001are you ready for us Monica we are ready if you'd like to step forward all right good evening president O'Brien members of the governing board superintendent Finch and special guests tonight we highlight our extraordinary azm2 results for Deer Valley this past year 80% of our schools had at least one student with the highest possible scale score in either English language arts or math a highest possible scale score is essentially a perfect score that's 41 students with perfect assessments across the district in addition Deer Valley has 18 students who had perfect scores on both assessments English language arts and math to demonstrate how tiny and amazing this group is we did some math these 18 students represent less than one tenth of 1% of DB USD this is definitely a select and an extraordinary group of
002these 18 students tonight we recognize six students from six different schools two of these students have moved on to high school but they will be recognized with the school where they attended last year students when I call your name please come up to the table over here you will pick up your certificate and pin and then proceed up the stairs for a photo and congratulations on your amazing accomplishment first up with the highest scale scores perfect scores on English language arts and math from Canyon Springs Ste Ste STEM Academy Violet K Violet is now attending Boulder Creek High School and I don't think Violet made it tonight but let's give her a round of applause next with perfect scores on azm2 English language arts and math from Diamond Canyon Bentley warreni he has an Entourage
003already oh I believe he was in third right last year you're in fourth now so the first jury could test the Aces and both from Hillcrest Middle School she had the highest scale scores on English language arts and math Alyssa caulk [Applause] now with the highest scale score on English language arts and math from Sonoran Foothills Jonathan aurin I'm afraid Jonathan wasn't able to be with us tonight next up from Stetson Hills with perfect scores on asm2 English language arts and math Sarah Hayden our final azm2 highest scale score honor for tonight from westwing Christian Bala and Christian now attends Sandra Day o Conor High School oh does did you get that Mom did his mom get it okay all right we will honor additional a M2 highest scale score recipients at the next two
004governing board presentations our final award for tonight uh goes to a student you may have seen before back in June we recognized students from our CTE program who were state champions in their field of study our only educa Educators Rising state champion went on to compete and win a National Title McKenzie Bremer now a junior at Mountain Ridge High School competed at the Educators Rising State and National competition in the lesson planning and delivery stem category to prepare she had to find a dvusd math teacher who would allow her to teach class and work with that teacher on which standards to teach she taught Mrs solano's algebra one2 honors class at Hillcrest Middle School after Consulting with Mrs Solano McKenzie wrote a lesson plan and then delivered the lessons to students for competition McKenzie sent
005a video of herself teaching the and the judges evaluated her written lesson plan and video and award her awarded her a national title congratulations to the Educators Rising lesson planning and delivery stem National Champion Mountain Ridge High School's McKenzie [Applause] grer that concludes our Awards and recognitions for tonight we have a public hearing beginning at 6:45 and the regular governing board meeting begins at oh my okay we will call the special meeting of the governing board the public hearing to order at 6:45 this evening please let the roll call show that all board members are present can I have a motion to adopt the agenda make a motion uh to adopt the agenda I second we have a motion and a second all those in favor of adopting the agenda please say I I I
006any opposed hearing none the motion passes um unanimously we have a public hearing on two different um items so the first one will be the public hearing on revision number one of the 2021-22 expenditure budget after the presentation from staff um all those who wish to speak on this item and comments are limited strictly to the revision to the 2021-22 budget item would then line up at the microphone so we will um to Mrs [Music] mock president O'Brien members of the board and guests we actually this one hopefully will be quick enough um we didn't bring a presentation this evening this is an unusual occurrence for us and uh typically we have a budget Revision in May of the current school year but because the legislature had not finished session uh the auditor General's office
007was not able to uh provide the formal official final forms for adopting the Budget prior to our budget adoption back in July now they have the uh official forms available and so we basically took the same information the same student projections that we had back in our July adoption and put those into the new official budgets this budget revision is not required but it is just an opportunity to get some of that information corrected and to ad and on our website as well we may still have a budget Revision in December prior to December 15th and we'll definitely have our final budget revision for this school year on May 10th of 2022 the only thing that changed in this budget revision is the uh some of the formulas specific specifically some of the weights on
008the group b counts so with that our group b count did increase and at this time we're looking at 1.86 million increase in our general budget limit and we will work with um NST and the other employee groups and mechanisms for appropriating district funds throughout the school year to determine how those funds are used for the current year or moving forward into next school year and all of those recommendations of course will be brought to the board for uh formal approval at a regular governing board meeting and with that I'll take any questions thank you Mrs moach do we have any um public comments on the revision one of the 2021-22 expenditure budget okay seeing none we will hold um board member questions until the um Regular meeting of the governing board we'll now move
009into public hearing Item B on the instructional time models and again we will do the same format we will hear from staff and then we will ask anybody who has specific comments on the instructional time models to please line up at the microphones to hear um comments uh with that we'll go to Dr gallagan good evening president O'Brien board members Dr fion guests this is the second public hearing for deer Valley's instructional time model the first hearing was at the board meeting on August 24th just as a reminder um this uh instructional time model has requirements based on ar50 808 and you can see each of those um they are amendments or repeals um from those specific statute the definitions have remained the same for ADM average daily membership daily attendance instructional hours and instructional
010time and how those are how those fit into this particular Statute in addition um when we look at the instructional time model and funding um most of this information well this is exactly the same information but it really this this statute really discusses um how we will have instructional time in Deer Valley and then how we will take attendance that's that's the nuts and bolts of it there's no changes on this slide in addition um the statute uh does talk about different ways of providing instructional time to students and those are listed there and then you can see in the second half of this um that it is inperson instruction remote instruction and there are some time requirements percentages for this year and a change going into next year nothing has changed on this slide
011when we look specifically at Deer Valley's instructional time model for this current year um these particular ones have no changes for developmental preschool ele M and secondary on this particular slide um number four Remains the Same number five we added letter e instruction may be provided to K4 students for behavior intervention as another unique situation in this particular slide we made a slight adjustment in um that sub bullet attendance marked for every day student is in distance learning program and we just needed to be clear in that first one in attendance d L is the code and that would be for students participating in canvas learning which is our learning management system and or corresponding with teacher check-in times um when the student is in distance learning and then absent Remains the Same um if
012the student is absent from scheduled remote instruction or the student is marked absent when a parent calls the school um my hours again is used for Aspire and we are done are there any members of the public wishing to address the instructional time models seeing none we will also hold um governing board questions until we go to the um uh regular governing board meeting this evening um with that I would entertain a motion to adjourn the public hearing I'll make a motion to adjourn the public hearing at 6:50 I second all those in favor please say I I I I any opposed please say nay okay passes 4 to one we will start the regular um governing board meeting at 7 P.M going to call the regular governing board meeting to order at 7 p.m.
013please let the record reflect that all governing board members are in attendance if you would please join me in the Pledge of Allegiance followed by a Moment of Silence to the flag of the United States of America stand indivisible andice thank you please be seated so okay so we have um a couple of um public comments to be addressed uh at the beginning before we adopt the agenda so Mrs Ordway is going to read the admonishment now all right and as I'm reading that of Chris D and Carrie Bieber could uh go behind the microphone that would be awesome the board invites public comment in the district's business in general on the district's B business in general and on any agenda item in specific all speakers must observe the rules of decorum speakers must fill
014out a card listing name address and topic and hand it to the board secretary prior to the president calling the meeting to order speakers must make their comments in no more than 3 minutes if necessary to accommodate all speakers within the 30 minute overall limit the board president May shorten each speaker's time constructive criticism is in order rudeness vulgarity disruptive conduct or remarks disrespecting personal dignity are not in order and will not be allowed under the Arizona open meeting law the governing board cannot discuss or act on any items that are not listed on the agenda board members May respond to criticism made by a speaker ask staff to review a matter or ask that a matter be put on a future agenda pleas step to the microphone state your name for the record and
015your three minutes will begin all right my name is Chris De Roch I'm the mother of four a 2020 graduate of Boulder Creek High School two current Boulder Creek um students and my youngest who I pulled and put in a charter school so I am a real dvusd parent I would like to give my opinion about the proposed change to policy bed under Rules of Order you're proposing to change it so it allows the Govern Gover board president the sole authority to recess a meeting without a vote of the governing board I did not elect a sole governing board president I elected five school board members the purpose of having five members is so that they can check and balance each other um it's bad enough you voted to give Dr Finch sole power over
016covid actions now you want to give the board president soulle power over this it's not okay I'm 100% against this and if this passes my group will be going forward with the recall measures on all those who vote I I know you have the power to pull it from the agenda and vote on it separately so I asking that you do that tonight thank you thank you for your comments you please step to the microphone state your name for the record and then um your time will begin Carrie Bieber I also have concerns about the policy Ved I'm uh hoping that the board will vote on this and vote no we elected every person on the board this policy allows the president to end the meeting with that in mind please vote no this will
017censor possibly censor not only my voice but people with opposite voices and all of our voices deserve to be heard thank you thank you for your comment um is there [Music] uh please pull that for separate consideration I know we need a motion but I'm asking that in her motion she'll it's uh [Music] 6f yes sir all right so I would make a motion that separate 6f from the adoption of the agenda so moveed to adopt the agenda with um the exception of pulling 6f for separate consideration is there a second second oh I can't second my own motion what is wrong with me did did is that sure you awake Mrs fiser seconded the motion all those in favor of adopting the agenda please say I I any opposed please say nay hearing none
018the motion passes unanimously so now I'm going to make a motion to the agenda as amended no there only one agenda okay has everybody recorded their vote on board docks excellent and we will move into District reports and our first report tonight is the finance report we will go to Mrs Mach for that president O'Brien members of the board and guests here with us this evening I am pleased to once again start the monthly Finance reports for the fiscal year the first report we have for you this evening is a our student enrollment report happy to paint a little bit different of a picture than we had this time last year at the end of August we had gone through 18 days of school at least for our last enrollment report for August and we're
019seeing an increase of 1.7% over our 2021 enrollment for the end of August back up to 32941 students so getting closer back to that 33,000 number um and uh we are seeing um steady increase in enrollment in our Aspire online school as well I will be having happy to take any questions about our first enrollment report for the school year are there any questions seeing then please move on to your report thank you president O'Brien for our first report for the 2122 school year for m o budget report we have approximately 48 million in expenses to date um and it is far too early in the school year to deter if we have any carry forward so at this time we are not projecting any but we will continue to um report at the first
020meeting for each month our m&o budget report for the current school year uh just a side note um this does not since this is report is for the end of August and our budget revision this evening is happening in September we have not uh made an attempt to include any potential new budget that will be uh captured by by the district by revising the budget so that's something that we would see in our future budget and with that I'll take any questions thank you Mrs Mack are there any questions from board members Mrs paperman so uh when when would there be like an attempt to look at the budget uh to see the money is going to be allocated um as stated in the public hearing we would do that through the processes all for
021the district and that includes the negotiated Solutions team salary and benefit commit um all of those teams that look at how we allocate our funds for the current and or future budget year we do already have some trigger language in place based on our uh average daily membership for the year that would allow a one-time payment for staff so part of the work from last year's committee uh already made a commitment for some additional funds um should we receive them this year as well so basically it's in contingency it's already it it was already discussed what was going to be for example the stifen for the correct part of it has been but we won't know until May when the school year is over what our you know full budget may be so typically we
022will include that uh in any plans for the 2223 budget through those committees and teams thank you any other questions okay thank you Mrs Mock and we will move to our second district report for the evening safe and healthy schools report Dr zurbach thank you uh president O'Brien members of the board Dr Finch uh tonight we have our second safe safe and healthy schools report and we'll go ahead and get going on our agenda we will cover the metrics the data and the dashboard such as we have done in Prior presentations I also will provide an overview of the operational impact provide an update on covid-19 testing opportunities and then Mrs Moffett uh will take it from there and then we'll provide an opportunity for uh question and answer okay on our community level of
023transmission metrics the good news is that our case count does continue to uh Decline and that's very good uh the news that is not so good yet is that it's still a quite High number overall so you can see in the label where it says a high threshold is greater than 100 that we are still in the high transmission threshold um but again it is good news that this number is declining and we hope to continue uh seeing this decline as you know from before as I have um let you know that our internal dashboard numbers tend to correlate quite well with uh the case count for the community level so when the community is going up we tend to go up when the community is going down then we go down as well the
024rate of positivity has stayed relatively flat again you can see in this graph that it is hovering somewhere in the mid4 uh% that is in the high threshold because it is above 10% uh and that number is as Mr miglino and I have commented uh very much dependent on exactly who is testing and so when covid case counts tend to go way up more folks tend to start testing and that can impact uh the case count and then when the case count starts coming down left folks go to or fewer folks go to test and so that can account for some of the fluctuations with our uh rate of positivity this graph captures the community epic curve and you can see that the curve is starting to flatten and starting to go down so again
025this is a good [Music] thing for the age count this particular graph represents children between the ages of five and 18 and so you can see that the graph was going up uh quite a bit and then now in the past uh few weeks it's starting to come back down and again that's a very good thing for us with respect to our operations our co9 dashboard uh this again has a very friendly URL the community can go to the dashboard on Mondays we tend to update it at approximately 4 pm each Monday and it has an active case count by each site along with a couple of District locations and so that uh total case count again has been going down for several weeks um in a row okay last time that we provided this
026report to you I gave you a summary of the impact on operations and so I wanted to give you another overview as far as how uh we have been impacted over the past three weeks so the first presentation again covered the first three weeks so this one now will cover the next three weeks and so we have had approximately 126 positive uh cases transmitted at school the quarantines that have resulted there have been about 3,800 that number in a uh from a positive Viewpoint has been going down though so if you looked at three weeks ago uh that number was much higher than it was uh in this past week as far as the work and the magic that our administrators some of which are in the room now need to do you can see
027that we on each week so this is not a total over the three weeks uh this particular bullet point is an average of each week and so about 50 to 20 schools have had to make arrangements to have classes covered uh fewer than 10 times we have approximately again each week about three schools that are doing it between 10 and 20 times and then we've had one or two schools each week that have had to do it more than 21 times 15% of our schools uh each week again on average have had to make an adjustment in the and then you can see that percentage for campus admin uh that that have had an absence due to a covid related reason okay in terms of our covid-19 testing opportunities we did report to you at
028our last meeting that we were looking at increasing the number of days that we offer the covid-19 testing here at the district office and so we have done that uh that is now Mondays Tuesdays and Fridays from 11: to two and then we also have increased through the help of Miss Mach here the number of binex now tests that we have and those are the home test kits along with some additional uh FDA approved home test kits and so those have been we've had certain orders that have been distributed to the schools and we have additional orders that we expect arrive and those help quite a bit both with the students and with our staff uh in terms of helping Mrs Moffett as they manage the situation okay and with that uh Mrs mfet why
029don't you take it away okay um good evening um a couple of things from Human Resources Co reporting reminders we do want to make sure that every single time we have the opportunity that we remind our staff because we have several um or many new staff members that may not be familiar with this process and haven't been ill before so we want to make sure that they understand that if any employee comes in close contact with someone that is tested positive if they have symptoms related to covid-19 symptoms or personally have tested positive it is very important that the employee go to covid report. dvusd .org so that a human resources um representative can work with them to get them back to work as soon as possible and to keep them safe secondly um we
030know that there are many employees um that are aware of the recent announcement from President Biden and might be waiting to know what DB USD is going to do related to that announcement what we do want all of our employees to know is that we are not doing anything right now immediately we are pausing we are waiting to see what this announcement means so specifically that announcement um did state that employers um that have 100 employees or more might be um expected to require all of their employees to be vaccinated or to test for VA um covid-19 once a week we are pausing um because OSHA has not yet published any rule or emergency temporary standard that could take a long time we also are in consultation um with legal and we do anticipate um
031that this announcement will come with a push back in many different ways so we are not moving instead we are pausing pausing and we are waiting to learn more as we do learn more um I'm sure you will learn much of this in in the media um we will too and as we um gain Insight we'll make sure that our employees and the board is informed and I would just add Jenna that that information was also contained in the letter from Dr Finch uh to the employees yes thank you Gary and then also um we want to remind anyone that's listening that we continue to recruit um to assist us in this pandemic environment Health office workers we are looking for anyone in the community whether it be just a um a Community member or
032a parent that might hold an EMT CNA paramedic LPN RN license we can um employ you part time to assist us in our health offices when you are not on duty in your regular job and we are also continuing to recruit certified and classified substitutes all anyone needs to do is go to our website where you can find the links easily find the links and sign up um and we'll help you out okay thank you Jenna and with that uh president O'Brien our presentation is concluded and we can field questions questions Mrs Fisher um can you go back to the SC did you have the numbers I know that they were on the presentation we were looking quarantines can you go back to that one of those 126 positive cases how many were students uh
033president O'Brien Miss Fitcher those are all student cases those all students so how many employees did we have that were how many employees that were were that were covid positive that were transmitted at school just covid positive employees I believe our number was this past week 29 Jenna does that sound right that does sound accurate for this past week and we have um hovered around that number over the last three weeks but we could get you that exact information of those 126 how many of them were first part of the 3800 quarantined president O'Brien Miss Fitcher almost all of those 100 uh positive cases were students who identified as a close contact for quarantine no what I'm asking is were they quarantined first it's like chicken in the egg were they how many of our
034quarantines came back as positive approximately almost the majority of the 126 so they got quarantined with no kids having it and then came back with it I'm just trying to follow the logic uh president orrian miss Fischer maybe I'm missing your question and of the so those cases there that's not the total cases that we've had in our active case count those are the cases that were transmitted at school so our overall case count is much more as you know from our dashboard okay so if we can because I'm what I'm trying to to understand and this is the biggest thing we have is our parents don't want to not support the district they do want to support the district but they want their kids to get an education and when they're out on quarantine
0351 quarantine 2 quarantine 3 with nothing but canvas and now they're you know 30 days into the year with no education because canvas isn't cutting it you know they want to know is was my quarantine meaningful was there a purpose behind it so if we're quarantining kids and then not and and it's for no reason whatsoever that's concerning so that's what I'm trying to get get to those numbers and I think that's what almost all of the public that has asked me about that is what they have asked me is is this a is there a purpose behind this or is this just following because someone said so so I would appreciate if we could get a better idea of we're quarantining these kids and then there's actually something that's occurring there's a reason behind
036it other than it's just a suggest suggestion from the county or a mandate because the county if I understand correctly is not going to court and officially quarantining unless I'm wrong that that is incorrect uh so in terms of the actual number of students that have gotten it from quarantine that math is pretty simple Mrs Fischer right there on the on the slide you can see that it is a small percentage of the uh total students who are quarantined so I'm not sure what you're asking for other than what it it is it is a small number I I it's there on the side number but I'm just saying the 126 in other words okay one kid's exposed to one kid comes in or gets it and then we quarantine 20 kids around that around
037that student it may only be one that gets it I I get that type of mathematics gotcha but what I'm saying is they want to justify when it's keeps happening repeatedly because we're having a lot of that and a lot of our parents don't feel that it's that they're truly an exposure cuz we can't even tell them when they when or where or how long they were exposed so I'm again that that would be incorrect and many times uh they can that's why they're using the seating charts they know how long class periods are and so when you say they have no idea I I I guess I'm not sure what what do you mean by that when you say they have no idea a class period is about 50 minutes long in the secondary
038level and so when they know a student has been seated next to a particular covid positive student during that class period Then they do have an idea so what do you mean when they have no idea when the parents have asked that question they've been told they cannot be given that data so if we know that that's awesome we need to communicate that to the parents I think they want to work with many times that's not what the parents have been requesting parents have been requesting they would like to see the positive test information information uh directly uh from the students as far as what the parents provide and that is not something we do not provide uh a health information record like that uh to other parents well of course we wouldn't but none
039of the parents that have come to me have said the other students information many have many have they're saying they would that's what they want they wanted proof that the student was positive not doubting you they may request that from you but when they've come concerned to me it's been that they're told that they can't even say when where or how long they were exposed I would never want another student's information given out but if if Little Johnny is quarantined um from the sixth grade I'd like them to say you know he was we had a student that sat next to him on the 12th and they sat there together all day pretty much so it's more than a 15 minute and the other concern I get is when they're high school they're transferring from
040class to class to class to class so are we just kind of picking kids that may be in the pathway the student walked I I'm just telling you the concerns that that sure and the answer to that is no again no really and truly as I stated last time the administrators nor I want to quarantine students we do not wake up and say oh we just want to find out who is passing the students as you just said uh in the hallway to quarantine folks that that that is not what uh the folks are doing they are looking to see primarily as I describ in the the previous meeting at the seating charts uh when folks uh are known to be within the six feet and then when the 15 minutes is there due to
041a class period uh and again that's mainly for the secondary for the primary it is somewhat easier because there's not the six classes so they know who's been um there in the proximity and then to your second part again by the requirement piece um is a mandate from mayor Coba County about the quarantine so again Deer Valley is not doing uh the quarantine we are excluding based off of uh the County's quarantine which is required we'll have to agree on that one because it's it's not there's a lot of mandates that there it's not law so we'll just have to agree to disagree on that one um we can but our lawyers going to sway the other one and that's just I mean if they if they were to put out a mandate to uh
042I don't know make each person cut off their left fing finger what we say okay let's just do it and I don't think we would so I do think there is a choice in in some of this and and I do think that that our senior Administration is making somewhat of a choice um but that's what I have lawyers again I would say that we we really have no desire to wake up and quarantine a kid all of the staff are administrators I am 100% confident um that they would Echo what I say and that we want all of our kids to be in school uh as much as possible absolutely 100% uh however we do find ourselves in this situation when we are um being told by both legal council uh and through mayor
043Koba County with the county attorney and the statutes that this is not a choice by us that this is a requirement okay Mrs Reed so in in hopes to help clarify a question that Mrs Fischer asked um because I know that when I had a student who was um exposed to covid it was the first question that I asked and they weren't the administrator wasn't able to share it with me but I asked what class he was exposed in and they said I'm sorry I can't tell you that so is that something because do we not share that information because we don't want it to be identifying information to the student and that there would be backlash against that student or that family or um it that is correct okay thank you Mrs paperman so
044you mentioned that when the community numbers are up uh with co uh this uh within the school uh also the number go up correct uh president OB Miss paperman yes that is correct we do correlate with the counties that be curve okay uh well I'm a classroom teacher I do have 28 students that were mandated that all of them to be mask and I work with second graders so you do see kids even wearing masks and I was wondering about that that mentioning uh you know the community the number goes out so you know even if they're mask in the classroom you know know they can get within their Community are you Miss paperman are you asking me a question yes what could you repeat that question even if a student like I have 28
045students you know they're all mask uh and and like you stated like you know if the covid numbers are up within the community they're going to go up within the classroom so basically even if if all of the students are mask uh they still can uh get Co from outside the community even if we're following all the mitigation process within the classroom uh president O'Brien Miss paperman I think are you asking would the students be quarantined if they were wearing masks well I'm looking at the numbers uh because I mean I see 26 positive I think de Vol uh with with the numbers that they're not high uh so I'm just was asking like uh if the numbers were up within the community these numbers 126 probably would have been higher uh because kids probably
046will get contact from outside of outside of school correct the again the the more the higher the case counts in the community uh we have seen in our data uh since uh we have been tracking this at the start of last year that again when the community numbers go up are dvusd active uh case count goes up as well and when the community numbers go down uh we see in our data that our own Co dashboard uh sees a reduction in total numbers as well okay I know uh within my district even if we have Max mandate that every student needs to wear a mask we still see students getting sick so I assume that's from probably in the community if the numbers are up they're going go up even within the school district even
047if they're all woring a mask uh certainly that Co is spread in the community um or that's one of the areas of spread in the community and so that um could be the case as you describ okay and another thing with the mitigation process I know uh I truly believe I know the governor you just threw it on our laps of you know going back into you know the school uh you know mask you know is going to be a choice uh but one of the things as a teach it would have been fantastic if we had lower class lower classrooms a lower you know students within the classroom that that would have made a big difference uh with the mitigation process instead of having large classrooms and uh this is one reason I would
048say not getting support from the governor uh you know we see High cases in in in other districts uh of students with covid uh since we did not get the extra support and funding to support the districts Mrs Ordway uh going to quarantining um if there was is there a difference um when you're quarantined if you are a person whether it be employee or student wearing a mask president o Brian Miss order yes uh and that is a let me answer that in two parts because it is a it necessitates a two-part response uh there are differences between the student and the staff member so with respect to a student there is a provision in the uh quarantine requirements where they provide exceptions uh for the need for a student uh to be subject to
049quarantine one of those is if the particular student uh is who is covid positive is wearing a mask and if the other students that would be identified as closed contacts are also wearing a mask that they then are exempt from um quarantine or in other words they are not subject to that mandatory quarantine for so that's the student side right the staff piece is different uh because there's a couple reasons one that particular provision actually does not apply to adults however there's a different provision which is the essential worker status in so essential worker status then provides Mrs Moffett and her team uh some discretion as far as uh how they would determine if someone needed to be quarantined uh Mrs mafa could talk about this at length but they too have uh kept track
050of their data they have analyzed their data and have uh they know when it's likely someone may um become covid positive or not and so they use that as one of the factors in terms of determining when someone would quarantine or not so uh if we required indoor masking our quarantining would most likely go down for our students U president O'Brien Miss [Music] Ordway your your question is if we required masking would quarantine go down would there be a great possibility of the quarantining going down yes yes okay all right that's it that and then Jenna um or Gary maybe this is you too I don't know maybe it's Jim who knows um I know that we are so down on our cafeteria staff our food service workers uh depending upon the size of the
051school are we noticing that our kids are not getting that full 15 minutes to eat and if you don't know that answer would you maybe get with Jan and and see if that might be an issue for our kids not getting enough time time to if there's not enough time to serve or enough servers to serve and I'm only talking K8 um that's the only configuration I'm referring to uh yes that's information that I could find out for you and put in a board update because I I know that we are not able to utilize our fabulous volunteers like we used to when we were down food service workers so I was just wondering if that's been impacting um time their eating time and thank you very much for your information Mrs O'Brien thank you
052thank you thank you um for the report Dr zerbach and Mrs Mett we will now move on to Old oh I'm sorry we will move on to call to the public we have do we have any for the general call of the public okay so the admonishments already been read um if these folks would step to the um microphone as your name's called is that CIS Fitz CIS Fitz and then Gabriel SAA Shantel briak if you'll step to the microphone and you go ahead State your um you might want to use the taller one might be more comfortable but your preference if you just uh State your name for the record and then your time will begin um sorry hello hello my name is Gabriel sza I'm a junior at Sandra de o Conor High
053School um please step closer or speak a little louder um sorry I'm a junior at Sandra de o Conor High School um I've previously attended Hillcrest Middle School and lo Bri's Elementary School um I'm here today to um ask um um for you guys to try and um require masks again like you'd had previously um as I understand um right now as it is a person who is um wearing a mask and a who tests positive and a person who sits next to them and is also wearing a mask um the person who did not test positive would um not need to quarantine so therefore if there um was a mask requirement again no one but people who students who tested positive would have to quarantine to me The Logical answer is to um require
054masks again and so I'm asking the board um to because I know there are many rules or um things in place that are preventing the requirement of masks so if given the opportunity I would ask the board to um require masks once again thank you have a good night thank you for your comments our next next speaker will step up to the microphone state your name for the record and then your time will begin name is Shantal break and um I have sorry I have uh eight kids one a 2020 graduate from Boulder Creek three more at Boulder Creek currently and four more at Canyon Springs Elementary um we've had multiple quarantines in my house as you can imagine with that many kids um my son I'll use as an example he's a sophomore at
055Boulder Creek he went from straight A a straight A honor student to barely passing he's given up um he I I don't understand the required instructional hours that you guys have on paper they're not getting that when they're in quarantine they're not getting any instruction he's given an assignment and he's expected to do it and he doesn't know how and his he can't even reach out to his teachers um I just don't understand how those needs are being met when he's home healthy he should be in school when he's healthy he's not the one who's sick and I'm sorry but wearing masks last year didn't stop the quarantine so masking up I don't think is the answer but if you're going to quarantine kids who don't get the shot then you should quarantine the kids
056who do because they're it's proven that they're still spreading it they're still catching it I know personally two of my daughter's friends who got the shot got covid they were still in school up until the point that they got covid they weren't required to quarantine when my daughter was because they had the shop but they still caught it and they still can catch it and spread it so I just I feel like my kids are being discriminated against and they're not getting the education that that we pay for um also my son like his classes are um software development we don't have things at home that he can do the class in he does AP Chemistry can't do that at home either it's handson um Spanish I don't speak Spanish I can't help him with
057anything um I just I just don't think it's right I don't think it's fair and I think it's discrimination and it needs some there's got to be a better solution um I don't and I also I was wondering if like why can't we get antibodies tested and show that for proof because we've all like my whole family's had it I've had it my husband all my kids we've all had it um I just I feel like there's more options out there that we're not exploring and I don't feel like the quarantine is the answer it's taking education away from kids that's all thank you for your comments and Dr Galligan could you please reach out to her to talk about the concerns relating to um the proper instruction during uh quarantines thank you okay our
058next item of business is old business and I'll make a motion that the governing board approve the K12 Visual Arts curriculum adoption as recommended by the administration a second and we will um apologize I lost my connection going to Dr gallagan president O'Brien there are no changes to the presentation that was shared at the last board meeting for this adoption excellent I see we have Mrs Backstrom with us again this evening thank you for joining us are there any questions for okay Mrs fiser has questions um the board um did receive an email with a link um and that link goes to this curriculum um and a lot of information regarding uh critical race Theory and things of that nature did you guys discuss any of that when you were reviewing it did the parents
059show concern did did any of that come up um it was the information when you followed the link was was a little bit disturbing presid president obrien miss Fischer I think we have some followup information to clarify that concern and I'll have Miss back Backstrom share president O'Brien and Miss fiser thank you so much for that valuable question as you speak this is a very Hot Topic in all of our districts now the link that you received was actually from a magazine article that is not endorsed through the current curriculum that we are looking at and it is public opinion only if you look at their website and any of their curriculum their lesson plans all of that information does not have an author name next to it because that information has been curated by
060an advisory committee which does not contain any type of information about critical race Theory or black lives matter the curriculum that we're looking to adopt is strictly about curriculum it's educating our students on state standards and teachers have been advised to refer to our very own dvusd outcomes and benchmarks as they are creating their lesson plans and unit plans as well as their Curriculum maps so all of these things um the articles in which you are uh pertaining to that is on their website because they are a public education University therefore their magazine articles are submitted from constituencies from across the United States and this particular article was submitted from someone in California where her districts are having to conquer these huge issues and topics so they uh the article very clearly states that there
061is uh certain States and it does list every state and links to the law that these certain states do not support the usage of this this particular material therefore this article is informative only and not to be adhered to through school districts within these particular States and that would be in the second paragraph that you are looking at in that article doesn't look like an article to me it looks like a lot of curriculum discussion um there's actually two links so I'm not sure um which one you're referring to it goes to the art of Education University um their philosophies what is critical race Theory and what might it look like in the art room um the other [Music] one sorry my apparently our network does not like Chrome the other one may be an
062article but one of them is a link to actual I'm understand the other one is an article the other one is it's episode 158 it's it's it's it's actually several um articles um but there is a lot of curriculum in this um that is directly related to Black lives matter and critical race Theory um how can we guarantee as we adopt this that you know that portion of this product of this Corporation is not going to be brought in here um when our laws are already challenged because um the the overall liberal um public education system is going to fight anything that's that does not fit their agenda so what guarantee do we have that that is not going to be brought in um through this and I I will say I didn't have they
063sent it fairly late and I was at work so I'm not I haven't read through all of it the second one is definitely articles the first one is definitely curriculum um so Dr Finch Yep this um I'll reinforce what Miss backom said um this is a vendor um and they sell to everyone in the whole country probably around the world and so um what we do is is we go and get the things that we want that line up with the Arizona State Standards and that's probably true with all vendors all vendors um if they sell to California and Massachusetts and Arizona um each uh company each district um have a unique relationship and then we download what we want to use that meet the Arizona State Standards so when we tell you um that's
064not part of the Arizona State Standards uh we will not be using it and that's how it's set up so is there a guarantee that a teacher can't download it correct an access when we correct when we We Gather that uh what when we buy something we uh import it to us that's and that's true with all vendors okay do you have any further questions I've seen teachers download so I'm just I'm not going to argue because I mean it wouldn't do any good but I've seen teachers just go on to what websites and since this is an appr if we approve it um I could see them just downloading something we're not approving the website we're approving curriculum that we are getting from this company and so there is there is a difference between
065saying this s is an approved um you know vendor anderes their website and go access whatever you want we have um vetted with a committee that it contains administrators teachers uh parents and it's gone through the process so we have a specific curricula curriculum coming to the district I see three heads shaking up and down in the yes in the affirmative so I I believe that's what we're doing we're not just saying go to this website the truth is every teacher anybody could go to any website right and pull it out that is why we have District policies it's why we have um administrative management guidelines it's why we have State statutes and certainly we also have a process by which somebody can file a complaint or call a teacher or call a principal and
066say this is not right if somebody gets does something that is not following our state standards and our District's curriculum um and we also have a discipline policy for that as well so this is curriculum I understand that you may not believe that this is what we're going to do but we are having our Administration say this so no I do understand where we are we are getting um curriculum from the art of Education who just happens to have critical race theory in their in their curriculum available as a potential to have curriculum it does not mean that everybody gets that curriculum no Dr Galligan you're shaking your head so please correct us president O'Brien uh the the resource that our adoption committee reviewed goes through a rubric process and part of that rubric also
067looks at does this material have controversial material attached to it and so the team reviewed all of that so the the specific adoption that you we are asking you to approve uh does not include critical race Theory or black lives matter Miss Backstrom thank you Dr gallagan um president O'Brien and miss fish fiser I I did have the opportunity to speak to the art of Education University's Chief academic advisor and she did absolutely assure me that no part of any of their curriculum which she and their own advisory committee has vetted contains nothing about black lives matter and critical race Theory again we are not adopting the magazine in which the articles are found in we are adopting the curriculum which is academic in its Essence and focuses only on our Arizona State Standards great
068thank you so much Mrs paperman so my question is uh especially now the way things are with critical race Theory sex education uh these communicated with parents like well we're going to adapt this curriculum but we will not be using this part that this is just uh we we we're only using this curriculum that's going to go uh within the Deer Valley because parents are going to look so they they may not understand you know the process you know when we adopt a curriculum but maybe communicating you know to the community and parents for them to understand that that you know that this is what we're going to adapt if you find this this is not going to be part of the curriculum and I believe this will you know uh the conflicts you that
069this this will we will not have conflicts if we can communicate this President O'Brien miss paperman when we do our training with our teachers as well um that information will be be part of the actual training and we can work to to uh inform our parents if um this is adopted by the board and another thing that Miss Brian mentioned which is true uh yes you know we have a lot of teachers within the district uh and yes you know sometimes mistakes happen and teachers will go to the wrong website or use a website but they are overseen by the administration so so it's you know it's not that the district is not doing what they're supposed to do you know sometimes you know yeah there needs to be disciplined if they go out of
070you know what they're not supposed to be doing so that will be a teacher's Choice thank you Mrs paperman any other Mrs zway I just have a comment I I did send some questions in had had you know the answers I I think that when we are looking at curriculum from vendors we pick and choose the specifics that serve our students um to accomplish the standards but we pick our curriculum and then we go over that and then we call it again and we do what um what's best for kids in DB USD and I think that with a critical race theory that um we still can't even uh Define what that means because it's been totally um taken taken in a different direction than than it originally um had been used or black lives
071matter that is going to be be part of of History doesn't mean that uh you can't say those words so I think uh for you Dr gallagan and your team kudos to try to figure something out that doesn't have uh those letters in it and and know that we're not breaking any rules or trying to indoctrinate anyone with a one side or another thing okay um with that I will call for the vote all those in favor please say I I I any opposed please say nay the motion passes 4 to one I didk you was that a correct vote okay thank you yes we'll move on to um consent agenda items all right I would uh ask that we or make a motion that we approve consent agenda items 6 a through S minus
0726f that is going to be considered separately I second we have a motion in a second all those um in favor of approving consent agenda items 6A through 6s with a exception of 6f please say I I I I I any opposed please say name sorry did you vote Mrs Fisher I did not I just didn't hear you okay yep all the um sorry motion passes unanimously thank you we will move on to 6f I'll will make a motion that we approve item 6f governing board policy b e d d Rules of Order is there a second I second okay this item um was I pulled this item because we had a couple of uh comments at the beginning of the meeting regarding um this addition to the policy uh we just um WR the
073Arizona School boards Association or I was um at the law conference where this item was discussed this um has been a part of the law it is about calling a recess to return order to a meeting when things um have gotten out of order it is merely a recess to bring the meeting back to order a governing board president may not adjourn the meeting on their own if they were not able to uh bring order back to the meeting and we would do that in concern for safety of our staff and our um constituents are who are here as well as our governing board members the governing board would need to come back out and take a vote to adjourn all as I stated this is already um uh permissible by law I think that
074given the climate over the last um 18 months what they wanted to ensure is that governing boards and governing board presidents in Arizona knew that they had the ability to call a recess without having to take a vote um again does not give the governing board uh president any power to adjourn the meeting without a vote there any other comments or questions Mrs Ordway I was just going to say um it's it's has been there and it is for your safety it is to quickly recess a meeting so you can get into a place that is not standing out here it has nothing to do with a board president having power to do um anything other than keep his or her uh board members and people in the audience safe any other comments or discussion
075Mrs paperman so from my understanding this is a decision that we're governing boards and this what is a collective decision uh that just not the board president is going to make be making the decision that it's going to be so the board if if if the board meeting is out of control and there's a concern for safety the board president may call a recess without a vote okay so it is not a collective decision to call a recess to re turn a board meeting to decorum so you make that a board president would make that decision out of concerns of safety for those in attendance at the meeting that would mean you would come back in a reasonable amount of time and either resume your meeting or if if you cannot achieve decorum and safety
076is you know board members don't feel like they would be safe there would have to be an adjournment which is voted on by the attire board that is a collective decision by the entire board okay that makes that makes sense thank you okay okay there's no other discussion I'll will call for the vote all those in favor of approving Beed please say i i i any opposed please say nay all right we motion passes four to one we'll move on to action item 7A yes I would uh recommend that the governing did I say something okay we're all voted in everybody's vote is recorded I would make uh a recommendation that the governing board approve employee out of state travel as per governing board policy g c c i second any discussion Mrs fiser it
077wasn't my understanding that um our cabinet decided they wanted to continue the Consortium and Mr Finch decided he did not want to be part of that but he wanted to go to the aasa has that changed no that's not true um we are still part of the cons but they haven't been meeting because of Co so are they not meeting this year and that's why everybody wants to go to this meeting correct now a few years back we had a concern from the community that all of senior leadership was gone and if something happened what security measures do you have in place for all of you to go um Mr or no it's not a week 16 well was a week um I have have nine cabinet members and so they're will be six administrators
078at so six administrators will still be here so all of senior leaders including U Mr migrino my Deputy superintendent so not all of the senior leadership will be gone Mr mcino will be here as well as five other cabinet members six other yep okay okay in the real is there any other questions or discussion all those in favor please say I I I any oppose please say nay nay motion passes 4 to one make a motion that the oh sorry please record your vote no did it go are we all done all right I will make a motion that we approve addended pre-approvals I second second any questions okay hearing none all those in favor please say I I I I any oppose please say nay I'll just abstain okay for I one exension the
079motion passes all right um I recommend that the governing board accepts the administration's recommendation to add extra duty pay for non-classified hourly staff who complete custodial duties the extra rate of pay Duty will be set to be equal with the beginning hourly rate of pay for custodian 2 and I'm pretty sure we'll get a second and have that explained do I have a second second okay and we will go to m muffett for this item president O'Brien governing board members what human resources is trying to achieve here is to have a rate of pay that our non non-classified staff could use when performing custodial duties so the ask has been because of our custodial shortage could our certified staff or non hourly staff perform this function and also be paid we don't have a pay
080rate for for this and everything that we do pay we need to show that the board has approved that rate of pay so we did consult legal specifically um on this item to ensure that we are following all guidelines that are necessary and of course the recommendation is to um uh utilize a rate that is equal to a custodian that performs this function so that's why you see the formula as you read it um currently that rate of pay is $221 to change in January to be $128 80 cents so that the board would not have to um approve that rate every single time that is adjusted that you are approving the formula for that rate so the attached pay sheet that you do see is the same one that we brought to you in
081the summer when we made adjustment for our non-hourly staff who um have a prescribed rate of pay for different functions are there any questions I would just like to know is there a reason I mean do are we do we have a lot of teachers that are acting as custodians or is this just for them to clean their classroom you know between classes or when they're on you know yeah president O'Brien Miss Fischer it's it's a really good question I'm um it is not likely going to occur very very often but we have been asked more than this year if this what we can't do is employ someone as both an hourly classified staff member and a a non-classified staff member so in this case this will allow those that would like to do this
082would like to step in and perform some custodial duties a couple of hours in the afternoon because they do have a custodial vacancy um they would be allowed to do that and receive compensation for it so do we have something in a process or procedure or something to ensure that they complete their duties of their full-time job I mean what I wouldn't want to see as a teacher saying well you know I've got my I'm going to give up my prep time so I can go clean the cafeteria for 12 bucks I don't know why they would but but you know that that's the kind of things that a community memb is going to see a teacher doing something like that and they're gonna true or not it's going to be a question that comes
083so are we it's it's a it's a great question and this this would be um allowable outside of their normal working day so when they're um if it is a teacher if their normal teaching day is done and their meetings and responsibilities are done then they could move into performing the custodial D Dy so it would likely be an early morning or evening um responsibility this would be similar to a teacher who had a second job away from the school district correct okay thank you very much do you have a question Mrs Reed I don't have a question just a comment I just want to say thank you to um the other staff members that would consider doing this um to help fill the void and um help make sure that their um school and
084facilities are clean so thank you Mrs Ordway I just have if you have this off the top of your head how many um custodial positions are open now I mean from plant Foreman to wherever I um president O'Brien Miss Ordway I do not know that number off the top of my head right now but it is something I can provide to you this in the this week's update it apparently is a larger a large number that would require um other than our hourly employees to want or need certain number we're not comfortable with um and I believe as I shared with you last time when we in the last report I provided the Staffing update and at that point in time um we we were struggling and we do at um hire a few and
085sometimes lose a few in our contract agencies are struggling as well filling those same um jobs all right thank you with that all those in favor please say I I any opposed say nay hearing none the motion passes unanimously are we ready all right I would would recommend that the governing board accept the administration's recommendation to approve increasing substitute pay rates for the 2021 2022 and the 2022 2023 school years as presented a second and Mrs Mett you're up again president O'Brien governing board members this recommendation is due to um recent comparisons that we have made with um similar districts and also non-similar districts if you recall recently you approved a rate of $110 for a daily rate for a certified substitute at that point in time we also um made comparisons after that many
086of these school districts increased the rates even days after you approved the 110 rate so our goal here is to continue to be competitive but we are specifically if you see um in our proposal we're specifically outlining this increase for this school year the 2122 school year the 2223 school year because we will be able to utilize Esser funds um for this purpose Esser funds will expire after that and um we will need to re-evaluate as well as the other school districts will re-evaluate what they are paying to try and recruit substitutes so we don't only want to recruit substitutes um by at increasing our pay but we want to Value the ones that are already willing to work for us if you look at the rates of pay that we are proposing I do
087want to um um I uh call out the VIP rate of pay that is not an increase it is just listed for information we are proposing a rate increase of uh for the daily rate to be 130 and the long-term rate to be 175 the 202 rate was established and it is outlined I believe in the certified manual and um as we uh looked at this I believe it was established back in the late 90s for a specific small group of employees a lot larger then but I believe we only had six of those employees left where that agreement was made so that is a again driven by a formula we're not proposing it increase it's for information purposes only thank you Mrs Moffett any questions from governing board members Mrs paperman I believe uh
088that you know I know in my district we have a short of of substitute so I I know everything comes down you know to the budgeting you know to be competitive and uh having that support that we need right now especially you know if teachers are getting sick and yeah so so if there's no substitute are the teachers cover for those classes and they can compensate it correct president O'Brien Miss paperman yes um we have recently implemented um the requirement for all campuses to use sub rotation pay when they are on sub rotation okay thank you okay all those in favor please say I I I any oppose say nay hearing none the motion passes unanimously you're all good all right I would uh recommend that the governing board accept the administration's recommendation to approve
089the instructional time model for the 202 21 2022 school year do I have a second sorry I have second we have any questions or comments Mrs Fischer um what's the primary reason for bringing this forward is it so that we can just continue to get paid while kids are quarantined and on canvas I mean I I that's that's the direct question I was asked I know that sounds a little I didn't I thought of ways to try and soften that up but I don't know no that is what it appeared to be state law no it's state law that we can change it that part of state law I can't change state law canvas using canvas with no instructional time is state law how where is that can you please tell me no that we
090have a public we have two public hearings we have to have two public hearings at state law no I understand that's part state law and the board by law can make that choice following the two public hearings what did why did our Administration decide to to to change the model now is it specifically because of uh to to have that ability to use canvas um and have that count towards funding time or was it or was there another reason president orway miss Fischer um Mr mcino can jump in as well we were given the opportunity to ensure sure that we have shared our different instructional time models including the ones that are typical the the traditional as well as our aoi which is Aspire um if you remember we also put in information in the
091event that we would have a Statewide closure um that had to be part of our um instructional time model and then for those unique situations or for um unique populations we wanted to sure that we had um ensured that all opportunities for instruction remote synchronous asynchronous in person were outlined in our two public hearings and as Dr Finch indicated um this this was state law given to us so by adopting this and correct me if I'm wrong the district is guaranteed funding no matter what so long as that child is enrolled president O'Brien Miss fiser I'm going to defer that question to Mr mcino or Miss mock president O'Brien Mrs fiser um we would in order to have any sort of option for distance learning we have have to adopt an itm um funding is
092um I wouldn't say guaranteed based on the itm if we ended up where more than 50% of our attendance or um attendance in an it in a distance learning plan for any single single school for the school year our funding would be reduced by 50% so the only difference is this allows us to continue to provide students education while they are not in the school building if we did not adopt the itm it's really not about the funding um even if the students were marked absent we are still funded when the student is absent this just allows us to continue to provide um those funding and with the distance learning codes provided by uh ad uh School Finance uh allows ad to track those students who are in distance learning so I think what we
093tried to do was to make the plan as flexible as possible not knowing exactly what would happen on an individual student basis on a classroom basis on a school basis on a district basis on a state basis and we want to be prepared for everything so that or any possible scenario so that we can continue to provide that education but the decisions were not made based on a um funding methodology and even with an adopted itm can reduce they were actually named the different including canvas was actually named as a mo for us to use so and that was one of the questions I asked when we first started quarantining kids is are they absent or what is that and no they're not absent because they have canvas and so my concern is that we're
094going to put a student out 10 days on canvas they come back a day we put them out for another 10 days on canvas they come back four days we put them out for another 10 days until the parent says okay I Surrender I will mask and vaccinate this child and my concern is is that what we're doing or why did we name canvas specifically in it we named canvas because that is our learning management system so we could have easily replaced canvas with District learning management system it would have been synonymous okay okay seeing no other questions call for the vote all those in favor please say I I I any oppos please say nay I just want to explain my vote because I want the parents to understand that I'm going to vote
095I for this um I do not support what's happening to your students canvas I do not support the damage being done to them however if we don't adopt this there are other kids who are online that we really need them to have those services and for that reason alone I'm going to vote for it um and with that vote we uh approv that unanimously we will move on to item 7f all right I would make a motion that we adopt the re Vision number is that 27 I'm sorry number one to the 2021 expenditure budget I second there any questions all those in favor please say I I I any opposed say nay hearing none the motion passes unanimous Miss Lee once we record our votes okay you're good Mrs Taylor awesome all right we're
096going to move into our preview items and for that we will go to Dr Gail gallagan oh no sorry wrong oh no it is Dr Gail Galligan I apologize or we need the clicker to move to Dr gallagan please president O'Brien members of the board and guests this evening we bring you um a preview of these particular policies um there will be Beyond um curriculum instruction and assess M um Human Resources will also have some of the policies to review uh as you can see here um these policy advisories are from the 55th 55th legislature on the first regular session in 2021 we will be advising the board and making recommendations to either accept or not accept uh the the um changes to these particular policies the first one is policy IC which is let
097me get to it which is um talking about instructional time actually what we just um talked about um it is for instructional time and instructional hours um a minimum of two public hearings are to be given and it is to adopt any of the instructional time models that our district has put forward we would like to say that this is a policy that dbd would accept um ASB asb's language policy Iha is the basic instructional program it's amended to move a deadline that was um fairly close so that at least one kindergarten through third grade teacher at every one of our k6 and K8 schools would have received training related to dyslexia that date was changed to July 1st 20 22 and we would U recommend that we accept the ASB asba language change policy
098IH MB Family Life Education uh is amended in each of those bullets I'm not going to go over the full bullet but I do want to just go over highlights that first bullet is talking about instruction uh for sex education may be offered in the district the second bullet says the school shall obtain signed written consent from a parent or Guardian before any materials are used on sex education the third bullet indicates that we are not to provide sex education instruction before grade five the next bullet indicates that before a parent provides written permission they should have time to um review the sex education curricula um online or in person and at least two weeks before that instruction Begins the next bullet indicates that the school district governing board reviews and approves the sex education
099course of study um that is provided the second to the last bullet indicates that a school district is not required to provide sex education instruction to pupils and the last bullet indicates that the statute does not prohibit classroom instruction regarding child Assault Awareness and Abuse Prevention we would recommend that we accept asb's language which changes policy ihb which is instruction and training and suicide prevention um is amended to say that if a school district provides identification cards to students in grades 9 through 12 that at least one of those four a through D um is on the back of the card and I am happy to indicate that in Deer Valley C and D are part of our high school identification cards already and we would recommend that you accept the asba language policy IJ
100uh provides greater um information about the definition of a textbook and textbook now includes printed instructional materials and digital content uh we recommend that we accept asb's language changes policy JJ textbook supplementary materials selection and adoption it is very similar to the previous um policy it has been updated for that definition of textbook and that a textbook includes printed instruction materials and digital content we recommend that we accept asb's language changes policy IMB teaching about controversial or sensitive um issues that policy now states that teachers administrators or other employees of a school district in grades preschool through 12th grade may not use public monies for instruction of any form that puts blame or judgment on the basis of race ethnicity or sex we recommend that we accept asb's language changes I'll turn it over to
101miss Moffett I believe or um Dr zerbach for policy JK okay we have three policies here for a first read for you all of them deal with uh House Bill 2123 uh which is a new house bill set to go into effect on September uh after September 29th uh there are Provisions in the language which are uh meant to limit the amount of suspensions uh and it also has an impact on expulsion as well for particularly for students in the K4 grade levels uh so for our uh JK for our first one uh we would recommend that the uh governing board would approve uh asb's language in addition to that we have added one particular word um that is not included in asb's language and that has to do with threats that to us um
102in the asb's language it says only to let me get it [Music] here uh teachers or other students and we have added the word schools as well so General threats uh that are to a school we have also included uh in terms of the regulated speech component for policy JK d uh again this is very similar because this speaks to uh the student suspension and so uh for this particular one uh again it has all of the language from uh the house bill 2123 we'll recommend again that we would that the governing board would approve this uh we do not accept uh the asb's language as is and that is because previous to this uh the governing board had already made a modification to this policy uh which allows for Vista Peak to be an
103alternative to um suspension so that is not something new but that is the reason why it's not a copyrighted for asba okay and then for jke uh this one is specific to expulsion and again uh just to repeat this is due to the house bill 21 language uh which does put on specific uh restrictions uh when you can do this with students that are in uh grades kindergarten through the fourth grade and on this one we would recommend that the governing board accept asb's language Dr gallan policy KB parental involvement in education is uh very similar to policy I MB uh the altered language uh includes uh information on instruction learning materials or presentations regarding sexuality in courses other than formal sex curricula it would require parents to opt their children in to any instructions
104such as this including learning materials or presentation it reiterates uh language that was added to ARS 15113 requiring parental consent before providing sex education instruction and you just heard that in the previous Poli we recommend that um we accept asb's language these are preview this board meeting and we'll come back to our our board at the next board meeting for Action thank you are there any questions at this time Mrs paperman so my question is uh like policy they have to be parents consent those AR follow through was the accountability president O'Brien Miss paperman uh once the board chooses to accept asb's recommendation this information goes out to our campus administrators um and and then they will be aware of changes in the policy and then we also review policies on a yearly basis with
105our campus administrators okay okay I see what you mean okay thank you all right then we will move on to governing board reports Mrs Fischer Mrs paperman I would like to say uh that as a classroom teacher uh we're working really hard this year and uh every district is trying their very best uh uh it's very difficult to figure out uh you know right and wrong wrong answers uh with you know with mitigation process and uh even having large class sizes we're not getting support from the governor uh also trying to fill in the holes from the students uh that were online and now we got them back so teachers uh for this year is going to be uh very challenging and and I will say to the administration to you know to have some
106compassion for for our teachers uh because you know going through from an online teaching uh through you know challenges that we face and now we're returning to school and then we have uh new ways of teaching to to reach our students so just have compassion to to our teachers that moral support okay back to you Mrs Fischer [Music] um before I hit the law conference um one of the things I want to note um and there's been a few different things in the meetings um I Believe Miss Reed at one point had mentioned you know the public understanding and being kind um I want to say that there is an extent for kindness and understanding and I think everyone up here well I I would assume everyone up here knows that when you signed up
107for this position you signed up for some people that hate you and some people that love you and that's just what it is and you're going to have both no matter whether you're a vocal board member like me or a quiet one does it make a difference you will have your people who on either side have an issue with you one of the things that I saw last year when I was running um and I did not reported in fact I was very uh vocal about it to the individuals was when they talked about showing up at the board members houses and I took a great exception to that and I said no don't don't do that that's their home you don't do that and part of the reason I understood that was because during
108the whole aiota thing I was followed home I had to have security I had to make arrangements with my neighbors um I had to have a weapon at my front door for safety um and much more this is regardless of whether this is an unpaid position or not it's it's it's ridiculous when it goes that far and I think it's growing and getting in perpetuating by the behavior of all of us I know that the individual who there was an individual that sent an email um to some of us and I made it clear I was not going to engage with that individual uh for many reasons um and uh I have filed a police report with the city of Phoenix because city is who you would file with um and I have taken other
109steps to secure my family and myself um the public needs to understand I I don't care whether you like me or not and I don't care whether you like these board members or not but when you start talking about a physical threat or you start talking and it's not even so much necessarily a physical threat but when you you start making it be known Miss O'Brien I know where you live I know where you this I know I can get to you no matter how they block you they can get to you whether it's done to any one of us it's wrong and not only should our our police departments address it our staff should not be encouraging it and they should not be encouraging the abuse of any board member whether they dislike them
110or not and they should not be gossiping Within this building or any other building whether they like that board member or not so that's my stand on that one um secondly that brought up a lot of of um one of the things that that made my individual really reveal herself was a post that I had put out I gave a summary of actual actions um actual statements um and and I will will say right now at no point have I ever slandered Dr Finch um I may say things he doesn't like um they are things that he has either done or said but they are not slanderous because slander has to be false that's just the way it is um there's a lot of people that agree with with what he's done or or hasn't
111done um so that again is similar to the board members that it is what it is but it did bring to mind that there is a lot uh in the last eight months I have some of the most vile and venomous emails and most unprofessional emails from Dr Finch and um we all sat in this board meeting and we watched as he would not turn his back or he would not turn and face our our our community um and I am requesting that our board consider not a punishment towards him but that we we have a meeting a private meeting with Dr Finch where we discuss all this it's whether we resolve whatever this this isn't about a punishment for him but we have to resolve some of these behaviors in general for all of
112our sake for our sake and for our public sake because it's spiraling and it's getting worse and it's not benefiting anybody it's an Ask um like I said I I've said it before when you have a board with a with a a makeup as ours generally it's it's you know what the vote is it is but it's an Ask um now let's going to gohe I'm going to go ahead and go on to our um last week I did go to the law conference as well um there wasn't anything significant to report on Wednesday they were good uh but nothing that was to me was very very telling um however on Thursday I was very uh encouraged by and I I I don't think well I don't know if other people enjoyed him but I
113enjoyed um the keynote speaker uh I think he is the first semi or or or conservative speaker I have ever seen at asba um he was I didn't even write down his name but it's the guy from cheers Norm I think it was Norm but no Norm's the chubby guy it was Cliff John it was Cliff yeah so he was and I will say it was awesome to hear him talk about CTE and a program that he had that I used to watch um the the best thing about him um wasn't just that he was a conservative or that he was bringing forth that information but he his talk whether people showed they appreciated it or not at the lunch table they did um I was able to have a lot of very meaningful conversations
114with um superintendents of J teds or C teds or I'm not sure whether it's j or C because they all say they're something different um and with board members specifically of those um and and what we can do to ensure or to help uh to ensure that our kids that aren't necessarily College Bound are prepared for a Jad um so that they can have that path that career path and it was meaningful um the key is to get them in the eth grade there was a lot of information they shared and I just think it would be beneficial if we partnered with at least had a meeting with some of our our Jed and talked about the potential for identifying kids in the eth grade um uh one that was one of our big conversations
115because I had told them I said what is it you know how what how can we help you and help our students um and one of the things is that that aptitude test because we talked a lot about what all of our qualifications were um a votch is is the only reason I graduated high school now I went on to college and I I was at the top of my class in in my studies but in high school I was not ready for that type of stuff however I could fix a car I could build a house you know I could there's a lot of other stuff I Barrel Race but I can't do that anymore my point is 4 whatever it is there is a lot of career paths that we can give our
116kids not all kids are are necessarily College bounds not that they don't lack that they lack the ability but for whatever reason maybe they just don't want the debt and to be perfectly honest there's some kids that come out of a a a career path making more than someone with a doctorate so um that was very interesting um some of the other ones I attended I attended uh new recreational marijuana law um it was kind of the standard thing that we're used to uh the one thing that I was appreciative I was able to get U some questions asked regarding uh THC products um for a potential future use in schools um because there is they are seeing a lot of um advancement with um autism and with seizure disorders with THC as a medication
117versus some of the um hardcore medications that have severe side effects um and so there is some stuff on the rizon um hopefully in the next year or so and I would I would hope that we stayed on top and and perhaps advocated for those children because they need them is there something that that uh Mr Finch Mr mcino is there something that we need to know just watching y'all okay just asking um I also attended the building need some help or something no I was just wondering just no I was just listening okay uh new recreation or the building affordable housing I'm trying to give it a um chance I did stop uh in that one uh the presentation was interesting the concept is interesting however um I did Express concern about fraud or
118potential fraud um and I did appreciate the superintendent that spoke with me afterwards um and um their concern also about uh some of the new direction of senior Administration within um school districts and their concerns um I don't know that it's a bad path or future but hopefully it will um have some better uh regulation to it um I attended one on social media rules um as well and um it was fairly standard protections of freedom of speech things of that nature nature um one of the takeaways it wasn't even mentioned in there I actually spoke to an attorney later to ask the question um because we do have people are mostly protected for their freedom of speech whether they're one of us or an employee um but one of the concerns I have heard
119and I've seen it on social media is when an employee is either expected to be um punished or whatever or expected or for something that a family member says or a spouse says um and and the question I asked is you know they're protected what about their spouse that's double protected so I just really want to make it clear to the public and I mean I if it's happening within the district I I don't know but um a family members comments arguments conversations whatever um should never impact one of our employees it's not our employee that's their spouse and I don't know about you guys but I can't make my husband say what I want him to and I can't make him even shut up what I want him to so um he's a smart
120man I just let him talk he gets there um I did immigration in schools there wasn't much there that applied to us there was a little bit for HR um but I'm sure that our HR department is on it um Title Nine regarding anti-harassment um I attended this one because I have been hearing a lot of information about um students being in bathrooms that are not of their gender their biological gender um and it's not even that those students are transgender it's students who have come to the conclusion that because of transgender kids they can get away with it and it's funny um not only is it disrespectful to a student who may need um the that you know our support but um it's concerning that our staff is in a position where they can't
121do anything about it or they feel they can't do anything about it um for that reason I did ask uh Dr Finch if we could have some consideration of maybe a policy or procedure or something a little bit more refined um to which I was uh quickly uh dismissed um but I am asking that the board consider um bringing this forward again because uh it it's we have to support our staff and we when there in a position that they can't even do anything about it and and we're going to end up losing good staff the final one I want to note um is the one that was um by our own people um it was the how many people are coming tonight about how to run a board meeting and you see so there's
122so many people that make accusations oh they did this because of this they did this because of that um it was upsetting at best to me um while you know while claiming to Value the public the board president the superintendent along with an attorney laid out the best way to undermine the public to actually uh be in attendance of the meeting the extreme limits in these seats how far they are apart far in excess of any actual safety measure the addition of this giant um table set up um to occupy an excessive amount of space I mean we are aware y all sit at a conference table together um and then uh you know that talk about you know keeping them keeping them in the lobby or or Worse keeping them out in the parking
123lot this is Arizona and I'm sorry but that's cruel that is just a cruel act um it is hot as heck out there and and you know maybe keeping them outside in December is one thing but in July is cruel that's just my opinion [Music] um I've had individuals um that question and I think they've sent it into all that you know was the boardroom stacked with employees well it it was basically hinted to that yes it was that is a good methodology to ensure that troublemaking public didn't come in and talk or didn't come in and and the the final and what was most disturbing um accusation was that our the people that are coming here are not even Dear Valley people one of our speakers tonight said and I really am a Dear
124Valley Parent because our parents are feeling that there are individuals throughout the state that are going District to District that are saying whatever there are individuals that are bringing in those affidavits and I'm sure those affidavits aren't all of our people because they I get emails every other do an affidavit to this or an affidavit to that and it's in Chandler I have nothing to do with Chandler but that does not speak to the people that are coming here the people that have come here to speak overall by and large have been our parents they have kids they can tell you what school they were in you know the group that was thrown out of here tonight did all of them have students here yes and no one couple their parents their their parents of
125students at Highland Lakes the other couple those are uh the aunts and uncles of those students and they've decided to bound together to support their kids um and and to have them removed um based on the numbers because they're not sitting in the right seat that is that is tyrannical for us to do something like that to our community and then to say that we value our community everything that was in that uh presentation though effective to undermining parents being in a board meeting it really made it a very well- ran board meeting because well basically nobody had any input not for reals and um I just think that goes against everything that we as Deer Valley claim that we believe in and we support and so if Dear Valley no longer stands for what
126we claim it does maybe we need to have a meeting and reassess what it is that we stand for maybe we do stand for a higher level of bureaucracy maybe we do stand for a jobs program for adults maybe we do stand for ensuring that the public simply is compliant to the administration regardless of how it impacts their children I don't believe that's true I don't believe it's true of of 99.9% of our staff because I have raised babies in this district and and the the partnership I had with Deer Valley from the time Barry was three till till now when he's almost 22 years old that partnership that cannot be replaced ever and and I am saddened to see that any organ any any individuals you know the question was asked but come up
127several times do people wake up with the intent of of doing harm I'm sorry but when you come up with a plan like this yes you woke up with the intent to doing harm to somebody and I don't know who came up with the plan I I I only know who presented it but I I I'm just very distraught by seeing it and I just again that's my second request for a board meeting is or a conversation is that we discuss what it is we stand for and how we can honor our public they don't have to like us half will like me half will like you or or a quarter are like me and three quarters are like you it doesn't make a difference our ultimate goal should be to ensure that we have
128well-educated children that come out of our district and I'm fearful that that is what we're losing and that's it for me Mrs Reed thank you um last week I also attended the asba conference and um was the delegate that was elected to um represent our board at the delegate assembly when um asba presented their um 2022 legislative um agenda and so we went item by item and voted on um those things and um I did vote the way that my board um requested that I vote on those matters um and so that um that legislative um agenda should be out and posted um soon um I did attend the pre-conference on Wednesday and sat in through um the the track about um helping um homeless students and students that receive Aid that was um very
129um very well presented I I thought um and I got some great um information out of it and some great questions to ask Dr Finch and followup um just to make sure that um we are doing everything that we can um for our students and that we are maximizing our Partnerships because um homelessness is um such a big topic right now um in different um levels of government but the one thing that um the different levels of government um still always have questions on is how do we identify students who are homeless and every time I say by working with their local public school district um and so just to make sure that we're we're strengthening those Partnerships um I did have a a request um you know I know that we are in um
130through my service on the board we've had different very um Hot Topic um things that have come up from boundary changes and new schools and um obviously all of the information related to covid and our um School front office staff are the ones that are typically inundated the most with questions and with um passionate feelings and um topics and so I would make a request that um the district make sure at the next um professional development opportunity that we um provide some um assistance and training to our front office staff for um maybe some deescalation tactics um to make sure that they um they are presenting themselves um in a professional way and um being able to hear um what the requests are or what the concerns are um even when the parents are very
131passionate so that we can help um resolve some of those issues um I I don't know that everybody you know those are skills those are soft skills that not everybody has um to the best extent that they could so if we could make sure that that is covered that would be great [Music] um I am concerned about one of um the items that Mrs Fischer mentioned as far as um harassment and um the accusation that she made that there might be some District staff members that are encouraging some of that harassment um and so um without being presented with the information that that she she has um I too would like to request maybe that we have a meeting um with Dr Finch I I know that Mrs Mrs Fischer has presented multiple times um
132accusations about Dr Finch being um unprofessional and um that she feels that she doesn't have access to him um as all the other board members do and and I do think that that is a concern that um the board should um should have and should look at to see if those um those things once presented are are happening um at the same meeting though I would request that we re also go over board member ethics um and make sure that the way that we treat one another and the way that we treat our constituency is also up to par with um the things that our board has adopted and that hang on our wall over there um and that is it I hope everybody has a great week thank you Mrs Reed um Mrs zway
133I didn't know that there were soft covid skills Miss Reed I think those are new um and I think that we try very hard to help each other uh deal with the world of Co because people have very short very short uh tempers now I think so we want to concentrate on our kids uh we do that through those two over there miss CTE and I think that's Mr gifted and then I see Arts over there and I can't see who that is who are you I know student support servic I'm just saying so we're all here for our kids and I appreciate the extra time an effort and uh I don't know there's just a lot of stuff that we're going through so I think if we have a meeting um to go over
134board ethics use of social media the effects of social media perhaps when we're giving our board reports and we talk about um emails or things that constituents want we we probably should do that and have a nice laundry list of how we share these emails with everyone and uh something else had come up uh about sending the board emails a person can send every member of this board an email we just don't respond to it because then that could be breaking open meeting law especially if it's something that's going to come up to be voted on but constituents have every right to attach all of our names to an email so I just wanted to clear that up um Sports is going on we've got teams winning we've got uh New Kids On on the
135what is that the new those new Fields junior varsity football feeling like they're you know the Titans now oh I'm sorry we're in Arizona the Cardinals did I say the Titans so have a great week I appreciate everything and I know we have a meeting after that and I didn't take my you know 15 minutes but I'll I'll yield that over to you um thank you all I appreciate hearing from all the board members and in light of um well I am going to say quickly that I did also attend the asba law conference and I thought the um information was good several of the key uh keynote speakers were some of my uh favorite in my um tenure as being a board member uh particularly regarding um being a generalist not a specialist and
136how uh kids who do a little bit of this and a little bit of that along their path to where they're going often end up more successful that's not to say that Specialists don't end up successful like a Tiger Woods but there is more than one path and um generalists do have uh often a lot of uh skills and transferable skills so I thought that was really um a nice keynote speaker to hear from and enjoyed hearing from the different attorneys on on the many topics uh we get to explore during this conference and so in an effort to expedite the end of this meeting I will adjourn my board report so that the superintendent may have his report because we are having another meeting to discuss um agenda as requested by Mrs Fischer I
137will keep mine short as well because I do have a longer version but I'll do the short version um we uh thanks again for the invite uh from asba to talk about um board meetings and uh safety and those kind of issues that we uh deal with at all uh board meetings throughout this state and there was there was a packed house standing room only and Miss O'Brien and our attorney did a nice job um uh giving uh really reiterating what Deer Valley does to ensure a safe environment and uh was wildly accepted and wildly cheered and we got a stand we got got a uh Round of Applause at the end which doesn't happen very often nice job and it was yeah it was a Friday so that probably helped um this morning I
138spoke to the anman chamber leadership uh group I guess we call them uh Academy about uh leadership and my 20 some years of being in a leadership chair and what I've learned that kind of stuff so it was very informative very fun I had some great questions and um and obviously it's a great opportunity to brag about deer Valley's success and so I took advantage of that as you know we have graen the groundbreaking coming for um our our setson Valley area a new Elementary popping up um September 17th pretty excited about that get that rolling as you know um many of the cranes are going alongside the road up by 17 if you haven't been up there in a while or taking a left on 303 and there's a a lot seven to be
139exact according to Miss O'Brien she counted them um that's not counting the ones on the other side so there was a lot happening um and uh Deer Valley again is on the rise as usual our goal is to be the number one school district in all of Arizona and we arm Russell with Chandler and um it's not if we're going to take them over it's when so thanks for all the support of my admin team and administrator staff working together to make Deer Valley uh number one thanks all right um meetings for the rest of the uh year are posted may I have a a motion to adjourn I'll make a motion to adjourn the meeting at 8:58 I second all those in favor please say I I I so we're going to um take
140a five minute um personal Comfort break and we will uh we will come back at 9:03 thank you study session to order at 9:04 pm. please um show oh let the roll roll call show that all members are present if I could have a motion to adopt the agenda and a second second we have a motion to Second all those in favor say I I I any oppose say nay hearing none the motion passes unanimously we are having um the city session to discuss uh agenda and I apologize because I lost my connection Am I who am I going to go to I'm gonna go to Jenna Moffett Mrs Moffett thank you so much all right good evening again president obry and governing board members we have a brief presentation for you um for your
141study session on agenda um specifically uh we'd like to First outline the purpose of aenda in our school district is a supplemental pay to employees for for specific responsibilities that are not of a nature that warrant a full position they're considered to be one-year positions and sometimes less than a year and the employee that fills that responsibility does not have a right to continued employment once the responsibility has been fulfilled for the duration outlined for that specific Enda here are um the variety of options that we have for supplemental pay types in Deer Valley I first want to say that we do utilize the word addenda in our school um district for purposes that aren't necessarily agenda so that's why I we put this um graphic together for you so first we do have what
142we call as IBN addenda this is driven by the certified manual it's identified in the NST process many of these agenda have lived in the certified manual for a very long time they are negotiated and um often times special committees are formed to review these agenda and make recommendations to the NST which of course then goes to the governing board examples of these would be coaches but specifically coaches that are identified in the certified manual because you'll see Coes come up again a department chair hair is another example a club sponsor those are there's a formula for Club sponsors in the certified manual student council sponsors Web Master and Etc and then what we have um we also have a non IBN agenda in Deer Valley and this is identified as all of those agenda
143that we have a job description for and a pay formula already identified that does not live in the certified manual this process has been um streamlined over the last handful of years we'll talk about that in an upcoming slide in order to provide um more Equity across our system some examples of jobs that are outlined in non IBN agenda or receive a non IBN agenda are extracurricular and co-curricular responsibilities online instruction um we offer many addenda full-time positions and addended positions as you all know in Aspire that that would be instruction um and then school or Department additional responsibilities that might be um approved are paid through non IBN agenda now the third column is what we use the word agenda for but it's actually a stien so you might hear someone talking about a
144hardto fill agenda or I receive a national board agenda they're not actually agenda because there's no job to fulfill rather they are as stien attached um to to a qualification that you do have have so if you are in a position that is identified as hard to fill then you would re receive that hard to fill stien national board or related Services licensing all of those actually that you see there are outlined in the certified manual but I just want to be clear that they are not a denda they are a stipan and then another form of supplemental pay that we utilize is extra duty pay these are hourly compensation this is hourly compensation that our employees compl complete extra duty pay forms for those are routed straight to payroll someone might receive um extra
145duty pay if they're a classified or hourly worker for orer time um a teacher might receive extra duty pay at the rate of the board approves for class coverage and also um because in in recent times the last two years with our substitute shortage and the need for teachers to be in the classroom we are paying extra Duty for professional development that is done that is completed outside of this student day because those teachers typically would receive that professional development with a substitute in their classroom and then they would attend the professional development so I'm going to go through this quickly to um outline for you what the IBN process looks like first the school must follow standard hiring guidelines for these positions an AMG that you have access to is called addendum position selection
146and review process covers these guidelines and many of you I'm sure are very familiar with them the school or Department identifies the employee who will perform the duty they complete the agenda paperwork and they submit it to payroll next the agenda is listed on the governing board consent agenda and if approved by the governing board the agenda is paid in equal payment during the agenda duties previously if you recall when when um an employee was completed with an an agenda they may they had the option to reserve payment until the end of that agenda which is not appropriate practice so we shifted that to receive pay as you are working and then lastly each agenda work performance is evaluated upon completion and may be reposted or the employ employee may continue in that role and
147that is also outlined in the certified manual now a few years ago the previous board requested that we take a look at non-n Agenda and specifically because campuses uh were creating um perhaps diff different job expectations for different roles and also identifying different pay structures for th those payments so um Mr Migo's office really took the brunt of the work in with this responsibility Shelley gettle and Mr miggler Rino spend a lot of time reviewing um non IBN addenda um requests those are then routed over to payroll and um they do a very nice job with this Human Resources comes into play with this specific process when we approve the job description and we approve the pay structure for these IBN addenda no employee May um take a position that is a non IBN agenda
148without first human resources approving that specific job description you also are aware that um there are specific times when pre-approval comes to you it's twice a year first semester annual pre-approval is at the June board meeting and the second semester pre-approval is at the December board meeting if there are any additional outside of those times we bring those um either grouped in small groups or as Singletons the schools must follow standard hiring guidelines for these as well they complete the agenda paperwork and they submit it to paper roll pay payroll and the agenda with the names and the amounts are listed on the governing board consent agenda so after they're pre-approved then you are approving who holds those roles and each addendum work performance is evaluated at completion and they may continue in the position
149um and and they also may have to reapply for the position depending on the administration's decision anything else you'd like to add here Mr Migo these are the forms that our campuses utilize the one on the left is the request for the agenda and the one on the right is what the job is what the job description looks like and I believe the board does have access to all of those job descriptions additionally all of these documents are related to agenda um and you can reference them and we are happy to provide any of these that you might be interested in and then Mr migler weo uh so we wanted to share just kind of the you know some of the magnitude of the supplemental pays there are some limitations to our system so essentially
150we have like two classifications of pay we have what we refer to as position pay so that's paying for somebody's contracted um work and then we have uh what's called supplemental pay so as Miss Moffett covered that covers a large area of uh addenda stiens extra duty pay there's a lot of uh information and Detail in that um but uh because we're close to closing out fiscal year 21 we wanted to proide provide the data from that just to kind of give you uh a picture of what this looks like so just under 25,000 records uh in supplemental pays um that includes everything from performance pay uh results based funding um overtime extra duty pay addenda stiens uh so there's a number of of um things that are included in those in that number and
151about $21.3 million in total spend with all of those uh from a variety of funding sources um you know for example Performance pay comes from the classroom site fund um for our non-classroom site F eligible people performance pay comes from our indirect uh cost fund or from one of our f cash funds that we um that we review uh each year um but if we kind of pair that down and and take out um uh stiens and performance pay it works out to be just under 18,000 uh Records uh and about $13 million in uh total dollars uh by the employee um you know for those that have received a supplemental pay uh averages about 4 and a half uh supplemental pays per employee and an average amount of about $3,400 um from that about
1523825 employees received at least one supplemental pay uh we have about 4,100 maybe 4,200 employees that we consider in a in a payroll period at any time so the vast majority of our employees do receive some form of supplemental pay at least one supplemental pay and again that's because it includes all of the things that I mentioned before right overtime extra duty pay uh so it's not an exclusive list of uh the people that actually uh receive that information the next slide just really kind of breaks down and this one's a little bit uh misleading I had to create some categories of uh position title uh to be able to try and differentiate between the district office staff and then other staff uh from the standpoint of who receives uh aenda so the bar chart
153or the bar the pie chart that's that's shown there actually gives you uh it's the same information um trying to show the same information one is the number or quantity of um supplemental pays and one is the actual dollar amount and so um the district office functions U by title and this is Again by title includes bus drivers cafeteria managers District Maintenance um and you know bus driving alone is over 300 ,000 of that $1.6 million spend uh for for district office uh so it's not um and that's because we have a lot of extra duty pay for bus drivers driving extracurricular routes uh covering routes that uh uh due to vacancies and whatnot so this isn't uh super clean but uh everybody else uh all other functions um works out to be about 87.
154uh two% of the of the supplemental pay so the overwhelming majority whether you look at it by the number of supplemental pays or by the dollar amount um is uh is paid out at the school level um and you could make the argument that cafeteria managers work at schools um but it's really a district function so they're included in those district office numbers so uh again kind of a little bit um difficult to parse the information to get a very clean a definitive answer to to to some of this but just again wanted to paint a picture of what addenda looks like for us uh as a district and with that I think uh we wanted to um see if there's any more discussion regarding addenda in general Mrs fiser part of the reason I
155brought this forward isn't just to differentiate district office versus campus um no I have two questions way back when when we brought agenda before um one of the things that teachers had expressed concern that there was not um opportunity for all has that been resolved and has that stayed resolved because a lot of what we resolve um at one point when the board changes doesn't necessarily stay resolved and we've had two board changes since that was done president O'Brien Miss Fischer um what has been resolved is that um we have identified what jobs are allowable across the system and the rate of pay that they are allowed to offer for it it doesn't mean however that each location will choose to pick that job description and use it and offer it on their campus one
156campus might one K8 campus might do that while another does not um anything related to the certified man ual of course an IBN agenda that that does have Equity across the system because the district through the certified manual is stating that they are supposed to have that on their campus where the non IBN process allows the option and do we still maintain because the other concern was that opportunity was being given to external individuals are we still prioritizing that our staff are who have other jobs here are being prioritized first president O'Brien Miss Fischer that is it is still true the AMG is still in existence and it is a requirement that um District staff be considered first before opening a position up to the outside if a person at the outside in the outside
157is able to secure that position they cannot maintain that position for the next cycle unless we go inside again that is different than District staff who could um be renewed in that position without it being posted again okay and then the last um the the the really my main question is um other duties as assigned are some of these agendas potentially other duties as assigned some of them when we see them come through they seem very applicable to a position where we're we're actually paying a full salary for a position I don't know how to give an example it would be like if we say well well you know Miss Moffet we're or we're going to give you an agenda for reviewing policy or for hiring staff something of that nature and and and when
158it comes through and I think that's that's the concern I get from the public and that's sometimes I look and I and when I can't answer why we're doing something if it's a football coach a baseball coach a chair coach Student Activities things like that I can explain it to them I can explain that this is completely outside of the scope of their job um but when they see that we are paying somebody to say write curriculum and we have a curriculum Department their question is what does the curriculum Department do um that they are getting a stien or or multiple stiens per person to write curriculum and I'm just using that as an example it may not be the exact question that comes that's the part that I need to be able to understand
159to to answer that type of question and and even when I send them in here to ask that question I don't think they still understand it so I can't understand it they can't understand it I'm asking you to assist president obri and Miss Fisher um it's it's a really good question and I believe that is why we implemented the process for HR needing to review the job description so we part of that process is um when let's say Dr gallagan for example may have a function that needs to be completed she or whoever Works um for her that is putting the job description together would have to identify what those responsibilities are would have to identify what employee type certified or um what type of certification would be required to fulfill that responsibility and then
160we would also have to show that it they were duties that would be outside of what a normal perhaps teacher would be required to do sometimes it's completely different duties and sometimes it is a workload were for for example Aspire Aspire and rolling out online curriculum that we built ourselves was even though a teacher does lesson plan and a teacher can maintain campus to write the curriculum at the rate in which we needed to design it we needed experts um and we needed a Workforce to do it people that would volunteer to sign up not really volunteering because they were getting paid right on an agenda but willing to put in for the job and complete that test so for that reason sometimes it is for the workload well sorry just to your point since
161we're asking about the the workload um and and I think Co was a really good example right where we needed to have the ability to um produce a whole bunch of online uh curric um so that kids who were strictly online and and um we needed more folks than we had so one option right is to say for a month or a year we need 50 more people correct and and that when we hire an additional person especially a full-time person we incur um benefits on top of pay when we uh divvy it up potentially and say and in set of 50 full-time people we can have I've used large numbers but 200 agendas instead we're just paying an hourly rate or a job rate per se um without additional employee benefits correct um president
162O'Brien we we would not have uh benefits such as medical attached to that but we still have obligations um the Mr M Lino would probably be better at explaining as far as um the costs wonderful thank you yeah president Brian we would still have uh what we refer to as the legal responsibilities of of benefits so FICA um you know things of that nature that would be a percentage of their Arizona State Retirement um ma um match that the employer has to to pay all of those would be a benefit cost that for the addenda um but we wouldn't have the the position related expenses such as health and medical and dental and those costs because those were already been paid for uh with their what I'll call Main position or contract that we have
163with them wonderful and thank you for making sure that I would not want to insinuate at all that we are not playing our legal um benefits we would always do that so Mrs paperman do you have any questions so there are d basically is renew every year so so so so for example like we'll have a d that's what we need for the 2021 2022 school year it may change for the following year president O'Brien miss paperman the the job description won't change so the need for example for an assistant coach for tennis at Mountain Ridge High School would be a a non- IBN agenda and there's a rate prescribed for that the person that fulfills that role does not have a right to that position the following year the campus could also choose not
164to hire an assistant coach um but then two years later choose to hire again the assistant coach because the job description still exists in Human Resources okay thank you and to that point Mrs Moffet again covid would be a good example because hopefully it was a onetime occurrence so to speak that we would um who evaluates and determines when that need is no longer there what happens and what is the process to either eliminate or determine whether or not those positions need to remain Miss O Brien are you are you referencing the job description and whether or not we want to offer that as an opportunity across the system or at a specific location I guess my question is do we ever have a a time where we evaluate whether or not we might no
165longer need a an agenda that we've added or and you've actually brought up another point I guess a part two which is um do we assess uh um on a regular basis do we need this for the next year how do those two different processes work so Mr O'Brien we do not have um uh a timeline for auditing those job descriptions um as you know they've they're relatively new because we've put them in place so um it will be something that we do moving forward we have already removed some of them and revised them because we've decided to change the format in in which we would pay an employee to perform that function function instead of it being on an agenda um so we would delete the agenda um but perhaps not the job description
166just the the method in which we'll do it because the job itself still needs to be performed and that needs to be outlined um it at the campus level it's based on need okay you any more Mrs paperman very good so how are we allocating the money to pay for [Music] these president O'Brien Miss paperman uh it it is dep some of the job descriptions do identify where the funding source comes from okay While others are flexible where the F where where it will come from so a campus principal could use discretionary funds to support the payment um of that specific job if it's grant for example title agenda are all going to be paid out by title funds the principles and assistant principles that receive those um 21st century for example is is Grant
167funded so we know the the specific line item for that um anything in addition to that that you'd like to add Jim or Heather um I might just add that uh all of the IBN agenda that are in the certified manual um are prescribed and additional funds uh M funds are provided to the campuses to fund those that are in the m so all of those positions um um they the schools receive additional dollars for uh in their M funds now they can use the funds as prescribed in the certified manual or they have the flexibility uh to be able to uh divide up the the funds in other ways what's a common occurrence is you you have maybe two uh individuals that are staff members that want to share the responsibility and so they'll
168split the agenda so the amount can't be exceeded um that's in the manual so if the amount is uh $1,200 and they want to split the responsibility they can be split 600 a piece um it cannot exceed the $1,200 okay thank you but but we do provide additional M doll allocations to schools for the IBN addenda uh and I can't take credit for that I need to uh acknowledge it Miss mock does all that work so great Mrs Ordway it seems as because my concern always was that since 200 N um when it all started cutting and then when when we started having some money to um actually uh have employees to do the jobs that had been chopped up into gosh knows how many pieces that we had added that and they had not
169been the position had not been compensated for the exter to work but um from talking to you and going through the um the agenda what I and and and employees also it seems to me that there are tasks that we just don't do anymore anyway and that is not a concern uh that people are well people are overworked all the time especially during Co but what I'm saying is that you have done a great job in making sure that um all those extra tax that were put into certain job descriptions it's not there anymore you're actually getting to do your own job now so the the squishing the blending has leveled out that was my concern that that they weren't being compensated I didn't have a concern that um you know we had people doing
170something that they should have been doing during the day or they could have been doing so I think you guys have have done an excellent and awesome job in in making sure that uh our students have the best of the best because we're keeping ourselves monitored and utilizing the talent the way that we should so I appreciate the work Mrs Reed sorry my request is just really super basic um I think that sometimes when we have these meetings we speak in alphabet suit because we all know what it means but um for the parents that are watching or that might come back and references um could you just explain what IBN and non- IBN is um I know that you gave examples but um that's important that that is a great question um president O'Brien
171Miss Reed uh actually it's a term that we use to distinguish something but it actually is a term we don't use anymore so it's interest based negotiation which we no longer do but at the time uh the when the manual was put in place uh we were uh using interest based negotiation as our um to uh negotiate with our employee groups and so it has just stuck so even though we no longer use IBN we just use it as a way to distinguish between uh addenda that are prescribed in the certified manual so and and these are ones that you would expect right the football coaches there the baseball coaches the the you know um the student council uh folks the department chairs all of the ones that you would expect uh to have uh
172between um extracurricular co-curricular and sponsors um are in the uh certified manual and um we continue to use the word IBN attenda even though we don't do interest based negotiation any longer but that's what IBN stands for thank you and then one other request um possibly when we have this on the board agenda if it would be possible to put what that is so that the the differentiation between some of these are in the classified manual and some of them aren't um for our constituents who go through and and read the board agenda thank you it could be time to change the name I was going to say it's time to change the language I think and because I'm pretty sure that um IBN hasn't been around for a really long time I think I
173served on the last committee that included or that was an IBN and um I don't want to talk about how many years ago that was because it makes me feel a little old so maybe some some language changes are are appropriate and and that'll help um our our folks our community as well maybe we can give the job to NST maybe that represents all our groups maybe uh yeah I'll let them worry about that Mrs fer did you have a some it is still just Union approved so it's kind of similar we don't have a union we have an association but it's split on words but it's still because it is still kind of IBN I we still work with the association so negotiated agenda could be a good NE negotiated agenda negotiated Solutions team
174yeah yes but my final the other question I had that came up was um we did an efficiency study back in 2015 or 16 um because we were looking for things that were being done in multiple areas and cross um what do we have in place to ensure that a denda is uh is not a duplicative area of expense president O'Brien Miss Fischer what I think you are asking um is does the job description for the agenda is it replicated in someone's job out there that we are paying cont potentially correct do we have any kind of cross reference to um because that was one of the efficiencies that we had found was that there were areas where there was a duplicated effort that is part of what we are looking for when we do
175review the job description at any point in time um the board may be aware sometimes someone's job May shift as well as we um new work comes along or uh departments merge or uh a new position is added and that position has responsibilities so when that does happen it's our responsibility to also go back and look at the job descriptions to make sure that someone's not receiving payment for the exact same work that someone else is receiving that payment for okay one thing that I think might help um which I never would have thought of if it weren't for the law conference um one of the I'll get you the exact policy titles um I know it was uh both Miss obrien and I were in the session so I'll have to look back to
176which which session it was but there was a couple of policies that um at the time I was looking at our policy manual that we either don't have or that we've modified so job descriptions and new positions don't come before our board um it's standard asba that they would but in our district they do not so it might be helpful that if we take a look at those policies whether we imple Implement them or not is a different matter but it might be helpful to look at them certainly could include them maybe in a Friday update if the asba policies I I'm I don't recall which ones they are so um we certainly the job if you are the job descriptions available in the portal or where people can I think what Mrs fiser is
177saying is a policy that asba has a polic a recommended policy about board board boards approving job descriptions I I am not familiar with that policy but she said when you get it will you send it to Sheila to to include in a Friday update wonderful uh president O'Brien I might add that um when we uh provide the agenda for the board's consideration we do attach the job description for the board uh it's not approval which I know that's what uh Miss Fischer uh was mentioning but we do provide the job description for all the agenda um that are under consideration so by virtue of approving sorry to interrupt you but by virtue of approving the agenda we are approving the job description and the ability to pay I mean I realize we don't go
178through each job description I I we're splitting hairs a little bit but you're right if somebody went through and had a real question about one of them we certainly could send an email in and and have a discussion about that specific um item if we needed to are there any more um questions or discussion hearing none then I certainly would entertain a motion to um adjourn this meeting at 9:40 so moved second all those in favor please say I I motion passes unanimously thank you all
