i come from a long line of conservatives and married a conservative i was an advocate for returning to schools in january 2021 during covet for a myriad of reasons and also hoped the decisions would have been made to remove mass before the end of the last school year all that said i also come from a long line of educators starting with a great grandma who taught during the spanish flu pandemic my family has always been pro-public education and we have always loved and value our scholars dedicating ourselves fiscally and physically to enriching their emotional or their educational experiences i'm gonna skip down um although my mom did pass away in 2020 my son needed scl for grief and in closing i have to say i'm frightened by your ability to force our wonderful superintendent to resign if you're so easily able thank you next we have johnny v melton hi madam president board members dr dean how are you uh my name is johnny melton i have a i've had three kids go through dysert great schools and happy to be here i'm here to talk uh because i'm actually supporting the board here um the board makes decisions that you're voted you're elected to make tough decisions financial governance sometimes hiring decisions and because this is the way the system works we we don't know all the inner workings we're not privy to to what you are always discussing so we're left with conjecture a lot of there's been tonight there's i've heard a lot of speculation on why and questioning your motivations and and i i don't do that i give but people benefit out i give this board the benefit of the doubt i i know a lot of you on that stage i know a lot of you behind me i'm a known political actor so i know a lot of people here and i choose to give you the benefit of the doubt and i i hope the community will learn uh what transpired and and and why you took this course um i just hope we all have patience to let the process play out thank you board appreciate it [Applause] thank you next we have alexis anderson hi i'm short so this was okay um i am a proud parent of four kids one graduated dysart last year i have three that are still in thanks to dr kellis i have now asante that school has opened up because i like the idea of having school choices my kids now have school choices to attend a traditional middle school something that is well liked and hopefully it continues um i also have a i don't have a say in your positions because i am an open enrollment for my kids because we don't have a great school district from where we live but if you guys accept his resignations i will be boots on the ground helping my neighbors across the street where they are voters in this disart dysart district recall you i just want to put that up there also from the financial point of view looking at tonight's financials uh it does not seem the best fiscal responsibility of the board to spend this money when it is not warranted on to buy out a superintendent who is phenomenal if if he wasn't phenomenal we wouldn't have the community relationships that we do our mayor is here speaking on him i mean if that doesn't say wow what is going on with us then take off the blinders because this is ridiculous go callous next we have bill pupo or puppo i'm not quite sure good evening governing board members and staff i'm bill pupal i'm a 22-year resident in the city of surprise i'm a grandparent to two students within the dysart district and a third to come in a year i'm a retired city manager and one of the things i was taught as a as a city manager early on in my career was as a city manager to discuss the undiscussables economic development requires a tight partnership with the school district businesses looking to locate in a district needs certainty stability and vision this governing board transmits an image of dysfunctional policy making your behavior and actions potentially impact economic development it creates an embarrassment to the district the employees and the region i told three business leaders today that represent about three thousand employees they're not located in surprise and they were frankly shocked at the agenda item that appeared they were wondering why this dr kellis is being forced to resign dr kellis they said has assembled one of the greatest staffs in the state of arizona for the district these staff people came to dysart district because of dr kellis not because of a great board most of them probably don't even know you frankly the voters in 2015 and 2020 placed trust in you by approving the override they trusted you to put that money into the classroom now tonight you're taking a forced resignation with an undisclosed amount of money that the attorney did not apparently disclose or discuss you're taking that money that belongs in the classroom thank you thank you jason laubermeyer good evening my name is jason loebmeyer it's everybody makes a mistake don't worry about it i just want to say thank you for all of you being here i know that this is an unpaid position and i appreciate your service we have a lot of fantastic people in the room we have a lot of fantastic people in surprise and i agree that dysart is an awesome district i want to urge you to vote no on accepting dr kelsey's resignation i've got a lot of personal stories that i could tell but i feel there's so many other people that are doing such a better job than i could do so i plead with you to please hear what they're saying i did want to share a couple of things the main argument that i think we've heard is some sort of financial piece to it we've talked about it tonight there is a great resignation going on it's hard to find quality people if we take this action of accepting a resignation when we have him for at least another year we're putting ourselves in a very difficult position to fill his spot along with the referral program we talked about not losing people in droves but the referral program only retains 30 of people who actually tried out dysart so so we need to retain our leadership and strengthen that i want to leave you with uh two quick things i i'll strike it to one uh yesterday i was at a choir concert for one of my students who attends canyon ridge and the lyrics were in a time full of war be peace in a world full of hate be a light when you do somebody wrong make it right i urge you to vote no next we have crystal rogers hi madam president and board members my name is crystal rogers and i am a member of this community i am one of the parents that stay in the back i don't pay attention to a lot of the drama and things that go on i've had kids in the ice art district for 16 years during that time i've often considered moving my kids to charter schools or moving out of the area because of struggles i had in the schools from ieps and 504 plans and poor administration and the way they treated the kids i've had three kids graduate from dysart high school and i currently have a child in elementary a child in middle school and a child in high school and i can tell you as a mom for the last three years my kids have excelled further than they have ever in their entire career in school and i attribute a lot of this to dr kalas because when i did have problems i was able to go and voice my concern and they were addressed my kids come home and they tell me about dr callus they have a personal relationship with him i have never in my life heard of a district where kids know who their superintendent is who love their superintendent who care about their superintendent and know that their superintendent cares about their success i have many teachers they're my friends i have many and had many conversations with them about wanting to leave the district because of things that were going on in the last few years we don't have those conversations anymore they people have talked about the super in 60 seconds i look forward to that every friday to see what's going on with these kids in this area and how they're excelling and he's the one that brings that out for them i don't believe any of this is coincidental i love the transparency dr kalas has truly been a light to this district and i believe that he has the kids and teachers best interest at heart my kids know him my family knows him and this entire community knows him and i urge you to vote no thank you next we have candace rudolph good evening um i have been a member of the surprise community for 15 years i have three children two in high school one currently in junior high we are very active in sports in the community and with our school that being said dr kellis has been a huge uh supporter of that we've seen that come through over the last few years we've seen a lot of support for the special ed services support with iep issues that we've had where the schools are now getting more staff and more help with that that has been huge and has hugely impacted my family having a senior at willow canyon i can tell you this was not a great year for her one of the highlights was talking with dr kellis and him talking to her about what's your empathy helping her see that even though there were some horrible things going on that were directed towards her that she should still have empathy and continue to move forward and be positive and i think that that has been incredibly helpful for her and i'm very grateful for him doing that um other than that i'm not too sure that there's anything else i could say that other people haven't already said tonight probably far better than i could i do really ask and pray that you will vote no and not accept his resignation again having been here for 15 years and having had a lot of issues i can tell you that the last three years the impact on the attitudes in the schools on how the teachers feel has been incredibly changed for the better if you are not willing to vote no tonight then i ask that you table it that you listen to the community that you listen to everything that everybody here is saying because as a whole it sounds like thank you next we have laura wellman hi my name is laura wellman and as a parent in the dysart school district i wanted to voice my support for dr kellis and tell you my experience with him um i sent him an inquiry about an issue that one of my children was having at school and that was hard for us we were struggling with and he directed me the person that i should contact to work with to resolve the issue and then i later found out that he went with that person to the school the next day to look into my concern and i i was touched by his his personal support for me and my concerns and my experience illustrates that he places a great priority on student and family experience in our district um and i think that's invaluable and my teachers of all my children's teachers have all told me that they have felt a lot of support from dr kellis his focus on students family and school staff is exactly what i want from a superintendent and he should stay and continue the good work that he's doing thank you [Applause] next we have meredith sierra good evening madam president fellow board members and i want to acknowledge all the great leaders in this room and our community i am i have been a member of the dysart boundaries since long time um i have been a member of or part of the surprise wonderful community since 2006.

that's when my children began to start school and i want to start that i'm also a very proud educator but in another school district but as my children started school within the dysart district i quickly learned this was not the place for my children i quickly learned that the board that the superintendent did not have the best interest in my education of the future and unfortunately i tried to turn to a charter school it hurt me as an educator as in the public school to do that in the last few years i have watched dr kellis i have heard him i have heard the comments in the community and i finally said it is time to be a proud member of the dysart school district my children started this year and have flourished and have loved it and i know it was under his leadership even my children my daughter was here and staying in front of you guys a couple of months ago shyla seatta and i could see the passion of your eyes and the love for the children that you guys serve and i don't know what the issue is because it's being done in private but i encourage you please work together please have the best interest of all of our children and keep dr kellis thank you next we have michelle dillard hi my name is michelle dillard i don't usually do this but i want to thank you for allowing me to participate in the open meeting today without violating my constitutional rights and trying to have me arrested but i guess that's because dr kellis isn't here so i'll be able to speak which is good because i'm here to thank the board and to recognize the board for the courageous decisions that you have made over this past school year you have removed the mask mandate you open the schools you're putting the kids and the community first and the parents you disassociated with the arizona school boards association and i've heard a lot of great things being said about dr kellis what i haven't heard about this evening in relation to him is the district ranking and the achievement academic achievement of the students and that is what education is about it's how the kids are performing i understand that everybody might have a nice story because he came to a football game but we need the kids to learn the achievement gaps to be decreased and that's what education is so i say to the board i appreciate you being courageous and putting the kids first and the community first and it sounds to me from what i understand from what the attorney said that this is a mutual agreement he's not being terminated he's offered his residency he's offered his resignation and if you don't know what it's about you ask yourself this why didn't he tell you why you're only talking about what the board is and isn't telling you what about him why isn't he here tonight to defend himself he quit he's not even here thank you [Applause] [Music] [Applause] thank you next we have mark demmer okay i'm going to remind everyone to be respectful even if it's something you don't want to hear or will end comment no there is no we'll try there is we will be respectful that is the end thank you madam president member of the board my name is mark demers i live in el mirage i'm also a proud dysart unified school district parent a grandparent and then a parent again my wife and i adopted our granddaughter i've lived here since 2011 and there's a lot of talk going on about the whole dysart unified school district is 187 700 people that's 40 000 people more than the city of surprise it's a lot more than city of el mirage it encompasses 140 square miles that's bigger than surprise it's a huge district less than 30 percent of the people in this district are directly involved with the public school system that's students parents teachers administration social workers the other 70 of this community like myself are not involved with public school i have my daughter over there she attends a different school i'm not involved in public school by choice because of the statistics because of the i'm into facts and the state of arizona has had a d-plus rating from the department of education since the early 90s in 2018 when dr kellis took over here in the dysart unified school district they had a rating in a top 40 percent today it's 37.7 percent so he might be a wonderful person i don't know i don't know him personally but i just look at stats and facts and evidence my daughter's not en enrolled in this school because i am interested in education and she's enrolled in a school where she actually gets an education i'm here to show my support for the three members of the board crystal christine and don who understand what the entire district thank you next next we have kelsey royer i'd like to first thank the board for volunteering in your positions i recognize that it takes a lot of time and effort and that it's voluntary on behalf of the community i also want to express the wish that the board be transparent with parents as a parent finding out that a superintendent was suddenly resigning and finding that out like just through a facebook group was jarring i wish that i had been informed in a different way on that note i'd urge everyone to consider the costs associated with this kind of change setting aside differences of opinion about curriculum etc what cost can we expect our children to undergo as a result of this sudden change i believe it's safe to assume the district will incur a significant monetary cost and that will be taxpayer funded certainly there will be less tangible costs as well will there be items of business that are put off until a permanent placement is secured will the new superintendent be as proactive in communicating with parents lots of questions and concerns i asked the board if the many positive qualities associated with dr kellis that we've heard tonight are not what the board is looking for what is the board looking for is what you're looking for specific to your own personal beliefs or does it benefit the community as a whole you agreed to represent all of us all of the students and i ask you and urge you to please consider whether terminating your contract with dr kellis is truly in the best interest of our children i foresee next year a lot of turmoil as we go through different changes a national search for a new superintendent and um my concern is that the new superintendent that's put in place is not going to represent my values as a mother of very young children who still have many years in the dysart district thank you thank you next we have marissa elder good evening thank you for the opportunity to speak my name is marissa elder and i'm an occupational therapist in the district um i would like to point out that the staff retention rates in the 90s are directly related to dr kellis and his leadership in this district based on the lack of evidence of misconduct his forceful resignation is unethical and detrimental to the students who are charged to service education is more than numbers it's more than rankings or letter grades it's about treating children as a whole and bettering them and preparing them for a future and dr kellis has done that he just demonstrates an effort to connect with staff and student students community at large and he cares about students on an individual level as an occupational therapist i work with students with emotional disabilities and i've seen it firsthand how trauma and abuse can impact their ability to access their educational curriculum dr kelly's support for social workers and the emotional needs of our students is one of the reasons i've loved working in this district and he's being punished for that i've recently read a book approved by the arizona council for exceptional student services for continuation credit on the need for empathy in our children it states that failure to understand and cultivate empathy however could lead to a society in which no one would want to live a cold violent chaotic and terrifying war against all as it's a culture that could be inadvertently developed throughout america if we do not address current trends in childbearing education economic inequality and our core values social emotional learning is learning fostering empathy compassion integrity and self-esteem in our students doesn't take away from their instruction in more traditional academic areas like math reading science and social studies dr kellis understands his importance and is it is a shame that he is being displaced because he demonstrates empathy and emotional intelligence in regard to our students thank you thank you next we have jay leonard my name is jay leonard and regardless of what you may think i appreciate each one of you and i pray for you often i understand what you're going through when i asked our friend what i should say because i'm not good with words and this is really a tough situation we didn't agree on anything our friend shot down every idea i had our friend told us what what are you going to prove by getting up there angry she asked me one question she said why are we even here and i know you can't answer questions but i would pose that to you and jokingly i said if you don't want me to talk so long because she would never get up here and speak i said i'll yield you half of my time tonight our friend is represented by an empty chair that has never been empty before and a set of flowers in her honor i yield the end of my time to hurt and will not end with anything negative she told me i could say three words we are dysart [Applause] thank you next we have brent cobb hi brent cobb thank you madam president on the board for the time that you spend here and dr kellis i appreciate your service i've been listening to a lot of testimony today uh in your favor sir and there is a conservative group we're here i'm here because there was one officer supporting these boards typically and now there's five there was a risk and a concern for the ability to conduct business and the only time that business should be conducted with the borders either through the ballot box or through this podium and i was very concerned about the lack of discretion and the lack of a civility that i have witnessed so my daughter was in this school my son was also in the school district and i did not like the low performing scores i did not like the the things that i was seeing and as you know parents have an opportunity to put their children in private school charter school home school online school they have a lot of opportunities and every time they do that they take money away from the students that are in the public schools which most parents rely upon so when i put my daughter in private school it was an absolute disaster it had the best academic rating in the state and she hated it so the next year i put her back in public school now i'm a staunch conservative i care about results i don't care about social emotional learning i don't care about touchy-feely stuff i don't care about hugs i don't care about snapping i don't care about any of that but what i do care about is the compassion that you've displayed in the testimonies that i've heard with the students and i think if you choose to resign or if the board goes forward perhaps you should take a 20 to 30 position as an educator where it really matters in the classroom where the future is and if you choose to let the doctor go we want to know what your plan is going forward for success thank you [Applause] thank you our last one of the evening of the evening is heather brooks is miss rooks here she's not okay if miss rooks is not here then that concludes our comment on the agenda item thank you everyone who took the time out of your evening to speak [Music] miss mccollin before we move to take action there was one there's a couple com several comments made um they're a little bit concerning and i'd like your clarification on legally one of the earlier comments in regard and was in regard to executive session and implication that the board has a choice in regard to what they share um implying and i think i've heard through various emails and just in listening to our community members tonight that there's this feeling that the board is withholding purposely withholding just providing reason or explanation for particular feelings or in relating to this item can you please uh reiterate where the board's the confidentiality piece that's tied to executive session whether or not the board truly does have any say on what they can disclose and not disclose and then also speak briefly to the allegation of any any force or coercion in regard to this proposed acceptance of dr kallis's resignation madam president members of the governing board the governing board has engaged and as i said in my earlier presentation of this item has engaged in a series of executive sessions related to dr kelly's contract of employment the matters discussed in those executive sessions are confidential by law there is no ability for any member of the governing board or any individual whether that be a staff member or your attorney or any other individual who is entitled to receive information from those executive session all parties are prohibited from disclosing and that's a part of ars 38 431.03 specifically it's section e of that statute so there is a expressed prohibition against disclosing information from the executive session with regard to the the agreement that is being presented for your consideration it is a resignation agreement and release it has already been signed by dr kellis it was negotiated between the parties thank you all right um so we have a as we are on k7 approval of superintendent's resignation agreement and release do i have a motion i move that we accept and approve the superintendence resignation agreement and release second motion made by crystal chapman seconded by don dunsmore i would like to go on the record stating that i will not accept this this resignation agreement i have not had any i have always been respectful of dr kellis and he has been respectful of me we may not always agree but we respect each other and the last time we had a dark day in dysart was in january 2014 where we had to lay off 143 employees due to an override not being passed i also want to state that dysart was a contentious board several years ago approximately 2006 2007.

we're now a contentious board again and there's been one common denominator i will be voting no [Applause] [Music] so is that the motion that i entered except that's not the wording the governing board may take action that's not the motion i made it's okay that's okay i just want to clarify we're good okay i'd like to also explain my vote for the record um thank you all for coming tonight i had a whole lot to say but i just i can't do it um the decision to remove dr kellis is wrong it's wrong for dysart and it's wrong for the community this is also fiscally irresponsible when dr kellis only has one year left on his contract this is not in what is the best interest of the students in the dysart district and i vote no [Applause] motion carries next we move to the request for future agenda items yeah i'm just waiting to see if anybody else does yeah i do i'd like a future agenda item please and dr croto dr carter dr croto dr croto keegan is [Music] we're still in a public meeting yeah [Music] okay we're still in the we're still in the midst of a meeting so if you'd like to stay you're welcome but if not please exit quietly so it can continue the board business now may i do my future agenda item i have one first if i can continue okay sorry i think she's waiting for it to come yeah and it's a little bit disruptive no i'm not talking anything i'm just waiting for my turn that's all looks like some petitions over there under his chair oh dear do what colin left a bunch of stuff well you have this water bottle surely probably some petitions too along with that water bottle he might be bad okay i um for one have a request for future agenda item i request an action item to further discuss potential board action pertaining to commissioning and investigation into the recent confidentiality breach any other agenda items for consideration yes i would like a agenda item for discussion and action regarding giving years of service to paraprofessionals in special ed they're and i don't i may not have the right title but they are an f and h in that chart and the you which are the uh licensed uh classified assistance please anything else next we'll move to item m executive session we have a call for executive session pursuant to ars section 38-431.03 a one to discuss the appointment of an acting superintendent this time i move that we adjourned to executive session motion made by christine pritchard seconded by don dunsmore ah motion carries we are adjourned to executives you ready all right this time we will okay it's not back i saw louisa nod saying we're ready ready this time we'll reconvene the regular meeting and move to uh section n action discussion and one appointment of acting superintendent this time i moved to a point dr jim dean as acting superintendent drive a second second motion made by christine pritchard seconded by crystal chapman i suppose before we actually do you accept that are you thank you motion carries next we move to the adjournment eye motion that we adjourn the meeting motion made by christine pritchard seconded by joe grant you

[Music] i call to order this regular meeting in the bullhead city elementary school board on the hearing there's we're doing the budget it's on here at 2.1 and that's when you that you have to have the five-minute hearing before six okay the public hearing so we have to do the salt order and the oh sorry [Music] oh high five right uh this meeting at bullhead city elementary school board on thursday uh may 12th 2022 at 5 55 p.m roll call corey burgess here charlene diaz here anna boyd here uh pledge of allegiance if you'll all join me for the pledge item 2.1 uh public hearing to convey a public hearing pursue pursuant to ars 15 948 c and d 15 905 150 501 15 962 d 151103c for review of proposed fiscal year 2022 expenditure budget revision number three at this time we are open to comments from the public for our hearing on our proposed budget yes so yes sir i have a two questions come on please first of all good evening good evening my name is fred rushton and uh i was just looking on the back side of the sheet and i noticed that the federal projects line item fund has been increased by 111 and i see many of the other percentages some of them being decreased by 100 but i was curious about why that federal project budget line was increased by that much what it might be used for and also i had a question about where is it down the second from the bottom about the food services i'm assuming that means uh providing the lunch service for the students i was just curious about why that decreased was there a decrease in the population but i just had those two questions thank you for clearing that up for me i will try to clear it up for you so on on the federal funds last year the seven million three hundred and thirty seven thousand was our usual federal funding title one title two rural title four those things plus the sr1 funny funds which were covid relief funds the first set of those it looks so much bigger this year because we also have sr2 and sr3 funds so i'm kind of glad that i left my posters up over here so you can see that the sr1 funds were about a million four hundred thousand if i'm remembering correctly and so that 7.337 would have included that for last year and then this year the 16 647 000 would include the 4 million from sr2 and the 10.3 million from sr3 food service which is account 510 part of the reason that is down is because we get funded based on student enrollment and our enrollment last year was down because of covid so we started with less money in that in that program it will be back up because our enrollment has come back up not not quite 50 of the students we lost so at some point it will come back up but this reflects what it is right now for this year it may go up higher for next year you're welcome do we have any other questions all right so i need a motion to adjourn our hearing i'll move that we adjourn the hearing i'll second the motion and avoid all in favor aye corey burgess aye charlene diaz hi anna boyd hey hearing is adjourned uh we will move on with uh resuming our regular meeting uh citizens present please sign in in the back uh call to the public the call this is the time that the public may criticism made by those who address the board may ask the staff to remove review a matter or mass that a matter be placed on a future agenda however the governing board cannot take action on matters that have not been noticed in advance as part of the agenda uh we have one call to the public today ava smith hi guys thank you for your time um tonight i'm here to talk about my educators club that i have i created it uh in june two years ago it's called band together stick together educators club and for now over a year i've been working on an educator's discount card with 21 businesses in our area and i'm here tonight to ask the board's permission to disburse it to all of your district staff and so i'm not unveiling it just quite yet i can show you the card um i so don't tell anybody sneak peeks so the educators club on facebook includes not only classroom teachers but every single person who is part of the education realm and making the system work and so would include paraprofessionals the kitchen staff the custodial staff district office staff admin superintendent of course the teachers the aides the administration everybody who is part of making the education realm work so what i would need from you is permission to bring these cards to the sites and in the correct amount of staff numbers that each site has and then for it to be distributed out from there making sure every single employee does receive a card being that this is not an agendized item we can't take board action but when it comes to donations that's something that is allowable through the superintendent okay so why that's something you just kept talked about okay without it being an agenda item we can't of course discuss that tonight right i just wanted um i just got them today okay so i was and i knew your board meeting was today so i wanted to i just skirted under the rug just in time um so is it okay if i email you then sure absolutely absolutely okay so i will email you then and um and then i'll need the correct staff uh members from every site uh so we can envelope them and then deliver them sure and then we'll probably be looking at delivering them the last week of school if that is okay awesome and then um ava would you have them for new employees when they come in the fall absolutely so my my goal with the club is that i'm constantly pressing everybody to you know invite all of your colleagues invite everybody you know so if i could work with you this summer on getting the invite out i'm getting business cards made that will have a qr code that you guys can have at each site and it will have the qr code right to the club and you know every time you get a new employee join the club just let me know all right awesome thank you i will definitely email you i'll take those cards back you're not allowed to have them darn i pass my doubts don't tell anybody yeah thank you so much thank you for coming you do not you do know that this was streaming live right yeah okay so it's still kind of top secret so kind of top secret yeah well thank you as with any donation we always greatly appreciate that um item 4.3 adoption of the agenda can we get a motion to adopt the agendas presented i'll make a motion to a job adopt the agenda as presented unavoidable i'll second that motion charlene all in favor aye corey burgess hi charlene diaz aye anna boyd so city city of an estimated value of 350 um an incredible list uh thank you so much for all of our community members who step up and help it is so greatly appreciated uh item 4.5 superintendent reports dr stewart mr president and board members you have the standing reports if you have questions i'll try to answer them hearing none i have a couple of miscellaneous items first of all excuse me the auditors were here week before last i met with them briefly on the friday before i had to leave town and we have a what you would call a clean audit there are no critical issues they will present to us probably 10 to 15 recommendations for us to change some procedures we're doing and then there's one other item it's not a finding but it is a recommendation that i will be coming back to the board to discuss something that we've done for years that's been a good thing for employees but we have not been doing it quite correctly so it's something we can fix easily so i'll bring that to another board meeting positions we had as of today we had 38 positions well no as of two weeks ago we had 38 teaching positions opened and our principles have been very busy we filled 12 of those in the last couple of weeks kind of surprising actually giving given the teacher shortage and those things we're very pleased to have filled that many and they continue to work hard at that they've also moved some folks around and and within their within their sites i just wanted to call attention to you that for whatever reason this has been the year of multiple audits so in addition to that regular annual audit we've had the civil rights audit it started last july and it took until the end of february to be completed because they wanted three years of data relative to all kinds of things that have to do with civil rights this happens every three years and it takes a great amount of time and we submitted it and it's clear so we're good on that one two weeks ago well actually about six weeks ago we started a self audit on the food service program and then the inspector was here from ade last week and sat down with us with his findings and we had a very good audit report from him there are some things once again here's some procedural things for us to clean up but nothing serious and he said he was very pleased with what he found he was pleased with what he saw in our cafeterias he went and watched meals and and things going on he was pleased with that we're also in the middle of an adm audit so the ade checks for the previous three years what was submitted to ade as our average average daily membership reports that go to ade and then they compare those to our actual documentation and then they pull the files the queue records the permanent records of a percentage of our students to check to see if the information in those files matches what's on our computers matches what's gone to the state and so we have about completed that so needless to say jenny particularly has been busy with all these audits because a lot of it had to do with student information and those kinds of things and then in addition to that we had had an open records request from a reporter in phoenix who wanted all of our disciplinary records back five years and that took a great amount of time because if you recall this is only our second year using synergy and the pre prior three years we're in powerschool we have all the data it's there but we could not immediately access it so we had to work with powerschool and convince them to get that you know get us access to reading the data that was there that finally got sent today that's taken about eight weeks for us to do because we couldn't access those records right away so um we've been busy with auditing and public record requests the last thing i have is a very big thank you from all of our employees for appreciate staff appreciation day everything that i heard was good they appreciated the food had fun with it and i can't you can't quite believe how much fun the adults had just with gift cards you know because you drew a ticket and and i was at fox creek representing corey and you would have thought that they were little kids because they were so they didn't even care what amount was on the card they were so excited about did my name get did mine get drawn and you know they were just they were like kids so um a thank you from all of them for a really successful day any questions for dr stewart all right item 4.6 board member updates do we have any updates from the board item 5 the consent agenda do we have a motion to adopt a consent agenda i'll make a motion that we adopt the consent agenda i'll second that all in favor aye corey burgess aye charlene diaz hi anna boyd item 6.1 fiscal year 22 main maintenance and operation and unrestricted capital budget revision number three dr stewart mr president and board members uh it's always a pleasure to be able to come to you and say our budget has increased we've had some years when that has not been the case so it's it's a pleasure to say that we have an increase in student enrollment and as you know the state looks at our adm every single month and they adjust how much money they send to us the next month by the variations from the previous month but overall our enrollment is up about 112 students not weighted 112 students and then there's the weighting wei ght ing for some of those students so that resulted in a significant amount of money and then as i was going through the calculations page and and those things i found a place that i had not filled in in december and so our increase in the in the m o budget is about 735 000 i knew in december that we had a limit a capacity limit for capital that was greater than we had budgeted um but i didn't do anything with it then at this point i felt like we needed to put it in the budget and make sure that we have it so that whatever is not used we roll over to the new year so that was about two hundred thousand dollars so um good good news in this budget most of these extra funds i have put in reserve accounts partly because we only have about six weeks left in this fiscal year and i don't think we could responsibly spend money in those six weeks but more importantly we are not sure what the legislature is going to do relative to the aggregate expenditure limit next year and i would like to have a reserve line to cover some funds in case we get stuck like we might have gotten stuck this year of having the money and not being able to spend it and and so not budget those dollars and then try to figure out how we could cut back so that's what we intend to do with that so i request your approval of revision number three any questions and i'd like to make a motion that we approve uh the adoption we we adopt a revision of the fiscal year 22 budgets i'll second that motion all in favor aye corey burgess aye charlene diaz hi anna boyd item 6.2 of classroom site fun plan for the school year 22-23 mr president and board members this is a document that comes to you every year you have we have a committee that is elected by the teachers at each site who operate this plan make sure that it works they do the paperwork and those kinds of things but one of their responsibilities each year is to recommend a plan for the following year this year our emphasis was on trying to make the plan as simple as it could be and to be very much in the spirit of the original intent of proposition 301 which was in what 2000 or 2001 something like that so the plan reflects that the the base pay plan the fifteen hundred dollars that we have been paying our employees that in the past has been part of their salary so in other words the base salary right now is 38 000 and for the current year and in previous years the 1500 was part of that i suggested and the the committee liked the idea that we put that outside of what's on the salary schedule and if you approve this plan then next month i will bring you a revised salary schedule where the schedule will look very much the same but we will state that there is a base pay edition of fifteen hundred dollars on there the second part is for many years our teachers have earned points by helping with school activities things that are not funded in any other way so if it's something that's not funded by title or by 21st century or by addendums for coaching and club sponsorships that folks could earn some points for that that used to be tied in with what now is component two of this and so you had your points and then you had these other things and all of it went together for the rest of the money the committee suggested we separate that and assign a specific amount of dollars per point with a maximum of 10 points the 10 points is what we've done for years and years and years and that way then we can very much say to folks if you do if you're with us you have 1500 from classroom site fund and if you make your 10 points you have another thousand dollars then all of the rest of that performance pay is tied to things that we expect teachers to do anyway and that have been part of the plan in the past so those are not new items they're not change the teacher's evaluation their growth plan and their participation in the school improvement plan those were all parts of this in the past it's just separating out those two things one of the nice things for this of separating out the the activities points is that everybody knows that if they do these things this is a given and i agreed to those amount to recommend those amounts of money because historically the funding that we've gotten for classroom site fund more than covers twenty five hundred dollars per year per employee but the rest of it always floats because it's based on sales tax so for instance last year the the amount per student was 425 dollars per student in our enrollment this year the amount is 735 dollars per student so 425 dollars per student is more than enough to cover the 2500 and and then the floating amount becomes just this last piece the other piece i left out is that there is a component that has to do with paying for salaries for right now for six teachers in the district six teacher positions in the district to help with class size reduction so that's always been there the components you see in this plan have all well maybe not always but they certainly have been here as long as i can remember and we've just rearranged them a bit and simplified the process so i'll answer any questions you might have so the fund is funded from the previous year's tax returns right well i presume that the state determines that amount based on the sales tax they had the previous year yeah okay the reason i asked that we're setting in a 2500 fee and it's a rollover when do we ever catch up 400 700 that's an awful lot of money to be sitting in a rollover we don't roll it over i will tell you that the 1500 gets paid in salaries okay and the and the 2500 um i mean these these are all dollars out of this year's money that's is coming to us from the states so they send us a 12th of the total and and actually in the budget not a page i gave you but in the budget is the page where it shows those dollars okay so they pay us 1 12 each month and and so we're covered right at the pretty much right at the beginning certainly covered at the beginning for the 1500 and then as people you know they don't get paid the thousand until the end um and then that then the rest of it what has happened in the past is that the district has usually made a payment made that payment of whatever's left because that's really what it amounts to everything that's left everything that did not go out in the 1500 and everything that did not go out in teacher salaries whatever was left got divided amongst the people who were here okay they tended to pay for it in june which meant we had not yet gotten the may payment and so we get the may payment in sorry we get the may payment in june we get the june payment in july and what the district has done in the past is take those two payments and for people who return that's divided among the people who return so this 2500 is a guaranteed base and at the end of the year whatever's left is yes that's what i was getting yeah i'm sorry yes yes here's 2500 bucks right 3 400 a year ago 700 this year that's a whole lot of money different well it is because that's per student yeah yeah and yeah it's all going to get divided yes yes okay yes and i will tell you saying they're only getting 24.

happy and we are looking forward to continue this relationship and continue helping the community especially the hispanic community thank you so much all right thank you for the partnership um anything else with regard to item 2.01 daca bar no we will be sending these beautiful plaques via mail great all right and i'll reserve the balance of my comments on this on this item for the board comments later on um all right uh moving on to item 2.02 city of san jose presentation safety education in san jose vision zero for president uh do we need to take public comment at least on that previous item oh yes thank you for the reminder um is there any members of the public wishing to speak on item 2.01 if so please indicate by raising your hand good afternoon board president at this time i see no request for public comment all right we'll go ahead and proceed title 2.02 see if there's a presentation on safety education in saturday vision zero hi thank you this is ann jasper i managed the walk and roll safe routes to school program for department of transportation patient zero um on the vision zero team i understand i have five minutes is that correct uh yeah okay great um i'm gonna share my screen okay can everybody see it yes okay great you get this okay so um as i mentioned earlier the walk and roll program is housed within the vision zero program at san jose's department of transportation all right um and so uh briefly vision zero um is um a um an initiative that we signed on to where our goal is to have zero traffic jazz and serious injuries on san jose roads um to that end we have um doesn't we have looked at the crash data on all the different roads the san jose department of transportation manages and we've identified 17 corridors or streets that com that are about three percent of the roads in san jose but account for 30 to 40 percent of fatal and severe injuries so those are the roads that we call priority safety corridors we want to improve street design increase driver and general road user awareness to get to zero fatal and severe injuries these also overlap with the metropolitan transportation commission's equity priority areas which are areas that are historically underserved low income um or somehow affected by um you know by conditions that make the roads less safe so fatality trends over of the last decade unfortunately have gone up we know that the population of san jose has increased as well but in 2019 pre-ependemic we were at 60 fatalities 2020 dipped a little bit to 49 possibly because a lot of people were working from home um attending school at home but in 2021 um the fatalities rose again to 60 and this year we're actually on a on pace to uh exceed that this year so we're beefing up efforts to improve safety design um promote driver awareness bicycle bicyclist awareness and pedestrian awareness to make sure that everybody is sharing the roads peacefully um among the fatalities um it it tends to be that there are a lot of auto fatalities but also um there's been an increase in motorcyclist fatalities from two to ten last year um and uh the pedestrian fatalities um are still the most numerous so we had about a third of fatalities in 2021 being pedestrian fatalities um so the vision zero uh program puts out an action plan every few years um the newest one is 2020.

no no no no no no no no no i'm sorry but that's a guarantee and the only thing in the old plan the only thing they were guaranteed was the was the 1500 and it was part of their whatever their salary was on the salary schedule okay um and that's not what prop 301 that's not what prop 301 intended and so i will tell you i'm the one who took this to them and i will tell you it took two meetings for them to really understand what i was saying to them because they finally they said you really you really mean that this is going to be in addition to our yes that's what i mean oh they didn't yeah yeah but i'm thinking that was it no yeah yeah no no no no all the rest of it okay so you're looking at you're looking at appendix b okay so this is the page that that says whether they get a hundred percent of all of the rest of that money or 50 or whatever so it's time and it's tied to three things they have to do anyway right i like the plan okay the rest yeah because i was reading this and just my fault no fifteen hundred dollars at its base a thousand dollars if you did your ten steps yep and that's it no it's everything else that's a fluctuating amount it is and we've always covered it's been higher than 2500 every year my question was where's the rest of it right now that i know that it's at the end of the year right i'm good before you ask anna and the reason that i held them to the 2500 is historically looking back through the budgets i know we can cover the 2500.

so these are the items that uh that we employ to try to improve safety on san jose streets so we look at data analytics through various tools i'm not an engineer i want to mention that i'm not an engineer or a planner but we all look at the [Music] the data on crashes um near misses every you know injuries ages of victims all of that and determining what safety design improvements we want to implement we also have a vision zero task force which meets quarterly it is a public meeting it includes vision zero senior staff sjpd county public health and other agencies and we want to strategize traffic enforcement we know that sjpd is understaffed at the moment um so it takes a lot of smart strategic thinking to uh make the most impact and get the most out of our traffic enforcement unit um what i'm most involved in is increasing community outreach outreach and engagement so our walk and roll team works with about 60 schools right now mostly elementary a few middle schools and we hope to launch in some high schools this year to increase walking and biking to school but also to make it safer for kids and talk to parent groups about being safe when they are dropping off and picking up their children from school implementing quick build data driven safety improvements so quick builds are things like um just paint or plastic or like in this picture the small um green fault what we call bollards um to see first how these improvements may affect traffic um we can't predict everything that will happen but we get a lot of community feedback from sort of temporary improvements that we implement and then once we get a lot of community feedback and get some data on whether they made any change whether they made improvements in safety then we start thinking about making it a permanent and then number six prioritize resources on the high fatal and severe injury corridors and districts which are those 17 corridors that i mentioned earlier um as i mentioned community outreach engagement is the part i'm involved in um but we also have outreach on on the roads we do outreach to senior centers to people experiencing homelessness as well so i'm sure you've seen or i hope i hope you've all seen uh banners and white cold bands that we've had about crossing and the crosswalk being safe around senior community centers um in the center we have um changeable message signs what we call cms uh that helps to you know kind of provide that uh in real time awareness of what's happening on that particular road like last year we had um a high number of fatalities at the monterey tully cartner intersection so we had cms signs that um draw that drew attention to that to hopefully make people think twice about speeding um or making any unsafe moves so this is some of the community engagement that i do so we do bike rodeos we've done a couple since february um as schools have opened up and allowed outside visitors on campus we've not only taught kids about how to be safe on bikes and how to be safe when they're walking and make sure that they have helmets but also educate the parents of the school about being safe uh drivers and being aware of kids who are walking and biking a lot of people don't uh aren't in favor of letting their kids walk or bike because of the the traffic that they see around morning drop-off and pickup and afternoon pickup times um luckily we have not seen um uh you know kids being impacted by fatalities or serious injuries aside from the tragic hit brand on ocala um the grandma and the aunt of a san jose school student but um we're trying to um just kind of keep that up and make sure that you know while we are um kind of faced with a rise in the number of fatalities um we do want to um we do hope that the improvements we've made help save the lives at the same time um so that's a very quick overview of the vision zero program we uh typically do about a half hour to 45 minute presentation on vision zero so please do reach out um or if you have questions now about vision zero i can answer them and if i don't have the answer i can get them to you any questions from members of the board uh a board member madam yes thank you very much um for the presentation and um the information that you provided us tonight uh i believe i'm thinking this is in response to the request that i had put in i think last month about um you know bringing us bringing the board some information about the programming either that the district has done is currently doing or can do and so i'm glad that we got this presentation because i'm familiar although it's been a number of years now but i'm familiar with the um bike rodeo program and the um the the walking school bus i was uh forget the name of it you got it exactly right walking school bus oh yeah so i'm familiar with those programs and i'm glad to see that that was part of the presentation my question i think at either at this time or for consideration as we move forward is to staff i think more than anything in that i'm wondering what can we do can we do something to make programming like this whether through collaboration with the city and and the program that they was just presented to us or whatever resources it may be but i think given that i mean it's so sad to see that basically the map that was put up is alan rock and you know and and franklin mckinley and maybe a few other districts but that's our district and so and it's again to repeat what was said it's fortunate that we haven't seen many youth um fatalities but you know i don't want to attempt fate on that if there's anything that we could do about it and those youth turn into adults and so you know at some point it may touch us so i would like i i've mentioned last time that i remember back in the day in elm rock we had safety patrol and we had a lot of things that were um you know and i thought at least what i understood as a child at that time was they were kind of part of schools at the time and so i really would like to have us consider and again this may be something that is talked about offline but consider how do we bring some type of programming that's not just this year or next year but we really internalize it and make it part of kind of like the citizenship aspect of what we do to educate our children i think it's part of being a good citizen being responsible with traffic safety and stuff like that so again i don't know that i have necessarily a question for you ms jasper but just i'm throwing out to my colleagues and to staff further consideration of how to make this type these types of programs and this type of traffic safety programming a regular part of what we do whether it's an awareness week or whatever for every school every year something like that but anyway those are my comments thank you again for the presentation thank you so much ernesto um i i'll just quickly jump in and say that we are actually the walkerville program is actually completely funded by the uh county uh 2016 measure b sales tax measure for the next um i think 28 years so to bring it into elem rock schools will be completely cost free to the schools and we have three full-time staff and we will provide all the supports that any school needs um we would love it if alan rock wanted to become like a walk-and-roll school district um berryessa union is a is right now the only one but we have individual schools all over san jose um and we will provide you know any supports that you need at whatever level each school needs because we know you know some schools are in more urban areas than others so we'll provide different supports you know traffic observations and so forth thank you so much for that sure further comments uh linda trustee chavez um yeah can dr bauer can we please have a rock and roll program uh here at the district i think uh miss jasper mentioned that uh it's that the berryessa has been doing that um and it's very successful there is it anyway possible that we could work with them and have them um you know bring it on down the line to all the schools may i answer board president yes yes we have had it in the past and there was an an attempt we started with puritan and so uh it's just one of those things that we i will say the pandemic happened and so a lot of these programs were put on hold but definitely we're looking into that we're also and thank you so much and for being here i really appreciate you presenting to us tonight definitely we will reach out to you in the in the near honored to present this year's honorees i'm going to read directly from the nomination packets these employees were nominated in some cases by two to three different colleagues and supervisors for this great honor so i'm going to read directly some of the quotes and i'm going to start with mr ricardo fuentes from cureton elementary school our custodial and maintenance services employee of the time to decorate her kitchen and service area based on holidays to create a festive and joyful environment as featured in our photo tan was also i'm going to save that last part next i'd like to honor susan nicholas avila from painter elementary school our clerical and administrative services employee of the year this is what they said about susan she creates a family atmosphere at our school that cannot be matched she is loved by staff and students because she goes out of her way to help others susie cares for her community and takes responsibility in helping to assist families in need of in assisting a transitional kindergarten teacher in the classrooms by working with small groups on reading instructional strategies she uses her animated personality as she instructs four-year-olds during the reading strategy lessons andrea takes on the difficult task of keeping young children engaged as they learn letter sounds and identification the staff at the adelante duo language academy unanimously nominated andrea as a 2022 classified employee of the year andrea has built a strong bond with students at our school with many of our families congratulations to our 2022 alum rock classified employees of the year all right um comments from members of the board uh border vice president phone uh thank you mr president uh you know uh i want to extend my my congratulations to and thanks to ricardo concerto ton susan carlos and andrea thank you for everything that you do uh you know i often say t you know if teachers are central casting then uh was it uh you guys are all the supporting actors and so uh our was it our efforts but uh would not uh you know our efforts would not be uh you know implemented uh for laughing their term if it were not uh for your support and that of your colleagues uh you know uh education is a partnership you know not just between the school and the parent but also the teacher and the classified staff without which the the show would never go on we you know we'd have a is it it'd be an open-ended monologue on one end or the other so uh again i want to express my gran uh my d uh was my gratitude from the bottom of my heart for uh all the work you have done in congratulations on your recognition tonight uh remember i don't know what i saw you had your you were and raise your hand right after thank you yes thank you uh yeah i just want to congratulate all the classified staff employees of the year i know that we all do our job right we have uh all the specifics job specifics that we have but i know that each and every one of you just take it a little further and give a little more if not a lot more and you have been recognized by your peers um you've been nominated um for good reasons and um you know now you're here and you know i know that all of us at alum rock you know just give a little extra um and so that tells me that you give even that much more so thank you for showing up doing not just your job but uh going going above and beyond um and really making an impact um on uh your peers um and those in your community uh within your school um to have received this um so thank you again for all you do thank you for remember yes i also just want to offer my congratulations to everyone who's been recognized tonight and to all of your colleagues i mean obviously this year those who have been selected are the ones who have risen to the top for your work but i do believe that our classified staff are in many ways the backbone of everything that gets done here in the district because not only do you do each of your individual jobs but we know that there's so many valuable relationships that you establish with children on the playground or on the bus or in the cafeteria wherever it may be the relationships you establish with staff with parents and so um you know the work that you do as classified staff although you have your specific areas really bleeds into the entire district and so i just want to recognize all classified staff for the work that they do and really like i said being the backbone backbone of everything that happens in the district day to day um and you know specifically those of you who have been recognized tonight congratulations for this year being you know rising to the top with your efforts so thank you everyone and congratulations remember travis um i guess the words that stood out the most to me about all these workers were that they're exemplary and hard working thank you all for all the work that you do for the students um there's so many people here that are all trying their best to do everything to make everything enjoyable for these kids and you guys went above and beyond thank you i'd like to echo that sentiment from my colleagues uh classified staff are part of the educational overall environment that allows us to provide a quality and dignified education to our our alum rock students here and so thank you very much for the work that you do um from regardless if you're a para educator to somebody receiving uh parents uh students at the front office um all of you are essential to the to the operations of the district that allow us to continue to to move ahead so thank you very much for your what you do um at this point i'm gonna go ahead and call on uh public comment is there any members of the public wishing to speak on this item hello board president at this time i see no request for public comment all right go ahead montana 2.04 santa clara county office of education classified employer of the year assuming that mr torrico is going to take this time again thank you please receive me to share my screen thank you very much and that was again this is uh from the last slide and as i mentioned as i spoke about on the last item each of our winners our honorees were also forwarded to the santa clara county office of education for consideration to be the santa clara county office of education employee of the year and their respective categories so now i'd like to announce we do have some of our employees who are also santa clara county office of education employees of the year we are very honored to have ton nguyen and carlos tripodi also be honored as santa clara county office of education employees of the year their names will also be submitted at the state level to be considered to be state employees of the year all right congratulations uh comments from members of the board uh board member yes thank you just to repeat my congratulations um that i just had a couple of minutes ago but also i do also want to recognize and correct me if i'm wrong but the entire we had sever the several members from our district on the list that went to the county and i i don't know that there was another district that had more i mean it seems like some districts didn't have any this year selected some had one i thought i saw read somewhere that we were the only district that actually had two or there might have been another one but anyway i it speaks to the excellent work that um the two who are being recognized for this tonight have done and again to the work that is done in the district and the recognition that we um because of our our team have have received beyond the borders of the district so congratulations to both of you and to the district for for this recognition uh board vice president you're muted yes yeah i know zoom i'm getting tired of it but to to ton and carlos uh congratulations on your your big award um you you've made a you've made all of us at allen rock very proud you've showed silicon valley what we're made of uh and i wish uh you know i you know both of you uh the best of luck uh you know because i know you'll do us proud at uh you know when when you show the rest of california what allen walk is made of at the uh you know california state level school uh classified employees of the year award uh thank you so much for everything you do and uh you know let's get out there and you know make everyone in sacramento know what we're all about or remember travis you had your hand up just congratulations steve bo job well done uh you're muted sounds like you're really far away am i the only one or others getting the same it sounds like that to me too [Music] very faint i i i have a quick comment if that gives trustee a little bit of time to see if she can fix it if i may oh you're muted right now that's why we're hearing you a little bit i think a little bit oh no all right go for it finishing your comments and then oh is mine loud no no yours is fine oh okay um well as i stall as i see the work going on over there i just did want to confirm i took a look at it and it looks like um in the county there were eight uh winners that were selected from all across the county and we had obviously two of those eight so if if my math serves me correctly that's 25 of those who are recognizing the entire county are are two from alum rock so that's to me that that says a lot and and it you know again congratulations you're very special for your work this year cool you can just talk really really loud let's try it again if not it's okay yeah go for it just talk really loud i just want to [Music] myself um and working full-time i know that on many sleepless nights so congratulations carlos your sacrifice paid off and um we both motivate all of us to to be better so thank you for your patience with my audio care all right yeah get it checked out it's coming in really staticky all right um a comment from members of the public there's no public comment all right see now then uh i'll go ahead and uh finish up with my comments i completely forgot congratulations uh for rising up to the top from throughout the county uh just is obviously indicative of the caliber of work that you all do maybe log off and log back on yeah if you restart the machine maybe it'll fix it hopefully not all right um all right uh moving on to item 3.01 uh members of the public we should address the board on a matter this are you all here in carlos as well okay carlos i'm on the english channel and i'm hearing you translate all right um moving on to 3.01 public members who wish to address the board on a matter not on the agenda uh please indicate by raising your hand at this time hello board president uh we do have one speaker uh labeled as event svh uh you have two minutes please submit yourself when you begin speaking the timer will begin hey thanks so much this is alison singlani sorry i'm on my work account i need to rename myself i'm the chair of the citizens bond oversight committee and a parent at brusd the role of the citizens bond oversight committee is to provide transparency and report back to the public on the way bond money is being spent i just want to make sure that this is elevated to the board and expressed concern that the oversight committee does not have a full slate of members right now as required by law we have worked with the district staff to create flyers advertising these openings and push them out to parents and community members through parent square the translation team has been super supportive in making sure that the flyers and the applications are available in spanish and in vietnamese but with no luck at this point uh we are now short at least three members we do have a fourth member who would like to retire from the cbs teams so as the board moves forward and issuing the bonds that the district really needs to keep our facilities safe i want to be sure it's very clear that the oversight committee that the board needs is not complete at this time so please make it a priority to to help support the district in filling these roles at minimum we need two parents and one community member at large and our senior member is the member who would like to retire she's holding on uh to try to help us as much as possible but she would like to to step down from that role so we do have four roles that are in desperate need of being filled so that we can communicate clearly with the community and preserve that trust and transparency that they need to continue to support the district so thank you thank you miss ellison our next speaker is sandra rivera miss rivera you have two minutes please submit yourself when you begin speaking the timer will begin good evening members of the board my name is sandra rivera and this is my going on 17th year in the district i was just coming to you tonight if we could possibly look into the technology policy that you have the employees sign and look at what we can do to help alleviate some fears for example earlier this month i was using my laptop and going back and forth between home and work and my charger got damaged and when i called and asked if i could exchange it to get another one i was told that i was going to have to pay for a new charger and unfortunately things do happen but in order to have my laptop here at my house tonight so that i can participate in the board meeting i have to bring it home and i have to have a charger in order to do that because the batteries don't last all day so if we could look into a policy that doesn't harm our teachers who already give so much into their classroom by being able to use our devices and not have to fear whether or not we're going to get charged if our charger gets damaged or if the port gets damaged or if the laptop itself gets damaged earlier this year a student of mine crashed into my desk knocked my laptop off and the fear is always am i going to have to pay for the device that i need to teach and do my job so i'm coming forward and asking that we look into that and make some changes to that policy thank you our next that is our last speaker thank you miss rivera mr president at this time we have no more requests for public comment all right uh moving on to it at 4.01 alum rock administrators association good evening board not sure dr bauer is identifying somebody i just wanted to relay a message from tom foo he um told me that he was not going to be able to be here tonight and some of the other teamsters were not going to be able to join us tonight they have been arduously supporting um the parcel tax campaign so um they are taking the night off and thank you for that thanks all right um 4.03 childhood school employees association you have somebody from csa sharon good evening board president quintero superintendent dr bauer members of the board first of all i would like to say welcome again to mr tariko it was nice to see you at the board meeting and um i reviewed the board agenda and board items with dr bauer and she answered all questions that i had and i want to say congratulations to the um classified employee of the year they're they do an outstanding amazing job and it's so nice to have them recognized and congratulations to the two members that are moving on and being recognized by the county that's a great honor well deserved and good luck at the state level i'm sure you're going to do outstanding and uh congratulations really to all of our classified employees who will be recognized next week during classified employees week i agree with what all of you say they do a great job in the the schools the district office even everywhere they're they're pretty amazing so thank you for recognizing them and normally i end with i'll see you next month however next month i will be in virginia visiting my sister so i will see you all in july have a great evening thank you all right let me know item 4.04 adam rock educators association jocelyn the floor of yours thank you good evening i would like to echo what um sharon and many of you have said too and congratulating the classified staff that was recognized here tonight they each one plays such an important role in the education of our students and their in keeping them nourished and healthy and and congratulations to all of them uh i would also like to express my appreciation to those of you who were instrumental in helping area and the district reach a tentative agreement for our 20 to 23 reopeners on salary and benefits it's my pleasure to announce that as of five o'clock this afternoon our ta was ratified by our members um and while i realized that ultimately all the employees of this district will benefit by the salary increase that everyone so desperately needs right now with the skyrocketing rise in inflation i do believe that it will make a big difference for the district as a whole in attracting and retaining teachers to our district i will say i have already heard from several of our teachers who were planning and almost on their way out planning to leave the district who are now actually reconsidering whether or not to leave the district at the end of this year so that is in my opinion very good news because it it definitely helps for all of us to know exactly what our salary is going to be before committing to another year especially after all the challenges that we've experienced these last couple of years so once again thank you for those that were instrumental in in making this happen i realize it isn't completely done yet because the board needs to ratify it um but i i do want to say well it may be an unexpected surprise to have this settled prior to the expiration of the terms of our bargaining agreement this is the way that it is supposed to happen and it's the right thing to do so again thank you to those of you that helped to make it happen and i realized um i and i anticipate and would expect a unanimous support when the board does take a vote on this keep in mind that today's dollars should be spent on educating today's students which involves attracting and retaining the best educators possible i would also like to remind everyone in the community as well particularly that the ballots for the june 7th election will be mailed out very soon the alum rock educators association is a proud endorser of measure i which is the continuation of the parcel tax for the alum rock school district and for all of you voters in the community who support what's best for the students of our district please be sure to vote yes on major i on june 7th because that too is the right thing to do thank you uh ps i want to welcome assistant superintendent cesar tarico as well and hope to meet you in person one day soon thank you all right um moving on to 4.05 superintendent thank you for president this has been quite an eventful month and i want to thank everybody for the tremendous achievement in many many areas i just want to highlight i know that at different points we're going to highlight the early learning center and definitely reaching agreement with our teachers has been very very self satisfying in so many levels because jocelyn is right it was the right thing to do and i hope that the board will support that at a later date i want to thank everyone for participating in copita i think that and i want to highlight in in thank trustee herrera because she connected us with nbc telemundo before that we we were going to do it kind of a la alumrock style you know with volunteers and we were just going to go and and practice and bring it this was the idea of one of our teachers in uh 20 2020 when we were finishing up our march madness he approached me and said you know dr bower we need to do the same tournament but with soccer because most of our families are very uh die-hard fans of soccer so in that following up with that uh after the pandemic as we were getting ready to reopen the school year i share that um you know with with a couple of team members and it's like let's let's start preparing and i shared that during one of my one-on-ones with the uh with doctor future doctor loera and uh she uh uh connected uh telemundo with us and that partnership was just magical i think that i thank you for that trustee here and i think erica and geraldine and carlos one more time for making that event truly remarkable uh people that i know in other circles were talking about copita and it was like magic right when when somebody that is not part of work it's coming and saying we're so excited we want to see it and like a real sports event it really was amazing and to see all of you who were able to be there and to see our kids i want to thank you for that i also want to highlight the work of a very enthusiastic classified manager and and i think every single classified employee in allen rock because you are just like you said at trustee vegeta they are the backbone of what we do without their support we can function just think in terms of cleanliness and i.t we would not be able to consume you know all of those kinds of things that we have um and in that spirit i want to thank jesus for the endless enthusiasm that he brings to alumrock he uh and his team is a true leader like the alumrock wonderful leaders that we have put together a resource fair in very quick turnaround during the copita event and jesus i have received so many compliments of that effort we had the mascots of a lot of the professional teams playing with our children and celebrating dia del nino the international day of the cha of the child muchisimas gracias jesus for your work on that thank you so much for everything you do on behalf of our kids and i just wanted to make sure that in the spirit of celebrating classified employees we also include jesus in that group thank you so much um thank you so much for your continuous support all right moving on to uh comments rewarders trustees i'll go ahead and um call you as i see you all right uh board member uh chavez um thank you to the district and everybody involved with akopita there was a lot of little soccer fans there as well as all their parents and looking around the stands everybody really enjoyed everything thank you very much board member from ah thank you thank you mr president uh well first i want to start off uh thank you for everyone who was a part of cupita i want to extend my congratulations to uh hubbard media arts academy the joseph george middle school girls soccer team and the ocala middle boys soccer team on winning the uh alum rock cup uh you know uh every of every one of our schools is a winner uh you uh you showed your spirit on the soccer field and uh you know showed san jose what we're made of what our kids are made of and what our families are made of and uh you know i look forward to seeing uh everyone again at the next copita uh i also want to take this opportunity to encourage uh anyone interested to attend parent university this saturday uh you know this is an ex very you know great it's great that we're able to do this in person again uh you know your local school district is helping you navigate the public school system so i encourage uh everyone to come and get involved in your child's education it goes both ways the school doesn't work out without family and the family doesn't work without the school so we both need each other let's see here i am very glad that we have a tentative agreement with uh our teachers and i look forward to voting in favor of that as soon as it as it is presented to the board uh i want to con you know uh now that i've just heard it i want to congratulate shepard middle on being the miss the chapter of the year uh that is a a huge huge achievement especially in a time when stem education is sorely needed in every public school so uh you know our schools are uh going above and beyond to seize the opportunities to uh build a better future for our kids uh lastly uh you know echoing uh the appeal of the chair of the bomb committee uh you know we're our district is ready to do big and great things again and the bond committee is helps you know make sure that that process is transparent i myself uh started on on the bond committee and so i encourage everyone who wants to help shape the future of our district going forward to putting put in an application to get on the bond committee this is an exciting time for alan rock and i hope that we all take the opportunity to you know get to a better place so on that note thank you so much mr president thank you i hope that this is better is my audio better you have a kind of an echo but go for it i think it's but is it better so as you're aware i'm having technical issues today so i was bummed that i wasn't able to say my words earlier when erica was here but i want to thank her for her collaboration um i know our you know relationship she called me and said what can we do in alam rock you know i want to bring nbc telemundo out there and thank you dr bauer and staff for jumping on the opportunity and making copita happen for our families it was great to see our schools activated you know our fields um with ice chests and umbrellas and um just you know having children on their little bikes and families cheering on their children their friends um and just the community you know as a whole uh i look forward to continuing to collaborate you know with nbc telemundo and many others um who like them wanna you know bring good things to alum rock um i also want to um thank all the staff you know i know dr barry you mentioned jesus and i saw several other staff that i was there on you know friday to sunday when i showed up they were there the whole time so i'm sure they were there throughout the weekend um and then also uh collaborating with the organizations in our community to bring the resource fair um the children activities so thank you all i know that um it was definitely a success because you were all involved um you know the music was amazing you know we were dancing and it was just great and so i look forward to having many more copitas and many more activations like it for our schools where our families can get together and smile and laugh and cheer and at the same time also i saw a lot of hugs you know to those that came in second you know but you should be very proud of yourselves um everybody gave their best um but you know just the love that i saw right and um within the teammates and the families there really made my heart happy and i look forward to many more events like that um thank you so much and that's it for now all right um uh board remember i don't know do you have any comments um i'll just keep my comments brief in the interest of time but i will um kind of go back a little bit to trustee fans commentary with and uh missing galani's comment that she provided with regards to the to the committee that we need members for um i know in the past we have had several individuals and or groups that have requested to collaborate more with the district and be a part of the district so i would invite those groups or individuals this is an opportunity for you to directly collaborate with the district in the you know in a role that's very significant and very appropriate for for someone obviously we heard that we need parents and community members at large so um i think this is a great opportunity for them so whether they may hear this and and take the initiative or if need be if um staff maybe needs to reach out to those some of those organizations that we may have had come to us with those requests for collaboration um then maybe that would help out to make sure that we are in compliance with what we need to do while at the same time um you know kind of responding to the request of the community to to better collaborate with the district so this seems like an opportunity and um i would hope that that it would be something we can move forward with so that that will be all for tonight thank you all right um i want to change the opportunity to thank um uh the work of my colleagues i know that there's a lot of things that have been done from everybody to help us move in in the right direction from the amazing work that word west president farm did in reminding us that the 90th anniversary of our district was coming along and that was a great opportunity uh appreciate um uh board member uh establishing that reestablishing that relationship with san jose pd which is an important partner in ensuring that we maintain a school a safe school environment so thankful for that and as mentioned board vice president you have our instrumental in bringing in a massive amount of earned advertising to this district to let people know exactly what's going on in alan rock and so that partnership that opportunity that um to partner with was great not just for the advertisement but the opportunity that it created for our kids to be able to be in community it was great to see everybody just having fun hanging out together as an alum rock family uh the staff um demonstrating the amazing work that they do all the time um it was great to see everybody out there and so very appreciative of the work that was done i know a lot of folks who spoke about it um but i definitely wanted to underscore uh board vice president erdogan's uh instrumental work in turning this into a professional uh professional event uh i know it would have been great had we done it you know uh like a homemade style like helen rock does it we put out some great events oh this took it to the whole other level and just to let you know that one of the individuals there carlos who was who was an amigo the alum rock recipient is in june is going to graduate from a um from a european university uh with a degree that was created by real madrid one of the premier best teams best soccer team in the world he happened to be the coach for the kids at um aptitude correct dr barry yes aptitude and so they were getting um training from obviously the curriculum was like some of the best one of the best soccer teams in the world and that's the caliber of uh of equality uh that was coming in from our partnership with with uh ala morocco so once again thank you uh board member for making this happen i know it's so uh that that that trust has been developed uh with others and uh you basically put out your your experience your credentials people recognize that and uh um said all right we'll we'll make it work with alan rock so thank you to all those who will in the work once again i think uh congratulations to hubbard uh for taking the um elementary school um you know bracket and uh joseph george and ocala for um taking the um girls and the boys brackets respectively congratulations on the excellent work that you did looking forward to the next one uh i know that it's going to be amazing um and in addition uh thank you to all who have been working to put on the parent university i know it's always exciting and fun um i know that my kids my family thoroughly enjoys it and they get a lot out of it in terms of the knowledge that they get from the sessions and so i would invite everybody out there who is thinking about it to jump on and register and attend the setting is going to be beautiful um it's at the uh rancho porto golf course a asset for us here in san jose it might not be pebble beach but it's in san jose it's the site of the former thunderbird golf course where i used to hang out when i'd go out there and uh chase after my brother uh because he was uh he as a teenager he would work out there picking up golf balls and every once in a while i'd tag along uh and you know just fun times i know that probably brings back memories from folks uh for me some people say who remembers thunderbird golf course so uh with that said i'm not gonna continue to steal your guys's time with my uh memories of uh thunderbird golf course but uh let's go ahead and move on to um 5.01 discussion consideration resolution number 53-2120 uh this is authorizing the remote virtual teleconference uh meetings um is there comments with regard to this item from members of the public i see no request for public comment uh mr board president all right um i see hands raised for this item order travis you raise your hand um since there has been more participation um with the remote virtual teleconferencing i would like to make a motion if it's possible to uh approve resolution 5321-22 um there's a motion there's a couple of hands raised let me go ahead and take comments and i'll take the motion afterwards just to hear the perspective of the colleagues uh board vice president i get me uh mr president i'd like to move to uh um um i don't know if amendment is necessary but um you know and and uh you know if superintendent bower can jump in uh you know i you know given the situation i i see the merits of this the current situation i see merit this resolution uh however given uh given some concerns about the uh you know uh about the uh breach of confidentiality of closed session uh i'd like to you know i'm not sure if it's in your power i mean it may be in your power to do so uh or you know i'm open to amending this but uh i uh you know i will i believe that it is appropriate to uh suggest a hybrid uh hybrid me a hybrid forum meeting where uh we as the board would return to the board room however uh you know upon consultation with the superintendent uh it is technically possible to retain the online option uh for purposes of participation in board meetings so you know if you would consider i don't know if it's that needs to be an amendment to the item or if it's something that you you could uh do on your own but i would recommend that uh you know it strikes the balance uh of risk of recognizing the current health situation and the issue of participation while at the same time ensuring the confidentiality of closed session all right let me go ahead and take as i mentioned before let me take comments and then we'll get back to emotions um um i think i would like to know the answer to mr pham's question before i um because i'm in agreement something like that and i had just raised my hand to do a second so i don't know if you want to go okay all right cool um dr bauer do you have a response to that um i think that the idea of following kind of the same format that you have followed when you have had these special board meetings where you interview you know the the people and the borders in the dice i think that in the audiences you know in in zoom or youtube um i think that that does not need any amendment it just needs an agreement to the board to come and be in other words the resolution states because that's the same resolution that we have been using all along it's just you as a as a group need to agree that you want to be back in the dice and everything else the the public continues virtual all right thank you for that response uh what remember i don't know yeah i'm initially actually i was gonna second trustee chavez's motion um i don't i do not believe that i would be in support of the amendment or whatever we're calling it um one of the main reasons being that i've for the most part for most of the meetings that we've had like for the selection of all the different things that we've done and we've had board members in the board room and and you know as dr bauer described it the audio in almost invariably in those instances is has been almost inadequate to say the least it's very difficult to hear um board members speaking or the you know other people in the room that may be speaking there's often echoes and all the challenges that we have with zoom um and so and i think that would be it it's worked for the meetings that we've had those special board meetings but for regular board meetings i think that would be um you know not a good thing for our public i think it wouldn't it would not provide them with the with adequate um access to to what is being done in the meetings and so i have concerns about that um just you know the technology of zoom with us in the room and and all that kind of stuff i i've witnessed it to be a challenge already um and additionally you know for me if the whatever concerns there may be with regards to the confidentiality of board meetings and and the thought that this may uh um alleviate some of that i i think that if there first of all if that is a legitimate claim i think that it's unfortunate it's it's sad and frankly illegal i think we all know that um and so there's that level of it i also think that um you know i i believe that whether or not we're in the board room in real time um as board members during closed session um i my opinion or my belief is that in the past even when we have been in person there have been um possible leaks of closed session items um in those instances so i don't know that necessarily that this would alleviate those concerns if they're legitimate so for those reasons i i think i would continue to support as we've been doing i think that in the near future we'll be at a point where hopefully where we can um you know safely and and you know reasonably with regards to the technology and everything else return to what we would call normal although it's been a few years now from what is normal um and so i think um like i said if the original motion was on the floor of trustee chavez i would second that i'm not sure that i would support the amended version or whatever we end up calling it all right so it looks like we have um two schools of thought here um give me a second i'm calling you once i've made my comments um there were some questions raised with regards to technology dr bauer and the volume stuff of that sort are we thinking that those issues are going to disappear given the fact that we would all be in the same room when we're using the right the same equipment that we would use in a regular board meeting oh yes i'd like a response to that yes i followed up with um rit and i think brett is here i wonder if he can speak to that from the technical perspective to reassure the board that the sound will be adequate i rather have an expert's opinion than my very lay woman's opinion so i see brett and i know that jose is here but jose is kind of monitoring the the comments can you answer that question please yeah so uh we we have gotten uh another microphone mixer into the boardroom before basically we were actually using uh multiple microphones in one jack just because we didn't have enough jacks and so we we have enough jacks now for every microphone so that there shouldn't be this issue with some microphones being lower volume or having to increase the volume to maximum in order to get like two or three microphones to work at one time so so that should pretty much all be gone the only issue that we really run into is making sure that when board members or whoever's in the board room when they're actually connected to zoom that they actually mute you know their microphones and their speakers so we don't get feedback from that other than that i believe that's all we really need all right uh thank you for that thank you for that clarification um or board member from you had a comment yeah well i guess i i was gonna ask that same you know question about the technology but uh it looks like we're in a better place than we were the last time around so it is actually uh quite feasible for us to return to the uh for the board only to return to the boardroom while uh maintaining an online outlet for uh for public there so i i would guess that you know since you know we're asking teachers to be in the classroom we should at least make out uh you know make the effort to you know all be in the boardroom and as i've said uh yes they're you know in in response to trustee baehran's comment uh yeah you know nothing is foolproof but uh they're happy i have been you know i have heard of stories of weeks past you know i used to work for the california legislature at one point in time but i i believe that having all five of us there uh decree election decreases the possibility of leaks and allows i you know lord president or per you know presiding officer to have to um grow to provide a greater protection of the confidentiality of uh closed session you know mind you that we are discussing you know uh as this district is moving to a better place we are discussing uh bigger and better things and uh those those discussions need to be able to uh take place in you know as secure as an environment as possible without uh without an un you know undue burden of the possibility of uh a weeks that you know that could prove uh i should say leaks uh that do not help the district in any way shape or form so uh again i mean uh you know we have the benefits of an in you know of an in-person meeting and the benefits of an online meeting and so uh you know uh so if i may ask dr boward um is it necessary for me to propose an amendment at this time i don't think so i think it will be some more of a consensus because you have used this same resolution okay to be able to use it's really this the team working together and coming to an agreement there is no need to change the resolution okay so i would defer to board president to proceed as he sees fit remember i just want to add you know i hear uh board vice president fam um and you know i i hear vegeta i think um i agree i mean i know fam you know president quinteno myself have been here for at least a year right we're in the district office in different rooms um i know you know trustee chavez has began to come in um and for purposes of of the closed session maybe right i mean the room's big enough or we can each sit in a corner and be you know safe um i think in regards to you know changing the entire meeting sounds like the audio you know is gonna be is gonna work better for a hybrid um so i would support a hybrid i definitely would not support for um the entire you know board meeting to come back um into the boardroom um or even in a cafeteria yet um as i know that also takes resources from our district um but you know in regards to hybrid i would be open to that um where you know it's just mainly our board that's in the room along with the administrative staff um i think this room is big enough for that um and i know several of us of us are already here um but i'm also open to continuing in this way until we're in a better you know place where we're um you know safer to come in i know a lot of uh people appreciate um you know and i've heard it myself to have a virtual meeting where they're able to connect um while at home and taking care of you know the homework the dinners and all the other things so um i know it's a benefit to also have this meeting available virtually so um yeah uh i know we're kind of in between both so uh let's see president quintero how you figure this out i don't know yeah i have just a question so i'm glad to hear that we got a new mixer anytime we can upgrade our technology or facilities or upgrade anything that's good news um i'm just wondering if if we've you've done like a test run with the mixer and the multiple mics and the zoom and everything to know that it works or we're assuming that with the new mixer the problem should be solved sorry if that's the question for mr littrell unless dr bauer you want to give the lay woman's response the lay woman know what you're talking about if it's okay with board president i would like to ask mr littrell to respond uh please do bro yeah we we have done a test run we actually did it uh yesterday uh we just recently got it in a couple days ago so we have gone through it obviously before every board meeting that we have a hybrid we actually go through and you know do try and optimize the volume uh for all of it but with the new mixer we won't have to you know kind of pair two microphones into one so we can really tune uh per uh board member that's using a microphone their levels to to the actual mixer itself so i can say with pretty good confidence that it should be just fine okay thank you for that so um yeah i think you know the other part of this for me also frankly is that if we had you know some clear objective obvious um you know instance where where we could clearly say that the the closed nature sessions had been breached then that's one thing but i also um i have faith in my team members and my colleagues to respect the the law to respect the way that things should be done i think we've done a lot of work to turn this district around and be a very reputable respectable um body and i just don't it doesn't sit well with me to to without really cause unless i'm unaware of something that definitively we have to believe this it doesn't sit well with me that we're putting out there that we are suspicious of each other we're not trusting of each other um and i think you know obviously we all have different opinions on any specific item item or overall but i um if that is the ration now the primary rationale it just doesn't sit well with me so if you know if we i'm kind of struggling with it a little bit i do like that we have the new mixer and and that kind of helps me go in one direction but again i'm i'm very proud of the work that we've done to establish a solid board i believe in spite of our differences and um you know i'm aware i'm wary and i'm conscious of of what a decision like this says about that all right um let me go ahead and help us move ahead because i don't want to spend four hours on this item i think it's beneficial it looks like there's clearly two um one side that's willing to move forward another side that's wanting to maintain uh what we have now i want us to move forward with consensus because we're a body and we all have to be here we have to be in the same room if we choose to go with the hybrid model um or we you can continue on with zoom um i would like to say that i'm of the mindset of war member behrano there's no issues with regard to issues with the rarity closed session it's not airing out during laundry but there are some serious issues i mean addressed by this body with regard to closed session um and board member fem is i i i completely share your concerns um and i'm thankful to the vast majority of my colleagues that are doing their job properly there are very very legitimate concerns with regard to closed session however i want us to move forward as one and um if board member bam board member can have a conversation between now and next month to figure it figure this out i would appreciate that and we can go ahead and continue on with the um with this resolution what we're doing is this i'm interested in i would be willing to move forward to a hybrid but uh i would like for you both to maybe have that discussion and what the rationale is for moving beyond closed session issues um so at this point for the purposes of moving ahead we maintain what we're doing by next month i would hope that you both have been able to have a discussion what your perspectives are and hopefully you can one of the one or the other can convince each other uh to come over to your side all right um so at this point if we can go ahead and move forward with the resolution as is take this month you have dialogue and we can come back uh board member phone just before now now are you you know i am willing you know of course always going to have a dialogue but i guess uh should we not leave the possibility open to yeah you can both come to some sort of agreement or you can convince or remember i don't come on board to your side before that we can through consensus or to the broad vast majority of us can decide that uh we will come in in person have the meetings in person the boardroom fairly distanced but it'll only be the board members of the boardroom and they'll be broadcast via zoom for the rest of the public to engage so i mean i mean i meant but in the few you know future you know would we not want to leave the possibility of this as a stand-alone motion for a boat if it came to that uh what like uh to man can you clarify i would say you know uh future motion to have uh to have us meet in a hybrid fashion how about that so you want to make a motion i i should say in the future not not now but yeah yeah that's what i'm saying yes next time um um i want you to have a conversation so you all can hopefully convince each other about um how we should proceed okay it's only two of you so you know leave us out of it that way it's not a run act violation uh wherever chavez you had to handle yeah point of order do we have a motion the motion i made or uh yet because i think i heard that say he would second yeah i was going to get to that okay one second let me finish please and my other question you asked if we had a pardon me you asked if we had a motion and i was informing you yeah yeah but i have a couple other before i i guess the answer can i finish the question so um in reference to uh trustee pam's question every 30 months we do have to uh put the resolution up so are we going to have it in the next special board meeting or are we just going to let it continue to the next month and then vote on it like regularly thank you i think you meant you meant 30 days not 30 months so yes it would come up next next month if you meant 30 days um all right uh so at this point there was a motion or remember chavez you had made the original motion before i hadn't accepted it yet but at this point if you're interested in making it i will accept it yes i'm i made it before i'll make it again thank you all right and was there a second to that motion well i thought i i think uh president quintero your suggestion is reasonable and it's um you know it's a good way to try to reach some consensus and work through the the concerns that we both have so i i'm not sure the motion is to just continue as we are it's it's a proof 5.01 okay so we're okay so this is for the next meeting when we would come back and give you whatever we had come to in our dialogue correct yes yeah yeah you got it back okay i'll i'll second the motion then all right there's a motion and a section uh you had your hand i was just gonna second uh-oh you're on mew turning comments from members of the public at this time i see no request for public comp um excuse me i do see one member miss veronica talton miss dalton you have two minutes please admit yourself when you begin speaking the timer will begin good evening uh this is veronica taulton just wanted to speak to the matters that the board are discussing and i first wanted to say and give uh thanks to dr bower and other alum rock leaders who allowed us to continue to wear masks when the county mask mandate was lifted i'm very grateful for that at the same time i'm hoping that the board members who are not attending in person at the district office would consider the impact that it has on those of us who risk daily exposure with students even when wearing masks um and show their courage and considering coming back to the board meeting just all of them together however they want to do it and it would show your courage it would show the employees who do it on a daily basis that you are standing in solidarity with us so it is certainly my hope that going forward that would be a consideration particularly knowing that staff some have started uh the school year this current school year doing it in person but some have been doing it since april of last year so thank you very much for listening and i certainly hope that you'll consider that going forward all right um thank you miss elton uh at this time mr board president we have no more requests for public comment all right uh if there's no further comments from members of the board i'll go ahead and call for a vote as i see you more vice president now board uh member yes uh board member hi board member chavez i have always been present here for months and so has all the other trustees i vote i uh myself when i motion passes for one all right moving on to item 6.01 approved resolution number 50-2122 resolution of the board of trustees of the alamo rocket elementary school district authorizing the issuance and sale of the general obligation bonds election series a and the principal amount not to exceed 40 million dollars and approving documents and official actions relating there to dr bauer you want to go ahead and introduce an item this is uh this is a historic moment and moving forward for our district and i hope the board will support this it will mean trim a tremendous uh support for our facilities and i'm gonna head over thank you dr bauer and good evening for president members of the board and superintendent dr bauer mr chavez if you can also elevate mr joe crump uh from uh dale scott and also miss courtney jones from jones hall there are partners that would be able to assist the board um in answering any technical questions that you might have but i can start with the background this resolution in front of you this evening is to request the board to authorize the districts to issue uh approximately or not to exceed 40 million dollars of measure i uh 2016 bond you may recall that uh back in 2016 uh voters uh approve uh measure i bonds um in the amount of approximately 140 million dollars since then we have not issued um any bonds from that measure um and so as dr bar had mentioned this is an historical uh step for us uh as we're able to tap into some of those funds um a couple things i want to highlight with this request is that um part of the bond proceed will be utilized to pay off the 2000 cops uh prepayment uh right now that cops obligation is about nine million dollars and so of the 40 million dollars that we're asking to issue um about nine million dollars of it will go towards um paying off that cops obligation and the remainder um will be used to fund projects that the board have previously approved and those projects consist of the hvac systems and also some regrouping projects at some of our disc our summer school sites and with that um i will take any questions that the board might have any questions for members on board all right um let's uh i did have questions uh but dr bauer and i 101 did a good job of conveying to me the you know the information i need and so i don't i don't have questions at this time and also mr chang's um short presentation kind of answered the questions that i had so thanks right um all right uh there's no further questions or comments so go ahead and wrap up with my comments um i am very very happy uh and that this is a milestone and moving away from a lot of the issues and um the problems that we had in the past this the only reason we're allowed to do this is because we've been able to clear up a lot of those issues i think this is important for the public to be able to recognize that those who you put in place i'm not talking about individuals or anything but the action of putting people onto this board um does have consequences and it's important to be thoughtful and to think of um what you're doing when you're making a very very important decision because um those who are here are going to be making decisions that can either move the district forward or can [Music] cause some serious problems we weren't able to solve bonds we weren't able to move ahead with our with our needs a very very um old district with a lot of old buildings because of some uh um poor decisions that were made by uh some individuals in the past and we used to show on this board we just got to be clear about it and so um i'm you know it's very very exciting to see that we're able to turn the page and uh look forward and continue on and be able to repair make the repairs close off that those cops so certificates of participation are looming over us remember those conversations that were holding years ago and i had explicitly uh mentioned we need to pay that off i don't like that looming over us no no don't worry about it leave it alone it's it's uh you know some sort of finance thing as if i'm some sort of whatever fact of the matter is that i appreciate the proven approach that we're taking now to just say let's remove that so that no longer pose a threat to our um general fund what you know i i do want to you know uh i uh to uh make a few remarks uh on the importance of this occasion uh you know this is about alan rock for the next 90 years here uh you know i've had the pleasure of visiting uh all every school site in this district and and a couple of them a second time and uh you know these buildings are serving their was it some are serving their third generation some are serving their fourth generation uh of children uh i know for a fact that the the cubbies at aptitude and gospel or in the kindergarten rooms are still the same cubbies and i went to school uh to uh over 30 years ago our children deserve better this is an opportunity for us to uh provide 21st century facilities uh in a 21st century world and to uh upgrade our buildings appropriately to you know uh our children should not have to melt in late spring heatwaves this is this this moves us forward in providing uh our kids our staff you know the facilities uh they need to continue to provide an education for the children of alan rock and uh you know it is a huge step for us to move from fiscal trouble to issues of fiscal disclosure which which i faced on the bond committee to a position where we can we can confidently go to the public and issue these bonds uh so uh for those reasons uh you know i want to thank everyone who has had a part in getting us to this point and uh i urge my my colleagues to join me in approving these bonds all right uh board members i hope that when we uh replace those cubbies that uh board vice president fam maybe can keep one of those vintage cubbies um i just want to thank you board president because i remember being a parent at the time i remember you being one of the only ones if not the only one i'm the only board member at the time voicing exactly what you talked about and so many other things during that time um i just wanted to highlight thank you thank you for your time um and your commitment um ensuring that our children and the families that you represented that elected you at that time um that you were you know here on the board to be our voice and sometimes our only voice um and you know thank you to the staff who stuck with us you know dr bauer culvera i mean we're here because of many right many staff time and just continuing to push believing in our district and our children um ensuring that we have what mr pham talked about the next 90 years in mind and that our actions you know will have that effect so thank you all um to get us where we're at today you know um i know you know as a one of the newer trustees you know i had my little part and so um as vice as board president talked about earlier you know what we've done has really made a difference into where we're at now um so thank you all and um i you know urged uh the rest of our board to to um to vote yes on this matter um but i really wanted to thank everybody um that did so much work to get us here to even be able to vote on this matter um so with that yeah turn it back to you board president all right uh if there's no further comments from the board and we're gonna go ahead and move on to uh comments from the public see no requests for public comment at this time mr board president right uh we're gonna go ahead and call or call for our voters i see you board member from i remember to interrupt you but there makes motion to approve a second second second by board remember there's no further comments from my colleagues on the boards and they'll go ahead and call for a vote as i see you or vice president prom aye 49 motion passes four to one with board member linda chavez voting in the descent winning against asylum all right uh moving on to item 7.01 approval resolution number 49 fifth amendment to the joint news agreement with dango to add additional facilities at cesar chavez early learning center dr bauer do you want to go ahead and uh introduce this item this is also a qui quite a historical moment and i know that um there has been a lot of work and a lot of efforts to get us to this uh i will have some further comments once the item is considered enacted upon by the board if if i may uh trust a board president i know that um this is the an amendment to the lease and you you receive the information about it and once the board considers and depending on the board action then i would like to have some comments at the end if i may i do have uh comments from the public remember the public wishing to speak please indicate by raising your hand no request for public comment at this time mr board president all right at this point i'll go ahead and uh i'll go ahead and entertain a motion move to approve second motion by board remember second by board member linda chavez all right i'll go ahead and open it up for discussion more remember uh boardwalk yes thank you mr president uh you know um i you know i know you know from from the april meeting that yeah you know uh you know we we took we took us we took action to transform uh chavez into uh chavez elementary into the shadows early learning center and i wanted to uh reiterate uh what i said then which was you know this is an opportunity to take a uh to blaze a trail not yet taken in you know uh an action to make sure you know to see that cesar chavez continues to educate a new generation of allen rock students an action that uh you know does not does not result in any losses in staffing or nor educational capacity on the part of this district uh you know our partnership of kidango allows us to move into to take advantage of a uh you know of an opportunity uh that we have a great deal expertise upon early learning uh for us to move in that direction to serve a new a new population of our children uh as well as ensuring that the uh we retain ownership and control of uh the property of the residents of alan roth and i you know again uh you know this uh you know uh you know i i look on this but what hope and faith in the future that we will we will be providing a brand new array of services uh to an underserved population and to [Music] prepare our children uh more thoroughly uh for uh for k-8 education and beyond you know every dollar we spend on education means that we save a lot more dollars uh you know in dealing with uh our children if things go bad in the criminal justice system so uh you know this is a great uh uh great great opportunity we have and uh you know that you know for us to move forward in a in a new direction that will uh keep keep alim rock uh relevant as uh the foundational educational authority in the alum rock portion of east side san jose thank you all right uh board can't remember who raised her handed her first board member behind him thank you um i just wanted to first of all um mention how something stuck out from my conversation with dr bauer in our preparation for tonight's meeting um that really makes me proud to be a part of this board a part of this community a part of this district in that in the work that i've done you know professionally for the past 25 plus years i although it's not directly with education i've been aware of the the the research that tells us about the importance of early education the impact on that um that type of education positive or negative with if it occurs um or doesn't occur and so i've always been aware of that research and in the work that i do it's come into play and now on the board it's much more directly come into play and and as we were talking about that dr bauer and i we're just talking about the fact that there's millions of pieces of research out there that speak to this and one of the things that we kind of came to a conclusion about or just a realization or stated out loud is that the research is just research until you put it into action until you do something about it and i'm proud to say that alumrock is doing something about that research is actually implementing the findings in that research in a very strategic um you know purposeful well thought out collaborative way that i think will be sustainable and so you know i'm very proud of this work um in addition to that i think the specific item that we're approving tonight um is for some of the work that needs to be done to prepare the this physical structure the environment for this this new direction that we're moving in to be more appropriate for this the children that will serve and i'm excited that you know i think there's even vision beyond that um for what is possible here and not just you know have a have some kids in some classrooms that we have and pop them in there and teach them but actually you know maybe some innovation beyond that that really will serve our children and our families beyond what we're even maybe have conceptualized initially and in a way that um in another instance yet another instance sets alum rock apart as a trailblazer as a district who's innovative who serves the needs and and answers the the responses and the requests of the community and does so in a way that's you know collaborative responsible and future thinking so i very proudly will support this this um item tonight and i'm excited about what uh what lies ahead for us as we continue in this direction uh board member thank you um and just with all that i just want to add you know um after reviewing the lease and those details um you know and asking dr bauer questions um thank you dr barr for the answers um it's important that you know we we look at um these leases right that that are gonna be beyond us um and and ensure that um you know the the partners are paying their share and um also understanding that they are going to be investing right in our community um and in moving those um actions forward as trustee vicarano mentioned um that we're able to do it uh in just having the children in mind and the families that are gonna benefit from it and so with that you know i know it's not a part of this lease yet and i know we're in the early stages um very exciting um and i plan to support this as well um but i did mention to you know i asked dr bauer about um you know in the future right because the thoughts are already coming in and um the children and uh being able to provide resources for free or not and i know some of that you know depends on funding that is um that we get but as a trustee i want to ensure that we do all that we can um to ensure that these services are accessible for our families here in alam rock um you know whether that means looking for more partnerships right to ensure that we're able to um you know provide these resources um at a low or no cost right um i know we're not talking about those things now but i just want to make sure um that you know we open the center but that also the resources that are at the center that are for the children and families of alum rock um so yeah thank you staff i know it was a quick turnaround i'm sure there was a lot to do behind closed doors to be where we're at we were at at the last meeting and then be where we're at today um so thank you for that and i look forward to supporting this thank you further comments from the board all right um see none that'll wrap up with my comments uh i think that um we have a night of uh items that are clearly denote that we're on the right track we're moving the right direction uh we have a good team both as a board as well as staff that's allowing us to chart our own course and adapt uh obviously doing it in line with what we've for the input that we've received from the community if you have the the the committees that have been set up and establishing a course a lot and in accordance to our practice of transparency that we've adopted here is important so very appreciative of the work that this board that staff has done to allow us to move forward um this item is representative of uh alan rock that looks at the reality and adapts and doesn't just simply say we're gonna stay the course and until we're forced uh to make it make a decision forced by the state foreign agencies no we came up with a a good a good plan that was a product of of of public input but also part of a a priority that we set up as a board to retain our assets and have them under the control of the public this is the public's assets and they're still here for use by the public and uh we have on site a certain number of grades that are still alum rock greats and we're supplementing it with our partnership that we're looking to establish if this uh item moves forward and uh that should be an uh indicative of this new way of thinking uh that alan rock just doesn't hunker down and says well let's see what happens no we're not going to go the route of sac universe sac city unified or san francisco unified or englewood we are being responsible we're moving in collaboration with our partners to make sure that it's a win-win for everyone especially for kids and so for that i want to thank the board i want to thank staff for bringing this forward and i at this point if there's no further comments i think i called for public comment earlier correct the very beginning yes um i'll go ahead and i'll ask for a motion to approve there's a already a motion in a second yeah no motion die second all right thanks i double move all right all right um all right well thank you for that um at this point if there's no further comments remember the board i'm gonna go ahead and call for a vote i was in favor uh please indicate by saying that i'll call you to see you board member board vice president bomb aye board member behind them aye uh board member of the chavez hi with myself 49 motion passes unanimously correct dr barry you said you had some comments i just wanted to thank the board for the tremendous support and i want to ask the staff in in permission from you board president if we can bring uh scott moore executive director from kidango to be uh raised to the panelist um he wanted to say some words to the board and i wanted to echo we are right now trying to to talking about trailblazing we are investigating and we're i think we're pretty close to find the answer we are going to be the first public school zero to five in the state of california and this is super exciting there are other um other elementaries that have infant and toddler programs but they have sort of like you know they they it's more of a supplemental services this center is being designed before your eyes to serve zero to five so we're still doing a little bit of double checking on that and more of that information to come but that is super exciting because we are resetting the way we do education in the state so scott thank you so much so honored to be uh partners with kidango on this uh one of the most excellent early learning programs in the nation so scott thank you so much and um i'm popcorning it to you yeah thank you superintendent bauer and thank you so much uh uh board members and and staff it we're we're just thrilled um kadango's been uh serving the alum rock community for 20 years uh and you know it's alum rock is kadango and kadango is alum rock uh and the idea um when we first you know designed our public school system uh 90 years ago or however long it was we started at the age of five what we learned in the last 90 years just like so many of you have reflected on is you know we would never start at the age of five it's too late we know so much learning and development occurs starting at birth and the cesar chavez early learning center is going to be a model for what the future of public education can be and it's going to allow alum rock families to stay in alum rock because as we know it's really hard to afford to raise a family uh in the bay area but if you have free child care starting at birth that's that's a big support and it's more than just allowing families to work it's it's allowing children to learn and develop in a way that prepares them for success in school and a number you talked about the research there is a tremendous amount of research on the power of early learning and i just want to note um that the university of chicago did a study a three-year study on kadango's programs and it found that kavango's children are as well prepared academically as the top pre-k programs in the nation and that's not just the university of chicago saying that that was published in the new york times so you know our commitment to excellence uh you know does not waver um and you know we're always just so proud to be a partner of alum rock and we're just super excited to be able to build on that partnership and continue our support so thank you all right thank you for your partnership moving on to item 7.02 information presentation on facilities condition for releases by charter schools uh dr bart you want to go ahead and shoot this i am going to turn it over to mr chang thank you dr bauer uh mr chavez if you can elevate mr lowe shira and also artudo vazquez up to the panel they'll be doing a short presentation of the facility conditions thank you [Music] mr shira and mr vasquez when you're ready please go ahead and start um well thank you mr calvert chang and dr bauer and board president quintero and board members um we've been asked to do a little presentation on the condition of the charter schools their facilities in alum rock and so i'd like to share a presentation that we have so there we go okay let me move this up okay charter school facilities assessments um 2022 and we're down to what what uh question are we uh asked to to uh review and as what is the condition of school facilities operated by charter schools in alum rock so i want to look at some of the site descriptions here um you know what okay so site descriptions um the facilities we we didn't look at all of the charter schools in alan rock but we looked at three of the very large ones alpha public schools it's 35 000 square feet of facilities uh provided by the district as well as eight classroom portables that they have provided and they will be providing two more uh kipp public schools again a large facility thirty thou thirty three thousand square feet provided by the district plus twelve classroom portables and one restroom portable provided by the charter schools and then escuela popular 45 000 square feet of facilities provided by the district and then recently completed 24 additional classrooms provided by escuela papua looking at these charters alpha public schools has two charters and we reviewed both both of these are located at the sonicare site uh one of them black alvarado sponsored by the district and the other jose hernandez sponsored by santa clara county office of bed uh one's k-8 the other tk8 uh the current lease dates for for alpha public schools uh goes from july 1 2021 through june 30 20 26 although they uh were part of that district chartered in the district uh long before that the current lease uh kipp public schools very similar situation two public schools at their site the miller site uh both uh chartered by the district uh five grades five through eight for each of those two charters um and the same dates for their current lease uh 2021 through 26 but again they have been in the district long before that as well and then finally a squalor popular a very different kind of lease arrangement there uh they're sponsored by east side union high school district they're at the pile of middle school right next door to the district office uh and their lease is a 40-year lease august 2010 through august 15 2015.

now how many teachers are in that section that has to do with classroom class size reduction right now that's six positions okay when i came to the district it was nine we had to cut it back because that per pupil thing had dropped from i don't know what to 425 well that's a huge cut i mean even if it was 600 that's a huge cut just like right now from 400 to 700 is a big jump um but i knew that we could i knew we could guarantee unless this whole thing goes away or people stop buying things in arizona we can guarantee the 2500 and some positions in that other budget okay so then this leaves everything else so anna your question and then i have one more piece of information for you okay so the only thing is okay so is this paper just for the guaranteeing of the 2500 no or is there a statement in here that that lets them know that they would get that extra yeah at the end kim will you go uh go back a little more i just because i didn't see so i wouldn't make sure that okay okay right here so you see uh component two yeah okay component two is the one that tells you the annual funding that is not expended in the base pay plan and the maintenance and operations plan which is the paying for teachers will be distributed to teachers okay so the basement where is that the base no the base pace is 1500 the 1500 is 1500 the thousand is if they earn their 10 points but they could earn eight points and get 800 of it yeah so that's freestanding yes still part of yes the top component yes the second component is this yes oh okay okay okay okay okay so that's that's what i was sure because i thought component two was the thousand dollars okay okay so basically here you're guaranteed 1500 on your paycheck type stuff then here's another thousand at the end if you do all your site and student activities and then whatever's extra here's component two yeah you know yeah absolutely okay okay okay the rest of the money and it'll be the rest it'll be the rest of the money uh up through the may payment which comes in june and teachers liked the idea that we could wait one more month because that means that the people this year who've earned it are get as much of that money as they can i can't i can't pay them for money we haven't received yet so um so the what they get then in august that's the that really was the june payment that's really small you know it's a couple hundred bucks or something but um but that means that the people who were here this year get the bulk of the money now the thing i will tell you is for this year be so this is going to be i'm hopeful that nobody thinks this is bait and switch because it isn't but this year we actually only filled three of the six positions that are were budgeted for these funds so the the budgeted part for the other three now rolls into this pool of money even better yeah uh there were um so you know so it's going to be that's a big chunk and there are a number of teaching positions we did not fill this year so there's fifteen hundred dollars times however many positions those were that we did not that were budgeted it is going to be an amazing prop year okay but i want you to know that when i come back to you next year uh if if the let's say the money stays at 7 25 and they haven't told us they usually tell us by the middle of march what the dollar figure is going to be for next year i don't know why they haven't told us but they haven't it kind of scares me that they haven't told us but the thing is that next year let's say we fill all those positions and let's say the money stays the same at 7 35 or whatever it is right now the prop payment won't be as big so i want you to realize that when that happens and somebody goes how did we have the same total and we got less money well it's because we spent it the way we budgeted how many teachers are on staff too absolutely yeah i just wanted you to be aware i was wondering oh yeah i was reading it the same way because component two was for the thousand and i was like oh this makes sense all right and the committee has already this is there and it has been approved at every site we had to have seventy percent uh employ uh teacher approval from every site for this to come to you as the board and um i think we had about 95 percent approval excellent i would like to uh make a motion that we approve the classroom site fund i'll second that motion adapter i'm cory burgess hi charlene diaz hi anna boyd hey i have 6.3 approved the acceptance of internet connections e-rate fund for the and issue purchase orders dr stewart mr president and board members if you recall a while back james presented e-rate applications and these have been these were approved and we got quotes for them and so we're recommending that we go ahead and accept these awards from the e-rate uh and pay our fifteen percent any questions no no it looks good i'd like to move item six point three i'll second that motion all in favor aye corey burgess aye charlene diaz hi anna boyd i am 6.4 teaching positions mr president and board members i am requesting some additional positions out of mno budget because what we wanted to happen which is less need for transition classes after this year from this year to next year so those positions were funded out of esser funds and we don't need them but we need we still need the teaching positions so i'm requesting approval for four positions in mno that move back from esser into mno and then i'm also requesting that we reinstate one of the elective positions at fox creek that we put on hold for this year we did that bef when we didn't know how many kids we were going to have and we just held it and then just never filled it so i'd like to have that one reinstated and these are in dis in addition to um uh oh and there's one other one um uh no two fifth grade positions uh these were all those positions uh those four positions were all paid out of esser and and we want to reabsorb those so um i'd like your approval to do this in addition to um the previously approved positions and these are sustainable positions yes and that was our dire that was what we were hoping to do anyway so the fact that we're getting students back means that you know we can pull these back into our budget any questions i'll second that motion all in favor hi corey burgess aye charlene diaz aye anna boyd item 6.5 addendums for district committees leadership positions club sponsors and coaches mr president and board members i'm getting ahead of the game here i usually bring you this list in august or september and we were working on getting them getting the approval from principals to pay these addendums and i thought and let's just put this on this agenda so we have it on the agenda there may be some um there may be some adjustments later but at least we've got the the base uh base set up and i'll remind you all that you raised the amounts that we paid to these folks last year which they greatly appreciated so i'm recommending adoption any questions i'll second that motion all in favor aye corey burgess aye charlene diaz hi anna boyd 6.6 i had put it revie the new business and she had put it in the consent agenda so you've already approved this all right okay 6.7 that was fast aspa services dr stewart mr president and board members we are members of the board is a member of the arizona school board association and we do participate heavily in their policy services as well as in their uh subscriber manuals and in their trainings and all of those kinds of things um we've not had this kind of a contract from them before or this kind of request or agreement from them before so when i got it i knew that i would need to bring this to the board if you notice excuse me if you notice it is they're requesting a commitment for four years and most of the other things in the agreement are exactly like they've been um i had one problem it's a year-to-year contract and under their termination clause if we get out for whatever reason we have to pay the whole contract so even if we do a year-to-year contract and we decide we want to be anymore we're still paying um i would like to send it back to asba until we want to be on a one-year contract and if they don't want to do that they will [Laughter] then we will figure something out i don't have a problem with asba i just have a problem with telling me oh you're going to be on a year on your contract for and it's a four-year renewal so you you do every year but i mean like with any election service what happens if something goes awry and the new board wants to get out we've tied their hands they can't i'm not comfortable with that so i'd rather let them make the decision each year when they come around and if they want to make a change they can make a change um we're still going to live up to our part if we sign a year contract we're going to pay our contract i'm not saying what we're going to get out of the contract but under termination the amortized fee 48 months times the monthly rate minus the subscription you pay the whole thing i'm not okay with that so they just let's just go on a year to your contract and that's what it's always been we've done it yes and now they're wanting to go four years but we just want to use your contract carolyn did they give you any reason why they changed that no they just sent they sent the document okay and i think i'm sure they send it to every you know every member district right yeah i have my i have my suspicions but they didn't say okay i'm okay with sending it back and telling them we want one year only we'll do a year at a time see what happens see what they say um you probably should make that a motion and move the current contract resubmit to asp on a one-year contract i'll second that motion all in favor aye corey burgess i'm charlene diaz hi anna boyd so if they agree with one year absolutely so item um submission of proposed issues for consideration for the 23 political agenda mr president and board members this is the opportunity that the board has to put forth to the executive committee of asba the things that you would like for them to emphasize or consider or push you know to the next legislature obviously this one's about over every year they create an agenda with the input that they get from board members board governing board members of sba aba sba and um and and then they present those to the delegate assembly of the last at least the last three years we've not sent anybody to that delegate assembly but you always have as a as a board the right to elect somebody or send somebody to represent your board at those decisions so i just wanted to be sure that everybody especially since we have several new people recognize that you this is an opportunity that the board has to say for example we really want asba to push for state funding for all-day kindergarten i'm using that as an example and i'm using it as an example because this board has done that in the past that's been one of the specific ones the board has done in the past so it's an opportunity for you to say hey asba you represent us this is important to us and if enough different boards say that same kind of thing of course it becomes one of the items on there on their agenda so if you have things that you would like to put forth this is a good opportunity and we may not be ready for what ideas you want and it isn't it isn't due yet no but i want you to have time and then we tell the public this is the things that we want aspa i have attended this conference in the past but it was in years past um it works out really well basically they take your ideas they if the board sits out there they tell you this is what we're talking about it's discussed it's voted on as a body of asba and they make the decision and move forward i've had many suggestions that we've given some went over well some they didn't like that's kind of what happens you know when you have a body like that um but i like being able to have to have a say and we do have to say um doesn't mean and many of mine have been shot down but i get kind of used to that right 27 years [Laughter] um so yeah it's we have time so if you have ideas bring them um and any idea let's talk about it as a board we send those in and as dr stewart said anybody that wants to attend that if you haven't been to any of the aspa training i highly recommend it because it is fantastic training but fitting sometimes fitting that into your schedule you should have the time you should have the timeline in some of the asba information that comes to you regularly uh i saw it the other day and i'm sorry i can't cite for you which one of the little announcements but you don't have a huge amount of time but you do have a little bit of time and as corey said it's a pretty good example of the democratic process um you know in in a smaller setting so um so be thinking about it and maybe we can come up with some ideas for next meeting put in the workshop we can talk about okay ideas and that way we can get a little bit ahead of it so when it comes closer to that crunch time we have an idea where we want to go okay all right so let's um we just don't need to take action on that no that's okay i wanted you all to have a chance to talk about it i don't know that we need to okay we'll move on item 6.9 governing board policy revised regulation j-i-c-a-r-a student address mr president and board members the superintendent's advisory committee employee advisory committee has met several times on this one if you remember they were the group that presented to you the adult dress code regulation and and they felt like we needed to renew review and update the student one so you can see things that have been struck and you can see some things that have been added and some of the things that have been added have made this consistent with the one for the adults and others are items that apply to students and might not apply to adults so um as i say they've spent about three meetings going over this a very good discussion and um role playing sort of we had some devil's advocates and we had lots of discussions so um they're very they're very much wanting us to not just have this revised version or a revised one but that we make sure that is stated the same way in all of our handbooks and then of course that it's um carried out by not just administrators but by teachers and and folks in the school so if you have questions suggestions things you want to change they know there might be changes okay you go first can we go to the top um the the pants uh we're adding with no holes shreds sprayed edges overalls skirts or pajamas um i'm all about the no holes and shreds i'm all about that i do have a concern we get some students especially young ones that may fall tear some pants get a fray in there and what if that's their only pair of pants all of our all of our health offices have have clothing and so if that happens um the student is offered clothing yes but what kind of clothing like are we like because if you're talking about someone who's like they only have two pairs of jeans and they rip both of their pairs of jeans and it has a hole in it when they go to that office do they get a new pair of jeans they might or might not be brand new they may have been gently worn that somebody has done it but they are jeans okay we try to give them something similar yeah yeah that's why i'm just like like are they gonna be walking around with hot people no no no no no no it's gonna be it's going to be similar it's going to be similar similar as we can make it you know we don't have a whole clothing store in our health offices but we do have we do have um you know selection and of course sometimes it's going to be a little bit determined by size and and those kinds of things but our health attendants are really good about uh you know about collecting those kinds of things and and having them available so yeah we're not going to cite some student for a dress code violation for something that happened you know an incident that happened on the playground kind of thing also on that same one skirts or pajama pants pajama pants i am 100 thrilled with no pajama pants right that's a problem for me but you have joggers you have other types of pants that aren't pajamas are they included in that no they had a long discussion about pajama pants they're talking about the flannel baggy drag around the waist they they did talk a little bit about the difference between maybe if they were a plain flannel as opposed to one with bunnies or hearts or football symbols or whatever and they decided no let's just say no pajama pants that way we nobody has to make a judgment the only judgment is are they pajama pants meaning the flannel baggy ones or are they not pajama pants at the very end final decisions made by site administrators exactly [Music] where there's a couple more i had if we go down further i don't see it there ah yes the closed toed shoes part um kim if you'll just roll it up just enough to see the bottom of the other page okay so you notice that it used to say encouraged they were all adamant so recognize that this is a this is a committee that has two teacher representatives from each site it has a representative of health attendants it has a representative of a clerical staff and it has a representative of our paraprofessionals uh transportation has a representative but he doesn't usually get to the meetings so but it's a you know we're talking about a very representative group of our employees and they were adamant that uh because of safety they're seeing real safety issues even at junior high with shoes that don't have closed toes and so they pushed that and they had a long conversation about crocs because those are of course close close toes um they decided nope if we say it has to they have to have some kind of back on them so you notice that addition of with a back so crocs usually have the little strap they're like more likely to stay on feet if the strap is up so they really wanted it to be that and they very much wanted to make sure that students must wear appropriate shoes for pe so that means they might have to have a second pair of shoes for students who don't we go to legacy shoes appropriate shoes would be shoes that would be appropriate for pe are among the items that legacy gives to our students as part of the backpack program so they always have available to us shoes so if we have a student who you know maybe has one pair of shoes and we know that's the case with some of our kids all they have to do is ask and we'll take care of it that's awesome i did have one more sorry go ahead one more time go ahead because it kind of plays into the whole physical education thing um i'm so i don't know how else to put this but junior high boys stink out they do and i'm okay it's it's not reserved to just junior high yeah fourth grade high school very stinky yeah it just goes it just keeps going just just don't stop at an age perfumes cologne senate deodorant soap senate hair gel aerosol products are prohibited at school i got a problem with that because some kids need well but here's the thing is that deodorant comes in a stick yeah but it says scented deodorant so that's that's so but you can get unscented stick and understand and they they leave it in their backpack and use it after pe okay okay i'm just saying so i i also don't particularly like this one i understand if you said no aerosol products you know no aerosol deodorants no perfumes no axe body spray to take your shower in those kinds of things and stuff but it says yeah but i i disagree with the the deodorants part um and mostly because you know sometimes that might be the only one that they have that was the only one that was 99 cents or that was the only one someone gave them and i don't want to limit it and like i'll be honest with you i mean i i my mother-in-law had extreme fragrance allergies and she could not tell when i was wearing scented deodorant okay but she could tell if i was wearing perfume or a scented lotion but not a scented deodorant she couldn't tell like and i mean her face would get all red and her eyes would start puffing i mean we handle it in a specific situation when a kid has an allergy we deal with it that doesn't mean well that's that's why i was saying like the deodorant part if you wanted if they changed it to aerosols i think that would be a lot better we could take out the deodorant part if you want leave the other things are you comfortable with that i mean yeah i mean i i personally don't like it when kids like spray spray in my classroom and stuff so i would yes that's what i'm just i'm literally like a kid walks down the hall and you're like you know what i mean so i i had actually be perfectly fine with not having aerosols in school but not banning them from say putting some on before they leave the house per se because i mean nothing nothing you say is going to stop them from oh no and the intent there is not to say they should not use it but [Music] personally maybe strike off like the the santa deodorants but you could and i would agree with this because i've gotten some aerosol deodorants that were very like made my i couldn't use them because my husband was sensitive to them so if there was a way to add no aerosols okay right then that would that would do the well they have we have no aerosol products okay okay okay sorry i got so stuck on the deodorant deodorants is one of the items so so strike yeah so strike off the deodorants okay who brings soap to school well i mean maybe there should be a rule about they must have deodorant with them i actually have some in my classrooms that for little little ones that i buy that when they have emergencies yes you can get little ones that they throw in their backpacks it was a fun car i still have them in my house okay my only um i i have no problem with the with the um dress code at all but um i would like to encourage strongly encourage teachers to adhere to it absolutely because many times i've walked into classrooms and students have hats on or they have their jackets on that are not whatever their school is or you know yes so we have the dress code yes it needs to be consistently because i can go into one classroom and it's like you know strict and then another one it's just whatever right so and that was and that was made clear by the committee as well it's it was just not the kind of thing that i would bring to you all with something in writing so i will say one more thing i don't particularly like it as a teacher if your classroom is really cold and that is the only do so do we have jackets for them to wear just in your classroom or something like that because the school approved hoodies and jackets yeah but so so does the school have those to give to them that's what i would want to know because if some kids only has one jacket and your class is freezing that kid's not learning in your classroom if you can't put that sweater on but we have another problem then i mean if we i mean if the classroom is that cold then we have a different problem that i need to do everybody's different like i get freezing cold in rooms where other people are taking their sweaters off do you see what i'm saying so that's the only concern i've always had like at mojave ours is more like along a bunch of different colors right spectrum that could definitely be on on the the aspect of the site administrator handling that problem because we do have a student that does get colder than other students that's something we need to address with that student rather than saying and i'm not a big fan of how we handle our outerwear because it gets abused yes yeah and it needs to be this is our outerwear that's approved in the classroom so if you're cold that's maybe that's your christmas present or we can deal with it another way of maybe we have to find some jackets well they can and that could be well that's what i'm saying it's like there needs to be if we're saying that you have to wear a school approved or school with a logo jacket on there then there needs to be available those kinds of things that's the only thing that i don't like about that is because you have kids that can't afford those things they can't afford it for christmas i think i spent three years of my high school year not even having a christmas so on the individual basis so and then but then you're going to have the arguments from other kids why do they get to wear it no no no no no wear that jacket because if we have somebody who's freezing out of class then then we'll figure it out we'll figure it out okay changing what the dress code is or or making those because that's going to be i believe that is going to be the minority that's going to be the exception and we do usually have we do usually have some of those sweatshirts in the health office in that clothing we don't usually have as many of those as we might have jeans or socks or even underwear because we do provide that for some students as well or school shirts we usually have lots of school shirts so um you know so there are usually a few of the sweatshirts if we need them okay but on another knock the kids can wear a regular um outside sweater sweatshirt underneath their school shirt yeah so as long as that logo that school shirt is showing with the logo they can have a sweatshirt underneath that it doesn't have to be a school sweatshirt underneath it so that would be beautiful and we have lots of kids who do that yeah we have lots of kids who do that to solve that problem right well we can those can be addressed in and yeah the principals can figure that out there's nothing that is set in the stone there's an exception to everything okay um but i'd like i like the idea to be consistent that's that's my big this is where it is this is what is expected and this is how it's going um because it's going to make everybody's life easier when that's the case yeah i know that the one thing that i hate hearing is you know sixth hour well nobody else dress coded me yes they did you went you win the bathroom and change it when i'm the one that caught you first hour here you are six hour away and okay yes you did you changed so but we get that consistently that expectation going um that's that's great i like it okay any any other so really all we're asking is the change of strike scented deodorants strike that pretty much okay we can do that all right um okay we need a motion i'll move that we accept the um dress code revised regulation j-i-c-a dash r-a student dress with change of striking this the center deodorant i'll second that all in favor aye corey burgess aye charlene diaz aye anna boyd uh we didn't take action so it died there was no motion uh because it's not due yet so we're gonna we're gonna put in our workshop but later so we can discuss come up with some ideas of what we like to see uh so we just said we instructed to have it on a future agenda uh a future workshop no worries uh where am i 66 yes 610 item 610 governing board policy new exhibit jqec student fees fines and charges mr president and board members um following your discussion last month in approval of the trip for bullhead city middle school to washington d.c we had some discussions about that that should be a recognized club and because there's money involved that needs to come through accounts whether it's tax credit money or donations it still needs to come through accounting and so lance was familiar with some things that had happened in other districts where clubs needed a formal approval by the board we've not done that in the past but given given the nature of this club where there's quite a bit of money going to be raised he did he did the legwork on this and the research and proposed to us this exhibit for clubs going forward we're not going to require currently approved clubs to fill out one of these you know after the fact so we'd like your approval on this particular exhibit as part of policy and we will use it first with the club that mrs moss is proposing for that trip and uh for any future clubs it streamlines the process and it makes it formal in this case that um you know that this wasn't just somebody's dream on a saturday afternoon and and the teacher went forward with it that it is a formally recognized part of our programs by the recognized by the i'll board that motion all in favor aye corey burgess aye charlene diaz aye ayanna boyd so i'm out i just uh great uh then i would like to amend my motion to uh approve the corrected typo [Music] oh i thought it was on this form this isn't the same form yes it is it is this isn't the one you typed up so it's not the same form that you're just you're talking about yes oh she's already fixed it she fixed it she's another high five man she brought her a game today so we're good why would i even doubt you man i'm telling you okay um item 611 revised job descriptions dr stewart mr president and board members last month you approved some new positions some changes in positions that the transportation assistant transportation director would be a half-time position that we would have two secretaries and their duties would be somewhat different so we needed separate job descriptions for those positions and then you also approved the new el intervention positions for diamondback and sunrise so these are the job descriptions for those jobs and um so i would appreciate your approval of the job descriptions any questions on the job descriptions all right then i'll move we approve item 611.

so uh now to move on to the physics that's about the charters now let's move on to the facility assessment process we chose to use the facility inspection tool called the fit this is a facility inspections tool published by the california office of public school construction often known as just opsc to determine if school facility is in good repair as defined by the california education code good repair means that a facility is maintained in a manner that ensures that it is clean safe and functional as a public school the assessment staff and dates of assessment alum rock school district facilities staff are trained in using the fit have used it many many times for several years uh the assessments for this particular study were done from march 23rd uh to april 6th and in terms of usability of this assessment the fit is used in facilities throughout california on an annual basis providing a reliable method of using of assessing school facilities so it gives you a a very good standardized assessment of the condition of these schools so now on to the assessment and uh the uh for the assessment table uh the fit assessment tool has uh several systems that it looks at at a facility including both the buildings and the grounds and so and then there's an assessment for each of those systems and details within those systems so so the first one is called systems uh assesses the gas systems the mechanical hvac the sewer system and then gives you a total rating for the uh for that for the systems and what we're looking at is how many uh the many observations of these oftentimes 40 to 50 going into every classroom every space to make sure that the systems are operating efficiently and so we're looking at what's the percentage of those observations that are that are good or better and so in terms of uh looking at the gas systems in each of these schools 100 were good or better no deficiencies uh hvac there were a few minor deficiencies but a good rating achieved by 85 percent at alpha uh ninety-six percent of kipp at 100 at a school of popular uh sewer systems nearly a hundred percent in each site and so for this area uh the total systems rated 94 to 100 so that according to the state standard is a good rating that's as high as you can get a good rating for for systems at each of the schools um interior surfer interior surfaces didn't show up on this um i don't know how that got left off of this church but i can look at my other one and see what we see for interior services is ratings in for alpha schools uh kip rating 73 percent and escuela ratings of 74 so the interior surfaces need need some work and they they know that they need some work in that area cleanliness hello i'm sorry to interrupt uh mr can ask a question really quick on that sure robert thank you president uh so interior services i'm assuming that that's like the floor inside right whether it's concrete or whatever it may be is that correct first of all yeah yes and and arturo if you were on a view arturo actually did many of the actual on-site inspections for us so he could he could answer more details about uh the various interior surfaces okay because then my second part of that was just um in general what with those 70-ish numbers um is that kind of like cracks or i'm just curious as to what impacts the score on the interior surfaces category yes i'm here can you hear me yes yes all right hello everybody um president quintero members of the board and dr barrow my name is arturo i'm the operations manager for for the school district and to answer your question so the interior surfaces does affect when there's cracks on floor tiles holes in the walls it could also be for example brittle countertops so if there's like an extensive leak on the sink you could see the progress on how the the particle will in getting inflamed and the rotting begins basically so um that's all interior surfaces okay so let's see what else okay so basically anything inside any surface inside from frayed carpet to the insides of windows or ceiling whatever you know it's everything inside and it could be cracks or just all of the other kinds of wear and tear for that particular type of material correct okay thank you okay uh next was cleanliness um overall cleanliness uh at good ratings from 89 percent to 95 percent throughout the schools uh evidence very little evidence of pest infestation uh good ratings of 96 to 100 percent um so total cleanliness 92 to 96 percent which good ratings for each of the sites electrical ratings for the sites i had some issues here um as you see 58 at alpha uh were good so quite a few had had difficulties uh kipps was a hundred percent and escuela had a fair rating of 86 i did uh want to note here for electrical that most of these problems were due to uh the need to replace light bulbs and and we actually did uh i actually did talk to the people at uh alpha public schools about that specifically um in terms of the issues that they were having there uh restrooms uh fountains um again very good ratings here restrooms 90 to 100 percent sinks and fountains uh 83 to 97 uh so overall ratings for restrooms and fountains uh 89 and a half percent to 95 so those were good ratings for uh restrooms and fountains there mr shearer if you don't mind and president keep that i have another question uh-huh okay thank you all good president cubano all right go for it okay um i just wonder if you can go maybe a little bit more uh give us a little more detail about the the light bulbs in terms of like um is there was there i guess like a systemic reason why there was an issue or or you know what was just what did you find and because those ratings were seem to be some of the lowest so i'm wondering why and also the impact of that is it in classrooms is it affecting you know the students abilities to see or be safe and so any other information you could provide would be helpful just for my curiosity on this one yeah arturo can you comment on that yeah um yes most of the electrical is like uh although i'll mention it's the the bulbs that are burnt out in in the classrooms actually and so most of the classrooms have burnt bulbs um it could be either just they're not changing them maybe they don't have the staff that's unknown and but with bar bulbs then become the other problems you could have burnt ballast um and then it just requires more cost to repair another issue for electrical could be exposed wires but that will be an extreme deficiency but we didn't see any of that or frayed plugs i just recall seeing one but um but majority it was light bulbs for electrical okay and were these um i don't know if you can answer this mostly in classrooms or like hallways or offices or just in general all over the place um [Music] so yeah majority in classrooms i would say 90 were in classroom and i'm i'm assuming with those numbers being or at least one of them being fairly low does i'm assuming that that's a significant lighting issue in those particular classrooms that um my only assumption would be that that would have some impact on the ability for students to either learn or potentially be safe i guess is do you have any ability to comment on on that no classroom was heavily effective due to light bulb changing uh the rating is very important because it's an overall of the whole site so it just brings your score down because it's as a whole um so there's not really a classroom where it's pitch black they just have a few light bulbs so it's just an overall and that's why it just brings the score very down because it's pretty much in every classroom that there was burnt bulbs but nothing too significant that i would see where a student wouldn't be able to see or learn but again if it continues it could lead to that because if they're not able to be changing light bulbs now it could get worse okay thank you that's really helpful for me to just kind of get a grasp on that thank you all right uh board member fun you know yeah thank you mr president you know i mean uh in you know i i wanted to clarify first uh you know this this was a item that i had requested of uh administration a couple months ago in order to uh make sure that our you know uh that our property was taken care of to be uh you know best of the tenant's ability you know uh you know these are assets that were that were built by you know previous generations and you know i hope that we we are able to preserve them in order to educate uh the next generation you know uh you know so i i want to thank the uh trustee peterano for asking those questions there uh but uh you know uh i'm you know i am pleasantly surprised that uh the facilities are being uh that the uh tenants of our facilities are taking are being respectful of the people's property and that the maintenance is for the most important order although i will just point out yeah you know i don't quite understand why uh you know there is an issue of replacing light bulbs but again light bulbs are uh clearly the responsibility of the of the charter schools who are acting as tenants and uh you know uh it goes to show the lack of responsibility some charters are doing that they're unable to replace light bulb in a timely manner i certainly know that we you know uh you know earlier this year you know i i you know when i heard about issues of facilities problems i you know work with the administration and with my colleagues on the board to take care of them and it's sort of sad to see that you know what is it uh some of our tenant schools are not able to uh change a light bulb in a timely manner but you know going back um you know just to summarize uh this is this is a good accounting of uh the state of our property uh in the present time and that so far uh i'm glad that uh you know our attendance schools are abiding by the terms of the the terms of the lease that they signed with us when they uh rented these facilities uh all the oh i would just uh caution that uh well if a charter school can't change the light bulb in a timely manner i mean i think we've got some problems there uh educating uh the children of allen rock so on that note thank you mr president all right further comments from the board uh board member travis um i think i went a step further and i i asked if they got changed and corrected and the response was yes all right uh further comments from the board all right um cena then oh uh board remember i just i wanted to say i think my question that i asked about the light bulbs was in the middle of the presentation so i don't know that the presentation is actually done yet so i just wanted to respectfully say that since i um my question was the interruption i think at first you got it all right i assume that uh since all the questions are coming up now people had read the presentation and were comfortable but uh go ahead mr shara go ahead and wrap up sure um finally the final slide here uh or a couple more one is safety uh the next section and and very pleased here that that that all those sites had a hundred percent uh positive observations in terms of fire safety hazardous hazardous materials uh so good ratings for each of each of the sites in that area another an important safety issue is structural um any structural damage issues there were none 100 positive there was some slight um roof issues at alpha um but 98 positive and 100 positive for the others so very good uh safety and structural uh ratings and then finally um external uh playgrounds windows doors gates um good ratings there uh again alpha had some uh issues 79 rating for windows doors and that that really uh was all about doors um not not windows and gates and and we did talk specifically to alpha about that it was um um they were having problems with the door closers not closing all the way and so they were made aware of that that problem that they were having um and so when you look at all categories combined total for all categories alpha fair with 83 percent rating notable issues where the windows lower the doors and the light bulbs as has been discussed uh the other the other two schools uh 95 and 93 rating so the very very good ratings um so i did want to point out finally that uh there were some deficiencies found in each site but there were no um what we call extreme deficiencies and arturo uh mentioned that earlier when he was talking as well no extreme deficiencies extreme there's a and the the definition of extreme deficiencies is down there having to do and that's us the state definition that uh an issue would be so severe that it could cause immediate injury illness or death to occupants and so no no extreme deficiencies at all so that's the end of our report and thank you very much and uh thank you for the good questions as well all right uh board was president palm you have a question or comment uh well first the question you know uh to mr uh is it shira or shira please correct shira okay thank you um you know is there a reason why only why the three sites were uh inspected i mean eventually that is the case you know we would want to inspect every every piece of property that is uh currently leased by the charters yeah um these were large sites of interest um to be looked at first um and to the extent that that the board may want um all of the charters sites looked at i'm sure the administration would certainly work with the board on that okay okay and you know just to comment again as i alluded to earlier you know uh we have a responsibility and make sure that public property is uh you know respected and taken care of and you know just like just like a tenant uh has their apartment manager inspector apartment once every year the district office has to inspect these lease facilities you know every so often too so i thank uh the administration and staff for uh doing this and i hope you know and i guess take this opportunity to request that the remaining facilities leased by charter schools are given in inspection also and then finally uh you know they've said you know i'm glad that uh so far that the property is being maintained and respected though i do uh you know given the issue with the light bulbs i would be concerned about school that can't that can't seem to change a light bulb so on that note i thank you very much uh again thank you mr shira for your efforts you know and uh thank the administration and staff for uh getting this report out to the board and the public thank you all right for the comments from the board seeing none then i'll go ahead and conclude my comments uh appreciative of this uh request from board member of war vest president pump i think it's important to um as uh owners of the facilities to ensure that everything's uh um being uh kept up and that uh i'm glad that we got uh good news that it looks like for the most part you know everything seems to be in working order and there are minor issues that uh uh seem to have already been addressed um in certain instances and so looking forward to seeing the the balance of those uh reviews from the other sites that may still be outstanding all right um if there is no um did i call for comments from the public you remind me yes you need public comment yes all right thank you for the reminder any comments remember the public no public comment at this time mr board president all right um so we've dispensed with that let's go ahead and move on to item 8.01 improved declaration of need for fully qualified educators in 2022-2023 no to approve um can somebody let in since that's the report i think he just wants to come in as a panelist where he has his hand up mr turico you are now a panelist yeah yeah we're still on 11.02 i'm going to go ahead and take public comments uh from anyone wishing to speak on any item that will be heard in closed session then i'll go ahead and call on you board members before we jump into recess and declaration i see no request for public comment at this time mr board president all right uh board vice president palm you had to come yeah and just a request could we recess for a 10-minute break before going into closed session so the reason we'll we'll meet up at 8 40 in closed session board remember not available looks like we have forums we'll go ahead and reconvene open session at 9 17. uh dr bauer do you want to go ahead and proceed by reporting out all the items that you're going to report under a item closed session item 1103 the board approved the settlement of case number two one cv three six seven six three zero unanimously thank you [Music] the board voted unanimously to appoint vanessa [Music] as the new assistant principal of joseph george and jeanette galicia as the new assistant apprentice assistant principal at renaissance at matson all right congratulations to both um moving on to item uh 12.01 uh requests from border caesar the public for future agenda items at this point i'll go ahead and suggest that anybody who has a request for future generators please forward them over to dr bauer uh so they can be considered an endowment um oh uh foreign oh you know what if you put the mic closer i think let's see does that work better yeah yeah a lot better so i i didn't check in with you before but i'm hoping that since he um your friend as well in honor of fernando lopez um yes so well go ahead uh do you want to go ahead and uh make your remarks um you know i know he saved a lot of use from ending up in custody and even underground um i saw you know the way he worked with passion and the way he came and lit up our communities with his music and his presence um and even in my life you know as a friend um and i know that you also hear him so all right um yeah fernando was heavily involved with our youth was part of the safe schools campus program the city had and so it was always great to i usually would run into them right on a regular basis at the uh the gang prevention task force and other events of that sort and i was very very um happy to see him at evergreen valley college in my in my job and see that particularly graduate of the honors and stuff of that sort and so it was cool to see the type of work that we all uh were engaged in on a day-to-day basis and then get to know them in a different light there and uh it's a huge loss for uh our community particularly out here he said we'll stay in all the areas where he worked at uh and making sure that kids were safe and that they were being brought out from that path that uh was leading them to sometimes bad decisions um and uh and getting him on back on the right path and so he definitely uh will be missed and yes uh that's what i was going to say i worked with them since the 90s too and and i as was going to add that i'm sure he would the joy that he brought to us and it brought to himself i think you know i think he would want us to also mention that you know his his extreme talents as a as a mariachi so that will also be a big part of the legacy i think he leaves with that yeah so we'll go ahead and adjourn in his memory and uh gets this point a moment of silence in memory of fernando lopez all right see you at the next tech team meeting for another thank you
