001thanks our recording and it is preparing to upload onto YouTube for the live stream looks like we are up and running and I have Let's see we are up to 268 attendees I am going to do my best to try and find public commenters as you get going but now you're welcome to start as needed everything is running the way it needs to Jen we're good to go I believe so so far I don't have a second interpreter but I don't know who that is and I can't find them yet so hopefully they arrive okay if you need help there just stop and we'll we'll figure it out okay thank you okay is everybody ready to go here like to call to me in order for August uh 10 2021 to our regular board meeting

002um right now um we are going to have director pyros as she usually does the Pledge of Allegiance so director pyros if you're ready to go that would be awesome I pledged allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all Rebecca thank you again for doing that I'm just going to review what uh is going on tonight I'd like to thank everybody for being part of the meeting and um the the first thing we're going to do after kind of give you the review of the agenda will be our our public comment time uh after that uh we will have the board and superintendent comments and then we will take a break we'll have consent

003agenda we'll have reports and presentations our monthly Financial from Nikki Fowler and our ready School safe Learners update including the mask update from assistant superintendent Derek Brown we will go into Old business we have three items on that list tonight and then we'll have new business part that will be to designate board committees it's going to be a long meeting so I hope everybody's ready to go um we'll start with public comments I'm going to tell you kind of some of the rules tonight it's going to be a little bit different public comments are a time for the public to call in and uh speak to the board we are well over 60 people calling in tonight and so getting through everybody will be uh quite difficult we're going to limit the each person calling

004into two minutes if you are calling in and and you have a pretty quick stance on your feeling about an issue uh the less time uh you take could give somebody else a chance to speak and uh but if you take your two minutes you do um we're modifying to two minutes we're trying to get as many speakers in as possible we also have the rest of the board work to do tonight uh please be ready to speak when our board secretary calls on you there will be no personal attacks made on board members or District staff in any way no exceptions if you do not get to speak tonight you can still email your comments to the Newberg School District board of directors and we will also attempt at September 14th to put you

005near the top of the list so you can speak directly to us we really want to hear from you I think the key word tonight is civil if you look that word up it'll say courteous and polite so I'd like everybody just to think about the word civil and courteous and polite and with that uh Jen I think we're ready to take the first comment hey can I ask a quick question sure is it possible to prioritize students first since we've got a small amount of time students staff parents community and if time allows people from outside of our community yeah it's we've been having this one we've never had this many people call in we've been talking about this whole time so uh we're gonna go right from the top as people called in

006um and I know what you're saying on that I think we'll get to the board retreat you know Brandy I think we need to look at that how we're going to move forward with that one uh probably won't be our last time with a lot of people calling in uh I appreciate the comment I really do Jen and I have talked back and forth this all day and how this can possibly work um it's going to be frustrating tonight if we have to cut it off and not get everybody to speak so that's why I'm kind of asking everybody if they if they can go a little less than even the shortened two minutes that would be awesome so we can get everybody to speak and uh that's definitely going to be something a high

007priority to talk about at the board retreat so great thank you can we could we have commenters just reiterate their connection to the district and the absence of you know being able to prioritize sure yeah I think everybody when you call in you need to identify you know who you are and uh you know I noticed some people on the list were from uh don't live in Newburgh but they have I don't want to say a name because I already know who they are but they have lived here worked here uh have raised kids here so you know we've got all kinds of different kinds of people calling in so thank you for that Jen are you sure you're ready no I've been trying to promote uh sonda Martin up to the panel a few

008times and for some reason I don't see her appearing um and I was going to take you off the the hot seat tonight I guess I'll I'll just kind of run my my stopwatch timer oh there she is if you could please um just turn on your video I'm figuring that out right now okay at least we can hear you I've got you okay don't start me yet because I gotta pull up my what I have to say can you still see me uh yes Okay so um good evening board members my name is Sana Martin I've lived in Newburgh for over 20 years I've worked in Newburgh at the fire department at the hospital I've volunteered in Newburgh I currently still do with the homeless population here and I have two sons who have

009attended Newberg schools I'm also a registered nurse um two minutes is not enough time to address the important issues that the board is considering tonight I sent in a very long email regarding my concerns but I'm really worried that several of the directors especially have already made up their minds and were rushed to make a decision tonight without really taking the time to thoughtfully consider the perspectives of all who speak tonight and all who have submitted written comments um as a property owner in Newburgh I don't want my tax dollars being spent in a way that doesn't actually help all the students and when you're in the majority you're already getting a lot of benefit but when you're in the minority like our lgbtq students and our minority students you're not getting all the benefits

010that are there and there's a lot of bullying going on in our schools I know this I was a kid I'm an adult um anyhow to this end I respectfully request that the board table the vote tonight on the anti-resolution when it all comes to uh the all students belong policy banning all the flags um if you're truly non-partisan and working for the best interests of all the students then you're going to need time to listen to all the perspectives and read everything that everybody's sent in so um I'm hoping that we won't rush to a vote tonight and that we really will do the best for all the students thank you two minutes appreciate that Jen are you ready I am promoting Ross Davis Aquarius sorry it logs you off and then logs you

011back on yeah thank you so much for giving me the opportunity to speak tonight my name is Ross Davis I'm an administrator for the Lynn Benton Lincoln education Service District in a concerned parent of a 12 year old at Chehalem Valley Middle School this is obviously really uh an emotional issue for me and a lot of people um I think everyone here agrees that uh academic learning is definitely important but the issue is up for debate tonight are not distractions to Student Learning um they're an essential component of a supportive learning environment uh one thing that the research is very clear on is that every student can flourish when the foundation of schooling is built upon belonging uh that concept dates back at least 80 years to Maslow's hierarchy Maslow's work shows that before students

012can learn which lies at the very top of the pyramid when we ask students to do they must have the needs below met including the need to feel a sense of belonging so instead of removing the tools and supports previously put in place in enacting barriers such as prohibitions on symbols of support and statements of solidarity it's my opinion that we should refocus this conversation to how we might ensure that every educator has the tools training support and skills to make every corner of our schools a welcoming environment for every student but it's important to think that we get there By ignoring the needs of our lgbtq our our black students and their families throughout the decision-making process just remember you're dealing with some of the most vulnerable students in our schools 57 percent I'll

013wrap it up 57 of these students have heard homophobic remarks from their own teachers and staff our LGBT students are five times more likely than heterosexual peers to attempt suicide I beg you to forsake this misguided agenda that you have for the sake of our most vulnerable students because the likelihood of these decisions adversely affecting them is great thank you Ross something I'm promoting Stacy Dalton to the panel Oh Stacy you are on mute sorry my name is Stacy Dalton and I'm a teacher for the Newberg School District I completely agree with members of the board that political statements and messages do not belong in classrooms teachers do not take an oath when they become licensed but I believe that intrinsically they do take a moral oath one to love and care for and support

014their students no matter no matter the political Winds of the school board Community or Nation for this reason I'm aghast that the school board would attempt to ban symbols of love and support in the classroom Pride flags and BLM posters are not messages of propaganda they are messages of love and support white and or heteronormative students the majority see their own validation consistently in the curriculum Newburg school districts have adopted and therefore do not need extra messages of support teachers display these items to show the students that are not represented in the curriculum of the school that they are still welcome valued and appreciated as much as anyone else many of the teachers in NSD are white and heteronormative the intentional implementation of these symbols of support send a message to the students that even

015if they do not see themselves in the curriculum or the staff that they are welcome and valued Banning these items from schools equivalent to asking teachers not to support their students that do not fit into the hetera white narrative that is found in our curriculum swastikas and Confederate flags are banned because they are symbols of hate the school board has no reason to ban symbols of love doing so will not only deter students and families from moving to a community that does not support love but it will do the same for teachers and staff as well think about the story you tell by Banning these symbols of love and what story it will tell to the community of Newburgh and surrounding communities as well if you have any interest in the validity of all of

016our students and the welcomedness of our community please do not vote to ban BLM and pride Flags in our schools and do not revise the already comprehensive anti-racist policy the school board has adopted thank you thank you Stacy hey I am going to promote Shannon eoff and oh next and I'm going to be having Jerry Witherspoon on standby okay okay can you hear me yes I can um yeah my name is Shannon eoff I am a queer 44 year old woman Newberg High class of 95 alumni have four children two white two black who have attended Newburgh schools and a local business owner until recently first pride flag removal staff members who display a pride flag show that they are a safety and refuge when queer students feel bullied or unsafe in some way at

017school at home let's encourage inclusion secondly repeal and BLM symbols when one of my adopted Haitian kids frondi played on a club basketball team if memory serves I think chair Brown was a coach on that team if there was an anti-racism Revolution as there is right now and my black son's coach both refused to support it and publicly stated that there is not a racism problem I'd have been as upset as when an opposing player called him the inward during a public school game please be anti-racist I have gladly Taken part in Black lives matter protests in Newburgh and Portland to dispel misnomers about BLM participants I am not a Marxist I am a capital us to has financially benefited from capitalism acab is the anti-police slogan which some use however that does not fit

018my beliefs my father was a police officer when I was young and my uncle is a retired SWAT team sergeant and Sheriff's detective I am not anti-police but acknowledge inherently racist flaws within law enforcement and Justice systems until they change I will continue to say black lives matter and hope our schools do as well minority students need to know they are safe with staff members racism is not just lures but a system built to elevate white people Oregon was founded to be a whites only state because the founders wanted a white Paradise until federal law prohibited race discrimination Yamhill County property titles would commonly prohibit a black person from purchasing a property when sold these attitudes Prevail in families which have long been here and who have reached and influence by stating black lives matter

019we are saying that people of color matter that racism does not have a hold in our areas of influence language in this motion would also exclude college and military symbols in addition to other logos and Brands it is far too broad I passionately ask you to vote no on both motions thank you thank you Shan good morning uh Jerry Witherspoon and next up will be Adam B itch hi my name is Jerry Witherspoon I am a lifelong well since 1979 member of the Newber Community but I recently moved to Lafayette I'd like to begin by asking the question what makes a good school board school board members are elected public officials entrusted with governing a community's public schools the role of the school board is to ensure that the school district is responsive to the

020values beliefs and priorities of the community as a whole members of the school board are accountable to the individual members of the municipality in which they serve as school board's actions and behavior affect everyone in the community so it is imperative that school board members are able to back up their decisions and actions with facts and data school board members must understand that education happens both in and out of the classroom to be effective the school board must be willing to work with all stakeholders they should base their decisions on input from the superintendent school staff students city government business owners and individual members of the community this school board represents the entire community of Newburgh including those who are marginalized like women religious minorities racial and ethnic groups including immigrants native indigenous communities lgbtq

021plus people and people who are disabled a school board also represents people who have opposing views from their own it is imperative that each School Board member makes decisions based on what they believe the representative Community wants not their own personal agenda the board's actions as a whole must be honest representative and transparent and so my challenge to you is this will each of you be willing to share in essay form the foundation of your values and beliefs the Paradigm from which you base your decisions it would be helpful for the Newberg Community to understand your motives long-term goals and aspirations in in leadership as your role on the board in watching these school board meetings for the last several months it has become obvious that a line has been drawn and from what I

022can see there are two opposing views I believe each of you would agree that the work of the school board will be hindered until you can find Common Ground the best thing the school board can do is to help our community understand fully what motivates each one of you the citizens of Newburgh Newburgh put you here your time is up yeah we're over by quite a bit there so thanks chair Jennifer I'll start telling you at 30 seconds to go so we can try to stay on this um uh if you don't mind share it might be best for you to if your time yet if you could just verbalize to them that it's there because I can't yeah no problem all right I think I just promoted Adam B up to the panel and

023I believe Brianna D is on standby foreign can you see me nope it's black I can see your name oh there we go sorry um my name is Adam Berger I'm a resident of Newburgh and I have two children here my wife I'm a trans fan but my wife grew up and lived here basically all of her life went to school in Newburgh High School um yeah I just wanted to you know I think in society right now we have as adults we have done a terrible job at listening to others at finding viewpoints and this country has become a country of tribes of people who don't listen to each other and we can't talk to other and can't communicate so my concern is if we take up any point there's vast differences some people

024view one point as centuries of of minute being minimalized being pushed to the back slavery other people view it as unfunding police other people view it in my my concern it's the overarching principle is do we allow teachers to decide hey this is my guiding principle this is my politics and I'll teach in class and so until as a society we can all agree what something means and we have very different I don't know how we can have students go into a room and not become have it become this tribal cut people off and then you have a teacher who decides how to teach it you have a teacher to decide what it represents and I just now what I'm not saying is that we don't the school board the school classroom has to be

025a place where students can learn and it represents but I just don't know how a teacher with stuff that's this levered and this political how can a teacher walk in and what are they going to teach there's different opinions on everything how are they going to teach it and then do can teachers just start picking out politics or what they believe in and start posting things and then it kind of comes down to oh this teacher believes this and this teacher believes this about Equity this teacher doesn't believe in it and all suddenly we just have so that's my concern is how do you regulate that and how do we have that in the classroom at all but still make classrooms a safe place for all students thank you Adam thank you Brianna D is

026coming up and we have Raquel peregrino de Brito on standby Brianna come up yet try again go and Grant if you could turn on your video I I actually I didn't submit anything to talk tonight I just came to listen so that's really weird that that's in there oh I had your name down here okay yeah yep thank you thank you [Music] I'm just gonna check make sure I don't have another Brianna no okay I am going to look for Raquel okay she should be coming up now hello I am Raquel and I am a citizen of Newberg and a d I'm moving to Newberg uh and a parent of uh school age children I'm here to support the American and organ flags as the only political symbols allowed in school buildings and properties between

0272016 and 17 the number of gender surgery for females in the U.S quadrupled gender dysphoria used to afflict overwhelmingly boys during early childhood tomboys like myself inhibited femininity by not wearing dresses and having short hair now in perfectly feminine girls are encouraged to consider their gender operations teenage girls are the new dominant demographic of gender dysphoria because of lgbtq ideology on the website page herstry BLM claimed they are an ideological and political intervention blame was designed to silence and shame opposition but it's not about Black's lives it ignores thousands of black lives taken by other blacks every year in minority communities Across the Nation about truth there are only two genders and all lives matters about fairness it is not fair to expose vulnerable kids to adult topics not fair to instigate racism about relationships

028LG gbq TQ propaganda does not prepare kids for healthy relationships BLM is divisive about benefits kids do not benefit from adults imposing their agenda and ideology in the safe space that school is supposed to be the BLM and lgbtq ideology and curricula are shattering the innocence of children promoting racial divide and negatively impacting the lives of our kids forever Public Schools should be about math science reading and writing the responsibility of teaching values morals and about the birds and the bees should be left for parents regardless of sexual orientation and of race as an immigrant I attest in America you can pursue happiness remember life liberty and the pursuit of happiness thank you Raquel okay next I am looking for Brandon Casey and promoting him now uh on standby we have Joshua Reed hey Jen

029do you have any control over the names of people that appear foreign okay my my good here thank you good to go yeah I'm Brandon Casey I actually live in Newburgh and I have two kids that go to school here um I'd like to start off by reading some quotes to you guys and if anyone on this board supports any of these quotes for the people that they represent that they need to explain to this community why first quote what do we want Dead Cops when do we want them now this was chanted by thousands of BLM supporters and leaders shortly before three police officers were murdered second quote white people are recessive genetic defects this is factual that was said by a BLM leader in Toronto white people are devils and Aliens this was

030said by Henry Rogers AKA ibram kindy these quotes are a few examples of vile and racist remarks given by BLM members and the people that support them you know uh my eight-year-old daughter asked me why her life didn't matter that's the message that BLM signs delivered it's not okay for BLM propaganda to be in our schools our school's only job is to educate our children we also need to have this so-called anti-racism resolution be completely removed making a resolution that states the school board is anti-racist was never needed as the school board was never racist to begin with the entire the entire premise behind this itself is racist because it states if you're a white person you're racist by your very nature and just just being white makes you racist guess what that's racist and

031if we're going to be Against Racism which we all arm we all should be that we should against all Races our last School Board election you know we we had an election did we want to continue down this left-wing authoritarian anti-constitution anti-American Road or did we want to do what was in the best interest of our children and the community and get rid of this left-wing world of nonsense and we voted to get away with it we voted for this school board to make sure BLM signs are not in classrooms we want our children to go to school oh okay well can I just finish my last I got 10 just one thing I want to say in closing is just with the masks if if we're gonna have these run and rolling our killed

032our kids from the school district period so thank you for your time thank you promoting Joshua Reed to panel and uh Carly Barnett it's on standby thank you my name is Josh Reed I'm a school counselor in this District and a father to three recent NHS graduates more than one out of every three Newburgh public school students identify as a student of color or an lgbtq student that's more than 1900 students every school counselor in our district has signed on to a letter asking you to vote no for the three agenda items initiated by director Shannon students must first have their basic needs met and have a personal sense of safety before they can learn hungry or afraid students are not passing all their classes or graduating on time and these three policy changes would

033undermine our ability to help students feel safe let me tell you a few of the stories from Newburgh students who have told me their stories through deep emotional anguish and they are the students who will be affected by the policies you are considering some Newberg lgbtq students have had to seek medical help from problems that arose from not using the bathrooms during the school day because these are often the most unsafe spaces in our school buildings some of them have been rejected by their families needing to find shelter out of friends or with a local family that volunteers with safe families one black student who specifically asked me to share his story with you tonight was walking home one afternoon listening to music with his earbuds when a truck with four white passengers he did

034not know pulled up beside him they first got his attention by repeatedly yelling the n-word so loudly that it startled him over the sound of his music then two of them jumped out of the back pushed him into a ditch and the two of them chased him by foot while the other two chased him in their truck they pursued him all the way back to his house where he rushed inside locked the doors and was too afraid to even speak of what happened to his parents when these students enter our schools and see the symbols that we mean to communicate love and support and affirmation they don't see propaganda or indoctrination or any ideology they see a glimmer of hope that there can still be safe spaces and safe people in their schools on behalf

035of all 16 school counselors in our district I beg you vote no thank you Joshua promoting Carly Barnett and Lisa Joyce is on standby hello can you hear me yes good evening board I thank you for being able to speak tonight I also thank those who have already spoken and will speak tonight my name is Carly Barnett and I live in Newburgh with my wife and twin four-year-old daughters while in our car the other day we heard the song Go the Distance from the Disney movie Hercules one line said to find where I belong so I asked my daughters where they belong and without missing a beat one said Newberg in one year both my daughters will enter kindergarten with hundreds of others joining the Newberg School District family My Hope Is that they will

036both continue to feel that they belong board members I ask you to continue to allow newberg's staff the option to show the pride flag allow my daughters and all students to see that they too belong thank you Carly okay I'm promoting a Lisa but I'm not sure if it's Lisa Joyce or not it there's just a first name next up will be Caitlin Collins Lisa are you the Lisa Joyce that signed up for public comments yes and I don't know why my video is not turning on so I apologize um so my name is Lisa Joyce I am a white privileged female I go by the pronouns she her hers and I introduce myself this way because I have been humbly educated into realizing that that is who I am and I have had the

037privilege of putting together some Anonymous donations to offer to this board of Newburgh high schools School District the opportunity for some education in um it's called Equity diversity and inclusion the program that I had the privilege of attending was taking it up it is one that I would recommend chair Brown if you and the board are willing to accept this donation I would love for you to assign someone to work with me to determine which program would be best for the board to help them be educated in these things the other piece of Education that I had the privilege of having was actually through my work at Newburgh High School and the program is a documentary by Katie Couric and I would strongly recommend that at your board retreat on August 24th that you take

038the time to watch together as a board gender revolution it is an educational documentary medically and it has a very wide variety of different people who tell their story and speak their truth um it's a very empowering educational opportunity and I hope that you will take advantage of that I appreciate very much chair Brown's words where he said and on the last meeting that changes necessary he also said that every student deserves our utmost respect and our focus should be on the kids and it shouldn't be about us but it should be about the kids in closing I would like to suggest as I read into the board packet the proposed members for the different committees I noticed on the ad hoc Equity committee that all three members that were proposed were members that voted

039towards this um removal of these emblems within our building our buildings and I would strongly recommend and encourage that you re-address the three members that you've placed there and make sure that you add a member that either voted no or abstained thank you for your time thanks Lisa hey up next is Caitlin Collins and on hello are you seeing me and hearing me yes great I'm Caitlin Collins a resident of Newburgh and wife of an NSD teacher and I oppose the resolutions Banning black lives matter slogans and pride flags and efforts to roll back the Newburgh School District's anti-racism resolution I oppose these motions out of concern for communities they will most directly impact but these efforts Rob all students of learning opportunities regardless of their race gender or sexual orientation telling our black and

040lgbtq students that they matter isn't political it's essential because research shows that an affirming School environment improves behavioral academic and mental health outcomes for all students condemning racism and ensuring that teachers staff and students are equipped with the Knowledge and Skills to combat it must be a part of that effort these inclusive values align with the highest American ideals I understand that some students and parents feel uncomfortable with these signs in anti-racist initiatives however discussing challenging topics in our schools ensures that students are informed citizens for example had my teachers deemed the Holocaust too uncomfortable a topic to discuss my Civics education would have been lacking because Civics isn't just about understanding the laws in the present but learning from the mistakes of the past to ensure just Society for the future all of this

041may seem removed from the fundamentals but for all children to learn and grow in our classrooms to gain the skills that will make them productive citizens prepared for the workforce we need to proactively affirm them for who they are not discount their lived experiences such a curriculum prepares all children for a workplace that requires them to engage with people from a range of backgrounds so these initiatives benefit every student not just black and LBT lgbtq youth so please vote against these resolutions to ensure a safe and healthy learning environment for all children in the Newburgh School District thank you thanks Caitlin thanks sorry okay Nicole Welling is being promoted and on standby is Tay heartmore foreign I'm sorry I think I skipped someone was the last speaker Caitlyn okay and I do I skipped someone

042I apologize um Tiffany should be the next one coming in this is to not find it's me um sorry I do not see it Tiffany let's see f-o-t-r-e on the list of attendees so I am going to go to Nicole you should be promoted now I'll keep looking for Tiffany hi there can you hear me yes okay hi my name is Nicola Welling I am a resident a parent of a child who attends cvms and also grew up in Newburgh it is my opinion and belief that no Flags should be flown in or on any school property other than the American flag and the state of Oregon flag the BLM Flag represents many things to many different people to me it represents Division and hatred especially hatred towards police officers who risk their lives to

043protect ours BLM is a political organization that calls for the dismantling of our Constitution and our values as a nation politics has no place in our schools period some board members and community members May disagree with BLM being a political organization however it states on their website black lives matter is an ideological and political intervention and if you take the time to read their List of Demands I'm not sure how any school could support having this up on school grounds or in individual classrooms so when this flag or other item supporting BLM are hung in our schools you are saying to me we as a School District board members teachers and staff support and agree with this organization their beliefs and more so their ongoing demands this is wrong schools are supposed to be a

044neutral ground where all kids can feel safe not one group or one belief system all kids what about the children whose parents are police officers should they now be fearful or will you also support back the blue and hang their flag in classrooms so police officers kids can feel safe as well if you start supporting one group or one belief you will have to support all the others where does it end the truth is every child should be supported regardless of their skin color religious beliefs are sexual orientation praising one group over another is discrimination and prioritizing one sexual orientation over another's is wrong if you are saying to me that you need BLM Flags Pride Flags or other items that pertain to these organizations oh sorry there Nicole time is up though thank you

045very much foreign in the attendee list I'm gonna promote her and see if she is the one who signed up to speak hi Tiffany Olea you can unmute and just let me know if you had intended to speak tonight are you there Tiffany I'm gonna assume not I can't hear anything coming from their connection um so we have tejan Moore next and on standby is Kristen Stoller all right okay we see you can you turn on your microphone and there we go all right again my name is Ty hardenmore and I am a Newburgh resident and the mother of a Newberg School District student thank you for the opportunity to address the board tonight I will do my best to keep it short uh sadly policies that were implemented in good faith and in order

046to ensure every student that attends a Newburgh public school does so with the sense of belonging Safety and Security came under attack as soon as this non-partisan board seated its new directors this was a political Ploy aimed at undoing the great Equity work that the district has done to make sure that students who need the most support those who are on the margins are not forgotten because their needs and their voices are drowned out by the loud voices of the majority culture much has been said at the previous meeting and tonight about black lives matter and pride and why these symbols are political and bring harm to students particularly students who are members of white dominant culture however what these arguments fail to consider is that students who identify as members of white dominant culture

047likely already feel a sense of belonging Safety and Security at school because they are not constantly under attack black students and other students of color are under attack in Newburgh schools I know this to be true because my son was called a at school but I also know it to be true because as one of the advisors to the black student union I had a black male student share with me that he was called the n-word so much at Newburg High School that he made the request to leave his classes early in order to avoid being called or hearing that word in the hallway for that student seeing a black lives matter sign hanging in a classroom helped him identify which teachers were safe for him to talk to which ones he could go to

048with this request without those signs what our time sorry about that Ty Pastor time thank you hey next I am bringing up Kristen Stoller and on standby we have Adam Johnson hello can you hear me yes can you see me too yep good thank you my name is Kristen Stoller I am the mother of three girls in this District I'm a volunteer the co-founder of the community Wellness Collective and the NHS Wellness Center where we provide free mental health therapy for students of which approximately a third identify as lgbtq plus I'm also the co-founder of Wine Country Pride where we successfully distributed over 350 progress Pride Flags this year alone the Motions at play here feel retaliatory to the success of the progress our community has made like you want to fight back against the

049demonstrations of inclusion and Equity we have made in this small tight-knit community that Newberg is I'm here to remind you and the rest of the board of your responsibility as an elected official to vote with the representation of your District in mind feels extremely exclusionary to propose three emotions with the shared theme of equity and inclusion mid-summer added to an agenda without any notifications of the public without any public comment and without the full communication to the student staff families and community of Newburgh what a vote in support of these motions would mean this makes me feel like you are intentionally exclusionary is the vote to remove every student belongs policy to allow the band hate symbols back into schools or is it to intentionally make those who relate to the flags feel unimportant unseen

050unsafe or both is the vote to ban signs symbols and flags based in your personal fear hate discrimination and inclusion why else would you want to ban and things that have a tremendously positive impact on our community by marking safe spaces for our schools for students and staff why would you go against nearly every other local organization in denouncing the equity work that my understanding the board has received letters and support from the city of Newburgh Providence Newberg George Fox Juliet's house Civic groups counselors of Newburgh school districts teachers unions students alumni and families what is the goal here who are you serving you mentioned you wanted Community input I sure hope that the 300 3700 signatures are enough the letters are enough the public comments are enough for you to consider at least delaying

051the vote for tonight to include the voices of this community I beg you to vote with your heart and Lead With Love all right thank you very much I am bringing up Adam Johnson Melody Melody bye hello everyone my name is Adam Johnson and I live in Newburgh and have two children in the school district I support the Newberg school board and the proposal to take all Flags out of school buildings and obstacle property and leave the American flag in the Oregon flag in order to take politically divisive symbols out of Education the facts is Newberg is in the bottom 50 of the state on scores math scores were at 26 in 2019. the 2018-19 school year and reading was at 54 the same year the score the score started dropping in 2012. why is

052this one could attribute it to the lack of focus being placed on Strictly the subjects needed to succeed academically and more of a focus being placed on other items that are outside of the purview of our kids to succeed academically the outside distractions are playing a greater role in the classrooms and it has caused kids to lose sight of why they are there they're they are there to study the subjects that are required of them to achieve academic Excellence not to be bombarded with items of social justice or sexual orientation the burden of those those items should be falling on the parents outside of the classroom if they choose to learn about those items they can do so at a later date in a college Sociology class parents need to be allowed to play a

053greater role in the character formation of their children and schools need to get back to teaching kids education that prospers greater academic excellence um I'm sure since covid-19 these scores have dropped even more significantly since most of the student studies talk relied heavily on Independent work and the consistency reliability of the parents we are already in the bottom half of the state and I'm sure we felt even more in saying that we don't have a choice we must refocus our attention on the subjects taught in school knowledge is power should our children feel pressured to believe or feel a certain way I'm right there limit right there sorry all right thank you thanks again you were muted sorry can you start Melanie and Meryl do I start do I start go ahead okay hi my

054name is Melody and I attend this Maple rush I'm here to talk about the recent Taco Banning Pride Flags black lives matter Flags Etc I did not feel like this movement was fair to people to people of color and in the lgbtq plus Banning these flags make me feel like I would not feel welcome or safe and this and I do not believe this is the right thing to do it makes me feel like you should be this or you should be that I think that these flags should not be banned I have I have friends of color and friends who are part of the lgbtq plus and they agree with me as a kid I think it's unafraid to say kids should not be around an environment and by in this environment I see

055it as an example like you are not welcome here if you are this and this frustrates more people than just me please take this into consideration and consider into consideration thank you for your time thanks Melody thank you okay I am looking for a Richard Arnold and pulling up now on standby would be Colin Riley shoot on video there we go now you can see me okay hi uh my name is Richard Arnold I am a multi-year well I don't know 20-year transplant to Newburgh I've raised all four of my children in the Newberg School District two of my children are currently attending the high school I've got a senior and a sophomore my sophomore is transgender and one of the saddest things that I ever had to deal with was the fact that she

056didn't feel safe enough to talk to me about how she felt like that for two years um when she realized where who she was so that's that's how I feel the thing that I don't understand is I don't understand how this even came to be I mean was there a multitude of students that were talking about being threatened by identifications inside the classroom was there a teacher that was pushing their agenda on so many students that parents were getting complained to I mean where did this all start I thought that Newberg School District was doing just fine one of the greatest things I loved about this school district is that I felt like my daughter was mostly accepted by her peers and her friends just simply because I hadn't heard any of this I haven't

057heard anything about the n-word being thrown around or any of this stuff now I voted for you I believe my Representatives because I believe that you guys were looking in the best interest of the school district I didn't realize that there was suddenly political points of views being involved in it personally I want to commend Melody because I think that it was extremely adult of her to come to this meeting and to give her presentation I personally believe that you guys should vote no on this or postpone this in order to allow the students to make their own decisions for their individual schools just because okay thank you very much for your time tonight I appreciate the opportunity to talk in front of you I know that I haven't been able to change the ideas

058of people who have already set them up but for those of you who I hope have been influenced please vote no or postpone thank you thank you Richard on standby is Lydia shrimp connected and unmuted okay yes okay thank you members of the committee just want to start out by saying 57 years ago in 1964 there was an image that went viral around the world and we're talking about the civil rights movement and it was image of a black male with a police officer holding a dog in one hand and the dog had ripped the leg of his jeans and the headline read that Police use dogs and fire hoses on Negroes in Birmingham Alabama that was Eugene Bull Connor and that image went viral before anything really could go viral we had a U.S

059ambassador in France and he had no answer when people asked him what was happening in his country and that action people couldn't handle it they had to face it and that led to the ACT that we had of 1964 the Civil Rights Act of 1964 and it was the involvement of white people that also further led to the Voting Rights Act of 1965. and that wasn't that long ago I suspect some of you might have been born before that actually legislation was passed but that was the first image that went viral and a lot came about that and it wouldn't have happened without the well-meaning intentions of people and in 2020 we had another image go viral of George Floyd and this was powerful and white people especially got involved and got active in a

060civil rights effort and this is a movement so I understand all the language but saying that black lives matter is an organization or is political do you want to say brown lives are very really really important is it semantics are we getting into the font and the color scheme of a logo in a political organization no there's basic ideas 30 seconds human principles that say that all these people matter but you're not going to protect this this isn't some type of Reefer Madness just keep your kids away from lgbtq people you can keep your kids away from Pride as much as you can keep your kids away from porn white people don't matter because if other people said this entire state was founded on the importance of white people we don't have to face that

061reality so I urge you to vote no thank you for your time thanks I'm promoting Lydia to the panel and up next on standby is Robin Wheatley foreign there we go look my daughter was helping me it was so awesome hi you can hear me okay yes okay okay hi good evening my name is Lydia Schram I'm a parent of a middle school student in our district and I am coming in regarding the upcoming vote to remove BLM and pride science from our school our students staff and Community need to know they are valid and valued education has for many years gone beyond teaching just the core subjects because Educators have long recognized students do their best learning and are most successful when their basic needs are met in 1943 a Psychiatry psychologist excuse me

062Abraham Maslow published a paper describing a hierarchy of needs and suggested that if our basic needs weren't met within higher needs such as learning could not be well met we still use this basic hierarchy of needs today to inform some educational practices these needs are most often depicted as a pyramid at the base of the pyramid are the most basic needs such as air water rust food shelter and health schools today help provide some of those needs with food water free health care screenings and most recently adjusted school schedules for later start times for middle and high school students because we know supporting these basic needs leads to better educational outcomes the next levels on these pyramids are security which covers safety security stability and social needs which covers a sense of belonging and inclusion

063these things too must be met in order for students to be the most successful Learners they can be data previously shared with the board clearly shows our students that fears and concerns for their safety and feelings and inclusions in the area of bullying feeling judged racial discrimination lgbtq plus discrimination and school shootings these fears clearly fall in the security and social levels of the needs pyramid you've heard from many students who have told you what Comfort it gives them to see symbols of Pride and bipart support in their schools and Community but it sounds to me what you want to do is take care of the symbols that have helped some students feel safer and more included meeting some of their basic needs so they can be more successful Learners more times sorry all right

064um I I just feel that removing everything but the state flag and the um Oregon state flag and the United States flag seems impractical and I urge you to either postpone or vote no thank you thank you I'm promoting Robin to the panel I I'm sure if this is the same one there's no last name hi Robin are you Robin Wheatley who signed up for public comment you could unmute hi Robin hi okay here we go hi um my name is Robin Wheatley I have two kids um in the Newberg schools I also um went to Newburgh High School um today I want to say I support the school board Banning political signs such as BLM and pride Flags those flags oh my dog I am so sorry these flags are completely unnecessary there are

065many rules against racism and discrimination on the books racism and discrimination has never been tolerated in our schools people say they need the signs to feel safe or that a teacher cares I feel this is a lie and is manipulative I would like to think Newberg with all its rules about racism and discrimination has carefully interviewed and vetted all of their teachers people make people feel safe not signs if we need signs to make people feel safe we have failed our students BLM and pride flags are not inclusive to all they hold one group over the other BLM actively promotes hate against police officers here in Newburgh we have a large population of police officers and their families how do police officers children feel when they see a BLM sign not good you have successfully

066excluded these children what happened to inclusivity for all police officers are not allowed to speak at public meetings due to policy they don't have a voice Community they serve the community and must remain neutral teachers serve the community and should also remain neutral it is the school district's role to educate students not indoctrinate them with political beliefs it is a parent's job to educate their kids about politics thank you thanks Robin I'm promoting John 3 read to the panel and on standby is Amber and Taylor Dawson if you could turn on your microphone and your video here you are there we go good evening um yeah there's a lot of uh I I would like to uh to speak on on behalf of the the school board's decision to uh to remove the signage from

067uh from schools and that doesn't matter uh uh what signage that is uh other than our our state flag and our national flag um whether it be conservative whether they be um uh I I have a line of line of thought uh again we I agree with the um the concept of our teachers teaching uh curriculum in the school that's what we need uh we need to be able to um focus on those things there's we already have restrictions on what things are in school you can't wear a um a gang symbol to a uh to a classroom um you couldn't have something with a lewd or vulgar language on your on a t-shirt or a hat on a bag in the nature why because it's disruptive all these these uh uh signs these flags

068these posters uh distract from what the purpose of those kids are are going to the school Institution for which is to learn to get an education which is going to better them in the world most of these offside groups if they want to attend them if they want to participate them they need to seek them out themselves they don't need to be slowly indoctrinated or persuaded uh by somebody else's ideology uh it's a dangerous precedent to set uh and it's not going to serve them uh in the long run and so um they need to be removed and we need to seek out better methods of of connecting with our children and allowing them to to feel close to the community um it's my time you know thanks Sean um the next stop is Amber

069Dawson but she is having difficulty with staying on the call so let me see if I can grab her oh it doesn't look like she's on anymore um okay I'm gonna go to Walter want and see if we can try Amber again later let's see okay sorry I don't see Walter on there either let me see if it's under another okay no I don't see Walter want either so let's see next would be Ruth schoenhalls so let me see if I can find Ruth okay I'm gonna promote Ruth and I will keep looking for the others recipe could turn on your bike in your video great there you are hi my name is Ruth schoenhoff believer and um I have been an El teacher in New York for 20 years mostly at Edwards elementary and

070I'm a gay parent of current and previous New Birth students um I hope that you will be willing to read and and take to heart the things I wrote you in my letter but I want to stand in agreement with um things that have been repeated several times here tonight that no matter how much we focus on education and improving our teaching our students can only learn if they feel safe and if they have Equitable access to the opportunities in our district so this is why we show our support visually and why we spell out our commitments and policies let's preserve these opportunities that we've set up and um please vote no on the policies being discussed this evening thank you thank you Ruth hey I see Amber is back so I'm going to try

071and pull her up again my hamburger there if you could unmute okay I'm unmuted can you hear me we can hear you okay um thank you for hearing parents I um I'm thankful that people are willing to serve on the school board I know it is a thankless job and um I would agree with a previous caller that this election um was definitely um the voice of parents um I know that some are not brave enough to be on this video call um but many of the parents that I speak with you know it's disingenuous to say that black lives matter is not a political organization they have stated firmly on their website you know I keep hearing George Floyd and uh the other names of people who have died that's true that those are

072tragic incidents but seriously I have a rap sheet right here 14 charges I don't want a George Floyd day for my children I don't want to uplift a criminal there are so many good people who should be honored um it's also disingenuous to say that the lgbqt is not a political agenda it most certainly is um I try and teach my children to love everyone those stories and incidents that have been shared that is not right I don't believe that it's right I certainly don't teach my children to do that and like a previous father had said is there a incident report like is there a list of these things that are happening because I don't believe from the two that just graduated I heard one story like that the only Story I Heard was

073a kid being sent to the office because he used the wrong pronoun sanity seems to have left our school another father talked about the math it's true less than 50 percent of the kids were passing math at Chehalem Valley I wish we could remove the politics and just do Reading Writing arithmetic I didn't wear a t-shirt that gave my opinion like some of the school board has Amber worth not about me it's about the kids thank you thanks Andrew okay chair I have um the next person up to speak uh there was another person who has requested to give their two minutes they were signed up Pat Bauer was signed up and they requested to give their time to Michael Gunn who is up next so I am bringing Michael up to the panel Jennifer

074do we still have Walter want in there or is he didn't I keep looking I have not found him okay Michael if you could turn on your microphone in your video we are ready for you should be on it's unmuted can you hear me we can now yes can you go can you hear me then we can hear you okay my name is Mike Gunn I I guess I'm I'm going to start with a cynical response I must be a over privileged white person because I grew up born and raised in Newburgh went through Newburgh grade school high school Etc graduated in 65 got ambassadors a master's a law degree nobody gave me a dime for my education or anything I think this is appalling as far as this black lives matter the LBGTQ I

075served in the military there were two things back when I grew up that were basically sacrificing from politics one was the military the other was schools and both of them have gone to what you would say is the opposite of heaven right now here's it I got involved with this black lives matter thing because I was put on alert that or I found out that in May or June that that Dundee school this or the Dundee Elementary School I live in Dundee had black lives matter paraphernalia signs Etc in the school I sent emails to the board re-logged in the principal Joe Morlock the superintendent I got back some tepid responses I had various specific questions for them one thing was I said don't you understand that black lives matter is a subversive organization founded

076on Marx's principles their response was well we don't really it's not really black lives matter it's the black color that matters which I think is disingenuous as anything here's the situation the school district needs to educate these kids Reading Writing arithmetic and Civics the school district should look at the mission statement what their mission statement is for kids it is not to try to hammer home a political left-wing Marxist ideology and I understand everybody's got it right of a First Amendment right but here's the situation all these people that want this black lives matter this racial inequality this critical race Theory Etc talk to these kids can go demonstrate on their own time off the school grounds that has no business in our school system now and one thing that really upset me from the

077emails from Mr Morlock and Mr logdon and and granted they gave I have to give them Kudos they they responded although an attempted response I said what happens if I bring down blue lives matter and all lives matter Banners To The Dundee school and I want them posted I was told well that's up to the teachers whether they're going to post them or not and I and I think that is absolutely appalling when the teachers or the superintendents or the administrators control what the curriculum is and obviously they have a political agenda to to uh follow as far as the kids are concerned as far as this racial Injustice is concerned there are plenty of laws on the books as far as anti-discrimination I'd like to know who wrote These and who wrote these uh

078resolutions to start out with the other question I'd like to know is who authorized these black lives matter signs banners to be put in the school I've never been told that and I've asked that and I would say that that is obviously not the school district's purview so with that I'm done thank you thank you Michael hey I um pulling up Stephanie Whedon and on standby as Matt Moriarty Jen before we go any farther that's going to be our last two speakers we're going to be out of time so if anybody doesn't get a good speak tonight uh we'll have you go ahead and send your remarks into the board um and then we will try to get you to the first of the list on September 14th for the next meeting for those who

079didn't get to speak tonight but please send your comments in so we can read all those uh that would be greatly appreciated uh we've never had this many people call in and speak even trying to to tone it down we're still going to be at 31 and uh so again thanks for everybody calling in and uh you know speaking your mind and we really appreciate that but please send in your your comments you're going to make to the Newberg school board so we can read those so we'll we'll finish with Stephanie then Matt care Brown I have a question sure um what was the total number of folks we have heard so far we're 29 right now okay so you want to stop at 31. yes and how many total did we have submit a

080request January somewhere around 62 aren't we uh no actually we are um more like 90. oh there you go thank you so that came in a lot late didn't it Jen so much lucky um that was sorry and that was about at four o'clock we were about 62 or 63 right there so we're ready Jen for Stephanie yes okay thank you dear school board members my name is Stephanie Whedon I'm a teacher and parent in the Newburgh School District I wanted to share how forcing the removal of Pride BLM plots and reversing the anti-racism resolution can impact our students our students all of our students deserve representation being seen in the classroom curriculum and school when you think of being seen groups that are minorities are not always given that opportunity by removing any type

081of physical representation location that makes them last representation which are you starting to fight with these minority groups planning on addressing the trauma that is happening or will happen to our students according to the Oregon healthy teen survey from 2019 roughly one in 10 youth are gay lesbian or bisexual the data shows that in Yamhill County alone about 25 of eighth grade students in the 2019 seriously considered attempting to Suicide which is five percent higher than our state average if we look at bullying which we know can contribute to lower attendance rate lower student achievement some of our eighth grade students and four percent of our 11th grade stand up eighth grade students and four percent of 11. th grade students being bullied for their race or ethnic coordinate thinking of the status that these

082numbers are not declining what we're doing is not enough how will removing this resolution and flood support our students who are suffering how will these actions improve the percentage of students who are being bullied and or considering suicide I asked the board to think about the message that this is sending to our students of Newburgh and how it'll impact the already oppressed thank you thanks Stephanie hey I'm promoting Matt Moriarty uh my name is Matt Moriarty and I'm a parent of one current and one former Newburgh student and I have to say wow culture War culture War culture War knew how many people I was at odds with here in Newburgh and so four of you decided to rim this issue onto the agenda this month this is a very divisive thing you've done we

083weren't in such disagreement until you did what you did it's funny how that works especially because I've always considered Newberg a welcoming City I understood it to be a tolerant City even at a time when such intense hatred is being demonstrated Nationwide with 40 churches Newburgh seems to be a Christian City we have George Fox if you do the math I'm sure many of you whose faces I see here consider yourselves to be Christians and I love that because it means that right here in Newburgh and especially on this Zoom call it means that Jesus is watching so when the new school board votes four to three to upend policies that simply extend the Christian ideals of Love tolerance and understanding to the most vulnerable Among Us Jesus is watching when a little sign with

084the letters BLM make a nine-year-old black child feel just a little safer in his own School but someone from the new school board comes to rip it down Jesus is watching and when a gay child comes to believe that there's no place for her anywhere because of a new school policy Jesus is watching he's watching all of you my understanding of Jesus is that he's the one who would take every one of these children in his arms and hug them and tell them don't fear because you are my child made in my image and I died for you because I love you we're all here at this meeting watching you decide on policy that affects the children of this community not the adults with their culture War but children who deserve to feel safe and

085welcome in their own schools and whatever you do Jesus is watching thank you thanks Matt okay Jen we got through 31 we did all right there so again for all you people that didn't get a to speak on that we have other things to do on the board tonight to get through all this uh it's gonna be a late late night so please send in your comments to the Newberg School District board and we will look at those and uh again appreciate everybody calling in tonight and sharing your heart so thank you very much Jen you doing okay over there all right thank you uh at this point uh we're quite a bit behind schedule already but we knew we would be so uh we will go to uh the board uh comments and then

086we will go to superintendent Commons so I think right up off the bat we will start with I have you guys all listed out here and we'll go with Trevor de heart foreign thanks chair Brown um man boy we uh a lot of passionate um uh people speaking a lot of uh emails coming in um so many of them I haven't I haven't been able to get through all of them we're uh we're definitely uh divided on this issue and no matter how it turns out um the one thing that that's kind of peculiar to me is that kids don't feel safe in our school and somehow up until the recent decade um until we the the uh the invention of these these flags these symbols that kids haven't been felt uh feeling safe now

087kids are always going to be mean um adults can be mean and we have to not judge people by their personalities but by their character and their actions and it sounds to me like um we're not doing a good job of addressing bad behavior in the schools um because it sounds like it's pretty uh pervasive throughout the schools so um we got a lot of work to do and how we address this and how we um how we make our kids feel safe by our words by our actions it sounds like it's coming from teachers and other students that make people feel unsafe um not included and uh I I'll give you my word that as we move forward on the board that we'll be having this discussion over and over again not only among

088the board members but among the um uh among the administrators to see how we can do things different to make sure all these kids feel safe that that'll give you my word thanks Jerry Brown thanks Trevor uh next up I'll go to NS foreign ER in Miss Micah's class at Mountain View Middle School when a classmate who I was working with on a group project told me shut up stupid immigrant it was those words and that moment where my advocacy began I realized his Assumption of me being an immigrant was because of the way I looked Miss Mikus made me feel seen and heard for that I want to thank her and all of the other teachers who have treated me similarly You Know Who You Are Miss Mikus value of the contributions I brought

089to her class and even told me I would be in the news one day never did I imagine that I would be on the news across our entire State Associated to the headlines that have come out in the last couple of weeks I'm embarrassed the headlines don't represent my values nor what I want for the education offered in our district I was disgusted with the Motions from our previous meeting and to me they felt personal as the only person of color on this board however I was not surprised I have been targeted disrespected belittled and hated on before but this isn't about me this is about the students in our district students know I support you and will continue fighting for you to have an equitable education one you the one you deserve to me

090you matter your voice matters and I understand that I will never understand but I have your back I want to thank everyone that has had my back and has shown support in the last couple of weeks from the thank you letters to the encouraging messages to the quick check-ins you all have helped me stay strong so thank you thanks uh go to uh director Renee Powell hi so some of the main concerns I was hearing from everybody is you know the safety welcoming accepting including non-bullying the Oregon Department of Education recognized that all students are entitled to a high quality educational experience free from discrimination or harassment based on race color religion gender identity sexual orientation disability or national origin and without fear or hatred racism or violence all staff and leaders are also entitled

091to the same all students belong does Oregon have a state law that prohibits bullying in school yes it is found in the Oregon revised Statute chapter 339 sections 351 through 364. this also includes cyber bullying if we have so much bullying going on in our schools why is that and I would like to know why and what are we doing about it and what is the discipline that is happening to discourage it um I have had teachers and staff that are aren't being able to speak because they are afraid of losing their jobs or being canceled or being bullied I have met with parents privately that have been afraid to speak out or fear that their kids would meet even more bullied or their businesses would be attacked this makes me really sad that these

092people are afraid to have a voice um a couple uh shared how their daughter was being bullied for being straight so they're planning on taking their kid out of the school because of this as a parent quote I want my child to focus on their education while at school not their sexuality as a parent it is my responsibility to have the conversation in regards to the topic such as sexual orientation transgenderism and more with my child it is not a place where the teachers principals or administrators to do so and there was more of that coming from other parents that I met with so um another quote was you know about having that the flags are makes the feel the kids feel comfortable so what about the kids that don't feel comfortable with these flags

093do they have a voice in this or has say in it and aren't we supposed to be all welcoming to all children um so I'm sorry but you know that is what I've been hearing from the public that the police officers children and there's other children that that is offensive to them on December 8th 2021 board meeting Joe said something that I agree with that applies to this situation about how symbols can come across as good or bad depending on who the person is it may not be your intent but the impact that symbol an image can have on someone can be viewed and affect people differently it might not have impact you but it does others it's about the impact that it has on students so I'd like to end by reading what an

094anonymous person in the schools sent me says love your neighbor who doesn't look like you think like you love like you speak like you pray like you vote like you no exceptions so we need to be I feel all welcoming for all students and that is in our policies that we already have written up for the schools foreign thanks Renee I'm gonna move on to director Pinner thank you Dave just want to say thank you uh you know in the last few weeks the board has seen engagement like never before uh you know from students staff parents and community members and so many of these have shared their experiences and often deeply and personally heartbreaking detail and I really want to thank everyone who has spent their precious time to help and for inform the

095board in tonight's decision pride is resistance there should be pride in a culture that has thrived despite violence pain and cruelty creativity and Beauty Thrive despite artists poets brought the pain and beauty of black and lgbtq plus experiences to the Forefront of our culture powerful voices like Audrey Lord Nina Simone and Mary Oliver powerful cultural influences like music art writing Cuisine fashion amazing and Powerful forces that are changing our world John Lewis Martin Luther King Jr and Harvey Milk elevated oppressed voices Billie Holiday passionately sang Southern trees bear a strange fruit Blood on the leaves and blood at the root black body swinging in the southern breeze Strange Fruit hanging from the poplar trees there is pride despite the brutal enforcement of oppressive laws and policies laws and policies that people like us create beatings

096and depth for simply daring to be who you are for being unapologetically out and proud to be fully themselves always I am proud to be leading in a time when I have the opportunity the privilege to be an ally and right now that means acknowledging that you matter don't ever stop showing your pride in who you are in what you are or why you are never let someone else determine your worth be unapologetically proud of Who You Are to my fellow board members now you are in the position to create policies that will uphold a system of Oppression and are attempting to eliminate policies that uplift and support our students you're attempting to create a system that will have to be enforced with no regard for student or staff well-being you're forcing teachers and Educators

097to remove signs of pride why because it makes you uncomfortable ask yourself why it makes you uncomfortable angry or fearful why does the idea that someone other than you could be proud make you uncomfortable angry and fearful the idea that someone other than you as someone who doesn't look like you would love like you could be proud is problematic only for you this isn't about politics or other people this is about us you are leading and you can choose to build or you can choose to destroy as I attempt to destroy that is resistance subverts oppression always from the Underground Railroad to the Stonewall riots and the already newly designed signs of pride in our community you cannot oppress Pride what side of History will you be on to the staff and students in our

098community you are amazing because you are you all of you not despite but because you are you what you may see in tonight's meeting is not because of you it's a misguided attempt to a lesson the amazing you for every child student and staff member who is hurt scared and angry angry regardless of the hate you see around you stay bright remember you are the best you that will ever be so always be unapologetically you all of you loud and proud this is one more battle that has been forced upon you and unfortunately my friends you have got to resist we have all got to resist you have got to fight for your facing inherent human dignity and it's unfair and it's hard but this is the reality of your existence as long as I'm

099here I will be in service to every student and staff member I will stand up and support your right to walk the halls of your schools safely and proudly open and honest and who you are and in your hard fought rightful Pride thanks Brandi I'm going to move on to director Shannon I'll save most of my comments for the particular agenda items uh I just want to thank everyone who turned out to speak to us tonight and everyone who took the time to write in to us you know um you can say a lot about these topics um but I don't think any of us can deny the fact that these symbols are divisive the conversations and the letters and the emails that we've gotten have shown just how much they've divided our community and

100gotten our attention away from where it needs to be which is teaching the basic fundamentals of Education which is what people pay us to do with their tax dollars they go to work and then we take some of that money on the promise that we're going to educate their children in how to think how to do math how to do science how to read not what to think not your particular ideology and just because you call it social justice does not mean it is some sort of Universal moral imperative that all of us have to agree with families are where values come from in America not the state not the government thank you thanks Brian uh next we'll go to uh Rebecca I wanted to thank the school district for the opportunity to attend uh

101the Oregon School Board association's conference this summer I attended board Essentials and board leadership and being on a school board I encourage all of my fellow directors to take advantage of the The Learning Experience through osba so that we can um grow together and learn to work together and be more productive for our our students staff and community and I also want to thank all the people who wrote pro and con I I was so touched by the letters from um former students to share their hearts the the articulate um of Quentin Comas and the valedictorian who shared his his story they they put their critical thinking that they learned at Newburgh High School to to real work and all the parents you know everything has I've read um for the last four days I've

102been reading all this and and I do hear both sides and and but I I also have to say that I I talked with a young black student from Newburgh high school and I asked her if she wanted to sh if she could share what what the these these motions make her feel like and she said I don't feel like I've been listened to and I'm afraid to speak before the board again and and that makes me sad that a student does not feel heard by the school board and like with when Renee I I we want to hear from everyone and there there is no um there is no should be no fear of loss of job for for sharing your opinion and um I think that we we have we can work we

103can be collaborative and find ways to solve these these these this Division if we work together so thank you very much thanks Rebecca oh one more thing I want to thank this the School principles and the district team this is a horrendous time in August is is such a crucial month of trying to get the school into operation and to have this this um amount of discussion around something that they need to get have time to get the job done to get the school ready schedules made teachers hired staff hired they have so much and so I I want to thank you for all the extra work you're doing on behalf of this this the community thanks Rebecca I guess for me uh you know I appreciate all the uh I think if you're out

104there listening you can tell each of the board members have a lot of passion moving forward we have a board retreat coming up I encourage all of our board members to bring that same passion to that Retreat and I think our main goal's got to be to work together to learn how we can work together and so we represent every every student out there it'll be a challenge we're on different pages that's for sure but I think we can do it and uh the one thing I hear from all my fellow board members is you care you honestly care I know you do and I I uh I think with that we at least can have a starting point to where we can start to have more discussions and and move forward I would say

105after reading uh you know over 500 emails that came into the board um the thing I'm excited about is to see the excitement level in the in the community of people wanting to engage and uh to to take the time to write your letter to to speak at our board meeting um I think that's awesome that people are starting to step up and say things um obviously we're not always agreeing but at least people are stepping up and saying stuff [Music] um I would say after reading all the emails and I read every single one and uh so I again I appreciate you guys uh I remember a year ago that one of the goals of the black lives matter was to cause division and whether you agree with black lives matter you don't we

106are the we're divided like no other um we're not listening to each other the words hate anger you're wrong or used often uh we're grouping people by color and groups we are uh we are a nation that's turned away from our roots um I haven't seen this kind of division since the Vietnam War and as a country we have uh chosen to fix people over listening um we're trying to listen to as a board and then we need to also try to learn how to listen to each other as a country I feel like we're bringing a lot of uh adult and grown-up battles into the classroom what Rebecca paros just said is school's tough it's tough right now to get started and we're doing this coming out of covid there's nothing easy about what

107our superintendent has to do to get our school district ready but I'm going to say this as strong as I can to everybody out there we've had so much said to people in a strong way but I'm not a racist never have been never will be I work with and will always accept those around me no matter what I don't care if they're if they're gay I don't care if they're white or brown or black I work with everybody and uh I'll agree with uh director de heart that if we have problems within our schools that people don't feel safe I think it's a board that has to be our number one thing I know in emails I read from staff members anonymously that they cannot say their name on that because they fear they

108have fear and just like we're talking about our kids we have fear um this Probably sounds a little bit self-serving but I've spent the last 44 years coaching 20 years at Newark High School and I have never worked differently with somebody because of color of their skin or who they are and um I know we have great teachers and and educational assistants at our schools who want to do the best for our kids and um but for me I'm not going to accept excuses on the behalf of the school district the school board or anybody else we need to teach work ethic we need to teach people not to be selfish we can't lower the bar we need to raise it for every single kid in our district we have a great teaching staff here

109and I think as a board that's that's going to be my main goal is every single kidneys come out of Newburgh high school and uh and and be ready to go three weeks ago I got a chance to meet with one of my former players he's 19 years old he's a minority and he never let that get in his way now he's making so much money he wants to take me out to dinner because coach I am doing so well but he's done it all through hard work and no excuses he came through Newburg High School could have went to college chose to go into the workforce and he has found a great great line of work for himself let's don't make excuses for anybody Martin Luther King did not want us to judge his

110kids by the color of their skin but by the content of their heart I've said this now at about five school board meetings and I think if we all set back I think we all agree with that so now we got to figure out a way to put it in practical purposes so that's my comments thanks for everybody making their comments and now we're on to the superintendent comments with Dr Joe Morlock thank you chair Brown I'll make this short in the interest of time we have lots to get through tonight for business I do want to thank our commenters we had 30 I think that we put on I'm a little disappointed we're getting through all 90 I knew that's uh that was a large number but I do think it's important to hear

111from everyone you know we we did get lots of emails coming in of course as you mentioned hundreds and hundreds I'm glad somebody kept count I lost track after a while I do appreciate those so thanks to everybody who did those I would like to hear from the other 60 or so who did not speak tonight because I think everyone should have an opportunity um speaking of that we are um uh rumbling toward a September 14 Target date that would be our normal first meeting um in September um moving toward probably will look like a hybrid meeting um we will continue the zoom access and the live streaming of our meetings during that time um you know some of that will depend upon room capacity if there has been some change in mask status generally

112um but we will at least for the foreseeable future make hybrid meetings available so the public has access whether they're going to be at home or in person so I want to make sure I knew I had gotten a few worried comments that will move back into in person that they wouldn't still be able to connect so I want to let folks know that that's that is not true we will be available both streaming on YouTube if there aren't enough seats virtual seats or here of course on Zoom so we'll be able to to continue to take comment and to operate that way and if board members should wish to uh also attend the meeting remote they would be able to do that so I just wanted to clarify that so it's hopeful that we

113had a few folks that wondered so I'm going to stop there chair Brown so we can move along with the rest of the meeting thanks Dr Joe uh we're at that point right now on the schedule we're gonna take a five minute break and we'll be back in five minutes so see you guys in five minutes thank you how much foreign doing good now is he doing tracker football this year is he going to do track for sure no he's he's um assistant principal at Conestoga Middle School now oh well Jesus done coaching yeah at least for the time being that's a busy job yeah is Grant 38 he's 34. what yeah oh wait a minute how did I miss that one so he wasn't with Paul he was with Tyler yeah yeah geez I'm

114making you older than you're not oh well I'm going to be 65 soon oh yes I know this is so the day I turned 64 I went outside and I was singing that Beatles song yeah you know when I turned 64 will they still need me will they still see me yeah I couldn't shake that song for a couple of days yeah Paul will be 38 in November so we just got to see him and his uh wife and their little four-year-old son a little guy can wear you out quick that's why you have kids when you're young oh my goodness he's worse than 30 high schoolers in the practice we took him swimming and he just goes and jumps he didn't have his army things on there you know the floaty things next thing

115you know he's going down in the water and I'm like dude you can't do that you don't got your arm thingy Bob's going he goes oh I forgot so yeah but you can't forget but he goes yeah I'm I'm four I guess he gets a chance to forget well Brandi we're just at a wedding up there by your house last weekend that Big Thompson wedding up there was it at the uh what is it called The Old Farm on King's grade you go up your road then you turn left down into it it wasn't very far down that just real quick yeah property I bet it was beautiful 340 people it was crazy big so I and I did it with Paul almquist Pastor Paul and that was we both we part of the wedding

116ceremony but it was fun they did a great job it was right down from your place we were waiting for everybody back here I know Nikki's getting ready to go there [Music] got everybody back there you guys okay I think we do I don't see you guys see an s on there I don't have it on my screen she's there and Trevor okay I've been here for a while okay I should have you on my little box screener I know sorry all right you guys we're gonna keep going through this we are down to the cassette agenda um so I'll read through this really quickly I think there's a couple of ones we've got to highlight um it's the 2021 minutes approvement minutes from the July 13th uh board meeting the personal recommendations we have

11717 new teachers to accept their probationary license contracts effective August 30th I won't read all the names because there's quite a few but welcome to all those uh teachers and then we have uh we're accepting license temporary contracts effective August 30th um I recognize Connie Kaiser on there for Newbury high school and Kelly Voigt from Mabel Rush we're accepting a licensed resignation effective June uh for Rebecca Boyd uh teacher at Mountain View Middle School English teacher so Rebecca um you know we'll miss you um also uh resignations from Megan Hewitt Melissa love Matthew McCloud and Jared Reinhardt we're also accepting a licensed retirement effective June 19th for Mary rior a long time teacher at Ewing young and so Mary congratulations and welcome to uh retirement time you deserved it and you uh did a fabulous

118job so thank you on behalf of the board of the Newberg School District uh we need more of those kind of teachers out there so if you're a younger teacher go find out what Mary did and you'll be awesome so the recommendation is uh uh there to move this Newberg School District Board of Directors to prove the consent agenda as presented I moved that the Newburgh School District Board of Directors approve the consent agenda as presented a second raise a hand for uh yes votes there everybody's hands are up 7-0 thank you very much for that motion passes and uh it gets us through the consent agenda now we're in reports and presentations from uh Nikki Fowler so Nikki you're on great thank you um tonight I'm presenting the June 30th preliminary report for new

119board members there's still quite a few entries that we'll make when the Auditors come through in a month or two so there may be changes to taxes and and different items there a few of the big items that are related to ssf so these numbers are truly preliminary there might be a bit of movement um before we're all said and done for the year and the audit will be complete by the end of December and that's usually when we really get our final figures for last year that completed June 30th um so at this point it's looking at about 11 just over 11 million carryover um we do have a chunk of money due back to the state um due to taxes and items coming in higher than projected um have about 740 000 right

120now um but that being said that there are tax adjustments the Auditors bring come in and do when they get here that number can change a little bit um we did not I did not present July yet because the poor report was due pretty early this month usually I go later in the month it's all our bank Rex and our interest payments and those sorts of things aren't completely in the system yet for the new fiscal year so next month I'll get the July and the August report to you at the normal meeting so we'll get those caught up for you um did you see any do you have any questions about what was presented I've just got a couple of points of clarification or hopefully and clarify them so on the first page of

121your report the revenue sources two thousand and four thousand those have negative if all the way to the right the actual percentage budget um negative balance and negative available balance could you just help me understand that a little bit more you mean completely to the right where it compares to the prior year yeah where it says available balance and actual percentage of budgets [Music] let's see it's page 23 in the packet I hope that helps okay well let's see I was looking at the um so that's comparing to the prior year so it's just saying from year to year that's that much of a difference okay um the available projected June 30th I don't see any in the revenue page are you talking about so the revenue page they're all they're all well if they're

122they're above budget a little bit in the revenue page I just realized it's federal and state grants so maybe that's okay okay that makes sense yeah that that'll that'll be good um no go ahead what was that uh oh I was just gonna move on to the general fund Revenue I noticed it on that page and the far right that percentage change some of them have like error messages um right because some of the grants that came in and we can receive Revenue over what was budgeted um but you just can't expend what over what was budgeted so that's why some of those numbers are negative we just received more than what was projected um and there's you know we've uh one thing that's very um good with our district is we do receive a

123lot of Grants we have a lot of people go out and seek those um so we've had just more Revenue come in and specific function areas Federal versus State and those sorts of things and projected so the SEC the expenditure part is that part you really want to keep an eye on as far as meeting um budget rules budget law and not expending more than you have a resolution for sorry my dogs decided to play I don't know if you can hear them but they're dancing around back here were there any more questions I have a question since you know I'm new to all this and this may seem like a dumb question but what is the local um sources under revenues what is where's that money coming from or what is that under on

124the general fund one or yeah on page 23 is that just um yeah local sources can be say County or they can be private grants um there anything that's just kind of a miscellaneous grant that has doesn't funnel through us via the county or be as the state or feds so they could be Austin Family Foundation they could be other small organizations that somebody reaches out to and receives a grant from okay great thanks foreign so just really quickly on the general fund expenditure page um item let's see 1270 educationally disadvantaged that's just the overall through there can you help explain that that's a that's a code that isn't um really used anymore we just probably just need to delete that out of there um yeah so it's just sitting there we don't budget anything

125to it and we don't spend anything I just need to clean it out and there's an old number okay good and then my last question 2140 Psychological Services um the same kind of thing where available balance is negative in percent of actual is negative yeah so that's an area um a lot of the sped accounts are balanced against like the idea grants and federal funds that came in um some of those grants didn't have the capacity to hold those so we put them back into general fund um so again that's another area where we have a lot of those Support Services the 2000s and we just watched to be sure the bottom lines are balancing um but but yeah that's how that happens with those sometimes thank you for that clarification because I saw those

126and thought wait a minute does this mean we've overspent or what is what is that so yeah thank you for that clarification hey Nick you have a question um kind of a tough one and I know you can't really really answer it but you kind of did a couple board meetings ago um oh my dogs are running around here too uh I think the you know the mass thing you know I know Dr Derek chant you know talk about that if we end up taking hits on amount of kids I mean where are we at comfortably where we can you know I mean I know we're doing pretty darn well in that Indian fund balance so um is there a point where we the next amount of kids where we're you know it starts where

127I budgeted this year I should say I we because it's a joint venture we talk about all the numbers in the ADM when we when we build that budget um we were down about 400 kids when I budgeted I budgeted about 150 returning which I feel like is probably a safe number um so I'm thinking we would come back in higher than that so I'm hopeful that if there are some folks that choose to make a decision you know to not to return to the district due to that that we have enough coverage there um but you know I don't know I don't know what those numbers will be it's a it would be a complete total shot in the dark um for me to guesstimate that but as it is now with the budget

128going into our current budget um we yeah we would really want to watch that number because we intend to spend the majority you know spend as budgeted um I don't expect us to be a really ahead of the game and be gaining a lot on the ending fund balance into this year so we'll really want to watch that number okay when will we know what the actual enrollment number is what the actual number is for students we would be into the school year I forget is it two weeks in that we do that official count October 1 is our official date yeah that's the ADM official count I thought we did another account before that but that's our first number that goes to the state for the collection we start counting students the first day

129of school for the first couple of weeks before we have to do an official report to Ode thank you thanks Nikki [Music] anything else as usual you're helping us catch up on our time so I try we try to be efficient Jim great thanks so thank you very much which always does great uh so we're Item B ready School safe Learners update including Mass from assistant superintendent uh Dr Derek Brown hello everybody I'm going to go and share my screen and put some slides up for you foreign yes okay great thanks okay thanks for the time tonight um I'm Derek Brown I'm the assistant superintendent for the Newberg school district and wanted to give you an update on our reopening plans most of this will focus on recent guidance that we've received around masks although

130I will talk a little bit about some changes to quarantine um rules and we'll try to share a little bit more information about some of the things we have planned around mental health support for students and staff there we go okay so just starting off here some of this will be review for everybody Governor Brown directed ode and OHA to create a rule requiring face coverings masks indoors for all K-12 schools back at the end of July that included both public and private and that guidance was consistent with what Washington and California are also doing um we've seen a significant increase in coveted cases and hospitalizations primarily driven by the Delta variant which currently is making up about 80 percent of the cases in Oregon we know that Delta has been substantially more impactful at

131least in terms of transmissibility we don't know yet scientifically if it is uh more severe but we know that we've seen an increase in hospitalizations the guidance that we continue to receive and believe is true is that Universal and correct use of face coverings will keep students in in-person learning by reducing infections and quarantines the guidance we've received is that all individuals and schools must wear masks including staff students contractors visitors and so on at school during regular hours or when they're engaged in activities like field trips or other off-campus kinds of events during school hours or at school engaged in educational activities outside of regular school time and of course face Shields can be worn as an alternative for folks that cannot wear a mask for medical reasons there are some exceptions to when

132um people will be required to wear masks listed here I'll read through them very quickly for you actively eating or drinking sleeping playing a musical instrument which requires the use of their mouth engaged in a sport during physical education class such as swimming or other water sports and so on or a sport where a mask would be hazardous alone in a private office enclosed by walls on all sides of the door or under the age of two foreign of course there have been lots and lots of questions um about um about this Rule and how that's going to roll out so the first one is is the rule for the full 21-22 school year and the guidance that we received there is that no the goal is to get back to local decision making on

133this uh ode I'm sure as well as OHA and oee will be monitoring statistics on the virus getting feedback from schools and making informed decisions moving forward but the goal is to not require masks for the full school year our fast masks required for indoor sports no this is a local decision uh these would be considered non-educational activities so those non-educational before and after school programs are voluntary with regards to the use of masks unlike school and other required educational programs before after and after school our masks required at the district office or other non-school sites what about board meetings no again these are local decisions and I've listed where it's required I will say we sent out guidance today to let folks know that at the district office consistent with our schools we are

134requiring masks but again those are going to be local decisions um there are there has been some communication about potential penalties for uh schools and districts that may be in violation and so what we've heard uh currently is that we may be subject to 500 per day per incident uh for violating mask rules uh OHA has the authority to take additional action not exactly sure what that would look like but they can do that um licensed Educators that means uh administrators teachers counselors anybody who works with a license in our school settings who does not comply with the mask rule could face additional penalties which include probably most significantly the loss of their license um and school board members who vote to violate the rule can also be personally named in lawsuits for damage or

135neglect should they vote to violate the mask Rule and students or staff become ill let me uh pause there for just a moment and see if there are any questions about the mask component of the conversation that seems to be uh where we're spending a lot of time talking and and need need to pause and see if anybody has any questions there foreign go back one slide I hope so maybe not ah there we go that one yes okay so say based on the vote that happened at the last board meeting where we wanted to and have masks be optional moving forward that is not the case right because of this new we have to have something in place for our schools right and and I believe that that conversation also happened prior to the

136guidance coming out from Governor Brown so um I think that even if the board had you know made that decision at that time I would think you'd have the opportunity to revisit given that the state has provided additional guidance now so we wouldn't automatically have to do this um we would have to talk about it and decide whether this is what we want to do and if we choose to continue to have it be optional then we could personally be named in lawsuits if something were to happen right thank you so Derek I mean we're also at that point where um the the governor Brown mandate over rides because she's taken that ability away from local school districts right that's correct yes and that could change like Dr Joseph we have a lot of time

137between now and September 1st and the other part of that is I know there's legal challenges to this all over the state so I mean there's a lot of things you could change between August 10th and September 1st you know I really did agree with Dr Joe on that that um even if we have to go to Executive session or something like that um there's also the the challenge of the the 500 per day incident because my question osba was is that a Monday find a Tuesday find a Wednesday final Thursday and he said yes right now but then if that turns it into a there's a meeting coming up actually it's tonight that all the top people administrators for the state were meeting to talk about that as far as is that for incident

138or is it just gonna be a flat 500 a day to a district so they're deciding if that's gonna you know would just be per per day or is that per incident for that whole day so if there's 10 that'd be five thousand dollars so they're trying to determine all that in a meeting they're at right now yeah my understanding is that it's per day and per incident um but I'm sure as you said there's a lot of space between now and when schools can actually open and I'm sure we will continue to receive guidance from the state level right probably about tomorrow we'll have a lot more clarity on that too sorry Brandon well it's okay it's just a question for you because you mentioned executive session I wonder if you meant um having

139like a special session meeting because is this something that we need to revisit prior to September 8th since our next board meeting isn't until after September 8th yeah I think uh when I talked to Dr Joe I think it's something we'll definitely have to talk about because moving forward you know I mean I know the parents want to know what's up a lot of parents are you know on the bubble what they're going to do so I think is is uh early on as we can you know we're going to have to probably have a meeting you know so um right now I mean the board you know made that vote to make Mass optional Governor Brown there's even been rumors that she could possibly go back to local control um so I I don't

140know Dr Joe can speak to this or you you know Derek is you know we might have a little bit more time here before we have to get to that point it could resolve itself for us you know before we have to to do that so I don't know if that made sense or not yeah um I think that um given what we know about uh the cases per 100 000 right now even what we've seen just in the last week or two much less the last month since the board had that last conversation and voted on making them optional uh would suggest to me that it's pretty unlikely that the governor is going to come back and rescind The Mask mandate I uh I suppose that's a possibility but the way the direction the

141virus is going right now doesn't make me feel confident that that's going to happen um so um I'm just sharing with you the information that we've received from the state about what the potential penalties will be if we don't comply with it so it's uh uh I would I would take action on the most current information that you have would be my advice okay so I wanted to share just a really quick update on quarantine and just to sort of make sure everybody understands some of the definitions here exposure is defined as a susceptible part of me individual who has close contact which means less than six feet for longer than 15 minutes per day with the person who has a confirmed case of covid if a student or staff member is diagnosed covid then

142we are required to let the local public health authority know about that which we have done and fully vaccinated individuals are not required to quarantine what's changed here is if a school cannot confirm that six feet of distancing was consistently maintained during school day or three feet of distancing with consistent mask use was maintained then each person that the confirmed case was in contact with would need to quarantine and that would also include members of a stable cohort if we were in a cohorting model so that's just something that we need to address as we are refining our plans we've already written you know policies and procedures around quarantining and isolation things like that but we'll need to adjust that component of it um I wanted to share a little bit more about the mental

143health supports that are going to be in place as we move into next year um and so this is these are just some kind of General comments to give you a sense of uh where we're focusing our our resources uh we'll have district-wide Suicide Prevention plan which meets the requirements of Senate Bill 52 which is also known as Addies act that'll include trainings for staff to be able to deal with suicide prevention and specific training for our principals and our counselors at all levels um some of this may be familiar to you also because we're funding it through a student investment account we'll have mental health counselors at all schools and therapists at elementary and middle schools that's through a partnership with Lutheran Community Services and Mental Health Counselors at the wellness center at the

144high school which is a partnership with Providence um a full-time drug and alcohol counselor be placed at the high school we have a variety of different social emotional learning and other social skills development curricula in place at the elementary level and for our sped teams and this year we expanded the Jumpstart program which is typically just for students who are coming into kindergarten to also include first grade given that that group of kids did not get kind of the normal start to kindergarten that every other kid has gotten so we're trying to expand that program to help Orient them to being back in person and school and Pax is a program that we've been using it's a behavior related program we've been doing that for a few years have been starting to be able to

145deliver that training via partnership with Yamhill County and we'll continue to train staff we have a couple of schools that have done some really fantastic work and we continue to expand the use of that program as well so those are just a few of the things that that we're going to be doing in terms of mental health supports as we enter this school year knowing that folks are going to be coming in from lots of different places in terms of Need for mental health support to in order to be able to access their learning and um just a quick update on the reopening plans that we're writing are actually due to Ode by August 23rd and that includes a couple different components one is called the District plan and that actually has a little bit

146more to do with um plans for how we're going to be spending our sr3 money and then a continuity of services plan and that has to do more with the things that we're doing to make sure we're opening School in person safely and that we have all of those uh health and safety protocols and procedures in place so the continuity of services planned looks a little bit like the blueprints that we were writing you know last summer as we were getting ready to open school so we are refining those and so on and those plans will all be posted on the district website prior to the start of school so we're working actively on those things um and that's what I have for you for reopening tonight any more questions for Dr Brown I have

147a question can we get the printouts of this is that available you bet I'll make sure that Jennifer Nelson has those and can send them to you thanks Eric do you have you had to know what stat authorizes the governor to assess a 500 a day fine on us you know I don't know off the top of my head but I'm happy to find that for you okay yeah let me take a look and see if I can get you that information and would the district be responsible for that or would the the the the parent of the student who re who comes to school or that's or the staff member who who violates that no the district would be irresponsible Derek on page 46 of the packet so not in your presentation but in

148the ready School safe learner information that was in the packet there's a mention of an OHA supported program for testing for for Rapid cover testing in schools will we be participating in that um you know I'm gonna have to check with Annie Berger our school nurse to know if we're part of the rapid testing program I know that we will be offering testing and screening of course so that is part of our plan that we're writing up um but I don't know if we're offering testing specifically through that program or if we're doing it another way but I I will find that for you and send it to the board Annie Annie is qualified and trained and that program was implemented last year at the end of the year so we are we are ready

149to go for that and she's confirmed in the chat that we have done that awesome thank you Annie I had one other question um on page 47 again of the rssl they mentioned professional development for teachers and lesson plans for students to help with their learning of the new health protocols is that I mean it's early still we know we still have roughly a month to go but is that something that's kind of been at least in the works of discussion of how to approach that sort of professional development and lesson planning yeah um and tomorrow we actually get our first opportunity to be in the same room with all of our building administrators for the first time in you know probably a year and a half or so so we're really excited about that

150and we'll be spending part of that day talking about some of the more tactical kind of details around reopening and the professional development plans that have uh that we'll be rolling out um and so that'll be part of it is um you know staff learned lots of new things as we went from distance learning into hybrid and a lot of that had to do with um how people are coming in and out of schools and how we maintain safe distance and what we do if there's an issue and so I think a lot of those a lot of that knowledge and skill is still relevant and is transferable to what the new model will look like but there will be some new things we have to talk about in terms of things like what three

151feet of distance looks like and and some of the other adjustments so we'll definitely be training staff and giving them an opportunity to to give us feedback and help us refine it awesome thank you anything that can get kids to wash their hands more I'm fully and supportive of the parents so I appreciate that yes any more questions for for Derek I I would kind of encourage the board members uh obviously this isn't what we wanted um it's not it was kind of the goal getting back to school and get kids you know back to as normal as possible so for all the public gets out there listening I would say that uh this is really a tough one for a lot of people um but I would also say that uh uh after speaking

152with Dr Joe and listening to Derek uh that uh again this isn't their their goal either is to to throw a mask back on but the governor's made a decision and it's going to have to be something that we look at over the next couple weeks and just kind of let this thing play out a little bit so I would every I would encourage everybody to express a little bit of caution board members if you have questions for for Derek I know he would answer those uh try to make your emails nice because it's not really what we were going for but let's just kind of see how it plays out before everybody loses it on this this Mass thing um things could change or things might get worse so we've kind of been through

153this whole thing once before but uh I would encourage everybody not to to fly off the handle just yet on mask let's let's try to let this thing shake out a little bit longer and just kind of see where all the information is coming in around the the state but I'm sure Derek would answer any of our questions or an email if we can thanks a lot Derek thanks for the time Mr chair I have a motion with the school board request from our district council information on what our options would be for challenging the governor's mandate can you repeat that please I move that we request from District Council an opinion as to what the district's options are for challenging the governor's order her mandate in court the second that all right I'm trying

154to write that down as fast as I can so we have a motion to challenge our district council to come up with the options to challenge the governors it's a requester information from District Council okay districts options you challenge the governor's mandate in court okay we have a motion and that's been second in any other uh discussion there uh it I seriously doubt that this 500 per day per incident fine that the governor just mandated is based on any statutory law and if it's not then she is violating the Constitution's separation of powers and she should be challenged in court for that I believe right now that there are several of those instances out there um from what I've heard from different boards around the state I think that's happening right now um is that

155something you'd be willing to to let these other people see where that's at before we move forward well I would assume that they one of the options they would present to us would be to sign on to someone else's lawsuit so that would be one of the options that they could present to us I would assume would the um the council also advised the Financial Risk to this to the school board or to the school district if we should do something like that by Financial Risk do you mean legal fees or do you mean well legal fees and and financial um consequences if we if we move to file a suit and and we're unsuccessful I would assume that that would be one of the things that they'd provide us information on also it would

156be interesting uh and important to know if we're going to do that to know the personal liability that could potentially fall on individual board members there would be no personal liability for filing a suit in court I would like to know what our district council would say in regards to what happens if we defy this order that's not defying the order it's challenging in court those are two different things uh Derek um didn't I ask a question about how we would be liable if if something were to come up and us going against this 500 I I'm just I think it's already been answered that we would be personally we could be named in a lawsuit as an individuals right yeah the guidance that we have right now is that school Rivers can be personally

157named in lawsuits if they vote to make a motion um to go against this particular mandate and a student or staff member becomes ill so there's lots of ways to interpret that language but that's the information that we have now and that may or may not be a little different than what director of Shannon is identifying in terms of uh being attached to a lawsuit so I don't know how to differentiate that for you but I know they've told us that school board members can be named personally and I wanted to add just one other comment uh the you know the statutory authority to uh to Levy like the 500 per day per incident finds we'll have to get more information about what that part looks like I do want to point out that the

158I think the second bullet that I had on that particular slide talked about Educators putting their licenses at risk as well and that's a that's a different thing that falls under a different governmental organization and I do know that tsbc does have statutory ability to do that um not just for mask mandates but for any number of other things where a professional educator might not be acting consistent with um laws and rules and regulations and things like that so don't know the statutory piece on uh on the fines but I do know that the loss of license is a real risk for sure yeah and then just to interject the the law is actually ors-431a.010 so 431a.010 that's actually the power of the Oregon Health Authority and local public health administrators to enforce Public Health

159laws and that 500 maximum fine is written in that one as well and then just as a side note tonight as we started our board meeting um started to come across multiple news agencies that the governor will be enforcing a an indoor mask mandate across all places so not just schools so we're not in this boat alone so that's I don't want to be the biggest news Bearer but that's coming across in multiple locations um so just those two items number one we're all going to be indoor masked and number two uh this is the power of the OHA to Levy those fines I guess my you know uh production I'm talking to you is uh I'm gonna be at the SBA tomorrow and I'm gonna be down there talking to those guys about some

160of our board training uh I wouldn't mind getting a little bit more information and then I can get back to an email to all the the board members uh Dr Joe and Dr Brown um I think there's you know there's a big meeting tonight with a lot of information that's coming out of that so tomorrow there should be a lot more clarity from Colt McGill um I know uh Jim at uh green and osbas there they're meeting as as we speak they're having a fun meeting also so if you guys are up for that I'll try to find out as much information I can and forward it to you guys and this Mass thing is going to be tough we it it could be a thing where we have to have a special meeting even

161though it's summertime and and come to the bottom of this of the board because we can't put our superintendent in a situation where we're starting school without being super clear on this so if you guys are okay with that let me go tomorrow and see how much information I can get back to you guys uh within the next 24 hours um well I'm fine with that I would also like an opinion from our lawyers who we pay to be our lawyers and who are the only people in this room who are lawyers well they're not in this room but none of us are lawyers so um I would call the question on my motion Dr Joe our lawyer straight up through osba or do we have somebody that uh we haven't talked a lot about

162that we haven't really had that need well we do have that need we use them often we have different lawyers and so we will we will get an opinion from our lawyers on that I know that there is guidance being worked on now um that uh will come out from one of our three or four law firms so we'll we'll bring back the answer to that question uh to our either to our next meeting or we can send that via email the quicker the better on that one and then I'll try to find out some information quick as I can uh again I like we have about 21 days until September 1st that's kind of was our vote so um I think it's gonna be interesting next week or so everybody's Gonna Love Governor Brown's

163newest one with the mask so that's going to be fun again so is everybody okay with that care Barrow I think uh chair Shannon called the question that there's no more debate on it I did not hear that so director Shan what's your thoughts uh well call the question it just means is a motion to end debate so you should call for a second on that and then we should vote on the motion all right is there a second second you need more discussion uh yeah that's fair there's there can be discussion on the motion to End discussion I just want to make sure everybody has their opportunity to talk on this one okay if not we'll go ahead and vote on that so if you're in favor of uh table on that we'll uh

164it's able to get some motion to End discussion and move to the vote on the motion this requires a two-thirds majority vote I don't believe that's true according to our board policy it requires a simple majority So Courtney Roberts rules is what I was mentioning yeah our board policy over overrides Robert's Rules can you let me know what policy that is Brian just for the people following along at home thanks I think he's looking it up yeah we have a lot of policies so you're if you want to go down this road we can I mean it's literal like there was no further discussion so I don't know why we're not just voting on but I am happy to go through all of our policies and find you the particular one I just wasn't familiar

165with the policy that said that to End discussion it could be a simple majority versus a two-thirds I just I'm just looking for that clarification thank you well I said we go ahead and vote and then we'll get that clarified uh one way or another I've read that on the two-thirds and I've read that on the the majority have seen both of that in different different uh so it's code bddf and it says the board may vote to limit discussion and the terrible confine discussion to the matter before the board since it doesn't call out a two-thirds minority There It Is defined automatically as majority vote yeah but the first sentence says the rules of parliamentary procedure contained in Robert's Rules of Order newly revised shall govern the board in its liberations right which if

166we were simply going by Robert's rules that sentence I just read you would not be necessary so if you want to have a discussion about amending our policies to make it clear that that is a two-thirds vote we can do that but as it reads right now it's a simple vote any language about a vote if it's not specifically called out something other than a majority vote it's assumed to be a majority vote so direction if we vote yay on this what's that mean if we both know what's that mean vote on the motion like that's all it means nowhere to go are after that just asking us to vote on my motion which will lead to where requesting the information about of our options in court the original main motion that I read to

167you at the start of this discussion voting against the motion you call the question simply means you want to keep talking about the question do you guys want to keep talking about the question are we still talking about directing the District staff to go find this out who request an opinion from our Council about what our options are for challenging and in court okay thank you for clarifying that just got a little little uh little different there anything else sir we've got a motion in a second I'll go ahead and get uh those uh supporting that motion raise your hand I can't see everybody there I've got four and I can't see and that's another you yes yes I'm raising my hand and Renee and Trevor I see it now there you go Renee and

168Trevor are you there yes okay got you Renee Trevor do you say yes yes okay motion passes seven zero all righty now that was the motion to to bring to talk about to to bring the motion that he played so now we have to vote on his no motions yes everybody good there everybody more questions the fact that that motion passed ends discussion so call the question on the the main motion please okay we have a motion on the uh the first one Brian you made that motion we need a second correct we already got a second from Trevor so we go straight to a vote now call the vote call to vote here we go if you support that uh raise your hand say yes could you repeat the motion just oh go ahead

169to make sure I know it yep that's fine it is requesting information from our district council regarding our options for challenging the governor's mandate in court okay raise your hand if you vote Yes on that I've got five to two you gotta call the nose uh if you vote no please raise your hand I have one I have two there we go okay voters five to two head passes thank you director Shannon appreciate that again you guys be ready for a special meeting here maybe in the next couple weeks we'll have to get together and talk about a lot of stuff um so we're at that point in the meeting where it's going to get uh to Old business and uh we'll just have to jump right into this this is uh number a on

170there is removing black lives matter Pride signs Flags Place cards symbols uh from the school brought up by uh director Shannon at our last meeting so I would like to make a motion that we table this until we can gather a group of students and staff to to work out the issues that to have students from both sides of the coin in order to make sure that we do something that's inclusive and that everyone feels safe about it I don't feel I don't I I would like to see to put that motion in our Amendment or motion to table it one second okay we have the motion the table we have a second any discussion there the reason I I um would like to table it is because what do we do with all the

171students who are going to feel that we didn't listen to them and if we if we just take take these signs out do we have um something to replace it so because the need is there from we from all the letters we heard the need is there to make them feel welcome and and um if we take this these two signs that are are thought to be divisived by some out without replacing it with something else how do we what do we say to our students then and I'm a mother of a of a gay son and I asked him about the signs and he wished he there was there was something representing him that he knew he could talk to a an adult when he was in high school and and I think that

172we need to we just can't rip it out without replacing something and I think that the students and the staff who work with these students can come together and find something that that would be agreeable to all sides and show it that we can work and be collaborative together there was also another 60 folks that wanted to speak to us on these three issues um that are on our old business and didn't get a chance to so I would like to give them the opportunity to get their two minutes with us I opposed the motion I think it's pretty transparently an effort to just stall the vote the fact that we would remove these signs does not preclude District staff and teachers and students from working on Replacements that might not run afoul of District

173policy in the meantime any more discussion I will say I I agree that you know especially considering that two-thirds of the people who submitted comments this evening were unable to voice their opinions is incredibly impactful and I think it's our duty as representatives to hear our constituents regardless of you know if we agree with what they say or not but on a personal level as a leader it is incredibly important that we help Elevate communities students staff voices um and I know that several members ran on platforms that really included being conscious of having a lot of transparency having a lot of Parental involvement having a lot of community involvement and it feels like this is one of those points where we have a decision to allow that or to try to silence it I

174would just respond to that by saying this issue has received more public feedback than any other issue in the history of our school district O2 frame it as we haven't given people a chance to speak is just not sincere in my book any other discussion I I would say to that that um it being summer we haven't heard that much from our student population and from our staff and I I think that um it it doesn't hurt to keep it in place for for a little bit longer and if you have if if if you're unwilling to to try to find uh um something that that is is going to um show that we're not being unwelcoming because this is going to affect the community not just our school board our schools schools but it's

175going to affect our whole community and if we can this is something that we can do to work together to bring this this issue together I think Rebecca one thing I'd say to that is like um you know we've had um the opportunity to to listen to you know we're pushing 500 you know it's a lot of emails we've had a lot of feedbacks we haven't listened to public on this but I think the one thing that that uh I want is I I do want all these kids to feel incredibly comfortable comfortable and safe in our schools I've always been my number one priority no matter what I'm engaged in with at the school levels from Peewee Sports Camp to Varsity level um I'd also say that we're also the the way you have

176to look at is though we've had a lot of feedback for a lot of people that are also not only do they disagree with with what we have in our schools they also are hurt also and I guess the way I've I've came back to this thing as um and I've read every email no matter how somebody feels I I've looked at and said okay why are we so divided you know um it's an important issue for sure and uh I think until the point where we can sit down as a district we can't be harming anybody on purpose we're harming harming a lot of people by keeping these aim there and then we say we're helping a lot of people by keeping it is in there if we take them out we're going to

177be hurting you know a lot of people and then again we're hurting people and I think right now we have the opportunity to to sit back and say okay wait a minute let's just do a pause here on this thing and it could be a challenge for the board for the rest of our time on the board is how do we make our schools absolutely safe for every student that walks through the door and I think that I've heard it tonight from several people I believe everybody feels this way that that's got to be our number one priority I mean I want kids to be smart and learn stuff and do all the fun stuff school can offer but it I'll never stop working for kids to feel safe and it's just that we're going

178about this I mean you feel one way I feel another half our community feels one way I have to you know feel the other way but by leaving the signs in we are hurting a lot of people by taking them out we're saying we're hurting a lot of people why don't we set back now as a board and sit back and say okay if we're going to truly represent every single kid in our district let's represent every single kid and every single family and we've been given a lot of feedback from people who are wanting them out and frustrated by it and kids say the same thing and all the way down to people who have people in the law enforcement and then let's come back with uh uh policies we have policies in place

179for all all these things but let's revisit them as a board and let's fine-tune them and get them to the point where uh we have every single kid feel safe in our schools I'd like to see every single principal start the first day of school in the Newberg school district and and challenge their their staff already then challenge every single kid in the school district try to start treating everybody well I just know for myself personally and what I've experienced in the school district is there are staff members if you don't agree with them they attack and we're adults and uh they attacked us because they disagree with you on something I've been attacked since last year in my vote and uh so I get the attack part and I get the part that didn't

180feel safe but we've got to protect every single child in this District not just the ones that uh that are you know every child every single child needs to be protected and we have a lot of kids that aren't protected because of the signs and a lot of families feel that way and a lot of families feel like this today yeah I do go ahead Venus oh no go ahead Renee oh well um yeah and I don't uh don't you think that it would cause more of a problem by starting out the school year um without having a clear understanding of what we're doing and just staying neutral I think would best represent all children if we we have this keep going and going it's going to be causing more division and more anger and

181more upset people and their staff and there's parents and there's students that aren't going to ever come on and talk because they are fearful of doing so so they're never going to have a voice and the other side is going to be very loud and have a voice and so this thing is just going to continue and then we're going to drag it into the school year and cause more disruption and more of this divide and and we have a policy and it's actually a law of the Oregon Department of Education that every student belongs that is every student and that we are not supposed to be taking sides that we are supposed to be staying neutral so by eliminating all of them we can't be bringing in um the Blue Line flag to represent

182those kids or or we're going to start bringing in all these different flags to represent all these different children that are struggling and hurting from what has been happening you know where do we draw the line with these flags and we're not saying that we are going to just have the American flag and the state flag if somebody is teaching French or whatever they can have the French fly it's not like we're eliminating we're eliminating just the political and the stuff that can hurt the children on both sides sorry Renee just really quick clarification in the current motion it would eliminate all Flags except the American and the Oregon state flag so it would eliminate that as French flags I would like to to not have that in there I would like to have that

183rewarded so it doesn't eliminate you know because I don't think that a Mexican flag or a French flag or whatever is going to be threatening to any students yeah so um we're getting a little more into the main motion I think we should probably vote on the motion to table and get past that and assuming that doesn't pass then we can discuss the main motion uh because it's not I would dispute your characterization of what this does and I'd like to speak to them I have a quick question for Jen if that's okay did we have our our interpreters for longer tonight or is our cutoff at 10 because I think we're getting close to that I I read questions attention to 11 this time thank you okay appreciate you guys uh going to assume

184we have a motion from Rebecca to table this we got a second from Inez and so I'm going to ask for a vote on this one so if you are in favor of this motion please raise your hand nice I'm not seeing you on this Brandy sorry on my screen is that a yes right it's a yes thank you if you're opposed the no vote raise your hand motion fails four three back to the main discussion here in mind motion uh so first um I would like to make a motion to amend uh the original motion uh the uh amendments that I propose are as following uh strike the and before placards after placards add comma apparel comma buttons comma and all other modes of display comma uh after the second instance of the words

185Flags add apparel comma buttons strike the word and after placards uh add comma and all other modes of display from and so the amended motion would read I move that the Newberg Dundee School Board of Directors direct the superintendent to remove all black lives matter AKA BLM signs Flags placards apparel buns and all other modes of display and all instances of the symbol known as The Pride flag from District facilities immediately and direct the policy committee to draft policy language prohibiting the display of political signs Flags apparels buttons placards and all other modes of display from District facilities with the sole exception of the American flag and the Oregon state flag and I will also add to the end of that uh with exception exemptions it sees proper oh who deciding with the exemption exemptions

186as it sees proper after the final word flag um so I'll just read it again so everyone's clear on what where what the proposed amendment is the amended language would read I move that the Newburgh Dundee School District board of directors direct the superintendent to remove all black lives matter AKA BLM science Flags placards apparel funds and all other modes of display in all instances of the symbol known as The Pride flag from District facilities immediately and direct the policy committee to draft policy language prohibiting the display of political Flags apparel buttons placards and all other modes of display from District facilities with the sole exception of the American flag and Oregon state flag with exemptions it sees proper as proper and um so uh the language around apparel buttons and other modes of display

187were to make sure that no one gets around um this directive by wearing shirts that say this thing that we've prohibited and the final amendment that I offered there at the end is to placate the concern around things like the model un or Spanish clubs or whatever like uh gives a little bit of wiggle room in the policy committee to look for places where a an exemption to the policy would be proper that's my man um you would call for a second Mr chair yeah I'm just running all South is there a second to that um and I just had something to say like so who who decides what is proper or not who so that would be up to the policy committee uh to when they draft language it will come to us and

188then you know they'll have the list of exemptions that they're recommending in the policy and then the the final say would be the board itself would could add or strike exemptions laid out in that policy okay so like if a teacher wanted to have something special in their classroom she would run it by the policy committee or yeah I think the policy committee will go through a process in drafting this language to try and gather feedback from our teachers and our staff and our students okay drafting the broader policy language that prohibits political um signs and all the other things more generally being overly duraconian uh in the final policy language quick question kind of along those lines too who who's defining political well there's um a level of common sense in it but then

189I would assume also that the policy Committee in their language would seek to Define political the little defined political and they will also give a list of everything that is acceptable of exemptions yes uh so I made a motion Mr chair if you would call for a second okay is there a second on that oh second okay we have a motion we have a second any more discussion yes I would like to ask Joe about the legal ramifications of passing such a such a um restrict restrictive for our teachers and and I also have a question who's who's going to to um regulate this who's going to be um monitoring this and what are the what are the um the the consequences of teachers who who who don't follow this uh well as stated now

190I don't actually have any answers for those because there's no enforcement mechanism there I don't know if this is about staff or students or both um you know we have uh certain capabilities people to wear certain things there are some contractual things I'll have to look at and we'll have to of course take this through our lawyers before we can enact any of this because there are probably parts of this that as you start to restrict um those other things we have to make sure that we're not going to be trampling on people's rights so I actually I can't answer your questions at this time because there are several parts of this that as a directive make it very challenging to to enforce and to know the limits of and so without actual policy um

191the this is a difficult uh one for me to I I'm not even sure I can answer your questions because of the the range of things and the additions of tonight so I don't have an answer for you right now Rebecca um I was curious like um at the instruction of Governor Brown the Oregon Board of Education has reenacted the every child belongs rule which prohibits hate symbols and she recognizes the hate symbols some of them as The Noose and symbol of the Nazis and the Confederate flag and so there are already rules in line of what hate symbols that are already um in the law with Governor Brown so those are those are recognized as hate symbols that would be correct yeah this is a different Yeah a different set of them so that's

192that has a a level of enforcement because it's actually written into the law and those specific symbols uh listed as hate symbols are there but I don't think that that doesn't cover us in this situation okay so we don't just to clarify them understanding we don't know who would actually enforce and police this uh not at this time though and you would recommend that we talk to our lawyers about this in case we were to be um to have a lawsuit because we were violating people's civil liberties uh yes we will be discussing this with our lawyers um as whatever the the motion that eventually comes out to be we will have to work this through several of our lawyers the reason that we do that with all of our policies and this is actually

193not a policy this is just a directive to the superintendent we do all of our policies all go through normally we go through osba because they are a team of lawyers who have written those and so we know those policies are relatively safe from lawsuits and do follow current law so in this case of some kind of emotion of this nature where it's just a directive superintendent my first actions of course will be taking it through a separate set of lawyers and then trying to prepare for what those other things might be so I like I said I don't have any idea where we'll end up on this especially with the additions of of clothing and buttons we may be wading into something else that is far deeper also it's not clear if there are

194staff or students or if it's both and so I think that's there is some murkiness in all this this is generally why boards create policy and and not just um directives because it allows things to be clearer when there's a list an enforcement mechanism uh consequence things of that nature well even the ACLU who is you know about is staunch a defender of freedom of speech arguably um as there is we'll say on their website that teachers do not have freedom of speech rights when they are acting as agents of a school district what is the freedom of speech that we are impinging on here well I think on students oh uh I'm hap I so I am happy to offer a second amendment to uh to clarify that this is not applicable to students

195because I don't I have never intended this to apply to student speech uh so yeah I will have to do another motion to amend uh so I moved to amend that the restrictions on displays contained within this language solely apply to District staff and faculty while in the performance of their official duties as District employees well that was interesting so now that we have that first motion of that you need a second so let me draft the language real quick here just so we all know what we're voting on I will say really quickly Brian to your your comment about legal repercussions I believe it's called prior restraint on speech We cannot put prior restraint on speech and that could get us into potentially some legal ramifications and that is also a space where individual

196board members can be named in lawsuits by teachers unions and held financially uh accountable for that in a civil or not a civil in a lawsuit specific to prior restraint on speech hey uh Brown I got a question I keep hearing that um that that the individual board members can be held accountable uh does anybody or is anybody familiar with Oregon tort law because I was told by a lawyer that while um while fulfilling our official duties in in that capacity that individuals can't be held liable for decisions that they make Under Oregon tour law yeah but if we willingly uh go against the law say not in this case necessarily but in like the potential retraction of policy ACB every student belongs which is now state law if we're breaking the law that is

197when we can be held accountable and if a teacher or a teacher's Union was able to say I am suing the board because they have put prior restraint on my freedom of speech that could be an issue and I think this you Trevor you bring up a really good point that there's a lot of greatness and this there's a lot of murkiness than this and as an individual board member not knowing those answers is very uncomfortable and I think it speaks to why we need more input from legal we need more input on the ramifications of this vote before I know speaking for me personally before I felt comfortable giving it thanks Brandi uh does anybody know or is anybody familiar with what happens when a board passes a procedure or a directive and it's

198found in violation of law foreign well you may pass it but I'm not allowed legally to enforce it so if you pass a policy you create a policy any policy you want and your policy is against the law I cannot enforce things that are against the law so your policies don't supersede law so the reason that we look at policy through a lawyer's lens and through in accordance with the law is to make sure that your policies which sit below the law don't violate that law so if you were to pass this again I will not be enforcing this until it's been cleared by lawyers so I will be going through a whole of the process if you make this a directive when you do it in a policy committee and when you develop a

199policy that's when you go through lawyers ahead of time to make sure that whatever language that you put into a policy is not going to be outside the law and and when you ask the question or somebody asked the question earlier you know about getting in trouble whatever I can't answer that I'm not a lawyer that's why I have a team of lawyers that I ask different questions of and policy folks and so I think that my general concern is that um a directive I won't be able to follow until I've checked to make sure that I'm not breaking the law which I'm unwilling to do in this case so I want to I just I'm recommending that maybe you consider taking this to the policy committee to begin with get the policy written so

200it's clear so we talk about ramifications and what a mechanism is for enforcement and then it's far clearer than just making a directive because that policy then would be a directive to the superintendent because those policies are what the the board has decided to do so I just a suggestion I won't be able to enforce it as it is until we've gone through a bunch of legal reviews you won't be able to enforce it at all including taking the BLM signs out of distant facilities I will get an opinion of our lawyers before I move ahead on any of this that's correct and how long will that process take I don't know it won't take months but it will will make the call tomorrow and start the process but we if if you want to

201do this the right way we should do certainly do it be a policy that would be my recommendation because that way it goes through a process of checking it um before it gets to the board for a vote to vote on how come we don't have a lawyer on our board that sits in um I know that other school districts do and then it makes things a lot sometimes a lot quicker because we have a lawyer that's right there can answer questions for us uh well cost per hour it might become um quite a bit of money to have one we have not had one in the past sitting on our board or at board meetings larger much larger districts sometimes do that um but we have never done that um and the cost I

202think would be pretty significant to have them um set through three or four or five hours all right so the Second Amendment breeds this is tacked onto the end of the language this link the language contained in this directive shall only apply to District staff and faculty while in the performance of their official Duty District employees so that's the second amendment can you say it one more time the language contained in this directive shall only apply to District staff and faculty while in the performance of their official duties as District employees thank you any more discussion here and I think you need to call for a second on that one for the changing language yeah is there a second on that second foreign of Joe far away do we does the board have um insurance

203like a board Insurance whatever do you mean the school board itself or for the district yeah School Board itself and the district the school board doesn't have separate insurance so the school board and and I believe that Trevor asked that question before operating in their official capacity would be covered under Pace um it was our our primary Insurance group that would that do that so yes we have insurance but it depends upon what you're trying to ensure oh I also was informed that again Pace or any insurance does not cover illegal actions that's correct any more discussion Joe does this um we got several letters that that um the BLM sign and the pride flag are are not considered um hate symbols or political groups because of the hatchet Act would this have any legal

204ramifications on on doing this directive um I would have to I'm going to defer that to our lawyers I think there are several parts I mean are you talking about the Hatch Act from yeah yeah 1939 yeah um again I think we'd have to kind of look at that uh because it has to do with the connection of federally funded programs and it could even run a foul of Title IX so we've just got several things we're going to have to look at before we get into any kind of enforcement and again um I don't have there's no enforcement mechanism because it's not within policy so that will be the next part of this or a point of clarification uh render your current motion would this also prohibit the display of University Flags military recruiters

205when they come in with their different military branches is it is it going to be country flags or no country flags it's just BLM pride and whatever the policy committee deems as political is that correct right what about like I mean I guess this will be a question for the policy committee but you know there's so many questions around this because like you said in December rightly so if we are restricting Americans constitutional rights we need to know where the line is and so would this include you know posters of Martin Luther King or Edith Windsor or um Shea you know people who have been resistant sort of Fighters I guess you may classify them as would that also matter or could they have like black black mines matter black imagination matters is that all

206going to be left up to the policy committee under your current motion that's all left up to the policy command under the current motion I would expect that historical figures will get an exemption although I don't I would not support hanging Che Guevara in our schools what about like rainbow stickers right I mean I have a fourth grader so can you know they not have rainbow stickers in their classroom anymore rainbow stickers uh I don't believe that's a particular symbol of anything well it is you mentioned pride and rainbows and the motion so that's why I'm just again I'm trying to really because there are so many gray areas trying to really understand it the pride flag is a and I we should direct our comments to the chair the pride flag is a well-defined

207symbol that represents a particular ideology okay so like playing rainbow could not be in my mind interpreted in that way okay so the teacher wears rainbow socks that's okay or she has a rainbow pin that's okay we're talking about the flags and the dead symbolism of what that the pride flag is not if they have a rainbow colored shirt on or socks or stickers okay just because you know you specifically said pins and clothing and so I'm just really trying to ensure that you know what what will be defined I I am uncertain of it and if I'm uncertain of it and I'm a person voting on this I can imagine that staff and um uh who whoever is eventually policing and forcing this will also be fairly uncertain on that well and to add

208to that um I'm not wearing a flag but I do have a rainbow headband um what does that mean under this policy a teacher in the performance of their official duties could wear your headband but not your shirt would any of this apply to their social media not unless they're doing it during school hours which I don't think there's Joe correct me if I'm wrong but our teachers aren't supposed to be on social media while they're teaching our kids unless it's part of their official dude and they're doing some kind of a program but no if it's their personal social media probably not uh so a point of clarification too if if a group of students and teachers get together to to find a unifying poster that um can embrace all all walks of of

209um life can't so they can have a rainbow on it and something that says black and brown children um are are are cared for here just not black lives matter correct would they have to get that passed Again by the policy committee before they could decide to display it no not under this language but of course the what the policy committee will draft has not been created yet so I I will have more clarification and guidance once they do their work well you mentioned earlier that my shirt would not be appropriate I mean this isn't the specific flag or sign not even the same colors it's just words on a t-shirt yeah but it's not the official logo it's not what you think uh is political because of the font is the policy committee decide

210that or like we cannot say black lives matter like we can't say it we can't write it we can't display it regardless of the format is that your current motion yes can we say black minds matter yeah why do we guys I mean back up here a little bit you know I know you want to nitpick this thing to death but it's like yeah when we get this thing to the point where so many people are comfortable but so many people are uncomfortable as a board we need to look at that and say okay we got a lot of people are they're not going to like this we got a lot of people are going to like getting them out of there then we have a policy committee start back with staff with kids and

211come back with what's healthy in our schools right now this is not healthy because it's so divisive divisive to a great amount of people in our district one way or another and that's what we're feeling here we want to just get back to the point where we sit back and we want to of course it's political I mean to sit back and say it's not political is you know black lives matter is is is is stated all of their their goals they've stated them all and how we ignore those I don't know but they've stated all their goals and they're they're hitting them they've destroyed a beautiful town like Portland and uh they're destroying town after town after town look where we're at they're reaching our goals to divide in our community these things are

212divided in our schools so how about we get back to that point where we sit back and say these flags that's what we're really been talking about in banners are out the door we get their policy committee back in here we do sit down with staff we do sit down with students we step back and go what can we put in schools that aren't going to be divisive what can we put into our schools that are going to work I go back to the original thought if we are really here for all the right reasons we should be here to sit back and say we're not going to discriminate against any kid that walks through our doors in our schools and yet that's exactly what we're doing right now if we don't take these things

213out we're telling half those kids out there that don't want this stuff in there that you're not important either maybe we've gone too far too fast with this and we step back and we'd say just let's just get the flags and and the banners and that kind of stuff out the door then we can start nitpicking on all the little details we've hijacked a beautiful rainbow sticker into something different it is political the rainbow sticker in itself for a fourth grader is not political but the rest of it is and it's it's half our people don't want that I'm just putting out a rough number there it'll be exciting to see what we can come back by working with a policy committee and our students and our student Representatives what we can come up with

214that would be healthy in our school we keep talking about you know stuff that right now it's unhealthy in our schools because if the kids aren't feeling safe around it it's not healthy for them and so we've got to find a better way to do this and just step back and say it's it's it's got a stick it's got to change it's got to change that's our biggest thing right now we're not willing to do that because we got too many adults that want their way and how about we sit back and find the best way for every single kid I said this before if I'm a fifth grade boy and I just moved from Mexico and I'm here in day three just help me out I'll show you what I can do I've coached

215all these kind of kids they'll show me what they can do they don't need me to make up stuff for them they just need me to give them every opportunity that's available to that young person and they're going to soar Dave I think you bring up a really good point and and I think that that was Rebecca's attentional intention with her motion was we need to get more student voice I personally the overwhelming student voice that we're hearing and staff voice that we're hearing from our counselors from our principals from our students is please don't do this and so I agree with you it is contentious and divisive and I and I certainly wish that it wasn't and we need to have these conversations but I think that pushing it through and taking away a

216symbol of of Pride for a lot of people who don't have many symbols of Pride um is really going against what I hear you saying and so when I'm asking these questions around the details it's because I want to know more I want to know more so I can help understand the impact that this will have on our students and our counselors and and the teachers that are you know in the trenches so to speak with these kids so they're they're currently two motions to amend on the table I think we should at least deal with those you know I'm trying to placate some of the concerns that folks have with this language to make it clear that we're not restricting student speech so that's the first motion is or the first amendment is we

217vote on is the language contained in this directive shall only apply to District staff and faculty while in the performance of their official duties as District employees that is the motion that we're currently dealing with I would ask that we deal with that language in our discussion Mr chair so that we can move this along in a proper manner okay so we are back to our original motion then are you talking about your emotional second motion to amend which is to add at the end of it the language contained in this directive shall only apply to District staff and faculty while in the performance of their official duties as District employees okay there is a motion we had that second I believe it was already made yeah I believe we're neighbor director dehart I believe

218may not so we have a motion and we have a second call to vote we're voting on the amendment if you should support uh director Shannon's amendment to that uh that motion uh please raise your hand and support all those uh no votes please raise your hand motion passes four three okay uh the Second Amendment or the yes the First Amendment and we have to vote on uh it's the one to add apparel buns and all of their modes of display um to the language of the uh portions of the uh directive that direct the superintendent to remove symbols from our buildings and uh give instructions to our policy committee about what they're supposed to be driving clarification would this impact our Union since now our Union contracts since now this applies to our employees

219and how would that look like or would we need um to talk to our Union reps uh we will have to review the contracts we have I know that they were on the list for public content I'm not sure what they were going to say but I I know they were part of the 60 we didn't hear from um I will have to as again part of the legal um work we'll be checking to make sure that we're not in violation of their contract uh during this you know putting this into policy because we already have a contract in place with that and just to be clear any policy change we make applies to all of our Union employees so but if you have a contract in place you cannot make a policy that then

220violates their contract as the as written we'd have to go back and negotiate that so it can be difficult on Zoom you know because we see the I don't know 10 or 12 of us that are on the picture but you know there's over 350 people watching this and that we know of um and fully two-thirds of the people who signed up for public comment tonight were not allowed to voice their opinions and that is a major concern a major concern and I don't know who those people were I don't know what they were going to say but the fact that those people took time out of their their nights to come here and to see this and to stand up and have the courage to say this is what I believe X Y or

221Z and we're unable to participate in their local governance is incredibly troubling or the other way you could look at that would be we had over 500 emails come in on this issue and so people had plenty of time to send in their their thoughts and I know looking at my computer today probably had 150 people come into last second that wanted to make comments and uh so we did get a good flavor of what the the the people out there are looking at and it still goes back to the fact that we have a lot of kids that are impacted by this positively or negatively and uh as a school board you know it's our job to to make the decisions they're going to be there for every single kid at Newberg High School

222not just the kids that uh that uh that are represented in just one group it has to be all kids and we've we had over 500 so those people can still send their things in and that'll impact the policy committee that'll impact how this moves forward um I still want to represent every kid and we're not doing that we're only representing some kids who who say they need this we didn't have this a few years ago and we have policies in place that can take care of this stuff we have policies in place that because somebody's transgender gay brown black or white a seventh grader a 12th grader we have policies in place that protect every one of those situations but we've made these things political and that's exactly what it is it's political let's

223take that out of the equation practice it what can can we vote call for the vote and do that because the second for the First Amendment we already voted for your Amendment now we're going back to the First Amendment yes the main motion so can you please State your first amendment again there yes so um after the word Flags it strikes the word and after placards it adds comma apparel comma buttons comma and all other modes of display comma uh after the second instance of the word Flags it adds apparel comma buttons comma strike stored and after the second instance of the word placards it adds comma and all other modes of display and then after uh the words the Oregon state flag adds comma with exemptions as it sees proper so that the language

224uh amended reads the new uh I move that the Newburgh Dundee School Board School District Board of Directors direct the superintendent to remove all black lives matter AKA BLM signs Flags placards apparel buns and all other modes of display in all instances of the symbol known as The Pride flag from District facilities immediately and directs the policy committee to draft policy language prohibiting the display of political signs Flags apparel buttons placards and all other modes of display from District facilities with the sole exception of the American flag and Oregon state flag with exemptions as it sees proper uh and then we already passed the length the other amendment that tacked on the language contained in this directive so I only apply to District staff and faculty while in the performance of their official duties as

225District employees well that part's already been passed so you just stated your uh First Amendment again do we have a second on that I believe it was already seconded was that Trevor or Renee got it okay call the vote we're not having further discussion on this should we vote on that to End discussion uh we're voting on that that Amendment the First Amendment to that one yeah but were are we voting and discussion on the amendment you can continue discussion if you want it would like to uh again because I still have a lot of questions and a lot of clarity and I'm listening to your words Dave and I and I know you know that you care deeply about kids and that you have a lot of experience with the kids and the looking

226at who we have heard from and how we've heard from them the students we have heard from have overwhelmingly said I need these things my friends need these things people I know need these things and I think by making this motion uh you know so go through before even like I said the people who just signed up tonight had didn't even have a chance to speak really doesn't give students the chance to voice their opinions and like I said it's it's either way I mean I don't I don't know what students are going to say but the fact that we're not allowing them but at the same time saying that their experience is so important feels incredibly hypocritical to me I don't understand how those two things are merging by saying student experience is incredibly

227important we want all students to feel valued but we are going to disregard the students we've heard from I am having a hard time with that who improved the BLM flag and the Dundee schools in the first place nobody talked about it they just did it and put it up there I've had Parents contact me saying that they see the BLM flag behind the teacher's desk during the zoom so a lot of this stuff came out because of being on zoom and the parents seeing what's going on in the classrooms and what the teachers are saying and it that's what really concerned a lot of parents because they didn't have a voice in having these symbols put into schools and that's what started this whole thing to begin with if a teacher or somebody wanted

228to display something like this they should have presented it in the first place to the board to talk about is is this going to be okay with within light with everything that was going on in the world with police officers being shot and with with families that have police officers as family members and you know kids that have police officers in their family that they weren't they didn't have a voice they didn't they nobody said hey is this okay with you and they just did it there was no discussion on it so is that fair I'll just say one quick thing on that under current policy that the board currently has we played only a governance role we don't play an operational role so if we don't dictate teachers don't need to come to the

229board to ask for permission to display things currently but it's a political I thought I thought there's a law that it's um they aren't allowed to be in a political um like they couldn't be in the classroom having a big uh Trump flag or a big Biden flag and push in their political agenda on the children isn't that correct or am I wrong well that's exactly what the policy word I'm attempting to pass through here would address yes we do have requirements in our policy to teach both sides of um controversial subjects I think you can make a strong argument that hanging a BLM sign runs a foul of that current policy uh since that is clearly a contentious issue in our society right now and I don't think you can make a strong case

230that both sides of it are being presented in our schools currently uh nonetheless I would ask that uh Mr chair uh you keep members comments around the current motion which is the motion to amend because I do get the sense that some folks are trying to run out the clock on us here um so I actually I called the question all right so we have called a question I'll second that you have a second it's all about Paul a vote on the amendment that uh motion to call the question which means we will then automatically vote on the amendment vote on a call to question those in favor I believe I had that five two you have to call no yeah no I'm just telling my computer there for you guys uh and then novos

231please please vote there one and then Nez I didn't get a Nez on there right here but I voted for to move on to got it so the motion passes six to one so now the motion to amend is voted on is to be voted on all right so we're back to the uh the main motion here being a meme first amendment that I made adding the apparel and buttons and all other modes of display language and the exemptions as it sees proper to what the committee is going to address okay back to that first amendment then those in favor it's going for the vote say on uh I'm looking for everybody there again I've got there we go and those no votes on that passes four three okay are we back to our motion

23213 here to vote on this then you guys the amended language Jen just so you don't have to try and do this all via dictation sorry what did you say I'm sending you the amended language to try and take it from dictation and I'll blind CC the board so we're back to our motion 13 then with the first minute Second Amendment on those on languages are we ready to vote could you read that again just for the record so all board members know exactly what they're voting on yes and I'm blind CC saying the board right now so he'll have it delivered well I can't look at it so if it could be read I'd appreciate it oh okay all right uh I move that the Newburgh Dundee School District Board of Directors direct the

233superintendent to remove all black lives matter AKA BLM signs Flags placards apparel buns and all other modes of display in all instances of the symbol known as The Pride flag from District facilities immediately and direct the policy committee to draft language prohibiting the display of political signs Flags apparel buttons placards and all other modes of display from District facilities with the sole exception of the American flag and Oregon state flag with exemptions as it sees proper the language contained in this directive show only your District staff and faculty while in the performance of their official duties as District employees thank you for reading that again absolutely it's a mouthful so we have our first necessary amendments on that we got the final reading on that some called a vote we need a second well we

234already did yeah we've with the original notion was seconded and we've passed the Amendments we can have discussion on the main motion as amended which we probably should do and I guess I'll start off since I'm the the main driver of it uh the main goal of this is to get political symbols and divisive symbols out of our schools so we can focus on the already difficult task of educating our students in the core subjects it is not fair or one particular ideology the ideology of social justice to declare itself above the fact that it is an ideology and and claim that everyone has to support it he's as was said in most of the emails from the people who support having these in our school they call these social justice symbols social social justice

235is an ideology it's an ideology that people can legitimately oppose and having an ideology endorsed by the school by the state school system in this manner is not appropriate and it needs to end to clarify for everybody viewing this will be defined by four people in our school district technically three because the Committees are three people right right but then the board has to vote on it yeah again we had a you know I'll use the term 500 you know in that in that neighborhood again and uh there was a loud voice for removing these so it's not just for people it's a it's a it's a large course of our community too and there was also allowed voice supporting it to your point Dave yeah well and chair I would like to say that

236quantity over quality like is not a in this case is not you know the quality of some of the stories that we heard should count more than just the number of emails that we received absolutely and I feel like that's not being heard the students are not being heard I shared a story of something that happened to me today and I don't know that you heard it no I did I had teachers who cared about me and supported me and I want students to have that too well I would just say you know um sometimes you hear something that just strikes you as as fundamentally true and you know when I was listening to people talking tonight the thing that struck me that just you know ripped me when I heard it was when I

237think it was Robin said people make people feel safe signs will never make people feel safe people are the ones that make people feel safe and the great people who work in our schools are going to be the same people once we take out these politically divisive signs from our schools as they were when those signs were there and if they feel safe it's because of the people who are in our school system not because you hang BLM on the wall it greets the people and to know that four people in the entire system are dictating what is defined as political in our policing what is going on in our classrooms so such a minutia is is incredibly uh upsetting and I see Dave and Trevor you've got the American flags behind you I think

238that is also a symbol of Pride and completely appropriate for our schools as well and this feels so anti-everything anti-free speech anti-free expression anti-safety and and I know that this has been framed a lot tonight and I think rightly so in in the framework of student wellness and I think you know in the past it's also been framed and we need to focus on academic excellence and again I agree with that I think I think everybody here on this board shares that value and so I did a little research because I thought okay what are the top performing schools in our state and so top performing can be defined as graduation rates you know assessment rates that kind of thing and the top five performing districts every single one had a diversity equity in inclusion

239coordinator every single one had intensely robust Equity vision statements that included gender gender expression sexual orientation race socioeconomic status that's something we haven't even talked about tonight and then I looked okay what is the bottom what are the bottom performing schools in our state have in common I'm sure they have several things in common but one of the things they have in common is a complete lack of anything to do with equity on their web pages they do not have Dei coordinators and there's nobody in their District who is coordinating these efforts and I'm not saying those two things are completely you know if you have this then you will have great Excellence but it definitely shows the school districts Lake Oswego Westland Wilsonville Riverdale Corvallis Sherwood the school districts in our state that are

240thriving that have students that are thriving have recognized the importance of this work and I I think it's difficult if this vote passes to say that we we Elevate student voice that we care about student experience that we are committed to academic and excellence and that we're committed to student mental health and well-being I it's incredibly difficult to see how those two things or all of those things can merge together because again this feels so Draconian and oppressive in nature okay well thanks for your comments everybody and uh definitely a lot of things to say so that time I'll uh on motion number 13. I'll call the vote those in favor uh how it was stated by director Shannon please raise your hand and vote Yes those not in favor saying no please raise your

241hand motion passes 4-3 Jennifer I know you're going to look at me and tell you tell me we have five minutes with our translators I already see it they can read your mind right there um I think in our other two ones right here we have the next item on the there's the direct uh the policy committee to replace language and the anti-racism resolution and then C would be resent policy ACB at all students belong and refer to policy committee um we obviously are going to run out of time here um so I'm gonna also I need to get back to our future agenda and we have a a little bit of new business there at the end on this tonight too um we are going to have to have another meeting in August it's

242just that simple mask first of all and then these two uh amendments so get ready for another board meeting um We Can't Stop school starting in September it's just not going to happen school's gonna start and we have to have these things cleaned up uh before we can move on to another one and then we are going to have to find out all the updates we're going to find out I think we're going to find out a lot in the next number of days about masks and um not trying to be silly on this one but when you look at 500 fine if that's what it truly came out to be I added that up that's about 92 000 that we get fined if we didn't wear masks let's just say it was that simple

243it won't be it never is um that would be about nine or ten eleven kids if they leave our school district because of this and and unenroll that would be about the amount of that fine now I know it's going to be a lot more complicated than that in uh Dr Brown already uh made that clear let's see where that shakes out um but we're gonna have to have another meeting on mask our parents deserve this in our community one way or another to get it cleared up if they're going to keep their kids in Newburgh Dundee schools or if they're going to take them out or what their options are we owe it to the the parents that do that so I know it's summertime I know it's not ideal to have an extra

244meeting but I will talk to to Dr Joe tomorrow and we will try to get that scheduled and give you guys as much notice as possible uh but we have to get that done uh here in August if that means we have to come in before our board retreat whatever we've got to do we're going to have to do that um so with that said um we have one last thing to do um under the new business designate board committees um so I know that uh pulling us out here really quick I'm sorry Dave just a quick point of clarification are we tabling the other two motions or how would you like to proceed we've got about 90 seconds here so I'm uh I'm gonna ask everybody if it's okay if we table those other

245two motions until this next meeting which could be in a couple of maybe next week so get ready for another board meeting uh to get these things taken care of plus the math thing that's going to come up to find out I'll motion to table those two remaining items a second foreign those motions please raise your hand I see one two three four of those and not in favor raise your hand I see one two Trevor how do you vote I didn't get Trevor's I voted a table Renee I voted to table okay motion passes six to one to table I'm gonna read the board we got just a really quick uh time it's not going to be something everybody probably likes but I didn't like it either when I got put on committee so
