Are we going to consider his request? >> I'll make a motion to consider it. >> a motion. >> I'll make a motion to consider it. We should add it to the agenda. I'll try to get a second. >> Yep. Mr. Do we have a roll call? Mr. Troy Beers? >> Yes. >> Mr. David Bradley? >> Yes. >> Ms. Lori Frye? >> Yes. >> Mr. Jeremy Blauch? >> Yes. >> Ms. Denise Hartley? Mr. William Hollen Hollen? >> Yes. >> Ms. Heather Nott? >> Thank you. >> Before we I just
want to add before we we officially amend the agenda for the Sunshine Act, we need to state the reason for amending it at at the meeting this evening since it is within less than 24 hours before the meeting. >> The issue just came public less than 24 hours ago. >> So, we'll amend the agenda to add uh >> Item 2.2. >> 2.2 discussion of battery the fact there has been a lot of discussion and >> I might be motion to have it as Because it's a discussion, not I'm not going to put any calls to replace or spend money. >> It also only became We only became aware of it within the last 24 hours. So, we wouldn't have been able to do add or amend it prior to that. >> That's enough to say.
It's enough to just say that this is a new issue that came to light that the board would like the opportunity to discuss at tonight's meeting and then the revised agenda can be posted tomorrow indicating that there was discussion about this topic. >> Thank you, Beth. >> I didn't come out within 24 hours. >> That's what we made it. That is not on the >> It was already on the agenda. >> So, are we We've added We've added an item. Are there any other public comments on agenda item 2.2 discussion of the data breach and >> My document was submitted on the agenda item. >> Yep.
>> The educators and the staff that are seated among you are seeking lawful compliance and transparency. We are tasked to be compliance officers to watch over others and report misconduct. Student, staff, and family safety is paramount. Irreparable harm was committed. The website publicly attacked the legal anonymity of the heightened students, adults, and minor children. An individual identified as David Bradley appears to be the webmaster of this site and sits before us as an appointed board member. I hold over 150 of formal complaints we wish to submit to the Lehigh Area School District. Please accept these complaints. We implore the Lehigh Area School District to take every possible action to address appropriate The expectation is to respond in a manner that will restore the trust that students, staff, and public have lost due to this incident.
THANK YOU. >> ANY OTHER PUBLIC COMMENT? ANY OTHER >> I'M NOT A TEACHER. I'M a school bus driver, but my wife is a teacher. And I just wanted to bring to your attention what Mr. Bradley did, violated three laws. The 14th Amendment, which guarantees the right to privacy. The Privacy Act of 1974, which protects the disclosure of social security numbers. The Right to Financial Privacy Act of 1978, which protects against disclosure of financial records. Mr. Bradley, you should be arrested and thrown in jail for what you did. Do you know it doesn't take just a couple of days to straighten out if somebody gets a hold of your financial records and decide to go in and steal your money. It takes months and months to figure it out, to fix it. But you, you just
decided to throw it out there and let the whole world, including those who take advantage of people. I'm not speaking for myself. Personally, my social security number isn't on file. My wife says, "When we went in to try to find out if our information was But I'm on the bank accounts." We went in to try to file Oh, the site was taken down. I want to know, did you put your social security number and financial information out there for everyone? You sure as heck didn't mind doing it for all the teachers. Why didn't you do it for yourself? Why? You're sitting there and you smile. >> I do. >> And And it's your number is out there, too? >> No. >> Your social security number is not out there. Your social for the teachers. >>
I >> You're a heck of a person, you know that? >> I respect >> Disgusting. THANK YOU. >> YEAH. >> ANY OTHER PUBLIC COMMENTS? >> DAVE, HAVE YOU EVER HAD identity theft happen to you? Have you? >> I'm thinking. >> You know what? You did. It's horrible. It takes a very, very long time to get your crap back in order when somebody steals your identity. And I know this because my husband because my husband You think this is funny? THIS IS NOT FUNNY. PLAYING WITH THESE teachers and these students' lives is not funny, Dave. You're despicable. You're dishonest. You are a horrible person. And you know what? I hope you get WHAT YOU DESERVE. >> I'LL GO. >> SO, DAVE, HERE'S YOUR CHANCE. WHAT'S your Social Security number? Your wife's name is Charmaine, right? What's
her Social Security number? Because you know his wife's name, so they now know your wife's name. You have three children, right? What's their Social Security numbers? Oh, now all of a sudden you have nothing to say for the man that always has something to say. >> I have plenty to say, well, you know. >> And then while we're at it, >> I don't want to talk about that. I don't want to see this guy. >> the two of the board members that sit up here that appointed Dave Bradley. Troy, would you like to tell us your Social Security number? How about you, Jeremy? How about you, Beth, your children? Well, come on. Let's hear your Social Security numbers. >> This is garbage. >> Yeah, garbage. >> Yeah, that's you. >> You appointed him, you loser.
And now he let her off the hook. >> You can't control the actions of somebody. >> You could have controlled the actions of him because you You knew Brad. >> I'm not arguing with >> You knew it. >> I second that. >> the day you voted for Brad that freaking executive director was going to happen. >> Thank you, Wally. >> You knew what this was going to happen, Brad. You knew the day you appointed >> I knew it. >> YOU KNEW IT. >> ANY OTHER PUBLIC COMMENT? MR. BRADLEY. >> THANK YOU. I appreciate You're special. You're pathetic. All right. Appreciate your opinion, Wally. The district shockingly released confidential personal information >> You did it. You did it. Don't even blame anyone. You're responsible. >> No. >> You're responsible. >> Let me explain one thing. >>
That's your MO every time. Blame someone else. >> Thank you. I yield the floor. Thank you. I get my >> Three minutes, Mr. Bradley. >> The district Thank you. The district shockingly released confidential personal information even though the court order in this case permitted the district to redact certain information made confidential by law other than right to know and fortunately district you released social security numbers and other information to me without even alerting me that such sensitive and confidential information that was part document production of over 120,000 documents. Certainly, I fully recognize the need to protect the confidentiality of social security numbers and other sensitive information as I would have expected the district to have the same regard. The digitized records provided by the district were made accessible to the public. The district received a
complaint that suggested social security numbers were provided with the document produced. Further review of the reduction material or the redacted material shows much less sensitive information was also redacted and other sensitive material within by the reduction team. I have once I learned that the district had included social security numbers, I took steps to ensure that the information disseminated to me by the district would no further be disseminated and we shut it down instantly. 6 hours later. Have to get an IT team to do it. It's all public. >> 6 hours later. >> Okay. >> You have 1 minute left. >> I know I I respect that. Please let me have my my turn for a little bit. The truth is of the 120,000 documents that were released, uh we ran a computer using military software
to find nation look like information and the files that were contained We also pulled some of the redacted files to give to the district and in every way to correct the to the best of our ability. Best of my time on this. Mr. Redman There have been some >> That was executive session only. >> Student information that went through this disclosure like file issue >> There was some student information where of the extent of what was what was released, we don't know >> And this like FERPA, could you explain to >> FERPA is the educational privacy act. Information is is supposed to be confidential and is to not be released publicly. >> And that's a federal law. Privacy much like HIPAA? >> Thank you. >> Can I make a quick comment? I forgot to tell
you before that the ACLU deals with this kind of violation of 14th Amendment and Privacy Act. I did call them and notify them and contact the lawyer so that the ACLU >> Correct. >> And they took that view. Oh, you did too? >> Yes, sir. >> On yourself? >> Yes. >> Cuz you're the cause of all of this issue. >> The point is it's your personal website and you're the one that released it. >> I just took >> And you're trying to >> How many documents say >> Others. Anybody else for public comment? >> Uh all I wanted to say was I don't really care what measures you went through to before you put your stuff on. My name and my social security number have been breached. And that's wrong. >> Hold on. Hold on.
>> I just wanted to know exactly how I could find out if any information of mine was released. I'm obviously a student. I know friends of mine that I would very much need to have their information released. I'm not too keen on it myself. But I would I just want to know exactly what was released. And from what I've seen so far, it seems like I won't be able to know that at all until litigation and legal processes. So, I I have Mr. Bradley, is there any way I could tell what you posted about me on your website? >> Yes. >> How would I do that? Instantly. Instantly. Um, but it's taken down now. So, how would >> It's taken down publicly. The records are being given back to the school district that was responsible
for redacting them, so they can review the list of redactions that you requested. >> It's never their fault. >> I will say the order the court order the court order said unredacted. However, the court order said unredacted. But a agreement was made that the school was taking responsibility to redact those sides. >> Nor did the school district authorize the public release of the documents. >> Once again. >> Uh, I'm sorry. >> Once the lawful release of documents is provided, they are public. >> Can you please give the audience a chance to >> I I was. I was responding back to Mr. Moser who mentioned that once the documents are released by the government, they are public. >> Okay. So, the young man that just came in here and spoke, that's our son, Connor. Uh, he
just >> We can show you how to do this. >> Sorry? >> We can show you how to do that. >> Okay. I just I want to ask the question for other people that He's anybody at home that is here. People are listening in. So, I just want to make sure that they know. My son just turned 18. This could be the first thing that ever shows up on his credit record is fraud. And it could haunt him for a really long time. We're in the process of applying to get him into colleges. He's looking to have like his first financial responsibilities. He's had his first job. He's just voted for the first time. And this is his first like adult financial experience that he's having. And as you can imagine, his parents I'm standing
here, I'm shaking. And my son came here tonight because he's frightened. And he's here speaking for friends of his who can't be here. I understand that there's going to be a lot of emotions while you guys figure this out, but we also need to figure it out and as quickly as possible. Because every minute that this goes on, Lori and all of these teachers and all of these students and all of these parents like I are sitting here with our hearts in our guts wondering, through no fault of our own, I did nothing wrong. I've never served on school board. I've never done anything wrong. I've never voted incorrectly or authorized any contracts. Neither has my son who was a minor until a couple months ago. And he's the victim of this betrayal. And we
all are the victim of this betrayal. How far does this have to go before we stop this and put our town and our people and our teachers and our staff and our students and children first. THANK YOU. >> WE WE CAN HELP. >> DAVE, DID YOU HEAR ME SAY THAT I asked to speak? >> We can help. >> Yes. >> Go ahead. Sorry. >> Thank you. I just want to say to everybody in this room, I have I myself have gone through identity theft. I know how hard it is even be dealing with this. I just want to let all of you know, I appreciate everything you do as teachers, as members of our community. And for students that are dealing with this, I myself personally apologize to all of you for having to deal
with this. It is not fair. It doesn't matter who created the problem. It's not something that I am What I'm saying to you though is I'm talking for myself. So, I'm saying that I didn't I didn't do it, but I'm saying to you all, I'm sorry that every single one of you has has had to deal with it. And I'm just openly saying, I'm sorry to you for having to deal with it. >> I'm sorry, Jason. Can the district release a letter to each person and parent of every child whose name appeared in this document? >> We are We are working on We're working with legal counsel to make sure that we provide information to anybody who may have been affected in the most appropriate manner that we can. >> Okay. >> And if I'm
correct, this goes back years. >> I I I was also briefed on this. I support you. So, thank you, Jason. Give me yours, I'll be glad to share it, too. >> Well, you wouldn't have to. >> I was going to say this for the end, but it seems like the conversation's leaning in this direction. So, let's talk. Um Well, most of us knew that this day may come at some point. Uh we just didn't know exactly how, when, or why. It was simply a matter of time before Brian crossed the line. We've known him to be the grandmaster of walking that line like a tightrope. Back in November, the community and I literally pleaded uh to not appoint Brian to our school board. Um discussion was heated. He was appointed. Um so, let's take a
a moment to review what this protector has actually done. Uh take Brian through his private website, the hidden government.org, um which has no official or unofficial association with the Lehigh Area School District. Um, despite using a web address that resembles a government site, or his illegal use of the Lehigh Indian head logo, um, uh, you know, he we're we're at least protecting students, staff, dependent information both current and past. This will include, but not limited to, sensitive health care data under HIPAA, social security numbers, student IDs, and further student information. Mr. Bradley had custody of these documents through a massive right-to-know request, and publicly stated in the right-to-know request process that he would not release any private information. Yet, it was released. He was attempting to shape shift the blame onto the Lehigh Area School
District claiming poor redactions. The Office of Open Records explicitly required the release of unredacted documents. Instead of doing the right thing by going through these documents to ensure no personal data was released, he instead uploaded it into the site, perhaps using some sort of AI to make it searchable, and release it on the World Wide Web. This was a clear breach of our trust to our community, combined with his subsequent failure to fully take responsibility for for this disaster. As a result, our district faces potential litigation as does he. The full extent of this exposure is still unknown, but it's certain to cost taxpayers thousands in litigation and legal fees. Just in the last 2 days, our legal costs have been considerable. Probably enough to help offset some expenses for an FBLA trip, just an
example where our money could better be spent. Mr. Bradley, be a man, accept responsibility for what you did, and resign from this board immediately. YOU ARE DONE. IT'S PLAIN AND SIMPLE. THE MAJORITY OF THE CURRENT BOARD did not want you, and the community spoke clearly in November that they did not want you on our board. These events have most certainly confirmed all of our opinions. You are continuing to force Le Hi Ton Area School District to spend taxpayer money on legal counsel fulfilling at times unreasonable right to know requests and litigating and potentially paying for lawsuits. You received three or four votes that night. You represent the few that voted for you and not the greater community. Our district doesn't deserve your chaos. It's been about 13 years of your nonsense and you have very
little to show for it. How does that feel? Now you have broken the law and it's time to pack up and get out. You're not wanted. I'd like to end by saying that we as a board sincerely apologize for what has happened to our Le Hi Ton Area School District community. You deserve better. I believe most understand that these are the actions of one person and regrettably she sits on our board. In the coming days, Superintendent Moser, the school district attorneys and the remaining school board will sort through this mess and do our best to ensure it doesn't happen again and mitigate any ongoing exposure of personal information. I just wanted to sort of set the record straight a little bit about why the information was released or how it was released. Um it was
the Office of Open Records. I believe that's an office in Harrisburg that mandated the release to Mr. Riley you know, his right to know request in an unredacted form. The Court of Common Pleas did not require that these materials be turned over to Mr. Riley in the December 10th, 2024 order. That order only imposed sanctions on the school district in the form of a fine. The district that the district refund Mr. Riley $731.25. I think I remember that being for copying costs that the district collected and that the district be responsible for his attorney fees in the matter. Thank you for for listening and I again I apologize for what happened. And thank YOU FOR >> SANCTIONED FOR NOT PROVIDING THE DOCUMENTS to the public. >> Please sanction. >> Heather, I think Alex might want
to speak. Oh, sorry, Alex. >> No, sorry. It's a little difficult to determine the best time to to chirp in with the owl. Um can everybody hear me okay? >> Yes. >> Um so I want to start by um apologizing. I had a prior work obligation. I'm down in DC at a conference. Uh So, apologize for not being there in person. Um but uh you know, similar to Bill, I want to speak in my capacity, obviously not just as a concerned citizen, um but as board president. Uh when I was elected president, I vowed to collaborate with all directors, right? Remember back to December, regardless of who was running together, who was elected, who was appointed. Um I vowed to put aside differences in ideology to work together and do what's best for students and
and for our community. Um and despite these efforts, I I can no longer stay silent and allow misconduct and malfeasance and pandemonium to define our our district. Um but you know, these actions uh you know, that have occurred over over the the sequence of the last few days um is is obviously a huge detriment not just to our students, our staff, their families, but the district as a whole. Um you know, through this publication that you know, from this personal website not affiliated with the district. Uh and regardless of intent, you know, this behavior represents a critical breach of trust. Um not just to the board, but to the community. Um And I think as as school directors, we should would I should obviously be held to a higher standard. Uh we're entrusted with confidential
info all the time. Uh understanding that improper disclosure can cause real harm. Uh and when we break that trust, uh confidence in the board's ability to govern responsibly is is damaged as well. Um so I think to say I'm deeply disappointed as as a president and as a director is an understatement. I think this evening was supposed to represent the approval and and you know, perhaps even celebration of a new CBA that it was deemed objectively fair for all parties. And again, here we are instead, the evening is mired in controversy once again. Um and and so again, I I want to I don't want to get too long-winded, but you know, after careful consideration, I believe that the actions taken by Director Bradley are are incompatible with the responsibilities of those serving on the
board. Uh I I I believe that in the best interest of the district and to to begin restoring the trust of the public, um I too am formally calling for the resignation of Director Bradley from the Heights Area School District Board of Directors. Thank you. >> Okay. Um I read that here every month. Is that part of what's going on here or is that lawsuit or whatever suit you got? Is that why I have to do this? >> The redactions? >> Yes. >> Uh I believe that was a a policy set That was a procedure set forth prior prior to my arrival here that they were done in real time. >> is because there was some thing that is real. >> Well, for the public. >> So, um is it true that >> Exactly. >>
Yes. Okay, that's just what's put on the website for the public to see because only the board can see the whole thing. >> So, now that this is all chaotic, how does that make a person like you feel? >> It doesn't have It doesn't have um social security numbers on it. >> does, but I I would they were redacted. >> But what if I miss it now? >> But it's not 120,000 documents all at once. You know what I mean? >> You just double check. >> I mean, people make mistakes. I People do make mistakes. >> And now we're getting confused. I'm making mistakes, which doesn't make me feel odd by >> not by anybody's >> You're not >> Not at all. >> One person >> That person is secure in here. And he's the
one that put it on the internet. >> Yeah. And he's the one that thinks this is all funny. >> Yeah, I know. >> I don't think it's funny at all. It's a wild >> I WANT TO PUNCH HIS FACE. >> BECAUSE you were screaming and being emotional and not logical. >> No, I am logical. >> It's a very logical >> Any more public comment? Stop. Nobody wants to hear you. Stop. >> That's fine. Government transparency is important. Private >> moving on. >> Personal privacy is important. >> Shut up, Amy. >> I just want to remind everybody back to November and December of this year. It was very chaotic because we were they were trying to push through certain things. Joy, Jeremy, and other people that were on the board. And one of the things they
tried to push through is appointing Dave. Three people walked out of that meeting. Three of them are here because they knew what was going to come. But two of them didn't care. >> Look at that, smart guy. >> And now now in a league, these people are going to be looking for in in charge of the Republican Party in Carbon County. They can't make the right decisions on the what they're going to represent in Carbon County. They're looking to make major decisions for any Republican in this county. They can't make a board decision correctly. You should not even give them one vote next Tuesday. >> Well, the only thing I'll say on that is anybody in Lehigh and Hanover that does not trust >> Any more public comment? >> About agenda item >> About the
agenda item. 2.2 All right, we are moving on to action items 2.1. I need a motion and a second to approve the collective bargaining agreement between the Lehigh Area School District effective September 1st, 2026 through August 31st, 2030. Along with the memorandum of understanding between the Lehigh Area Education Association and the Lehigh Area School District modifications to the health insurance plan commencing July 1st, 2023. >> So moved. >> Second. >> Can we have a roll call? >> I make a motion to table. >> Hold on a second. >> I got I got a comment before you start. >> I heard the district again, Joyce. >> No, I have a reason for it. If I can get a second, I can explain. >> It's logical. >> Second. >> Thank you. So, the reason I made my
motion to table is because tonight is a Catholic holiday and the Catholics cannot attend this meeting without committing a sin. So, right now So, I went to mass this morning at 8:00 because I work for myself, but parents and taxpayers who have to work 9:00 to 5:00 jobs do not have another option. And so, Dave, you can make your statement and then the board can vote. And the other reason was I don't think the public had sufficient time to look at the contract. And I propose that we have another special meeting a couple of days from now so that people have time to contact and make comments. That's it. >> Heather, on that on that comment of postponing, in addition to the issue of excluding a portion of the population, I took the contract with
the steps that were provided and I put it in Excel and we ran some math on it, basic second grade math. >> Whose waiting? >> You got a mouse in your pocket. >> You would enjoy it. >> Cuz joy math doesn't work here. >> Anyway, we looked at the we looked at the records and it was very evidentiary to see that I don't believe it is fair to the school staff that some members, depending on where they are in the matrix, will get a 2% raise this year and others will get an 8. We think it should be a unified fairness and I think if the opportunity was there that more than 24 hours to make sure that the people can see what is in this contract to be available to the public and to
the staff to recognize the difference between and the year-over-year percentage of raise is significant for the current budget uh given the staff levels that we have. And the word significant needs to be expressed in >> a significant damage you did >> I will inform the public that the overall cost of the district in totality, the percentages reflected in the raises in case you did not have the opportunity to review, but would like to know before the vote occurs or before this motion gets tabled. Year one is a collective 4.3% year two is a collective 4.01% year three is a collective 4.02% and year four is a collective 3.83% in addition to that there are some health care changes in which the rate of PPO increases to 7.5 the rate of premium share of part of
the employees increases to 7.5% for the PPO in year one and then up to 8% thereafter and and the HSA gets uh the the funding for the HSA gets reduced over the course of the contract if they are on the HSA plan uh by $350 not all at once but over the course of the contract. >> And with that in mind, everyone just learned that now at 7 >> Are there any other are there any other board >> uh for ratification from the union what was the number on >> I'll I'll answer that approved. >> Okay, so >> That is not something that needs to be discussed. >> Oh, okay. All right, I didn't know. >> Thank you. >> Now you have to take this emotion as a table the table the vote. >> Okay,
so can we have a roll call on the motion to table the vote? >> Can we have a discussion? >> Yes, it was tabled. >> Call Mr. Walsh. >> My question is, are there additional costs attached to delaying the vote and any costs associated or to the district if the delaying of the vote impacts open enrollment program, which is supposed to start on the 18th, which is Monday? Are there any financial impacts that would occur to the district if that this vote is delayed and the open enrollment process begins on Monday. Thank you. I I don't need you. Okay. >> Yeah, I was going to say the attorney I'm >> Go ahead. >> We're all wanting to talk at once tonight. Um, the attorney did advise us that the best in if when we discussed
postponing it, which I did ask on Monday night's meeting, um, unfortunately, due to the open enrollment, um, if we would postpone it, it would affect the approval of the new contract. >> So, that would cost taxpayer dollars. Thank you very much. >> I'm not proposing a postponement to rehire >> Just turn it >> They should get a chance to >> I think that is fair. >> I can't take it. >> Can I have a roll call on >> Is there any other public comment? >> Yeah, me. So, at the last meeting, I believe or it was at the meeting before, Jeremy you can tell the committee and voted to uh Dave to wait to see what kind of a contract that they came up with. And and I took out of that that he was
happy with what we could do for our teachers. And then tonight, Jeremy and Dave showed again to try to cause controversy for our teachers. >> After receiving the document >> the negotiation committee >> After receiving the contract last night >> the negotiation committee feels like they got a good deal. >> I understand that. >> Okay, then shut up. >> No. I um >> You don't want >> I have a right to say >> I understand that. >> I have a right to say that both parties >> Hang on. >> I appreciate your comment. >> It feels like you got a deal. >> I know you feel that way. >> No, no, I agree with you. The negotiation committee feels that way. And the teachers that voted yeah feel that way. >> 175 >> and I
don't believe they were fully informed when they made that vote. >> Dave, we understand your point. >> I have a number of members that remember >> And therefore, I think they should re-vote. >> Dave, >> or clarify >> I understand your point. Is there any other public comment? >> Save the district millions then re-vote. >> Moving on. >> Motion to table. We need a roll call vote. Mr. David Bradley. >> Yes. >> Ms. Lori Frye. >> No. >> Mr. Jeremy Glauser. >> Although I would like the public to have more time to look at it, I would hate to cost the taxpayers more money, so my answer is no. >> Ms. Denise Harley. >> No, for the same reason. Tax tax dollar cost. >> Mr. William Hallen. >> No. >> Ms. Heather Neth. >> No.
>> Ms. Jody Beers. >> Yes. >> Mr. Timothy Kack. >> I was there. >> Mr. Alex Betica. >> No. >> Your public comments weren't even on the list as opposed to the district >> Motion to table. Can we have a roll call vote for approving the collective bargaining agreement? Ms. Lori Frye. >> Yes. >> Mr. Jeremy Glauser. >> Yes. >> Hopefully we can have this way. So, she had a motion in between. You still got to discuss this motion of the budget, I mean, of the agreement before you take a vote. >> I think >> I have a You got a motion and a second, correct? >> Yes. >> I have discussion. Does anybody else have discussion? Would you like to first about this agreement that was contrived? >> No, that was the next thing.
>> Nobody? >> I guess not, Mr. Bradley. >> Okay, then I'll go. All right. >> You got 3 minutes. >> Why am I limited to the time in which I want to speak? >> Because everybody's tired of listening. >> That's so funny. That's so humorous. I love it. Why do I get limited to 3 minutes? >> Come on, Mr. Bradley. >> I'm just asking a question. Why would a Why would a director limit I'll set the timer. We'll have some fun. I'll set the timer. >> It's already set. It's already running. >> Good for you. Ready to go. Setting the timer. Now. I put a spreadsheet together that that's able to show each step of each employee from year one to year four. If you look at the rates using base year one to base
year four, it's about a 19% increase in a four-year period. They're laughing. But it's on the document. It's because of step movements. The step movements are unfair to our staff because they are arbitrary in their percentages. >> So you voted yes >> Don't argue. I've got my time. >> You voted yes. >> I understand they did. As much as they voted yes in the rush that was created, so was this district's financial future for this. What's the estimate of the total contract? About 12 * 4? 13 * 4? Mr. Bozer? >> It is 52. It's 13 * 13 * 4 is 52. >> Yeah, somewhere around there. 50 plus taxes >> Under 52. >> Yep. Somewhere in that range. >> in the salary >> Yep, in the salary part and then you got the other
part. If we were to give our staff a higher salary in this agreement instead of some of the benefits that we're paying for that we are not consuming and they are not getting the benefit of the benefit to the staff would be higher, the savings to the district would be higher. And the net result would be a more fair relationship between new staff members and existing staff members for lower longevity. Instead of trying to push out the highest paid teachers that have the most experience by giving them a teaser um early retirement rate. I'm less than 3 minutes. Have a nice day. You guys should have had more than 3 minutes to look at this and more than 24 hours. And that spreadsheet is available. I understand you think you know what you looked at,
but when I ask the questions I'm going to go to When I ask the questions of the negotiation committee as to whether or not they had this information, they did not. >> Thank you. Thank you. >> You're welcome. It's all about fairness. Actually, what the high school When Mrs. Parker in second grade taught me math and I can use it. And I love her for it. God rest her soul. >> Is there any more board discussion? >> Mr. Jeremy Glouse? >> Yes. >> Mr. William Halim Halim? >> Yes. >> Ms. Evanette? >> Yes. >> Ms. Denise Hartley? >> Yes. >> Mr. Ed Ayers? >> For the record, I'm totally okay with the contract. I think it's fine, but I'm a no because I don't think today is the right day. >> Mr. David Bradley? >>
I vote no because of the other problems within the contract for fairness to the contract. >> Ms. Lori Frye? >> Yes. >> Mr. Tim Tack? >> Yes. >> Mr. Alex Betica? >> Yes. >> Item 3.1, board comment. >> I know you have item 2.2. >> Oh, I'm so sorry. Item 2.2, discussion of the data breach. Yes. >> I think an investigation is in order. I am concerned about what happened on the district side. >> We all know what Dave did. >> That doesn't need to be investigated. We know what happened on his end. I'm really curious what happened on the district end. >> Well, we also paid money, Joy, to a firm to take care of the redactions, and they didn't have all of them. So, that needs to be investigated. >> They didn't have
>> We we paid a firm to scan the documents to make them more accessible. >> I apologize. >> again. >> I do feel that needs to be investigated and taken care of because I don't like my information out for the world to see it. >> I I agree full investigation and if charges are possible, we'll explain. >> Absolutely. >> I had said earlier, I AM I'M WORKING VERY CLOSELY WITH OUR with our legal counsel and taking every step that we need to take and that we should take to do everything we can to protect the privacy of of staff and individuals. Literally felt nauseous yesterday. I I feel terrible about it today. Uh this should not happen to anybody under any circumstances and for that I am deeply regretful that this occurred. However, there was
certainly no mal-intent on the part of district employees who were doing the redacting and I I have to say there are literally tens of thousands of pages that people have poured through over the last year and a half since I've been here and time before that before I got here. Um somebody said earlier mistakes happen. And and I do believe at this point in time there there there are honestly if you have that many thousands of documents and that many different people working on redactions that unfortunately there are going to be mistakes made. The sheer number of documents that were turned over in compliance with the OOR with the OOR's order. Uh you have to imagine even even a company that was hired to do this would probably have had a small percentage of mistakes.
But I assure you we are doing everything we possibly can in order to figure out how to communicate with all stakeholders, students. I heard you. This is Ms. Dugan, I assume. >> Thanks. >> I'm sorry. >> Hermans? >> Two letters >> Okay. I hear you. The fact that this isn't just about staff uh any student information, knowing that knowing that that could have been breached knowing that it was breached and could have been exposed and garnered for nefarious uh actions uh disturbs me greatly and I think it does everybody in the district regardless of how you how you think this happened regardless of whose fault. At the end of the day, there are literally victims here. And I take this responsibility incredibly seriously. And we will do everything we can from this point forward to
make sure that we right what has occurred. I can only apologize that it happened uh for in the past and make sure that we collectively do what we can to help people protect themselves going forward and from this moment on. >> And Jason, can you make a statement about my efforts in cooperation with you since yesterday when the breach was identified? >> Dave, I will say you communicated with me. You were you did try to find documents. I will say that. I'm going to be fair and objective. >> Thank you. >> Yeah, we love the >> However, I >> Since you're saying that there was no mal-intent within the district why does everyone assume that Dave has mal-intent? >> Because he said >> So he did >> So what like >> Every file has a
word redacted on it. >> Doesn't matter, Dave. >> The rule of law is into your website. Somebody has to upload it. And anyone uploading those documents received that those social security numbers were on it and there should have been a red flag right there. >> I've I've heard everybody else apologize to you, but I have not heard him say it one time. He's also responsible as everybody else. And I believe he needs to resign from THE SCHOOL BOARD. >> YOUR OPINION IS VALUED. NOW, AS FAR as the We did everything we could once we found out that a breach occurred in cooperation with the school district. And whereas it is regrettable that such a thing would happen, uh we just can do everything we can forward for what occurred. As far as As far as
identifying the files, they were provided in public comment and there was no it was not a review of the documents prior to uploading the documents to the website. You did. His team did it. Yeah, my team. Okay, your team didn't see the social security numbers. >> So I have a question for you. What time did you shut down the website? >> Um well, I shut down when you told me and then by the time my guy got there >> At 12:00? >> Uh no, I think it was earlier than that. >> Um >> I don't know about that. >> At 12:30 p.m. I was searching that website. >> Okay. >> So, it was still out there. >> another question for you. >> Sure. >> You claim that the state said they were redacted. >> They
did. >> It was okay to post them. What happens if none of them were redacted and that you were still would have posted them because your >> We had that discussion. >> data said it was redacted. >> No, after the court ordered the release of the documents >> I'm asking you right now about your website. >> required the redactions. >> The Office of Open Records ordered the release. >> And the court did. How was the ticket signed? The court ordered the release. >> that, but I'm asking you why you decided to upload them to your website. >> That's false, Dave. >> Yeah? >> Alex is saying that's false. >> What's false? >> Can you clarify, Alex? >> Yeah, what would you like to clarify? >> It was the Office of Open Records who ordered the
files to be released unredacted. >> Absolutely not. >> Oh, yes, because >> What >> In your words, that's an objective truth. >> So, the the process was It's important, I think, but the process was through through records were requested. The district denied the request. I appealed the request to the Office of Open Records who told the district to release the records, at which point the district would have a period of opportunity to review the records and decide whether redaction was required. >> If they were asked to >> So, on December 10th of 2024, under notes that the district should have filed an appeal over sensitive information. They did not. >> That is not the question I asked. >> When did you ask? >> I asked you. >> How did I clutch up the website then?
>> knew that the records would have been unredacted, even though your little underneath said, "Would you still post it?" >> Absolutely not. >> Heather, can I ask one thing? >> Yeah. >> We know he'll never be mad enough to resign. Can we ask our solicitor, can we make a motion tonight to have HIM REMOVED? >> DAVE, MAY I ASK A QUESTION? >> DID I hear a question from a board member asking about making a motion to remove Mr. Bradley? >> Yes. >> Or censure him. >> No censure. >> There isn't really isn't There There isn't really a mechanism for this type of action for a motion for removal, but the board could censure Mr. Bradley and make a motion for that. >> And what happens with the censure? What does that mean, Dave? >> I
mean, the other thing that we could do is that this is something that if the board is interested in pursuing this, I my recommendation would be that the board decide what what it might want to to do, any action to take, and put it on an agenda for a future meeting. >> Dave, why did you do the right to know in the first place? How did we even get to here? >> Yeah, I don't know if he's here, but I will try to explain it since our treasurer obviously doesn't understand the background. The uh >> Oh, I more than understand the background. Dave, can you do your explaining without insulting fellow board members? >> Yeah, I'm tired of >> Cuz there's no reason to name Paul or insult anybody. It's just inappropriate. You always insult
me. >> Sorry I took it that way. >> You just did it again. >> Yeah, he did just do it again, didn't he? >> He's incapable of being respectful. >> Why is he >> Guys, this is this >> No, because the >> This is obviously not getting us anywhere. >> Public there will be public comment at the end. >> entire situation, why did you do the right thing to the district? >> Because the auditor general found so much discrepancies within the records that we had to find out where the money was going and what was happening within the district when millions of dollars were coming out of the pension fund and going to other things off budget. And I cleaned it up. >> I I do I do want to add here. I mean, there
could be authority to remove an officer of the board under certain circumstances under the the the school code here. But there would have to be some due process. So it wouldn't be something that could happen tonight. Again, this is something that if the board is considering that, I recommend that you take time to think about what you want to do if anything, and then put it on the agenda for a future meeting. >> Thank you, Beth. >> Thank you, Attorney Shore. >> Any other board comment? Okay, hearing none, public comment. >> Can I speak? >> Public We you we'll go in order. I will go through the ones that were submitted and then anybody else will have the opportunity. >> Can I have the floor for >> Dave, please. It's public comment. >> I know,
but I'd like to talk for a second. If anyone has any questions of what was in these documents, they're going to be held at the district and they're going to be able to be searched with the with the software that we created so that they can use it >> Okay. >> to find what they want to find. After we have this issue, thank you. And if they want to help >> Dave, please. It is now public comment. >> I'm I'm trying to help. >> So this is now the beginning of the comments that might be beneficial to you. >> You got to have the information. >> So again, Dave did a right to know for 120,000 documents that cost our district more than $40,000 on top of the six figures on legal lawsuits against our
district in the last 10 years. If you go to the courthouse and you look up the Bradley years, more than uh there's three pages of lawsuits that they've filed. He's won nothing. He still has nothing other than expenses for our district. 120,000 documents. Dave keeps sitting up here at the table saying, "We need to have this sooner. We need to have this sooner. We need to review it." Apparently, Dave did not review 120,000 documents before uploading them and putting these people at risk. I again ask you, Dave, what's your social security number? >> Dave, what's your social security number? >> 120 pages of lawsuits that the school district does against their own people. >> What's your social security number? >> Okay. >> Enjoy your question as a lawyer because you already know why you did
it, but it was already decided that the DA was not going to take a look at the case. It went off to the attorney general, and the attorney general already found that there was nothing that they were going to investigate because it wasn't done intentionally. And again, you come back years later and say, "I want 120,000 documents." >> If you would like my social >> Taking 120 850 hours of their time >> And because Jeremy doesn't know this >> No, you didn't pay them. >> Hold on there. >> And no, you shouldn't expect them to work for >> social security numbers and you want a volunteer to do this? >> No, no. They're salary. >> That's how stupid it's not >> They're salary. >> That's what >> They're salary. They work Saturday and Sunday and
holidays for free. >> Did you pay them? >> No. That's where the $300,000 salary went. >> What's your name? >> Thank you. >> My social security number is on the internet and you can search it. >> Barbuda. >> I'll find it. What is it? >> Look for Jeremy's. It's on the internet. You can find it if you'd like. >> Let's see if we can find him and get him out there. >> All right. Who is against supporting Dave for obvious reasons, right? Everybody knows now. Um Joey stated he was her chaos. She was afraid of a mild-mannered dentist. She needed a protector because of things that occurred on the previous board and how she felt. I'm sorry, Dave. You want everybody to get a chance to review everything, but you didn't bother to review anything
before you put it on the internet. People make mistakes. Jeremy, you have repeatedly made comments and giggled, "Oh, better than $300,000." But $300,000 would have bought a law firm to do all the redaction. >> Can I know that? >> So, this 40 grand I was happy we saved the money, too, but look what happened. People make mistakes. >> Yeah, I understand people make mistakes, but >> It's not this job. >> holding them accountable. It's Did you hold yourself accountable? >> Of course I have, pardon? >> No. >> When it's needed. >> Dave, you have lost I don't know who this we is. It's always we and it's always, you know, uh shadow figures somewhere. Maybe it's you and AI. I have no idea. I don't even care. But if you have lost the respect of
this community and you've taken this district and driven it into the ground again with your antics. Resign. Yes. >> Any other public comment? >> Mrs. Derby had >> Sorry. Um I heard you Monday night and I heard you again tonight talk about your season ticket and your concern. You were not concerned. I've given this district 35 plus years of my heart, blood, sweat, tears, whatever you want to call it. And you took that all away yesterday. You published my social security number, my Ameriprise account number. It's going to cost me more than whatever you were concerned about me getting a raise. And I don't know how the people who put you in here sleep at night. And you know, there's people behind the numbers. There's people behind Look at me. I'm talking. >> I am.
>> There's people behind your grievances with others and just trying to get back at people. And I'm not alone in this. So, think about that. I don't know how some of you sleep at night. >> If you are ON THE PUBLIC >> ALL RIGHT. >> I I STILL HAVE AN ISSUE WITH THIS UPLOADING. >> How many people are on your team? >> Team of eight. >> And you're one of them, I suppose, right? >> Yeah. >> Okay. >> Where is your mouth now? >> How many people? >> Seven people. >> So, you're telling me that you took those papers and physically you have to upload them to your website. >> No? You scan them? >> Nope. >> What did you How did you get them on to the website? >> So, I appreciate that. Good
question. Love to help you. The uh the district handed us 40 or 50 thumb drives with thousands of documents on each thumb drive. And all we did was we took those thumb drives >> and just plugged them in and let them download. >> Right. >> You didn't upload as it was because it comes up on the screen when you're downloading. >> We don't have to download. >> You did not see the names or the social security numbers of >> Thank you for the information. >> anyone that were on that hundred some pages, right? Or whatever. >> 20,000. >> 120,000. >> Correct. >> So, you didn't physically have someone looking at it. >> No, absolutely not. >> Were you aware of the law that was passed in 1974 guarding against any government agency releasing social security
numbers without without the permission of the person that it's assigned to? >> Correct, and that's why it's called a database. >> You were aware of that law? >> Yes. >> And you were in charge of downloading this information? And you were in charge of the team? >> Yeah. >> Okay. >> 100%. And you're 100% responsible for breaking the law. >> 100%. >> You should be put in jail. You destroyed lives. You messed up people's lives. They have to go in and fix things that you and your team screwed up. >> I'm here to help you. >> And you don't even give an apology to them. >> We are HELPING >> YOU'RE DISGUSTING. AND MY FAMILY IS ONE of them. >> I respect that. We are helping in every way we can with our team. >>
Judge Matika, please. >> That's the goal. Because at the end of the day, what happens happened. We need to resolve it. That's how it is. >> You knew about this. You knew it would cause havoc. And you didn't care. >> Judge Matika, please. >> Judge Matika, would you like to speak? >> Thank you, Madam Vice President. I'm only here, regrettably, and I will probably be chastised by the ALPC for being here. I'm here only to clear my name for something that Mr. Bradley continues to reiterate that it was me who ordered that these records be disclosed to him. He knows that's a falsehood. He has the order. He knows that it was the office of open records that directed that these records be turned over to him. He also knows that the December 10th, order
that has been referenced only requires that the school board be subject to sanctions for legal fees, for a fine, and for reimbursement of costs. And nowhere, Mr. Bradley, does it say in there that I ordered these records to be turned over to you. >> I respect that that you've explained >> it that way. >> I did not know that. That you're you're you're Hold on. >> Thank you, Judge Matika. >> Thank you. We can open the court. >> Thank you. Thank you. >> THAT'S WHAT I'M SAYING. >> YOU DIDN'T WIN ANYTHING. >> THANK YOU FOR LETTING ME SPEAK. Um It's really humbling and scary. um to be in this situation. Um I was a student here at the high. So many of you are why I'm here. Cheryl Scavuzzo small Laurie Kemp Once in school,
you just ignited um for me this passion that I knew I needed to be a teacher. Um I didn't know how I was going to get there. My parents worked so hard. We just did have a lot. So with four and sometimes five jobs I was able to get to the university and get my degree. And I was willing to take any job at anywhere just to make that life and fulfill my dreams. I'm sorry. My opportunity to come back for the high ending that was just unheard of at the time. It was so competitive in education. The idea of coming back and working amongst the people who inspired me was a great feeling. Um that was just crazy. I'll never forget the first time I subbed and Mr. Reynolds, Mr. Newberger, I kept calling
them Mr. Reynolds, Mr. I still can't use their first names. Um and it was just surreal to be amongst these educators who really were inspiring to me. And then to get a full-time job here was just so exciting. And so it's just so disheartening that the district who promoted such a future is the one that's jeopardizing the future for me and my kids now. And so my question to the board is is there a possibility to let us know as soon possible um what can be done um to protect us um legally, financially, um but also I would request that you really sincerely look into how to rectify the situation because I don't understand the legal points, but I believe that there's common sense to not put these documents out in the public and as
employee, as a parent of the district, as a taxpayer, we just ask that you would really consider the next couple steps to to solve this problem quickly so that we can all feel safe in the community we work for. >> I think Jason said, I'm sorry. I I think Jason So, first of all, I'm going to thank you for your service and I know it takes a lot to sit there cuz I was sitting there a couple one couple months ago, one or a couple, but anyway. If this is going to take time to sort out, I know Jason is sorting it as quickly as possible. I know that we want to get that information to the people that you know, work breach as soon as possible. Um time frame-wise, I I don't think there's
a specific day or time yet. I think as soon as possible is the best we can provide. Um I I openly say and I said sorry before, but I openly say this is a nauseating situation. I'm with Jason. I work in health care. I've dealt with HIPAA breaches. I can only imagine. So, I understand that an answer today is what we're looking for. Unfortunately, it's going to take some time to figure it all out and I apologize for that, but I just ask everybody here to know that Jason and the legal team and people involved are working on it and we understand the importance of doing it in a timely manner. >> Thank you. This is making me think of I know other organizations that have had data breaches have offered to their um clients
and employees you know, like a a LifeLock, which is paid for by the organization >> Sorry, sorry, you can sign up for free credit monitoring at Experian in the meantime. If you want to do something immediately, it's probably a good idea to to sign up for the Experian free Um I think she's right. I think the district should look into what we can do to provide some kind of paid credit monitoring for everybody involved. And it's also a good idea to go to the district office and take advantage of the fact that you can find out if you were involved in the data breach as well. It's really I mean, you know, you can probably do it on a lunch break or something like that. I mean I agree Well, I understand your miss opinion.
>> What I'm going to ask recommend to Mr. Moser if possible We have no idea what you people are going to be going through yet financially, cost, everything else involved. My recommendation be that if we look as the district and as a class action lawsuit, civil suit against Mr. Bradley independently and since he was so easy to throw his team under the bus the other seven people that may be responsible and maybe he can tell the district attorney their names easily faster than us. >> And their social security. But I think all of you that have filed a legal complaint with the district attorney's office I think and I know a lot of people have been in touch with lawyers and if you're looking to do a class action lawsuit against him personally by all
means feel free to do so. >> This is how it happened. The district put the redacting on the files. And so this gets straightened out. >> What what redacting? >> Like the redacting that we put on every single month of every single bill that comes out of this this organization. That we have another bridge. What if we mess up or either >> It's bills that's not going to have that problem. >> The bills do have it. >> Oh, okay. >> They do. Come over here. You guys know what you have. I mean not saying it has to stop. Just We're all going through a lot here. I don't know. Is that And I'm going to ask Is that something Is that Is that >> posted on the internet that they have to be >> That's
true. >> You would have to You you would have to remove them from the agenda then. >> Yeah. That's what I was going to ask is I think we'd have to remove them. >> And then we would be in the clear. >> the board members can add them or whatever you want to do. I don't really care. Yeah, but then but then public >> I mean go back to hiding them. >> So then the public there's no transparency in that. >> I can answer >> When you get them registration sheets that has every single check, every single company, how much, what we bought. Anybody here wants to say, "Oh, we paid $5,000 at Lowe's. What in the world did we get?" They can call the office and they can get a copy. This is the
way we used to do things. >> Yeah, but that's not the way it works these days. You have to do a right to know for that kind of stuff and it's it's not a >> So the public you have to do a right to know. >> But we're not saying yes, >> I I can answer this question for you. It's the way things work is >> Then we need to hire a company. >> I got a better answer for you and it's way easier and I suggested it 5 years ago. We control our vendors because they are our customers. We can tell them, do not put any of this documentation on those, use student numbers, don't use names, don't use those screen names on these documents because we control them because they are our vendor
and then they will never give us something that needs redaction because just as we have a confidential secretary that opens up the mail that can see things we don't want to have it disclosed. >> But we have to take the blur line off. There's got to be something on there. There's no way a company is going to just say, "Oh, for the height, I'm not going to put their account number or I'm not going to put this up." >> The risk of a data breach could be important. I think we can and we can ask >> We would redact the kids' names. So you're going to get a bill with no name on it? >> It'll be a student number. It'll be a student number. >> This is our order. >> We will look into
it and discuss it at the next meeting. You're welcome. >> Can we stop requesting 120,000 documents? >> Any other public comment? >> Um I I'm just going to sit here but I just want to let you know that I've been with the district since 1992 and for the first 7 years I couldn't even get a job here. Because there were so many substitutes, you know, and they were hiring people that weren't here before me, which was fine. And but in 1999 I finally got hired. But over the years and especially now with this you know, we have to disperse kids in the elementary because we have no substitutes. With shenanigans like this how are we going to attract younger people into this district? How? They They're going to read the paper. They're going to see
what this board is doing. Well, some people on the board, not the whole board, but it's a shame. And when a whole bunch of us retire in, I don't know, 4 to 8 years, what are you going to do for teachers? >> That's the goal of two of us, not having it. >> I I I just >> Thankfully, we've had no problem over the last couple of years attracting new teachers and talent. >> We need to have more on this board, Mr. Glauch. >> But anyway, we uh we have been lucky. While other districts are suffering a teacher shortage, we have not had that problem. And I am >> How do you say that when you're dispersing children at the elementary level? >> I think what Mr. Glauch is We We have been We have
been very very fortunate to attract candidates for full-time positions. I will acknowledge your your your mentioning substitutes. We are We We have a very very difficult time, as do >> I mean, cuz that's how I earned a job here, by substituting and showing that I can be loyal to to the district. >> Offer substitutes more money. Maybe you'll get some. >> We have done that over the last couple of years. We have tried to come into parity with the other districts, but you know, there's It's hard to >> What about the comment? >> Resignation >> I have a motion and a second to adjourn the meeting. >> Social Security number, David. >> So moved. >> Second. >> All those in favor? >> Aye. >> Motion carried. Meeting adjourned at 8:11 p.m.
