All right. Good evening, uh, East Hampton Town Board. We're live on channel 22. The phone lines are open. We're also streaming to YouTube. This meeting is being recorded and you may begin. >> Great. Thank you, Matthew. Good evening everyone and welcome to the East Hampton Town Board meeting of Thursday, March 5th, 2026. Michael, if you could please read the roll call. >> Council member Fleet, >> present. >> Deputy Supervisor Lee, >> present. >> Council member Rogers. Council member Calder Pedmont, >> present. >> Supervisor Kathy Bur Gonzalez, >> present. If we could all please stand for the pledge of allegiance. I pledge algiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. >> So, unfortunately, Kate Rogers

is under the weather and isn't joining us tonight. Uh, we do have five public hearings. The first is an acquisition of real property at 68 South Elmwood Avenue in Montalk. Second is to amend chapter 255 of zoning to modify the requirements applicable to accessory dwelling units. Third public hearing is another amendment to chapter 255 zoning modify the building permit requirements applicable to personal wireless facilities. The fourth public hearing is to amend chapter 151 special event permits. And lastly, the fifth public hearing is to amend chapter 75 airport. That's going to be followed by public portion and then resolutions. We ask uh that you kindly keep your comments to three minutes. But before we begin, we have our town historian here. Welcome, Hugh. >> Thank you, Madam Supervisor. The U town crier is still on February

break, so I'm the town historian. In 1784, there was a a school built in Eastampton. It was called East Hampton Academy. It was largely the brainchild of Reverend Samuel Buell. And when uh Governor George Clinton found out about this school, he came down here and he gave him the bell which is in the Belelfrey and uh that's why it's named Clinton Academy. The school was farreaching. It enrolled girls and women and not just for embroidery or learning social graces. The Clinton Academy young women attended classes in the English academic apartment and the common school which included subjects such as writing, arithmetic, reading, English grammar, French, rhetoric, all highly unusual at the time. Now we move ahead to 1821. Every April the school would have an open exhibition and the students would demonstrate their abilities. It

was also a way to advertise for the school and many times they put on theatrical productions. In 1821, Eleanor and Lenora was put on. Jerusian and Mary Anne Miller were in it. Later on, they put on the Brothers, Miss Abby Huntington and Mary Gardner were in that show. Uh, Manuel, a tragedy was done in 1822. Phoebe Miller and Maryanne Miller are in that one. Gustaf Baza, a tragedy. Susan Isaac's Joanne Miller were in that. You know why I'm telling you all this? This was highly unusual. Women were not to be on the stage by any means. But here in East Champton in Clinton Academy in the 1820s, women were performing on the stage. And to show you how really really groundbreaking this is, the most famous woman in America, Harriet Beecher Stowe, whose father was

the minister in East Satin, but she wasn't born here, probably penned the most one of the most influential books of the 19th century, Uncle Tom's Cabin. And when she was invited on a book tour in England, she had to take her brother and her husband along, and she sat on the stage while they spoke. So you can see what was going on here. Clinton Academy far ahead of its time and the academy was a result of the American Revolution in many ways because uh education had been devastated, you know, during the American Revolution. So that's it. Women at the forefront right here in East Hampton. >> Gotta love it. Thank you, Hugh. Okay, so Michael, if you could read the first meeting notice, please. The public hearing will be held live and in person by

the town board and will be available electronically by video and teleconferencing and will be televised on local TV LTV channel 22 and available for live stream on the LTV website ltv.org. The public shall be permitted to appear in person, but may also provide comments on the matter being heard by calling 351-8886331. Any person or party wishing to be heard with respect to the foregoing may do so in person or by agent or by attorney or by written comment addressed to the East Hampton Town Clerk, 159 Panigo Road, East Hampton, New York, 11937. Comments may also be submitted to the town clerk by email to mhansen eampny.gov. All comments must be received by the town clerk by the date and time of the public hearing. Please check the meeting agenda posted on the town clerk's website,

ehamptonny.gov, for any changes and for updated information. Take notice that the town board of the town of East Hampton will hold a public hearing in the town board meeting room, East Hampton Town Hall, 159 Pentag Road, East Hampton, New York, pursuant to section 247 of the general municipal co General Municipal Law on March 5, 2026 at 6 p.m. or as soon thereafter as this matter may be heard to consider the following. The town's acquisition for general municipal purposes for the use of municipal with the municipal with the use of municipal funds and/or other appropriate funding sources of a property located at 68 South Elmwood Avenue Monttok repeatedly owned by Irene Dagustinino and consisting of approximately.28 28 acres of vacant land at a cost of the town of East Hampton not to exceed 1,450,000 plus reasonable

survey title prrated tax and recording charges said property being described on the sub county tax map as SCTM300-49-6-6. >> Thank you, Michael. I don't we don't have anyone signed up. Oh, first Scott, you're going to introduce the the public, show the map. >> Yeah. So, you could see on your aerial on your TV screen there, the property we're talking about is highlighted in blue. And I just I'm here to make clear that uh with regard to the acquisition um you know, we're only talking about the acquisition of real property here. Um while the town has identified a need for infrastructure for the town's police, marine patrol, lifeguards, volunteer ocean rescue and code enforcement in one building at this point, you know, the idea is still conceptual in nature. So our first step is actually to

secure an appropriate property and we hope 68 South Elmo will actually help fulfill that need. And I just want to note just to the bottom right of this property uh 1477 South Emerson uh which the town already owns with uh with public bathrooms uh modest parking and some storage. Now our notice of hearing to acquire indicates the acquisition of the property is classified as a type two action. So again at such time that the town takes any next steps for the creation of plans engineering the town can begin its analysis uh with all appropriate town departments and agencies. So at that point, you know, we would do a full environmental and planning review uh of the specific proposal uh uh with uh appropriate public input. >> Great. Thank you. Appreciate it. Scott, would anyone like

to address the board on this matter? Matthew, is there anyone on the line? >> We have uh zero callers on the line. >> Motion to close. >> Second. >> All in favor? I. All right, Michael. Hearing number two, please. Please take notice that the town board hereby directs that a public hearing shall be held on March 5, 2026 at 6 p.m. or as soon after as this matter can be heard at East Hampton Town Hall, 159 Panago Road, East Hampton, New York, to hear any and all persons either for or against a local law entitled a local law to amend chapter 55 zoning of the East Hampton Town Code to modify the requirements applicable to accessory dwelling units. >> All right, thank you. So, we have one person signed up, Andy Hammer. Oh, Eric, did

we want to have Eric introduce it for? Is this the one Eric's introducing? I apologize, Andy. >> Hi, Ken, if you'd like. I'm here. >> Okay, take it away. >> I'm Eric Chance for the planning department. Um, so basically, uh, the board is considering changes to the town code, which would help facilitate the creation of additional ADUs or accessory dwelling units. These amendments are intended to balance the need for additional affordable housing uh, with protection of neighborhood character. Um to summarize the changes in the proposed local law, um there's a a few changes to the town code. One, the minimum lot area for an attached ADU, that being one within the principal residential building, would be reduced from 20,000 square ft to 15,000 square ft. Uh various sections of the code would be amended in

order to permit second homeowners to build and maintain ADUs, including including no longer uh requiring that either the home or the ADU be owner occupied or the owner's primary legal residence. Property owners would be permitted to participate in the rental registry program while maintaining an ADU. Uh the prohibition on the number of vehicles which may be parked on the property overnight would be changed uh from more than four to more than five. Uh changing the language that ADUs must be the tenants's legal doicile to their sole legal residence to provide additional safeguards and clarifying some language including changing apartment to accessory dwelling unit in various sections. Um, these code changes have been reviewed by the planning department, office of housing and community development, and the town attorney's office, among others, by letter dated September 25th

of 2025. The planning board supported the code changes as currently drafted and with no changes recommended. >> Great. Thank you, Eric. All right, Andy, now you're up. >> Good afternoon, Supervisor Burke Gonzalez, Andy Hammer. Uh, you know, I just wanted to be here because I think this is a very important provision. You know, the way you eat an elephant is one bite at a time. We haven't been taking too many bites out of this thing for the last 10 or 15 years. We've tried, but I think this is a significant step forward. The ADU legislation to begin and then every as we learn, we get smarter. Part of this code provision sort of originated with my office. I applied to the zoning board for a variance from the provisions of the town code because I

had a family in Wayne Scott who had created an ADU when they moved a quasi historic structure from Sagaponic onto their property. It just happened to be the perfect ADU. It met all the criteria. Uh and I was seeking a variance from the zoning board because the owner's primary residence was not on the property that this was moved to. They actually lived behind it. the house was occupied by the family members, etc., but none of them could claim it was a primary residence. My application to the zoning board was essentially denied. Uh although it never got that point. They said, "Listen, we think this is more a legislative change. Uh that should come back to the town board." So, that's kind of what started the the discussion. As it turns out, about 30 days ago,

I purchased a house in in East Hampton that has an ADU in it right now. And I don't didn't plan to uh occupy the first story. Uh I will tell you that since I purchased that house, the list of teachers, administrative assistants, farmers, everybody is contacting me, the need for this is so dire right now. So this will allow uh if adopted personally, it will allow me to rent out keep my ADU tenant as well as rent it out to the first floor. I personally would have no problem if as part of this process the board said, "Hey, you also have to rent your first floor out and stay in accordance with affordable rent guidelines. You know, that might be a bridge too far for the rest of the town." But, you know, I think

that's a reasonable compromise to say, well, you can rent it as long as you have a year- round renter uh and somebody in the community. But I think anything that we can do is, you know, I I would hope that we're going to learn from this and maybe we'll be able to expand this further to the point that we'll be able to address additional needs in the community as they come up. But I wholeheartedly support this uh as an amendment to the code. And I think it's it's something that we've learned quickly. Uh and hopefully we'll be able to continue to learn quickly because I think this housing is just so important. If I could show you the list of people that contacted me, you know, it would blow your mind. I guess it probably

wouldn't at the end of the day, but it really is a a really important need in this community that these things are fulfilling. >> Thank you. >> All right. Thank you, Andy. Would anyone David, >> welcome back, David. Thank you. Thank you. I missed attending meetings. I need a new mic. I broke. >> Good evening. I'm David B. I reside in the Springs. I have both some general and specific objections concerning some aspects of this latest proposal to continue tinkering with and eliminate some of the reasonable guard rails that have existed from the start of the town program of what was originally termed affordable accessory apartments but is now termed accessory dwelling units or ADUs. Despite a long history of this program obtaining very minimal if not dismal results in terms of generating only a

very small number of such dwellings which is a type of affordable housing that are second family dwelling units placed on single family zoned parcels. You continue to metaphorically bang your head against the wall and hope to achieve yet a different result with this latest iteration. Great amounts of time and effort have been expanded expended to try to generate more of this type of affordable housing. Instead, those same efforts and resources could have and should have been directed towards creating more large-scale apartment complexes such as the two recently built by the East Hampton Housing Authority. They satisfy a large amount of the demand for new affordable housing, all in one fell swoop instead of just one at a time. If you feel the town needs more affordable two family housing stock, then I suggest you spend

your time searching out undeveloped areas of the town where this different type of zoning can be created and placed without disrupting the quality of life enjoyed in existing single family zoning districts. Most of the ADUs that have been built so far have been built in the two school districts with the highest school tax rates, the Springs and East Hampton. Few if any have been built in Waynecott, Amagansit and MTalk. Most homeowners simply don't want to be bothered by all the bureaucratic hurdles and limitations that the ADA ADU program engenders. In most circumstances, adding an ADU to an existing single family residence generates a need for an expanded and upgraded septic system. I don't expect you will have much success in the future enticing more people to allow an ADU to be added to their property

even if as you intend to allow it to them to be built on parcels as small as 15,000 square ft which is of course a non-conforming lot under the existing zoning codes and it seems that you intend to make gifts of no interest loans also known as free public money to entice residents who add ADUs to their properties. The town is also considering, I understand, awarding grants through this New York State's plus one program, which would could provide up to $125,000 in the form of forgivable loans to eligible and income qualified owner homeowners to build or legalize an ADU. Those financial resources should go instead only towards supporting the efforts of the East Hampton Housing Authority. In my opinion, I urge you to be mindful of the need to weigh the remedies for our affordable

housing crisis with the need to maintain people's quality of life. When you allow halfacre zoning to in effect become quarteracre zoning by putting two families on a single lot, the effect of such increased density is detrimental to the environment and to the value of nearby properties. But my single biggest objection to the provision provisions that you are proposing would be the elimination of the long-standing eligibility criteria of requiring that accessory ADU dwelling units only be added where the principal dwelling is owned and occupied by a primary resident. That doesn't mean that such homeowners have to live in their residence 365 days of the year or that they cannot even participate in some limited seasonal or short-term rental of their home under the terms of the rental registry program. By limiting ADUs to residences where the

owners occupy their primary residences the vast majority of the year ensures that they have a self-interest in ensuring that the ADUs are not misused or abused. In my field of work as a property tax grievance consultant, I am well aware of a type of a distinction that can be made and is made in my field between owner occupied residences on the one hand and those that are deemed to be income producing commercial properties. That is the dividing line that is applied to determine eligibility for the filing of a small claims assessment court case. I urge you to consider developing and applying a similar line of demarcation to bar those commercial property owners from participating in any ADU program. There are many entities such as limited liability companies and some families that own a multitude of

four rentonly residences. The owners never live in the homes. I doubt they even step into them. They only rent them out year round. that this type of owner should be continue to be barred from building ADUs. Many of these residences are problematic from the get-go and are ready to and are already are detriment to the neighborhood due to poor quality poor property maintenance, unlawful occupancy by multiple families, excessive number of vehicles, etc. It is these type of property owners that should continue to be prevented from maximizing their commercial profit margins by engaging in ADU building. Our existing town code is unable to prevent such housing abuses abuses. Please don't make the problem greater in number and degree of magnitude. Thank you. >> Thank you, David. >> Matthew, is there anyone on the line? >> We

have zero callers on the line. Motion to close. Second. >> All in favor? I. >> Okay. Please read the third meeting notice. Michael, >> please take notice that the town board hereby directs that a public hearing shall be held on March 5, 2026 at 6 p.m. or soon after as this matter can be heard at East Hampton Town Hall, 159 Panagago Road, East Hampton, New York to hear any and all persons either for or against a local law entitled a local law to amend chapter 255 zoning of the East Hampton Town Code to modify the building permit requirements applicable to personal wireless facilities. >> Great. Thank you. Would anyone like to address the board on this matter? Matthew, is there anyone on the line? >> Stand by. Hey, good evening. This is Matthew Chiron. I'm

calling in from the LTV studios just to affirm that our uh landline is operational and there are no additional callers at this time. Thank you. >> Motion to close. Second. >> All in favor? >> All right, Michael, read the fourth meeting notice, please. Please take notice that the town board hereby directs that a public hearing shall be held on March 5, 2026 at 6 p.m. or as soon after as this matter can be heard at East Hampton Town Hall, 159 Panago Road, East Hampton, New York to hear any and all persons either for or against a local law titled a local law to amend chapter 151 special events permits. >> Thank you, Michael. Would anyone like to address the board on special event permits changes? Matthew, you want to check those lines again? >> We

have no callers on the line. >> Okay. >> Motion to close. Second. >> All in favor? >> All right. Michael, the last meeting notice, please. Please take notice that the town board hereby directs that a public hearing shall be held on March 5, 2026 at 6 p.m. or as soon after as this matter can be heard at East Hampton Town Hall, 159 Pinno Road, East Hampton, New York, to hear any and all persons either for or against a local law entitled a local law to amend chapter 75 airport of the East Hampton Town Code. >> Great. Anyone like to address the board on this public hearing? >> Matthew. >> Still no callers at this time. >> Motion to close. Second. >> All in favor? >> I. >> All right. Now we're up to public portion.

Would anyone like to address the board during public portion? David, >> I just wanted to uh thank Ian and anyone else that has been working on the proposal to reveate the 1acre portion of the Springs Park that had been uh that had its invasives removed. I think that the although you aren't planning to do the entire right >> 20 acres as someone might have some might have thought by reading the the paper uh this one acre test area certainly can be used to uh try out some methods of beautifying and improving the quality of the user experience at the park. I also read I really didn't have a chance to read it verbatim, but I think there's a provision in the um document that it was you discussed at the work session concerning expanding parking

because there certainly is a need for more parking which might engender also a new entrance gate gate. If that's the case, then that's certainly I something I would uh agree with and second because there are definitely times when there isn't sufficient parking. The park is that popular and that well used. Thank you. >> Thank you, David. Matthew, is there anyone on the line for public portion? >> Uh, yes. We have one caller on the line. Um, it says David Buddha, but I'll put it through. >> It's a triple head, David. I mean, that's impressive. >> Hi. Um, this is Carol Rudolph calling in. >> Hi, Carol. >> Hi. Um, I wanted to uh say that I was very pleased and excited to hear that there's a plan to reveate the Springs Park, the acre that

was cleared with native trees and plants. Um, and I had a couple of questions, comments. First, um, yeah, Ian had mentioned at the beginning that planting season can start, you know, basically right after the snow melts. It's a wet time of year and I know that it's optimal maybe to plant in the fall, but that's another 6 months of weed growth and possible bug wart spread. And I don't know how how quickly um uh you know contracts can be bids can be put out, but I was wondering if it's possible to move the hearing up to two weeks rather than a month. So that at least that's an open possibility. um to consider the the other uh two issues. Um I Ian mentioned that he understood that many people in the community are concerned about

preserving woodlands which which we are. We had a petition and about 40 people come to a spring CSE meeting and I wanted to ask that uh we we were basically asking that the percentage of woodland versus open space be preserved as it is. And I wondered if that would be stated in any update to the management plan. And my other comment was about the grasses. Um grasses have been in the management plan for 20 years and never happened. And my understanding after speaking to people who are knowledgeable is that maintaining grass meadows is very difficult because it's a uh transitional state in the environment. So to keep something as grasses, you're really fighting nature. And I wondered if um I don't know, even would be better to answer this if wildflower meadows are maybe easier

to maintain and better for birds and bees and environmental issues. So that was just something to um you know that I'm curious about that's being considered. That was it. I again wanted to say thank you. I'm I'm I think this is a a very good way for the future of the park to and I'm very optimistic that it'll be be effective. >> Thank you, Carol Matthew. Is there anyone else on the line? >> Yes, we have one additional caller. I'll put them in I'll put them through. >> Thank you. Matthew, did we lose the connection? >> Hi there. Uh, >> hello. >> Hi. Could you please identify yourself? >> Can you hear me? >> Yes, we can. >> Yeah. Yeah. Uh, this is Michael. Michael Forest. How are you? Um, thank you for the opportunity

to speak. Sorry I was late to the ADU um public hearing, but I would like to just express my support for the legislation. All affordable housing is good affordable housing in this town at this point. So um I'm supportive of that um that bill. Um, on another note, uh, with regards to the building department, I watched, uh, March 3rd with Larry Zimmerman, who, uh, is a longtime contractor in this town, uh, looking to have a job at the building department when, um, you guys are in need. The building department needs help uh, drastically. It's really affecting my life at this point, not being able to get a building permit uh, in a timely matter. and for a qualified candidate like that to be able to come in and want to work for the town and

help and um there'd be some stipulation that he doesn't speak fluent Spanish when he speaks fluent building. Uh that seems crazy to me and I hope that that uh is reconsidered. Um there's plenty of people in that office that can speak Spanish when needed. So, thank you very much. Have a good night. >> Thank you, Michael. Matthew, was there anyone else on the line? >> Uh, no. We have no additional callers. >> Okay, then we're gonna move on. Larry, did you want to >> I don't know if it was the right forum, but I live on Springy Bank. >> What? Why don't you wait till you get to the microphone and introduce yourself so the clerk can get your name? >> Yes, ma'am. >> Thank you. >> I'm Larry Zimmerman. Uh, I live on Springy

Banks Road. I've been there for over 30 years. When I moved there, it was a nice quiet street. Um, they've since developed uh Northwest Woods. I now live on a highway. Uh, cars, particularly in the summer, but not only speed up there at 60, 70, 75 miles an hour in their fancy sports cars or in their pickup trucks or whatever. I just want to know if there's some way to slow down the track. I have two dogs who despite the fact that my yard is fenced, they're smarter than I am, they figured out a way to get out. And I'm a wreck thinking about them crossing that street and and uh not that there are so many kids that live on that street, but even the sound of these people just accelerate. It's it's crazy.

It's crazy. And and I don't know, I spoke to Steve Lynch about it maybe putting in speed bumps. He said you can't for a 30 mph zone. Uh, is there anything that we can do or the town can do to to and I don't I don't have any ideas, but to slow down traffic. >> So, this is public comment. This is not, you know, we don't go back and forth in a >> That's why I say I don't know if this is the right, >> but you you know, one of us will reach out to you. >> We'll we'll bring it up in our public safety meeting and discuss it, too. >> Okay. All right. Cool. Thanks. >> Thank you, Larry. >> All right. So, now we are up to resolutions. Tom, if you could

start us off. >> Yes, madam supervisor. Thank you. I'll start with resolution number 2026 394. Uh, this is for approval of claims and warrant number 3A. It resolved the claims of number 3A in the amount of $4,95,17081 for 2025 uh payables and $7,190,24059 for 26 2026 payable uh payables also be it resolved exactly uh that utility warrant number 3A in the amount of 10,197, 70 for 2025 payables and $16,777325 for 2026 payables were ordered by the town board and the supervisors hereby directed to pay the same. I >> I think you meant 10,000 not 10 million but sorry I apologize. Thank you. >> Correct. As uh >> it's been a long day. I apologize. >> Thank you. >> Uh 2026 395. This is not to biders for EH26011. For further information, feel free to contact the purchasing department 631-3244183 or email purchasing at eamny.gov. >> Second. >> All in favor? >> I. >> 2026 396. Uh, this is a payout for Robert Leland, formerly of the sanitation department. our condolences to his family. Um, payout is in the amount of u total amount of $39,859 and sorry, $39,860. >> Second. >> All in favor? >> I. It's my privilege to offer resolution 2026 397. This is the notice of public hearing met chapter 213 shelfish of East Hampton Town Code. This was uh discussed and the public hearing shall be held on April 2nd, 2026 at 6 pm. >> Second. >> All in favor? >> I uh hold please on

and the Monttok Playhouse Community Center Foundation where the town of East Hampton uh and the Monttok playhouse community found uh center foundation have jointly and in good faith renovated and restored this first floor of the uh western section of the Montto community center and construction and constructed aquatic and cultural center. Uh the foundations graciously donated nearly $8.25 to $5 million in the town of East Hampton and then have additional common goals. We are uh we are amending the original lease agreement on June 27th uh 2025 to make sure that the the cultural center will be actually run by the Montalk Playhouse Community Center and that amendment again is on June 27th through 2025. >> Second. >> All in favor? 409 is authorized payment of prior year's invoice for the highway department and this is an

amount of $148.73 to master car. >> Second >> I >> drum roll please 410 appoint lifeguards to preseason training for 2026 uh effective retroactive the March 1st 2026 names positions and paid rates listed below. This was for Ditch Plains, Otis Road, Ditch W to the Ditch Witch, uh, Indian Wells Beach to Exotic Poles, and then Kirk Park to exotic poles. >>

Second. >> All in favor? >> 413 is budget modification for the highway department. Uh, due to the high volume of snowfall from Wintertorm Hernando and due to conditions, the amount of snow. Um, the contractors need to perform snow removal operations and additional snow mitigation supplies were needed. The town is hopeful the New York state legislature will provide additional fund state fundings and assist local governments with snow removal efforts. However, until that happens, the town uh will need to appropriate fund balance to cover additional snow removal and mitigation costs from this storm. The town board directs the budget officer to make the following changes. We're increasing the revenue budget line for appropriate unreserved fund balance in the amount of $500,000 and increase the expendure budget line in subcontractor cost for snow in the amount of 400,000

and for snow removal supplies in the amount of 100,000. Second discussion please if you don't mind. So what we're seeing here is the cost of large snowstorms to make sure that we maintain a level of public safety on the streets on the public streets but also on some of our UR UR roads. Uh and also to clear the streets so that emergency services get can get there. Uh what I believe we also see here is that by using unappropriate uh uh appropriate unreserved fund balance, we have that fund balance in place because of the conservative budgeting budgeting by this administration and the supervisor's budget allows for these types of state of emergencies and historical storms. But again, large snow form the fall means large cleanup costs and this is what we're seeing here in this

calendar year. So, and what I just wanted to add is that I signed on to a letter from the Suffach County Supervisors Association asking the governor to uh consider financial emergency assistance in respond to this historic blizzard. And the uh East End Supervisors and Mayors Association is also going to be sending a letter that I will be signing on to. So, we're you know, we're hoping that the state is going to come come forward. >> Thank you.
