all right thank you so much um and thank you to these three that came here tonight and and then just a big thank you to all of the tech review committee members and also to all the parents and staff that had an invested interest in this have reached out to us reach out to board members reach out to principals and express their feelings and concerns and know that they're heard and we're doing our best to address those so thank you very much moving forward our work is not done supplemental materials in the teacher's manual are being routinely reviewed staff and parent requests will continue to be reviewed and looked at closely and the ela department will continue to foster and develop access points for staff and families to stay involved in literacy in our district
the work of the committee has set a high standard for curricular review and stakeholder involvement across all content areas for the future as we look at our next steps as we conclude this wonderful process and think about where we go next we are establishing a district ela standards committee made up of educators from across the district to closely look at our comprehensive core reading program the purpose of this is to align essential standards with each module of this program align standards for grading and reporting purposes to streamline those efforts for families and for teachers and to also continue to look at our district-wide assessments at their alignment and their credibility as we move forward and with that dr cresco madam chair members of the board thank you for your time and entertain any questions any
questions yes that's awesome go ahead thank you madam chair um thank you miss dicksol and mr jackson and everyone who presented tonight on their experience i appreciate that um i i know i'm a parent too and that's why i sit here on this board because of my interest in being involved and i know that we heard last year at the beginning of the year when we adopted our new k-6 reading curriculum a lot of concerns about what was in the books and and in particular there were there were particular examples of concerns and i know my my elementary student came home and as is her practice was reading me her new book in the fall as i was cooking dinner and and there wasn't a whoa moment like what what did you just read and
it was a situation where the student or the child in the book contemplated murdering a family and you know that that kind of caught my attention because that that's not my values um so i would love to know i know there were other examples and that's just one but um i i really appreciate because i know number of the board members we brought up this concern of what are in what are in these books and can we find out more about how to address certain issues without throwing the baby out with the bathwater and so i appreciate dr crespo's leadership on this and your work on this and all the folks that got involved to go through these books and have this book review at our request very much appreciate that and to um to
ask my question i'm wondering about um if there is a book like the one that i experienced with my student and we'd like to find out personally as a family if that book is still out there or if that book has been modified how does one go about looking that up thank you for that question madam chair um that's a that that's a great point and we have that information publicly available on the district website so by grade level every test um and every decision that was made including whether or not that book was sent to the curriculum committee from the general text review committee is publicly available yes okay so if if a parent were to see a book like that that was not modified or removed if that's the case um they could
still how could they how could they have input if they were not invited to be part of the committee absolutely um thank you for thank you for the question trustee um you know so as we as we look at this process moving forward our curriculum committee will continue to be in place as an access point for parents to express concerns um that's best done for the teacher and the principal as always however we want that access point to continue to exist and so we always invite that feedback and welcome you to bring those concerns to us and we always welcome the discussion mr jackson yeah katie covered it but um the best way to do that is for the public just to directly email us either katie or myself then we take those back those
concerns back to the review committee for further consideration hey yes mr smith go ahead thank you madam chair um thank you miss dykstra for your presentation and to those of you from the district and the parent who shared about your experiences on the review committee this has been something i'm very i'm just thrilled that we had an update tonight because i've been wondering how it's going and and what's been what's happening um i just had just a few questions for you what my first question actually just answered about the status of those 34 books that have been revered i'm sorry referred to the review committee um so i'll look at the website and get my answers there and would encourage i'm sure there are folks in the audience who maybe have that same question so
i will probably get a lot of hits on that website today and tomorrow um [Music] another question i had um what are we is there a standardized process as a district or for the for the individual elementary schools to send out information to parents um before a child begins a unit i know that actually just this morning and i googled um a certain quarters i'm if third grade i actually googled fourth quarter but it was third quarter i pulled up all of the information on what my third grader will be looking at this quarter um i hadn't received that from the school do we are we supposed to be sharing that information or is there a way that parents don't have to google that to know what their kids are doing through this program absolutely
um one of the things to recognize i'm sorry madam chairs members trustee smith one of the things that we have to recognize as a first year rollout we are not on the pace of one module per quarter we wanted to give the grades to our teachers to experience this i mean it is a massive lift for our teachers and our principals as they navigate a brand new comprehensive core reading program and so many of the teachers may not be in the fourth module yet and we gave them the permission that that's okay this year obviously next year we're going to look at the pacing guide and kind of pick that up because they're going to know the program they're going to know what to expect and so we should get a little bit more efficient
with that to directly answer your question at the beginning of every module module every teacher should be sending home to parents a module overview that includes all the text titles on some helpful advice and hints for parents and certainly we encourage folks to contact their teachers if they have further questions okay thank you and then man i'm sure i just had one more question if that's okay um you know i actually i had this question earlier tonight i'm listening to the folks from our military who are here um talking about the discrimination that kids of military families are experiencing um and if hearing you broke my heart um [Music] but i i one of you referenced a word that we just don't say um starts with an n and it's a word that it was
in across the pages of a book in the second grade curriculum so i'd i'll look at the website to see what's happened with that book and i'm anxious to know but if i as a parent know that book is coming and i as a parent don't want my child to see that word is there an opt-out is there is there anything that i can do to advocate for my child so that they are not exposed to that in our classroom absolutely uh we have a process that's clearly defined both in board policy and then we have some internal processes for a parent to voice our concern to the teacher and then to the principal uh and then even to the district level where katie gets involved and we support uh our parents out as a
matter of fact this year we've had i think maybe about 10 10 concerns from parents um anything from a kiddo who might have lost a parent and and the book might have brought up some some tough feelings to what you're talking about and the parents can follow that process we're very very sensitive to those things and we absolutely want to work with parents to make those modifications that a parent feels their child needs absolutely thank you any other questions thank you so much appreciate uh great presentation thank you and i just want to say one more time thank you to katie and to the team that she led really just a stand-up job and really to the parents and the staff that helped out with this really truly outstanding and i'm here to tell you
the work has just begun we will continue the processes we'll continue to include parents and staff in the decision making process so thank you very much katie and to the team and thank you guys for speaking tonight thank you madam chair that concludes our update for tonight okay thank you very much now consent agenda all agenda items will be uh are listed with the designation of ca and are considered to be routine items by the governing body and will be enacted by one motion there will be no separate discussion on these items any item removed from the consent agenda will be considered in its normal sequence on the agenda so at this time does any board member request to remove a motion from the consent agenda thing nine madam chair i move to approve all
motions listed as consent second all those in favor say aye i said then agenda is adopted we're moving on to new business um madam chair i moved to approve a contract with elko fencing company incorporated for fencing at various sites in an amount not to exceed plus a 10 contingency to be included in the project budget second for the motion are there any questions or discussion seeing none all those in favor of emotion to approve a contract for fencing at various sites say aye aye opposed opposed no that motion is adopted now the chair i moved to approve a permanent utility easement with the city of cheyenne board of public utilities at the coyote ridge elementary school site second any discussion seeing none all those in favor of the emotion for permission to approve a
utility easement agreement at coyote ridge elementary school please say aye aye opposed no motion is adopted madam chair i move to approve a leave of absence for the attached list for the 2022-2023 contract here second any discussion seeing none all this in favor of the motion to approve various leaves of absence please say aye aye opposed no motion is [Music] madam chair i move to approve a resolution from the laramie county school district number one board of trustees second we've heard the motion um i think that uh uh is it going to be put up on the ball and uh it's gonna be projected okay so we apologize for the technical difficulties so we're going to share it biozoom and i'm wondering if it's appropriate this time to read it okay should i do that
or mr clerk okay so the uh it's entitled resolution supporting cheyenne city ordinance prohibiting harassment and threats against others whereas laramie county school district one and board board of trustees is committed to providing all students and staff a high quality and safe learning environment where all are treated with kindness dignity dignity and respect and whereas our community and schools have recently received a significant increase in reports of intimidation harassment and negative behavior in regard to race and color and the business and city government of i'm sorry the city yeah the business and city government of cheyenne have condemned that behavior and whereas actions and speech that threaten intimidate and harass do harm to lcsd-1 students and staff and their ability to teach and learn in a safe education environment and whereas the cheyenne city council
has responded to increasing reports of intimidation harassment and credible threats of violence by passing an ordinance that prohibits such actions against persons based on their race color religion ancestry sex sexual orientation gender identity gender expression national origin disability or political affiliation and prohibited behavior includes one assault battery assault and battery of another person two damage destruction vandalizing debasement trespass upon or theft of any real or personal property of another person or three threat by word or act to do any prohibited acts if there is reasonable cause to believe that such act will occur the result that lcsd-1 board of trustees joined with city government civic and religious groups civil rights organizations business community and others in cheyenne to support policies practices and ordinances that prohibit activity or speech that maliciously and intentionally intimidates harasses or
threatens others and also therefore lcsd1 and trustees reaffirmed their commitment to enforcing policies and procedures to ensure activities and speech on district property or during district sponsored events maintain a safe and quality learning environment of dignity kindness and respect for all so there that is the as it the ordinance and the resolution as it was written and submitted to the board to support what the city has done in other groups as they are concerned about this um and is there any discussion at this time oh i'm sorry again well i smith there might be a lot of discussion so i don't have to go first but i um and i may have more discussion so i'll just apologize for that up front but um i let me just start by saying so the members of
our military i'm sorry that the families that are part of our military that their kids are experiencing this or some have experienced this in our schools i grew up in military brat my dad retired from matthew warren my brother was a pilot in the air force my son's attending a naval academy starting next year maybe maybe west point actually is still deciding but we um i'm from a military background i grew up with very dear friends who were also military brats who were from different different races and different backgrounds and and i know that as a as a military unit i'm you're a family and i um i i'm just heartbroken to hear what you've shared tonight and i we've got to do something about that it's not okay i but it's that said it's
it's not okay for any child um to to experience discrimination and bullying because of the the color of their skin it goes much further than the color of their skin but i i just as a board member i want to apologize to you and aren't you to the families that you represent that their kids have experienced us in our schools it's just not okay it's never okay um so i start by saying that um i'm i'm a little concerned about this discussion tonight we um we received the first resolution on friday to review on friday i don't i was on the east coast i don't know what time it came in but it was easter weekend um which for our family is a big deal but anyway so we prepared and we we reviewed that
and i had some notes um i didn't i i was contacted by a lot of people actually who said what is this i mean obviously some people knew what we were doing tonight many people in our community had no idea what we were discussing um with this resolution that's troubling to me um i believe that probably most of those people's hearts would hurt like my heart hurt tonight to to know and to hear firsthand exactly why we're here and why we're having these conversations um but you know at 3 30 this afternoon i was in a meeting for work and left that meeting about 4 15 and has happened to look at my phone and there's a new version of this resolution we're voting on tonight so between 4 15 and when i had to
be here at five i had to drive from downtown up to my house out east and back downtown that's 40 minutes of driving i had literally five minutes to to look at what's in front of us tonight and i um maybe my colleagues appear to not experience that short very short time frame to to look at this but i honestly i'm just not comfortable voting on a resolution that i have given that much attention to because this this is important this is really important and we need to do it right and i get that it's just a resolution and it's not binding and it doesn't accept policy it doesn't you know apparently do much other than we just we we make a an official statement but if i'm going to put my name behind them
i really would like a little more time to process through what it says and to to look at the content now i said i might weigh in several times because i did um earlier when i should have been paying better attention on other things review a few areas of this that i have you know i would like to have some discussion about um so i don't know if you want me to just like say it all now or if we if i'll just chime in in a little bit but i um i'm glad that we are doing this i'm glad that we're going to make a statement but i just in good conscience i really have trouble voting on something that i have had like almost zero time to work my way through um okay
and if and it may come to um you may want to make a motion later on in the discussion um but and i i guess so just i guess are there some initial any initial comments before we start working it in detail yes first of all um i would agree with what she just said i didn't see this until my fellow board members said we have a version three here i never saw version two at all i haven't seen that at all i saw version one i thoroughly went through that i made some suggestions a couple of minor changes on that i really agree with everything that was in version one i think this version three and i've only had a very cursory time to read it right before the board meeting started but um
i get to feeling there though it's we're saying we're doing this only because the city did it first i don't think that's right i mean we have been taking positive actions in this field for a long time over the last several years and so we're not doing it just because the city has done it we're doing it on behalf of our students and i think that's that's not a good tone to be taking we're doing just because of the city path ordinance so i don't like version three so again i think we need to take more time to look this over and uh i would certainly be willing to go back to version one which we've all had a chance to look at and take some action on that night but i would not be
willing to go on to any other version without having more time to looking over yes mr wheat is fine now i'm sure thank you uh just a couple of comments and i guess i would have to reiterate what my colleagues have talked about except from some of the members of the public who commented about how do you really expect me to opine on a document i haven't had a chance to read i don't disagree with that okay so but the but the good side of that is this is not and or this is this is a resolution it's not anything that's legally binding but but still i think we could be a little bit more transparent in this regard i didn't see the final version until later today i think it was a little bit
before 4 15 but but having said that i i don't see anything in this document of version 3 that i disagree with the lady that spoke that i used to be an elementary principal i know that violence does occur in schools sometimes we don't condone it and we don't encourage students to behave that way but it does sometimes occur it doesn't make it right but i but the very thing that she's concerned about is covered in this resolution thread by word or act to do any prohibited act if there is reasonable cause to believe that such act will occur she was afraid for her children that's what moms do and i'm sympathetic to that i think that should never occur in our schools okay if we go back to what the city of cheyenne has
done i watch having been a former council member i i watch what city council does i knew mayor collins when he was a regular person and i think we're lucky to have him as a mayor by the way but i don't you know i think the city council had a lot of courage bringing this forward i applaud them for what they've done i extend my apologies to the members of our military community that have experienced this kind of blatant racism discrimination in our schools and we can't if we can't forget other groups too it's not just the military community it's just regular people who are not in the military who have experienced these kinds of behaviors and by any one standard that i'm aware of this is just wrong and we should not have this
occurring in our schools and we should be incensed by what's happening here if i were on my children if they were treated like this because of some lifestyle that they chose or the color of their skin or the way they wore their hair we're better than this we have to be better than this so if our if our board decides that they want to put this off that's fine and vote on it later i have no objection to that i'm ready to vote on it tonight because i see nothing in version 3 that i object to [Music] but i think if some of the members of our community would like a little bit more time to digest this come back and give an informed opinion maybe we should give them that opportunity i think the
reason why that hasn't happened is because we were you know like my colleagues have said we've drafted a couple of different versions of this and we really couldn't put it out if it was just a draft document and we hadn't even decided on what it was going to look like in the final version but i do understand people that come to the board meeting and say don't expect me to vote on something that i haven't had or opined on something that i have not had a chance to read so i do respect that and i do understand that so for me this has been a hard discussion and cheyenne is my hometown i was born and raised here lived here most of my life we are better than this when members of our military community
have to come and talk to us about how their members children are being treated in our schools and it's not good it's a it's a total embarrassment to me as a board member i know we are better than that and i think we can get this fixed so madam chair that's all i have to say thank you thank you anyone else want to yes yes mrs marguerite i'm sorry i had my hand raised when i'm sorry i couldn't i can't see we don't we're not looking at the zoom camera thank you did you call on someone else well i i did um okay i'll just go what no you can go ahead yeah i we didn't have you on the screen but yes go ahead and then miss clausen can go after go ahead okay
um thank you i would actually just like to um rewind a few things um and one is the work that our sponsors that put that together whether it's the first second or third version they were still the same individuals that worked through this so it's a one-page document um it's not um it's a board statement um so seven of us have have you know um are are going to make a statement on whether or not we stand with harassing whether harassment is is all right in our district or not um even though we've already set as a board um the call to action said that it was not um so could you tell me could you um you or brittany address the difference between the first one um the first draft and um what the
emphasis was to move it to the second draft or the third draft my understanding was it was a simplification in terminology not changing the content i know that our attorney we've made sure that the attorney is weighed in this and i know that the attorney has responded to different board members questions so could either you or brittany address um what the changes are between those three different drafts they're not significantly different but if you could do that that'd be helpful to start with um i could i think we only had two drops i don't know that two went out um margarita um no just sort of sort of the explanation you know and so this was um well i've i've uh uh coordinated with uh ms ashby to write it and we there there was
a version too that had some typos and some some needed some grammatical cleanup and so this was version three is sort of a clean version of version two it's there was no real substantive change in there but um to answer can i go if i can go ahead and answer the chairman renee's question and the difference between one and two is that it the structure of it was to indicate our school district and what what we already um believe about a self-environment being absolutely essential to our duty to provide our students a good education and that again and a separate environment absolutely does is essential to carrying out our mission and then we mentioned and another warehouse mentions what the what the um the city has done city has passed this ordinance and it and
so it lays out what the city has done and then it goes into therefore we um we agree or we we support the city and all but it's not just the city government it's also military business religious groups civil rights organizations all the groups that have come together to act to say that our community needs to do something and and as we learn to you know for the abundantly clear strategic plan is our school district is part of the community it's a seamless um again i've lived on many air force bases and i can tell you the cheyenne and warren air force base is so integrated it is extremely close it's always been it's been a strength of both that's the fact but because of that um i think that that our school district when
people say you need to say something i kind of think yeah probably we need to say something and the earlier speakers that we already have things in place yes we do maybe maybe we need to work on um enforcing them but we're not asking to change that but we are standing with the elements of our community who've spoken up so so that's what the two resolved parts are those are the actions those are the things that we say we need to say something about um before the earlier version included more about the ordinance in the in the resolved part which um i made the judgment that that really is the city statement that is what they passed that was their jurisdiction they have means of enforcement that we don't have so i the result part
was simply what we can do with our procedures with our policies with our enforcement procedures so really to say that we're we are doing our own um sort of soul-searching and our own statement and our own assertions and that um it's different the city is doing everything the military is doing a different thing business community can make its own the resolved on this version is strictly what we can do what we want to do with some what we have a mandate to our our children and families to do so i i'm trying to make that distinction um but you know i guess if there is a will of the board not to vote on this at all or to not vote on it tonight um it's on the floor it's been moved and seconded and
so if someone has has you know something to say about the the this how this is handled going forth um i would appreciate that yes i'm sorry yes sorry just might follow up on that madam chair thank you for that explanation and i believe in another resolution that we address some concerns with the national school boards association i would really like to vote on this tonight and if we needed to take it uh whereas by whereas to make sure that we're clear and on the same page in the statement that we're making i would be willing to spend the time to do that um it as i said it's a one-page document it's not um it's it's not complicated i i think that the fact that we are not um condoning any type of harassment
for any of our students um and i agree with mr bolin in the fact that i support what um all of the community members have come together to state that we cheyenne and and i'm as wyoming native as well that we do not treat people this way and it's not okay so if we needed to work that through i think the statement needs to come from the board and from lcsd1 that this is where we stand on that type of behaviors in our schools and and i would support uh mr bullan's statement there so um do i need to make a motion to make that happen or do we continue the discussion um maybe our attorney can weigh in on what's the best way to clean this up uh well ma'am term thank you for
your name and i i did ask for an expression of whether to go forward or to lay it back and so thank you for that and miss possum you still have to weigh in i'm sorry um at this point you can weigh in on what you're going to say and the whole thing about the disposition but please go ahead thank you so much madam chair um i appreciate what the chairwoman just stated about her desire to make a statement tonight however we did just get version three um and i actually didn't have five minutes i was driving and that red lights trying to look at it and i know that your depiction of the difference is that there wasn't much difference but the way i read it it seemed it seemed to align us very
closely if not um in support of the city ordinance and i i think that we definitely need to make a statement because i don't i know the i know these board members and not one of us agrees with harassment or or racism and we want to protect our children our policies are in place to protect every single child from that kind of behavior in the schools and so um we definitely i am very open to making a public statement against that kind of behavior and i too would like to just apologize to our military families and thank you representatives today tonight for coming and speaking on their behalf because that is not a message that we want to convey in this community and i agree with my colleague that we're better than that and so
i do think it's important to make a strong statement in support of our policies but i do think that we have some wordsmithing to do we are a separate entity governing entity and we as a board have to decide as our our general counsel gave us direction that whatever comes out of this resolution tonight reflects the opinions of this board and that it what was the words um it's a statement of discord's beliefs and so we really need to do some wordsmithing there's a few of us that feel like we need more time to do some wordsmithing and certainly we can be here all night which is one option and or we can have a work session which we've done on other resolutions to get it right and to be able to ask questions um
another point that was raised tonight that i think is very important and i just cringe when we're not transparent but transparency is so important to our community if we're going to tell everyone that we want to be transparent and our strategic plan event is going to have more and more information out there for our public to look at about our district and about our test scores and we just heard about our book review for k-12 literacy that you know we can know what's in these materials that's what parents have called for that's what good leaders do is that they they they're transparent because they're not they're not hiding behind anything they're proud of the decisions they're making so i think that we should be transparent this resolution um was i i first learned about it
in the works at a meeting with the mayor and um and i thought we would roll it out publicly i was not aware until friday that it was being done in draft form so i guess that's why it wasn't on the agenda but i do think that we need to be consistent with how we roll out information as well and when we take up things like this there might be good ideas by our community that would influence how we draft our resolution and why wouldn't we want to have the opportunity to hear those voices so those are my those are my opinions i'm repeating a lot of what's already been said but i do think we need to make a strong statement showing that we have these policies in place and that we will not
tolerate this kind of behavior um and um i think we can get there i know i know my fellow colleagues we all care about this issue very very strongly um yes mr baldwin um as i look at the two versions my the main difference in two versions is paragraph four and to me the the paragraph four that's in version one um is much stronger than what we're doing and have done um than the other one which talks about the ordinance so in the other version three is shorter in that respect but i think this one goes much further in talking about first of all not only is it going to be prohibited on any of our properties but also at any of our district sponsored events and i don't think the other version even mentions
that so there's a lot of things in that fourth paragraph that i believe are important to be in there and in the other version there's things in there that i don't think we need to even be mentioning i mean we do mention that we're working with the other groups which is great but we don't need to mention exactly what they've done because there's been no publicity about what they've done already in the last several weeks so okay and any other further comments we can sell what some of the options we can call for the question voted up or down as is okay again i'm sorry and yeah um he just took it down chairman sorry madam chair this roseanne i'm sorry i don't i know that everybody's trying to try and see my hand up
there but um um i would uh thank you for pointing that out mr bolin um would it be possible for us to whether as i mentioned before in my last comment that we go by um either clause by clause or if we can agree as we did in the national school boards association i think we ended up tweaking the last uh paragraph in that one as well um and we just wordsmithed it on the floor um and uh and i i think everyone had a uh they were confident about the the result that was obtained by that working through it that way so um would we is it possible to what motion do you need to have that um i would like to have this discussion um so i would like to go ahead and
put a motion that we either go through it clause by clause or we address our attention to we're good with everything except for paragraph four and then we work through it yes um can we pull back up version one um that seems to be the one that people did spend time with um you have to ask your counsel to send hi mrs paulie has it yes okay uh madam chair i uh trust you to ask you i do have a talk so if we and so just to sort of clarify if we wanted to work that version um at this point we would have to take care of the motion that's on the floor so we would have to or offer it as a substitute or else dispose of the motion on the floor by
withdrawing it [Music] that would be possible but we have a motion that we need to deal with either to dispose of it or act on it so um if is that is that what you you would like to do is to yes yep could we dispose of the motion that's on the floor and consider draft one um and make a um i would make a motion that we would consider uh the draft one uh focusing on uh paragraph four it came from rich it came it came from okay so so if you want you so you can withdraw the motion and the second can agree to it and then it's off the table and i'm sure i move to withdraw the motion is that secondary and now and now we can if you want to
we can move the original so so uh trustee clausen and you have a potential motion on the floor well while council is trying to get that paper i'll step in uh you have a motion on the suggested motion on the floor from uh trustee rini who needs a second in order to have that conversation between version one and version two i would say that oh um you know i mean and actually um i have that one hold on i know what you want so you have a motion on the floor trustee renee has made it's been seconded by trustee bolin so now you can have the conversation and you'd like to take a five minute recess we have a yeah a five five minute break request it is now ten minutes to nine if everyone
can be back here at five minutes to nine is that possible or just or as soon as thereby and then and then we'll pick this back up i think we have recess um yes recess for five minutes we'll be back at 9 55. [Music] i just don't know how to get it [Music] foreign so she can pull it up from there can she pull it up on her oh my god okay specific to this probably not thanks sure we're just asking them not to have negative behaviors towards them specifically so that is i think we have a policy at the state level but when it's as a threatening and negative behavior [Music] i see everybody [Music] okay we're back we're back um now the version that is up on the screen is the original version
it has um it's longer um and maybe mr bolin um well we don't have emotion on the floor we have to have a motion am i right no you have emotions you have emotions in a second i'm sorry so we do have a motion and mr bolland since you have um you're familiar with this and you addressed it um do you want to offer any any um i guess comment on this version i had originally had just a little addition to it but i'm going to withdraw that at this point i'm not sure really made that much difference i like this version just the way it is so i don't have any suggestions so and why can you explain uh why you prefer what what what part of this do you do i like the
fact that first of all it's talking very early here about us resolving well no one doesn't talk about what we're resolving until the very end so i like that part up there and it says in joining with other government civic and religious groups civil rights organizations business community and others in china so talks about who we're working with without actually talking about what they've done already because this is really our action that we're taking not their action and i also like the fact that it talks about on district property and at any events so those are the things that i think encompass pretty much everything that we're going to do because if you're on a bus around this property if you're at a game in casper a cheyenne game then you're it's a disresponsive activity
so you're going to be covered there so i think it pretty much encompasses all the situations in which we might find ourselves or one of our students or staff might find ourselves involved in this situation well if it is the will of the board we can we can certainly work this version right now um and it's one that people had read before so familiarity is is a benefit so um why don't we go ahead and um take amendments uh comments and amendments it sounds like some of you had um ideas prepared um we'll take the first the first um paragraph whereas laramie county school district one and board of trustees is committed to providing all students and staff a high quality and safe learning environment where all are treated with kindness dignity and respect are
there any amendments to that okay so second paragraph and whereas our community and schools have recently received a significant increase in reports of intimidation harassment and negative behavior in regard to race and color and the business and city government of cheyenne and i'm sorry there should be actually the business community and city government of cheyenne have joined in condemning that behavior so i i would offer an amendment at this time to insert the word business community um community after towards business business training well business community and city government of china have joined in condemning that behavior um so i would i would um offer that amendment at this time if there's a second weekend that was a second um any discussion on inserting the word community which is yes go ahead do we need to
approve each one yes okay all right okay um [Music] okay so um so with that that amendment has been made in seconds so can we vote on that amendment to insert the word community after the word business all those in favor say aye so that that is amended insertion of the word business i mean community after business all right are there any other amendments to that paragraph yes madam chair i would propose that we modify the end of that sentence to read um business community and city government of cheyenne has condemned that behavior i just think it's clear but um that's that's my proposal is there a second to that and we can discuss it a second okay second am i mr bowling and i would simply comment you have a compound subject predicate so
you need i mean so you need a compound predicate business community and city government have that would be my only yeah i'm sorry may i admit my first and i didn't read it that way but yes have condemned would be my amendment proposal oh have condemned okay and and then just to delete the words joined in and changing condemning to condemned is there a second to that second second by mr leader spawn um any discussion those in favor say aye all right all right okay that amen that praise the minute do you have that darlene i want to make sure you or or miss paulie whatever who whoever is um that that that did get cleaned up in version three but that's that's fine that's good yeah okay so moving on to the next paragraph
is that all that those are all the changes okay and whereas actions and speech that threaten intimidate and harass do harm to lcsd1 students and staff and their ability to teach and learn a safe educational environment are there any changes to that okay scene 9 we'll move on to the be it resolved at lcsd1 in the board of trustees in joining with government civic and religious groups civil rights organizations business community and others in cheyenne reaffirm their commitment to enforce policies strictly prohibiting any activity or speech on district property or at district sponsored events that maliciously intentionally intimidates or harasses another person because of that person's race color religion ancestry sex sexual orientation gender identity gender expression national origin disability or political affiliation is there any um [Music] any suggestions to change that yes ms
mill so this um this is one of the paragraphs in this i really struggled with okay um and i'll just throw out some ideas and and then we can take it from there with an amendment but um one idea would be to uh remove the last two lines of this not last sentences last two lines because of that person's race color religion and on and on and on and just simply leave this to say that we're reaffirming our commitment to enforce policies strictly prohibiting any activity or speech on district property or district sponsored events that maliciously and intentionally intimidates or harasses another person we have much of that same language and um uh trustee herman i think this is part of what you were cleaning up in the version three but we have much of
that same language on down but perhaps more than that we have federal law that that outlines protected classes protected status we have state law that adds a couple of different classifications to that um particularly military service or status and off-duty tobacco use we have also a school district policy non-discrimination policy or notice you know i'm sorry can we just get a motion in a second and then you can i don't know what it is yet so okay either either make those last two lines echo our school district notice of non-discrimination or take those last two lines out there's verbiage in here that we don't have in policy and is not covered by state or federal law okay so there are words that should not be in this okay so your motion would be to put
a period after the word person and delete the balance of that line in the next line is that correct that would be your emotions right you can do that one first okay yes and is there a second second second by miss clawson okay discussion does anyone uh did anyone want to address this i guess wisconsin sure i'll take it um i agree with what trustee smith said that we do have federally protected classes um or yeah i think that's how they refer to it so it doesn't need to be stated and i do agree that there were some expressions in here um or i'm sorry some terms in here that i didn't really understand what was meant by them it's not they're not in our policy and i'm not familiar with them so um i
think that her suggestion is a good one for that reason okay it gets at our point and it addresses all those who may be maliciously and intentionally intimidated or harassed okay uh yes we just want go ahead okay man i'm sure i guess the last two lines of that particular paragraph much of that is is stated in federal law i don't know that there's any federal law that prohibits discrimination based upon political affiliation i don't i don't believe that's the case so that surprises me that that's there i would propose that we take that out of there you know okay well okay let me just i'm just just clarifying my point did i miss something no i just want to make sure that we're keeping an eye on your council so that as you're sharing
she can share where she is okay and i think to some extent i think some of these things bear being reiterated okay this is so you so so you would say you would um oppose the amendment and you might have another one to do in its place but you you oppose deleting anything and everything after person correct correct yeah i accept you know i think i think some of some of those things you know it's they're well served by being reiterated because sometimes people don't understand that really it's it's against the law to do that there are federal laws that that provide protections to people that have gender identity issues people have gender expression issues but certainly i wouldn't i wouldn't agree with political affiliation so okay um and i i was a comment that
um that this is an attempt to mirror language in the ordinance and i did check to see why those groups were mentioned explicitly in the ordinance including political affiliation what i was told is that um the city council wanted to address the um we're like a better word attacks made by people based on political affiliation that they have seen here and around the state and bart and it was borrowed from uh language sort of kind of a model ordinance somewhere else so it was it was it was the city council's um on second reading they added that um deliberately um and so and and and this simply uses their words so um we can delete it all and or just you know vote on that suggestion and then come back you know either it'll go
away or else you can make it your own suggestion if you want to vote against this point so madam chair oh yes yes thank you um before we vote on this could we have our um to remove it um because i don't have a problem with it being reiterated again um but could we have our our council weigh in on uh the points that uh trustee smith um pointed out as far as protected class etc is there a problem with this being stated the way that it is council uh madam chair i don't think legally that you have an issue with it and this is a resolution of the board your policies delineate uh certain protective classes there's a catch-all phrase within your policy that says any other any other basis protected by federal state
or local law um so you know you're not acting contrary to your policy by leaving this end um it's not changing anything within your policy by leaving this in uh so it's really the pleasure of connect thank you can i make a comment the only you because the issues that we have seen are specifically around race color national origin i wonder if it would be acceptable to use some of them and then use the language as articulated in our policies to cover the broader spectrum of policies related or whatever you just said well you just feel like well in in the terms of very specific reasons or we can dispose of it put it up or down and then we would be open to further amending yep and so i wanted to throw that out
as an option before we voted it up or now okay so um are you ready to vote on the amendment as the ones before us i send you to take it all off i actually have one month tonight sure go ahead and speak to it sure speak to your amendment i cannot say anything about it you have an amendment on the floor you have to admit you have to vote on that one she can comment on her so my my proposal to remove those two lines um we we do in version one have this exact same text down in the be it further resolved paragraph just on down the page so um version three that we received today just before the meeting was a little bit cleaner and that it it only stated that language
once um i'm not sure we need to say the same thing twice so by removing those two lines here we still have the opportunity to list out all of those protected classes um later on in the resolution i mean they're they're they're just a couple same verbiage a couple of paragraphs down so we don't know that we need to say the same thing twice and and i and just to add on that um the thing that um the version one um version two specifically ascribes that to the city ordinance and says we support that this adopts those same words ourselves so it is mentioned twice in two different you know as a city council and then we also adopt that um that coverage so it's it's it it may seem redundant but it is ascribed
to to them and us and so and i just yeah make that point um but as you you want to comment again mr reach point if i could just just quickly i guess you know i i understand trustee smith's point uh the language is included in the be it further resolved paragraph at the end of the resolution so i'm fine with that so i think i would probably support her okay her amendment got it it's not understanding okay um any further discussion on ms smith's amendment seeing none all everyone's ready to vote all those in favor of the amendment to put a period after person and then delete the balance of that line and then the final line say aye aye opposed no that motion is adopted do you it's just a voice folk that's
fine okay so um are there any further amendments on that paragraph yes this clause go ahead madam chair i would just offer a few suggested cleanup words sure um so be it resolve that lcs d1 and the board of trustees enjoying with i would say the government civic and religious groups civil rights organizations the business community and others in cheyenne reaffirm their commitment to enforce policies et cetera okay so um join instead of in joining no no i'm sorry madam charles repeatedly yes okay joining so yeah everyone's there okay okay the the incen and still in front of government right in front of government and then keep going civic and religious groups civil rights organizations and then insert the business for business got it community okay okay so inserting that in front of government the
in front of business that's a motion is there a second well second second by mr bowling okay any discussion saying none all those in favor say aye aye opposed no all right so that amendment is adopted any other amendments on that paragraph so we'll move on and prohibited behavior includes and that is um behavior that that's specifically mentioned in the ordinance so that that's where that comes from any amendments there okay uh then we're down there oh i'm sorry go ahead sorry um knowing that that language there comes specifically from the city ordinance and not from district policy i moved to strike prohibitive behavior includes and take out one two and three um though that's not our policy that we're referring to but just make the motion one second and then when i go we
take out prohibited behavior it includes and then one two three three there were a second all second second by mr bolin okay now discuss and then because okay okay go ahead on me to discuss okay i move that we take those out because that is um that city language um the city policy or from the city ordinance that does not um it may uh mirror some of what our district policy says but this this is not our policy and this is not our language i think it's inappropriate to have it as a standalone in our resolution okay so part of the reason i left it in is because i did want to make it clear that um we're looking at behaviors that are truly a problem and so i had articulate i had chosen to
articulate those um because i thought the city had done a good job of articulating and these these are the types of things we're talking about these are the problems this is it's assault it's battery it's um prohibited acts and so i agree it's not match necessarily policy but i don't know if there's a way to articulate that i'm sorry uh so chairman vinnie go ahead thank you i would agree with uh trustee ashby and if we go back to um um our experience in the board uh we often see these types of things when we are when we have students reporting or building leaders reporting so i think whether or not we refer back to a section of policy that does actually address um these types of behaviors whether it's through our um whether it's
through our policy um mr fraley might be able or dr crespo might have that or maybe um our attorney could speak to the specific area of our policy that refers to these types of behavior because i'm sure we have it in there somewhere whether it's verbatim to this or not we do have we do call it out madam chair um trusty rooney yes we do have language specifically related to what is prohibited in language and actually is language similar to this um and we can certainly add that in i can look it up while we're while we're navigating okay yes miss classic uh mr simny says it's eight chapter eight chapter eight okay thank you sir uh madam chair yes i i agree i think we should reference our own policies okay and maybe we
you know we insert right where this is our own policy language as a possible solution i've lost track if we have emotion but i think we have emotionally emotional issues emotionalist is true is to delete and um uh we can amend the amendment for sure or or just go ahead and dispose of this but did you have something to add mr readers uh man i'm sure if i could i would just oppose the amendment to delete the language i think whether or not it's reflected in our policies or not is really a moot point i like the way i like the fact that it uh calls out those specific behaviors and i frankly think it needs to remain in the resolution so thank you okay yes mr bowman um i would like to take those
three things out of there and if you go back up to paragraph four what we did leave in there was we're going to reaffirm their commitment to enforce policies strictly prohibiting any activity or speech on disney property or at district sponsored events that maliciously intentionally intimidated stresses another person and we have those things all divided in our policy already we're already saying we're not going to allow it i don't think we need to specify down there because it's specified in our policies okay so by reference any other comment um does rene you still have your hand up did you want to weigh in again no i think um i will pick this up um are we going to look at our chapter 8 and define that specifically i think it's more powerful when we call
those behaviors out because that's why i agree with trustee ashby that's what we're that's what these kiddos are dealing with that's what we're seeing and that's what our building principles are are talking about in their meetings and we're all you know trying to to address these kinds of behaviors so specifically addressing them um and calling them out i think is a powerful thing so if we could work through that that'd be great thank you i apologize i didn't move my hand down but thank you for letting me reiterate oh okay so the motion is to delete and then we can come back and add in others if certain people want to make that motion here it's discussion roseanne yeah the motion on the table is to delete and so let's go ahead are you ready
to vote on that okay all those in favor of the motion to delete that section say i all right oppose no no no okay so there are two no's on that from mr waiter spawn and there's ready um so the motion does pass that motion to delete passes does someone want to make to further amend yeah so i'd like to then make a motion that we um articulate some version of prohibited behaviors based on our uh based on the policies of the district and do we have those yes we're getting okay a second thank you okay uh i think this is kind of goes along with the same amendment but i think we can probably just add it to after another person i hate to go back pair to four since we already have done
that but you couldn't just say reference which section in here you know as as defined in section whatever that way we wouldn't be listing them all but we would give a reference to somebody who wanted to go and see what they were because this looks like okay mr bone let me just ask are you talking about [Music] i'm talking about paragraph four where it ends and intentionally intimidates or asks it's another person in violation of oh i see okay so um well let's like you know um okay we can get back to that we can definitely get back to that right now we're talking about whether to list out the prohibited behaviors and so um and so what would partly the prohibited behaviors would be where is that it's right there uh it's okay i'm
sure it's posted right now on the shared screen okay okay um oh i see okay okay is that section 25 yes yes thank you okay [Music] well the district prohibits down to mail um oh well oh well yeah it's a pretty big section yeah there there was what was that list you had up a minute ago because it talks about physically verbally and or electronically torturing tormenting bullying abusing or maltreating willful destruction of district personnel's property need to use sexual harassment okay so that's both of those um so so um we don't so we we are open to further amending if if you want to specify what you want to put in that spot or if we decide we want nothing in the spot or uh in that delineation instead of one two three is
there other is do i have a motion to insert emotion so the motion is is to insert language are we better articulating okay but can you specify what it is or i well i just said better articulating based on the policies of the district but i it's the way we've got those laid out they're not as clear-cut as what we have there was that like i'm sure yes cause i looked at that the list before we had that we're gonna go for six and seventeen would cover everything that we have so we could replace these three with four six and seven i think if we look back at those prohibited behavior includes and then have six and seven maybe have bullets don't put a number on them perhaps and just something like that because that
was that with trial version two so [Music] seven eight right but that's part of you can wear something that we're prohibiting that right now i think we even talked about that mm-hmm so that is um section 14. going back to mr bolland's suggestion that we do it by reference to those two policies i just i'm not sure it's real so prohibited behavior includes anything in section 14 or just met you give a section now that the only thing let me just go ahead and weigh in on here you know sharing the thing is that it wouldn't be available to the public then they'd have to go look it up and then i think i think it would have less impact as a document on the because you know i think um i think the hope
is that this will be a stand-up on its own kind of a document but i just mentioned that yes mr wiederspawn man i'm sure if i could i you know we're not going to be able to create an exhaustive list and i think if we reference a policy without stating what the policy is then i think chairman uh his point is well taken that the public's they have a difficulty a lot of difficulty accessing the information so we're creating we're complicating the document and i think if we totally eliminate it it's going to make it a much weaker resolution than we originally intended so the motion is to insert um prohibited behavior explicitly mentioned in ours in our um policies so if you um can you can you say what what you want that which
ones madam chair could as as somebody who's just listening to the conversation and really has no say in anything that you're talking about would it be helpful to use the language um that you've got in place reference our our policy right so lcs d1 policy 25 and blah blah blah blah in addition to the prohibited behaviors outlined below because there's nothing in these prohibited behaviors that one we would condone or don't already fit in our policy yeah there's nothing here that we wouldn't mention in a much more they just have written it more sustainably yeah we could so i was as i was searching through that my suggestion was going to be that we put the back in and add a four or a fourth bullet that says or any other prohibited bay behavior in
the policies oh open district's policies okay so okay so that is your motion then is to restore this language and include a number four that does reference our district any other prohibited behavior as referenced in this district's policy we're 14 and 25. okay so what if the policy references you can actually you you could actually just leave it as lcsd one school board politics the resolution stands without whatever we change without giving a specific session okay so that and um you had a second for your original form is this is the second okay with that with that with that uh change yes okay so the motion on the floor is to restore this language and add a number four that specifically says mlcsd1 policies or behavior prohibited by lcsd1 policies that is the motion on
the floor is there a discussion on that motion so do we have the words any other in there i heard it never before no one no number four we would at least store it one two three and have a four that says anything prohibited and elsia is the one called okay so that is the motion on the floor is there any discussion are you ready to vote looks like we're ready to vote all those in favor of that amendment please say aye aye aye aye okay post no all right that is adopted yes that maliciously image harasses the emotions made and has to amend out because of that person's racial religion as i understood the discussion because it was included in the paragraph below the numbered paragraph um i just want to point out that
that paragraph specifically deals with disseminating communication that is intended to excite and produce violent is the second paragraph um would include those i just want to make sure that that is the intent of the board before you move on to your next version okay um and is it is it problematic that it specifically calls out communication um is that it does that limited and then or should we just should we delete that then to make it clear that we're talking about any kind of speech or behavior so uh madam chair i think that that your the order of this mirrors the city organized and um so the first prohibition is against um essentially physical um violence and threats and behavior and property destruction and the second is that disseminating information perhaps through electronic means or
others that that incites others to act violently because of those classes so you just it's it's not consistent so we and so we can revisit the other one to make it parallel or um but i so that that's a good thought to keep in mind all right are you ready to go to the last paragraph but for the amendments i don't know that we've done be it for the result you're right there's a okay yes okay so um so after the list we've amended that and i think we're all done with that piece uh be it further resolved that lcs d1 and trustees join with the cheyenne community and using available means to prohibit and available means then and i kind of use this word because obviously we're not going to have the same enforcement
and charging power so we are we are going to use our means of suspension and discipline it's not going to be the same as city so um available means to prohibit any person from disseminating any communication that is intended to incite or produce a violence produce violence directed against another person on district property or during a district sponsored event because of that person's and then the list and it's a full list um so are there any amendments to that paragraph in um so and i hope yes i would like to actually add because of because this is where we're talking about the um anything that might be might include social media kinds of things inciting or producing violence um i i would like it to say another person on district property during a during a
district sponsored event or that significantly impacts the learning environment which i believe is the language that's being used um in the social media so you would insert that um disrupts the learning or what is the word it's um maybe mr zimni can tell us what the bullying that it is disturbing uh it is disrupting the educational process disrupting the educational process okay so um where would you like to insert that those words disrupting um at the end so i rearranged it so it reads and intended to incite and produce violence directed against another person on district property during a district sponsored event or yes comment that during a district sponsored event comma or that significantly impacts the learning environment but i is the language i use but that may not be correct okay and then
uh and then picking up after and then because of that person that picks up at that point right it's inserted okay so if there's a comma after property delete order and then say during a district sponsored event or that was a what was the phrasing significantly disrupts the learning environment because of that person's pick up there okay is that that's the motion is there a second second second mr wiederspawn okay so discussion yes mr ball uh i have to put that in there i'm not sure it reads very well with putting all of that stuff in it's a little it's a little ungainly but um yeah but um it gets it gets it all in there i would like to make another emotion on that piece okay so so um so the motion is there
and [Music] um in inserts um disrupting the disrupting piece is everyone ready to vote if so all those in favor say aye [Music] no mr boland okay okay so that passes what they know from mr bowling um what else did you want to talk about that paragraph so i would like to suggest that instead that we put a period after environment and then um make that list or some version of it relevant to the entire document that says something along the lines all of the above um okay um or any other protected state federal local class i'll second that okay and that was this myth correct okay sorry so okay and so the that it would either come at the end of a separate sentence or be a whole separate paragraph but what is your
my envision i was envisioning a second paragraph there but that way it references the entire document not just the paragraph about it okay understood something like the district um the behavior and the language where if if we wanted to include those those classes where would that where would be the best place to insert it to to the hope that it none of the behaviors are language addressed above you know what it could go into a could you scroll kyle just a little bit to the top okay so condemning the behavior after behavior um on the second paragraph condemning behavior that um singles out people based on something like that and then and then it would be up there it's just a possibility [Music] further resolve paragraph and we're going to eliminate the last part when
i was in but anyway my first would be to eliminate the after the last part we added there where it starts with this person's race after that but via further resolve that lcsd number one has defined protected groups in its policies well that's not accurate though well unless i'm sorry i'm sorry i'm excused i'm interrupted i i just think that so none of the above articulated behaviors or language will be tolerated because of a person due to the person's phrase color so you want to put it down below yep and reference back up i think that's right okay okay and and it's something like some okay so your amendment would be to insert a separate statement maybe even um just you know a sentence added on to that further resolved down thank you i'm just
trying to make it relevant not just to that one paragraph i understand yeah council recommended can you add the word in all the aforementioned in all the aforementioned behaviors [Music] none of the aforementioned behaviors or language will be tolerated due to a person's race color or religion and then they know there was discussion on making sure we were not that we were sticking to either policy or protected classes so you're saying we're just going to embrace color religion and then we're going to say and all federal state protected groups is that uh i am open to suggestion on that um i think having fun none of the aforementioned behaviors or language will be tolerated due to a person's race color [Music] religion or any other state national station i think that um i think we're
almost there but how it's currently being articulated it sounds like those behaviors won't be tolerated because of the person's yeah [Music] um none of those behaviors will be tolerated if they are particularly those due to if they are performed or if they target if they are targeting another based on that person are they are motivated i don't care yes ms monson perhaps use that word but just say a sentence saying um targeting or a better bird you know um harassment or where's that language maliciously and intentionally intimidating and harassing persons of race color religion or other in you know state and federal protected classes will not be tolerated just make a nice clean statement so and and uh you know i appreciate the the reference i i would just say again i think it answered
to the effectiveness of the if the list is actually in the text um but i would say you know if um or directed at persons based on their something but you know the will of the board if you want to include it by reference you know anyone who's listed in law or if you want to actually include the actual list i'll leave it up to you to make that decision i personally think it's more effective to explicitly name eliminated the language above that was explicit in the definitions with the understanding in what i heard uh with the understanding that those those words would be added towards the end with the understanding of the federal federal protection conversation so perhaps with trustee claussen's statement and then the remaining portion being the language specifically related to those
protected which you're quoting statute you um you're able to meet both the need of the members that wanted that removed and then meet the need of the members that want that to remain it's in both places contextually it flows from now through the resolution it raises um trustee ashby's concern question about making sure we're connecting it to the prior language and you're still within the spirit of what you had anticipated uh doing through the process which meets the general counsel's concern related to intent and implication so can someone turn that into text you're right there so very i just took it right off of what you're all you all shared right so it whatever that last statement was trustee plus and if you and i'm i will tell you i'm not i haven't kept up
with the most recent motion but that language that that statement that you made and then referencing the specificity around the language of race color religion ancestry whatever that looks like that will recapture because you've now brought in the entire component of the language actor crespo i thought we added that back in we took it out and then we added that language back in um yes i thought that's what we did um so chairman really but the we're talking about um the list of sort of states of being or conditions or whatever that that was after the word persons in paragraph four i believe so it's a different thing yeah we didn't restore i understand that yeah i understand that so um just because it's hard to follow um on the and probably is for everybody
because i think we're all tired could you go ahead and pick up the language i think somebody tried to read it earlier but go ahead and pick up the language um um and and work it down from the first from be it resolve that lcsd1 and the board of trustees etc worked through that and then said that it kind of segues into the paragraph that we're trying to wordsmith so not the last not the not the last be it resolved or further resolved but the the um paragraph above that prohibited behaviors includes so just to get some clarity here and maybe it'll all come together and how we're trying to to address this yes uh be it resolved that lcs d1 and the board of trustees and joining with the government civic and religious groups
civil rights organizations the business community and others in cheyenne refer reaffirm their commitment to enforce policies strictly prohibiting any activity or speech on district property or district sponsored events that maliciously and intentionally intimidates or harasses another person prohibited behaviors include assault battery assault and battery of another person damage destruction vandalizing debasement trespass bond or theft of any real or personal property of another person or threat by word or act to do any prohibited act that is there if there is reasonable cause to believe that such an act will occur and any other prohibited behavior as articulated in the lcs d1 policy be it further resolved that lcsd one and trustee is joined with the cheyenne community in using available means to prohibit any person from disseminating or communic any communication that is intended to incite
and produce violence directed against another person on district property during a district sponsored event or that significantly impacts the learning environment that's where we're okay that's gotten to so okay that's we've already okay so that so you're you're you're saying to say put a period after um event or i mean um just after the disrupting language period and then delete yeah yes can i make a motion for the next sentence well hang on a second okay good but is that is that your motion yes but delete the last no not to delete it to put a period and then to rephrase to then reference the okay so we different okay groups back to the entire piece because that is the issue that we're having specifically and so whether it's it's in a separate sentence here
in a separate paragraph in some way use it and um and yours and your intent is not to simply refer to protected classes or people already mentioned but to use that actual list correct is that right dusty ashby um i am open to suggestion i think there needs to be at least some articulated pieces because of the issues we're having okay so that's okay just just hang on because we already had emotion on the table so she's defining the motion she wanted that's already out so that is actually moved it on the table but yes miss clausen go ahead i seconded in that motion but it's changed and okay i seconded the motion that listed out race color religion and other federal and state protected classes if that is no longer on the table i
remember i okay withdraw yourself okay is there a second thing okay and then is there a second for which this ashby has it has yes expressed mr wieder's spawn then we'll second that okay so what are we where [Music] how to express it in a separate sentence a separate paragraph but to specifically say that it refers to prohibited actions and say that they shall not be directed at a person based on that person's race well she part of it was still in in composition but uh i my motion was to put a period and move it down and rework that last sentence okay i didn't specify necessarily well i at one point did say any discrimination harassment bullying will not be tolerated due to a person's race color religion and either all of them or
some okay articulation okay so that seems to be the point of discussion here is whether it should be the whole list or it looks like roseanne um none of the aforementioned behaviors will be tolerated if they are substantially motivated by another chinese and it's a separate paragraph so that it's a standalone kind of a correct that's i believe as amenable would you restate that would you say repeat that please sure so it would be a separate and it could be a separate via result that lcsd1 and trustees will not tolerate any of the aforementioned behaviors if they're substantially motivated by another trace color religion ancestry sex sexual orientation gender identity gender expression national origins okay is is that acceptable to you ms ashby is that what you want to that is the type of paragraph
that i was looking for yes okay i'm sorry could you um could one of the board members read that i don't i don't know it's very hard for me to hear um our council's uh mike um so i i don't always catch what she's saying so if you could repeat that please thank you you bet so uh she can read it louder who's turning on the mic okay so again uh miss paulie's going to go ahead and repeat that with the mice that is fully functional hang on [Music] okay and chairman rene this would be what she's getting ready to say just now would be a separate paragraph to come after the paragraph we we've just been discussing so uh go ahead uh thank you madam chair uh trustee ronnie i apologize about that the
the proposal that i made would be uh be it further resolved that lcsd1 and trustees will not tolerate the aforementioned behaviors if they are substantially motivated by another's race color religion ancestry sex sexual orientation gender identity gender expression national origin disability or political affiliation thank you mr wheat was fun is that okay with the second well one thing that i would suggest that i would i would eliminate substantially and just leave it motivated okay so miss andre what do you think is that is that the motion you want to um i think there will want to be discussion on the list there will be but i'm just trying to get a motion that we can discuss and make it kind of yes i think please yes i can go with that motion then we can
talk about it and uh this is what substantially deleted perhaps is that does that understand it okay and and madam chair uh trustee ashby what i would suggest is that um you start with this and then an amendment to the amendment can be made but at this point i don't know that we have at least we have something to start clear motion that's on the table and so this at least gives you something that is at least similar to what your intent was yeah and then we can clarify it through amendments okay so that is the amendment to have a separate paragraph that says be further okay one more time if you could read it miss paulie and then we know what we're voting on um be it further resolved that lcsd1 and trustees will
not tolerate the aforementioned behaviors if they are motivated by another's race color religion ancestry sex sexual orientation gender identity gender expression national origin disability or political affiliation okay that's the motion on the floor is there a further discussion about that motion to um we didn't get a second generation yes we respond and so it looks like we're ready to vote oh yes okay margarite i'm sorry [Music] chairman um herman if i in just reading that um it and i understand the intent i think of what we're trying to get to but um it said if it's motivated by those behaviors that are prohibited anyway if they're motivated [Music] for against any of those protected um individuals and or classes do we tolerate them at all i mean overall we those are none of the behaviors
that we tolerate anyway so when we say if they are i know what the direction you're headed i just uh when you read it through and thank you council um but when it was read it made it sound like we might tolerate it in some other way and we don't so that would be an argument not to include the list um okay yes ms clawson i think it's just the wording not the list okay uh several minutes ago i made a recommendation but it wasn't my turn well now are you gonna address this yes good yeah okay good i am i think it and and that is i really like in the fourth paragraph i really like the words maliciously and intentionally intimidates or harasses another person and this is where we get into i
think some some people have concerns about you know well what if i say something that my values are different from another person's values am i going to get you know expelled from school we're not talking about the use of the n-word or something like that we're talking about maybe a religious point of view or something like that so i think that when we when we insert those words which were inserted above maliciously and intentionally intimidates or harasses another person and then puts the qualifiers on that sentence i think that's always good to do so that we're showing that you're intending to hurt someone by your words um and so i would really like for us to consider um amending the amendment i like the idea of putting in a you know be it further resolved
um but adding those words that that language to the front end of the descriptors and then i would also say that i really think because we have not taken the time to study out some of this terminology we should stick to what we know we should stick to you know work this resolution is about color it's about racism and of course we're trying to encompass other other folks that might fall victim to intimidation and harassment so i understand what we're trying to do but that's why i would offer an amendment to the amendment that says something to the fact that be it further resolved that lcsd1 and trustees um will not tolerate maliciously and intentionally intimidate not tolerate um the maliciously and intentionally intimidated or intimidation or harassment of another person based on race color
religion or other federally or state protected status okay that's the right word so okay so that's what i would offer as a solution to the differences on this board and hopefully we want to work together we're all trying to get to the same goal but um i would suggest that we try to find agreement on the language okay so i think let's let's take care of this and then then you can make another amendment um it sounds like sort of you're borrowing you're sort of combining those two um elements from those to be resolved but right now okay so the ques the motion on the table is whether to end this sentence here at the be it further resolved after we talk about disrupting education and then making a separate paragraph to include a list
of um uh madam chair people yes it sounds to me um based on what i'm hearing from the trustees that because the specificity around this current incident or this current series of events is specifically with race and color and perhaps ethnicity um i hear trustees talking about trying to explicitly call those out without explicitly using the entire verbiage or in the federal um expectations while making reference to them so and no and and i and i understand the the the argument against using this specific list as is so just concentrating on the current events and then getting general yes so i babies would suggest that with the link with some version of the language and i don't know if there's any view or some version of the initial language that we have the second paragraph
before the result that the lcd is d1 board uh lccc one and trustees will not tolerate any of the aforementioned behaviors against people due to [Music] does that work i don't know or based on directing no i shouldn't and then use the language in um in the um district policy which does include a number of those listed out and the additional pieces um technically under the you know some of the things that are in there are covered under some of the things that are in the district policy so race color gender religion national origin disability age sex or any other basis protected by federal state or local law okay please can i just make an observation i mean i it's probably not going to make anybody happy but i think we were better off with
the original document i think we're beating a dead horse here so to speak i think the language some people are objecting to the fact that with whether we were repeating things that don't need to be repeated that are already reflected in in-board policy they're objecting to the fact that we're including protected classes that they don't think really need to be included personally i think we were much better off with the original document i think it says everything we want to say i think it's well written and personally i just i just think that we should probably go with the original document but that's just an observation right so however however the motion on the floor is to is to separate out the lists to make sure it applies uh which is but and so and
actually you've adopted the motion you've adopted paulie's language in the in the motion so i think we need to vote on that and then if we we don't want to use that version is to then come back and rework the paragraph maybe going back to the original language or whatever so i think i'm going to go ahead and miss windy did you want to weigh in at this point or wait wait till we vote um the the motion up or down and then move forward well i think we need to clear this up i i don't have a problem with um the orientations um and actually you know until we got down here um that was kind of the trade-off between taking it out of the the paragraph above the first be a result so
i think it's important that we we um we specifically uh talk about those um orientations and and protected classes so um we can dispose of of this and and um try and i appreciate everybody working through this this is really important and and we're going to get there so thank you okay so the motion on the table yes is is a separate paragraph with miss paulie's wording so that this list then it applies to everything on on on the resolution but separated out and so that's on the table let's go ahead and vote on that and if we don't like it we can go back and do something different just a little bit more discussion um the the verbiage that miss paulie recommended there um incorporates the text from the city's resolution that they passed
and not the text from the lcs d1 notice of non-discrimination and it includes classes to be protected that are not protected or that are not listed in our district policy federal law or wyoming law okay so i would you can you're going to vote no based on that it would that be the affair unless well okay because i think you can come in a minute okay but okay and then so yeah and then you don't want that list that's fine we'll vote on it it'll go down i think the list is great but i'd like for it to line up with shirt law okay okay fair enough so let's go ahead on in voting and again the the list that is in this separate little sub section is in the full list so all those
in favor of that say aye aye aye okay there's two votes against no no no no okay so that's no separating okay the nose have it so i had i had two yeses i had two eyes i would like to suggest we put them back at the end of each of the paragraphs repetitively okay so new motion here new motion to put them together we store them some version of them back at the end of each of the paragraphs so they reference to each of the specific issues um what it would be what is in the list is it the list as it is here or is it a different one um i um i am fine with it being the list as it is listed in the um district policy um because some of
the things that i know people have concerns with are actually covered under some of those things in the district policy and and and we should probably have the exact words before so before we vote so that we know exactly so it says be it resolve that lcs d1 board of trustees going down to harass is another person based on the person's race color gender religion national origin disability age sex or any other basis protected by faith federal state or local law and then down below also during a district sponsored event or one that significantly impacts the environment due to race color gender religion national origin disability age sex or any other basis protected by federal government and that is language lifted out of our policy it isn't so so okay second so the motion is
to insert that language twice in those two places in lieu of the of the list that the city used so any further discussion okay sensing you're ready for a vote all those in favor of that motion please say aye aye opposed no okay that motion is adopted and i should check with darlene do you have that or do you need where is writing make sure she has okay good is any other any other further amendments yes madam chair oh i'm sorry yes that's fine i just want a clarification and hit a little rewind here um my understanding when um we talked to or when i asked i think i asked our counsel earlier in this discussion um the majority of these orientations and protected classes are actually in somewhere in our district policy in multiple
levels if i remember multiple occasions so is there um i know that political affiliation you know uh was one that was questioned but are there any others that are in that list specifically that are not somehow covered in our district policy or state or federal law miss paulie madam chair uh trustee rooney um no so um your uh policy lists out and and i looked at this earlier so race is covered color is covered and and i for everyone's benefit i'm going back to the original language so that we can kind of crosswalk that right so race is covered in your policy color is covered in your policy religion is covered in your policy um ancestry is not that ancestry is covered in federal law um which makes it covered in your policy because we
reference uh federal law um sex is covered um so um sexual orientation gender identity and gender expression are the three um that in it's it's a little questionable so in the title vii context we know from a recent supreme court opinion that that is absolutely a protected class um that in in [Music] employment context you cannot discriminate discriminate on an individual based on those three um identities we do not have clear supreme court uh or consensus amongst the cert the district circuit courts um whether or not that prohibition applies in title ix what we do have though is when courts interpret title ix they rely heavily on title vii um case law and and reasoning in order to interpret that uh we also have direction from ocr within the office of civil rights that's within
the department of education that has come out and said that based on that based on the fact that the supreme court has you know said these are protected classes um in the title vii context ocr will interpret title ix to include um sexual identity gender or sexual orientation uh gender identity transgender those those types of um because they they are tied to an individual sex so there is not um specific language that includes that in in federal state or local law um there's not a supreme court that directly applies it in title ix it is directly applied in title vii there's no indication that any court would not apply it um in title nine context because of their um one their their the court's um tendency to apply title seven into title ix and the
direction of ocr so okay let's claim around those three areas um national origin is covered disability is covered of course political affiliation is not a protected class under federal or state law based on your policy you do have local law and if it's not a federal law or state law an ordinance and i believe would qualify as a local law and you do now have a um dually passed ordinance within the city of cheyenne that lists political affiliation as a protected class within that ordinance so okay that could potentially fall under there you know as well okay all right um well i honestly at that thank you for going over that again um i would i would like to make a motion that we keep the language that that is there because as you just
went through everything we can [Music] tie it back to policy so or federal or state or now uh local ordinance so i would like to make a motion that we keep the original that the all of the different classes um in that language that we just changed so we just adopted policy language in those two spots and the motion now if there's a second is to replace that and restore the list as it is in the in the city ordinance so is there a second to that motion mr bowling yes dude but we already have a book on the floor we voted on them okay so what we voted on was to put it back in there but just with policy language in those two spots the emotion now that so this is a motion
by roseanne yes if he has to get to second is to restore this language in lieu of the policy language that we just changed so that would be if it gets a second we'll discuss that and vote on it i would second it for discussion period okay he's going to second that yes go ahead oh and discussion anybody oh yes mr reedus madam chair thank you i think in light of our our council's uh explanation i would uh i would support restoring that language because there are gaps that this apparently hits marks that the other one doesn't although by invite one one could make it our argument okay um and yes let's close it madam chair i i'm up here being asked to vote on things i'm not fully briefed on what does it mean
and i don't think this is the this is rhetorical because i don't think this is the appropriate time to do this but what does it mean to list political affiliation as as one of these lists of of experiencing harassment because i know when you're in the minority you get harassed i know that but that's just part of the gig you know so and how do you define harassment i mean some of these things some of these things are not they've not been vetted through this board very carefully and i think you know other things are clear federal law is clear we're all very aware of things that are protected and needy you know that they've the courts have ruled on them and i don't think that those are in question but there are terms especially
that one and you even raised it about trustee wiederspen i honestly don't don't have a good picture of that i don't have any examples of that in our district but i'm not saying they don't exist i just you know we're up here being asked to take on language that we haven't even vetted or talked or discussed in in any like you know depth of detail and you know it was news to me that because the city ordinance ordinance has this language where is that now going to be kind of the standard for our district that's news to me and i think that that's at least worth a fuller discussion so if we're really going to go down this path of of taking on new concepts i would recommend we we pause and and go to
a work session and really vet out this stuff well or or if you do not if you want to use the language as it was previously amended then you vote down this particular proposal i think harassment i think we have plenty of uh you know our policies pretty well defined you know prohibited behavior intimidation and harassment but whether but i think if then it sounds like you do not want to make this change you agree with the previous change and so you would vote and then yes yes i'm sure i would just like to ask on the previous one you voted on does it say state federal state and local yeah that's what the policy is so it's covering all this it covers all this so i'm okay with what we already have so you
would okay so that's an argument to stay with it in this current form okay anyone else wants so i i want to be real clear as to um the laws that um amy was referencing earlier the federal court or the supreme court ruling made it very clear under title vii that those three things are covered under the term sex um under title seven um and so for me we're still covering them um and so there cannot be discrimination or those things above if we take them out and so that is part of why i am comfortable taking them out because i don't think they should be discriminated against in those basis either and and and you know the argument just sort of because for the other side would be that there was a benefit to
listing them explicitly for the public who doesn't understand the vagaries of title vii and what the courts can do and their sort of thing so i'm just saying that's that would be a reason to say them explicitly not that i'm making that argument i'm just saying that would be on the other side so perhaps um we have i just want to clarify we could call and see where we are because we have one that was already previously approved what we have preview just to prove that was the policies this the district language and what's on the floor is to put that back again use the city language and so does everyone ready to vote okay all those in favor of the motion to restore the um ordinance language in those two spots um say aye
hi hi are those two these no no okay so um that would be so uh the nose have it and um are there any more motions seeing as none then um we'll go back and vote on as amended so all the changes we made we'll go back to the original motion about as as amended and that quit and that motion is still on the floor and then chair we haven't done the last paragraph oh i don't is there a last yeah can you scroll or is there a therefore oh sorry okay therefore lcsd1 and trustee thank you mr bolin will enforce policies and procedures to ensure activities and speech on schools that significantly that comma should be deleted anyway that significantly impacts um the learning environment in district facilities or during district spots or events
maintain a safe and quality learning environment of dignity kindness and spectral okay so there are a couple of grammatical things i'm going to write off the back um my amendment would be to delete the comma after school um [Music] and then um we have to let me see that significant and then make impact take off the so it's plural to go with the plural subject so those two things yes okay yep um let me see there is kind of an offset environment and dignity i know no i i would say let's let's delete my suggestion delete after schools delete the s on impact and delete the comma after environment that would be my motion is there a second oh yeah i'll second it but um so i this this language was something that i put
in here again um trying to differentiate between in the schools and any anything that significantly impacts the learning environment right so not just in the schools but harassing text messages harassing social media that significantly impacts the learning environment so that's why there was a comma well it's not a restrictive clause so you wouldn't use the commas that's a non-restrictive clause no i vice versa it is um so it can be made parallel that significantly impacts the learning environment that is that it happens in district facilities or that happens during district sponsored events so right to offset in district facilities and uh and so yeah okay okay so my amendment is to take off the comma after school take off the s after impacts that comma after environment take off the comma after facilities and insert
the comma after events so in district facilities or during district sponsored events it's offset with commas and the others are removed second yes question comment so that i can better think through this would you mind to repeat absolutely delete okay speech in our schools delete the comma that significantly impact delete the s keep the comma after environment what we're doing is we're offsetting in district facilities or during district sponsored events that gets offset with commas so the comma after facilities is also deleted so the only commas in there are to contain in district facilities or during district sponsored events those get commas the rest except the series at the end is that so it does offset the phrase as massage and then you seconded it okay yes do we need the word to before the
word maintain something's still missing yeah trustees one force policies and procedures to maintain a safe and quality learning environment something and they kindness and they're just qualifiers in between okay so there would be a okay a two inserted after events in order to maintain something like that in order to maintain should i go through it again okay delete after schools delete and make impact a plural verb impact the learning environment comma and district facilities delete comma or during district sponsored events comma in order to maintain all right and my second loves it yep okay all those in favor say aye aye opposed no all right those those uh grammatical corrections made is there a substantive amendment to this paragraph that you would like to know oh i didn't hear her roseanne yes critical okay she's
a she's a yes now the whole motion is there are there is is there any further discussion on the whole thing now as amended seeing none all those in favor of approving the resolution as amended say aye aye opposed no and ms renny are you no i support the resolution thank you i'm sorry thank you okay so the motion is adopted as amended and a finished version will be on the website i'm not sure when tomorrow afternoon tomorrow afternoon but it will be in its final form i and i i apologize for the tortuous method of this but i think we needed to work through it um piece by piece the way we did so anyway i shouldn't be addressing that um so we finally okay and um future business let me get okay i
do appreciate everyone's forbearance future business the next regular board meeting will be held monday may 2nd at 6 00 p.m work session will begin at 5 00 pm the business of the district is done and we have the second public comment period that we don't have anyone signed up for it so we will go right to and i'm sure i moved to go into executive session at this time prior to adjournment for the purpose of possible student long term suspension expulsions personnel and negotiation second all those in favor say aye aye opposed no we are now in
