002County school district 14 Board of Education the board has control of instruction in its public schools and whereas Colorado law expressively states that the holding a public office or employment is a public trust created by the confidence which the elector electorate sorry reposes in the Integrity of public officers members of the general assembly local government officials and employees a public officer member of the general assembly local government official or employee shall carry out his duties for the benefit of the people of the state 24-18 103.1 CRS and whereas the board and its superintendent Endeavor to maintain the public trust through their acts and protection over the Adams 14 School District Adams 14 its students staff Teachers Community and resources and whereas this public trust obligation requires the board to negotiate and enter into contracts without
003being forced coerced or threatened by any person with action through the Colorado State Board of Education and whereas the board's fiduciary duty further requires those seeking to enter into contracts with the Adams 14 do so with transparency good faith and Fidelity to the Adams 14 Community and whereas the board is open been to consider lawful contractual relationships with Charter Schools based on public promises made to the Adams 14 Community by Charter Schools seeking to contract with Adams 14 and whereas Adams 14 proudly serves a highly diverse and unique student population in which a substantial majority face socioeconomic challenges in our linguistically gifted at rates well above State averages and whereas the board believes all Adams 14 students deserve rigorous and effective academic programming to enable them to achieve post-secondary and Workforce Readiness in postgraduate success
004and whereas on September 1st 2021 the board received a charter school application from University Preparatory schools uprep and whereas uprep made public Promises to the Adams 14 Community in their applications such as dual language component programming supporting whole Child Development and social emotional learning SEL full day offerings at no cost to families serving students with special needs capping enrollment at 16 students per room serve early childhood education through fifth grade including Pre-K 3 and Pre-K four-year-old programming engage in a slow growth model by launching ECE 3 4 and kindergarten to start in August 2022 and growing one grade level at a time each year uprep would be physically located in Commerce City and year two would serve Pre-K 3 Pre-K 4 kindergarten through first grade whereas uprep advised the board that the stability of their
005Charter School hinged on two key factors ability to meet anticipated enrollment figures and availability of affordable space in the proposed geographic area of Commerce City or the use of District space and whereas uprep identified three Pathways in its application to secure a suitable facility and whereas in its application uprep was responsible for finding its own building space and whereas whereas Adams 14 was not and is not obligated to ensure you prep secures building space and whereas uprep's application identified its own funding sources and unreserved funding it could use to secure its own building space and whereas also as part of its application uprep provided the board and Adams 14 Community and an enrollment timeline as follows January 10 2022 kickoff Outreach and recruitment efforts for the 2022-2023 school year January 10 2022 through February 25th
0062022 collect enrollment forms for pre-k 3 and Pre-K 4 and kindergarten seats for the founding students 2 25 2022 cutoff date for enrollment form submission by 5 PM forms may be submitted physically or through a digital platform March 10 2022 enrollment Lottery if needed for 2022 2023 seats March 10 2022 through March 24 2022 post enrollment Lottery Outreach to verify seats and pull from wait list if needed allows for five business days to pull from initial Lottery list and another five business days if any grade level needs to move to the wait list April 4th 2022 through June 10 2022 family student welcoming and orientation efforts July 18 2022 through August 3rd 2022 home visits for all new to all new to you prep families August 8 2022 through August 12 2022 orientation week August
00715 2022 first full day week of school and whereas based on the application promises made to the Adams 14 Community and you preps presentation to the board on December 14 2021 the board approved you preps application on a 3-2 vote which then opened the contract negotiation period and whereas the board was unequivocal in a December 14 2021 resolution resolution number 21-022 that a contract would be conditioned on the following the application is approved for negotiations of a charter contract for one school for an initial term of four years to commence July 1st 2022 serving grades preschool to kindergarten and year one plus an additional advancing grade level each year thereafter up to third grade and year four contingent upon execution of said contract within 90 days or a date otherwise agreed to by The District
008in writing and upon the satisfaction of the following material conditions and whereas the December 14 2021 resolution detailed a number of additional materials conditions uprep was expected to follow and whereas there was no delegation of authority from the board to any District Personnel or employee of MGT of America Consulting LLC DBA Adams 14 School succeeds LLC to change the conditions identified in the board's December 14 2021 resolution and whereas uprep did not protest any of the board's conditions identified in the December 14 2021 resolution and whereas on Monday January 10 2022 at the very first meeting between uprep District personnel and Senior Management of MGT up Representatives proposed uncontested by MGT to push uprep's timeline out so key dates would begin one year later and whereas this material changed to the application timeline was not
009presented by MGT or uprep to the Adams 14 Community or the board for consideration and whereas uprep representatives and District Personnel agree to waive the 90-day time period to finalize a contract and establish the new date of June 28 2022 to finalize a contract for the board's consideration and whereas at the beginning of June 2022 the contract language sought by you prep stated the following if the school does not receive ECE approval from the Colorado Department of Early Childhood due to facility or other constraints during its 2022-2023 planning year or subsequently the school May open and operate without ECE and may later add ECE upon approval from the Colorado Department of early childhood and whereas the contract then contemplates opening the charter school with kindergarten only in violation of the board's December 14 2021 resolution
010and whereas the contract language later indicates that uprep may not open Pre-K 3 or Pre-K 4 by the 2025-2026 school year if at all and whereas District Personnel advise you prep Representatives that they did not have the authority to authorize or accept any material changes and whereas District Personnel openly expressed concerns about these material changes to the application particularly as the material changes were made at the end of the contract negotiation period and whereas this contract language was not in conformance with the board's December 14 2021 resolution and whereas uprep was advised that based on these material changes the board and the district accountability committee committee needed to be informed and whereas because of this last minute material changes sought by you prep it would not be possible to meet the June 28 2022 deadline
011and whereas the contract also did not detail which waivers you prep sought from District policies and whereas other board conditions identified in the December 14 2021 resolution were not reflected or addressed on the proposed contract and whereas District Personnel expressively notified you prep Representatives that the June 28 2022 deadline could not be met due to u-prep's last minute material changes to the contract which required consultation with the board and the district accountability committee and whereas on Thursday June 16 2022 a u rep representative threatened District Personnel that they would reach out to State Board member Steve Durham regarding the unapproved contract and where District Personnel expressively objected to the threat issued by the U prep representative and whereas on September 27 2022 the board invited you prep representatives to answer questions at a study session
012and whereas uprep admitted the board did not modify the conditions stated in its December 14 2021 resolution and whereas you prep further admitted it had not secured a location in the Adams 14 boundary but had two potential sites and whereas contrary to its own application you prep then attempted to place its failure to secure a facility on the Adams 14 board for not having signed a contract and whereas at no point did the board agree or commit itself to assist you prep in securing a facility and whereas you prep further confirmed it has not secured certification for early childhood education ECE from the Colorado Department of Education and where it whereas It is believed that uprep also has not secured any certification to operate an ECE from the U.S Department of Health and Human Services
013and whereas without such state and federal certifications uprep is unable to meet the board's condition identified in the December 14 2021 resolution and now therefore it be resolved that on October 11 2022 a proper motion oh I'm sorry is that oh yeah um a proper motion was made and seconded to deny the contract with you prep and now therefore it be resolved the board's motion to deny the contract with you prep past four to zero and now therefore be it further resolved the board's denial of the contract is premised on the fact that the promises made by uprep in its application its presentation to the Adams 14 Community and its presentation to the board are inconsistent with the term stop by uprep in the contract and now therefore be it for the result you perhaps
014desired terms in the contract failed to adhere to the board's conditions as identified in the December 14 2021 resolution and now therefore be it for the result the contract and you preps application presented to the board failed to identify the list of waivers of school district policies and now therefore be a further resolve the board will not enter into a contract where waivers of District policies are not expressly identified at the time of approval of the contract and now therefore be a further resolve that despite you prep identifying its own funding sources and the three Pathways to secure an appropriate facility within the school district uprep has failed to secure an appropriate facility and now therefore be it further resolve neither the district nor the board were or obligated to assist you prep and security
015and appropriate facility and now therefore be a further result uprep has not secured state or federal Early Childhood Education certification and now therefore be a further result neither the district nor the board are obligated to secure state or federal Early Childhood Education certification for you prep and now therefore be a further resolve the board will not be forced course or threatened by any charter school with Colorado State Board of Education intervention involving contract negotiations and now therefore be a further resolve that state law does not Grant authority to the Colorado State Board of Education to interfere with or hear any appeal involving fail contract negotiations related to the denial of a new Charter contract and now therefore be a further result because of the board's public trust obligations the board's Fidelity to its constitutionally derived
016local Control Authority and the failure of uprep to adhere to the conditions of the December 14 2021 resolution you preps failure to live up to its public promises made to the Adams 14 Community it is in the best interest of the pupils the district and the community for the board to deny approval of the contract with uprep all the information referenced above including but not limited Communications reports draft contracts applications documents recommendations and resolution are hereby incorporated into this resolution and made part of the official record unless protected from Disclosure by state and federal law thank you directory trivia um colleagues any discussion comments no comments for me no comment no comments from me none um I agree I think we covered everything in this resolution um Ramona will you roll call please Mr Amador
017aye oh we did an emotion yes okay sorry I um Ms Lovato aye Ms Molina aye Ms Zubia hi thank you any um any comments or I know actually I I just um um I wanted to publicly disclose to everybody that I too am allowed to get sick and I was truly sick um at the the previous board meeting and I do apologize for having missed the vote regardless uh I just want to state that I accept the decision of my fellow board members um as it stands thank you thank you all right um no further discussion we'll move on to the next agenda item which is 3.5 approval for 50 Adams City High School and Lester Arnold high school students to attend an overnight field trip to Mesa State College which I'm assuming it's
018Mesa State University I know they changed their all the state things yeah okay in Gunnison Colorado Okay um may I have a motion improved this overnight field trip oh in Grand Junction oh oh miss a state college I'm confusing with Western you're right okay thank you I'll motion to approve thank you second and comments question ends this sounds great I'm glad we're here get some more of them such a big group going I'm super excited yeah all right um Ramona roll call please Mr Amador aye Ms Estrada aye Ms Lovato aye Ms Molina aye Ms Zubia hi and our final agenda item is 3.6 continued discussion of board committee and school assignments um director Zubia we felt a little bad running through this without your um input um so I'm trying to think I think
019we got through all of the boards and committees are there any that you're going to want to talk about we're talking about the first Kids First Health if we wanted her to be the primary oh yes we were going to ask her that I think that would be a little um a little bit of a conflict since I used to work there um so yeah I think so um that's why I had I also want to mention that um I see that it would be nice if we added ct8 on onto this list and that's meeting with um the teachers union so I like that and I think um we should also consider the classified Union in the classified yes yeah the unions I love that because I know that's something we've talked about for
020a number of years yes um with kids first it's a little hard because um well an alternative on that it looks like the readings happened the third Thursday of every month at 8 30 A.M um and they're in person and Madam president it doesn't always start at 8 30 they start with an executive session at 8 30. okay and then whenever they finish the executive session is when the meeting starts oof okay hard um okay I know we want to keep our connection there is there a possibility where we can do something like we we do with area boards and the Education Foundation where I hate to add another thing too Dr lauria's plate but maybe you or a representative from Administration can attend those to make sure we have that connection and then I
021would be happy as an alternative to come when I can it's kids first I think it's it's difficult because yeah if we're attending there and then waiting until the meeting starts um we'd all be missing work um yeah Madam president you can always delegate that to staff okay Oak it doesn't work let me know I'll turn it but I just feel uncomfortable yeah I live right next to it oh okay um yeah Hannah starts eight o'clock oh that gives me enough time to get there you go okay it's not too far from me do you want to be listed as the liaison and then I could be the alternative and then we'll designate staff to for some reason you can coordinate with us yeah if we can't make perfect okay it's a good one um
022are there any other committees that we miss sure that you missed we would like to get involved on well I'm already changed the alternate yeah yeah thank you I really do um you know my head's off to Rotary because they do so much for our district and they go almost unnoticed with everything that they do for our kids um so I think that that's awesome I I love representing on rotary so it's great um I see the only one that you don't have the alternate on is the Commerce City urban renewal yeah that's an actual appointment that's why you don't have one yeah well then I'm fine yeah okay okay so I think we're oh I think we're all good on the Committees um that's next on the schools um oh no actually can we
023go ahead and and ask for representatives for the two oh yes for the union so um I I do we know when they meet so I I meet with I can meet with them um I have so I want to be able to do that with um CTA I haven't reached out to the classified yet so and do you guys have an interesting you want to do the alternate you want to do it together okay um I would love to serve on the to be the liaison for the classified Union um great but I would love an alternate as well because I have no idea like when they meet or I can with the classified I can do unless you want to do it do you mind finding out meeting times and um thank you
024great and then schools [Music] um I know when um I have not been able to be as involved with is Adam City Middle School I know Mr Amador you had um offered to be the the main liaison acms and then I am um if anybody has any interest in serving as the secondary alternative I can be alternative okay and then are there any other um we don't have alternatives for Monaco Rose Hill or Central Central Stars oh yes what what schools are you yes which ones do you have interest in working with or that you work with three four five so should I just fill in those blanks but that would only if you want or do you want to be primary yeah yeah you could be primary primary work person you can ask to
025switch with one of us whichever one you want yeah not that we give it to you but yeah you can ask I'm next to these ones like I'm next to Alsip City Middle School I think it'd be awesome Lester Ireland you know yeah awesome all right so I'll give her allsup okay I'll stay secondary if you don't mind okay and I don't mind being a secondary Christian Monaco you want Monaco I'll be the second and you can be primary well well and nothing precludes us from working together right we can work together like we go together and I are both on the high schools and we we coordinate our visits and yeah like I just want to like go to all of them yeah yeah and we we do that as well yes yeah um
026[Music] foreign so Madam president um will Ms Molina then be the secondary and all the open Elementary ones and you can still go we need some help so you're going to be the secondary for all of them and then the primary for okay anybody wants to church I tried to give you one you said no well Monaco and I'll be the secretary since I'm the only one there so you can have it primary and I'll do secondary there okay yeah and I already have yeah and then nothing precludes us like if there's something going on and you want to invite another member and somebody else can't then I think we do a great job of communicating that to each other just coordinating yeah yeah awesome all right we have our assignments uh Mr Ramona I
027think we're we good in that area um I believe I have everything okay I will put it in the Friday packet and if there's any changes let me know please thank you and we don't need a vote on these we came to a mutual agreement so we're good on that one great well um this concludes our agenda for this evening thank you everyone for hanging in there um our next board meeting is on Tuesday November 8th may I have a motion to adjourn so moved second Ramona roll call please I'm sorry who Janet first oh yeah I'm sorry can you please stand up hi Ms Estrada hi Ms Lovato hi Is Molina hi hi great we are adjourned thank you for being here with us this morning and have a great night yes
