Mhm. >> And I'm here, Mario's here, Al Mansi, Kathy's here, Casey's here. Donna's here, Doug's here, Pat and Robin, Alana, Zoom, Sue, Effie's here, Alana's here. Mike Z is here, John Jenny's here, Dean and Dean brought his uh bodyguard Nick. >> [clears throat] >> Okay, the agenda. I I gave you because I just got it yesterday the AIA document for payment, and then we have an addendum to that, too. So, I just want to let you know, so I'll give the addendum out right after we start the meeting. So, can I have a motion to approve the agenda with the additional AIA document? So moved. Got a second? Second. Second, Casey. And that will go under A because it's a payment? It'll go under uh C. Application, there'll be two applications there. Okay, so that'll

be D and then the document will be E. Okay. Any discussion? All in favor? Aye. Aye. Any opposed? Minutes? I have a correction. Okay. So, correct it. Reviewing the minutes, it seems the secretary escalated our expenditures to the billions. Oh. And So, item seven should be 173 million dollars. Yeah. That's a big number. Yeah. Power of fluctuation. Yes. That motion to approve the minutes with that change. I'll make that motion with that change. Second. Second, Kathy. Any discussion? All in favor? Aye. Opposed? Okay. Mike Dureau. Uh good evening, everybody. Um few updates [clears throat] I'd like to present tonight regarding some various uh major topics related to the athletic field construction, uh landscaping, and HVAC, uh building commissioning, uh high school gym floor, and roofing. Um Regarding roofing, during the last building committee meeting, I

had advised that we were in the midst of roof repairs over the April holiday break. Um you know, originally we had thought these repairs would extend beyond April break and into the summer, but further investigation beneath the membrane uh limited the overall repair work. Um and you got the blessing by the manufacturer GAF. GAF. Um the repairs were completed on that Saturday of April break, and we are awaiting the final uh manufacturer's warranty from GAF. I should expect that hopefully by next week. Um >> [clears throat] >> to switch gears to landscaping, and okay. >> Can I ask a question on that? You Yeah, you Yeah. Um Did they come out visually and inspect it? They did. Yeah. Um I do have a couple questions. I was up there yesterday. I was up there today.

Um, the walking strips The walk pads, yeah. The walk pads, I noticed underneath a couple of them seemed like there was water trapped underneath them. Water or air? Mhm, one or the other, but it kind of felt like a waterbed. Um, when I was walking on it back and forth in some areas, is that something that is typical? Um I've noticed that throughout throughout a lot of the walk pads, but to me it's never been a water issue. I think I'd be able to feel feel that or at least it would have been picked up by the manufacturer so the thermal scans that we had done. So we had done a thermal scan back I think in the summer of last year to show areas where moisture was intruding through through the roof system. Um,

and none of those walk pad areas had come up on it, which makes me think it's air and just adhesion of the of the membrane cuz it isn't fully adhered. Could be water between the pad and the roofing membrane, but it's not likely. Mhm. But then but then I did notice under just the white part, too, that was not that was not the walking pad close to it. Yeah, sometimes it's deceiving cuz we bought a non-fully adhered roof, so there are ripples. And you feel that air space? You might. Um, just speaking on one other thing with the roof, we did notice that the um entrances to the chiller filters are are um, you can't open the door completely because of the guardrails that were installed up there. Yeah, handrail. Handrails in there. It was

with the the VFD. Uh, I believe so. Uh, yeah. I believe so. So you can't get the door to get to it and it's a rail that obviously goes into the roof. Right. Right there. So We had to rework I don't know if you saw some of those handrails up there. It's just a regular handrail, but then it kind of offsets down and over to kind of alleviate some of those issues we had. We repaired one prior to, but there must be another one like you're saying, so it's okay. We'll have a look at it. Which one did you come to? I'm going to be honest with you. The chiller guy was up there and he sent me pictures of That was on the punch list. I thought it had been addressed. Yeah, well I

mean He could see the doors and it didn't open all the way. So, I didn't know if that had to do with if you're going to do something with the roof on that or if you can cut it lower. I think the door Well, I don't know. I don't want to speak out of turn. Door might come off, you're saying, instead of swing open? >> That's what I recall. Uh this was the This was the drain grout out there, so See if we can get it. While we're on the roof, what about the cleanup of it? Um Mario's referencing to the roof drains up on the roof. Throughout construction, a lot of debris you know, clogged some of the roof drains. There's a lot of active old old roof drains that are washing out things

that wouldn't have been washed out if the drains, the primary drains were clean. Um it's on our list when we get the manufacturer's warranty. We'll have Slam issue us a certificate like we have previously in the building or other exterior things and we, you know, hold a value to that to clean clean them. Um I don't have an ETA on when When are you going to clean them? It's a punchlist. It's a punchlist, I don't know. You good with the roof thing? Yeah. Yeah, okay. Um switching gears to landscaping, we had met with Slam earlier this month to discuss the overall state of landscaping. Um as you're all aware, since last meeting, you know, lawns or plantings have been accepted by Slam in any area to date. Uh in the meeting held earlier this month

just helped to hash out items of deficiency and ultimately uh what the lawn and plantings need to get to that next acceptance stage. Um ONG had reviewed this with CJ Fuji in conjunction with TC Landscaping earlier this week. So, we got to receive the report. Uh and they've been on site the last uh you know, few days performing various various activities. Um you know, installing weed filter fabric where it was originally missed, uh weeding, remulching of all of the beds and edging of the beds in accordance with the specifications, um mowing on a more consistent schedule. Um you know, they had previously slice seeded a couple of different areas. The javelin court comes to mind. Also in front of the middle school they had slice seeded back in late April and early May. And big

picture here, the hydro cedar is coming back I think it later this week potentially Friday or maybe next week to spray the athletic field areas that have now been sprayed with topsoil but also touch up the remaining areas that are also not you know, sprouting. Doesn't meet SLAM's threshold with the growth for for a lawn within a certain area. You know, we're intending to have SLAM come back out in the next few weeks to review the progress and the work that DC Landscaping has put in and you know, since the last meeting earlier this month that we had with SLAM just to evaluate you know, conditions of the plantings and and germination of the lawn after they get re-seeded. That's right. I got a question on the the grass area where the signage is, you

know, the electric sign is Yeah, in the front? Yeah. That soil in there is very rocky. Okay. So there the grass looks like it's I know it's better today than it was. >> like the tundra and not a green nice Yeah, that Yeah, on our landscaping report there were areas that were referenced that have you know, a rocky you know, soil You can see the rocks there they're like this big. Yeah, and they're going to have to re-spread topsoil and going to have to re-seed. Okay. So they'll be removing the rocks and you said it's And they got to cover it >> to have to rock hound it and then dress it up with topsoil probably. It's like the only way I think. And and you mentioned that a more consistent basis as of today

you said. Cuz there hasn't been a consistent basis up until today. Yeah, I think the first mow it happened for the season I think it was last week. Mhm. Probably the week before so I I know that I know that somebody emails back and forth. >> [clears throat] >> We really didn't get a time frame on it. Is it going to be weekly by-weekly? I think the Yeah, the rule of thumb that we had set was you know, no more than 2 weeks. On day 15, you know, if you don't have anybody there mowing No, I got you. it's going to be a forest and But rule Again, rule of thumb, depending on how wet it is out there, it might Yeah, it's seasonal-wise, too. With obviously now it's going to be more mowing than

in June and July. There's not going to be very much. So, does this include, when you say that, paying attention to cleaning the islands? You know, in that area, cuz the islands have not been Unless they did it today. I don't know if they have been kind of run wild. Should be all in one off mowing operation, but Yeah, to Dean's point, like the islands right in front of the gym auditorium entrance, it looked like the Everglades. Yeah, and that's so yeah, that area. So, in that landscaping report initially, it was, you know, disseminated to us with a couple different drawings and markups where they had wanted to change some of the seed types that we originally had put in, and then they backed that out of the report and were going to send us

a slightly different way to, you know, send me that as the proposal request. So, we are looking at different seeds, but to your point, this is not mowing. Yeah, the makeup Not what it makes it up now, not really the the kind of grass it's supposed to grow or whatever, but just the general look of the complex, especially around all the islands, even in the lower lot. I'm not sure what is a plant and what is weed at this point. Um Yeah, you know, there's a lot of clover and we're going to have to deal with that. So, yeah. >> I mean, because of the pesticides we can't use, right? And things of that nature. I mean, this is what we bought. You can't see grass, it's all clover. So, yeah. Um it's unbelievable. The

clover looks better cut than it does long. So, of course, should we keep it that way or not? >> Yeah, for sure. Yeah, I'll um I'll look at the mowing of the island, but I still got to confirm the regular planting season stuff. Like, what about up on the up on the back side of the building? We got a lot of wash out. I don't know for sure where, but what's your time frame over there? We have you know, a little the little asphalt walkway that we have going up um going up >> Going up the football field? Yeah. Yeah, that wall's got to get resprayed. Yeah, to the left of it we have, you know, tremendous washout and and and Towards like the Route 8. >> Yeah, towards Route 8. Summertime, is that a

summertime thing we're talking about? I mean rather, I mean the hydro cedar is coming later this week, next week. He can hopefully, you know, start to spray areas again, hopefully get them more established. I think they sprayed it late last season and didn't get a chance to grow, obviously. Um Okay. And and they fill before they hydro seed, obviously, right? Yeah, they got to fill it first. You know, we're going to rock out there. And what about that fence that's going across here? What's that schedule? When's that schedule? The 10-ft gate? I think I think so. Then we decide then we yes, we report the gate. >> it's on our radar. We reviewed it with them, you know, with you and I when I was walking with the landscaper in there on Monday and it

is on the radar. They're focused on trying to get, you know, backstops and stuff put in the field and stuff, but it's it's on the list. There's a lot of washout in there. That's what I'm talking about. Yeah. Um regarding the HVAC and building commission Oh, go ahead. I'm sorry. No, good question. And and I don't know this or not. I could have checked the plans, but I didn't. Um is there a gate going from Hogan Daily. Daily. Hogan Hogan is school. Hogan is school. Sorry to Daily is school. Daily is school. They Daily Huh? You losing it? A little bit. Um Daily is going into the concrete, the heavy traffic ready concrete slab. The ball gates. There were in the in the field chains that were removable ball yards, but when we were going

through the price we changed Perfect. one of the um we added a >> Okay. Permanently, yes. I got you. Okay, yeah, yeah, yes. Um going to the HVAC and the the building commissioning, you know, to be totally, you know, transparent with everybody and with the hot humid air that was present last week and earlier this week, you know, issues related to space conditions and you know, odors have represent represent themselves. Um, they've been causing some serious problems to the occupants of the building. Um, you know, I don't want to necessarily get into the the fine details of it, but you know, there's a lot of technical terms that are being thrown around and you know, I don't know if that necessarily would benefit this group. Um, but I'm going to try to divulge as much

as I can um, related to the community and the temperatures. Um, you know, like roughly generally the root cause of a lot of these issues has to do with the chiller systems and the chillers, you know, tripping off a low flow and having all these various alarms. You know, some are related to leaks that you know, we're chasing and we're trying to repair. Um, you know, additionally, you know, throughout MJ Daily's investigations with Trane, they've you know, observed the arrester screens and the fresh air intake hoods were being restricted, you know, due to heavy debris being built up in them. Um, you know, the worst one that they had found is in one of the more prevalent complaints, which was you know, DOA 6, which serves area F, the middle school, the first floor, the

second floor and the third floor. Um, you know, and being just very unbearable and uncomfortable, you know, from a space condition standpoint. Um, you know, similar issue was occurring up in DOA 3 with the conditions of those, you know, arrester screens and again, the area that serves the central office that was having another, you know, high humidity temperature complaint um, this week. So, we've been focused on trying to get those, you know, screens clean, not just on DOA 6 and DOA 3, but all of them. Um, you know, there's a general feeling from MJ Daily and the service report that I had read today that, you know, in their conversations with Trane, that the type of arrester that's being used, the screen on the intake hood is not correct and it's it's wrong for the

application, you know, in the climate of this area. So, we're trying to review it, you know, further with Trane and maybe look at something different, a 1/4 in you know, chicken chicken screen. Um, something that allows, you know, more air flow through it and not be so restrictive with debris being held up. Um, we're going to also loop Slaman and CES in on that conversation as well once we figure out a little bit more information. This is all kind of unfolding. No, you know, smoking gun I can, you know, tell you today but we're trying to put in the effort trying to you know, make these conditions more livable. Um, you know, there's there are obviously other outlier rooms and areas where, you know, investigations are continuing to be flushed out. You know, a room's

got a bad transformer in the BMS box. It's got a bad, you know, thermostat. You know, those have impacts, you know, in addition to what's going on with the chillers um that we're also looking looking into. Um you know, it's just a good reminder to everybody it's, you know, it's hard to believe it's been 15 months since, you know, that high school got occupied and middle school got occupied last August. These systems have been running for a long time. Failures happen with thermostats, transformers. Um and really I just wanted to put that in perspective but, you know, I can assure you that, you know, OMG, MJ Daily, you know, ABS, from a controls uh perspective, the manufacturer train, you know, Slam, CES, IES, you know, Field Companies, John over here, you know, we spent a

lot of time and continue to spend that time uh to get to the root cause of all these issues. Um but the investigation takes time and, you know, I I really don't, you know, want you guys to feel like you're being, you know, kicked to the side of the road but we got to see this process through and that's, you know, part of this communication effort. Um you know, regarding odors in the building, you know, there's a few ideas that we've been kicking around with the designers that, you know, on what could be causing them. Um you know, some of it has got to do with those arrestor screens but I think a large majority of it and, you know, from the latest correspondence that, you know, we've been working with with CES is, you

know, maintenance of the the CDQ wheels they call them. The enthalpy wheels are the big red wheels inside the DOA units. Um you know, could be a big contributing factor to that. You know, there's each of those wheels, there's one in each DOA unit. You have three DOAs up on each roof, high school roof and the middle school roof. So, there's only six of them that are serving, you know, fresh air into the spaces. Um you know, and maintenance of those wheels is a process that's listed in in Train's literature and we're also looking to see if we can try to tackle that next week if it works with the schedule. We have to talk with MJ Daily. Um each unit is actually supposed to take two men for one day to clean just one

one unit. So, I mean, we're talking about five six days of trying to get up there to to clean them. >> How often are they supposed to be cleaned? I don't read too much into the literature. I would think before cooling season, every cooling season. So, once a year? Cuz really yeah, I would say once a year. Um you know, something too that we looked at with CES was that in the winter you probably weren't noticing the odors as much, probably a little bit, but there's low humidity obviously as we all know in in the winter. So, the the wheel's really not working and doing anything that would cause the odor and you know, as we got into spring here and you know, we needed cooling you know, it's no surprise now that we the

odors are popping up and I think that's a you know, valid a valid point that CES had brought up and happy that they shared and we just got to keep working through it. But it definitely has a must. Yeah, and I think it's just debris getting caught in that wheel and there's little slits in that wheel. It takes time and you got to brush it out. It's there's a depth process and it does take time. Um you know, from a commissioning standpoint overall, you know, we are looking to have a meeting scheduled in the next couple weeks to talk about the overall state of commissioning and and where we're at. Um MJ Daily's presence has been you know, felt there you know, obviously over the last month since you know, we received the latest uh

commissioning progress report. There's a lot of items on that report that they're continuing to address, you know, other memos that have been you know, disseminated from you know, IES the commissioning agent, things and anomalies that they're that they're aware of and you know, we're working on on doing that as well. We're having a meeting in 2 weeks with everybody uh CES, SLAM, IES, W uh MJ Daily and uh OMG and John to get this thing done. Well, I I feel like um as of yesterday MJ Daly sent out a person Henry Haas and I met the service manager Joe Pesci. Really? Joe Pesci? Is that true? >> real name. He spells it French, though. It's p e s c i e. Henry Hill was out there talking. Henry Haas was very good. So I feel

like and I and I really believe this is what we need. We need one person and this kid is very, very good. I've known him for 2 days so far and he's impressed the hell out of me. I've been up and down a ladder with him. We've been out. We've talked about the systems. We've talked about the equipment and I feel like this one person should be involved in anything that we do. He just started with MJ Daly. But he is so far has unveiled many things that we didn't even know about. Within 2 days. So, I'm I'm I feel I feel much better with him there, to be honest with you. Did you get his phone number? I have his phone number. I have his email. I have everything. You know, again, um I

want to I'll see if I can get you to that commissioning meeting in 2 weeks, too, and also make sure that Henry is there, too. And and I and I asked him today and I don't know if if he sent that report to you. I haven't been in the office this afternoon, but I'd like to be CC'd on any of those reports going back and forth with them. Yeah. Um because we are chasing these things every day. Yeah. We're chasing them. Meaning Nick and the crew. Chasing here. We're on we're on computer. We're trying to do this and trying to do that. Um but a lot of it is out of our control at this point. It's out of our control. I think a lot has to do with the design, to be honest with

you. It's got to be fine-tuned or tweaked or changed or whatever it is, but um anyway. Um The And that's it. What? Okay. I'll put my name down. And you haven't come to the meeting too. Yeah, I'm going to go now. Thanks. >> [clears throat] >> I have a question. Yep. Just You mentioned that I don't know what it is, a filter or a screen. You said that there was There was one that wasn't geared to this climate necessarily. Do you know Do you get a default one or that's not geared to the northeast? >> No, it's the specified one that we're supposed to put in through Trane. It's just they think that there's just air like they wanted to switch to a 1/4 inch bird screens that's had a little bit more openings in

so debris when it it get get caught in there it wasn't so So this is the on the exhaust, right? Intake. On the intake it's the moisture >> Okay, on the intake there are the screens that he cleaned today. Those were never cleaned during normal maintenance and they should have been cleaned. >> Right. On the exhaust end there's also a problem. There's a heavy it almost looks like the what you put over fencing. Like the slide. The vision guard that you go over fencing so you don't see it almost looks like that. >> like a nylon thread. It's like a nylon mesh that's on there that the amount of air blowing out of this thing the thing is you're looking at it and it's it's actually pushing it out and almost looks like that after

time it's just going to start sending the screws up because there's that much pressure behind it. Yeah. And he feels as though those that is not the problem. Maybe just a bird screen on that or insect screen nothing nothing to stop the flow like it is because we're adding that much pressure inside that unit and it's not expelling as much as it is because it's being restricted. So it's backing up on the other end. So it's I don't know if it's backing up though. It probably isn't coming out I don't want to say it's backing it's probably restricting the flow not necessarily sending it back. But the problem is those other screens that they cleaned today should have been done when the filters were done. Right. So so I think we really need to know

what the service of this because it should have been done Right, only when we're changing filters. When we change filters and it wasn't >> with the same Same thing with the FAP wheel. That should have been done when the filters have changed. So, we kind of got to get those things done before we can blame something else or even eliminate something. >> Yeah, I hear you. A lot of this has to deal with maintenance. With maintenance. I agree. I'm not the expert on it, but those are those intake screens or moisture eliminators. Those are That's what keeps the rain and snow from going in. So, [clears throat] I wouldn't I would make sure that they're comfortable with it if it's in the duct work or not. My my take was those just have to be

cleaned more. My take today was just those have to be cleaned, not to change those, but the exhaust on the other side is something that we should look at. And put a message to Mike. I could be wrong about this, but you got to That's what I was talking to you about today. So, there's two different items on one one over on this piece of on this side equipment, one on this side equipment. There are sensors in there that that monitor static pressure. Yeah. Should be telling the system when things are not allowing enough air through. So, I would imagine that on both sides of the intake and the filter and the exhaust lines that the static pressure sensors should be saying, "Hey, too much static should be too high." I would think so. And

my other my other thought was too, we go change that that balances that changed the balances of everything. Air flow balances of the whole thing gets changed, so. That information again can get pulled, right? The history of it? Um if you get the you have to track it. You have to set the system up to run at the full time. Right, but you can You can go there right now and take a snapshot and see what it is. It doesn't Static pressure will not go down unless you clean them. So, it always just gets higher and higher. So, when you clean it, it will drop. Um so, if you run the system now, you'd be able to see what it is at this moment. You could always run a report and you can ask to

have that included in the report. Any other bit of information you gave me today because I asked him, "Does this happen a lot?" He goes, "No, because he's a custom made for the strap." Those Those train units are custom made. So, these are things that There's a few other things that he found that some is going to have to do something about it because it's not meant for the situation. I think this is one of them. That That That exiting filter I'll call it, that mesh thing, you know, meets California codes, which they want to clean indoor air before it goes outside. And that's pretty much what it's doing. It's trying to filter the indoor air before exhaust outside, which not here. So, so not necessarily built for the Northeast. No. Possibly. Yeah. I mean,

to be determined, but it's it's not necessarily designed for for New England. Yeah. I think adjustments, you know. Right. >> I think adjustments have got to be made. Okay. Thank you. You're welcome. Um just switching gears to the athletic fields, um construction remains ongoing. Um on May 1st, I had issued a certificate of substantial completion for the varsity baseball and softball multipurpose field. Uh aside from the punch list items that were attached to that substantial completion certificate, uh the only item that remains in that field is the dugouts. Um it's been challenging for us to get the dugouts installed. We have, you know, set up temporary dugouts for now. Obviously not good enough. Um you know, but I'm hopeful with the softball pads being poured earlier this week at the installation of the dugouts being

imminent. Um you know, I understand wholly you know, the hardships that this has put on you know, the community and you know, the athletic department, you know, the baseball team, the coaches. You know, it's a fully completed field is really what seniors deserve on on their day and you know, I just I sit here and I take ownership of that and you know, I apologize. Is the backstop all done? The softball? The baseball. Oh, yeah. Yeah. Yeah. Everything on that field is done. All the fencing is done. Not the dugouts. >> Not the dugouts. What was the hold up? Okay. Different installer. Different installer, yeah. Oh. And they didn't show up? Did not install. They had it scheduled, they didn't come. Are they coming back? They're coming back. Yeah, they're supposed to come back next

week. Well, to Mike's point, they Now that Now that they missed their window to do the baseball, they probably were waiting for the softball to pass so they could do it all so they could do it all at once. Um you know, for the varsity baseball or the varsity softball field, um actually a lot of progress has been made since the last period, you know, from working our way out of the baseball field, you know, the sidewalks, you know, have been placed around all the softball field limits, most of them. Um except for one we work our way out. Um but you know, excavation, installation of the backstop posts, you know, the mesh fabric, all that's, you know, nearing completion on the backstops. Um most of the curve has been already formed and already placed

with concrete, except for the section that the heavy trucks got to go and drop stone and work their way back out. Um you know, but next week we are looking to start the stone infill, the filter fabric, and all the flat drainage. Um that ties into all the perimeter drainage. And then, in addition to that, um respect to core, all the four foot or the fencing, um the perimeter of the field, so. Um Quick quick question on the on the field. I was just wondering why uh Fuji wasn't represented at this meeting just because they're the ones that are the They're the like the CM for the field, right? Well, essentially almost all the trades are fall under their umbrella. >> Yeah, Fuji has Fuji as a sub con prime sub contractor through us but

Fuji owns field. Fuji has field turf underneath them, they have Liberty underneath them, they have Eagle underneath them, they have TC Landscaping underneath them, and part of the whole, you know, grant when it all came out is that in order to get the reimbursement, we had to stick with the trades that were already on the you know, the project. I was just wondering why they weren't represented here. We didn't invite them. Wouldn't want to do that. >> [laughter] >> From that end later. They're not good for us, so. so yeah. Um last item is um the the testing of the high school gym floor. Um earlier on in May, I think it was May 1st, which was a Friday, I think. Um we had JJ Curran, who was a subcontractor to our prime flooring contractor,

R&D, um perform deflection testing, they call it, to test the the height and the bounce of of the floor. Um I was able to get my hands on a report today. Um don't have all of the answers yet. I think most of the testing points that we had worked with with Dean and we might uh Yeah. Yeah. We're there testing different spots of of the floor, you know, Dean had, you know, pointed out a couple spots of concern. He had pointed out a couple spots of concern. He pointed out a couple good spots just to kind of measure what was going on. >> [snorts] >> Um and I think everything I think there were 12 tests taken and two of them fall out of conformance. If you bring one of them back up, which is

one area that the keys uh closest to the weight room, the the basketball key, um you know, if you bring that one up to conformance, the average will will will raise and you know, that last one will go back into conformance. So, we have a little bit of following up to do, but generally that's kind of an update on the testing of the floor. So, what does that mean? Means I got to set up a meeting with you guys again and talk about it. With the manufacturer and really try to get a plan on how to fix that one area that's like a trampoline. So, I got to get a plan on Okay. I sent you the video today. Me? I don't think you looked at it. I I I I didn't get an overview

of it. Yeah, I'll take it to repair it. Well, it's it's uh For the gym floor. Yeah, basically you drill a 1-in hole and shoot it up. Yeah, fill it. Underneath and then sometimes it's a little too hard. Yeah. We'll have to um I want to loop Connor Sports into it in the discussion on what they would you know would be willing to accept and that doesn't include any of the other things that we do. So that's So we have time to absorb this report and then you're going to come to us with a plan and address the area or areas that we feel need to be addressed. John, you're on. You have two reports there. Uh let's see. So since our last meeting has been two of our field reports for entry number 138.

Uh the attention items that we're tracking, one is on the punch list for the high school that remains. One is for the middle school that's on the punch list as well and then there are 11 items that we feel uh that are part of either either punch list work or work that we're doing on. There was a issue a field report issued by SLAM regarding the landscaping that Mike referred to earlier. Uh it included a number of observations or deficiencies and then some opportunities to grass types within the swales. Uh no CES reports or Vanessa reports since the last meeting. Uh there were some material test reports that were received and they were all for the light duty and heavy duty concrete applied to the athletic fields and there were no deficiencies noted. The startup

testing package for the DOAs the dedicated outdoor air units was submitted and approved. So those are the six units. Uh all that says is that they installed them and they completed the installation process. Still has to be uh the commissioning process still has to take place but the installation has been uh documented and approved. And then IES commissioning, we talked about that. Mike talked about that earlier. Uh there are operational uh checklists. There are uh control checklists and there are uh device sensor checklists that need to be filled out and then there are a number of deficiencies or observations that were identified by the commissioning agent that we're going to meet about in on June 2nd to go through. MJ Daly believes they've addressed a lot of them. Just a matter of making sure the

documents reflect that. So we're going to go through all the checklists to make sure that they check them all off. If they haven't checked them off, they'll have to go out and go through the processes of going those out. No IAQ or waste management checklist reports and no construction waste management reports. Thanks, John. The next item you I gave you tonight was the AIA document. As always, the front page and then the second page gives you a small of the purchase orders and who's getting paid what. Let me know that totals $1,046,246.62. Have a motion to approve? John, thank you. Second? Doug. Any discussion? All in favor? Aye. Any opposed? Now we have a a second one to add on which I said this uh on the one that I just gave you did not

include uh any payment for Fuji. So there was a uh back and forth with everybody. So here is this one. Basically, they missed the timing. Yeah, they missed the timing. I won't guess at that. I'm sure any of you would. Guess that. Now, while you're while you're getting it this approval is contingent on everybody's signing off. That means Fuji has to sign off on it. And then Slam has to sign off on it. So, nothing gets paid on this document, Fuji, until the sign off is signed signed off on it. Uh we do not hand out the 30 pages back. But this is what uh ONG and Fuji agreed. Right, yes. We sat down on Friday and you guys and me and Slam as well to review this and see what we all felt would

be, you know, appropriate to certify payment in the absence of the He did want more money, but uh uh that was not a requirement that Mario and I would uh even so to speak. So, if you approve this, it's remember it's on contingent. Cuz nobody has signed it. Signed by Fuji and by Slam. Okay? As you know, all of the previous ones that I have given you signed by the owner, by by the contractor, and the owner, which uh is signed. I didn't give you cuz I just got the signed copy uh today. So, when are the other signatures going to be at? Uh uh uh Which one? >> I don't know. Explain to me On on this one? On the on on this one here with the highlights. you got a darker you got

a cloud in there and all that. >> to sign it. And SLAM has to agree to it. So Dean So the committee voted Gucci wanted $484,000. >> Yeah. That got cut down to 220. Got it. Gucci didn't respond in a timely fashion, so they ended up getting nothing. Um So it remains to They might say we don't want I can't believe they won't. I can't believe they would turn down Yeah. But that's They wanted What What is this exactly for? Any It's their monthly work. Just monthly work. Monthly progress. So their monthly progress was too high. Their monthly progress in their eyes was 484. >> Yeah. But not in our eyes. Not our eyes. So So we cut them and they wanted to protest it. And I don't know what the tribunal system is what

it's called. The experience are going so far. Yeah. At some point I had to move the bill forward yesterday to not impact the other, you know, six trades that were included in this and then made the decision to, you know, make them and you know, today we had a discussion to see if we can try to include some money in there just to try to build some more good faith with them and just try to make sure that they keep going and finish the fields. That's really what this is about. It's trying to finish the fields and keeping them here. Why are they like What Why are they not progressing with their share? Well, what's no What is No, work is progressing. Work is the financial aspect of it. They wanted more than we had

told them that. Yeah. It's It's a money thing, it's not a work thing. No, it's money. They want more and more. We can We want to hold it. You got paid for all of that, too. Yeah. It's not unusually you can't redline most most trades submitted applications, but then you get redlined. But in this case Yeah. the redlined trades submitted applications and but So they say they completed the 484. >> We said no. Yes. They wanted some retainage and all that. We said no. We want to get it to 220. So, then the motion would be to on contingent to pay 220. Well, to authorize Right. you to make payment contingent upon that signing. Signing for everybody. They sign and Slam signs. They If no, they don't sign, then I don't get paid And this

can't wait for another month because you want to keep the Right, keep the flow. So, if if we just for instance, if they don't sign it, let's say they sign it cuz tomorrow I drop off all the other invoices to the city and they pay me next Friday. So, if he doesn't sign it till next Thursday, he ain't getting paid until a week later. It's not us. >> update us on the next meeting >> Yeah. Okay. Well, we've been every time you know, we the city's been paying a week later. It's always so. But, if I'll tell them tomorrow that this may be coming, but I don't know when. And if it comes, you know, by Wednesday, they may not be able to pay on Friday. And it's not a matter of any dispute about

the work you've done. No. It's just no. They wanted more and we said no. Yeah. And this number They know this number right now? They know the You negotiated this with them? I didn't negotiate. I mean, he said to after we agreed He came in 486. We met with them. We went through it and said they're not getting paid for it. He says So, why didn't they sign when you met with them? Uh we didn't I met with Ed Mario and Slam. Slam and he met John as well. To agree on this number, this 220. This is new from them. But, wait a minute. So, who did you meet with Gucci to agree on this? You met with But, it's a it's a traditional billing process. We get an initial pencil from the trades. We

send our We send the pencil to Ed Mario and the design team as well and the only draft as well to see if they have any comments you know what we're looking for. And ultimately this is you know what we had come up with between Ed Mario and Slam to say this is what we feel is appropriate for this period. 260 grand higher and I don't think that's Right. So if Ed and Slam won't sign it so we can do that. Correct. Cuz that's the Yeah. As long as they agree with it. Yeah. Yeah. Which they were Well they were on the call. John was on the call. They were all on the call. Yeah. Oh yeah. It's really up to Which you do agree to it. Yeah. Exactly. They don't get paid? They get

paid at all? At all. And what if they pull off the job? >> [clears throat] >> Excuse me. It could happen. Could happen. I don't know. I don't But just so you know that the subs I That's why I broke out purchase orders. So we know when the subs are supposed to get paid. And if they don't they call me and I call them and say you got to pay it because that's their money. We had an We had an incident with uh Fucci in the beginning with Liberty. Uh they owed him a couple hundred thousand. He was paid right away. So Fucci had to pay [clears throat] it right away cuz we knew they called us they didn't get paid. Yeah. So if this goes through and we agree Yeah. you'll notify Fucci tomorrow?

If he signs it. Yeah. We're having a discussion with them tomorrow. We'll talk about So he's going to take a look at it. So it could pass or could it get into his hands tomorrow? Yeah. Yeah. I mean I So I would deliver it on Tuesday. Or I'll have lift. >> [clears throat] >> Okay. So can I have a motion to approve Fucci's payment $220,884 contingent on on the on Fuji and Slam signing the A O E document. I would okay. Second, easy. Okay. Discussion. All in favor? I. Opposed? PCO couple of five PCOs. So, PCO 629 is an owner contingency cost of $10,585 $10,585. Um this is for work that was completed last year to bring additional electrical circuitry to the evaporator heaters and chiller units. Um 772 is allowance number nine for 120

journeyman hours for additional labor due to field condition coordination that was needed throughout the project. Uh we exceeded the allowance, so it hit up $3,060 to the CM contingency. 779 is our recurring monthly temporary toilet cost for the April period. 780 is a bond adjustment cost to close out of the miscellaneous metals contractor. Final payment is included in the current uh application contract closed. Uh 781, another owner contingency cost of $360. Um this is for the aluminum window contractor's bond adjustment. Again, final payment is included in this application and contract closed after this part. Have a motion to approve the PCOs. So, okay. I'm going to hand it down. Discussion. The uh Yeah. 629, that was a design miss? 629 is an interesting one. When we had lost, if you guys remember, we had to

install a replacement chiller cuz over the winter I believe it went from 24 to 25. The coil had cracked in the chiller and that is when we had discovered that nobody had powered up the evaporator heaters. And when we went to investigate it, um and we had worked through the spec with with Slam and CES and ultimately it wasn't on our power drawings and you know, there's been further conversations with Trane and CES about what was what would have been possible. Was it always possible to provide these, you know, through the chiller power or do they just need to be independent, you know, 120-V circuits from the house power if you will? So. Put that on. Okay. Next one, as you always get, you get my payment selection on Ammons. And then the last one

is Bills, B L Company, $300, $3,465. Have a motion to approve. So moved. Second that. Casey's. Any discussion? All in favor? Aye. Opposed? Aye. The next one is Tri-State, $844. Have a motion to approve. So moved. On the line. So moved. Any discussion? All in favor? Aye. Opposed? The last thing is the as I always do, the uh project budget summary with the uh two conferences, second page if you notice. Uh we do need to go into the executive session for especially existing potential litigation, mediation, arbitration, or administrative proceedings. But before we go, comments for the good of order, Doug. Thank you for all the information. Thanks for your patience and all the information. I appreciate it. John? >> I don't have anything to add. Thank you. Donna? What's that? I'll sit here. Okay, thank

you, guys. Thank you. What's that? Also. I do have a couple of things to add, if you don't mind. No, I do mind, but that's okay. Um Alice's birthday is in I know. Um Well, something came up today that I want to kind of investigate. I get asked about the girls in bathrooms in the middle school side. Um there's only one receptacle uh in the ADA stall in all the bathrooms on the middle school side. High school side, they're in every stall. Um feminine receptacles. Yeah, we We looked at We looked at that. Remember that in the fall? We looked at the drawings and we had put in the ones that we had missed. The high school did call for more of them than the middle school did, and we ultimately said we'd provide at

least one in that same stall in the middle school. Okay, so the I I do remember that. But but what you tell me is so the middle school, they're not going to be in every stall? No, they're not. They weren't supposed to be. My only question I have is code. I'm not sure if that meets the code or not at this point. Um Yeah, I remember like in the stall, Uh Uh it is law as far as receptacles go, not the actual products themselves where they put it afterwards. Afterwards. All right, so because we're we're we're finding an issue with only one of them in So Let's thing is to get that a little bit to see if they should be in each one of these stalls. Is this something that can be added? You

can always screw them to the wall. You can always put them in. Yeah. And how many more stalls are there? Well, I don't have to count them all. Probably 12 15 through the whole building. The only thing that I see a problem with that is if we do want to add more, if we did put in what we were supposed to put in is that I don't have a contractor anymore with the general trades [laughter] guy. Contractor David dissolved as a company and that's who we want these through. So, we wouldn't have that avenue anymore to do that. But let's confirm first that we have the scope right. Yeah, let's make sure we have the scope right. That's my question right now. They should have put them up themselves. Okay. Um Where did we end

up with um I think we asked this question. I think it was in the last minutes we had that. Um breaker number six that handles all the outlets in the middle school all the middle school gymnasium, the locker room, the bathroom [laughter] and it's also it's also controlling a heating transformer on the same circuit. >> [clears throat] >> We um if they haven't done it already, I thought you already got in there one early morning. Maybe I don't know he can talk to you Nick. They're running a separate home run for for just Okay, so you think you think it's taken off the It should not have been capped off of the water cooler next to it or any of the outlets that are in those PE offices, you know. So, we are running that

separate home run. >> Okay, that'll solve that problem. Um The high school drinking fountain I guess daily came up, but we haven't had any resolution on it. You lose. There was a leak, correct? Yes. But it I think it's repaired. You don't think it's >> not up and running. Let me let me check on that. The one in the high school cafeteria, right? >> in the high school cafeteria. Um The other thing is we're still every day and at this point we have TMS locker room ADA side TMS second floor caf caf bathroom and lower level toilets that are shut down because of the continual running or lack of. I think it's lack of. I think it's just running, right? Yeah, they at a certain point and then we have to go and shut them

off. Often. They repaired a couple of them. One of them they repaired a couple of times. So um I know we've been through this on both sides. I'm at a loss now which ones we repaired once, twice, three times. I don't have Yeah, we've repaired between all of them. I know you're talking about toilets between, you know, flushometers and sink faucets, we've replaced a lot of them and we're going to continue to do that. We're going to warranty for 5 years and, you know, it's the product that we were supposed to put in and, you know, if it's inferior if it's an inferior product then we just have to live with it for now unless there's another way out of it. You know, I we can talk to CES. I know you have you've been

talking to Zurn, your your friend, your your rep. Um has he said anything to you at all today at all? Uh no, other than other than giving us some new parts that are new and improved. So so he said it might so for 5-year warranty on the whole thing, right? That's labor and so so no matter what happens with these here a year from now who might come? You you that the binder that Matt Barber has given you in that electronic files here is contact information to reach all these various subcontractors and they all tie into the warranty. You call them J. Elliott at the end of the day. If they're not responsive to you then that's when we get involved but really when we leave, we're done with this job, that binder is your

binder. You're going to call all these numbers if you got a leak here or a leak there. If it's within the warranty then, you know, they're they're going to come out and do it. Okay. The flushometers are 5 years? I believe the flush flushometers are 5 years. I'm sure that the faucets are. I think it's all plumbing fixtures that the five year manufacturer is from from date of substantial I believe this is what this bathroom is. Five years from January or whenever they occupied in 2025 July of last year for the middle school and then area HB November 10th date. So you're covered for a long time and you know I'd love to not have to keep replacing them because it's a problem but I mean there's a I'm hoping they debug it eventually. I'm

hoping so. That's a problem on on the last like three jobs it doesn't matter what kind of flush hammer they're always some will continuously run some won't even flush the faucets go you know won't stop running or they don't run at all. It's you know it's a common thing with these photo eyes sensors and stuff it's just a very technical system. Yeah. Uh couple not a couple something about the feminine products. Connecticut state law states you must provide in middle school free accessible menstrual products including tampons and pads in the girls restroom. Okay we knew that. Schools are not mandated to install expensive wall dispensers but can be provided in disposable generic containers inside the designated bathrooms. I think disposable Oh not disposable. to dispose of Yeah. Got you. Okay. And it's inside the stall.

Yeah that makes sense. It's inside the ADA stall so there's only one in there and you've got four of the stalls in those bathrooms so there's nothing in there. That makes sense. Yeah. >> And there's none outside. And there's none out there's none outside. No and again you don't you you don't you don't want >> I'm just saying I'm just What does it What does it look like then? Just like a It's a trash can. stainless steel with a flip top with a flip top Mhm. Yeah, that's I understand. Yeah. Now we do. There you go. I was thinking dispenser, too. >> No, we take we take care of that. Right. You know? You got to Your vendor gives you the thing. Yeah, we we're also It's It's It's It's not that we're talking We're

talking about the mailbox. Jeez. Wow, right? I want to know mail. Post office, isn't it? Right? Okay, well Okay. And it's attached to the You just screw it to the wall. You just screw it to the wall. And and our supplier doesn't give us those, right? There's no chance. No, I don't I don't If If it was as simple as that, you know, I don't. Just want to keep moving. I'm moving. They don't want it, we have to do it. I just I want to find out before we go any further with it. Go on to Look at it. Yeah. Okay. Uh so, I have a motion to go into executive session. All we need is just John and uh The only thing is one item that you don't have to stay and you don't

have to stay. Regarding John. Just John. Excuse me. Can you let me outside for a Good night. Get out of We need a motion to amend the agenda. For what? I didn't Pardon? It says into executive session negotiations. Possible. Possible. Regarding Yeah. Possible or not regarding negotiations. Two sessions. We can join you. We're going to go to executive session. You, too. Thank you. Okay. Okay. just making a motion to do that in executive session with a change. I got that. Reading. Possible I'm dying in. Yes, I am. You want to leave it on for two guys, two people, and then come back? I I think I can do that. Say that again. I think I can do that. Okay. It's not going to take long. Give me 1 second. What's this? Let's stop that audio.

What's wrong? Okay. We are open. Open session at 6:12. And now what do we do? The next item. Yeah. Oh, move on. Move on. Uh we'll have to change the June 18th meeting. That's a graduation. >> It's right? Is that the high school? Did I get that wrong? >> Yeah, no, it is. It is. The 18th. Yeah, high school graduation. Okay. Probably so I will change the date. I mean next week yeah. And you'll let us know. Oh, yeah. September 29th. I should have. Okay. >> [laughter] >> Can I have a motion to adjourn? Owen. Second, Doug. Ed. 6:13. Right on. All in favor.
