Present. >> John Green. >> Here. >> And Bruce Elstein. >> Here. >> I think you've all got copies of the meeting from last month. I'd like to have a call for a motion to approve and also a second. >> So moved. >> Bruce. >> Second. >> John seconded. Have a vote, please. >> Yeah, I'm going to abstain since it until about an hour ago I wasn't going to be here, so I haven't looked at them. >> That's okay. The um So the first discussion item, and I guess Margaret you're going to present this, is the um operating budget update for the >> [clears throat] >> Water Pollution Control Authority. And I guess it's been adopted by the Town Council. And it's the May regular meeting. So I don't know if we need to go over
it. Um they didn't make any amend- amendments, did they? I think that's what Bill told me. >> They made no changes. And they adopted it on the regular May meeting. >> Okay. >> Just note, I spoke with Bill before the meeting also about that and we discussed it and he told me the same thing. Was adopted as is, no no modifications by the council, so. I think that covers it. >> I don't think we have technically a little housekeeping here. We list as new business out of town connection to the Trumbull Center Street Sewer policy. Um as you all may recall, at the last meeting we authorized Attorney Nugent to draft a policy and and he I think he's shared that with some of us and gone over it and we we have that policy
written. So, it's really old business, but regardless can someone bring that up on their screen? Margaret, could you do that or >> And Margaret, I have a question for you. Do you think we should read it into the minutes? >> Yeah, I think so. That's why I asked to be brought up. We'll let you read it, Mr. Nugent. >> Sure. My uh >> Yeah, I think you have to read it before we vote. >> Yes. >> Sure. >> Okay, go ahead, Jim, if you would, please. >> [cough] [clears throat] >> Well, this is the proposed um policy um regarding non-resident use or non-use of the Trumbull sewer system. Whereas, the Trumbull Water Pollution Control Authority, the WPCA, is under contract with the Bridgeport WPC BCA dated 7 1 16, which automatically renews for 3 more
years through June 30, uh 2029, and whereas said contract specifies that Trumbull is subject to maximum flow limitations and surcharges for exceeding that maximum, and whereas the contract specifies that the WPCA shall not convey wastewater from a municipality that is not a party to the contract without prior written consent of the WPCA, and that only wastewater originating in Trumbull may be delivered to the WPCA, and whereas the Bridgeport WPCA requires the Trumbull WPCA to appear in person at its meetings to request a connection for a non-resident, which the WPCA of Trumbull is under no obligation to do, and whereas the WPCA has been experiencing experie- uh significant increases in the usage of its sewer system due to the construction of and planned construction of several multi-family projects in the town of Trumbull with the potential
for more. And whereas a continued increase in the usage of the Trumbull sewer system has placed a significant strain on it and on Trumbull town personnel in maintaining and repairing the system's infrastructure. Now, therefore, after deliberation in this regard and considering the urgent and significant concerns pertaining to the operation of the WPCA, it is hereby determined as follows {colon} uh numeral one, effective immediately, future connections to the Trumbull sewer system will only be permitted for single-family homes with structures totally situated within the town of Trumbull or for commercial or industrial or MDU property owners whose building is at least 75% situated within the town of Trumbull as measured by square footage, period. Uh numeral two, connections from a Trumbull residence or building which complies with paragraph one above to another structure located outside the town
of Trumbull are not permitted, period. Uh numeral three, this policy shall remain in force and effect unless and until amended or rescinded by majority of the vote of the WPCA, period. >> Thank you. So, with that I'll open it up for any comments. If not, then I would turn >> Okay. >> I have just as I was seeing it read, hearing it read, it says in paragraph one, at least 75% situated with the town of Trumbull as measured by square footage. I assume that square footage of the building, not of the lot. And maybe we should clarify that. >> I I I think that's a I think it's a good idea. >> So I would propose adding by square footage of the building. or building >> Well, it says whose building is at least 75%
situated. So is doesn't that imply that it has to be the building? >> Whose building? >> The The property owner's whose building is at least 75% situated within the town of Trumbull as measured by square footage. So that the footprint of the building. >> I agree. Never mind. Good call, John. >> Right. >> I Technically you should have a motion to approve it, second, and then discussion um in case there's going to be an amendment. >> I so moved. >> Second. >> Have a vote. >> Well, do we We all set to vote? >> I I I think John's correct. I don't think there's a need for an amendment in that regard. >> Okay. >> Does anybody Does anybody Okay, now that it's been approved, does anybody want to make any amendments? I guess I'll
take that as a no. So the motion passes. >> Did you get Did you get the votes, Margaret? >> I I think it was everybody, but >> I I Sorry. I do need to know. >> sure that's the case. >> I'm sorry that I saw it as being unanimous, but we could call it by unanimous consent if you would like. Make sure everybody's in agreement. >> I believe so. >> I believe it's unanimous consent. >> Thank you. >> Okay. I I'll just note that this is not an ordinance. We may want to consider uh presenting it, which I can do, to the town council to adopt as an ordinance, which would have >> I think I think I think that would be a My opinion, I think that'd be a good idea. >> If the
commission wants to weigh in on that, I can I can get it on an agenda. >> If they make it an ordinance, would that change the last paragraph number three? >> Uh it would. Yeah. Except that they a future commission could vote and then bring that to the council. But it would have uh a stronger effect as as an ordinance. For that reason. >> All right. Do we have to then do something to make that request of the town council? >> We have to some We have to make a motion for Jim to present it to the town council for ratification or inclusion into the town ordinance. So, instead of being a just a water pollution control requirement, it would be a town ordinance. >> You can think about it later. It's It's not urgent,
but if that's the consensus, um >> If it goes for a town ordinance, is there any type of notice provision before it can be uh reached or anything like that? So, I don't know the law on that. >> You know, Margaret, I don't other than putting it on the agenda, um pursuant to state law requirements, I don't know that we have to do anything else. >> The noticing would be included in noticing the meeting, and um all ordinances have public hearings. >> Right. >> Thank you. >> [clears throat] >> Uh Uh pardon me, there's a hand raised in the attendees. I just didn't know where that would enter in during this um situation. >> The chairman to wants to if he wants to allow public >> Do you Yeah, please let them in. And announce
who they are. >> I'm promoting Christine Kurtz to a panelist uh with their hand raised. >> Okay. Uh we know Christine. >> Yeah, sorry. I didn't mean to jump in, but I wasn't quite sure where to uh >> That's fine. >> Hi Christine. Welcome aboard. >> Yeah, thank you. I was kept raising my hand. I I have a question for you on some of the wording. It's more to make sure um it doesn't mean an automatic approval, so to speak, on this um document that you're presenting. When you say um that it will be permitted, a building that's 75% within town the town of Trumbull, by saying it's permitted, do do you need to have a caveat that says as long as it also meets all the other conditions? Approvable by the town by by
you by the WPCI? >> It does say will only be permitted, but I think the point is well taken, Christine. Um >> It almost sounds required. >> Well, I I took that to the the only was the that that was the reason for the word only, I I thought. Um maybe I overanalyzed it. >> But maybe she's right. We add a clause that you know, to the extent that it otherwise meets the criteria used to approve. >> Well, you can change the word will to may. It may only [clears throat] be permitted for Um in which case it's not a guarantee that it has to happen even in the best of circumstances. So, >> It's a perfect change. >> Yeah, I agree. >> Fair enough. You need a motion to amend and a second. >>
a minute. Wait a minute. So, so you're going to change may to will? Will to may? >> Will to may. Yeah. >> In the first sentence of paragraph numeral one, right? >> Thought you lawyers didn't like may. That means it's it's not required. >> No. >> have the We have the right to the WPCA to approve it and not that we must approve it. >> Oh, I see. Okay, makes sense. So, and So, the language would be and I'm going to summarize it and not put it in legal prose. The that they have to meet all the other requirements of the WPCA. And I think we may want to add and and also are approved by the city of Bridgeport. Even though we we say that up front in the preamble that >> Well, but
this is talking about single-family homes with structures totally within Trumbull. They We don't need their approval for that. >> No, we're not >> Actually, Jim, there's an interesting question. I I thought about this when I read the original text. If it's 75% situated within the town of Trumbull, um and the access point is in the town of Trumbull, does does our contract require us to go to Bridgeport anyway? >> I don't see >> last 25%? >> I don't see why because it's originating in the town of Trumbull. >> Okay, in which case I think may is sufficient here and we don't really have to introduce anything about the a a requirement to go to Bridgeport. >> You may get to paragraph above the third paragraph? So, that's right out of the contract. I took that
language right out of our contract with Bridgeport. So, those are the uh limitations on on the um origin. >> Now, I I did put a little extra insert into what I just said when I said the building's 75% situated in Trumbull. And the connection is in the town of Trumbull, but seeing as our you know, we're not extending lines into to outside the town line, I still believe that's probably okay. Um it's sort of implied by the the existing language. Is that okay, Jim? >> Uh there's no harm in in amending it to say that. That the um >> I think the major >> to the building must be within town the town limits also. It's kind of belt and suspenders, I think, but no harm in it. You'd want to amend one to say
number one that it's uh the word will in the first sentence is changed to may, and then that uh the connection point must also be within the town of Trumbull. >> Okay. All right, except now I still have one more point. What What is I I know what that I think that language means. When we say connection point, uh I believe that's when it enters our system, correct? Uh as opposed to when it enters the building. Uh or or actually departs the building since we're we're taking outflows, not inflows. Um >> No, I think it's got to be the building, John, but the connection at to our system has to be within the town. We don't We don't have any system outside >> I understand. That's why I was saying I wanted to clarify what
the connection point meant. Um so who's I mean essentially it means who's Um What is the right word? >> to the What you want to I think what I think I think what you want to say is that the connection lateral is within the town of Trumbull. >> That's probably the best thing. Who's Who's connection lateral is entirely within the town of Trumbull, period. That means it it has When it leaves the building and when it enters our system, every all of that's within the town of Trumbull. That's your point, Frank? >> Yes. >> Works for me. >> And you're adding that at to the end of paragraph one? >> Yes. >> Yeah, we can add that last part to the end of one and then the the word changes in the first sentence. >>
Right. Okay. Thank you. >> you need to you We need a motion to amend though in a second to do that. >> Yeah, yeah. I I got that, but we just wanted to make sure that we're all happy. That's the only amendment we want to make at this time, right? We can always amend it later. >> I have one one question. Why is it necessary to put in that it's entirely within Trumbull? If the property if the Bridgeport says we can only connect if the wastewater originates in Trumbull, um doesn't that Why do we need to put that the connection occurs in Trumbull? It matters where it's originating. It's originating from the building, which is 75% in Trumbull. >> Uh >> Bruce, do you mean I think you technically you may be correct, but I
don't think the amendment detracts It may be a little redundant, but >> Okay. That's fine. >> But versus your point, you don't really care where the outlet is from the building because the building is 75% in Trumbull and presumably uh well, I I think it just keeps us safer, frankly, because we're we do have the issue of we're not supposed to be taking stuff that didn't originate in Trumbull. And from our standpoint, when it enters when it leaves the building and enters our system, that as long as that's in Trumbull, that makes sense. So, I I think it's just safer to to do it that way. >> I think we need to clarify the wording before we vote. >> Okay. >> You want to read paragraph one with the amendment? You want me to? >>
Sure. >> Okay. Effective immediately, future connections to the Trumbull sewer system may only be permitted for single-family homes with structures totally situated within the town of Trumbull or for commercial, industrial, MDU property owners whose building is at least 75% situated within the town of Trumbull as measured by square footage, and the connection lateral must be entirely in the town of Trumbull. Is that what you wanted? >> That's what we were talking about, yes. >> Sounds good to me. >> So moved. We got a mo- we got a second? >> Second. >> We have a vote. Raise your hand, please. >> Okay. That's unanimous. >> All right. All right. And now no more amendments. Well, any future amendments can always be taken up in future meetings. There is old business, and that is the sanitary connection
requests from the eastern residence. Um which I don't know if we have to vote on Jim because we now have an ordinance, but maybe we should because we had previously discussed it, but obviously the connection is denied based on the new ordinance. >> I think we have to So policy not ordinance yet. >> Right. >> Yeah. It's commission policy, but yeah, you're right. Somebody should just make a motion um in that respect. >> A motion to deny and a motion to second. >> So moved. >> Thanks, John. Have a second, please. >> After you, John. >> I'll second. >> Either way. >> Okay. We have a vote, raise your hand. Passed unanimously. Margaret. >> Thank you. >> Any other business to discuss? >> I I do have one question. Just going back to do you
want to vote to authorize the town attorney to bring this to council? >> Thank you. So can we have a So moved. Can we have a second? >> Second. >> Can we vote? Margaret, passed unanimously. Thank you for the catch. Okay. Any other business to discuss? Okay. >> Can I ask what Margaret, do you know when is the June meeting? Cuz I'm going to be away for 2 weeks, but I don't know if I'm Yeah, I'm going to miss that meeting, I think. >> You missed You missed June. June is going to happen Monday. So that's already been noticed. You would be looking at the July agenda. >> What do you mean June? Missed June. >> Which meeting? I thought we were talking about the council meeting. I'm sorry. >> No, no, no, no, no,
no, no. Our meeting. >> Our meeting? Okay. So sorry. Uh June 24th. >> Yeah, I'm not going to be here. So, um you guys go ahead and meet. Um I won't uh I'll be in Europe somewhere. I'm not sure um exactly where on the 24th. >> You could still attend the meeting. It's virtual. >> It's possible. >> [laughter] >> I think I'll be in I think I'll be in Switzerland on the 24th. >> I I think we could give him the night off. >> What is it? A 6-hour time difference? Yeah. >> 1:00 in the morning I get get on the stupid meeting. Give me a break here. >> I'm just kidding. >> [laughter] >> All right. So, then if we have no other business to discuss and um I don't know what the outcome
of Bill's final design meeting was for the pump station over by Canoe Brook. But I assume it's a go to finalize construction drawings, but I'll talk to him when he's back. Um >> He'll be back on the 9th. >> The 9th? >> Yeah, that's his first working day back. >> Okay. Well, he'll probably put it on the agenda for June. So, we'll see. But anyway, um other than that, do we have a motion to adjourn? >> So moved. >> A second? >> Second. >> John seconded. I voted. Raise your hand. It passed, Margaret. We'll talk to you Talk to you all at the end of June. >> Okay. >> Thank you. >> And thanks, Jim, for
