had school districts view industry works. We've also if you look at page two, it includes something very unique for a school district to hold their construction manager to. So the construction manager agrees it will act in a fiduciary role. So they've agreed to be spend money. Um and very rarely do we standing relation they uh the contract outlines our terms. It outlines how we how they pay how we how it's built. U what substantial We should we should etc etc. It has there's uh we generally include names of employees that want to make sure they assign to us in the contract. We include structured schedule. They are a snapshot because things happen um and budgets and they're aligned as closely as possible with the architecture contract. there. Uh, want to thank Christie and our attorneys
spending I don't know how many times it's been back and forth times reviewed it multiple times changes made sure everything matched. So it appears our contract pass. >> Any other questions? Um there are exhibits building that explain the building. There's sign schedules, due dates. It really outlines the entire pond. We've been working at it. Uh I finally have it to a point that we get these really small tables with every detail. But with every detail into the contract so that the rates are in there and everything is building for the boxers attorneys. this this contract and all they started with the uh uh Miller Canfield they uh they give us a contract modifications district and then they help make sure language that anything that
could be changed still fits and work for SA She knows how she's going to be built. >> And was TMD are the last bomb? >> We did. Michigan's 31A funding for school safety and mental health has been delayed for many districts
due to a lawsuit challenging the new requirement to wave lead privileges in case of a mass casualty event. A compromise allows schools to opt in by December 4th, 2024 and resend the waiver by December 30th, 2025, sorry, December 4th, 2025 and resend the waiver by December 15th, 2025 if they are concerned about the provision's broad language. 31A funding these things like school resource officers and security equipment must so lots going on strings attached the most recent um ruling was to allow districts agreement was waiting was to allow districts to op in and that after that December 19th rule if it is not the district's favor that soon or if there are some strings that are still in the district that you can opt out without uh it's uh the attorney that Miller Canfield that is
representing district lawsuit um it's pretty clear uh process true law recommended saying go ahead. What they're recommending talked about is we have until tomorrow to say yeah we're in but we can always so but we don't act out no matter what back and says yes these waving privilege is unconstitutional that's their approach they talk about that they agreed they'll have >> the courts have agreed that in the case of issuing >> that's >> and if that gets moved from the state >> even the agreement for districts to reset was agreed between the department of ed >> the judges can do it >> yeah but the issue is they have to distribute funds by >> so what'll happen is districts that say they're going to take it we get the funds and if we resend that
they just have to take it back. They do that all >> they'll take it over time. >> I don't >> and they do it we get checks and they take >> you can res I don't see the sun by tomorrow. >> What is the what is the financial op $140 a student? You're about 3312. So >> okay. >> Yeah, it's a month. >> But I agree with feels like it would be our fin >> as long as we have the opt out because >> legal privilege. There's no reason. There's no basis. There's I I don't understand why anybody would ever do that. >> We'll know by the 19th. We als >> we don't need an actual action. We're just uh >> generally the board's never. >> Yeah. wouldn't think that would work. some unless unless
the grant packet said authoriz change our approach that teach >> right so the decision down in the 192 >> I would say the decision need a board action to tell you to go out. We can just tell you right now >> in the whole rejected the issue is modified in some manner and then you said after >> we have to before >> I would say the deal >> yeah the investigation pieces they are they are >> no but if they might the way often go they would modify or there will be an agreement to modify what's proposed. There'll be a different flavor of it. Well then so if it's if it's in whole just rejected that condition entirely fine but if it's modified to be narrower consider why not >> I'm around over the holidays
so people. [laughter] >> Okay. So, we don't need to take any action, but we're >> y 19. >> Keep us updated. North Camp everybody we're getting like MASB sent something out immediately webinar >> so we don't have we have not engaged council on this they would join >> they were they were good what we needed So we're not part of the litigation, but we have to wait and see whatation comes out so that we know whether >> that's fairic. >> Thank you. >> All right. Um it's our second opportunity for public participation. No one has joined us. So we will move on to the questions.
