call this meeting to order. If everyone could please stand. I had the opportunity to meet with some great young people from town from PAC 94. They are earning their community badge today and they asked some wonderful questions. They are here to lead us in the pledge of allegiance. So path 94 have >> to the flag of the United States of America and to the republic for which it stands. One nation under God, indivisible with liberty and justice for all. >> Thank great job PAC 94. Have a good night. Thank you. Okay, roll call, please. >> Trusty Matson, >> here. >> Trustee Scaliz, >> here. >> Trusty Galuza, >> here. >> Trusty Riser, >> here. >> Trusty Christopherson >> here. >> Trusty Wilson >> here. >> Mayor Baldin >> here. All right. First up is uh

recognition of our citizen academy participants. As I said to them about an hour ago when I met with them, and I'll say it again, we not only here at the village, but all of the governmental bodies wish that everybody could find the time to participate in this uh citizens academy. We are very proud of the work that we do. The schools are proud, the park district, the library, everyone's very proud of the work that they do. And um as is the case with every walk of life, not just ours, often the criticism that you hear is based on misinformation. Uh just not really knowing what's going on. Um as the mayor, um I love to hear other people's opinions if they're informed uh opinions. if they just have a difference of opinion from myself or

from our board and what we're doing. That's the great thing about the country that we live in is everybody can have that. But there's nothing more frustrating than working hard for a community and being attacked with misinformation. This citizen citizens academy is really meant to not to find people to jump on board with our agenda and what we're planning to do, but to become informed citizens, to know how your local government works. Everybody talks about what's happening in Washington. I promise you the decisions that are being made within the borders of this community affect you more dayto-day than anything that's happening or not happening in Washington or Springfield. Your property taxes in this godforsaken state, which has the worst property tax structure in the country, go to local governments. And people are really upset about

that, about their property taxes. and they should be because our structure here in Illinois is horrific. But it's often the locals that are trying to provide the services that get the brunt of the anger for people who are paying high property taxes. You go through this and you realize, for example, that although the state of Illinois by constitution is required to pay for a majority of public education, which which would be 50% or more, in this town they pay about 12%. Which means that you as the local taxpayer are picking up the rest of your education because our state fails us. But you come out and you learn what's happening. You learn who's responsible for what. People used to say to me, "Mayor, why don't you open the library on Sunday?" Because I don't have

anything to do with it. Library has their own board that you elect. Now, I will also say, as I said not that long ago, in this community, we're very fortunate that all of the governing bodies work well together to serve you. And we're very fortunate that we have an incredible community of small business owners and residents that care. And for you to take the time out of your lives to participate in the citizens academy, it says something. It really does. You didn't do it because your board had nothing else to do. There's plenty you could do with your time, but you cared enough as citizens to become informed. And what we hope is that a you found it worthwhile. I certainly believe that you did or you went and stuck it out and b that

you pass the word to others that they should try and find a time to participate and c that when you're having your Thanksgiving dinner or whatever it is and the topic of conversation comes up, you are now more informed and you can share an informed opinion on why things are the way that they are and we can't ask as your representatives. We work for you. We can't ask for anything more than for you to take the time to find out what's really happening and to share that information. That doesn't mean you have to agree with what we do. That's okay. But at least you'll know the right questions to ask. And if there is some politician that's full of it, you'll know because you know what they're supposed to be talking about. We want you

informed. So, thank you uh for being here. And for the family members, I like to say this too. Um your loved ones took time away from their family too to come participate in this to get educated. So, thank you for understanding that as well. Now, um Elena Murphy, thank you. Elena put this program together and and really has built on it and done a tremendous job. Of course, uh each and every one of our staff members participates here. Same with the library, the schools, the park. There are so many good staff members and board members in those other places that participate. They're not required to participate, but they want you to know what they're doing as well. So, Elena, thank you to all of our people that are here. Thank you to all the other

boards and employees in town. Thank you uh for putting that in. Um but for all of you uh again, we hope you found it worthwhile and we're very very grateful that you are concerned citizens and now you're hopefully more informed citizens. So we will pass out these certificates. Elie, you want to step on What you learn very early, it's one of my quirks. Um, what you learn very early as the mayor is you don't read people's names if you don't know who they are. So you pass that off to the person with you so you don't pronounce someone's name wrong. Elena, you go ahead, read them up and I will I I'll start to help you. Amanda Milton, >> thank you very much. >> We have the right to use this for our marketing purposes.

Anthony Kramer, >> thank you very much. Thank you. There you go. Thank you. >> I know. bath. Come on. >> See, sometimes you know some people that are coming and I'll look >> and we have hope right now. >> We should have something. >> But do we have a certificate? We'll get you. >> We'll get We'll get >> I think we have here. >> Thank you. >> Good to see you. >> Nice to see you. >> Thank you guys. >> Bob Kinski. Of course, >> Gary Capers. Gary's been around. See, Jeff Warren You're welcome. >> Thank you, >> Jennifer. Mar, >> thank you. >> Hi. How are you? I'm awesome. Here you go. Thank you. Thank you, >> Karina. Bravo. You >> Thank you. >> Lori Ward. Thank you. I think you're a great job,

>> Martin Heris. Maryanne Bondana. Marianne, how are you? Maryanne has been fighting for years about burning, illegal burning, not in the community because we banned it, but in the county. She has been, her and her husband have been very active citizens in this town for a long time. come to meetings don't just complain. They take on a cause and they and they work toward it. It's wonderful to see you here and we appreciate everything you and your husband do. There you go. Please >> was great. Thank you. >> Thank you. >> All right. All right. Mercedes Geral. Is that wrong? >> What do you know? Not bad, huh? There you go. Mercedes, did you think I was going to scroll up Mercedes or did you think I was >> I don't know. >> Thank you.

>> All right, Renee Crowley. >> I want to open it. Thank you. >> There you go. I'm going to open it. >> Oh, you want to open it? There you go. >> You think I was I giving you the right one? Now I know why it says troublemaker on there. >> Thank you, Renee. All right, Susan Ren. Nice. Thank you. >> All right, here you go. Thank you very much. All right, William Len. Very good. >> You did a great job and you're doing a great job. >> Well, thank you. I appreciate that. Here you go. >> Very good. >> Thank you. Ela, anything you want to say? Go ahead, please. >> Just thank you to all of the participants for your dedication to this program. Um, watching you guys want to learn and grow

and become better citizens has been truly inspiring. I've loved getting to know each and every one of you. Um, and thank you again. I hope you take this information and become better community members as the mayor said. Uh and I also want to take a moment to thank all of the taxing districts who presented as well as all of our wonderful village staff for presenting. Without you guys uh helping with these presentations, this program wouldn't exist. So, thank you to not only the participants, but all of the presenters as well for making this program as successful as it is. >> Thank you. All right. Now, you're all certainly welcome to stay if you like, or we understand you've given enough of your time to the village. If you'd like to leave, thank you again for

participating. Either way, we appreciate you. >> All right. Next up is our 2025 tax levy. Kim, >> uh, yes. I'm here tonight to announce the 2025 tax levy. Um, it is, um, $4,8,610. Um this does comply with the property tax extension limitation law or tax cap as we say. Um this was we are not required to follow the tax cap how as a home rule community but we made a pro uh promise back by in 2008 that we would follow it um follow the tax cap. Um the levy itself um is a compile it it it compares to last year's levy. It's 200,000 $29,000 more which is 5.51% increase um which requires a public hearing in December um at the December 10th meeting. Um the levy itself um is comp does pay for IMRF a

portion of IMRF portion of FICA expenses and police pension expenses. Um the growth um that the village is expecting in the levy uh equalized assess value is about 36.3 million. Um that is uh that information came from Bonnie Hernandez the new tax assessor as um and uh what else could I share with you guys? Um the CPI which is the cap that the Illinois Department of Revenue puts on the tax levy um is 2.9%. And the equaliz equalization factor um which adjusts residential property taxes um is 6.9%. All of those uh factors helped us dive at the amount of $4 bill8,610 for the levy. If you have any questions, I'm willing to answer them. >> Anything for Kim? All right. Very good. Thank you. All right. Next up is a public hearing, vacation rightway, Elm

Drive alley. Madam clerk, you have proof of notice. All right. Very good. Is there anyone here that needs to be sworn in that's speaking on this public hearing tonight? >> Nobody. Okay. Robin. >> Um, yes. Uh so the previous property owner of this uh of the parcel to the north of here um entered into a license agreement with the village many years ago when it was found that their driveways lo located predominantly within a village rideway. Um as you can see here um there's now a new owner um and the request is for us to vacate the rideway. There is a sanitary sewer that runs along the south portion of the rideway which is an unimproved alley. Um so we would vacate the rideway but maintain an easement uh 10-ft easement along the south um

area in order to keep the sewer. Um but as you can see the alley does not extend further east or west of this existing home. Uh so later on the agenda is the first read of the ordinance which would vacate the alley and transfer ownership to the property to the north. All right. Any questions for Ramen on that? There's no one to speak. All right. Then we'll close the public hearing. Next up is our consent agenda which consists of five items. They are the ordinance authorizing release of surplus surplus property owned by the village of New Lanx Police Department vehicles. SH reduction Channon states unit 7 approval of purchase two police department replacement doors and raffle licenses for 2026 for the VFW post 9545 and for re for veterans. Does any member wish those items

to be pulled and discussed separately? >> Okay. If not, is there a motion to approve the consent agenda? >> So moved. >> Second. >> Motion by Trusty Madson, second by Trusty Scaliz. If there's nothing further, roll call vote, please. >> Trusty Wilson. >> I. Trusty Christopherson. >> I. >> Trusty Matson. >> I. >> Trusty Galuza. >> I. >> Trusty Scaliz. >> Hi. >> Trusty Riser. >> I. >> Mayor Baldin. >> Hi. Motion carries. All right. Next up is consideration for approval of an ordinance granting special use for preliminary and final PUB plat patio southwest corner of US Route 30 and Prairie Road. Second read. Robin. >> Yes. Uh, this was before you for first read at your last meeting. Um, so I'm just going to touch on a couple of the changes that have been

made since that time. Um the site plan is uh has remained largely unchanged. Um there was some discussion of moving the electronic message center sign on along Route 30 um further to the west, but that would have put it too close to the existing electronic message center sign for Joey's. Um so the plans, some of the plans need to be revised to be consistent. Um, one of staff's recommendations was that additional 6- foot tall evergreen shrubs be planted along the south property line, uh, where, uh, those parking spaces would face the existing residences to the south. Um, while they did extend the, uh, Evergreens a little bit further to the east, there's still a gap that staff would like to see, um, filled in. Um, they did make some changes to the signage. Um the

sign along at Route 30 and Prairie was increased in height uh just under three feet. Uh they added additional uh drive-through wayfinding sign and then the overall square footage while it did increase is still in compliance with uh with the village code. Um and then if you recall on uh more centered on the site on Route 30, they had proposed a sign that was strictly an electronic message center. um they have revised that, made it a little bit a little bit taller and added a business identification sign and a drive-through wayfinding sign. Again, even though these uh changes do result in a taller and larger sign, it is in compliance with the zoning ordinance. Um the uh wall sign on the rear elevation did not change, but it just to recall it is uh illuminated

a little different, so it does not negatively impact the residences. Uh the building elevations remain unchanged as well. Um so subject to uh some of the discrepancies between the engineering plans and the site plan regarding the placement of that electronic message center sign on route 30 and the addition of um additional evergreens. Staff is presenting the ordinance um for village board approval tonight. >> All right. And the uh petitioners here tonight, is there anything that they'd like to add? Anything you want to add at this time? No, no, thank you. >> All right, board, if you don't mind, it's uh although we're not required to do so, I've always allowed um the community to speak before we take votes, even at a second read. We do have one member of the community that signed up

to speak. Um Matt Clark. >> Oh, uh hi. Uh sorry, I thought I might have to speak, so I just put a card in in case. Uri >> Let's go, Matt. You have to You have to speak now. >> You're all good. >> He's the architect. Thank you. >> He's all good. All right. Well, then I guess Matt has spoken. >> All right. Board comments or questions? >> Matt, looks great. >> Nice job. >> Thank you. >> Anyone else? No, it it really does uh look fantastic. Uh we're excited about um the patio expanding out into this community. It's been many years, I know, since you've built a new restaurant. Um you and your family, your reputation uh precedes you certainly. uh not only great food but just a great family and great business owners

and that's who we like to see developing in our town. Um you've also been uh wonderful in working with neighbors that had concerns as we work through the plan commission as we work through the public hearings and we talked to people. Uh so um even even all the way down to that malberry tree whatever that is and wherever that's going I don't know but um that's who we like to see here. So, I know the community is incredibly excited about seeing you go. Steve, do you feel comfortable at all talking about um a timeline? >> Uh >> because I will tell you that we will hold you to it. If you come on up, Steve, if you don't mind, because people are excited um and and anything can happen in your world, of course, but

if you've got if you've got a tentative timeline. >> No, just you know, thank you everyone. We're really excited about the project. So, uh we're trying to get it going as soon as we can. I know I think our architects resubmitted the um the permit application. It's in the process of submitting the permits for to get started with the the site and the foundation. So if everything goes right, we're I think hoping to break ground sometime in December. >> Okay. >> To get the project started and then we're figuring roughly six six to seven months. So sometime late summer, fall of >> ideally, yeah, if we can, let's say August, September, I think would would be ideal. >> Yeah. Weather has to cooperate and >> everything's got to work out. But so 2026, uh, open

>> for sure. Yeah. >> Fantastic. We're excited. Thank you so much. >> Thank you, mayor. We appreciate it. >> Appreciate you. >> All right. If there is nothing further, is there a motion to approve the ordinance granting the special use for preliminary and final beauty plat for the patio? >> Second. Motion by Trusty Madson, second by Trustee Riser. Any other comments or questions? >> Roll call vote, please. >> Trusty Riser, >> I. >> Trusty Matson, >> I. >> Trusty Galuza, >> I. >> Trusty Scaliz. >> Hi. >> Trusty Wilson, >> I. >> Trusty Christopherson, >> I. >> Mayor Balder, >> I. Motion carries. Now we have consideration for approval of setting shy for the patio. Will. >> Yes. Thank you, mayor. Uh, so like to set for the public improvements for the project. You just

talked about the patio in the amount of $514,34.50. >> All right. Very good. Any questions for Will on that? >> Is there a motion to approve the setting of shity? >> So moved. Second. >> Motion by Trusty Scaliz. Second by Trusty Gala. There's nothing further. A roll call vote, please. >> Trusty Madson. >> I. >> Trusty Riser. >> I. >> Trusty Gala. >> I. >> Trusty Wilson. >> I. >> Trusty Scaliz. >> I. >> Trusty Christopherson. >> I. >> Mayor Baldin. >> I. Motion carries again. Thanks very much, guys. We look forward to working. Appreciate it. >> All right. Next up is consideration ordinance creating a class A liquor license for Queen of Hops. This is uh in at Hog Wild. The background check has been um completed and there are no issues. Um there

were they looking to move or it doesn't do we have a representative here on this tonight? Do um is there anything you want to say or just let it go through the normal process? You're good to go. >> Yeah, don't worry. >> All right. Very good. Any questions on that? >> All right, then we'll bring it back for a second read. You don't need to uh be present for that if you don't want to. Okay. All right. Very good. Thank you. All right. Next up is consideration of an ordinance vacating an an alley extending west of North Elm Drive south of the property known as 10001 North Elm Drive. First read. Robin, >> this is just the ordinance that goes with the public hearing. So, if there's no comments, we'd bring it back for second

read uh in two weeks. >> All right. Very good. Thank you. All right. Next is consideration for approval of final plat gas and wash lots six and seven Spring Creek. Robin. >> Yes. Uh so the next three items sort of go together. So um this gas and wash uh would be lots six and seven of the Spring Creek commercial subdivision on the north side of Route Six just north of Silver Cross Hospital. Um they because they are taking two lots and there are some platted um setback and easement lines along the common property line. This new subdivision would um remove those easements and uh allow the project to be done on one zoning lot or on one uh legal lot. So staff has no comments um on the final plat. The plan commission reviewed it

um in October and recommended approval. Um our only condition is that prior to uh issuance of a building permit for the gas station that the final plat be recorded um and provided to the village. >> Okay. Anything else on those three items at all? >> Yeah, go ahead. >> Okay. Um then the second item is an encroachment agreement. Um the proposed site plan does show a portion of a drive aisle extending within an existing easement that was granted a number of years ago for uh water main and sanitary sewer. Um you can see in red the area of encroachment. This is a similar situation to uh what the board approved with one of the solar companies along Spencer Road in the Spencer Road water tower. Um so the agreement just says that if they harm

any of our utilities or if we need this to be removed in order to maintain our utilities, they would be responsible for replacing the drive aisle. And then lastly is the site plan for the gas and wash. Oops. Um, so, uh, it includes a car wash with, uh, vacuum, uh, 24 vacuum stalls. There's a vacuum enclosure, a shed for storage. The convenience, uh, store would have two drive-thrus, one on each end. Um, and then the gas canopy for 12 uh, gas pumps. Um, this is just a colored rendering of the site plan. Landscaping is in compliance with the village code. um signage. There would be signage for the restaurants, which are at this point unknown uh who those tenants would be, but there would be adequate signage for them, similar to what you've seen. Um

and then as well as on the monument sign, um the proposed building elevations along the base show a st a stone product that does not meet the minimum thickness specified for masonry in our village code. Um, so they are asking for a building code waiver to allow that to be used. Again, it's just on the base. The majority of the building does uh comply with the code. Um, and I know um the representatives are here if the board has any questions. >> Does a petitioner wish to add anything at this time? >> Uh, no. >> You're all set. >> No, Mr. Nothing at this time. >> We're here to answer questions. >> Absolutely. We appreciate that. >> Thank you. >> All right. Any questions or comments from the board? >> All right. I would just

start out by saying obviously um some of you were here when we imposed the gas station moratorum. Uh that's important. However, when we did our our study and we looked at it obviously up north, especially with the addition of the sports complex, there's only one gas station. So, there was still a need uh up in that area. I will say that um Gas and Wash, in my opinion, does a phenomenal job. They run a great station. Their their stations are always clean. Um they always are built with quality. Um you know they're they're they're good to have uh in town. They do a really really nice job. So uh um I think it's great to have them up there. And uh with the amount of cars that we see at the hospital and the sports

complex and as you know the hotel development, everything that's coming, there's going to be a need for that. All right. So if there's Lyman, nothing else? Everything's good then? No other comments or anything? Okay. All right. If if there is nothing else, then we'll take these one at a time. Is there a motion for approval of a final plat for gas and wash lot six and seven Spring Creek? >> So moved. >> Second. >> Motion by Trustee Madson. Second by Trusty Scaliz. If there's nothing further, a roll call vote, please. >> Trusty Christopherson. >> I. >> Trusty Guza. >> I. >> Trusty Scaliz. >> I. >> Trusty Wilson. >> I. >> Trusty Riser. >> I. >> Trusty Matson. >> I. >> Mayor Baldin. >> I. Motion carries. Next, I need a motion for approval of

resolution authorizing and approving an encroachment agreement for gas and wash. >> So moved. >> Second. >> Motion by Trusty Riser, second by Trusty Gala. If there's nothing further, a roll call vote, please. >> Trustee Wilson, >> I. >> Trusty Christopherson, >> I. >> Trusty Matson. >> I. >> Trusty Galooza. >> I. >> Trusty Scaliz. >> Hi. >> Trusty Riser. >> I. >> Mayor Baldwin. >> I motion carries. Now I need a motion to approve the site plan and building code waiver for gas and wash. >> So moved. >> Second. Motion by Trustee Scaliz, second by Trusty Christopherson. If there's nothing further, a roll call vote, please. >> Trusty Riser, >> I. >> Trusty Madson, >> I. >> Trusty Galuza, >> I. >> Trusty Scaliz, >> I. >> Trusty Wilson, >> I. >> Trusty Christopherson, >>

I. >> Mayor Baldin, >> I. Motion carries. Thank you, Dick. Nice to see you. Appreciate you. >> Take care. >> Okay. Uh, next up is consideration for approval of setting insurity for the gas in Washington at Spring Creek. Will. >> Yep. So, uh, for for that, uh, project, we're looking for shity for the public improvements in the amount of $449,845. >> Any questions for Will on that? >> Is there a motion to approve the setting of Shy? >> So moved. >> Second. >> Motion by Trusty Scooy, second by Trusty Wilson. If there's nothing further, a roll call vote, please. >> Trusty Madson, >> I. >> Trusty Riser, >> I. >> Trusty Gala, >> I. >> Trusty Wilson, >> I. >> Trusty Scaliz, >> I. Trusty Christopherson. >> I Mayor Baldwin. >> I motion carries. Okay.

Next is consideration for approval of site plan for Dutch Brothers Coffee 550 West Maple Street. Robin. >> Uh yes. So this is a proposed for a drive-thru um only restaurant for um just west of the Thornton between Thornton and McDonald's. Back in June, the board approved a special use for an outdoor patio. So there would be a walkup window with some minimal seating um but no indoor seating. Uh so the proposed site plan does comply with the zoning ordinance requirements. Uh they do provide for a substantial amount of stacking spaces prior to the menu board, a double stacking uh configuration that then does get down to a single stacking lane after they placed the order. Um landscaping is also consistent with the village code. Um and then these are the proposed building elevations and wall

signage. Um so uh all of staff's comments have been addressed. So, we are uh recommending approval of the site plan subject to receiving a copy of recorded easements for the surface and underground storm water detention, water, main, and fire hydrants along the east side of the property prior to the issuance of a certificate of occupancy. >> Okay. Is the petitioner here? >> Yes, sir. >> Anything that you'd like to add? If you would just please step forward, state your name. >> My name's Todd Smooth. the director of development with GMX Real Estate Group and uh I'm glad to be back in your community. Uh I was the project manager for the Thornton's next door. So I always enjoy coming back here and being a veteran I kind of feel at home. So >> yes, >>

um I just want to tell you today I put together the big qualification for three qualified commercial retail general contractors. And uh we're looking like we're within budget. So I need to do some qualifications with them and clarifications on their bids. And uh we are ready to resubmit for building permit. Uh we have received the comments and we're making revisions right now. So we want to start within the next few weeks uh once the building permit is ready to pick up. >> That's great. Yeah. A lot of excitement about Dutch Brothers. That's for sure. It's it's nice to see you again. >> Thank you. >> Appreciate that. Thank you. Any questions or comments from the board? >> I just have one question. Sure. Is there an overflow for that that will funnel into the baggers

or kid works parking lot? I just know we have the neighboring town is a new drink place as well and that line backs up halfway down the back alley behind the the local businesses down there. So I wasn't sure how deep or how many cars fit in the proposed and if there's a overflow option or what the plan was for that not to back up. >> So this is sir this is typically the maximum amount of stacking they would show. I think off the top of my head it's um I think there's 17 cars in the drive-thru and there's an additional four beyond the drive-thru. Um so u talking to their operations group that there would not be more cars than this. That would be um a significant black swan kind of event. >> You

could turn that coffee out faster than the 18th car can show off. >> Yeah. Yes, sir. Well, additionally, they walk around with iPads to fill orders while people are queuing up in the drive-thru. So oftent times people won't even get to the window. So they'll they'll run the payment in if need be. they'll bring the coffee out and then the pull around lane that's showing the hashed area, they'll just uh scoot around the side there and not even get to the window. >> Okay. >> And the the other thing, Trusty Wilson, is you know, if if somebody were to enter from that um curb cut on Route 30 and enter the site, there is ability to wrap around the building and queue up that way, which does not existed >> one in. >> All right,

good question. Anything else? >> No. All right, thank you. You're welcome. All right. If there's nothing else, then is there a motion to approve the site plan for >> D? So moved. >> Second. >> Motion by Trusty Riser, second by Trustee Scaliz. There's nothing further. Roll call vote, please. >> Trusty Christopherson. >> I. >> Trusty Galuza. >> I. >> Trusty Scaliz. >> I. >> Trusty Wilson. >> I. >> Trusty Riser. >> I. >> Trusty Matson. >> I. >> Mayor Baldwin. >> I motion carries. And now we've got the setting a shity for Dutch Brothers. Will. So for those public improvements looking to set shity in the amount of $336,625. >> Any questions for Will? Is there a motion to approve the setting of shity? >> So moved. >> Second. >> Motion by Trusty Scaliz. Second

by Trusty Wilson. There's nothing further. A roll call vote, please. >> Trusty Wilson. >> I. >> Trusty Christopherson. >> I. >> Trusty Madson. >> I. >> Trusty Galuza. >> I. >> Trusty Scaliz. >> I. >> Trusty Riser. >> Hi. >> Mayor Baldwin. >> I. Motion carries. Next up, we have consideration ordinance granting a fence variance 20004 Cardinal Drive. First read Robin. >> Oh, you're skipping. >> Oh, sorry. Uh request a county special use for 2024 drive. >> Yes. Um so this is a request for um county special use, which the county defines as light equipment sales and rentals, but the intention is for it to be um a used car dealership. Um the site itself is improved with two buildings. There are other tenants on the property as well. Um these are some existing conditions

of on the site. While staff doesn't object to the proposed use, there are some concerns with the proposed site plan. Um you know, the site plan that was submitted was not drawn to scale. So, we have concerns about whether there is actual room to add the additional parking um for vehicles on display as well as um employee and customer parking and still be able to maintain um two-way traffic circulation. So, um while we are recommending that we not object to the use, we do have some comments and concerns about the site plan that we would like the county to consider. Um as well as the fact that there are uh the existing parking area is in disrepair. There's no real striped parking, no handicap parking. Um, and the rear storage area is not fenced. Uh,

so we would ask the county's consideration in addressing those through their review of the county special use. >> Has the petitioner stated, did you discuss that with them? Have they stated whether they object to what we're wanting? >> I don't know if he is here. >> Petitioner here. Yeah. >> Sir, if you wouldn't mind just stepping forward and stating your name. Do you understand the concerns of staff? >> Yes. Yes. Um >> are those things that you're willing to address? >> Yes. Yes. We're replace the parking lot in the spring and um uh fence the back. >> So there isn't anything that staff will be asking the county to have you do that you mind doing? >> No, I I'll do anything they need me to do. It's not a problem. >> Well, we appreciate

that. We uh it's the county's decision, but yes, >> um we don't want to file an objection. Uh, I mean, I I can't speak for the board. I can't imagine we want to file an objection provided, especially if you're willing to uh meet staff's concerns. So, you're on the record. You have no problem doing that. >> Yeah, I have no problem. >> All right. Very good. We appreciate that. Any questions for the petitioner? >> All right. Very good. Thank you. >> All right. Thank you. >> Appreciate you. Good luck. >> Thank you. >> Uh, is there a um a motion to not file an objection uh for the county special use for 2024 drive? >> So, moved. >> Second. >> Motion by Trusty Scaliz. second by Trusty Wilson. And and if you don't mind, I'm

assuming um based on the based on the petitioner's uh stating that he would go along with staff's concerns, right? >> Okay. So, that's the motion. Amended motion. All right. Thank you. And second, that good. All right. Motion's been properly moved and second. Any comments or questions? >> Okay. Uh roll call vote. >> Trusty Riser. >> I. >> Trustee Matson. >> I. >> Trusty Galuza. >> I. >> Trusty Scaliz. >> I. Trusty Wilson. >> I. >> Trustee Christopherson. >> I. Mayor Bowman. >> I motion carries. All right. Thanks again, sir. Good luck. Okay. Next, we have a consideration of an ordinance granting a fence variance for 20004 Cardinal Drive, First Reed, Robin. >> Yes. Uh so this is the very northeastern lot in the Lairway Ridge subdivision. It does have um frontage on Cardinal as well

as on Lairway Road. Um recently with the uh Lairway Road widening project, the county installed a 19 foot tall soundwall adjacent to Lairway Road. Um however, because it is a corner yard, um our our ordinance says that within that front yard setback, the sign can or the fence cannot exceed 3 feet in height. Um so they are requesting a variance to basically connect the dots. Um so the zoning board of appeals conducted a public hearing. one resident attended in support of the request and the ZBA did recommend approval. Um, you can kind of see what we're talking about here, but um, because there were no objections and the ZBA recommended approval, it's actually exempt from first and second read. So, the board can take action tonight. >> All right. Very good. Is the petitioner here?

>> Yes. All right. Anything you want to add or you okay with that? All right. Um, yeah. I mean, it makes perfect sense under circumstances. Any questions from the board? Any concerns from the board? No, you guys are good. All right. Uh, so it's not we're not required to have a second read. >> Correct. >> On that. So is there a uh motion to approve uh the ordinance granting the fence variance for 20004 card? >> So moved. >> Second. >> Motion by Trusty Manson. Second by Trusty Wilson. There's nothing further. A roll call vote, please. >> Trusty Wilson. >> I. >> Trusty Christopherson. >> Hi. >> Trusty Madson. >> I. >> Trusty Galuza. >> I. >> Trusty Scaliz. >> Hi. Trusty Riser I. >> Mayor Baldin. >> I motion carries. Good luck motions. Thank you.

All right. Next up is consideration to approval purchase taser conducted energy devices for the police department. Micah, are you going to handle that or are you not here for that? >> I am here. >> I will come on up. Sir, the uh and board the police department received a grant for Axon tasers and um the tasers we currently carry are 10 years old. They're out of date and unreplaceable. We received a grant which um granted us the ability to purchase six tasers. We're looking for the approval to grant to uh purchase another six tasers in conjunction with that grant. Uh the um deployment rate with these tasers is not high, but it's a great tool for the officers to have if they need. Yeah, absolutely. A non-lethal tool. >> Non-lethal. Yes, sir. >> Any questions

for the chief on that? >> We look to pay them the rest of them off for the next few years of the budget as well. >> All right. Very good. Any questions for the chief? All right. Is there a motion to approve uh the purchase of the tasers? >> So moved. >> Second. >> Motion by Trusty Madson, second by Trustee Scaliz. If there's nothing further, a roll call vote, please. >> Trustee Madson, >> I. >> Trusty Riser, >> I. >> Trusty Gala, >> I. >> Trusty Wilson, >> I. Trusty Scaliz I. >> Trusty Christopherson >> I. >> Mayor Balderman. >> I motion carries. And Mike, you walked away too fast. We always see uh Mark and all them tell you what a great job the police department's doing under your leadership. You're doing a great

job. We really appreciate it. Our police department is outstanding and we appreciate all your efforts. >> Thank you. >> All right. Next is consideration for approval of a purchase for two lawnmowers public works. So, uh we have uh two lawnmowers budgeted to be replaced next year. Um however, our supplier has offered uh two floor models available now uh for a savings of $6,500 each. Um this will put us slightly over budget in the vehicle replacement fund. Um, but our our reserves are very strong and uh both these models have less than five hours on them and they're offering the same warranty uh as a as a new one. So, um this time we recommend the purchase of these mowers in the amount of $27,99.98. >> Get the clippers out, pal. Our money went to Tasers.

>> Any questions for Mark? So this would put us over budget for this year. >> Yeah, slightly over. >> The act the vehicle and uh equipment fund is very very healthy. We've built it up over the years. You see the money we could have coming back in. In fact, we tried to time our purchases when advantageous to the village as well. >> Well, it makes sense. >> Yeah, absolutely. >> First deal. >> All right, buddy. Is there a motion to approve the purchase of two lawnmowers? >> So moved. Second. >> Motion by Trusty Scle. Second by Trusty Christopherson. If there's nothing further, roll call vote, please. >> Trusty Christopherson, >> I. >> Trusty Galuza, >> I. >> Trusty Scaliz, >> I. >> Trusty Wilson, >> I. >> Trusty Riser, >> I. >> Trusty Madson, >>

I. >> Mayor Bald, >> I. Motion carries. Now we have consideration for approval of proposal forest elm drive channel stabilization with Christopher Burke Engineering. Mark. >> Yes. Uh, in 2024, we uh did had some work done to stabilize the channel between Wood Street and Forest Street. If you remember, the the banks were eroding and uh causing potential problems with uh some buildings over there. Uh this is the next phase going from Forest Street to Elm Street. Um it's showing the same type of erosion um and could cause issues with with fences and actually pools over there. So included in the pack is a proposal from Christopher Burke Engineering for the design of the second phase of this. Um the proposal is not to exceed $91,980 and is a budgeted item for this year. Um this

time it's our recommendation to approve this proposal. >> Any questions for Mark? Is there a motion to approve the proposal? >> So move second. >> Motion by Trusty Gala, second by Trustee Scaliz. There's nothing further. A roll call vote, please. >> Trusty Christopherson. >> I. Trusty Galuza. >> I. >> Trusty Scaliz. >> I. >> Trusty Wilson. I >> trusty Riser >> I. >> Trusty Matson. >> I. >> Mayor Baldwin. >> I motion carries. Okay. Next up is consideration for approval of a change order kitchen display system crossroad sports complex. Scott, are you handling that or do you want All right. Then come on up and um everybody tonight. >> Uh good afternoon. Uh yes, we're looking to uh upgrade our kitchen display units for the restaurant at the crossroads. Uh we've currently moved from uh

Clover Sport, which was an operational POS system at the Clover restaurant, which then matches our uh our new design. Uh and with that is an upgrade of the kitchen display system. uh as well as a printer uh as we'll be using um waitresses and hostesses to serve at the uh tables. Uh this way that that information could go directly to the bar and to the kitchen uh instead of writing it down or verbally giving that order in. Uh so this is what that upgrade is for. >> All right. Very good. As you all know, um, as we anticipated in the beginning, we're moving towards not only having that beer garden up there for tournament play, looking for it to be a 7-day a week restaurant. There's a lot of work that's going into that. Um,

we're going to slow roll that out to make sure we're doing it right, but this is all part of those necessary upgrades. Any questions for Scott on that? >> No. All right. Is there a uh motion to approve the change order? >> So moved. >> Second. Motion by Trusty Galooza, second by Trusty Wilson. There's nothing further. A roll call vote, please. >> Trusty Wilson, >> I. >> Trusty Christopherson, >> I. >> Trusty Matson, >> I. >> Trusty Galuza, >> I. >> Trusty Scaliz, >> I. >> Trusty Riser, >> I. >> Mayor Baldrick, >> I motion carries. All right. Next up, Scott, we've got consideration for approval of a resolution approving and adopting an agreement for use agreement for the Crossroad Sports Complex. >> Correct. Excuse me for walking away prematurely there. Uh this is the

uh use right for u rentals at the facility for either private parties uh birthday parties uh corporate events fundraisers. Um the information there uh is uh the the language used here at the at the for the commons for normal rentals u and it's all been uh looked at and approved by our legal attorneys. Um and we're looking for that approval as well here this evening. >> All right. Any questions for Scott on that? All right. In the motion, uh, if someone's willing to make the motion, I'd like it to be subject to, um, a little just a little further discussion between Kurt and Scott and myself, uh, in legal counsel. There was just a couple things I wanted to address. Um, but so if we can make a motion to that matter, we don't want

to u move forward with renting out the location until we have this use policy in place. So Scott has done a good job of getting that prepared for us, but I just have a couple things I want to talk to to them about. So can we have a motion to that effect? >> I'll make that motion. >> All right. Is there >> those stipulations? >> Second. All right. Motion by Trustee Scaliz. Second by Trusty Riser. Is there anything further? >> Roll call vote, please. >> Trusty Riser, >> I. >> Trustee Madson, >> I. >> Trusty Gala, >> I. >> Trusty Scaliz. >> I. >> Trusty Wilson. >> I. >> Trusty Christopherson. I, Mayor Baldwin. >> I motion carries. One more, Scott. Consideration for approval of a change in services, Emirate Facility Services. Are you handling

that? >> Correct. Yes. Um, we're doing a change in service uh through our facility cleaning now that it's the offseason. Uh, so we've removed some of the different sites. Uh, and just concentrating on the main restaurant area as well as the maintenance area. Uh, it's a reduction of $2, I believe, $900, uh, and some change. This will uh return to service in March when our normal operating hours uh commence. >> This is per month. >> A reduction over 2,000 a month, >> correct? >> So, where Mark went over budget, you're helping us out by getting us a reduction. >> Thank you, Scott. Any questions for Scott on that? All right. Is there a motion to approve uh the change in services? >> So, moved. Second. >> Motion by Trusty Manson, second by Trustee Wilson. There's

nothing further. Roll call vote, please. Trustee Matson. >> Hi. >> Trusty Riser. >> Hi. >> Trusty Galuza. >> Hi. >> Trusty Wilson. >> Hi. >> Trustee Scaliz. >> Hi. >> Trusty Christopherson. >> I. >> Mayor Baldererman. >> I motion carries. Thanks, Scott. All right. Next up, we have consideration for approval of a contract utility relocates uh for Northern Builders uh Crossroads Sports Complex and retaining walls for Northern Builders. We're going to take them one at a time, but Will, do you want to talk about those? >> Sure. Uh yeah. So, the the the those two projects are are to help utilize some of that space over there where the where the hotel is as shown up there. Um the existing it's kind of hard to see, but the existing sanitary kind of runs underneath the

north side of the building right now. So, we're looking to move that sanitary sewer out of the way so that we could construct that that building and not have it uh over the the sanitary sewer. Uh the dashed hatched lines up there are water services that were originally installed for the the the previous uh development up there. So looking to remove those um as well, so they're not um you know, they're not needed anymore and and they're not underneath the building. Uh there's a couple fire hydrant relocations on the far east and west side of of that uh that picture up there. um that would move those hydrants into a a more uh a better spot for for the site plan that's going there. And then along the the north side of the the property,

we've got a retaining wall to help utilize again, you know, maximize the amount of space up there for that. And uh and that's kind of why those all those water mane uh leads are are going away because they're underneath the retaining wall. It was a narrow, very narrow section of that lot that we anticipated there might be an oper. We might have to move that sanitary line. We did not anticipate having to break the wall at all. >> Right. All right. Any questions for Will? All right. Is there a motion to approve the contract for the utility relocates? >> So moved. >> Second. >> Motion by Trusty Scaliz. Second by Trusty Christopherson. Any comments or questions? Roll call vote, please. >> Trusty Christopherson. >> I. Trustee Galuza. >> Hi. >> Trusty Scaliz. >> Hi. >>

Trustee Wilson. >> Hi. >> Trusty Riser. >> Hi. >> Trustee Matson. >> Hi. >> Mayor Bow. >> I motion carries. And as Kurt alluded to, uh we were not anticipating the retaining walls, although Northern is obviously our general for that project up there. Um before we take action on this, I'd need a motion to uh wave the bid process uh for this project or for this particular >> because the the the project's in good shape. We should be able to still get both these done within the bud the original budgeted amount. So, it will fall under that. >> It It'll still be within budget, but it was unanticipated. And so, just to be safe, we're asking to wave the bidding. Correct. Is there a motion to wave the bid process for this? >> So, moved.

>> Second. >> Motion by Trustee Scaliz, second by Trustee Gala. Any comments or questions? All those in favor signify by a voice vote of I. Opposed. Motion approved. Now, is there a motion to approve the contract for the retaining walls with Northern Builders? >> So, moved. >> Second. Motion by Trusty Scaly, second by Trusty Matson. There's nothing further. Roll call vote, please. >> Trusty Wilson, >> I. >> Trusty Christopherson, >> I. >> Trusty Matson, >> I. >> Trusty Galuza, >> I. >> Trusty Scaliz, >> I. >> Trusty Riser, >> I. >> Mayor Baldwin, >> I motion carries. All right. Next up is a consideration for approval of a contract Mighty Motors exhibit boss display for the Kidswork Children's Museum. As you all know, uh we were looking to put a new vehicle in there. We

had moved forward with a previous contract uh with a um car design. Um not the one that I wanted, but the one that somebody else wanted. As it turns out, that business went under and um so we need to move forward with somebody else's plan B and my plan A. Uh this is in the amount of $43,8125. Any questions on that? All right. Is there a motion to approve the contract that we should have approved in the first? >> So moved. >> Second. >> Motion by Trustee Scaliz. Second by Trusty Christopherson. Beth, do you want to add anything? >> Yeah, I'm doing okay now. >> You're doing good. All right. Any other comments or questions? Roll call vote, please. >> Trusty Riser, >> I. >> Trusty Manson, >> I. >> Trusty Galooza, >> I. >>

Trusty Scaliz, >> I. >> Trusty Wilson, >> I. >> Trusty Christopherson, >> I. >> Mayor Bald, >> I. Motion carries. Next, we have consideration for approval of waiver of village code for parking lot expansion on Route 30 and Galer Road for Nyore Gas. Will, >> thank you, mayor. Uh Nycore Gas had reached out. They're looking to add some parking to their existing facility over um there in uh at the corner of 30 in Galer. Um it's about a 24,000 square foot uh area that they're looking to to put in there. Um they are requesting to uh put that in as a a gravel stone parking lot which is similar to the one that they have out there um just on the picture up there just to the to the right there of of that wonderful

white box. Um but uh that obviously doesn't meet our code. And so one of the requests that we have with them is is to ask them to plant some uh some shrubs and a landscaping barrier along the the north side of of that or I guess north and west there along Galer Road. Um so they were requesting a waiver of code to be able to put that in as stone for the time. >> All right. Very good. Any uh questions for Will? >> All right. Is there a motion to approve the waiver of the village code for that parking lot expansion? >> So moved. >> Second. Motion by Trustee Scaliz. Second by Trusty Wilson. If there's nothing further, a roll call vote, please. >> Trusty Madson, >> I. >> Trusty Riser, >> I. >> Trusty

Galuza, >> I. >> Trusty Wilson, >> I. >> Trusty Scaliz, >> I. >> Trusty Christopherson, >> I. >> Mayor Baldick, >> I. Motion carries. Okay. Honor reports and communications. Um, I have a few things. Um, you see all the business, all the great things that are happening in this community. um this community that was incorporated in 1946 and uh we appreciate all those that are working so hard to make this such a great town. But um for those of us who have been here for a while, we know that um we are standing on the shoulders of people who were here long before us in this community that did tremendous tremendous work uh to make it a desirable place for all of us to move in. I moved in 31 years ago um when there

was 10,000 people here, but I moved here because it was already a great community. one of the people who we have recognized here who was a grand marshall in our parade. Um a business owner, a resident, um but more importantly just really one of the sweetest, kindest, most unassuming people I have ever met in my life. Marilyn Curts um passed away. And um it's uh for those of us that knew us personally, I know Keith certainly did uh and was very good to her. You and your wife Patty. And um I had a my family and I had a close relationship with her and a lot of people in this town knew Marilyn well. Not just that she was a business owner, they knew her well. Um it's a really tough tough personal loss um

for us and you'd be hardressed to find another person that has touched that many people uh in a small town like this than Maryland did. Um and just uh just the most truly truly wonderful person. Uh usually when someone passes you find all kind of people saying good things about about them but uh during her lifetime she was very fortunate to hear just how appreciated she was uh by so many people. So um our thoughts go out to her family um her her son her grandkids her great grandkids um and to so many here in town um that called Marilyn a friend. um forget the fact that she was incredibly generous financially to many of the events that we do here in town. Uh she was a donator to the hospital and nothing bothered her

more than seeing her name up in lights or getting recognition. Um it really was uncomfortable for her. Um she was a great financial benefactor to some of the many things that we do here. um and that really pales in comparison uh to who she was just as a human being and how much she gave to people of herself. So on behalf of of all of us here to her family and friends we want to extend our condolences. Um she will really really be missed on so many levels. So, um, then, uh, some of, uh, the board and staff were able to participate along with some other local community leaders and veterans at a tribute to valor event, um, that we had a couple weeks back with um, American war heroes Israel Del Toro and Gary

Lynfoot. Uh, the Medal of Honor is the highest honor that a military person can receive. Uh, in fact, the president's required to uh salute a Medal of Honor winner. Um, and so I've been fortunate to be involved in that organization. Um, thanks to Tony Orlando, who half of you in this room never heard of and half of you know very well who Tony Orlando is, but he's a wonderful man who has gone back to the 70s uh working with Bob Hope, has committed his energies to recognizing veterans. We took tribute to Valor to Lincolnway Central and were able to address several hundred kids there and then went to another community high school where we saw another five or six hundred kids. Um it really it it it tries to teach children um about the six

core values of the Medal of Honor uh citizenship, patriotism, courage, integrity. It's just really important. Um, and so I'll be asking uh this board uh to adopt a uh resolution at our next board meeting uh just stating that we as the village um are supportive of tribute to valor and of the six core principles of that medal of honor. Um they have asked me to serve on their governing board because I had all kind of time on my hands. Um but it's my responsibility to uh try and get uh this resolution passed at state levels, at county levels. Uh I did have a great meeting uh in a time when there is very little um working together of the different partisan groups. Uh, I had the most liberal senator uh in Illinois and one of

the most conservative senators in Illinois uh with me who are both on board and helping carry this resolution through down in Springfield. Um because this is not a partisan issue. Um this is we live in the greatest country in the world and we have uh despite its blemishes it is still the greatest country in the world and uh if we can help people answer the question who am I by using uh the six core values of the Medal of Honor to guide them um that's that exceeds and goes beyond all party politics. It's just good uh Americanism. So, um I'll be asking the board to uh adopt that resolution at our next board meeting. And then I also again with all that time uh traveled to Houston last week um to meet with his highness

the Aakhan uh who oversees um the Aakhan Development Network. Uh I was with the mayor of Houston and uh his to uh welcome uh their first American center down in Houston. Um and they're all about pluralism and community outreach and um early childhood education and health care. And so it was really an honor to represent our community. Um it was uh myself, uh the mayor of Houston, the mayor of Plano, um some congressmen and religious leaders. So it was really nice for New Lennox uh to be a part of that celebration down there and um it's uh it just uh was a wonderful wonderful experience and and good for our town to uh to be a part of it. So, that's all I have uh for tonight other than you've all been following the news.

Santa's got a friend coming. Mark, uh I keep asking Mark when the arrival date is, but uh it should be within the next two weeks for sure. We want to have everything up and and going before Thanksgiving. It's important to have uh Christmas in the Commons all set up before Thanksgiving uh because there's so many families come home and it's such a beautiful display and uh Mark and his team uh along with the company that we do business with though, but it's a lot of work out there and they do a tremendous tremendous job of getting that ready. It's one of those things that when it's all up and going, uh, thousands and thousands of people uh, come through here uh, through the end of November and December and they don't realize just how much

work goes into it. Um, it, you know, it's never fun when it's cold and you're out there working on stuff, but uh, Mark, we appreciate you and your team and all the efforts that they put in. So, thank you for that. It really is the most beautiful display around. So, thank you. All right. If there's nothing for me, village attorney, >> nothing to report. >> Thank you, village administrator. >> Well, it's a good thing you don't sleep so you have time to do these other activities besides being there. >> Um, actually, the staff does not have a need for a council home unless the mayor and the board have one and then the staff has no further comments. >> All right. Very good. Thank you. All right. Payroll and dispersements. Trusty Matson. >> Yes, sir.

I make the motion to approve our five monthly dispersements in the amount of 3,9,329.70 and a manual dispersement amount of $2,72.38. In addition to these dispersements, approval is needed for a payroll of the amount of $541,29967 paid on October 31st, 2025. That is an informal motion >> and I will second that. >> Okay. Motion's been properly moved and seconded. Any comments or questions? Roll call vote, please. >> Trusty Matson, >> I. >> Trusty Riser, >> I. >> Trusty Galuza. >> I. >> Trusty Wilson. >> I. >> Trusty Scaliz. >> Hi. >> Trusty Christopherson. >> I. >> Mayor Bald. >> I. Motion carries. Anything else, Keith? >> No, sir. >> All right. Very good. Thank you. Okay. We do have uh somebody who has signed up to speak. Tim McCutchen. Tim, if you'd like to please

step up. >> Yes. Good evening. Mayor I trustees. Um my name is Timothy McCutchen. Um >> I appreciate what you said earlier, your opening statement with the um uh the academy. I thought that was really nice. Maybe I'll sign up for that. >> Good. >> So I'm impressed with that. Um a little bit of who we are, where we're from. We're at 950 West Woodlong. Okay. Um, we built that house five years ago, my wife and I, and some of our neighbors are here just uh right on Woodlong, too. Um, and we built before Darby Farms was approved. Uh, it was a um a field. It was a farm when when we moved in. Um, and we voiced some concerns four years ago when Darby Farms was approved. Um, and we've been in contact with

the village for the four years as it was being developed. Um, we're specifically right on the, for lack of a better term, I call it a swamp. Um, the water area. Um, and we're we're seeing MI Homes coming to a conclusion. Um, and we've asked if they could clean it up a little bit or put some maintenance into it or or what's happening over there. Um, and we're afraid that our concerns are not being taken and MI Homes is going to be gone and we're going to be stuck with uh something that looks like a what I call a swamp. Okay. Um there's a very good areas around Alex, excellent areas around the Lennox that my wife and I and I'm sure everybody have seen where they'll have um water retention or water detention areas

that are very well-maintained, beautiful areas and increases the appeal to the neighborhood. Um, I have never seen anything like this in New Linux and it's right outside of our back door. Um, so we're trying to get uh the mayor, the trustees, the staff on board to uh address this problem before um and I'll call it out. A MI Homes, a multi-billion dollar stock company, pulls out a new Linux and sure leaves us holding the bag. Um, so again, we've been watching it for four years. We've been told slow development on retention detention areas and it takes time, but four years later, it's as worse as it ever has been. >> Okay. And and I appreciate that. And I asked Robin and Will about that. Where where are we at on that? >> So, I'm working

on a a timeline with the developer to to clean this stuff up. There's some uh stakes out in the pond. There's uh some chicken wire that's left over around the outside of the pond. Um there's some drainage concerns that I've talked to Mr. McCutchen about um that I'm working with them to get a timeline to do that. I know they recently did a lot of landscape work out there and things like that. And you know, our conversation with them has been, you know, those items need to be addressed before we do a reduction. >> Right. Because we still have shy on it. That's what I asked Robin. Right. >> Right. and and even when we do the reduction, we will still have shy because we won't do a full release and you know for another

year after they put the the surface down and things in there. So there are still there's still time in there, but you know we're not doing a a big reduction for them until they address those the items that we've asked and >> Okay. So I I did talk to staff about that when I received your information and I asked about the shy. So I I'm assuming that Will has explained to you in other words they're out there. They have to be cleaning up. They have to be fixing. But to your concern that if for some reason they left, they're not going to want to leave without their money. That's why we have that shity. We have the money then to clean up what they their money. We use that taxpayer money to clean up if

they for whatever reason don't meet what they have to do. Yeah, you can understand our frustration after four years and the grading that they did with silt fences and the earth movers behind us and everything from day one was okay, they're going to fix it. They're going to fix it. They're going to everything's our grading and all all of our backyards were set on a development that uh was ch changed when Darby Farm got their approval. So, so our grading was set to the side and not addressed because we're already moved in and then we have to deal with the grading of Darby Farm, specifically us as far as 950 West Woodlon, but right next to us is the Lee family and right next to them is Tim and Terry. And uh and um so

their grading in their backyard also is affected by this by Darby Farms digging out their their swamp. Everything looks good on paper, mayor. Everything looks good on paper, but when you're there day in and day out, >> sure, >> it ain't working. >> Has the grading of Darby Farms affected the neighbors behind them? Is there >> the Silven Meadows >> grading and all of those lots wasn't touched as part of what Darby Farms did? >> Okay. So they have a they have a burm between essentially between >> the the Silven Meadows, what that subdivision was, and then the Derby Farm. So they have they each have essentially a separate storm water system that runs along there and ties into the P. >> All right. I I here's look here here's the bottom line. There obviously

are some legitimate concerns that the neighbors have there. Are they all easily addressed? They should be. I mean, there isn't anything that there's is there any discrepancy with MI Homes as far as what's their responsibility? What's not there? Are they disputing any of this stuff? >> We we've been out there before. There's there's and there the neighbors have legitimate concerns and we we'll we'll address those. Part of it is it in the very nature of the pond itself. It's a native pond. It's a little different than a manicured pond. So, at the end of the day, it's not designed to be a manicured pond. It had by its very nature was different than that. And I understand it still needs to be done. We have to tweak and we have to go out there fix

it. But it at the end of the day it it isn't like a number of ponds where it's manicured around there. It had it it was built with a design with native plantings. So >> with native plantings, >> correct? And to your >> So we'll have a different look to begin with. No function it functionality should be be meet the the concerns of the residents. That's what we have to make sure that that does. But it at at the end of the day, it is not going to look like a manicured pond. >> No, there are and I do I know it does take a while for native plantings. I mean, um when Orland Park built their police station, they did native planting and everyone said, "When are you going to cut down all the

weeds and all the garbage that's out there?" And it was native plant. Even in front of Lincolnway Central, they have native plantings out on Route 30. And sometimes people think that it's weeds or it's it is what it is. Um, but I'm sure it's more than just that that the neighbors are having an issue with. >> Has MI not been timely in their addressing of these issues? >> Not timely in that they did, like I said, they did the landscaping out there and I assumed when they did that that they would address our the rest of our punch list. They haven't done that. They haven't told me they're not going to. Um, but I'm working I'm playing phone tag with the the their development guy out there. So, I'll be following up with him multiple

times. >> Yeah. tell them they have to get on it because even if they're going to get there, people are living with that and looking at that. >> Um, so like to your point, Kurt, if it's native plantings and >> you know that's not always to people's liking, but >> u if it's all right to keep speaking, I know I'm past five my five minute limit. >> No, that's all right. Go ahead, >> Mr. Carol. the you know there there's been a lot of things told to us over the years and we watched as they planted the cattails back there to absorb the water and they did a lot of planting back there and two years later there was no cattails coming up. They were actually washed away and and starting to stink. And you

know, we we can go on a lot with what it smells like. And I I got to check my shoes when I'm coming in thinking I stepped in something. But it's the the plan was for a while a bubbler system, fountain system, moving water, um native plants. Um, you bring up or anybody brings up native plants and I'm going to tell you, um, Cam cuts his yard next to me and it's perfect. We have grass right next to each other. I look on the other side of our house and it's three-foot weeds right on my grass line. There's no transition. There's no grass for the water. I learned things that I I'm not a builder. I'm not a developer, but I learned things. The water is supposed to flow away from the home and the

whole reason for the swamp is to hold the water. Well, it's not flowing away from our home. It's not flowing away from their home. They had to dig out theirs. So, we're left with problems from what Derby Farm did. >> Okay. Well, where are we at in the season for them to be able to address them? We can we can do that and and you know if we need to they'll have to uh put some um erosion control down or something like that, but I mean they still can we might be able to get some grass growing or something out there. But yeah, I'm going to be following up with them tomorrow until I get them. >> All right. Well, when I when I when I received when I received your email, I talked to

Robin right away about it and they told me what was happening. Um just it's uh the first board meeting here in November. I mean we need a couple weeks to address this or >> we should be able to do something quick. I mean I don't I'm not aware of any drainage issues that you guys are having. Darby Farms didn't touch anybody's property. So I don't you know whatever is going on in the backyards isn't a result of Darby Farm in my opinion. >> Okay. That's an opinion that and Mr. Nash, you know, >> I showed you pictures of standing water in our backyard and >> Derby Farms didn't touch your backyard though, right? >> They they as they put the silt fence out and they did a great job because they built up the dirt

around that silt fence so that it wouldn't blow away. And then when we requested the silt fence to be removed after the earth movers were done, we actually got them to remove it. the now you have the hump that the wa water doesn't flow uphill. So, and we've talked about this, but the the fact of the remains that the grading and the humps behind our yards are still up and then they drop down. Um, so we're we're we're we're trying to do something. And I'm sorry it's a midnight hour here, but we're seeing MI homes. Uh that's what well pulling out. >> But again, we hold money for these purposes that if something isn't done, if there is an issue, we hold their money. That's what these shies that you heard all night long >>

is for. And so if for whatever reason MI Homes didn't address something, they're not getting their money back. And we'll said we hold it for a year after that as well. So then we hire somebody to complete the work on their dime. >> Yeah. >> So, but regardless, we it should be addressed. >> I'll go back out there again and and take a look at that. >> All right. Still fence is still cut to grade. The 2 by twos are still in the ground. Silk fence is still in the ground. >> Above two foot is cut out. They took that out with a bobcat, but they left a big hump. >> Have you been out there with the residents? >> You have. Have you seen what they're talking about? >> I've seen it on the

side between the the the between one singular house and the pond on the side. >> Okay. >> But not behind the houses because there was a burn there already. So I don't >> I I wasn't aware of any issue along. >> All right. Well, why don't we why don't we do this again? The >> great let's let's let's get back out there and see all these things firsthand. >> I'll touch base with Sean and Mark tomorrow and we can go out there. >> Yeah. let me know and maybe let me know when you're going out there, coordinate with with you and the neighbors. I'll meet you out there and see what what's going on. I >> I'm not speaking on behalf of my neighbors, but I'm more than happy to sit down with anybody that

wants to see >> No, we'll meet we'll meet >> we'll meet you out there. I'll come out there when staff is going to meet you and your neighbors out there and look at this issue. >> Yeah, that's fine. >> Okay. You okay? >> All right. Thank you. Appreciate it. >> All right. Anyone else? >> All right. Thank you. Trustee comments. Trusty Riser. Um, congratulations to the Citizens Academy graduates. And, um, Elena, are you over there? I can't. >> I'm still here. There you are. >> Hi. Good to see you. >> Good to see you, too. Um, I just want to let you know, um, a friend of mine, his wife participated this year and I was speaking with him and he was talking about how his wife just had nothing but good things to say.

So, great job. It was good to see so many participants. >> Thank you. Thank you. I'm happy to hear the positive feedback. There you go. >> All right, Trusty Manson. >> Mayor, I want to thank you for your kind words regarding passing to Maryland Curts. And uh I've been uh going through the roundabout. I think it's wonderful. It's what I it's what I told the Cub Scouts when they were talking to me today. I said, "What's they said, what's the hardest part about being mayor?" I said, "Listen to people for five months complain about a roundabout and when it's open and running perfectly, you never hear from them." Like, "Oh, sorry." All right. Thank you. >> Great job. >> Very good. Thank you. Go ahead. >> I don't have anything to add tonight. >> All

right. Very good. Trusty Guza, >> just looking forward to Christmas in the Commons and I personally love the roundabout. Never get stuck there anymore. So, it's been fantastic. >> Really has. Excellent. Thank you. >> It has. >> Trusty Wilson. Nothing tonight. All right. Thank you, Trusty Scaliz. Just thanks to um our public works for getting our streets plowed this morning and um I had a couple co-workers that do not live in New Lennox and they made comments on how nice our roads are compared to the roads that got them to work this morning. So, thank you to public works as always. >> Yeah, they do a good job with that for sure. All right. Well, we have no need for executive session. So, if >> you got your lawnmowers, we have no need for executive

session. Is there a motion to adjurnn? >> Anybody or do you want to stay? Second >> motion by trustee Matson, second by trustee Galuza. All those in favor signify by voice vote of I. >> I. >> Meeting adjourned. The paint.
