I'd like to call the Inland Wetlands Water Course Commission for June 17th, 7 p.m., which is a special meeting tonight, which from our perspective means that we cannot add anything to the agenda under agenda review. We might be able to bring up something, but it will not be dealt with tonight because it is a special meeting. First order of business is attendance. Stephen Molinelli, chair, present. Okay, and Mr. Malinelli if Appropriate I would like to make some remarks based on remarks that were made at the last meeting by 59 East Lake Street and 61 East Lake Street I'm not aware as to how The Commission works, but I would like to make some remarks and I do have Some photographs that I've sent Shane to City Hall to

Okay, fine. So long as they're objective and they're not reflective on the individual who said them. Well, I'm just concerned about the facts. Yes, yes, sir. Okay. Before we begin, talk to me about your project. So, sir, the project that we are looking to do is actually add a dock 40 feet long, four by ten, four pieces. And that is because initially it was three. Pieces by now it's four by ten four pieces mainly because what is there right now is Ready to fall in the water Which is really called a deck dock. It's just really on the wall and we want to just replay Remove

007that and have the new dock go from the wall out into the lake. How many waterfront do you have? I have 25 feet sir Okay. And I have 10 feet plus, you know, 10 feet or more on each side, and the dock is 4 by 40. Okay. I have a question of you. Sure. In my visiting the site, what I saw were two stakes in the ground identifying the littoral boundaries, and both stakes seemed to indicate that the littoral boundaries were approximately 10 feet apart. Yes, sir. Yes, sir. When you go out further into the water, how do you get from 10 feet to 25 feet? I'm not sure I understand the question, sir. We do own 25 feet of property, and when the surveyor surveyed the property, we meet the littoral borders of 10

008plus feet each side and the dock in the middle, which is 4 feet. I didn't see anything indicating where there were stakes at the water point indicating your property line. I didn't see any of that. Well, if we could just look at a surveyor. Yeah. You know, again, I did not survey the property. It was there since 1987. And there was a dock there since 1987. We bought the house. Harris, they go on the lake, show me the house. We bought it in 1999. I had a dock. And your survey will show 25 feet on the water. Yes, sir. Okay. And, you know, we did not have an earthquake that moved the earth plates. 25 feet are still there. And we went from 10 feet to 25 feet either. So I understand what you want

009and what you don't. So we had 25 feet. And we have the right-of-way, which is a little bit over 10 feet, go from our home. The right-of-way. The right-of-way. Oh, that's the 10 feet. That's the 10 feet. Yes, that's the 10 feet. And then when you get to the water. We have 25 feet. Sorry, I misunderstood the question. Okay, that was my confusion. Yes. But is there anything, because in visiting the site, I didn't see anything that indicates your littoral boundaries on either side at the water. Yeah, well they were set back what like eight six feet or so. I have a picture do I was there today? So like the stakes are just set back from the water. Yeah, they're not essentially on the waters. 010was just gonna clarify the point between the easement and the actual property. Okay, so it is. The easement is about ten feet wide. And the property is 25 feet. I think the question last month was the line going out into the water. Yes, go straight out. They're saying go straight out. Yes What our question was was needed something showing the tutorial lions going out into the lake to make sure you have distance Just that shows correct. Yes. Yes, this is like this is showing what it is, but the argument was on this plan that they have, okay, but the neighbors aren't agreeing with this plan. That's how it went last month. 011right, the commission has a right to ask for a public hearing based on interest or concern. Technically, okay. I don't believe a public hearing was asked for last month, but I think if there's enough of a concern this month that I would like to open it up and suggest that we do have a public hearing and the public hearing would then take place next month at which time anybody who has interest in the outcome of the property or the application can speak in a public hearing. Pro and con either way. So we can't do that. Am I correct? You can do that. Yes. Okay. We did though. We did, you know, I know you kicked it around. We kicked it around and then we decided I, there may, I'd have to look back at it

So, sir, we have had a dock there since 1987. 25 feet, and this town has not changed regulations. You have 25 feet waterfront, and you can now build a dock. Four feet. actually five feet, but ours is only four feet going into the water, four by 40. And we had the doc surveyed again by the surveyor. We had to survey it twice. Because it was said that the first survey was incorrect. The surveyor was questioned. But one of the

013neighbors, sorry, it's not a neighbor, it's one who lives on 59 East Lake Street. Because a neighbor has a positive connotation to it, sir. And if I may say. I said talk to me about the facts, not your opinion of your neighbor. I am talking about the facts. Go ahead. So the survey was surveyed. I mean, the property was surveyed again. And the editorial lines are right there. They provide us what we need to build a 40-feet long dock. and the surveyor put in writing number six in the survey that he stands by as a certified surveyor of the state of Connecticut. He stands by the survey and the littoral walls measurements. That has meaning. I mean, when we met the last time, that was what I understood, that if the survey shows that the

014littoral walls are there, and they are correct, then there is no issue. Now you have asked me not to say anything about comments made last week, I mean last month. I said you could make comments about the issues that were raised. Yeah, so may I also show, sir, that one of the issues that was brought up last time was that we did not have a doc. Oh, some doctor made a 61 East Lake Street, made a comment that we did not have a doc. And I've asked Shane to have photographs. Sir, if you look at that picture, that is my doc in 2015 when the person on 61 East Lake Street bought the house. that is right from realtor.com. Can you arrow his doc please? Yeah. Okay. From realtor.com in 2015. Actually if you go

015on realtor.com right now, 61 East Lake Street, you can still see those pictures. No problem, the doc was there. As a matter of fact sir, my kids grew up on that doc. And my daughter, who is a leading environmental attorney with 1,600 attorneys in New England, knows nothing about this because she would be extremely upset. But you could see, sir, that we have a picture of the dock that was there when comments were made by 61 Lake Street that the dock was not in existence, was dilapidated, was just a structure. There's also another picture sir of my doc and the other two docs sir Jeremy I think you have that yet. No, not that one We will use that one if I'm allowed to there was a pitch that shows all three docs in 2015

As a matter of fact, the 61 East Lake Street said there was no dock. And there is 2019. There's my doc. Okay, I understand that now. Okay? Yeah. May I go on? Yeah, please. Okay. So the doc was there. The surveyor who surveyed our property twice said that he stands by his survey as a certified surveyor in the state of Connecticut. Yes, sir. They just want to eliminate the one in the middle Which happens to be the only African American woman who wants lakefront property in Wednesday the Highland Lake. Well, we have sir the objective

019a doctor with Hartford health care And I'm going to stop all my affiliation with Hartford Health Care after we get the attorneys from New York, from the Office of Civil Rights on this, sir. Because I have to tell you, what was supposed to be cut and dry last time, my wife was dragged into this. And we will go to the bottom, all the way to the Supreme Court if we have to, sir. You are telling me... The lies were told by a doctor whose character is on the line here. He said no doc existed. I mean, the Dicara shows a doc exists in 2019. Pictures in 2015, sir, shows that my doc was right there. And actually, all three docs were right there. One of the statements I was going to make before you... elaborating

020on things that should have been said. I'm not a happy person right now. Neither am I. Number one, if you have 25 feet of waterfront... I do, sir. ...then you're entitled to a dock. Yes, sir. Okay. The question now becomes the position of the dock in relationship to the littoral boundary of your property. And the surveyor did that, sir. He drew the map of my dock going out into the water, sir. Okay. So that's, you know, that's factual. Yeah. And, sir, are we looking at someone having 35 feet, somebody else having, let's say, 36 feet of front property, being more important than my 25 feet? My 25 feet of water property, sir? That's not true. I'm just saying. I don't mean to cut you off, but nobody's. We're just trying to interpret the laws here.

021But, Mr. Davenport, the last time you said very clearly. that you're not singling us out. And I'll be very honest with you, sir. My wife and I feel nothing but singled out. And I'll tell you, sir, people living at 61 and 59 East Lake Street have ulterior motives, and we will go all the way to the Supreme Court, sir, because their motives have nothing to do with facts. And you know, Mr. Malinelli, I know you were a school principal at one time, and so was I for 30 years. How do you know that? I know a lot about everybody around here, sir. My attorneys know a lot about what's going on here. Okay? And as a school principal for 30 years, and as a college professor at the University of Bridgeport for 12 years, and

022as a director of border education supervisors, I'm no dummy. I know I was born at night, but I was not born last night. And you know, I owned that home for 20, my wife and I owned that home for 27 years. And all of a sudden, two people who disliked one another, one said to me, Joe, I wish, okay, I'll be glad, sir. Let's stay with the application and how we can accommodate you or not accommodate you. Yes, sir. But if my surveyor took the darn survey twice. And everything fits. Why doesn't this fit because of 61 and 59? I'm not saying it doesn't fit. Go ahead, Matt. I'm just saying we're getting way off tangent here. I'm sorry, Matt. We had asked you to verify the littoral boundaries at the last meeting. You did

023that as requested. Yes, sir. So they verified it. Joe came in. He made the notes. Everything's good. So with our regulations, he's got 25 feet. He meets all his littoral boundaries. I think we move forward with this application. And I don't feel there's a need for a public hearing. Because there's no encroachment on the littoral boundaries, and he is entitled to have that document. Any contrary opinions from what Matt says? I agree with that. I agree, too. It's a very straightforward. We asked him to present these things, and they did. Okay. And the question with the littoral boundaries, just for everybody's... information it really comes into play. A littoral boundary is an extension of one's property from land into the water and it only becomes a conversation worth talking about is if we're in a

024cove where the boundaries, because of a horseshoe shape, go to a particular point out into the cove, and they overlap each other. In visiting your site today, you, in my opinion, seem to look directly straight out across the water. So we're not in any cove. Is that fairly accurate? I agree with the surveyors. Okay, so the only question I now have is the positioning of your dock within the 25 feet. Talk to me about that. It would go 10 feet on each side, and it would go straight out. And if you look at the survey, sir, it's right there. Okay. I mean, the survey is the one that I paid to survey. And, Mr. Malanelli, this is a different picture from the other one, Jeremy. This is the current survey that came with this application.

025I pulled up an older survey just as a reference point. This is new as of yesterday. This is when the surveyor looked at it again, gave it a second opinion, redrew it, and also made a note that the existing wooden platform, I'll call it, that's there is going to be removed. This is not in our folders now? I don't know if it's in there. It came in yesterday? The positioning of the dock is the same as it has been for a month other than that wooden platform being removed. Okay. Mr. Malinelli. Yes, sir. When you have a second, I just want to add one more item. I see 10 feet 0.15 on one side of the dock to the littoral boundary and 10 feet 0.06. So you have just a shade under 25 feet on

026the waterfront, it looks like. No, sir. I have a little bit. I have 25 feet. Well, if the dock is four. and 10 and 10 are 20, you got 24 and the .15 and the .06 don't add up to another foot. That's why I'm saying you have just the shade under. All right, anybody have, Gary, you have any problems with this diagram and the numbers? No, no, no. You know, it's on a skew. So Using your doc as an example, can you go back to the other picture? And I'm going through this explanation in hopes of alleviating other people's concerns that aren't speaking about their concerns, but I just want to alleviate them. For public information, the doc is... Its location is in the middle of the 25 feet. Right, sir. Which is appropriate. Yes, sir. And there's 10 feet on either side, give or take an inch or

029two. A boat can be parked in either of those 10 feet. Yes, sir. You cannot, the applicant cannot ask for a boat lift to be put in there. Because that becomes a structure as opposed to a boat. So you could park a boat, you could park a jet ski in there, you could tie it to whips, but you cannot put a device that holds that boat lift, that boat or jet ski secure to the dock. Yes, sir. If I may say, sir, the eighth graders were able to say, Mr. DeLucci. We all park on the left of the dock. There is no navigational hazard if you look at that the three dogs If everybody parks on the left nobody has to run into anybody Navigation has it becomes when you go in and out of

There was a point made about navigational concerns. There is 61 East Lake Street. There is 59 East Lake Street. I'm right in the middle, sir. They're both pointing right at me. Dr. Vellucci here, my wife, and myself are two little birds, wounded birds, locked in a cage. And for some reason, sir, I do not understand why. 61 and 59 make a point that my 25 feet are worth less than theirs when they are pointing right at me. Why aren't they straight? Whatever the reason, I'll be able to work it out. I'd like to just say quickly this. One has to do with what

031you were saying with parking in the littoral and navigational hazards. I kind of looked at DEP's definitions of navigational hazards, and I really see them as, Not so much as parking issues, right? You can go down a slip. I've had to go down Where you had to park the boat on the right and left and you have just that center line going down like it's tricky It's hard, but people do park in very very tight place. So I don't think of this as navigational hazards It's just it may be challenging parking You know, that's really how I think. In terms of being singled out, please don't think we've had men. Hold on, please hear me for a second. Yes, sir. We've had many, many neighbors from people from all over this state and country and

032different countries get into very similar tough discussions in front of this board. I don't think it has anything to do with where anybody's from or any race or anything. It's just you're condensed in a tight spot, and it's tough. That's how I see it. Black and blues on my leg, so may I speak tonight or not? All I'm saying is no one's signaling anybody. Unless you have anything new to add. I have one more thing, sir. Because I cannot see, sir, there is a rock in my 10-feet walkway. If I fall and get hurt on that rock, I'm gonna own that house. And I also need to say to you, sir, there are railroad ties on that walkway that are like two or three inches above ground. That if I were to fall and get

033hurt, I'm gonna own the other house. That is a promise that I will keep if it costs me millions of dollars to accomplish my task. I, as a disabled 72-year-old man, Should be able to walk freely from my steps to my property without a rock there, black tarpets in a way. I put calls, I received some message, not all, but this black tarp has not been removed. I asked the neighbor, sir, two or three months ago, can you please remove that tarp? The response was no. What did you do for a living before you retired? An educator, you ever learn from no means yet? Call my lawyer. Hangs out the phone. I've been treated like a second class citizen, sir, and so is my wife. I want what is mine at the right time, which

We're talking about what's in front of this commission and not very much else of concern. We got the latorial lines on it, and we did actions with the other plan you have. John, the car, as it solidifies, that's what the latorial line is. Okay. Are there any additions to approval? I'm here representing the Mickelsons on their dock replacement. Okay. I don't know. We went over this. I know you weren't here last time. They're just looking to replace their existing dock in its exact same... Shape, fashion, everything. Exactly where it is. It's just deteriorated. It was permitted in 1999 by the commission and approved in its current location. They're not looking to modify or change anything other than just replace the rusted structure. In order to replace the rusted structure, you're going to have to remove the dock? Correct. And you're going to need a regular drawdown or a deep drawdown? Regular. Regular drawdown. Yep. Okay. Are you going to

039be any stockpiling of material or anything? No. What are you going to do with the dock while it's out of the water? Where are you going to put it? We'll load it on a truck and take the old one away and then bring a new one in. It's going to be built in three modular sections and we'll bring it in because... So you're not going to put the top back on. You're going to put a whole new dock in. They're going to replace the top, yeah. They had looked at that, but their engineer determined that it wasn't worth the effort to just replace the top when they put the new structure in. So we'll take the old one out, remove it, and then put the new one back in. No bolt lifts, no nothing else.

040Just the dock itself. Just exactly what's there. Same size, same location. Everything. Same structure. We had the structural engineer review the old plans, and he just updated the drawings, but there's no changes. It met the code, and he had no issue with it. Anybody? No. Cut and dry one last one. Cut and dry last one. What are the I-beams underneath? Rot it out? Yeah, there's holes right through them. Yeah. And you could do it with a shower drawer down? Yeah, it's up on a rock in the back, and the legs and the piers in the front and everything were fine. They're all concrete. We're reusing all the existing piers, everything. Okay. Staff, anything? 061water around that lake, we have a lot of drainage plans for. Here, I just see somebody backfilling an area with debris, nothing. We're working with that applicant. We're out there a lot more than we even want to think about. Then why don't we just put a stop board on and have them come up with a drainage plan for it. They've engaged an engineering firm to work through the process. We have been in contact with them that all the work needs to kind of stop for now until the engineer is able to do what they're going to do. They were about to move forward until we realized that our zoning regulations weren't quite up to par in terms of marina uses and what they want to do out there. So we've got sort of two things

And the Planning and Zoning Commission is in the process of fixing a portion of their regulations, which would then allow the marina to kind of move forward, which will get them in front of you, get them in front of the Planning and Zoning Commission.
