>> Uh your typical conditions for vernal pools and wildlife habitat protection. Uh the applicant just changed the title to potential vernal pool. Um most of the language here is specifying within condition 62 and 64 that it is potential vernal pools. And then in condition 64 um instead of requiring the vegetated buffer to [clears throat] be planted with highdensity diverse native plantings to provide a variety of structure and food variety for vernal pool species to simply read that it shall remain in its undisturbed vegetated condition um except that it shall be kept free of invasive species. And that's the language that's also consistent with the ZBA uh condition. >> Are there any comments from the commission on that? >> I I'm I'm good with that. I you know, leave the pools alone. >> Do do we want to say, you know, if restoration is required, it should be planted with high density diverse it >> if restoration is required separate.
>> Well, well, let me ask you in a different way then. um because we have uh more teachers that are retiring that are coming in. Um so and I don't think all of those retirees are necessarily aging out so to speak. Um is there anything that has shifted within the system that's causing them to take advantage of their retirement earlier sooner rather than later? >> It's hard to answer that that question there. Um you know if you I guess if we value education then we will do all means possible to keep teachers where they are where and it's not all about the pay you know but it it could be about incentives on you know to attract people from from the mainland providing them some housing because it's so expensive to live here in Hawaii. >> Um but it it is being creative and thinking out of the box what it is like I said it depends on the situation depends on the area.
Never mind. We're going to be in an enforcement action. >> It'll be a restoration plan. >> That's true. >> And moving on to the perpetual conditions uh condition uh what would have been 80 uh storm water operations and maintenance. Um the applicant has adjusted the language and I apologize it's a little hard to sparse off uh to sparse what's changed and removed. Um, >> actually I just the entire section of it was just replaced with the first section. Um, I'm happy to go back to the prior language. I just thought it was very confusing. Um and I I don't I take no pride in authorship but I think the idea here is that um so long as the site is being managed according to the O andM plan subsequent uh any work that's done in order to maintain compliance with the O and M with the storm water management system uh you know shouldn't require a new filing.
Um but you know teaching nowadays it's it's not all that gratifying. You you have to love the job and you have to love the kids to be there and you have to love to educate and so um you know making it attractive in whatever ways possible. Um a lot of it has to do with pay but you know incentifying it within your community as well. um just looking for ways to to keep and attract people to stay there. And and like I said, it builds the it's it starts with the culture that you build at your school. As a principal, it's it's what I do and how I um I interact with my with my staff and that that starts, you know, my track record speaks for itself. I've only been at now four schools and the fourth one was kind of was an ask to to serve there and and I I didn't want to say no to my boss and and in in a good way and it wasn't a forced way.
>> Right. So you the part that part you've replaced and took out the stuff at the bottom. Correct. Just rewarded this. Correct. [snorts] Kind of the same thing. >> Correct. >> Okay. >> It looks fine. >> Yeah. Do you need to highlight the month, day, year, something that needs to be updated? Yes, we would uh put in the language citing the operations and maintenance plan uh prior to this going out to signature for you all as is the typical procedure >> and I apologize it's highlighted but the track changes is not showing it. >> Yep, that's good. Uh the remaining changes um in the perpetual conditions are all just removal of language specifically saying the condition will remain in effect in perpetuity um and shall not be be released by the certificate of compliance um or that the condition shall survive the expiration of the order of conditions.
It was something that I understood that I needed to serve in that school and I had a had a mean there. >> Yeah. Thank you. Thank you very much. Thank you chair. >> Thank you. you know the being principal is not an easy job and I acknowledge that and at the same time u many times retention retention of teachers are dependent upon the principal and the relationships and um and I hate to say it but I do have a school that I'm been told there are going to be 14 15 16 people leaving and because the principal and so it's it's it's very troubling when those kinds of things are brought to our attention and there's nothing we can do about it. Um and and we try uh we introduce measures but unfortunately you know those things are are very difficult. So we really appreciate the work that you've been doing.
>> That's already covered by the heading up above. The last one was a condition that was added uh for a permanent vegetated buffer. Um this is just referring to the ZBA's vegetated buffer um and clarifies that it shall be maintained around the wetlands um and that it shall be kept permanently vegetated. Um that's duplicative of the earlier conditions. And then the bottom section is that long-term invasives invasive species management plan um which was added to an earlier condition as well which is part of the >> right that that's the end of it you got to I will note that as of right now That's only 72 conditions. [snorts] >> Get rid of three. >> We've probably dropped a few pages, too. >> Yes. >> And for the record, I'm assuming that you're okay with the the conditions. >> We are, as we've discussed, [clears throat] very thorough.
Um, I'm fortunate that most of majority of the principles in my district are are excellent and we appreciate, you know, the work that that you folks do and in making sure that we have teachers in the classroom that can understand and reach out to the kids and not necessarily the most qualified but certainly in the eyes of the students because they can relate to them are very qualified.
Well, I'll make a motion to accept the order condition. >> Wait. Um, I think the hearing's still close. >> Is there anybody in the >> Yeah, I was about to ask if any I know it's >> public.
So with that any questions? I guess you you've been you know thank you for sitting with us but you've been able to hear everyone else's answer so you have the benefit of that I guess from your perspective what is the policy direction we go from here right I I think I asked the same thing and miss um you know one of the previous candidates of as you know the the legislature starting to step in right we don't we don't necessarily need to step in but I think we're being being arbiter what's your feeling of where things need to go from here and what what's the role that HTSB needs to I any I kind of wrote down here um I see it as taking the strengths of of everyone involved. You know whether the legislature have to be involved or not. It's not so much that it's more how do we leverage at at corno in my in any school that I'm at I leverage the strengths of people and that's how I I don't look at it as as oh you have this weakness or you can't serve here you can't serve there you start with the strengths right and so the strengths of the legislature the strength of the HST um HTSB the strength of the DOE and collaboratively you use those strengths to our advantage.
>> Is there anyone in the audience that'd like to ask any questions or comments at this point? >> There's still a few hangers on. >> I don't think so. I see no hands from our one resident remaining. >> All right. Okay. >> So, we need a motion to close the hearing. >> Yep. >> Yeah. Do I hear a motion to close the notice of intent 61 Waverly Street, map 15, parcel 12, the Guteras Company, D file number 95-1016. So moved. >> Second. >> Roll call vote. >> Amen. I >> Crow I. Crouch I >> Hackinson I >> Molton I >> Toledo abstain >> WS I motion passes the hearing is closed >> right now I can yeah >> I'll make a motion to accept the the issue >> to issue the order of conditions um as discussed for 61 Waverly street map 15 parcel 12 dutier company D number 95-101 [clears throat] Six.
And perhaps then you can find the incentives that will keep teachers, you can find the the pathways that um prospective teachers can be educated. Yeah. And and you know, we all know there's no oneizefits-all, but it's super hard to adapt to every situation that you have and you have policies that you have to set forth in order to make sure you have some consistency. Um so I look at it as utilizing the strengths of all the stakeholders and come together collaboratively for the better of the good. >> Okay. Thank you chair. >> Thank you. You know that's so important. Sometimes though collaboration no matter what you do ends up not happening and so sometimes you've got to pass laws or rules or bills to to make it happen. So, but thank you so much to for your >> patience and for your willingness to serve.
>> Second. >> Roll call vote. >> Acriman I. >> Crow. I. >> Crouch. I. >> Atinson. I. >> Molton. >> I. >> Toledo. Stand. >> Wan's eye. Motion passes. Order conditions are accepted. >> Thank you. >> That's it. Uh before you go, uh we've come a long way since we started these hearings and I think it was pretty efficiently. Um I know that we had some differences uh on our first sitewalk on different things. I I can't speak for the whole commission, but um I appreciate the fact that your team worked with us on these things to try to get the best uh project possible. Whether these projects are popular or not is another it's another discussion. We've had that discussion prior as well. We only have jurisdiction over what we have jurisdiction over here. um and you've worked with us with that to accommodate uh the concerns that we have.
>> Thank you. >> Okay. And finally, we have GM 757. I guess we keep the best for last support. We appreciate your your patience here. Submitting for consideration and confirmation Hawaii Teacher Standard Board Gupanatoral nominee Logan Noito for a term to expire 6:30 2029. And uh we have a number of people uh GM uh GM757 Osatoule from HSTA in support. >> Aloha chair Kim and members of the committee to be president of HSTA. Uh you have so many great candidates today and I hope that uh they will follow through with some of the things that they said that they will do. uh I have seen the board of education itself also start asking critical questions because of you folks and what you're doing here forcing them to have to do their job. So I just wanted to say mahalo for that. Uh someone who I know will absolutely um ask the right questions and won't just take status quo is Logan Okita.
Um I hope it's a good project. I hope for the town it's a good project and uh so thank you. >> Yeah, I think we've done everything we can to make it the best project that we could within our jurisdiction. >> Yeah, I agree. >> Thank you. Um and I appreciate the all the work and the time that's gone into um the liberation. I think the town um has been served well by the review process that the commission put forth. I'm not just saying that. Um I do think that uh the comments and the the information and the topics that we covered were um you know were good to talk through and uh we're excited about the project and uh we we uh thank the commission for all the work. Uh >> well, we appreciate your willingness to work with us uh and make this a positive experience for both of us.
She is my vice president at HSTA. She has the ability to hear from teachers across the state about their struggles. um as vice president she kind of his duties as assigned and so as president I've said your assignment is uh aspiring educator so she's had a lot of experience working with our aspiring educators and listening to their troubles not only that she works on standards and she's on the national board of professional teaching standards and we want all our teachers to be MBCT she is on the national board uh for those things so her depth is uh very deep on what she needs to know and she could be an asset to the board and she will ask the right questions and she won't do status quo. Mahalo. >> Thank you for that. Okay. Hope >> chair, vice chair and committee members. Um I stand in strong support of um Logan Okita.
I think I hope >> well we've been doing this a long time. Um you know, we're a small company, but we you know, we kind of live and breathe uh permitting projects and building projects and all uh around, you know, inside of 495 and just on the outside of 495. That's uh we don't do projects outside of Massachusetts, so uh we take a lot of pride in everything that we do. >> Good. Well, good luck with this one. >> Thank you. >> I also want to before we finish, publicly acknowledge the work that Sophia and Becca have done. It's an enormous amount of work that they've done. It makes our job easier. Um and we very much appreciate it. >> Agreed. >> Yep. Thank you. >> Thank you. Thanks. All right. Thank you. >> All right. Thanks very much. >> Have a good night. Good night.
Not only does um she have all the things that OSA previously said, but she really truly cares um about our profession and like uplifting our profession and making sure that we don't continuously put up barriers um that hinder people, but rather listen to their situations cuz she gets to hear from teachers across the state. Um and she's built a network where if she needs an answer, she can go get it and she will. um her due diligence and her ability to um not just check a box but make sure that her decisions are informed. Um I've witnessed um that she always asks the questions and doesn't just take an answer from one person but gets you know ask five people divide by two and then that's your answer right um but I I really truly believe that she will be a great asset to HGSP.
>> Do we have any minutes that we have to do tonight? >> You have one set of minutes you need to approve tonight. And uh just one second before you get to it. As a note for anyone coming in to sign the order of conditions on the topic of a lot of work to do. It's going to take us a little bit longer than normal to clean up all the formatting and everything on the that those conditions. So, it may not be ready for signature tomorrow, but we will try to get it to you this week. >> You have my comments on these minutes, correct? We did that last week, didn't we? Um, can we were going to do them at the last hearing last week and we deferred it to this week, I believe. >> Yes, I do have those comments. >> You have my comments.
Thank you. Karen Ginosza in support person. That's a name from the past. Welcome. >> It's been I think 23 years since I here. >> I know. >> That's how long I've been retired. >> We're happy to have you. >> So, I'm here as a sorority sister for Logan. >> Oh, what sority is that? >> Alpha Delta Kappa. It's an honorary society for women educators. Wonderful. And so she's part of our chapter >> and she's asked me to testify on her work as our treasurer. Now she has done six years as our treasurer for our chapter. I survived two. So that tells you of her tenacity. She has been very good in keeping our books in line. Um she makes sure all of the we're international organization so we have minutes that need to be transmitted to international and she's done that and she responds to our teachers uh our members concerns.
