Order at 429. Uh I have a roll call >> here. >> Rosner >> here. Patricia Moonen >> here. >> Also in attendance, Dr. Ken Serinich and Kristen Santilli. >> And let's rise for the pledge of allegiance. And Mondays. >> Looking for approval for the meeting minutes from the February 10th meeting. >> I move for approval of the minutes of February 10th. >> I'll second. >> Motion by second by Patty. All any in all in favor? >> I. Any opposition? Motion carries. Any public comment? One call, first call, second call, and third call. >> I'm gonna do that next time. I like that. >> First, second, and third. Done. >> Nobody there. >> There's nobody here. Uh agenda items. Uh there's um transportation committee or transportation policy and then start with >> Dr. percentage. You want

to plead? >> Yes, I can speak to the transportation. So, um I asked the board to review the transportation policy only because it has not been touched um in quite some time and it it predates our relationship with Shelton student transportation services unique bus company. Um, a lot of the transportation policy they most of it the part of it that concerns me the most the very end six section five you all have copies. Um, if you just peruse the complaint procedures, it talks about complaints will be filed with the transportation manager. That position was cut from the board of ed budget >> years ago. >> I can't even count that. >> I was still working. >> Jim Burns, that was Jim Burns. >> And then it says, um, after the transportation manager, you have to

go to the assistant superintendent, which we don't either. Um, so I think if I mean the board has the right to update the policy as they see it in any way. If anything, I'm requesting that the board um update the complaint procedure. Um, my recommendation is that since our bus company, they are not bus. I think all complaints concerns should go to them first and then the appeal process like the second paragraph if the complaint is not resolved by then it can come to my office and then the last paragraph actually follows the statute used to Like I said, if anything, that's my biggest piece that I think needs to be updated. But as all policies when we're for one section, I think it's practice whole. I don't know if there's any other glaring things

that board members have questions about or feel like, oh, what about this? Should we look at this? Should this be changed? I can make reference to you about whether that's covered under statute or such. >> But we should have a transportation policy even though it stretches. >> Well, everyone has an outsourced transportation. We our transportation though is part of this >> right >> versus being DO company. When when when we hired an external company, we had a position manager who facilitated relationship and the outside company when we went to student transport services back in >> I think is when it started >> Jim Burn's position was eliminated was going to take responsibility for the bus company take responsibility bus company our policy reflect that telling people to go complaint person. That's all I have to

say. >> I'd happy to answer any questions for anyone that has any issue. >> Isn't the the bulk of the policy from state statute? >> It is right. in terms of >> the distance between a child walking to school dictated by statute, the definitions uh in in a in a in a um the policy in terms of who's responsible for what dictated by statute. Um if not necessarily statute, the language about 504s and IDA and special trans that's done under IDA. Can't really change those. >> Yeah. Right. Mhm. >> And currently, where is it on our website? When there is a a a school bus problem, doesn't it already say to to contact city, right? >> Yes. >> So really, we have to make this policy practice, >> right? >> Yep. >> Okay. >> So,

that's not really that hard. >> No, but but obviously, as I said, necessary. some language. That's all you want to >> craft suggested language. >> Sure. I mean I I I think >> I mean you essentially said it. >> Yeah. I think basically the way this reads we would replace the word transportation manager with you know Shelton student transportation services and we replace assistant superintendent with superintendent because it would still remain superintendent or designate. So a corrected edit of that is what we would present to the board at next. >> Yeah. >> Correct. So I mean we could do that >> if that's the only changes break into the policy and everyone's looked at the policy and no one has any other questions. >> Yeah. >> Um we can make those changes and have it

in next month's board packet as a policy. >> Correct. >> And then come May it could be voted in as an adopted. That's it's it's a really easy. >> Yeah, it's not difficult. Just >> right. >> Yeah. >> Cool. >> Great. >> Yes. >> Yeah. >> It' be rough. I think that's one of the few things that was changed originally when it was back in the >> day the the dark age is Perry Hill was in existence and that was taken into consideration but beyond that the policy itself is basically state pronouncement >> plate >> good word yes it >> uh does anyone want to make a motion for >> I make a motion that We amend section five complaint procedure the appropriate language replacing patient manager and I second that >> motion by K

second by Lorraine. Anyone else in favor? >> I. >> Any opposition? Motion carries. the board of board to review at the next board meeting and the big topic uh discussion of the 9000 series. So I just make a statement for the discussion >> since the 9000 series board of governance. >> Mhm. >> Right. Um I don't think it would be appropriate as to offer any advice relative to normally I know it goes superintendent what's your recommendation I I think it would be inappropriate for me to make recommendations I worked for you guys inappropriate for me how your governance should be I think today is inapprop appropriate start of discussions. My recommendation that at the next policy that you invite our legal counsel panic knows the statute very well. actually then instead of the superintendent giving

advice, ask council. >> Yeah, that >> Yes. Yes. >> A policy. Yeah. Yeah. >> There wasn't one scheduled in June. Yeah. Kayley brought that up, but said that we should probably put one on the books for June and then we invite attorney standing to be here. I think that not only would I I had an offline conversation with happy to be a part of that but I think I think it's more appropriate that he gives the advice and >> ask whatever ask discussion >> that's fine there might be some we can take as as a lumpy >> however you want to do it because also the tricky thing here is a lot of uh bylaws are also statute and how a board could govern itself that's where I think >> right >> okay then the

suggestion might be that we just go through these one by one. Correct. >> I'm not asking. >> I'll say correct. >> No, that's might want to decide which ones you want to >> and depending on what we get through today versus the number of meetings we have. I know we've all in the past we've piggybacked off of teaching and learning and if we know we have x amount of stuff to do um for a policy meeting and you have maybe a shorter teaching and learning than normal. We can always >> well we have a date second if you want to do >> so nothing in May. Oh, okay. Cool. My bad. >> But I'm saying if you want to do policy after all the >> it would just stay. >> What would that be? Um

>> choose >> 5:30. >> Yeah. >> I just make >> Oh. Oh yeah. >> Let me just put this. >> You want 5:45 instead? >> Second. I have teaching and learn. >> Oh, would that be 5:30 is better for you. Okay. >> Just didn't want to rush you. >> I have teaching and learning starting at 4. Is that >> 4:30. Okay. Well, they go If if we do four to five, then we have five. >> We could do four to five and then >> and then five could be low. >> Yeah. >> Are you sure? >> Yeah. >> Okay. So, teaching and learning will be four to five and then um policy will be have fun. >> Yes. Barrel. It's barrel. Carol >> a Yes. Just asking Carol. I don't think Carol's >> No. >>

And if she does talk to her, >> she does she >> That's right. >> And she'll be fine. No, an espresso. >> Oh, >> please. I'm the dirty one. >> Oh, that's the espresso. So, hey, I saw your document that you sent over. What is I like the rationale on some of these? I like the cleaning up of the language. Um, what else did you have in mind with these? >> Those were the only ones I found that I thought correction. >> Okay. Mhm. >> So I went through them one by one and highlighted. I saw something >> like that being done. >> Um Lorine, did you have anything? Um, no. Because when we start going through these, we're going to find some of them are very short and sweet and we don't have to

really worry about it and it's state statute oriented and >> there's really not a lot that we need to change. Um, the only one that we might have some discussion on is our famous 922. Yeah. >> Um because really right now we don't align enough in my opinion with state statute. >> Well, that's that's what Fred said too last time we went through it. >> We had no process. >> Yeah. So >> So was that just a state was that state statue and us not aligning with it or is it just >> We had a very skimpy policy. >> We did. Yeah. >> It was it was >> I I read it and I was didn't give anything specific on how to >> and and sadly we did have a situation where we probably needed

some kind of steps to implement and we had nothing >> and then it got very dice I'm being bluntly honest it got very dicey among the board members and there was no need for it period because if we had something to follow it would have been done and over with and the lingering resentment >> yeah would ever have really started. >> Mhm. >> My opinion that >> people were resistant to the policy bought the policy. >> Exactly. >> Which you didn't understand that because it's a bylaw have to take the action. So, you know, like it >> if twothirds of the board want this to happen, regardless of whether you think it's going to go be applicable to you or not, that's the the right of >> it got very political very fast. I mean,

in nanoseconds >> and every time we voted on it, it was >> No, it didn't show up. >> They tabled. Yeah. forum to on it. >> So it has not be a full board when we vote on the >> Yeah, because if you didn't have enough >> Joey grenade, >> that's what it is. >> That's what it >> Yeah. when you do a by law. >> Yep. >> I did. We did just pass 9230 as revision that we >> I saw that and I I didn't even I I was just going by the fact that I had >> Yeah. Right. >> This is my old >> cuz I hung on to this. >> The one that I >> This is from like last year. Obviously, >> there was there was one that I did that

I looked at and it was the same exact policy. Just one of them said policy and one of them said Bible. Mhm. >> And I >> Yeah, >> that was my biggest question. I think then if >> our plan is to have the the attorney show up for the next one, then it will make sense for me to ask him directly at that meeting. So what I would recommend probably be helpful looking at >> right >> make like I I would think what would be productive for today is basically >> if you don't have to do all of it in one meeting for that meeting we're going to just do excellent Well, if we go just go through, is there any issue with just eliminating that one sentence about the um Oh, sorry. I'm wondering

if we if we I I don't think it's going to take forever, >> but I'm wondering if we just go in order of the bylaws because some of them are just a check off >> and if we have this list and something there's a question on something, we write the fact that there's a query next to that particular bylaw so that at least Fred knows where we've created hits for the the bylaws >> because I don't think we're going to have a problem with like 9,000 which is the role of the board members. >> Oh that's that one >> right >> because it it even Yeah. >> Right. And I think if we just keep ourselves organized and go through this, I'm not saying quickly, but if we just go through it in an organized

fashion, I think >> the first half I made I went through really. >> So is it the opinion of the committee that you just want to start with 9,000? >> Yes. >> In my Yes. >> for today. >> So first one is 9,000. I think all of us can agree this is state statue, >> right? >> We can >> and it's pretty generic and there's really not a lot. >> The next one is file is policy 9012 which is the legal responsibilities of the board of education. Uh I have something on here. We we're recently in that cave training and it the state statute says itemized estimate of costs approve them. I don't know if we wanted and >> what letter are you looking at? >> Letter C to consider and adopt an annual budget

prepared by the superintendent. If the state statute says itemized an itemized estimate cost, does that reflect what we do? I if you want to get finite, it is an estimate because this example uh teacher salaries. >> Yeah, >> we know what the increase is going to be. It's kind of an estimate of what the increase is going to be. Do we have the same exact faculty this year as we do next year? Nope. So, it's kind of an it's a it's a very educated guess >> about what cost is going to be. So I can understand where that's an appropriate statement, >> right? Which one? >> Uh >> the itemized estimate of costs or annual budget talking about C. >> Yeah. Are you talking about putting in the words itemized? >> Yeah. Instead of budget

because that would identically match >> estimate of expenditures. How about an annual estimated budget? No. >> Yeah, that would probably >> Yeah. I don't have a different color pen. Alien. Yeah. >> The art teacher doesn't have color pens. I haven't. That was the only thing I saw in in 912. Come on. What? There it goes. That red pen. >> Okay. Pinky red pen. So then we're okay with the rest of 9012. >> Mhm. >> Yeah. I'm >> so 9020 I specifically for who speaks for word cuz that was an issue. Yes. Last >> Oh yeah. board chair or superintendent. >> Yeah. >> Because we did have issues with people speaking on behalf of board >> that they're no longer here but people are making statement >> right >> value no value. >> All right. >>

So the next one is 9030 commitment to democratic principles in relation to community staff and students. This looks like it's fate statue. Yep. >> Guess and then there's not much we can change. >> Some of this also aligns with city charter. The charter needs >> Yes. So, um just >> are you >> saying because I know fact Joey's question one of >> that's why I said >> but that's that's why we need half right here >> here we could we could >> yeah we could just >> No, I I would just tag which ones you want. Yeah, >> we tag. >> Yep. >> You're right. >> Let's have have Ken review, you know, >> not review something would happen. >> Yeah. And I didn't prepare myself to know which one is which. I mean, I

could have, but >> No, but that >> I'm going to take an educated guess to say yes, it probably is, but I don't know off the top of my >> Yeah. Just have him review it. And if he says, "Yeah, that's state statute number." Good. And I know I looked at visits to I know visits to schools. I looked at >> I mean it was reviewed the summer of 2016 so it could have changed. >> You're my favorite. >> Look it I got colors. I should do orange. Go Shelton. Accept this. >> Oh, that is cool. If you bring your lap, that's great. >> Or if you bring a cord for your cell phone, you can turn cell. >> Oh, like it. So >> 9110 looks to be >> city charter. >> Um office of

the chair. This looks like it's state statue and city charter. And >> which one still on 9110? >> Uh he went to 9120. >> I went to 9121. >> Okay. >> Permission from the chair. Yeah. >> Um I I could step out and call >> right now to confirm that. >> That would be great. >> We're saying June 2nd at 5. Is that correct? >> Correct. >> Uh 9122 vice chair just looks like same thing charter and state statue. Same thing with 9123. >> And Kaylee, you're going to um obviously on the bottom do the change. >> Perfect. >> Okay. My question on these three with office. Our current chair is using the three offices executive. Should that be itemized in bylaw? That has never I know he has met with just matters. >> Yes.

Oh, I'm sorry. >> I didn't know if it needed to be itemized in the bylaws that those three consist make up an executive. >> I think that's a question for Fred. >> Yeah. And so where does that go? Well, >> yeah, I would. >> Yeah, >> I would probably >> set up the terms and >> maybe maybe a separate item under each officer if it >> could be a bullet point. >> It could be a bullet point on terms of office >> part of a consultation with >> Yeah. Because it took me back when I realized he was discussions were going on. I was like, well, what's going on? Yeah. 9124. Again, this looks pretty similar to eight state statute, city charter. >> Is board clerk what you're called, Kaylee? Actually, >> very special person.

>> Oh, yes. in prim. I've heard various things over the years. Ernie, uh, the attorney by law. I had a question. >> You could look at that. Why don't we just tag him to look at that and decide if it's correct? >> I was going to ask him a qu. I was going to ask anyway in a just a general question. I don't know if it's from are we in concert with the city in this or are we out of concert? What do you mean? No, the city the city makes us take attorneys. >> Okay. >> Yes. >> Okay. That was by that was 2019. >> Oh, when we had used >> at one point the board did have a separate attorney. >> Okay. >> To represent themselves that were was not attached >> which

worked very well when it did >> at the beginning of latest structure. It was contentious. >> But there are still there are still the possibility of situ where it would be >> case in point the resident. >> Oh yeah. >> Well, it's true. >> Yeah. He did. Yes, >> that happens a lot in negotiations. There are things that come up that Fran doesn't understand. >> Step system, you know how long it took us to explain to him step. >> But Joey, to your point, maybe there should be a statement in here. If there are situations that warrant an outside legal opinion, the board should be free to get that counsel. >> Particularly specializing in education, huh? >> Yeah, >> that are you putting that on? >> Yeah, I marked it down here. Good. Well, >>

they get on there. Okay. a more contentious one I think or the next few not really contentious but more unanimous 9130 committees um besides that one sentence I don't see anything else on 9130 >> correct so just ditch that whole >> take your >> yeah take yeah we'll take that one sentence out >> red line >> where which one >> right here. >> Okay. Third pair. This one eat. >> Yep. >> Oh, yeah. Never do that. >> And again, I just want to state these are all for recommendations up to correct the full board. >> Mhm. >> Uh 9 9131 again state statute. >> Mhm. >> Uh 9132 this is standing committees. I know we were I was instructed by the chair to look at athletics. >> Athletics. He wanted athletics. >> There used to

be transportation also back in the day. But now that we are no longer in charge of transportation, that was a committee that maybe didn't need, >> right? So put it in buildings and >> why don't we just call it building? Yeah, buildings and grounds to take out transportation and then athletics. So, I saw that it was revised in uh 2021. Um what was the change? Morin bill >> to get rid of transportation or >> or No, no, there was it says that there was a change in 2021. I >> maybe it added transportation. and we added transportation but from what it sounds like from previous from like Anthony and Jason from >> I'm trying to remember exactly we had finance had policy had teaching and learn but the others have been >> yeah I can

I can >> so this district had >> multiple subcommittees all everything cafeteria committee athletic committee, building and grounds, transportation, all these different things. Um, under under Chris >> Kuette, >> he had worked with the board, worked with Cade that the board was overreaching on their board of governance by having all these committees >> that because the board doesn't control, you know, like the day-to-day functions of cafeteria, they got rid of it and they boiled it down to what the board control over. Finance policy teaching and learning not because the board has control over teaching learning was kept in place so that administration can explain to the board about the work we do which is an educational institution you know so that that's why there wasn't that >> that the board has the right to say

what's being >> so that administration has a forum to >> explain to the board what we do the work as a public >> and that's what it went down to and then Everything else was an >> everything is >> now I would say my recommendation that you talk to Fred Stanick again because this was done the guidance of Tabe and all why all these things then all of a sudden they slowly started migrating back backgrounds brought back transportation then we dropped transportation and we're bringing back athletics and again I know the board can >> the chair wanted athletics is >> no I I understand but and that's the chair has the right to express that I The board has to vote on that. But I'm just giving you the history here of under the guidance

of Cabris Kuette as superintendent. It was shared that the board of education at time was overreaching on the functions of the board by having multitude. >> Okay. Then a point of clarification, if you still wished for some ridiculous reason you wanted athletics, then it would therefore become an ad hoc. >> It has to be an ad hoc. But the rules of an ad hoc is an ad hoc has to be in place for a purpose. >> Once that purpose has been served, >> they're dissolved. >> Yeah. >> Okay. >> Correct. Now, now I I don't I I don't know. I'm not questioning in terms of the board's decision the purpose of having a standing athletic don't know what what the goal of that would be. it was put in as an ad hoc and I

still don't even know what the goal of the ad hoc was um whether that goal's been reached but this is a discussion of the board detail >> okay >> but but I I I would bring that up to legal counsel in terms of standing committees because may or may not tell you about board of governance because that's why I was changing the because again the like teaching and learning and you know way teaching learning operates the board can be informed of athletics Yes. >> And we can do that at any meeting. >> All right. But the board does not hire coaches. >> Oh, >> right. >> The board does not dictate athletic >> governance, >> right? >> You know, that's done by the CAC. the board has no authority on how athletics is run, you

know, and so that's why an athletic committee I don't >> I think the last time athletics started could have been study fund raise >> I I think the ad hoc committee was was an ad hoc for that point. >> Yeah, >> it was the fundraising and it was the um >> the concessions. >> Yeah. >> Right. because they were building the concession stand, right? >> And then it was the fundraising for the concession stand and all that stuff. The concession stand is now in place. Now, I know that Jason and and um Anthony are still working on who's going to run the concession stand and that can be done at the ad hoc, but they can get a permanent committee, >> right? >> That that would have to be the decision of the board, but

I would I would ask a legal. >> All right. So, for this one then we have a question for Fred. >> Yeah. And I did speak to which I understand he is available on the second. >> Great. Okay. We should also get not a verbal explanation >> but maybe a written explanation right as why he >> if you look at other boards of education in Connecticut they only have really two committees policy and finance and finance. really go >> Stford has way more. >> Well, when we had the training, um, you know, it was mentioned. Oh, good. I'm glad you cleaned that up. He had said, "Oh, when we said how many committee >> Oh, he didn't. I wasn't there. >> Yeah, he had you were somewhere else. >> You were busy. You got busy.

We were having fun." at you. >> I think we would rather have been up there. >> And he made the comment. I'm glad to hear that you clean that up. >> 9133. This looks to be >> Is this for building committees? >> This looks like that's exactly what it >> Okay. >> for, but I'm again I I'll write it down just to >> Yeah. make sure that I'm not >> because the public because the city has a public improvement building committee that normally takes care of some of the background >> and the city has altered their building now have a board of ed representative they've changed their their Jason sits on it as the board >> okay >> so is this pol policy. I'm sorry. By law necessary or is >> Well, there's a legal

reference. >> There's a legal reference. So, it looks like it's in addition to the public. >> At least we kind of have an idea of the purpose. >> Yeah. >> Mhm. >> Okay. >> 9140. This is basically the uh representatives to CAB and CS. Yep. >> That's not going to >> I don't know if we need to add it. But it does say such. >> Yeah, that I I think that's >> We're good on board consultants. This morning, what does Do you know what this used to do or >> we employed a consultant to help a superintendent? Is it also it could be for something like um >> yes >> I remember because I was a I was the paid fireman in that meeting. >> Oh you understand the joy. Okay, good. >> 9221. This

is filling of the vacancies if we have any. This is charter statue. >> Yeah, that's that's dictated by >> that. I'm not >> I know that one that that you can't just >> uh this is 9222. This is the one that we're going to >> we're going to move that to all the thing. Yes, just move it. >> He was very involved with all that revising. >> Yeah. >> Um Kaylee, did you ever find any of that n? >> Yes, I have it here. >> Okay, cool. All right. So just for keep Fred in can and that be placed in our packet for him to cuz that way he'll just he'll have something. >> Excellent. Okay, cool. That's good. >> I remember the red was delete, blue was >> Yes. You would be remembering correctly.

>> All right, that's good. >> 223. Yeah. >> Oath of office, which is state, >> Which we do >> in our nice little party >> 92. >> It's not set forth when we take it by Connecticut set forth. >> It's set forth in our charter. >> Yeah. And that's done in an earlier bylaw. I think it's done in the number of members in terms of office. >> Okay, >> it's done in that one. >> Lovely. Thanks. >> 9230 which we just revised. I don't think we need to look at that one. We're up on to date there. 9240 board member development. This just looks like it's for if we're if we need to go to a training class that's in state, far away or out of state. renumeration reimbursement. Uh Kate, this is something you

brought up. >> Yeah. Well, Connecticut li I don't I don't think so. >> And then I'm looking now, too. >> Is the cost of meals. >> You're right. I just hit me. >> So, um, what what could we put in there? Well, back in the day, we used to send people to um me ask Boston. I mean, you're kind of invested in that. You don't have a lot of wiggle room whether or not. But honestly, the NES because the majority of the cost came out of the high school. The high school has their own um fund. Yes. So, a lot of what used to have to come before the board is negated because now the the high school basically pays the way. >> Um, nobody goes to national. >> They used to, but not >>

always. >> Yeah. But not >> Tim used to. Yes. >> Next one. Conflict of interest 9270. This looks like it's entirely state statute. >> Weren't we supposed to sign a document at the beginning of the ever remember? >> Now that you mentioned I remember something. I thought it was a conflict >> was uh yeah, I'm probably saying it's a years. You might have to go archive >> if I've done it. I've only done it once, twice, but that would be something to investigate. >> Need a order. I came on in it would be before that. Yeah, mostly before 9271. This just like it looks like it's a list of a code of ethics. Looks like prescribed key. >> Yes. Which we took and put into our map packet >> which doesn't get rid does it?

I do >> 390300. Uh it looks like just how we operate into our board governance. Is everyone good with that one? >> Yep. This is again Kate this is something you brought up um as you mentioned that we do not have typical hard copy policies of policy regulation bylaw books. Um >> I think all we need is >> yeah write this down so we can get this. Yeah, because we I mean hard copy policy manuals or I think the past everything >> the last surviving one ser >> Oh yeah, I did see I still have mine. >> It has been returned. See >> 9311 and 9312. Looks like these are from Robert's rules of order >> except on bylaws it says 23 vote post or when I saw this this reminded me of what I

this this looks like they this looks like it was a from when it was adopted in '06 policies and bylaws they were the same exact And they're the same exact. >> Yeah. >> If >> by uh bylaws govern the boardies policies govern. >> So I don't know if this is state statute that we have to keep it separate. >> School. >> Yeah. These are by state statute. We have to keep these separate or if it's just >> style. We'll I'll mark it down cuz >> if we can bylaws are definitely separate from policy and the thing that's in their question bylaws part >> it's saying 2/3 vote what I'm confused about is if it's a formulation and adopt why can't it be bylaws and policy I'm >> that that's why I looked at this when

I when I was looking at it earlier today like this could probably be both. >> Yeah. Like bylaws slashp policy >> and if there's a if we want it put in where there's like majority rule if for certain policies, >> right? >> This is take minutes. >> Well, we'll just have to meter. That's all. No, I mean I think that is an easy fix. But >> what we could ask Fred is, is it okay to love them together? Yeah, I think that's important. >> If we just change the title, is that enough?
