001we have three people that have signed up so far for the agenda topics portion excuse me U just make sure you state your first and last name keep your comments to three minutes there will be a time R here for you keep your comments General in nature not directed a specific individual or individuals and suitable language content 12 students also make sure you don't attack any groups either please or any individuals add additional information or perspective and try not to be redundant all right so first up will be Patricia McCoy and I think board members you got something from here already I land that so thank you chairman good evening superintendent Dr Newton chairman Bol and members of the board my name is Patricia McCoy and here we are again the threats and lies told

002by some individuals have delayed the passing of this much needed procurement policy these are the same people people threatening each of you and anyone who tries to speak before you these same people want to convince you that by passing this policy you are limiting the First Amendment rights of students adding more work to teachers and Librarians and that you are preemptively Banning books they love to throw these accusations around to convince you that what you're doing is wrong but the reality is none of this could be further from the truth if you were to listen to their arguments then your very own policies which I have provided you with a copy of currently censors and limits a students First Amendment rights and you are already preemptively Banning content you see on pages 32 and 33

003of the districtwide student parent handbook that each of your high schools hands out every year you have a section that starts on page 32 titled Technology based tools and student internet access at lcsd1 under this section you have a subsection on page 33 titled acceptable use I know you're probably thinking what do this got to do with a book procurement policy but please allow me to explain this section of the policy reads as follows Tech technology Services may not be used to access download store and or distribute any material text graphic photo or audio which is defamatory abusive obscene profane threatening or sexually explicit to the average person under the additional subsection titled clarification of unacceptable computer use it also States appropriate use of computers by students is closely monitored by the classroom teacher and

004District Personnel if a student uses a computer inappropriately he she may face disciplinary action then goes on to give more examples therefore by limiting what students can be allowed to have access to on their school issued iPad and computers according to their arguments you are already in violation of the students First Amendment rights adding more work to teachers and Librarians and you're already preemptively Banning them from these topics but this is how it should be there is a reason these limitations and blocks are in place a child's brain is not capable of processing the overwhelming amount of information being thrown at them online which is why you as a district have rightfully put these blocks in place to limit them from accessing these things yet the library does not have the same filters and barriers

005up to protect students from inappropriate materials being accessed by the student in the book form this procurement policy places the same protections for students when it comes to the books that you have set up in your Technology based tools policy I urge you to continue to listen to parents again vote Yes to pass this procurement policy and put it back out for public comment it is imperative that you protect our children focus on how we can improve their education and again I thank you for your continued work on this matter y next up is George Powers good evening I'm George powers and I'd like to address the procurement policy that you are going to be discussing later this evening I sent you all an email earlier this month call calling attention to the fact that

006under the policy that you adopted regarding sexually explicit books one person this treasurer of the local moms for Liberty has been responsible for almost all of the nominations and all of the um books that you have declared to be sexually explicit that one person has made her values uh this template applicable to every student in this District now you are looking at a dis at a policy that will deal with acquisition the same person be empowered now to overrule the decisions of your professional Librarians your professional staff to acquire books these books will never end up on on the shelves now these books are include things like The Bluest Eye a book by a Nobel prizewinning author one of America's most honored authors yet you will close the doors and prevent those books from being

007on the shelves and accessible to your students that is ridiculous in in a word particularly when you look back on the fact that there have been now three referendums where people have had a chance to talk and to tell you what they think about your ideas about book banss initially and when you originally adopted this policy the public comments ran I think 75 it was three to one against you ignored those and said that wasn't representative in part one of this process which you are about to extend I understand uh the comments again are running 3 to one against your policy and most importantly of all when parents made a decision as to what how they wanted their children to be able to access your library materials the vast majority of parents elected to have

008open access Open Access which you are now going to close when you adopt this policy and go forward with this new procurement policy you will be denying those parents their option of open access to their children I urge you to stop this whole process thank you thank you next up is K Rene hi everyone my name is Kaye ream I would like to express my support for the procurement policy although I appreciate that the error was found I don't feel strongly either way about keeping the comments or not keeping the comments as was pointed out previously it is not a public vote and the comments are only for the board's consideration either way the policy is important and should be passed the policy details that there will be procedures for procurement that will help a

009librarian determine if a book is sexually explicit I don't understand why incorporating the board's policy into their current procedures would not work the policy I believe the policy is written in such a way that allows our qualified Librarians to make meaningful determinations with the tools available to them while still understanding that this will be done to the best of their ability and they may not get it right 100% of the time this policy is not to punish Librarians but is a way to stop the of money staff time and the resources on book reviews that will be used if the district continues to allow sexually explicit books in the door I also wanted to address the issue of book Banning as I have many other times if books uh if a book is still accessible

010to the public I would argue it is not a baned book as the board may already be aware there has been a local effort to purchase and provide sexually explicit books with private funds this is exactly how it should be done if parents want their kids reading these books it shows that books are still easily accessible and can be read without using taxpayer funding to do so if you are a board member who has received a postcard I applaud your efforts to protect our children I also want to speak on the process of allowing for public comment in general not only during the 45-day review of policies but also allowing us to stand here and speak to you I feel that teachers and School staff should feel comfortable speaking to you and not fear for

011their job in the same way the public should be allowed to speak their mind in meetings like this without fear of being publicly ridiculed and without fear of groups harassing them we all have different opinions here and we can disagree while still being respectful the board deserves to hear everyone's opinions private citizens should not be bullied into thinking they can't speak their mind to the board it does not make sense to me that those arguing for people to read freely would discourage people and public comment and not allow others to speak freely by using intimidation thank you thank you that's all the people that have signed up in advance to anybody else here who would like to speak and if you're online and you'd like to speak would you please raise your hand Mr chairman

012there are no hands raised online okay so we end that part of the meeting and we'll go on to board Communications and reports upcoming meetings July 15 6m will be a regular board meeting and budget hearing in the boardroom July 24th and 25th 2024 11: a. is the challenge Rodeo CH Frontier Days Rodeo Arena which is always a very special event and August 5th 2024 yeah have 5:00 P PM work session 6 PM regular report meeting uh next we have individual board Communications and reports any anybody have any reports go ahead Mr ban I'll just um note that we're all excited that trusty Humphrey's here with her new addition and just congratulations and he's very good in the earlier meeting we had today and he's been very good so far so maybe good board member

013for the Future Okay um let's see is on is she I think she has okay looks like that's it for that so reports from superintendent and staff thank you chairman Bolan just a a few items um as you are probably well aware our summer school is underway and um with Session One running from June 10th uh to June 26th and the second session from July 1st to July 18th I'm pleased to report that we roughly speaking have about 886 element k6 students who are attending um getting some extra help and just over 400 about 413 7th through 12th graders who are also getting some summer Help U you may have heard that there are summer feeding program um is is uh in conjunction with that summer school and as I just reviewed the numbers looks

014like we have about 10 different feeding sites and we're roughly serving about 495 breakfasts and about 960 lunches uh per day during the the summer school so um I'm sure that's benefiting those who are taking advantage of that greatly are we charging for those uh well it depends if these um if they're sites that are eligible for um the sfsp program which means that the school has at least 50% of the students on free and reduced lunches um then the USD reimburses for those um for the sites that don't fall under that um then students that are on free and reduced lunch continue to have the free or reduced lunch um but those who are paying students pay for theirs um so um great uh great opportunities for our kids as they're learning a lot

015um couple other items there is an agenda item uh D 3.3 which is the approval of of Administrators and um one of them was uh listed as the business services administrator that may just be our fancy way of saying Brian harmson and so um Brian's position in purchasing Brian is riding off into the sunset so in addition to sharing that that's the actual job that we are filling U with the appointment tonight um I also did want to take the opportunity um talk about work to the last minute Brian is here with us tonight after 14 years of service uh to our district and um and I believe Friday will be Brian's last day if I'm correct so Brian from all of us a very special thank you for your many many years of diligent

016service and one last item uh the Chamber of Commerce at their yearly meeting had a a special presentation for a teacher of the year and a student of the year so I'm very pleased uh to report that at the chamber uh I think it was last Friday at their at their get together they honored Miss Marty daringer from goens as the teacher of the year and South High School student key Henderson as the student of the year so we couldn't be more proud of those two and a special thank you to the chamber for acknowledging the work that our teachers and students do so with that Mr chair that's the end my reports okay so we'll now move into the consent agenda all items listed with the designation of CA are considered to be routine

017items by the governing body will be enacted by one motion there'll be no separate discussion on these items any item removed from the consent agenda will be considered in as normal sequence on the agenda does any board member request to remove a motion from the consent agenda Mr chairman I move to approve all motions listed as consent agenda I second have motion second to approve all the consent agenda items all those in favor say I I those oppos no motion passes joined us now okay now we're going to be going down to new business Mr chairman I move to approve the amendments to board policies chapter 9 section 16 parental rights and education and chapter 2 Section 10 complaint procedure for violations of chapter 9 section 16 as reflected in the attached proposed amendments here

018to and made a part hereof by this reference I second okay have motion a second to approve the changes to um or policies chapter 9 section 16 um any further discussion go ahead Mr chair I um wanted first off thank you to miss Paulie and I believe the Wyoming School boards Association attorneys over there working on this um I think uh we all know this but the public may not know that we're considering tonight a draft proposal um because there was legislation that was enacted this last legislature um requiring notification of certain certain changes for students um by school districts to notification to their folks to their parents or their Guardians um and I was looking over this language and I spoke to miss Paulie about it and I think that um I'd like to

019propose an amendment to the definition of change all the board members have seen my Amendment but I'll read it aloud um I would like to move to amend the draft policy language in chapter 9 section 16 by adding a new criteria for a change in a student's educational physical mental or emotional health or well-being as follows on page three in the definition of change insert uh number six and that would involve a request by the student to be called a name different from the name or nickname field approved by the parent in The District student information system so that's my um proposed amendment you have a second a second okay have a motion a second to amend the changes to board policy any fur the discussion so I'm just I know we've had ongoing conversation

020about this good bad or otherwise this feels like a big enough change it's adding a piece that is very talked about if you will is this not require us to go back out it feels like a significant change to me uh chairman Bolan uh trusty Ashby so again when we look at what changes would require um a a second 45-day public comment period you're looking at whether or not this would be a logical outgrowth of what the the original um notice to the public provided so that notice provided that there would be definitions for change this is adding to a a an additional definition um related to um a desire to to go by a name other than um that prop that is already in um the student LA or record system um I think

021it's sort of um I I can see that that is significant um it it wasn't one that was there before um but again we're just adding um an additional requirement we've already said that we are going to Define What A Change Is and so you're just um including additional language for that change we didn't specifically go into what the change requires and I think that it fits into the intent of um the legislation of a change in the social emotional educational um well-being um or health of the student trying to remember all of the categories that were Inc incorporated in that having said that um what the board could do at this point if the amendment goes through um you know you do have an emergency rules Pro procedure um that would allow you to

022adopt the rules that they would then go into an effect for 120-day period during that 120-day period you're still complying with the legislation that requires you to have this adopted by July 1 um you've adop you're adopting it on an emergency basis and then you could go out for a second 45-day public comment period to um provide notice that instead of the five originally proposed there would be a sixth um definition of change so if if I think the cautious approach to provide as much um public notice would be to probably go that route again you would have this I'm shouldn't do math on the fly but 45 days is going to put you um at August 9th um so you're you could still have all of the definitions in place prior to the beginning

023of the school year if you go that route so you would still have and again those would be um implemented on an emergency basis um for that 120-day period which takes you past the beginning of the school year anyway so I'm not sure that that directly answers the question I think you know is it a logical outgrowth of what was proposed um if you want to be exercise caution and give as much um public notice um I think the emergency route on the rules and then um formal adoption of uh any proposed changes at the August whichever meeting comes in right before so can I clarify you would suggest we pass them as emergency rules evening and put them immediately back out correct so your August meeting uh sorry Mr uh chair trusty Ashby so

024your your August meeting is going to be on August 19th um which is just right before the beginning of the school year so you could still have these in effect um on a permanent basis again that 120-day emergency rule provision would cover you out about three months four months should there be addition ches um Miss p i I'm sorry my computer totally crashed a second ago and so I was trying to pull up the public comments that we received on the parental rights policy um I believe there were some public comments suggesting I mean along the lines of what trusty clawson's amendment was so knowing that could would this be a logical outgrowth of those public comments received and then we actually are it it could be considered a logical outgrowth Mr chair truste Smith

025I think you know I going back and looking through we didn't didn't receive as many um public comments on this as we have on previous uh policies that the board has been considering um but there were comments that did address um similar um provisions and and kind of requesting that um language to this effect would be put into the policy um so I think at least some may have anticipated that that would be a potential change that that would come of this policy so this might be a logical outg out of that public comment I mean those those comments that we received thank you right okay thank you yes chair thank you um I think we should probably just make it clear for U the general public that the reason we have to consider doing

026an emergency passing of these rules is because they're required by the legislature that we get these completed so that's why it would be a we wouldn't just put it out for another 45 day review without doing some kind of adopting because we have to adopt these rules um at this point um I yes there were a couple of comments made by the public about this and I think um there have been some uh news articles um in the uh State um over the last few months uh last month or so at least um about um legislators um feeling like the school boards in other places have not gone far enough about what their intent was um for this rule um but I agree with um trusty Ashby that um if we were to add this

027in obviously I disagree with adding it in I think um it's a violation of of kids rights but that's neither here nor there um if we were to add this in I think uh it deserves to go back after public review because other than the people who recommended it through the public uh review process other people have not seen it and it and it is a change um and so I do think for transparency's sake we should put it back out for review If This Were to be adopted anybody else Ed do you have any questions she on I think she voted last time think she's on so I I just would you know in terms of my comments or thoughts as a parent if if my children were were I mean I I just

028like to be informed about what's going on in their world and if they have chosen to to to her Amendment um to go by a different name even my youngest when he was little decided he was going to be called Teddy and we called him Teddy for a long time but that would have been even for a four or five-year-old would have been an important thing for me as a mom to know that my child preferred to go by Teddy um so I I don't think that asking the schools to inform parent when parents when there is a significant change including a name change um asking the schools to to let parents know that I I just don't know why it's a problem to keep our parents informed so I'm I'm in support of the

029amendment okay any further comments yes I also want to clarify Mr chair that you know we we've had a few problems with um folks reading the roster of their class and and not calling a student by their preferred name and this is one way to clear that up our system allows for us to add a preferred name and um I think this is just a opportunity for us to clear that up and allow for it so um I definitely think that it could be looked at from a different perspective I guess I have a question um on the system does it when you have a role is it going to show that nickname Mr chair I Believe Miss Paulie has discussed the technical capabilities of infinite campus in that regard sure um Mr chair so

030within Infinite Campus there is a nickname field um that field can be filled out during um registration by the parent after registration closes it's um limited it's all of the information that's within this the person kind of section um that's limited to only be changed by um a records Clerk um or or the building administrator so that is information that's already you a parent can already choose to fill out as far as the class roster goes um there is a way for um the class roster to include it it shows up in parentheses behind the the students name so um if Stephen Newton goes by Steve it would say Stephen Newton and then in parenthesis Steve so that does help clarify um it you know if you're if you have a nickname or a preferred

031name um that your parent has entered into Infinite Campus um and that's what you would want to be called that then would appear we can have that that box selected as essentially for the roster um when the that's printed out for substitutes or for for teachers in general so it's currently not being done correct um Mr chair it's uh it's kind of discretionary at the school it's who it's whoever happens to print it if they select the nickname it gets printed with the nickname if they don't select nickname it doesn't get printed and so that would be just sort of a an standard operating procedure that we would Implement um that that box will be checked and that list will print with the the nickname um and parentheses besides the students given name and I'm

032assuming that can also be done for when you print a seating chart with name with names and pictures on it uh Mr chair so there are some systems that we use so when we're at in Infinite Campus um we know that we can do it there are some systems that infinet campus communicates with um where we have to look into that a little bit more um and that is uh Mr McKinny and Sarah lucero's area of expertise not mine um Miss lucero's been incredibly helpful trying to figure out a lot of these pieces on the the technology portion of how we notify parents and what what we can do with an infinite campus to um kind of streamline this process but Mr McKinny may know that answer we might have to get back to when

033when I can visit with Miss lero further I'm sorry what was the question uh the question one of the options you can do as a teacher is you can print a seating chart the seaing chart has the student's name on above it a picture that's always very helpful for the sub students so that they don't try to switch seats on you I just wondered whether the n show up there as well Mr chairman I do not know the answer to that question um I know it's used quite frequently through the system so I wouldn't be surprised if it shows up on that as well um but I I couldn't confirm it we' have to check okay thank you appreciate that all right any person discussion okay so what we're doing right now is voting on

034the amendment Mr chairman uh Susan had her hand raised oh I'm sorry okay go ahead Susan I'm sorry thank you chairman Bolan I would just like to say that I think this proposed amendment clarifies things up from a teachers perspective I think it's a good idea thank it any other comments I missed okay so we're again we're voting on the amendment so all those in favor of the amendment to add the number six there um which is talking about changing name say I I I okay so can I see Hands I can quite tell how many there were one two three four okay those opposed okay so motion passes so we now have it amended okay is there any other motion so Mr chair yes so what I might recommend at this point um given

035that it seems like there's at least some a split on whether or not that would be um a logical outgrowth again you have the emergency rules procedure that is available to you that will put this into effect you are in compliance with the legislation that requires you to adopt a policy by July 1 um and you know just to exercise caution so that you know someone can't come and challenge um the rule and and we start back at scare one you know sometime down the road um it might be um a prudent exercise to go ahead and and adopt these on an emergency basis and put them out for an additional 45 day comment with the proposed amendment included so do we need a motion for that yes Mr chair okay does anybody want to

036make a motion to do that okay Mr chairman I'd be happy to make the motion that we adopt this as an emergency Rule and put it out for a 45 day comment period due to a fairly significant change to the policy okay do you have a second I'll second okay we have a motion a second to change this to an emergency author emergency change for 120 days and then I assume sometime in the 120 period we have to vote on it again to make it permanent uh Mr chair that would be correct so you would need to both adopt it as an emergency rule um put it out for an additional 45-day period and when that 45 day period lapses which would be um early August you could then vote on it um to formally

037adopt it on a permanent basis at your August 19th meeting so that would be two separate motions we get this one to take care of first then we'll put it out for for Dew okay everybody understand what we're voting on now and does anybody have any additional comments okay all those in favor of putting this out as an emergency rule say I I hi okay so we have sounds like let's put hands up okay so sounds like we had okay so we have four okay so those opposed I okay so motion passes so we're now going to put this out for emergency 120 days um temporary thing and then we will come back and vote on it again now we need another motion if we want to put it out for 45 day review again

038yes Shar can I ask a question before we do that okay you at one point in time there was concerns from the board in general that there may need to be other adopt or other changes before we put it back out for 45 day review does there need to be anything else done to it if Mr chair that's that's why I didn't vote for it originally to go out for public comment because we got it on a Friday afternoon and we had to take it up on Monday I saw it Monday morning and I just had didn't have time to even think about it um but I was um you know I in the time that it's been out for public review and then I saw the comments that we got back and I read

039them um and I can't I proposed this amendment and I appreciate those who supported it but I do feel that is a valid point and we we're supposed to be prepared tonight for any additional work to be done on it I guess I'm just at this point expressing sort of like why aren't we ready to do this okay so does anybody want to do a motion to put it up for 45 day review I'll move to put it out for 45 day review okay I'll second okay motion second to put it out for 45 review any further discussion I'm putting it out 45 review yes um Miss paully can you just explain would do we need to pass it under these emergency procedures and then put it out for 45-day review I'm a little confused

040about what we're doing here uh sure Mr chair uh trusty Smith so I excuse me so it's it will be out for the 120 days on an emergency basis so that will be the policy that's in effect for approximately the next four months you don't have to put it out for another 45-day review now if you want it to be permanent before the start of the the school year this is about this is the last chance to get that done if the board would like to consider additional amendments to the policy um you're absolutely free to do that um and bring them forward even at the next um July meeting that just pushes out the formal adoption but again this would be you would be starting the school year under the emergency rule um and

041then implementing a permanent rule sometime September is before you would get your your permanent rule in place that okay other comments okay so we're voting now on whether to put it out for 45 it's already been approved to be an emergency um change so we're putting we're now voting whether it goes out for 45 day review under the 20 days 120 days of the emergency rule is that clear no uh Mr CH thank you I have a question then so if we didn't vote for it to go out for 45 day review we'd be under the emergency rules as amended tonight and then what happens um Mr chair trusty Clon so your emergency rules would be in place for 120 days and statute does allow you to reup them for an additional 12 20 so

042that's that means that we would be operating under this rule as amended for the next 120 potentially 2040 days while the board considers additional changes that it may want to make um once you do decide and V and vote again so you would need to vote bring this back um to put out for an additional 45-day period including any additional changes that you would like to make to the policy um before you could vote on it again so um you know you can you're you're in compliance with the statute you will have a policy in place um by July 1 which is your deadline sagittally um changes can be made at any time during that 120-day period if we get to the point where we're pushing it out too far you can um reup for

043essentially another 120-day period so you can be operating under emergency rules for a significant period of time before you have to make the permanence thank you for that any further comments clarify at this point it has to go out for 45 day review and for final approval because of our vote too Mr chair uh trusty Smith because because of the amendment um I would recommend putting it out for an additional 45-day public review I think that was the reason we're going with it to be an emergency otherwise you could have just okay it that way so clarifying okay so now we're voting on whether we wanted to go out for 45 day review all those in favor say I I those oppose no all right so we've got that one all clarified now we're on

044to b3.2 Mr chairman oh yes I'm sorry H thank you before we um get to the next um um D 3.2 I would like to U make a motion to table the entire procurement policy as um requested by multiple people during our public policy comment that that was the appropriate thing to do and I agree with them that tabling the entire procurement policy change um is appropriate due to the fact that I I honestly do believe that if we based on sexually explicit definition that this board has adopted that we will be banning books from from students so I would move that we table the entire procurement policy change let me ask for a point of clarification should we should we move it first before we do the tabling of it um Mr chair yeah

045I I think it's appropriate to uh move it you need a second and it's a non-debatable motion I mean do the tabling now and instead of moving the motion correct yeah okay so we do that before we do the regular motion correct okay so we have a motion to table we have a second I'll second it okay so we're voting on whether to table um D 3.2 which the approval of additional 45 day um review process for the library procurement process actually no it's it's and you just have to take a vote we're tbling the entire Amendment right uh Mr sherff so you would be tling um the uh putting out the 45 putting out the library procurement language out for 45 day public review so you be tbling that motion so that doesn't that's

046just the 45 so we do that may me another motion that may be necessary then after that right I don't think that's chman my motion is to table the entire change to can we do that at this point tbling it means you're doing with a motion that's already been made correct or that's on the agenda correct Mr I it would be a motion that's already on the agenda which you're your motion at this point is to put it out for 45-day review uh tabling it does essentially have the effect of of um stopping the entire procurement policy at this point because you won't have it you have to have a 45-day public review prior to uh you formally adopting it so I think the tabling the motion to to put it out for 45 day

047does essentially stop the procurement policy from moving forward in in any okay everybody understand what we're voting on it's not not debatable so all those in favor of tabling motion 3.2 say I hi hi those oppos no no no and I see the hands on the nose two three four okay all right so motion fails okay so now D 3.2 Mr chairman I move to approve placing the proposed amendments to chapter 7 section 21 library media Services related to the procurement of new library materials out for an additional 45-day public comment period i further move to allow for the consideration of the initial public comments on the proposed revisions which were submitted from April 8th to May 23rd 2024 when the board takes final action on the proposed revisions at its august 19 2024 meeting
