001okay so trusty L is connected now I think yeah yeah that makes three of us okay perfect great thank you okay so now I would um like to call to order the West UNIF High School District Board of Education June 10 20120 regular meeting um do we have public comment before close session we have one public comment from Matt Horton um Mr Horton thank you greetings everyone uh probably the last time you'll hear from me from a little while at least uh praise me for small favors I imagine um I just I wanted to take a minute and just tell you how disappointed I am in all of you uh you've been hearing from us for months in in every conceivable format uh I won't bore you trying to change your mind or find another
002re another way to reach out and change your mind on this issue of Dr mura being forced out of her position except I did want to say one thing and and just let you know that our site Council has received the advanced performance report for this year and Lupine Hills has improved in nearly every metric you folks use to measure the success of a of a school um so I just I don't know what narrative you're being sold uh or or by whom uh but these results really should speak for themselves um so I just I want to say shame on all of you uh you came here to help the district and our communities and and and our kids to be the best vergins of ourselves and today you're absolutely failing in that um
003instead of showing the leadership this Des this District desperately desperately needs you're choosing the easy way out um you you just you're going to keep your head down and and don't speak out on this and you know don't support the folks that are out there trying to improve things for everyone um you know pretend pretend that this is out of your hands and there's nothing you can do we'll we'll see you again in the lead up to November thank you actually there is now one more public comment um and that public comment is from TJ Warfield thank you thank you Mr Horton I just want to Echo the disappointment that us as a community has for this board and the superintendent and how we've gone to this this board meeting every single time it's been
004in session and watching all of the board members on the video looking disengaged disinterest uh disinterested not listening to any of the public comments just looking like they couldn't care less you all have been very disappointing you're not leaders I just I can't express how upet I am that this district is failing across the board and how you're just you're refuse to to do what you promised you would do um fine if you're not going to give us back murza at least give us a leader at Lupine that isn't just going to let the status quo go isn't just going to let random teachers do whatever they want like all of the other principles in the past there's a very strong candidate that um you should choose over the other one who's just not going
005to be a good fit so if you won't let us have Dr mza which is a joke and just so disgusting on your part at least give us the our first choice candidate because the other one just isn't an option our school our children deserve better and shame on all of you for failing in your jobs thank you that concludes uh public comment thank you Mr Walton okay thank you public for sharing your uh public comment with us today and now we're going to recess to close session in return for Open session at 6:30 thank you everybody almost all of our members present we uh just need trusty guas still arrive okay perfect okay and Mr Duffy is about to be here in one more minute so we will begin our meeting um as soon

023thank you so much um even though I am an activist I do get really uh kind of shy and scared when I do read so hang in there with me if I do stutter a little bit of course we'll be ready to jump into if needed all right thank you guys should I say now yes thank you whereas on February 23rd 2020 25-year-old Ahmad arberry an unarmed black man going for a jog was shot and killed by two white men one a former law enforcement official in Glenn County Georgia um and on March 13 2020 26 year-old emergency medical worker Banna Taylor was shot and killed by police inside her home after a no knock raid and on May 27th 2020 46-year-old father of two George Floyd pleaded for his life and was ultimately killed
024by a police officer who pushed a knee into his neck for more than nine minutes while Floyd lay handcuffed on the ground and whereas the death of aad arur and those of excessive and militarized force are among the most serious ongoing human rights and civil liberties uh violations in the United States and have led to community uh destabilization a decrease of uh a decrease in public safety and in exacerbation of structural inequities and whereas the system of policing in America and it systematic Target and the use of deadly and brutal force against people of color particularly black people stems from a long Legacy of slavery lynching Jim Crow laws and the War on Drugs in the United States and has been perpetrated by violent and harmful law enforcement practices and whereas contemplar police practices that
025employ policing for low-level offenses as well as expanding and excessively militarized police has led to a mass criminalization High violence and mass incarceration of that disproportionately impacts black and brown people and whereas police Ed the force in among the leading cause um causes of death for young men of color and black people including black women and girls Native Americans and Latinos are killed by police at disproportionately higher rates uh than their white peers and whereas people with disabilities and and other historically marginalized commun ities including lgbtq plus individuals um immigrants and those experiencing homelessness are significantly more likely to be criminalized and targets of police violence and whereas over the last two decades the number of police killings has increased dramatically since 2013 police officers have shot and killed roughly 1,000 people each year and
026whereas police brutality and the use of excessive force have robbed countless communities of precious lives have inflicted inter generational harm and Trauma to families and are intensifying our nation's Mental Health crisis and whereas do somebody want to pick up for me real quick I'm sorry I think he's doing okay I think we should just be patient yes thank you uh all also start words police in the United States through acts of brutality and the use of excessive force kill far more people than police and other comparable Nations and have historically shielded from accountability and whereas the killings of hundreds each year the demonstrations have followed have brought sustained National tension to the racially biased police violence against people and whereas US Representative um is it I don't know how to say it wrong Ayana Ayana
027Presley along with the US Representative ilhan ilhan Amar US Representative Karan B and the US Representative Barbara Lee have introduced legislation condemning police brutality racial profiling the use of excessive and militarized force and calling for systematic reforms necessary to stem the epidemic establishment of positive School climate policy that a recognizes that inv uh that involvement in the um delinquency a system has a significant negative impact on it students including higher like um likelihood of dropping out and later involvement in the adult criminal system B students and delinquency system often struggle to uh reintegrate reintegrate uh into their school communities and make academic Pro uh progress after arrest and incarceration and see WCC us uh USD has made stride to limit the role of law enforcement addressing minor School related behavior and begun to focus more
028resources on effective evidence-based supports and D wccusd consider referral of students uh to law enforcement a last resort and E funding a law enforcement should be redirected towards the reduction in class sizes and total class loads to support restorative justice practices and whereas the belief of all students can achieve a higher level of proficiency um and that the effects of institutionalize uh uh racism can be uh mitigated in Central and high Equity uh is viewed in West country Casta Unified School District now uh therefore be it resolved that the West country Costa Unified School District Board of Education um strongly condemns the extra extrajudicial killings of Ahmad Rihanna Taylor and George Floyd and causing citizens of this District to join in peaceful protest to call for the adoption of sound and unbiased law enforcement policies
029to all levels of government that reduce the desperate impact of police brutality and use of force on black and brown people and other historically marginalized communities and be further resolved the West Contra Casta Unified School District Board of Education calls for the cities of Hercules Peno s Pablo Richmond and elero and kasta County to end militarized policing practices support strengthening efforts to eliminate instances of excessive use of force and conduct stringent oversight and independent investigations into instance of police brutality racial profiling and excessive use of force and hold and hold individual law enforcement officers and police department accountable and be it further resolved the West kraasa Unified School District Board of Education directs the superintendent uh to write a letter in support of the house resolution introduced by the US Representative Ayana Presley along with
030the US Representative um Alon Alon Omar US Representative uh is it Karen I sayen Karen Karen Bas and the US Representative Barbara Lee that condemns all acts of police brutality racial profiling and the use of excessive and uh militarized Force throughout the country and be it further resolved the West kraa Unified School District Board of Education directs a superintendent um and District staff to develop um uh antiracist anti-racist sorry I can't read anti-ra you got it policies and procedures and provide training for teachers staff and administrators to understand race racism um and its impacts on teaching learning and knowledge transmission recognizing difference between anti-racism and multiculturalism and uh pedagogy pedagogy curriculum and educational advocacy and understand how the place geography uh and institutional cultures are uniquely important um to the implementation of such programs okay
031thank you so much student trusty Vasquez simola I really appreciate that you read um this long resolution that is crucial at this moment and I really um appreciate too that you uh that you did this you know for for the whole Community to to hear to know that this is where our values are and I I appreciate all of the work that you have done not just then the Insight that you have provided the questions that you have raised but also the mobilizing in in our communities I think all of that is so crucial to this moment and to to all the time you know not just now um before yes trusty Phillips I would like to move the resolution great second trusty penis trusty Penna seconding the motion by trusty Phillips um before we
032vote on it I want to give space for our trustees to to speak on their um you know on just share what they're thinking at this moment because I think this is a crucial um point I think we're at a Crossroads and I really want us to have an open um conversation about this and I I don't want us to you know just pass it I want us to actually hear from each other and have the community hear from us and and communicate with the public about this and um before we do that I just wanted to know if there was any public comment for this I know that there is a lot of hands raised um and it's hard to tell if if it's for this specific item um yes uh president Hernandez Jarvis
033we're going to assume that everyone's hand who is raised right now wants to speak on this item and we have currently 21 um 22 23 uh hands raised to speak okay great so I see that there are okay so I see that there are 2 five now so um we're going to have one minute per speaker since it's more than 15 and okay once we have the first speaker um share we want if we can do um as best as we can to make sure that we we monitor that we listen to everybody that had their hands raised before we start the discussion okay um and um I will again uh let the public know we need a first and last name uh there is the name of a church that is listed and we
034would uh respectfully ask mlin Temple if you can uh sign back in with a first and last name um and if you only have a first name or a nickname uh we will not recognize you for public comment at this time thank you Mr Walton the first public speaker is Helen Burks Miss Burks go ahead and unmute hello my name is Helen Burks I've been a wccsd employee for nine years first a teacher at elero and now an assistant principal at Kennedy over these years I've come to know many different school resource officers and have both positive and negative experiences about interactions with students that I could relay in relation to this resolution I ask that you make further action in order and that you terminate all police contracts with our district I think that
035it's an action that follows from the logic presented in this resolution my reasoning comes from a deep Phil opical belief that the presence of police is antithetical to the purpose of schooling and also from a copious amount of research into the impacts of police in schools that shows they do not increase student safety reduce crime and instead result in higher suspension rates and triple the odds of a high number of arrests and wi racial disparity I've been especially inspired Lately by the youth and alumni who are part of Richmond Revolution sharing their experiences and Leadership I ask that you listen to their heart dreams pain and hopes thank you all thank you the next public speaker is Gabriel meletti hello yes we can hear you hi great uh my name is Gabrielle MTI I've been
036a teacher at Verde Elementary for the past four years um I am so hopeful to hear about this resolution with the schools um because like the prior speaker I do believe in the research shows it is really antithetical to that school experience to have authority figures there that are not mentors like teachers like principes like other staff I'm really hoping that in this year where we've had to make so many cuts and everyone's made sacrifices that we can also make this cut here and take that money elsewhere take that money in places where it supports students and helps them grow and helps them deal with traumas they may have to deal with instead of creating them so thank you so much for considering this revolution or resolution thank you the next public comments from Olivia
037chisi good evening honorable board members and Personnel of the district um I I'm I'm wondering if I can still speak since um a principal has been appointed for Lupine um Miss chesi we that item is not uh this is not for that item that item um has uh already been reviewed and discussed by the board so you can uh comment in the general public comment item on item B8 or B9 and if you raise your hand at that time uh we can call on you then yes for item um b11 item B1 thank you president thank you so much thank you Mr Molton thank you the next public comment is from Marissa uh gliden Miss glinton if you can unmute hello my name is Marissa gliden I'm here today because black lives matter and we
038must all grapple with the fact that our systems in our schools are shaped by inequities by bias and by institutional racism as educators we have an obligation to work to end the school to prison Pipeline and with that West contracosta Unified School District must immediately eliminate school resource officers and invest in our black students the funds used for policing our schools must be now used for counselors training and ethnic studies thank you thank you the next public comment is from Nikki Marlin Miss Marlin hi can you hear me yes okay cool hi my name is Nikki Marlin I'm a teacher of a K8 um I first want to shout out to we you did such an amazing job at the protest I was there awesome thank you so much for organizing that now um I
039also want to demand an end to the contract with the police department and to remove all officers from our schools we must invest this money into more counselors we need to provide mandatory anti-racism training and provide ethnic studies for our students thank you I Y my time thank you the next public comments from Chim CH chimaca in hello can you hear me yes hi my name is chia Maka I was a student at alone Elementary Lupine Elementary Hercules middle and eventually Hercules high school so definitely wccusd um student I now attend UCLA with um getting a bachelor's degree in biology and I think that um all of the resources that I didn't have while I was a student um at all of these schools um you all have the potential to provide that um by
040completely terminating contracts with um the police and investing those resources into ethnic studies into more counselors in to um more hiring more non-white teachers that they can relate to there are just so many different resources that these students let students that like me needed back when I attended these schools that you all have an opportunity to present them or like give that to them now because they so clearly need it thank you thank you the next public comment comes from Jacob Gran hi can you hear me yes hi good evening my name is Jacob Gran and I work at Richmond High School as an instructional coach um I'm calling to recommend and urge the board to take a step further with the resolution and end the contract with the school resource officers I think it's
041imperative that we not only talk about defunding our police and that we shouldn't have police in our schools but that we also need to talk about reprioritizing that money specifically towards the African-American uh students resolution to support the ASAP resolution uh we need to make sure that our students have the appropriate our black students have the appropriate funding to support their needs whether that's through counselors whether that's through Mental Health Services uh whether that is through uh additional restorative justice coordinators all of those things we know will support our black students and so I urge the board to take a step forward and make that appropriate resolution thank you thank you the next public comment uh comes from Danielle store hi I was I wanted to comment on the healthy enrichment proposal do I wait
042to do that or do that now um the healthy richment proposal for the I think um I think if I if I may respond to I think that maybe she was referring to the public hearing for the budget oh I don't know potentially maybe I thought I thought is that where it comes up I I'm not sure um is it for the recommendation yeah for from healthy Richmond it's it's also regarding the police and um you know so does that mean we wait here probably no I oh she needs to speak now Madam chair because it's related yeah it's related to this to um to the topic of this resolution so yeah it's a good time now okay thank you yes thanks my name is Danielle stoer and I'm a parent of a wccusd student
043and I also work at the James morous project Health Center at elero high school where I've been there for 18 years I'm here today today to support the proposal um from healthy Richmond to stop using District funds to pay for school resource officers and instead use those funds to support counselors and the school-based health centers as many other people have said I don't think that using police funds to um you know to I mean using District funds to pay for police is The Right Use of our money thank you thank you the next public comment is Demetrio Gonzalez good evening School Board member student board member and superintendent Duffy my name is Demitri Gonzalez Hoy I'm the president of V teachers of Richmond Educators in wcusd stand with you this resolution and with our youth
044condemning the racism discrimination and Injustice that has been occurring in our country for for far too long we have an obligation to act and to listen to what leaders across our country and what youth in our community are saying Educators stand with youth today and we ask that you expand this resolution and act on the five following things one you must defund school resource officers from all of our schools for next year two we must provide training for educators and administrators this summer around restorative justice practices and implicit bias training three we must provide space for black Educators to share input concerns and needs that they have experienced and that their students experience every day in our schools four we must uh we must come through what our positive climate resolution says and ensure every
045site has a raise and Equity team that discusses data for their schools lastly do USD must create a plan to increase access to ethnic studies courses for every student thank you we must act today and history will judge us for how we react to this crisis thank you our next uh public hear um speaker is a Wilson Mr Wilson good evening everyone so I just like to Echo the sentiments of some of the folks that have already spoken earlier in order of us to do the right thing then we do need to defund our school officers and we also definitely need to provide training for our Educators regarding anti-racism anti-racist practice and we must have discussions about race and Equity not just equity and we also must provide space for black Educators to share input
046concerns and needs if our black students are aware of the fact that their black teachers are heard and listened to then that will make them feel a little more confident to being heard and listened to as well by their black Educators also we must create an some type of plan to increase our ethic studies course I will be teaching the ethic studies course this fall but there's only one of me and we need to welcome that into the district and D I appreciate you for reading the resolution earlier you did a great job and it's great to see that happening amongst the community thank you thank you our next uh public speaker is Lucero Garcia hello yes hello my name is Lucero Garcia I grew up here in this community I attended Kennedy High School
047graduated in 03 I also work at the JMP at Elser Ohio and the health center and so yeah we have to step it up you know in 2003 I remember the experience of having police officer come in and motorcycles on the K telling us to go to our classes what message did it send that we were not valued that it didn't matter right we were already being trained to be in a specific position years later we're having this conversation I graduated 03 I ask that you really value our community value our kids right step it up and contracts at herd and devalue let's begin long needed repair and healing fund our health centers every day you know during this time I've been contacting parents having students contacting me so I ask that you really fund
048what is needed to repair and heal from everything that's going on thank you thank you so much our next public speaker is William McGee thank you I appreciate you guys taking time to discuss resolution I will say that there is a need for more support and along with the killings it's not just the killings of black people were concerned about but it's also the law enforcement and the white Vigilantes that are a way to get away with this so that's what else is upsetting the thing that we need to also talk about in our district is the hiring practices and the retention and S um support of black Educators there needs to be anti racism training from the superintendent's office through the whole organization we all need it we all need to be in this
049fight together and as we just heard the space for black Educators is now I want to come back and introduce Ben the black educator Network to you all this is something that we have started in the West Contra Casa Unified School District this is the opportunity for all black employees to share their voice and it's also an opportunity for other people to listen to our experiences thank you thank you the next uh public speaker is Yolanda Vieira Allen thank you um as I'm reading through the resolution I'm first let me say thank you so much for taking the time to do this and putting the efforts that you did into this resolution I also want to remind you you that for four years Asad has been asking for this this is not new to us
050this is exactly what we've been asking you to do if you have ignored us who have been here how do we feel confident that this is going to go anywhere this feels like much of the same that we've been getting I hope that this board holds this Administration accountable to implement this resolution passing a resolution is fairly easy as we have seen getting a resolution implemented is the difficulty and the institutional racism the bar is the barrier to getting it enacted please let's fix that thank you thank you our next public speaker is rqa Ray hi um my name is Rocka Ray and I'm a middle school science teacher in wccusd and also a woman of color I'm speaking out to advocate for the immediate abolition of police officers on wccusd campuses in light of
051the most recent budget cuts as well as our current geopolitical situation it is wildly inappropriate to continue to pay $1.8 million per year for campus police on Monday I attended the vigil for Eric Salgado who was killed this weekend shot 40 times in East Oakland by CHP so many Educators myself included fear that the next hashtag the next name chanted the next person summarily executed by a police officer will be one of their own students having police at school sites is nothing more than a scare tactic police are not social workers therapists or counselors and their presence on campus threatens the well-being of all students but in particular are black students who are already marginalized and disproportionately over disciplined as an educator how can I have faith in our district leaders when I next year
052my school will see fewer teachers fewer therapists fewer counselors fewer social workers and fewer grad tutors but the same number of police I am not asking you to defund and abolish the campus police I am telling you it is in your comments inexcusable to continue to have them thank you thank you the next speaker is Lucy sturba can you hear me yes hi my name is Lucy sturba I'm a rising junor elero high and I'm also member of the ysp with dowit who organized the protest on Monday um I'd like to just express my support with the others who have argued for the district to terminate all contracts with school oh sorry school resource officers um it's been seen Nationwide that policing policing in schools directly contributes to the school to prison pipeline especially for
053black and brown students who are three times more likely to be suspended than white students um we've been spending up to a million dollars on these officers but if we instead directed that money to social workers we'd actually be solving the problem instead of um adding punishment instead of providing help um so I'd just like to support that thank you thank you our next speaker is paa chakon hello board members my name is paa chakon and I am a former dza high school graduate high school peer mentor teen dating abuse Advocate and current San Francisco State University student during my time at deanza I was unfortunately a victim of teen Dating Violence I thought I could trust the SRO at my school by being being vulnerable and sharing my story their SRO I trusted told
054me that my situation was my fault and no jury would believe me during my time at da there were only three school counselors for more than 1300 students so I was not able to meet with one thankfully a friend referred me to an Oregon the Student Health Center that offers resources such as counseling and advocacy training I felt comfort and solidarity in the organization than I did in the sro's office we the community members of richond California are demanding the SRO be removed from schools and use the 1.8 million taxpayer dollar that is used to F them towards counselors psychologists Resort of justice and mental health programs thank you board members thank you the next speaker is Nathan baric good evening board members my name is Nathan Beric and I'm a concerned Community member and
055advocate for restorative justice the issue that I would like to address is the use of school resource officers and the termination of the contract in place I feel this $1.8 million is better suited for ethnic studies courses counseling and school psychologist this will improve mental health and awareness of students rather than perpetuate the school to prison pipeline the ACLU has proven through research that the continued use of officers in schools targets people of color Zero Tolerance policies criminalize minor infractions of school rules while cops and schools lead to students being criminalized for behavior that should be handled inside the school these are young children being put into a juvenile crime system when there's plenty of time and resources to help them I'm sure some of you have children nieces nephews you would want a second
056chance in this world instead of being thrown into a system that fails them and creates a feeling of contempt that they carry the rest of their lives thank you thank you our next speaker is Wanita Flores Mahia hi um I wanted to say thank you to DT for um doing the resolutions I think he did a great job and it's hard to public speak so thank you and I also saw him at the the rally on Monday and I thought he did a good job there too um so my name is wiita Florence Mahia and I teach fifth grade at Florida Elementary I wanted to ask um for you all to shift the budget allocations for police to programming for black students punitive discipline is um in this district has a disproportionate impact on our
057um black students shifting our resources away from punitive models and toward restorative justice and mental health can help address such disparities last year alone we spent 1.8 million and we have like 1.5 million that uh supposed to be allocated for sros in that kind of uh system um this money could be better spent to hire more school counselors and you know people to help in the mental health areas um other districts in um California have already eliminated reduced or considering eliminating reducing um police presence at schools um so I just wanted to ask if you could please consider adding this item to the next agenda for consideration and thank you for your time thank you our next speaker is zon Harrison Miss Harrison if you can unmute oh can you hear me yes thank you
058guys for coming I mean for letting me speak and thank you guys for all um listening at least to this resolution if you guys do not pass this um recommendation and take it in I at least want you to look at retraining the safety officers that interact with our children because like a lot of the speakers said this isn't always a good thing to have people there that don't know how to support black students and I do realize a lot of the safety officers at my child school which is Richmond High are black so I would like to keep some of them there for mentorship and to help black students that are on campus but in a different way so uh peacemakers can offer supportive and getting instead of safety officer some type of different
059name and support with training around how to interact and support black students and staff thank you thank you our next speaker is Armand Lee hello everybody can you hear me yes good uh first want to say uh we often say black lives matter but we have to put our policies and our money where our mouth are uh is um my name is Arman Lee I'm a Richmond resident at wccusd alumni wenton Mar Vista um Lan dejan and Elso graduating 2015 and I'm a current UCLA student um it's a shame that our schools are currently modeled um after prisons uh we know that black bodies are car carceral rized at a higher rate and black girls and boys are suspended and pushed out of schools than any others um this is an intentional act to undermine
060black communities as education is highly political uh just last year my 8-year-old cousin was arrested inside of his classroom for throwing a tantrum beginning at the age 11 I was exposed to school policing at D Middle School through high school I'm demanding that wccusd rate their contracts with local police departments and I advise wccd to fun all those resources to underrepresent it and underserved communities um black communities aiding in Mental Health Resources restorative justice uh youth programs and that will actually strengthen our communities and actually make them stronger thank you our next public speaker Sarah Tama hey can you hear me yes okay so I'm Sarah I been going to or while I have gone to WC USD school since I was 5 years old and I graduated in 2016 from deanza high school and
061in my opinion we should be defunding and terminating the contracts with the police and invest in our black youth and black Educators when I was a student we were always told that we didn't have enough money to give us the support we needed such as counselors and mental health services and we and our duty as well since now I'm graduated our duty is to stand up for the the youth that are like you said protesting for you guys to hear that they that the police are sorry that sorry oh my go um anyway ear you mentioned that the youth are organizing protest and always have been for many years to make that change and we've been fighing fighting hard for this and it's your job to listen to the community that we need to provide
062training and Educators around restorative justice thank you for your time thank you our next speaker is L Lucy uh gusta hello I am a alumni of elero High School parent of a student in wccusd and a teacher at Hercules middle school and I want to support the people who are talking about um policy and action I absolutely think we need to have these um items instilled in our district however we have policies that contradict that for instance the Hat policy that we have um has negatively affected our students of color with not being able to use head coverings that make them feel comfortable for um their own purposes and um it has had a huge negative impact also having um administrators trained so that when we report racist comments that we hear that there is
063follow through with that so please continue to support our students of color marginalized students with not only money but policies thank you thank you our next speaker is Simone Anderson Miss Anderson can you hear me yes all right um my name is Simone Anderson I'm a Kennedy High School alum class of 2018 currently an undergraduate at UCLA right now um during um my time at Kennedy I've seen countless police violence I've watched my own friends be beaten tased slammed against lockers thrown on the ground put in choke holds handcuffed right in front of me um I've experienced some harassment myself from not just sro's but actual RPD cops um innocent kids are being policed brutalized and violated in a place that's supposed to keep us safe and instead we're being treated like criminals wccusd needs
064to terminate all contracts with police entities police in our schools police in our school districts perpetuate an oppressive system that limits the achievement of our black students I think these funds um used to fund SRO should be reinvested into counselors and Mental Health Resources and programs for our students college readiness programs restorative justice programs and trainings diversity and Equity trainings along with trauma in informative trainings for all wccusd please conclude your [Music] comment our next speaker is Diana Le you hi my name is Diana Le um I'm a former seventh and eth grade history teacher and taught for four years at laavan Dean Middle School I currently work with an organization that supports theal development of students in California and I'm joining this conversation today to urge the board to remove police presence from schools
065in West Contra Costa I was at laan dejan the year that restorative justice was introduced on our campus and I saw the incredible relationships that our students built with our RJ coordin Ator our school psychologist and our counselors and the impact that those relationships had on students and on their social emotional and academic Development Across our community staff members fought hard to support the needs of all of our students but there were not enough hours in the day we needed more adults on campus dedicated to the well-being of our students and in my experience those interventions deeply impacted outcomes as a white woman I'm grateful to have worked alongside educators of color and I know that I would have benefited from further training and restorative justice anti-racism training and ethnic studies curriculum to ensure I
066equitably supported the students in our community as a member of our community I urge the board to defund police presence in our schools and to use that funding to invest more in counselors provide anti-racism training for educators and provide ethnic studies classes for all students thank you thank you our next speaker is lesante Smith hi can you hear me yes thank you um good evening superintendent de and Schoolboard thank you for bringing forth this resolation um my name is lante Smith and I'm speaking today as a parent um in a Community member of this school district I attended the West Contra crost Unified School District since kindergarten um and ended up graduating from Hercules high school policing is detrimental to the economic and public health of the black community due to the restrictions it places
067on access and achievement West contracosta Unified School District must take immediate action to address the education systems that contribute to the population of black and brown students in the Juvenile and prison systems we all know that the school to prison pipeline is real and it's time to take action I am asking that West Contra Unified School District immediately terminate all contracts with local police departments I am asking for the investment in mental and Behavioral Health Services special education and restorative justices practices that Pro to disrupt the school to prison pipeline also research shows that the presence of school police officers on campuses do nothing for reduction in school crime they it does not increase uh perceptions of student safety but instead it results in higher rates of suspension and increases racial disparities it also triples
068the odds to a high number of arrests and creates a wider racial disparity in our Criminal Justice System I'm asking us to step and be a part um of this historical moment and stand on the right side of History we have to terminate the contracts immediately and we have to invest in our communities and we have to serve our students who have been underserve for so long thank you thank you the next speaker is Marcelo Lopez hello can you hear me yes okay perfect hi everyone my name is Marcelo Lopez uh I am an alumnist of the wccusd school district as well attended Murphy Elementary cresy and dianza uh I just recently graduated last year uh with a degree in international studies from midbury and I'm an ex Fullbright Brazil scholar so in terms of
069abolishing the SRO um I'm just echoing some earlier points that I did hear people communicate uh that they you know just in my own experience with the sro's um at da there were three counselors for about, 1300 students and there were a three assistant principles the problem is that there was such a high turnaround that a lot of people didn't feel like they really had the support speaking more to the role of the sro's The increased police presence also leads to increased criminalization uh particularly with minorities particularly black and brown bodies so I think that once again if we are going to say that black lives matter if we're going to show up we do need to make sure that we are stopping uh stop perpetuating the school to prison pipeline um I also wanted
070to say that we do need to invest in our black Educators mainly because a lot of the teachers from da please include your comment down thank you Adam chair can I ask a clarifying question yes Jesse glas did that speaker actually run out of time before or they were told to please conclude their comment cuz maybe the clock on my end is slow um I was not looking at that clock right now um superintendent Duffy maybe we can bring back that last speaker and have them um and I get it we're I I I I don't know what's going on but it feels like we're telling people to conclude their comment well they still have 15 10 minutes 10 seconds left to speak and then what that does is stop them from finishing their one
071minute thank you for bringing that to our attention uh Mr Walton if I may uh president Hernandez jarson and trusty quas um actually we've been allowing people to go over and uh so they're over by 15 seconds got it okay or so thank you for that maybe for um even more transparency with the public would it be possible to pin the the clock that has the um the the image I'm sorry from U Mr Nick burger that way everybody can see the time because I I think that what I see currently is when the speaker is talking we see that so maybe if we pin the clock that way the speaker um image won't move and we'll just have the clock at all times visible does that make sense yes we can work on that
072okay perfect thank you thank you tras for bringing that to my attention our next public speaker is Audrey shieldz Miss shieldz hello do you hear me okay it seems to me I I've only been around District a couple of years but I've been spending a lot of time in looking what's going on and it seems to me the biggest problem this district has is that black people are not seen black people are not listened to and our opinions are not taken into consideration we request information we offer advice and we are seem to be completely ignored I I have noticed uh complaints from various teachers in the district and uh other professional Educators and administrators in the district black people are leaving in drone black professionals Educators and administrators are leaving because they're not feeling
073supported and they're not feeling like they're heard uh the monies that are requested for the Flatland schools are not being made available to them we need to be seen you have to see us see us and hear us do help us we'll take you where we need to be we need to look at programs like peacemakers where um Community Based people who love black kids come in and work with us and families and make uh progress in the school we don't need to be policed we need to be supported and understood and helped thank you the next public speaker is Alex mazwi hi can you hear me yes yeah okay so good evening board member members and thank you for taking my calls so my name is AD maet and I live in Richmond close
074to Caesar Chavez Elementary School I would like to urge you tonight to support defunding the police from all public schools enrichment we need to cut the police budget and use the money elsewhere there are many areas in education that can use more funding for instance we need to upgrade the our school's technological equipment for the benefit of both students and teachers we need better training and a more racially Diversified Body of teachers and we need to invest in our neighborhoods that have been systematically D divested from four years thank you so much thank you our next speaker is Simone malovich hi I'm calling in to support the resolution to terminate school resource officers and West Contra pasta School District as many have said this would create opportunities to reallocate funds to things like Mental Health
075Counselors ethnic studies classes RJ coordinators in anti-racist trainings for our staff it's our responsibility to dismil the school to prison pipeline I really hope you're listening to students especially the ones on this call when they say that RSO officers in their school don't make them feel any safer um I hope we're following the lead of other districts and we're defunding we're defunding the resource officer program in WCC us because black lives matter thank you the next public comments from Brian Coleman I'm sorry Brian Coleman hello can you hear me yes thank you you know I've been a parent in this district for a while now and attending a lot of these meetings and I do appreciate your board and superintendent duy for all of your hard work and everything that you guys have done but
076you continually do the same things over and over again and watching all these resolutions and all these meetings the problem you're having is from the top down your leadership isn't telling you hey we need to stop arguing with one another as a board you guys know what programs work and what don't work so us to keep continuing having the same problems in the same meetings shows me that your egos are in the way and you guys aren't really focusing on saving the problem and stopping the problem and us as parents are tired of it I definitely am going to make definite moves to make sure our children are getting taken care of and it's not just about the police it's about us policing ourselves to do better things and actually doing it thank you for
077your time thank you our next uh public comment is Guadalupe and Y and in Lana I want to thank all the board for this resolution and the work to adop in it but this is not enough resolutions that are not put into work and just adopted do nothing for the community I urge the board to continue the followup and implementation of this and many other resolutions that have come into adoption so that all that looks good on paper and sounds good looks good in the implementation of it as well thank you thank you our next speaker is Karen Larson my name is Karen Larson and I too am requesting that you defund the school resource officers contracted through the police department who have a presence at our schools I've been an instructional assistant at Richmond
078High for the last two years and have served on the PBIS positive behavior interventions and supports team for the last year prior to that I was on campus for six six years with an outside program supporting student writing I've been able to observe many different classrooms as well as the Halls on campus I have seen great success in programs such as Bay Area peacekeepers and the restorative justice programs facilitated by Catholic Charities as well as those programs run by our community health center that really support our students kids who are involved with these groups feel seen as individuals all of our students need and deserve this type of support in addition Richmond High is working to expand its offering of classes such as ethnic studies and African-American literature the savings realized by the defunding of
079the school resource officers could be used to support these programs and more teachers and staff at our sites need training please conclude your comment it's time to be brave and creative and to reimagine what engaging our students looks like thank you the next speaker is Jen Raider hi um I'm the director of the James Morehouse project the ECS school health center and a 22-year district employee I'm speaking in favor of the recommendations put forward by healthy Richmond specifically recommendation number one to repurpose $1.5 million of SRO funding to support school health programs we can make real this resolution adopted by the board and uh comments later by lante Smith Lucy sturba paa chakon and others around the impacts of police presence on school campuses policing is not the solution to racial Injustice we have an
080o opportunity to repurpose those dollars to invest in healing to use these funds for mental health and youth development services that provide necessary supports for our young people who are up against the effects of the pandemic and the ongoing trauma of racial Justice to not fund these necessary Services is another form of violence against communities of color young people of color specifically latinx and black students access these District these services in the highest numbers and I'm finishing school-based services are the only place often that these young people can access mental health supports a lack of funding for these Services next year would limit our capacity to serve these young people at the moment when their needs are greatest thank you thank you our next speaker is excuse me our next speaker is Leonia Bobo hello
081can you hear me yes okay I'm from Rich I went to Sheldon Elementary portala Middle School ELO high school as well as Contra Contra clost to college and I recently graduated from Howard University I now work with children inside the Richmond Community there is no need for our children to be be policed in school they do not feel safe with police there when I attended eler High School I worked on a youth council with the district I saw that eler have much more resources in schools such as Kennedy and Richmond and I hope that that is long no longer the fact but but this the this shows that resources should be allocated correctly there's no reason that These funds should be given to police when we can have ethnic studies classes college readiness courses more
082psychologist books and more much more resources in totality this is where our schools are lacking infl not in the presence of police during this time this is extremely essential because of society's move against police terrorism amongst black people and black kids are heavily present in wccusd I trust you all to make the right decision let's stop treating our schools like prisons you can show us that black lives do matter by removing police from the school thank you thank you the next speaker is Tamlin Chen hi this is Tamlin um I grew up attending schools in the wccusd um elementary through high school and my time I was taught by many racist teachers who have wrongfully called campus Cops time and time again disproportionately on black students um police are dangerous and create a hostile environment
083for students this resolution is performance and does not make black students attending these schools feel any more safe unless you immediately terminate all contracts with the police and have police and law enforcement permanently removed defund the police and put more money towards better teachers teachers who aren't racist black teachers who actually care about the safety and learning of their black students and also towards restorative practices thank you thank you our next speaker is Alica Africa can everybody hear me yes okay well my name is I was a former student um Harding Elementary KATU middle Elso High I'm a recent Els high school graduate a former culture keeper and student work at the JMP and I know speaking for um my fellow peers that that's sometimes the only place that um the most vulnerable students can
084access mental health Mental Health Services and the money that we spend on nsro could be spent on things like counselors or um mental health programs and just ways to better support um black students and other students of color um I was also part of the schools side Council and I remember um a student Representatives myself and Adrian slone advocating that we should when asked we should spend that money we had the choice to choose between an a SRO or a counselor and you said a counselor but that didn't happen I know that that's not a choice that the school board can can change um well I hope you do but that that that's like even our even our admin like they're not there has to be a change from top down like it just can't
085continue like people can have been advocating for this for such a long time and only now is there a resolution written up like this um yeah it almost seems performative but I hope that changes so yeah thank you the next speaker is Carlo Huna hello can you hear me yes hello my name is Carlo Huna and I've been a social studies teacher at Richmond High School for the past two years I wanted to express my deep appreciation for the students in our community who've organized demonstrations and protests during a global pandemic to Rally our community for this cause we need to follow our students leadership our duties is Educators is to serve all of our students and meet their needs this past week we've heard what our students demand they're asking for the removal of
086police officers who monitor Richmond campuses which they describe and we've witnessed as a detriment to the economic and public health of the black community due to the restrictions they place on access and achievement when our students speak it is our duty to listen Beyond defunding campus police we need to seriously re-evaluate the implicit biases that exist at all levels of the school district and I support the idea of professional development for all of our employees of the district we need to invest in building ethic studies programs increase mental health and counseling services for black students and shift our funding towards restor of Justice programs I'm here to say unequivocally that black lives matter and demand the school board to make this a continued priority thank you thank you our next speaker is Gabriela nagula hi
087there can you hear me yes okay hi um I graduated from Richmond High School in 20 0 and um I'm currently a nurse now and um when I'm taking care of patients at my job the only times that we ever have police officers arounders um when patients have been when they're under arrest or when we have uh patients from s Quinton prison and um so having police officers at school is already criminalizing them so I uh really demand that the um almost $2 million that we spend on um sro's for the school district be um used better for healing the uh people that have been under served for so so so many hundreds of years um also we need to train our teachers how to be anti-racist um and that's all thank you for your
088time thank you our next speaker is cherylyn mcgallen hello can you hear me yes we can hi um I went to aloney Elementary Hercules middle and high school um and as someone who grew up in West Contra Unified School District police presence on campus did not ever once make me feel safe and I'm an Asian Pacific Islander woman um so for our black and brown youth police presence is not what we need for them to feel like they are in a supportive learning environment um merely enforces the school to prison pipeline um I would like to endorse healthy richment uh platform um divesting and um breaking all contracts with police um and reallocating that money into Mental Health Services um services and support for our Justice impacted youth um racial structural oversight committee to address
089specific racism specifically in the form of anti-blackness in scho school curriculum and on campus um support teachers of color um and I really hope y'all are listening because everyone has said that listening to the experiences of black and brown Youth and they have been fighting for this for so long thank you thank you the next speaker is Valerie Jameson m hello my name is Valerie Jameson I'm a wccusd alumni and parent I'm supporting healthy Richmond's demands and utrs memo of solidarity with the BLM movement I implore the board not only to pass a feel-good resolution but use this moment as a platform for all the important recommendations shared before me this includes but not limited to the immediate elimination of SRO in our schools if the district is contractually Bound By Any ongoing agreements that
090you exhaust all measures to Halt and divert funding away from policing policing in schools is not a personal attack on individuals in those positions but a pragmatic approach to dealing with the district existing budget shortfalls we must address root causes to our dependency on police Personnel and fund social workers and mental health practitioners as agents of prevention and support wccsd must provide training around RJ implicit bias anti-racism provide space for black Educators to be supported in the profession include aggressive recruitment strategies for bipac black indigenous and npoc Educators in our schools create race and Equity teams at every school um That's essential for addressing disproportionality of discipline actions negatively impact black students and a plan to increase access of ethnic studies partnering to Lobby the state and ensure ethnic studies is viewed as a legitimate
091course of study yielding a3g credits I urge the district to implement all include your comment with commitments and timelines for execution thank you thank you Sonia Decker hi can you hear me yes thank you um I want to up what a lot of people have already said um I'm a white family therapist and I work with youth and their families in contracosta County um many of whom attend wccusd um I urge you to end the contract with police and schools now defund the SRO and invest this money in programs that serve youth like restorative justice anti-racist teaching and mental health supports I urge you to listen to black and brown Youth and Community organizations who have been fighting for this when they say that they need police out of their schools now police in schools
092is incredibly traumatizing to black and brown youths and sends the message that they are criminal rather than supporting them to learn and grow and have hope for their future as a therapist I sit with many children in their families who have lasting Trauma from their interactions with police in their schools um many kids who have behavioral challenges in schools who have needs that are not being met are then arrested rather than supported and filtered into the Juvenile Justice System once kids are in the system any violation school can um rearrest black children matter please invest in supports rather than criminalization thank you the next speaker is Nicole Perez hi there uh I'm a Richmond High alumni 2010 um I just want to support the resolution and say we should definitely get uh rsos out of
093schools um it doesn't help anybody black and brown students left and right are constantly getting the short end the stick we all know the uh school to prison Pipeline and I really would like to see it end I'm tired of seeing uh my classmates their students I mean their kids um probably being at risk um to the system so I hope you guys put an end to it now thank you thank you our next speaker is Lena Tama hello can you hear me yes we can hi I'm Lena Tama I'm a senior at deanza High School class of 2020 and I've been a wccusd student since kindergarten it is time for wccusd to take responsibility for their involvement in the school to prison pipeline I've been advocating for the removal of officers on campus from
094the beginning of my freshman year from my experience school resource officers have been a negative aspect in resolving youth issues from what I've seen and heard from fellow C classmates and make students feel criminalized and antagonized it's the first thing we see when we go on campus through the window to the gates excuse me when students have issues that quote unquote require the use of police officers they need to have issues addressed by someone who can heal them not an authority figure that will make them feel unsafe and antagonized thank you thank you Guthrie Flashman good evening everyone um I I love this conversation and I'll be brief as brief as I can um other folks are more eloquent than I am tonight U I'm here to speak on behalf of devvon Faron Devon was
095a student of mine at Kennedy High School uh in 2009 uh sorry 200 uh six and we pushed him out um he didn't drop out we pushed him out and he was murdered in December of what would have been his senior year of high school I'm really tired tonight um but I was reminded by my good friend will McGee that black Educators don't have the luxury of being tired and so I'm doing my part in my experience in in 17 years in this district is that often when students escalate they escalate due to the antagonizing of adults um and on growing racial microaggressions um we have to do better whatever comes out of this we have to do better we have to train the adults in the building um to better uh support our students
096lastly I I'll leave it with a quote from Angela Davis in a racist Society is not enough to be non-racist we must be anti-racist thank you all thank you Hector malvido hi my name is ector malvido um I'm can you guys hear me yes we can great um I'm the policy advocacy and Community engagement manager with insuring opportunity to end poverty in Contra Costa County uh prior to this role I worked in schools for about five to six years working with youth and I can promise you that every time any interaction there was with youth and uh school resource officers it was harmful uh there's a saying that goes when it comes to restorative justice if and uh restora of Justice practices if you're not uh reducing harm you are inducing harm uh I am
097I stand behind healthy Richmond's uh recommendations every single one particularly recommendation one where uh we are divesting from uh school resource officers and moving those funds to school-based Health Centers um it is very important that that students have support networks especially when they are facing uh daily uh adversity uh for the color of their skin and for the society that they live in uh on top of conclude your comment exists outside uh that could cause harm it is very important that we are investing in our thank you our next speaker Stephanie Garcia of AA okay can y'all hear me yes we can okay great uh my name is Stephanie Garcia and I'm a rising senior at Rich and high my ask is to defund police and invest that 1.8 million into resources and uplifting black
098youth and students bip po have always been racially targeted by police and through keeping SRO at school it increases the chances of our youth being exposed to the school to prison pipeline SRO do not make me feel safe at school because I've been a victim of targeting by policing let's not forget how buildings of Richmond High School in Kennedy look like there is a difference between putting things on the table and not doing anything in actually doing something we cannot say we get we stand against inequality but continue to contribute to it thank you and black lives will always matter thank you our next speaker our next speaker is Melissa Payne Miss pay our next speaker is Jesus Galindo hello can can everybody hear me yes we can uh good evening everybody I just want
099to Echo the sentiment of all the speakers that came before me and I urge you think of the messaging the message will be powerful a district that not only listens to its youth but works aggressively to expand the Spheres of freedom and justice for the most marginalized in our nation a district that is committed to the liberation of our kids of color I don't know about you but I am if you could see my face I am beaming with pride to hear to hear all our students all our alumni um really engaging in this democracy trying to change the system in a way that's going to benefit the most oppressed in our nation it gives me hope and it gives me the energy that I need to continue this work thank you for your time
100thank you our final public comment on this item is audre Goldie Williams Miss Williams can you hear me yes we can thank you I stand with the black lives matter movement initially I was in support of officers on campus however what I thought was if it would be okay if they had anti-racist cultural competency and implicit bi training but I can't support any system that implements harm on our students especially our black and brown students anything that causes them to be affected and feel oppression safety issues harm the pipeline of prison prison or injury I was thinking change is coming but our youth have shown us that change is here defund school resource officers train our campus security give them anti-racist training implicit bias training cultural competency and use our funds to service our children
101with services that they need thank you thank you that concludes that concludes public comment I would like to tell the audience if uh remind them that they need a first and last name in order to be recognized and that uh we will cut off the public comment um at once we won't accept any new public com comment after public comment starts thank you Mr Walton and thank you to each of the community members who spoke and share their uh public comment with us it really means a lot to us um every time and I think even especially now I would like to open up now for discussion I know that we've had a motion in place already we've had it seconded and I really want to um give you know the mic now to our
102student trusty vas simala and then uh continue on to trusty qu trusty Phillips trusty buas trusty L and then myself at the end thank you very much for this opportunity I do feel really strongly about this so I appreciate um the opportunity to talk um well first of all I kind of wish there were more students who did talk about this I know there are a lot of students out there who do have an opinion um so I'm a little disappointed we didn't have any more but thank you to those who did speak and thank you to the alums who did speak um I think so if we look at the demographics of Elso it's 5% African-American right if we look at the high school 20% African-American if we look at the police it's almost
103all white um and all and then if we look at the teachers it's almost all white as well um all it takes just all one racist teacher one racist police that's all it really takes we had one white man put his knee into a black man's neck and now the US is in chaos there are a bunch of riots like it just all it takes is just one man so if we can help prevent that now I think we're setting us up for the future as well and as an African-American male um I don't I don't I don't love the cops I mean and like don't get me wrong the cops that we've had on campus I do like them and they've been good people but it's not about that one cop that you like
104that's on campus it's it's about all of them overall and what they could potentially do if you have the wrong one on campus that is racist um and so as an African-American male it I I don't love cops especially after what's been happening now and where we've always been talking about how we can help um Ure African-Americans do better in our schools how we can help African-Americans overall um do better overall in schools right this is one way that we can because this is something that is holding down people of color and that is not affecting white people as much um and what it seems to me is that police are protecting the white people but they are policing people of color and that is not what we want and that is not okay and
105like we've said people of color are more likely um to get arrested to be in trouble with the cops um and so that's obviously already a problem like uh problem right there and what is and to our kids students when you're in school you should be learning you are learning to become a better version of yourself so you're ready for the the real world right you shouldn't be like there shouldn't be cops already there to see you get in trouble to get you arrested at such a young age we should be taught that once you make a mistake um well that yeah that you're not going to get arrested right away because then kids are going to keep doing it they've learned what it is to be arrested and if you start at a young
106age you're setting them up to fail in the end so I think we could we can put other programs um that are there instead of punishing kids for what they do to teach them that what they did was wrong but in a more healthy way and a better way to set them up to succeed when they are older and when they are in the real world that's all I got to say thank you so much student trusty Vasquez I really appreciate your input and I know the rest of the board and the community really thank you for your uh contributing insights thank you trusty quas um thank you madam chair for um for your um bringing this to our agenda this week and uh clerk laara as well I do want to say that um
107and thank you to our students in particular student trustee who as I've often said um I'm I learn and often um appreciate the voice of our students more than anybody else um this is not an issue that's new to us uh it's as old as um the issues of the implications of a oppressive um racist law enforce system that has in fact touched communities of color historically but when I say it's not new to us it's not new to this board within the last two years three years uh I know that we uh and the reason why I know I'll speak in the verbial we and instead maybe I should say I uh I didn't need to see a video of the extinction of a civilian African-American man with his life snuffed out by militarized
108authorities to know that this the presence of armed police officers are not not are detrimental to the healthy development of black and brown youth in our schools and the reason why is because of the chance that those racist overtones that excessive force that militarized police practice those militarized police practices can in fact end up in our schools as a result of the institutions not having address these issues historically over generations for hundreds of years so I'm in full support of this but I'm done I am done not putting teeth Behind these efforts and the board can disagree with me uh we can certainly decide where people fall and while I appreciate that the motion's been moved uh I would actually like to uh motion a second a a second um I'd like to make a
109second M um motion for us to consider that second motion would be that we in fact pass this language with one set of inclusion in in a certain Clause of it and that is the Clause where it says now therefore be it resolved no I'm sorry now be it first further resolved the West Contra Casa Unified School District Board of Education calls for the cities of Hercules Peno s Pablo Richmond and Alero and Contra Casta County to end militarized policing practices support strengthening efforts to eliminate instances of excessive use of force and conduct stringent oversight and independent in investigations into instances of police brutality racial profiling and excessive use of force and hold individual law enforcement officers and police departments accountable and and this is what I'd like to add and until all of these
110named systemic issues detrimental to the healthy development of black and brown youth are adequately addressed full-tim full-time armed police services via the school resource officer program will not be contracted in the West Contra Costa Unified School District period so that is my motion I leave it as that trusty quas can you please repeat that whole part again I'm typing it thank you it is actually after it says be it further resolved where we talk about what we're calling on these departments to do I think that's great we need to call on these departments to do that but I as an individual board member have the opportunity to say this is what we will do as this board because this is the second time that I've been asked to take and push and make this resolved
111for us specifically around this issue and so I'm asking in this motion that we include the language at the end of that Clause where it says right afterward it says law enforcement officers and police department's accountable semicolon and that we add add these words and until all of these named systemic issues detrimental to the healthy development of black and brown youth are adequately addressed full-time armed police services via the school resource officer program will not be contracted for any campus in West Contra Costa Unified thank you Jesse I got that down superintendent de can you confirm that you also noted that down I'll second the motion y I think I've I've got it pretty much and if there's a word we need to word Smith I will loop back with trusty quas to make sure
112we've got the exact verbiage just stated great so the motion was made by trusty quas and was seconded by Trust St us thank you trusty guas um I'm done uh with my comment other than I agree with what the gentleman said earlier because I I was going to mention that as well it's not enough to be non-racist we must be anti-racist and unfortunately until these institutions address that and be be what we want for them what we hope for them there is a healthy place there is a healthy relationship with law enforcement that can exist I absolutely believe it we see it every day there are folks even in those institutions that in fact live it but until those institutions as a whole address where they fall short not what certain people who are good
113do I don't believe those institutions belong on our campuses and with that I'll yield my remarks thank you TR um so before we vote on the motion made by trusty seconded by trusty p I uh I I do want to say you have I would definitely let all of our colleagues have their opportunity sure to speak yeah yeah so um I would like to have trusty Phillips then trusty pis and then trusty L myself um share our comments with the public and the board trusty Phillips thank you very much uh can you hear me yes okay so what I want to do uh there's a lot going on in this conversation and the first thing that I want to do uh is start with uh a point of order uh we are how do I
114say this if folks want to eliminate sro's in the school district we actually need to put that on a Schoolboard agenda uh this is an issue that that is uh extremely uh divisive and it is an issue that is extremely volatile and it's not that's not something that I have to explain to anybody but the item that is on this agenda is a resolution the action that is being asked to be taken right now is not actually agendized and I'm not trying to discourage enage a conversation around uh having SRO in our schools um I think it's a conversation that should be had but it needs to be placed on the agenda uh so that is and you are the president of the board so obviously you can do that um and without any problem
115but it needs to be agendized so uh folks in the community who have something to say about that have the opportunity to call in and speak on it so uh that is my thought uh about the new motion that has been made uh frankly it's it's out of order it's it's not on the agenda and again not to say that we can't vote on it or that you can't put it on the next agenda but the community as a whole needs to have an opportunity to call in and weigh in on this and then the decision is what the decision is is uh but what I really wanted to talk about this evening uh regarding this issue um I wanted to speak to to to Allies tonight um as a as a as a black
116man that's grown up uh lived his entire life in America I have uh some very strong feelings about what's happening right now but what I want to do is just take a moment and speak to allies um and and kind of what does it actually mean uh to be an ally and um this is my opinion but I do know uh that there are many other African-Americans that that share uh share this opinion and I'll say it in my own way uh but please uh and it's not meant to offend anyone but please look for the intent uh in what I am trying to say um and the best way I could talk about this or what it means to be an ally um or or a teammate right we're talking about a teammate is
117to use Sports analogy all right you have uh you have a football football game right and you have the African-American Community carrying this football and they're carrying it for 99 yards right they've gone from one end of the field to the other end of the field they're carrying it for 99 yards now when you get to the first you when you get to the one yard line on the other side of the field there are some options right now an ally uh as an ally what I AMC don't take the ball people have been carrying the ball for 99 yards when they get to the first yard don't snatch the ball out of their hands and then dive into the end zone and scream touchdown uh that's not what this should look like and I
118don't mean this to be disrespectful but I'm trying to put this in perspective for people because I'm telling you how a lot of people really feel now if you get to the one yard line or we get to the one yard line and then people say well you know we want to do a quarterback sneak and we're all going to get behind the quarterback because we're allies and we care and we're going to push you across the one yard line so you fall into the end zone the the the first analogy that I used that's not what people are looking for people are not looking for people to snatch the ball on the one yard line jump into the end zone holler touchdown I did it we did it people are looking for people in
119the quarterback sneak example to get behind them and actually push them across the Finish Line AC into the end zone and so I I'm very happy and I'm and I'm I'm I'm I'm ecstatic that there are people in this District calling in um talking about uh African-Americans uh because that is uh that's what's supposed to happen but what I would really hope and what I would really like to see folks do uh is not I'll give you a great example you know asset has been working on this resolution for a very long time the board has made uh it very clear to uh the staff that the monies that were talked about regarding the resolution of the Imp mentation that that those things be put in place but that was said a long time ago
120and it's something that's been said repeatedly from every person on this board so don't when they get to the one yard line don't snatch the ball and jump in the end zone you know help push people over because that's what being a teammate you know do the quarterback thing get behind people and help with that's being a teammate um and I know that every everybody's going to have their feelings and I know some people may even be upset about what I'm saying but we've had uh we had will McGee call in and talk about the black Educators Network we have asset people calling in on the phone Audrey Shields made a comment and she said we know where we need to be listen listen and it's not that people are saying that they don't want
121help it's not that people are saying you know I I I want to do it all on my own I don't anybody saying that in the African-American Community I think that what I hear people saying is the people who are going to to to to to fight with us uh we appreciate and we love you for that and we are so happy that you are are are standing with us but don't try to take over because that's an entirely different thing because what it does is it really disrespects the struggle that people have been fighting for their entire lives and for Generations so um I I want to say to our allies I truly appreciate you I truly appreciate you uh calling in I truly appreciate you sending emails I truly appreciate you marching I
122everything that you are doing I appreciate you um I I I am just asking that as you do that um that you do it in unity with um and that you do it in support of um no more than if we were talking about uh a women's rights issue would I come in and try to take it over I would support because I'm I'm I'm not a woman and I want to respect what you are doing uh as a woman uh and and and let you know that I am here uh as as a friend as an ally and that is what being an ally means to me um and I know that's what being an ally means to a lot of other people um but I do want to thank everybody and I know
123that this is going to be a long meeting we're going to come back to the budget conversation later on so I'll be saying other things but I wanted to get that out right now so thank you very much thank you so much trusty Phillips really appreciate your comments thank you trusty trusty pis thank you president arandis charvis so thank you to everyone who spoke on this resolution tonight I'd like to express my deepest appreciation to a couple of leaders in our community leaders who also happen to be students Simone Anderson graduated from Kennedy two years ago who was instrumental in putting together Saturday's March which was great and our current trustee from Els serito High da at Vasco who was instrumental in putting together the march on Monday another March and like slightly easier for
124us old people who didn't have to walk quite so far um I'd like to thank um also Mr fman for speaking about ongoing racist microaggressions because that is such a big deal thank you Mr flashl and so Community like silence is violence we can't continue to do things as we've done them in the past we need to fundamentally realign our systems to give our underresourced communities what they need to thrive um we've got to close a school to prison pipeline it's incumbent on us to make it clear that we sincerely believe that black lives matter and that we value our students and communities of colors we've got everything to gain and nothing to lose from that we all need to be committed anti-racists and look at everything we do through an anti-racist lens and I
125just feel the stars are literally aligned for us to do something truly transformational for our kids and our community and we need to take action now thank you thank you Jessie buus tresse L yes thank you uh Madame President I do have some thoughts about uh about this I um I'm very proud of the people that are our students are youth that are that are out there and um showing their commitment and I it's just a wonderful thing to see I have to say I'm 100% in favor of ending contracts with the police department and I would like to see that fund those funds reallocated because we have already in-house programs that work we do not need to reinvent the wheel we have programs that need support and that's where reallocating these funds could go
126for instance our csos our campus security officers uh who live in the community and they know some of our kids families and they like a richond high there's many of them they're African-American they need our support they reach out to the community and uh for instance our scows they are our school community outreach workers they go out to the community sometimes they do uh home visits or they call and they really make if the parent comes to the school they help to make the parent feel comfor comfortable they are very very valuable uh individuals at Helms we had African-American Scouts and they would have um you know events for for that community so they need our help they need our support they need more support and then uh another program last one is CIS the
127community and schools these are at Richmond High mental health providers who serve groups and they're also there are African American mental health providers who do groups and they need our support these are some these are the ones that I know of having worked in the district there's probably many more um inhouse programs that work with our employees we don't have to reinvent the wheel we need to reallocate this these fundings to the programs we had that and they need our support and that's that's what I have to say about that but actually absolutely we need to end the contracts with the with the Department thank you so much thank you try thank you to all of our um students who have organized who have mobilized thank you to each of you Trustees for your role
128and for um the insights that you have provided thank you to our community members too who are joining us today um to voice their their support and their concerns I hear all of you and I just I want to share this from from you know the perspective that I've had as a trustee as a teacher as a parent and and as a former student um as well of public schools in the US from fifth grade to 12th grade um I think that you know we are usted with schools that's our Focus Education is our Focus um schools is our Focus not prisons and I just want to make that clear um we are interested with education and not incarceration that is not our role in this and I do not want to promote um and
129perpetuate an imbalance of power um because it is by default an imbalance of power when you have police officers on campus no matter the title um that sends the message that there's a clear imbalance of power from the moment that children walk into that campus there's assume criminality and conflict and to me that's a philosophical problem that I as a teacher cannot conceive and being okay with you know and I I know I profoundly saddened and infuriated by the killings of African-American children women and men by armed civilians and and by police officers Across the Nation with impunity I think we have all seen um I remember being 21 or 20 when um trayon Martin was killed and there were there were protests and then everything went kind of back to business as usual across
130the country um but for many communities it really didn't and and I know that I think we need to make our Point very clear and explicit even about the title of this resolution I think we we need to name things the way that they are um we are condemning police violence and brutality against black people and people of color not just people of color because that is an Erasure of Blackness and of African-American Heritage so we need to name those things and be explicit about it um so I I think that's one thing that we're we need to begin actually naming the resolution for what it is we're are condemning the police violence and brutality against black people and people of color as well as extrajudicial killing some black people by armed civilians um you
131know I just I want to share a tiny anecdote because I don't want to Center myself around this conversation this is not my place to be centered around but I just want to say that you know as an immigrant uh coming here to this country not speaking the language having my dad who still doesn't um communicate in English having him pulled over at my high school by a cop that was supposed to be taking care of us had a crucial impact on the way that I viewed um our resource officers and and from middle school through high school we always had cops on campus in La um LA County La USD and in um Bakersfield and and I know that you know there's different cops people are individuals but I think that this is a
132systems change is not just about talking about one person it's about talking about the whole system needing an overhaul not just a small reform but an actual overhaul and I I had the opportunity to attend two protests organized by youth one in penol and and of course wearing the masks right everybody was so attentive and I know I saw trusty quas there too I saw a lot of my former students there and and their parents and everybody was covering and trying to keep social distancing because it's not like people are trying to go out for a haircut like people are actually being out and putting themselves at risk because this is something that we cannot stay silent about um I was able to make it to the to the protest enrichment very briefly um but
133I was able to see just the impact of our youth I I saw our um I saw trusty Phillips there too I saw our student trusty Vasquez simola um leading that leading that that March and I just want to make sure that we carry on that message that black lives matter and actually mobilized behind our students for this and I just want to thank um our student trusty Vasquez suala and all the the students who organized and participated in these protests and also the ones who have been um in solidarity and active from a distance and behind the scenes too for a long time I think that as trustees it is in our full responsibility to follow through with our part to hold ourselves and the superintendent accountable to the resolutions that we passed and
134and I think that in the past maybe there have been some resolutions with no teeth but this is not one that we can afford to have no teeth then we have to put um you know put all of our efforts into ensuring that this is fully implemented last spring during our joint meeting with the Peno city council I asked for information on outcomes and local data on the effects of Sr on campus um to this day I have received nothing and last year at one of the meetings after that I also brought the issue that because I didn't have enough information and I did not believe that police should be on campus I could not vote to approve the SRO contract to continue paying for it and and I know that at that moment that
135was that was a bit weird because we hadn't talked about it with the police units but I just think that we should not have per we should not have to ask for permission to not have police on campus I just think that's not a role and and I also I think that we need to the cities to make this shift I think it's completely um relevant to say that this is not just a national issue this is a local issue all national issues are local and and I think that we need to make sure that we burst that bubble because we're in an e ecosystem together it's not like if we just pass policies and Implement things in a way that's going to change things for our kids because once they leave our educational system
136and they're part of the larger social ecosystem in our cities that bubble is not going to hold them in any longer they're going to be part of an ecosystem that it's either going to break them or make them and I think that we need to to provide as many structures and Partnerships with local agencies to make sure that their their voices are completely heard and their dignity as humans and their rights as children and as people in this country are always of held and protected um I know that the positive School climate resolution was passed by the previous board and we are still in the process of fully implementing that and I really want us to prioritize that work too because that's the resolution that I know had some immediate effects but it was not
137systemic enough to to cause the outcomes that we wanted to see across the board um I know that you know um black indigenous people of color lgbtqia plus gender a non-conforming girls young women students with IP students who have special needs students who are undocumented students who are not speaking English yet is fluently to communicate their needs um may also you know be suffering from effects U of police on campus Because have not we don't have any of that local information yet and I think that that for me is a red flag um I I strongly believe too that SRO is the euphemism I think that we need to call it for what it is if we pay $150,000 per SRO um how much can we actually afford in books in mental health services and
138psychologists and nurses and counselors for that um yesterday I read a quote by uh the former Housing and Urban Development secretary Julian Castro um and he said teacher shouldn't be forced to buy their own supplies while our police departments purchase combat vehicles and I'm not saying that we have combat vehicles on campus but I'm just saying that where do I priori lie as a district we're interested with education not incarceration and and I think that the message has been clear for so long and it's finally being magnified that we need to divest and reinvest in what matters for kids and it just doesn't make sense to to have police on campus um I I think that just like ice and Customs and Border Patrol we don't have them on campus so why should we have
139police on campus why what is the point of that we need to have more mental health supports more restorative practices coaches more unconditional love coaches more people who are actually going to be there to do the preventative ground work that's going to help kids never enter the criminal justice system and I think that we seriously need to take a look at what an an anti-racist educational framework could look like in the district I think that now it's becoming um a very cliche term in just like the last month because people are starting to to become more aware of it I think that there have some people that have been working on this like um uh Miss batina love there have been a lot of people who have been leading this work and and now people
140are finally tuning in and I think that's great but I think we also need to identify that this is not a fat this is not a trend This Is Not A Moment Like This is an actual movement that we need to com you know commit to um I know that our our budget is always tight but I think it needs to represent the priorities and an anti-racist educational fra framework is complet completely a priority for us and and I think you know it's it's clear that racism colorism implicit bias is very real and active in our educational system not just in in the police system and I you know even me like as a person of color like I've had my credentials question like many times right and and my parents too like and I
141know that a lot of um black children women and and men have had their credibility their credentials question and it's not okay to continue to perpetuate those things and finally people are really tuning into that a bit more than before um I think that more than anything we need to be clear that educational Justice is racial Justice and and have the representative and substant substantive evidence evidence to prove that we're actually moving toward that um and commit the funds what can we do with $1.5 million how can we help to implement the asset resolution that we passed in January and take solid steps through implementation if I don't see deadlines if I don't see groups of who's going to hold what work accountable if I don't timelines that to me is not saying that we're
142doing a clear commitment and serious commitment to implementing these resolutions I think that in all honesty we need to have a cultural shift as an organization and and have that anti-racist framework not just expected in the classroom but have it as a key ingredient from classrooms to the leadership at schools to our school board to our cabinet to HR to every playground um Aid that supervises and has contact with children every day and I think that we we need to um really make a commitment to it in the past I have requested um Dei training diversity equity and uh inclusion training I think that now we do not only just need that like that was for me to try to bring it to the attention of some folks and I know other people have been
143doing this work too um but there just has not been an energy behind that in the way that there needs to be and now we need to add on top of that that we make sure that we start to take steps to actually learn what does it mean to be anti-racist it's not like you just get to a point where you are it's a work in progress that you have to commit to long-term term for life so it's a substantial commitment that I'm asking everybody to make and not pass an empty resolution that sounds good that feels good at the moment but that's actually going to have long-term impact long after we're gone you know I I think that that's what I want to see um I think we need to formalize the role of
144students and families especially black students and families and have their voices Amplified and centered I think we need to listen to them and listen to people who have been doing this work for years like trusty Phillips was saying um not just take the Baton like keep you know like not pass it really over uh throw the football not just say like here like you know let me do this work because this is not our space to Center ourselves on this is something that we need to amplify and center the voices of black students and their families and we need to not replace or push them to the side and I think that's something that I want us to stay focused on and and my last kind of question for this um besides a technical question
145and another technical suggestion is for us to think as a board are we in a role of oppressor or a role of disruptor and I think that we have to know that not just a role individually but our role as a board because whatever decision we make we're going to do it as a board and I think that once if we choose to be a disruptor we have to show what is our commitment going to be what funding are we going to put forth for this to make it happen and the timelines without timelines nothing is going to happen because there's going to be no accountability so I I want us to to really keep this in mind mind and I I I want to check in now on a more technical note um with
146u superintendent Duffy if if they would be if the the what is it called the Clause that trusty quas had requested to be added if if it's actually out of order or not um to trusty Phillips's question because I I would gladly um agendize it for the following meeting um for sure but I also know that in the second page um in the third whereas the very last item it says and E item e funding for law enforcement should be redirected towards the reduction of class sizes and total class loads to support restorative justice practices is that something that essentially like allows for that motion to be specifically to that item that's in the resolution agendized ma Madame chair before superintendent um speaks if I could um address that concern as well as the person
147who made the motion yes just um I actually think it's actually very much in line with this resolution this is not like trying to pass a clause that has nothing to do with this topic at all um I understand trusty uh the the good gentleman trustee Phillips may have some challenges around this uh I know that historically you have not been supportive of uh doing this for many reasons and you've explained that um but for me I Absol abut think this is within bounds of this resolution and um I will I I would like us to have a vote on it um I don't think there should we should be afraid of taking clear uh action in relation to what we believe is within the the the the content of this particular resolution which is
148in line with where this board has actually gone before uh which is in line with conversation the community has actually had before we know where folks are at this is an extension and I uh believe that it is appropriate for us to take this vote president hernandes trust yes trusty Phillips can I make a suggestion uh I believe that this is a brown act violation because this is not an agenda item on whether we're going to fund the police my suggestion is this later in the meeting we have a budget item where we we have a budget item so when we get to the budget item this is my this is my suggestion you all do what you want to do but I'm trying to stop us from getting sued when we get to the
149budget item what I suggest somebody does is direct staff to do exactly what you're asking for now that you just do it in the budget item but that's my suggestion appreciate your comments Tristy Phillips and I think there is conversation that still needs to happen in that budget item like what will we do with that 1.5 and that's where I will be a good Ally and listen to what folks want us to do with that money but in this instance there have been plenty of times where this district has made and taken action and if for some reason we're told it's out of bounds then we go back and rectify it but we don't stop the action that we think is right there are very few times where we have choices to make it clear
150will you stand or not stand and I want us to take this vote today thank you truste think trusty Phillips um superintendent Duffy or trusty Phillips my understanding is that we are voting on the budget so what you do when we get to the budget item is you simply say the money that is allocated in the budget for SRO I want that removed the board can do that it is totally within the item I'm simply saying that it's not in this item it's four items later somebody I'm gonna finish saying what I'm saying trusty quas people can do whatever they want to do I've made my suggestion I'm not counsel for the district right now I'm putting on my lawyer hat because what we're doing I think is a legal but there's a there is
151a budget item you can do the same thing in the budget item and you do not have to worry about anybody saying it was a brown act violation but that said do what you will right and my suggestion as a resolution is again and it's an opinion of one person on this board who has in fact brought um amendments to resolutions from his first board meeting and so the issue for me is um I will in fact push that we do it during the budget as well we will do it twice if we need to but I think that this is a clear resol uh statement in line with this resolution I'm done thank you both thank you trusty Phillips thank you trusty quas I think um I would like to hear from superintendent Duffy
152just to make sure that the way that I'm reading the resolution is open to to this Clause because I believe that it is and I just want to get your input before we go for a vote sure I believe you are within your uh rights to add on to the resolution we have done that historically uh as the majority of the feels uh something needs to be added or deleted um I will be happy to check with legal counsel uh in the morning if something has been uh violated uh but based on what we have done historically on this board in terms of uh the majority having a discussion and then deciding based on that discussion they want to add or delete something I do think that is in your purview thank you superintendent Duffy
153president Hernandez J yes Jesse L I'd like to call the question thank you so board we need to take a vote can we begin with um student trusty dwit Vasquez himala and I will uh read that this is the the Clause that was added by trusty um so the motion was made by trusty quas and seconded by trusty panas to add um after be a further resolved until all of these named systemic issues detrimental to the healthy development of black and brown are at back and bound uh students or children I I had said I had said youth youth thank you so I will begin again after be it further resolved um once we name that we need the cities to to do this work until all of these named systemic issues detrimental to the
154healthy development of black and brown youth are adequately addressed full-time armed police officers via the school resource officer program will not be contracted for any contracts in the west cont across the UniFi School District can can I repeat what I had said just to make sure please until all of these name systemic issues detrimental to black and brown youth are adequately addressed wccusd will not contract armed police officers as full-time wait what did I do with it I'm sorry that's my apology start over until all of these name systemic issues detrimental to the healthy development of black and Brown youth are adequately addressed full-time armed police services via the school resource officer program will not be contracted for any campuses in West Contra Costa unified yes okay so now that motion was made by trusty
155Banas seconded by trusty uh by trusty qua seconded by trusty panas so uh trusty Lea requested for us to call the question so we're going to take a vote um beginning with our student trusty D yes weas yes yes panis yes Mr Duffy do you have the exact language that she just read I do can you just read it back really quick I have an addition of until all of these names systemic issues detrimental to the healthy development of black and brown youth are adequately addressed full-time armed police services via the SRO program will not be contracted for any campus any campuses in the West Contra Costa Unified School District got it yes Fernand dvis yes so this motion passes the resolution passes unanimously with a additional Clause by Jesse glas thank you board thank
156you so much for this work for this discussion um and thank you to the community for all of your input and participation we really appreciate it thank you okay Bard so our next resolution is resolution number 119 and 20 lgbtq month thank you so much again to everybody for the work on this resolution to Mr wton again and and to each board member each student everybody who is raing around um this resolution and this movement um we I'm going to make sure that we all stay accountable to it and that we follow through with the implementation thank you madam chair yes trusty glas jie quas Madam chair I'd be happy to read the next resolution unless our student would like to no you're good to go okay thank you just uh there we go west
157contracosta Unified School District resolution number 11920 lgbtq pride month June 2020 whereas the West Kross Unified School District models Advocates and promotes the inclusive and respectful treatment of all our members of it of the community it serves and is committed to safety for all including the lesbian gay bisexual transgender care questioning Community or those that may be perceived as such and whereas the fair can we make it a little bigger please and whereas the fair Education Act of 2012 called for positive inclusion okay not that big just go back down one more um there we go and where uh the fair Education Act of 2020 called for positive inclusion of the contributions of lgbtq Americans and social studies curriculum and the Student Success and Opportunity Act of 2013 strengthen protection for transgender students and affirmed
158for all students and affirm that all students should be recognized and participate in activities by activities by their gender of identity and whereas the California Fair Employment and Housing Act prohibits employer discrimination based on sexual orientation and board policy 0410 prohibits discrimination in its programs and activities based on gender or sexual orientation among other characteristics and whereas from The Stonewall riots in New York City to the Compton's cafeteria riots in San Francisco the LGBT community has fought for equal representation as an integral part of our nation and whereas sexual orientation and gender expression based bullying is among the most common forms of harassment in schools and the significantly higher rates of school dropout academic failure and school disengagement amongst among lgbtq youth across the country are attributed to peer harassment and bullying and whereas no
159one should ever be the target of bullying harassment or violence and we must strive to ensure that district schools are consistently safe and affirming spaces for all students staff and their families and whereas the district is committed to fostering a safe and respectful school and Community is committed to to fostering safe and respectful school and Community cultures and affirming school and home environments substantially improve the mental health and school engagement of lgbtq students and whereas the month of June is an opportunity to celebrate the identities and contributions of the lgbtq community and by recognizing pride month we support policies practices and curriculum that honor and respect lgbtq student staff and their families now therefore be it resolved that the West Kross Unified School District Board of Education declares the month of June as pride month
160and be it further resolved the West cont cross Unified School Board of Education directs the superintendent and all District staff to support lessons and activities that engage students in meaningful learning research and writing about our lgbtq students and families passed and adopted by the board the West con cifi School District on the 10th day of June 2020 uh I'd like to move this resolution Madam chair I'll second that thank you trusty glas for reading this resolution and for removing it trusty pis has seconded uh do we have any public comment before we take a vote there are two uh hands raised for public comment so thank you the first is uh TJ Warfield I'm a parent of a gender non-conforming child from the first day of kindergarten and now going into fourth grade I have
161yet to see the inclusivity that this resolution boasts says that it District the district promotes so much SB 179 gender recognition Act of 2017 created a third non-binary gender marker California Ed code 200 to 220 legally requires public and charter schools to protect against harassment of LGBT students students must respect schools must respect gender identity including using the correct gender pronoun yet going into fourth grade my child still has only male and female options on District forms and Power School throughout my child's School career only two District employees have ever used proper pronouns their third grade teacher and our current principal you know Dr Mercer who you pushed out California Ed code 234 to 234.567 protect students right to discuss lgbtq issues and topics in school California Ed code 51500 forbids instruction that promotes and
162reinforces gender stereotypes Fair Education Act Ed code sections 5120 4.5 and 600400 require schools to teach the role and contributions of LG lgbtq Americans throughout history yet a teacher wanted to talk to class about gender and how it's not binary but she had to get permission from the previous principal no such permission was given no such conversation was ever allowed in class I've seen no efforts by the school or District to support children like mine nor many have any many other parents I've talked to the district is not educating staff on lgbtq topics and student rights this year our amazing principal Dr murza has been the only the first district admin that has organized any kind of school education on this topic but she couldn't get District funding and then she get got pushed out
163by this very board for years the district and this board have been violating California Ed code federal laws and US Constitution to date the district still for as my child to choose between binary gender choices has no way to capture their correct pronouns and is doing nothing to educate their teachers my child's rights are being continually violated by this district and has been bullied and not properly protected you want to prove that you actually stand by the statements made in this resolution prove it and put agenda items on future district meetings to discuss how you aren't leaving up to these standards put budget toward the proper training of your staff put the proper systems in place to be in line with Ed code and federal laws I've seen enough from this board and District employees
164to know that appealing to this board and district is like screaming into a black hole so go ahead pass a resolution but I want my voice heard and on record that this resolution is a joke without any further action to every member of this board and superintendent Duffy your actions speak louder than any resolution you pass we see you and we're paying attention thank you um Mr Duffy I think I we would um I would like to ask you if we can follow up on on seeing how we're implementing um this resolution as well thank you the next public speaker is Diana Diaz Nora hi everyone my name is Diana I'm a WCC is the alumni and a community and youth organizer once again as folks are saying yes this is a resolution and this
165is one of the steps that folks can take and I want to um lift some things that like some action steps for yall to consider and one of them is around uh gender identity sexuality that there's a ladin for y'all to consider um Pathways to have gender neutral restrooms at all schools and not just high schools but thinking about elementary middle schools Community spaces and even allowing or giving the right to students to change their ID names um all lot of go through transitions in any grade and they should have the right to switch their name and their school ID and to not be called by their dead Name by their teachers and for educators to know that and to acknowledge that a student has a right to switch their name and to have a
166name be what they prefer um and even thinking about sports that Sports also be a space where gender not be a thing that there be non-gender football soccer all of that so thinking about how you can actually incorporate gender sexuality identity politics in school IDs uh books Sports the whole building itself and education and educators and definitely considering pronouns as being the norm for all your meetings for educators classes um anything that has to do with school and learning thank you thank you the next speaker is Audra Goldie Williams can you hear me yes we can I'll be very brief um I just want to say that I absolutely support this resolution I believe that it's important for every student to feel represented for every student to feel they have a voice and eventually hopefully
167we'll have calendar full of um months that represent our entire student body so thank you for this thank you the next speaker is Claudia Jimenez hello yes could you hear me yes we can uh uh we I want to say like uh thank you for uh adding the language and the resolution however it since uh weaker I I think like what you had to aim for is to finish completely finish the contract that you have with the police departments and and and take out the police from the schools safety does not exist when black and brown young people are forced to interact with a system of policing that views them as a threat and not as a students for many black and brown youth the presence of police in their school disrupt their learning environments
168so I need you need to be bold and to push that the envelope because it's not enough to say that until the police will show and demonstrate that something is wrong you won't contract with them I think like what you need to say is that because all what is happening and because data shows that having police in the school the only thing that has is to have like is to fill the school to prison P line we need to change that and this is why we are ending the contract with sros and I think like you have another opportunity tonight uh to bot your values when you are Bing the the budget and that is another opportunity that we are watching you tonight to see if you are actually moving this money that goes to
169the sros and goes to other services thank you for your time and I am waiting thank you the um the next speaker is Mariela okay um I'm gonna confirm that that you were that um she was able to hear that so if our interpreter can um please uh listen to to the public speaker and then when the public speaker paes if they can please uh interpret what the public speaker said in Spanish into English that's the request thank you so much from from our public speaker thank you Gra um um Mr Duffy can you confirm that our Steph interpreter was able to translate that into English um in real time I'm gonna have to get that confirmation from Mr Walton because I don't hear the interpretation going out to the public okay Mr Watson yes
170we are uh trying to make contact with them now okay perfect thank you um so Mr Walton if you can confirm once you have been able to reach yes go give me um 30 second okay thank you so we're gonna wait 30 seconds to get our interpreter um connected thank you MH Madam chair if we could take a moment while we're waiting to remind folks that the topic we're addressing right now is a resolution related to lgbtq pride month thank you tras yeah I know our previous um speaker was speaking about the resolution that we had just addressed um in the item before this one uh so now the the resolution that we are having public comment on right now is specifically about the lgbtq um plus uh pride month resolution can we confirm that
171with our public speaker that she is commenting on this resolution see okay um so the public speaker just suggested um if we can have the if we can continue to have the agenda um visual for everybody in the public while the public speaker is talking about the item so that they know that's the item that they're talking about um and so we are still waiting to make sure we get the translation into English um for everybody to be able to tune in okay um okay uh president Hernandez Jarvis um so in order to hear the English translation of the Spanish speaker um you need to switch over click the interpretation button and choose English while the uh Spanish the public speaker is commenting in Spanish it will be a real time uh uh uh it
172will be a realtime translation and interpretation so if you will click over to the English it's just the way that Zoom is is set up um okay so so the the public speaker continues in the main room and the those of us who need to listen in English will switch over to the English interpretation great so then the the public clicks on the interpretation option inputs English correct yes thank you for clarifying that so if I can ask um everybody who's tuned in if you would like to hear the the public comment in English to please go to interpretation it has a little globe and then click on it and put English so that you can hear it in real time thank you everybody for waiting um for okay J okay [Music] um for much
173um conflictos for gracias so um the and that concludes public comment on this item okay thank you Mr Walton and thank you to each member of the public who spoke on this item and I um I don't know if any board members would like to to share I know that the last resolution that we had we did have a lot of time to to speak about uh that resolution and I just want to make sure that I give everybody a fair opportunity to also speak if they have something that they would like to share for this resolution um I do have a comment that I want to make and um I would like to start again with an order with our student trustey Vasquez simola first and then um go to to the rest of
174the trustees after that to trustey quas Phillips lettera and B thank you for giving me a chance to speak again um I am not ltq plus I am an ally but um and one thing that really upsets me is when I hear I even hear it from my own friends and it's a big thing in school but using um things such as gays um and as insults um and I know many people like they're like I'm not uh I'm not against lgbtq and like I'm and I'm like like they're okay with it but then they like use Insel like that and like in some ways definitely like like using the nword um which I am also against um I don't know if that's something that we can try and do in schools because well one
175thing I just don't ever hear is Teachers I'm talking about that bringing that up in classes um and I think and I know that many students are just quiet about it but they don't they don't appreciate when people do use that um and so that's one thing I feel really strongly about hopefully something that uh we could tell maybe teachers to talk about or something can do on a district level um not only that but I think Deanna Diaz uh who spoke a little bit before I think she brought us some really good points about I think it's we should we should do more than just say here's a month for lgbtq we should actually do some stuff about that um and I know that getting more bathrooms gender neutral bathrooms or um helping change
176names and IDs or something those could seem like little things but to some people they they're they're a lot um and I think it may take more time resources um and effort but I think it's something that we should definitely try um spend uh try harder to invest time into um and I know money is a problem right now but I think this is something that is really important and if we really do care about our lgbtq community we would try and invest more time into stuff like that that's it thank you so much Vasquez Madam chair no comments other than um I do know that if we def if we defund uh armed police on our campuses then that's a set of resources that can help us accomplish all that good intention that we
177have but simply uh don't have the resource to do um and I think it's important to think about all those uh different types of programs uh positive School climate policy uh shouldn't be starving for funds the work that work is important it's all connected um and I do think that that's what this is about but I will say as a member of the LGBT community that I knew at some point it's also about recognition the bare minimum of this resolution is there are still plenty of people who believe that I should not exist that I should not have fundamental rights because of the fact that I uh am married to a wonderful woman who is in fact um an important part of my life and so I think that's important to hold uh to the
178uh value of what the resolution is the resolution is in honor of pride month and I do think that that doesn't mean that I stop being gay after June or that you stop and we stop doing this work Beyond one month um there's there there has been evidence by every resolution that we're going to look at tonight that there is lots of work to do lots thank you trusty glas trusty um trusty buas uh trusty Phillips first I think oh I'm so sorry let me read again trusty Phillips you're right trusty Phillips then trusty fenis thank you I'm sorry trusty Phillips so thank you very much for this resolution uh I do support the resolution I do want to make sure uh that we acknowledge uh Miss Warfield who called in earlier today um because
179I know often times we listen and we hear comments um but we don't acknowledge that they're actually made and I think part of the reason people call into these meetings is because they want to be heard and we need to make sure that folks are being heard now I want to bring in um and maybe I'm going to get in trouble for doing this but I want to bring in something that just happened we just had I don't know how many people all in uh and say that we should defund uh the SRO program uh and spend that money or redirect that money to African-American children and this is where the game start because two minutes after that resolution passed we have a board member talking about using that money for something other than African-American
180students so uh don't use black people don't use black painy phips is no no trusty phips yes you did no I didn't trusty Phillips you did trusty Phillips I am fully in favor yes that's fine I'm talking about what you just said trusty Phillips I said there's plenty of work to do and until we take a vote on budget I suggest you leave your assumptions to yourself because the reality about what you just in the wrong dire bottom line is this video is recorded So anybody wants to go back and Community to let you know their opinion that's that so what I'm going to say to this board is we just took a vote about if it makes you feel better CH phips I will be fully supportive of all those do going to support
181black students because I will make myself clear and not let another board member understand okay trust let's try and do a second round of comments thank you can let trusty Phillips finish his comments please thank you so as this conversation proceeds I don't want to hear any conversation about any of that money going anywhere other than the past budget because that is what everybody used whether they're on this board or off of this board to justify defunding that program and that's where that money's going to go those are my comments thank you trusty Phillips um trusty quas I will come back to you after we finish the first round of comments uh by trusty panas and trusty l oh thank you president nameis Jarvis this is another problem all over the country and this is
182like the one of the communities that can't even admit who it is sometimes if you have and concerns like it may be in your household it may be with your friends it may be at your school so we just need to do everything we can to support our entire community and this is part of that community and I'm really happy that we have this resolution every year because it reminds us and I just want to say like this should be part of our life every day not one month a year thank you JY buas try L I have no comments thank you thank you I just want to share um that I think that you know when a parent brought up this in in public comment right now that we have to make sure that
183we actually stay accountable to these resolutions and I think this is another one too that I know last year we had it this year again um but I just think that we have to also prioritize like what does it actually look like to teach kids you know what is it what does it mean to be an ally what does it mean to um respect someone's chosen pronouns what does it mean to actually say she he they them and really stick to that and and you know not just be visible and talk about being an ally but identify that we all do need to have structural training again this goes back to diversity equity and inclusion because um you know at the beginning at the beginning of the meeting we were talking about or not even
184at the beginning right right before this resolution we were talking about another resolution and about visability and making sure that we are um allies and that we really carry through the work that we say we're going to do in these resolutions and and I think about also the the fact that we need to honor the lives of Nina pop and Tony McDade who are also trans men and women who um also lost their lives and and that you know there's still no um investigation happening I think that that's completely relevant um because black Trans lives matter and and it's not I'm not saying that just to sound um you know like I'm I'm saying that because people are saying it right now but I'm actually saying that because we cannot we should not contribute to
185the Eraser and invisibility of transgender people and families in our community and and so I think you know I I really would like to connect with um Miss War feel for for the comments that that she made about um the way that we need to to ensure that their child is having exactly what they need to be successful in in our classrooms and not to be um ostracized and and I think that this is part of a larger conversation that we also need to bring back to to delve in deeper and to talk about what structural change do we actually need to have um to ensure that we don't perpetuate those same type of uh gender stereotypes but that we actually help our kids understand like what what does it mean to be um lgbtqia
186a plus and what does it mean to to ensure that we are defending and protecting the human rights of all kids on campus and and for teachers too what does that mean for you to be an ally and and active in ensuring that all of your kids feel safe under your care um that's my that's my last comment on that so I would love for us to be able to follow up with the superintendent and families uh to look further into what this work is going to entail too uh trusty quas um before we wrap up did you have another comment that you I just I have no further comment I'm not going to justify what I think is pure assumption and politically motivated discussion um if anybody wants to know whether I care about
187black lives and prioritize black voices uh over anybody else's when it matters uh then they can recognize where my consistency is if putting my mouth where my actions are thank you Jesse guavas um so now this uh motion if the board could please remind me um if it was who who moved it and who seconded it I motioned it and I believe it was seconded by Mr panis yes okay thank you so trusty quas made the motion to pass H this resolution um resolution number 11920 lgbtq pride month June 2020 it was seconded by trusty p if we can please take a vote 100% yes quas yes yes panis yes yes this drive is yes motion passes unanimously to pass resolution number 11920 lgbtq pride month June 2020 thank you and now we're on to
188our next resolution thank you so much for the discussion board um and I I would encourage everybody to make sure that we continue to engage as best as possible with each other thank you so now we have our next resolution item B10 resolution number 101 1920 immigrant Heritage Month any member of the board like to read the resolution I'd be happy to do it thank you trusty buis um West Contra Costa Unified School District resolution number 101-1 1920 immigrant heritage month June 2020 whereas the West contra cost Unified School District models Advocates and promotes the inclusive and respectful treatment of all members of this community and has committed to school safety for all members including immigrant students and their families and whereas since June of 2014 immigrant heritage month has given people across the United
189States an opportunity to annually explore their own Heritage and celebrate the shared diversity that forms the unique story of America and whereas board policy 51453 expands the district's commitment to the success of all students and its belief that every School site should be safe a safe and welcoming place for all students and their families irrespective of their citizenship or immigration status and whereas the family educational rights and Privacy Act fura of 1974 calls for the right to privacy regarding students personal information including their immigration status and in n and in 1982 the Supreme Court decision implier versus do set the precedent that no Public School District may deny students educational access or opportunity based on their immigration status and whereas the deferred action for childhood arrivals DCA of 2012 helped to expand higher education and
190employment opportunities for undocumented immigrant students and whereas the state of California has played an active role in opening up academic Pathways for undocumented immigrant students through the California Dream Act and ab540 and the state of California's 11 million immigrants make vital contributions to the economy to education and to the communities throughout the state and whereas the United States is a nation of immigrants shaped and supported by Culture by immigrant Innovation and labor including that of activists and leaders and immigrants contribute to the cultural linguistic and diverse Heritage of our communities and whereas by recognizing June as immigrant heritage month we support policies practices and curriculum that honor celebrate and welcome immigrant students staff and their families now therefore be resolved that the West Contra Costa Unified School District Board of Education declares the month of
191June as immigrant heritage month and be it further resolve the West contracosta Unified School District Board of Education directs the superintendent and all District staff to support lessons and activities then engage students in meaningful learning research and writing about immigrant students and families I'll move resolution number 101 1920 nice second it thank you do we have any public comment for this resolution there's one public comment from or now to Blanca Gonzalez thank you hi um can you hear me yes we can okay um I am an alumni from Richmond High School I also went to um a few different elementary schools in the district and and um I was also the last graduating class with Adam's middle school before I closed down um I just wanted to say it saddens me a lot that um
192while in high school I didn't really learn much about I guess you know my my culture where I came from my people what what we had to do in anything you know I guess as history went on how we were treated or or you know anything like that I went on to go to um Contra Casta college and I took a larasa class only because it was you know um a class that I needed for like to um transfer to a four-year and I cried um because it was just so much information being dumped on me at at once and and so many things that I did not know um I'm Mexican by the way and just so many things that I did not know that I guess um other Mexican people went through throughout
193the years and um you know um what it took to get us to this point to me it was like okay we have one paragraph in the history books um of you know I had like AP US History or something one paragraph saying that there was a war and that you know the US took over Mexico but really it's like it it was so much deeper than that and and there was so much more that I had so many questions about and I asked the questions you know I I felt like I did my part I asked the questions you know tough questions and sometimes I got half answers sometimes I got no answers or you know maybe tried looking it up or search it up in some books I feel like we need more
194books that include immigrant history in general from all different places I feel like we need the recognition of immigrant month for all people you know history is all about um just seeing it through through one perspective and that's what the book teaches us and I get that but having this be you know implemented in this way really highlights everybody includes everybody and and I feel like we need more of that we don't need to wait until we're at a university to learn about ourselves in that way um thank you that's all I really have to say about that thank you the next public speaker is uh Audrey Williams good evening again and by the way I go by Audra Goldie Williams um I'm always goingon to speak from the platform of inclusion so I absolutely
195support this um I think with every resolution that we're hearing what we're hearing is there's gratitude for the initial um movement or motion and what's needed is um the details to support um what's being presented um I'm totally in support of a curriculum but I'm I guess I'm not just in support of but I'm excited um for our district to put ourselves in a position where our curriculums are representative of our students um the sentiment that the young woman just shared I remember feeling that way um growing up we growing up excuse me we had one paragraph As blacks or African-Americans so um I'm very excited um probably too much so because there's until we finish doing the work we haven't done the work um but I'm excited for the direction that we're talking about
196and like I mentioned earlier at some point I'll be very happy when um our calendar is filled and what I meant by that is and let me you know what let me not there's so much well I guess that would how do I say I was gonna say something there's there's several groups that I are are important to me but I don't want to take away from what we're talking about in this resolution but I just want to say that I absolutely stand with inclusion and um our immigrant students and families um and I mean I'm ex I'm probably too excited like I said I'm excited um because change is here and I'm not talking about Justice resolution I'm talking about the change that's going on right now we can absolutely take advantage and be
197able to be supportive of all our students to be included thank you thank you the next public comment is Diana Diaz norga hi everyone Diana again she I'm also currently an immigrant and went through school without being able to talk about my Identity or even knowing that I was undocumented immigrant until I was a junior in high school so I really hope that we can work together to uplift all the narratives and I know we are used to like the word immigrant but I wonder if we could also add terms like undocumented documented Refugee or Asylum Seekers because they all would need the same not the same but they would need resources as well and also if yall support this wholeheartedly that you invest in the learning of immigrant students documented Refugee Asylum Seekers um
198and I'm talking about like higher education and work opportunities that our schools need to have conversations or spaces for young people to get access to these resources when I was at Richmond High um applying to school I submitted my application for UC 3 days before it was due and that's because people in in those places did not know about FASA or Daka um or forms that people who are in documented need to fill out to get to higher education um so thinking about college centers and um Health practices that they need to be aware of language and resources that undocumented documented immigrant and Asylum Seekers and Refugee folks need and that if you also support undocumented immigrant Etc folks that y'all invest in finding ways to pay immigrant Educators and staff who do not have
199Dhaka because right now we do have a lot of Educators that are currently working with aaka and we know that this is continuing and ongoing but if it were to be removed you would lose so many documented Educators and we need to find a way to invest in these folks that doesn't take their work away thank you thank you our next speaker is Blanc Gonzalez Miss Gonzalez oh I'm sorry I was trying to figure out a way to lower the hand but I guess um I guess I'll just say I I really like the fact that the last uh woman mentioned um undocumented uh undocumented uh students as well as um I guess community members I think it's so very important I am now a student at calate East Bay um and it was so
200hard being first gener Generation Um there and having to figure everything out by myself and you know um even even even there there's nobody that just reaches out to you and and helps you with you know with DACA or how to or the you know DREAM Act or anything and it's like there's resources available and I feel like it's not being pushed enough out there like you know this is how you do it or you know when me help you with this or that I know I'm not the only one that is first generation you know college student University student and I know I'm not the only one that's not only that but also you know also was a DACA um student um also had to figure everything out by myself so I think yeah
201as part of the whole um immigrant Heritage not only impl you know history about immigrants but also the times now you know the time is now to help these students now to to be able to become those first generation um you know in their family to to go to college to navigate through college to fill out those applications to to use the resources that are available to them but have become so obscure and kind of like hard to reach um sorry about that um that's all I have to say thank you thank you our next speaker is Alica Africa hi can everybody hear me yes um I think I had spoken before um I'm a recent graduate from El high school and um like Miss Goldie I'm pretty excited about this um this resolution uh
202I was part of the pilot class of group of us was part of the pilot class for ethnic studies at El ohigh I know how transformative that is to um students of color but also to our our students who aren't of color they learn about our history and just how as a collective we contributed um to this country to the history of this country um just how much we contribute how how much work all of our ancestors have put in to be able for us to have this opportunity um I to in first gen um I know that for undocumented students documented students uh a lot of you know visibility matters representation matters I know for some of us who are privileged enough to be part of aop we got that extra support but I
203know that having a month like this could give could give visibility to all undocumented documented all immigrants children of immigrants um and just how much that would mean to everybody so yeah thank you our final speaker on this item is Mariela quer and just as a reminder to go to the English translation um for our Spanish speakers and um comment um hels immigrant for fa gracias and that concludes public comment on this item thank you Mr Walton and thank you to each member of the community too who shared their public comment with us on this item so we have the motion um for this resolution it was uh moved by trusty panas it was seconded by myself um are there any board members that would like to share anything before we take a vote no
204okay thank you so I just want to say that I I really I say something yes tressy Vasquez Sima sorry um I just really want quickly want to say like what really frustrates me in my classes are in every class my teacher has a strict schedule of what is going to happen every single day um and if we don't like and if we're like even like like a few minutes late then we're off schedule so it's really hard to implement things like this where we can take time to learn about things that are really important I just met U it was actually just like a week ago I met my friend who's uh who's an immigrant and he did not know what Sanctuary cities were it's like I think it's like and to me like
205I'm also an immigrant um but like I I said that just seems like something to me that everybody should know about especially if they're an immigrant um for them to be in high school going to go to college soon and not knowing what a uary city um I just I'm just wondering what else they do not know about and we know that like euro centralism is a thing um and so that so we all know that we don't really spend much time talking about Africa or talking about Latin American countries anything except Europe and that to me is really frustrating um and so I think I I think that's something that we should really focus on as well and trying to make more time in classes to talk about not only what the class is
206made for but about other important things because I don't I don't believe that in my like in my English class that English is the only one subject that is only important in that class like I think you can make a little bit of time to talk about other things that aren't just English like even if it's if it's just like a day um out of your whole class I mean a class I have 90 minute classes if you just take one 90 minute class to talk about I don't know some other something that's not white something that's not Europe you know like I don't know that's just something that's really frustrating to me thank you so much trusty um basima for sharing that perspective I I think that again like every other board meeting that
207we have you have something that you bring that's a very crucial insight to these conversations and helps to Center um you know these these resolutions and the dialogue that we have as a board um around students really sorry um and yeah I just want to say you know as an immigrant too I think that these resolutions um I wish I would have grown up knowing about about them being more informed and and I didn't you know start getting more involved in things that actually open my eyes to advocacy and to the work that um it is you know to have social uh justice and racial Justice in our public institutions and what does that look like um until I was in college that's when I really started to become more aware of these things so
208thank you for mentioning that and yeah I think that we have way more work to do you know this is the third resolution that we see tonight and each one has um made us confront the fact that but these are not surface level issues that we're trying to tackle these are very deep issues that are going to take um a lot of effort not necessarily a lot of time but a lot of effort to actually begin the work and and to commit to it not Let It Drop halfway through thank you um so can we please take a vote doubt it yes us yes Philips yes yes yes this drive is yes so the resolution number 101 1920 immigrant Heritage Month passes unanimously thank you board thank you to the public for participating and being
209part of this conversation as well um now we have arrived at b11 which is our public comment and it is 9:49 sorry Mr Walton it is 9:49 so after public comment we're going to have to um make a motion to extend the meeting president uh Hernandez Jarvis we currently have six uh uh seven hands raised for public comment I see 14 now it doubled in in two seconds okay so the how many minutes so we're going to do um one minute it's over 15 one minute okay first public speaker is Matt Horton good evening um rather than continuing to waste efforts uh speaking at this board I thought I'd talk to everybody in attendance um and I just wanted to remind everybody that uh huge changes are coming to the way that we elect board
210members in November um there's an opportunity for everybody listening here to replace everybody here who's not actually voting in your interests all those people that all the all the words that you hear tonight don't mean a lick uh it's important to to pay attention and to continue to listen and watch what these people are doing on your behalf and to get rid of them in November because they suck thank you thank you uh the next public comment is Mariel laqua see um hels High School um School um please conclud your comment oh god um was the speaker cut off see in last Chatters gracias gracias our next uh speaker is TJ Warfield hey can you hear me yes we can uh trusty dwit you're amazing keep it up as for the rest of you with
211all blatant lives that we've been told by District staff it is quite now quite obvious that this board is just straight up corrupt Marco Gonzalez lied during a recorded parent listening panel to the deadline of applications being accepted he said the deadline passed when there was still the rest of the week he had several chances to correct himself and stuck with his lie the lopine hills principal interview panel chose two candidates for second round interviews with Duffy the priority candidate the one that was ranked highest was never even called or in interviewed as was promised by District staff I want to stress that our chosen candidate is a highly qualified black woman who lives in our town Hercules attended our City's K to 12 schools and you choose still chose the older white person without
212even following up with our chosen candidate hell you appointed a new principal without even voting out our current one there's nothing Equitable fair or honest about this process and the board's Behavior this board in and district is riddled with cronyism and is simply corrupt racist please conclude your comment with your crap thank you the next speaker is Vivo hello Vivo with healthy Richmond today we're coming to you with the intent to propose a platform to shift existing funding from sro's contracts to fund services that parents of Youth have been recommending please agendize discussions to vote for defunding sros and reinvesting the resp at the next meeting recommendations number one school-based house centers 100,000 for the seven sites um totaling 700,000 recommendations number two supporting Justice impacted youth 150,000 supporting District staff and 300,000 for Community
213Grant Partnerships recommendation three the development of a structural oversight Community to challenge anti-blackness 350,000 we'd like to acknowledge that the funding to school based Health Centers will not be enough to cover all Cuts but will be extremely important to maintain Mental Health Services for students secondly we'd like to acknowledge that utr has proposed a similar platform and we are in conversations to find alignment this platform has been approved by our uh schools neighborhoods and action committee stiring committee and has been follow um has been endorsed by the following organizations wccusd DLC caps WCC parent Council yes nature to neighborhoods rder brider Beginnings SC family foundations and Ed fun West thank you please thank you for your comments the next speaker Is AO Wilson good evening hello again everyone um since we're short on time I
214just want to touch upon something that came up earlier black pain is black students when they're not supported black pain is Teachers when they're not supported black pain is in the voices of all the black parents that are counting or counting on you all to do something about their black children that is also black pain black pain is when you do not listen and acknowledge the black pain that is taking place within this District so since this resolution was passed black pain will be holding you all accountable for taking care of business thank you thank you for your comments the next public the next public speaker is Shakira Reynolds good evening I'm Shakira Reynolds a black mother of two special needs son former educator and concern Community member I'm here in support of the healthy
215richment recommendations as well as the utr platform and the implementation and funding of the ASAP resolution this requires more than empty promises but demands action and funding the time is now for change at all levels my son was accused of Faking injury and punished by being denied access to a staff member he requested for Comfort he was seven with autism and a speech delay I live in fear of his future interactions with law enforcement as well as teachers administrators and authority figures La the training awareness and the systems to ensure that he is not criminalized for being his beautiful black self I'm asking you to take immediate action by reallocating the SRO funding recruiting and retaining black administrators teachers and staff funding school-based health clinics and providing training that challenges antiblackness and dismantles the school
216to prison pipeline please invest in what you claim to Value thank you the next public speaker is Rose mcgean hello yes can you hear me yes we can um so I really struggled with what I wanted to have the board understand and and speak in in this this public comment and I guess the the thing that really comes to mind is disappointment um again obviously you guys are all aware of how our community in Hercules has really advocated for our current principal Dr murza but we went ahead and interviewed a new panel with the hopes that we can actually have a voice um and believed that we would have a voice and yet the one voice that we really felt was the one that we needed the African-American woman who was highly qualified never even
217got a call back I I just don't understand how you can put forward resolutions and talk about how black lives mattered and systematic racism and yet here we are as a community begging you for this individual and you won't even give them a chance I'm just I am I am DF founded and utterly disappointed that's all I have to say thank you for your comments the next public speaker is Gianna M milrick hello can you hear me yes we can okay hi thank you so much for taking the time to listen I just wanted to comment that I support the police being removed from all the schools in our district and I support all the demands that have been made by healthy richm and Richmond Revolution I just wanted to say I'm new to the
218area so I don't know about the schools here but in my area where I grew up I actually had to move across the city and transfer to a different high school and drive an hour every day because I was so targeted and traumatized and harassed by the police and I'm a white female so I later became a teacher I'm a middle school science teacher and I saw this happen over and over again with my students the police being on the campuses that I worked at only created more violence and Trauma so the data shows that taking the police out of our schools is better for our students so thank you for your support on that matter thank you for your comments um I would just like to remind the public speakers that you need to
219have a first and last name um organizational names will not be called uh the next speaker is Olivia chesi good evening again honorable members of the board and District Personnel in session my name is Miss CH is an educator in this District about 23 years but for the last 12 years I have been teaching at Lupine Hills Elementary School during during this 23 years of service I have worked with many principles each of these principles come with management and administrative styles that are peculiar to them of these principles Dr Samuel murer stands out as one of the most compassionate caring thoughtful helpful calm and respectful administrator I have ever worked with she cares equally for parents students and teachers alike students always surround her each with a story or something to share with her she's
220fair and just across the board Which is less than we can say for the past four years that we've been there if there was any any error any hostility in our school Dr murza was um she was a victim she was not the one prepet trting it we have a include your comment we have a few teachers that have been that have been terrorizing other other thank you the next speaker is Jake hasell hi can you hear me yes can hi I'm a Richmond resident and I would just like to add my voice to the chorus of people demanding we defund police in our Public Schools um I think we all understand that police are inherently racist so by having police there that's a disadvantage for black people and people of color um instead we
221should invest in money our money in programs for restor of Justice uh expand ethnic studies and uh add more counselors to schools and I also just want to take a second to thank all the students and former students who organized the Richmond Revolution rally last Saturday and thank them specifically for guiding me to this meeting uh and giving me something to be proactive about and just say uh keep up the good work and we'll keep following thank you thank you our next speaker is Sarah Vargas can you hear me okay yes we can okay good evening I am really quite emotional right now I really wanted to trust you as our trusted board member and our superintendent to do the right thing with Dr murza and the Lupine Hills Community but you didn't you chose
222not to listen to us you chose not to respond to us you chose not to be transparent with us and for that I am not voting for any of you in November um I'm also upset about the whole situation with the interview process how that went down once again the board was found on white supremacist values and policies and you are continuing to enforce and Implement those policies when you choose somebody that did was not the top choice or was not re uh reached out to in the process you guys need to investigate it investigate the interview I'm demanding that you investigate it and report back to us immediately thank you the next speaker is roxan Garza good evening board trustees and superintendent Duffy I'm roxan kog Garza and we'll be speaking on the healthy
223Richman recommendation number two which calls for the investment in existing programs in positive School climate for justice impacted youth we've made a lot of proog progress since the positive School climate resolution passed in 201 17 but Cuts in District staff assigned a positive School climate resolution implementation will set us back you can send a message to our families tonight that combating institutional racism and seeking alternatives to policing starts with entrusting and solidifying strong Community Partnerships like safe return project the office of neighborhood safety New Life Incorporated and Bay Area peacekeepers who are committed to the implementation of best practices to increase academic and social success of Justice systems involve young people through non-law enforcement assisted diversion programs I ask you to consider and vote on our platform at your next board meeting thank you and
224good evening thank you the next uh speaker is Cindy G gergus good evening Cindy gurus with public advocate it's as a community and Nationwide we are experiencing a difficult moment that calls for Meaningful and bold action tonight I want to Echo what has been said by students alumni and community and call on the board to redirect funding from SRO contracts and other school hardening measures and instead invest funding to measures that have proven to support High need students students of color and particularly black students who disproportionately experience trauma depression and anxiety as many folks have shared tonight research shows that school hardening measures like having sro's on campus fuel the school to prison pipeline by pushing out criminalizing and harming these students we call on the board to invest in priorities that black youth and
225youth of color identify in their Community by investing in more school counselors psychologists social workers and social emotional supports as recommended by healthy richment platform thank you thank you Guadalupe and Jana hello board members I'm here in support of the healthy richment recommendations uh we need to redirect funding to support our students especially for our African-American students directing money to the health centers in lude of all the budget cuts is an essential necessity in our district we cannot continue funding services that don't contribute to the education of the students in our district we need to fund education and support services moving funding to cenal support service programs and health centers that we ensure our children Thrive and be successful thank you thank you Guadalupe remedios attentio teacher at lopen Hills Elementary School right at the
226start I was already shocked to hear from you guys that you have pushed out Dr Mera you see I have been a teacher at Lupen Hills Elementary School for 19 long years and within those years one principal stands out Dr Mera she was the only one who I've seen practicing the highest level of professionalism at all time times she respected everybody and everybody's rights and and I am one of them she had respected my rights as a person as a human being as a teacher I've never felt better I've never felt being treated equally as others until Dr mura came she's a principal who has a lot of things for the kids on her own she would do all of those reading clubs math clubs dance clubs PE clubs and all those she has everything
227she has support for my students who are who are who are with special needs she gives all the support to all these kids I don't know why just being pushed out thank you the next public speaker is Kathleen Maloney um Miss baloney uh has disappeared so we'll move on to Blanca Gonzalez hello can you guys hear me yes we can okay great um not only am I an alumni from you know the wccusd but I'm also now a mother and as a mother um I would not feel safe sending my daughter to a place you know anywhere an institution where she's supposed to learn where there is police officers there especially with me having uh sorry excuse me having gone through um you know a very traumatizing um experience with somebody that I called a
228friend who turned out not to be my friend and advantage of me I had the courage to go to an SRO and well first I went to a mental health counselor mental health counselor directed me to an SRO SRO said that basically there was nothing they could do about it that because I chose to come in um I think it was about a week or two after the incident that um there was not enough evidence there was this there was that just basically a whole SPI about how nothing could be done for me and that all I had was um the Mental Health Counselors at the um Health Center that was there at at Richmond High um I didn't feel safe I didn't feel protected I didn't feel listened to I didn't feel heard I
229I didn't even feel like I mattered um not enough for a report even not even enough for a report to be done nothing like no chance of me you know being a person it was just like here you go um you know Mental Health Counselors or or health center it's your guys's problem to deal with basically your remarks basically I'm saying I support the defunding of the police officers on school campuses thank you Carlos lias good evening Schoolboard trustees superintendent and youth trustee my name is Carlos Lemos and I work for healthy richm first off I want to thank off everybody who has engaged in the conversation of redirecting funds from SRO to go to essential student services programs and basic needs especially as it goes towards black families ENT during these budget cuts as
230the ASAT laid out in their resolution first and foremost we sent you all a copy of our platform and three recommendations to redirect funds from sros and other Investments of families specifically black and African-American CL such as mental health services justed impacted Youth and a structural oversight Council I'm going skip this part for time sake check your emails healthy Richmond has prepared uh three recommendations around uh the elcap and budget I will speak on the third uh structural oversight council at its core you have heard from many black leaders and parents that they don't feel heard or respected or felt accountable for even when they write down the blueprints for what they need right now it's from the bottom up well we want it from the top down and basically we just want an oversight
231of uh to dismantle institutional racism as it shows up in our educational system stand up okay thank you the next public speaker is Yolanda Vieira Allen good evening I'd like to speak about uh the healthy Richmond recommendation and I'd also like to speak on um recommendation number three um institutional racism is maintained through the intersection of oppressions that are embedded within systems structures and procedures that direct the decisions and policies of West Contra Casta Unified School District in its governance these decisions are made behind closed doors these systems are closed lacking access and scrutiny we must liberate them by granting access and a seat at the table to all invested partners and make transparent all decisions policies and procedures to the citizens who are the true owners of all public schools thank you thank you
232thank you our F uh that concludes public comment thank you Mr wson and to members of the public who share their public comment with us right now I apologize president Hernandez Jarvis uh William McGee accidentally uh removed he was the last public speaker and I guess he toggled his hand down um on accident he's back okay thank you uh next public speaker William McGee thanks please don't start my time just yet the reason I'm saying is because there's something wrong my hand got lowered twice and I did not do it either time so I just wanted that to go on the record but I do appreciate you allowing me to speak you could start the time now um I wanted to just speak on I know you hopefully you guys will get to distance learning
233tonight but talking about the resolution that was passed and Equity or the inequity I do want to let you all know that there will be a lot of inequity that will happen especially in the Kennedy family of schools the Flatland schools even more my school dejon middle school particularly we are not able to have our effective assistant principal back because of funding and so with the the lcff funds Frozen at this time it's putting us in precarious situations and so this man who works at my school site as an assistant principal started a youth court something that's been my vision for years we were able to reduce suspensions and actually children because they listen to their peers in this Youth Court were actually running the class not being tardy so I just want to bring
234that to the board's attention that this will negatively impact my site as well as the Kennedy family of schools with the freezing of funding so I hope you guys can really take a look at that and uh work through this to allow us because we are going to lose this man who is an asset to our district and hopefully you'll get to the budget discussion and I'll I'll talk to you guys about comments there for distance learning too good luck you guys thank you that concludes public comment thank you thank you Mr Walton thank you to everybody who share their public comment with us um for this item right now so with the public comment concluded now we have uh concluded now we have the uh action items that have been combined which are F1
235and F2 uh public hearing of the 2021 budget 2020 2021 budget and the adoption good evening trustees we would recommend that we begin with the public hearing which is required each year to allow the public to make comments on the budget we would then follow with the presentation and discussion of the budget after the public hearing sorry I'm I'm so sorry I was talking muted I'm so sorry I apologize um to the board and to the community um we are now officially Opening Our public hearing of the 2020 2021 budget do we have um are we putting the presentation up right now too normally we what happen in the public hearing anyone that has comments would make those we would then move to the second item which is the budget thank you Dr wal so
236yes so um Mr Walton do we have any public comment for the public hearing the public comment is now uh showing up uh we currently have four I am sure there are others who want to speak on it uh who uh have not raised their hands yet so the first public comment is Mariel quar okay and I still see Four Hands raised so we can start with uh three minutes if we get more than 10 then we'll have two minutes so three minutes per speaker right now thank you Miss har request that was made was to have the presentation first and then have public comment um Mr Duffy can you can you clarify just on this because I know that when we have done the public hearings in in person we have the public comment
237um at that time but I want to see if I mean if we need to do it that way because I think that there would be benefit in the public actually seeing the presentation right now before their comment but I want to make sure that's not um going out of line in this way we can do uh sorry yeah we can do that that's fine we need to do that presentation um so let us do that and then we can um have public comment uh we'll just have to fig that out for the second part of the item so when we get to the technical budget presentation we will have already presented it in that way thank you for clarifying Mr deffy so um so so then right now I see that there are still
238four people with their hands raised Maria lauad Randy Joseph TJ Warfield and Yolanda VI Allen so if I can ask you to um to to comment once we have the presentation we'll come back to public public comments so we can have the presentation right now um especially because it's 10:20 so I would also uh request for a board member to to make a motion if they would like to extend the meeting now would be the time to do it I'll move we extend the meeting to 11:30 is there a second to extend the meeting to 11:30 I second that motion can we please take a vote Yes of us yes PHS yes panis yes L yes then this drive is yes motion passes unanimously to extend the meeting to 11:30 thank you okay Mr wal
239Dr wal thank you president Hernandez Jarvis we'll bring up the PowerPoint Mr Duffy and I will both be presenting part of the PowerPoint tonight we will try to go quickly so we can get into the comments we'll go to the next slide tonight we are presenting the proposed 20221 budget um next slide please and in tonight's presentation we're going to highlight some of the good news about the bond sale we've highlighted the word School in yellow throughout the presentation because as we've had a lot of talk tonight about the needs that our community has and the priorities that we need to fund we need to really Define and over the summer Define what will school look like and it's different than we've ever had this is is one of the most unusual budget Cycles we'll
240ever go through and so a lot of our conversation is about what are the true needs and redirecting those resources to support those needs we'll talk about what is in the budget what is not in the budget and what very likely will change in July and August at both the state and federal level we'll quickly talk about cash flow and what comes next slide next slide please so I want to start with some very good news the board approved for us to issue the last of measure D and measure e bonds $130 Million worth of Bonds were sold last week and we are pleased to come back and tell the board this was the most successful Bond sale in the the history of those two bond series we ended up with a combined rate at
2412.60 interest rate which was the lowest borrowing cost for any new money series of Geo bonds for either the 2010 or 2012 meas e we had extremely strong investor interest from major investors this was even after a small downgrade in our bond rating for Moody's we were still able to bring forward all of the 130 million plus deposit on just over 10 million into the bond repayment fund from the premiums which will already reduce the taxpayer burden for this wond next slide please this is just a quick summary of The Measure D if you go to the next slide you'll see a summary of measure e folks can look through and see that our 2.6% is significantly lower than any of the other series ABC or D so we're very pleased with the timing getting
242out in the market and doing that so that not only do we have the funds for our construction program but we're doing right by our taxpayers during these times next slide please the governor's May revision came out on May 14th it was a sobering May revision we presented most of the details to the board right afterwards he he is proposing more than6 billion dollar in cuts to K12 education with the caveat that those cuts would be removed when Federal cares act Federal Heroes act money comes in there we are being directed by the contracosta County Office of Education to use these assumptions for our adopted budget I will talk about the legislative proposal when we get into the details in addition there is a proposal for deferrals 1.9 billion at in this month June and
243then next year 5.4 billion where public education will receive no State funding in the months of April May or June requiring us to do some borrowing through the County Treasury next slide please so the big takeaways from the governor's budget were that in three months more than three years of lcff growth were immediately erased the state does not have a permanent solution for the economic impact and needs the federal government to step in to help also it's very likely that the 2021 school year will be much worse 2122 than 2021 because the impact of lost income in this calendar year won't be felt until we see income tax returns in April of 2021 and so it is still very very important that the educational Community continue to advocate for Relief so that we can provide
244just the basic services and we're starting to hear that our voice is being heard in Sacramento as I get into the details later and there are a lot of movements to continue to Value education we still are in a position where the governor has proposed the elimination of every new program that he was looking to do and then cutting back on existing programs so our challenge is to be very efficient with how we shift our resources next slide please now the state legislature however has a very different strategy they believe that we're going to get the federal money so they are recommending no cuts to lcff they are recommending no cuts to the categorical programs or state preschool they're recommending the funding of a 2.31% cola there and their belief is if the federal funds
245don't materialize their course of action will be to add an additional 5.3 billion in school funding deferrals what that means is Not only would we not get paid in April May and June it's very likely that we will have to borrow cash in within the year to cover a promisory note for another five billion across the state they also have an average daily attendance hold harmless there that requires that we have distance learning if schools remain closed there but we would still get funded for our students this is a much more promising event as we stand right now both the legislature and Governor have agreed on a couple things they agree on the deferrals they agree on the stirs and purs reduction where they're having some differences has to be has to do with the
246distribution of the last portion of cares act and I'll talk about that when we get into the details and then they have the disagreement on whether it's a fully funded budget or whether it's a Cuts budget and then we'll refund money in September October next slide please the reason that the county has required us to budget based on the governor is because in state in the state Charter the governor has blue pencil rights he has the ultimate ability to veto or remove by line anything that the legislature sends to him in the budget that he doesn't want to fund or doesn't believe should be done so in a sense Jerry Brown did this in 2011 when he did not believe that the legislator's budget was balanced and sent them right back to start over the
247entire process again and so the legislature will adopt a budget before June 15 the governor has till June 30th to approve or deny it and then the process starts over so again we have to prepare for the worst but be ready for much better news next slide please and so this again talks about what we're going to build when I go into the details our budget is based on the governor's proposal at this time I'd like to pass over to superintendent Duffy for the next two slides next slide thank you Dr Wald um I just wanted to take a minute to uh remind the board and community that we continue to build around these board budget priorities so um as folks have spoken throughout the night um the budget we're building is doing every everything
248we can with extraordinarily limited funds uh to make sure we take care of the goals and the activities set out in the road map um and that we keep focused on our newly adopted Ela program we continue to focus on our di program support for African-American students to positive School climate work and policy we've called out stge elementary school as a place we want to continue to invest um and that last bullet make the necessary reductions and I think that was for this year and we've really done a wonderful job on that of getting there so just really making sure folks understand that what we're doing is driven by a set of uh core values and priorities I wanted to also just take a second to make sure we captured uh the dlap budget recommendations
249and we know that the full LC cap is not due until December and we're going to take full advantage of that extension to continue working on the lcap through the summer um and make sure we get our programs in place before school opens um so the budget recommendations from the DLC cap were that all base funding should be included in the lcap we're working towards that uh the cuts to the supplemental funded programs um should be proportional to the cuts the district needs to make that we utilize an evaluation tool for lcap programs and we create a concrete plan for mental health so we are fully aware of those and we thank the DL capap for their uh incredible work over this year and they wanted to make sure they got those to us early
250um so we have them and we'll continue to work on them so as we go to the next Slide the old model really was about Equity of funding as we spent a lot of time tonight talking about Equity of outcomes student- centered approach and as we move forward that truly needs to be our Focus that every available resource is directed to where it's most needed slide please so as as we go forward our program decisions everything needs to be about what can we accomplish how will we measure our results based on our resources what actions do we want to implement and our whole strategy is as with the adoption of the budget that's just the beginning then it's back to with all of those resources that we do have on hold where do we direct
251those what is the most important piece to make sure that we're meeting the needs of our community that they've really broadcast very clearly to us what they want to see next slide and so the building blocks this is something we talked about in September when we started this process that the budget needs to be consistent within our organizational objectives it needs to be realistic and understand what we can do and what may be a stretch but it also needs to be extremely flexible and flexibility is very difficult when 85% of your budget is attributed to staff so one of the things that we've done operationally is we put a hold on every non-essential contract that's within the budget the budgets remain but the contracts have not been brought back to the board to allow for
252that flexibility to allow us to redirect resources which has been a big topic tonight so that we can address those critical needs next slide please and at the same time we have to spend this summer redefining what school is we have task forces that are beginning that involve all of our stakeholders our unions our District staff our parent groups the board that we're going to need to have discussions and Define that word school there are new service requirements there's new instructional delivery methods new groupings there's going to be training required it's going to require a shifting of resources and likely more resources than we have today to be able to implement so I'm going to quickly go through a couple of highlights from the Govern from the state superintendence document that give just an idea
253of some of the conversations we have to have on the next slide there as we Define what are we going to have to do but the most important thing that he really talked about is that we really need to look through different pieces and and the big piece that I highlight on this slide is none of the costs that are associated with the concept in that document are currently included in our budget so as we go through and make decisions we have to make sure we have those resources next slide please and there was a real important two tenants that Tony Thurman put in the forward that we really need to make sure sure that we have a quality education whether it's in a physical classroom or distance learning and that we must must and
254I I'll emphasize again must emphasize the focus on the emotional well-being in all of our students and our staff and put that at the Forefront of every piece of our decision making in one of the budget presentations we brought back um masa's hierarchy of needs which starts with Safety and Security you have to be able to feel safe and secure and have that hope to move forward and so social and emotional support is going to be an area that we really need to invest in moving forward so as we go forward that the guidance there is going to be real critical as we leverage all our funds not just elcap funds but supplemental title funds and different flexibilities from the federal government to meet the needs of each of our programs and so we are
255looking at every fund not just lcap to meet these needs next slide and so we know that um we're going to need to do several things we're going to have to have adequate supplies we're going to have to have all the safety equipment we're going to need to maintain social distancing for quite a period of time and define whether our facilities can even accommodate that we'll have to determine the student staff capacity at each site next slide we understand active screening is going to be a requirement that all staff are going to need to wear some sort of face covering as well students we're going to have to redefine our cleanliness standards and what does that mean for our staffing limits it pretty much recommends that we need to limit access to our campuses for
256parents and other visitors which changes the interaction that we've always used to be inclusive there's even the recommendation of cancelling all out of um campus trips and Intergroup events and so it's a challenge to Define what will school look like next slide and so here are just some quick examples of what it might cost to fund some of these things next slide if we're required to provide a disposable mask and the state says that they're going to provide them but they didn't say they were going to pay for them so it may just be a a lower price but if we had to give one mask per student each day that were disposable that would be at first estimate $5.6 million that we don't have in the budget for staff another $835,000 next slide if
257we were to be able to use reusable masks where the students take them home and staff take them home and wash them we figure maybe you can get through 15 uses there so each person would need 15 masks within the year that drops the cost to 1.6 million for students and another just under 200,000 for staff again not in the budget and that's just for masks if we need to put in um safety Shields at all of our um front count ERS and anywhere that the public may come in contact with staff we're looking at just for the parts 77,000 that doesn't include any of the installation and Facilities modifications then talking about the fact that we need to do active screening daily to have non-c cont thermometers if we were to give one to
258every classroom that's 100,000 just to buy the thermometers if we just put them then every non-school site building another 1,400 so again these are that aren't built in so with that I'm going to pass it to Mr Duffy again for the next series of slides so similar to what I talked about earlier but in the covid-19 pandemic uh this is going to continue to force us to think differently about school um and really make sure as we're building the plan that we take uh into consideration all of the needs of our students both the very traditional needs many of the needs we t talked about at the beginning of this meeting but so much of what's happening in the online environment uh is creating a lot of inequities uh across our system and exacerbating uh
259existing inequities so we are going to have to adopt the budget but also understand we're going to have to be ready to tackle these challenges in many different ways so what you'll see here is just a little bit of uh a framework for How We are continuing to think about opening School uh we'll talk about that later uh in our covid update and what the opening of school will look like the task force the working groups how that will work uh but it will be revolving around these areas um that you see here so one of the key uh pieces of this budget that you do not see this year is the lcap that is due in December so where you might normally see the programs and line items for every single program we're not
260finished with that yet and so we want to continue to work over the summer as Dr wal shared there are two competing budgets at the state level and we hope to know by the end of the month a little bit into July where we will stand over time we also need to know what federal resources um may be coming additionally so we're going to adopt this budget and know that some of the specifics in terms of how some of the line item programs play out in the lcap and then the supplemental concentration dollars uh which you will also see later um because we have such huge reductions in that area will continue to work over the summer to get ready as we get ready for school in the covid era and connected to that one
261of the very very important areas in our lcap uh is the funding for African-American students we sometimes call that pass our programs for African-American Student Success um and so we adopted a resolution in January that committed um ourselves to incre inreasing resources for africanamerican students and families um and that is exactly what we're doing um so that resolution called for about 7.2 but it also called to be in alignment with our supplemental we expect a major reduction in supplemental so that would lower that amount of money just a little bit but right now we believe clearly that we will be at that number by the the time we get uh to the opening of school and the next slide outlines a little bit more about how we're doing that so on this slide you'll see
262on the left uh what we believe we've allocated um so far and while we don't believe next year we can take that entire uh seven or close to seven out of supplemental we're doing everything we can to get to that number that we've committed so you'll see on the left dollars that are finished completed allocated uh for the work and there's another set of dollars on the right that we continue to investigate and so um you see uh the second line also has uh shift the safety budget uh to African-American it should say slash mental health um and that is just what we talked about earlier so if in fact that money were freed up uh and the board has made a move to do that tonight uh that would be another pot we can
263dig into um for these types of resources and so you see the cares act funding you see it says other we will continue um to dig in but we believe with both what we've allocated what we'll continue to do with these other pots we absolutely um can get to uh the resource that we want to add we would of course love to add even more uh resource to support African-American students but um we are doing it I'm excited that we're going to get there and then part of the work over the summer is to continue to say with that $65 million doar exactly what will be funded and that's usually what we do with in inside of the lcap um and that again isn't 100% ready um but we really really are excited about the
264work that's being done for us to be able to get there so wanted to just share our workto date around this um resolution so as we move to the next slide our our process that we've been talking about for a while is with the adoption tonight this is a mechanical requirement we're required by law to adopt a budget the budget does not have the item programs what we've done is we've freed up dollars that are not directed to contracts we have not entered into contracts next year so that the board can spend after adopting the budget redefining those priorities shifting those resources exactly where we want making the determination we want to purchase this program or bring these staff in and then also be in a position as the state and federal budget adjustments occur
265to be able to quickly Implement whatever comes from there and then be able to in September Implement our new definition of school so tonight when we asked the board to approve the budget we are not saying that everything's set in stone and now you can't change how we're going to direct resources in fact we're saying the opposite we're saying we've defined what our expected revenue is and what our total expenditures are and we now have the ability to have a true two-way dialogue about where those priorities get redirected how we defund certain things and we purposefully noticed all of our main contractors including the cities more than two months ago that their contracts would not automatically be renewed that they had to come back to the board for final approval so that the board does
266not need to take any additional action to defund we've already put the board in the position where they have the ability to direct us which direction we go next slide I'll go into the details now of the budget so when you look at the sax forms we thought it would be quickest to just show what's there so when you look at the big difference here our lcff Revenue based on the governor's proposal is dropping from 287 million to 262 million and then within the budget we have implemented multiple onetime Revenue Solutions we have the cares act special ed and the District's version of car's act which is 13.9 million there is another element of car's act that is not in the budget the state has $2.9 billion dollar they're going to issue to school districts
267right now there is a disagreement between the legislature and the governor on how those dollars will be distributed the governor's proposal which is best for West Contra Costa by the way is that they are only distributed to school districts that receive concentration Grant funds should that proposal go forward he's not drawing a line in the sand that he wants it to be that way we would potentially get upwards of another 15 to2 million dollar that you don't see in this budget one time next year the counter proposal by the legislature is that it's distributed based on a per pupil amount based on lcff formulas in that case we might get an additional 8 to 10 million so in either case we will get additional Revenue that's not there that will allow us to either mitigate
268some of the cuts that we'll talk about or Define some programs over a couple periods of time you'll see that we removed the preschool block grant from this year and then the OPB transfers are built in to the budget here next slide please so this is just a picture of how we build the budget next slide and then a graph of how what percentage of each of the um different budg budget pieces next slide this shows our expected expenditures um you can see that the stirs reduction and rate meant that we spent $2.5 million less next year for stirs and 700,000 less for purs but you can see that when that sun sets those expenses do come back in the third year there and so we've updated everything else throughout if you'll go to the
269next slide please this talks about our expenditures the board took dramatic action to reduce services and non salary and you can see in the budget a 20% reduction from 63 million in the current year to 50 million budgeted for nons salaries so a 20% reduction very significant you can also see that the board's adopted budget reductions are indeed built into this budget and that we've reduced our expenditures down to 377 million next slide please this just shows a quick history of our revenue and expenditures um next slide this talks about the transfers so you can see this year we brought in fund 17 Revenue one time to move us through the year you can see that the contributions continue that is the amount that we pay for special education more than the state and federal
270government provide us this has been consistent for years but we just wanted to point that out also because of the amount of work we've had to do to feed our community there is the potential for a larger encroachment or contribution for nutrition services we're hoping that there will be augmented REM Revenue through FEMA and other pieces but until we can quantify that we did account for the possibility that there's more expense within the budget continue in the next slide please so our ending fund balance we will end this year with approximately $27 million above our 3% Reserve those dollars will help us to not have to do every cut and move the cuts over two years again and by doing that we will end next year because of the work the board did in the
271worst case scenario the governor's proposal we will end next year with our 3% Reserve in fund 17 and an additional 9 million unrestricted that's still in our ending fund balance so the district absolutely will be viable under this circumstance next year we'll go to the next slide this again shows our fund balance changes you can see with all of the changes this year we actually were able to maintain a very healthy fund balance and not have as because of the one-time funds we brought in we were able to mitigate some of that structural deficit for one year it comes back when the onetime funds go away in the next two years next slide so this is just a summary of the actions the board took we've gone through that multiple times before covid we were
272going to have to cut$ 18 million next year for the following year that was where we stood with the hope that schools in Community First would help us to reduce that amount next slide because of covid-19 we've recalculated in the governor's proposal the new cuts are $26 million meaning that we will need to cut 44 million under the governor's proposal then have an additional 18 million in cuts for the 2223 school year based on the one-time Solutions the governor put in this year that means that in the worst case scenario we're looking at a two-year requirement to reduce an additional 62 million so that's the worst case scenario and then we'll show you that in an myyp on the next slide so this shows it in the myp it shows that the ending fund balances
273without cuts that were fine in 2021 but without cuts we would end up exhausting all of our reserves in 2122 and then certainly you would have even you'd have nothing in 2223 so if we make the cuts go to slide the next slide please you would see that we would indeed be able to get through the 2122 year and the 22 23 year but that would require 44 million in cuts and an additional 18 million so a total of 62 that does not include any federal additional assistance we get any of those do would allow us to push these problems farther out and continue more of the services that we have so now let's flip over to what that meant for supplemental concentration next slide please this year we budgeted 54 m777 th000 in the
274lcap next year based on the governor's proposal we would have $47 million for supplement on concentration a decrease of over $6 million in supplemental concentration and 18 million in lcff base so you can see the 24 million there for 2021 then you can see an additional reduction the following year based on the governor's proposals we can go to the next slide however the legislature would fund us completely and so what ends up happening with the legislator's proposal is we get 378 million in revenue and we still will get the cares Act of 13.9 we end up with over 38 million in our balance at the end of the year next year we then would need to cut approximately 16 million each of the two years so a total of 32 million over two years based
275on the legislative proposal so it drops from that 62 all the way down to 32 so 30 million go away and that's before we add in possibly $20 million from the cares act that would allow us to then divide that probably into three years of10 million Cuts instead with those one time dollars so there's there's a lot of Hope on the horizon as we go forward and this is the reason why this is adopting a mechanical budget there's so much that will change between now and August today we sat on a webinar from casbo that talked about there will be a August revision just like there's the May revision and that you need to prepare that things are going to change and the only thing we know is that the state budget today is wrong
276it will be different and so we know that it's going to be somewhere between the worst case scenario and the best case scenario in both cases we have resources available that we can meet the goals that we've talked about tonight we have resources that will get us through next year we do have the ability to do this well and do it right if you go to the next slide please you can see when we do the cuts we actually end up with a balanced budget in 2223 if the legislative proposal comes forward and we are able to implement those cuts in that timeline we would be back in the worst financial situation the state has seen since 2008 we could actually bring ourselves right back to a balanced budget and a positive certification in two
277years and again that's without that 10 to 20 million in cares act built into this budget so there is a lot of Hope and a lot of possibility because our advocacy has been paying off next slide please so again you can see there under the legislative proposal we still do have a reduction in supplemental in concentration from 54.7 million down to 52 .2 million so it's about an $874,000 reduction a small amount but still a reduction next slide please and so that talks about the cuts that are 18 million based on the governor based on the legislative would actually drop to 16 as we talked about before next slide cash flow is going to be a big issue for us we know the deferral in June will happen for sure because both the legislature and
278the governor agree on that so if you go to the next slide it's very hard to read that well this just shows that the deferrals you can see 1.87 billion at the state level in this month and then fast forward a year from now you can see no funding for three months and the difference a year from now is there's no guarantee that we're going to get that money in July whereas this deferral that's happening this month they will fund it immediately in July if you go to the next slide you'll see our this is how you're supposed to get funded you get in July and August 5% and then you get 9% every month equally um you can see what happens next year on the far right we have that big V we go
279down to zero and then hopefully come back but we don't know when that comeback will be and that'll be part of our borrowing strategy you go to the next slide when we look at our cash flow scenarios the board has approved the ability to adopt they to use in fund transfers so we currently do not believe that we'll have an issue with deferrals until potentially November of this coming year we're already in conversations with the county um to utilize the Teeter meth methodology to get an advanced apportionment of that 108 million in property taxes should that occur and we get them earlier which is very likely what that would allow for is that we would not need to potentially do any type of borrowing until more likely April or May April May or June of
2802021 and most every district will have to be borrowing at that point so we're going to look at doing some pulled options to get the best possible rates so our calendar of events we're proposing that we adopt the budget tonight it's a mechanical exercise and we then immediately go back into the conversation of having priority conversations of defining what school is working with our community and our board through study sessions to have clear reallocation of resources that we've put on hold to allow that to happen wait wait for the next Governor's budget update which will be probably in August and then just like we did September 14th this year with the United actuals we'll come back in September with the true budget plan as we move forward leading us to that November 2020 election where
281hope there'll be some additional solutions that would make our reductions even less to get us right on that pathway for a very possible balanced budget even during this era as we work together so with that um if we'll go to the last slide we are committed to not only working with our associations but we need to work with our community and so we've added quite a few different bullets onto this slide because part of our work starts to after the adoption into this budget to really go into priorities there was a lot of information tonight there's a lot of hope we are really pleased that we do think we see a pathway to do what the board has asked and directed us to do and we're here to take all questions and comments thank you
282Dr W and superintendent Dey um since we had the presentation right now before the board starts to ask questions I would like to um officially reopen the public hearing so that the members of the public that wanted to speak at the beginning have a chance to do so at this moment okay president Hernandez Jarvis our first uh speaker is Mariela quer thank you [Music] limbo [Music] um w um and [Music] um for [Music] please conclude your thank you um I'll share the questions that were brought up during the discussion too with Mr W thank thank you next speaker is Elon Harrison Miss Harrison if you'll unmute Miss Harrison we'll move on to the next public speaker uh Randy Joseph hello can you hear me yes we can okay um just want to make sure that
283I uh a few clarifications and some questions that make sure that you guys answered so what I heard um Mr Tony um say was that that the money the budget is just used as a placeholder not to where how you're going to spend the budget want to make sure that's correct um because I want to make sure that this budget really helps our youth in in this community help our school district community and make sure that these monies go to the proper places um for example especially if youall getting ready to go back to covid but going back going back into schools from what covid grown uh making sure that all our students have internet access just in case a revamping of this happens again and kids have to go back home and that was
284one of the big things that I saw a lot of kids did not have internet access so it made it real help really hard for people to do distant learning without having internet access right so making sure that is really institutionalized in the budget making sure that African-American achievement making sure that that is centralized in the budget making sure that um lgbtq youth are centralized in the budget making sure that Mental Health Services are centralized in the budget making sure that I saw there's a reduction in textbooks I've been to schools and I've seen some of these textbooks they have textbooks with George Bush is still in the the president in textbooks like that's these are all problems that need to be addressed and to be a part of these these budget changes right but
285also with this new environment and stuff like that making sure that the kids are ready resting case to go back to distant learning that the funds are available to support these kids and not them already have been behind which happened the first time that's all the time that I have thank you thank you our next public speaker is Yolanda Vieira Allen well thank you so much um finally I see some light um finally I see some work I wish I was I want to be happy and excited but I still am a little bit not trusting and I I just want to say that I know the reason part of the reason is because this is a feels like a last minute effort um let's try to get something in before that we have this
286board meeting when we've been asking all year to be included in discussions with you we've been asking all year to be in dialogue about this so that we could have come together with this plan and we would feel very far more rooted in um holding this piece uh together but I am thankful um that at least uh now we're beginning to see um some real concrete um designs to support African-American students and to bring about a a change in this district one that is so needed um and um so very necessary so thank you for stepping up today and thank you um for what comes next because next is the hard part making this happen thank you thank you the next public speaker is Cindy ggas Cindy gergus again with public Advocates we appreciate and
287want to thank the district for its commitment to include all base funding in future lcaps and ensuring that programs funded with supplemental and concentration dollars are supported by data and we are confident that providing this information will enable the district and stakeholders to assess the effectiveness of its investments in light of tonight tonight's budget discussions my comments are around future engagement we know the state will revise its budget in August and that the district should also revise their budgets in August or September and we'd like to know how the district plans to engage the community throughout this process additionally it is important to understand how the district spend has been impacted by covid-19 providing this information will increase transparency and ensure stakeholders are meaningfully engaged at every step of the decisionmaking process lastly we recommend
288that any unused snc funds retain their original purpose and continue to be used to increase or improve services for high need students now more than ever increased transparency is necessary to ensure that lcff dollars generated by high need students are used to support those students many of whom are most impacted by covid-19 and who will experience disproportionate harm caused by this pandemic thank you thank you um now uh Zeon Harrison Miss Harrison hi can you guys hear me okay great thank you guys for um even putting us on the budget and even bringing us to the light I appreciate that but there again like uh Miss Jarvis said I don't want this to be a fat and I don't want this to be a show you guys need to show up and this Board needs
289to hold them continuously accountable and continue to revisit and making sure that this rolls out in a way that the community is a part of the decision making and the district and the board are working in collaboration so we can get the effect we want for our children clothing the achievement gap for black students and making sure we have equity in this District so Bard do not let this be just a show please follow through and make sure to ensure that black students in this District are getting an equal and a quality education and we do not have to feel that this is just something that they're saying and not going to happen this needs to happen every year we're losing children due to jail death black children are dying in this district and undereducated
290and that we don't need to continue to happen when we can choose today to do something about it we need to not just have the money but adequate resources that are effective for our children not resources that are not effective and they're saying that's where we spent the money ensure that this happens and we get equity in this and that black children we can change things ask to see the change don't just ask to see the money allocated where's the change happening that thank you thank you our final public comment for this item is Audrey Goldie Williams wow book where are we at um I just like to take a moment to say to my African-American and black students parents teachers administrators and our allies and our board members we made history we were able
291to put our African-American and black students in a position where monies were attached to the words that were spoken about them where monies were attached to the expectations that we have for our kids I said ear earlier I said change is not coming change is here so I Echo what Yolanda and zon said in our expectations as well as I have the firm belief and knowledge that we're going to do the right thing and we're going to do what's right because here's the biggest thing some people lost it it's just like with the black lives matter movement people get caught up in being unable to say black lives matter one of my students said how can all lives matter if black lives don't matter what people don't get is when you acknowledge that black lives
292matter and things get better for black lives then things get better for brown lives then things get better for our indigenous people for every community and all lies get better when it comes to this what people have to understand is our focus is the African-American student not just because we're African-American and black but because our student is the lowest in achievement so when you go and attack that area and that student gets better every student in the district gets better every student in the district prospers every student in the district is successful so to my africanamerican and black families thank you for all of your hard work thank you for all the times that you've come and showed up and um wrote letters and showed up and said see us they see us so now
293that we're activated we cannot stop being act activated we can not stop pressing because now the words were there the approval was there the money's been assigned not all of it but some of it so now the expectation is for this to be real not just a presentation on paper for this to be monies that show up that help our district by starting with the African-American and black community every student will be served in our District good job wisc Contra Costa UniFi School District families friends allies and board thank you that concludes public comment on this item president Hernandez Jarvis I wanted to suggest because we have to do the second item um that we just close public comment here and because this presentation was originally with the second item um that the second item
294which is the adoption of the budget that the board take discussion there that way we can finish one item and you can move into the next item and we wouldn't have a presentation for that item this one would suffice thank you for that suggestion um superintendent Duffy and Mr walson just to confirm there's no more public comment correct that's correct thank you so now we're officially closing our public hearing um for the 2020 2021 budget and we're moving directly into the next part of uh this Consolidated of items consolidation of items to adoption of the 2020 2021 budget and I uh I would like for the board to to have a chance to um ask questions and comment now as well and if uh student trusty would like to begin or if uh he would
295like to go after that that's okay I can um it's up to you uh trusty basa I'd like to go after okay thank you for clarifying so thank you so we can begin right now with uh trusty let me check very quickly trusty quas then trusty Phillips trusty panas then trusty L then um student trusty Vasquez Sima and myself or we can we can switch at the very end too uh trusty clas um I don't have any um comments I know that so much is still dependent on what the federal government does what our state legislature does uh one thing that isn't dependent is our awareness of what our needs are and how much we need to be able to dedicate resources towards that but I do want to say that it's also about how
296do we still support our needed students with the resources we have no matter what the amount is and that's where again I will be a broken record to say that we will be in fact opening up contracts with bargaining units in the coming year and that's why your Schoolboard elections are very important because it's there where the leaning in has to happen because the majority of our budget goes to the human endeavor of paying folks in the district so if we want to see outcomes for our students with the resources that we will have regardless of where the outstanding issues are it will begin with that conversation and making sure that folks are in fact amable to what does it mean to provide supports for our black students for our native students for our in
297um immigrant students whoever they might be for all our students in relation to where the majority of the money that we get allocated goes to and I'm looking forward to the community being a part of that conversation the last thing I will say is that I would actually uh make sure that we have firm and anything we do however we adopt this budget reaffirm the decision we made which includes a language that says we are in fact not funding um SRO services in this budget I understand Mr Mr wal you said well that's already in action that's encompassed in what we are presenting and you don't have to worry about it um I I know that's what the community is asking us when they say make it happen and I think part of making it
298happen means being explicit about it so I will hopefully see some language when we do adopt from anybody who wants to present and I'll be supportive of that that that be explicit in our adoption of this budget those are my only comment thank you trusty trusty Phillips uh thank you very much um I have a couple of comments sorry it's getting late and I'm a little tired to be honest um the monies that were Al there were monies Al I'll start with a question so there were monies allocated in the budget for SRO is that correct yes okay and so there's a a a line item in the budget right now for sro's right correct there's a five in the 5000s the services there is 1.5 million budgeted that would have been directed for those
299contracts should we have brought them to the board for approval okay and there is a pass budget correct there is okay uh now president Hernandez Jarvis are we right now having the discussion on which discussion are we having right now are we having the hearing discussion are we having the the adoption discussion what what what's happening right now this is the adoption discussion thank you try for asking the questions yes so we closed the public hearing so we moved on to the adoption discussion for the board okay so thank you so I am requesting uh as in line with what I was I've heard multiple things and they were mixed what I was was hearing but I am requesting that that entire amount of money uh that was allocated and this budget for the SRO
300that that entire amount of money be moved to the Past budget because that is what everybody said they wanted to well that's not well that's what I'm requesting trusty Phillip can you clarify that a bit further so so what I heard uh was a bunch of people call in and say that we need to uh defund the SRO program and that we need to spend that money on black students and then after we did it I started hearing about healthy Richmond's proposal and everybody's proposal but we have a past budget uh that is for African-American student achievement and uh I know that the people who were arguing to defund SRO I know that none of them were using black children uh to get across a point that they wanted to make and then use the
301funds for something else I know nobody would do that uh so that money all of it I am requesting that it be moved to the Past budget because that is the budget that is supposed to help black black children and specific so the the simple if the board directs we would take it from the operations budget and place it in the past budget and then the board would then direct how those dollars get spent within the past budget that's basically what you're recommending it doesn't change your adoption of the budget because it's still in the 5000s it's just moving from one operational budget to another that's what I'm hearing is the request from the board to do that and that's a very simple mechanical thing for us to do it doesn't require a change in
302the budget as published it's just us moving it from one place to the other and then spending it after we have it other meetings the board will direct how that 1.5 million gets spent so just so I'm sure and I understand this when you say uh because for me personally the idea that budgets are just placeholders I don't believe that's what budgets are I believe budgets are statements and you've heard me say this before um and I have some concern that what I'm hearing is that in this meeting what I'm hearing is that uh we're saying that this is what we want to do um but then later on after the budget is passed we're going to have a discussion about how we're really going to spend the money uh that's what I'm hearing and
303and and I could be mishearing and somebody could correct me but that's what I'm hearing and so I'm just trying to make sure that uh I get it that the board has to approve the contracts and we're not giving anybody a blank check I get all of that um but the budget that is passed tonight I want that one point whatever million dollars it is in the past budget yes that's what that's what we're saying yeah I think one of the easiest ways to potentially do that is when you adopt the budget that we add clear language to the adoption so someone would have to make some type of motion that adopts the budget including the $1.5 million being moved from these contracts to the Past budget so it could be memorialized and and and
304Madam chair if I may I'm happy to add that um and you as well Tristy Phillips to that language around the the funding of SRO and spefic specifically redirecting those dollars to the Past budget um I think that that I see what you're saying and I think that's where we will say there's the um where the rubber hits the road now I know for a fact everything that we would fight for for additional Services the past budget knows what those are and we in fact use those dollars for that and that's for them uh to weigh in on what I want to say though is 1.5 million is not inclusive of everything our students need and deserve so that's fine uh for the sake of demonstrating that that we're serious about what it is we're
305redirecting those dollars to the notion of redirecting SRO dollars is a conversation we started a long time ago a long long time ago and I am happy to support that in terms of uh what you're suggesting uh but I agree with you um that's the minimal I think we could put out there yeah no I I trusted uh quas uh the total ask is as you know it's it's a little over $7 million so uh $1.5 million is a contribution towards that um and I agree with you what you're saying that it's it's more that this board that this district is going to have to come up with uh but I just want uh like you said this is where the rubber meets the road so you know my motion is that we adopt the
306budget with the $1.5 million uh being reallocated to the Past budget uh to be spent uh under the past budget that is the motion that I am making than trusty Phillips are clarifying trusty and I would just say um I'm happy to support that uh as a second the issue is going to be that I think there's probably going to be more conversation from everybody that will lead to a bigger motion than just this one I think these elements will be in there but I'm certain other colleagues will have some thoughts about other parts of the budget thank you Joy so jie Phillips made the motion did you have something else you wanted to add no I mean I just want that to be memorialized and it is because I I don't want to have
307any conversations a month from now about people wanting to spend the money elsewhere yeah got that thank you um and so I I think that it's true we're going to hear more conversation right now from the board and I would excuse me I will be happy to come back to to this and and have this uh captured as we make the motion um or not make it I'm sorry as we second the motion and then take a vote thank you um trusty FAS and then trusty l thank you president hernandz Jarvis um so I say I completely agree that we should have a a budget motion tonight that says that we are not going to fund SRO and instead we're going to invest those in other services you know we heard a lot of people
308come talk about the past budget we heard Elie Richmond come talk about a really interesting proposal they made you know to spend that one5 million we've had utr make a suggestion um that's really interesting and we could spend a lot of time talking about this but I think we need to acknowledge that I think there've been a number of people come tonight with some really I'll just say suggestions uh that are excellent and need some careful consideration I have some specific questions and comments about the budget beyond that though so um first of all I have a general question like we're proving a budget here we haven't even seen an org chart yet when are we going to see an org chart that tells us what is this structure we're trying to build how is
309it going to be put together well I believe you've seen one uh or chart at uh one point um and we still have a number of positions that are in flux that we are trying to settle um and so I believe as as soon as we feel like there is enough um final movement and positions are you know finally approved uh through the board level by the end of this month um we'd be happy to to share that with you I mean I don't I don't actually care who's in the position I just I don't know like what does our organization look like I still can't tell if we have less people than we used to have I mean we have no information on what's it going to look like you know we've seen an
310or chair that like maybe goes down to the director level we don't know what's below director level in the central office we don't know anything about how many people are anywhere you know and it's very unhelpful to the board members to be saying well we're just going to have an organization we'll tell you what it looks like later um okay let me go on here um you know our County Office gave us clear direction to use the governors May revise as a basis for our 2021 budget whenever you create a budget you use the best data you have and crunch through the numbers as Dr wal indicated you use the best data you have sorry and we did exactly what we did using the governor's budget um however I'm completely in disagreement with the concept
311that what we're doing here is a mechanical activity it's a throwaway activity I talked to fmat you know I talked to vimat periodically and they said absolutely you should not consider this as a throwaway budget the governor is the guy who's got the power and if the government wants to change something he will but when you make a budget you're using the best you should use the best available data and work through the numbers so like I must I'm not buying into the concept I'm not saying we're not going to revise this two or three times but like say what we're doing here is a mechanical or throwaway effort I just I have a hard time buying into that I want to ask some questions about a couple of slides here um on slide um
312we talked about the budget priorities and there was a s there was a suggestion that we're doing something special for stge next year are we allocating extra money for stge is it just going to be the money to run the school what's going on with stge so there are a couple things that continue there were a couple additional positions that were built into the siege model that continue in next year we're still trying to sustain some of the growth that we're hoping to see happen with that investment there so it is a rollover from the same resources for the most part that we had this year okay so it's basically the same operations this year okay um and the next bullet talks about the positive certification I mean like we're not even close to hitting
313that Target so that that is correct um as the board is aware we we are certainly recommending a qualified yeah um um so uh on page 13 you know are we all agreed that all base funding is going to be in the in the lcap because the DLC caps committee last night they were completely unclear on whether or not all based funding is going to be in the ELC so the the board directed that we need to create a better model that shows all of our funding and so we will have it show up in the lcap some of it doesn't align to lcap goals some of our base general fund so we'll create some other program categories but all funds will be represented by December for everyone to see okay um so on slides
31424 and 25 you know it talks about for example the masks I mean guidance came out from the state it was in a document called guide book for safe reopening of California public schools and in there they said we're going to get these masks for free and there was an article in the chronicle a few days ago that said we're getting thermometer no touch thermometers for every school face Shields millions of cloth face coverings million of disposables and yet there all every you know the state document and the chronicle say this stuff's all for free and Dr wal you're telling us that maybe we have to pay for this stuff so what's the disconnect there so the disconnect is that until the budget is adopted at the state level and there's a trailer bill that
315states that the state is going to fund those right now it's a mandate that you have to have them and while the state has indeed made the statement in multiple places that they're going to provide them we have yet to see any funding dedicated by the state for that so we have to continue as as you stated prepare for every possibility it's not in the budget as an expenditure it's something that we're just saying if we had to pay for it this is what it would cost okay so if we have to pay for it that's what it would cost okay I would also add um Mr panis and to the board I think what we're trying to do there is also just really symbolically show that there are going to be significant extra costs
316in the covid era um you know one of the recommendations in the book that you're talking about is like make sure windows are opened and we have comprehensive high schools that don't even have Windows right um and what do we do about that and what's the cost of that so I think um it's really to show getting us all ready for August is going to be a costly Endeavor okay um so in our proposed budget how does it impact school level budgets and if we get additional cares funding what's our methodology to Res restore School budgets I mean because we're getting lots of questions about when will site budgets be unfrozen uh when will contracts for positions and organizations be allowed so part of that has to do with how many Cuts do we have
317to make is it a $62 million Target is it a $32 million Target we don't want to go and invest in even more people than we have where we're at 84 85% and then have to turn right around and say oops we shouldn't have hired you back we have to cut you because the state just came back in September and said we don't have dollars so so the answer is we need to get clarity on our true funding and then it's a matter of how do we want to take our Pathway to get to that Balan budget we're gonna hope that it's the legislative version we're budgeting and we're asking you to adopt based on the governor's proposal which is that we will be going into making significant Cuts over the next two years okay
318um when we look at uh the major expenditure assumption slides there's a line there for declining enrollment and so there's a hold harmless um how does that hold harmless work in terms of next year's Ada so we're looking at for the two out years being pretty much flat but in there we have to assume that there may be a change because of economy so while we plan for it being flat and until it's legislated that it's 100% hold harmless you get paid on the higher of the current year or the previous year there we also have to build in the possibility that there will be declining enrollment so that we're prepared again and not caught where we had a budget that had Revenue that was never going to be there and then put the board
319into a scramble to make Cuts you weren't expecting so we always plan for that and then when it doesn't occur and that l legislation comes through will adjust at that first interim based on that legislation of hold harness and what it means okay you mentioned in your presentation the cafeteria fund and a $1.9 million subsidy from the general fund I went back and looked at three years so we've had before this year uh we had a minus we had a $2.1 million subsidy then we had a $18 million subsidy then we had a $1.5 million subsidy when I've asked in the past of this I always hear about like oh it's just part of an acral process well this clearly isn't an acral process and I'm just wondering when's the last time we did an
320analysis of this because the general fund is not supposed to be subsidizing the cafeteria fund unless the board says we want to subsidize the cafeteria fund it's like almost $8 million over the you know including next year that we're subsidizing the cafeteria fund you're you're correct it's something that when I came on board and started to analyze the fact that we have been um exhausting fund balances and had' been running a deficit for quite a while we have started the process of doing exactly we were in the process of doing an exact analysis unfortunately when covid happened we had to ramp up cafeteria services to supply food for our community I I know that but I'm talking about the last three years we've had a deficit of of between $1.5 and $2 million every year
321it's not just this year when we had to ramp up for Co you're correct and and that that is something that we had just begun to look at what we need to negotiate reduction wise and efficiency changes there we need to get back to a normal state to determine what that will be because right now we're not in a situation where we can cut our program today so we built in the budget based on what has been the contribution knowing that that's work we have to do moving forward okay when I look at the last pledge of age of the presentation the cash flow I see enormous enormous differences between the ending cash flow here and the cash flow in the state forms I mean I see $40 million differences and I'm just wondering you
322know you know if I if I go across the months from July to June I see 15 million 22 million 14 million 20 million 31 million 17 million and so on these are differences between our state form that we're going to submit and the forms you're giving us here to talk about the budget and so the reason for that again and we talked about this at the cash presentation there are one-time transfers coming in such as OPB that when you actually put them into the sax forms you can't attribute it so the sax form cash flow is going to look slightly different than what is the reality because you can't put it in until it until it actually occurs so we have to do a separate analysis that accounts for for those pieces and the
323one-time funds that are coming through we've gone and analyzed when we would get each set of dollars where it would play out to make sure that we gave a more accurate form than what the state forms allow and it again it goes down to how the system is programmed and sometimes you can't override a program that you have no control over and saxs is not something we program or have control over Okay so so looking at our multi-year projection based on the governor's proposal you know you're looking at a um what are our you know for the the next year and the year after that are uh ending fund balances are 18 million and minus 33.9 million correct I'm going to the slide so I can say the exact numbers for you give me one
324moment so based on the governor proposal assuming that we do not so first off you have to assume that we make no Cuts so we we don't have a board approved plan right now so correct so you have to assume no Cuts so we will end next year with fund 17 still having 14.7 million a little more than 3% there and an additional 9.7 and unrestricted for a total unrestricted balance of 6.44% % that's our projection based on the governor's proposal based on all of the cut all of the reductions in Revenue moving forward to 2122 we would exhaust that entire 14.7 and that 9.7 and use up an additional 28.5 there meaning that we would go negative -7% if we did not make those 44 million in cuts if we make the 44 million
325in Cuts we would end the year with just over 4.5% in reserve and then still need to make an additional 18 million in cuts for the second year okay um that's fine uh that that's my questions for now and I just I'm just I'm just wondering about the time of the night and the fact that we have um com you know we've got we've got our possible all the money going to the African-American programs we've got a possible you know we've got healthy Richmond with an excellent program we've got utr with an act excellent program I don't know how board members want to try and deal with that at this time of night thank you U trusty Bas um it is 11:42 so we are going to need to um see if we're going to
326extend the meeting um what we're going to do with the items that we still haven't gotten to and I know this has been a very long meeting from the beginning um for multiple reasons we at the board we heard from a lot of members of the public from the presentations as well um but this is extremely important uh crucial um items and and I think that we I need to hear from the board very briefly on how uh the majority like would like to move forward with this trusty Phillips so I respect healthy richond I respect utr but this is why I started out at the very beginning of the uh conversation talking about allies and what it means to be an ally and I'm not saying that healthy Richmond is not an ally I'm
327not saying that utr is not an ally but again don't take the football on the first on the first yard and jump into the end zone and say we fixed it we have a pass budget we passed the resolution that actually said that we were going to look to black parents to actually give us recommendations as to how money is spent on their children on my children because I am a black parent in this district and for folks to come behind and then say well you know what defund the SRO because we need to help black kids but uh we want to decide how all the money spent that's not being an ally and I I hope that we put this money in the past budget I'm not sure if you want my I'm not
328sure if you want my opinion here or recommendation but I do uh fully support uh Mr Phillips on that um that's where I think it should go I think it's going to end up serving uh a lot of the services that people are promoting and some of the other uh plans through that work but um if you're asking me that's where I think it should go as well thank you and trusty letter hasn't had a chance yet thank you Mr Duffy J letter yes I have a question um earlier I mentioned these in-house programs that work that the scows and the CIS mental health uh that we have a lot of African-American employees who work there and they serve many African students my question is this if that money goes into the past budget will
329any of these Services see resources they're still funded those services that were we didn't eliminate scals they're still part of our operational budget not my question are they going to receive additional resources from that money from the sro's so the money were going to pass and we would follow the um resolution that the board put together to make sure that those dollars do meet the needs of African-American students that that's our goal that's what the board promised and our goal is to put dollars starting with that 1.5 and then additional Car Act dollars and the other pieces we put on that chart so that we can indeed ensure that there are increased services for including these Services here mental health and the scows Outreach to parents all of that that's all part of the model
330that we would be talking about as we move forward there and there's still additional resources that we can continue to redirect above and beyond that so I think um trusty Phillips I see your hand up I know we haven't checked in with uh just student trusty Vasquez Imola um but I just want to uh to say again that I think that you know I haven't shared my comments yet but I think that this is where we need to have clear communication around the engagement piece because we're saying that we're going to pledge you know this money and we're having the earlier conversation about what services these or where these 1.5 million we going to go um but I think this is part of the conversation we need to have with uh um African-American families and
331students because I think ultimately that's around the that's what we're trying to Center this these funding um behind so I I think that this is this is a a larger conversation we need to have um specifically centering uh the the voices and the the needs of uh black students and families um soon trusty Vasquez sua and then trusty Phillips yes thank you I didn't want to say too much um I was going to let youall do your thing but one thing that I did want to say is I think if we are if we have six million um for masks or like we have to potentially pay six million for masks for school right for like um five million for the students and maybe about 1 million for teachers if that if we have to
332have a mask each day I was going to say I think with that nobody like the district knows that like we don't like that money is just like it's gonna cost um so I think one thing that we could always do is I think we could ask some people from the district um if they're willing to make some more um soome or whatever for students in the district not only that but we a lot of us already have ones that we can reuse so I think that um I'm just I just want to be cautious with the way that we do use money and like with that five million that we were talking about that we could potentially use towards masks I think we could um we could ask yeah we could people have their
333own um but also we can ask people in the community to make masks for others so I just hope that we don't use money in ways we don't have to that's kind of all I want to say thank you s trusty Vasquez toolo trusty Phillips you you said you said it and I'm not saying that that um trusty Laura you know I'm not saying that Scouts are not important or what not but I want us to stop having to com if the money's going to go to the Past budget I want us to stop talking about how we're going to spend that money because what we agreed to was that we were going to take recommendations yes everything's going to come back to us but we agreed we were going to take recommendations we need
334to stop talking about how to spend that money because that's that's not what we were supposed to be doing I agree thank you trusty pH um trusty I saw you turn on your microphone to yeah I I mean I agree with trusty Phillips I think the reality is is that the the past folks involved with the helping to determine the past dollars are actually quite inclusive um of lots of folks and I again my main priority is to say that there is it's it's it's the it's important it is it is the reason why um that money I think needs to be ear marked for past now the questions about well what about all these other programs I think that means we have to have continued conversation with the rest of the budget and going
335through it with the fine to comb to see what is it funding and if it's not funding the things we think are a priority because remember as I'm gonna remind folks $1.5 million is not is is not nothing compared to what we need to turn things around for our students and this is still a joint effort I don't think this board necessarily loses the opportunity to do right by its students we have a $363 million budget that's being proposed um and that is inclusive of lots of stakeholders and I got I guarantee you I know the hearts of those folks who uh are engaged with uh the past programs I'm telling you I'm not going to be surprised if they fact they decide they want to fund sculls they want to fund mental health they
336wantan to with that 1.5 but that's not what the point is here the point is that we make it clear that we have underinvested in our black community and we've chosen to make overinvestment in the militarization of our campuses and because of that it is correct and the right thing to do to move those dollars over specifically earmarked and still do the work for the rest of the budget and that's what I meant in relation to the positive School climate work I totally agree with the comment that Miss Williams made which is that when we in fact support our most vulnerable set of students all students benefit there is benefit from increasing the positive School climate work and it doesn't mean we stop doing that outside of that $1.5 million budget for all our students
337including black students so I think part of what we might want to do is just maybe is it possible to make a declaration just so we don't leave this meeting now that we are not necessarily adopting this budget now now but we are in fact directing the soup to go back and take the feedback people have and make sure those questions get answered and that we leave here knowing that we're also affirming that this board is is GNA vote to say and by the way take the 1.5 from here and put it here to our um past budget so that's clear uh before and that will be that to me I think is ultimately what will be um uh what we adopt as a total budget as a whole knowing that we can't re there's
338no reason to believe that we would Retreat from that because we're affirming that right now as an integral component of the budget we will in fact pass so president Jes can I make a motion uh yes just the uh well yeah sure go ahead uh I'd like to move that we direct staff to remove funding from SRO from the budget for FY 2021 and instead put those funds into the past budget part of budget adoption motion um that didn't sound like it it sounded like it was now we could make it a budget adoption motion adoption motion but is I'm not sure the board's ready to adopt the budget I think trusty Phillips had made that motion earlier right that's the exact motion I made did you did you actually I didn't realize you actually
339made it okay fine at the very beginning okay so then we need to vote on it so what was there a second I'll second it if there wasn't a second I believe trusty quis seconded it that's what I thought you did thank you sorry I didn't I didn't note that down so trusty Phillips made the motion trusty have a second to it um I just I think we should take a vote ASAP um and I I I just want to be you know fully transparent too um with everybody about the way that we had agenda is this as an agenda setting team um I I really wanted us to have this um as I had shared with uh super and Duffy and with Dr Walt to have this be two separate meetings to have this
340be um the public hearing today and the on the 24th to actually have the adoption um but I was I was you know I was given the reasoning that because uh the county wants us to do it in one meeting that this is what we're going to do and that we could not make any changes between now and the 24th and I'm trying to be fully transparent because I want us to honor this process of getting feedback from the public and from more members and to actually say like we can actually go back in these two weeks and bring something back to to board members that is more reflective of what the actual Community input is and the things that we see need to be fixed um so that's what I want to share I
341I think that we're ready to take this vote and I would be happy to bring this back on the 24th in the agenda and and work with uh clerk board clerk L and superintendent Dey to make this happen so if I I can just interject there any changes that the board directs us won't change the underlying numbers of the budget you're adopting what's the direction you're asking us to do we can do that shift and make that go forward but as we stated before all of those different priorities it's going to be a lot more than just two weeks of conversation to do we're not going to expend any additional dollars there so what we're still recommending as staff is that you are adopting the budget we will be making adjustments there we will continue
342to redirect additional resources from one budget to another within as we put in the slide there but the 1.5 would immediately be moved over to past if we choose to not adopt tonight that is certainly the board's prerogative the Sach forms that will come back will be identical there's there wouldn't be a change if I move it from operations over to pass you're going to see the exact same number on the form so the board really the important thing is the direction that you're stating the how that you want that money put into the past budget so we can begin that conversation and our recommendation is you adopt the budget and then direct staff to begin immediately the conversation about showing every aspect of that budget that could potentially be shifted so we can have
343those conversations thank you Dr Walt so we had um tresse quas one more um comment and then if we ready to I I just think that that's part of the issue though Dr wal is that those numbers what if we want them to change what and in adopting the budget framework that you're suggesting basically means that we're adopting a budget without um at least getting closer to where we want to be knowing that that maybe maybe I get what you're saying but maybe without some initial input the budget numbers might look different on the sax form unless you're saying there's no way that there's going to be able to be any change and if that's the case then why aren't we passing a sax form Le budget that's congruent so the sax form is what
344drops into the 1,000s with your teacher salary 2000s what your classified 4000s are your books and supplies 5,000 of your contracts so if you move a contract from one contract to another it's still rolls into that 5,000 number so you're saying that any changes we would have made on programming are still going to be encompassed within the line items of the sax forms yes okay so I think it's just for this board I guess my question is remember that the the only leverage this board has is the actual adoption uh process and so what you're asking us to do is adopt based on some numbers that you're saying we're going to have time to go back and change but we're already making it clear we want to make some preliminary um decisions without adopting it
345those preliminary decisions are a you're going to remove five 1.5 from sro's and put it in pass yes and two it sounds like people want to have more discussion before they adopt the rest of your numbers so the issue is we have to do a 10day sunshine of any new numbers so the the problem is we run out of time no knowing that we're going to have to reopt a budget in August all we're doing is adopting this one so we've met the legal standard we're not going to be expending those funds until we've had further conversation with the board and I think that's the the critical one I said mechanical that might not be the right word it's really you're meeting the statute requirement there but the expenditures are still authorized by the board
346that's where the leverage plays but the statute is until June 30 30th correct correct so we would still we can have a discussion at the next meeting right it would still be the same sax forms and I'm I'm I'm not saying discussion to change what we would agree at this meeting wouldn't change which is 1.5 is going from sro's to pass budget yes so it's completely up to the board if you want to bring it back that's fine I'm just say it be the same fors we've got you know we've spent the year with our budget um going through a pretty thorough process with stakeholders unions Etc to get to this point of here's uh what we think are our expenditures for next year here's what we believe are our revenues um for next year
347um knowing that we're going to continue to make some adjustments within the total budget um that we have um so you know if there if there items that the board wants to significantly discuss further uh we should figure out what those are um but I think what we are saying is you know this is how we see the macro budget we see our these are our revenues these are our expenditures um we we don't see uh any possibility of adding any more expenditures at this time um but we certainly can continue to swap things in and out try within what have to say um take this out add this back in and that we can do you know after June 30th as well um we're setting a total number uh that we've got to base
348our budget on and again as as Dr wal said we're going to see some numbers change um but I think if there's something significant uh that the board sees in the budget um then we should find a way to talk about about that um but right now this shift that we're making I think is something we're hearing loud and clear um as we adopt this budget thank you um Mr Duffy trusty Phillips thank you so earlier in the conversation when we were on the resolution I brought up a point and folks disagreed with me and that's fine but I think things should be done decently and in order and my suggestion was to agendize the SRO issue uh not because I would have necessarily voted differently but because people in the community need to have
349an opportunity to talk about stuff and we couldn't do that and we moved forward and everybody and and and and I just feel I'm I feel used I'm just going to be Str and I'm not saying I'm not saying no I do I I feel and there are people who are watching this and I'mma tell you I have a feeling some of them feel that way too because we just had this whole conversation about SRO and defunding and how we needed to support black children and then I've never voted on a budget in my life every single year the budget comes to this board I say no because I don't like the priorities that are in the budget and this is the first time I've ever moved to vote for a budget and then it's
350like okay well we're gonna move this money yeah we're gonna move this money and then I hear some well maybe we need to think about what health enrichment is saying maybe and then and then all of a sudden and everybody and people want to vote on the budget and then all of a sudden it's like the past money it's yeah it's going to go in there and it's like you know what you know we need the postpone this we need to wait and come back in a week because we need to have more conversation and I'm just saying I know nobody on this board would do this but to me this feels like using people we need to vote on the budget and the motion has been made the allocation the motion is made with
351the allocation to go to pass we all know what budgets are this is not anything new and we all knew this budget was coming I would like us to vote on this budget triste Phillips um I I when I second your motion I thought you were motioning that that was the line item change we were making were you in fact motioning to approve adopt the budget as it's presented with that one change or that one caveat that is the motion that I made I I resend my second because I think it's possible to do exactly what you said so people don't fill use and make an affirmation that we are affirming moving 1.5 from SRO to ASAP which I believe is what you mentioned you wanted now what you want to do though is you
352wan to you want to adopt the entire budget and I just think that there's disagreement on the fact that maybe I want to put more than more than what's been dedicated in the conversation for some of those other servic what does that have to do with the 1.5 that we are in fact promising and saying we're going to make in stone that we're moving to to the the past program I've made my point and this board is going to do whatever this board is going to do and uh and the world is here to see so the world I and I agree with that I think that that's fine I think people should F the way they want but also think when people get what they want and they're still disagreeing then there's something else
353miscommunication happening and I think that's what we need to remember is that there are still five folks on this board and I don't hear anybody not affirming what you want it's just a matter of semantics now that you want us to pass the whole budget and I'm G to be frank with you I don't trust the whole budget the way it is I don't trust that it's set up to support black students Brown students any students the way we think are important and I want some more time to be able to look at that is that unfair thank you trusty Phillips and thank you trusty quas I I would like to just clarify that I I initially thought that the motion that trusty Phillips made was to just move those $1.5 million dollar that it
354wasn't to a motion to actually adopt the budget um I thought it was that Standalone motion um but now I understand that it was also to adopt the budget and what I'm hearing I just I would like to hear a little bit more from trusty uh L and trusty panas just so I can gauge what we're wanting to do right now if we want this to come back to us um at our next board meeting can I just clarify something really quickly yes just you can't adopt pieces of budgets so if anybody out there in TV Land is is thinking like okay well they're saying move this on line item over here and Mr why don't you just accept that and you can't adopt a piece of budget you have a budget and you adopt
355it now you can make multiple changes in that budget but you can't go line by line and say I want this one and not this one so if anybody out there in TV Land is wondering what's happening right now and why you have why you can't can't say you it's a it's a it's a package now before we adopt it the pieces of the package could get moved around but there's no such thing as adopting one line of the budget and then coming back next week and I'm not saying anybody on the board is thinking this or doesn't understand that but if there's somebody who's watching this you need to understand you adopt the whole budget at one time thank you trusty Phillips trusty letter trusty pus yeah oh I have a question uh Dr
356wal so the recommendation is for us to approve this budget is that correct that is the recommendation and then we would immediately do exactly what the trustees have said bring back over the next sub subsequent meetings anywhere that we can adjust expenditures and say hey what's here can we move this over what's here can we move this over and continue those conversations with all of our groups groups they we're just trying to get the the budget part done and then get into the real priority conversations well that makes sense to me and I would vote to to do that to approve it yeah okay thank you so for my perspective like for the last two or three meetings I've said we should do this over to we should do it over our first and second
357meeting in June and I still feel that way and we've had a number of people come from healthy Richmond some people come from utr saying please at your next meeting do this they didn't say do it tonight they said do it at your next meeting there's a lot of people who are still thinking that this is we were going to do this as we have always done it which is to even though perhaps it was driven by the lcap but I think it's um really helps the public if we do this over two meetings rather than one it gives it more exposure so I'm very much in favor of bringing this back uh at our next meeting so that we can get more feedback from the public and if they have other things that they
358think they want to change you know I think the board has pretty much decided on what what we're going to do about this 1.5 million from the SRO but maybe there's other thoughts that people have I would love to hear those thank you try BOS so what I'm hearing is that there is two trustees who um will likely like to adopt or make a motion to adopt the the budget right now and also that there's two trustees that would um potentially like more time um if I'm not getting this correctly um please somebody speak up so that I can give Mr Duffy the the right direction well I like to add to please this is my ask as superintendent to not pin us up against a wall at the 11th Hour on the 24th with
359anything that we're not prepared for or ready for or ask for additional expenditures in the budget Etc if we don't know what we're cutting um so that we can meet our statutory obligation to have the budget passed by June 30th thank you superintendent M Madam chair if I can I think it's clear that that's why I misunderstood because I didn't understand that Mr Phillips was saying adopt the budget in his motion I do recognize and I agree with him this is not you cannot adopt parts of a budget which is why I say we can adopt affirmation language on what we want to do with dollars that's not adopting a budget that's about a little piece of an action related to directing dollars that's not AO uh uh approving a whole budget and I do
360think that that's why there is the a possibility to do both to in fact affirm those dollars and still give Community more time to look at our budget before we come back and approve it and I hear what you're saying Sup which is well then we need to square away any final changes way before we get to dis that's two weeks away and I still think it's better to have that input because that goes back to people again I mean people want input and then they don't I don't think we don't want input I think we have the DLC cap recommendations we worked hard to get folks input and recommendations I just want to make sure we keep ourselves in a a smart position and know that within the allotted amount of expenditures um we
361can always make moves we can always say you know what we real ized that's something we we're not going to do and we realized we are going to do this I mean that's part of our process I just want to make sure I hear what you're saying I also know Dr wo basically said I don't care what you do in the next two weeks I'm bringing the same numbers back to you that fundamentally is what the problem is yeah that unfortunately the law requires us to post a new Budget on Monday we only have tomorrow to make any changes there's not going to be any ability for us and that's why I said it's a mechanic Tech budget this is not to take away everything the board is asking to do we are 100% committed
362to doing exactly what the board has said and direct dollars exactly where the board wants those dollars and the community is giving us the communication to do we just need to meet the statutory requirements and so I will have to post the same sax forms on mondy the board can absolutely not adopt tonight when we go back to the 24th I just want to be very transparent to the board what you will get from staff because it's not that we're not trying to do what board wants we can bring a PowerPoint that has other aspects and other detail but it won't change the state forms that you're adopting that's all that's all that we're trying to state so it's a matter of when the board wants to take that action and what direction they want
363to give us for the 24th because we can absolutely update a PowerPoint we just can't update saxs trusty F and trusty G well I think trusty L had her hand up first actually okay I have a thank you am I okay um truste Phillips could you repeat uh your motion or you made a motion right could you repeat it for me please my motion is that we adopt the budget with the change of moving the 1.5 million from the SRO into the past budget that's the motion and did you get a second it was taken away I don't have a second now oh okay well I'll give you a second on that I second that thank you so Dr wal you're telling me the entire past budget is in line 5800 I mean you say
364not going to change the sax forms I'm looking at the sax forms there's a whole bunch of account numbers on them Pro the police are in 5890 and that's rolled up into a 5800 line you're telling me the entire past budget is in line 5800 because you're telling me The Sax forms aren't going to change no that what will happen is because we haven't directed that expenditure I would move right now I would take the entire 1.5 million and in 5900 I would put it in the past budget in line 5890 so it' be the same thing on Sachs but it would be in the past budget but with no contract attached it so the the entire sax budget lives in line in the 5800 series of account numbers you're telling that's not what I
365said what I said is because then the sax forms are going to change if you make that move no because again right now the police budget is in Zach object code 5890 right in the operations Department it will now move to Sachs line 589 in the past Department budget so all it's doing is moving from one spot to the other spot we're not changing it's not all of a sudden we're putting some of it in the 1000s some of it in the 3000s because we don't have positions assigned to it so I would leave it in a 5000 which is an undefined object until we had that definition from the P committee and group on how it would be fully allocated and then we would do a budget expenditure transfer which is normal that we
366do from each interim so again there there there's the mechanical how you do a budget and then there's the adoption and the direction of the budget they're very different okay and we're also hearing I mean this is supposed to be the board's budget not the staff's budget and we're hearing that it's extremely difficult for the staff if we if we don't pass it this time yet every year I've been on the board we always pass the budget at the last meeting in the month and the staff managed to deal with it correct it was the same sax forms twice you brought for the budget for the public hearing and then the same I don't Rec that they were always the same I recall there were changes like I think the first Year's on the board
367there was changes again the board can direct us however they want to I just know that if it's a new budget we have to Sunset it for 10 days so there have never been changes since I've been on the board that's one of the reasons I vote no every single time we just we know we haven't been making changes I'm just telling you that that's how every District I've ever been in we don't change the sax forms between public hearing and adoption okay thank you thank you Dr W trusty buis did you finish your your question okay can I just ask a question though of clarity the reason why we don't change them is because it's always been presented on one day on June 30th correct no we usually done a yeah we've usually done
368a public hearing the first meeting of June and the second meeting is adoption but that has also been uh a public hearing around the supplemental concentration dollars as part of the lcap um that is not due right now so that's also why you're not seeing maybe that kind of program level detail um in terms of what's in this line what's in that line what's in this line what's in that line I mean we're pretty much there because there's a lot of things we'll continue to do and a lot of priorities that have been raised throughout the year um but that's the one area we can continue to move around some discretionary money um at any time and we obviously want to hustle do that um next so you know I think at the end of
369the day we know that there's an issue not an issue there's a directive of the $1.5 million um but I do think you know if we're going to do this in two weeks then we would ask clearly um what are the other major concerns knowing at this point the kind of macro structure of the budget we don't plan to okay change our expenditures and our Revenue projections unless something from the governor you know changes tomorrow thank you Jesse I just want to call the question I'm fine um then um I'm fine with it but the challenge I have again though is is there an option to add to that adoption language that it means the board will come back um over for not just two weeks but at any time it wants and continue to
370refine which is I know you're saying we're going to do that but can we just add that to the language language support that yes we absolutely want in addition to the affirmation of moving the 1.5 from SRO to to the Past budget yes we believe we're gonna have to meet every board meeting as we get more information to continue to shift things around that was always our plan that we've been putting in writing for the last last two months thank you Dr Wolf so um trusty quas are you um I'm just trying to to understand are you suggesting a friendly Amendment to the the motion yeah okay so M so trusty Phillips okay so I um we've reached the hour of 12:19 we're way past the time that we said we were going to extend
371the meeting to so we need to um the question has been called so now we have to actually take the vote um trusty Phillips do you mind just restating your motion and then trusty quas you're a friendly Amendment to make sure that the second from Jesse Lett still stands your microphone is off Jesse Phillips sorry the motion is that we adopt the budget uh and but that we also move the monies for the SRO $1.5 million to the p budget that is the motion that's the motion that was seconded uh truste qu's uh friendly Amendment uh if we can I don't mind adding a friendly Amendment as long as we say that we are the monies that are being transferred to the Past budget those that is not open to discussion when we come back
372it never was and I think it's a trust issue we're telling you it's not but I think you're while we don't trust the rest of the budget you don't trust that those dollars that we're making commitments to aren't going to show up and I'm guaranteeing you that that's not negotiable it will move in what we're affirming 1.5 from SRO to pass right so I'm all I'm saying is that I I accept the friendly Amendment with the the caveat that the past part of it is not open to being Revisited absolutely okay so now I I think that we've had now um a clear shift I think and a trusty L are you is your second still Standing okay thank you um and your microphone was off but I could see that you said yes yes
373thank you so okay so now I think that the majority of the board is giving the direction now um we're gonna take a vote um can we please begin with our student trustee vusa I'd like to abstain thank you us yes Phillips yes yes L yes yes motion passes um unanimously by trustees uh student trustee Vasquez abstaining from the vote thank you everyone uh for this conversation and I just want to emphasize too that um we are going to be can everybody see me am I still my video can you hear me yeah okay sorry I know what happened um yeah I just I I want to you know move forward with I didn't share my comments on this before the vote but I just want to make sure that we are all um very
374accountable to to what we just did right now and that we make sure that we follow up with engaging the community and actually taking the time to hear okay once we actually start making the changes to the line line items and to actually um allocate and and reinvest funding not just you know the the 1.5 million that we're talking about um specifically going to our African-American student achievement resolution but for other things that that we need to to have a bigger Community discussion and we just need to make sure that we keep the community as engaged as possible especially in the time of social distancing um and I I want to acknowledge it is 12:23 we still have people who are with us right now members of the public um we had one contract that
375was pulled from C3 and C4 and item C7 was pulled and I want to check with with a board and with superintendent Duffy because we've reached an hour where I think um we need to just consider what is most essential that we get done right now yeah um we do need to do the LC cap one because that's part of the budget requirement so F3 is required and we would strongly look at C7 we don't want to bring the C3 C4 was pulled back and only thank you and only part of the C3 and C4 were pulled correct reach my notes very quickly it was just one contract and staff does not need that approved we're not bringing that back got it thank you okay so now um so F3 C7 so board it is
37612:24 I I I suggest suggest that we extend the meeting by 15 minutes maximum um and that's it and we are going to have to move all the other items to um our following meeting I'm Al am I unmute sorry um yes sorry I'm just quickly checking with our staff if there's anything that is mandated that needs to go so um I know we want to do 15 minutes um so I'm just asking my staff who's listening to just please text me if there's something besides F4 and C7 that has to go um so okay so are we going to do the consent calendar we say F3 yes we have to do consent calendar F3 sorry F3 okay so F3 C7 the consent calendar and do we need to do uh what is it F7
377as well is that is that a do we have a deadline for that to ensure we get the Chromebooks on time or is that oh yeah wait okay so see so F7 unless the board wants to just ratify it later if you are willing to ratify then you don't have to do it tonight okay so I need um I need us to to extend the meeting first to make a motion to extend the meeting by 15 minutes and then to um adjust the agenda to do the consent calendar F3 no I'm sorry the consent calendar F C7 F3 and F7 did you say C3 C3 is on the consent no um F3 C7 F7 and the consent calendar I'll move weend the meeting by 15 minutes and do the consent calendar C plus C7 F3
378and F7 thank you there a second I'll second that motion can we please take a vote Yes us yes yes Anis yes l no and on this drive is yes motion passes to extend the meeting by uh 15 minutes to U move to the consent calendar then C7 F3 and F7 uh with a four uh members of the board voting yes trusty L voting no um one no and no absences subtensions and student truste Vasquez Sima voting yes so we are on to our consent calendar is there a motion to to approve the consent calendar I'm I'm move the consent calendar absent the C7 item that was pulled second can we please take a vote no yes quas yes yes P yes yes dri is yes um passes unanimously motion to to accept it passes
379unanimously and we're on to C and I'm sorry not c um yes C7 C7 so I pulled C7 it's routine Personnel changes um I pulled it um not because I have an issue with any of the employees who are on there but I have an issue with an employee who is not on there uh this item has Denise Van Hook being replaced at Peno Middle School I believe that part of the reason that Miss Van Hook is no longer going to be in that position and this item passes frankly has to do with racism and sexism in the way she was treated and I do not support her being replaced at Peno middle school that is why I pulled this item thank you truste Phillips superintend Duffy did you want to um share anything with
380the board before we continue with this item um I don't feel comfortable uh commenting on that matter um but to say that uh the decision had nothing to do with uh race or sex um in my mind just for the record I'm not for the record I'm not saying that Mr Duffy's decision was based on race or sex I'm saying that the complaints in my opinion the complaints about Miss Van Hook were based on race or generated from race and sex and so that this whole thing came from that not that you made a racist or sexist decision okay thank you uh trusty phis for clarifying that okay so um it was a pulled item so since we don't have any more discussion on this uh superintendent Duffy shared his thoughts right now trusty Phillips
381shared his concerns with it too um I think that potentially we can have more um discussion if we need to look into this in close sessions it's it it does pertain to Personnel matters uh and I would like to know if right now any board members would like to um to to make a motion to approve this item or if we want to table it I move that we approve the item with the exception of the p no middle school placement I second that okay so motion was made to approve C7 with the exception of the Peno middle school placement and it was seconded uh made by trusty Phillips seconded by trusty L um trusty quas did you have a comment before we vote trust just just again I I think it's I think the
382issues that Mr Phillips raising those concerns are definitely uh something we need we should discuss in close session but it's also a vote not necessarily on that issue it's a vote on what who who's being suggested and we are liable for that decision as well um so I would I I would suggest that we hold the whole thing so that there isn't some singling out of individual appointments on this action than you jie GL jie buus uh given the board memb comments I just like to move that we table this I mean is that is that what we're saying no one asked to second that so we had yeah I I second that that motion wait we're tabling the entire all of the appointments of principal ships for schools well here's my here's my concern
383is that you're are now in fact rejecting one per one position on here that actually already has a named person to it and that person I believe can sue us no that person can't yes they can uh I would suggest again that we look at the group as a whole because we're talking about making decisions about principles as a whole and that's why you bring them as a whole uh but I you can disagree if the board wants if trustee Phillips if the board agrees with you then they should vote that way I'm just saying why I know how I will vote that's it can I say something this is going to take two minutes and this is a sensitivity thing and not that anybody has to listen to what I'm saying but we're talking
384about respecting people and we're talking about respecting black people for example in this s in this situation I am the only lawyer on this board and I will make a suggestion or I will say something and everybody up here will pretend like they have law degrees and ignore what I'm saying now there's one accountant on this board his name is Tom panis now when he starts talking about stuff that he does for a living I don't ever see anybody doing that to him thank you trusty Phillips um I I would really I think that this is a bigger conversation we need to have and I'm wondering if we can actually um bring this back on Monday for a meeting uh since I know that that we do want to to get this approved we want
385to get the rest of them approved but I also want to validate that I do hear that there's more conversation that we need to have as a board yeah Madam chair if I can just add that I think Mr panis is um thoughts and and ideas outside of his profession have been challenged quite a few times uh but the issue is I hear what you're saying Mr Phillips is you feel discounted and that is not necessarily the case this is a disagreement on how to proceed with procedure uh but again I encourage folks to vote the way they want to vote remind the board that we have taken up part of this question in closed session I can't speak to it any more than that but just a reminder that we have thank you Mr
386uh Mr Duffy so yeah I think what I'm still hearing is that we still don't have um we haven't had a closure in a way I think I I'm guessing that we need to have that conversation to to be able to to take a vote on these positions I I don't want to to lag this kind of vote because I know that people are waiting for the the placements but I also want to make sure that we validate that there's some you know something that we need to to just put the lid on um so I I would really I I seconded the motion to table this and I hope that um I can talk with superintendent Duffy and B cler GL to see if we can schedule it for Monday so that we can
387take care of this as soon as possible and not um drag any placements but also acknowledge that there's some conversation we need to have so um trusty fundas made the motion I seconded we had the other um motion that trusty Phillips made that was seconded by trusty l so if we can um take a vote on the the motion to table it can we please uh take the vote right now i' like to have stain thank you yes Phillips no I don't see a reason to hold everybody else up yes I don't know then this dve is yes so we uh we tabled item C7 and I will work with subon Duffy and B cler L to schedule this as soon as possible to have it come back to us thank you okay so now
388we have F3 and then F7 um yes I think I am not muted anymore so hopefully everybody can hear me uh good morning board uh president hernandz Jarvis uh superintendent Duffy um F3 just has to deal with uh a uh covid-19 related uh operations written report report which is uh required to be submitted along with the U adopted uh annual budget um that we discussed at length um earlier um and the report um needed to have uh different areas we had a 300 board um uh limit on each of the areas and the areas uh include um ways in which we had to deviate from uh program um offerings during school closures also how we um um were able to meet the needs of uh English Learners through distance learning and also Foster Youth and
389low-income students um uh in addition to being able to look at how we were looking at um um offering the distance learning opportunities for students uh how we were able to serve meals uh while at the same time being able to maintain social distancing practices and and also if uh there was a need how um was the district able to uh arrange for supervision of students during primary school um hours um and um this is uh what was required to be submitted uh in lie of what will normally be the uh lcap document and of course as you know we have got an extension to submit this final document until December so for now this is what what the state was um asking that the districts to be able to uh work on and submit
390along with the budget um so we have um so it will show how we had deviated from the uh normal expenditures that we would do and of course the um approval of the um lcap as well um through this um written report thank you and I can entertain any questions you may have you also have the um attachment of the actual report there uh I do want to be able to note that we will um continue to work with the the lcap uh uh group uh as we work together to be able to finalize what what is going to become the final elap um document that is going to be submitted mid uh December 2020 thank you Dr G yes you're welcome do we have any um I'm do we have any public comment for
391this item I'm guessing not I don't see any hands up right now I apologize uh trusty Hernandez uh president Hernandez Jarvis there is no public comment at this time okay great thank you okay so um Bard does anybody have any questions for this item
