001Madam supervisor, can you hear me? All right, can you hear me? >> [screaming] >> No, they're upstairs. [laughter] I'm just going to go after they do their stuff. Oh, okay. Okay. Matthew? How's he going to hear me? Eileen's working late. Taking pictures. I really had time to talk to her today. I hope she enjoyed her vacation. >> [screaming] >> I sent he's I sent him a text. He's writing back to me. I don't think they're in yet. Uh he's having a tech issue with his mic. Thank you. >> [laughter] >> After all that I told you I told you I was coming in hot and heavy. After all that, now LTV is having a tech issue with their mic. Okay, here we are. Okay, so Okay, we're going to get ready to start. >> [laughter]
002>> Thank you. Matthew, you ready for us? Can you hear me? I can. Okay, good. Yeah, we're we're rolling now. We're live on 22. We're streaming to YouTube. Sorry about that. Um you guys can begin. Phone lines are open. We have a few callers waiting as well. Okay. Well, thank you, LTV. Good evening, everyone, and welcome to the East Hampton Town Board meeting of Thursday, April 16th, 2026. Michael, if you could please read the roll call. Council member Flight. Present. Deputy Supervisor Lease. Present. Council member Rogers. Present. >> Council member Calder-Piedmont. Present. Supervisor Burke-Gonzalez. Present. If we could all please stand for the Pledge of Allegiance. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice
003for all. That was the best one. Take that. So, first let me say we don't always have so many young leaders here in Town Hall, and we're very excited to welcome all of you tonight. So, I am going to start. I'm going to move down here and uh invite Liam Knight up. >> [applause] >> Liam, I don't know if you know this, but when your mom was pregnant with you, my son was in her fourth grade class. >> [laughter] >> A little like, "Woo, I'm not ready for this." Okay. So, the Town of East Hampton, we want to give you a certificate of recognition. And this is awarded to Liam Knight in recognition of your outstanding achievement as a New York State YMCA Scholar Athlete of the Year. A member of the YMCA Hurricanes from
004the age of seven and a team captain for two years, you have shown exceptional dedication as a student, athlete, and leader. While competing for the Hurricanes and participating in three varsity sports, you maintained a 4.0 GPA and completed 400 hours of community service focused on water safety through the Hamptons Lifeguard Association, and I know they're very proud of you. Your accomplishments in the pool, in the classroom, and in service to others have made you an an outstanding example for young people in our community, and for all these young faces here that are looking at you and look up to you. We just want to congratulate you on behalf of the Town Board. Congratulations. [applause] All right, don't go. What we're going to do now is invite up all of the Hurricanes and your coaches. [clears
005throat] You're going to all stand up here. Maybe we have the taller taller kids like you guys in the back. And have your coach here next to me. Thank you. Hello, Eugene. How are you? Nice to see you. How are you? How you doing? Doing good? Parents and grandparents, you got a good position? Here we go. Everybody ready? Whereas the East Hampton Hurricanes YMCA swim team earned the title of New York State champions after a season defined by dedication to one another and a shared commitment to excellence. Whereas this achievement was especially notable because the Hurricanes entered the state meet as the underdog against larger programs including Hunting including Huntington, the defending state champion, and still rose to the top. And whereas with 108 swimmers in the program, 76 athletes competing at the state championship,
00612 new team records, and 11 swimmers qualifying for nationals, this accomplishment reflected the strength of the entire team and the contribution of every swimmer. And whereas by advancing to the YMCA Nationals, the Hurricanes carried that success to the national stage and showed that a team from East Hampton can compete at the highest level. And whereas this achievement reflects the determination of the swimmers, the guidance of your coaches, and the support of families whose encouragement and sacrifice helped make this season possible. And whereas the Town of East Hampton also recognizes the YMCA East Hampton Rec Center and the YMCA for the important role they have played in the lives of these young athletes by providing a place to train, to grow, and to be a part of a program that has helped shape both young competitors
007and strong young people. And whereas the success of the East Hampton Hurricanes YMCA swim team gave this community a meaningful moment of celebration and served as a reminder of what can be achieved when young people are supported and inspired to give their best. Now, therefore, I, Kathy Burke-Gonzalez, supervisor of the Town of East Hampton, on behalf of the Town Board, do hereby recognize and commend the East Hampton Hurricanes YMCA swim team for winning the New York State championship, for advancing to YMCA Nationals, and for the example they set set through their effort and unity, and do further recognize that the YMCA for its contribution to this achievement. Congratulations. We're so proud of all of you. >> [applause] [applause] >> When we have young people at Town Hall, we give them an opportunity to come up
008to the podium. If any of you folks want to go up and let the community know what your this season has felt like for you and what working as a team feels like and being, you know, a Bonacker, now is your opportunity. We'd love >> [applause] >> All right. Hi. Hi. Um Just say your names so everybody knows. >> My name is Novella Dunham. Um and this season has felt really like good to me because all these swimmers are like really good, like really good. And all these coaches are like my besties, like best friends, especially all you guys. Yeah. Um So, I'm like really proud of the whole team and like really proud of myself, too, because I feel like these coaches have helped me a lot cuz I've been swimming for a while,
009too. So, it's like helped me come up to this level to swim. Yeah. >> [applause] >> There you go. You can do it together. Absolutely. I love it that the girls are going up first. You could just I'm Reagan. When you talk You need to just bring it down >> Yeah, cuz I'm like short. I'm Ellie. Um being on this team is like I've been on the team for a long time. Um, me too. And like we've had really great experiences and we like thank all the people that have helped us. I've gotten like some really close to breaking some records. And all the coaches has helped me do that. And the team, too. >> [applause] >> I do want to commend the team. I want to commend the community. I also want to get
010a big round of applause for all the parents involved because [applause and cheering] the fusion of everybody working together, we couldn't do what we've been able to do. And I pushed this team Really hard this year. And they really rose to the occasion. And I can't say how proud I am of everybody. >> [laughter] >> And all the coaches, all parents, all thank you very much. >> [applause] >> Yes, absolutely. Look at this little one. >> down, okay? >> This little one. My name's Isabel. My name's Adeline. And I just want to say um I think I really worked really hard this year. Um, but we couldn't do it without our teammates and our coaches encouraging us. And they've helped us get our time improvement and we really thank them. And I just want to
011say I think I really loved how my coaches really pushed me because without that I wouldn't have actually did really good because at first I was like not the best swimmer, but now as I rose I'm actually a pretty good swimmer because of them. >> Yeah. >> [applause] [cheering] >> We have two more coming up to speak. Yeah? Go ahead, the three of you. I'm Paul. I'm Geronimo. I'm AJ. Um, I just want to thank all the coaches and all my awesome friends on the team um, for just being there for me always and pushing me to do better um, even when we're not at practice. Even at school, just saying like "Hey, nice job at that meet." Or you did really good at practice yesterday. Um, it just really pushed me to go as
012fast as possible um, at all the meets. And I just want to thank you guys. >> [applause] >> Um, I want to thank um, my friends, my family and the coaches especially because they helped me push and yeah. >> [applause] >> I I want to thank um, my parents and my coaches for always um, pushing me to the um, to always get better. And yeah. Beautiful. >> [applause] [cheering] >> I want to show of hand. How many of you folks want to be town lifeguards when you're old enough? You folks are our future. Michael, if you could read the last public hearing notice, please. Please take notice that the Town Board hereby directs that a public hearing shall be held on April 16, 2026 at 6:00 p.m. or as soon after as this matter can be heard at East Hampton Town Hall, 159 Pantigo Road, East Hampton, New York to hear any and all persons either for or against a local law entitled a local law to amend Chapter 225, Taxation, of the East Hampton Town Code to allow for a property tax exemption for newly created accessory dwelling units. Thank you, Michael. Would anyone like to address the board on this matter?
025Matthew, if you could please put Mr. Buda through. Okay, putting him through. Good evening. Thank you. David Buda from The Springs. I'm participating in this public hearing to point out that some of the language of the proposed addition to the Town Tax Code, Chapter 225, is either incomplete, imprecise, incorrect, or otherwise needs to be clarified in order to ensure that the newly created property tax exemption is not misapplied to properties that are not the eligible and intended beneficiaries of this new property tax exemption that the Town is proposing as a local option to implement a state law. The legislative intent section of the Town of the legislation before you should be amended to make clear that only properties with new ADUs that fully comply with the provisions of Town Code Section 255-1163 are eligible. Next,
026the purpose section contains language referencing the creation of one or more additional residential dwelling units on the same parcel, which would be inconsistent and contrary to the current Town Code provision that states that, quote, no more than one accessory dwelling unit shall be permitted on any lot, end quote. Next, the state enabling legislation, which is New York State Real Property Tax Law Section 421-P, which was added by Chapter 56 of the Laws of 2024, states in subsection five that it is to that to be eligible for the ADU property tax exemption, the, quote unquote, pre-existing residential building on a property that adds a newly created ADU must be one that is, quote, designed and occupied exclusively for residential purposes by not more than two families. Subsection six also states that the pre-existing residential building must
027be, quote, used primarily for residential purposes, end quote. To my mind, that means that if an ADU is to be added to a property that has a residential structure that is not occupied by the owner or is otherwise being used by the owner for income-producing purposes, i.e., it's being rented by the owner and not occupied by the property owner, then the owner is not eligible to obtain the property tax exemption for newly created ADU. The New York State Division of Taxation and Finance has reportedly issued guidance that states the property must remain residential and cannot be used as a short-term rental. To make this point clear, the state-prepared application for this tax exemption, which is Form RP-421-P-ADU, requires the property owner to affirmatively state that, quote, prior to the creation of the accessory dwelling unit,
028the property was a residential building that was designed and occupied exclusively for residential purposes by one or more or two families. The state-prepared instructions for that form states, quote, for the property to become eligible for this exemption, the following eligibility requirement must be met. The ADU must have been added to a residential building that was designed and occupied exclusively for residential purposes by not more than two families. The state legislature did not create this new ADU property tax exemption so that it could be taken advantage of by property owners that do not occupy their residence or that or that use it primarily or exclusively for income-producing purposes. The proposed new Town Tax Code provision fails to incorporate this aspect of the state real property tax law, which enables you to consider this exemption, and therefore
029to adopt it in its present form would be ultra vires, and I request that you have your attorneys look carefully at all of the appropriate references that I've cited. Thank you, David. Matthew, is there anyone else on the line for this public hearing? We have no additional callers. Motion to close. Second. All in favor. Aye. So, we've gone through all six public hearings and now we're at public portion. Is there anyone here in the room that would like to address the board? Please. Welcome. Please state your name and address. Good evening. I'm John Stoner, a 50-year 56-year [snorts] Wainscott resident now living in Sagaponack. I'm here to follow up on my Tuesday call and deliver the promised quantification of public support for the 66 Main Street uh management plan. Hillary Osborn Malekki couldn't join us
030tonight, so I'll share the new data and try to make sense of what I've observed over the past few days. This all started with the language we've been using to refer to the volume of public response within the idea that maybe some aren't listening to sheer volume. It's been a slew of pretty united asked to the board or the overwhelming support or an outpouring of public sentiment, but I like Supervisor Cathy Burke-Gonzalez's description best, dozens and dozens. >> [snorts] >> After reviewing minutes, videos, emails, call-ins, and in-person statements, even those read in absentia, I identified 14 unique individuals who have voiced support this year. This includes the first Jan Jan 29 first draft, the Feb 3 revision with its many changes, and the final public hearing where Hillary's updated garage sleeping quarters description was was
031incorporated. Whether you were affiliated with the CAC, another group, or simply spoke as an individual passionate about the Vista, you were all counted once. 40 people in the record is neither understatement like 24 or two dozen, nor an overstatement like 48 or four dozen. Cathy was right. This is dozens and dozens or just right at three and 1/3 of a dozen. I've sent the full list to the board under the 2026 Wainscott public activist title down by affiliations and individuals. If someone was missed, let me know and I'll add them to the tally. Along with the list, I began categorizing messages. No farming, deer fencing, no asphalt path, landmarking structures, and acreage were eight key issues in total. The pattern, however, became clear quickly. A pretty unanimous chorus around to discuss priorities. Everybody's Everybody experiences
03260 66 Main slightly differently, but not all without getting the quietness, as Kate used, and the unique experience of peering back in time, something I'd never considered in my lifetime here. But I'm grateful to have had the opportunity to hear and see it described through others' eyes like no other place I know. We all came to this moment differently, from which reminded me cautiously of the old bestseller, 92 New York Times Men Are From Mars, Women Are From Venus. I know that framework is dated and risky, but it came to mind as I listened to the board members each expressed in their own way a very appropriate respect for what we have at 50 at 66 Main. Ian spoke about being open to working with licensees and suggested creative solutions like mowed grass paths with
033special outdoor wheelchair tires. Dave [snorts] recounted his success with historic designations from Amagansett Life-Saving Station to the D'Amico Art Barge and Montauk Second House. Tom was briefer, but echoed the sentiment that landmarking now would be too restrictive and flexibility today leaves doors open for the future. As As Cathy closed the meeting, the town was the tone was clear. The guys were absolutely listening. No new arguments arose and the plan remained unaltered. It has become apparent to me that we are and have been on the same page, just [clears throat] interpreting the approach a bit differently. I'd ask us all to believe in the process, and and I mean all of us who are on the public side as as well as each other. Um >> [clears throat] >> the group and all the incredible and
034the incredible subject matter we are we're able to work with. And on reflection, I'm much easier about it all and more than happy to keep the faith. Thank you. >> Thank you, John. Would anyone else like to address the board? Barry. Welcome, Barry. Hi. Hi. Um talking on the same topic. Uh first I wanted I just wanted to thank you board members for the road improvements on 114 Stephen Hands and the roundabout Long Lane and Stephen Hands. That is really an improvement. A change that clearly is better. I support those kinds of changes. On this matter of the Osborn property, uh I'm a member of the Wainscott Citizens Advisory Committee. Uh this land is a centerpiece of Wainscott. I I think that's an accurate to describe it. To echo what John said, everyone I've spoken
035to or heard speak wants to preserve the land the way it is. Preserve means preserve >> [snorts] [clears throat] >> as it is, which is so rare and especially out here when, you know, we're just subject to constant uh infringement of the of the natural habitat and the landscape and it's just constant changes, and but this is an opportunity to do something better, I think. I do have some questions. I wouldn't want to see I would wonder why three board members would override the wishes of the great majority of Wainscott residents, those who have the greatest stake in this. If the land is farmed, who gets to farm it? If the farmer turns a profit, who gets the proceeds? The pond is polluted. Will the farmer use chemicals? I believe this land should remain in
036its present state, preserved. Thank you. Thank you, Barry. Would anyone else like to address the board? Matthew, you could put those callers through now. Okay, I'm putting through the first caller of phone number ending in 0017. Hey everyone and and thanks for the time. Um my quick statement here. So, I'm I'm a home homeowner at 546 Wainscott Northwest Road, directly adjacent to properties at 549 and 550. Okay. Um I understand the town is considering acquisition for future housing. Yes. I'm sorry, before you start, we we the town clerk needs your name for the record. Sure, it's uh Christopher Kozak. Okay, thank you, Christopher. Now, you can start again, please. >> Um Okay, perfect. So, I I am a homeowner at 546 Wainscott Northwest Road, directly adjacent to properties at 549 and 550. Um I understand
037the town is considering acquisition for future housing purposes, uh but what concerns me is that this is being advanced without any defined plan for density, layout, or infrastructure impacts. Approving the acquisition first without deferring environmental review and development details limits meaningful public input at this stage where it matters most. Resolution that impacts to groundwater, wildlife habitat wildlife habitat, traffic, and community character cannot be meaningfully assessed without a defined project. This is exactly the concern because it means the town is moving forward without a clear understanding of those impacts. It's difficult to reconcile that impacts cannot be assessed at this time without a defined project, but funding already restricts the use of this property to community housing. The property is located within a groundwater recharge area and is subject to the water recharge overlay district, which
038limits clearing to approximately 45,000 square feet. That total must accommodate all buildings, parking, and septic infrastructure. Any practical construction scenario, particularly at a multi-family scale, would likely require the town to seek flexibility from these clearing limitations. That raises clear environmental implications in a groundwater sensitive area. Given that this area relies on septic systems and that water in Wainscott is already a sensitive issue due to documented PFAS impacts at the airport, it raises real questions about how multi-family housing could be accommodated here without significant environmental impact. This property also supports a significant amount of observed wildlife, including deer, fox, mink, turkeys, a wide range of bird species, further underscoring the ecological sensitivity of the site. Looking at existing community housing developments in East Hampton, they're generally located along major roads or within developed areas. This site
039appears fundamentally different. A wooded, groundwater sensitive parcel with no sewer infrastructure, it raises questions about how it aligns with that sitting approach. I also want to note that this statement was submitted to the town clerk for inclusion in the public record. I was advised by email that it would not be considered until after this resolution is passed. This raises concern about meaningful the meaningful role public input has right now on the acquisition of land itself. I would ask the board to provide clarity on the potential scale and impacts of any future use and to ensure that environmental considerations and community input are fully addressed before moving forward. Thanks for the time. Okay, Christopher, could you just stay on for a minute? Are you there? Yeah, yeah, I'm here, Susan. Okay, so just so the way
040it works is we have the resolution tonight that the the board is going to consider and if we notice it for public hearing, that's the time when the the public record opens and then the public record closes just the the night of the hearing. So what the clerk asked you to do was resubmit your email tomorrow morning and then it will be on the public record. That that that's right. My concern and maybe this is my misunderstanding is that the resolution today approves the actual acquisition which is what the comment was about rather than the actual development around about the use of land. No, it sets a public hearing. So there's going to be a public hearing on May 7th at 6:00 and that's when folks can speak again. They can either send us emails,
041write us letters, or they can come to the meeting and speak on the records or call in like you just did. It's It's And if you have questions about the procedure, you could call any one of us on the dais and we'd be happy to to take you through how the the mechanism works for public hearings. Okay. No, no, fully appreciate that and and I will I'm going to endeavor to attend person. So So thank you for welcoming to the detail there. Okay, thank you. All right, Matthew, you can put the next caller through, please. Okay, caller with number ending in 7006, I'm muting you. Thank you. Hi, this is Alyssa McKenna. I'm also a homeowner at 546 Wayne Scott. No, thank you for telling us educating us on that process. We look forward to

When, you know, shocking the heart
069is one of the few ways you can get it back into a regular rhythm, and the other is when someone has an anaphylactic reaction, and really the only thing you can do to get that airway open in that situation is administer epinephrine. So, the fact that we're doing this to our PD, the speed at which we will get medications to patients in need will save lives. So, I think this is a fantastic thing to do. Yeah. So, just for the board, Lieutenant Alversa came to me and wanted to put this program in place. I outreached to Sheila Rogers at the East Hampton Healthcare Foundation to see if they wanted to collaborate and partner with us, and Sheila couldn't say yes fast enough.
