Already everybody, welcome to the MAY 21st special meeting of the facilities Committee. Um, so I just want to clarify, if I MAY before, um, that there are two meetings posted for tonight. Uh, we re going to take up the special matter first, and then we re going to go ahead and do the regular meeting. Um, so, um, MR. Hollis, can you take a roll call to established forum. Uh, yes, MADAM Chair, on the rope, not the roll call, um yeah, on the roll call to establish quorum for the facilities Committee special meeting, uh, 6:30 P.M. Director Barry in Director Thompson, PRESIDENT, Chair Batchelor. Here. Thank you. So I just want to remind folks that speaker cards are located next to MR. Hollis. Please get a card if you are making a comment on this item

or other items that we will be discussing tonight. Um, so our first item is c126-1 072, amendment number 2, Amendment, um, I m sorry, agreement between owner and alternative design builder, Alden s Construction Inc. With each kit, uh, architects, uh, McClymon s High School modernization project division of Facilities Planning and Management. I believe there s a presentation for this item. Um. is it No, not a presentation, but um, yes, we re really excited to be bringing forward this is the, there needs to be a sec, there needs to be a motion. Um, I ll go ahead and move it. Is there a second? 2. Thank you. Go ahead. So we re really this item is the guaranteed maximum price. It s the ultimate construction contract for the McClymons project. And so I ll inviteele and

Doll Hayes, um, who will be talking through the contract and um it ll, you ll also see it represented a little later in the next meeting, um, as we talk about the spending plan. Good evening. My name is Cele Nael Hayes. I m the executive director of construction for Oakland Unified. Um, we are very pleased to bring forward to you, um, for a review. Um, Amendment number 2 to the DesignBuild agreement with Alton Construction for the McClements High School, modernization and turf field replacement project. This amendment establishes the project s guaranteed maximum price or gmp, um, in the amount of approximately $85.1 million. Um, I can say all the all $85,118,050 which brings the total contract value to approximately $97 million which includes the previously approved design and early procurement work in the original contract

and the First Amendment. This reflects the full scope of the modernization and athletic field improvements. It incorporates, um, both contractor and district contingencies and maintains the district s local business utilization commitment at just over 50% participation Um, approval of this amendment allows the project to move fully into construction implementation and maintain the phased schedule, um, for campus occupancy and athletic use, um, which will be 3 phases, um, anticipated completion in very early 2029. Um, I m happy to review any details and answer any questions in the contract document itself, which includes the, um, the pro the proposed budget, um, the schedule and the um sort of list of um assumptions and considerations that the contractor used when preparing um their their guaranteed maximum price for us. Colleagues, any questions Doctor Thompson? Can you elucidate for

me, please, um, does that cut any of the um proposed construction off, or am I correct in assuming McClymons will get everything they need Yes, the project scope has not been altered in any significant way. Um, there are a couple of places where, um, we work to identify, um what we call lower cost, um, ways of, of meeting the expectations that the school community has, um, communicated to us and that has been part of the design process that included the school community for several years. Um, and it s things that, um, that I don t imagine anyone will actually notice, um, changes in the flooring patterns in the hallways, for example, um, using a method of installing the flooring that is more d ur able and easier to maintain, but it s similar and it

s the same quality. So changes like that were reflected in the um in the guaranteed maximum price, um, but otherwise, the full scope of the project from um the full modernization of the building, new entry, new classrooms, new electrical, new plumbing, new heating and ventilation systems, new track and field, um, new stadium, all of those new parking, new Plaza of Peace, new landscaping outside the entire building. The entire scope has been maintained. Um, and we re really excited to get started with the construction. Bay, have any questions? Ok, um, yeah, thank you. It was very, I thought it was a very thorough report. Um, so there s been a lot of questions that we ve gotten from the public around, um, the look, the improvements to the specific sports facilities. I know you ve mentioned

it kind of briefly. For a layperson. What exactly is included within this project? At this time, for the sports facilities the sports facilities. So we ve already done a renovation of the gym, but we didn t, um, include new bleachers in the previous renovation. So this, um, brings new uh seating in the gym for spectators, um, for the different contests that are held in the gym. It also includes, um, a complete renovation of the locker rooms, which players home and visiting players will enjoy, as well as the students who are participating in pe um during the school day. On the field, um, we are completely removing the, um, the existing uh track and turf. We are remediating the hazardous soils that are, um, beneath the track and turf, um, that are currently encapsulated and completely

safe, um, to be playing on, but, um, creates a big hump in the middle of the field that, um, gives the the warrior s an advantage over some of their competitors, but, um, everyone would prefer to have a flat field, um, and we will be, um, doing that soil remediation under full oversight of the Department of Toxic Toxic Substances and Control, um, it has very detailed, um, soil mediation, um, plan oversight, um, and so we ll be completing that, uh, segment of the work in the in one of the phases. And then um there will be a complete, uh, um, renovation or remo demolition and reinstallation of a stadium, which will have spectator seating, a brand new press box. And last but certainly not least, and brand new scoreboard. And did I MISS Anything on

the scope? Sorry. I think, um, two things that I just want to be clear and tie it together with an item on in the next meeting. This is a $12.25 million dollar increase in the overall project budget for McClymons, and one of the things that also was lifted up in and, and why there was a delay when it was in the uh division of State Architects is they identified some walls that needed additional structural reinforcement. And so there are the the soil remediation plus the structural, the increased structural, um, um, you know, kind of, um, how would you describe it? Like structural reinforcement that needs to get done to lift it up to code. Um, is, is one of the driving factors as to why the, the price is increasing for the overall project. Yeah

I think that was gonna be another one of my questions. Are there any other approvals for this project that we re waiting on from other entities besides ousd. Thank you. Um, we are currently, um finalizing the voluntary remediation resolution for the oversight by the Department of Toxic Substances and Control, um, and that is required for us to get started on the earthwork. Um, but that is in our court. So, um, as soon as our, um, as it makes it through our review process with our general counsel and, um, and the board, um, will be cleared to go. And will that need to come to the board for approval. Right now, um, I believe it will come to you for ratification, the general counsel is able to sign, um that amendment. It s an amendment to

an existing oversight agreement. But there are no other entities like the dsa, the state, the county. On the full board approves the, this amendment, um, we will be issuing a notice to proceed to the contractor, and they ll be able to begin work. Then I, we did have, um, challenges around water quality in our district. Can you talk a little bit about whether or not this project has any of that scope within it and what that could look like. Yes, this project includes all new plumbing, um, that will address the, um, the water quality issues within the building. Um, and we ll continue to monitor the groundwater, um. That that does not go into the drinking water for students or staff or community, um, but we ll continue to monitor that monitor that throughout the

project and after the project is complete. I ll just add one other component. The, the type of systems that we ve now studied in our embedded within our master plan will be installed within the site. So the lk units that have filtration as well. So not only is it the full replacement of all the plumbing systems, but it s also updated to the new filtered water stations that will be installing with all future projects. Um, I also wanted to bring back to Director Thompson s question as well. The funding for this, and I do want to, and we ll talk about this in the spending plan as well. Um, we, this bond measure y was designed with a contingency of $73.5 million and the intenti of that was always to be able to increase to

maintain the commitment around the scope that we made to schools, so it will not impact other projects. This was something that was planned for, and so the 12.25 million will come out of that contingency, just like we ve done with other projects throughout the as they ve reached the gmp. So I just wanted to name that that there is an investment, it is increased, and then it also is not going to impact other projects because we planned for it. Uh I just have a couple of questions, but if you want to respond directly to that, go ahead. I just want to say thank you very Connie. I was gonna ask him about the contingency because when you mention it, when you presented it earlier, you talked about it being included in. And I just wanted

to make sure. So I was gonna ask that question. That s why I decided not to, but I m glad you brought that out Preston was speaking of the contingency that s within the full $735 million bond program. This contract also includes contingency dollars within the project. If there s anything unforeseen either on the contractor s side or anything that we want to add as the owners, um, that contingent that there are dollars built into this contract that we MAY not spend, but that we could, and then we don t have to um worry about delays or anything of that nature. If anything comes up in the course of construction. Unforeseen things or, um, you know, changes in, in requirements. Yeah. Thank you. Um, we also, you know, have been talking a lot about our

climate resilience work. Can you talk about some of the specific factors that are built into this project, such as like heat pumps or other. Yes, I, um I will begin, and I ll ask for support from the team. Um, there are a number of, uh, sustainable sustainability related, um, improvements here. Um, the first is, uh, as you mentioned, around heat pumps and I m having a, a, an efficient, um, hvac system for the entire campus. Um, there s also some, um, an assurance around, um, uh, the lighting, um, and the fixtures of the lighting that, uh, will meet the new Title 24 standard. S and, and that, um, are currently not um part of the, the current uh building. I. I think the, the, the biggest thing that we are, they are going to heat

pumps, but also the building envelope itself is getting upgraded, and that is where you lose most of your heat or you gain your heat, depending upon which season you re in. And so there will be upgrades around the entire building to support the building envelope. Um, one is envelope? It s the exterior of the building that holds everything in. Winds sprayed water in it if you re envelope was not secure, water would get inside. Gotcha. Yep And one of the other things just to kind of connect it to the next meeting. There also are contracts where, um, we, it, it s time now with the solar that s on the roof at McClymon s, that there is some deferred maintenance that needs to get done. There s a contract later on this evening that ll

be on the board meeting on um on Wednesday night if you all approve that, that we ll actually get the, the solar array backup and functioning just as uh to fall to its full natural strength because it is over 10 years old at this point. So there are some other upgrades that ll be continued that aren t included in this contract as well, that hit the sustainability. Work as well. Oh, ventilation and ventilation. There will be ventilation and air quality improvements as well. Last question When will the community see trucks, workers, shovels, um, things happening on that campus. Um, our, our plan right now is to, is for things to begin, um, in the first week of JUNE, pending approval by the full board. And we are planning, um, working with the school leadership to

plan a not exactly shovels groundbreaking ceremony, but a celebration of this next phase of our of our work. Um, so over the summer, there will be um activity inside the building, so maybe not so visible from outside, um, but, um, but it will be heavy, loud unpleasant work, um, that means that we re making progress towards um towards our promise. And I um I guess like one suggestion that I would have to just that is making sure like the neighborhood council there is aware and can send out a message if there s a way for us to just like communicate to that geography just because I would, I would hate to have folks be confused or like frustrated about the the noise. Director, oh sorry. No, go ahead Um, our community engagement, um, team, uh,

has been sharing information with the um with the neighbors in particular who will be who will have more visible impacts and also assuring them of the environmental measures, environmental management measures in place to ensure that we re controlling dust and other, um, other things that, um, impact the direct neighbors, um, and we will continue to do that. Thank you, Doctor Berry How soon after we approve this do schools, our school s engaged in the planning process around impact of whatever construction is happening on learning and sports and everything else that happens on campus. We ve been engaged with the school community, um, for over, we, we anticipated beginning this project back in the fall. And so last, um last spring, there was communication about what it means and the school actually was moved into half

of the building. You MAY have heard about that. And so we ve been in, we ve been having meetings with the staff throughout the spring and, um, working with them on what the actual phasing looks like, where they ll be able to park, um, what it means for access to things that they ve been used to. Um accessing. So we ve been in deep conversation, um, throughout this this waiting period to make sure that folks were ready, um, and then we re continuing to be on site, um, and in communication through the school leadership, publishing bulletins to the staff, making our team available to answer questions, um, or concerns supporting them with the implications of moves, um, all of those pieces, um, for this, we ve focused primarily on the staff. We ve had a

couple of times with um at a parent power hour um to support parents to understand what they can expect when they come back to school, um, since we re starting in the summer, um, and we ll continue to do those updates to the community and those communications and listening, um, to community to ensure that anything we can do to mitigate the discomfort that people experience in construction is um is banished as well as we possibly can. Yeah, one of the frustrations that I ve heard often this year is that the move was made. And you know, for what? And so how do you mitigate that? In the future? We are, we were really hopeful, um, that we could get started during the year. And I think the way and, and because of the delays with

the approvals, we weren t able to. Um, and we ve apologized to the school community for that. Um, we ve taken responsibility as staff for that that decision making. It was certainly a trade-off, um, either to have them move mid-year if, if a, um, if the approval came through or to be preemptive and try to do some early work, um, to get started. Um, and we ve learned certainly that we in the future we ll evaluate those factors a little bit differently and use this learning, um, to make sure that we re not, um, subjecting community to something unnecessarily, um, it does mean that they don t, there s very little movement that has to happen now in, in preparation for the start. So they ve already experienced the discomfort and they ve worked through

it. They ve had ways to tell us how they could be better throughout this whole year. And so we ve been working with them, um, continuously through the year. And so this coming year, we don t anticipate a ton of new discomfort, um, and we ve learned when we need to start communicating and planning for the move that will happen at the end of the year when they can move into the spaces that are, that are being worked on. This year I like, if we look a little bit further down the road, the way the school community will experience is there won t be a lot of movement for next year. There s just a small, uh, I think a counseling office that needs to move, non-instructional spaces. At the end of next year, so

next year will be a year of construction on the, the, the side that s currently closed off to the school. The following year, the students will be moving into the new area that s been remodeled as they begin working on the area that they re in right now. So, they will experience newness, and, and this is why it s important to get this contract so that we have the two full summers to do work on the building, then we ll work on the second side of the building, and then after that 2nd year of construction, the in the, the, the vast majority of the building will be open to the school community. So, you know, there is going to be a year this next year where they ll be constrained to this area. And one

year where there ll be extreme constrained to the new area, but they will experience newness within 16 months of where we are today. Right? So there s gonna be multiple ribbon cuttings as the whole campus becomes revealed, um, including the field, including the stadium, and then finally including the shops. So, I just want to name that there, there is, it s a little different than like some of the projects where you have a big ribbon cutting and it s completely open. The students will experience upgrades in the following year. Thank you Alrighty, we ll go ahead and take public comments on this agenda. MR. Hollis. Are there any commenters? Yes, MADAM PRESIDENT, there is one side of Olubala. How much time would you like to allot for public comment. So insulting and disgraceful It feels

like you were diagnosed last year with cancer. And this is the, after a year, we re gonna give you chemotherapy now. That s how it feels for a whole year I have been coming to you asking you. Why we have not started this project. You even have tonight confusion. You have one agenda that alludes to $99.7 million. Another gender, $97 million. Even have different start dates. This project was supposed to end in 2027. And you act like, oh, we re moving it to 2029. We were supposed to do the football field a separate funding for the football field. Somebody said, oh we re gonna change that and put it with the project. You didn t have to do that. There was no reason to do that. But you did it You have caused a lot

of inconvenience inappropriate. Let me tell you something too. You re gonna come back I was at City council meeting on the army base. The Army base has started to develop commercial uh property The contamination. It s been discovered contamination is still there. Even after efforts of remediation, it cannot be resolved. The soil, the uh ground water. Is still contaminated This is so insulting and you breeze by it like it s nothing. These young people s lives have been impacted for a whole year. You got a community where they just accept. I don t accept this. And I ll continue to say, this is a disgrace. You have no reason to have this project being done like this. You haven t explained anything. That football field, where we gonna play next year? Where we gonna play

next year So there were some discrepancies between the items that were posted for the 6 o clock agenda and the 6:30 agenda. Can you describe a little bit as to what happened and why that item was withdrawn and the special board meeting is happening today. Thank you for the opportunity to explain. Um, in our processing of the, um, the final documents, um, a placeholder item was, um, inadvertently included in the um the documents to, to be shared with the public. Um, that placeholder item included pre-final numbers and dates and and a spelling error. Um, when we discovered that error, um, we worked with, um, the parliamentarian and with the chair of the committee, um, Director Batchelor, um, to determine how we could best move forward, um, being as transparent as possible about the um the

actual correct numbers, um, and information and ensure that the public could um, weigh in, um, and give you their perspective as well. Um, while continuing to be able to move forward with the already delayed timeline, um, and we really appreciate the opportunity to do that in this forum, in this special meeting. Yeah, and thank you. I think uh that came to me pretty quickly. We were able to remedy the situation. Just got timing a little bit off about when we wanted to do this meeting, um, but yes, and I wanted to make sure that this was the first item that we talked about, that there were no other delays that we could cause on our end, uh, because the school community has had multiple delays, as has been said, um, and those students have been

very much impacted. Um, so with that, I think we ll go ahead and take a vote on this item. Um, MR. Hollis Yes, MADAM Chair. On the motion to approve, um. By the Board of Education upon recommendation by the Facilities Committee of Amendment number 2 Agreement between owner and alternative design builder buying between the district and Ayden Construction Inc. With hkit architects on the motion Director Barry Yes Thompson? Yes, Batchelor. Yes. A is approved. Wonderful. And then that means this item will be on. This is not That means that this item will be on the MAY 27thboard agenda. It s a disgrace. All right, so with that, we will adjourn, um, this special meeting, um do we need to take any sort of number of minutes before we open up the other. Yes, it ll

be uh postponed, possibly 1520 minutes at this point, um, I ll let you know as soon as we get it up and running. Wonderful. And just so folks know in uh Zoom, it s because we need to switch out tech pieces in the background to make sure that we can accommodate the regular meeting that we re going to have next. So again, uh, the special board
