I just want to say congratulations. I have a great relationship with all of the new administrators up here today and I look forward to working with you all in the future. It's fantastic. This current school year I have become increasingly aware of and alarmed by the district's utilization of contracted services that overlap duties which are currently provided by classified employees. While CBCO may accept that certain specialized roles might be better filled by an outside agency to fill a short-term need, we do not and cannot accept what appears to be blatant workarounds of our negotiated working conditions, pay, and benefits. The magnitude of this practice has become untenable
013with the renewal in July of various contracts for special education contracted workers with a value exceeding $18 million. $18 million in July. And this will continue to grow with even more vendor agreements coming before you tonight. Needless to say, it has become immediately apparent that the practice of utilizing contracted personnel to displace employees, particularly classified employees, is widespread. And this both devalues the service of our members and limits opportunities for those same members. CVCO might not object to filling positions with contracted workers if the district demonstrated an ongoing effort to fill those positions and it was simply using the vendor contract to fill a gapped position until a permanent employee could be brought in. To make such a case, I would expect to see an advertised open position for each and every vendor contract filling
014a role that is met by our members. What I see, however, tells a different story. For example, there are currently no postings for the registered behavior technicians, yet we currently have 24 contractors to fill this role. Similarly, we have no postings for LVNs, yet we have 19 vendor LVNs. There are no SLPAs or OTA postings, even though we have three contractors providing this service. 13. of the 27 occupational therapists, nearly half of our OT support is being provided by contractors with only two postings to fill this. Last month, we approved a job posting for the ACERT to support fire and security alarms. Yet tonight, up before the board, is a request for a $99,675 contract for outside services from Standard Electronics to essentially do the same thing. There are also two vendor contracts up for
015renewal tonight, one with Hopskip Drive, which costs the district $180,000 per year, $15,000 per month. transportation services that could and should be provided in-house with existing and available district van drivers. Another one is with the Covello group for a hundred and thirty three thousand two hundred dollars to support LVN services. These vendor contracts hide money within the district's budget. This is not the transparency the district touts. CBCO's expectation is that the district puts employees first. In this case, that would entail diligently working to place classified employees in the roles that they fill and only begrudgingly rely on contractors to fill positions on a very temporary basis. This would mean intentionally minimizing the use of contractors to perform classified functions and in places where they are being used to actively seek in to fill those gaps
016with permanent employees to do otherwise devalues classified employees and weakens our organization it also sends a strong message about the district's core values and how it views employees cbco requests that any any vendor contract affecting classified employment including those that are up for tonight's approval be reviewed with the utmost security, and a job posting be advertised to show the district's good faith efforts to fill these needs with classified employees. We've been noticing for a couple months that he's coming home with bruises, scratches on his back that have dried up blood. The bruising is not somewhere where it's Like normal play it's on his ribcage. It's on his abdomen. It's on his chest He again is in the San Diego. Sorry the special day classroom So he has an IEP has his disabilities. He's verbal but doesn't speak very much limited communication When I ask about these bruises he gets very emotional in a very distressed state Almost angry a trauma response.
019He doesn't want to talk about it Recently we noticed a piece of skin missing on his hand. I asked him what's going on? This time he did let me know that when his 101 aids that have provided by VBA pinched him and I asked if he let another adult know and he said no it's called a secret my son does not know how to very speak very much so that is very um heartbreaking to hear um not just that but in the esy program my son um brought up sexual assault but it was it was minor on minor but still what is the school doing that it's negligence they're not watching them um But yeah, that's pretty much what I wanted to bring up today and some sort of Investigation I guess would be nice

I touched the computer and it went back Good evening board members, superintendent and fellow community members. I stand before you today as both a concerned resident and a parent deeply disappointed by the recent revelations involving questionable practices within our Chula Vista Elementary School District as outlined in the Voice of San Diego and other respected publications. First I want to address the alarming issue of quid pro quo dealings that have emerged in connection to our certain to certain district decisions. As a district, we expect our leadership to operate with integrity and to prioritize the well-being of our students and community, not to bow to
021interests of a few individuals with influence. These questionable exchanges, where favors are given in return for personal or political gain, erode public trust. It is unacceptable for our district, which is meant to set a high standard of ethical behavior, to be marred by these practices. In addition, the shocking details about Cesar Fernandez as highlighted on dumpcesar.com paint a disturbing picture of corruption and deceit. Not only do we see a pattern of unethical behavior, but there's also evidence that Fernandez misused taxpayer money for personal indulgence. One particularly egregious example is the fact that he used public funds to support himself from a karaoke bar to another bar located at 440 Castro Street in the Castro District of San Francisco. This type of misuse of district resources for personal entertainment shows a blatant disregard for the trust
022that was placed in him as a public servant. I'm chapped by this. For someone who is entrusted with the responsibility of serving the public, his actions demonstrate a complete lack of respect for the community and for the hard-earned money of our taxpayers. Our children deserve role models who exemplify honesty and accountability, and it's imperative that we ensure those representing the district uphold the highest ethical standards. 023spoke to you and expressed our concern with regards to you hearing your plan to fill an empty seat ahead of time. Word on the street was that Cesar was supposed to get the seat, and the plan was then to move. Reyes into that seat. And as everyone can see in the room, that's exactly what happened. Efforts were made to recall Caesar. And in September 2021, Caesar told the San Diego Tribune a special election would cost 1.5 to 2.5 million dollars. Those that seek this as a remedy cannot claim students are their priority. It's funny how that can change when moving your moving your political career forward as an option. In 2022, Caesar ran for election to his seat and was rightfully elected. He raised over 50,000. dollars for his campaign his largest donor was the
024san diego democratic party fast forward to november 1st 2023 city councilman our dan a woman sorry andrea cardenas is charged with felonies essentially making her unelectable andrea was who that same party that gave caesar money to get in that seat had endorsed for the seat caesar then throws his name into the hat november 15th then the san diego democratic party announced they're going to revisit their decision november 21st shocker i can only imagine what your campaign finances are going to look like for this election i should probably honestly just congratulate you now um now you want us all to trust you as you carefully continue your game of political chess i actually had no clue how bad these meetings had gotten shoot i lost my spot hold on um this last year if tamayo is
025successful in unseating kate and caesar gets to the city council which by the way chula vista educators is supporting you get two more seats to fill We know how this is going to go. More endless bonds will be placed on our ballots, just like Measure AA, which is on the ballot right now. It's funny, so many people get caught up in which president to support, hating each other over that, talking bad to each other when they fail to recognize that the decisions made in this room make bigger impact on their homes. As you all know, I recently made one of the most difficult decisions of my life where I had to choose between my
026students and my own child. When the district denied my request for a job share, I wasn't happy, but I also didn't protest because the reality is that, yes, there are rules and timelines for my request. As an exception, it wasn't something that was fair to be considered. So with a heavy heart, I strategically and thoughtfully planned an exit that would minimally impact my students, their families, my admin, and their teammates. How? I completed the data and the assessments. I met with the parents for fall conferences. I provided extra SEL for the transition to go smoothly, and I invested genuine time with the new hire. I resigned on September the 3rd. My position was posted September the 5th, and it was open for the mandated days so that an internal candidate had the opportunity to transfer.
027A whole week went by and no transfer was applied or placed by the district. Since no transfer applied, it was decided the best candidate would be somebody who knew our community well, was a former temp teacher that had previously taught at our school for two and a half years and had a B-CLAD, and most importantly, was a veteran teacher with experience. With everything seemingly in place, I informed my parents and a letter... And I assured them that during conferences that I knew this teacher. I trusted this teacher. And while change is hard, I would be there to support this teacher because she was a former colleague. I did this with the students as well as they expressed their nervous emotions, ensuring that everyone would be okay and that a little change to the routine would
028be okay too. I did this confidently because I trusted the process and protocol. Fast forward to the last day of school. As I was about to leave, sad, but at least at peace that everything was in place, boom. Plan aboard it. New hire moved to another site. Transfer teacher coming in. Information, other than that, completely unable to be shared with me. I couldn't even get the new teacher's name. Nothing can be done. It is what it is. Go home, Jennifer. Rest, enjoy your break, and start your new chapter. Thanks for your service. When has this become what's best for kids? It doesn't seem so. I feel people are not doing their job in this district with empathy and correctly. We're not following protocol. So I would really ask this board to please, if schools are
029being restructured, both formally and informally, why are district departments also not being restructured? There are some departments here that really need to be looked into. They are not following protocol. And also, I'm here to bring this to your attention so that this doesn't happen again. There's so much negativity, personal agendas, our own ideologies being poured into others that shouldn't be happening. Remember, we took that pledge. What does that mean to us? Does that mean, is that just empty words? Or are we going to actually take that to heart? And in doing that, I just want to read this to you out of love. In Matthew 18, 6. But if anyone causes one of these little ones who believes in me to stumble, it would be better for him to have a large millstone hung around his neck and be drowned in the death of the sea. Rules for thee, but not for me. A common saying that refers to the arrogant attitude of certain people that rules are meant for the rest, but not for them. During the November 2022 campaign season, residents of West Chula Vista were very unhappy to see their neighborhoods littered with campaign signs and telephone poles by three Chula Vista elementary school district candidates.
032Numerous complaints were made to the Chula Vista Public Works and other city officials, and we were told what the public could do about this littering, and we did it. But here we are again, another election season with telephone polls, and it's not just a telephone poll here and there. It's numerous telephone polls on a single street littered with the campaign signs of Ugarte and Tamayo. Has not first-time candidates you must be aware of the rules and in case you forgot the rules on political signs the Chula Vista City Attorney sent you all a letter dated October 2nd titled reminder that Chula Vista prohibits private posting of signs and public rights away this letter notes cities of rules prohibit the posting of signs including campaign signs and public rights away and The public right-of-way includes city
033parkways, landscape strips adjacent to streets and sidewalks, medians, open spaces including any fences, utility poles, and structures located therein. And where campaign signs are involved, the city holds the candidate responsible for the violations, and this is the case even if the campaign workers, whether employees or volunteers, post signs on their behalf. Over the weekend many of the signs were taken down and resulted in a much better view on our streets in Chula Vista in the west. But there seems to be reposting of the signs on telephone poles in some areas again after only a couple of days. I've noted in my area that now yard signs are in the ground being posted on public property. You give us parents and students rules that we have to follow. What kind of example are you setting that
034you do not follow the rules of the city of Chula Vista? Your campaign signs are a form of your voice. You limit our voices here by stopping phone in comments and limiting our time to speak. We want your campaign voice via your signs posted excessively on public property and so many of our streets limited to the rules of the city. Thank you. Thank you. My five-year-old son is in the SDC program in kinder class in Wolf Canyon and I'd like to talk about the culture of institutionalized discrimination that this board is seemingly allowed to foster over the years. My son has been in three schools, Burton for preschool, Jeffers for TK, and now Wolf Canyon for kinder. And while these two school changes made
035reasonable sense, what has never made sense is the us versus them mentality that I've seen these schools treat these students with. When starting the school year I went to Wolf Canyon for the district letter indicating to do as such and was immediately told that while my son was registered for the SDC program he was not registered as a student despite it being his second school year because as I was told by the front desk staff SDC is different. When I called the school later to confirm that kinder had orientation that would include my son's class as he's autistic and gets easily overwhelmed especially with a bigger school than Jeffers I was told no. Only the general education kids get orientation. SDC can have it on the first day or not at all. Shockingly, it was
036not at all. Then I proceeded to ask what the teacher's preferred name was so I could prepare my child for meeting this new person. And I was informed by the front desk staff that they don't know what those teachers go by. This is a student, a teacher that was previously there for five years and you don't know the person's name? While in that conversation, I asked what the protocol was for eloping students and was told that eloping students are, and I quote, the teacher's problem and no one else's. I've witnessed myself, my own child, and other SEC children, in fact, eloping. My own son eloped for over an hour before school break. And it was, in fact, no one else's problem to make sure that the children were safe. I could go on and on
037with all the points about how rainy it when it was raining the day before fall break the students had to stand in the rain even though general education children got to stay in the multi-purpose room I could tell you about how the fun run our kids were not included in the dance time because they were forgotten about I could tell you how I last year's Jeffers school thing school trip our children were not included in the tour bus because they were not thought of yet again I could tell you all of that but that would be purposeless because this treatment is only okay because it's okay with the principals And it's okay with the principals because the fish rots at the head. And while my child's behavior is actively regressing because there is no appropriately
038credentialed teacher at Wolf Canyon for over 11 weeks now, and I have asked three different times over 60 days now to have an IEP meeting and have been not responding to in any way, shape, or form, I know that a new teacher is coming, but that will not change the culture with which we're allowing the teachers to treat these other teachers, support staff, and students. 039my concerns and would begin to address the severity of the situation immediately. I appreciate the board members who took the time to visit the campus and I look forward to hearing about their experiences and what their observations were during their scheduled visits. With that being said, I'd like to address transparency within the school and the district or rather a lack thereof. Some examples. I was shocked to hear when my daughter told me about how often They have to evacuate the classroom due to unsafe behaviors displayed by other students. Although I understand why they would have to evacuate, what I didn't understand was why this information was not being relayed to parents. We deserve to know what's happening within the classroom environment. We deserve to know when they aren't learning and when they are supposed to.
040especially due to unsafe behaviors. At the school site council meeting, I was distressed to discover that no emergency drills had been scheduled for our children. Not only does this violate ed code, but given the recent threats, credible or not, we should be proactively preparing our students. Conducting regular drills would help reduce anxiety and panic and increase effectiveness of response should an actual emergency occur. I am deeply concerned by the high turnover of excellent teachers at our school, including two just this past week. This alarming rate of staff departures is unnerving. Even more so, you can only imagine how I felt when I learned that a teacher on campus who led an after-school club and supervised students in isolated areas is currently under investigation for inappropriate touching. Despite these... concerning circumstances the administrative staff has provided

Community designation, I spoke about the high percentage of socially economically disadvantaged students, disabled students, and foster youth. We all need community schools to provide equal access to resources. Has this consideration been under review with you all? For instance, I have been made aware of the unreliability of some third-party aid companies, such as VBA, and of allegations of physical abuse, as well, from that same company. I urge you to consider bringing these jobs to classified as soon as possible

During the IEP meeting, I expressed concerns about the classroom environment and how running away from classes, because he would run out of class and there was multiple times where I would go to pick him up and he would not eat. So I'd like some clarification on what the school sites councils responsibility is as it pertains to Decisions that are made there to how to spend funds and they're the partnership between the school the administration the parents the district so the schools that councils are composed of teachers, classified, parents, and community members, and the principal. And basically the role of the school site council is to see how the funds, the federal funds are going to be spent. And the way they do it is the way the funds should be spent is they should be aligned to
058the school site plan. So there should be an alignment to the school site plan. So first the school site plan is developed It's approved and then the school the school side council funding is used to Pay for for the different programs on That support the site and that includes the instructional aids that noon duty Correct. So it could be resources, it could be consultants, it could be personnel like an instructional assistant or a counselor or a resource teacher. And then that's probably explains some of the disparity we see between school sites and others where some may be a little on the top heavy, I'm exaggerating, top heavy versus not having. much of support so the decision is made by the school site council which is led by the principal well the so two things the

And then like at our junior academies, we had as part of the contract not only the fun activities that we had, but we had two Olympians that also came and they spoke to the kids. So oftentimes what they'll do is throw in added services that we can take advantage of. of so some do and then as we develop long-range partnerships with them of course our lead team is always talking about ways I'm hoping I don't recall reading but maybe I missed it that these programs are also on our lower income schools So what we recently did as a lead team is we did a program analysis in quarter
074one and leading into quarter two to see whether or not we have balance within the programming across the district. Where we have schools that have lower programming, which sometimes does happen on some of our west side schools, what we do is we supplement that program with vendor opportunities. Also remember that our schools receive money based upon the number of unduplicated students that they have, and so they might have... increased budget to be able to provide services and vendors and we're going to have a question about that later as well okay but I'm just hoping to see that there's some equity in some of these partnerships and I don't if you could provide us a list of the different programs and partnerships that are out there for the different schools They are all children. I've shared it before and I share it so that people know that we're victims. My ex-husband's addiction didn't just hurt him, it hurt my children, who suffered in silence. The physical violence, the mental abuse, it all goes hand in hand. Thank God he is now a recovered addict, but my kids' entire childhood into young adults was horrifically affected. We know death related so well as well. Like I said, some children suffer in silence and others act
092out. Thus my persistence in always calling out that there's other children out there that are suffering for different reasons that we know not why. I hope we are able to provide the children with that little something extra just to steer them away from the ills of drug addiction and tobacco abuse. So my question evolves from Is staff provided material they can use that's age appropriate for their grades or is there material that we provide in a resource library or something so that teachers can take advantage of it? Dr. Reyes? Are you talking specifically about Red Ribbon Week or in general? It's the combination of the purpose of the Red Ribbon to help them. to help them understand. Research Council's website and I see that they provide to college and also K through 12 but there's very limited information on their website what they do for K-12 when you look to case studies I found one or two one was about distance learning and so in the drop-down it says they do curriculum and instruction diversity, equity, and inclusion, academic program planning and impact, strategic planning, teacher recruitment and retention, operational planning, school climate, research and insights. And again, even in your additional data description here in the item title, it says high quality research and analytics, but it doesn't really say who are the surveys gonna be on. Is it on employees? Is it on parents? Is it? on the students

We need some more work in these other two categories. It also provides us data on, now, it doesn't have a name of a student or anything, it's just general. data but it does gives us data on particular schools so you know what we gotta put more emphasis on xyz at this particular school
100or in this particular areas so it does support the the district with helping us see what which what are the categories that we are doing well that we need to continue and some of the ones that we need to focus more on again it is parents can opt out. Thank you for being so patient with us. And I will turn to Mr. Romero. Thank you. Acting President Fernandez, Governing Board. Superintendent Dr. Reyes, it's my pleasure tonight to bring forward our first reading of the revision to the CVLCC school petition. We have with us today Chief Executive Officer Eduardo Caballero. Eduardo, thank you. Good evening, Board, Superintendent Reyes, staff, and the CVLCC community and the rest of the community. Thank you. I'm here with my charter board, some staff members, and some families to present the updates for our charter. So starting with CVLCC, as many of you know it was the first startup charter in the district. It was opened
116as an innovative hub for dual language serving as a model to in the hopes of opening further programs throughout the district. And as you know we have several programs that are based off the 50-50 model throughout the district. Our first school opened in 1998 serving in elementary K through 6. As TK was implemented, TK was added. As student achievement increased, parents requested the opening of a middle school. And from there, we went to a high school. So over the course of several years, we were able to span the TK through 6 experience for students, making certain that they graduated with seals of illiteracy and all doors open to them to the future. So our charter renewal process started with stakeholder input. Our advisory committees came up with five areas that were incorporated to our annual
117LCAP survey. We had nearly 500 participants from our community and staff. We had over 290 thoughts and over 23,000 ratings. It was based on a one to five star rating and you can see here the ratings of the five sections that were rated. Most are close to the five and receiving the results and the feedback from the parents. We're looking at sections for effective instructional program. They're looking for more STEM and Spanish support. In the four pillars, social justice focus. maintaining our social-emotional supports and increasing academic supports and enrichment opportunities for students through field trips and athletics. We have our restorative practices, parents asking for more workshops in that area. And for our charter board support, they're actually looking for a new facility for middle school. They want to avoid the over-enrollment at seventh grade
118and turning away students in ninth grade and establishing some sort of parent organization. And so that was our feedback that we took as we went into the updating of our charter. And so tonight I'm going to cover 15 elements. These are the elements that charters must address in seeking renewal. Most of the information within our charter remains the same as our current charter with the exception of a few updates that I'm going to highlight tonight. We'll start with educational program. Here, our accreditation visit, this is for us to be able to issue diploma to our high school students, really highlighted the need for a systematic math program. I'm going to talk a little bit more in the results and what we're doing as we get to the dashboard results at the end. We also further
119aligned our courses to make certain that students were meeting the A through G courses required for graduation and UC acceptance. We also strengthened our community engagement and global perspective enrichment activities for our high school students and The theme throughout this presentation tonight are going to be legal updates It has to do a lot with legal updates and so here in this section There were some updates for students learning English as a second language and those with special needs The next two sections are student outcomes and progress. We had to align with our LCAP baseline goals, which are listed there. And then we also had a legal requirement where we were updating our testing of our students. So now we're including the newly formed California Spanish assessment as part of one of our assessments. Next section
120is governance. Really the highlight here is we made the update that all of our community members serving on our board must reside within the enrollment boundary. We also have changed titles. So for example, mine used to be the executive director, now it's a CEO. And in lieu of principal, we are now using director. And so that's been changed throughout the document. Employee qualifications, health and safety procedures. So previously we only had the required teacher requirements. Now we've added the CEO and director qualifications. We've updated our ratios for TK students and adults within those classrooms. We've updated the background checks that are required by Ed Code now for the employees, mandated trainings, the updating of safety plans on a yearly basis, health and wellness. One of those examples is providing opioid the prevention for athletes and
121then finally prevention education such as suicide prevention and sexual sex trafficking for our high school students we also aligned our teacher evaluation to the five dimensions of teaching and learning framework Next sections, student population, admission, attendance, suspensions and expulsion. Of course, we updated our student demographics, which have changed a bit in the last few years. We are also continuing on our efforts. Really, a charter school must mirror the population which it serves, so we're constantly addressing that and trying to diversify. We also had several legal requirements within this section, really making certain that we were in alignment with the new online process through the district and also specifying the steps in our public drawing for the acceptance of students, which is mostly TK and kinder students. We also had the updating of grounds for suspension
122and expulsion, which are in alignment with new ed code. Next section is a financial audit employee retirement rights and dispute resolution. So here again legal requirements are annual independent audit which is conducted by the district and submitted to the county. We also must provide retirement for our employees and we also found within these sections a duplicate resolution process most likely left over from the previous revision. inadvertently left on so we removed that. Finally we have the closure procedures so previously there were 16 elements the Education Employee Relations Act is now embedded into element 5 resulting in school closures moving down to 15. The new requirements do establish a miscellaneous charter provision and you can see there the different attachments that are within that section. Okay, so two pieces of evidence for meeting charter renewal. We
123have our three-year financial projections. So call your attention to the top section, that blue section there. That's our beginning balance or our carryover. We have the green section, which are our total revenues of state and federal monies coming in. And then our projected expenditures are in pink. And finally, down at the bottom, it is noted in... the black section that is our ending balance and so really something to highlight here is the difference between our revenue and expenditures as we project out you begin to see million dollar deficits and so our strategy at CVLCC was to make certain that we were prudent and strategic with our one-time monies coming out of COVID so that we can continue to continue with lower class sizes additional supports social emotional supports for our students the ongoing years as
124when we project the budget cuts from the state. Finally, we have the California dashboard comparison and so just as a refresher here in the areas of English and math, this is the distance from Met. So for example, ELA, if the goal was 100 points, we are 14.3 points above that. In math, we would be 48.7 points below. And so in ELA, currently we sit at 14.3 points above, which is green. In math, 48.7. I mentioned a concerted effort in this area. We have adopted a new curriculum. We've implemented professional development for teachers and established end-of-year grade level expectations for students, making certain that we're moving towards the green section. When we first started we were orange, negative 63 points. We have made significant gains here and are on track to meet green within the next
125two years. Chronic absenteeism, as you can see here, it is significantly less than our comparisons to the districts that we serve and the state. Suspension rates, likewise, are progress for English learners. This measures what percentage of students are making one year's growth from one year to the next in our graduation rate. And so really it is about that last indicator. Constantly we've been near perfect in graduating seniors. Last year all of our seniors graduated with a seal of biliteracy, all of them were accepted to four-year universities. Currently we have students attending Harvard, Yale, Berkeley, and UCLA to name a few. And that's really what CVLCC stands for is making certain that we provide those opportunities for our families that we serve so that every door is open for them in the future. Questions? We'll start
126with Trustee Dominguez-Cervantes. You mentioned sex trafficking, the prevention of, and you also mentioned, I believe I heard you say, just your high schoolers? Yes. What about your middle schoolers? Yeah, so it's a program that starts in seventh grade and articulates through twelfth, so it's part of the AGE courses that we provide for our students, the adolescent growth. And what kind of experience are you having with that sort of danger in the... the devices internet and whatever you're using to support your students electronically yeah that is one of the challenges especially at our high school and being able to mitigate that our students in particular have to check in their cell phones at the beginning of each period we have little pockets that they have to check them into but we are pursuing a more stringent
127policy where we're going to restrict a little bit more, and that's what I'm going to be following up with our charter board. What do you do with your elementary school kids? So no cell phones, no smart devices are allowed at the elementary school. What if they have them? What do you do with it? So basically, they are taken by the teacher, given back to the parent at the end of the day, and just reminded of our policy. It was a significant issue coming out of the pandemic. Now that we're three years removed from that, it's been much better. And also you called out, let me pull out your numbers here, the math, you were like at negative 48.7. What has it been like in the last two years? Yeah, so we've actually averaged within the
128last two years over 11 points in gains which are significant so anything between 5 and 15 is noted as significant and that puts us on track. Actually our preliminary data shows us at negative 40 currently. 129theme. So units of study, for example. The students will learn about reading and writing skills as they are acquiring the theme of reading about how farm workers are growing crops and making certain that they are selling them at an appropriate price to be able to make a living. Our eighth graders, for example, develop projects that they display that are not only a community connection but also giving back to our community. So we might address some of those inequities for our students that are unhoused or those types of events that happen and so they'll put together that project. In the end our seniors have to put together a senior project where they have to elicit each of those pillars in regards to how it's affected them through the 12 years they've been with us and moving

I'm actually learning more about Charter schools and I met with the California Charter School Association I think it's called anyway, they talked about high middle or low. Is it graded charters? Where are we on this middle middle? Okay, and it's really because of our math So once we have our math squared away in a couple of years, we will be in the high section Great, and I actually had a question about that math score, negative 48.7. It was great to have it within context. My question is, do you have disaggregated data on that? Like which sections of CBO? And you know, really what it is, is that as we transitioned into our... Common core state standards there was an over emphasis on project-based learning and so really it's about
131it's a balance making certain that our students have the skill sets and the number fluency in the math facts along with the Explanation of how to solve problems so that we could have that balanced approach and so within the last few years we've made that Adjustment to have a more balanced approach and what we're seeing is at the elementary level for example kinder through fourth grade students are now uh more in line to what our scores were before and so really it was a big emphasis coming out of the pandemic and making certain we were catching students up so when we're looking at that 48.7 we're talking about a lot of the the impact is coming from the higher grades rather than the elementary school grades okay um and then my last question is What's
132the process for removing a student other than expulsion? Do students have to maintain a certain level of performance to keep their place at the school? There's expectations we have within our charter. They're outlying there in regards to the roles and responsibilities. I would say that as long as a student is making their best effort and we're seeing the student moving forward, we're able to continue forward. There's no expectation or set GPA, for example, that has to be met. At our middle school, for example, students don't receive D's and F's. They receive incompletes and always that opportunity to make up the work. Our teachers offer office hours. We have extended day programs. We provide a lot of wraparound supports for those students to move forward. What was happening before was that we were enrolling 50 additional
133students in seventh grade, which was causing a bottleneck because we only had 100 seats in ninth grade. And so then we had to turn away 50. And so now with the addition of TK for all, now we have 100 students in TK, and we won't have to enroll those 50 additional students in seventh grade. Gotcha. Also when the unhoused are you know displaced that becomes a challenge as far as safety for our kids. So it's more about safety and providing that environment for our students. And also, I applaud you for changing the requirements for the board members to be part of the community that they serve. I

As a norm, how long can staff go without paying their health benefits before being discontinued? This from our information so for for the staff that I made that's a Jenny. I know she's here, but the for staff that pay their benefits for whatever reason that they In addition to her salary the benefits or that all the district money each month to pay their benefits If they don't pay let's say in one month or two months, at what point would their benefits get discontinued? Okay, so that's a great question. There is no automatic discontinuation of benefits. So there is basically at a
145point the district is taking on that obligation. So if an employee has a failure to pay their benefits, it's up to us to report that we need to stop those benefits from existing. So it could be within. We don't have an allowance, so if they're not paying one month, the benefits should stop the next month. Correct. So what we have done in the past for employees is it has been one month. So, for example, if they owe September, they're due September 1st, and they don't pay the entire month of September. By the next month, on the 1st, they get discontinued. Okay. So we do have students who have been identified as GATE in schools, but it is no longer, like Dr. Reyes said, no longer a funded program. Our hope is that we are able to differentiate instruction for all of our students within our classrooms so our most gifted and talented educated students receive the same kind of differentiated support as any other student in class. Since when? It's been a while. I can get that information, but it's been a while since the funding has stopped. Over a decade, yeah. About
14910 years. Yeah, exactly. About 10 years. Okay, and so I'll only read a certain piece of this because that's what was sent to me, and I'm not going to mention names. I'm not going to give anybody the benefit of mentioning names. So in this particular concern that's being called out, the concern is that There are or is an individual conducting GATE instruction. And so if we don't have that program, which is why I asked the questions in advance. If their GATE program does not exist, why is someone teaching GATE? And whoever did teach GATE, if we did have it, do they have to have teaching credentials? Ms. Romero. So GATE is a program and there is a certificate of qualification. I think there is one run through UCSD and I'm not sure if there's another
150one in San Diego. So GATE certification is an extension of a credential. It's not a credential in itself, but it's a certificate of completion of their requirements. It's a branded program. So to teach a GATE. class that's labeled as GATE you need to have that GATE certification. Okay so are any of our members here on the board teaching in this school district that you're aware of in this school district are any one of us or even Ms. Ugarte teaching in this school district? So there's a board member who said was teaching an after school GATE program. However, and focusing on GATE students only. However, I spoke to that board member and asked the particular board member that the after school program could not be for GATE only because we need to, we cannot. DIFFERENTIATE OR
151NOT ALLOW OTHERS TO JOIN. WE SHOULD BE ABLE TO ALLOW EVERYONE TO BE PART OF THAT AFTER SCHOOL PROGRAM. AND SO IT'S NOT A, TO CHANGE IT INTO NOT A CLASS, FROM BEING A CLASS TO BEING JUST A REGULAR AFTER SCHOOL PROGRAM. SO YES, ALTHOUGH THE PARTICULAR BOARD MEMBER DID CLAIM WAS THE I can't remember what the word was. Enrichment. Gate enrichment teacher or educator. That is, it's not being done that way now. Parent I suppose I don't know who this person is I was asking the same thing wanted the same opportunities for all family members So your response is consistent with what this person was asking. 152districts any kind of a after school program enrichment program should be available for every single kid every students so what are the guidelines for that enrichment program because I would imagine that there's guidelines there's a board policy that oversees that what are those For the ELOP classes, the guidelines that we follow are directed by ELOP. So they need to be prioritized for unduplicated students and we need to meet the staffing ratios required by those funding sources. If we do not have students who fall into, who are unduplicated students, we do open up those classes to other students who are on that wait list. So what about it? But what about if it's funded by ELOP, but if the person providing the instruction is not being paid by ELOP because it's a board member, then... Then
153it would be just an enrichment class that we would have at schools throughout our district if it was ELOP Then it would be we were be required to follow those guidelines. So it would be based as a voluntary, correct? so if I'm understanding correctly Enrichments go through ELOP If a board member decides Let's say I want to do an enrichment program What is that process? Do I go through ELOP? Do I go through you? Do I go through the school? Do I go and put a tag? So that's where it gets complicated. That's where it gets complicated. And I think that's the follow-up that we need to do. Because then the question that I would ask is, well, are you doing this as a board member? Are you doing this as a parent? Are you
154doing this as a community member? Now... if you're doing it as a parent or community member that it would be paid since you can't get paid because you're a board member then that's when it gets complicated. The other component is how is this being offered? Is it going through the principal? Is it something that the school needs? And if it's something that the school needs and the principal says, yeah, I think we could benefit from this, then it gets complicated because of the power dynamic of being a board member and possibly a community member or parent. Right, because if I show up to Morooka tomorrow, which is my home school, and I say I want to teach something or open a program, I don't expect the principal to tell me no because I'm a board
155member. So if there's no restriction, can I show up tomorrow and teach robotics? Because I could. Or could I say, and here's the other thing, right? It's not just me showing up tomorrow and saying, by the way, I'm going to open up a class to teach robotics after class. But I also want you to open up a space and buy me all these things. Are they going to say no? Am I imposing influence because I'm a board member? So what are those regulations? Because it's not just a parent, right, showing up. Like no parent from the community can show up and say, I want to teach. No one. In fact, we have so many red tape to volunteer, just to volunteer in a classroom. So can I show up and create a robotics? No, right?
156Can I get paid? So no, you will not get paid. $50 an hour, come on. So you will not get paid, and that's where it gets complicated, because as a parent or as a board member, however, part of what legal said is that being a board member supersedes being a parent because there's that power dynamic. It's the same thing of me being part of the PTA, right? As a board member, I sit here. Could I be part of the PTA leadership at the school? Maybe, but that's a gray area. So I think the question is the board. would have to because it's a board member or it could be a board or for board members for board members then the board would have to to let me know uh the the the route in regards
157to or the the criteria so for example do you as a body Are you as a body okay with A, B, and C? Are you as a body okay with one of you doing an after school class or a Saturday class? Are you as a body okay with you doing certain things at a school site or school sites? May I interject or ask? I don't know that it requires a resolution, but I believe that us board members should be held to the same standards that it comes when teaching our students. Any other teacher, we should have the same requirement. I'm not a teacher. I can't teach. So that would mean that we would need to develop policy or an administrative regulation of sorts on what is allowable as a board member. to do because there's
158a there's a there's a role for board members and that role while yes we continue to be parents we continue to be community members there's a hat that even though we can pretend to take it off we can never take it off we're board members walking into Costco we're board members walking into anywhere and that perception carries influence. So I would suggest to Trustee Dominguez to maybe look into developing policy on what are those guidelines, what can a board member actually do outside the role of a board member because it creates very much of a gray area. individual board members like myself can be allowed to go and walk into Morroco tomorrow and open our robotics club or tell them that I'm opening our robotics club. 159very nebulous conversation. I know. Like we're all so confused about who we're talking about. Okay. So just to clarify some things really quick. I ran ran past tense a gate program at Clearview Elementary School where my children went to school it predated my time on the board I want to say that right now In 2020, while I was running to be a member of the board at that time, but prior to that in 2019, I was a school site council member, and I was seeing the school site council agendas come through, and GATE was on the agenda each time. And each time, it was on the agenda as, hey, do we have anything for the school? No, we don't have a teacher to teach it. We have nobody to step up to take on that
160role. And so at that time, as the parent of a gifted child, and as a person who benefited from the GATE program as my own child, as myself, when I was a child. I said, I would like to create something that creates additional enrichment for these students because I, as an underachieving gifted child, was frustrated by going to school and feeling like I wasn't given enough enrichment. I was one of those kids that fell through the cracks because I didn't feel like school had something special for me because I thought. you know, because things were too easy for me or whatever. I believe that gifted children are special needs children on the other end of that bell curve. And we can have that debate all we want, but it is from my own experience and
161my experience as my mother as a gate coordinator growing up. She was the gate coordinator for Capo Unified, Capistrana Unified. So I am very, I have a lot of... background in gate programs and I felt that we needed to address the needs of our gate children at our school in a quasi informal way because I didn't want any money for it. I wanted to volunteer. I was a consummate volunteer. I was on the council of PTAs. I did a lot of volunteer work. So I said. What if every other week after school, we had an hour and a half where gate identified students would have a place to go to get additional enrichment, something that would drive them to want to go to school. And it was implemented during COVID shutdown. In fact, when we
162first started the program, it was on teams. And what we did was we invited people from the community. to come in and share something that they had expertise in. It was more a coordinator of different external speakers. But at other times we were also doing enrichment programming ourselves when we were unable to fill the spaces. So this program, again, predates my time on the board. I have never gotten a single dollar paid to me for the work that I've done in this. capacity. I will also point out that I actually have my CBEST. I did get my CBEST, I passed the CBEST test so technically I am The state of California says that I can teach in classrooms if I need to. But finally, I want to say that because this issue was brought up
163as a potential issue, we addressed it. And I went through the process of becoming an ELOP. An ELOP, I guess, is teacher the right word? What's the right word for an ELOP? Instructor. Thank you. I applied as an ELOP instructor and just and again the class was opened up to anybody that wanted additional enrichment and my position as an ELOP instructor I just refused the money that would be offered to me as an ELOP instructor and I will point out that this is not without precedent a previous board member Leslie Bunker used to work as a substitute teacher on Fridays at at a Harborside for most of her time on the board. She volunteered her time as a substitute at Harborside. So it was not without precedent to actually do volunteer work on campuses and
164I believe as a member of the community, as a parent, and as a person that cares deeply about trying to make sure that gifted kids have enrichment that I have, that I am moved. to create this support for these students that are otherwise unsupported. And again, the class is for anyone that needs additional enrichment through the ELOP program. And I will say when we talk about money spent on the program, over the course of the 2020 to last year, I averaged less than $200 a year total for the program. It was literally just paying for a couple of like, what do you call it, like materials to like create. Building whatever trustee Bishop. I'd like to ask you to not say anything else only because there's documentation in here of you reporting to work even
165as of last year as far as logging in so I would recommend that you guard what you're saying only because it would contradict the paperwork and I'll leave it at that and I know you got your see-best this last year or this year right last year Last year. Right, so under the California Commission on Teacher Credentialing, there's a minimum requirements to ensure that our guest teachers meet the minimum requirements for providing instruction in a classroom. uh a c-best is a certification after you've completed a test i don't want to talk about the grade levels but some say the tests are about the seventh grade level um and then that allows you to be a guest teacher in in a classroom it's not a credential it's not an acceptance of qualification it's not an interview it's in no way in shape or form equal to what a credential is it's a minimum qualification that allows you to be
167a guest teacher in a classroom Also, Trustee Bishop mentioned that she has enrolled or somehow applied to be a LEAD instructor. That's right. A LEAD instructor? Yeah, for ELO. Yes, I went through all of those processes. I got a TB test. I did all of the processes that are necessary to be a volunteer on campus, and I did that many years ago, in fact. Mr. Romero, when we first got the scan in the district office, I was one of the beta testers for that. I got tested for that a long time ago, and I encourage my fellow board members to go through the life scan process to see. I'm just saying it's not part of requirements, which shocks the heck out of me, and I would like to actually address that as a
172board policy to have that we have to go through the life scan process officially. I was officially life scanned. Everyone was life scanned. Yeah, we were. All right, now I'm going to prolong this. So I saw some agreement over there that... Anyone can volunteer and be a lead instructor through ELOP in this district. Anyone. You don't have to be a classified member, a certificated member. You don't have to be an employee of this district. And Mary's over there like, I'm one of them. Is that right? Is that well advertised? Correct. So it could be. Ms. Morales. Correct. So to be able to capture the different instructors that we would have to provide different areas of expertise. Because remember that with LEAD, we have not only academic offerings that we do, but we have sports. We

And, you know, so you don't necessarily have to have a teaching credential for that. However, if that... program does want to be added to the lead offerings at the school site they have to go through the same process of submitting a proposal aligned to the guidelines that we have with learning objectives activities they have to then be onboarded for our human resources department have fingerprints and everything like that so we do have a variety of different community staff classified as well as certificated providing classes in our lead program Are they then employees of the district and they're getting paid? They are getting paid. We do have, they will be getting

Now, I'm assuming that if I want to do an academic enrichment, I'm a parent, I want to do an academic enrichment class for math or for history, social science, for fifth grade. Now, because it's an academic enrichment, wouldn't the curriculum that I teach be vetted by someone from the school site? Correct, or it would be vetted also by our lead program. Our principals are the first pass at that, then the proposal gets
175submitted, and then we also check it at the lead program. So then if it's curriculum enrichment or academic enrichment, then it's not just the principal but also the lead? We have the coordinators assigned to school sites and when the proposals come through, they also look at what materials and supplies and resources are going to be used. But the vetting of the actual materials starts at the school site because they know the resources very well. We're just looking for allowable expenditures and programs that we want in front of our students. I had a motion and he clarified. Well, I got a lot of questions. 177the software updates the database With the alternate names used by children if they are trans if the child uses a different name at school My colleague was concerned that the software outs children to their parents. It was clarified by our staff that there was coding or workaround inserted to prevent parents from having access to that information. And I know my colleague's position is on that, and she makes it very clear she's not shy about it, but I'm not shy about mine either. And I believe in parental notification. my colleague goes to other school district to protest parental notification policies but I want to be clear that we all know what the vote before us was the vote was solely the approval of the power schools contract power schools software does what it's supposed to do
178the issue was not about adding a code to prevent parents from knowing by what name their child goes by at school, it was solely about the contract. So I voted yes to approve the contract. I am of the position though that parents have a fundamental right to know everything about their child. 183as we got it, we actually sent a group of folks throughout different sites to monitor the air, test the air. It has ranges, so it didn't go to any range that is reportable. However... Part of the information that we received is that we have to test different times because it could be They could be there with the wind. It could be the weather. 185month because teachers and you know everyone was on vacation but I did participate in the CV PD Chilvista PD's police foundation they're showing sock drive that they had that sergeant Natalie Caseres told us about when she came and it was really cool Do you know that Solo Shoes that's right there in that little Broadway Palomar Plaza? They partner with the police foundation, and they only make a titty-bitty little bit of money, but we had about 240 people come through and got shoes. The majority were from our schools, and they have a wonderful process they did, and I don't know which schools they came, but... It's really humbling to stand in those lines and help the community that really needs it when some people have a bazillion shoes in their closets and in their parents' closets

188is a growing concern of mine. what would I call this excessive severe student behaviors and traumas and I'm I'm certain it's not just at those two schools so I will just want to reiterate that we as a district need to be more vigilant and proactive about dealing with this deep concern of mine so thank you for that and on to item 16 superintendent communication dr. Reyes So I think it's the first time in a year that I get to do it. You're lucky. Yeah. So the week before break, I had an opportunity to attend a conference slash training. in Chicago with different superintendents from different states. So there were two or three superintendents per state from throughout the country. And it was really, really interesting. I wasn't really sure what to expect. I thought it
189was just going to be a conference and breakout sessions. And actually, it was a great opportunity to just... to do the training with different superintendents on things like crisis communication, communication throughout the district, working with the different stakeholders and communities. And we worked on different scenarios for different districts. And there were districts, most districts were much smaller than ours. But still, you get to see that regardless of where they are, I mean, Minnesota, they were from, I mean, all over, every single, all states, that educational issues are the same. So the issues that we're facing here and some of the challenges and some of the things that are happening here that we think that we're alone in this work to continue to improve the educational opportunities for students, they're the same throughout the country. And
190so for me, I really appreciated the opportunity. to learn from others and to be able to share with others what is working well. And I also felt really proud because yes, I do recognize that there's things that we need to work on. But I also by speaking to superintendents from many other districts throughout the country, all the things that we are really excelling at and how we are doing things that are honestly, way above what other districts are doing.
