is it 6:45 yep all right I'm going to call the meeting to order at 645 someone make yeah the public he in Mrs O'Brien oh she I move to adopt the agenda I second all those in favor say I I I is that popping up Miss mock president O'Brien members of the board and guests um tonight we are going to conduct a public hearing for the adoption to come in the board meeting following the public hearing for our 2122 budget and also for our truth and Taxation notice um adjacent ways for the construction of Elementary 32 we are just waiting for our presentation to come up as a reminder we've already reviewed this presentation at the prior two board meetings this really is the Apex event of work that went into the budget um starting
at the beginning of the 2021 school year and we will continue to work with this budget and revise it through the 2122 school year all the way up until uh May of 22 part of those processes include working with our uh negotiated Solutions team on salary recommendations and other uh items for the budget input process we received uh information from our stakeholders through the District budget committee and we continue to report to the public through board meetings for the entire school year so as you can see at the bottom this is July 13th public hearing for our budget adoption some of the highlights at that are that we continue our 15% M override there was an increase in inflation um some of the not so highlights we are experiencing a decrease in our teacher experience
index um and but right now we are projecting a decent M carry forward at $1.79 million um this is just a reminder of the Staffing that we use and all the factors that go into our budget book for for uh the budget that we built that we will take a look at here uh in a couple slides but just some brief highlights um it is a slight increase in our general budget limit from fy21 to fy22 and we are expecting a slight increase for inflation District additional assistance full restoration uh we do have some Elementary and secondary schools emergency relief funds the second iteration of that or our user 2 Funds uh Grant funds that we been awarded through the state in order to help us out this com this current school year as well
um we may have some additional budget adjustments coming and then um budget carry forward our we will have some decreases a slight decrease to our override group a and Group B weights Group B weights all related to our decrease in students um and then the $1 million decrease for our teacher experience index we said we were going to continue to revise the budget throughout the 2122 school year and some of those elements that may affect those revisions are additional carry forward cash accounts our Reserve balances any additional federal grants that we might receive and any staffing changes caused by shifts in our enrollment and so those could be increases as we see students return to Brick and Mortar schools in the coming school year um or could be decreases so this is the overall picture
of what our budget looks like for next year uh we are planning on $183 million base support level continuing our $8.69 million Transportation Control limit uh our prop 123 funds are just over two million and uh 14.8 million in District additional assistance as a reminder District additional assistance is our capital and this year we are keeping 11 million of that overall allocation in our Capital fund the rest we are moving to our M to help with our uh Staffing uh and also to help with our salary increases some of the other funds we mentioned are our overrides at 28 million again our Sr 2 Funds we do use some of our cash accounts to help offset and enhance our M budget um we have increased our contingency for fy22 from 1 million to 2 million
and that's just because we are not sure yet what's going to happen with students returning on campus uh again the governing board earlier in the school year I believe back in April uh through the recommendation of our NST approved uh a salary increase of 1% for All Staffing groups and then uh 2.7 roughly 2.72 million in onetime payments uh to be paid to staff in December uh we already mentioned the 1 million increase in contingency and here we've highlighted some of the other changes to Staffing non- Staffing include uh 12.22 uh increase in Arizona State Retirement uh from 12.22% to 12.41% our private tuition increase and again mentioning that our capital budget we're establishing 11 million for next school year when we talk about District additional assistance we always want to make sure that the
governing board and our stakeholders know that um I think it was the last 13 or 14 years the state has not provided school districts with their full allocation and so when we say we're celebrating that we are receiving that full $4.8 million this year um we have um been shorted for lack of a better term over $115 million in District additional assistance since roughly 2008 so that's what we qualified for based on our student enrollment uh but did not receive as uh the state use District additional assistance as a way to manage and balance the state budget um overall uh changes to the tax rate um we saw an increase to our assessed valuation of 5% or prop 117 limits uh the assessed valuation growth at 5% we actually did see an increase of our
assessed valuation of 5.8% this year or uh just over3 billion or just two over three billion doar and even though we don't directly set our tax rates those are established by County uh we work with them closely to make sure that um we have the the correct amount and um we were um projecting a total of um I apologize I haven't looked at the slide deck uh recently um we received some initial information from County actually just yesterday and the tax rate that we projected um we are right on where county is going to set us for the uh current school year so we were very pleased with that um some of the other highlights cash balances school districts are no longer considered um and we do have some examples I think these uh present
a better picture uh primary tax rate for uh 21-year projected uh which feeds our 2122 um school year is the 3.67 S1 for primary 2. 3862 for secondary for Combined rate of 6.06 and I believe county has us right at the 6.06 so we're very pleased with that projection um and um just uh a representation here of what that means for the average parcel in Deer Valley Unified School District part of the public hearing we do also talk about our uh truth and Taxation notice and conduct a public hearing um for our adjacent ways tax this year we are requesting that the governing board approve a tax levy of $900,000 last year I think in the year prior pretty uh consecutively we have asked for $500,000 this year we are asking for $900,000 this is
for the Ingress and egress for the construction of Elementary 32 overall that's going to be a uh tax of 25737 uh per $100,000 per home for the entire year so if roughly you had a $200,000 home it's going to be just over um $5 for the entire year for us to be able to have that that and to be able to give safe Ingress and egress to Elementary 32 Mrs mock could you please just explain adjacent ways um and give an example so everyone can understand what that means I may ask Mr miglino for his assistance with this because it really is uh for construction and limited to the safe Ingress and egress um of our property properties it doesn't necessarily have to be a new property that's just what we're asking for at this
time we can use it for our existing properties as needed as well and I will let Mr Murino add any pertinent information uh yes so as Miss moach mentioned it is for the new elementary school um so all these are all the adjacent improvements as the name uh indicates uh that are necessary uh for the roadway uh as well as for the fire lane that's required um to be able to provide a safe inra Ingress and egress to to the uh new campus so um it we do have an estim from the GMP that the governing board did approve for elementary 32 and it is $900,000 thank you I just wanted everyone to understand what adjacent ways meant and with that being that this is a public hearing we are required to um open up
the mic for any public comments specifically related to our 2122 budget adoption this evening or for the adjacent ways taxation do we have anyone that wants to speak to adjacent ways or the tax I think that's a no board members Mrs Mrs arve oh yes Mrs O'Brien I since this is the public hearing I would call for us to um adjourn if there's no public that wants to comment there are no public that wants to so we uh make a motion to adjourn at 5 to 7 I think it is or excuse me 75 or 657 so moved second all those in favor I I I I and there's no nay so we have concluded this meeting and getting ready for the next three minutes any here to join my disappeared I'll have to find
it as Mrs Mrs O'Brien did you start the could you join the meeting yet we're working on I I can't um I keep I keep trying but it's not it's not giving me to join the meeting so mine we may have to do uh roll call votes for you Mrs O'Brien yes did you get to join no it's not I'm I've logged I'm logging out and trying to sign back in now to see if that will help you might need to close your browser and reopen it that's what I had to do okay we are going to start our regular meeting of July 13th at 7:00 uh roll call will show all members are here Mrs O'Brien telephonically we will all stand to do a pledge of allegiance and then afterwards remain standing for a
moment for a moment of silence please I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible liberty and justice for all we can sit now Mrs O'Brien yes ma'am want to make a motion I move to adopt the agenda a second all those in favor say I I I uh so we will we have oh no I'm sorry do we have public comment we do we have three public comments and if I could have it looks like John Palmer do you want me to read the okay it looks like Dr Macau Sandra Larry mcau and John Palmer sorry and would you read the yes ma' the board invites public comment on the district's business in general and on any agenda

agenda okay the U microphone is there if Dr Sandra mcgaan would go then Larry mcgaan and then John Palmer and you have three minutes each thank you and you need to state your name uh when you start I'm Dr Sandra Macau this it's a get a ladder do I still have three minutes thanks now I'm loud did that get it uh I'm Dr Sandra maccau I have two kids at Diamond Canyon School one of my kids will go in the sixth grade the other will go in the eighth grade they've been at Diamond Canyon since they were in prek in kindergarten uh I have had uh several comments and several conversations with Dr Finch and members of the board uh but today uh even though my kid is is through with the book Chains I
am so distraught about it that I'm bringing it to the board I've completed kece to have it removed from the list my kid and 90 other kids that read it are emotionally damaged from reading this book about slavery the book is told from one point of view it's told from a young girl's point of view she was abused she was mistreated and it just screams bad white people white supremacy that's all the theme of this book is and children should not have to read that in addition Arizona statute 15 341 the governing board shall exclude from schools all books uh papers publications of a partisan or denominational character this book is truly partisan there's no evidence that there were any white good white people everybody was bad I just want to read to you and
I submitted this to all the school board members to Dr Finch but this is what my kid had to read it is graphic it is violent he is a nicest little 11year old boy that has no experience for home abuse abuse of anybody this is the first thing that the this master is so mean that he is going to he hits his wife she has a swollen lip a few pages later he picks up keys he hits her in the face he pushes her into a bookcase calling causing books to fall to the ground and that's the good part of the story beats his wife now you're going to see the slave abused I I copied this for you guys to read they're little children that read this Isabel's 13 years old and she is
going to be imprisoned and branded with an eye on her face for insolent with a hot iron the man pulled me by my rope outside the courtyard after two days in the dungeon the noon SC son scalded my eyes I stumbled but I did not fall whatever you do the man told me don't scream that's what they want you to do so the white supremacist now he's going to make the iron hot the man pushed the hot metal against my cheek it hissed it bubbled the SM the smoke hurled under my nose they cooked me the little girl says the man stepped back and pulled the iron away the fire in my face burned on and D deep My Flesh searing my no child should read that it is emotional abuse thank you Mr MC
oh there he is thank you this is to follow up on what Sandra has has reviewed as she said we've got two kids at Diamond Canyon Andre and Neil in the sixth and seven and eighth grade as you know Governor Ducey signed House Bill 2906 prohibiting the teaching of CRT in Arizona however the teachers union has endorsed this teaching of CRT from Dr paulonis I have an email stating DS DB USD will not teach CR CRT however it's a fact that a teacher can submit a novel or a supplemental instr instructional material not on the approved list and the principal has the authority to approve the or instruction materials to be included and talk because of the circumstances with the principal Diamond Canyon have a powerful concern that CRT and other inappropriate materials can be
easily become a part of the Diamond Canyon curriculum in addition in the fifth grade an inappropriate substitution was made such as the case has changed as you just mentioned we've read uh uh teacher Christy koger's sixth grade language arts teer web page uh the novels for that year have been all district approved the titles of the novels are the bronze bow Refugee and The Giver uh M Miss kogo missed the theme of the novels uh I don't want our grandson to read about cruelty violence and mistreatment of any group of of people the bronze bow is not appropriate for anyone to read at that age bronze bow includes violence crucifixion of parents hatred distrust Revenge demon possession and killing as a means of to Justice Neil won't read The Giver The Giver because has violent
sexual pactice past and the books discusses inaside and in inaside youth in Asia and youth in Asia the discussion of these topics is is totally inappropriate as far as a refugee the other book it has themes and circumstances around Nazi Germany trauma Injustice cruelty bobbing and drowning and and we're requesting alternative assignments to these novels the the eighth grade teachers do not have instructional materials standards or texts identified on their websites Miss wden that do does not list instruct materials or resources for science there's nothing listed in the sixth grade social studies however certain that the DB USD curriculum department has a list of approved resources we don't approve them reading uh these 8th grade selections as well as indicated in ARS 15102 provides the opportunity for parents to review all instruction materials parents to
submit a written request for the information person to this section during regular business hours and it goes on you know you know you can read this yourself uh just accept this is is the attachment to our email that was previously sent the six in the sixth grade uh language arts uh they indicate that all articles be used for standards instruction come from the district adoptive curriculum from common lit uh news Ela ReadWorks the sixth grade math sources are identified our particular concern are the constru materials will be used to teach sixth grade your your time is up and I'm going to ask Dr Finch to have Dr gallagan get in touch with them so they can understand how to have an alternate assignment thank you right and and they'll get to you but your time
is up so we want to have our next speaker the the mic picking you up yeah you need to move closer to the mic how's this I really don't need the mic well for live stream we want them to be able to hear you so yes he does need the mic because I can't hear him if he doesn't use the mic okay okay my name is John Palmer I have three children in the Valley Unified School District I have two fifth graders and a ninth grader I'm going to read to you something emotional abuse a means a pattern of ridiculing or demeaning a vulnerable adult or child making derogatory remarks to a vulnerable adult or child verbal harassment vulnerable of a vulnerable adult or child threatening to inflict physical or emotional harm on a vulnerable
adult or child that is Arizona revive statute 133 623 of the criminal code what I have read to you is a Class felony CRT constitutes a class two felony that book that they brought in constitutes a Class 2 felony by the teacher and by the principal it is not one count for that book it is one count poor child affected by that book and for you to allow it on your board you were also criminally liable the reason I'm aware of this I had the pleasure of sitting on the Maricopa County grand jury where I was read into every criminal Statute in the county including this one and I have indicted on emotional abuse of a child the bigger problem that we have is not just CRT it is political crap in our school and
I'm using crap as a specific word in the past few years we have seen LM red fored and many other political messages purported by the teachers Administration etc those are unconstitutional as state actors they cannot by any means prosze promote any ideology whatsoever as it is a form of religion and The Establishment Clause clearly indicates you cannot do that and I will tell the board right here right now now if I find my children exposed to any educ any educational material that constitutes critical rates Theory e Equity trading or any of the other things based off Marxist or any other political ideology my first phone call will be to the county attorney and I will file criminal complaints against the teacher against the principal and against each of you if necessary my second call will
be to attorney for violating my civil liberties you do not have the right to promote any political ideology in the classroom as a private citizen you do the students do but not a state actor thank you thank you Mrs o Brian I think we're moving to a yes ma'am I move that the governing board accept the administration's recommendation for the principal of of the Aspire k6 and I apologize if you would please say her name Mrs orway Laura Victor can we say that one more time Laura Victor it almost sounded like a bingo thing I second second uh do we want to have uh Miss Moffett speak and then we'll have our 10-minute um dissertation from our our candidate no we're being nice it's only 10 so it's our pleasure to introduce Laura Victor to
you this evening Laura comes to us from Mesa where she has served as a k6 principle over in that school district we're lucky to bring her over here as the Aspire principal Aspire is our campus that will oversee all of our online learning for K through six students so Laura go ahead and stand up this is Laura and Laura if you would like you're not required but if you would like you can come over and say and I was only kidding about 10 minutes it's really only 30 seconds I just want to let everyone know how Madam president governing members of the governing board thank you so very much for um I'm very excited to be a part of the Deer Valley family so thank you for having me oh let's not clap it we
haven't voted save the Clapping after the vote all those in favor say I I I I all right now we can have loud Applause and I do need to vote okay my computer keeps shutting off Mrs O'Brien can we move to our yes ma'am hour next I move that yes I move that the governing board approved the administration's recommendation of termination of employment from the de Valley Unified School District I second all those in favor say I can I explain my vote Mrs you absolutely May okay um if you were following along at our last board meeting um one of our fellow board members um had some questions and brought some concerns forth um regarding the legality of our policy and so um I think it's really important that when one of us brings forth
those um questions that we um meet with our attorney and and seek legal advice and we did so before this meeting um and the advice that we got from our attorney was that our our policy was was followed and that's what we we were going to look for um so um when I vote that is what I'm I'm voting on is that we have um upheld whether or not we have upheld our policy thank thank you anybody else want to explain their vote Miss paperman mine as well um the question I brought forward was not regarding whether it was legal it was regarding the fact that I cannot terminate an individual when I have inadequate information to do so um I take it very serious that um losing your job or gaining a job is
such so impactful to the life of an individual and their family and everyone around um and so my concern at the last meeting was that we had to have adequate information to make a meaningful decision because it is the board who is by Statute responsible for all terminations and hires um so the concern was that not so much how our policy is written um and because of that I could not vote in that meeting with inad adequate information um um we did get clarification that our policy was followed um but without additional information it's we followed policy Mrs paperman okay so I would like to say uh as a teacher working in a district we do have a process and we do need to follow policies uh at the site level and District level this
investigation and I have learned uh with meeting with the attorney that our job as governing board um is to uh to to get whatever information we get from the district superintendent is now our job to investigate uh and and get information uh to to see why this person is going to be termin so I know uh working in education for 18 years we always have a process and we do have opportunities to voice if there's if we need representation or to discuss uh to defend ourselves uh but once it gets to the point that it goes at the district level all those all those steps have been taking place so we have a policy that that we're we're following and we have put in place and this is why uh how we're going to vote
today thank you Mrs O'Brien thank you Mrs orway I'd like to explain my vote as well um I agree that when a board member has questions and um it's important for us to get additional information um we did receive that additional information uh this evening from our attorney uh furthermore uh per statute it is the governing board's job to um hire or terminate a superintendent because that is the only employee that reports directly to us and they make recommendations to the governing board um for all the other employees that report to them the superintendent in the district and um this employee is an atwi employee and we all received um the same information regarding the situation and so with that I will be voting I I wanted to uh I'll explain my vote I believe
that um we need to follow our process in policies they're there for a reason that was part of a negotiation with our classified employees um we don't change policy um when we have one single instance because then we set a precedent that we don't need to set so if we have a a will to change that negotiated policy at the proper time we would do that but we really don't have a right to uh change the policy in Midstream so I'm going to be voting I everybody Mr Fisher uh miss paperman and miss Reed Miss obrien have we all voted I'm voting I I did four votes who hasn't 41 Okay so moving on to the next item Mrs O'Brien oh iiz I I apologize I was on mute let me try that again I
move that the governing board accept the administration's recommendation to approve the use of insurance proceeds for fiscal year 2021-22 I second do we need discussion on this yes no Mrs O'Brien do you need discussion I do not all right all those in favor say I I I are they all in and there are no opposed that motion passes 5 5c please I move that the governing board accept the administration's recommendation to Levy The increased primary property tax rate of the district to pay for increased EXP expenditures over the state imposed spending limits I second any discussion necessary and this is a roll call vote Mrs fiser would you go first please um several years ago I sat up here and and I supported the adjacent ways and we had a long discussion about it and
uh Miss Tweety pointed out to me after the meeting that we tax we tax in Bard we tax in bonds we tax in overrides we tax we tax and I know that any proceeds not used will go back but um I cannot U approve I cannot vote yay for a increase in any tax when we know we currently do not have um our schools at capacity we have several under enrolled schools um so I'm going to have to vote N Mrs paperman well we have looked at the student enrollment uh so uh I will have to vote n to on this uh we still uh need to work uh to make sure that that we're not going to uh have empty schools if we're going to be investing in those schools uh so I'm going
to have to vote Nate on this too Mrs Reed I'm voting I we approved um for elementary school 32 to be built and without um this money we won't have um a way for our students and our families to get in and out of school safely um so I'm voting I Mrs O'Brien I Mrs orway says I so we have three eyes and two NS moving on 5D I move that the governing board accept the administration's recommendation to adopt the 2021-22 expenditure budget I second any discussion necessary all those in favor say I I I I I I motion passes 5 Z Mrs Reed yours didn't go through okay um Mrs O'Brien we are on consent agenda I move that the governing board approve consent agenda items 6A through 6j I second all those in
favor say I I I I is that five no uh any n okay 5 Z that passes uh let's go to 7A I move that the governing board approve all employee out of state travel per governing board policy g c c e i second no okay um actually no you don't um the the public comment is at 7 um if you want to let me finish speaking so I can tell you how you can't no because you don't have the right to speak right now if you if you would wait after the meeting um Dr Finch can talk to you and no we can't do that [Music] um uh I don't we're we're going to move on and vote all those in favor say I I we didn't run the meeting out of agenda are
you did you vote Mrs O'Brien did you vote I did all right did it go through it went through 5 Z moving on to seven b b I move that the governing board accept the administration's recommendation to pre-approve the agenda as presented I second all those in favor say I discuss it all oh oh I'm sorry I just I just really want to make a note I generally approve I generally always supported them I know that we have a lot of tasks that are done within school districts that are outside of the scope of individuals um contracts and that's why agenda is used and it's important but I am a little concerned looking at this agenda um this time we have $ 97,7 N8 at the district office and it I at the end of
every job description is other duties as assigned I I question whether or not aenda is being used to just increase salaries um and so I am very concerned um at that level of agenda I just want to ask because there were a couple of things I had questioned did you did you have specific agendas or and and ask questions about them I I don't have that opportunity I this you can't email this is my opportunity to ask questions um it's pretty much the only opportunity I have and so that's why I brought it here uh I am not trying to nitpick but some of them a lot of them are coaches or or you know um I guess I could expand my thing and pull them out exactly what they are um my concern is
some of them and some of them like that there's one for a copy copier manager and I know we have people who work in that area it is not a small amount it's a $10,000 agenda um there are several others that are um you know I guess maybe my confusion is having worked in district offices before for I as an administrator in in a district I went to campuses and I coached teachers I um taught I taught teachers how to keep their their certification I whatever it was it doesn't make a difference but it was a part of other duties as a sign it was a part of what my job is I am curious if if we are truly if this agenda is valid and we truly need need it then is there a
potential that we just correct job descriptions and make it a part of jobs and then um you know even if we increase that position by x amount I'm concerned that the agenda is growing out of hand and that's just my concern all right the the reason why I asked if there were specifics because then it could be explained and I do know that we have this conversation usually at this time of year because there are certain agendas that pop up um at a certain time however the conversation goes to do we increase someone's salary for a task that they're only going to do for a certain amount of time or is this something that uh becomes part of their task so I think if we um or if you could um categorize some of them
we can have a study session and under and understand if they are a a small time frame or if it's it's going to be um something that they do the board would like to have a study session we can discuss it I would be more than happy to kind of pull them I would like to understand I don't ever want to deny um our staff a payment for an an extra duty if there is truly an extra assignment but I want to make sure that we are being fiscally responsible and and it was the sheer volume right um that I just can't support that without additional data yeah and and I had questions to you that's why I wondered if you had specifics and Mrs re I'm going to ask Mrs O'Brien for Mrs O'Brien
yes ma'am did you have anything to add yeah I would support having um a discussion about um our agendas and where they're going Mrs Reed thank you I was gonna say the the same thing since these are pre-approvals they have to be brought back to be officially approved so if that's something that you feel comfortable doing we have that discussion before it's brought back um no this the way this was set up is that we approve it now and it's put in consent later because it's almost a guaranteed we want to make sure somebody is a guarantee before they do a job um and and that's so it's it's kind of the only opportunity but we don't have to put it in the consent agenda vote on it later we don't it doesn't necessarily have
to be put in there um so are are you ask asking that we table this or are you asking that we vote on it or what is what is your ask I'm expressing what my concern is um I am voting nay on it because I I don't have adequate information to vote um um for it I don't expect any other board member to follow what I'm doing um if they have questioned or or or know what these are um I think the discussion I would like us to have is so that we're not stuck in this for uh or in the future um I think we just have to have a better idea of what agenda it we went through a lot to get it to where we had the pre-approvals and then the post
because we wanted to make sure that employees did not do jobs without a guarantee um so my my purpose is not that we derail it um I personally cannot vote for it um but and the discussion is something different because it's an overall of of aend so if if if other board members are good with voting for it as it is um it's it's they may have a different reason or or or different knowledge I have no problem with that as well okay with that I'm going to call the vote all those in favor say I I I I all those against say Nay [Music] n I don't have four one go ahead Mrs O'Brien I move the administration re sorry let me try that again I move that the governing board authorize a provision
of two weeks up to 80 hours of covid-19 related sick leave at the employees regular rate of pay to employees who are experiencing covid-19 symptoms and are seeking a medical diagnosis or who test positive for the covid-19 virus are in and are in self isolation and cannot tell a work due to illness or their job duties or who are assigned by human resources to quarantine due to close contact with someone who has tested positive for covid-19 and cannot tell a work due to their job duties I second Miss mofet if you want to uh go over that um I think this is a really good thing for our employees thank you for putting this together president o'ri inv vice president orway governing board members this is a request to the governing board to extend the
timeline um that the district would Grant this particular leave as a quick recap of history previously we had a leave called FFC that we provided but it expired so the governing board approved the leave that you see in your executive summary now it did expire at the end of June because we will need to continue to practice quarantine and self-isolation um uh into this next year and we anticipate that uh occurring we ask that the board extend this through December uh one point uh that I do need to make is um in here you'll also see that if an employee has already exhausted their 10 days either under FFC or underneath the co9 leave that they would not be eligible this is a continuation of this exact leave that I understood when I read your
rationale behind have questions M Mrs [Music] O'Brien so I do so this is a continuation of sorry the leave so anybody who that who has had covid or who has been quarantined up to this point is no longer eligible president O'Brien they would no longer be eligible already utilized their 10 days um a good portion of our employees about 34s of our employees can typically continue to work from home while they are under quarantine or in isolation um but there are employees in our system that can't perform their job duties from home and so uh this leave is very important to those people but if any of those people have already utilized 10 of their working days under this leave then they would be not eligible for an additional amount of time and do we
know how many employees are not eligible or who have already used their time I guess would be would be a better way to phras that question president O'Brien that is information that we could out for the board okay thank you Miss Fischer um so because this was originally approved before we were on the board so I really not sure my head's wrapped around it yet um so let's say someone goes out do they hit their sick lead first or they hit this first or they only hit this when it's covid versus the what's the pathway if an employee has been quarantined or put in isolation from Human Resources we have asked them to do either of those things then they are eligible for this leave first so it's not them calling in sick it's you
saying look you've been exposed you need to be separated correct okay that makes sense um what funding source is this coming out of one of the federal funds for for for the extension um I'll kick that over to miss mock yes we plan on using uh most likely it's going to be our our sr3 funds okay all right thank you any more questions all those in favor say I I I I I and there is no opposition so that passes five to zero and that will take us now to governing board reports Mrs O'Brien would you like to go [Music] first um I have no report this evening well thank you Miss fiser turn that on um I'm not sure okay this is probably a smart alec comment I shouldn't say it but I'm not
sure if there's a book out there on how to manipulate things and if someone's read it but I just feel like I've been hit by it so much in the last eight months um but this last week has been a real culmination of what's what I've been experiencing um I have told individuals um that I bring these things to the board meetings as a discussion at a board meeting um I don't think they realize this is the only opportunity I have to do so that's it um there is no other Avenue for me um so if it offends you that I bring it here I apologize but this is pretty much the only Avenue I have okay um one of the things for me has always been uh transparency is very important and transparency is
one of the things that has left Deer Valley in the last couple years um and the latest um behind the scenes planning or maybe it's not even planning maybe it's just happening I don't know has increased it exponentially um so I'm going to just kind of give you the questions that have been brought to me this in the last two weeks um I tried to make them as least emotional as possible um so that they're just factual and they can be answered however they're answered um a past concern that was expressed is that at a prior board meeting Miss O'Brien gave statistics on who had submitted affidavits about parent rights there are only two ways for this information um could have been obtained either by intervie interviewing the individuals um and they self uh uh
disclosed or someone had to access furpa protected information that um would have been inappropriate uh Gathering data on students for political posturing purposes is not valid reason to access our student specific data um that being enrollment um I would like to know uh where this data came from uh if it and if student data system was used to gather this um then I would like to know if we have any potential um liability or something for the parents to file a fur of violation against us as a district um it's a concern um public and employee concerns um uh qu questions cons uh continue to come regarding critical race Theory though we have stated it is not adopted uh this uh has increased because one of our teachers on a is on a list list
of individuals who signed um some pack that they're going to teach critical race Theory regardless of what is adopted or what laws are passed um I have sent um there was also additional questions that came about Savas is that correct um curriculum the only thing um we have and this is for the public is an i a program called IIT I will tell that I did look at I lit when I was trying to increase my son's um reading um because it is a very good program for that purpose and I do not see anything in it that has anything to do with critical race Theory [Music] um I have sent all this information to Dr gallagan and she's you know of course as I receive anything else um I'll just cut and face and
send it to you um somewhat related to that question um was a secondary is if vendors have access to the district email system for employees the reason being is because some of our teachers have received information about a Savas training um and these are teachers who are concerned about being pushed being pushed to teach critical race Theory when they are not comfortable doing so um and I don't know that answer so if you could just you know email us or let us know I don't know why they would and it could just be that they grab they just figured out what our code is you know first name last name or something I don't know and so they emailed out teachers I I don't know but that has occurred um the final questions that question
that I have received um were directly regarding quarantining um and if that would be continuing it is my understanding that the reason we are able to quarantine individuals is because we as a state are still under the state of emergency Mery and that state of emergency allows for quarantining even though that should be in the least restrictive way um I would appreciate an answer of how how can we answer that to the public um they are concerned that their kids will be masked again regardless of what has happened um there's been a lot of comments about the masks still being in our policy when it has already been said that it is not legal for us to force masking um I have tried to explain the transportation masking as a federal issue but it it
may be good information to still get out um but the quarantining um honestly I don't know that I as a as a board member or as a parent or as a community member like the way we're doing it because I don't believe requiring a student to be home because they may or may not have sat next to Jenny on a bus or something or somewhere is is the least restrictive environment so I am concerned that that that what we're doing isn't correct but I do need to know if it is in fact true that the only reason we're still doing that is because we're still under an emergency order okay that is the questions from the community um there has been mentioned that um we were talking about there's an intent to require board members
to move an agenda item by making a mo a motion requiring the majority vote from the board um this goes against our policies um that State uh bdb uh board officers I'm just going to do the one point under the board President says allow for full and complete exploration of each item of business and bed meeting procedures bylaws the president of the board is responsible for the orderly conduct of a meeting and shall rule in such matters as the time to be allowed for public discussion the appropriateness of the subject being presented the sustainability of time for the for the presentation the point is we have a consent agenda and I don't know as long as I've been on the board now or in my prior time that we ever really question the consent agenda
oh I think it died there are times that we may not necessarily like something on it and it's always been that we simply say can we pull this off a consent for separate consideration and when the original uh motion to adopt is made it is simply uh we're going to make it moving such and such for separate consideration the proposed change to put it to where we have to motion to move something um essentially means that only the board majority has a say and what will be discussed even if it's agendized and I just really think that's problematic the only only way I can see that that would be a reasonable thing to do is if we agreed on items that are never potential items to be discussed um and then put those in our
consent like meeting minutes or things like that um if the board does wish to go ahead and and move forward with this then we need to maybe change our policy to where discussion of each item is dependent on whether or not the board majority wants to discuss it and I just really think we're pushing more into a lack of transparency by that move to begin with the second thing I wanted to bring forward is the superintendent goals um and I know we've had executive sessions and I cannot discuss anything that was in an executive session but um Arizona rided statutes 15 34139 the second line um well it it says what basically what the goals are it says 25% of the performance pay is determined on the letter grade of the district 25% performance is
determined by a percentage of the uh parents of pupils who enrolled in The District in the sign a letter grade of a it has more detail um same thing percentage for um our employees but in both of those two it says that the satisfaction survey shall be administered and scored by an independent entity we have not been doing that 25% of the performance pay shall be be determined by the criteria selected by the governing board so that gives the governing board the ability to set the goals with the superintendent and 25% of his performance pay is is on that governing board but there is a clause in there that says unless the school district governing board votes to implement an alternative ative procedure at a public meeting called for this purpose and then it says
the performance pay shall be and it gives you the details I understand that my vote is pretty much all votes are 4-1 or maybe um and and that's fine you know I've been on the side of the board where I was on the three side versus the one side or the four side versus the one side but if this board is going to move forward with not following the law as written it is important that this board has that meeting and in a public meeting with constituents is clear that they are going to deviate from the four prescribed 25% items um and so my ask is that if this board wants to move forward with that specific division that they go ahead and and get that meeting scheduled and then vote uh discuss it in
public with you know so the community um has that input and they can um pass that um but I I my two things have always been transparency and legal and uh I would like us to follow the legal process um that's it anything else I will well I'll bring to the next meeting Mrs paperman first I would like to let the public know that uh within Deer Valley School District uh the board we have not voted for critical race Theory or even sex education so U I know like I'll hear from parents oh we have it in the we we do not have it in the uh one suggestion I would say that we need to oversee our campuses uh to see what literature uh are being are being given to our students uh so
we need to have that in review I know as a teacher when I provide uh in the upper grade levels if we're going to be using a book uh we actually had to have the parents uh be aware of those books that they're going to read and they had to sign a form so we need to come up with a better process so there's no conflict uh between uh parents and and the district so we need to oversee and have a something a plan a better a better plan in place so we don't have this conflict uh also uh we need to keep politics out of the classroom we need to focus on the academic standards uh we're 49th in the country so we need to get our kids to to re write uh mathematics
uh we we need to to have our focus on what is important I also would like to say that I visited uh all the high schools uh yesterday I went to B go watera high school that was the last one that I visit I am very impressed with all the high schools the administrations are doing an amazing job uh from my observation as an educator I feel like there's so much strength in each high school I just get to wonder that these administrators collaborate and share strength uh you know to to you know to work together uh so so like I'm very impressed I'm hoping that they do have those opportunity like if they have a staff meeting professional development give those administrators those opportunity to share what's happening at their high school was working
for them so so so that they can become become stronger together and this will benefit our children thank you Mrs O'Brien thank you I would like to um talk about the agenda the change to the agenda um board agenda there is no reason that any board member cannot request to have something taken off consent agenda um there was a change related to when we went um got technology for which is called board docs and we are voting online so that our individual votes are recorded and that the Motions are set and ready to go ahead ahead of time and because of the newness of that technology we were requesting any changes to come well in advance so that our board secretary could be prepared our board secretary is now very now very Adept at making
changes um on the Fly she just needs a couple of minutes to input those so actually in full transparency for all of our um Community to know when a board member wants to to separate something out or to do something differently uh that will happen at a board meeting and be discussed in front of the full board um I don't believe there's ever been a denial related to making a change to the agenda but it is important that we do do it in front of everybody um I do want to also state that related to our um super intendent goals in the current superintendent contract there is an attachment exhibit a and that paragraph expressly affirms that the board has chosen to create its own performance-based plan and we do vote on that um in
a a public meeting as well as vote on those um performance pay goals in a public meeting as well where the public is able to have their say um also just as a side this is our uh only meeting this month so we actually will be resuming school prior to us coming together again so I hope everybody is able to enjoy and relax um with the rest of their summer break and come back uh renewed and refreshed and ready to have a killer 2122 school year thank you Dr Finch oh I'm sorry Miss that's okay thank you um just two quick asks for um an upcoming um board meeting um with all of the legislation that's just been passed um that the governor has signed um I think that it's really imperative since the majority
of the Hot Topic um bills we um were regarding um schools and school districts I think it would be wise um for our district to prepare a presentation for a future board meeting that outlines um how these um how these new laws will affect DB USD our teachers and our students I think there's a lot of questions and um we really don't have any room for inferences or best guesses from stakeholders of um how they're interpreting that we might use them I'd rather them um get it directly from our district and get it from the horse's mouth um and then have the ability for them to ask questions um of how that's going to play out and I think that um our teachers are um in a place where they um have a lot of
questions also and um moving forward I think this would help um maybe our executive cabinet um not have to answer so many um oneon-one um emails from parents and teachers because we'll have a presentation that they can all turn in tune into and that we can point back to later um the second um since we've had a lot of questions about curriculum adoption um and then um with the email that we we received from Ma's um yesterday I think it would be um wise if we did a a refresher I know that it hasn't been brought forth as far as how we um adopt literature that for books that are used in the classroom what what that looks like and and what the process is um and maybe where we're able to find the book
list um that is approved um I think that would be helpful for um for stakeholders so and I know that Dr gallagan you're planning to speak with them but um I think for everybody um in general I think it would be very helpful um I also do want to wish I know a lot of our um classified staff is returning next week um so I just want to welcome them back to um the 2122 school year I'm excited for um somewhat of a normal school year crossing our fingers um that we can have this year and um with celebrations and big moments for our students um and our community um so I'm looking forward to that I hope that everyone enjoys the rest of their their summer break and um that we all have a
wonderful first day of school thank you thank you Miss Reed and I forgot myself so I would like all the classifi and the 12-month employees that have shown up every day and maybe had their two we or one week vacation and I hear those floors at all of the gyms are looking Shiny Bright and beautiful we've had a couple of schools that have had their carpets replaced um we have the stinky new Fields I mean beautiful new turf fields at the high schools I can't get used to the smell yet no more grass so we've had people working 24/7 Around the Clock keeping things uh safe and and kept up transparency is an interesting word some people use it to be transparent and others use it to make things cloudy so depending upon where you're
sitting when you hear the word transparency you can either get your ey up or it can make you uh feel better we're on a board we've got five different people they have five different lenses the lenses I believe are all based and making sure our children have the best of what they can be whether we agree or disagree how we get there I do believe that we're all based in that so with that Dr Finch you have a report just a couple of items uh I will be sending you the ASA summary um of the bills and it actually was I just got it today it was really good and I think I worded it to my cabinet um that will help I do agree with Miss Reed that we can throw a report in
there uh for the the P or for the public and uh listeners at a board meeting that would be good to walk through it because obviously the legislature um which kind of brings me to my second Point uh school districts in general are in the middle we between the legislature and uh Dr Sunshine who runs the Maricopa County Public Health Department there are two different trains of thought and districts are in the middle that's not news to you it happened last year um and it's happening this year as well so we're looking forward to uh another year of um kind of figuring out as we go we have good processes good procedures and we'll continue to be consistent that's what we're good at that's what deer rally is famous for and so uh we're continue
to um do what's best for students and be a contributing Community member there was a question about um uh whether we if we used our system to find out if filers against us are parents or not that's totally legal we uh the where it would be illegals if we mentioned their names in public or gave those names to anyone uh that's uh been a common uh practice obviously around all of Nik uh they're finding that many of the filers don't even have a students in their system that's it for my report looking forward to a good start of a school year uh should be another good one we have uh future governing board meetings and with that I have a mo a motion to go ahead I move to join the meeting at 8:01 p.m.
I second all those in favor say I I I is that five eyes well meetings adjourn you don't have to stay anymore unless there's somebody that's got ice cream
