Kevin McCalpine is here tonight with his wife Morgan and family members. Uh he grew up in Palis Hills, attended Stag High School, Marine Valley, and then Western Illinois. He uh has been on

002the Worth Police Department for the last 5 years and comes with certifications as an evidence technician, a field training officer, and the AC task force. That's the internet crimes against children's task for children task force. Uh so we're excited to have him coming here and he is here tonight to be sworn in. So, as we do uh anytime when we have a a new officer being sworn in or we have a promotion, we've got a great group of our police department that is here tonight. So, we want to thank them for not only being here, but for all the great work that they do for us day in and day out. Uh certainly Kevin, I'm sure you know. And uh Morgan, where there you are. Um you'll know you're he's in good hands here working

003with fantastic men and women at the police department. uh a board, an administrator, a staff that are uh very supportive of law enforcement, most importantly, a community that's incredibly supportive of law enforcement. Okay, next up is our public hearing for the annexation agreement of Cedar Point. 006>> Thank you, Robin. >> Sure. Uh so Cedar Point is a 158 acre property, I'm sorry, a 78 acre property on the west side of Cedar Road south of Lairway Road. Um the proposal is for annexation, reszoning um and uh preliminary PUD plat. Uh this matter all these matters were before the plan commission um last month and did receive a recommended uh recommendation of approval on all three subject to the successful negotiation of an annexation agreement and resolution of staff's comments. So, quickly with regard to annexation, the property is contiguous to the Lairway Ridge subdivision to the west, uh um Taylor Glenn to the south, and then uh the property on the east side of silver of Cedar Road was annexed as part of the village station um annexation agreement 20 plus years ago. Um

007the requested resoning is R2A single family residence district for the majority of the property with the Cedar Road frontage being um uh recommended for R5 which is a three and four unit residence district. Um the preliminary PUB plat contemplates 121 lots for single family homes, 20 duplexes and 18 triplexes along Cedar Road. um as part of the PUD they are requesting some deviations from um the underlying zoning districts with regards to um set setbacks. Um none of these are unusual and have been approved for other residential PUDS in the village. Um they are proposing some improvements to the park site. So this the annexation agreement anticipates the park site being um a turnkey or have some improvements and no cash and loo uh donation would be required to the park district but all other taxing

008bodies would receive cash and move land donation. Um they did provide some preliminary landscape plans um for the detention ponds and the buffers along Cedar Road. Um and they will be required by the county to make some improvements to Cedar Road, some widening from layway to their entrance. Um they did provide some uh duplex uh elevations. Uh the all the buildings would meet our first floor brick requirement. And then this is what uh an example of the triplex. Uh so with regards to the annexation agreement, um staff did send comments to the petitioner. there was some provisions in there that either reiterated the village code or were not something that staff felt um could be supported. So, we did um provide them with some recommended changes. Um but this uh there are some utility extensions

009that would be required um both water and sewer um along um through the through Lairway Ridge as well as coming from uh through the Taylor Glenn Park site. Um and then there would also be some utilities extended along um Cedar Road. um they would they would be required to make a contribution to the village for proportionate share of the layway road relief sewer. Uh so that uh was one of the changes that staff recommended. Um but overall subject to um addressing staff's comments uh staff recommends approval of the annexation resoning and the preliminary PUB plat. >> Okay, very good. Mayor Balderman, you inspired me to be here today because in third grade, you came to my class and you showed me uh your village works for all of us. So, I'm I'm here to, you know, I work in New Lennox. I've lived in New Lennox. I I represent three taxpayers. So, I'm here to help make their voice heard. I'm actually not here to complain, which is the best part. >> That was third grade, buddy. I'll tell you. Go ahead. >> Yeah. So, you were telling us we were getting portillos, so you know, I'm sure that got out the vote. Anyways, uh I'm here not to complain, so that's a good thing. Uh I I like

011uh the bike path. I like that you're putting that along the combat corridor. I think that's a good thing. I think where possible, we should be doing that across the village. I ride my bike a lot. I uh go out three to five times a week, and I ride 10 miles. And a lot of the time, uh it doesn't really end up in New Lennox. I'll go and ride my bike to Moina. I'll go and ride my bike to Frankfurt. And uh when I do that, I spend my dollars there. I'd like to be able to ride my bike safely in New Linux and spend my dollars here. On route 30, we have a bike path uh a lot of curb cuts there, not the safest. So I'd like to see some residential uh bike

012paths and I know eventually down the line that'll connect into over by the Burkott and that'll increase the mobility. That's good. So staff comments not yet incorporated, I assume, which means in this version of the plat the bike paths are only six feet, not 10 feet yet. Uh that was a comment in the uh plan commission meeting. So I'd like in the future uh 10 foot width on the bike path is good. Six foot is a little narrow. There's all these kids out here with ebikes zipping around like crazy. And I have, you know, mixed feelings about that. But at least they're, you know, out in the world and not cramped in their room or whatever. They're not being criminals on these bikes. So I'd like them to be outside. That's good. But I also

013don't want anyone getting run over. You know, there's people that like to go out and walk with their kids, with their dogs. avoid any of that just by having a little bit wider path. Go in, build it right the first time. That's a good thing. The next question I have on that is uh maintenance on these bike paths. So, in the meeting, it mentioned that uh the bike paths inside the subdivision would be maintained by the HOA. However, uh at the same time, there is a bike path being uh built alongside Cedar Road. Is that being maintained by the county? Is that being maintained by the village or is that also being maintained by the HOA? First of all, the bike path is 10 foot. >> Okay, wonderful. >> What was the next question? >>

014Wait. >> Uh, the bike path along Cedar Road, is that maintained by the HOA, by the village, by Will County? >> Hold on one second. >> What? >> I was going to say typically if it's within right of way, and in this case, if it's within Will County right away, they would do an intergovernmental agreement with the village to maintain it. >> Okay. >> Along Cedar Road. >> Okay. Uh my next question is uh regarding these town houses. First of all, I like that we're doing them. Uh they look fairly attractive. I don't think anyone would really call these ugly. I uh I think the var the suggestion from staff for some variation and color palettes and design is a good idea. Help break it up, especially with there being, you know, more than uh

01520 30 units. U my main question regarding them is uh square footage per unit. Do you have an estimate? >> Well, at the public hearing, we don't we don't do that. You don't do any of that? No, no, no. you can just speak and then >> you know what so what'll happen so just so you know what'll happen is uh it's public hearing you're welcome to speak the developer will speak um and then there'll be first read we let people speak and then we allow people to speak again before but it's kind of premature at this time since there just got staff comments back because a lot of what you're asking may be addressed >> fair enough >> uh by them but you're still welcome to continue for back and forth. >> Yeah, that's why

016I think these should be these, you know, comments should be raised early. I'm not necessarily looking for a back and forth, >> but uh I would, you know, the they did mention cost. So, they said these would be about 500,000 plus per unit. So, that's why I think wondering about the square footage is somewhat relevant to the conversation. I'm hoping these are at least 1,500 square feet. That's really what I'm getting at. Uh I was raised in a townhouse, not really like this. I was raised in one of the quadplexes by Martino and off of Circleg Gate Road. Seems like all of those were built by the same developer cuz they're pretty monotonous looking, but uh those are somewhere in the neighborhood of 1,600 to 2,000 square ft. And of course, they were built in

017the '9s, early 2000s, but those were $200,000 when they sold. Not a luxury finish like this, of course, and not really comparable, but uh I'm just wondering how much value for our dollar we're really getting. Overall, I like it, though. That's really all I have to say. I like the bike paths. >> All right. Thank you. And we would encourage you, and I appreciate you being here. I'm glad that you came and spoke. 018I did want to mention I know he mentioned the bike pass and just want to mention that the board has been working with the county when the widening of Lairway. They are putting in a shelf and the village has been putting bike path along their way as it expands too. So the village has made that commitment. >> Yeah. And that was a deal that we made with it was going to be all on our dime and no longer is. We got that split correct 50/50 which saved the village a lot of money. >> All right. Good. Thank you. So, >> I could and and you got staff comments, so you're working you'll be working with staff. >> Yeah, we we received comments from Jeff last week. I think Brian took a first shot at revising plans. Um, making sure all those bike paths are as wide as you guys have requested. Um, I think they have a meeting tomorrow with the park district to finalize issues

Next up is uh consideration of an ordinance granting a variance for 111 Central Road first read. Rob? >> Yes. Uh so this is a home on Central Road just west of Cedar Road. It is in uh an older part of town, not part of the Wildwood subdivision. Um and they have made some improvements to the home uh including new sighting last year and approached the village to add a covered front porch. Um and when staff was reviewing that they noticed uh according to the Plat survey that the existing detached garage does not meet the uh minimum separation distance from the primary residence. So the home was

025a non-conforming use. um before they could uh make any further improvements they uh or expansions they needed to have the variance this variance addressed. Um the front yard setback would encroach into the front yard uh or the the front porch would encroach into the front yard setback. The zoning board of appeals had the final uh decision on that variance and they did grant that last week. Um but the issue before the board this evening is to um approve the variance to reduce the separation between the house and uh the detached garage from 16.2 ft to 10 ft. Um so that's what the ordinance included in packet. Uh there's reference to the front porch variance being granted. Um but the sole decision before you tonight is uh the building separation. >> All right. Is petitioner here

028on center and one um from Mon. The west side of the building would be fenced in uh storage area. Um landscaping is in compliance with the annexation agreement um for this plane trail industrial center and the building elevations are in compliance with the village code with um a masonry facade facing the two public streets. Um, and per our ordinance, uh, they had a specific amount of time to submit the fees and the letter of credit and have the final PUB plat executed. It has been extended a number of times since then, dating back till 2019. The developer is working with somebody and may have another um, developer that would come in and change the plan, but if that doesn't move forward, he is asking that this plan be extended um, for an additional year. Uh so this is a proposed hotel uh adjacent to the uh Winrust Crossroads Sport Comp complex on lot one of the um subdivision or the reubdivision. Um staff has been working with the petitioner for uh several months on the site plan and engineering plans. Um what you have is a 147 room hotel. Um the parking is in compliance with the village code based on the number of of um rooms.

032Uh landscaping is also in compliance with the code. And if you remember a few meetings ago, we approved uh or you approved um a PUD to grant some relief from some of the zoning standards such as uh the size of the parking spaces. So this is this plan is also consistent with that. Um it is a four-sided building. So, um the elevation on the top here is what you would see from um Cedar Crossings Drive. The um bottom elevation is what would be um facing Route Six. Although with the elevation, it's really only the top couple floors that would be visible. Um and in addition to the site plan, they are requesting a building code waiver to allow um basically Ephis on the majority of the building walls. Um there is some brick um components

033to it but this is uh this design is typical for hotels um in this uh in this area. Um and the building department or the chief building official did not have any uh concerns as long as it is done in compliance with the code. >> Very good. And the petitioners here tonight. I have a Bowling Brook home Hilton home to suit and I'm really excited when I heard about this opportunity to build this hotel here. And initially we were thinking about like

034a smaller hotel but with the mayor's support and everyone's support [laughter] and we keep on >> No, it's true. >> Yes. So, and we extended it up to 147 rooms. And Hilton is also very excited about it. And it's the two best brands, the Hometo suites and the Hampton in those are the best brands in in the Hilton. So, and we are and we are going to put a full-size bar inside um in the lobby which you normally don't see in the Hilton the limited service hotels >> and and I went there were a lot of people that obviously wanted to come to the site and I went to Bowling Brook to visit Arvin's hotel and he has extras that you're not going to see everywhere. I mean just a quality quality hotel developer. A

035beautiful property. Um we're really excited to [clears throat] do business with you. We know it's going to be a great addition uh to our town here. Um so this reubdivision plat shifts the property line a little bit to the west to accommodate the hotel footprint. Um and all of this was done when he closed. Um but just to clear it up and have it consistently on one

038um plat of subdivision going forward made the most sense. And then the plat of vacation, if you recall, there were some utilities that were relocated. So this uh plat of vacation um removes that area of the property from being encumbered by any easements for utilities that are no longer there. >> Very good. Any questions for Robin? 061events as well to kind of learn more about what all of the departments do. So they go on facilities tours. um they will go and meet some of our Ka like the K9 units and just other fun activities like that um to get more involved and become more knowledgeable about the community and applications for that program open this upcoming Friday. 063that we did have been seen uh nearly a half million times. Um, it it was really uh what we were doing here was emulated by towns throughout Illinois. We I got a lot of phone calls from mayors in other places, from a lot of legislators. On the Sunday of the last legislative session, I talked to some state senators and reps that were calling me, filling me in on what was happening throughout the day. Um, this was not about defeating a political agenda. We don't do that. This was about preserving our opportunity to do what's best for our communities. Um, when this all was proposed, uh, Robin did a an excellent job of going through, uh, that proposal and providing me with information on where we would see issues here in town. We were able to

064spread that word uh, throughout the state. It took off. But more importantly, uh not just staff members, not just elected officials, uh the reason that this entire plan went down in flames and it went nowhere was because the people got engaged and people think you can't fight city hall. My voice does not matter. They're going to do whatever they want to do. Pockets are being lined. I'm going to tell you, other than the last one, because we don't like to make those accusations, people aren't wrong. People aren't wrong. Especially at levels of government at the state and the federal level where you don't have an opportunity to interact with your elected officials, especially at those levels, especially here in Springfield. Things have been done in the middle of the night. plans have been attached to

065bills, trailer bills, just forced through. One thing has nothing to do with the other. We've seen our rights eroded in solar. We've seen it eroded in internet and what can and can't be done. This would have been the most egregious. And mayors, board members, and staff members and and our cogs are constantly fighting these battles. But as a state legislator, you hear from a few mayors or you hear from the cogs and then you have the powerful billionaire and the powerful lobbying groups that are in their ear and it's unfortunately sometimes it gets difficult for them to listen to us because the the community the citizens are not engaged. Well, they were engaged on this by the thousands throughout the entire state. People were picking up their phone. They were emailing. If they did run

066into legislators, they were telling them. They really, really did it. And normally, if there is some progress, it's in the form of compromise. And we get screwed. It's just a matter of maybe you don't get screwed as badly as you would have. In this case, nothing happened. Nothing. They couldn't even muster up, and when I say they, the governor's office could not even muster up enough votes. They broke the build plan down to eight different sections. There were five of them that were not that objectionable that we would have said, "Well, okay, as long as we kill the other three." They couldn't even muster the votes for those five because of what happened. And I will tell you the credit goes to the people, but quite honestly, the loudest voices came out of here and

067we had we really started something special. And when I heard from legislators that they were telling other mayors uh around the state, do what they're doing in New Lennox. That makes me feel good that we had a lot of success. So very early on, Robin, thank you for your hard work on that. I appreciate it. You really gave me a lot of ammunition. Board, thank you for spreading the word out through the community. I really that was very, very impactful for us. Uh, but we said we'd give an update. Here it is. Now, in the veto session, I can assure you for the very same reason that this was brought up, which is a political agenda because build plan does nothing to address affordability or shortage. This will come back after November elections. when people

068are securely in their seats again and they feel like, well, I'm not up for two years. I'm not up for four years, depending on the office. People will forget if I pass this disaster. We cannot let up. I watched a governor at the National Board of Mayors conference and you expect dishonesty coming out of some politician's mouth. But when I watched him sit there just a couple weeks ago and he was asked a question about the importance of relationships with mayors and he talked about how critical it was and how happy he was that he has that type of working relationship with mayors in Illinois. It's not true. We were completely cut out of this process. And not only were we were we cut out from the beginning when our cogs asked to have a

069seat at the table, they were dismissed. It wasn't there wasn't even okay, let me hear what you got to say. I'm not really listening, but I'll pretend. There wasn't even any pretending. It was get lost. This is what I'm doing. I'm in charge and the legislators are going to do what I say. But it didn't happen. legislators across the state were able to push back and say, "I can't do it, governor. I'm sorry. I can't do it. Realators lobbying group, even though so many realators on the ground were opposed to it." The mucky mucks at the top weren't, and we know why, because that's the games that people play in politics. But the legislator said to the governor, "We cannot support this. People want no part of it. They could not even find compromise. And

070we pushed on the mega projects bill and that went nowhere because the people were saying, "No, you're not taking our tax dollars to pay for a billion dollar corporation." So like I've never seen in the 25 years that I've been elected to serve people in one capacity or another in this town. The voice of the people was heard loud and clear and was extremely effective, more effective than me and any group of mayors could ever be, ever be. But we can't give up on this. Now, we're told we're going to have a seat at the table, and that's good. But we cannot give up local control on what happens in our communities. We have to work on affordability and housing shortages. The whole country does. But we cannot give up our rights to local control.

071And the most insulting thing talking about threats to democracy, the hypocrisy that comes out of that office saying the federal government is a threat to democracy. When the governor's plan said no nuisances like public hearings, his words that a public hearing is a nuisance. the ability for the people who live in this state to be able to come to their elected officials and stand before you and say they support or oppose something he considers a nuisance. And the build plan was saying to the people, we're not interested in what you have to say. We at the state level will decide what's best for you. It's insane. But I think because what we have seen happen so many times at higher levels [clears throat] of government that nobody really is aware and nobody pushes back, this

072kind of crap gets passed all the time again in the middle of the night. like the bloated budget, $59 million budget that was 3,500 pages long and the legislators had a couple of hours to look at it, which includes another billion dollars in taxes and fees and unrealistic revenues. It got pushed too far this time and the leadership in Illinois woke the sleeping giant and that is the people. They have had enough. They are taxed out of their homes. There was no relief in sight for them. It's never ending fees. It's never ending taking away from local authority. And this was a big we don't care what you have to say to the public. And they heard it. They heard it. So again, to staff, to this board, to our community members that reached out

073for me, and I'm sure they reached out for many of you as well, and said, "I called my senator. I called my representative. I called the governor's office." It was phenomenal. I have never been so proud to be a part of something that was so effective and I really hope that people stick with it. I have seen younger people say I saw something that was so disheartening young this younger generation said that they are realizing that voting today is the adult version of writing a letter to Santa Claus. That's what they think about voting, that it doesn't matter. That's horrible. And the reason they think it doesn't matter, and I don't blame them, is because this garbage has been shoved down their throats from government for too long. But if this can be the catalyst

074to prove to people that their voice matters, because I promise you, wasn't my voice, wasn't your voice, wasn't some other mayor's voice. It was the thousands of phone calls and emails that made the difference. Their voice matters. It really does. And it's our job to continue to engage the people our guy here who showed up today. I get asked all the time when I go, you probably remember this, when I go to classes, kids ask me, "What's your favorite part of being mayor?" And I say, "Doing this, coming to talk to kids." And I mean it. Because if we don't inspire those generations to get involved, to get engaged, they're just going to tune it out. Tune it out. They're anxious. They see no hope, but there is hope. There is an opportunity. And I

075love that you were here. And thank you for telling me that I came and spoke, even though you made me feel old, that I came and spoke to you in the third grade, because that's what we need. We need people engaged and speaking up. So success, we can't rest on it, though, because we got another big fight coming in the veto session. So get ready for more. Obviously, that's been like a forever thing, so who knows if they'll actually come. Not to, you know, talk down on that. I hope they do. I really like that, actually. 48 units right there. uh if they, you know, sell for half a million dollars, three quarter of a million dollars, you're talking about 24 million, $36 million worth of, uh, assessed property tax revenue in a pretty tight space. So, that's good. Uh, the other thing I'd like to mention, uh, in one of the previous recent trustee meetings, we signed an agreement sending a new Lennox police officer to our, uh, schools, District 122,

082as a school resource officer. Again, to take it back when I was in school, we had a police officer come and uh he did Operation Lifesaver. We have a lot of railroad tracks in New Linux. New Lennox, I mean, has its foundations in the railroads. Obviously, that's how a lot of towns came to be. And uh with the quiet zones popping up everywhere, we have a lot of uh railroad crossings where there's parks directly adjacent like on uh Illinois Highway or where there's a path on either side but no pedestrian crossing gate like on Joliet Highway or on Nelson. On Nelson there's no direct connection right there. But either way, I think it would be good to have a course this takes cooperation with the school district and probably would be more coordinating on their

083end than on your end. But I think it would be great to have a new Linux cop go out there and uh say, you know, see tracks, think train, stop, look, listen, all that sort of thing. And uh that's pretty much it. I'd also like to thank uh the board and you, Mr. Mayor, for your time here. As you can see, we have a packed house. Everyone in New Linux is here for the board meeting. Second thing, my son has been in travel baseball for a long time and uh since the sports complex is open, we have not had the opportunity to have a uh to be a a part of a tournament there. We've had games at night uh during week nights and obviously it's not the same experience but two weeks ago we finally had one and uh I just want to say it was just a great experience um you know to friendly service at the concession stands to uh people driving around on golf carts selling hot dogs and drinks so you

085don't have to walk to the concession stands everything was clean um you know not only myself but the people that I was with the parents who live in New Lennox they were all proud to be there and say that this is in our town.
