001good evening everyone Public School District 132 Board of Education committee the hold meeting legal training agenda for Thursday September 19th 5:00 joh call yes Brown absent ENT Dixon pres goar abson Kimbro pres love present story abson Harris yes here all right [Music] all you can wait it's on the next agenda okay okay we going to move [Music] right greetings hi everybody my name is Mary Rock which is a law firm that does work District I'm here to present uh legal updates that happened in about the past year or so um just so the board knows all the new on questions as I go through it let me know [Music] maybe you there you goosed to move to be able to see that show on there there saf place okay so thanks for having me um
002okay so throughout this there's a couple of like true false questions just to make a little bit more interactive because it can be pretty boring going over legislation um so the first one um is is the first one [Music] is so there's a Public Act 102 0711 that is effective as of January 1st of last year but I thought this was a good one because lot of schools are dealing with teacher shortages um and so that's kind of why I put this on here just to kind remind everybody about what we can do to kind of help with that because it's still an ongoing problem throughout all the districts in Illinois um but there is an act that was passed uh that says that you can allow uh substitute teaching license if you have completed
00370 hours of credit uh for an education preparation program so if you are looking for substitutes uh that's a good good way to look for them if you look at the people if that to get liced you say or 90 sorry 90 hours I did say something it's 90 okay so um this is a question for you guys what was the district show to allow a substitute teacher to continue in emergency situations um so this is a multiple choice question uh just to jump ahead it's all of the above but if there's an unforeseen vacancy that's occurred a teacher is unexpectedly unable to fill their uh contractual duties the vacancies are unfilled due to a lack of qualified candidates and the district is actively engaged in advertising to hire a fully licensed teacher for the
004vacant position then a district can allow a substitute teacher uh in emergency situations for long term um and this is Public Act 103-1 0193 um and so if there's an emergency situation where you don't have a licensed teacher you can employ a substitute teacher uh for 30-day periods at a time um but you have to notify the regional office and then this can be extended uh for up to 90 calendar days or until the end of a semester whichever is greater um and that's just done through the regional board of educ ation um just so this is another way that you can kind of fulfill some of those positions that may be vacant that are not filled um is by putting a substitute in those in those positions that you can't F and then also
005it can be extended as well um and the regional office is the one that you WR to to get those extended I have a question yes if you're extended I don't know if it's through this contract or if it's through the union do the subs get a benefit after a certain number of days I know the Chicago public school if you do a certain number of days you start getting uh Insurance correct so I don't know this this app doesn't address that issue so that would be your bargaining agreement that's what I was asking that yeah so you have to look at your bargaining agreement according to this act it's not addressed okay um and so then it kind of talks about what that emergency situation is which I um there's also now tenure for
006Career and Technical teachers so if you had a teacher that has an educ educ ucation license uh with Career Technical um they can be granted 10-e simulations that's a new law that went in effect as of July 1st so I don't know if you guys have any teachers that have that licensing um but that's that's a new La for tenure um so there's also a new law out for job postings on now's requirements um you have to include uh pay scale and benefits so this multiple choice question is what has to be included pay scale benefits a statement that no employment that employment is at your own risk for A and B obviously it's a be pay scale and benefits um and so as of January it goes into effect January 1st this coming year
007so you don't have to have it yet but a lot of schools and different businesses are already including the pay scaling benefits when they're making their job postings but uh starting January 1st if you're going to have a job post you have to let them know what the pay scale and benefits is and you can simply just put a link to it you don't have to list everything out in your job posting but if you put a hyperlink that has all information you'll be covered okay so this is a true or false question uh must priority be given to Educators with a license of endorsement and physical education when hiring for that position so this answer is now true um and so there's a new law that was in effect as of January 1st about
008hiring priorities so not only for physical education but also music uh physical education Visual Arts uh have to be given priority when you're hiring for those positions if they have an educate educator license and endorsement in those areas um so if you're looking to hire in those areas and someone comes forward make sure you're giving uh priority to those people that apply for the job um there's also a new Transportation benefit program that was in effect as of January 1st and this is just uh that you have to allow for the employee to elect to excluded from taxable wages uh Community costs for the purpose of of P of purchasing either transit pass or public transit uh you know allowed up to by the federal tax law so I don't know if you have any
009way that takes public trans trans work might run into this us or whatnot I think this is more probably a Chicago Public School kind of benefit program but it is it is Statewide so if someone were to come forward and say I take public transit to work with the bus room or whatnot you have to allow them to kind of deduct that from way wish um okay so this this next one uh is for school code for holidays for uh support staff um and so you cannot require support staff to work on a legal School holiday other than um if there it's for an emergency situation so holiday pay is not automatic uh so you have to look at whether they're a 12-month employee or a 9 9 to 12month employee so it's if the
010employ is based off the number of school days then um you don't have to give them the the holidays uh but if they are work based on the number of days that they work then you have to give them pay P for the holidays off that question on that yes okay in our our calendar we do not schedule um what is that President's Day which is a Federal holiday but we work that day can they just take off because it is a Federal holiday but we didn't schedule it in our calendar as a day off so the way that this it's for the school holidays so if you guys are working on on President's Day you have school too or is the school open yes yes so if they would come in to work is
011any other day but if you were guys were closed then youd have to give them pay for that day so they can't take it off just because it's a Federal holiday because you guys are still little B the morning that that's your question yes okay um there's also uh this teaching Excellence award that just to kind of make it make everybody aware of it um you know just kind of an incentive for teachers to kind of help you with your your teaching staff but there are funds for for um as an incentive for teachers a retention bonus of $4,000 a year for two consecutive years for hard to staff schools um and so if you are part of a hard to staff school you can have you can have funds distributed on a first come
012first serve basis um it's not by District it's by school so I don't know if you look at the different schools within your District if you have uh a student population uh Which is less is 30% low income or higher than than people would qualify for this this hiring bonus um so that's something just to look into um okay so coners receive paid leave when representing a Statewide teacher Association um so the answer is yes so you can get paid leave if you're a teacher for federal advocacy work um it's you can get leave for up to 10 days per School term um if this is they're going to represent either IA or if and syoy work um and then you get reimbursed by this Association that they representing um but they should be able
013to leave with pay to do to do this work for those agencies okay Can employees receive paid leave degree family killed in a VI crime the answer is yes um there's a victim security Economic Security and safety act so this act allows employees um to use unpaid leave uh to grieve and attemp to matters in the death of a family or household member who's killed in private violence so um just another way that they can can be granted leave um you don't have to pay them um but they can use their their paid leave as they would you know if you allow them to use your sick time or whatever other time they have but if they don't choose to use that they still take that unpaid leave to degree for the uh family M
014who died for what length of time um that is a good question it doesn't hear I will have to get back to you I don't listen on here and I don't remember off hand um is it still up to 10 days like it says on slide 18 [Music] 16 so this is this is for federal ABY work okay um so I don't know what the the law is for um The Grieving of of a family member who dies in violent crime I know it's probably the same as as the other gement policies but I'm not sure say I'll have to get back to you guys I don't it off hand usually about 10 usually it is 10 days but short it is um okay so another uh law that has come out deals with harassment
015and retaliation there's a lot of new laws dealing with harassment and retaliation T mine that have come out recently over the last couple of months this is kind of in line with that um this was effective as of August 1st um it basically just says the school districts have to have a policy on discrimination and harassment based on race color national origin and it prohibits retaliation so I don't know if you guys have looked at your school board policies lately um you just want to make sure that your policies are updated include the statement um because this is not required under the law um so you want to just make sure you have that policy within the school board um and then that it does uh prohib discrimination based on uh raise color and national
016origin and also that retaliation piece um this again has to be posted wherever you post your policies near at the handbooks um online and then distribute to all employees as well um another law that went into effect uh as of January 1st is that if the board chooses to enact a policy they can have a policy that waves non-tuition non-resident tuition for a student if they're the child of a district employee I don't know if you guys have that policy so yes you're allowed to have that um previously you had to submit a waiver application is be for this but now you just have a policy with the Board of Education [Music] said and then and um this is not necessarily a school law about Labor dispute damages I just thought it was interesting it
017could affect uh any sort of lawsuits that may come up within the district um but it does provide that there's no Award of monetary damages except for Damage Done to an employer's property as a result of conduct prohibited by law uh will be granted by a court when there's a case involving labor dispute so if there's a labor dispute between uh an employee in the district um there's not going to be an word of monetary damages other than for damage up to the employe property if there's a dispute so that's just something to keep in mind okay so there's lots of drills that have required in Illinois for school safety um so which of the following is required F fire suspicious items or person severe weather law enforcement drills or all of the above so
018the answer is all of the above um so there's a new school safety jur that's required as of last year um and it's the school building's emergency and crisis response plan uh should also include plans for law enforcement to rapidly ENT the school building in the event of emergency so I don't know if you've looked up your uh school safety to plans but you just want to make sure you have that included uh that there is a plan for law enforcement to enter to building rly if you haven't done that ready um and then they' this is not that new law it came went to effect last December um but you can provide water education safety uh for students uh through prek through 6 um you don't have to provide it but the law does
019allow for you to provide water saf education if you wish to as part of your curriculum um okay so as of August 9th of this year um there this is now they can have kindergarten through grade 2 assessments um so there were previous restrictions on pre kindergarten through grade 2 assessments uh that were just for Diagnostic and screening P purposes now those assessments uh can be used to determine eligibility into the GI and talented children um and acceler placement part of the code so um if you do give those assessments you can look at them to consider kind of those placements into those accelerated programs and that's new as of August 9th okay so is notice required prior to the use of District administer assessments um yes it has to be posted on the website
020yes the school board must hold a vote at a public meeting no the district must is not required to provide notice or no students do not not take District ad administrative assessments so the answer to this one is that you have to have a vote with the school board at a public meeting about any District assessments that are being administered so this law just went into effect July 1st so when you this is when you when you approve a new contract for any District Administrative assessments so if you are going to be administering any new assessments or you have a contract that you sign off you have to have a vote at a board meeting and allow for public comment um before you administer these assessments ments um and you have to submit the proposal
021the terms that you're going to be accepting um and allow for people to come and make and make comments on those assessments before before they're [Music] approved okay so here's true or false can School staff can use physical restraint to prevent a student from completing an act that would result in potential physical harm to himself herself or another or damage to property um so this is kind of a tricky answer the answer is true uh you can still use that but they changed the law um so we want to be a little bit uh mindful of how what's what's happening with the law now um so this is a new law that went into effect August 9th and it says no corpal punishment of students which you know they've had that for a while but
022now it's an official law on the books with this Public Act um and so what it's saying is that the schools cannot use any form of corporal punishment for a student uh and it can cause inflict corporal punishment upon a student um part of the law then also says uh in Provisions concerning the maintenance of discipline um you may only use reasonable Force as permitted under Provisions concerning timeout isolated timeout restraint and Necessities uh which is a change of what it used to say right the law used to say you could use reasonable Force as needed to maintain safety for the other students School Personnel or persons or for the purpose of self-defense or defense of property so now they're saying you can only use reasonable for as permitted under the provisions for timeout isolated
023timeout restraint and necessity so that's a big change um but I wanted to point out when you go and you look up those Provisions that are are part of the timeout code and and the isolated timeout and restraints um it kind of defines that physical restraint piece um and so in that in the code it does say physical restraint does not include momentary periods of physical restraint by directed persons uh without the Aid of material to prevent uh a student from completing an act that would result in physical harm to himself herself or damage to property so as you read the statute as it is even though it says you're not able to use that that uh reasonable force or restraint um they do Define physical restraint is not part of this so when you're
024looking at corporal punishment um and restraints for students uh if you're using physical restraint to prevent a student from hurting themselves then it's okay but you want to make sure you're doing it very minimally and you're not doing it more long than you have to um because then you kind of get into that gray area and ISP is supposed to write up discipline codes that are uniform across the state that's coming in the next year or so um it's so so hopefully there'll be a uniform code for everybody to follow um and this will kind of clear up and they'll clear up the modeling of this because it does as it reads I think is very confusing um but you know our Law Firm has looked at this and so our guidance is you can
025still do what you're doing um because based on the the definitions of physical restraint when you directed to that code it does allow for that um but you just want to make sure that you're not doing it for long or longer than you need to okay so the next law that went to effect in August it deals with Ela and literacy interventions um and so there is a Statewide literacy plan that is be has introduced and made um I don't know if you guys have had an opportunity to read it but there is Statewide plan that's out there so this law basically just says any vendors that districts use to support Ela learning or language English language arts has to be based off that comprehensive literary plan developed by ISB um and be in compliance
026with what that plan is so um you know this is like your Wilson programs or whatever programs you have for reading you just want to make sure that and most of them are um because they did a really good job like making this making this program and doing very comprehensive job but you want to just make sure you look at your vendors and that they know what the literary program requirements are for Illinois um that they're they're in compliance with it following it um another law that went to effect in January which I thought was good for for some districts too as well as this computer science Equity Grant um if you have not looked into it it's a really good program I think to look into there is um an allocation of $3 billion
027in the budget from the state legislature um it provides a grant to uh for enhancement of computer science programs in grades K through 12 um so if you wanted to bring a kind of program to the district there is a grant out there with money allocated to it um so you might want to look at this computer science Equity Grant and see if there's some money for your District to something you guys want to apply for okay so there's a bunch of new laws on District Operations and finance that I've just kind of listed here um so I'm just going to go over them kind of briefly the first one um Public Act 10339 requires boards to present at board meetings each year a written report covering the annual average expenditures of its operational funds
028for the previous three fiscal years so that means every year you have to go over your your annual average budget for the last three fiscal years so that should be something that you're doing now on an annual basis um you can also invest in the obligations of us corporations provided there's certain criteria that are met if that's something that the board is interested in doing um uh you know certainly contact one of the attorneys in our firm and we can go over what those criteria are to make sure you're complying with that um if you have more questions on that one we certainly can talk to you a little bit more in depth about that um in in terms of the bidding threshold for purchases as of January it's been increased from 25,000 to 35,000
029um so that's $10,000 increase just just kind of keep in mind when you're making uh bids and then uh you can use a design build delivery system for construction projects uh provided provided their specific procedures then follow so if you have any uh construction projects that are in the works or that you're thinking about just make sure you're looking at this Public Act and you're following those procedures again if you have any questions I'm sure uh the one of the attorneys in the law firm will help you make sure you're in compliance with those procedures as well and then there's also a healthy School meals for all program um that has been passed uh so there is this healthy School meals program for all that's sitting in the legislature pasted except they have Frid any
030Al could any funds to it so um I think once they figure out how to put funds into that program then there might be free meals for everybody but that's that has not been so done yet so can you okay I'll wait so I mean the healthy meals I mean we getting that already so and I think it's free and reduced right right so I think this the way this Public Act is it's for everybody so now they have it for certain you have to be a certain threshold income for students that get it oh okay low income low income yeah there's a certain threshold of students that get it it's not for everybody so this would be for free mails for everybody so it would be for all students so free mails for students
031so the legislator passed it but they didn't put any funds in the all get any funds STS it so it's passed but there's no money so so a student don't have to be questioned about any paying for lunches or anything like right that's that's what the law says okay but they haven't but that um it's passed it yet so I'm assuming during this next hopefully over this next year they'll figure out where the funds are going to come from but it but it hasn't passed or they'll resend it I'm not sure cuz I know during what during I think this came out of Co CU during Co I don't know if you remember they all the kids got this the Department of Education I think wanted it they all got free meals and I think
032that's kind of their intent of what they were thinking continuing it but for some reason they didn't put any money towards it so so funding is to be determined on that um okay so there's new training for trauma um that's coming down January 1st um so this really just says that uh you have to have trauma and for practices and training in service training workshops um and that so there's another slide here I'll get to as well they've kind of revamped all the different trainings and kind of Consolidated them cuz they're they're just Happ they just kept passing it and then there there were like millions of trainings that everybody had do it was really confusing so they kind of they passed a couple laws that kind of consolidates what the training is and kind
033of makes it a little easier to dissect and understand what is needed um so this Public Act removes certain Provisions that requiring uh in service training for all School District employees on methods to respond to trauma but those school districts who are trained in trauma uh can be immune to civil liability if they use a trauma kit um on a student so if they're trained in it um and they respond to trauma with a trauma kid or something happens they are they are immune from any civil liability that's kind of what this this trauma training access can you explain the trauma part so exactly what is it right so I I don't know what the exact it's common forign practices so um so trauma kits are used for things when when a student you know
034is bleeding or has is having an allergic reaction to something and needs needs some kind of assistance uh or or something they're using trauma in the sense of bodily harm in in this in this particular okay legislator so I don't know I don't know exactly I don't know what the definition of a trauma kid is but I was yeah I was going to ask you that too um is it the the physical or is the mental so it's physical yes it's physical so it it's it's like this is related to physical trauma so if you have students who are bleeding students who are having a medical emergency and then the staff is trained on trauma and how to respond to it I know there's also trauma mentally too right like um so I mean if
035you read the ACT doesn't say either way but the way you read it is talking about a trauma kit you know the assumption is that physical I guess there is student that could get hurt if there's there's a mental trauma going on you have to call the ambulance right because kind of acting different ways but it it it is just creating this this uh immunity for liability for I I can speak to it this trauma uh training is it's heavily focused on Athletics and sports so if a kid let's say they run playing football and they their bone comes through their leg then this is the type of training um that staff have to have in order to mitigate that right but this legislator say that but I mean that's the because we have to
036to perform the training and that's what it's about so it's about uh freak accidents um if a kid let's say a fan fa or TV fa and it crushed a kid what would you do so that's what the training is about tourniquets how you stop the bleeding in an emergency situation and that's kind of what a traum is so that's why I assumed it was mostly but I could see how a student could get hurt in a mental trauma situation something happens and they're freaking out and then you have to call an ambulance um excuse me I had a question to what you said so you said like if kid if if a kid bone come out of his leg then someone other than a nurse or doctor can assist him with that without being
037sued right so that that's what the the training is for so let's say the kid is at PE in gym or or at football practice you're probably not going to have a nurse at football practice so the football staff have to know what to do okay of course they'll call 9911 but you put a tourament on really fast to stop the Le and and I'm glad that we're talking about this because uh a student not here was playing football at another school and the leg was broken and so they didn't have anyone there other than that training from the other school so who assisted that child they didn't have any params or anything so the parent had to take that student uh to the hospital so there was no one to be able administer that
038so I was just kind of puzzled on how this works because everyone I think feel that works in the school should be trained right so I mean yes I mean there is did they do away with the tra training I don't know if they it's requirement so the the board has a right to require everybody to do it through negotiation with the UN um but essentially ser certain jobs require this so that would be PE anybody who's coaching a athlete Athletic Club or something like that the nurse um so people that they're required to do the trauma training but the board does have a right to demand it uh through negotiation with the unit for all staff right so this this law is just overall they're not okay so that's that's kind of where I
039was going Illinois does not require schools to have it but if they choose to have it then the people who administer it are from some okay okay I have one question isn't this school considered a trauma school you know because they had brought out a law early I don't know if the law or what but talking about the kids uh seeing murders and things and they come to school and they're affected by that that's a trauma trauma but this this law does not speak to mental does not speak to this is this is only to physical only physical is different kind of okay that's what I want more trauma for practices yes so there's there's two different things 45 yeah that's why 45 okay yeah so those would be those trauma hor practices in training
040for school boards um but yeah that's another training that they talk about too but that's that's a different kind of train okay so so I was talking about all the different trainings for School Employees and Boards um they've kind of cleaned up the school code because they had passed so many different trainings that required and it just became muddled and there was a ton um and so if you look on the ISB website they have a really good chart now of what's required and when um but they passed the law and as of July 1st they kind of clean it up um and so they've outlined the training uh in this in this public acum on the ISB website of what trainings are required when um and so if you look at this section it
041talks about in service trainings that must be completed by the school board and other training opportunities um which ones need to be completed within 6 months of employment and then it's on once every 5e cycle um so there you know if you complete one then you have five years to complete it again but every year you do different a different section um throughout that 5e cycle I have a question about that oh this is to Dr Alexander it's have we um ever considered about having someone train for live Shooting if someone come to the district do we have something place that so we do that every year with our Alish training okay uh Alice training so we do all of our mandatory uh trainings by September 1st for all employees so Alice uh that training
042includes active shooting uh what happens um if there's a incident outside so we go lock down if there's an incident inside we talk about reverse um what's the word uh reverse isolation leave the person you know so we go through that all throughout the year as well as we have to go through that mandatory training with the caget Park Police Department so they come in as well and do it I know Al is used by L schools it's perent um so this these are different topics now um that are kind of embedded in the school code uh for training so it's health and condition of students social emotional learning which is that um adverse uh trauma kind of component talking about developing cultural competency warning size of mental health and suicidal behavior in youth Domestic
043and Sexual Violence uh needs of expecting imp parenting youth accommodation for students educator ethics sex abuse and grooming um you know violence and prevention and conflict resolution um so if you look look at the school code it kind of this consolidates everything in here and it kind of streamlined what's what's being for training all right so another big topic that everyone talks about is Banning school books um and so can a school library ban books um yes or no um so no it really can't ban books um so the illino library system uh adopted the American library library Bill of Rights uh that says that you can't uh remove books because of partisan or doctoral disapproval um and that uh there was a written statement declaring the authority of the library to provide adequate collection
044of stock of books or other material uh to satisfy the needs of the library in the state and so um this kind of extends into into school libraries and school library grants and so if you're going to be eligible for an aate Grant uh for with your school library um you have to adopt the American Library Association Library Bill of Rights uh that kind of says that materials should not be removed because the partis are neoral dis disapproval um and so as long as you have that you should be fine with your state funding um but you have to have that in order to continue to receive funding from the state I think the you guys have a policy on that do we have do we have that we our policy states that we do
045not band books band books so you might want to look and just kind of include the same language that's in the American Library Association um it's probably very similar but that's kind of what they're they the law now requires you to adopt the same the same language um and they're going to look at that for funding purposes um I haven't had anybody had an issue with it but it it'll probably catch up within the next year through press plus okay yeah so very can I can I make one point um and this kind of just covers this entire presentation a lot of these laws were just implemented or implemented uh even though they passed the law we still have to wait for is to provide us the guidance on how to implement it so just
046because a law passed on August 9th does not mean that the district is required to do whatever it says on August 9th we have to wait for is to provide us uh Source documentation and guidance uh on what the procedures of the law are so I just wanted you all to know that uh before you ask questions are we doing this and things of that nature I I will say you don't I don't get into title Title 9 has just changed August 1st and it seems to be a lot of where the focus is so I know for press policies as well so they're they're focusing on that to make sure your in compliance with with those I think that just came out the new policies for the board for for Title 9 and so
047so um when you read through press they also that the next update they have is going to address some of these these policies as well so um if you don't have it it's coming so we get the new laws of event um okay so can special education students be exempt from participating in emergency School drills um yes if the teacher feels it's too burdensome yes in consultation with the student 5 four plan no all students have to participate so the answer is yes in consultation with the students IDP or 504 plan um so if you have have a student who needs emergency uh accommodations during a drill um you want to make sure that that is being addressed in their 504 or IP plan as well um because uh that's considered an accommodation um so
048in terms of I don't know if you heard the ter I do a lot of the special work so I don't this is all my my whe he um but for David purposes of that um we want to make sure we're talking about it when we have those IEP meetings and putting if they need these during a drill so that they know what to do in case of emergency for those students so that would be like students who are wheelchair M or can't move as well or or whatever the needs are okay you just answered that I was going to ask so what types of uh disabilities right so it's really Case by case I mean if you have a student with wheelchair part something like that yes there might be students who are artistic
049who can't handle the B you know so the team's going to know and make the assessment thanks and and this is more applicable uh M to what you said like a student with autism who the loud noise and frantic moves would go crazy but we take this opportunity for especially for our students and wheelchairs we take this opportunity for drills to practice because if something happens we need to know and everybody needs to know what happens in this situation so we don't shy away from uh students disabilities but we are cognizant if you have certain students there are certain students who does uh who are medically fragile who shouldn't be in cold air so sometimes fire drills there's no time to get a coat or jacket so the kids are outside so if we had
050a student like that then we would make Provisions for them to stay uh but overall we try to make sure we include everybody just so that we do know how to deal with those differences when they come perfect so you guys are a union just in the law now re I want to make a comment about that too Dr I want to conv you guys on that because um like my grandaughter she's been through trauma and when she was going out one day oh I'm sorry one day um they you all was going out for a fire dram and due to the fact of the the amulance and the police it just had her all you know so you guys actually informs her let her know that it's going to Beed and I thought that
051was a great thing well appreciated all right um so there's new uh Provisions for school placement tuition reimbursement that went to AFF July 1st um so you want to just kind of look at this it provides if students placed uh in a public special education day school that's kind of those therapeutic schools outplaced um if you are making payments of tuition uh in excess of $4,500 uh you're not you're so it says tuition P be responsible for an amount in excess of $4,500 equal to two times the district per capita tuition charge um and then you can get Reimers from the state so you want I don't know what your tuition charge is you have to look at your policy yeah it is a lot so um you just want to kind of look at
052that and see if if the changes kind of what the tuition is you're paying and get R we will benefit from this we have some students that are um the students who are not in the co-op so it's a students that go to the private placement um the co-op we can control the cost private placement is very difficult to control the cost so we've fought very hard to get this bill passed even going down the spring Springfield to Lobby okay um and essentially uh the co-ops only so big they only have so many seats so you have to go to these external companies menta and all these other companies and you have no say so so to speak over what they charge so this will benefit our there are a lot of schools that are
053to so yeah so yeah so you just want to I you're well ver with this so just kind of look at your bills and see you can get some reement for this which is um okay so now we're going to talk about transition plans for special education you guys don't really you guys do Transition plans do you have what what's your highest grade we do Transition correct so um if you have your eighth graders this mostly to special ed um you have to include all the above in their transition plans assistant Tech needs uh Services related to future goals for employment or Independent Living um and then considerations for post-secondary education so even though they're not in high school um when you're looking at those uh eighth graders and they have IPS you want to
054be talking about transition plans and kind of include all these things in there which I think most people are doing anyways but now they just kind of made this more specific um okay all right so then there's student access so this is just access to mental health for students a legislator loves mental health and making laws for mental health lately um just because of everything that's going on in the world so they're going to provide uh the Department of Human Resources is partnering with the State Board of Education uh to provide assistance for mental health care during school days uh to students that need it um and so this is going to come this is passed but nothing really is going to take effect until after July 1st of the next year um because they
055haven't passed any kind of the rules or how that that Cooperative between the two departments is going to happen um but there's probably going to be some new materials that come out about mental health between the Department of Human Resources in mby within the next for the next school year so it's coming down the pike it's pass and ready to go they're just going to make hopefully you know they take forever to make these documents but that's the deadline so hopefully they'll they'll have some more guidance on that and how that works um districts can have oxygen tanks uh as part of their uh Supply if they want to as of January 1st I know there's there's a bunch of different undesignated uh medications that District can have I don't know if you guys have
056those prescriptions there's you know epipens uh asthma inhalers and now you can also have oxygen in takes if you have students need them uh you can get a prescription to keep on hand for oh we oh we can have a we can get prescription to have that just in case yes you can you don't you don't have to but it says that you can get it on designated oxygen tank if you need it and this is most this mostly supports your cooperatives who have um students who are medically fragile so not necessarily in the public schools but it still gives us the same right right so I you know you just want to look at your school po popul and see if there's need to cuz you may I mean not every single student who
057has out place but just something to keep in [Music] mind um so this talks about speech and language pathology uh for students so this is uh can a c for speech and language phology perform speech services for students um and the answer for here is yes under the supervision of a certified speech and language pathologist I thought this was an interesting law it goes into effect January 1st um but this also helps with some of those um vacancies right and I know speech language services are very hard to come by there's not a lot of them um and so if you have someone who has a candidate and you have a speech language pathologist who's here already licensed and they're willing to supervise them it may be another tool for you to get those services
058to students uh if you have someone who's able to um you know watch over them if they're if they're getting their their candidacy for it um there's new information about diabetes that also needs to be provided to uh students and staff and families um this is from July 1st so you want to just make sure you have all your your uh handbooks and board policies updated um I don't know if the Press made a new policy at related to diabetes but there's information you have to be provided to everybody related to diabetes um so the information so this is the information on this slide and I I don't know if you guys have copy of this but make sure you get a copy of the slide slides um so this is the information that has
059to be included in terms of di diabetes um to all students and staff in the handbooks and and online um just kind of what diabetes is risk factors recommendations um screening process and then [Music] recommendations and then um there's lots of stuff that has to be included in the student handbook it's always updated every year there's some new stuff for this year uh the name of of Staff train and funds I don't if you guys know what punds is person under under need supervision um board policy that new board policy related to discrimination and harassment uh is the resource guide on sexual abuse response and prevention the district's code of professional conduct and information of type one diabetes so there's kind of this new new checkbook checklist for a student handbook of what needs to
060be included all the new public acts so um all that stuff I just went through you might want to just look at your handbooks and just make sure it's all included in there if not for this year at least for next year you'll have it updated and just to reiterate what Mary said ISB is working on creating a universal handbook across the state so you still will be able to you know put your own touches on it but it's a universal handbook that has all of the components and requirements that they require and then once it gets to the district you put your spin on it which I'm surprised it took this long I mean I know there is services that provide that yeah I'll be happy when that comes out excuse me I have
061one question yeah Dr Alexander the children that we might have here that is diabetic the lunches do they bring their own food or have we staffed our lunch people to you know make special foods for them so for most students who are diabetic um the standard ISB menu satisfies their diet of sort if there's a need for like uh I know one kid I was just talking to her the other day she eats four Starburst every hour or she doesn't have Starbursts we can get an orange juice and fruit so that's what she utilizes to level her sugar so we don't necessarily have a specialized menu for students with diabetes we just have additional support for them candy peppermint fruit juice uh and they always have access to that okay well I mean legally but
062I sure your dis doing this students who are diabetic have to have a diabetic plan so they meet with with the school and the nurse and they come up with that plan and that's usually right 504 some students some schools don't call it 504 for but whatever it's under um and that's all included in that so hopefully it sounds like you guys do that so um that's usually where it's addressed to so then all the teachers and everybody knows what to look for and what the plan is okay for the they do that with diabetes and seizure and a bunch of different things so um I've also included a SL care are the things that should be included on your District website and posted um there's just some new policies that are out there so
063again you have to put the new harassment policy um you have to put the person who's uh the punds designated to be the punds uh the person in charge funds from the district the new sexual harassment grievance procedures um so just you just want to make sure that those are on your your District websites uh when you can and then this this is a new law that's coming out uh the uh just updating website mobile applications so I don't know if you wanted to let your it departments know um the Department of Justice and this is not just schools this is for all websites has created new uh safety and updates to websites and mobile applications and so it's going to change your web content content and the standards that are on them so you're
064going to want to start looking at that and make sure because I think it's going to be a process because they have to be updated by 2026 or 2027 um and so just make sure your it Department knows items working on updating your websites so this is something that we actually uh get audited on by the Illinois Association of regional um school superintendent so isc4 the regional office when they come out to do their compliance visit one of the things they do is look at your website to make sure it's ADA Compliant so uh our website we have a new website our new website is ada8 compliant um it's not easy at all to get this done um but we did work with our tech company to get it done so we are in compliance
065with this but this is very interesting to say the least yes you're the first district I heard say that so because I know it does take a long time to get these developed up here so they pilot that this was a pilot before it became law and region 7 piloted it so okay good to know all right so nothing here on top of that which is good um oh and so this is not in in effect yet but I thought you guys should know there and I think I mentioned this briefly before I was talking about the corporal punishment but ISB is working on model guidance for student discipline there is no State model guidance for it um you know there's laws but every school has their own kind of way that they do discipline
066and write their their procedures so hopefully and you I say hopefully because a lot of times they they delay putting this stuff out and they want to get public comment and review but there's supposed to be a model guidance uh issued by next July probably so for next school year um so I think this will be very helpful uh for districts and in issuing discipline across the board for uniformally across the state um so it's just something to look out for it's not available yet but um you probably will be hearing about it coming on the F attention um and then another one that's coming down that's uh something you watch uh which I thought was interesting as well this has not pass yet but it's pending before the legislature it talks about maximum case
067loads um and I think these numbers will probably change but they are talking about maximum case loads for uh School social workers nurses psychologists and speech Li Pathologists um and so that if this passes in some form or another I think this could uh you know really impact school districts uh depending on the sizes so I mean if you look at for example they're they're asking for nurses to have 250 students Max that's a case load so that's that's less than one school in some schools I don't how many students you have in your school but I think that could really impact districts so we want to just make sure we're watching this as it comes down so I submitted a uh witness against this bill last week um and historically we look at the
068nurses case Lo based on Special A what they're required to do uh pertaining to IEP we don't necessarily look at their case loow for every kid in the school the proposed legislation looks at everybody in the school as being part of the case FL so if that's the case um if you have to have 250 kids to one nurse then we would have to purchase a nurse for every single building um lot ofct don't do so that's I mean that's just not District a lot a lot of schools just have one nurse that travels through only satisfying IEPs okay so our district is very uh privileged to have a nurse who does um IEPs as well as general support in the building but this legislation would negatively impact our district right and it's not those
069nurses too as you can see social so um I just thought it was something that you guys should be aware of um it hasn't died it's still very active in the legislator so we're going to hear more about this yeah um okay so this is I I don't know if you guys have issues with with transgender in this District um but there was an interesting case that came out of uh Indiana uh that's affecting is kind of the law now for Illinois um so I just thought you guys should be aware of it so this is AC versus metropolitan school district it's the uh seven circuit case um and it was a decision that involved three transgender male students in two separate Indiana school districts um they were denied access to the boys bathroom um
070so and the boys locker ref in class so they they were transitioned they identified for mail for several years prior to requesting the use of the facilities um one of the students was offered to use the heal Health office as the bathroom or attend school online um and so they didn't like that obviously so they filed lawsuits um and they said that because of these restrictions and they weren't allowed to use uh the boys bathroom and boys facilities they were experiencing depression low School attendance and low grades um and so the court affirmed uh and and decided with the students who are transgender um and they said uh that they transgender students should be allowed to use the boys bathroom and locker room uh it's still ongoing the litigation has not completed yet but the
071junction uh was was thror out and said that they could use the boys boys lock room depending the outcome of this um and they said uh that the disallowing them to use the bathrooms violated their 109 and equal protection Clause rights um I think what's important about this case is they really looked at um because I know a lot of school districts ask me a lot of questions about this case you know if you have a you you want to look at what's going on with those students right so it's very different if you I know some schools push back and say well what if you have a student who just says I identify as a girl because they want to go in the other bathroom it's very Case by case right so this I
072think the reason why the court decided this way in this case is there was enough evidence to show they had been transitioning for years the district had known about it they were showing you know kind of those effects on the students like they had low raids they were having suicidal ideation depression um so there was a lot going on with those students that they could show up really back to that um and so it really is Case by case and I think if if you do get something that comes up like this certainly call our office CU we can definitely help you try to navigate that um but really you know as much as you can still include those students uh you know in those bathroom situations this case says that you have to um
073but again you want to look at the full scope of what's going on and make sure that um you know you're doing what's best for everybody in the situation the safety issue as well so question it was almost so for whom me for the child if I have a daughter that if my daughter say another transition guy that's a guy that's a transition over to a girl and he says I want to go into the girls watch but then once he get in there he might just decide he want to do something different so where where does that leave with safety purposes well I think you have to look at Case by case basis right so that crosses over I think to like discipline issues right prevent you disciplining students already that's all I'm so
074excuse me my safety was some some kids I'm just saying you know um cuz when I went to a college it was um it was not trans but it was like what is it though everybody could go all genders so I just went in because I just wanted to look to see what was going on and so I a safety issue meaning that some of the kids may not accept the transgender person so that's what I was saying with the sa right not just um that cuz it's happening everywhere because they have an all gender but just that piece and then that's when like oh I don't like you cuz it's some kids and they CW and even some adults they not accepting right so that that's what I was saying as far as the
075safety part so right so in terms of like the bullying and the stuff that goes on for that there's laws against that so T is kind of putting has a lot of protections now for lgbtq and transgender a lot of ways that schools are dealing with this issue um and of course every school is different is um you know if you have a student that really is AD of they want to use a lock gr and students are pushing back against it have maybe two different time slots andad letting kids choose like you can't force students to say you have to go at this time but you can let them divide them into groups in in some way that's that's not uh discriminating against them right so um want to be mindful five moments before
076we start okay I just want to ask I have one question how do you deal I mean do say if you have a student that comes to school today and says I'm going to be Barbara and tomorrow I want to be bill so I want to go in this washroom today and I want to go to that washroom tomorrow so again Case by case what I would say is you would want to sit down with that student and figure out what's going on right is a confusion right you know and talk to them and kind of see where they're at and how far long they are they um thank you this this is the last I will just say um I didn't talk anything about Title 9 um but I just wanted to mention it
077briefly Title 9 change as okay changed as of August 1st um there there's new definitions as to what sexual harassment is everybody needs to be retrained on it the full Title Nine um it's now sex based harassment which includes a lot broader def commission um there's new ways to handle title n investigations which I think is better for school districts because they wanted to do these inform formal resolutions rather than go through the whole um investigative process if you can avoid it um and and and do that kind of resolution um I don't know if you've heard about injunction that different states have passed there are some Illinois schools that are part of those injunctions I don't know if you guys know if you have boms of Liberty who are part of this District so
078you guys might so what there's a group called Mom deliver so they filed the lawsuit in Kansas and that judge is upholding injunctions for students who attend different districts in Illinois so if the mom's Liberty says my student goes to this school then that the judge said is upholding injuction saying that the new title line L RS are not applicable and are not to be imposed yet so there's a long list it's not every District it's not every school so if you are unclear if your district is part of that I you know give me a call and I'll look it up for you um because list is Ever Changing um so not every school in Illinois is part of it only some of them that deals with M to Liberty because they're part of
