So, um at this time, um you don't really we're not going to be necessarily asking anyone in particular any questions for clarification purpose. Um but if there are any members of the board that would have a specific question in mind. I mean, I think we'll have plenty of time to to discuss later, but Okay. Is there let's see. We do have a speaker. We're going to >> You've got two on the list. Two on the list. Hold on one second. And we will have opportunity to have um some time for public comment for those who haven't um submitted a speaker card, uh but we'll go in the order that we have here this evening. And And our first um community member is uh Alicia Trider. Thank you for the opportunity to speak again on this. Um yes, my name is Alicia Trider. Uh and I just want to point out that the recent Canvas hack is a great reminder that everything is hackable.
Um with the commission I should say inside the building. I think they're still working on a date and then also to hire an LSP peer reviewer. Um and >> I think there were conditions, right? There was a condition in the from the comprehensive permit of a $10,000 towards an LSP. It's either 10 Yeah, it's 10,000 or or a maximum of 10 hours. Yeah, I'm not sure. I think uh I >> 10 there. It's in there. I think Mr. Engler uh read the $10,000 number the other night, so I'm not sure if he was a reading from that document or winging it. >> Yeah. He looked like he was reading. He was reading it. Yeah. Okay. >> Great. We're good. Just one thing with with respect to 40B's. We have a friendly 40B that we're waiting on a decision on from land court judge. Have we heard anything from them?
>> Yeah. And and I, you know, a lot of credit has to go to the clockers there for for having some timely hits. We talked about not stringing things together, but obviously the leadoff home run by Laurelai was huge, but you know, Ruby gets on an era. They work a walk. >> Uh big big double by Quinn Herder. Another walk to Ustaris. U and then two clutch hits, two two out clutch hits with runners in scoring position um by Vendetti and Kyra. And then you know obviously they leave they end up leaving Colette and Kyra stranded. But a six-run inning for the Clockers puts them in really good shape right now. Up three going into the fifth. And Nico's still still in the circle. >> Still in the circle. And she looks to kind of replicate that first inning. That was definitely her best inning.
But, I mean, renting it if the cost of renting it cuz you're like, look, 400,000 and you're just like, great. But, I mean, what is it to rent it for the season? 200 something? 220 to 230. And now, if we were really close to being able to execute the long-term plan, that's one that's a different conversation. But, realistically, 3 to 5 years, right? I mean, it's so So, we're working on both of those, the short-term and the long-term you know, solutions in tandem. Yes. Yeah. And they're both they're equally important, right? But, we do know we have a much tighter timeline for the immediate need, for sure. So, that's that's really the the update on that. We will continue to as we get information, this will be you know, updated with the facilities or the facilities committee coming up. Yes, the business operations business operations committee call.
616 results of the local climate surveyformational. uh you have that included in your packet. Uh as Mr. Parker pointed out, we had growth in 30 uh out of the 33 questions those areas. Uh I I just wanted to note uh the uh where you don't see those girls uh where students and families know what classes they will have and take graduate graduate from high school. um slight little decrease there of about4% from the previous year. So remember last year this was the local uh the climate local climate survey was a inaugural year first edition of this as well. Now we're getting to that second. We have the baseline. Now we can start really looking um of the three questions. The second one is schools offer appropriate courses to prepare students for college and career readiness. Again that was a 0.1% decrease. And then finally the last question there was a decline uh was schools offer curricular activities, sports clubs, etc.
All web and cloud-based technologies have unsecure external access points. Right now, you have the power to set anti-AI policies that protect our children and school staff from predatory company companies like Riverside and Verkada. You have the power to uphold California laws such as the California Consumer Privacy Act, the California Constitution right to privacy, and student protections under federal laws like Family Educational Rights and Privacy Act or FERPA. However, with this $2 million contract, you have seated your power to a private company with a history of data breaches, sexual harassment lawsuits, and pornographic misuse of their stored data. I'll let you Google it. It's horrific. Riverside Technologies, Verkada, and the CUSD IT department claim that this AI technology is making schools safer, but they don't have any evidence to support this. So, that is a theory, not a valid argument. Riverside Technologies and Verkada claim that their cloud storage is secure, and yet they are already under federal oversight for multiple data breaches.
>> No, we have not. >> UGC. That's the UGC. >> right. Like a friendly 40B. What Yes, UGC It is. It is. >> Yeah, and actually >> on that. I know. It's extremely frustrating. Um Yes, it's extremely frustrating and I think um just if I may add, one of the things I think I would like to um focus on over the next fiscal year is a way to maybe loosen up some of these that's the only term I can think of to find some way that maybe doesn't require legal a legal action to move some of these approved projects forward. Um if that's something that you want uh if you want me to work on that. Well, are we are we scheduling a board retreat cuz that would be something to talk about? >> that would Okay. I'm sure of that. Well, I I was thinking, you know, during the evaluation process for my evaluation process, one of the things I know we've all talked about and wanting to work on is more towards like some some goals and some definitive goals.
A couple strikeouts, a scoreless inning. And the offense has re-energized the this place and she will begin against the seven hitter Julia Rafon who had that home run her first time up. She takes inside for ball one. So, we've seen a couple home runs. We've been treated to some some great swings from both sides. Yeah, it has it has been there have been some big hits today. Uh and 789's coming up here. So, we want to keep them off the base pass if possible >> as that one misses low. So, two balls and no strikes to she is one for two with that home run >> as delivers the two. That one bounces in there. >> Get that to the plate now. So now a three ball count to start the fifth inning here. >> She'll look to work her way back in this count.
Okay. >> [snorts] >> So, so when I mean, I'm assuming we're getting some potential time frames too, right? To do this work. So, when's the drop dead date of having to make these decisions? >> So, I want So, Dan has been working with these three vendors pretty regularly this week. If we can get If we can get solid quotes from those vendors in the next 5 to 7 days, and I've already spoke I've spoken with our our purchasing agent, you know, because of the and I don't want to use the word emergency, but because of the tight timeline and >> a lead time on parts. There's a lead time on install. >> Exactly. Um because of the tight timeline on this, if we have, you know, um options for solutions from these three vendors that we've already, you know, reached out to and is already they've already looked at the boiler room and it or assessing, um we will likely go with one of them and and forego putting it out to bid formally.
students are interested. This is an interesting one that we got to do some more digging into. It declined by about 4% to be exact. Um, and you're going to see the lowest average on that coming from teachers responding and uh the students and parents guardians were similar. Uh, but it's an interesting topic that we really need to tackle at the sites. Start start having those conversations. >> It's got to be communication because we Jill does a great job with the after school program. We offer more clubs at West than I've ever seen. So, I don't know if we're just not getting the word out about we have dice club, robotics, bag. I mean, like we you you go on a club, you can start it. So I just don't it's a communication issue that we'll need to work on to make people more aware and I know Anderson has a really things.
Riverside and Verkada claim that their technology increases student safety, but bringing in a cloud service creates the opportunity for data breaches and for the misuse of predators. Speaking of which, Eric Steven Georges was a CUSD IT department employee arrested for child pornography. I have a real problem with the IT department keeping images and videos of children safe because they lack oversight and transparency. Let's be honest. Now, legally, contracts that were passed without proper public input via the consent agenda, like this one, can always be reassessed by public demand. It is your obligation as publicly elected trustees to do this. Robert's Rules of Order, parliamentary procedures, and your fiduciary responsibilities compel you to seek public input from parents, educators, staff, and the public on this issue affecting minors. Your failure to disentangle this item from the consent agenda must be addressed. I also noticed that Tom Lando is not present tonight, so I suggest tabling any vote on this topic until the next meeting because all members should be present for such an important topic, discussion, and vote.
Uh and I've been thinking about that and just thinking about some of these things. that are are lingering, I guess. And you know, trying to find a way to I guess I don't want to use the term wrap up, but just um kind of tie up some of the loose ends. loose strings. Yeah. With the issuance of the comprehensive permits on those two um 40B's, does that put us in safe harbor? It it should and I know Jasmine has um yeah, yeah, it does and uh so Jasmine has uh submitted for certification. Um that we would be in safe harbor uh with the um with the two comprehensive permits that were issued. Now, how does that work in terms of um there's a certain amount of time now where they have to actually uh build or something some kind of timeline or will fall out of safe harbor, is that true?
>> Got it. >> Mia pulls waiting on deck. >> Yeah, these walks have hurt us a little bit. So a free pass here is is not something you want to do specifically with the seven hitter. Um, but if we can potentially induce a double play here, we can we can maybe try and get out without having to get back to the top of the order. Coach Sasso coming out to talk to Nico. Uh, maybe just relax her a little bit. Probably have a conversation and say, "Hey, you got 8 n coming up. Let's see if we can throw them strikes. Try to get out of the inning without too much damage happening after a first first batter walk. So after the visit by coach Larry Sasso to to get his team ready, uh let's see what Nico can do here >> against the center fielder who has made a couple big plays against the clockers defensively.
Mhm. Um and if that's the case, then then we're going to we can move fairly quickly. If we do put it out to bid completely, um then the time the timeline I put in the RFP was to have bids due back um by June 26th, I believe, the last Friday of June. Um and, you know, with with milestone completions completion dates, you know, the bulk of the work completed by August 15th with a September 1, you know, operating and Mhm. you know, full commissioning of the unit. Okay. So, that's where we are. Okay. So, with the boiler, putting a new boiler in, we would still have a boiler online if staff is here and they can have access to hot water, correct? Like that's what I'm concerned about. If we're doing like a September 1, I mean, I don't think summer school's here, so it won't impact that, right?
So >> is there participants in it or they >> Yeah. Oh yeah. >> One Baz has a weight room open. He has a weight lifting club. Like there's tons of kids in there every day. You go to Eagle Vision after school. They just did a pool tournament. It is busy. So I I just don't know how that I truly think it's and Lisa has brought this up a lot in our principal meeting. It's it's there. People don't know it's there and that's where we got to work on that. >> Stop talking. >> Well, yeah, that too. Kids probably don't talk at all when they get home. You're exactly right. >> And so overall, you have this pretty pretty and you take it in its hole, but then you start digging. Uh we have pretty good results. uh there are some some challenges. There's some areas that we need to to work on and it identifies some pretty consistent themes uh as to student engagement, communication, academic support and school family partnerships.
Thank you. Is Teresa here this evening? Thank you. Me again, first time, third time. Uh hi, my name is Teresa Bond. I'm a parent at Hooker Oak Elementary School. I unfortunately wasn't able to come to any of the public um forums and focus groups on this issue, so I just wanted to make sure that my concerns and the concerns of some of the parent other parents that weren't able to go to those meetings are heard. Um I think I'm here today. I know I'm here today because I believe that the issue before us is not one about the system that we installed today, but what becomes possible tomorrow. Our children should not be a testing ground for emerging AI surveillance, regardless if it's in the classroom or not. I think that's actually a really um disingenuous um uh thing that the board has said that these videos won't be in the classroom.
Yeah, that's a good question. Um and so if it's a comprehensive permit, so if it's done as a 40B, um after the comprehensive permit is issued, uh you are able to submit and if you have a housing production plan that's valid and in place, if you are making progress, which is defined by either increasing your affordable housing percentage by half a percent or a percent, you can get safe harbor from the time that comprehensive permit was issued. So, if it if it's the number of units approved equals a 1% gain on your affordable housing, you get 2 years of safe harbor. The only thing is is that if a building permit has not been issued for that comprehensive permit within a year, you lose that safe harbor status. So, you have to get if they have to start construction within a year for you to maintain that additional year for safe harbor status.
>> She has and last inning they kind of targeted her when all those balls just hit the center field. the home run. Herder's double. Couple bloops as well as she lays down a bun here. It is a fair ball picked up by Usaris and just gets her at first base. That is an accurate throw. She has played really well on defense on the mound. >> Yeah, Nico has fielded the position really well today. It doesn't surprise me at all. She's a heck of a defensive player. Um again, know she's she's quick off the circle. She makes a nice play to Kyra there to to get the out. Unfortunately, the runner does go to second on the sacrifice, but we still have one out here for the nine hitter. >> Cahill will bat. And that's a good stop from Vendetti behind the plate. Cahill's 0 for one with a walk.
But the school is used. It could possibly be rented with camps and whatever. I mean, we still need these boilers for hot water. So, we have a another solution to that. >> Okay. Um and uh Mr. Caldwell is is sourcing a electric hot water heater in order to forego the um the boilers altogether. Um it is relatively very inexpensive to be honest with you. It it is a fraction of the cost of what another oil delivery would cost today. And our oil is getting low that we would we would likely have to replace get another delivery at least a portion of a delivery before the end of the fiscal year. And so I think the next time we meet as either a facilities committee or as a board, I will have some good news to report on that. And so then that would it would completely eliminate the need to be turning cuz I think part of the problem that we're we're seeing and why they sort of have sprung these new leaks is because now that we're not in the heating season, the boilers are going on and off and on and off.
And so uh working with our stakeholders in those areas will be kind of a focus whether that's at the site 617 agreement with five peaks youth solutions for MTSS aligned services for alternative education sites by Would you like to comment? >> Yes. >> I heard a little fly over here. I wanted to make sure >> Mr. about What's the funding for that? >> So in the packet there's a bid for a total of $64,500 up because currently this year they're four days a week and they're pushing five days a week. There two funding opportunities here. One is the cover actually Miss McCauy's funds in her program will cover all of it. She has fun she has to spend by September that fit this category and so she can cover all of it. If you remember our district did not join the California behavior initiative education is consortion with major but five peaks has also applied for that grant.
