001okay uh we are going to start our Tuesday November 12th 2019 regular meeting of the governing board at 7 o'clock um roll call um all members are here mayus miss Frank and we will stand to do the pledge e president Ordway I move to adopt the agenda I second all those in favor I I I governing board governing board reports I know have okay Darcy do you have it Miss Tweety Miss Reed I hope everybody enjoyed their um their fall break and um their um Veterans Day weekend um congratulations for making it through the first quarter and parent teacher conferences um thank you to all of our um staff and teachers who um stayed late on the days to accommodate um parent schedules and thank you to all of our PTSA um PTSA around the

002district for providing um dinner and snacks for our teachers I know that that was very appreciated um I'll make my um report quick just wanted to touch on um some of the amazing things that happened um over the last couple of weeks um Senator Heather Carter was able to um go to Sandra de Conor high school for takee legisl to school day and um the administration and the teachers were able to show off some of the signature programs that were available at o'conor um and then um councilwoman thelda Williams from um district one was able to do a school tour at boldwater high school and that was the first time that she's ever been on campus um so it was great to just be able to show her around and show her some of the

003signature programs that are in her district and um so she can see what an amazing school that is um for the students who live in her area so I just wanted to say thank you to those two elected officials for taking time out of their day to visit two of our high schools this is O'Brien um it has been a long time since we've been together and so I've missed everyone but there has been a lot going on um and in addition to thanking um Senator Carter and uh dist uh councilwoman Williams for attending our schools and and for w to attend be able to go to other schools I'm very excited um thank you for all the celebrations honoring our veterans this last week we had some amazing celebrations um I'm going to let

004I won't steal all of Dr Finch's Thunder but I will say that this morning um I was able to attend a panel discussion with some legislators reg regarding Workforce Development and it was very refreshing um to hear them talk about how the important role that K12 plays in that and how um Senator Carter will again Ask for CTE funding for nth grade to be brought back um and even had some talk a little bit about taking that down into the junior high levels that we really can't wait till high school that these kids need to be able to um experience some internships and some opportunities and exposures to different careers um prior to getting into High School even and then some additional talk about um some organization Statewide organization on how we have access to

005the resources available and to get our kids connected with the business community and and our schools connected with there as well so that was um an incredible discussion to get to to be a part of this morning and she did highlight her her tour at sander day o Conor and the great things they're doing there with um the different CTE programs um and with that we have a packed agenda so uh congratulations on the end of the first quarter and here we come holiday break and I have no board report because I can't speak Dr Finch all right I'll cover it for you I have three things I wanted to mention uh one is uh we obviously in the word ceremony honored mountain rids high schools uh band success they did win the State title

006uh for class 4A uh last Saturday and that puts them in the round of super eights and so the super States is on Saturday at GCC um we have three bands three of our five are in there and our other two just missed and so Deer Valley High School's at noon on Saturday o o Conor's on at 7 and Mountain Ridge is on at 8:30 so um if you can get to those that would be good and yes we did have teacher the year at esparanza an e teacher and the Name Escapes me at the moment Eileen yeah Eileen she um and we're GNA be honoring her at our next board meeting as well so she got um introduction from Kathy Hoffman the state superintendent was there so that was neat at that celebration and

007timed it with the veterans one as well so uh second thing I wanted to mention is that we've done again dear Valley did well with her a merit scores as you remember last year we were ranked number two in the state by KT as the second best District in all of Arizona and I fully expect that we will be ranked number one after that performance um we just uh outstanding thanks to our teachers principals students uh stepping up and showing uh their skills and we saw again tonight bunch of 30s and 34s and 32s on the act as well so um you have extraordinary students here with quite the range and uh be able to almost score perfect on the on the ACT is a big deal last but not least we want to thank

008our communities for our bond and override U that was a positive uh Mo forward momentum for Deer Valley we're headed in the right direction and that will obviously Propel us into the future so um want thanks thank our community again for that so uh we are definitely headed in the right direction it's fun to be part of Deer Valley thank you and we have the the finance report Mrs mock good evening Madame President members of the board Dr Finch and guests I am pleased I continue to be pleased to bring you the enrollment report for the district as of the end of October we uh continue to show an increase in students of about 05% over the same time last year it's about 100 actually more than we're looking right now at more than 100

009more kindergarten students than what uh we had over this time last year with that we do want to give you the reminder that uh those kindergarten students uh we only receive half of the you know 0 five funding for those kiddos compared to the other students um so we will see the the uh continued benefits of those next year when we receed that full funding for those kindergarten students I want to point out to you as well something that would be different from the report that we shared with the board at the board meeting back in October is between then and now we found an Omission in the report where we had inadvertently left off some uh students from Desert Sky specifically in this report and once we got them uh included in this report

010we uh that's about the time we tipped to 0.5% uh whereas before we were showing about 4% increase in students so we have any questions about about the enrollment report at this time no questions okay he and your financial report absolutely we are let me open it up over here I apologize um we are not showing a lot of difference in the M budget report from October um excuse me that we reported in October for September to the October report we're trending up just a little we're projecting about just over $300,000 and carry forward at this time and um with the the trends in special education tuition we are expecting uh just to go over that budget just a little bit at this time um but otherwise we are seeing Savings in Staffing and other

011areas for an overall uh projected budget carry forward of $332,000 and I'll answer any questions about that report any questions board members thank you so much Mrs mock so next on our agenda is a the human resources report from Mrs Moffett good evening to president Ordway when she returns governing board members and superintendent Finch might not if she yeah um I am happy to have the opportunity to share with you the work that we have been doing over the last couple of years around the idea of Engagement in Deer Valley first of all I'd like to go back um probably around a year and a half to two years we spent time with Deo looking at the Strategic plan and in anticipation of rolling out the new plan and in priority area to always has

012been our Focus around Workforce we knew that we were going to need to be spending a good amount of time around the idea of Engagement so we pulled out um out of the Society of Human Resources management this idea and I'll read it to you um that our strategic plan is Advanced by creating an environment that promotes positive relations between employees and management that seeks to balance the needs of employees with those of the organization and that is marked by greater Employee Engagement taking on this idea we knew that uh development and understanding around the idea of Engagement was going to be critical in our district and that helping our employees and our leaders understand the delicate balance between employment needs and and what our organization was trying to achieve and of course that is

013student wellness and student learning so our um board did adopt our recommended strategic plan and we focus our engagement strategies around priority area 2 healthy District culture fostering a district culture where employees are engaged in their work and have a desire to stay within the dbsd family well you can imagine no matter who you ask they're going to have a different definition for what Employee Engagement is so our district adopted the first bullet you see in front of you and that is in the workplace engagement refers to the degree of positive emotion a person attaches to the organization to their job and their colleagues this has been a nice definition for us to use specifically because we can um pull it apart into those three categories if you were to take time and look at

014um employee satisfaction surveys whether it be Gallup whether it be hours or any other agency that puts out an engagement survey or a satisfaction survey you're going to see questions that are specific to those three things we do want to know how are employees feel about the district overall the relationship with us their desires and their needs and are we satisfying those also their relationship with the specific job that they chose how what does that look like at that period of time when we're um evaluating or asking them to provide input and most often importantly the most important thing that tends to come to the top is relationships how our employees feel about the people that they work with and the people that they work for so second to that um to further the definition

015we know that when a person is engaged they're attracted to the organization or to their job or to their colleagues they're inspired by they're committed to and even fascinated with their work and their input to the relationship that they do have with their work structuring how we were going to be approaching our engagement campaign we looked at four core competent comp encies in human resource in human resources and first off was under the area of Learning and Development we have a plan in place that you've probably seen um if you have looked at any of the things that Dr frch has shared with you under engagement that we have specific ideas that we are training with all of our leaders and all of our employees around engagement employment life cycle and neural leadership additionally we're

016um working under the competency of Total Rewards and I'm going to be spending some time sharing with you specifically in on the HR side our EAP we look at retention data we have a lot of retention data different areas that we collect and now we're pulling it all together and we're devel developing a data dashboard where we can start to create a story how the data comes together and the story that it tells so that we can make sure that we're taking the appropriate actions in the area of engagement and then under employee relations specifically relationships with our different employee in groups and recognition plans to give you an idea of um where we're hoping all of our employees will reside is in the career life cycle that you see in front of you we

017start with typically someone that is excited about a job they move into their employment in the idealized phase and this could be any job can be a classified job an administrative job a certificated job in education or outside of Education most often people when they begin their employment have an idealized way that they see that job and if we stay focused on a teacher it could be their romanticized idea of what they think it's going to be like when they become a teacher and when they are hired they often move into a phase called the honeymoon phase and that's where it's still really great they see that the job is something that's quite fantastic they haven't realized yet that there are some very stressful and difficult things that are associated with that job and that's

018when they begin to move into stage three um we call this when the other shoe drops and when the other shoe drops you start to realize well I there's a lot of paperwork that comes with this job and I didn't realize that I would have to be um working with so many different stakeholders and some of them are quite cranky and and you you realize what the total um uh the totality of what the job entails moving into stage four this is where most people want to be and that's at Peak Performance it doesn't mean that they have highly um proficient evaluations or that they are amazing in all ways but they know that they have the job down and they are rocking it in their eyes and in other people's eyes as well where

019we want to to avoid but it can occur is when people begin to Plateau out or where they begin to feel devalued so we have run focused groups over the last couple of years um with this life cycle we've asked our employees to report how they are feeling and why they are feeling that way we are also educating all of our leaders about the life cycle and we're asking them to have one-on-one conversations with their employees at some point during the evaluation cycle to get an idea of how our employees are feeling about their employment within that year um one area that we want them to focus on specifically is that stage six devalue phase because many of our employees we see may be behaving as though they are in the devalue stage those are

020easy for our um administrators to address when you see it you can open the dialogue we do have many employees though that could be in the plateau or dvalue devalue phase and they don't vocalize it they look like their Peak performers but they are burning out and so by opening that dialogue we have opportunity to help that employee re-engage in their work some of the things that we've noticed with with our employees are not unique to Deer Valley we do take time to Benchmark with our peers here in Arizona as you know we Benchmark with our Consortium and we also do a lot take a lot of time to um research for uh educational National Trends as well as industry National Trends so this is in the area of Human Resources this was collected through

021Forbes 96% of employees believe showing empathy is an important way to advance employee retention 89% of workers at companies that support well-being initiatives are more likely to recommend their company as a good place to work 87% of employees expect their employer to support them in balancing work and personal commitments we are noticing the same 61% of employees are burned out on the job that's the plateau and the devalue phases 61% of employees agree that they have made healthier lifestyle choices because of their company's wellness program there is a difference between corporate and social sector so specifically for us um some of the the differences that we have noticed is that our employees are experiencing a significant amount of stress you uh may have heard us speak if you've come to any of our um EAP

022presentations that that we share with our groups that it it seems to be a natural thought process people understand that work can be extremely stressful for police officers and work can be extremely stress stressful for firefighters work can also be very stressful for educators and it is not specific to teachers it is in my belief specific to Educators overall when you look at the research nationally around education you'll see that they that there is a big Trend right now for secondary traumatic stress we in Deer Valley because we began to experience these things in the last couple of years we um began to look at this as well a recent study by deoe shows that 84% of employees have experienced physical psychological or behavioral symptoms of poor mental health where work was a contributing factor

023we also know that uh many of them do not want to vocalize that they have these stresses in fact 8 and 10 teachers have had mental health problems throughout their career careers and only a quarter of those who indicated a mental health concern told their supervisor in Deer Valley we have noticed an increase in the number of employees requesting leaves related to mental Wellness issues the number of employees requesting accommodations for the same number of employees requesting time off due to family me members who have similar illnesses and the number of employees indicating that they have uh even suicidal ideation this is what drove us to look into the EAP program so an employee assistance program is not incredibly common we learned in in education in Arizona so we feel fortunate that you gave us

024the blessing to move forward with this work we did meet with Public Safety crisis Solutions if you recall when we presented this to you last year this is the entity entity that provides support to the Phenix fire department Phoenix fire also came in to look at the framework that we had drafted and to provide some insight to to some of the things that we could do to help our employees here's our criteria when we looked last year and this is um what we have had the benefit this year in utilizing we did need an EAP that could provide an educational platform we do know that when we roll anything out if we just tell tell people that it's there and we never touch it again and we never tell them how they can utilize it

025or how it's beneficial to them it will not be used we did need the EAP to support us in campaigning we also needed their assistance in destigmatizing emotional needs not many people like to like to vocalize that they are struggling and therefore we do need to do work in Deer Valley um on destigmatization we also needed a crisis solution a flight deployment team if you're I think you all are aware that we have a flight team that is specific for our students and that team did vocalize to human resources that they were not incredibly comfortable in working with employees or with their peers who were struggling emotionally they were not trained for those things so that's something that we needed our EAP to do also and we needed additional Wellness Resources focused on things that

026would help us with present ISM psychological Fitness physical wellness where payroll spends most of their time over there and financial support and legal support so we did adopt interface EAP interface EAP provides every single one of our employees six face-to-face counseling sessions on any single issue benefited or non-benefited dependents and employees they also provide legal assistance this was another ask knowing that legal issues can be um uh issues that present themselves and and cause people not to be able to engage in their work so and we did also ask that the EAP be able to provide a simple will kit for all of our employees every single year free it can be adjusted financial assistance also and online benefits that are um available to every single one of our employees so um I want to

027highlight here again third to last that one Focus that we um wanted to make sure that we had was that all of our employees were able to access this benefit and they can including their dependents and that it was budget friendly or budget conscious and um it has been or the adoption of it was met all of that criteria so you may Wonder at this point what does our utilization look like uh our interface EAP is telling us that currently we are trending above the national average in the usage of our EAP resources 73.5% of the users are employees and the rest of them are dependents of our employees the top three reasons our employees are utilizing the service currently first is for anxiety these were all tied actually anxiety the other one being stress

028and the third being legal we also collect data from our um each on how they heard about our EAP to make sure that we Market it appropriately and you'll see that 40 a little over 45% hear it through our media push HR and supervisors are pushing it out as well some are self-referrals physician referrals and and peer referrals we would like to also specifically thank you to for this partnership this is passionate work um from Human Resources I know cabinet and all of our leaders we also have the fortune of of working through aspa they um are very interested in this and um we will be working with them running the fall Conference next fall of 2020 this is the key topic of that conference through aspa we also um this Friday the asba asbo

029and ASA legislative Workshop we were invited in through Justin Wing to participate in that um panel so we'll be able to share some of these things this Friday and thank you too for allowing us the opportunity to share it with the governor's Council um last month questions thank you Mrs mfet any questions board members are you good thank you for your presentation this evening and all your hard work okay our next report is from um Dr zerbach on school threats good evening members of the board Dr Finch tonight ALS and Communications have the privilege of speaking to you regarding procedures used in the event of a credible or non-credible threat at any of our campuses this brief report will include details from the 40,000 foot perspective rather than from the ground level as there are

030some Safety and Security pieces that we do not divulge to the general public the Safety and Security of our students and staff is the number one priority not only for the ALS department but for the entire District as well we thank the board for its commitment to supporting a district level director position that focuses on Safety and Security as you are aware we are fortunate to have Mr Scott Warner a retired police captain with more than 20 years of experience to lead us in this area Scott's background in the public safety sector is extensive and among his many assignments in his career is that he was a member of the original FBI San Francisco joint terrorism task force following the events of 911 in 2001 he was a SWAT team commander and also a hostage

031negotiator in addition we are extremely fortunate to have Miss Julie Frank in the safety coordinator position Miss Frank similar to Mr Warner has over two decades of experience helping our schools you can only imagine the number and types of situation that Julie has supported our administrators throughout the years finally we also have Miss Monica Al with us tonight miss Al has numerous years of experience in the communications field and her Insight is invaluable when working on the public working with the public on high emotion matters before we begin this report I do want to make sure that it is clear that our schools overall are very safe places in fact according to the most recent report by the national Center for Education statistics and the Bureau of Justice statistics schools are safer today than they

032have been in a very long time students report feeling safer and the percentage of students involving incidents excuse me involving violence is down local statistics paint a very similar picture as our own dvusd parents as stated in our annual parent survey Report with a very high percentage that their students feel safe one of our challenges however is the inappropriate and sometimes unhelpful use of social media when it comes to school threats this is certainly an area that we will be working on in the future to to make sure that we mitigate social media miscommunication and that we communicate in a more strategic manner at this point I would like to hand it over to Mr Scott Warner well thank you Gary um so here tonight uh we want to talk a little bit about uh

033what goes on when we receive a school threat or redetect a school threat now in my years in law enforcement before I came to education we didn't have the social media component that we have now and so that's dating me but that's that's the truth so um but the the the prevalence of social media and the way that accelerates um people's knowledge of what's going on U whether it's misinformation or or credible information um is our biggest challenge when these things happen so if you go to the next thank you so what do we do so the first thing we do is call the police and con and contact the district office so let's say a site administrator uh learns of a school threat VI social media um or any other means uh they will

034call we ask them to call the police um whether they think that the threat is non-credible or not at the time we ask them to call the police and start that investigation they also call us and it becomes uh a opportunity for us to uh start working with the school uh we talked to Monica immediately to start to draft communication so that we have that information available to us um and then we make a determination if this is a credible and ongoing threat um we make a mod we make might make a determination to modify school hours and that might mean canceling school the next day or or doing something of that nature um if we deem this to be credible and ongoing then hasn't been um neutralized yet if it's credible and has been

035removed uh let's say a person who made the threat has has been arrested uh we would have school just as as as scheduled um and if it's non-credible we determined through the police investigation it's a non-credible threat we also would have uh the school as just as normal um we think it's important to communicate with our community even when it's a non-credible threat so if there was a social media uh activity around a non-credible threat during evening hours we try to get that letter out first thing in the morning before school starts um if it if our investigation is during the school day uh then we wait till the end of the uh school day to send out the communication about what was going on um of course if it was a credible and ongoing

036threat we would communicate immediately with our school Community uh and work to uh figure out what we would knew uh in that particular situation um once we have uh done all of that during the day the next day or the day after we we debrief in ALS sometimes we debrief with the school itself other times we debrief as as a group group in uh our group depending on the the severity and the scope of the particular threat so that's really what we do so I want to take you through kind of a scenario that's not unrealistic here's our scenario at 8: am on a school day a parent emails a high school principal an Instagram screen grab of what appears to be a student holding a rifle with a caption that says tomorrow so what

037would happen here the principal would call the police and form their admin team and call the district office and all of us together would begin to try to figure out what was the source of this particular post um in this particular case we're going to say that the student is identified within an hour and brought to the office and the police and admin Administration determined the threat is not incredible and that the student was holding an airsoft rifle and chatting with a friend about playing with it after school um and at the end of the school day the principal would send out the letter to communicate now can you imagine what this social media would look like if this is what we uh if one parent have it has it what we have end up

038finding is it goes out to a whole bunch of people and we have to try to mitigate uh the social media part of this we we made investigation we we're very quick to to determine it was a non-cable threat however the life of its own is that social media component so we have to try to F how to mitigate that I've actually gone on social media and my role is director of school operations and Athletics to dispel rumors that were being circulated about a threat at Boulder Creek at one point so uh we just try to it's kind of all hands on decks when it comes to social media to try to figure out what we could do to put that cat back in the B so that's a scenario um so that's really in

039a nutshell for talking about the the large view of what happens if a threat happens at at one of our campuses so y Scott why don't you share although the the number of times that a threat actually is credible is is rare um you want to share a couple times in terms of things that we have done when we've made a modification we had some athletic uh examples from last year so we had a couple of opportunities last year there was a threat at one of our schools that that we were going to for a volleyball tournament um it was determined it would be non-credible but it was had a life of its own on social media uh one of our schools one of our high schools who was going to that tournament made a

040determination not to go to the tournament um uh and and cancel their trip to to the to the to the other High School another time there was some uh information that had happened at at a particular basketball game and that there was a spill over at the next basketball game between the same two schools um and there was concern that someone was making a threat um on social media and so we actually modified the the start time of the basketball game and uh moved its location so uh we do make modifications sometimes if we if we have to try to figure out how to how to handle what people are feeling uh we've had by our account we've had nine School threats this year that we've investigated um I think Monica has sent out more

041than 20 more than 20 letters this year of different kinds of issues that we've had to deal with um but from our our St our tally Point where're we're at nine School threats and then Monica do you want to talk about the process usually of the communication and how that goes between you and the school administrator members of the board Dr Finch um when we have a um threat that has been made um I'll generally if the principal has a moment uh talk specifically to her or him uh to get any any information that's um available and then uh we'll be working on a letter and and Scott laid out nicely if if the thread is credible and we need to get the information out we'll do that immediately almost um uh all the time

042uh a threat is non-credible or deemed non credible uh pretty quickly um and so then we'll decide when that information needs to go out at that time so did you have any questions for us Mrs Trey I I had a couple questions first where it talks about notifying the community or the employees included as Community the the the school level employees usually we depend on the principal to tell the school level employees what's going on well well I guess and I and so one thing that's been brought to my attention by numerous employees over the district when things have happened is um the employees either aren't notified at all or they're not ified after the community or they'll show up at school and they'll be increased police presence and they have no idea why so

043at least from my perspective it would make sense to have more of a standardized protocol for including the employees at the school in the notification process that I mean I guess that would be the first one and then the second one what's the thought behind notifying the community of non-credible threats after school hours because then when they hear about it elsewhere and you haven't notified them that it's non-credible they may perceive it to be credible the struggle that we have um is when we notify uh the school Community during the school day it disrupts the school uh we have parents coming to take their kids out of school even though we say it's non credible even though we've said the investigation has deemed that the police are involved or whatever might be what happens for

044us is it disrupts the school day and we have parents showing up at school to take their kids out even though as I said we've said it's not credible we found the best practice Force to not disrupt the school is to wait till school dismisses so you don't have an issue with parents hearing about it anyway but not anything from the school and thinking it's more of a threat than it is because they haven't received communication that it was non-credible I mean I don't know if you're following what I'm asking Twee um members of the board Dr Finch in a case where uh there is a lot of chatter on social media certainly we would then move to communicate in a case where there are just a handful of parents and a principal is able

045to talk to those parents um and there's and it's not CommunityWide then we would wait till the end of the day uh it it's really about the capacity to be able to communicate to those that are concerned and so once there's you know more than 10 parents calling the office it's givs difficult to answer those questions quickly and then that way we would send a letter out to all parents immediately um and generally um the information that that we send out would be asking parents their assistance in not spreading this information and that kind of are the yeah all your questions Mrs Reed um I'm curious about the debriefing sessions um I've had some other conversations with um some other school districts and then um some police officers who actually sit on crisis teams within

046the school district and they um had mentioned that um at one point Deer Valley had one of those and to their knowledge that we didn't have one any longer but it's a crisis team a conglomerate of different stakeholders that meet quarterly and then meet after um you know a a threat to go through it so is that something that we have and I just am not up on it or is that something that we can look into so for uh Mr Reed uh members of the board so for instance that our high schools who have either a safety officer or an SRO they do do debriefings on their campus and so that would be their police presence that are there outside of that I think Scott do you You' had some meetings with um some

047of the community members for that I don't know if that was specifically though for debriefing School threats specifically debriefing School threats or specific threats so we about talking about how to approach School threats is that something that we can can look into considering our district is so large and that's something that our other peer districts do that are similar to our makeup I think one of the variables that's different about Deer Valley is we are not a town and we're not we're not on the map we're the part of five towns and so that makes it really difficult to say to um Parts Glendale Parts you know an the part we we're all over the place so that's why we use our SRO to be the communication tool to the PE to the police in

048particular fire those folks uh but we're not against the concept of getting people together to talk about um you know student safety etc etc but as they mentioned 99 times out of 100 actually 999 times out of a thousand that's not credible and so most of our uh most of our process is around education so and Co and collaboration and working together so it's more about training for us so I don't disagree with you we need to continue to work with our agencies and and continue to train and continue to educate our community I think they did mention too that um with the rise of social media and uh parents interrupting the school day by coming to the campus that's a that's a no no and if you get in front of um any law

049enforcement agency cars um stop everything so if there was a real threat and the cars are parked everywhere that's the first thing tell you to not come to the school because it makes it more dangerous when they when cars pack up the entrance and the exits and Fire Can't Get in police can't get in um Etc so um we need to continue to educate our parents about U you know that situation is under control and and usually it's social media that's causing it but we continue to work with our our places that are impacted our really through our SRO and that's one of the nice features we do have is we have police right on our campuses so um they are a nice conduit to uh to our neighborhoods police officers and police um stations

050and another thing that I think is super important to remember about this whole thing is not one situation is the same as the last one and so we use kind of guiding principles and we really talk it out um the team goes through all the possible scenarios and again the wild card is social media even though it's de deemed in um non non-credible threat we still have to fight the the social media monster pretty much every time have additional questions yeah and and I I agree and I don't know I don't know how to to solve that problem either but you know one of the things that I think you know safe to say we probably all heard from over the last couple of let's say months with um some of the more prevalent um

051issues that happened at school um we just heard a lot of complaints from parents that the communication um process or protocol wasn't clear that it they didn't feel like um that we were being forthright and honest about what was going on because of the way that um things were worded because we can't share all of the intricate details and I don't know if there's a way to like we had talked about before to do some sort of community conversations where parents can better understand you know what why we share or why we say the things that we do um and more of an education um component for them just like we did with um social emotional health and and things like that so parents felt like they were more um as a partner in in

052keeping their students safe and that they have more of a say on um on whether or not their kids are going to come to school I think that was a big thing is that they wanted to make sure that they were the ones that were making the decision on whether or not they felt it was safe for their student and given the roll out of some of the communication they didn't have enough time to have those crucial conversations with their kids however as a parent you can't wait until the last minute to have a crucial conversation with with your kid and um and I think that in some of the comments that I had heard parents are realizing that too that they have to have these conversations with their students even if it's uncomfortable so

053giving parents the tools and the resources to be able to have those conversations with their kids prior to something happening so um I don't know if that's a possibility but I would really like to to see that happen and I think that um our parent Community would feel much um calmer and safer if they felt like the district was able to provide some of those resources good um thank you for presenting this information um this evening I would also one thank thank you Mrs swey for asking that question about our staff because I also had that on my list of questions and I think that we should make sure to include our entire staff at our schools as part of whatever that school Community is when we communicate with them I think that's important that

054they feel like they're receiving those Communications um in a in a timely manner so that they can either ask qu answer questions or deal with the kiddos and parents if they're reaching out to them uh secondly I did come on as a as a governing board member five years ago um when we still did have um a district position a director of safety and we did have those Partnerships with our agencies and I realize that um we do fall in in several cities and Maricopa County and I would like to see us look at and um developing those Partnerships again um if for no other reason than while the school resource officers are awesome um having those relationships with Phoenix PD at a higher level Glendale PD Maricopa County Sheriff's Office um it law enforcement

055is changing just as education is changing on a on a daily basis and um as I remember my mom thinking back saying are you kidding me I just sent you to school and I never worried about you at all when when I went to school in Deer Valley um a few decades ago and then when I sent my kids um I I probably worried a little less than parents do today and and so I want to ensure that we're and I I think we are doing um good things but we need to do a few more things to mitigate their concerns and provide them with the tools so that they can have those conversations um I don't parents don't have the same feelings about schools Unfortunately today that my mom had and and I don't

056think it's founded in true data because when I I go to to workshops and conferences I know that our students are probably safest when they're in our school buildings the data shows that um unfortunately this is an emotional topic and you don't deal with an emotional topic with logic and and we need to help bridge that gap for our our parents and and I appreciate all the hard work you all are doing and I appreciate that your willingness to to tweak the processes a little bit so that we can um better help our parents to trust us more with their students when they feel like there's a threat even when it's not not a credible one so thank you tonight and for your presentation okay we are on to public comments the board invites public

059education uh I'm here tonight to highlight an incident of bullying and harassment that took place on October 17th at your nor Tera Canyon School unfortunately bullying in school is not uncommon uh but what makes this incident especially awful is that these students were not bullied by other kids uh they were bullied uh by the by nor teras principal and assistant principal students were bullied by your school leadership I'm here to ask for your help in improving the environment at nor Tera Canyon others here tonight uh will speak about what happened in the principal's office that day um after the incident I was asked to step in as an advocate I've been doing this sort of work for about four years now across the valley and in my four years this is the most egregious incident

060that I've come across um about a week after this incident I met with two of your District leaders and it was a good meeting uh the two leaders with whom I met uh were appropriately disgusted and they pledged to investigate uh immediately uh I was surprised a week later when I received an email stating that the investigation was complete and the claims of the students were unfounded um I was surprised by this uh because the meeting I had with Dear Valley the week before was so positive that I thought surely I missed something uh perhaps I didn't have the whole story perhaps the students involved weren't as forthright as they ought to have been uh but as I asked more questions about the investigation I was surprised again to learn that the um Deer Valley

061investigators only questioned one side uh they only gathered reports from Deer Valley staff not a single student uh was interviewed about the incident and that strikes me as totally inadequate uh how can you investigate both sides of the story when you only hear one side of the story now I've been working off and on with de Deer Valley Unified for about three years and I recognize that some of your schools are outstanding when it comes to support of your lgbtq students uh families in our support group note good support at OK Conor high school and I want to specifically recognize your principal at Stetson Hills uh she has worked diligently to support every one of her students students and has created an environment where all her students have the opportunity to thrive Dear Valley should

062be highlighting her efforts and use Stetson Hills as a model for the entire District because the fact is that other Dear Valley Schools like nor Tera Canyon fail to support gay and trans students um I have a number of recommendations to present to you all but that's hard to do in three minutes um bottom line the district needs to steep in uh and the governing board must ensure that every single one of your students safe and supported and I welcome the opportunity to speak with you further thank you for your comments Nina ciano maybe a second gold star tonight okay good evening everyone I appreciate the opportunity to speak tonight my name is Nina ciano and I'm the mother of four children who currently attend dvusd schools three of my children are currently attending nor

063Tera Canyon Elementary at the beginning of the school year my daughter Maya who is in eth grade at Nora came home from school visibly upset she told me that her good friend a transgender student was not allowed to be called by his preferred name anymore last year he was able to and most of the students knew him at this point by his preferred name I be I began to ask her more questions and eventually found out that principal Tish maner advised his teachers that he was not allowed to be called by that name I also found out at this time that principal maner told this student he needed to start acting like a female since he was born as one a few weeks later some of the seventh graders decided to talk to a teacher

064they felt safe with as to what they should do about other lgbtq issues they were having specifically with principal maner and assistant principal Jennifer Hermanson the teacher had them fill out an incident report the students felt that maybe it would be just be better if they went directly to principal maner to address these issues upon asking to speak with her they were quickly escorted into assistant principal hermanson's office where they were held for over two hours Miss Hermanson told a transgender student that his face hands and voice were still feminine he was so upset that he cried in the office for the rest of the school day at this time miss maner and miss Hermanson told the students that any talk about gender was considered inappropriate at school and if they were caught speaking about

065it again they would have to call their parents and tell them basically forcing them to out themselves as they didn't stop speaking about who they are the transgender student told my daughter he wanted to kill himself that night upon reaching out to the students with my daughter's help I determined that these students have been dealing with years of bullying by principal maner some of her staff and many students after numerous incident reports filled up by the students no change has been made the students are still not allowed to speak about their gender at their school students are called derogatory names on a daily basis as an lgbtq child once myself and as a mother of an lgbtq child currently the behavior demonstrated by maner and some of her staff is completely unacceptable these students feel

066unsafe and welcomed at their own school they have been shamed bullied and belittled so I'm asking you all tonight to please assist me and these students by creating a safe environment for them no child ever should ever feel ashamed for the way they are born thank you for your time thank you and then we have Maya seretta I'm sorry you allowed to what oh absolutely please just make sure you speak into the microphone so that we can hear you okay I do that just kind of lean forward a little bit it there you go um um my name is mayaa and I'm a student at nor Canyon um I've been there since kindergarten and um I myself I'm in the lgbtq community I have a lot of friends who are also in the community none

067of them not one feels safe that's an issue because especially a public school public school not Catholic school but uh my uh transgender friend struggling with principes by the first week he was to call him by his name and uh but then one of the teachers told all the teachers dead name him and wasn't allowed to be called anything but his birth name and his at double that that did something to him like really bad he self hared often he told me about it I saw it on his arm and his that he attempted I I I don't fact that students are that students are terrified to speak up is also pretty saddening um them that's not safe for them either because UNS supported parents that kicked out in thank you Dr Finch can you

072so I'll be brief with our School boundary initiative um so just uh to provide a little bit of background uh back in January uh of 2019 we had our initial discussions about looking at potential School boundary uh options um we reconvened back in February uh to talk about uh guiding principles at a board work session and uh one of the charges that you left us with uh uh was to actually get some survey results from the stakeholders uh about those guiding principles so uh this report this evening is to provide the update uh regarding that stakeholder um input on The Guiding principles and then to uh share with you the process for looking at School boundaries uh and the timeline um so the uh um the governing board uh created uh these guiding principles uh

073this was uh determined again on February felt that was a a work session um for these particular items I'm trying to keep Pace here with my laptop um so these particular eight items sorry sorry Siri Siri doesn't like my presentation um the uh I won't read each of those um thanks to the help of Dr uh Scott Smith um and our folks at Deo uh they helped us put together a survey um and uh um the the results are are are here basically more than 3600 responses mostly from parents um and um it was a fourth ranking survey uh that we had opened from uh the end of September through the first week or so of October um and um so good participation uh we were surprised uh I was pleasantly surprised how how many

074people actually responded to it um this survey just actually kind of gives you the forced ranking of the uh eight particular guiding principles that the board developed back in February um from that information uh here are the top ranked responses so keeping families and neighborhoods together uh proximity location and contiguous boundaries uh a sustainable long-term plan and Transportation uh related uh concerns so um again we didn't uh necessarily learn anything new uh because they were also supportive there was also uh at the board Direction uh the opportunity for narrative uh comments to be uh part of the survey um and there really wasn't any common theme with those narrative comments so no additional guiding principle was uh determined uh we did get plenty of comments specifically about a school again that wasn't the intent of

075the of the survey it was really just to talk about what are the things that we want to make sure that we're using as a way to establish uh what changes might need to be looked at when it comes to school boundaries um we do have the need for specifically looking at the new Elementary School uh and what boundary it will uh have um again that uh is scheduled to open uh in August of uh 2020 uh so we need uh there is a um an immediate need to address that um we are taking the opportunity to look at some Elementary School realignment um based on uh patterns that we see with uh open enrollment Trends um and changes that have happened over time with when they were when School boundaries were originally established and

076and the the changing demographic of uh those School attendance areas we have some school specific programs uh that Dr Finch uh and other cabinet members have presented to the board uh that we'd like to look at and then High School realignment uh so we actually don't have um too many high school students we end end up having too many high school students at particular high schools um so redistributing uh the high school students over the existing um campuses would uh be a very um uh maybe daunting task but it would yield the the need for us not to have to consider a very expensive proposition uh such as you know dealing with capacity issues at a particular campus or two that are our largest high schools um so with that in mind we've come up

077with some timelines um that we would start the process pending the board's decision uh this evening uh for initial Community meetings starting as early as Monday uh November 18th um there would be one meeting at each of the high school uh so we would do these meetings by region um not every High School potentially has the same number of changes to it um but uh again if we're going to realign the high schools um uh as part of this effort uh we would use those as kind of a a base to be able to make it convenient for the communities to be able to come uh and share their input um we would send out a required mailer U that's part of our our policy your your board policy JC um there's also a statute

078around this uh ars5 341 I think uh uh it's uh paragraph 37 um and then we would come back to a the official meetings um December 9th through the 12th uh where we would have the second committee meetings where the public input would be uh we would share the actual uh proposed changes on the November 18th meeting it's really just a conversation starter to be able to get input uh from the community as to um again what changes uh would they potentially uh support or object to uh so that we can make an informed decision uh bring back those uh options uh and those meetings the second committee meetings into December 9th through the 12th um we would preview those with the board we have a board a regular board meeting scheduled on December 10th

079um we would post uh any board meet or any uh potential boundary changes on our website which is also part of your board policy uh so that by January for as early as January 14th uh we could uh have a formal consideration of any boundary changes um that we would look into uh implementing I want to make sure that um I just mentioned here that there are the potential for us to have especially when it comes to High School boundaries uh I don't think we've ever done High School boundaries that haven't been phased in over time so even though we'd be making this decision as early as January uh um of 20120 um the implementation might be in a future year uh so that the existing students at a campus would continue at that campus

080potentially um but there are some other uh campus needs especially as I mentioned the new elementary school that might have a different timeline right we need a School boundary for the new school so that we know how many students are going to be attending that uh school that could likewise be the case with other Elementary realignments that I mentioned before uh so the what's being decided tonight really is using the guiding principles the board is already determined um and applying it to this timeline or process and I'd be happy to answer any question the boards might have Mrs treaty I guess a few questions first I see we have our initial meeting and then the very next day we have a a mailer going out to potentially impacted um do we already know who's potentially

081impacted or uh vice president O'Brien Miss Tweety uh since we are considering realignment and potentially all the high schools it it it's essentially going to be the entire District so every parent in the district's going to get that they get get one of these letters it would be a notice yes a notice that they're potentially impacted so we should put our emails forwarded to you that day no I'm just kidding sorry I couldn't hear you said we'll forward our emails to you that day thanks for the heads up it'll be boundaries. DBU or dvusd.org and then the next thing when you bring options to the board are you going to have more than one option as to what this realignment and and and at what point is are the options presented at which one of

082these uh so vice president Brian Miss Tweety uh we would be bringing back to the board we can certainly provide updates to the board throughout the process Our intention is to bring a preview of the School boundaries uh what those options look like at the December 10th meeting um that will be going on simultaneously with the required official meeting with the community um that will be happening that same week so we'll know what the options look like um for the December 10th regular board meeting and we'll be also presenting that to the community but we won't have all of the input so any of the input that we receive from the official meetings with the community let's say you know because we're not sharing uh a definitive option on Monday the November 18th we're we're

083basically saying hey we're looking at boundary options we want some input uh here are some ideas that we're considering for example the new elementary school um we're considering realigning the High School boundaries to balance enrollment Etc um it won't be until the December 9th through 12th second meetings that we actually have some options to share um so I don't want to uh commit ourselves to having multiple options but there certainly could be multiple options based on whatever input we're we're receiving between November 18th and December 9th and then there's going to be more than one option considered right yeah we are considering multiple options okay um but it depends on your definition of options right multiple options for High School boundaries or you know so more than one op option for um each High School

084uh I don't think that's part of our plan but multiple options for uh for High School boundaries in general we're certainly open to that answer your questions kind of it's clear as mud and it's still early too we we don't know yeah I don't I don't think we know what's going to come out of the meetings on Monday from the community and based on our guiding principles and what we hear from the community and what we know about our enrollment might help to drive what kind of um options are presented to us well I guess as one quick followup did the consultant provide you with options uh vice president O'Brien Miss Tweety I yes so we have uh we haven't developed like a definitive plan but we certainly have things that uh are conversation starters

085um that we are that we are prepared to share with the community on November 18th but they are not I wouldn't consol them consider them options in fact we uh we debated this word uh earlier I think we're going to refer to them as considerations so this here are some of the considerations uh that need to take place to meet the objective so in order to balance the high school enrollment we're going to have to increase the population at schools that have smaller uh uh student populations currently and in in the foreseeable projected future uh and we need to decrease the population of those of those campuses that are um over their capacity can can you just send the board then in the next update what the consultant has given you so we could at

086least understand with follow the thought process here uh we can certainly share the presentation that'll happen on Monday with the board we can do that we actually have a presentation that's going to be um already it's already done we can sh we're planning on anyway give to you on Friday that would be Friday upate because it's um we've broken into teams and so all these things will actually happen simultaneously on November 18th at um by by members of the cabinet so for example I'll be at bter Creek with so um we'll have 10 folks out um gathering information and we'll give you that PowerPoint Mrs Reed so I know that this is like the big elephant in the room that all the parents that are watching are dying to know is if on Monday you

087will have the um provisional boundary recommendation maps on display that make sense I know that there are some proposed maps that some parents have seen and um I think that other parents have heard of them that they've been rumored that this is what it's going to be that this is final and so are those projected new boundary Maps going to be on display on Tuesday or that is that something that's not going to be talked about is it just going to be more of a presentation and then you guys get feedback vice president O'Brien Miss Reed uh yes we will have proposed Maps but I I just want to make sure that we're clear that just because we're providing the maps it's more of a conversation starter than we think it is a final uh

088if they were finalized there'd be no reason to have this initial meeting uh we're only required to have one public meeting uh to take input on the um on the actual um boundary changes so between November 18th and December 9th we hope to create a final map that you know that that people can provide official input on um but we do have maps that we are intending to share at the November 18th meeting which is Monday the 18th I think you might have said Tuesday but um uh so that at least people have a vision of what that might look like uh or could possibly look like right again it's not a definitive plan we don't want to characterize it as as such thank you yes I've been telling people it's not a definitive plan

091our first preview item this evening is juel vaping um lawsuit and I believe that is for you Dr Finch I will start that one wonderful um we actually have Jose Riv Rivier from here U from a local Arizona firm as I mentioned in the Friday update um to answer any questions you might have I'll do a little um kind of my version and then I think I attached the PowerPoint that I actually saw in the webinar that I was involved with I think hopefully you had a chance to take a peek of that I think I actually have it in paper form in front of you but um in general what this is not news to you what it's in G in bardoc so there she's on it Y and um it's the jewel lawsuit

092they control 80% of the market and so they're obviously the one with the Target on their back now that students are becoming addicted younger and younger and uh more research shows over and over that they are directly marketing to our student so uh we as a um the aftermath of that we we use our own services our own time our own energy and efforts along with our parents um dealing with the um the problems related to vaping and so uh what has been suggested and there's a firm I believe it's out of Missouri that's probably one of many that's starting to collect school districts and social sector folks um that are being impacted by a lifetime of nicotine and so um uh was actually presented at a state conference State superintendent conference and several uh

093Arizona schools have started to join the lawsuit obviously it won't be a class action until there's enough and until other more folks get involved but I think it's taking the same path as as the opioid but maybe um if Jose wants to pitch in here our um our goal or our objective obviously is preview it tonight U there's a contract or uh agreement ment that says we're willing to join the lawsuit it may outlive all of us um on our tenure on this board in or in our service but um it is part of a public health uh problem that we needs to be addressed so I don't know if you want to add anything sir a couple of comments I am afraid about that out living All of Us Part uh because I'm not

094getting young any younger uh but this is a little different this is not a class action lawsuit this is what it's called the multi-district ation lawsuit and what it means is that yet there's so many of these lawsuits being brought across the United States that rather than of each Court resolve these issues they find one Court in this case it say no then just to kill here are all these cases it uh makes it a lot easier because you just have one liability hearing causing and the problems that is causing and then damages and the damages will we'll do is'll four or five high schools across schools not necessarily high schools across the United States excuse me I've got a cold so you can't understand me just stop me U they'll pick four or five

095different category of schools they'll they'll litigate those issues and hopefully those those issues about the findings and those will apply to all the other schools U you know the lawsuit is not about the you're seeing a lot of these cases about injured children injured adults and the Crystal that's not our lawsuit our lawsuit is representing School Lo uh I can go into detail if you want some but I mean it's basically what you guys are paying what school boards are paying for epidemic that this is a now I have we have one high school it's here in Phoenix cost him $5 million last year hard I've done I'm affiliated with a law firm out of Kansas City uh they're the main drivers on it uh they in the B four of lawsuit people have F

096lawsuits I'm probably the I'm the Arizona representative I belong to a firm called canelli uh we're one of the preeminent law firms in the state class not class action litigation but do litigation Partners in Stanley development who was obious Justice I was the US attorney for so I know some of these issues you were talking about earlier uh I saw them come through from a prosecutors a head prosecutor U I mean I'll be happy to answer any questions you want I've got a presentation but it's an hour and a half in two hours I don't think you want to hear that yeah go ahead Miss twe have questions Mrs twe go ahead well okay so in the case of the parents suing with personal injury I for the for the people who have had personal

098heard a spiel about loss of attendance and how many students are showing every time one of these students gets us by because of the vaping you're losing money when when you have to hire extra Personnel you're losing money have to hire a lot of the schools what are they're doing now is they're just putting smoke alarms in the bathrooms that's what usually happens they're having to pay for it they're very they don't work as well as you think every time you have to add Personnel to your guard against this to have more security Personnel to do more patrols you're losing come back to school and up uh they start taking remedial classes that's another budget item would you have back they can't graduate for another year uh it's indirect heart causes it's not like I

099told you it's not a personal injury that just the added attention the added money I I have not looked at the statistic that you have a little smaller than you already uh expelled 13 students probably the largest of the scho uh had expelled a significant number you can go to Circle case store here you can see them uh I provided the material in terms of how they look they're very pretty they're very small uh the market that they're going after is uh when they opened it up the first day uh I Vue we had gone to uh downtown Manhattan uh they rented every one of those buildings Jewel has been in existence four years and the reason I mention je there other vaping companies could Jewel like uh in four years Jewel startup with no

100money four years are the fastest growing company United States uh tobacco is seeing this tobacco is seeing this uh they've invested 11 billion dollar into this if you look at the it's very tight end and tobacco if you look at tobacco right after the tobacco litigation smoking from youth ially down they were down to like three or 4% they that introduced and now they the second largest nitin factor manufacturer that makes to Tobacco larger than tobacco pre at 28% they went from definitely goes and attacks uh the numbers that you have in terms of the figures you have that would be something that long lasting effects it has Tyne uh Tyne school elementary school district just bought every one of their bathrooms uh this well when when you can get that like anything else you

101invents is have cloes so you can hide this thing going into the bathroom and rather than smoking it out lot and put their head in the toilet that answer your first question eally would just want the district to provide me documentation as to what type of money we're out and why we think it's Joel's fault and I we're working on getting the the data because we have started looking at um dividing out those um issues that are related to U discipline issues at the high school level related to vaping versus other I mean also in just understanding because we've also had issues with alcohol and other things and we're not suing the beer companies so I I just want to understand the logic here absolutely I can give you that absolutely that that's why this

102is a preview item any assistance we can provide you to y uh this litigation as we told you it's going Nationwide uh we got most of the most of the large schools throughout the United States are joining our litigation there is a number of lawyers that are doing it but it's not significant it's not very many uh part of our the people that we're representing our Miami Chicago uh a number of of suburbs I think uh Los Angeles just joined last week as well yeah we're looking at Angeles um I'm not sure what somebody else is hand that's really can't give any specific turning to your second question in terms of how how we would Finance it you're right this is will not be charge you hourly if you like to pay me hourly I'd

103be happy to take my hour I think you could afford it uh but we're doing it on a contingency fee basis uh it's Arizona allows contingency fees cover something we we will charge you something uh we provided you with a a standard cont contract uh Arizona this is what it's called a product litigation case uh most of the time You' be allowed to go up to 40% is a norm uh we our contract has two different actually three specific Clauses that would be really helpful to the school districts and hopefully to us our our our our fees are capped at 25% pick up the cost uh which in other words I mean the cost of litigation everything else have a 5% clause on it that we charge you if we're successful but not successful we

104won't charge you we don't anticipate that we charge you the reason we each school will be on school that's the first two closets you know it's 25% uh actually 20 we take the 5% out uh the other Clause that we have is that if for some reason uh we don't like each other when we start litigating for whatever reason you want to we have an escape closet lightly tell us to go somewhere else and leave and we will charge to you if you hire another attorney we will CER another attorney but it won't never come out of the school cers never charges the school all I've got a we drafted we've got a couple couple of complaints I could show you the complaint that we drafted for Tucson yeah we can give you can probably

111districts there are um Millions of dollars um on the line and I know that Mrs Reed has been uh integrally involved with census 2020 for Phoenix she was named to a committee by uh councilwoman Williams and has been working with multiple agencies to ensure that we get the word out that um every person is counted and so I recommended that we put this um on our agenda so that we could as a governing board support and help to ensure our citizens are counted do you have anything to add Mrs Reed not really summ it all where where did the resolution come from who wrote it the original resolution uh was written by the Arizona School boards Association has been modified for our district um so it was passed uh unanimously by the board of directors
