Um in my free time, I'm a junior council member and I've been dancer 14 years and I also work at ice cream and Lehigh Center. >> Thanks

006very much. Okay. >> Um, so on the academic end of things for our high school, uh, we recently had our top 10% ceremony. This was on May 18th. Uh, we recognized high academic achievement within our high school at our top 10% ceremony. And Mrs. Howland started the ceremony by welcoming everyone before introducing the guest speaker. The guest speaker was one of our very own alumni, Dr. Carpowitz, a scientist specializing in advanced wearable technology and artificial intelligence systems. Her speech was impactful and well put together. The rest of the ceremony went smoothly and seniors were specially recognized. Attendees were then treated to refreshments and pictures were taken. Uh then on to AP exams and keystone testing over the course of May. Uh all of our AP exams and keystones were wrapped up. Um all those classes

007uh coming to a conclusion and upcoming events for academics. Uh we have obviously graduation upcoming uh will be on June 9th at our stadium which will open at 5:30 and ceremony begins at 7:00. We're very proud of our seniors and would like to wish them the best. >> I have our 2026 band spring concert. The band concert was a huge success with majority of the auditorium building featuring pieces by Steven Ricky, Robert W. Smith, and more. The performance went great and overall the it was a great reput representation of our students musical department. On May 14th, I have our spring chorus concert which took place alongside a basket raffle that they hosted. The concert itself went expectedly well and the course went on a great performance. Alongside that same day, we also had the art

008show which was our art department would host their art show in the foyer featuring the words of many art students. The art show went very well and displayed the creativity and artistic capabilities of art students. On May 1st, we had prom. Our high school had their prom at Catapulta Grove in Barnesville. The theme of the of the prom was Phantom of the Opera. The venue featured a nice indoors area for eating and dancing as well as an outdoor area where pictures were taken. There was plenty of food and drinks there for attendees to enjoy and it overall was a fun night for everybody. Recent classrooms events. Our physics class launched their rockets that they've been building up at the field by the stadium. All of our all the launches went smoothly and were a great

009display of the scientific capability of our students. >> And then some schoolwide events. We had field day. Last Friday, May 22nd, our school council hosted a organized hosted a field day. The majority of the day was spent at the stadium with games like goggle ball, laser tag, obstacle courses, point ball, and more. FCC was running the concession stand and selling snacks and smoothies. The day went smoothly and everyone seemed to have fun. Then stries against stigma. Um early today Aiden sponsored a fun day to promote awareness against stigma during the last two periods of the day. Students who paid $5 were allowed to participate in the series of events which included coloring, face painting, walking on the track and other activities up at the stadium. Everyone had a great time and it was a large

010success. For the sports, our baseball team entered the colonial league playoffs at the AFC um yet won in the quarter and semifinals which took them to the finals on May 14th against. It was both great game. However, our team would unfortunately lose to Lehigh. That should not take away from their hard work and dedication our team put into the making into the championship in first place. Overall, the baseball team had an amazing season and put on a great performance. Then with the track and field team showed an excellent performance at the district 11 track and field competition. We had state qualifier in class 3A shot hawk. We held a hall parade to celebrate his excellent athletic achievement this last Thursday. >> Thank you guys very much. All right. Uh, next up, um, we have a

011nutrition midyear update. We apologize for the technology. Uh, at this point in time, we're unable to have a nice PowerPoint, but we're not able to share. So, we're just print it out or PowerPoint. >> I have a copy. >> Okay. If anyone has a copy, feel free to. >> So, something new that we did this year at the start of the year was the farm to fork program. Um, we uh reached out to Celtzers Produce, a local farm stand. And in all of our schools, we were able to get um all kinds of apples, bell peppers, broccoli, and cucumbers. students are excited to see because we we're showcasing Seltzer's produce. Um we were able to use their crops from September through early November and we're going to try and do that again next year. We

012had Molly the cow, who is our nutrition group mascot, come to visit in March for National Nutrition Month. Um she was around the breakfast time and then she was at prek's morning and afternoon sessions. She gave out coloring sheets um string cheese and we tried we talked to the students about the importance of milk and how it helps um make your body stronger and your bones stronger. The kids of course loved her. Also in March we celebrated National School Breakfast Week. This year's theme was the quest for school breakfast. So, one of the things we did do with the students was give out crowns. So, um on the PowerPoint was all the kids sitting there with their crowns having a good good breakfast. So, use your imagination. We um are constantly trying to come up

013with new recipes. Uh the chefs are always coming up with ideas and then they're kid tested at certain schools. Uh some of the things we offered here this year were um cheese tortoilline with an Alfredo sauce. We did a mandarin orange chicken bowl that really was successful at the high school and middle school. We did um a noodle bowl and also oven roasted chicken legs. We did an everyday nutrition program with actually the prek parents and the students where we made little owl rice cakes and we talked about it was a rice cake. It was wild butter instead of peanut butter because we're nut-free. Um it had blueberries for the face. It had um Cheerios and it had apples. So, we talked to them about um the vitamins and all those things and the nutrients

014and then they all made their own little alves. That was a big hit as well. One of our bigger vendor partnerships is with General Mills. Um that's who we got our Cinnamon Toast Crunch through our cocoa pups. Um, we chose them because they are they comply with the biamerican requirements. Um, general meals both processed um domestically and they're committed to um 51% domestic American products. By summer, General Mills under um the K to2 program is supposed to be certified without color or caral coloring. Okay, talking a little bit about average daily participation through the years. So, if you can see the graph, um we're looking at last year's average daily participation compared to this year's budgeted participation and what we're currently running as a district. So, you may or may not be able to see

015um that we are over budget in participation across the board in all categories which are breakfast, lunch, and all of which is great. So, we're hitting budget across the board. Looking at um you know, comparing to last year and what we're budgeted for to hit this year, this is just a testament that the students are enjoying the program in, you know, across the board over here at Lehigh. Um they're enjoying the menu items that we have on, you know, Nicole does a great job of menuing different things throughout six week cycle. Um you know, participating in the Olive Heart program and purchasing snacks and beverages through us. So, it's just a true testament that the students are enjoying the program here. Next, looking at year-to- date revenue. So, this is looking at reimbursements and cash

016sales. So, you can see that for cash, we're a little bit under our budgeted um cash for what we should be making. This is as of April of this school year. Um this is due to the fact that we were not able to run shine for some of this for majority of the school year. I think we started up probably midFebruary. So, we did start this school year um but unfortunately the program was put on pause due to um a pause on the funding for it. So, we weren't able to run that. However, you can see that we're almost $67,000 over in reimbursements, which again just goes to show that students are participating in the program, which you can see with that breakfast participation. So higher reimbursements um coming in and we are seeing a

017dip in that cash but hopefully next year we can run the shine program from the start and do that through the whole year. So looking at next school year's budget um this was all based on revenue was all based on what we're currently running in terms of sales and participation. You can see that revenue dollar value right there. Um, and then expenses. This is what we are currently running with a 5% increase on food, labor, and cleaning costs. Um, just the normal 2.7 CPI on all other costs as well as a labor wage increase that is normal year-to-year. Um, we didn't increase any hours, but we did increase wages. Um, so we're looking at bringing in a profit for next school year of 23,000. Um, of course, our goal year to year is always food

018quality, driving participation, and making sure that the students are enjoying what we're selling. So, um, PA is still going to be free breakfast across the board. Still C. So, free lunch and free breakfast for all. So, um, the next slide would be our contact information. So, we're happy to answer any questions now or take any comments or our contact information is listed. So, you can feel free to reach out to us. What is I apologize and you may have said it but what is the Shine program? >> Shine is um it runs Monday through Thursday at the elementary school. Um it's for students who um may need help extra help with um homework and getting their work done and then we also provide dinner for them. >> Okay. >> So the funding for that program

019was put on pause, >> right? It normally would start up right after Labor Day and this year we started in February and it is going I just did their menu. It's it's we're done school June 12th that's done June 11th. So it's going right to the end. >> Now will it start up again in September or was it another when >> it should we're hoping it will be >> all depends on the state budget. >> Well that's why that's what I was kind of picturing that's what it depended on but just wanted to make sure. >> Yeah, >> it's a great program. I I I just want to say, you know, fantastic job in in all all of our buildings. Uh you know, never hear ever hear any any worries or complaints. So, you know,

020it's such a critical part of a student's day. >> Uh guaranteeing them a good meal. And so, I I deeply appreciate the work that you all do with with all of your staff. >> Thank you. >> The menu sounds fantastic. >> Come visit us. >> Absolutely. >> All right. Thank you. Thank you guys very much. >> All right. Uh, next up is public comment. This public comment is only on the board's proposed approval of the agenda as presented or modified. Is there any public comment uh regarding the agenda? >> No. >> All right. Next up is approval of the agenda. Do I hear a motion to approve the agenda as presented or in the alternative? >> So move. >> Second. >> Questions, comments? All in favor? >> Opposed? The eyes have it. Uh, next up

021is our traditional public comment period. Do we have any public comment? >> We do. >> Thank you very much. >> On agenda items. Um, first up we have Abby Gardiani. Thank you. Good evening, members of the board, administration, faculty, staff, and members of the community. You may or may not recognize the folks surrounding you. I know some of you do. Uh if you do not, those that stand before you tonight are retirees of the Lehigh Area School District who proudly and faithfully served this district and its children for generations. Go stand. >> I am here to speak on behalf of some of the retirees. Some of us knowing knowing we've been breached by Mr. David Bradley and his website. Others having no idea at this point because the school district can't even begin to figure

022out the scope of this breach. So retirees stand here before you not even knowing if they should protect themselves. The Lehigh Area School District protected and maintained my personal identifying information in its files for more than 42 years. Thank you for that. On May 13th, I saw with my own eyes my name and social security number publicly posted on the website created by Mr. Bradley along with the confidential information of 19 other current and former employees on one page. One page. What was taken from the victims of this breach can never truly be restored. The exposure of personal and confidential information has caused permanent and irreparable harm, the full scope of which may not even be known yet. But tonight, I choose to speak not only about what was taken from us, but about what

023Mr. Bradley's actions will never be able to take from me. Mr. Bradley, you will never take from me the pride I feel in having served this district, its children, and its families to the best of my abilities for 35 years. You will never take from me the love and respect I have for this district, for the dedicated faculty and staff who work tirelessly every day, and for the good people of this community. You will never weaken this community's resolve to recover from the chaos and division your actions have repeatedly brought upon this district over the years. You will never weaken the resolve of the victims of this breach to see accountability pursued fully and lawfully for the recklessness and illegal exposure of confidential information. And you will never erase in the minds of those in

024this district and community the negative connotations forever associated with your name and actions. After spending decades working in this district, I know this as well. You will never break the commitment of this district's faculty, staff, and administration to continue providing the quality education that the heightened students deserve. Although, goodness knows you sure as hell have tried. Your actions were not accidental. They were a choice, a reckless and profoundly poor choice. I recognize the enormous task now facing this board and district, not only in determining the full scope of this unimaginable breach, but also in addressing in addressing the harm done and attempting to chart a path forward. Mr. Bradley was not elected to this board. He was not elected to this board by the people of this community. and in my opinion, he never should

025have been appointed to it. Tonight, I hope this board's actions will represent the very first meaningful step forward in correcting this wrong, restoring trust, and standing firm with the victims whose personal information has been exposed. Thank you VERY MUCH. THANK YOU VERY much for those comments. >> Next up, we have Autumn Blosski. >> I'm not sure how I'm supposed to follow that. Um just I said just because I won't make sense. Sorry to everybody. Um so I am in no way, shape or form going to downplay Mr. Bradley's uh participation in what has happened. Um I know that is the main focus of everybody. However, I do have one question and I don't know if you'll be able to answer or not. Um, but why did the school district not appeal the OOR's determinate or

026recommendation for the release of the confidential materials? Was that not the school district's responsibility? >> I honestly cannot answer you other than knowing that they did not do so within the proper time frame. >> Okay. So, this goes back to what I have said at multiple meetings. You do not have representation here in this room. I understand they're on the phone or on Zoom or whatever, but I've I've been here in person and I've watched the videos online. I've watched your solicitor sitting in their Tesla driving, going through dead zones. I've watched solicitors in their living rooms saying, "Can you repeat that because I missed what you had to talk what you're talking about?" In my opinion, not having a solicitor in this room, especially especially with what you are going through right now and

027what they have put you through, you really need to re think I I could come up with a better word, but I can't right now. I really think you really need to reconsider your solicitor and your representation. And I have asked this for years. about three years ago, you find not you, but the previous board had actually um agreed to do an RFP for a new solicitor and by the next meeting that was kind of tossed aside and just I was told that something else was decided behind closed doors. So again, Mr. Bradley absolutely did something wrong, but I think the school district did something wrong first. So, and I think that falls on your solicitor. Thank you. >> All right. Next up, we have Walters Lovage. Thank you, board, for getting 2.1 and 2.3

028um draed up relatively quickly. Um I'm glad you're taking this very seriously. Um, I hope that all avenues are pursued against Dave Brandon who couldn't show his face tonight and I'm certain that he has a good excuse. Um, I also hope the board's looking at protecting our past employees and students um in any way possible um due to the breach of a citizen in reality. And then I hope after you get through 21 and 23, this comes back to become his financial issue of protecting those people. But I think he's going to make that first gesture of trying to cover the people and then whatever that expenses to recoup later on. Um I I also for many meetings and agree with him that he should have order in the room. Um there was an RFP

029and then somebody decided against following through with the RFP. So I think you should seriously take a look at uh doing another RFP to try to have a lawyer in the room. If the firm you're currently using you believe and trust in it and could go to for decisions, that's great. But I think you actually need somebody sitting here, you know, to see what's actually happening there. Thank you. Shame on you. Shame on you for not showing your face. All right. Thank you. All right. Uh, next up, >> hey, Alex. Hey, Alex. >> Yes. >> Can I have the floor for a second? >> Um, 30 seconds. >> Wow. Generous. All right. Are are we uh as a district, are we contacting the people that had their social security uh number sent to me as

030part of the record public record release that I filed in 2022? We are working through the process. Uh we requested the ability to compare the documents that were actually uploaded to what we have. Uh obviously that request was not fulfilled. We are doing our best to work backwards working with both legal counsel and our insurance carrier uh and putting together databases of uh individuals who may have had records between the time frames of the documents that were that were out there. And then the other question I got to ask is did did we know that these records that were released to the public uh under my 2022 right to know request >> had unredacted stuff in them? >> We did not >> to the best of our knowledge when we when we supplied the materials

031to you to the best of our knowledge they were redacted. Obviously as I said in the last meeting there were things that were missed. there were documents that were not fully redacted properly. Um, but given the amount then, you know, we we kind of have to work through which ones exactly were not. >> Well, originally in in the twice in the minutes it was mentioned that the district was going to publish these as well. Once back in 2025 and then once just in April's meeting. Were you guys planning to publish them without double-checking them? >> No, we would have done so in a very thorough and vetted slow release making sure that there were no mistakes made. >> But the ones you gave to me, >> there may have been mistakes that you we didn't

032know about the agenda. >> Thank you. >> Did I know about them? >> Did you give me any indication that they weren't >> fully rejected? The question I'm asking is prior to releasing the public records as part of the right to know request, did the district know >> they had social security numbers exposed and their responsibility under the law to make sure that they were not >> can hear you Dave. We moved on to the superintendent report. >> Yeah. But the question was, prior to releasing the public records as part of the right to know request, did the district know their responsibility under the law to redact them and did they give me any warning that that was not done? >> All right. Thank you, Dave. Uh, superintendent, >> I want an answer to the

033question. I think it's fair. I mean, >> you've exceeded your time. >> Say that again. I did what? I asked a question of the district. It's a very pertinent question. If we know, if we can easily find and know exactly who was >> move on, please just move on. Please move on. >> Why wouldn't you do that and notify these people is the question. >> Dave, we're not not wanting to answer your questions. He's asked, Alex is asking if you could please wait till we get to 2.0 area of the agenda to address your questions. Could you the hanging? Okay, sounds great. Thank you. I'll wait. >> Thank you. >> Sorry. >> There's always when you're online, there's always a delay. >> That's why I hate attending meetings online because sometimes you don't hear one

034person. >> So, I'm not saying that's the full excuse, but that's part of it. >> I'm sorry, Jason. >> That's okay. In an attempt for brevity, I will provide here uh monthly safe to say report. You see a total of I believe it was 14 safe to say that were filed. Uh for the most part you see isolated instances for most of the most of the areas. You do see bullying, cyber bullying at three and cutting and self harm at three again for the duration of the month. Uh you know again we we see these are these are relatively low numbers from my understanding districts which is a good thing. Um it doesn't mean that these were all founded. It just means these were the tips that we actually received in an administrator's work through.

035So uh in an ongoing effort to provide you with that information. I also want to spend a minute because it's it's pretty critical when talking about budget uh and you know the question has come up about uh BHA enrollment and what we have what we have done internally to be able to provide services uh for students in our district and I thought that this was pretty important information to put out there and show you uh that these efforts have been have have been ongoing. Uh it includes uh the opening of an of uh our own emotional support classroom at the elementary center at the beginning of this year which we uh had been previously run by DHA. It then includes the opening of a second emotional support classroom at the elementary center. It also then

036includes returning students who have met their program goals uh and who whose whose disposition certainly lends us to believe that they will be successful with the proper supports. And then looking into the future, we are looking at the creation of an autistic support classroom at the at the elementary center as well, which will also have an effect. You see at the end of last school year 2425, so about a calendar year ago, we had 57 students enrolled at BHA. At the beginning of this year, that number came down to 50, mostly attributed to that opening of the emotional support classroom at the elementary center. At the end of 2526, so as of right, you know, as of right now, enrolled are 33 students. Those are the efforts of making sure that we have supports in

037place, doing what we can to add staffing where we need to. Of course, we still have one open position that that we are going to look to fill again in the coming months at the high school. Uh you see that it's down to 33 students enrolled at VHA. And with graduations and students who are scheduled to return to our buildings, you see at the beginning of the 26 27 school year as of right now. Of course, that can change very very quickly. Um, when you start talking about specific numbers, I just want that to be clear. You can see at the beginning of next school year, we are scheduled to have 27 students enrolled at BHA. So, um, tremendous amount of efforts. Uh obviously the staffing that we have added at the elementary center has

038been successful. We are looking at uh the addition of a position which had been previously posted at the high school. Uh we were unable to fill that at the time. It is a those are some challenging positions at times. Special education positions in particular are challenging to get uh the right person. And then we're we'll be looking for an autistic support as well as uh support staff to help support those teachers and students and families as we move into the beginning of next school year. Appreciate the efforts of uh the faculty and staff and welcoming those students back into our buildings. Uh you know, we could not we could not be doing this without without those efforts. Looking ahead again, I thought I would try to stick to brevity here. Uh some big things going

039on obviously of high school graduation on June 9th stadium. Uh in June we'll also be looking at a final budget. I know that a final a proposed final budget is on the agenda for this evening. Please note that that can change that can take some very drastic steps in a lot of different directions between now and the time we we approve a final budget and we are working on that with each piece of information that we get so that we get to a final budget. Um but that that that's a big that's obviously a very important thing in June. Uh and then academically again the the reason we are all supposed to be here um we will be reporting in June on our end of the year norm referenced and criterion referenced academic assessment from

040the 2526 school year in totality to show you how close our students were able to move toward uh grade level benchmarks and how quickly we were able to close existing gaps. So they might not hit the grade level benchmark, but our hope is that what we will see is in totality we have moved them closer to getting there uh throughout this current academic year. Again, a big change in the practice of the district in terms of how we're how we're assessing, what we're assessing, and how we utilize that information. It's it's a challenge. And for the first full year of this initiative, uh I I am incredibly pleased with the initial results. And I want to thank our administrators at the building levels, our teachers at every building because uh when you are faced with

041really paying attention to new data, that can be overwhelming at times. I understand that. I promise you all it gets easier and it gets easier than as long as it is consistent. That is the key and we're not doing something different the following year. you get consistency, you get measurements, and you get plans of action. And we will all get better at that as we move forward. Uh, and I I want to I I just want to thank them as we're coming to a close of the school year. That's a lot of work. It's a lot of effort. It's a lot of it's a lot of learning something new. Um, because you don't really ever get fully properly trained on the different types of assessments, quite frankly, when you're becoming a teacher. uh you don't

042even as you're going in through your administration, it takes some some outside research and understanding and training to really get adept at using the information for the right reasons. Finding the right information, gathering the right information and then acting in the according ways at the information you have in hand and that takes time. We will get better. We will we will continuously grow as we help our students do the same. >> Does anybody have any questions on the report? We're looking forward to hear that data for our next month. Okay. Thanks, Jason. All right. Next up, we have our business administrator uh reporting with Matt's on the call. >> I may believe it correctly. I don't see one. >> I don't know if he's having connection issues if he happens to pop on. >> As

043long as he's on a good budget discussion, >> right? True. >> All right. Well, we could we could circle back to Matt uh if he has a report to share with us if he has the opportunity to join us. Um next up, we would have LRYC. Dave Krauss actually reached out. There is no LRYC report this month. Uh so I will go right to Jeremy with the CLU. >> Uh I did not attend this month's meeting. home, my daughter had her final elementary school chorus concert. So, that was a little more important to me and I apologize to those at the CLIU for saying that. But, um, basically the board summary report has uh, you know, May was mental health awareness month. The annual golf tournament is June 16th. I'm not sure if you can

044still sign up, but if you can check it out, if you like golf, go for it. It's a great cause and it really helps the IU pay for some good programs. Uh there was the aspiring leadership our leaders program. Looks like they just gave us a presentation regarding that. So I mean it was a they were doing great things at the eye industry. Uh, so do I hear a motion to approve the minutes of the April 27th board meeting, the May 11th special board meeting, the May 11th workshop meeting, and the May 14th special board meeting? >> Second. >> Questions or comments? Hearing none. All in favor? >> Opposed? >> Hold on. We have to

049wait for Dave. >> The eyes have it. All right. Uh next up we have board governance. Uh and uh the first item on here uh is the district's resolution. Uh and so do I motion to approve the resolution condemning the unauthorized public dissemination of confidential employee and student information calling for the immediate resignation of school director David Bradley demanding remediation reimbursement and an apology. authorizing legal and administrative action, restricting access to confidential and litigation related matters, and adopting a school board member confidentiality and litigation related restrictions policy. >> I'll second that. >> Um before I move on to questions and comments, uh I would like to uh read the resolution into public record. Uh and so uh the resolution states, "Whereas the Heighten Area School District is a public school district organized and existing under

050the laws of the Commonwealth of Pennsylvania and is charged with educating students, protecting student and employee information, complying with federal and state law, and maintaining the trust of the students, families, employees, taxpayers, and community it serves. Whereas members of the board of school directors occupy positions of public trust and are expected to exercise their authority, access to information, and official status solely in furtherance of the lawful governance and educational mission of the district. Whereas the district understands that on or about May 13, 2026, financial records and other district related records were posted on an independently operated website not affiliated with, controlled by, endorsed by, or operated by the district. Whereas the posted materials appeared to include confidential personal information of current and former district employees, including names and social security numbers, and information that may

051constitute confidential student information protected by federal and state law. Whereas the district did not authorize, approve, direct, endorse, or consent to the public posting of the confidential personal information and confidential student information at issue. Whereas the records at issue were produced by the district in connection with proceedings under Pennsylvania's right to know law and pursuant to a decision requiring production to Mr. David Bradley by the Pennsylvania Office of Open Records. Whereas the district's production of records to Mr. Bradley pursuant to legal process did not authorize Mr. Bradley to disseminate confidential employee information, social security numbers, confidential student information or other protected information to the general public. Whereas Mr. Bradley is a current appointed member of Lehigh Area School Board of School Lehigh Area School District Board of School Directors and by virtue of that office

052is obligated to act consistently with the district's legal obligations, the confidentiality interests of students and employees, the integrity of board governance and the public trust placed in school directors. Whereas based on the information presently available to the board, Mr. Bradley posted, caused to be posted, permitted to be posted, and or failed to remove unredacted district records containing confidential employee and student information on an unaffiliated website accessible to the public. Whereas, based on the information presently available to the board, the public posting of such unredacted records exposed private and sensitive information of current and former district employees and students, created risks of identity theft and other harm, required the district and its administration to divert time and resources away from the education of students, required legal review and response, required notice and mitigation efforts, and caused

053or may cause the district to incur legal fees, administrative costs, insurance deductibles, remediation costs, settlement or claims related costs, and other damages. Whereas the district has formally requested that Mr. Brownley immediately remove all such materials from his website and any other platform on which they may have been published and take all necessary steps to prevent further unauthorized disclosure of protected information. Whereas based upon the information presently available to the board, Mr. Bradley has not adequately cooperated on a timely basis with the district's efforts to remove that confidential information. While there has been some effort to mitigate the harm and protect affected individuals, is unfortunately too little and too late. Whereas the board finds that the public dissemination of confidential employee and student information is contrary to the duties of the school director, contrary to the

054district's obligation to protect students and employees, contrary to sound board governance, and fundamentally inconsistent with the standards of trust, judgment, and fidelity expected of a public official of the Commonwealth of Pennsylvania. Whereas the board finds further that based on the information presently available, Mr. Mr. Bradley's conduct constitutes willful misconduct, a derelction of his duties as a member of the board of school of board of school directors, and conduct warranting his immediate resignation and removal through any lawful process available under Pennsylvania law. Whereas, the board recognizes that a school board does not possess unilateral authority simply by resolution to remove one of its members from office and that the removal of a school director must proceed through the lawful mechanisms authorized by Pennsylvania law. Whereas the Pennsylvania public school code provides a judicial mechanism by which

055school directors may be removed by the court of common please upon proper verified petition by resident taxpayers where the statutory grounds for removal are established. Whereas the board further recognizes that the public school code removal mechanism is limited to duties made mandatory by the public school code and that any request for removal must be pursued through the court and in a manner consistent with applicable statutory requirements, due process and the rights of the affected official. Whereas the board desires to take all lawful action within its authority to protect affected employees and students, preserve district privileges and confidential information, prevent further dissemination of private information, recover losses sustained by the district, and requests that appropriate public officials and resident taxpayers pursue any available removal remedy. Whereas the Pennsylvania Sunshine Act permits executive sessions for specific purposes,

056including consultation with council regarding litigation or identifiable complaints or charges, personnel matters, student matters, and other legal or recognized confidential subjects. Whereas the board has a legitimate and compelling interest in preserving attorney client privilege, attorney work product protection, litigation strategy, confidential student information, confidential employee information, and the integrity of district decision-making concerning the legal issues arising from the unauthorized dissemination of confidential information. Whereas a board member whose own conduct is the subject of legal advice, claims, investigation, threaten litigation, litigation, administrative proceedings, insurance claims, remediation efforts, settlement discussions, or other confidential legal strategy presents an actual or potential conflict of interest with respect to those matters. And whereas the board therefore finds it necessary and appropriate to restrict Mr. Bradley from attending or participating in any executive session or portion of an executive session where the

057board consults with the district solicitor, special counsel, appointed legal counsel, insurance representatives, administrators or other adviserss regarding the legal, remedial, financial personnel, student privacy, insurance litigation, investigative or claims related issues flowing from the unauthorized public posting of confidential employee and student information. Now, therefore, be it resolved that the board of school directors of Lehi Heighten Area School District formally and unequivocally condemns the unauthorized public dissemination of confidential employee information, social security numbers, confidential student information, and other protected district information and condemns Mr. David Bradley for the actions described in this resolution. Be it further resolved that the board finds based on the information presently available that Mr. Bradley's conduct was designed or undertaken in a ma in a matter that foreseeably harmed the employees and students of the district placed their private information at risk

058undermined the district's educational mission and constituted willful misconduct and a dereliction of his duties as school director. Be it further resolved that the board calls upon and formally requests that Mr. David Bradley resign from the Lehigh Area School District board of school directors immediately. Be it further resolved that the board declares that Mr. about these conduct as described in this resolution warrants removal from office through any lawful process available under Pennsylvania law. Be it further resolved that the board directs the board president, superintendent, district solicitor, and any special counsel appointed by the district to evaluate and pursue all lawful options available to the district to address Mr. Bradley's conduct, including referral to appropriate law enforcement, regulatory ethics, privacy, insurance, and governmental authorities, requests for injunctive relief, preservation, and recovery of evidence, claims for damage or

059reimbursement, and any other appropriate civil, administrative, or equitable remedy. Be it further result that to the extent the Carbon County District Attorney or any other public official declines, fails, or is unable to pursue removal or other action, the board requests that qualified resident taxpayers of the district consider pursu pursuing any available statutory removal proceeding under the Pennsylvania public school code. And the board authorizes the board president, superintendent, district solicitor, and special counsel to cooperate with, provide non-privilege information to, and otherwise support such lawful efforts to the fullest extent permitted by law. Be it further resolved that nothing in this resolution shall be construed as the board preparing to remove Mr. Bradley from office by unilateral board action where Pennsylvania law requires judicial action or another lawful process for removal. Be it further resolved that the

060board demands that Mr. Bradley demands that Mr. Bradley immediately remove cost to be removed and permanently cease publishing, posting, distributing, forwarding, storing for public access access or otherwise disseminating all district records containing confidential employee information. social security numbers, confidential student information, privileged information, or other protected information. Be it further resolved that the board demands that Mr. Bradley identify all persons, websites, platforms, entities, accounts, servers, repositories, or other locations to which he posted, uploaded, transmitted, provided, or otherwise made available any such district records or information, and cooperate and cooperate fully with the district's efforts to secure removal, mitigation, and remediation. Be it further result that the board demands that Mr. Bradley reimbured the district for all monetary losses, costs, expense fees, liabilities, and damages sustained or incurred by the district as a result of his conduct,

061including without limitation, legal fees, technology and investigation costs, notification costs, credit monitoring or identity protection costs, insurance deductibles, cost upon cost imposed upon or agreed to be paid by the district to affected individuals, settlement amounts, claims expenses, administrative costs, and any other direct or consequential losses arising from or related to the unauthorized release of private information. Be it further resolved that the board calls upon Mr. Bradley to issue a full and public apology to the current and former employees and students whose private information was exposed or placed at risk to the families affected by the exposure of student information. 062and to the community that is entitled to expect integrity, discretion, and fidelity from appointed public officials. Be it further resolved that effective immediately, Mr. Bradley shall be barred from attending, participating in, receiving materials for, or otherwise accessing any executive session or portion of an executive session where consultation with the district solicitors, special counsel, appointed legal counsel, insurance council, or other legal or claims adviserss will take place concerning the legal, factual, investigative, remedial, financial, personnel, student, privacy, insurance, litigation, claims, or settlement issues arising from or relating to the incidents described in this resolution. Be it further resolved that the board president in consultation with the superintendent, superintendent and district solicitor or special counsel is authorized to identify the portions of executive sessions from which Mr. Bradley must be excluded and to implement procedures to ensure that

063Mr. Bradley does not receive privileged, confidential or litigation related materials concerning those matters. Be it further resolved that the restrictions imposed by this resolution are intended to preserve attorney client privilege, attorney work product, confidential student and employee information, litigation strategy, insurance and claims related confidentiality, and the integrity of the district's legal position and shall remain in effect unless and until modified by subsequent board action, court order, or advice of council that the restrictions are no longer necessary or legally appropriate. Be it further resolved that this resolution shall take effect immediately upon adoption. questions or comments. >> So, we're voting for something

065that hasn't even been investigated fully yet. I mean, as per most of the things that are in this, it says based on the information we have at the moment. Correct. Right. I mean, there's no investigation. Is there an open investigation anywhere? >> Can we answer this? >> I've been asking all week and nobody seems to want to answer that. >> These are the facts that we have. We're not the facts. They're not the facts. What kind of investigation? >> I'd like to add a couple >> investigation into how we got to this point. How that the social security numbers left the district office to be included in what David Bradley was given. >> So >> given that everybody was concerned, Lori, I'm just give me a second please. Okay. being that everybody was concerned about

066releasing confidential information. That is the reason that while I was president, we did not release stuff to Dave Bradley back then because we were told he wants everything. So for a long time, we kept saying he shouldn't get everything and then the district goes and releases not everything but some really important stuff. And nobody is sitting I mean Autumn gets it. The district seems to have a little bit of liability in this and I want to know is there an open and active investigation. Not that I mean I do feel bad but I may be in that breach as well. My children are students in the school district. So I'm not absolving Dave Bradley from anything in in regards to that. And I do feel bad for everybody. I've been involved in in breaches before.

067I know how it disrupts your life. But what I'm trying to say is we are basically frying a man before he's investigated. >> So part of you trying are looking >> is there an investigation as to how this information was given to him without being redacted? Why was were some things redacted? From what I understand, some names were redacted but some numbers weren't. And in other places, some numbers were redacted and names were not. So, how did this happen? >> So, you're looking for the person who didn't redact. >> No, I don't want I don't want anybody to get in trouble. I want to know how I want to know how we got here. Is there anything >> based on this? Everybody is saying he did this intentionally. >> Well, he posted it, >> but

068they're saying he tried to he's trying to I mean, read it, Lori. It says he's trying to harm the teachers and the retirees. No, I don't believe that. And I I can't vote for This is like the Patriot Act. Yeah, there's some great things in here. Trust me, I read it. I read it all. I reread it while you were going through it. There's some great things in here. The Patriot Act. Great things in there, but there were also a lot of really bad things in there. And you're telling us to condemn a man? I am not God. I cannot condemn a man. I can condemn the actions of a man, but I cannot condemn a man. And that is what you're asking us to do here without an investigation. There should be a full

069investigation. And I mean, did did anybody did Attorney Greek Attorney General Creek, did he get back to us? Do we know if there's actually any criminal investigation by the attorney general? We have had communications but that's collaboration to provide information upon request. >> Okay. >> None of the board I mean have you guys received information on this on what's going on how it's proceeding? >> I know my name was breached. I understand that. And again, Tim, I don't disagree. >> Person that also put in his first, >> you guys hate each other. >> In our first term, this person also put our checking account posted on the internet. Wasn't even >> Yeah. So, we had to get all new checks because we reaction. >> No, it wasn't. We had fraud coming in. >> Every time

070he does something, there's an intent. >> And again, I am not saying I'm not talking about that. Has it been investigated? Why are we rushing to this? Is this to make everybody feel good in the audience or post? >> Did he post it? >> He He did post this action that he >> That's not what it says here. >> I'm not arguing with you. >> So, can can I >> can I step in and answer a lot of these questions for you, please? >> Dave, go ahead. >> Dave, >> I have a lot of answers for you people if you'd like. the floor. >> So here's So I think we have to investigate both sides. I'm not pointing fingers at anybody, but what I'm going to say is something happened. Whether something was missed by

071the reduction team, an error happened, things happened. It was a lot of papers, under 9,000 great papers, >> but amazing that some of the most sensitive items were missed and now we're saying, "Oh, it's Furpa. It's not furbo. It is what you know we're going there. But you know what? If you guys wanted to redact such things, why were some redacted and why were some not? Go ahead, Denise. I'm sorry. >> It's okay. No, it's okay. My only thought is in order to prevent something from happening in the future, whether it be releasing documents to another citizen, we're releasing documents to a law firm, whatever. We need to look at the root cause. It's a teaching moment. It's no pointing fingers. It's a teaching moment. Something happened. He got the documents. He released them and

072that's on him. We, you know, I don't disagree with that. That's on him. But it's a teaching moment to see how it happened. So I think that part of a looking at it but that may not even be possible if I'm understanding correctly really to do an investigation from what I'm understanding whether it be on school side or anything as to how what documents he got we need to have them we do not am I correct in saying that >> that's correctly unfortunately right so to my understanding in inst investigation into that at this point is our hands are tied until we get what we need. So, I don't think anybody's trying to not do an investigation. I think unfortunately we don't have the information available to do an investigation. >> But the problem I

073have is they're having us vote on something that has a lot of whatifs and whereas and and you know, they're not the information that we currently have. We're voting on stuff that is not not factual. This is assumptions. You're telling us that he did this on purpose. I understand his past actions have shown that he does certain things on purpose, Dave, and you know that, but the fact of the matter is that's what you're having us vote on. And that's just that's just kind of crazy. >> I think ignorance to the confidential information doesn't change the fact that mishandling it is inappropriate. And I think the two things are not mutually exclusive. When you have 120,000 pages of information to redact, things might slip through the cracks. But if that happens, if that doesn't absolve

074somebody for >> malfeasants, >> I don't think this was malfeasants. Did the district in any way I know you you dislike him as well. I get it. And you know what? >> I've given David a chance. I have no clue with Dave. Did the district or the or the attorneys warn Dave that there's a possibility of sensitive information within the files >> that I mean that there might be some sensitive unredact >> are we forgetting that he was supposed to receive all these documents unredacted >> I know and then and then when >> my second question is to you how do you know what was redacted and what was miss being redacted do you have access to these files >> no I don't have access to these files and I can I will swear on

075the Bible for that. I don't have any access to these files. I've had some conversations. That's how >> okay >> because I want to get to the bottom of it. >> I want to get the people taken care of that are in the breach. >> That should be our main focus here. But right now, we're focusing on basically lynching somebody. Okay. And that's ridiculous. >> And once we move on from this, we will be able to focus on the most >> Hold on. There there's a little bit more. So that's how I knew better. >> Alex the conversation. I'm just curious why Dave isn't sharing it with the rest of the board. >> Oh, he he >> I can't tell you that. Did you reach out to >> He said he'd sit and laugh on

076the screen in person at the meeting last I would rather not cuz I do not love the gentleman to have my phone number. >> Okay. >> I didn't forget the point that I was going to make, but if I do remember it, I will bring it up. I mean, the fact of the matter is we got to focus on getting everybody taken care >> and that's where we're going next. >> We are. Well, but why is the first step condemning a man? >> Because he broke the trust >> right here with a blown up photograph of an employee and a student. That's Dave. That's the way Dave operates. He took the time. He received a message. >> You posted it on your goddamn Facebook. He put He put a picture. >> Can Can I add

077the floor in relationship to this original problem here, guys? I mean my understanding what you what you what is in here is >> it is not set in stone. This is this is at this point what we're doing. If a if if 6 months down the road we find out that you know there's a change and there's no fault or however you want to put it. this this this condemnation can be his his inability to be in executive sessions involving this matter etc can be absolved am I correct >> and so it can change any time towards the end point we are basing this statement based on the information we have at the moment and the information we have 10 minutes from now may change the way we're looking at it I'm not saying it's

078going but it could investigating it to get that more information. >> I believe if I'm incorrect, Alex, >> stay tuned for the next item. >> My understanding is that's why we're looking at doing an ad hoc committee is to have PE have this looked at more further and to have a group of people that can kind of answer everyone's questions. I mean, I'm sure everyone out there has questions. I know I do. You don't think we should have an independent investigator that we approved a couple months ago >> to possibly look into it so that there is independ we can make that suggestion at that point. >> That's the suggestion I'm making because you know what the administration's going to want to protect the administration. Dave's going to want to protect himself and in an

079independent investigator is going to make sure that both sides are heard and make sure that everything was done properly. At that point, at that point when he has been investigated properly, maybe I would consider voting for this. But then again, there's some things in here that really need to be removed. As I said, Patriot Act, good stuff, bad stuff. There's some good stuff, but there's a lot of bad stuff. >> My opinion, >> I think I will take that into account certainly. That is part of the purpose of the next item is to help decide what are the next steps moving forward. >> I think Dave wants to say something to >> Can I have the floor, please? >> Dave, >> can somebody turn it off so people can hear? >> Yeah. And can I

080please have more than 30 seconds? >> You can five five minutes. Is that reasonable? >> Go ahead. >> Thank you. Okay. In the first part, I agree with a lot of the first part of this whereas statement. However, I did not knowingly release any such information. I had no indication that the district was not going to go through these documents with a fine tooth comb. And in in my humble opinion, they did a fantastic job. You're talking about 120,000. And the list that I created and gave to the district shows about 20 pages were kind of sprinkled in there that that had no redaction. There would be a redaction on page 235. failed to redact. 237 was redacted on books. All I asked for was the financial books of the district. Some of these things

081I don't even know if they exist within the five in in the section of the code that I requested. It doesn't make any sense. However, we are completely open to the idea that the information presently available to the board. Was the board aware that this was shut down immediately when Jason and I had a conversation on Wednesday night when he first discovered the breach? And then we worked all night through the night to the next morning where I was able to then give him through through an extensive effort this list of all the files and the page number of each book that was provided to us by the district on the uh public record release. We're in complete cooperation with the same ideology that both of us recognize mistakes happen and the goal is mess

082up when you mess up and fix it. So the question I had before is would he contact these people yet? There's about 60 of them. >> Let me continue since you're not answering the question. prior to releasing the prior to releasing the public record as part of the right to know request. Did the district know that they had a responsibility under the law to redact social security numbers or are they trying to hide under this furpa/hippa relationship? And and realistically the district I hope the district knew that the whole reason for this request was after the auditor general's report that evidenced non-compliance with school codes with a lot of issues would be the term. Did the district know I'd released the public records I request requested that were there evidencing the auditor general's findings of

083non-compliance of those school codes? >> Any other comments from the >> Hold on. I'm not done. I get a couple minutes here. How about the NEF problems that we found? How about the stipens? How about the stadium debacle? All that's in this set of records. The fact that there's a couple, the fact that there is a couple that have poisoned the water well means it's difficult to get this information out to the public. So when you say the information presently available to the board, it sounds like the board is being mushroomed again that it doesn't have all the information. It doesn't know what we did to try to help and took the information we did and may or may not have used it for the benefit of the community, which is the exact reason that

084I made this request to give them to the public for that request. >> Can I ask >> Hold on a second before you go. Heather mentioned that she doesn't want to give out her phone number. Heather, then why did you text me? When you text somebody, they get your phone number. But understand, I have one more one more thing. Hold on. I get my couple minutes of fame before I get hung. I I'm at Valley Forge, which is really nice. It's the birthplace of the revolution, right? Where people get rights. But um just because this school got screwed up, and I apologize that I'm not there in person. I wish I was. I'd like to be. It'd be a lot easier. I agree. But uh in hindsight, I probably should have went to Salem, Massachusetts.

085But >> could the board ever plan on notifying me that these public records needed additional redaction if the government was going to do a double check before they released them. >> Were they going to check all 120,000 or were they going to do a spot check like I did where it shows 300page document? They were all redacted. It was only after we were able to search the documents because they knew they had a problem >> from Jason that we helped them to try to resolve them >> by Denise. >> Did you literally cut that? Did you really cut that off? Why >> Why are you silencing a a board member that's currently being >> witch Why would you do that? But anyway, I'll repeat it then. Did the Did the board ever plan on notifying

086me publicly released documents needed additional redaction? We had every understanding that they were fully redacted and they were going to be published by the district on the website twice. Once in at the beginning of this debacle and then once just a couple weeks ago they were going to release it. This is way worse. If the district released these documents without knowing >> the reach of the district is so much greater, it would have been way worse. We were able to contain it. >> The floor go away. >> Start over the roll call. I didn't hear anything. >> Um, Mr. Jeremy, >> no. Miss Denise Hartley, >> I'm going to vote yes with with an understanding that it is very difficult for me to vote that yes, the idea of condemning anyone is very hard. Um,

087but I also feel that his actions need to be addressed and this is the first step to addressing them. So, as much as I don't like the word and do agree with Jeremy that it's something that God only has the right to condemn someone, I think we have to address it and this is the first step. So, I vote yes. >> Mr. William Howland, >> yes. >> Miss Leone, >> yes. >> Mr. Timothy T. >> Yes. >> Mr. David Bradley. >> No. In the words of Bill Hill, no. Mr. Alex Matika. >> Yes. >> Six yes, two no. Motion passes. >> Thank you. Uh, segueing into uh, item 2.2, the ad hoc committee appointment. So, it's already been discussed. >> Are we going to get any of the answers to the questions I asked? >>

088We're not getting answers, Dave. I don't know why you're bothering. >> I'm just asking, are we going to get answers to whether or not these people have been notified >> if they want me to do it? Oh, >> uh, I'm sorry. Um, >> you need an answer, guys. We got to help the people. >> Attorney Spurlock, do you have a comment? >> Yeah. Can you help? >> Thanks. >> Sure. As far as demanding that the superintendent or otherwise answer any questions related to what Mr. Bradley has just said, there is no obligation to during the board meeting unless the majority of the board demands that he answers the question. So, as far as what's being discussed during this meeting, there's no obligation to answer that. One thing also to note just I know there's some

089discussion about investigations. It's it might be it's likely that an the insurance company may do an independent investigation. That's something that can be discussed further but that is something that often times is done by insurance companies. >> Well, that's understandable. And then this motion. >> Can we get a motion to have the superintendent ask the simple questions that I requested to have answered so that we can investigate right now, right away, and get some specific path forward to help the people that may have been breached. >> I firmly believe the school district was in the best interest of the people when they provided and followed the law to release the records. They gave to me as a public record and I released them for the same interest. >> We should find out. Jason Jason is

090trying to answer you. If you could please stop for a moment. He's answering your question. >> Dave, we >> are I can confirm we are doing our best to notify individuals as we can confirm. The challenge we have is that it is difficult for us to confirm exact. That's what I said. I said that last week. We are in the process. I send letters. Um and as we move, we are doing that. Now, I think there may be something broader as we work with the insurance company. Uh there was there was a call today. We will get further guidance uh in terms of what our next steps are. I have communicated with anybody who has reached out personally. Um, I have a letter for retirees and and basically I've had people ask and if they

091can't confirm that they saw their information, I can't confirm that it was out there because I did not see it. And that's that is the challenge that the district actually has in trying to determine exactly what information was out there and what information was not. And so if we can com that's why that's why the request was made for a digital copy of the files that you originally uploaded in totality so that we could actually secure a third party to do a cross check between those and our original unredacted and we could identify exactly whose information was exposed and then we would be able to quickly notify that. However, we have not received that yet. Do do you have a copy of what you gave to me in redacted form? >> I mean, you have

092a copy of everything you gave me, right? >> We have we have some, but we it's hard we are we are unable to determine if we have all. >> So, all those thumb drives that you gave to me that a lot of them we gave back to you to refill. Do you have a record of what was provided to me? If someone else does a right to know request and says, "I want all the records you gave to Dave." You'd be obligated by law to give them the redacted records that you gave to me electronically. >> All right. Thank you. >> Are you prepared for that? Or do you have it or do you not have it, Jason? If you don't have it, there's a way to cooperate that makes it protected for me and

093for you because there's a suspect here. If I hand you the drive that I have all these discs on, can we go through the third party? Whether it's the insurance company, the third party investigator, that's a negotiable point. But when you guys are hanging me without even due process of like, let's talk about what happened here, guys, and how we're going to fix it. Let's put the smartest minds in the room. >> Apologize for not being there, and try to help, >> especially the people that got the the information >> if you really do. >> All right. Uh, next up and >> I would like Jason to answer that. Can we ask him do you need that or do you have the copies of what you gave me? >> Uh, so again planning on assembly

094question, Alex, it's important question. If he does not have what he gave me, >> that's a very important question. >> I'd like to >> Is that what we're admitting to that we didn't keep a copy as a school district that we did on a right to know >> to this committee? Jason, can you help? Please just tell me. >> Miss Nef and Dr. >> No, no one's going to answer this. >> Joining this committee and leaving the charge. >> Yes. Yes. >> I don't Yes. >> I think that that's a great idea. >> There's open hostility from him. There's open hostility from her. Denise is the only neutral party in this. >> Well, I really think >> hostility. >> I understand that. There's been hostility towards him for quite some time. >> So you enjoy

095>> No, I would never suggest that. >> I don't Can I say something? >> I I understand that there's hostility, but unfortunately we're sitting here as grown adults. >> Were you here at last week's meeting? Yes, I was. >> Okay. Did you notice the way Heather was talking? >> So, I'm not on the committee if you want. I'll help. >> I'll volunteer. >> I'm sorry. Everybody can have bad moments and can be going to make is this is a difficult topic. It's a difficult subject. There's negativity and hostility no matter what. I would hope that when we gather we can look at it objectively. I I not believe is that that's my hope and I maybe wish >> you know what that's what we have to go on. That's what I have to go on

096Jeremy. I have to rely on and hope that the fellow board members are going to be objective. >> It's possible that Bill can handle it. It's possible that you can handle it. I don't believe that Heather has the ability to handle it. >> All right. So, we move forward with you three moving forward. >> Well, now you're putting words >> now. You just you're like, "Oh, well, so we'll just keep moving on. I don't really care what you say." That's really exactly what you said. >> Well, so not that I not that I need to allow Tim. the president is responsible for assembling committees at Hawkerno, right? Uh but there's also a bias on the other end of it. And so I made a conscious decision that it probably wasn't appropriate to put directors on

097this committee who voted to appoint him last year. >> I totally I'm not asking to be on the committee. I don't think that I could do it. >> I'll be on the committee. I'm the most knowledgeable about the whole process from the beginning to the end. I have the best interest of the public >> even asking for a right to know. >> So much problem with the with the um auditor general's report. I mean it was it was a travesty. >> Join those three. >> I'll I'll help. Put me on the committee. Glad to help. It'd >> be awesome. >> I do appreciate your um >> I thought you might not even a little bit try to help. So, next up we have um next up we have policy 012. Um policy 012 was referenced

098uh in the uh resolution that I just read. Uh again this reiterates director's obligations to maintain confidentiality uh with all protected information that they receive uh and additionally prohibits uh director attendance and participation in executive sessions uh regarding any ongoing litigation or investigation surrounding uh such director. >> So hold on one second. Oh wait, there was >> there was sorry I probably should have said that first. Thank you. have second. >> Second. >> Any additional questions or comments? >> I'm going to go back to the whole Patriot Act thing and we're rushing on this. We are not going through the proper procedure for this. First reading, second reading, pass. We're not doing it. I mean, I understand. Look, >> I think there's some urgency to this. >> There's some urgency to this, but there was

099urgency to the Patriot Act and it was bad and bad things happened. We know this. I don't think we should break. That's potentially a false equivalency. >> Not really. >> Wait, guys, hold on a second. I have a question. Who Who wrote this policy? >> We should pass this. And you know what? If it were going through proper procedure, I would pass it because it makes sense. But we are bypassing procedure and that is a bad precedent to set. I don't know if Jeff or one of the other people at me or whatever the hell it's called now gave you this advice. You're setting a dangerous precedent right now. You are passing stuff without going through proper procedure. Now if you want to put it up for >> this is there is a proper procedure

100for this. According to policy 0009 we are able to expedite policy. >> I think it's a bad idea. >> I think put it up for read tonight. >> Hey Alex, who Alex who uh who wrote this policy? >> I'll show up to vote. >> Was it a PSBA policy or did someone else write it? I just don't believe that we should >> I'm sorry. Before we vote on this, can we find out who wrote it? >> I don't know. >> So, you hear me? Okay. I'm asking the question, who wrote the policy that we're rushing to adopt? >> This is from the solicitor. >> Perfect. If the solicitor is the one that's adopting this policy, that's great. when the board adopts the policy, we're actually taking advice of the solicitor and then prior to rubber

101stamping, blindly trusting after we just found out about this debacle related to release records and everything else instead of demnifying the solicitor. Why don't we take it to the public and let them see it for a month or so? It's not going to change anything. We really learned our lesson. I'm sure >> we rush this through, but it's okay. I like the idea. I'll probably vote for it. But just the process of the procedure, the fact that you're ignoring the public, the fact that we're not doing our job is fidelity, which is what our oath is because you're going to circumvent all those other policies and just get it done. It's back to the wood. But thank you. >> Glad to be the witch. >> you agree with I don't want to have to vote

102no. I'm vote I would be voting no out of procedure and yes. Okay. So, we're we're allowed to expedite things. But seriously, is >> I'll make a motion we postpone it until next month. >> That is something major that we're going to have a meeting on. So, >> is there Dave's mot? >> Next month is next week. So, I can second that and I know it's going to fail. So, go ahead. >> Can I have a roll call vote Janine, please? Motion to table. >> Motion to table. >> Until next month. >> Miss Denise Hartley. >> No. >> Mr. William Howland. >> No. >> Miss Heather Net. >> No. >> Mr. Tiny Tech. >> No. >> Mr. David Bradley. >> Yes. >> Miss Lori Fry. >> No. Mr. Jeremy Glow. >> Yes. >> Mr. Alex

103Matika. >> No. >> Two. Yes. Six. No. Motion fails. Do I hear a motion to bypass first reading and move the policy immediately to final reading uh in accordance with policy 009? >> I'll make the motion. >> I'll second. >> Janine, can I have a roll call vote, please? >> I make a motion we postpone this vote until next month. >> Second on that. If we're going to really ram it through, let's really make sure they do it. Can I get a second on the motion to postpone this motion until next month? So at least the people can see it, read it, and absorb it because we actually work for them, you know. >> Is he absent or is he here? >> I don't know. >> He's there. >> Can I get a second on

104that motion to postpone this final reading and adoption until next month? >> There is not a second for your motion. Keep up. Yes or no? >> It's your turn for a vote, Mr. Bradley. >> No, >> Miss Lori Fry. >> Yes. >> Mr. Jeremy Glouge. >> Unfortunately, I will have to vote. Yes. >> Miss Denise Hartley? >> Yes. >> Mr. Alex? >> Yes. >> Seven. Yes. No. Can we can we take a moment and explain to I want to say the audience, but that doesn't seem like the right what this what this means. >> I think we were supposed to have public comment anyway. Changed. >> I apologize. >> And shouldn't you do that before you vote, guys? Well, I know on Dave, but you know, unfortunately I I think you know the question is

105why are we moving it to without bypassing a first reading and I think that the public if I was sitting in the audience would want to understand what policy means. I understand most of you do but I'm just saying it is it it it would be helpful. So >> it essentially >> I can explain it. It was called fear. You can manipulate a board and lobby them to exercise their power with fear. >> And it works almost every time, >> especially when it comes from a significant lobby like either the superintendent, the solicitor, principles. Works every time. Good job. to be excluded for legal counsel purposes from those executive session content areas. Any additional I I know there technically was an opportunity for public comment uh in the beginning of the meeting pertaining to agenda

106items. Uh I did not allow for that u with the motion to table. Uh I'd like to retrospectively allow for that now if anybody has any comments. Yes. Now, I was here last on 14. I expressed myself and I'm going to express myself now. You understand about the chain of evidence. This this is similar to that you had unredacted files that you gave to Dave Bradley. He blames you for it going online, but it's inevitably his responsibility once he accepts that information. It is his responsibility to make sure there's nothing, no sensitive material goes online. He just out there and poured everything out, screwed the teachers, screwed their spouses, their children of this district with no regard. it was his responsibility to look at that information before he released it and he didn't. So all

107of this mess falls directly on him. You can't blame the board, Bradley. Some of these members up here weren't even here when you were fighting for that information. And yet you blame them because you got it. You released it. >> I'm not blaming. I am accepting the responsibility of humans make mistakes. >> Last week, >> now shut up and let me speak. >> Yes, sir. >> And that could possibly destroy people financially by what you did. Not an apology from you. Not I'm sorry. I didn't mean to do this. Yes, you did. When you took those files and threw them out to the public without even looking at them. And I don't care what anybody thinks or says. You're responsible because you got the information that puts it all on you to do the right

108thing and you didn't. You did the wrong thing and you possibly destroyed people's lives and you just don't give a damn. That's what hurts me and I'm sure that's what hurts all of the teachers here. And you know what? I filed a complaint with the FBI and the Department of Justice US and anyone else who wants to join me because there are strength in numbers. Go online to fbi.gov or justice.gov and file a criminal complaint against you for what you did. In response to that, I appreciate it. What I did when I asked for the right to know was to request the government to publish their financial books for public use under the right to know law. They compiled, they edited, they redacted, and they published it. And all Zs I did was donated to

109the public library which was basically 2026 version online. >> I respect that. I will join you with the same complaint. Thank you. I completely agree and it should be investigated fully. Although I from given the amount of the handful of documents that were speckled in there, it's really small. So let's recognize that human beings make human beings mistakes. The question we really should be investigating is the amount of redundancy. What was we looked at? The fact that I actually checked >> on the district website, we currently have 58,000 of these same records that have been being released regularly since 2023 to today. >> I verified those and there was not a single mistake, it should be exemplary, >> but the fact that we had a handful of very unredacted documents speckled into this thing, >>

110it's a shame. It really does. Thank you, >> Dave. We're voting on consent agenda. >> No, come back here. >> They they should have had a chance to speak before. That's a sunshine problem. Talk to Alexis. But redo the vote. Do whatever. But, you know, at least you should correct it. You have every right to correct the mistake. We should correct it. Let's just follow the rules. Follow the law. Thank you, >> Dave. The consent agenda items, are you voting for them or not? >> You're moving on without fixing Yeah, they they moved on like >> without doing the sunshine problem. Okay, sure. Consent agenda. Yes. Thank you. Unbelievable. >> Miss Lorie Fry. >> Yes. >> Mr. Jeremy Glow. >> Thank you. >> I'm sorry. Yes. >> Miss Denise Hartley. >> Yes. >> Mr. William

111Howland. >> Yes. >> Mr. Alex Matika. >> Yes. Thank you. Three pages and 30 seconds. That's terrific. >> It's already 8:41. >> All right. Next up, we have um item 3.15. >> Say look behind me because they're not there. Never mind. >> Donations and local grants. Uh do I hear a motion to approve the following donation/local grants? We have a donation in the amount of $6,242.33 from Giant for the Backpack Buddy program for the 2627 school year as well as the donation of one warm-up kicking net to the varsity football team from past football alumni Mr. Mike. >> So move second. >> Questions or comments. >> Greatly appreciated. >> All right. All in favor? >> Opposed? >> The eyes have it. Next up, we have some budget transfers. Just one budget transfer. Do I hear

112a motion to approve uh the budget transfer below for Toshiba document scanning? >> So move second. >> Questions or comments? >> Hearing none. All in favor? >> Opposed? The eyes have it. Next we have food service transfers. Do I hear a motion uh to make the following? I don't have this on my agenda. >> Oh, there's nothing in there. I don't have anything in there. There's nothing in there. No, sorry. strength placeholder. So >> table three table >> or does it just fail? >> It just fails. >> Motion fails. >> Yeah. >> Okay. Thank you. And I made a motion. >> Wait, you need to make a motion. >> I hear a motion. >> Second. >> No. >> All in favor? >> Yes. >> Whoa. Hold on. Now I'm confused. No, >> you we need

113to make a motion. Were we making a motion to table it or we were making a motion to let it die on the floor? Let it die. There shouldn't have been a second >> because if you get a second then it's not dead and you have to vote on nothing. >> Okay. So, let's try this again. >> Can we reboot? >> Yes. >> All right. >> I will move it. >> Is there a second? >> Hearing none. So, the motion fails. Thank you very much. This might need a little >> Yeah, it needs to go quicker. >> All right, next up, item 318. BFW Publishers uh personal finance. Do I hear a motion to approve the purchase of 30 achieve for business with personal finance for the AP course textbooks and e licenses at a

114cost of $5,13687 to be paid out of the 2526 curriculum budget. >> So second >> questions or comments? >> Is this a roll call? This was the new quote that they had said we had as >> all right hearing done none. All in favor >> opposed. >> The eyes have it. Next >> for for >> Gram Academy. >> No, I don't think so. >> Just making sure there was a question. Um 39 item 319 Graham Academy. Do I hear a motion to approve the 2627 annual contract with Graham Academy? So move second. >> Questions or comments? >> All right. Can I have a roll call Janine? >> Sure. >> Mr. Timothy T. >> Yes. >> Mr. David Bradley. >> No. >> Uh, Miss Lori Fry. >> Yes. >> Mr. Jeremy Glou. >> Yes. >> Miss

115Denise Hartley. >> Yes. >> Mr. William Helen. >> Yes. >> Miss Heather M. >> Yes. >> And Mr. Al. >> Yes. Seven. Yes. Why no? >> All right. Thank you very much. Moving on, we have item 3.20, the PARs membership 2627. Do I hear a motion to approve the PARs membership renewal for the 2627 school year in the amount of $175? >> Some move second >> questions or comments. Part is the Pennsylvania Rural Small Schools uh Pennsylvania Association Small Schools. We do get a lot a lot of information from them. We so this gives us access to newsletters, updates, uh but in addition to that, it also provides some pretty sound professional development opportunities for uh specifically administrators and business managers throughout the course of the year. >> Excellent. All right. Any other questions or

116comments? >> Can I ask a question really quick? Not regarding this specific thing. I ju I just want to ask the question while I have it on my mind because I forgot to ask it before the uh the what should we call it folk. So, has our business manager been business administrator, manager, whatever the heck, have they been looking at grants that are not the lowhanging fruit? Because I noticed that we got the same grant that we always get and we always go for it. That's great. Don't get me wrong, but I mean, a couple years ago when we brought that on, we were asking that he starts finding a way to get us grants that are not the lowhanging fruit or the ones that'll just, you know, get we'll get every time. Has that

117happened? Has he g us given us the reason why we haven't found any? I mean, or have we not dedicated him to doing it? >> I could certainly ask for him to provide you an update. >> I appreciate it. >> Yeah, absolutely. >> I I kept, you know, I've been telling people that, you know, when when we hired him, he came up with such great ideas on how to get us grants that would not be normal grants. And two years, all I've seen was the low hanging fruit ones that we've always gotten. And it's great, but Why why are we not being crafty at trying to get competitive grants? >> Okay, thank you. Sorry, I just I meant to bring that up before the other vote. So, >> any other questions or comments? Hearing none.

118All in favor? >> Opposed? >> The eyes have it. Next up, we have item 3.21, Senate 2627 proposed final budget. Uh, do I hear a motion to approve the 2627 proposed version final budget as presented in PTE 2028 format? The proposed version must be approved and posted for 30 days prior to final approval uh at the June meeting. >> Second >> questions or comments? >> I have a comment >> Dave. Dave, you have the floor. >> I said I have a budget overview that we should look at prior to making a budget because I don't think that we're being very diligent to our um constituents in relationship to the current budget without a without a citizens version of what we currently are taking in and what we're currently expected to expend. For instance, uh Jason,

119were you able to get that document that I created and put it up on the screen? >> No, the screen's broken, Dave. >> There you go. I'll put it on my screen, but it basically looks like this. This is the last year's third uh matrix at the end of the contract for the teachers union, which is wonderful. We definitely want to compensate them. And then this is the raise they got this year. Anybody read that? 10% for the highest payers. Most of them are in that six, seven, eight, whole, six, seven, six, seven, eight percent range. And the question I still have is on this contract that we know creates 60% of our budget, how many people are going to be qualified to get an NVert, which is worth about a 10 to 11,000 raise.

120Can a bachelor get that? NBert and therefore jump right to the highest column or do they have to get their masters plus 45 first? I was not able to get that answer from the negotiations committee. Can I please get it here in this boardroom because that is a wild loose cannon. That's an $11,000 raise to take a class and move yourself from the bachelor's column. This first column, I know everybody doesn't really understand this. I'll do a video for you. But this column to this column is really >> we get an answer on that. >> It's part of our budget guys. It's huge. >> They would have actually they would have to attain everything in between which is how it's laid out. >> Okay. So they got to get a mast's plus 45 and then

121they can get their MBA. >> National Ford certification is not simply a class. It is uh reserved for specifically generally speaking teachers who have been in the profession for several years. They have to have so many years before they can even attain that um documented evidence of that. They go through a rigorous process that is multi-year >> about three years, right? >> Yeah, it can be longer. It can be longer. >> It also can be shorter. If they take the if they take the rush class they can as long as they pass the criteria they get their certification >> but but the criteria they have to teach for multiple years in order to get there. So >> right so if someone has if someone has five years experience currently >> enough to enough to meet

122the requirement and then they want to go right from either just say bachelors or masters whatever they have and they want to go right to MBER. What stops them? It's an $11,000 rate take the class. It's about 1,600 bucks. >> And then early in your career taking it, you're going to have another 10, 15, 20 years. You're talking about a quarter million dollars over their career plus pensions. I love the idea of having certified teachers. They're the best. But the idea is does anyone look at the budget parameters associated with giving, you know, 8% and 9% 10% raises, right? and then this big wild card at the end, which is another $11,000 bumper for getting a uh board serve. And I couldn't find any other district that does this. >> Dave, I think at this

123point, these are expenditures that are are not up for debate for the for the budget. >> They are. We We're the ones that have to approve the budget. We're the ones that assign the money. You're >> saying you're trapped because you already made this negotiation without anybody reviewing it and not really looking at the ramifications of the potential that teachers might jump to this highest rating >> and expect to get their $11,000 raise for the next 15 years while they work for us. >> They must attain everything on the horizontal matrix. That is the final column. They cannot get there. They could get that, but they could not move up across the column until across the columns until they earned the other steps along the way. >> Where's that in the contract? I couldn't find

124it. >> Do you want to take Jason? You want to take one from the team? You and uh Matt sit down with him and craft it out on a >> Yes. If it's in the contract, great. I couldn't find it, guys. >> It's got that on the paper. It's on the screen. You have to get every stop along the way. >> It does not say it on the screen. It does not say it on the contract. It says as soon as you get your MB sert this is your rate >> the same time as earning national board certification earned their masters and an additional 45 graduate credits and then national board certification in one year then I suppose they would get an $11,000 job >> right now I agree they can't do that and that's

125not the point but I don't think our contract was written that way >> I think it's a loophole that people would more than likely exercise >> voting it looks It's based on a 4.8% tax increase. Am I correct on that? >> Yes. Here here's what the actual numbers are. >> It does include a tax raise up to the act one index. However, this is a proposed. Um, and what you would find is that as we continue to fine-tune with staffing and other costs, really at this point in time though, it's more about staffing quite honestly, uh, that you would have a better sense of where the actual expenditures will be. Please remember the expenditures included in this budget include everybody who is currently employed moving them up with a raise that they are slated to

126get contractually. Now for the professional faculty, we actually have those raises locked in place. However, if there are retirees, those numbers then come down. >> I could think, right, there's a lot of still moving parts. Correct point. >> I'm saying the what we're looking at here is 4.8. It could wind up being less than that, but it's not going to be higher than that. >> Correct. And even if it the proposed was lower, it couldn't go up once it's approved at the the prelim stage. And So if it would have been zero, we could increase it, but we can decrease it if it's at 4.8. >> And that's I I just >> Yep. >> I understood. >> It does not mean it will end at 4.8. >> That's a a great question. >> The reason

127we're able to do that because we put money to the side for capital projects. >> Do what? >> Don't h Are we supposed to >> Yeah, >> I would need to have I would have to defer to Matt for that. >> It looks like there's money. Yes. If you look at he it looks like his calculation method >> and I'm not Matt but um it looks like there's some things that are proposed if I if I correct >> that was to look at I must have missed it. Thank you. So, so just just to clarify on the capital piece, the um capital that's within the general budget is not capital reserve. It's items that like technology we purchase, facilities improvements that get depreciated that we have to allocate them to the capital function within the

128required state coding for the general fund budget, >> right? Which is the which if I'm looking at it correctly, Matt, is the line items on line five. Correct. On page five. >> Correct. So that's what I was referring what I was saying to um Jeremy to look at because that's what it looks like to me. But I'm learning. So >> that's that's really good though for a bunch of first time. >> Hey Matt. Hey Matt. We respect the amount of work that you put into this but Alex. Isn't the board going to get a chance to let the citizens make a review? I mean, we have a a significant number of ex employees, insiders, I'll call them, that used to be part of the district that are not necessarily acting in the best interest by

129not reviewing and acting with fidelity because they have all the information available. Kind of like the railroad and we did earlier, it was what you're going to call information presently available to the board. Don't we want to have all the information first? Yeah. So, wouldn't that be acting with fidelity, >> right? And and >> can we can we do that presentation at some point? I mean, you blocked it because you're concerned that I was the one that released the records to me before I released them. But I get it. It's punishment. I'll take it. But can we do it now for the people? You don't want to punish them for not hearing and understanding what's going on within the district. Right. Once the Times Once the Times News and the Bluidge uh you know airs

130this footage and Times News puts out there, Lee Heighten to raise taxes by four 4.8%. Don't worry, they'll review it. Dave, >> we didn't even present it to our own board yet. It was completely blocked. >> So Dave, it's not finalized. And I and that's why I asked my question was can it be lowered? And it can be. It's a tended I'm going to learn. >> But Denise, with all due respect, after doing this for about decades of watching these government agencies, it doesn't work that way. They kick it down the road and then everybody gets in a rush and then fear jumps in and then you have to hurry up and do it and June 30th's coming and we don't have time. Heck, I was on a board where they almost had to back

131date it. So, be careful with that ideology. You're assuming that people are nice. They are. I get that because you're nice. Not all these people are. >> Forget it. >> They're lobbyists. >> So, let's let's >> And honestly, Denise, I'm I'll talk to you because you listen. For the last several years, we were we were told at the last minute, oh my god, the sky is falling. Well, no, not the last two years. Sorry, Jason. I apologize for that. But we were told that, you know, if we don't raise taxes, we're going to perish in hell. And, you know, we're really not doing that bad. And we've actually started making moves to cut the deficit, you know, that would the deficit spending by bringing things back in house and realigning things. And I'm sure Jason's

132got a lot more plans to bring things into perspective. But this is what they do with new boards. You convince them that if you don't raise taxes by the maximum amount, you're going to regret it. And then they come in here and raise it. We didn't raise it for how many years? Four. And then we lowered it. >> But now look at our deficit >> and we're really not that bad. >> Okay, >> it's not. They said >> under the treasur's report at the end of April. We got one month left. You got $17 million. >> When I first started on the board, they said that we were going to run out of money by 2026. We didn't run out of money and we still have a lot in the bank. So unless we move

133stuff and deplete the funds that are in there, we have money. And it's really not going to run out by 2030. It It looks like it, but it's not. And and everybody here at the table can believe that it's going to, but it is not. >> Okay. >> And I appreciate that insight. I was not on the board the last four years, but >> I know that's why I'm trying to give you guys the advice insight. Yes. >> I I will actually say I don't use >> anticipate a June 22nd recommendation of a 4.8% tax. >> That's nice. I like that. They're not. You're gonna wear >> And Alex, it's it would be naive to think that you're gonna follow the advice of the professionals that you hired that are reaping the benefits of the

134money that you're collecting. This is $50 million collected and dispersed each and every year. The pressure on those people to extract more from the community is greater than taking the heat, which I'm really good at apparently, on telling the truth. >> Be honest. actually look at the numbers and say, "Guys, we have all this money because the tax rate is so high >> and we put it in other pockets." If you really look at it, there's a great opportunity to be more efficient and give the public more of the data on the finances. they will realize that I >> get it and I appreciate all that down as then it becomes then then the the crystal ball becomes a little bit more accurate as you as you get closer and closer. >> I am not

135putting you guys down at all and I believe the administration will do a good job and try to bring us in line. I'm just telling you guys all that 4.8 sounds scary. I won't vote for it even even on the beginning budget, but it's um it it'll get >> just a scary number to hear. >> There's a term called due diligence. I don't think it occurred yet because we're only taking information from one side and the side was created by the people getting the money. >> Need to be able to provide >> due diligence. We need to do it. That's part of our act of our oath with Fidelity. We want to do deal for the benefit of the people. >> You off that and the fact that I really would like Matt and and

136and like I said, we were told that we'd be able to find some some competitive grants out there. We never focused on that. And I really think a lot of districts do fill in gaps with competitive grants. Now, I understand that it could mean that you spent two hours filling out a form just to not get it, but that's two hours that you could get it. You know, it's very possible. So, that that's all I say on that. >> Right. Any more comments, questions regarding the proposed final budget? >> Are we going to schedule a time to have this overview or not? >> What What overview? We're gonna a budget overview from the community side, not the people getting the money, but the people paying the money for what the board can be lobbyed by

137the community that we serve to better understand the finances that are available for the $50 million you're going to collect from them next year and then disperse. >> We all have people that helped write this budget that you're looking at. I mean, it's just logical. It's it's common sense. I know you hate me, but come on. Anybody would say, "I want to see where the money's going to be coming from, and I want to see where the money's going before they pull it out of their pocket and give it to you." Right? I mean, that's just ethical responsibility. It's due diligence. >> You have that review. >> You need to stop and listen. >> Oh, it's hard to do. Go ahead. I'll listen. >> Going on and you keep talking over them, which is postponing

138the delay of this meeting and is causing more confusion. So, if you could please watch your screen and when people are talking, stop and listen to them. I understand there is delay, but let's give each other the respect to listen to what the other person is saying. Thank you. >> Thank you. >> I respect that. The only people I get to see on the screen are you and Jeremy. Everybody else is usually hidden even when they talk. >> So, thank you. >> Janine, can I have a roll call vote, please? Sure. >> Um, this is for the proposed final budget. Miss Denise Hartley, >> yes. >> Mr. William Helen, >> yes. >> Miss Heather Net, >> yes. >> Mr. Timothy Tac, >> yes. >> Mr. David Bradley, >> no. Due diligence first. >> Miss Lorie

139Fry, >> yes. >> Mr. Jeremy GL, >> no. >> Mr. Alex Mika, >> yes. >> We have six yes, two no. Motion passes. >> Thank you very much. I post. >> The eyes have it. You know what is nice though? I just got

141to say one thing. Looking back here at the treasurer's report and seeing 17,480,7141. That's actually pretty good for this time of the year, I would assume, because I mean we're we're we have a deficit, but not that bad. That sounds like not a bad fund balance to have. The >> the only thing that you have to consider is >> that's not a deficit. That's what you're spending this month, Jeremy. It it shows negative because that's what's going out. Just I didn't say it was a deficit. Go ahead, Jason. I'm sorry. >> No. Uh that that we still there's very little very little revenue coming in from from now until the end of the fiscal calendar and there's still a couple months of payroll to go. >> But then there's all sorts of shrewups that are

142going to occur and everything like that. Okay. Well, it sounds >> it does, right? See what happens when I have rosecolored glasses. They just go. Not going to happen. >> All right. Next up, uh, section four, personnel. Uh, item 4.1, job descriptions. Do I hear a motion to approve the job descriptions for the following positions? Um do I hear a second? >> Second. >> I'm assuming we're tableing it anymore. >> I'll tell you. >> Go ahead. >> Once it gohead. >> So no, rather than rush to get something on the agenda. I wanted more time to review with our administrative team exactly what our asks for are these positions, get it right, um rather than go through the process of having to come back and revise later on. >> That s is a great reason. table it. So, let's go on that. >> Yes. >> All right. Um, all in favor? >> Opposed? The eyes have it. Item 4.3 has been tabled. >> Next up, item

1444.4, candidates for employment. Do I hear a motion to approve the below candidates for employment in accordance with respective contracts pending any necessary paperwork? >> So, move second. >> Questions or comments? Hearing? None. Do I hear a motion to approve the below request for athletic coaching manager candidates as per contracted rates pending in any necessary paperwork? >> So any questions or comments? >> Hearing none. All in favor? >> Opposed? The eyes have it. Next we have item 4.6, Grand Canyon University affiliation agreement. Do I hear a motion to approve the memorandum of understanding between the Heterary School District and Grand Canyon University to work collaboratively to fulfill practice SL or practicum practice immersion experience for

145nursing and healthcare professional students? >> So moved. >> Second. >> Questions or comments? Believe we need a roll call. >> I have one. Hold on a second. >> Can we ask Alexis if we have liability with these contracts? And in all fairness to Autumn and the others that think that it's great to have a solicitor with us. Can we just check with that? Alexis, >> are you asking about all the contracts? >> The two theou and the Lee Heighten Area School District. >> I'd have to take I'd have to take a look at them and get back to you. >> I'm not the one who reviewed them. >> Yeah, no worries. Thank you. Appreciate it. >> Right. Any other questions? hearing none. Can I roll call please your name? >> Sure. Mr. William Helen. >>

146Yes. >> Miss Heather Nef. >> Yes. >> Mat. >> Yes. >> Mr. David Bradley. >> Not until we're fully informed. Thank you. >> Miss Lorie Fry. >> Yes. >> Mr. Jeremy Gl. >> Yes. >> Miss Denise Hartley. >> Yes. >> And Mr. Alex. >> Yes. >> Seven. Yes. Thank you. >> All right. Thank you. Next up item 4.7. Wils University District uh certification preparation memorandum of understanding. Do I hear a motion to approve uh suchou >> second >> questions or comments? Second that. All in favor? >> It's getting late. Miss >> Heather. >> Yes. I don't see him on the screen anymore. >> Is he absent? >> I'm here. I was waiting for my name to be called. >> We just called. >> Okay. Thank you. I could not hear that, but yes. >> Okay.

147>> Thank you, M. >> Lori Fry. >> Yes. >> Mr. Jeremy GL. >> Yes. >> Miss Denise Hartley. >> Yes. >> Mr. William Helman. >> Yes. >> And Mr. Alex. >> Yes. Thank you. >> Excellent. Thank you. Next up, item 4.8, professional development. Do we have a motion to approve the following professional development opportunities listed below? >> So move. >> Second. >> Questions or comments? 148district. >> So moved. >> Second. >> Any questions or comments? >> No. Thank you for your 20 21 years of service. >> Absolutely. >> I have one. Did she take advantage of the early retirement and was she the only one? >> She's she's not part of it. >> She's not Yeah. not part of the professional bargaining association. >> The nurses are on a separate contract. I'm your I'm understanding you're saying >> certified school nurses are on the professional collective bargaining agreement. >> Okay. Thank you. My apologies for on that one >> and I apologize for mispronouncing your first name. Um all in favor? >> Opposed? The eyes have it. Next up, we have uh programs uh consent agenda. Uh do I hear a motion to approve consent agenda items 5.2 through 5.4? They're the second

149readings. Uh Lee Heightenboroough Police and Disposal of Surplus Properties. >> So moved. >> Second. >> Uh questions or comments? >> This is a call. >> All right. Miss Lauria Fry. >> Yes. >> Mr. Jeremy Lounge. >> Yes. >> Miss Denise Hartley. >> Yes. >> Mr. William Helen. >> Yes. >> Miss Bernette. >> Yes. >> And Mr. Alex. >> Yes. Thank you. >> All right. Next up, we have item 5.5, first reading of policies. Do I hear a motion to move the following policies for first reading for public review and comment? >> So, second >> questions or comments? No, I want to review the meeting one definitely before next month's vote on that. I just I

150didn't get a chance to look at that. >> Okay. Um I mean in summary, it essentially uh provides just guidance on keeping decorum and streamlining discussions. It's just something >> does it say anything about it being evenly applied to uh the public as it is to board members? >> Um I didn't I don't know. Like I said, that's fine. >> I have one question that I I didn't see in the policy on the employment of district staff. >> Dave, we're on the first one about meetings. Can we wait for yours, please? >> Oh, sure. Sorry. I appreciate it. >> That's all right. You know what? You don't have to find it. I I'll take a look at it. >> Okay. >> And it just needs to be applied evenly. >> Sure. >> Because you know

151what? There have been some community members who have been terribly outspoken. Now, I'm not talking just about recent actions. I that's understandable the emotion that it's drawing. >> Sure. >> But there have been some that are very disrespectful. >> Sure. >> And they're not gaffled down. >> Sure. And I and I take accountability there. I need to be more >> You're getting there. I get it. But it's also the fact I understand why you're a little uh more lenient. But uh okay, just making sure >> actually under the right under the first amendment they have every right to be as costic as they like. Jeremy, >> I know Dave, but if we're going to admonish people like you for speaking, >> I know, I get it. Let them let them thick skin. It's a great

152thing. Be as costic as they did. It's the only way to refine government. You got to make sure we keep an eye on them. And the more the people participate, the better off we all are. Thank you. >> About the founding fathers wanted. Let's your question on the next one. Could Jason please identify what exactly is tested before we hire an employee? I believe it's only TB. We don't do a drug screen. We don't do any other things for employees before they get hired. Is it true that it's just TB? Tuberculosis. >> They have a general physical and and TB. No other screening other than that for an employee to be hired the first time. >> I do not believe so. >> Can we add that to the >> Yeah, we should take a look

153at that, guys. >> I mean, every job I you know, every job I go to these days has drug. >> Well, we also have great benefits. So if they're ha if we can ask for people to either volunteer if they're having trouble or someone knows they're having trouble, let them volunteer because we have great programs to help people that are suffering in that regard and it's better to identify them early than later. I mean that's the whole idea to help each other out. Thanks. >> Employment of the district staff >> and I believe that you know we should have a policy in place or at least part of that policy should be drug screening before hired. >> Um >> in real world that's the way it works. So >> I'll look into it. Yeah. >>

154Thank you. >> I appreciate it. >> Exactly. Probably tested like 20 times. >> All right. on the school board. Must be that. >> I'll even say do the school board. Have some fun. Get everybody. >> Any other questions or comments about uh first reading? >> All right. Hearing none. Is there a motion made to approve? >> Oh, wait. >> We're on a vote. >> Say we're on a vote. >> That's We can't talk about it until we approve it at all. I know it's late. >> No, no, no. That's right. I for sometimes forget the motion. Um all in favor? I >> opposed. The eyes have it. Uh, next we have item 5.6, some school enrichment journeys. Uh, I hear a motion to approve the below uh, school enrichment journey requests. So, second >> questions

155or comments? Hearing none. All in favor? >> I >> opposed. The eyes have it. Next, we have item 5.7, use of school property. Do I hear a motion to approve the use of school property uh, for the below requests? So move second. >> Questions or comments? >> Beware. >> Hearing none. All in favor? >> Opposed? >> The eyes have it. Next we have miscellaneous item 6.1. Authorization to enter and deposit material. U. Do I hear a motion to approved uh to approve uh said authorization? >> So questions or comments? Just want to b be b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b b briefly kind

156of explain this. This would be if there is a uh pendot project in which they have extra black top material available after they complete the job. Rather than finding a place to dump it, we could potentially they could dump it here. We could then use it to actually fill our potholes which would actually >> giant ones in the high school park >> which would actually be a savings for the school district. So that would have been a long fall. >> We'll give you a flight. >> I walking back after one of the practices and one of the kids almost went down. >> It's becoming pretty bad. So we need to Yeah, that >> I mean that parking lot's been there. I mean high school 1993 into 94. So that's a little bit >> Hey, I'm

157from 92. Um and Justin I believe pursued this. >> Justin did pursue it. Talked to the crew on on Mahoning Street there >> and said hey if you know they said well we have to have access to be able to come in. So that's that's sort of where it's >> Thank you. >> All right. I believe this is is this a contract or >> No, it's authorization to enter. It doesn't say that it will or won't. So there are no terms actually, just that they would be allowed to enter and deposit the material should there be any. >> Excellent. Thank you for the clarification. All in favor? >> I >> opposed. The eyes have it. Next up, uh board treasurer. Uh do I have any nominees to elect our next board treasurer uh who will

158be serving from the term July 1st, 2026 through June 30th, 2027? I'll nominate myself again as the one that has the most experience in reviewing board finances and school district finances. >> Thank you. >> Can I get a second on nominating myself? >> I'd like to nominate Lori. >> Second that. >> So I No. Is there a second for Dave's motion? >> No. Okay. And nominated Lori. >> Second. >> Yes. Okay. Are there any additional nominees? >> All right, hearing none. So, at this time, uh, >> yeah, open it up. >> Is there any public comment regarding regarding board treasure? >> I have one. If if I'm deemed a witch, I'll be magical and help with the finances so we can save the community a ton of money. But thank you. >> I hope that

159was humorous. >> Okay. >> We need a motion and a second for the >> We got that. >> We did. >> Or does the nominee count? >> We have a nomination. >> Yeah. We have a motion to >> Okay. to elect. Do I hear a motion to elect Lorie Fry as board treasurer? >> So move. >> Miss Lori, >> yes. >> Jeremy L. >> Yes. >> Miss Denise Hartley. >> Yes. >> Mr. William Helen. >> Yes. >> Miss Heather Net. Yes. >> Mr. Timothy Tess. >> Yes. >> Mr. Alex Matika. >> Yes. >> Oh, sorry. Mr. David Bradley. >> No. >> Okay. So, I I sorry. So, I want to say something before we move on. >> Mory took this on and I know a great job. You're learning it and thank you for the

160time that you're putting into it. I know it's a lot of time >> and it's a lot of learning experience. So, I just want to acknowledge and and say I appreciate that time that you're putting into it and your willingness to continue doing that. So, thank you very much. >> Absolutely. >> All right. Um, do we have any I didn't see any. Do we have any director concerns submitted ahead of time? >> No. No. Okay. Uh, is there any additional public comment? >> Came in later, right? You got one. >> Yeah, I think. >> Sorry. I will be quick. >> That's okay. >> So, you can take public comment after 2.1. So, I just wanted to follow up on some things that were said at the table. Um, one of them's regarding something Mr. Claus

161said. Um, he didn't want to condemn a man. Um, so what I'd like to say to you is you don't need to condemn Mr. Bradley because he did it himself. So, ignorance and tention don't change guilt or innocence. >> It was hurting at home. >> So, he admitted he did it. So, therefore, he is guilty. So, you don't need to condemn him. condemn himself. My in my opinion >> in my opinion, community and school district resources shouldn't be put into investigating Mr. Bradley's innocence or guilt. He's guilty. >> What need the focus needs to be put on is how this happened. whether it falls on, you know, the the solicitor, whether it falls back all the way to the to the O, you know, as an office of open records get a bl state um

162judgement of unredacted information, you know, should it come back to a school district to say, "No, this this information's in there. Social security numbers in there." and O I would think would say unredacted except for obvious social security numbers, confidential information. They didn't not their job. It was our job, our solicitor's job to appeal that they did it. So I would hope that your focus is on that and not Mr. because you didn't offer public comment after you um approve it budget or before you approve the budget. I've been living in this district for over 40 years and district 40 years. I just have something to say about what Mr. GL said no board. What happens is people say, "Oh, there's lots of money here. We don't need to raise taxes." So, they don't. Then

163other boards come on, and this is happened repeatedly in my 40some years. Other boards come on and say, "Oh my gosh, you know, we're running out of money. Weird decisions, one of which I made, things I had to do that I didn't want to do to save money." And then you get back down and say, "Oh, now we have money. we don't need to raise taxes anymore because now we have money and then three years from then you have no money because you didn't raise taxes. That silly ridiculous pattern has to stop. And Mr. Blouch, you had money when you got on that uh board, first got on the board because of ESSR money. This district didn't need ESSR money. You were able to have that in your fund balance. We had boards before you

164made all the reservations and all the hard decisions to get this district air conditioning and security and everything else. >> So, it didn't need a stadium. It didn't need to >> $3 million going out the door to the NEF with stipens for a program we didn't even get. It's okay. She She has a right to speak. Let her, please. It's important. All I'm saying is that it is ridiculous to think that you can get money one time and use it for operations. That's given money. >> It's found money. It's not operational. So don't use your fund balance as if it's going to put you through operation for the rest of the time. And don't say we're trying to scare the new board because you, sir, are way out of line on that. >> It's it's

165complete fear. Do do not believe fear. Fear is not there. There's an excess. It's amazing the amount of excess. It just needs to be more efficiently used and we'll be fine. The the for instance, our enrollment is down significantly. Our staff is incredibly higher than what it was for the same amount of enrollment. >> But it's okay. When we get the budget review, we'll all take a look at it and we'll all take the math together. And math doesn't lie. It's brutal and honest. We gotta love it. Run, Jason. Run. Everybody out of his way.
