opportunities to work with colleagues from all over the place and just how that benefits the district in terms of your capacity and ability to bring us the best that we need from our superintendent thank you trustee vegeta well i was invited to speak in this particular conference and i feel very honored um that they reach out to to me and say that wanted to uh for for me to present to the national forum how we did during covet and i think i'm very proud of about that people are noticing that alum rock is a model in so many ways we are also a model for early learning and social emotional learning programs and so the organizers of this particular conference were very uh impressed with some of the kinds of things that alan rock has introduced to the field and so in this particular time i'm going to be learning a lot from other superintendents across the nation um this is where um i don't know if you have had a chance to see the little video from from the reopening and how we were going to have our classrooms and all of that and that was an idea that i got from my colleague in miami-dade from that specific school district on how they because they they brought back students since the fall so we learn from each other we exchange ideas that i you know that i i just figure out you know let's copy them why do we have to reinvent the wheel if that was a good idea i was very proud that we had our staff that immediately was ready to to do something similar to them and so those are the kinds of things in terms of communication programming efficiencies that i'm able to learn from other superintendents that are leaders in the nation to be able to bring back to alum rock and also that they can learn from us i think you should be very very proud of alam rock because of that because we have people who say we want to know more about how how you guys are doing this thank you for that thanks for that explanation dr bauer and congratulations i actually wasn't even aware that you were presenting so congratulations on that and i know you'll represent us well because alan rock has a good story to tell and so um thank you for that clarification so i just wanted that comment that's it and i'm just gonna say the other guy that was invited from the bay area was the superintendent in palo alto so we are in very good company whoops any other questions or comments from uh trustees i guess i just want to say congratulations to dr bauer for being chosen to represent our district at such a distinguished forum absolutely and i i did want to also congratulate dr bauer uh for being invited to speak um the wisdom that you carry you know you're so humble because you're like i'm gonna go learn and no like that wisdom that you carry as an educator and your time here at alum rock has not been in vain you've gone through you know all the experiences to experience from one extreme to the other and i know that you know they're gonna be learning a lot from you so they're blessed to hear you speak and we are very proud you don't have to doubt that at all very proud to have you there um and have our name you know go along with you because this is you and what you've earned and we're blessed as alum rock to be there with you also representing and so thank you for continuing to represent us well um vice president quintero yeah i very much appreciate um your uh getting out there and getting on rock steam up there um in a positive way because um this is what allows us to to be ready to take on grants and other opportunities those investments that are being made by organizations when they look at these these things oh you know so and so i saw her presenting at this major forum and they feel comfortable that there's credibility that there's organizations that are allowing alum rock to be put at the forefront through the superintendent and so thank you for stepping up representing the district and then i know that it'll come back and we'll wind up getting the benefits later on by the good will that it's going to engender thank you and it's just an addition to what trustee karana was talking about right the many meetings we've had this year the work that we're doing here on melham rock the good things that are happening that when you hear alum rock you know you turn around you say wow you're a part of that district you know congratulations i hear of just good things happening there so thank you for adding to that um and with that um hope you have a good time uh we know we know you will um and before that let's see if we went through public comments so we'll go ahead and take it to a vote now i'll start with trustee pam hi uh trustee with gerano aye trustee chavez hi vice president quintero hi and myself i all right now i can say have a good time and enjoy yourself um all right we're going to move on to 406 approval of the district governance handbook move to approve move towards i heard vice president say first and foremost one second i know that it's trustee and vice president seconds i'm just going as i hear you thank you um okay uh i see uh justin bieber karana's hand up are you okay with going to public comment first trustee canada okay um we're gonna go ahead and do a public comment at this time mr travis do we have anybody wishing to address the board on this item madam president at this time we have no one okay i'll go and wait a few seconds any now uh still none okay all right thank you uh moving on to trustees but hirano i know you had your hand up yeah i have um numerous nothing with regards to content necessarily just numerous kind of grammatical uh suggestions or corrections so i don't know if the best way is to just submit them to maribel or read them aloud here or there's about um there is a lot of them and i also know that we're missing the goals which is very important um so i don't know how do you guys feel about moving it to the next meeting and then i mean because there is a lot of them uh before adding it to [Music] are they right we have a special meaning i see trustee travis's hand up and then quintero mine are only grammatical i yeah i say i see we approve everything uh exclu but that we will be allowed to correct the grammatical errors because there is a lot of them um but i think that we do have to add the piece that the trustees the the page for was blank so i think we should maybe if we could proceed doing that so we could kind of get the ball rolling and and i like that so kind of like a first reading approval of everything up until now and then bring it back with is that what you're saying approve everything up until now no no i'm saying if we could get this done tonight and then uh just do the edits um as the as it already has been approved but with the edits we if we can just if they it can be sent to us because i i did all my edits and then i could send my pages and if there was something that the other trustees wanted to edit as well i think just like the minutes though just like the minutes we can't approve something unless it's a final version that's my understanding roger um is he on just want to confirm that i i think that's fine it's fine to do what's fine i'm sorry i think that madam president go ahead vice president if we move forward approve and then authorize for grammatical changes that don't change the substance of the handbook then we'd be in good uh and good and i think would be okay if counselor can win okay um yes and so that's one piece but i also know that we're missing the goals piece of this handbook so for me it wouldn't be finalized like it wouldn't be ready for me and send off there's still some work to do and so that's why i was saying do we approve everything up until now and then add or may i weigh in on that yes please so i so what i'm hearing is that the proposed uh edits are non-substantive they're grammatical i noticed some grammatical errors as well and i think that's fine i think that the board can approve the document that's in front of you now with the understanding that those grammatical changes will be implemented but the document to your point board president the document would need to come back to the board on the on the goals section because that needs to be filled in but i think it would be good progress to approve what's been what's been uh okay that's what i meant perfect if if so if the motion is then to approve everything up until now without obviously finalizing this handbook um if that that's okay with the motion i know uh trustee chavez and board vice president you all made the motion yeah that's fine with me um we move forward implement the grammatical changes and then bring it back next month for the to uh to finalize it with the goals okay okay um i see trustee fam to hand up and then trustee veterano so first of all i you know i uh i covered the grammatical errors on my with my one-on-one with superintendent bauer on tuesday so i submitted my errors but uh so based on that i think what i think the you know if these uh trusty chavez would wouldn't mind and first board vice president quintero but let's just amend the motion called an approval of the first draft because as as you mentioned madam president we don't have the goals so technically it's not quite there yet so we could approve this as a first draft now and then again bring it back later when we have the goals thank you trustee fam trustee veterano yeah my question is uh with regards to the goal so i think i've heard it mentioned a few times that we would bring it back next month with the goals but um as i mean with all these 18 meetings and maybe i'm a little cloudy on this but my recollection is that we still had not defined the specific goals and that was part of the strategic planning process um that i know we will be continuing with so i'm just wanting to get clarification on whether those goals are going to come from somewhere and and be ready for next month or are we going to have a special board meeting to identify those goals between now and next month or how would that come about and i guess the other question part of the question is the what is the specific um expediency needs of having this approved i think if we go with trusty fan suggestion and approving it as a draft form i think to me that that shows good progress and it doesn't necessitate us to necessarily have to rush to try to get those goals in within a month and we could do it in a more thoughtful strategic way trustee bauer i trust you uh superintendent barry i saw you put your hand up i'm not sure if there's a comment you wanted me i wanted to remind the board that we have that it's a strategic planning initiative that skowit is paying for and the the facilitators are already reaching out to our partners for interviews we have not brought more aggressive in you know work to the team because we were wrapping up the school year everybody wanted to have a break so the fall we're gonna take again you know a little bit uh more actions around that and that's where the goal setting um will happen because remember that as a board you also need to talk think in terms of the stakeholders and you will be getting some feedback from your stakeholders in terms of um goal setting i just want to re remind you about that um i know that there has been so many other things but it's you know whatever you guys decide is we will implement it's just a reminder in terms of goal setting and having there will be focus groups there uh there is an analysis of the interviews that they are conducting right now with some of our stakeholders and partners individuals and so you will have a lot of information also from that perspective thank you thank you trustee chavez we put a timeline on it say the second week of september um i'm not may i even i think that's our next meeting right i think that's the point we're making in regards to the brushing it i thought we had one in august i'm actually putting it two months back oh i'm sorry i'm sorry i i think if if we have a timeline we're more likely to meet it by september versus postponing it till later um superintendent would two would 60 days be sufficient two months if if i may um suggest the october meeting trustee chavez i just need to circle back with the agency that is the glenn price group that is working on this i believe they they already interviewed some of you i believe uh and so that's the kind of of data gathering they are going through right now i just need to circle back some of the partners have not reached back to them you know what i'm saying so they will i will be able to give you a better uh sense of timeline um in the next four meeting uh or in our one-on-one but if you allow us to do the october i think it will give what i will consider plenty of time october will work so do you want to put that in the motion or yes please so do you have the emotion that um okay so we'll do there's another motion on the table but okay so we'll approve the to approve the uh the handbook uh by october 2021 uh for the first draft and the the goal i think approved that first half today yeah right with the edits and then i wasn't done yet okay with the edits thank you i'm sorry um yeah i don't think i did october 2021 first draft with the edits is that not my understanding but uh let's see trustee i mean i i understand as trustee chavez stated it and maribel repeated it i just i don't think that motion reflects the discussion that we just had because based on the motion we're not approving anything tonight we're were that we're just pushing it to october basically i think if i may um just to recollect the conversation i think what trustee chavez's intent was if you'll allow me is to approve approve a first version or draft or whatever you want to call it tonight with the acknowledgement that grammatical errors will be sent and corrected and in november i mean october we will finalize which will include the goals that's kind of perfect so no action today thank you for uh clarifying that um trusty chavez so actually the way he said it but without the first draft uh language in it just say approval for the handbook by you know and then put the stop date on it and then you know of october 2021 with with the edits that's not what i i'm sorry go ahead vice versa i'm comfortable with the draft part because it is a draft because if you say approval the handbook then we approve the handbook instead we're approving the handbook in october correct okay let's move forward let's let's do that with the first draft okay is that comfortable for everybody okay uh so can we can we vote on it what so what are we voting on tonight i just want to make sure i know what i'm voting on can say i know but let's see can somebody repeat what we're voting on right now i think what i heard was that tonight we will approve the first version or draft i don't know what language trustee chavez wants to include but something along those lines um the first version with the acknowledgement that grammatical edits will be sent and corrected and in october and so that will be the first version approved tonight with this um motion and included in the motion is the acknowledgement that we will approve the entire document including goals in october so can we put the language to be finalized in october 2021 so it puts like a final date it we have till october 2021 is that okay yes could be finalized are you okay yeah i agree with them okay all right yay thank you we'll go ahead and take it to a vote and my screen's shifted here trustee chavez aye rusty pam aye festival fellaini hi vice president quintero hi and myself thank you all right item 407 discussion under action to reduce board members uh compensation for education code i'm gonna go ahead and open up to superintendent bower for um some of those details you were talking about and i would like to just mention i would like for the board to table this item until we receive the data from the state i'm gonna ask rogelio to explain the ed code because this is a an unusual formula and i would like for the public and for you all to be very clear about the formula thank you good evening board um so uh under the education code that section that's cited in the agenda there board member compensation is um benchmarked to average daily attendance ada in the district so for very large districts those board members receive monthly compensation that's greater than small districts with much less ada for purposes the reason we are having this on the agenda and this discussion is that under this ed code section for school districts that have ada that is less than 10 000 for the 10 000 or less for the prior year the the monthly stipend compensation is reduced to i believe approximately two hundred and fifty dollars a month that is not that two hundred forty dollars thank you yeah that that is not the end of the calculation so what the what the education code says that section says that for purposes of of of calculating average daily attendance for purposes of determining the board member compensation the ada for the prior school year may be increased by a school district's percentage of excused absences reported for the 1996 1997 fiscal year so uh that is in um education code section 35 120 89.

the event was organized and funded through the parents years ago this year that didn't happen due to the lovely pandemic as some people say the covid caused it and it was a cover year i got a phone call a couple weeks ago before graduation i need your help you got to help me the board was going to be the board dr robitazi was talking to the group that i belong to clifton against substance abuse i'm the vice president of substance clinton against substance abuse since 2006. i've been project graduation chair i can't remember but i've been i've been volunteering my time since 2003 for project graduation got a lot of t-shirts up in the bin in my in my um in my attic people do not realize the amount of work that goes into that event and yes jim it was paid for by the board of education and yes there was rules but we never had adults try to sneak somebody into the event we've never had anybody go to the links to what they did to get two students in there the whole event cost sixty two thousand dollars with the in-kind donations from other events and that's without the sros i don't know if they were billed i don't have that figure yet and i'm speaking from the knowledge that i have from what i did with the report because the report has to go to the governor's council because not only do we report to the city on this we also report to the state on the findings and all this information has to go down to the state on the report it's called um it's the governor's council on alcohol and drug abuse it's chicago and this year we were asked to do it to do the to do the bus the bus loading and the chaperones i didn't want to do it because i only had a week to get people on to get people to volunteer went back to my group they contacted dr roberto we'll get people we've had some issues with students on the trip but it was it was handled in-house with administration people just not arguing arguing with each other minus stuff nothing to this degree we wait and then we load them on the buses we take them where we need to go we do rotations we were for short i usually have five floaters but we were four short so i had to break up my teams we had to move everything around and it's not easy organize this and i'm not i'm not looking for metal and i'm really disappointed that the people that volunteered that night were never thanked or properly notified i don't want to take the credit and i thank you jim for acknowledging me but this board even going back to the previous administration never thanked the people mary ann cornett did it for years and she never even was properly thanked it's just it's really i don't understand i don't understand that it just boggles my mind the event was fully funded by the clifton board of education however clipping against substance use did donate money to the course it was so much a kid we uh we paid for all the extra entertainment that night because there's it's just not what you see up there it's other entertainment and we put everybody out to work and they do rotations and they stand on their feet all night long some of them sit they have a chair but they're people that come back year after year because they believe in the mission of this project to keep them safe all night in an enclosed safety environment the people that come back don't care they have to go by work the next day they care about keeping the kids safe so when people get upset because the value of that arm band wrist bracelet whatever you want to call it is the ticket to get into the show or the event it's worth the life so i don't know how much anybody values a life but it's not 125 dollars it's a lot more to that to me it's priceless so when they come up here they rant they yell they they holler they hoop and they go and they take an hour and sit in the parking lot with their administration because they've done that for 20 something years that's because they've earned it they've earned the night to relax that's what they do i usually do the rotation i had to do a shift because i had a new new person that really didn't was uncomfortable so i stayed on the shift when he got comfortable i would jump off go someplace else i had i had chaperones that were doing the same thing as me and i commend each one and every every one of them for doing what they do we give them a t-shirt that says chaperone on the back of it with the logo they collect them that's their pay for the night a t-shirt what do you put on a valuable life i know it's not 125 to me two kids of mine went on that trip 2008 2014.

we didn't have the data this year we have the data so you'll notice that that percentage has changed and then you will also notice something that i had asked you to approve a while back and now the high school has also approved it with this iga that when bus drivers are hired by either district they are technically the employee of whichever district gives them the most working hours but we but each district will also have them on their employee list the others on their employee list so that we can make sure that any any benefits or any uh any anything that comes to those drivers will benefit everybody who is eligible to drive in both districts well the raises the high school district has to work on their raises you know for their for their direct employees but for instance um i think they have about 15 drivers who do some driving for our district like for after-school programs and those kinds of things so when they clock in to drive for us they will be paid at our rates for that for those for those hours and that hasn't happened in the past so this is a good thing for you know for them and for us and uh and encourages them all to feel like they're one you know one big department as opposed to two departments do you know how far off we are compared to the other district i mean we we gave we're a a race yeah 30 we're 30 cents higher an hour because our district approved those raises a year ago in the high school district didn't have the funding to do that mr silk and i have discussed that i've told him you know i made sure he knew that there was that difference um and and how that happened but then i also indicated to him um that it is likely that i will be recommending to our board another uh another race for our our all of our employees um we're not ready to do that yet it will come probably next month but um after i work through the numbers and make sure we have the money to do it but i wanted him to be aware up front because that does create some friction creating this nice cohesive environment where we're working exactly and then all of a sudden we're driving the money wedge in between exactly we're going to lose drivers they're going to lose drivers and we're not going to be able to we won't have enough room for them but we'd happy to take them because we like to have full numbers exactly exactly and we're and we're very conscious of that so we've you know we're trying to work with it a year ago when i recommended that raise for all of our employees so you know the bus drivers their par their salaries are part of a whole salary uh uh placement schedule for all of our classified employees and and at the time it was mr flora's intent to take you know to take a proposal to the high school board for uh for increases in salaries it just didn't happen and so circumstances kind of drove that i know that both districts have a very very difficult time yes keeping bus drivers leave we might get a few trip drivers are very difficult to find yes high school district uses elementary elementary uses high school districts the buses are shared and i would hate to see a wedge drive between absolutely or even further between um but i would like to see everyone come up yeah exactly and esser is a great example of that also we gave that to all of our staff members and there were bus drivers because they were they technically weren't our drivers they didn't get that but that was a big problem and had had we had them like we've described here where they are at least partly our employee you know that we have them listed they would have gotten some of that money so uh um you know and it was too late to undo that you know the first of june it was not the time to do that but that also brought home the idea that we that's why it's important that we have those even if the high school driver has listed it for us as a .1 fte which means they might only drive one hour a week for us at least they're still listed as one of our employees and then we you know then we make sure we treat them the same way that we treat everybody else the other thing that's going to help us we think we're hopeful of this um a year ago uh when uh representative fillmore was here one of the and a number of the superintendent more than a year because it was pre-coveted so whenever that was and the superintendents were here from the county the other county superintendents to meet with him and talk about legislation darlene cauley who is the superintendent at littlefield and they're even in a more isolated position than we are relative to getting bus drivers because the law said that we can only hire bus drivers who are certified in arizona so if you think about where littlefield beaver dam is and you know up in the colorado strip but just in that little corner they don't have that many people so she had asked representative fillmore to sponsor a bill that would allow us to hire across from across the river to hire people who are certified cdl certified from nevada and from california to you know help us increase our our pool of drivers and that bill did pass so we know we have we've already had some applicants from folks across the river so that'll help us a little bit if we can get them and keep them great any other questions all right i move we approve the transportation iga second all in favor aye corey burgess hi jeanne borland i'm anna aymond aye charlene diaz so moved item 8.7 board member resignation and replacement dr stewart mr president and board members we have received a resignation from brandy dubois from the board effective july 6th which was earlier this week and so you will need to take action on that but you will also want to consider how you want to handle a replacement situation and i sent to you today a copy of that policy to help you determine how you want to do that and what direction you want to give me relative to that so one of the things we'll need to do is accept her resignation but as far as looking for new board members i'd like to publish it with a newspaper ask them if they will put that in there that we're seeking a candidate to fill that spot open it up to the public maybe put it on our facebook have some people that are interested submit some letters then at that point we review those and decide as a board what recommendation we'd like to set on to mike philip in kingman any problems with that um if i could get a little clarification i suspected that that was the way that was going when you get the letters from these uh from the applicants do you want to consider the letters in the in the workshop at the next regular meeting do you want to you know how do you want to do that before you make your uh do you want them to have an opportunity to speak to the board how would you like that part of this do it on an agenda so that way we can make action and take care of it so do you think that this is something we could take care of by next month is that what has to be done within 30 days it does say within 30 days and and you're probably okay with the next board meaning i'd have to look at the calendar to be sure but i think the next board meeting is it might be 31 days let me look at the calendar that doesn't help us does it that's more than 31 years it's more than 31 days we don't accept brandy's resignation until next meeting but you can't publish if you if you don't exactly until the 13th and then we have our 30 days we have another meeting on the 13th you could do that you we could put this on tuesday's agenda then you would be except you could just table this for now you can um and accept it on the 13th publish it on the 13th that gives us the time um because then we're still in our 30 days to get it done by next by our following meeting because try to do it by 13th is impossible it's just there's no way we can do that um and i don't want to have a special meeting to send a recommendation unless you guys really want to have a third meeting in july so can we just table this until the 13th yes okay let's table it till the 13th do you guys have to vote on that you do have to vote on that then i move that we table item 8.7 uh until the third the our next meeting all in favor aye corey burgess hi junie borland hi amanda ayman hi charlene diaz it's all moved okay item 8.8 replacement for the health benefit trust board dr stewart uh mr president um i think you could probably do this even without and that's tricky i think that i think 8.7 and 8.8 probably both need to be tabled and maybe just 8.9 as well i'm sorry eight point yeah 8.8 and 8.9 should probably both be tabled item 8.8 8.9 until our next meeting i'll second that motion all in favor aye corey burgess hi genie borland hi amanda amen hi charlene diaz sorry so moved okay uh future topics do we have any other than those items that we're tabling any other future topics for our next meeting nothing to add okay if you do have something does come up please send that over to kim so she can get it forwarded onto me and we'll get that on our next agenda um upcoming board events aspa is holding the 2021-22 luncheon and learning webinars you have the dates in front of you these are open to all board members if you can attend or would like to attend please let kim know and she can get you signed up for those and once again throw a little pitch in there for the law conference if you can go it's really good and it will be in person this year so it's going to be in person yes and it's that's probably the bet it's a very it's a very it no it is a very good conference just so you guys know they've already opened up rooms and people are already signing up so if you want to go i need to know probably quickly just throwing it out there so just take a look at your calendars if you can let us know but of all those that would be the one i would say is it's it's very worthwhile all right um 9.3 date time and location for a future meeting we have the 13th a workshop is later than five better i get off at five so so 5 30 better yeah okay definitely better so let's do that uh everybody okay with moving that to workshop at 5 30.

and so to to do this calculation there's a formula we have to look at what your ada is for the prior year and then we have to look at excused absences for the 96 97 fiscal year unfortunately uh the method of reporting ada has changed over time and so the the part that that is missing from this calculation right now is what the excused absences were for the district in 1996 1997 i understand that the staff was looking through the district's hard files uh the cold storage and we they cannot find that data in your warehouses and so i know i understand that a request has been made to the state to see if the state still has that information available if it does then that may change the calculation on this there's one other issue that i want to alert you to which is during covid because of the impact on schools there was a hold harmless for school districts in terms of ada so what that means is that for funding purposes ada wasn't being measured last year during the pandemic the state was allowing school districts to use the reported ada from the previous fiscal year 2018 2019 so it's true that alum rock is a declining enrollment declining ada district but again because of the formula it's impossible at this point for me to be able to tell because of the missing information where the appropriate board compensation should lie under the ed code where i know that the superintendent is hoping to hear from the state in terms of archival information regarding 1996 97 fiscal year absences reported absences and excused absences but if we don't have that information within the next couple of weeks certainly before the next board meeting then i think the board should just take an action to to reduce the stipend okay i see many hands up um so hmm nice we'll go ahead and have that cover around one second hold on a second we'll have a conversation first since we're not sure we're gonna take a vote on this um and then open up for public comment go ahead trustee travis okay since um since i first read this and this was passed into in january first 2019 i was always asking dr bauer for how many how much was the ada's and so the last number that the district reported was 8 500 and then the crow report said that we had less than eight thousand and i said whoa can the state later on come back to the trustees just like the error that was done previously that one of the trustees spoke tonight it wasn't the trustee's fault it was the district heir but now i'm kind of trying to go on the side of caution because if indeed we do not do this or can the state come back later and charge us 160 uh the penalty each month thereafter that we don't do it so i think because the language and the law is set up clear for the districts that are lower than 10 000 and clearly we don't have ten thousand should we do this now and we and reduce the stipend to be on the safe side for one and to be on the law side for two um trustee travis i know you asked a couple a question there was that a question for rochello or you were just putting it out there uh i know i heard at least one question what was the question you heard can the state come in yeah i don't want to put words in your mouth was that a question for rogerio or no i i or the d.a because the da's the one that's coming after the trustees now because this is public funds and if it doesn't belong to us i don't think that we should receive it i think right i just want to make sure that that might if you will let me finish please my thing is is that we should correct this now instead of later um because it is the law thank you okay that's not that's not a question so i guess it's not a question to mr ruiz okay trusty fam okay so mine is a two-parter so question to general counsel so basically uh what what's needed to calculate under the relevant provisions of the ed code is current or current ada plus the was it the number of excused absences for 96.97 and then if that equals 10 000 then our confidence for in that case our compensation is set at the correct level but if it's less than 10 000 then yes the board will need to reduce its stipend am i correct thank you yes that's absolutely right okay so basically the long and the short is we are missing so we have you know it's kind of like a equation so you know a plus b equals c so we have a but we need b to figure out c okay very good so um based upon that uh you know i just want to preference we're not in this for the money i mean you know this is a small stipend this is pennies on the dollar i'm not i have a full-time job myself would benefit so this stipend is not important to me but given that it has an implication in regards to our district's ability to fight for funding and to maintain a sufficient capacity to provide an education for our students and i end up as dr bauer did reference that she has put in a request to the state for the 1996-97 data uh you know i believe that in the in the interest of the district um i would motion to direct administration to get to find this data and make it available by the uh was it by the end by the 31st of october and then to bring table this issue until the november board meeting and that way that way you know we we have a firm deadline we have directed the administration to get this relevant data and then at that time you know based upon the information we get from the state this board can take action at that time thank you trustee fam i see you vice president's hand up and then trustee chavez now the reference was made to a trustee i spoke earlier were you talking about trustee that spoke during public comment from another district or a trustee on this board from madam president no are you asking me the question yeah you uh remember okay so before you uh you were late today so you didn't hear a former alumni trustee come and say that the error was not any of the trustees fault because none of not this board nor the any of the previous boards going back 20 years ago since the district has been making this error um they were charged um the amount back because it was an error and they now have to pay it back so before you came this is the discussion that she said and so i'm saying to avoid all of this and um i know it's your time so i'm gonna let you speak and then i'll speak after yeah so oh i thank you for that clarification i was confused as to who was speaking you're talking about san jose every board member karen martinez who owes our district money and um and so you and i owed that money board member chavis you owed money to the district and you paid it i paid it immediately immediately i paid so we paid um so i'm not even sure why that came up but i'm uh but i think that there are ways in the ed code uh at code section 35120 has a provision so if there is any board member here who's concerned about any sort of repercussions in the future and stuff of that sort you can refuse to accept payment of the as an individual and nothing will happen you can avoid all this so i would suggest that if you have some serious concern you can go ahead and take that uh to avail yourself of that opportunity that the law provides uh while everybody else um you know waits to hear back from the state and settles this i think that it's very important um to make sure that this very working class area has the opportunity to to have some remuneration for those who provide uh who who choose to serve and and um and there is some recognition of of the work that's going on i think that our colleague uh went ahead and noted there's 18 meetings some of those meetings went up to three in the morning um it's you know we're not in it for the big bucks here um and uh that's most action does uh serve as a way of some remuneration and recognition of the work that's been put in by those who serve on the sport and i do appreciate that and um i will continue to support that if that's uh if that's allowed if uh council tells us we can continue okay good connection okay go ahead trusty travis i i want to give trustee pejerano a chance and then i'll go after because his hand was up before mine okay trustee with hirano yes thank you trustee travis so um i basically um i'm in agreement with everything that uh trustee quintetto just stated and i just um you know want to say that i i think we've been doing a good job as a board making decisions based on the information that we have um and i think that's a very prudent and responsible way to make a decision and like has been stated i'm my understanding i could be wrong but i don't think any of us here are dependent upon any com financial compensation to do this work i know that's not why any of us got into this but they're you know trusted keem federal reference there our time is you know you can consider it or some people might say our time is worth something we miss family events important family milestones in order to to commit to this and so you know when we get back to things there's also the question of the cost of gas and those types of things in attending meetings and all that so i would just say if if the data comes back and shows that we indeed should not um do need to modify then we do so and if it comes back saying that we are within um what is allowable and acceptable then then that should inform the decision at that time so um so that's my comment on that thank you okay trustee travis i'm gonna go ahead and say something before we go to youtube so i haven't said anything yet um so i i agree in regards to tabling it um until once we get that information and at that time if it is determined that we are then uh moving forward you know in in a way that um needs to be different that it's brought back um that's my suggestion otherwise we leave at as is and we don't bring it back um that's just my suggestion that once we get those numbers and it is determined that either we need to bring it back and make a change that it's brought back otherwise we don't need to bring it back again um that's my recommendation trustee travis and then vice president okay i i do have two questions um one of them first for dr bauer and the second one for mr rogelio and then i would uh make my statement after they answer the questions um dr bauer let's i'm just going to pick a year to make it simpler so in 2000 let's pick 2 000 when you 2007 when you first started and or 2008 any of the years that you started were any of the excused absences the total sum of 1 600 students any of those years any years stick out in 2014 as a superintendent no in 20 okay excuse me the the year you started or any year that sticks out to you that we had the highest excuse absences what was that number so when i started in alan rock i was a principal and i was not privy to the the district i'm sorry i i meant when you started a superintendent okay so that's 2014.

they still talk about it people still talk about it i get phone calls about it thank you for doing this i don't do it for the thanks i do it because i believe in the mission i yield my time i have one more other thing i have to say at the end of the day it's about safety security and what we teach teachers every day of their lives the health and welfare of children staff and the people that were on that trip that's the value of that ticket the welfare one other thing today was a very sad day in my family he used to watch these meetings especially when keith would come up and say keep bastford mountain view drive clifton i wasn't going to come tonight steve [Music] reswell i know you're not going to be able to watch these meetings anymore steve i just want to say one thing i wish i was leaning over the fence yelling out mamas mamas that's for you steve rest in peace good night uh miss belchon i'd like to thank everyone who stuck it out tonight i know it was and it still is a very long meeting hopefully we'll be out of here before midnight i'd like to take this time to thank joe and judy for voting their conscience and supporting me for vice president of the board it would have been a great opportunity for this board to put someone who reflected the demographics of this school district in a position of power our school district is 65 hispanic 65 percent only growing i hope in november that some other latinos and latinas choose to run to maybe change some of the faces that are on this board it would be nice for the students to look at this board and say oh i could be there too one day maybe you guys don't know this but i'm the first cuban-american elected in pasay county not just clifton in all of passaic county it's a pretty big deal cubans have been here since the 50s and i'm the first one to ever make it this far um in passaic county obviously menendez made it all the way to senate um but i'm the first one in passaic county um i'd also like to say that i think we need a training because the decorum of this board lately has been out of control to say the least we have board members commenting to people who are at the podium we have discourse going back and forth we have time sexist comments being made it's just i think we needed training from the school boards to either go over robert's rules of order to go over a proper decorum maybe even like a sexual harassment training a proper um how to run a board meeting we need some training because honestly i agree with a lot of uh the speakers who are coming up here and saying that we're disorderly because frankly i think that we are maybe it's because i'm a young millennial like uh for us but i don't know i just feel that you know there's a certain way nowadays to speak to people and to uh address the public and i think we just need to uh brush it up on our on our on how we react to things and that's all i have for tonight thank you vice president casper dr danny congratulations i'd like to thank my fellow board members for your confidence this evening i'm looking forward to working with all of you to make the next six months as great as possible i'd also like to um let mrs popovich and mr burnsack know i'd like to bring your topics back to the education committee so this way by our next meeting we can have some answers for the public i'd like to welcome and congratulate our newly appointed administrators thank you thank you for your time that you will spend with us in my last comment to dr robert tozzie and mr smith thank you for your leadership as well and helping our our district run as smoothly as possible thank you thank you to the public um we're on a stage here and on this stage which is meant for productions there are enormous amount of spotlights and somebody who suffers from migraines looking into those spotlights is a tremendous detriment so while i don't look up at all times i do take notes at all times but the other portion is because of those lights so i don't want people to think that i'm not listening to them or addressing them um but i just wanted that to be known um i do take notes tremendously so that the board uh has the information that we need uh so i am listening to everybody um but just because i don't make eye contact i mean no disrespect to to anybody um so if you see me at times looking down at school six we don't have that issue um so i just hope that people will understand that to those that are still here and those that are still watching yes we apologize to everyone tonight if i could just step back for a second when administration comes to me and says that we have items for executive session and in most cases this board always meets an executive session at the toward the end of our regular meeting we have always made the exception when we talk about student matters and tonight there was a student matter so administration asked if we could do executive session in the beginning this is not something that happens regularly and i apologize that it did happen tonight no one intended for anyone to wait to not be heard but on the other hand this board doesn't go into executive session and and sit around and have a party we had important information and things to discuss and without as the attorney would tell you without allowing every board member the opportunity to discuss and as miss beltran said maybe there needs to be some changes because board members will speak on the same topic 20 times in executive session so maybe going forward you'll speak once and we'll move on and maybe our executive sessions won't be so long but then the law says well if you don't allow board members then they're going to gripe that they didn't get their opportunity to speak and give their information and their input so you try to allow both sides to it unfortunately tonight the public got hurt and that was not the intention of myself and i'm sure of administration we do not take any pride or joy in making people sit around for two and a half hours but this board was working in the back room for two and a half hours so i will work with administration going forward to make sure that if it's student matters we will meet with the student matters and if there's other matters in the executive session we'll do those at the end we'll come back out to the public and then go back into executive session i think that's a fair assessment to make in no way did we want to halter anyone from speaking and if you look in the past history of this board and last year's board that i was that i came on there never was a situation where we had to go into executive session for hours upon hours unfortunately those issues happen tonight and again i apologize to everyone that it happened but going forward if they're student matters we will address them first and then we will come back out and if there's any other executive session we will do it at the end of the meeting so that the public does not have to wait and just so the public knows the board will stay here for whatever hours it needs to discuss those other executive session matters that's what we're here to do but nobody should have to wait around for hours and last meeting was an exception for a special meeting and that was the only reason the meeting was called for us to discuss things in executive session and then come back out we cannot possibly estimate when we give an estimate of how much time we're going to be there it's truly an estimate i cannot tell you how many questions the board will have what topics come in an executive session it is totally out of control so in the beginning when i give the hour estimate i'm hoping that the board hears that i gave an hour and will kind of move it along but they have every right to ask every question the board needs to be thorough on on all those matters so again i apologize to the public tonight you shouldn't have to wait around and i'll i will do my best with administration to make sure that doesn't happen again uh going forward and if we have to do two executive sessions then we'll do it i'd like to thank my colleague uh congratulate my colleague dr danny on her uh her doctorate um mr casper and miss danny are both educators on this board and they work very hard in educating the lives of kids and [Music] mr casper with your masters and um and and beyond and miss danny now with your doctorate you truly are bringing uh your uh expertise your education and helping educate the lives of students and that's what education and the board of education is all about and i congratulate both of you and wish you continued success with with your degrees mr casper i congratulate you on your vice presidency to the board i know that you will bring uh your experience your expertise uh to the board and assisting me in administration as well so congratulations to you you know i i don't want to elaborate on too many things um that people said or or didn't say um but and i don't like speak for other board members but other board members have spoken to me if anyone in the public got the wrong impression that this board in any way was trying to cover up was trying to show that we agreed with what took place at project graduation that was the furthest thing from the truth and it was portrayed that way you know i i don't know what to say but that was the furthest thing from the truth that is why it took and i don't know i don't know if anyone timed last week but that's why it took a long time in executive session last week because it was something that we were just throwing under the carpet or brushing under the carpet we would have been out here in minutes but it wasn't people voiced their opinion so to state that anybody up here agreed or was trying to sweep anything under the carpet absolutely not but as our attorney will reiterate to you no board member has the right to discipline punish any board member not only do we not have the right we can be brought up on charges and ethic charges from the board member we tried to discipline for trying to discipline them we don't have the right to do it the public is the only ones that have the right to do it and if anyone wants to file charges we've said that in the statement what to do but in no way was i and i know many other board members that spoke to me none of them were trying to throw things under the carpet or try to hide anything two hours plus an executive session i think proves that i'll finish up by again reiterating what mr daley said you have one of the best superintendents around and to discredit him to put him down to ridicule him to accuse him of things is beyond ridiculous he cares about these kids more than anyone i have ever seen this town made a true investment and made a great decision on bringing a superintendent like dr robitosi here he does not deserve to be put down to be ridiculed to be called a thief or someone that accepts thievery however was brought he doesn't deserve those things i think the public truly sees what type of superintendent we have and what has he accomplished in the short time that he's been here i think his actions speak for himself so please don't try and put the superintendent down he's doing a great job last thing i'd just like to congratulate all of the appointees tonight uh all those that are new appointees and those that have changes in their titles and um other positions that they're moving into we tremendously thank you and appreciate your years of experience and dedication to this town and i thank the majority of this board for supporting the superintendent of of schools on his recommendation for positions in this district thank you okay we'll move on oh i'm sorry move on sorry presidents i'm sorry no doctor overtones he goes first i know i'm out of order but i just had a quick a quick comment in there let him go first superintendent thank you thank you uh mr president first and foremost uh hardy congratulations to dr danny i had the privilege and honor of um being on her dissertation committee today and uh was part of the three members so when you defend your dissertation after you spend a you know years writing it you have to defend it and you have a an advisor and you have at least two other members who have doctorates on that committee and then you you present it and you get grilled a little bit but i have to tell you dr danny was amazing tonight in her in her dissertation defense i was extremely proud to be a part of it because i know this is a day that you will remember for the rest of your life so i'm very very proud of you on a personal and professional level it's truly an accomplishment so congratulations to you dr danny it has a nice ring to it too doesn't it and we'll get you a new sign i also want to apologize to the public for the executive session tonight taking so long um and from the administration's perspective we will do a better job of getting the notice out to the public that if we are going to go into executive session first i take responsibility for not getting that notice out to the public um if we are going to executive session at the beginning of the meeting in the future we will notify the public in advance so that people can adjust their schedules uh accordingly so again i apologize for that was certainly not anyone's intention to leave you out here waiting we did have important business to discuss we actually had a hearing for a student matter but nonetheless we could have given you notice and i take responsibility for that there have been a couple questions about what september's gonna look like for school and um we did do a presentation at our june 10th board meeting mrs kusalevich uh mr gingaro and our executive reopening team where we've clearly stated and i'm going to state again tonight september will be full day five days a week full schedule with lunch the governor has stated a couple weeks ago that the wearing of masks will be left up to individual districts now that could change if if anything like the past year working in a pandemic the way the guidance kept changing that could change but if september 1st is here and it is up to the district to make a decision on whether students are required to wear masks my recommendation to the board of education is going to be that we give parents that option give students an option whether they want to wear masks or not i don't anticipate that this board is going to mandate that so that's on a question that's still out there we know there will be more guidance coming out this summer so we will follow the law we will follow the guidance from the new jersey department of health and we will follow the guidance from the new jersey department of education but i expect september to look as close to what we consider a normal school year as possible i want to thank the board and also congratulate the clifton education association tonight for ratifying a new four-year contract the cea and the board negotiation team worked for months negotiating this contract it was passed overwhelmingly by the association members and unanimously passed tonight and good labor relations are good for education so congratulations and thank you to the board i'd also like to congratulate two new members of my administrative team mr keegan mr bertolini my advice to you i was sitting in your chair my first administrative job was the vice principal and it's probably where i learned the most right it's where i dealt with dealt with kids the most and my advice to you is this always do what's best for kids sounds simple but you will be challenged and there will be circumstances where you may question what is best for kids but always do what's best for kids in your heart and i will be there to support you along the way so congratulations on this new journey and finally um just to address project graduation very briefly i'm saddened that i came to this board because i wanted to make sure that our kids could have a project graduation this year i remember my own i came to the board in june and i said i know it's short notice but casa doesn't have the money the kids don't have the money we can do this we can provide this night for our kids and i explained to the board all the reasons why it was a great thing for our kids and you know what this board said yes dr robert tosie we agree with you this is great for our kids and what saddens me is that instead of celebrating what a great night it was because it was a great night overall the kids were amazing and always when i say kids i don't mean that disrespected disrespectfully those are my kids something kids had an amazing night instead of celebrating that it it's it's been tarnished and the person has taken responsibility for that what happens next i don't know but i have to publicly thank this board for providing that night for our kids most of them have no idea what's going on here but i know that they appreciate the fact that they had the opportunity to be there so thank you for supporting me and by virtue of supporting me making it a great night for our kids and finally i hope that everyone has a great summer i cannot wait to get away for a couple days and shut my phone off and not check email and uh i'm not sure if that's possible but i'm going to give it a try so i hope that every one of our board members has an opportunity to go away for a few days this uh this summer and i wish all of our students a happy and healthy summer and we will be back for a board meeting august 5th and again on august 26th we will have more details on what the next school year will look like so thank you and have a great night yeah i just wanted to add to one thing um sorry i was looking at my notes and uh i know i'm out of order so if you can forgive me just give me 10 seconds uh it was mentioned that you know obviously you all know me about responsibility and i want to make clear that the not one parent of any of those children reached out to me said give it to my kid so i want to make that very clear not one of any of those parents from those two students said give my kid the bracelet so i just want to make that very clear okay uh the board will uh next our next board of me education meeting is uh august the 5th uh 2021 and motion to adjourn so moved mr daley second second second by mr awad any objection meeting adjourned you

all right yeah that way we're not running into problems there we're going to that's going to be our big one though this is a big this is this is the first yeah it's the first step in the strategic plan and us talking about so3 and and i don't think you're going to want to rush through it you know do i think it will take an hour and a half maybe not but i think if you're really going through it thoughtfully it's going to take some time do you think an hour's enough or should we move our meeting to seven it's hard for me to guess i've had the meetings with all kinds of other stakeholders you're the last stakeholder group plus it's an open workshop and other folks who maybe couldn't attend those other meetings might come and have some ideas so i i kind of thought maybe an hour and a half would be a good a good time so nobody has to hurry you don't have to rush through anything everybody okay with seven yeah all right let's do that then so 5 30 and 7.

when i started as a superintendent there were 12 000 students about 12 000 students um the average attendance of those 12 000 students was about ninety five percent so five percent i just wanna also say that before i started as a superintendent the state had no more excuse absences this all of these um plays into this formula and that's why i'm very i'm respectfully asking you to really let me get as much information from the state as possible because just if you were to extrapolate and i'm not a mathematician but just very raw math um if you when i started in fisher middle school alum rock had 15 000 students 15 000 that's what alum rock had so i suspect that in 96 and 97 those were the years where you were at 16 000. so if we have a pattern of attendance about 95 percent you're always above 10 000 no matter what right and so that's why if if it had not been this particular number this huge number i would not be asking the state i would not be you know i would not i would recommend you know let's follow exactly because i'm with you trustee chavez i don't want anybody to pay back i know that's not comfortable for any family i don't know whatever your case is is not comfortable for anybody i i agree with you but i also know that the numbers that the data is not what what we think it is it's not the the below 8 000 right now that when you look at the formula you you have a lot of room for being able to keep what it is fair because this is about being fair none of you i mean when when trustee pejerano said uh to me the other night is you know we have had 16 meetings uh if you multiply the hours not only that you were in a meeting but that you spend with me and i do appreciate that because you guys reach out to me you ask questions you do all of that on your own time you are way below the the minimum wage if you're talking about you know if you're talking about remuneration so this this 400 a month does not cover the amount of work that you as a trustee do and so i just want to be fair in terms of honoring the formula who knows they might change someday i don't know but that's what we have right now right and if because the number is so significant i am pretty sure that and by the way this is my second time reaching out to the state the first time we reach out to the current student information warehouse the calpads and they don't have anything before calpads and this is the state so i had to figure out do a little bit more digging to see what other department in the state may have this specific information so the apportionment department is the department in charge of the number the money that every district gets and obviously you get that money depending on the ada right so they have to get they have to have something you know because they they're the ones that deal with the money the response that i got just you know you ask and i have to explain [Laughter] the response that i received from the state was that they are under covet right now the states the rest of us are back in you know in real life in the the that they are because of kobe they are delaying in the responses uh right now it's in the very beginning of the year where if the governor just approved the budget they're figuring out how much everybody's gonna get so i don't know if i'm gonna have an answer by the end of the month this month can i want everybody to know that okay you've been trying to ask my other can i finish my okay so my other uh thank you dr bauer for that uh explanation so um before i ask him a question in response to what you said even though if like you said the average was five percent um and if you had twelve thousand four hundred ada's you would still it would still be that you were you would you had to have reported fifteen percent absences in order to come up with that one thousand six hundred uh more figure that you need of 10 000 ada's i uh mr race let me uh ask you the question uh i think please correct me if i'm wrong i think i heard when mr uh pham asked you if we should do this now i i thought i heard you say yes uh me i have no problem returning any money but i don't want to take money that doesn't belong to me and that they overpaid i i don't feel right about that so mr reese since you get paid the big bucks what would you recommend well so let me clarify something so there are two different numbers involved one is ada average daily attendance which you report every october november that time frame and then the other is the total number of excused absences for 96.97 so those are two two entirely different numbers i think to your point remember chavez you're saying well you're doing the math you're doing the math and you're saying well there would have to be a total number of absences uh to to get a thousand but and i and i understand and i appreciate that way of thinking about it and that's one of the reasons dr bauer and i have been discussing this is because in 96 97 i'm very confident looking at historical data that your total enrollment and total ada at 96 97 was much higher than it is now and my experience in this area tells me that with you know 16 17 000 enrollment in 96 97 if you had uh you know that you probably had in that year you know a certain number of absences probably most of which were then considered excused so having worked on this issue with other school districts that's been my experience looking at historical data is there were there were a large number of excused absences back then and so that you know once we plug that number into the formula it pushed districts over certain thresholds so you know to get to your original part of your question i don't believe that mr pham i could be wrong but i don't believe that mr pham asked me that i agreed that the board should take action on this i you know i see it as my role as just to help guide the board on what the issues are and i would just say that there is a critical uh there is a piece of information that is critical that is still missing and we are sort of in our last place where we might be able to find that information and so and hopefully within the next 30 to 45 60 days and so i would you know i think it's it's ultimately the board's decision whether or not he wants to act on this tonight i would also say that you know the board vice president was correct that it's clear that the board individual board members do not have to take all or any portion of the stipend that's granted to board members that is an individual board member choice there's nothing that any of your fellow board members can do to make to compel you to accept that so i would say as a matter of individual choice if you do feel uncomfortable with it you can certainly make that direction to the staff as well um and then i have one more question when when i guess you're both going to ask the state about that that inquiry um can you ask what number like what's the final number if we do consider the absences and stuff so is it always just blank ten thousand adas or you know i i just wish that they would clarify it you know because now that you put the other part in of the 1996 and if we work next year on it is there a number like a stop number could you ask them on that well i mean the code gives us a formula for all different districts of all different sizes but i can assure you that once we get our hands on that data we're going to lock it in a safe [Laughter] [Music] it's it's always very difficult to find archival data like this and so once we get it yes it will be preserved and this will be crystal clear going forward thank you you're muted go ahead vice president uh madame president i think you set forth a good course of action which said go out there get the information and then um superintendent can go ahead and work with council to crank out that formula and if there is a change that needs to be made then bring it back to the board if the data says that there's nothing that needs to be changed there's a reason why we need to continue to belabor this point so i would suggest that that seems to be the consensus of the majority of the board and we move forward and stop uh spending so much time on this one item because that's me agreed thank you uh trustee fam anything else you'd like to add to that no okay with that suggestion i am okay so i'm willing to amend my or you know to direct administration and general counsel to find that indeed a report back to the board and great i don't think there was a motion so i think uh are you uh superintendent you're okay with that just get getting the data and then if it needs to come back for a vote then we'll do it at that he did motion i'll second it now he did make a motion earlier i did and i did yeah and i'm second in it your second is the motion earlier yes he made the motion he made the motion as soon as he started talking he made the motion remember you don't miss he made a different motion so i'm just wondering what you're seconding i'm seconding fam's mo motion i don't think we need i guess what i'm saying is i don't think we need to vote on this no no i made a motion to table at the time i made a motion to table right and i'm seconding his motion i just want to confirm trusty found because i know you said dates at that time and all that so that's why i i said i am amended the motion just to direct administration in general counsel to get the data and report back to the board you know when it is received and i'm seconding the direction the min fam game perfect thank you trusted travis we'll go ahead and open it up then for uh public comment at this time uh madam president at this time there is no comment okay we'll wait a couple seconds and just to clarify uh board member fam's motion your uh report back to the board could be a report to the board via a written message that hey the formula came back we don't need to take more time on a board meeting to deal with this right yes yes you can thank you okay um any other uh chavez anybody else raise your hand still none madam president thank you okay um justine i think you had your hand up before we moved on you didn't okay just want to make sure everybody was heard all right we'll go ahead and then take it to a vote trustee uh fam hi hi trustee chavez hi vice president quintero hi and myself i'm all right okay moving on to item 501 uh approved quarterly report on williams uniforms complaints and travis at the same time um motioned by chavez and second by quite are you okay with that is that correct yeah all right okay we'll go ahead and open it up for a public comment um first mr chavez no public comments at this time madam president thank you wait a couple seconds any now still none okay thank you we'll go ahead and come back to trustee comments concerns questions on this item all right scene none we'll go ahead and take it to a vote trustee fam hi hi dusty chavez hi vice president quintero hi and myself fine thank you adam 502 approval for school plan for student achievement can i ask a question one second hold on one second we'll go to the questions in a little bit uh motioned by trustee chavez uh but my motion is can we approve uh several of them at the same time meaning 502 503 504 505 and 506.
