[Music] Do we have any public audience? >> No. At this time, we'll go to the minutes for September 22nd, 2025 regular board meetings. I make a motion to approve the board minutes on September 22nd. September 22nd, 2021. Motion by Miss by Miss I. Motion passes. B1 district reports. >> Uh good afternoon, Mr. President, members of the board, community members. I will start with the gear up kickoff that we had with region one last week. Going to pass out the actual agreement that we
002had with region one. We were awarded uh the Gear Up grant for seven years. We're going to be starting with our seventh grade cohort this year all the way to college. So uh the gear up facilitator will be helping us out uh providing academic support for our students in that grade level. Uh and that facilitator will follow that specific cohort of seventh graders. If you turn to the last page of the packet that I just gave you, it's a draft of the actual budget. So, the overall grant is uh $83,000. Um it's the the last page that's uh $83,000 more more or less in a yearly basis. That's what we're going to be getting from that specific facilitator. Now, as you know, we have a federal shutdown. So because of that uh the monies are
003not available yet. As soon as the shutdown uh is open then we will get the money. >> During executive session I will present to you different options what route to take with this specific position. >> Also we have the spooky fest tomorrow October 29th. We will start at uh uh 4:30. It'll be here right next to central office. In fact, uh our administration, our our employees just finished a haunted house for our community that will be host here in central office starting tomorrow 4:30. Also have the information that we created based on our superintendent all tournament. And as we promised, we're going to be giving out scholarships to our 2025 seniors. So those seniors who graduated uh back in May will be able to apply to this uh scholarship and we will have an event
004in November. As you can see there, the deadline is Monday, November 3rd. So if you know any seniors who's passed on the information, uh we have the scholarship applications open. >> Screw down. >> Yes, sir. uh how much was it raised again? >> So if we had about $30,000 >> and revenue was a little bit more than $14,000. >> We encourage all seniors to apply visit do the QR or come to the admin office and please take advantage of this scholarship and hopefully in the years to come we can get we can get bigger we can get more funding. So that first we encourage your your all senior to last year. >> Definitely. In fact, our uh high school administration is uh calling uh the students to come. Uh and this is a good motivation
005because some of them are still taking TSI. The school is paying for those are free for for the students. We're getting them to apply as well. We'll pass on the information uh for for 2025. >> Are we going to post it on social media? >> Yes, we already did. Yes. We already did. they get the QR code and and uh if they don't want to make the application online, you can send them over and we'll help them hunt. >> We are planning already this year's uh golf tournament. We had a successful one during the summer, but now we're ready for the next >> I'm very happy to announce that our ARP program is working very very well along with Santa Maria school district. Right now, uh, our students from Progresso who are going to Santa
006Maria are taking real estate classes. The ones from Santa Maria coming to Progresso are taking the manufacturing classes. And I had a meeting uh with region one and we're already planning to expand for next year. Our plan is to uh get more students from Santa Maria to come and register to our health science and our students from Progresso will be going to Santa Maria for law enforcement. Uh so the the ARP program is working very very well. On another note uh I know we've been talking about the team of eight. I will give you the November uh dates. There's three dates. Uh I'm going to need all of the team to be available that day. It's either November 17th or November 18th or November 19th. I'll be calling you. That's Monday, Tuesday or Wednesday. That
007is the week before we go out uh on Thanksgiving break. we need to do the team of eight. So we'll have the meeting whatever we need to uh make a decision on we'll have the team of eight and I also want to invite uh Dr. ET to start the strategic planning. All we need is just to have one hour 30 minutes 45 minutes with you so we can guide Dr. And then we'll create uh the committees with the community, with the school districts, with the businesses around. And also we have the story book pumpkin contest this week. The deadline uh for that is tomorrow and we're going to be inviting any of board members that want to take part in the judging on Thursday the 30th. if you have an opportunity to be here in
008central office uh at 10 o'clock we're going to go to the campuses to do uh the judging of the pumpkin contest that's going to be on Thursday the 30 and then we'll announce the winners on Friday the 31st >> any questions that's all I have >> thank you >> at this time we're going to be two girls and boys cross country presentation for district champions >> yes uh board members as you know the cross country got the district championship ship and I'm very honored to um present to you the the players. Can I get Mr. [Applause] Good afternoon uh members of the community, members of the board, superintendent, board president. Uh today we not want to recognize a special group of uh students that have achieved some significant successes this year. Uh in front of

Uh also team member Stuff again this year at the district at the regional meet. We did have probably the most successful finish for our girls finishing in eighth place overall as a team. Uh we did we were fortunate enough to have Miss Alice Clark placed individually as a 10th place medal. On the boy side, we missed qualifying to state by a few points. We ended up in fifth as a team, but we did we were fortunate enough to have
011[Applause] October 31st at 8:00 with Alice and then 8:30 with Martin. So, we're extremely proud of the entire group. Obviously, we wish the best of luck to our two competitors that will be competing and again, thank you all for the entire the support season. I know sometimes people have complained that we run on the side of the road, guys. We try and make sure we're never going to put the kids in harm's way, but we try to make sure the kids have the training that they need to be, you know, competitive at the next level, competitive in our district. We're one of the most competitive districts in the entire valley uh when it comes to running. So, we just want to make sure the kids are are celebrated and we thank you again for having

Sophia Aosta Janet [Applause] Ruby Alvarado Ruby. >> Did I say right? Oh no. >> You think I learned it after six months? Isabella, [Applause] >> Adelli Borrera, [Applause] Francisco Benort, [Applause] Irene Castillo, [Applause] Juan Corn, Armani Cortez, [Applause] Jason, [Applause] Diego Gonzalez, Victor Gonzalez, Alejandra Guerrero, [Applause] Hannah Hallina [Applause] That's the face. [Applause] You pick smart. [Applause] [Music] [Applause] Galanelli Rodriguez. [Applause] Thank you Sanchez. Abigail and Robert [Music] Two, [Music] guys. [Music] Oh yeah, few more over there. All of a sudden, Robert One more time. [Applause] One more. [Music] directors, Mr. like Michael appreciation on behalf of the school board and
014administration for your hard work and dedication. Give a round of applause TO [Music] [Applause] >> we have one for cross country coaches as well. We'll get into that right now. And since we're talking about uh sports and and that, I just want to say that uh we got uh $500 donation that will be presented to the board on our next meeting from Weaver and Jacob's constructors. $500 uh to benefit the progress high school baseball program. So, uh we have our representative here. Thank you everyone. WE REALLY APPRECIATE [Applause] YES, OF COURSE. LET'S TAKE A picture >> and we'll present it to the board uh on the next meeting because it's $500, but we'll take a picture right now. Thank you so much. I really appreciate it, sir. [Music] Mr. Picturment. Don't take him away. Don't
015take him away. Take him. Anything else? All right, perfect. At this time, members of the board, we go to item B4, time and attendance software system. >> Uh, Mr. President, members of the board, community members, uh, back in May, we presented this item to the board. We only had one quote at the time. Uh, and and if you turn the page to the first page right after the description, we had the company TCP. Um, and the price was close to $70,000 and we were going to have to pay about $22,000 on a yearly basis at the time because it was the only company that provided the boat. Uh, we said that we were going to table the item. However, we were able to get another company and furthermore, we were able to get this price
016that TCP gave us uh to a an even lower number. So, if you turn the page, you can see the actual email where they say that uh they were willing to cut the price uh to 50% because uh they like the superintendent of Professor very much. And if you turn the page, you have the actual quote with the 50% which is 35,626 uh dollars. However, if you turn the page, there's another email and it says, "If you guys are willing to sign a seven-year contract, uh we'll wave the uh close to $12,000 um on different fees." So then they provided a new quote. So we would only spend 23,000 uh >> uh $23,000 679 years >> for seven years. Yes. >> annually we would have to pay that right. >> TCP provides all of the
017different uh features of the system. It's not only a clocking in and out. It gives you uh yes everything. all the different the hours they work, how much you're going to make and stuff like that. Uh in fact, when Lupita saw their presentation, she get at the time again it was very expensive and and in reality they like not super >> just a matter of making them wait. >> Yes, I think it's less because it says recurring and one time. I think the one will be one. >> Oh yes, the $23,000 will be for this year and then the recurring which is 15 300 and 1,120 that that would be the yearly. Yes, it's about uh $16,000 a little less than $17,000. That's what we're going to pay on a a yearly basis for seven
018years. Now I started asking different districts. Some of them are paying 40 $45,000 on a yearly basis. So this is a very very good price. Um however I added the other quote from another company which is work easy software and on this one as you can see the yearly cost would be 600 uh 16,800 and then also yearly 5,800. So it's a little a little bit more than $22,000 in a yearly basis. The only thing uh that this product does not have is all the features that the other ones have. So, this one is just clocking in and out, and it's going to give you what time you clock in, what time you clock out, and that's it. Uh, HR will have to go back and and do the actual payroll one by one. With
019TCP, we don't have to do that. So, we're going to save a lot of money because of that. Uh, so their recommendation would be to go with TCP for the seven years. Um, for the seven year, >> Both of them are favored. Yes. Now this uh investment will come out of fund balance but once we have the actual presentation of the budget then you'll see more level how they're doing with the >> are any of these >> uh no I don't >> any questions any question mark it integrates with everything here, right? >> Yes. Yes. The actual features that it has is with everything. And we might right here if you see uh they just put uh six actual punching in pluging in machines. We might order more, but they're about $250. >> Okay. >>
020The actual what's expensive is the software. >> Good job. Negotiation. >> Yes, definitely. We're good. Let's negotiate. >> What uh software do we use? >> Uh right now it's it's just HR. We we don't have an actual software. So uh we do have the punching in and out with with the card. So the ladies have to go one by one to do the math. >> This will be the soft Yes. Motion to approve attendance of the system. >> Motion by motion passes. >> Just for the record, it would be TCP. >> When would the when would it start? As soon like >> Yes. >> by when? Uh I I'll call tomorrow just to see how long they take. Uh we need to go through the training process, but we want to do it as soon
021as possible. Hopefully by >> at this time I'm going to see what ID by name is program evaluation. >> Yes, I have a SC to present that item. >> Good afternoon members of the board. Mr. Board President, today we're going to present to you the bilingual evaluation as required by statute. This item does not require voting. is just a presentation item and as requested by the board we will have region one uh conducting the evaluation and Mr. The class will be given the competition. >> Good evening uh board president, members of the board uh progress community. My name is Ka Lupas and I am the director of the emerging bilingual support program in region one and it's my honor to present the 2024 2025 bilingual and ESL evaluations program evaluation tonight. This is an annual
022report that is guided by uh the Texas Education Code Chapter 2903 and it reflects the district's commitment to ensure the academic success for all the bilingual uh students in your district. Uh for your convenience uh a copy of this presentation and an executive uh summary has been provided for you. So the purpose uh when it comes to the purpose of this uh evaluation pro it provides a comprehensive analysis of the bilingual programs focusing on English language proficiency, academic achievement and the equitable access to high quality instruction for all students. Uh the elements tonight presentation will cover six of the key areas um which is the student demographics, the linguistic and academic progress, student reclassification, uh professional development, bilingual exceptions and ESL waiverss and the alignment to those uh to the ESL uh to the alignment
023with the district improvement goals overall. So if we move to uh the first part which is the demographics. So based on the fall um 2024 spring appeal snapshot, progresso ISD serve 1,339 students. Of those 784 or 58.5% are uh emerging bilingual students. This demographic reality underscores really the importance of a strong well-implemented bilingual and ESL program across the grade levels. So when you look at this graphic and like I said you have the report and you have this graphic uh with your report in 2024 2025 progress ISC students were served through a continuum of models. So you have a two-way dual language program from prek to third grade. You had a transitional early exit program from grades fourth and fifth and then an ESL program implemented from sixth grade through 12th grade. So these models
024are designed to promote by literacy in the case of the dual language program. Academic achievement of course for everyone and English uh proficiency but honoring the students linguistic and cultural assets. So if you see in the graph, those are the numbers specific for the grade levels and this they're also in your report. Now as we were looking at this uh all this data, we wanted to frame this evaluation based on the goals that you have set for for this this past year. So in the overall when you look at go one of your district improvement plan uh overall you said an 80% of all students will meet the approaches level or higher on star. Now when it comes to the specificity of the EBS uh 29% you set out the goal for 29% of the
025the students will meet the grade level expectations in reading. So I wanted to remember that 29% in reading and then 40% in math. Now, we're not looking at the approaches level. We're looking at the needs level. And of course, the last one, the goal, the last goal was to have all students, at least 37% of the students will progress at least one level on the TEAS uh test. So, at least one level, 37% of your previous students overall. So, when you go to the next visual, we look at uh the different programs. So this chart reflects the linguistic progress of your EB students by program. So if you notice the first section of it is your dual language program and it goes from prek to third grade. Right? If you're looking at when you're looking
026at this chart, you notice that the the beginner and the intermediate levels are decreasing as the student are going up in the grade level and your uh advanced and advanc advanced high levels in are increasing. So it's showing a very positive progress when it comes to language development. So decreasing at the beginning and intermediate and then growing at the advanced and advanced high in third grade for those language uh students. And then you see the progression in the other programs the transitional bilingual uh and then you see it for the ESL as well. And so that's kind of like what we're looking at. So I want to note I want to notice how the number of students um in that dual language program is moving from the from the beginner intermediate to the advanced advanced
027high in a very noticeable way. So decreasing the number of the beginners and they're increasing that number of the advanced and advanced high. Now we also look at that 37%. So uh we said that at least 37% of the students will make that purpose. So during the 2024 2025 school year uh 33.38% of the EB students have asked at least one level on tel which is up from the 25.9 if you notice on the left of the of the the graphic uh it was 29.9 25.9 last year. So this is a 7.48 48 percentage point gain uh that reflects the meaningful progress in English language acquisition and evaluates the impact of the targeted instruction and professional development and of course the strategic uh implementation of the program especially at the upper grades. If you notice
028u there's the those section with the red is your 2025 numbers you saw a lot more progress in the secondary level uh because it was part of the implementation of some of the strategies for this year. So even though it's really not it we didn't get to the 37% really the increase of seven points in one year is very unique and it's not very typical but you're looking at more than seven points of progress in just one year. That's a very strategic way to move student forward. So congratulations on that. Um academic progress in the language of instruction that's another area of evaluation. to look at how are the students progressing in all the languages both in English and Spanish. So you remember at the beginning we set out with a goal it was at
029least 29% of the students will reach the meats level in reading language arts and then at least 40% in mathematics. So the graphics that you see there have that at the bottom of the graphic so you can see that. So if you notice in third grade, if you notice in third grade, uh we have those when you look at the needs and the masters, those numbers were surpassed. And so you're seeing that the students are at the meets level way that we're at 49% and 29%. That's way above what the goal has been set for. And if you notice the master's level here in the in the in the English RNA really goes is overpassing the all population. So you're looking at a 19% in the all population for the masters but then for the
030EDS you're looking at a 23% at the master's level right so they're overperforming when it comes to uh the the reading and then also you see the same pattern in the math area so they're surpassing uh the whole population in mathematics and they're one point above the all students in the about language students or the dual language students. So now that purpose you see across the board, right? So in reading language arts give you and go over this real quick. So we go to the next part of the evaluation, but in reading language arts, the ED exceeded the 29% benchmarks in most of the grade levels. So notably uh that dual language cohort is looking at outperforming their peers at the masters level narrowing those performance gaps uh very significantly. In math the students achieve
03138% at the meets level just two points shy of the 40%. Now that 38 that's two points shy of the 40%. There were very specific grade levels that performed way under um at least at least 10% 10 points under but it's only selected grade level not across the board. Okay. And so but the other levels performing greater it just gave us that 2% um cap which is pretty good. We're getting very close to that target. So if we move to the different grade levels, uh you see the pattern there with fourth grade as well. Um except that this one the meets and the masters they all is outperforming. Remember this is the transition bilingual program. This is not the dual language. This is a transitional early exit. So the students at the at the meets
032level they're performing under but they're still meeting that goals. Same thing happens with the mathematics performing under this is the transition by early exit still meeting that goal and you see it across the grade level. Now I want to go and you have it in your presentation in charge. I want to go all the way to your eighth grade which is when you when students are tested across the board. Now with this part in science and social studies the performance gaps still there uh ranging from 5% to 17% points at the means level and these are the areas that they need to focus to focus on in those areas of science and social studies. Now however when you look at the overall this is not just unique to your B students the performance is across
033the board. Those are areas that there needs to be a focus on when professional development and strategic actions. So when you go to the academic purpos of course u the gap is still there especially with the English English one. If you look at the needs we're only at 25% versus 35% uh of the whole population. But if you notice also the approaches is only at 50% with the all. So yes there is a gap of a 10 point but the approaches is also 50% in the but there's still that gap of 10%. Now um this is this goes to the US history and biology and algebra also we see that gap algebra was another area where there was that gap 5% in the need at the needs level and at the mast's level as well
034those mentioned before if you go to the reclassification of the students so reclassification is another area that we look at in the evaluation which it means how many of those of the students EVs are being reclassified as non through the program. So in 2024 50 students were reclassified as English proficient. In 2025 that number is increased to 73. So that was a 46% increase in reclassification. So this growth is is a strong indicator of the program effectiveness and and the student readiness for instruction in mainstream. So another area that we look at framing it from the same from the goal going back to your goals uh framing the professional development. So here's the professional development that was offered for your for your teachers. So to support your educators you provided targeted professional development aligned to
035second language acquisition. The sessions included by literacy pathways guided reading strategies and ESL certification support. So over 150 teachers participated in at least one session demonstrating that strong commitment to instructional excellence and progressive ISD. Now as part of alo evaluation we looked at exception uh the the bilingual exception and waivers waivers. So, Progresso Inc by legal exceptions in school year 2024 2025 and this year is filing eight um except eight exceptions this year. So, while staffing challenges persist, you're being proactive supporting the uncertified teachers through the targeted professional development and the uh certification support. So, when you notice here, we have some some teachers. Last year there were some teachers that attempted the test and there were two teachers that attempted the test and did not pass and there were four teachers that did not
036attempt the test. Now uh certification when it comes to the certification status six teachers bilingual uh supplemental certification plan so they are there were some of the teachers that were part they are part you're hiring some teachers that are part of a certification program and so those are not allowed to test by their program until they complete certain hours. So that's why you see that some of the teachers have not attempted their test because they're not allowed to test by their certification program until they meet certain uh criteria. So uh for this year we said uh you guys are going to be filing for eight of those uh positions for for the exception program implementation. This is just a part implementation self evaluation. Just an FYI for the board. Next year you will be seeing
037the self valuation part. It is now a requirement of the state to conduct a self evaluation and then present the results uh to the board at the end just like this. So they're adding that self evaluation to this presentation so the board knows how the district is selfating and the implementation and of course all this information is available to you is available to Mr. Bernardo and to all the principles of course for them to have and to pull that data to revise if necessary their campus improvement plans uh because that is the whole evaluation of course um at the end just to reiterate um in closing that's progress programs are showing measurable progress the 46% increase in student reclassification is the strong indicator uh the 7.48% point in the delta growth is a very strong
038indicator as well. And of course the achievement gaps that the dual language cohorts coming up are showing when you see the trend you see the dual language program closing that gap with the the meets and the mast's level over performing so far. So hopefully that's a trend that is continues to go that way because it will give you that meat and masters that will give you that will really really question any questions. >> Thank you. Thank you for the presentation. At this time we go to C2 uh memorandum of understanding between uh Ro Valley Independent School District charter schools and Ro Grand Valley Institute Higher Education of the College Mathematics and English Language Arts courses. >> We have Miss Garcia to present the >> Good afternoon board members, Mr. President and Progressive Community. So I
039am recommending approval of five-year with region one RSC and the participating ISDs for the implementation of the college prep for math and ELA at the high school level. Basically this helps our high school students our seniors strengthen the college readiness skills and meet the Texas college readiness standards. >> Any questions? >> Yes, this is actually something we already have. Yes, this is just anou because it's extending it for >> 5, right? >> It's through region one. Yes. >> And so we can meet our CCFR. >> So we just need a motion, right? >> Yes. >> I make a motion to approve C2. >> Motion by meas I motion passes. At this time we go to C3 2025 2026 student advisor council members. Yes, we have Miss Audrey present here to renew our6 uh school advisor.
040It's majority from last year. We just added uh another parent and university each year uh which is a requirement uh for the chat committee and then we added our high schoolers but it does encompass uh administrators, athletic directors, nurses campuses, uh myself, finance directors, um Miss E because she deals with uh the health benefits and what the employees are they have access to. and then two high schools. So, I just need a >> same ambassador to >> how often do do you all meet? Uh, it has to be four times a week. >> What What for example, what's the discussion points? >> Uh, it's multiple. It encompasses not only like now require financial education for teachers. Um and in not only food service but also uh the physical activities that those students can get together
041or walk um and to have access for the students to have school programs that encourage you know activities and things that um and open to all students. So it's not just food and I know everything for mental health and mental health >> if uh it's a good idea if the city continues with the recreck you know to partner find a way to work >> exactly and that would be something that our committee talks about how >> we haven't heard anything post the meetings we have to post meetings now this period it's required just like a change that the chair cochair has to be so >> and just to understand how how do you decide like who are the parent representatives or the students >> there are usually volunteers that are already volunteers for the district
042with my grant or PSL that are already you know vetted and are very knowledgeable about the process in the district and continuing and are very active the students and the community, >> but anybody's welcome. >> It's an open meeting. >> Yes, it's an open meeting. We have our staff members, but it's open to the public. You're able to come in and comment. We try to hold them after school as much as possible. If we do do it during the day, we try to allow your version for parents to parents to be able to comment and have access to it is right. >> It is. Yes. As much as possible. >> I see there's a few coaches on the committee. >> Yes. because uh it actually shock is a big portion of activity and making sure
043that the activity and nutrition and the mental health are all available for all >> any questions. >> I make a motion to approve motion by second by Mr. I I motion passes at this time. I agree on approve the beats. Are any of the vendors here? >> No. Mr. President uh just went out for proposal from approved vendor purchasing. We did receive three proposals uh project 314,000 stone 388,000 international 220,000. Uh this will include the intercom the video camera and this going to be integrated with the same system that we have to open the doors of the campuses. So all staff will have a key card. The vehicle, the school district vehicle do have a back, the buses and and the place because the the centers fund does include one year warranty for equipment and
044one year uh and all three codes are are apples to apples. Yes. Any questions? this time make a motion to approve five motion by Mr. Ramos second I passes have six level of September 2025 we have received 2.9 million and we have spent 200 540,000 we have 765 No action. We're going to have seven updates. >> Yes, we have some updates on our fiscal manual. Uh some of these purchasing priority approved by the state. We just want to update it to the fixer manual such as the fixed asset is increasing anything that we need to add fix increase from 5,000 to
06010,000 the micro purchases which is anything basically we can buy one thing without requesting proposal at one time from 10,000 to 50,000. Uh the district does uh selfcertify since we're not an annual or low risk audit audit district we do self certify the micr purchase we increase it to 49,90 the simplify acquisition track which is the form anything was increased from 250,000 to 350,000 that means that you pass that 350,000 you need to request formal seal proposal from an approved vendor or go out for also the competitive bidding was increase from 50,000 to 100,000 that means that uh from 100,000 down request only three quotes without open open uh donation where we wanted to increase um right now everything superintendent 500 plus,000 from 500 and up. We need to get approved by the board for
061for basically $1,000 to bring in money. I think we'll move it up a little bit. That's a good uh good call. We should be by the time we get a monthly meeting on the problem. But we want we we already do it as a best practice but what we want to put in writing on the money that anything that's not submitted within 30 days uh any reimbursement request we basically don't pay for example right now in August the close the this year end 31st and then they'll bring us something for reimbursement to get to get paid in September or October then it creates on his reported price. Anything that they bring after 30 days. Uh lodging as well. Uh what we wanted to do is the maximum number of reimburseable lodging night nights should be
062determined by the start and end times of the event and distance from the district. Basically, for example, the conferences in If I conference starts the 10th, you will not get a prior day uh room for that. You will get for that night. Same thing if the conference ends with 12, you will not get a knife or log for that night. basically checking that out. Um the other one will be the right now post for South Island. I know the rates for the summer they're like $320. The GSA rate right now is 140. What we recommended is that any excess gets paid through that one. It's different. Any question to approve? >> Motion by second by M. Say I. >> I. I can say name at this time at this time at this time and then

I'd like to discuss uh F6 the budget update. I'd like to request the the P&L on action here today for next board next board meeting balance sheet. And if you guys have a an actual spreadsheet of the budget of the yearly budget, >> I'd like to request that also on the more detail more detail please. And that that's all I have. >> You want it for every school or you want it? >> No, the year I mean the the school the whole district the whole district >> at this time uh members of the board by
065request by board members. I will be moving item D and E the open session. >> We already have it open. Are you taking them out of order first? >> Yes. Taking out of order first. >> Mr. For president, members of the board community, we have uh Mr. Levitz, our attorney, who will be presenting for you already. Awesome. All right. Good evening, members of the board. Can you all see this? Okay. Yes. Okay. Um, so I'm going to be giving an update regarding House Bill Code 3526, specifically as it relates to education code 11059E. This pertains to matters related to trustee terms and they're governed by u the Texas Education Code, but and also with House Bill that we've mentioned here. That's a new House bill that passed this legislative session with the state of Texas.
066And so we're going to be covering that right now. There you go. So again, we're going to explain the purpose for that. We're going to outline some of the policy reasons why the legislature identified the passing of that specific House bill. We're going to look at an overview of a proposed transition and timeline on kind of what that would look like. Um, but this part right here, I'm going to carve out and I'll explain why uh later on in the presentation and then I'll answer any questions that you might have here uh today for us. So let's first look at your current outline. Like I mentioned earlier today, this relates to how the board is governed relating to your trustee terms and how they're staggered. Currently, you are on a three-year cycle. That means that
067every year we have three trustees year one, two trustees year two, two trustees year three. Every year you have an election here in the provinesso. Uh as far as the clients that I serve, you all are an anomaly with that. Most of them are already serving on the four-year cycle. You all are still in the threeear cycle. And so that's governed by board policy, EPB local, which is the second item you see on there since we're taking them up together. They're kind of they kind of go hand in hand. The new law uh regarding House Bill 3526 allows school boards to amend that to move into the four-year cycle. And so what that does, it creates bianual elections. It cuts one of the elections out and then it moves into a staggered term of four
068seats and three seats. And so that's how the staggering would be in a bianual form. The this is brought to life through the enabling statute being the first statute that I mentioned 11059 that came to life through house bill 3526. So this this move is only allowed because the enabling statute was created by the Texas legislature to allow districts to move into this. So, the legal authority behind this, like I mentioned from the get-go, it authorizes school boards to change trustee term lines by resolution, no election required. And it requires that we enter into staggered four-year terms uh with bianual elections. So, instead of having an election every year under the under a House Bill 3526 uh amendment, you'd be having elections every two years. And so inevitably because what we're doing for the transition,
069there are some uh trustees who will hold over a little longer than the initial three-year term. The statute allows for that. What the statute doesn't allow is to cut a current trustees term, but it does allow for the trustes term to be extended in order to line up to the bianual elections. The policy reason that the legislature identified for this when we look at the bill analysis that was put out. Number one, they're trying to reduce the overhead cost of school districts running elections. Essentially, your election bill will be cut in half because you wouldn't have an elections every single year. They're also looking at longer stability in school districts when it comes to trainings and when it comes to board governance. As you know, every year this school district has to go through the
070team of eight. every year has to go through the new board member academy. The reason that the legislature identified this as a as a reason for it is that now your team of eight would be good for two years. For example, your new board member academy would be good for two years and so requires less training and it has more overlap with trustees uh for governance purposes and they're also trying to alleviate voter fatigue. the legislature has identified that we've had a lot of a lot of elections a lot of all the time and so they're trying to consolidate some of that to alleviate the voter fatigue area. And so some of these things you'll be able to find by reading the uh bill analysis that the legislature puts out in addition to some of
071the notes from the committee that they were going through. And so what this does is that no trustees term is shortened. It ensures that we are in compliance with the statutes pertaining to this. It allows for the constitutional holdover of trustees and it adheres to the uniform election dates uh and the joint election requirements that are put out by school districts. Now what does this mean for ISD? Right? If we look at just the financial impact on here, you're spending about 37,000 almost 40,000 a year on on the three-year cycle, right? That includes the cost of a potential election. That includes your team of eight training. that includes your new board member orientation. And so in total roughly as a consequence of your three-year cycles, you're spending in 10 years about $372,000 that you're kind
072of spending right now. This number does fluctuate a little bit because you are build based on how many how much your voter turnout is, but what you have to budget for is the actual quote being put out by the county. So it just kind of varies depending on how many voters actually come out. But for purposes of this and illustrative purposes, that's what the county quotes us for our elections here in Progresso. So if you move into a four-year cycle, that is essentially cut in half. And so in a 10year cycle, you stand to save almost $200,000 uh for your school district. And so that's the first impact that you have from your school district. If you move into this, right, you have another 200,000 in your coffers over 10 years to spend on anything
073else you want to spend because this money is coming out of 199. It's not being funded by anything else. It's all local money. So, it's local money. You get to have a backing here. And so, it's about 186,000 uh in the decade, right? The way you do this is very simple. You just literally adopt a resolution and the resolution outlines that you're going to move into the four-year cycle. That's how simple it is. The legislature intended to create this as a one-time measure with this with the a specified period of time of when you need to accomplish this and they did so with the intent of allowing districts to take advantage of this opportunity. Um I mentioned this right and here are some takeaways right regarding your authority regarding your what we talked about. I
074mentioned all this because the bill was actually written by your local here. And so, um, notably, you will notice on here that I did not include a transition plan. And let me explain why. I'm actually going to request that you all table this item. And the reason why I'm going to request to table this item is because in the initial transition plan that we created, how we interpreted the law, um, we reached out to Mando Martinez, who is the bill author of this, right? And so, I had a conversation with him today and I asked him, hey, I want to make sure I'm getting this right because you wrote this law. I don't want to misguide my clients on this and so I need your input on this. And so what he's going to do
075is he's going to send the our analysis and what we're doing to the ledge council which is going to guide them on how they are interpreting our terms to actually be moved or staggered based on their interpretation of the law. Now why is that important for us? Because since this law just changed in September, right? There's no legal interpretation of it. you're literally going to be one of the very first districts possibly in the state to take advantage of that. And because you're the first one to take advantage of it, I don't know exactly how a uh court might interpret the way the law is written, right? I did my best and so did Mr. Kevin O'Han and Mr. Dave Campbell to look at the law the way it is and we think we have
076it down, but in my conversation with Mr. Martinez and you're free to call it too so you all can also touch base with him. Uh he indicated that there might be a different variation of how they're interpreting it and so I don't want to put something on your table that we have to come back and fix later. So instead what I figured and I was talking to Mr. Fernal about this was let's present it. Let's talk about what what it is. Let's get it over to uh rep's office. They're going to send it to the legal counsel. They're going to send it back to us in time for the November meeting. That way in the November meeting you actually have a transition plan to actually vote on. And so I don't want to put something
077on there that that we've got to come back and fix later basically basically. And so um this is kind of the overview, right? It sounds very simple and short and that's because it is very simple and short. The only thing the legislature said was, "Hey guys, you all want to go from three to four years for the policy reasons we identified. You're welcome to do so. Pass your resolution. You're good to go." Now the transition plan is what we need help being interpreted and that's what we're working with with the leg council to assist us here >> and the transition plan is going to tell us who's going to qualify as a candidate to be extended four years and who's not. >> Yes. So part of it, yes, what a transition plan actually will do
078for us, it's going to identify the individual seats on the current board and it's going to identify where we are going to stagger them and how we get to the four-year mark because we need to transition from three to four years. And because you can't cut short terms and you have elections every year and we got to cut one of the elections out, it's how we stagger them uh that we need to make sure we get right. And so yes, we the guidance we hope to get is going to be one from the bill author themselves because since they wrote the bill, I want to make sure they have the best interpretation of what we're trying to do to make sure that we're in full compliance with any plan you're going to consider. >> Can
079you go back to >> Can you explain? Sure. Just to the audience. >> Sure. So the first one is regarding the cost, right? The first thing that the district will benefit from by moving from a three-year to a fouryear is you're going to cut your costs of election in half. And that's going to save the district almost $200,000 in the first 10 years. That's money that the district gets to keep back into its pocket. >> Can you explain the 199? >> Sure. So the 199 is local funds that belong to the district that are uh undiscretionary, which means that's money that you get to spend however you want. Oftent times a lot of our budget comes from money from the state or the federal government that's already marked on how to spend. So we have
080very little discretion on how to spend the money. However, election costs, those are paid through our local funds. And so to free up local funds for most school districts is a big deal because it's more unrestricted money you have to spend on more discretionary items you might want to take up. And so when we look at the bill analysis, the legislature, which is the people in Austin making the laws, they identify these as the reasons why they're going to allow districts to do this. In fact, they want districts to move in that direction so that people aren't spending money on elections every single year. And so that's the first reason, right? We get to save money for the district by 50%. The second reason that they're identifying is they're noticing that districts with three-year elections
081have big turnovers of school boards. They're constantly having new members. That's constant new training, constant new TA requirements, constant new team of eight trainings, constant new new board member orientation trainings. And so what TEA and what the legislature is trying to achieve by moving into the four and threeyear uh the the four-year election is that now you have trustees here a little longer and you don't have to replace trustees every single year. So now when the trustees do a training for example your required team of eight training instead of it only being good for one year it's now good for two years. And if you adopt a governance model, you don't have to retrain new board members every year for that governance model. So they're looking to promote uh consistency in our school boards across
082the state of Texas where there's not as much turnover on school boards. And lastly, community participation. One thing that the legislature identified is that there's so many elections all the time. We have elections right now for the constitution. We have elections going on for the primaries in March. We have elections going on in May. We have elections back to the primary runoff and we go back to the November cycle. And so what the legislature is trying to say is look, we know there's a lot of elections all over the place. This is one way to simplify one less election for the people in the community by instead of having to go to the ballot box every single year, they get to go every other year instead. >> So that's what I was going to say
083of the community participation. Yes, you mentioned that. So what you're saying is that no uh proposition is needed by our voters. That is correct. That is correct. And the reason why that's that's correct is because the specific law that was created is giving the board that authority to just do it by resolution. So this plan does not require voter approval. This plan just requires a resolution. You might have been emailed a sample resolution that I sent with Mr. Coronado. And so that looks kind of what it is, but there's things we got to fix depending on the transition plan you get back. And that's what I was going to say. So all this where's all where we get all this wording from? >> I know it has your your company's letterhead. >> Yes, sir. >>
084That's which wording specifically? I'm sorry. >> Uh Texas educator code 11.059 >> of terms. Is this >> that's in the actual education code in the law? And so what you have in front of you is our legal memo explaining this in the legal form because we need to have it on file. So me reviewing it, I I I guess I don't understand why we need more counsel from Monty Martinez's office or whoever's going up. Understand that we're changing it from three to four. So really what we want to see is you mentioned each each seat which one's going to affect. Sure. >> And if you want to can explain why I need the council the guidance from the office and so the way and I was having a debate with Mr. Hendricks earlier today when
085we were out there trying to uh uh answer this, right? Um the way the law the way the statute is actually written, there's a weird sentence that's in that's grammatically incorrect in my opinion. And so the way the sentence reads, it should be quoted if I can get it. And so it reads that essentially the board can move from extended terms from 3 to four years. Uh there's the initial deadline when the statute expires which is in 2030 and then it says it must be the and uh make senate until the next November canvas election and that sentence right there's no interpretation for that. So what we're trying to get guidance from is a is it because we have to adopt our resolution before our election before the November canvasing or is it that we
086have to align our elections to the November uh calendar. I don't know that specifically yet and that's what we're trying to figure out. >> Let me just say something. We are one of the few districts and I think maybe somebody else that has the elections in May. Most of the districts have the elections in November. So that's why uh have that question because it states right there the month of November. Our elections are >> Yeah. And so because this has not gone to a court before, normally by when we're looking at a statute, courts have already spoken about, but we have some guidance, but because we have no guidance from courts on what that means, the best safe block we can get for ourselves is getting the guidance from the Texas office because they're the
087ones that are going to be interpreting the intent behind it. And so I what I didn't want to do is bring you something that we got to change later. Instead, I wanted to play it safe and say, you know what, we'll present what we have right now. This has been changing over the last few hours because that's when we were able to get a meeting with Mr. Martinez when we called. And so, um, we'll have it ready for the >> It's important to point out because people might ask, how come you guys didn't do it before?
