U Trusty Slaws recognize outgo outgoing board president. Trustee Troy Tanaka will be recognized for his service as president of the board of trustees for 2025. Oh. It is my pleasure to recognize Trustee Troy Tanaka for his service as our board president for 202025. Over the past year, Trustee Tanaka guided both regular and special board meetings with steadiness and efficiency, helping to keep discussions focused and productive. He was also a visible presence across all our six schools and within the broader Cypress community. His consistent attendance at events both large and small reflected his support for students, staff, and families. As he concludes his

004term as president this evening, I want to thank him for his leadership and the time he devoted to representing the board and the district in this important role. It is my honor to present this plaque of appreciation for his service to our school district. Here's a nice Thank you so much. Awesome. Thank you. >> Public comments. In accordance with government code section 54954.3, anyone who wishes to address the board on any closed session agenda item may be recognized at this time. In accordance with board bylaw 9323, individual speakers should be allowed three minutes to address the board on each agenda item. Total time limit for public comments on each item is 20 minutes. Miss Parker, do we have any other comment cards? Just those two. >> Okay. Thank you, >> Miss Fiona Victor. >> If

005you can please make sure the green light's on. >> Yeah, I do. >> Thank you. >> Okay. Good evening board members and superintendent Dr. Salavs. Um my name is Fiona Victor and I'm the fifth grader at Frankfus Elementary School. This is my third time here talking about the light covers and why they should be allowed in the classroom. This is this time I brought one of the light covers that was being used in the classroom. At the last meeting you said uh one of the reasons they are not allowed up is because it damages the light fixtures. but they do not damage the light fixtures. The light covers are made from flame retardant fabric that meets California fire code and have managements that are encased in the fabric. I was disappointed that I did not

006get a response from after my last visit. I would uh like to request a response in writing as to why the fabric covers are not allowed. Your written response to me was only about the international fire code. the last meeting you said a few more reasons but why they're not up but that was never communicated. I did the research and spoke to representatives from the Orange uh County Fire Authority in the Cypress Area One Prevention Office and they said as long as they meet California Fire Code that the light covers in our fabric and they have magnets okay inside the fabric and will not cause damage. If you see right here, it has the magnets right in here and it has randomly magnets in along in here and uh in uh inside. So because the

007magnets are inside the fabric, they will not cause any damage and they meet fire code. Please reconsider allowing them in the classroom and please respond to me in writing this time. Thank you for your time. Good night. Merry Christmas and happy holidays. >> Thank you, Fiona. Like to call George pardon, please. All right, I have a lot to say, so three minutes. Let's go. All right. Good evening, Board of Trustees and Mayor uh Superintendent Slavis. Uh my name is George Pardon. I'm a 36-year resident of the city of Cypress. My wife is a retired Cypress school district, having spent many years uh teaching sixth grade at Vessels and I currently have two grandsons, wonderful grandsons at that that uh attend Landell. I for myself, I spent my career in university administration in the Cal State

008University system with many of those years as a university vice president for administration and finance. I'm speaking tonight in opposition to agenda item six, approve amended and related uh restated agreements with the city of Cypress for use of Damron vessels and Ross Rosen Acacia Parks. I would minimally request that the board delay the approv agreements until conversations can be held with the city. I believe there is the potential for the district to receive $1,382,290. that was overpaid to the city by Malia Homes related to the old district headquarters property which led to the school district receiving less money for the property. I recognize that 3 minutes isn't going to be enough to delve into it. So, I did send you an email with a lot more background. I have been speaking out against the park

009fee charged for new housing by the city of Cypress for a few years now, specifically after the racetrack agreed to donate 20 acres for parkland within a year after the new park fee was implemented. Park fees are charged to developers whenever new housing units are built. I talked to Tim Mlen and Malia Holmes at the time, but unfortunately the city manager refused to back off the fee. I believe a significant portion of the fee is especially unfair to the school district and the racetrack that have both provided parkland to the city at no land cost. If you look at the breakdown of the inloo fee, it has two components. $9,316. Uh that has to do with park development and $14,15 for park acquisition for a total inlue park fee of $23,421. And as such with

010the fort, since this school district is providing land as park land to the city for an extended lease, for them to charge a park acquisition land acquisition fee to the school district makes no sense. I don't even believe the city has any intention of acquiring any more park fees because of the amount of land that the racetrack. That being said, the fact that the school district is allowing use of of these three parks to the city u for the si the school district then to have to pay this um what they paid was a million3 that Malia paid and that means that you got less money for the property. And since uh since I sent the email, I did talk to the owner of the uh Malia Homes and he's agreed that if he if

011they get the money back from the city, they would pass it on to the school district. So, I would really encourage you to delay this item until conversations. We have new leadership at the council level. We have new leadership with uh we'll have a new city manager and a new director of finance soon in the city. So I think delaying this for that conversation with a potential of bringing a million three into the school district makes good sense to me. Thank you. Thank you. Item eight, organizational meeting. Education code 35143 requires the governing board of each school district to hold an annual organizational meeting. Elect board president per board bylaws 9100 9121. The board of trustees shall elect a president from among its members to provide leadership on behalf of the board and the educational

012community it serves. The president shall presside all board meetings and perform other duties in accordance with law and board policy. I will now open nominations for board president. >> I'd like to nominate Lydia Sandi. >> Thank you. Trustee I need him. Do I have a second? >> I'll second. >> Thank you. Any other further nominations? Good. Robert's rule of order requires that the candidates are voted in order which they were nominated. If the first nominee wins the three votes, then the nominee is elected and no further voting is necessary for the position. I'll now call for a vote. All those in favor for Trustee Sundi um for president say I. >> I. >> Any opposed say nay. >> Trustee Sandi has been elected president. >> Congratulations. Press the G. >> Well, good evening. And as

013you all know, um our board has uh as a whole agreed to rotate on an annual basis the various leadership roles of the elected officers of uh the the board. So, uh it was my turn to move into that leadership role. I will move on now for us to look at the 8.2, which is the election of the board vice president. And I'm just going to go ahead and read uh briefly the um the statement that bylaw 9100 and 9121 that the board shall elect a vice president from among its members and if the president resigns or is absent or disabled, the vice president shall perform the president's duties. The board as a whole um uh is looking at the next in line and the next in line for this next year for vice president

014is trustee Hayashida. Uh, and I would ask for a nomination for her as vice president. Is there such a nomination? >> Yes, I I'm nominating Trusty Hayashida as vice president. >> Is there a second? >> Second. >> Are there any other nominations for this position? Seeing none, the nomination sees and I will ask for a vote. All in favor say I. >> I. >> All opposed. Same sign. hearing none then um trustee Hayashida is our new vice president for the board for the next year. The next item on our agenda is item 8.3 elect the board clerk. Uh this is going to be a first for me. I'm trying to do something that uh trustee uh Tanaka has done for this last year and that is to uh do double screens and I'm not used

015to trying to talk and look at two screens at the same time. So, if you will bear with me for just a moment, every now and then I will perhaps be pausing. Our next item, as I said, is 8.3 to elect the board clerk. Trusty Periq is next in line to serve as the board clerk. Do I have a motion to nominate her for this position for 2026? >> So move. >> I second. >> Is there Okay. Are are there any other nominations? >> Hearing none, the nomination sees. And I will note that the uh clerk is selected from the membership and the duties of the clerk shall be to certify or to attest actions taken by the board, sign documents on behalf of the district as directed by the board and serve as presiding

016officer in the absence of the president and the vice president and to perform other duties assigned by the board. Uh now that we have the um um nominations closed, all in favor of this position uh of uh Trusty Peri taking on board clerk say I. >> I. >> All oppose say nay. >> Trusty Periq, congratulations. You're our new board clerk. Whoops. Yeah. >> Item 8.4 is to appoint the superintendent as the secretary to the board. Do I hear a nomination for appointing superintendent Salavos as the secretary to the board? >> So moved. >> I second. >> All in favor say I. I. >> All opposed. hearing none. Superintendent Salam as you are the secretary of the board. Item 8.5 is elect parliament parliamentarian. Uh trusty natam is next in line to serve as the board

017parliament par parliamentarian. That's a that's kind of a mouthful. Do I have a motion to nominate her for this position? >> I move to approve. >> Second. Are there any other nominations for um the parliamentarian hearing? None. nominations are closed. Traditionally, the board elects a parliamentarian to advise the president on procedures during the meetings and um uh this would be what trustee need would be doing during the course of this year. All in favor of uh trustee nem being the parliamentarian say I. >> All opposed hearing none. Trusty Nem congratulations. You're the new parliamentarian. Thank you. the um cursor and the thing are not acting well for me tonight. Um the next item on our agenda is 8.6 approve the schedule of regular meetings. Um the um per bylaw 9100, the board shall approve a

018schedule of regular meetings for the year. Additionally, board bylaw 9320 states, "Unless otherwise determined by the board, the board shall hold one regular meeting each month starting at 7 PM on the second Thursday of the month at the district's administrative headquarters located at 5816 Corporate Avenue, Cypress, California. The recommended action is to approve the list that has been presented in the agenda for the uh meeting schedule for the the balance of the uh uh 2026 for the totality to 2026. I hope that my fellow board members have had an opportunity to look at that list of meetings and uh we'll be ready to comment. Is there a motion to approve uh the um um the schedule of of meetings for >> So moved. >> Is there a second? >> Second. >> Is there any discussion

019or is there any change or are there any changes that members would like to make? >> Yes. If we can look at potentially trying to change um the January 15th I will be out of town that week. If we we can do any other time the week uh Thursday, January 8th or January 22nd or even any other day, >> I would um just request that the board consider um either sometime that week or the following week. Um January 8th doesn't give staff sufficient time to prepare the after the holidays. >> So anytime the week after would be great. I'd appreciate that. >> Can we look at our calendars, uh board members? And um the 15th is the th is a Thursday and as um we look at the um uh is the preference is the

020preference to try to do it during that same week or uh the following week. Superintendent Salavs >> I believe Trusty Tanaka said he was going to be out of town. Was that the entire week? >> Oh, for the whole week? Okay. I'm sorry. So it would be the next week you're referring to? >> Yes. >> Okay. The 19th through uh potentially the 23rd. Is it best for everyone for us to keep a consistence and consistency and stay on a Thursday? That um just for consideration to just looking ahead um just be aware that that if we moved the January meeting to the following week, we are coming up pretty close on the February meeting. So, just as a point of information, >> there's a um Lendell has an event on that Thursday that's rescheduled. >>

021And I just want to also offer to the board, you know, there are occasions when board members are unable to attend a board meeting due to some other personal commitment and and when that's necessary, there's a process for um you know, for the board members to do that. So if if we can't come to a suitable replacement date, that's always another option. >> Would somebody like to propose a date? >> Could we just move it to the the Monday? Is that >> Monday the 19th? There's not >> Never mind. Tuesday. >> Tuesday would be fine. >> I'm just I'd appreciate I'd like to make the meeting if possible. I'm I'm open to to making it the Tuesday because it'll be about four days out from the original date and it allows me to go to

022the winter event at >> Anybody else have conflicts during that week? >> I'm fine. >> Okay. I would typically have a conflict for that night too, but I would um be able to um forgo that particular meeting. Uh, so January 20th. Should we do we want to by consensus agree to that date? >> Okay, let's make it the 20th then. >> Thank you. I appreciate everyone's flexibility. >> Okay. Can I propose one more change? Um, can we avoid having daytime meetings if possible? I believe that the only daytime meeting that is scheduled is for July 9th, which um we have historically done during the daytime at 10:00 a.m. Um I would ask um Superintendent Salas and staff uh whether that's a possibility that we could look at changing the timing of that particular day. >>

023We can certainly do that. Um we I I do recall that Trusty Periq had mentioned that um previously at a at another board meeting. Um, we left the 10 10 o'clock time just as a point of discussion because I think that there was some conversation that um that maybe a little bit later in the day would still be possible and maybe didn't need to be a night meeting. So, I just left it for trustee to clarify what her um availability would be. >> I mean, just just not during business hours, I guess, because I have a a day job. Since you're since you're the one who is interested in um shifting the time frame, why don't you propose a time frame for the July 9th meeting that would work for you best? Uh for consistency,

024we've generally met unless we've had a close session at 7 p.m. Would that work for you? >> I mean, that works unless you guys want to do it just a little bit earlier. I'm I'm open to that as well. Five, six. There's no kids here to say six, seven, hopefully. That was good. >> Superintendent Salavs, um I don't know why we originally did a daytime meeting other than the fact it's summer and um you know, maybe people like evening uh free, but um if um you could sort of give some in in um insight or um what the preference might be for staff to um have a >> earlier evening versus regular scheduled meeting time for that date. Uh, I think it's really up to the pleasure of the board. If if seven o'clock for

025consistency sake is um is a good idea from the perspective of of the board, we can definitely do that. If we did start at 5:00 not knowing what that agenda would look like, though it tends to be pretty light, but we also do the facilities master plan historically during that time, so there may or may not be that. Um, you may not want to have a meeting during the dinner hour. Just a thought. What's the likelihood that there would be a closed session that day? You don't know. Okay. Well, with traffic and everything, what if we just kept it at >> 7? That works for me. >> If we keep it at 7 p.m., we're consistent. And um um our master, you know, facilities master plan is generally well within a 2-hour time frame. So,

026uh, if we, um, keep it at that particular time, I would entertain a motion for, uh, the schedule of regular board meetings with the two changes that have been presented. >> Bless you. >> Thank you very much. I I really appreciate it. >> Is there a motion to approve the presented schedule with the changes that have been presented? >> I have a motion to approve. >> I second. Um, Trustee Hayashida has um moved and Trusty Tanaka is seconded. Is there any more any further discussion? If not, all in favor say I. >> I. >> All oppose say um nay. >> Motion carried. Item number um 8.7 is approve the board governance calendar. The um governance calendar is approved um uh or is generally approved by the board. And we do have an actual uh example

027of um the governance calendar that was um presented to us. Are there any um is there a motion to approve the the governance calendar? >> So moved. >> Trusty Nem has moved. Is there a second? >> I second. >> Trusty Tanaka has seconded. Is there any discussion on board uh board governance calendar? The only thing that I would say is the board governance calendar gives us sort of a blueprint for the actions and activities that we have across the year and it is a good roadmap for us to keep in mind as we have questions for when certain items come up and what our responsibilities are going to be as board members. Um if I hear no other um >> I do have one question. Is this the master calendar or is there another calendar

028that we have that we add in for like uh back to school nights and open houses and other things? >> You're referring to the academic calendar that's a different calendar. That's strictly board governance. >> Okay, perfect. Thank you. >> I I have a a question regarding the the board governance calendar. Is there a way to um trying to figure out how to ask this is I know at least a couple meetings last year um or this year actually We had some discussions about being asked to vote on something and then when the information that we were given to move on something was provided to us. Um if there's a way to sort of line up when we receive the information and when we're expected to vote on it. Um, I think that would be that

029would be helpful, but I think that would involve me going back and looking through the agenda items. >> I can share with you that the things that are on this governance calendar are um required by statute or con or are a condition of funding. So, um, understanding what you're referring to, if there is something new that, um, you wouldn't have familiarity with, we would probably bring an information item to you the month prior to so that you could have an opportunity to ask further questions if you needed additional information. Um, that might be a little prohibitive with everything that's on this list because some of those things are pretty routine and some of them actually um may not actually come to fruition. It's just in the event that um the district would need to take

030certain action, the board would have to act on this timeline. >> That makes sense. >> I I think that um I I Let me see if I can clarify what you're asking. I know that there were a couple of times that we basically had an item on the agenda that if we didn't act on it that particular night, uh we would be in violation of a deadline that we would be required to have met. And um I think that what um Trusty Periq is asking for is some kind of tickler on some sort of actions uh that that are required by a certain timeline. Uh if if those actions or those kinds of things are actually on the calendar. >> Yeah, I was going to say if if it basically says, hey, July 30th, we

031are required to have this completed, then we know in advance to ask for additional information if we don't have it. And is so if we could have either a star asterisk or whatever that says that's the item that I mean is it that specific? I haven't looked I didn't look at it for that particular >> No I I think you're right. It it is >> it is pretty specific. Just for example like for um December um certify the first interim report that's required. So you will be doing be asked to do that tonight. Um um there are some that are more local decisions. So if you look again on December under finance it says appoint Cypress Education Foundation board members um that is just a internal date. It may have to do with the bylaws.

032I'd have to pull those but it's not like a state law that we have to meet. Um but primarily these are these are board actions that are required by statute. Um for example adopt the resol the GAN limit resolution that's under September for business or finance. Um approve the unodudited actual September. So, you know, primarily most of these are are tied to some kind of state deadline. >> And I think that may help. And perhaps what um sort of um caught us um you know unawares was the um recognition that this last year was a a fairly uh unusual year with um new board members and um uh lack of familiarity with that calendar. And if you recognize that as we're going to start the new year, we're going to have this nice calendar to

033look at and to keep it in front of us uh on a monthly basis, we can we can make sure that we ask in a timely manner for the information we think we might need. >> And again, anything that would be unfamiliar to the board, we would provide an opportunity to present something in advance of that meeting where you would need to make a decision. But um mo most of the things on this um calendar are pretty standard and routine. >> Okay. Does that cover um >> I I think it does. I I think what I'm going to have to do is go back to to my notes from certain meetings and and see if I can make specific requests about, you know, if there is a certain item that needs to be approved. I

034think it was a June or July meeting where we had a pretty lively discussion about, you know, wanting to stay an item but not being able to do so because we were being so we were bound by statute to approve the funding by that time. So, um I'm going to go back and see if I can tease out the particular items that we had concerns about and then um communicate those to you and then we can see if we can get the information a little bit earlier um to have the option to dwell on something if we if we want to. Thank you. >> Okay. Any other discussion on approving the board governance calendar? Hearing none. All in favor say I. I. >> All oppose. Same sign. Motion carried. Our next item 8.8 is select

035board representatives for board bylaws 9100 and 9140. The board shall designate representatives to serve on committees or commissions of the district, other public agencies or organizations with which the district partners or collaborates. The recommended action is to um select and approve appointment of the following board representatives for two 2026. The nominating committee is the first one. Um the nominating committee is to elect members to serve on the organiz uh the Orange County Committee on School District Organization. Uh each district um in Orange County has a representative and um it is um having to do with um um selecting andor voting on um the Orange County Committee on School District uh organization. It's simply um the takes place during July through October and um is a sort of a one-stop thing that the nominating committee member

036brings to the board. ask if we have any questions or determines whether or not there are certain members that we would like to vote for, then that person actually votes for them, takes care of the paperwork, and turns it in. Would somebody like to be on that particular committee? >> I don't I don't mind doing that. >> Okay. Trusty Nem has indicated that she'd be willing to do that. I' I've got to guarantee you that is a very simple process. So don't worry about it. >> I'll be her alternate. >> You'll be her alternate. All right. The Greater Anaheim Special Education Local Plan Area Board. We need one alternate. The reason why we don't need an actual member is that I am currently sitting on that board and it's generally a two-year appointment. So, I

037will be uh in my second year of that particular um that particular position. >> I'll be your alternate. >> You'll be the alternate. Okay, the next item is Cypress PTA Council. PTA supports individual PTA units at each of the district schools and the meeting schedule is set by the council PTA president each school year. Normally, the person who sits on the PTA council as a representative of the board attends the council PTA meetings and brings input to that council PTA and they share with us uh anything that's going on with them. It's generally a daytime meeting. However, it is up to the council PTA as to set their own schedule. Would there be someone who would like to sit on that particular committee? I will go ahead and and and um volunteer for that particular

038committee. Our next committee is the health >> Sorry, do we need an alternate for that? >> We do need an alternate for that. I'm sorry. >> I can be the alternate, but daytime stuff is going to be difficult potentially. Um what has been the track record in terms of timing for those meetings? Do we have uh any kind of consistency? >> Um I would say things are um in the last maybe 18 months I don't I'm not aware that there has been a council meeting. Um I think things have been sort of handled offline and not through a formal meeting. Um prior to that the meetings tended to be after school. Um, so >> I can be your alternate. >> Okay. >> So, are we saying that you would be willing to uh be my

039alternate? >> Yes. >> All right. >> Um, we're now moving on to then the health benefits committee. Um, one of the things I would strongly encourage and if you have in front of you the uh list from last year, we can see who has been on which uh of these committees. I would encourage our newer uh board members to try to rotate between the health benefits budget advisory committee um and other kinds of uh roles like that um on a regular basis as opposed to just sticking to volunteering for the same committee each time primarily to get a little bit more familiar with um the uh background of uh what those committees actually engage in during their deliberative process. So um our person who has been the um um representative this last year was represent

040trustee Periq and uh alternate was needed. Um do I have someone who would like to sit on the health benefits committee this year? Well, I can see we're falling over ourselves to volunteer for things. >> I'll go ahead and take that one. >> Uh Trusty Hayashida, is that was that what you said? >> Yes. >> Okay. Thought I wanted to hear that. Uh, is there a willingness to be an alternate for this particular committee? >> Can we just clarify on this as well? Is this a daytime after school? >> This is an afterchool committee. >> Okay. >> They also have a a Zoom option for this. >> Oh, great. I don't mind being the alternate. Okay. So, Trustee Needm will be the alternate again this year. The budget advisory committee. Um, I know this one's

041a lively one. Is there someone who would be willing to sit on the budget advisory committee? >> I don't mind doing that. Is Well, let me ask. Is it >> It's a daytime. >> Daytime. Well, but it's after It's after uh school >> like a 3:15. >> Okay. >> I could do this one again. No. >> Can I Can I actually offer to alternate? >> Okay. >> You be Okay. Who's volunteering? >> I I'm happy to volunteer or alternate. >> I just want it. You want you can you can take it. >> Okay. Okay. So, Trusty Periq will be on the ed budget advisory committee and um who's the alternate? >> Jamie, you want the alter? >> You want to be the alterate? >> Unless I can be the alterate. >> I already got like

042three alternates. >> I'll be the alternate. >> Okay. Trusty Hishid will be the the alternate. I don't know if I'm doing something or if there's something been in the water, but uh we're we're not doing this real smoothly tonight. Um our next uh committee is the joint city district committee and as the president I would like to sit on this particular committee but >> I'd like to do it as well. >> Okay so trustee um Sundi and trustee Tanaka will be on the joint city district committee. Now here comes the fun and games and I would hope that we would all fall over ourselves to be a representative for one of >> Could I take Morris, please? >> There we go. Uh, Trustee Tanaka, we're we're talking about being the representative to our schools. One

043of the things I thought we might have some issues with is the fact that we have um we have three of our um trustees uh at this particular time and it's something that in the past has not been as um as um um frequent. We have three of our our trustees who have children in our schools and uh so there's a certain affinity for each one of the individual schools but uh I would like to say that first of all you are a representative for the district and secondarily you are a parent and when it comes to being a representative of the schools I think everybody can be a representative to each individual school but we need a formal representative and I would like to suggest those who are parents be first of all a

044parent at their school for specific functions like openhouse and back to school night in which case then perhaps seed your representation to another board member unless you think you can do all of it. Um so uh that that's just the cautionary tale. I will take whatever is left over because I don't have any children in the school district and right now or even in the near future. Uh, so I would like to suggest that uh people just shout out to me. What would you prefer to do? How about Peri? Trusty Periq. What would you who would you like to be the representative? >> I mean I I I think I have to attend the back to school nights. So it makes sense for me to just turn it over to your husband. >> Um, we

045have three kids. We both have to be there. >> Okay. So, um, one of the things that a representative does is, um, show up at each one of the classrooms, uh, as, uh, as the representative from the school district to, um, observe every teacher. And if you are, um, in your kids' classrooms, then you can't be that representative in a full fashion unless you split. We do it. Okay. You can rotate it with your husband. Okay. So, that's fine. I just wanted to make sure that we had this clear. So, Trusty Periq is going to be uh the representative to Landell. Trusty uh Hayashida, where would you like to be the um >> King? Okay. And um Trusty Needm, >> I'd like vessels, please. >> Okay. >> And um I was representative to Arnold last

046year and uh I would like to do Luther this year. Uh just to sort of mix it up a little bit. Um that leaves us with one uh additional school that is Arnold. Is there anyone who would like to do double duty on that? You know that uh some of our schools have their open houses and back to school nights slightly different schedules. >> President Sundi, last year um I filled in that extra spot. >> Okay. >> Because it's very difficult for someone to attend two back to school nights. >> So I'm happy to be >> Okay. >> the consolation prize, if you will. Well actually I think maybe you would be a very good prize for the school to be representative there. So um that's uh that let me just go back and reiterate

047um for Arnold um superintendent Salavs King Trusty Hayashida Landell Trusty Periq Luther myself uh Morris Trusty Tanaka and vessels Trusty Nem um that moves us on to our next item on the agenda which is to let's see >> okay we have to do we have to um >> we need to vote on that >> we need to vote on this and so the recommended act Okay. Does that actually take a formal vote or can we just appoint? >> No, we're voting. >> So, we're voting. Okay. Um I don't think we had a motion. So, uh do we have a motion to approve the uh slate of representatives to all the different committees uh that we have identified so far? >> So, moved. >> Is there a second? >> Second. >> I think that we've had

048enough discussion on this. So, all in favor say I. I. >> All oppose. Same sign. Okay. Then 8.9 adopt parliamentary rules. Ed code 30 uh 35010 states the governing board of each school district shall prescribe and enforce rules not inconsistent with law or with the rules prescribed by the state board of education for its own government. Historically, the board has adopted the latest edition of Robert's rules of order as the standard for conducting the business of the district during all meetings of the governing board and committees operating by appointment of the board. However, CSBA recommends Robert's rules of order, newly revised in brief, as a resource sufficient for resolving the procedural issues of most school boards. The recommended action is to adopt Robert rules of order, newly revised in brief, third edition, as the standard

049for conducting the business of the district during all meetings of uh the governing board and committees during the course of this year. Do I have a motion to adopt these Robert rules? >> Move to adopt the parliamentary rules. >> Is there a second? Second. >> Okay. If this is adopted, um I would request that all board members be provided with a copy of said rules and and the parliamentarian take an active role in clarifying rules as needed. Is there any other discussion on this particular item before we vote? Hearing none. All in favor say I. >> I. >> All oppose. Same sign. Okay. Then we have adopted the Robert's rules of order newly revised in brief third edition. We now move on to item number nine which nine which are reports neither nine number >>

050oh that doesn't look in brief >> um >> is it much thicker >> oh my gosh I thought it would be like you know five page okay so we have that's your homework all right Um, our next item is reports. That threw me for a loop there for a second. >> ACT. >> Yeah. Uh, 9.1 is uh, Association of Cypress Teachers. Do we have a report tonight? Yes. >> Oh, yeah. All right. Good evening, esteemed board members, Superintendent Zilavs, cabinet members, and all of the ACT members that showed up tonight. Thank you. I love you. Um, I'm Candy Early, ACT's president. Thank you trustees for all of your work in your current roles and dedicated service to the Cypress School District. You're greatly appreciated for all the service you've done for our district as well

051as the entire community. Our union looks forward to working continuing to work with all of you this coming year. It's been great having several trustees and superintendent solves join us at our rep council meetings. Please let me know if any of you would like to join us in the future. It's hard to believe it's already December. We've been working really hard. It's a great time for us to reflect on our accomplishments as a district. And that being said, it's also a time to look forward to the coming year. We've all heard the bad news about the budget and we're all stressed about the impending cuts for the next school year. Everyone across the district is going to be affected. Although we're not happy with the proposed cuts, we understand that something has to give based

052on the district's finances. our fingers and toes are crossed that this situation is not as dire as it seems and that when the budget's revised, it will be better news. With all of this impending doom and gloom, ACT respectfully acts asks that the trustees not approve an increase in the monthly compensation rate at this point in time. Yes, the stipen has not increased since the 80s and no one would begrudge a raise if our finances were different. But in an act of solidarity with the certificated and classified employees of the district, we would hope that you would forego an increase to the monthly compensation rate. Um just like our our raise, we are asked to forego a raise this year. So we would like to wait until a time when we can all have a

053raise. Thank you for this time this evening and have a relaxing and happy holidays. Thank you. Next on our reports is 9.2 California School Employees Association CSEA Chapter 325. >> Green light. >> Is it on? Okay, it is. Good evening, board of trustees, superintendent salavs, administrators and guests. I'm Kelly Frasier. I work at King and I'm the incoming vice president for CSCA chapter 325 and I will be reporting tonight. Oh, I just got a little nervous all of a sudden. Um, as we enjoy the holiday season, we wish everyone a restful and relaxing upcoming break, but is with a heavy heart that we reporting the numerous concerns CA has been re uh receiving regards um to the budget crisis. Uh the volume of classified staff who have reached out is staggering. Classified members are confused,

054scared, and angry. Um though we can only speak for classified staff, I believe it's fair to say that all of the Cypress School District employees are having a hard time understanding how the budget situation became this dire. Um budget committee many budget committee meetings, annual reports, and numerous presentations have led us to believe that the district has checks and balances in place to watch out for the well-being and finance of the district. Over the past three years, there have been numerous reports of regarding um declining enrollment and deficit spending. So now classified our employees are in questioning why we were not able to avoid this budget crisis. Um employees are starting to turn the corner from worry and grief into anger. They want to know if the administrators who knew about this and let it

055continue will be held accountable. Um at the last board meeting, an agenda item to consider an increase to the monthly board member compensation rate was discussed. We know that some of you have dedicated years to the Cypress School District, and we thank you for that. We have heard about the time that you spent preparing for the school board meetings, going to all the events at the schools, and commuting over the city of Cypress. And we've heard some of you have not yet recouped the costs that you incurred for running for the school board. CSEA firmly believes that considering a 400% increase to your board stipend when we are in the middle of a financial crisis is insensitive and a poor use of public funds. It has been stated that you can revisit this a um

056agenda item at any time in the future. So, we would request that this agenda item be tabled until the budget has corrected itself and the district is more stable. After all, you came into office wanting to serve the students and families of Cypress not knowing that this law was going to be passed by the governor. If you are wanting CA classified and certificated employees to accept a 0% cola for the 2526 negotiations, we would respectfully ask the same of you to set this agenda item aside until the budget crisis has passed and then consider something that is fair and appropriate for a district our size. More classified employees reside within your Cypress school district boundaries and certificated employees. We are your voting constituents and classified employees are paying attention to the budget. Thank you. Item

0579.3 is Cypress Council PTA. Do we have a representative tonight? Seeing none, let's move on to 9.4. Board of Trustees. I will start to my immediate left. Uh Trusty Tanaka. >> Thank you. So, it's been a pretty busy month. Uh thank you to the district and superintendent laws. Really appreciate the special meetings that you put enabled the board members to go to additional site visits because that was one of my big asks is being able to go to the site visits as many as we can and I really appreciate the district. I know it's not easy for the work that you have to do to put publish everything and post things, but was able to attend a special meeting over at Morris um for had a great visit with Morris um on that special site

058visit. So, thank you so much. Um also was able to attend um the budget meeting which we received from business services team and the district looking like we need to increase our revenue or reduce our spending by 2.1 to $3 million. So, um, thank you so much, um, Larry, for that and as we work towards this, I know you probably got the results back from the survey that you sent out to the team and looking forward to getting some more feedback from that as well as well, I won't be on the next budget meeting because we have a new budget person, chair for that. So, I look forward to getting an update from that next meeting that's coming up in February. um school site visit and this was another special meeting that um we had

059for Landell. It was during this Thanksgiving break which was nice and being able to see the kids. We actually got to even see a bus coming up where they're taking the kids to on a field trip to the Shipley Center. So that was such a great thing to be able to see the kids all happy and then everybody getting ready for the Thanksgiving holidays. Um also had another special meeting for the vessels. uh site visit which was um another great thing as well that we you know given us extra meetings to be able to go see u our amazing teachers, our staff and everything that everything that they do for our kids. Uh also attended the CSBA conference over in Sacramento. That was a great meeting. We had great breakout sessions that you know all

060each of the board members were able to choose to learn um and um about the different board items. One thing that was a great thing was our keynote speaker which was one of the days was Matt Lurman which basically spoke to the group of the school board members, administrators, superintendent about conflict conversation which focused on strengthening our communities and disagreement isn't a failure. It's evidence that people care and we in order to fix this is the democracy runs by having the dialogue. Having those open discussions dialogues is the most important thing. Um also attended Luther site visit with trustee Hayesa. Um got to observe um our bridges program as well as an Keen's um program on the entrepreneur program with his 56 combo. So thank you so much. So, it's great to see things. I

061got to see what Mr. Kelly's going to do to top that this year. So, and trustee Hayashid and I were looking forward to seeing uh the Luther talent show that's coming up. So, Miss Macarovich, please don't forget to send the district the uh invitation so we can attend that as well. Um attended uh last Friday was I mean earlier this week was the Landel Pace graduation. So, thank you to Officer Julie Marquez, the Cypress Police Department for this amazing program you do for our students. And that concludes my report. >> Okay. Trusty Hayashida. >> So, uh, in November, I attended the Morris site visit and extra board meeting with President Tanaka and Trusty Periq. I guess it's just trusty Tanaka now. Okay. Anyway, um it was great and I really do appreciate um Principal Ori

062who um gave an excellent tour. She talked about the programs, the teachers, the staff and how everybody is just working together for the um for the kids and it was a really good presentation. Um attended the Gulpa meeting as the alternate for trustee Sandi and uh heard a presentation from Ben S. Ben Rodriguez, the director of behavioral supports and professional learning who shared about his program and how he's going to grow it and do great things. So, that was really exciting. Um, also attended the same board meeting and uh vessel site visit and it was nice to speak with the librarian who um talked about how the kids increase their skills and the reading that goes along with it. So, that was just really neat to have that conversation with the librarian. Um, and then

063while I do appreciate the accommodations for these visits, it would be nice to have more opportunity to actually interact with teachers in the future, not just kind of walking through um, just to be able to have conversations and get to know staff and teachers a little bit better. Um, and appreciated going to the CSBA conference. They do a really good job. And for me, one of the highlights was the Norcco Corona uh career pathway program. They're working with colleges and then all the way down to elementary school upper grades and now they're going to pivot and figure out how to incorporate the lower grades. So, I just thought that was a great um um highlight and um and was glad to see them showcasing their program and hopefully we'll learn more about it. And then

064the last um was the grand reopening at um the Cypress Ralphs and then um uh and then the Cypress High School Ed Foundation had their uh kickoff as well. And it was just really neat to see how Principal Brown is looking to she kind of spearheaded the forming of the foundation in order to work with the community to get more resources and funding for the school um to meet the needs where other where other areas are falling short. And it would be nice to see if if our foundation can do something similar where we can um expand beyond what it was originally formed for. Um so that's just side note, but and then last I attended the ACT meeting today and apologized for not being able to chitchat a little bit before or after the

065meeting, but hopefully we'll have more opportunities in the future. >> Trustee Periq. >> Hi everyone. Thanks for being here. Um, December's been a little little crazy. Um, we had a couple of uh special board meetings which was essentially um the three of us attending um a couple of the the site uh the school sites. We went to um Morris and what was it? Vessels. Sorry. Um I I think I I echo um Trusty Hashida's sentiments in that while I really enjoy the site visits um it and obviously you it feels a little bit like I'm interrupting the classroom because we're kind of walking in, you know, we don't really have a chance to talk with the the staff or the teachers or anything. So, I think it'd be great to have um a little bit

066of an opportunity to to really get to know um what some of these these the staff and teachers are are doing on a on a more consistent basis. Um I know I have a chance to connect with the teachers at my kids schools, but it'd be great to to sort of do that at other schools as as well um outside of of these planned events. Um I won't just show up, I promise. Um I've been told to specifically not do that. Um and um we had our second joint district and city committee meeting. Um there was a a pretty cool proposal by one of the the council members to um maybe help um beautify the the surroundings of our schools by um painting the the crosswalks in the shape of books. And apparently that would

067be too distracting for the children. And so it was rejected for safety reasons. Looking at you over there, Leo. Um, but I I thought it was a great idea and maybe that's something, you know, we should consider further exploring with the city to see if, you know, they would um uh be willing to pay for some additional improvements to beautify our our schools. Um, we I didn't have a chance to attend the the tree lighting, but heard it was beautiful. So hopefully some of you guys made it there. Um because we were at the CSBA conference. Um I I mean the the breakout sessions were amazing. Um there were several that related to budget constraints that all of the school districts are are facing. Um there were uh I attended one on um on bond

068measures and and sort of how that works which was very educational. Um and uh we had a chance to meet some of the uh the governor candidates which was which was pretty cool. Um and um yeah I have a couple more site visits coming up. Congrats to all the Landell kids that graduated from from Pace. Um happy holidays. Merry Christmas. Thank you for being here. And I will um turn it over to Trusty Nem. Thank you. Yes, Trusty Nem says she writes books over here, so it's good to leave her for last. >> I Okay. Um, so yes, I was also part of that joint committee meeting. Um, there was talk about the racetrack and so we were provided notes um so that we could share that out. So it says the racecourse has applied

069for a tenative track map and the environmental impact report the EIR and a developmental agreement to facilitate the future sale and redevelopment of the property. There is no construction that has been proposed. Um the EIR is evaluating the environmental impacts of potential development including um projected impacts on our student populations. Um it says for analysis purposes the EIR assumes project buildout by 2035 but it will likely be closer to 2040. Um the projected buildout includes 1,791 residential units and 440,000 square ft of commercial space. Of the of those units um 1,176 of them are within the Cypress boundaries. Um so they would expect a bit of an increase of about 237 students to our district. Um we were also given an update on um school bus stops and so um the police department and the

070city and Teresa, they were all able to work together to get some um bus stops um specifically designated areas. So thank you so much for that. Um, and then what uh we were talking about crosswalks and things like that. Um, I also attended the CSBA conference where there was over 5,000 board members from over a thousand school districts. Um, there were a couple important things to share. I felt like I went to a breakout on um the Brown Act basics. And so when you see us up here having discussions about who wants to do what when, it's because we can't have those discussions anywhere else. So that's kind of why we stumble over things. sometimes. Um, one of the takeaways from that was also that um, email is part of that act. So sometimes if

071you're reaching out to us directly, there's certain restrictions on those types of things. Um it was also mentioned that we can consider um our time for public comments that if that that's locally controlled and so if there's something that is a hot topic um we might want to consider um shortening the comment time so we can hear from more people. Um that was just a recommendation. Um, it was also talking about how we can pause meetings if we need to. Um, if things get out of control, we can clear the room and kind of start over. And then it was talking about how in July of 2026, um, certain meetings will have to be online, although I'm not sure if Cypress um, qualifies for that or not or if that's come down the pipeline. Um,

072but they were talking about how we're if if that does affect us, we're going to need um policies in place for disruptive audience members and things like that. If the stream fails, we have to um hold our meetings for up to an hour and board members can also participate online, not necessarily in person. Um, one of the things from the general session that I took away was that um, they were talking about how we should not be mandating things um, without investing in them. So, um, one of the other, um, breakout sessions that I went to was talking about um, school discipline concerns and how um, we can no longer suspend for willful defiance and things like that. um the research that was presented in that breakout session was talking about how even one suspension

073is leading more to negative outcomes um for students and for families. However, if that's something that we are um that we find important that we need to invest in that. So if um we're looking at MTSS and restorative practices and all those kinds of things that teachers um and staff need to have the training for that. Um they also encouraged board members to be invited to schools um to um kind of witness behavioral issues and things like that and bring that back to the board so we can have discussions about how we could potentially help to solve those problems. Um they were also asking um or suggesting that we ask for student input because they're kind of like the boots on the ground. Um and that was most of the conference I think. Um I

074also visited Landell um and I appreciated a lot of the teachers and staff there um inviting us back, welcoming us at any time. Um, it was great to see the engagement of the students while we were there, even though we were two days shy of the Thanksgiving break. Um, and I think that's about it. So, I would like to wish everybody a great two weeks off. And hopefully teachers, staff, you're able to relax and enjoy. >> Thank you. Well, I then um I will um make a note that um uh I'm listening to all of the things that everyone had uh experienced attending the CSBA conference. And I'll just preface u my comments on uh and and and and and note that uh as you could hear from the different sessions that the different members

075that attended uh made. Uh there's an ever growing in complexity in terms of what we're being exposed to and trying to try try to get our arms around in terms of understanding um the uh changes that are uh occurring in the educational environment. Whether it happens to be law, whether it happens to be technology, whether it happens to be politics, whatever it happens to be, whether it happens to be on the ground um uh addressing of issues that come up at uh in the district having to do with behaviors, etc. and so forth. These are all things that schoolboard members are trying to get on top of in terms of educating ourselves and being able to uh be the most informed uh board members that we possibly can to make the best decisions for the

076district. Well, that said, I missed the CSBA conference. Uh my husband uh was given one charge during the course of this last year and that was do not make any travel plans for any uh schoolboard meetings. He took it to heart. The very next day after our last board meeting, we left for India and I had a wonderful three weeks vacation with my husband. Uh I just got back on Sunday and so my number of activities during the course of this last month have been relatively small. I did have an opportunity to go to the p to the pace graduation at Landell on uh Wednesday which was yesterday and uh thoroughly enjoyed as always the uh surprise and anticipation of the ones that are actually writing the essays andor the making the posters or the

077writing the poems the ones who are the winners that are chosen for those particular um uh graduation activities. And uh so Landell's um graduation was no different than any other. The the children were amazing. Uh the children were extremely uh ordered. Uh they uh listened intently. Uh they were focused on what was being presented and there was an excellent showing of parents at that particular uh graduation. So I felt really honored to be able to be there and to experience the uh the graduation with the students and families. So, that is all I have to report, but I would like to say that as we're moving into the holiday season, uh where you're going to have time off, I wish you joy and all the blessings of the season, uh as um you are experiencing

078time with family and uh hope the children of our district also have a recuperative time as well. Uh I know that uh this is always a a wonderful time for us to uh be joyful and uh I wish that for everyone. So, uh, we'll move on now to 9.5, the superintendent's report. >> Thank you, President Sundi. Um, I just want to share that, uh, the CSBA conference was, I thought, in my opinion, excellent this year. There were a lot of really valuable workshops. Um, I attended several on school finance and budget. Uh, given our current circumstances and also, um, I'm going to provide those for the board in the Friday report. So, I've downloaded those handouts, and I just want to um encourage other board members who were able to attend the conference to forward

079me your handouts and any notes or perspectives that you'd like to share with your fellow board members, and I will include those in a Friday report as well. Um, other than that, I think I'll keep my comments brief because we still have a number of business items ahead of us, but I just want to wish everyone happy holidays. >> Fantastic. Next item on our agenda is uh approve the minutes. 10.1 is to approve the minutes of the regular meeting of November 13, 2025. Is there a motion to approve the minutes? >> I move to approve. >> Is there a second? >> Second. >> All in favor say I. >> I. >> All opposed. >> The next two meetings uh require approval by those who were in attendance with remaining board members to abstain from um

080from voting uh I on those meetings. We had two special meetings during the course of uh this last month. It shows the innovation that the the district is trying to uh engage in. As trustee Nemmit indicated, um the Brown Act does require us not to have more than two members of the board present at any school or any kind of activity. Uh otherwise, we're violating Brown Act with the potential of not being in a formal meeting setting. So we now are calling these special meetings if more than two people are wanting to attend these meetings or attend these uh visits to the school sites. So the special meeting uh school site visit to Morris November 19th. Is there a motion to approve uh the minutes of that meeting? >> So moved. >> Is there a

081second? >> Second. All in favor say I. >> I. >> All opposed. Are there any abstensions? >> I. >> Me I abstain. >> You abstain. >> Okay. >> I have to. Right. You said I wasn't there, right? Okay. Uh, next meeting, uh, 10.3 is special meeting at the school site of vessels. Um, that was on, let me get this down. December 1st. Is there a motion to approve the minutes of the December 1st, 2025 meeting? >> It's been moved by Trusty Tanakh. Is there a second? >> Second. >> Uh, seconded by Trusty Hayashida. Is there all in favor say I. >> I. >> All oppose, same sign. Okay. All any abstensions? I I Okay. Motion carried. Item number 11 is the consent calendar. Consent items require one motion only. Items may be removed from consent

082to be acted on individually at any board member's request. The recommended action is approved consent items 1.1 through 11 or rather 11.1 through 11.7. Uh would anyone like to pull any items from the consent calendar? Is there a motion to approve items 11.1 through 11.7? >> So moved. >> Is there a second? >> A second. >> It's been moved by trustee Nem and seconded by trustee um Tanaka to um approve uh the consent calendar 11.1 to 11.7. Is there any discussion on any of the items? I would like to make a a couple of um notes. Um I think that um uh the item 11.1 approved gifts report the there was an item on there that indicated that uh community provided uh donations of $5,000 to our great music program. Um I just wanted to

083note that that shows the robustness of our music program to note that we are able to continue to engender uh public support and um um family supports of this particular program. Uh the other item I wanted to comment on was 11.3 approved certificated staff report. Um I'd like to take a moment to thank the eight teachers who will serve as mentors to one or or more of the 13 induction program uh participating teachers during the 202526 uh school year. Even though there will be a stipen that is attached to this effort, the time commitment that you make will strengthen the skills of these teachers and strengthen the Cypress School District. So again, thank you for that particular effort. Um is there further discussion? Then all in favor say I. >> I. >> All oppose same

084sign. Then the consent calendar has been uh approved. Item number 12 is an action are our action items. 12.1 approve agreement with wear disposal incorporated for waste management and recycling services. Um the uh appro the uh recommended action is to approve um this agreement for waste management and recycling services at an estimated annual cost of $109,37156 for the term January 1, 2026 through December 31st, 2029 with the option to extend for two additional one-year terms with board approval. Um the note in the report indicated the district had published a notice notice calling for um bids for waste management and uh the uh where disposal incorporated was the sole uh bidding company and because it um um met the um uh specifications and was competitive uh it was selected to be proposed as the uh where

085the uh waste management and recycling service company for us for this next year. Is there a motion to approve this agreement? >> I move to approve the agreement with the wear disposal. >> Uh uh trustee Tanaka has moved. Is there a second? >> Second. >> There's been seconded by trustee um Nem. Is there any discussion? >> Yes. I I have one question. Sorry I didn't get this. Is what do we know what the increase was from the previous contract to this? Is it was it a big percentage, a small percentage? my button to work. Um it was actually a very small percentage and something to note is that per the contract um unless there is some unforeseen they actually have to keep these prices for those three years. >> Oh that's great. >> So it

086I think overall it was a really good bid. It was within what we thought we were would expect and so that's why even though there was only one contract we felt very comfortable with proceeding for asking for your approval. >> Good job. Thank you. I was going to ask the same question, but I did want to ask you, do we have a a separate schedule? Um, what does the separate uh schedule look like for the district office in terms of its waste management um contract or agreement or and do we use where for that as well? >> Um, as noted in the board item, we actually use Valley Vista and it's done through a collective agreement with Pan-American, who's our property management company, with the other buildings. And so um we did not include it

087because of the unique connections to the other buildings. Is there any further discussion? If not, all in favor say I. >> I. >> All opposed. >> Motion carried. Item number 12.2 is um uh just let me move my cursor down and get to the next item. It's wanting to go slowly here. The buttons on here is acting slowly. Okay. Item 12.2 is approved contracting with MP South Incorporated for the 2026 Landell Kindergarten restroom project. Um the state's expansion of the transitional kindergarten program has created the need for restroom facilities at some of our school sites and at Landell. Uh the restrooms are needed to provide accessibility within the kindergarten complex for all transitional and kindergarten classes. The recommended action is to approve contracting with MP South for the 2026 Landell kindergarten restroom project under the

0882021 maintenance construction unit price bid master agreement during the tenity period of 20 December 202 2025 through April 30 2026 at a total cost of $339,59340. Is there a motion to approve this contract? >> So moved. It's been moved by uh trusty Tanakh. Is it sec? Is there a second? >> I'll second it then. >> Trusty Hayashida. Is it peri trusty Periq? Your voice was so soft. I thought it was trusty Aisha. >> Second. >> Okay. Very good. Is there any discussion on this particular item? >> Yes. And thank you, Superintendent Law. I I did have some questions on this one uh just because of the budget constraints we're in. And you know, when you add in 122, 123, and 124, it's about 356,000. And my questions u were could this wait, this project wait

089until the Landell remodel project comes in. But due to the compliance issues with the ADA, making sure we have a ADA and the addition of the TK classroom, we it couldn't wait. So that was some of the reasons why this needs to go through. So, I wanted to make sure everybody understood that. >> Any other discussion? >> Uh, I just I wanted to add that um in addition to what Trustee Tanaka said that there's this is additional bathrooms that are being constructed for for kindergarten. This doesn't take into consideration the existing restrooms that the TK classes are using that are also in dire need of of upgrades. So hopefully that will be considered within the facilities master plan at some point. >> Good. I just did want to make another comment and I was remembering

090that we had a conversation about these um these restrooms and I know that there was a uh teacher request for us to have a conversation about this in the parking lot one night a couple of months ago and uh I didn't have the answer for that person at that time. So, I decided to go back into the agendas to determine when we actually uh approved the master plan where we were going to make be making those changes. But I thought that it would be helpful if in the future that if we have items that we have approved the project on but it's going to be a delay before some action comes before us in terms of um you know asking us to uh extend uh a contract uh to um or or or an agreement

091with an entity to actually implement something that we've approved. if we could actually put a reference into the staff report that documents when we actually approved us doing that initially and now we're actually bringing it forward for action in terms of implementation. Uh that would help because I had to go through several agendas to try to figure out where this was and uh it would be helpful if we just had that reference within the reports so that we wouldn't have to do sort of a u um you know we could we we wouldn't have a gross search. we could have, you know, much less um need for going back and feriting out the information. Otherwise, um uh if there's no other discussion, all in favor say I. >> I. >> All oppose. Same sign. >>

092Okay. Motion carried. Um the next item 12.3 is to approve agreement with AW Industries for inspector of record services for the 2026 Landell kindergarten restroom project. Um the recommendation is that this would extend through uh December 22nd, 2025 through April 30th, 2026 at a total cost of $9,500. Is there a motion to approve this item? >> So moved. >> Is there a second? >> I second. >> It's been moved by Trusty Needam and seconded by Trusty Tanakat to approve this agreement with AW Industries. Is there any discussion on this item? Hearing none. All in favor say I. >> I. >> All oppose. Same sign. Motion carried. Item 12.4. Four, approve agreement with American Engineering Laboratories Incorporated for materials testing and de uh deputy inspection services for the 2026 Landell kindergarten restroom project. Oh, this a

093materials testing and deputy inspection company is required by the division of the state architect to provide testing and inspection services to include soil, concrete, rebar, and postinstalled anchors. The recommended action is to approve the agreement with American Engineering Laboratories Incorporated for this uh function that would last between December 22nd, 2025 through April 30th through 2026 at a total cost not to exceed $5,942.36. Is there a motion to approve? >> So moved. >> Is there a second? >> A second. >> Then moved by Trustee Hayashida and seconded by Trustee Tanaka to approve the agreement with American Engineering Laboratories Incorporated. Is there any discussion on this item? >> I have a question. >> Yes. >> Um, so the the testing and inspection is purely related to the construction of the new bathrooms. There's no inspection of the

094existing restrooms. >> That is correct. Thank you. Okay. Any other discussion? Hearing none. All in favor say I. >> I. >> All oppose. Same sign. >> Thank you. The we have approved the agreement with American Engineering Laboratories for this um materials testing and deputy inspection services. Item number um 12.5 is considered liability claim number 03-25 um 26. This item was presented during close session where trustees received information regarding this claim. The recommended action um is up to the to the board. Uh various options were given to us, but the recommended action is to deny liability claim um number 325-26 dated November 11th, 2025. Is there a motion for this item um at your discretion? >> So moved. >> To deny. >> Correct. >> Yeah. So moved. >> Okay. >> Second. There's it's been moved by

095trusty Tanaka and seconded by trusty Nem to uh deny liability claim this liability claim. Is there any discussion? Hearing none. All in favor say uh say I. >> I. >> All oppose say nay. Um the claim has been denied. Item 12.6 Six is to approve amended and restated agreements with the city of Cypress for use of Damron vessels and Rosen Acacia parks. The Cypress School District and the city of Cypress have entered into three agreements that the that allow the city to use portions of the district's properties as community parks. These three parks are Damron Park adjacent to the Damron school site, Vessels Park adjacent to the Vessel School site, and the Rosen Acacia Park adjacent to the Swain Mott site. The original agreements were um for the um as as was in our report

096uh for Damarind and Vessel Parks dated back to 1995 and the one for Rosen Aacia Park was entered into in 1971. At the November 13th, 2025 uh board meeting, the board discussed the three agreements and provided direction to staff to work with legal counsel and the city to bring renewal agreements back to the board for approval. The recommended action by staff is to approve amended and restated agreements with the city of Cypress for the use of these three parks for 10-year terms effective upon mutual approvement by the Cypress City Council. Is there a motion to approve this item? >> Can I make a different motion? >> Um, yes, you can make a motion. Whatever motion you want to make. Can I make a motion to stay this item and to agendaize it at a different

097time? >> Uh, I believe um under Robert's rules of order that would be you would be moving to postpone. >> Yeah. >> And you are is there a specific meeting that you would like that postponed to? >> Um, >> could I add to that? >> Sure. >> Okay. I'd like to make a motion uh revised motion to postpone this topic until the board has time to have a conversation with the city and or workshop if necessary to gather enough information for this agreement. >> Is there a second for this motion? >> Second. >> Is there any current discussion on this item? >> I think that there was just enough information and and I would like just to have a little bit of a clarity. I think we had some active um or might say robust

098conversation about this item last board meeting and um as I look at these particular agreements, I do not see as that were presented to us, I did not see what the original agreements uh terms were, but I just would like to see um uh ask for uh Mr. Dr. Fchaw, if it's fair to say that there were only minimal editorial language and dates uh changes on these agreements or what was what was the nature of uh the changes that were made on these agreements? >> Sure. Well, as noted, these are 30 and 50 plus year old agreements and and a lot has changed uh in the legal language that would be used in these types of agreements since then. So, um, some of the significant changes related to liability and indemnification language, uh, that wasn't,

099um, as robust, um, for the district's protection, um, in the old agreements as it is in the proposed new agreements. Uh, there's specific insurance requirements that are identified in the new agreements that weren't in the prior agreements. Um there's more specific language on the expectations for the maintenance and upkeep of the properties by um the city um as well as um any you know remedies that the district would have if the city um does not uh take care of the properties as as indicated in the agreement. Um, we're also to be advised of activities um that the city plans and programs for these um parks and that hasn't previously included and also gives the district the ability to reserve use um of the parks uh during normal school hours with appropriate notice. So, those were

100some of the highlights of the agreements that weren't in there. We didn't do a red line because it would have looked like an English paper that I turned in in nth grade in terms of the amount of red ink that would have been there. Um so, it would have been uh pretty ill uh illegible. Um but those are among the highlights of the differences. >> Um in the future I would I would relish uh seeing a redlinined um document and then a clean version which would be what you sent to us. Um because uh in in absence of that we're we're functioning in a vacuum. All we're seeing is the end product. We're not seeing what the original document was. Um but if there's no more discussion, we do have a motion on the floor

101to uh postpone this to a later date. Um I think that um the uh direction was provided in the motion. Is there any further discussion? >> Do we have to provide a date at this time? >> I don't think so. I think the staff >> I haven't read my book yet. So I think your name um I think that uh I I think the motion did did were you able to capture that motion? >> I can read it again. >> Okay. Please do >> make a motise motion to postpone this topic until the board has time to have conversation with the city and a workshop if necessary to gather enough information on this agreement. >> Okay. So, um the timing would be up to staff to work with the city to select a date that

102we would need to be able to have the accumulated information. So, I guess we'll leave that to staff. Uh any further discussion? I I have um a point I want to make. I just I just want to point out that um we were provided a lot of information about a potential opportunity cost with this with this agreement. And I I don't want that to be interpreted by anyone here or the city officials is is the district not valuing the long-term positive relationship that we've enjoyed with um with the the city officials. Um but you know, we're just trying to make sure that we maintain our fidu fiduciary responsibility that we have to um the district and to um you know, the the students. So, I I want to make sure to to get that point

103across that we continue to appreciate the relationship that we have with um with the the city council. Um but, you know, we just need more information. That's all. >> I think that point is well taken and uh I appreciate you bringing that one forward. Any further discussion? Hearing none. All in favor say I. >> I. >> All opposed. Um the alternate motion to um the recommendation has been made. Item 12.7 is appoint Cypress Educational Foundation board of directors. My computer froze there for a second. The Cypress Educational Foundation Board of Directors has five members. the superintendent, two directors appointed annually by the superintendent, which include the assistant superintendent business services and the executive director of human resources induction and two directors and an alternate director appointed annually by the board of trustees. The following nominees

104have been serving uh for some time. Christine Barnes has served as a director since 1996 and is wanting to uh be reappointed for 2026. Christy Parker has been appointed uh has been a director since 2013 to 2015 and uh an assistant an alternate director 2013 to 2015 and a director since 2016 and would like a reappoint. Ethel Bowman uh has served as a director from 1990 to 2015 and an alternate director since 2016 and is recommended for reappoint as an alternate director for 2026. Is there a motion to uh approve these three individuals for the educational foundation board of directors? >> So moved. >> Is there a second? Is there a second? With no second, then this motion dies. Um is that what the is the um is the pleasure of the board? >> Yes.

105>> Okay. Then um this motion dies. Uh I would ask the um uh superintendent to uh advise as to what is the next steps that we would need to take since we are denying the reappointment of the existing board. >> I will have to check with legal counsel. >> Okay. And then um >> can I um bring up something I had brought up earlier? >> U since we don't have a motion on the floor um and and We don't have a second. Then it would be inappropriate for us to to speak to it. >> Can we do a discussion item >> on this motion >> on on this item? Can we do a discussion item on this? >> Normally discussion comes after a motion and a second. Um don't want to ask the parliamentarian to

106research that. >> You have the toughest job today, Jamie. >> No pressure. Well, >> can we can we move and second it to have a discussion and then >> and then deny it >> and then can we move to poll? >> Yes, we could do that. That would be in line. That would be an appropriate action. >> So, let me ask again. Is there a motion to approve this uh the the appointments of these three individuals? >> So, moved. >> Is there a second? >> Second. >> Okay. Okay, it's been moved by trustee Needam and seconded by trustee Periq to approve these three individuals as uh directors and assist and alternate director to this education foundation board of directors. Uh it is now open for discussion. Trusty Periq. So that this is one of those

107um this is an example of one of those items that I I was referring to earlier where it comes up every year, but if there's a specific timed um action that needs to be taken in order for us to move on this, we should be provided that information earlier. or if there is a specific timed action that the district should be taking um that should be on the governance calendar. So my understanding is that there's a certain timeline to either nominate the staff can nominate someone for this particular board or um someone could just apply. Am I correct? Am I understanding? >> The bylaws are very general. Um the bylaws were written back in the I believe like the 1990s. Uh we conferred with Ron Wingart Legal Council to establish um bylaws for a foundation

108that would enable the district to generate revenue from its properties to support its educational program because back at that time school districts couldn't just do that outright. So the foundation was created for that purpose. And so the bylaws were written in a way to favor the district and to ensure that those monies, those grants flowed to the district. And so the um structure was written um in a very generalized manner. So there's not a lot of specific rules about nominations or or any of that. Now, if there's a desire moving forward for the foundation to look differently, we will have to incur legal cost to employ an attorney to help us dissolve the current foundation if that's the interest of the board and redesign a new one if that is the interest of the board.

109But, um, that's a little bit of the history. >> Okay. And, um, so um, is there any other discussion? >> I do have something. So thank you superintendent Salos for providing information and details surrounding the appointment of the CF CEF board. this year's and just for the audience there's this year's process is different from the past three years which I've been on the board because the difference between this year and the prior years is the board approved the recommended board of directors which has done a great job for our CF foundation but um because there's only been the only candidates presented to the board but they've done a great job for us right but this year is different you know we have a highly educated qualified community member who has expressed interest in being considered

110for this appointment. You uh Mr. George Pardon has been formally recognized by the city of Cypress for his dedication and service to our amazing Cypress community. You know that's one of the things that you know to me we should be able to look at um everybody that wants to be able to go into and this instead of doing even have going with the people that have done such a great job. We need to look at everybody and give everybody that fair chance. >> I agree. I think that maybe um in a previous year um I had asked what the nomination process was and what was the open the open uh call for um either interest or nominations for these positions. And um I don't remember what the response was but it basically was you know

111it basically seemed that um as you said there was a very vague and general um nature to um the um um nomination process and at the very least it looks like that um some refinement of and more specificity to how someone could get on this board because I think that's what I ask. How does somebody get on this board and why do we only have the same three people over and over and over again? Um and um the um and and I I think that that's the issue here as much as anything is is that we need to have an open process for someone to sit on this board. And so um as we go forward, I think that maybe um there needs to be further discussion with the board to see what our uh

112specific um uh whether it's narrow in terms of need of opening it up for a broader opportunity for more people to apply for the positions or whether it is more uh more uh grand in terms of restructuring the whole foundation. Uh I think at this point it threw me for a loop because I wasn't aware that there was a community member who had asked for uh consideration for this particular uh position. So um I would say that um at the very least we bring it back for discussion as to what the board is what what the what what the pref preference of the board is in terms of going forward. >> I do have one more question though. >> Okay. I know in looking at the uh the bylaws it they said that it needs

113to be done by a certain time because of the next meeting that is I think supposed is planned in January. I don't want to disrupt things from that perspective. >> We won't be able to do any business which means we won't be able to I don't know how we do business. I I honestly I'm going to have to just check with legal counsel because this is so completely outside of my knowledge area, my expertise, and I don't want to ill-advise the board and I don't want to um I don't want to make missteps. So, we'll just uh reach out to legal counsel and get some um direction and guidance on this. >> Okay. Can I can you just put a >> I was >> Go ahead. I I was going to say I I see

114a pathway here of a possibility and that is is is that if the motion would be amended um um well we have it on the floor. If we vote it down uh we have the opportunity to make another motion associated with this tonight because this is the agendaized item. We could make an ex we could make an additional motion that actually gives direction to staff in terms of what uh maybe it would be a timeline to allow for the actual um uh stay of election of new officers to allow the January meeting to take place. And then the um reorganization or red designation of what the foundation should look like could come after that date but prior to the next board meeting. I can't advise you. I just don't know. I I really don't want

115to speak in an area I don't have expertise in. >> So, two other things I'd like to add to whatever research is done. Um, one, if trustees can serve on that board as well. >> Well, again, I'm going to have to check with legal counsel. That could be a conflict of interest. >> Okay. Because you've got board executives on there, and to me, there should be some other representation as well. Um, and then the last thing is we were asked to appoint tonight, but I don't even know who these people are. And so some type of application, resume, something to know more about them, especially if they want to be reappointed would have been helpful. I don't know if I missed it. If I did, please let me know when it came out. Otherwise, um,

116okay. Um, that's one additional thing as well. >> Trusty Periq, you had additional comments. >> I I have several comments. Um, so I and I I think I I raised this last December, but I I was too new to to all of this. Um, if Okay, let let me let me start with the the point I made earlier that I want to make again that this is yet another item that we are being told if we don't vote on this, if we don't pass this motion today, that we that the district will not be able to do business. I really really dislike being in this position of of this much pressure where the the school that my kids go to school at will not be able to operate unless I vote yes on this motion

117today. Um so I I don't understand the comment of we will not be able to do business. What does that mean? the foundation will not be able to vote on anything to to do any foundation business, >> right? Which funds a a part of or or >> monies from the foundation flow to the district. Yes. And and then that those in turn flow to the schools. So it will delay any any business that the foundation has. And I do understand what you're saying and I I don't want to um to sound as if I I'm not empathetic. I I'm we're trying very hard to provide you with information that you need. I'm just sharing with you that all of you voted for this last year. So, I'm a little blindsided, but we will adjust and

118we will get you the information you need. So, I believe that um as I mentioned, I will consult with legal counsel. This is not my area of expertise and I don't want to misadvise the b the board. So, uh we will come back with further information. That's about all I can share with you at this point. Could I ask just one question? You know the the identification is is that um you know the um the three the the three staff um members of this five member board are defined by the roles that they have. But you're telling us that the two directors and the alternative director are appointed annually by the board of trustees. But we are not aware of a nomination process or there is no nomination process for us to see or to

119provide input to or recommendations to at this point. Is that is that am I am I being correct in in the the bylaws are are silent on any kind of nomination process. And so past practice for I don't know back to 1990 is that the board members have just continued. This is a practice that predates me and several other superintendents before me. So I and I wasn't here when the bylaws were written. This is a program I inherited. So if we want to change it, we can do that. Um we'll just have to employ an attorney to assist. Okay. Well, I think that we have enough um u discussion on this. >> I I have a few questions still. >> Okay. Is this something that is germanine to either voting this uh appointment? Um >>

120it's a discussion point about this item. Yes, >> it's a discussion point about this item. >> So, I I don't know who these people are. We have not had an opportunity to meet any of these people. They control a lot of the funding that we get through grants. I don't know if the staff has had an opportunity to meet any of these people. If you know who these people are, um I don't know if the bylaws explicitly say this, but there was reference to the staff having the opportunity to nominate um folks on this board. Um I don't know what type of decisions they make. I don't know if they're simply a shell organization that the district uses to sort of figure out what they want to do with the funding. I I just I

121need more information on on what this board does, the the amount of money that they control, do they make all the decisions related to the properties that we own. Um I just I I've had a lot of questions about their involvement in our funding. Um and I would appreciate almost an educational session. Um and I would recommend to the extent possible making that open to whoever wants to attend. Um just so everyone everyone knows all of this as well. Well, that would be in a board meeting. You would do that in a board meeting. Yeah. >> Okay. Is there any further input at this point? >> There's a motion on the floor to appoint two directors and one alternate director that have been named. There was a motion and a second for that. All in

122favor say I. >> All oppose say nay. Nay. >> Nay. Nay >> motion fails then um the direction I I believe that um we're giving you is to proceed with uh communication with um um council to determine what our next steps are. But I think it's clear that this board is um is interested in additional information and perhaps looking at substantively look reorganiz reorganizing this particular foundation. Item number 12.8 approve the 202526 first interim financial report and certify a qualified financial status. This is the first of two interim reports of the years of the year and the recommended action is to approve this first interim financial report and certified a qualified financial status for the remainder of the fiscal year and two subsequent fiscal years. Um are we are are is Mr. Firchaw going to

123be providing a report on this tonight or are we just acting on it on the basis of what our report was? >> Did we have a motion? I'm sorry. >> I'm just asking. Oh, okay. >> I was just asking um I we haven't had a motion yet. Sometimes we ask for the report first and then the motion. >> I am just thinking that you might have questions. Yeah. >> Second. >> Has been moved and seconded. Uh moved by Trusty Tanaka and seconded by Trusty Periq to um approve the uh district's intra first interim financial report. >> Um now we're open for presentation. >> Well, thank you. I'm going to move this up here. Um uh members of the governing board, uh superintendent Slavs, cabinet, uh community members and staff, uh have a brief or maybe

124not so brief presentation on the first interim budget. Um and the clicker is not working. Um so Teresa is going to bear with me and we're just going to go to the next slide. Um and this report um is our first opportunity um of the new fiscal year um that started back on July 1st to see where um things are as it relates to the current year's budget. Um so we do this twice during the fiscal year where we um look at the budget, make revisions as new information has come to light since since June. Um so this is our first opportunity. So by December 15th, we have to um provide to the county our updated budget along with a certification as to whether or not we are positive, qualified or negative. We have another

125opportunity to do this again by March 15th for the second interim um before we uh get into the budget development process for the 2627 fiscal year. So we can go to the next slide, Teresa. Um state budget outlook. Um, you know, the we're at the time of the year where the state's starting the process of figuring out what the the January governor's budget proposal is going to look like. And one of the first pieces of information that comes out is the legislative analysts uh budget outlook um that came out in November. And so we have, you know, a good chunk of the year's um uh state taxes have have started to to roll in. Um and and if you've seen the headlines, um the state revenues are are up for the 25 26 year. Um

126but up more than those revenues are the projected state budget deficits for for next year and the year after. So the state headline is an 18 billion budget deficit for 2627 and a $ 35 billion uh budget deficit for the 2728 fiscal year. Um a lot of the money that the state is receiving this fiscal year is is one-time money. uh if you own stock in any AI companies um that's where all this capital gains um have have been coming that have have influenced the state's um tax receipts so far this year. And so the state is really looking at a lot of the positive revenue picture that we're seeing in the current fiscal year as one-time money. Um and so some of that will acrue to us in terms of some one-time um uh

127opportunities in the 2627 fiscal year, but that will be up to the governor in the legislature to figure out how that money uh will flow to districts in 2627. It won't change what we're seeing in 2526. uh the legislative analyst office recommended a lot of um kind of budget stabilization type expenditures looking at increasing the state's reserves um for education as well as doing um some getting rid of deferrals that the state was imposing on K12 education. So those are some of the proposals that are out there. Um they do project that the state will be able to fund a cola for the 2627 uh fiscal year of 2.51%. Um and that's number still yet to be determined based on statutory calculations. So go on to the next slide um which just deals with what

128are the various certifications. So um as I mentioned earlier district can be either certified as positive meaning that it believes it will meet its obligations for the current and um subsequent fiscal years two fiscal years. And by meet its obligations, meaning it will be able to pay all its bills and have an ending fund balance of at least the minimum reserve for economic uncertainty, which for our district is a 3% of expenditures reserve. Um, a qualified status means the district may not meet its obligations in the current or subsequent years. And a negative certification would mean that the district is identifying that it probably or will not meet its obligations in the current or subsequent years. Um, as the agenda item stated, uh, the district is recommend or the staff is recommending that we certify

129as qualified. Um, and we'll talk a little bit more about why we're making that recommendation tonight. So, um, some of the assumptions that go into, uh, to the budgets. Um, on the revenue side, it's it's our funded ADA. Um, that's not how many students in this particular year we have. Uh, we're funded based on an average of the three prior years worth of ADA. Um so that's a little bit of a buffer to the declining enrollment that we've seen. Um but you can see that we're funded at about 3196 um ADA this year. Um and that's expected to continue to decline over the two years subsequent two years to 3139 3140 the next year and then 3049 uh the following year. So declining enrollment um declining ADA so we get um fewer students means uh

130you know less dollars necessarily. And then cola, which is not the stuff you drink, it's the cost of living adjustment that the state provides. And that's not how much more we get um as a budget, it's how much more we get per kid, per student that's attending. So when you have declining enrollment and a COLA goes up, you may get flat funding, you may get negative funding because if you're declining enrollment is greater than the amount that the COLA is providing, um then it can kind of wash out or eat up the COLA percentage. So, if we had a 2% COLA, but a 2% decline in ADA, you basically would have flat funding. And I'm using kind of simple math there, but that's kind of the the thought process. So, COLA applies to the number

131of students, not to the district's overall funding. Um, on duplicated pupil percentage, this is the percentage of students who are foster youth, socioeconomically disadvantaged, or English learners. And for those students, we get additional grants above the base grant. And we can see that our percentage there is about 50% making us the second lowest um or third lowest um district in Orange County as it relates to unduplicated pupil percentage. Um only Fountain Valley and Huntington Beach City have a lower unduplicated pupil percentage. Um so we get supplemental grants which are a 20% increase for those students who who qualify for those. We don't get the concentration grants if we were over 55%. um we would get concentration grants which are a 65% bump on our our grant. So um those districts that are over 55% get

132substantially more funding uh than we do as a a supplemental grantonly district. Um STRS and PERS those are the district contribution rates. So um those are expected to remain roughly steady with a little bit of increase on the PERS contribution. So Stir state uh state teacher retirement system public employee retirement systems is for teachers. PERS is for classified employees and that's the amount the district contributes for every dollar that an employee who's eligible for those retirement systems earns. Um health benefits um what our assumptions are for growth over that period. So we're projecting out first interim a 12% growth because we know that's what our premiums are going up this year. Uh you'll notice at the time of adopted budget it equated to a 0% growth because the assumption was that we would have a

133decline in employees and and associated benefits that would get paid that would be offsetting any increases that we would have received in premiums. Um as we know that didn't materialize. So we're seeing a fairly substantial increase and we'll talk a little bit more about what that looks like now. And then step and column. So this is you know for every uh anniversary that an employee hits they hit certain marks of step and column increases for their compensation and so for certificated we assume that equates to about a 2 and a half% increase per year for classified as a group that represents about 2%. Um so when the when the calendar goes from June 30th to July 1st we have to make an assumption that it's the employee costs increase because of the cost of step

134and column that's years of service or employees um achieving additional um degrees and units that push them over on the salary column um on the certificated side. So um those increases happen automatically. Those aren't negotiated and that's something that we have to budget for. All right, we can go to the next slide. So, um, as of right now, our projection for revenue for the year is a total of $56 million. Um, you can see we've broken that out into the different funding sources. So, LCFF, that's the local control funding formula where the majority of our funding is from, federal revenue, which is mostly on the restricted side and is special ed and title one are the two biggest programs there. Um, you'll see the category of other state revenue. So, that's going to include state

135special education funds as well as any one-time grants and some other um Prop 28 funding um and ELOP funding. Those all fall under other state revenue. And then other local revenue um those can be donations, interest, earnings um any other local property uh local revenues that we may receive. Um unrestricted, those are dollars that can be spent on any legal purpose. restricted are limited in terms of either the time that they have to be spent or the particular use that they have to be spent on. So $43 million in unrestricted revenue and $13 million in restricted revenue. Um and you can see those how those will total up there. So go to the next slide. Um total expenditures for the year 57.5 million. So we already see that we have more expenditures than we have

136in revenue. Um we'll talk through that as we go through. Um but certificated salaries so teachers and certificated um administrator salaries um that includes other um SLPs, psychologists um that includes that's totals 21 a.5 million roughly for the year classified salaries um totals $10 million employee benefits at 16 a.5 books and supplies at 1.75 million and then services and other operating expenditures just a little over 7.5 million um for a total again of 57 million. you will see that there's um a category called transfers in um and that means funds that we're transferring into um our our um general fund from other funds. And so we're transferring in $866,000 in the budget as it exists right now um from a combination of fund 14 and fund 40. Um and so they show up as a

137negative expenditure because it's not really revenue. Um we can't recognize it as revenue on the previous slide because of accounting rules. So we have to recognize it as a transfer in um for our purposes here. So that just offsets our expenditure. So um in reality we're we're spending you know um what's the math on that? 58.3 million um roughly but because of the transfer in it reduces our expenditures to 57.5 million. Um and so that's um that negative expenditure there on the unrestricted side. Go to the next slide. And this just summarizes what our ending fund balance uh looks like. Um on the unrestricted side, we started the year with $1.9 million in beginning fund balance. We had the projected revenues of 43.1 million. Um projected expenditures of 34.5 million on the unrestricted side. And

138then contributions of 8.6 million from the unrestricted side to the restricted side. And that's primarily special education. and then the required contribution to our routine um restricted maintenance um account. Um that's a required 3% contribution that we have to make. Um leaving us with an ending fund balance on the unrestricted side of 1.8 million of which 55 million 55,000 sorry is an unspendable. It's uh revolving cash and uh prepaid expenses. So um our reserve for economic uncertainty uh is at 1.75 uh million dollars. And then beyond that, we have $20,000 above the minimum reserve in the unrestricted side. Um, and then on the restricted side, um, we start the year with just under $7 million, revenues of 12.9, expenditures of 22.9, yet the contribution from the unrestricted side, leaving us with an ending fund balance

139on the restricted side of the budget of 5.6 million. Um again the 3% reserve is required to be on the unrestricted side and it's 3% of expenditures in that given year. So on the next slide um what is it taking us to get to that 3% um because we're going to use some one-time monies um again this year in order to um ensure that we end the year at the 3% minimum reserve. So, um you'll recall that last year we used some of the arts, music, instructional materials discretionary block grant. Uh that was a one-time uh funding source that uh the district received in 22 23 time period. Um we used some of that last year to ensure that we met the minimum reserve and we proposed to reuse the remainder this year. Um it

140is a an a funding source that has to be used by September of 2026. So, we're going to use it no matter what. Um, but 862,000 of that is going to be used to ensure that we meet the minimum uh reserve. Uh, there is a new one-time funding source in the 2526 uh fiscal year. It's about $937,000 um which is the student uh student support and professional development discretionary block grant. So, they just get longer than names um that's how they uh figure this out. So, it's again, those are onetime funds and we're going to use $550,000 of that roughly $1 million in the current year in order to meet the minimum reserve. Uh there's about $116,000 in fund 14 that we're going to transfer into, as I said, the general fund to make the

141routine uh restricted maintenance uh payment. Um, in the past we've used redevelopment money that the district receives on the um on the restricted side of the the budget and we've transferred that into fund 40. So we used to take redevelopment money and put it into fund 40 for facilities. In this case, we're going to keep it in the general fund and use that to pay for the the routine restricted maintenance um obligation. Uh there's a one-time proposed allocation from the Cypress Education Foundation of $320,000. Um over the year there's been amounts that have been budgeted for distribution to the district that the district has not um taken um the full amount and so that is accumulated and the district would be um using all of that in the current year in order to meet its

142minimum reserves. And then we would do a one-time allocation from property rental income in this year um of $750,000. So that's money that would have gone into fund 40 um or is in fund 40 and is coming out of fund 40 that would have paid for facilities um but is instead being used to ensure we can meet the minimum reserve in the current fiscal year. So that totals about $3.1 million of one-time or special um pots of money that we're um accessing in order to meet the minimum reserve in the current year. All right, just doing a little bit of comparison of of where we adopted a budget in June um to where we are uh today on December 11th. Um I think it's still December 11th, right? Yeah, we're not that late. Um so

143in the revenue side um we have a comparison here. Adopted budget $54.9 million was the total revenue. Um the total revenue at first interim is $56 million. Uh there's two line items um for that. it. The LCFF is up about $275,000. Um, and that just has to do with the amount that we receive for uh TK students. Uh, we get an additional amount for TK students above the base grant. Um, and we had more TK students now than we thought in the budget. So, um, that produces that additional $274,000. And then the other state revenue is up by that $937,000. that is the uh student support and professional development discretionary block grant. So those are the two reasons why revenues are up by 1.1 million. Go to the next slide. This is expenditures. So at

144the time of budget adoption um we had expenditures of 55.5 million um and as of first interim we have um expenditures of 57.5 million. Um what we're seeing is that um certificated salaries um now that we know all the employees that we have um for the year um and those salaries are coming in at about $360,000 more than than expected at the time of budget adoption. Um classified salaries $175,000. Um employee benefits $1.6 million more than the budget um in June. um and services and other operating expenditures. Again, about 1.6 million. Uh you'll see here this captures the transfer in that wasn't budgeted for. So that's why um that's that's different. And then the transfer out that we're not doing is is also different. Um so while it looks like our expenditures are increasing by

1452 million, they're actually increasing by 4 million. Um because um the transfer out isn't happening and the transfer in is happening. So that $2 million is kind of um hidden, if you will, in plain sight. Um but it's really an increase of of $4 million in real expenditures um that are happening in the general fund this year. So just to dive a little bit more deeply into some of those line items, um health and welfare benefits make up the largest percent of increase of the health of the employee benefits um line items. So employee benefits are statutory benefits which are stirrers and PERS, social security, uh workers comp, uh Medicare, those types of statutoily determined benefits. And then health and welfare benefits. So health and welfare benefits was budgeted at $4.5 million for the year

146and at this point we're at $5.8 million. We've done a little bit of a change in practice as it relates to projecting health care benefits um for employees. um instead of using an average amount um per employee, we've gone through and we've pulled everybody's exact benefits that they are um receiving from the district for health and welfare. Um we've applied the increase that we're going to see starting January 1st. And so we think we have a little bit more of an accurate um forecast of employee benefits for the year um by looking at the actuals of what employees are are utilizing within their um plans. um utilities. Um you know, based on how we ended last year, based on how the current year is already starting, we think that's going to be about $600,000 more

147than budgeted in June. Um property and liability insurance. Um this is for, you know, any any sort of claims against the district. The cost of those policies um has increased. There's a a one-time assessment that the district has to pay related to um AB218 which expanded the time frame with which um folks could make claims for sexual assault molestation. Um and that has hit a number of districts, not ours. Um but we are in insurance pools with those districts. And so as those districts receive claims and as the insurance has to pay out those claims, um we all share in in that burden. um unfortunately even though we have not been one of those districts that has um had one of those claims. So that's um increasing our cost there. And then professional consulting services.

148Um this is anybody who's not an employee that's providing services to our district or our students. Um so some of the areas are the the costs of the SULPA are higher than what we're budgeted for both in direct services as well as contracted services that they um pass through to us. So, um, those four line items make about $3 million of of the increase that we, um, are seeing this year over what was budgeted. So, on the next slide, um, in terms of unrestricted ending fund balance, um, the adopted budget, obviously it started at a different starting point because that's where we thought we would end the year with 2.6 million. um with between the revenues, expenditures, and contribution, the expectation was that the district would have an ending unrestricted fund balance of 3.6 million.

149Um so roughly the 1.6 1.7 million of the um reserve for economic uncertainty and then almost $2 million of additional money beyond the minimum reserve. Um what we're seeing now is we started at 1.9. Um our revenues are up a little bit um based on that. uh the the conversation we've had our expenditures are higher um our contributions are higher and our expectation is the ending fund balance will be about 1.8 million um of which almost all of it is the minimum reserve for economic uncertainty and so the difference column just shows um our ending fund balance on the unrestricted side is about half or $1.8 $8 million less than we thought it would be at the time of budget adoption. And again, that is with using the $3 million um from that one slide

150in order to get to the $1.8 million ending fund balance. So, we're not supposed to just look at this year. Uh we have to look two years out and this is a requirement of the state law. So, we can go to the next slide. So, we have to look at the 2627 and 2728 fiscal years as well. Um and what we are making assumptions on for um is approximately 3.3 million in ongoing uh budget reductions uh starting in that year. Um so some of that is personnel due to declining enrollment. Uh we project we're going to have fewer students next year. Um so we will need fewer staff um based on ratios. So that that's part of that. Um we're looking at some reductions to services and um supply budgets. Um but there's going to

151need to be additional reductions in employee um personnel costs. Um because employee personnel costs make up 80% of of the district's budget. We're we're in the business of employing people to provide services to students. Um and unfortunately when there's less money to do that with um we have to find those reductions um within the employee um cost areas. And so um as Trusty Tanaka mentioned, we've we've done a survey of the budget advisory committee to look at various recommendations. We're still looking at the results and we'll be sharing that with the budget committee um in the coming days to weeks um of of how that survey is resulted. Um but we're we're taking our time reviewing various options and we'll be sharing those with the board uh in the coming meetings. Um it a little

152bit more on that one. Teresa, thank you. Um we're as I mentioned earlier, we're going to propose to use the remainder of the uh the new block grant that we received this year, the student support block grant of about $433,000 um roughly um in the 26 27 year. And then in 2728 uh we're assuming about 9 million 9 thou 9 900,000 start that over assuming 900,000 in reductions um in additional reductions in 2728 and again that's um staff due to uh declining enrollment and reductions in services um and you'll see how that changes the forecast going forward. So um looking at revenue um LCFF sources um slight increase next year based on the cola that we're projecting but that cola may not materialize. So you know that number may come down and probably will come

153down a little bit because um the cola that the you know we're supposed to assume is already is about a 3% cola. The the cola that folks are are estimating it to be is about 2.5. So, um that's going to come down a little bit in all likelihood um and stay relatively flat um over the next year. Um federal revenue we assume to be flat. Uh the state revenue comes down because the onetime money we received in 2526. We don't receive that again in 2627 or 2728. And then uh the other local revenue we expect to decline because of um the one-time nature of the additional um education foundation grant that we would be um accessing this year. So, um, you know, about $55 million in revenue in each of those two years. On the

154expenditure side, uh, you can see we we talk about $3 million in reductions for next year. And what you see is about $1 million in reductions. And that partially has to do with step and column. When you when you factor in a 2 and a.5% or a 2% increase in in salaries, um, that counteracts some of the reductions that that we're proposing. So, um, that's why, you know, $3 million in reductions doesn't translate necessarily directly to $3 million in total less expenditures next year, but you'll see from 57 and a half to about 56.4 million in expenditures. Um, and then that goes back up a little bit to 56.9. Um, we realize there's there's a lot of refinement that still needs to happen and that's part of the reason for a qualified status. Um, we

155know that there's work that needs to continue to happen and we're letting the county know we're we're doing the good work to make that happen and they're going to continue to support us through that process as well. So, on the unrestricted ending balances, we already talked about 2526 ending with about $20,000 above the minimum. Um we're projecting in 2627 based on the proposed reductions that we would make um to end the year at about 1.7 million um about $40,000 above the minimum. Still still cutting it pretty close there. Um but then in 2728 we still have to identify additional changes to the budget because we're currently showing um that we don't meet the minimum reserve in the third year out. So we're about $640,000 $645,000 shy of meeting the minimum reserve at this time in

1562728. Again, that's the third year out. We have time. We have lots of time to plan and figure the out the uh the the solutions to that. Um but that is part of the reason again for the qualified status because we don't meet the minimum reserve in the third year out. So next steps um after you ask me any questions you may have um just respectfully request that you approve the qualified status for the the first interim. Um you know one of the challenges we have is in the current year um our our ability to change what's happening is is limited. We we employees are here um and and we we have our obligations to those employees. But we are going to try to look at um any extra hours um requests that employees are

157are or rather supervisors are are asking for employees um at the cabinet level. Um, so we're going to look at that and we're also going to look at purchase orders and see if there's, you know, as a cabinet if we want to proceed with those purchase orders um over a certain threshold or if we want to push those back and suggest we might need to reduce those things on the on the general fund side. Um, we're going to continue to review recommendations for the budget next year and the following year. And then as Trusty Tanaka mentioned, we have our next um budget advisory committee on February 11th to review this. In the meantime, the governor um in his last year in office will provide his uh proposed budget in early January and that will give

158us a little bit more information and help us plan for 2627 and beyond. With that, I will be happy to take any questions. >> I have a >> thank you for I was going to say thank you for your report and I will now ask if there are any questions from the from the trustees. Uh trustee Nem. >> Yes. Thank you. Um I'm just wondering if any consideration is being given to any sort of golden handshake or anything like that. To my understanding, we're coming up on um teachers who were hired for the class size reduction, which is about 30 years and so potentially coming up on retirement. Is there any um financial impact that that that could offer the district? The the one challenge is we're still um making payments on our previous Golden

159Handshake or supplemental early retirement program. Um so that limits our financial resources if you will. Um I guess since theou has been signed I can say that we are doing an early tell incentive um for um employees that if they let us know that they are retiring um that there's a financial incentive um for them to tell us by December 31st. Um, may I also add to um last year we had PARS, which is the company that did the first um early retirement incentive. We asked them to do an assessment of our staff to see if it might be lucrative for the district to consider that. That was last year. And given the um ages and service years of our uh employees primarily are certificated because that's where the greatest savings comes um we weren't

160going to likely we everybody that would be potentially on the list would have to admit or would have to accept that offer in order for us to really see any savings. So at last year the recommendation was I don't think you're in a good position for it from PARS. That was their recommendation to staff. Um and and then as um Mr. Fchaw mentioned we're still paying off on the last one. But we did look at that last year and you know we can certainly um continue to keep uh that relationship open with PARS to have them do assessments. Um, but it it's dependent on a lot of factors and it may not actually yield the savings that we would um anticipate. >> Is that something that would cost us money to have them make a

161recommendation? >> I would have to go back and look. I don't think that we were charged for that assessment. Um, of course, we we do have a cost associated with the retirement incentive itself, >> right? But and we could also hold it to a certain number of employees. Correct. So if we if we found it um to be beneficial with you know 10 employees retiring or whatever we could hold that as well. >> You can you can set a number but usually like my experience with PARS in the few times that we've done this we only had one that we actually funded. There was uh much earlier we just um offered something but we didn't have sufficient participation so we didn't go through with it. Then another time we offered it and we did. And

162then last year we looked at just having the assessment and PARs recommended you don't it's not going to pencil out for you this year. Um but we do um we do incur the cost of the actual incentive itself. So we have to weigh all of that as well. And like Mr. Fawa, we're still paying off on the last one. >> Other questions from other board members? I think you have talked us to silence. >> Okay. >> Um I thank you very much for the detailed report and it's uh something definitely that we will be mulling over obviously with uh we'll be hearing more from you as time goes on and uh look for look for good strategies from you. Thank you. >> Thank you. We have a motion on the floor to approve the district's

163202526 first interim financial report and to certify this time a qualified financial status for the remainder of the fiscal year and two subsequent fiscal year. Uh is all in favor say I. >> I. >> All oppose same sign. Okay. It looks like we have approved the first interim report. Next on our agenda, my U. There we go. Consider increase to monthly board member compensation rate. Board bylaw 9250 states that each member of the board of trustees may receive the maximum monthly compensation as provided in ED code 35120. On October 11th, 2025, the governor signed Assembly Bill 1390 amending the educational code and increasing board member compensation limits for a school district with an average daily attendance between 1,000 and 10,000 students. The maximum compensation rate increased 400% from $240 to $1,200 per month per board

164member. At his November uh 13th board meeting, Trusty Sundi moved to increase Let me get this down. Um, the monthly compensation to the maximum allowable by ed code and trustees Hayashida seconded the motion. Following a lengthy discussion, the board voted to postpone the motion to the December 11th meeting following a presentation of the district's first interim financial report. We do have this particular motion on the floor. So, it is now open for discussion. I have something I would like to >> I don't think we >> moved it right. >> No, the motion was postponed from last meeting. Therefore, the motion is on the floor because it was moved and seconded, but we postponed it. >> Okay. So, the motion is on the floor. We're open for discussion. Uh Trustee um Nem. So, I have shared

165something with everybody sitting up here and I have a couple extra copies if anybody else is interested. I just wanted to give some information just kind of for consideration. Um I had asked the district if they could provide me with the salary of a a teacher in 1984. Um and the district was able to find a teacher who was hired in 1984 and that teacher earned um $20,000. It's unclear to me if that was um on a salary scale, on the low end, on the high end. So what I did was I looked at um 1984 $20,000 and today if a teacher was hired on step one column 1 that would be $58,833.84. So that's approximately 2.94 times the original salary in 1984. If we went on the higher end of the first um of

166first year, so year one but column four, that's $68,579.93. So that's approximately 3.43 times um $20,000. So somewhere between three and three and a half almost. Um when then I went and I looked at the inflation rate um and based on the information that I could find inflation from 1984 to 2025 is about 3.12 um and so that would give us about 62,000 or so. So then what I did was I looked at um the board member compensation. So in 1984 it was approved for $240. If we had the same increase over time as the step one column one teacher that would be approximately $7560. And then on the high end the step one column 4 um increase that would be $82320. When I looked at the inflation rate, sorry, I do have a column

167in there. The average of those two. So, the average of the highest and the lowest is about $760.40. And then if I did it with the inflation rate, um, it's about $748.80. So, um, I just wanted to give that as context because I do hear that the that's a huge jump from 240 to 1,200. Um, somebody referenced earlier it was a 400%. I don't know the exact math on that. Um, but when I do look at what the what a teacher made in 84 compared to now, it's somewhere in the, you know, three times more or whatever. Um, somewhere in there. So, we're looking anywhere between about $700 and $800 if we had the same increase as teachers and staff had over time. So, I just wanted to put that out there as a thought

168um and maybe have some discussion around that as well. Okay. Thank you. Any other comments andor uh conversation around uh this particular motion that was put on the floor last meeting? >> Trusty Dashita, did you have some comments? Um, I guess really it's I appreciate what you did here, Jamie. Um, and so thank you very much. Um, and I know in here it says that um, it was uh, the motion was to approve the in the full uh, maximum amount and I think that there was discussion at that time to consider not necessarily the maximum and and so um, and I know all of you are here today because you're um, not in favor of the increase. And so I guess um and then after hearing what um Mr. Kershaw has to say and the

169the the impending budget um woes, if you will. Um it probably makes sense to pull the item if that's the right term um for now but would like to bring it back at another time. Um so could I make a >> just for parliamentary procedure you have a motion on the floor. So I think unless the unless someone would do an amended motion. >> Could I make an amended motion or do we need to take a vote before I do that? >> Well, one of the things that you can do and and um no, don't ask her. Um, you know, since I was the maker of the motion and um, Trusty Hayashida was the seconding person on this motion, if we had a friendly amendment to that motion, it could be an amendment to the

170original motion as a friendly rewriting of that particular motion. So, we wouldn't have to vote this one down and go to a new motion. We could just we could just tailor an alternative or something else if you wanted to. >> So, >> or we I'm sorry. >> Go ahead. My microphone wasn't on. I apologize. So, the revised motion that I was going to try is if we can postpone the discussion to consider the increase of the monthly board member compensation rate until the district is able to provide a cola increase to our certificate in classified staff. If I think you know if we could do that make we get agreement to something to that nature. I would agree to that >> or second that. >> Well, I mean, again, you know, again, the point is

171we have a motion on the floor. So, you know, unless we actually vote this one down, that doesn't sound, you know, that that's not an amendment. Okay. >> That is actually a new motion. >> Okay. >> So, I think that we would have to vote this down and um re uh re make a new motion. >> Okay. But let's ask let let's find out if there additional um conversation around this current motion or the actual action today so that everybody has a voice and has an opportunity to say what they might want to say. Did you have any com any additional comments with regard to um Trusty Periq? >> I mean I mean I I I don't have any additional comments. I I do um you know your point is well taken. Um just in

172terms of the seemingly dire sort of financial report that was that was presented today. Um I I do think this chart is is really helpful um to sort of determine um and and well to explain how um an increase is is very much warranted because it hasn't happened since um I think this is public knowledge by now but the year I was born um So I I mean, you know, valid points, but um I I I think I will I will support um the the majority. >> So I do have a couple things as well and thank you so much to the district for providing this information. Sorry, I'll get closer to the microphone. So, what I did ask is what is some of the other um districts providing for as compensation to their board

173members? And Buen Park is $272. They're not sure if they're going to agendaize this for discussion. Uh Irvine's $439 and they will likely agendaize for consideration. Uh Fullerton is 400 and they will likely agendaize for consideration. and uh orange is 400 which will likely agendaize for consideration. I also went in and started looking through transparent California because trying to see you know and I don't know how accurate the website is but I was able to pull up 2023 information for board members and Anaheim Elementary shows 468. Um Magnolia Elementary showed 464. Uh Los Alamidos was 352. Fullerton was um 420. Anaheim Union is,026. Um Savannah was 240 as well as Centriia was 365. So you Cypress is on the lower end, but um I'd like to still stick with the revised motion to postpone that.

174>> Okay. The um the the the point is is is that at the time that if you wanted to um to when you postpone a a current motion, >> okay, >> you postpone the motion as it was made, not the not a new motion for consideration. >> Okay. >> So, I think that the >> let's take a vote then >> for us to take a vote on this particular motion. I think that I think that all the arguments that I brought tonight and I think that one of the things that I would like to say is is that I'm pro I'm I'm I'm the oldest member on the school board number one. I'm the longest serving member on the school board. And the possibility that I will consider rerunning uh multiple more times would suggest

175that if I am advocating for my fellow board members for an increase in their compensation that I likely wouldn't be one of the persons who would benefit greatly from an increased um um stipened or um compensation. Um, so that said, one of the things that I think is important for us to keep in mind is is that quite honestly, um, we have we have moved beyond truly being a volunteer, um, to our community. We're being asked to keep current with a lot of different kinds of things. We receive two different magazines from our state um, CSBA. And if you are like me, I read everything that I get. I subscribe to a variety of educational uh forums so that I can keep on top of what the issues are across the state. And therefore, I

176feel like I'm more informed. This takes time. It takes time to prepare for these board meetings, to read the materials, to do all these kinds of things. and I have volunteered that time um freely across the years. What I'm looking at is is that we may have um also limited the opportunity for uh some very good people in our community who because of um uh a very, you know, very diverse uh reasons, maybe um not uh maybe it's a a younger person who perhaps isn't the top of their uh their income earning level. um they can't necessarily um uh volunteered at the same level in terms of attendance of various kinds of meetings um you know taking off from their job and losing pay if you will. Um I think that we are moving towards

177the need for a more professional body here and no matter how we look at it increased compensation for us to the maximum is not going to is not going to make us wealthy and it's not even going to be a living wage. We're not working full-time. You're right. And um but I do think that there is time uh that is invested in preparing for school board meetings and uh being in the community and having a face in the community so that the community members can meet with us uh communicate with us their concerns and their ideas and uh let us know what we're doing right and let us also know the things that we're not doing so well. Um, I think that um um just from the time commitment uh valuing your school board members

178uh through a better compensation package will potentially um increase the pool of good candidates who might come forward to run in the future. If I was thinking about working full-time and maybe uh struggling to make ends meet, I don't know that I would volunteer for a $240 a month extra volunteer job even if I was invested in the educational process. Um I I I I do believe that that that thought out there is still there that um this is a volunteer job. We didn't do it for the money. And that is true. We don't do it for the money. But on the other hand, uh, for every board member who feels like they maybe need that extra few bucks or whatever it might be, there is a board member who could donate their money back

179to the district. If they didn't think that they needed the money because they wanted to be a volunteer, they could donate their money back to the district. Didn't have to accept it. Whether you like him or not, the president doesn't accept his salary. He gives it back in some form or fashion to somebody, uh, some group or whatever. Um, we all do things for a variety of reasons, but I think the most important one is that we're being asked to do more as a board. And I would like to see our board members being held more accountable and also uh more accountable from the standpoint of what our responsibilities are in terms of doing the work that needs to be done. And I would like to make sure that we have candidates who come onto

180the board or people who come onto the board who don't call their work in. In other words, don't come to the dis and basically pretend that you've read the whole agenda. I'm not saying that we do that. But I'm saying, you know, we want to make sure we have good candidates up here. And um I'm going to leave it at that and uh we'll call for the vote on this. >> One more thing. Okay. Sure. >> Thank you, Trusty Sunday, because I do appreciate starting to explain a lot of the things that goes on as a good trustee, right? And I do, but you know, I'm different. I'm extremely blessed to be able to be retired, right? Be able to give back to the community, right? And over the past three years, I have attended

181more district events, school visits, community events, uh, individual school activities, workshops, than any other board member. I am blessed to be able to do that, right? You know, being retired allows me to be able to do that. And you know, the public needs to understand that the board members to be an effective board member requires a lot of these different things that you know, the trustees are doing. And as trustee Sundi says, it it means a lot to take this board member thing. It's horrible when we have, let's say, somebody that doesn't come to do their homework on the agendas fully show up to some of the meetings prepared because we that's the what we signed up for, right? And you know, we have 13 board meetings um that take we have to prepare for

182it takes a lot of time to many hours to be able to do that. We have eight district-wide events, four community events working with the city of Cypress, four CSBA weekend and afterhour workshops, right? Two OC uh CSBA county events, four, you know, four budget meetings with five a Anaheim Union events, 16 various school visi events that I've went to, you know, 14 school visits actually I went to. But like I said, I've done more and I would go to more school visits if I was provided that opportunity, but that's where, you know, these are the things that a to me an effective school board member should be able to do. So, I think we should call for a vote. >> Okay. I don't want to obviously cut anybody off who made the comments they

183wanted to. Okay. So, I appreciate what my fellow trustees have said and we know you're most of you are here tonight because you're hoping that we would pull it or say no and and that is troublesome to us. Um, we appreciate you. We're here to fight and work for you and we do put in a lot of hours. I'm not retired. I still work. They still work. Um, and so just we would like you to keep that in mind. We're not your enemy. We're here to do the work. And I think you've seen today um there have been a lot of um things that are coming to fruition as far as what we're trying to move and forward to find more money and to work hard so that um we can, you know, find the

184money to I guess inverse the budget deficit kind of thing. So, just keep us in mind. You know, we're well, again, we're not your enemy and we are here trying to do the best that we can for you. Thank you. >> Okay. Then the motion on the floor uh to go ahead and to um re uh restate it. At the November 13th meeting, the motion was made. um to uh increase the board member monthly compensation to the maximum allowable by education code. All in favor say I. All in favor all oppose say nay. >> Nay nay. >> The motion has um has failed. Um, and I noticed that note that uh several have offered alternative motions. Uh, if there would be someone who would like to address that at this moment. >> Yes, I'd like

185to make a revised motion um to post is it does post one or is it a future >> to uh to Yeah, I I think you can say that at such time as that the district is able to provide a cola. >> Okay. I'd make revised motion. No, >> not a revised motion, just a new motion. >> I'd make a motion to consider the increase to the monthly board member compensation uh when the district is able to provide a cola increase to our certificate and classified staff. >> Okay. Is there a second to >> I'll second that. >> Okay. It's been moved and by uh Trusty Tanaka and uh seconded by Trusty Hayashida to um move the consideration of a um increase. You want to repeat that? I'm not trying to say that I forgot

186exactly what you said. >> I am sorry. >> Basically wait until such time as we are able to. I wanted to ask whether or not GB uh would would approve a friendly amendment to suggest that this come up at for consideration at the same time as we would be considering um contract renewals. >> Yeah, that would be perfect. >> Okay. So, we will be foregoing um the motion is to forego uh consideration of an increase until such time as the district is able to offer certificated and classified staff a uh cola um in their contra in their contract. Um >> um we So just to clarify um you would want that brought back when um there would be a recommendation to the board to increase the salary schedule for staff. >> Yes. Yes. Okay. >>

187Okay. So is there any further discussion on that hearing? None. All in favor say I. >> I. >> All oppose. Same sign. Okay. We have a new motion carried. Um, item number 13, information discussion. Uh, 13.1, gifted and talented education. I don't know why I've got this on my screen. It's frozen. There we go. There was a uh desire by the board to bring forward a conversation about the gifted and talented education program here at Cyprus and uh staff provided a brief report saying and suggesting that prior to implementation of the local control funding formula, the state provided categorical funding for gifted and talented education and that these funds supported the purchase of assessment instruments. supplemental materials, enrichment activities, professional development, teacher stipens, and other related needs. When LCFF was introduced in 20134, most categorical

188programs including GATE were eliminated as separate funding sources. And so um while um we have had a um Kman Anderson test uh to screen for GATE um the consideration is that it is outdated at this particular time and that since 2020 teachers have had access to uh more comprehensive and reliable measures of student performance through the star assessment in which they were able to in which four times across the year they're able to create d uh to collect data points points um to provide information about student learning in reading and math. And what this has done is um uh making the testing uh that was previously uh funded by a program uh redundant and um we don't have a recurring cost for a gate screener. The suggestion is that um what we might want to

189do um what what the what the questions that the board may have uh I will open it up for discussion at this particular time. >> I don't know where this originated but um is there someone >> originated with trustee pray sending an email to superintendent on the 13th of November and copying myself as board president be able to put this on the agenda. So, Trusty Break, would you like to start? >> Yeah, I um received a few um messages from parents in our district about why the program was eliminated and I I didn't have any any answers for them. Um I'm not sure if there was a replacement that was considered. I'm not sure what my kids weren't old enough at this time um to actually be even tested for this. My personal experience actually

190was very different because my my son's teacher had indicated that he's in third grade. So that would be the year that he would be tested for the program. Um and then a few months in we received um all the parents received an email saying the district was no longer participating. So I just have very generic questions about what was the program? Um what is my son missing out on by not participating in it? Do other school districts do this? Thank you for all the information that you did provide um about about the program, but I'm just I'm curious, I guess, to to find out why it was eliminated and what the thought process was behind it. >> I just want to clarify the gate program was not cancelled. What was um what's different now moving

191forward is that we're not using the Coleman Anderson to do gate testing. that instrument um dates back to I think it's like 1982 um and it's no longer valid. Um educational assessment instruments are typically reormed every 3 to 5 years. So it's really an invalid instrument. Um but nonetheless, we've continued to use it and it's really at the point where it's not yielding any new information for us. It's it's just a screener. doesn't inform instruction. We have the star assessments which do indicate how students are performing and enable um staff teachers to look at um how they need to differentiate instruction for all learners, our students that need intervention, our students that need extra challenge. So the idea behind rather than invest in a new instrument would just be to continue to use our star

192assessments um our gate program has been differentiated instruction in the regular classroom for quite some time now. Granted I've only been in the district 11 years um so I'm going to defer a little bit to Tandy Taylor. although Tandy hasn't been in the district much longer than I have, but she actually was a student here. And Tracy has been working in the district since the 1990s and was a learning specialist. So, I'm going to allow them to talk a little bit about the history of what gate instruction looked like in Cypress School District. So, um, as as um, Superintendent Silv said, um, I I was a student in this district, so I can speak to the what was actually called the MGM program back in my day. Um, which, um, was packets and we were

193just moved into another classroom in which we did kind of worksheet packets and such. Um, and so there there wasn't much other than that other than it was just higher and it was just for a brief moment of time. Um, it was not every day. It wasn't. It was just for a little bit of enrichment at that point of time. Um, going back all the way through kind of history of gate education, one of the things to kind of keep in mind the gate originally identification which when it was put in place was to help to identify potential students that could achieve academically. We have other means to be able to do that. This does not identify what we qualify as highly gifted students. um that is a different kind of assessment and which would

194actually um a cognitive test to determine the um 99th percentile if you were performing at that level. So the the original gate identific identification is solely for the purpose of potential academic um achievement. And so in the 90s, basically what they determined and identified through research and such as that embedded instruction to be able to meet a student's potential and differentiate throughout the day was a much more effective way to educate students than in a pull out program. And I'm going to ask Miss um Mo Lawrence who was a learning specialist kind of that came in um in the cyber school district to share what had happened during that point of time. >> Hi. So um in the 80s when my children were at vessels they it was a pullout program and it was once

195a week after school and it kind of morphed from the 80s into the 90s when I got my masters in instruction and curriculum and I was an adjunct professor at Concordia University and the most important thing that that they talked about in the 90s was that that's not a good gate program when a child is gifted and talented. You want it to be 247. You want it in the classroom. you want differentiation. So, um, Superintendent Silavs mentioned in the 90s and it it's exactly what was happening because I was a professor at Concordia. We were talking about differentiation, how important to differentiate for all students in the classroom all day long. That a pull out program one time a week is not going to help. So the gate program from the '9s until now has

196been differentiation and teaching the teachers how to work with students of all needs and not have a specific program as you said because gate students need to be differentiated in the classroom. Students with needs need to be differentiated in the classroom. Now the Coleman Anderson is ancient. It was from 1982 and it really doesn't measure. But what we have now does measure. So we haven't stopped a gate program. We are absolutely um educating our students the way they should be educated. >> Uh another thing to understand um most um districts across um state of California, I can speak to the nation um when that changed, they adjusted their board policies if they served secondary students to eliminate any kind of gate identification as a source to be able to access honors AP. And I can

197speak to our local area. Even with Oxford, those that apply there, they do not take that gate consideration. They look at report cards. They do their own assessment. They check into that assessment as well as teacher referral. And that is also for the honors >> and sometimes written work. I mean, they do an essay. So it it our our staff we've been working very diligently on when we um back it was first RTI we went into MTSS but we've worked very diligently on um small group instruction and um having dynamic groups to be able to meet the needs of students based at where they're at and if they need extra help they get the extra help. If they're able to um um learn deeper and more then teachers are able to differentiate and provide that.

198So, we're actually um able to serve all students based off of where they're at at the point of time that they need it. >> And then um as a followup, Trustee Tanaka had several questions. And so we staff worked together to pull some information to answer those questions. And one of Trusty Tanaka's questions um was about you know um what resources would be required you know to to run I guess a different gate program because our gate program is differentiation uh in the regular classroom but um so we did provide just a breakdown of some of the minimum costs. So if we were going to purchase a new instrument and you know do the necessary training and then um get some sort of certification for GATE although historically that's been university units but Orange County

199Department of Education uh has a program that they would you know um give a certificate of completion for. So, we did some rough estimates um and checked around and it looks like over a three-year period, the first year the cost would be somewhere around $75,000. Uh year two it would be another $25,000 or so and then probably about $24,000 ongoing program costs. So, um there would be um some investment uh if there was interest to move in that direction. And then Trusty Tanaka also asked a little bit about how many students um are currently identified as gay in the district. And so in fourth grade of the 426 students we have 32 were identified on the Coleman Anderson. Um out of 460 fifth graders 51 out of 700 excuse me 479 sixth graders 36 were

200identified. So districtwide about 8% 119 students out of uh 1365 that of upper grade students that would have been assessed. So just a little bit of additional data >> just just for clarification. You're saying you don't use that uh Kman um testing um process anymore, but you're telling us current data is showing these are the numbers using that screening. >> We used it up until this year. >> Okay. That helps clarify what Okay. I have um a couple distinctions that I would like to make. Um I feel like we're talking about two different things. Gate versus highly gifted or academically gifted. So in in my experience and I teach at a gate magnet, there's there's two different conversations we could be having. And I feel like we're having a conversation around um high achieving and

201not necessarily gate because gate isn't necessarily high achieving. those are not the same thing. Um and so I just I would like to clarify that. Um >> what is the difference? >> So you can be gifted in certain areas but not necessarily be um superior academically. Um you could also be twice exceptional meaning you have a learning difficulty but also have a strength a gate strength in some area. So you can you can be gate identified based on um whatever identification measures. You can be gate identified and not be high achieving. Um you know in my experience your typical gate kid is kind of the disorganized you know it's it's not the the kid that stands out as the completely academic put together kiddo. Um so I think that's an important distinction and I also

202have a question and I don't know if this is conversation to have with the teachers maybe but you know is the star data giving us information on gate and high achieving because star not being standards aligned is that information that's useful um I don't know if that's like a conversation for maybe ACT to have but is that something that we're >> just clarify we don't use the our test for GATE. It's just to help indicate a performance level >> with different >> for differentiation. Correct. But not for GATE. So I I want to distinguish that that is not used for gate identification. It's just to identify how students are performing on those assessments for differentiation. >> So going forward, if you've just stopped using the Coleman Anderson test for GATE, but then in the write

203up it references STAR, how are you going to determine who would be in gate. >> So we're not putting a label on a kid. I guess that's the bottom line is with the star we determine who is performing at very high levels, who is performing at average levels, who's performing below level, and teachers differentiate instruction based on those student needs. We're not using a test, particularly the Coleman Anderson anymore, because it's completely outdated. But we're not proposing to purchase a new test so we can put a label on a student because in the end, at the end of the day, the label doesn't change the educational program that the child's going to receive. But I also wonder if that is driving students to surrounding districts who have gay identification process. I I think that the

204um the distinction is not clear to parents. I know that, you know, there's a lot of parents who want that distinction and I wonder if not having that is >> Tracy, have we lost any students due to this issue because they have to ask for an interd district transfer? >> No, we haven't. >> I mean, I I think that's kind of a facitious point to make to say, have we lost any students because I mean I have received several messages from several parents who are very concerned that we're not doing this anymore. The feedback essentially was that starting some at some point during COVID um the gate program sort of fell off and it was never picked back up. Um I I know for a fact that um and also maybe I'm just confused about

205this but it it says in the responses that we got the star testing is being used in lie of this Khman testing but on the other hand you're insisting the gay program wasn't cancelled. So what was instituted? What are we? >> So our approach to our historical approach in the district to gifted uh the services provided to a student who has a gifted label has been differentiating instruction in the regular classroom. That's what it's been except for maybe some pullouts or packets that happened in the '9s. So rather than continue to use the Coleman Anderson, which doesn't really provide any relevant data, we would need to purchase a new one if we were going to continue to use uh if we were going to continue to label kids with GATE. But the STAR is a

206instrument that is used to determine performance levels of students and to determine differentiation. The Coleman Anderson just puts a label on a student. It doesn't tell you how to teach that student if that makes sense. >> But the star test which is not standardsbased is what we're using to >> the star is related to standards because it does give you it it provides a lot of measurements for us. One of them is it's a predictor for how students will do on star and excuse me how students will do on CASP. CASP is the state test for state standards. So it is aligned to state standards. Okay, I first off, you know, thank you to the district because everybody all the questions I had to put together and I asked, you know, got all that information.

207So, and I know and that took a lot of time to get that information back. So, thank you for you and your team to be able to provide that. Uh but you know the former gate program and the identification process for the gate students in reviewing this program I the um with I've spoken to many teachers right inside and outside of our district okay that have gate programs okay as well as several students that have been identified as gate kids you know how is their education being different from this you know that it's different because you know they've been identified as gay kids and as we consider this topic I believe it's important that we ground our decisions in our mission statement. Our mission statement says every student right every moment and every opportunity you

208know our gifted and talented students you know need to be challenged. They need to be supported and left uh not left to the wayside and or placed in a position where the parents have to seek outside resources to meet their academic needs. You know, providing a program for academically gift and talented if we need to include the um what Jamie mentioned or trusty need about the academically accelerated kit um in there as well. All it these benefit all learners because it gives let's say you don't test in the gate. It gives kids the ability to continue to say hey I want to test back in here. What else could I do to be able to be labeled as this? I understand you know the next level whether it's middle school or high school does not

209use the gift notification but they have a different status. They have honors classes. Okay. They have AP classes. all this goes together and it's just because one doesn't use it doesn't mean that we need to give it up for the other set of kids. So, you know, that's just my thoughts on my opinion. But, you know, I understand, you know, when I spoke to the previous GATE instructor that from Morris, she's no longer with the district, right? But she had that GATE certification, right? And that's one thing that consider you know that I see you know my thing is do we not have this because the message that I was told was the administration said there was not enough students for this and that's why a lot of it didn't continue on there was not

210enough students they were split between multiple teachers that's why this didn't happen you know so if we look at this why you know and I understand 32 kids out of 426. But we did this. You We took the test. We sent the parents these email messages and a letter to their house. Their kid was in the gate program. We didn't do anything. We should have if we stopped doing this testing, we should have stopped sending those letters to the parents because it really confuses the community because just like Trusty Pri said, I got a lot of questions. I couldn't answer this. Right? So, you know, if you look at it, 32 out of 426, you're less than 10%. But, you know, where are those 32 kids? Are they all at Landell? I know they're not

211because there's some at Morris, right? So, is it make sense? Can we put this together? Put together a program like the Bridges program. Have the kids come together? Where are these kids located? Right? If we still have 119 out of the 1300 kids, that's still 119 kids were not taken care of. I think, you know, I'd like to at least look at this. If we look at this as well as it says the first year is $75,000. $75,000. If we move it together instead, then we don't need a teacher at every school. If we have such little kids, let's put together a bridges type program for those advanced learners, at least look at some type of workshop to have some of those discussions, you know, and this is the letter that, you know, one of

212the neighbors stopped me and she gave me this letter. It says, "As a parent of two gate students, as someone who has uh seen firsthand the difference that even a minim minimally supported gate program such that Morris Elementary has can make a uh make in a child's academic engagement, confidence, and overall school experience. I highly recommend the program. I understand that the district is considering removing the gay pan program which we know that is that is not the case and I would strongly urge you to reconsider. While the current gate program may not be robust as it could be, it still serves as an important purpose provides academically advanced students with something meaningful to work towards a sense of belonging and a structure that recognizes their lingering needs. Without this program, these students are often

213require as much support as any other special population. Risk being overlooked. Eliminating gate will not uh create equity. Rather, it removes one of the few existing avenues for differentiating instruction for students who learn faster, think differently, or need different deeper challenge. These students may not always vocalize their needs. Yet they are no less deserving of academic support. When their support goes unmet, they disengage, underperform, or become invisible in the classroom. In the current uh concern is the program needs improvement. I would encourage the district to consider strengthening gate rather than removing it. Currently, no special provision is provided to these gate students and requires minimum addition resources from the school. I have seen this first enhancements such as better teaching teacher training, more consistent enrichment options or clearer communications with families would make a significant

214difference. But eliminating the program entirely would send an unfortunate message that excellence, curiosity, and advancility are somehow less worthy of support. Gates students are not asking for privilege. They are asking for appropriate challenge. The goal should be to ensure that every learner, whether struggling, advanced, or average, have the opportunity to grow. Removing the gate program removes us from the opposite direction. In speaking respectfully, the board keep the gate program in place and instead explore opportunities to improve it. Our children, their futures deserve nothing less. You know, this came from when three parents reached out to me. Only one got me a letter. So, I wanted to at least read that. You know, I think, you know, in my opinion, I think it deserves further discussion and between the board. >> One of the things that

215I would like to ask you is uh as we've had this discussion today and it sounds like there is um it's there there are two or three things going on. some clarity of definition of terms and what is actually being provided what I keep hearing is differentiation of education and um as someone who doesn't have a child within the school district at this point it's a question of well what does that differentiation look like? What would the differentiation for the average student look like versus someone who is a um high achiever andor is working uh well past their uh class um their their their their class placement. Let's say for instance a third grader doing fifth grade or sixth grade math. um what type of differentiated education are they fed into uh to be able

216to um continue to explore their uh their interest and their avidness if you will for other outside kinds of things. I don't know what that looks like. I mean I hear the concept of differentiated education and I understand in a general sense what that means. It means that in my mind that a student gets what they need and if we actually have those resources in place, but I don't see any place where it says do we do an actual assessment of the student body to determine whether or not they're getting what they what they need. We're saying that we're giving it to them and we're perhaps seeing it in the testing process that they're doing they're doing fine, but is that reaching their potential? We don't know and I don't know how we're reaching uh

217how we're how we're making that assessment. So, I do think that there needs to be continued conversation and it sounds like we do have uh some energy behind this. I would like to see um I would like to see um a joint um um parent um teacher board um you know committee look at some of this kind of um um uh concern and energy and uh questioning around how do we meet uh the needs of our most gifted and talented students where whether they happen to be as you were indicating that They may not necessarily be gifted in the academic areas, but they may be gifted in other other ways. How are we meeting those needs? Particularly, as you say, we have a mission statement that indicates that we're trying to meet the needs of

218all students all the time. Um, you know, I mean, we give it lip service, but you know, how do we assess that we're actually doing that? And that's not not not taking away from what the teachers are doing. Uh, I know that you're doing the job that you're supposed to be doing. And so the question the question is is how do we have that conversation about what it is that you do so that we have a better understanding of what it looks like for the students and for you as the deliverers of andor the moving students in different directions. Um I think that conversation definitely needs to be had. So, I don't know what that looks like, whether it's part of our workshop for our spring when we're working with our um our our different

219um um our different um groups or whether it's an entirely different uh different type of meeting or um uh conversation. But I do think we definitely need to carry this on uh further discussion. No. Do do we have any other do we have any other specific >> uh comments or conversation around this topic or do we want to let staff come back to it with a recommendation of how we might be able to continue this conversation? Yeah, this is one of the question that you know >> really I'd like to focus on is >> with the cancellation of gay program we know it hasn't been cancelled right what programs or initiatives have been put in place to support gifted students okay many surrounding K through sixes still offer gay programs what is the district's plan

220moving forward it says the district didn't cancel its gate program we understand that teachers continue to differentiate instruction to meet student needs including advanced learners at this time the district does not have any immediate plan nor funding to support a plan to develop additional programming for advanced learners that to me the advanced learners are being put aside. >> Well, let me just ask you something. These are answers that staff have provided with you for you, right? >> No, it went to everybody. I asked the question. >> I provided it to all board members. Mr. uh Trusty Tanaka asked the questions. I provided the answers to all board members. I just wanted >> Where where was this information provided? >> It was emailed to you. Yeah. >> emailed >> This last week. Yes. Okay. Pardon me.

221I've just gotten back. I haven't read all my emails. >> Yeah. So, tr I mean, Super Nintendo asked trusty Periq and myself to put together these qu whatever we wanted to talk. We had the right information. I didn't see anything come from Trusty Periq. So, I went researched this, talked to a lot of teachers, like I said, inside out, talk to kids. what you know I needed to make sure that we're not going to waste everybody's time right that we had the the board had all this information that we needed so that's where you know I like I said I appreciate I gave a list of questions and the district did provide all this so thank you >> okay I think >> can I make one one more point it's not a question so much

222it's um my my personal experience >> with the way that this was communicated is I got a completely different um perspective about the the gate program at the beginning of the school year from my son's teacher who I I love and respect very much and my presumption is he was as blindsided by that email as all the parents were because we talked about it so many times at the beginning of the school year. So, I'm trying to understand the disconnect in the district deciding to not use that screener anymore and teachers continually talking about that at the beginning of the school year to the point where they weren't even aware that the screener was was being taken away. And one of the reasons I I didn't really have any questions is because the whole thing

223is a big question mark to me. I I don't understand what the program was. I don't understand what the program is. I don't understand if the screener was being used. Were the kids being pulled out? Well, I I don't know if this information was just not provided to me or maybe I just didn't go to that meeting or whatever, but as a parent, I I was very confused about what exactly was going on. And the the the email that was sent out very much made it seem like the program was canceled. So, every single message I received about this was, "Why is the program being canled? What if my kids already in the program?" And I suspect like the teachers felt I was in a position of of having absolutely no answers because the board

224wasn't advised that that was going to happen. >> Best the best advice to parents that have questions would be to contact their school to talk to the principal. >> I mean that's the advice I had to give myself. Right. So yeah, >> but if enough parents have a question, should we not and if they think that Gate is canceled and Gate hasn't been cancelled, could another uh a follow-up letter restating it so that it's more has better clarification for them? I think we're going to need to regroup because we have a little I think there's a um evidently some parents have spoken to board members and I would really encourage board members to as our protocols indicate to turn those folks back to the school site because in talking with our principles no one has

225been contacted by a parent and ed services has gotten two calls. So either they're not talking to us, the people that have the information can and can do the explaining um or or there I don't know what the difference is but but I would just highly recommend that board members direct parents with specific questions about the gate program or really any other uh detail who that need detail about our educational program to speak with e start with their principal and then if they don't get the answers that they need that they can contact the district. Um we have protocols because um that's really where they're going to get the information that they need. And then additionally, uh staff needs to be aware of what some of those concerns are so that we can address them.

226Us not being a part of that conversation isn't helpful. >> I understand. And that is my broken record speech. I tell them there's that question section on the website. Go there. Go to the district. Send an email. Go to principal. Right. But I can lead the people that answer the questions. I can't make them drink, right? I hate to say I'd love to be able to do that, but you know, when that's why when somebody handed me this letter, I wanted to at least be able to read it. I would have hoped that they sent a follow-up copy to this, but I guess they don't. >> Okay. Well, we do have some clarification, at least some clarification for the board members at this particular time. And if there continue to be additional questions about this

227program um or the idea of how we deal with our uh gifted and talented students uh short of calling it gate um I think that we need to go ahead and um bring those forward to the superintendent uh and determine whether or not there is a body of questions that we still have that we want to have further identification andor um uh workshop workshop stop it. So, I know that was one of the things that we talked about in February that uh we felt like with a newer board that there might be several things that we need to workshop and this might be one of those items. In the interest of time and I think this is the longest time that I've seen us have a board meeting and I hate to have been on

228it been on my first night's watch. Um I think that I would like us to go forward to 13.2 uh which is the Williams settlement legislation monitoring report for Clara J. King Elementary School. And if you are Oh, there we go. >> Yes, you got two items. >> Yes, I I have it on my other piece. Okay. But thank you. Uh so I would like to um I I don't have the uh staff report on this particular item. Uh so because >> yes, the system is crashing on us right now while while we're while we're trying to continue. I think that maybe there's a time limit. Maybe it turns off at 10 >> here. Right here. >> Oh, no. I've got what I need. I've got the I've got the listing, but I don't have

229anything I don't have anything to read uh that was on the uh gamut. So, um the item is uh William settlement legislation monitoring report for Clara J. King Elementary School. And so, um if you all read your um agenda and looked at the staff report, I will now say the floor is now open for questions and discussion. But I could ask or defer to um uh Superintendent Slavs to just do a brief overview of what that item was about and uh why we're seeing it here. I'll do my best from memory since I don't have those same uh materials in front of me. So um the state has a system of doing some actual monitoring of Williams. you know, we have to report any complaints that we receive and we've proudly brought to the board

230that we don't have any complaints around the Williams settlement, which primarily focuses on um instructional and material sufficiency, uh teachers being properly credentialed, and the safety of school facilities. So, um, but nonetheless, the state, uh, in addition to having districts report those, um, complaints to the board, they also do some monitoring and they determine which schools they're going to monitor based on, um, those that have, uh, been identified for some um, academic monitoring. And basically if a school has um had a student subgroup that is not um performing at has not met grade level or exceeded grade level uh in a particular content area two years in a row. They there are different um tiers of uh state assistance and monitoring and so forth. So in any event, uh King, our title one school, there

231were two years in a row in which students with disabilities uh did not uh meet standard or higher than standard in English language arts two years in a row. So they are at the very lightest level of state monitoring in terms of all of the tiers and and and how much monitoring they get. But nonetheless, because of that, they fell into the pool of the schools that would get Williams monitoring. So folks from Orange County Department of Education came out in the fall and they did a site visit and they made sure that they had all the materials that they needed and that our teachers were properly credentialed. Uh and then they did they checked out the facilities and they they noted that we had two things that they felt were out of compliance. One

232was that um we had a couple of stained steel uh ceiling tiles at King. So those have been replaced. And then also uh we did not have um feminine hygiene products in uh some of the restrooms. We had them up in the nursurse's office, but we did not have them out in the student restrooms. And the rationale for that is elementary children can be a little mischievous and they can use those products to clog up the toilets and and that kind of thing. So, we thought that having them in the nurse's office was a responsible uh alternative to that, but we've corrected that as well. So, um that's what you have in front of you. We are required to present it to you and so now you have it before you. >> Thank you. Um

233I don't uh let me just I'm not going to make any assumptions. Does anybody have any questions? >> No. >> Okay. Then moving on to 13 uh.3 first reading of updated board policies, administrative regulations, and board bylaws. As always, um we have a nice long list, but we can't see it right now. Um if we have an opportunity, we'll have an opportunity between now and the next meeting to be able to read and review all of those uh before we are considering those for approval. So, I would request that my fellow trustees do so and um let us move to directly to number 14, which is adjournment, and suggest that our meeting is adjourned at 10:20 p.m. until our next regularly scheduled meeting, which will be January something something I can't remember what it was.

234January 20th.
