Are there any registered speakers on the items that are not been pulled for discussion? no ma'am. That registered. okay, let m me look at something really quick. I believe DR. Rupert? le I had a general comment retirement. Keisha, sorry, I can't read my handwriting and maria perez, I believe she was a regional superintendent. This was requick and the community was surprised to see this. So I would ask that when we know that a principal, has been at a cool for a while or close to the community, let's say any principal or administrator, when we know it would be wise to share with board members so we know what going on. And when we get phone calls, we'll be able to answer that they're retiring or whatever it is. I fielded a lot of phone
006calls for both maria and keisha. So we will MISS Them, but that my ask in the future. DR. Hepburn? that's noted, MS. Rupert. We'll ensure that happens. thank you. I would also like to give congratulations from the school board, 8 administrative retiree, 30 instructional retiree and 22 non instructional retiree and a special shout out to -- enjoy your new chapter in life. Speaker: speaker. hold on they're getting to that. ma'am, we have 12 speakers but do you want to pause for h1 for photos. I apologize, this is where we take a quick picture
007for those approved for h1. MR. Hepburn, do you have any words? N.Just a huge thank you. we would like to congratulate for each of you for your career and advancement, we value you and your families. If we can give a round of applause to the appointees, please. Thank you time we'll take a quick recess to take a quick photo with the appointees. Then we'll come back to h2. this regularly school board meeting now reconvened. We now have h2 as is is already on the floor, taffe can you -- staff, can you tell us what speakers are on the list? okay, we have I believe 11 speakers on this. First up yosh and richard rossi. so there is two microphone, if one person will go to the microphone and the other. So we can move this
008along. So if somebody is at one microphone, if you can move to the other one. Thank you. you can tart. Speaker: I'm going to donate my time to ana fusco. we don't donate time. I'm sorry, I forgot that we had changed the policy and we do not give time to other people. I forgot that was a resent policy change. Go ahead. Speaker: again, josh is next and richard and ashley glen and rebecca gates. O if your name called, come on up. There is no donating of time. Speaker: good morning, attorney richard rossi on behalf of MR. Harper. So at this point and time, there is a recommendation for disciplinary action before the board and MR. Harper and the allegation. That being said, MR. Harpr has been serving in his position of employment for 8 years
009and it's a career that span for 30 years without any blemishing, within the current 8 years or 30-year span of his entire career. No disciplinary actions, the allegations before the board that were were completely, there is no witnessed, my clients denied the allegations from the beginning. Prior to the recommendation, there was no reprimand no nothing regarding these allegations, and they went straight to the board today. MR. Harper has an outstanding career. He denies the allegations and completely unsubstantiated and we recommend the board deny. We would also request that MR. Harper be returned to his location. It's my understanding that he's in the west campus, and we request that he be immediately returned to the main campus. As tated, the allegations are unsubstantiated and based on that, we request the board deny the allegations before them
010today. Thank you. thank you, next public speaker. ashley glen, I would ask for a point of order and I ask that you I would like you to amend and give us three minutes that we can give to the members. I can't amend the policy. it's a policy. Speaker: MADAM Chair, can I ask that you waive that today? I cannot do that. Next public speaker. Speaker: good morning, ashley glen, I'm a teacher, I'm speaking of behalf of a situation cool year 24-25 school year. So I just want to ask for your reconsideration of the three-day suspension that has been proposed in the response to the situation that transpired at the time I was dealing with my medically ill child which still an on-going process. It was stated that there was a course of time me stepping
011away from my classroom and not seeing my children. I was dealing with my child who was on going medical issues, in perfect lung disease. And I was in communication with physicians which required me to give this specific situation attention which caused me to step outside of my classroom for my class door being open at the time and me standing by my classroom, by my students. My door was open, if it was shut it was because tud enters coming out. Students coming out. My classroom door does have a window where I can still visually see my tud enters and make sure that nothing taking place. It was, juniors and seniors present at the time in the class. I am asking that the three-day suspension that is proposed is reconsidered and due to the situation at the
012time, also thing, the three-day suspension will be a hinderence to me being that I am a single mother with an ill child. Thank you. thank you, next public speaker? rebecca followed by lillian rowedo. Speaker: hi my name is is rebecca yates, I'm here to ask that you reconsider my three-day suspension. I'm a teacher that teach autism cluster, I'm in charge of severely autistic children, three of which elopers, seven of which are non verbal. On the date, not even three weeks to the school, I was walking my kids to the car loop in chris elementary. I am in charge by myself with seven kids to walk them to dismissal, three that are elopers, three that will not walk without me walking their hand. I was walking when a fourth grader came barrelling down the stairway and
013I was walking with my kids. I asked them to stop. I was holding one of my child's hand and I put my right foot up asking the child to top as he was about to run over my four and five-year-old students. After that happened, we proceeded to walk to dismissal. He was not hurt, he did not scream. He did make contact with my hand at the time when I did ask him to stop. It was out of safety in protecting my kids. I am ensured with the safety of ten children. I did not push him, he did make contact with my hand. And he did step backwards, he he never fell and there was no injury. Please reconsider three-day suspension. This was not done out of malice, I was strictly protecting these students. Anyone who
014knows me, knows that these are my babies, this is not just a job this was a career and this was a dream of being a teacher to autism after losing my husband who was in the military and died of suicide, I went back to cool to realize my dream. next. Speaker: good morning, chair and the cool board. I'm speaking on behalf on my reconsideration of my three-day of suspension. I'm still confused as to what took place. I have been an educator for every two decades. One my past students sitting in front of me. One of my past students is one of the board memebers. The incident I speak about is last year. That whole ordeal, I don't even know, it was just period of time when I asked for help for my students, it was
015thrown against me. As I said, I don't know. I go to the extent to get what I need for my students at all times. When it's told that I have to call esol students and I ask, who do I go to for translation? And I say, well if english speaker students can get a call, why is it that non speaking students can't get a call. And I've been said that the district has policies to use parent link. That does not sound right. In my due process meeting, I'm not sure if this was due process. I was yelled at and be littled and demanded to answer questions, pointed at my face with my representing who attempted to call the police. I don't respond to people screaming at me, I remain silent. As I said, I don't
016know what due process that is. MS. L rubio was here trying to assist me and to be told, they're calling the police. So I received my corrective action paperwork on the last day. I got this note to come here on saturday. thank you. Thank you so much. can you tell me the last two speakers. yes, yates and willmont is the one that just finished. is willmont listed? yes, it's a little confusing. Even though they're calling your name, if you can state your name because we're trying to find you in the h-2 item. So next speaker. Speaker: lilian. we have to reset the clock. MR. Hill, can you list the names left? lillian, ana fuseco, shenisa, yadira, sorry if I mess up your name. And miyasha as well as richard torres. okay, please state your name.
017Speaker: lillian ridio, I'm here standing next to alaska, she is extremely stressed. She feels that three days suspension is extremely hard, what she does for students. She teaches pre-k intensive, I'm going to give you her statement. I'm going to ask you please read word by word, page by page. This teacher did not do what they say. They say she lost a studenenanan she dididn. Therere soso much momore the story, I'm going to ask that you please reconsider the three-suspension. The fire drill, the student had diarrhea and she went back to change diapers. So you're very quick to give people three-day suspension. I'm going to ask you again, when the employee came, somebody sent the student into the classroom. The student said, please don't take the kids, she has been doing this, so the employee did
018not listen to the teacher and took all the kids to the fire drill. While he was changing the diapers. And after she said, she took the student and joined the rest of the classroom. Therefore the teacher did not lose any of the students. Again, I want you to reconsider the three-day suspension and I want to ask you to valley the teachers. She does not deserve the three-day suspension. And I ask that you watch the video, they only show her frozen picture, no video was run. If you accuse me something, I am going to fight are hard and ask you show me proof, why was the video not run? Why did the process not give the opportunity to defend herself? I'm going to ask you to -- can we keep it in order. We're not sure
019how the order is. You got them waiting. come up the order you want, but make sure you let us know the name of the employee. Speaker: good morning, my name is richard torres. I've been teaching for 33 years, great looks, great cologne, great job on the test. You look smart, you're nice dressed. Beautiful name. Beautiful face, geese, love your new sneakers, love your lashes. No body is said that we're not allowed to give compliments. We're told to give rappor with the students and that's what I'm done. But a student took it the wrong way. In my culture, we give compliments. I do this to make my classroom welcoming and improve mood by the students and self worth. At no time do I want these compliments to be taken in a negative way. I'm at a
020loss that anyone would give giving students compliments into a negative thing. I've never told -- sorry, I never told students gotten their names or phone numbers, talked to my students by themselves, everything is in front of my entire class. Are you saying that teachers who are kind to their students, teachers who give compliments, nice to their students, will be fired. I'm in complete shock before, and sadness and ask that you don't fire me for caring and being kind to my students. And I'm nervous right now, in my 23 years I have never gone through this. At another school, I got hit by students, and surviving as a teacher now-a-days very hard, and for me to be confronted that I compliment my students and I can no longer do this, I'm saddened. All I tried to
021do was positive and welcoming and try to do the most important thing and that's to educate each other, or in the case of the students, the students. thank you for your time. next is is ken followed by ana fusco followed by terry. Speaker: somebody said, we can go as will. I'm terry lopez, price, I've been a teachr here prior to that in los angeles. I'm perplexed by the things that are coming up before the community. I'm wondering how these things got to you in this fashion this an entire community must listen for things this you're blaming teachers for. Certainly, they have in the past? When has happened lately, I don't know. But this is not the due process that these people had have and not the due process that we expect as a union. And
022there is one thing this I can tell you sometimes the professionals at the schools need to be trained better. I often use the word mop on purpose, if a student runs into you, that is not hitting the student. Can we're hispanic, we compliment, that's what we do, why are you even hearing this? But some of your people that are leading cools, are not trained up. They have not read books on the leadership, they have not read anything. And do you know how I know? Because I've read them all. And they don't know how to be kind and professional. They put their fingers in people's faces, they yell and then they bring you this because they don't know how to talk to a person about what really happened. Maya angelou said, when you know better, you
023know better. I hope you learn something, something is going on before it gets to you. I know there is zero tolerance on things that are done incorrectly, nothing burger is a word that coming to my head. That's what it is. And I would like to know what those that does not give the time, but whoever brought that forward or somebody else can bring it forward to not limit our time when we get here early to give our voice. thank you so much, next speaker. Speaker: I'm going to talk quickly, debbie, you said I could get extra time. and I know, it's on pp1 to give the time back. I'm going to be here for that too. You heard from our members, they felt it should be this way or that way. And I get this,
024but to go to the bang, that it's going to be automatically be, we're going to have a standard three-day suspension, everybody is an individual. They get their due process in different ways. We see a lot of picking and chooses. We're the representative and we're having this conversation. Most principals give us that. What happened to MS. Beaumont, the suspension should not go through. If I stand here, I believe they do not deserve this consequence, we have 25 people on the list. Some didn't want to take time off to speak here and we'll take it to a do-hearing. The thing that is is inconsistent, we have this process, and hr, er, lr, whatever you want to name that department only having a conversation with the notes from the admin. They don't speak to us or the person
025accused. Then this gets put on on the yaend. -- agenda. They only had short notice. I had some people that MAY want to retire, get a reason to resign. I want to make it clear that the process is not consistent. Most of them are new and they're building the plane as it's flying. I understand that going to happen, but when it's in the backs of people's livelihood, marilyn batista said it clears a bell, plained the due process. We're talking about people who get called into a meeting with just a general, you have inappropriate conduct. There is no follow-up or conversation so they can come back with evidence. And then the conversation happened with hr, lr, whatever the department, then the principal says, I didn't get the corrective action. It's not consistent. I'm can go asking
026for the speakers that came together to go with it. When you're given a short amount of time, and you're not able to speak, that's not due process. thank you. Next speaker. edward as well as yadero. Speaker: just point of contact, they signed up because they thought they could give their time. this was my mistake, sorry. this concludes public comment. okay, public comment. MR. Cervera. thank you. I want to thank those who came here. For those who chose to do that, I'm appreciative and that's why we are these in a public forum. Chair, I've got a couple of people that I would like to have discussion on. First I'm going to address the individual speakers this I took notes on and I would like to have an active discussion, first MR. Harper who came with counsel.
027I had questions on ten-day suspension. MADAM Chair, I'm not trying to jump on whatever you're about to say, I move to make a motion to pull out all of the people who came to speak today and vote the rest of the people on the item. second. all in favor say aye. Public comment on the motion? DR. Nathalie lynch, plantation florida. There had been a theme forming here around due process and it does not matter if you're a employee or volunteer. This cannot be, you're going to get sued and lose. And if it keeps going this way, you're going to get off the dias. I was almost in tears with the ese teacher. They don't know how to perform in leadership, it does not matter what it is, there is no thought going into these items.
028thank you. Speaker: I'm in support. next public speaker. Speaker: thank you, terry lopez, business women in broward county. I would like to thank alhadeff for this wise motion. I think you see how embarrassing and how flawed this is that this comes to this point. And I would like to say, with all respect, I respect, she influenced the lives of my children and so did your husband, that when somebody stands up to ask you a question, that it be you who answered and not MR. Sullivan, it's not his position to tell the rule. Excuse me, but that's what I believe. thank you, next speaker. Speaker: we represent the non instructional emplplees, and I'm herereto support this motion. Is not a a ruway y aiain not onon for the instructional but non instructional employees. I'm concerned because
029this is affecting the people here today. They're human beings and it's getting old when people are not treated as human beings, they're just objects and their families also see this, if they are children whoever it is and see them going through this. What a shame. We support due process and we want to see more. Speaker: point of order, don't do the time yet. When MR. Cervera asked for that person, I went outside to look for him. Can I hear it again. MS. Alhadeff. move forward with the rest of the people on the agenda to approve. N.And and to the maker of the motion, can we add five names, yates, torres and glen that we had. it was harper, yates, willmont, juarez and torres. Correct, there was six. given the seriousness of this, I want to
030make sure that we have the names. that's the best we can do right now. i wish you can see the former students of MS. Willmont, how proud he was that she was her teacher. And to hear that she was mistreated. We know this we have 30,000 employees and somebody is going to make a mistake. And people do make them purposely and not purposely. Not to be malicious intent and when we are making 2000 decisions a day, should not mean that we're going to pounce on you and take money away from you, in a career where people show up to do a good job. thank you. Any other public speakers? Board member discussion? MADAM Chair, it appears that MR. Cervera seems he wants to make a comment. comment on the motion? thank you, MADAM Chair, my
031comments are on the motion. Six employees, the remaining were here for disciplinary measures. Are we able to speak on specific individuals that we were not allowed to speak today. All right, so I think that's all my concern. thank you. MS. Rupert. I have one question. Was nicole part of those that would speak. this is just on the motion. come back, but I do pore the motion. MR. Cervera. on the motion, thank you MS. Alhadeff for bringing it. I do have one small concern and I'm going to direct this at the superintendent with the instruction on what he's going to do with this going forward. There is going to be an additional investigation what is going to happen, so we're not facing a situation where the folks are coming three months from now, except the anxiety
032and the ability to not know what is going on with their professional career. I think in all fairness, we want to know if the super is going to send this, are there going to be more interviews, what going to be different o we're not just kicking the can down the road. thank you, I was going to ask the board this. The team already made their resing. -- their investigation. Unless the board wants to more about detail. But as far as additional investigation, that has completed. I think the question is, what are we doing? go ahead, DR. Lozano. I want to remind the board, the process does not end today. That's when the grievance process, begins. That's where what you said, board member cervera, if the employee appeals the decision made today. That's the formal process
033that conditions after today for each of these employees. Their rights does not end today based on the decision made today. And there is a multiple of individuals that don't get to be here today. The principal, the students on the other side of the allegations. i remind the board that there is a process to review all the information at the end. And we're circumventing the process by building this parallel avenue in completing the process. MS. Rupert. please don't yell out. for me, many of these don't have prior discipline in the past. I welcome the situation but it's very difficult how they went from 0 to 100 to get here. I would like to clarify that, I'm not going to call names out but for their entire time, they've never had a disciplinary issue. 11, 12, 13,
034this is a rough, 20 of these people do not have prior or let's call it, the foundation of their discipline matrix, don't are that. Certainly there are cases this merit and this are information, I welcome the conversation for staff for that. But for me, it's alarming that there is no prior discipline. MS. Thompson in thank you, I had some questions. So the appeal is without pay, so if they're going to appeal it, when does that affect it in MR. Azzarito. if tt a grievance, if it's somebody not covered by policy, so everything can be on hold through this process. please do not yell out. thank you for this. While I appreciate the motion, I'm concerned about the precedence setting, if you're not able to take off work, but if you're able to take off time
035or are the ability to talk, it is unprecedent to remove some people without reviewing it. And it seems that staff is is not going to be doing anything differently. I'm curious, you feel that some speakers need to be reviewed. Thank you. For giving a more complete story and it seems that some of these need to be reviewed thoroughly. I don't know if I can support a motion that disenfranchise people that can't take the time to get here. MS. Leonardi? thank you. I think this is a very complicated matter that many stakeholders could have done more diligence. I do want to be on the record, staff does ask us if we want to be in these meetings. This month I declined. Our speakers raised some concerns that some of us up here would like to look
036into it more. I would ask the advocates, before it comes to a public meeting where we're being asked to look for video. I always return calls, I'm always available to meet, so I would love to sit down and go through case by case with our labor staff before it's in front of us. I do believe that some of these things need to be reviewed and we got a review in our emails. We need to have a more transparent conversation that better. But I also don't want to send to our staff a conflicting message, because we have said that we want zero tolerance and now we're criticizing the way they're doing things. I think it's a delicate ballot. We want our employees to be professional and with the respect that they deserve. And on the other
037hand, we're tasked to keep our children safe and making sure that they're in a thriving environment. Part of me wants to postpone the entire item but I don't, I struggle with the response that we're not going to do anything differently. We can acknowledge that there are some concerns raised today that were legitimate. That's where I am. And again, I implore our labor groups, they know that I'm available to let's schedule some time to review these things so I can requests the videos and documents. I cannot do that when I'm sitting up here, about to vote on it. I'm curious to hear from my colleagues. People are raised their voices, we want termination, we are zero tolerance. please, don't yell out. you cannot do that. and we've asked them for years and years to do so,
038so they're in a difficult spot. thank you. I also appreciate the motion. And there are some this definitely through up some red flags. Some show there were past discipline. We did ask about not sending it to doe. Some of this asking for the process and the process became different. So because of of this, you would like to support the motion. At the releast let us go through and hear. The paper we get does not have all the information, it yuft gives the -- and if somebody seems blatant, we ask and then another 22 people were added to the item. And then somebody calls you on a saturday or sunday can says, that's not right. This one different because we changed the process, and nobody knew when this was going to be. It was not mg
039this tf did, but it was a process change. I would ask if this motion passesesthis thbod member that want to are the staff, that we do this as soon as possible because I'm guessing, they would come back in the DECEMBER. And remember, we are a week off for thanksgiving. And since it's not in this motion, I'll do it when you come back to it. I do support the motion. I don't want to send a message to staff. I want to be able to hear both sides. DR. Zeman. thank you. I would ask that you please follow decorium. I'm a lot more concerned about the six cases, the six people that are the time and the representative that say this did not work. If you get a decent sample size, if you' something that didn't go
040as you wanted to be. You know, on balance, if we postpone this list to DECEMBER, we're not hurting anybody that could not come here. I'm always willing to give a little bit more time to make sure that we have all the information we need. I'm 100 percent in favor of terminating who hurts a child. Our number one is is to educate kids can all those, the miracles that are performed in a school are important. My concern, this sample size is too big. I'm worried about injuring the people that were on the list, time, you know, there are people who cannot leave their school functions to come here. And I'm not happy that 22 people added to the list. When were the 22 added? last week, 11-5. And I MAY add, nine of these, teachers, certificated
041employees, so if you look at MARCH of 2025, MAY of 2025, they've been waiting, they got all their due process. We talked about moving it to get people through it faster. That's why nine of them were added at this point. I'm as a board we're saying, maybe we didn't react in the right way. Maybe we didn't do all the preparation that we wanted to on the other cases. I would rather waive the list and bring it back in DECEMBER. So I'm going to make a motion. we do are employees that are up for termination, so I don't know how the impacts continues paying them. correct, we are a group of employees that are job abandonment. so you need to update the list. I'm okay with that. and MR. Azzarito, do we have any that must
042be terminated? how many people would be on the list if we postponed to DECEMBER in thank you for the motion. Of decorium. It's rehard. There was a process that MADAM Chair and somebody else, would say, there anything else that this this have to say. The point of the matter is, that it's disrespectful. We would get called back for a moment and two. So we're going to ask that it be called back. can I ask you to repeat the motion? I appreciate that motion DR. Zeman and I hear your concern with the quorum, you guys are speaking. It's about the motion. not about decorium. As I said before, the process happening, but there is a huge glitch and I'm in favor of the motion to postpone it, that had not be the we are. I said,
043they're a good group but there is a huge inconsistency. Speaker: good morning, I'll speak to these issues later, the process is a process that I did agree to. It was a, unnecessary and b, superbfalous. That's different than what we're talking about today which is a problem. We are a serious issue to communicate to you today. The process that you're talking about is not that. I think we need the time to figure it out there are closed ears that we hope will open up and are a better process, not just give you the sour sandwich. So it is the elephant in the room. That the royces will be heard, that they matter that they count . N.Thank you. Next public speaker. Speaker: there is a solution audit. For each of these people that were on this
044item. And where there is discrepancies that show what they should have done differently. All of us can tell you, due process is a problem. before we go to others, can you read out the 26 names. I think it could be important that we know. Just go down the list. thank you chair. heather director, so these are the 26 names that are being pulled from h2. Almasar last name, babis, bener, bruinfield, berk, canis, clark, christie, copeland, glen, goghman, gardron, getis, harper, hays, henitch, jones, keira, martinez, moore, motheran, wright, noel, rodriguez, scaninga, smith, smith, fabian and richard smith, torres, wallace, willmont, yates. thank you, board member discussion on the motion, MR. Cervera. I'm wondering if board member alhadeff is going to withdrawal the motion. she can't. so as to DR. Zeman's motion on the floor, I appreciate
045your motion. I have some concerns why. This is just us kicking the can down the road. If we're going to postpone in DECEMBER, which I'm in favor. We also need to know what going to be done between the 12th DECEMBER. I heard some good ideas that I'm going to elaborate on. Fusser and for most, for the 20 plus individuals that we yuft heard the name. I would encourage staff to do the following. Make sure that everybody has the file, all interviews, statements that were made. A drop box can be created, so all my colleagues have an opportunity to rerue. I'd like the opportunity if appropriate and I guess, perhaps I'll differ to MS. Batista, if we're able to reach out to this educators and have a conversation to them as to new questions we MAY
046are. I'll did you ever to MS. Batista, if that's appropriate or not. Lastly and to piggy back what the last speaker said, I do think internal control audits MAY be beneficial. There are a lot folks here, and board member made notice, there are a lot of folks this are subject to suspension with no priors. That's a little concerning for me, I had some names on the list for folks this I just needed some information. If that's the case, they had been disciplined accordingly. But when you are 20 plus people, facing suspension with no priors, that concerning. so if we have the ability maybe go back the last three years and compare to the best of our ability, I know every situation is unique. If sally jones facing a three-day suspension for yelling at a kid,
047just to go back, have there been teachers that have faced suspension for same contact. And perhaps a more vas sample size, can assist how we're going to vote. Tt hard to get this information, and it's pretty, we get a sentence and a blurp. For the benefit of the public and the benefit of the board members up here, there is no such thing as too much information when somebody's livelihood is going to be threatened. I'm going to ask that we expand the motion to include directive, videos, documents, the case file, if you will. I'll yield to MS. Batista if we can reach out to the individual teachers. And in addition, I want to see an analysis done, as to whether or not these punishshment have been levee, I think at least three years. That being said,
048I would like an answer from MS. Batista. yes, and can you remind us of the whole process and something else I was going to say that and maybe explain, what the process? Is? thank you, MADAM Chair, the short answer is, it will not be appropriate for the board to speak to the employees. scrap that, every one knows, we follow the rules so if it's inappropriate, it's scrap it. so we have two different groups, the certificated employees, the teachers and the other one under fopi who are the non certificated employees. In one group, the certificated employees, the board would have a quasi at the end of the due process. Therefore because you look at that again, once all the evidence has been adduced at a hearing, you need to remain impartial and decide through the official
049process and not on whatever else, you know, ex-parte communication if you will. For the fopi group, those items do not come back to the board. They're decided through arbitration. That's at the end of the line so it does not come back to the board. While I still don't think you should discuss with the employees about their discipline, that's for staff to do. thank you. it's getting confusing. Can you explain the process of what is happening here. DR. Hepburn? for my own information. go ahead MR. Lozano. I'll start and then pass it to MR. Azzarito. We saw, we saw the discipline was not consistent in certain areas, so as we move forward, we worked on not being consistent. you audited for three years. so if I MAY, we looked at the last three years, for example,
050plantation high school, we brought the data back. As MR. Lozano mentioned, the implementation was inconsistent. So it was a matter doing things differently to create consistently. But the the data not consistent at all. so when district looks at a situation and sees there is physical force in a redirection and with see that, we issue a three-day suspension around that. We're moving through new statutes when those are violated. We're setting the precedence, so we're going to continue to volve together. So right now if a door props and you see a employee violation, we have been trying to work through each situation. Get the feedback from our collective bargaining group. So it's helpful to us, when we say, these are the setting. So it it the board direction, to say an avertly, should just be a level
051of reprimand. And I think you heard this today with the consequences this were being shared that the discipline for the same infraction was consistent. And again, we're working with staff to get to the pf place. Perfect place. I just wanted to talk on this piece and are MR. Azzarito. part of the process, is we're doing things differently. We're taking out the complaint portion? correct. I guess what I'm confused about. Once somebody has this recommendation here and if with agree to it here, what the process after this? Where do mitigating circumstances and the ability to defend yourself after a due process internal? So we are a big picture of the process here. Where does somebody get to defend themselves in the process? MR. Azzarito? thank you for this, first clarification, there is 33 names this we're
052looking to pull. As you said, MS. Bulman, they've had their chance and then a recommendation coming to the board. After the board action as MS. Batista, if that you are certificated, they can appeal for a doa hearing, and legal puts together the complaint and submits that to tallahassee. and you used to do the complaints for everybody but now you're not? we were doing it beforehand for all iser -- certificate personnel. Other ones accepted what was given to them, the three day suspension, five-day and that's it. So they were doing 60 percent of these complaints that they didn't need to. so that's a change in the process? correct. did this just start this month in ? correct. and again, you would have that 12, 13, 14-month process sometimes that this board asked us to look at
053to speed up from incident to resolution. So we have could be conservative 50,000, and if that's a certificated teacher, then the principal cannot fill this position because it held by the individual. So it creates a burden on the longer we have to complete investigations and move forward. okay, that's for the certificated. so then they go to the hearing and then there is a determination? yes. and then there is a forum where they can defend themselves with the limited information this we have right now? repeat that last part? N.There is a limited forum? there is a forum where they defend themselves in front of the department. And the other two groups if they're covered by the agreement, and for those employees that are meet and confer employees, there is policy 14 to appeal. and are, o
054we're talking about consistency, we've deaudited the last ten years and the example of proping open the door. Are we going to a more strict liability? for safety concerns? yes, to talk it into considering or how is this? I mean, you know, it like if you have a strict liability or crime, you have your day in court or whatever. Is that just how these people are getting here in so just to clarify, I think you asked two questions. I'm not talking about arrest, as an example, as selling beer to a minor, you're getting charged for it at the time. So it you're leaving the door open? if you're a teacher -- are you going to be on the list? yes, if you leave the door. There MAY be some issues this didn't warrant discipline. This go
055through the rigors. I'm pretty sure that with have open door situation just an example because it was not the circumstances. okay. are you done? I'm done, thank you. MR. Cervera's point, I want to say, we as awe board have asked for different kinds discipline to happen. So it's hard to get -- door thing, the law is now, when the door propped open, that's a law. So some of the consistency will change because circumstances change. I don't are a real problem for the motion except there is somebody on this list this being put to a termination because they hurt a tud enter. I want this person to be off the list because we've been clear if there is harm to a student, this automatic termination. I accept this change, and just for the record, 33 names.
056correct, 33, this would be 32. The last name gauldran. yes. Thank you. DR. Holness. thank you. I have a couple of questions, MR. Azzarito said, nine individuals were added? When were they added? because you received the revised version before we met, I had an original version of the list of individuals. You mentioned, that nine were added and two as well. the nine that were administrative complaints. Those nine were moved on NOVEMBER 5th. So every month we move provisions on. But those were put on NOVEMBER 5ing. 5th. and you mentioned, 22. the other 13 were added before the meeting. I understand, I'm just trying to understand when we were added. So all were added NOVEMBER 5th. yes. MS. Batista, if a board member believed the consequence does not fit the offense, we do are a right
057to vote no on the item but not get too much into the weeds of what being done? correct. so if any us feel it does not fit the consequence. And MS. Batista, if we say no, what then happens? Is it dead? yes, if the board votes this for example a three-day suspension does not fit the offense can you vote that down, thz the end of the process. got it. So if any member simply believe that the consequence, they can simply vote no, and it's gone? correct. the employee will not serve the suspension, it is not the end of the process but this would not necessarily, that does not affect the employee's suspension? well to the extent, whatever is before you is a public cord and it will alalwa bebe a a pupubl r record. understand.
058We've received information like this for their actions and we also spoke about discipline manual and DR. Lozano made reference to this, where there is discipline being reviewed and provided. They usually meet one on one, you meet with MR. Azzarito almost before every meeting, to talk about the offenses. But what I did not appreciate there are a number of items revised and then I went through, and then the subsequent came a week later and there were significant items added. That was concerning to me with the revised items, that seems to be a lot. The particular employees if this had arrangements, because they were added a week before. Maybe others, would have shown up but because this appears a week later. I'm concerned with the timeliness of the revisions. I'm not sure I just want to make
059sure I understand why we're postponing? Are with postponing to get more information or we didn't get enough time with the revised items? So if it based on the revised items, I would rather a motion. Because some of these items were provided long before and my concern the next board meeting, we're going to are discipline actions in addition to the 26. So by the DECEMBER, we MAY end up with 40. I'm just wondering if we're postponing, I came prepared to look at the rest of them. I did come entertaining the revised ones. I would love to support it but I think the revised items were the ones that were concerning to me. And maybe the board memebers who needed to look closer at those items? DR. Zeman. those revised would be part of 32 cases that
060we have in DECEMBER. These are specific cases what I'm saying is that we need more time to make sure the public, and agreeing to what has been out. So it is just on balance to a, new process, not sure all of us participated fully. We MAY come back and bless every one of these and that MAY be the outcome. I just want them to know that we care about our people. I'm sensitive this our employees need to be accountable but I'm 1,000 percent on that, but we on balance, we need to make sure that we're aware of all these things. And people have talked about the process, getting better. That's great but that's a separate issue. I'm proposing because we know this we're getting an opportunity to get this right. we heard some substantial things
061and I'm very nervous some that could physically couldn't be here. And the sample size is just too big for the community to say this you got it right with confidence. Those late cases, could be part of the 32, am I correct with that, chair? yes. in balance, I want to make sure that we get it right for the community. I understand. And in the future, if staff with bring this to us as soon as possible. And I think they do a great job but I realized, the items did not were on the list. The earlier, the better and it benefits the public especially those affected to get more time. thank you. And I did have that same concern and I did call MR. Lozano, and because we changed the process. This will be a messy
062month because we changed the process and then it will be smoother. And to remind every one, staff asked us, do you are any questions, it would be important to take care of the opportunity. MR. Lozano. this is the first meeting where we're implement this transition, if it does not make the first delivery, we're not going to give you revisions to give you time. It will go to the next meeting. We hear this, and moving forward, we will not add revisions unless it's a does qualifier. thank you refp. -- very much. As those in favor saw aye as amended. Any oppose? It passes unanimously. MR. Cer very are? Cervera. I want to make sure, having the case files. You want confirmation that we're going to are that? yes, you made notations and we're going to make
063sure you get that available. thank you. MR. Cervera. in light of the motion, I don't have any comment. we're very behind. DR. Holness? Do you have anything additional? MS. Rupert? just double checking nicole is on the list? yes. all those in favor of the amended, say aye. aye. any opposed no? Motion passes unanimously. we have split the comment period, we will start with DR. Trudy. Speaker: in 2023 over 18,000, or 13 percent lft. My dad says, people like you don't matter anymore. No near, no malice, that cuts deeper, and he said you don't even have a tik tok. Today I tacked the last box and left the door. When I tarted teaching in the early 80s, felt like a promise. 064night, kids made you hand made cards. watching a child sound out their first sentence felt like magic. That it's now been replaced by exhaustis and loneliness, my evenings used to be spent glue sticks now it digital reports to protect my selves from angry emails and lawsuits. I've been yelled by parents in front of children. And the kids have changed too, they arrive, tired, and anxious and over stimulated. We're expected to fix it all. Patch the gaps, heal the trauma, teach the curriculum, test, test, test, on computers with five-year-olds. Replaced by data charts and learning metrics. A young principal told me, clara you're just too nurturing, as if kindness were a weakness. Still I stayed. Why? A note that said, you feel safe here, a quiet void meeting my eyes and saying, I read the whole

Speaker: good morning, again. Since this is my three minutes, 4.9, did not hear the process this got you people today. And you're making task to make sure that your policies are being followed. The only way you know that if you audit, the and know the no superintendent cannot audit himself, that would be done by the office of chief auditors. That's how you can rest assure that everybody did what they did. Experience would suggest that they're not following policy and I can certainly attest to this. The last time I was here I had a couple handouts and I wanted to proride a history lesson to people
066that were not on the board back in 1991. So just to go back over that, this has to do with when call due process for the removal non school board appointees. You have two sets of pools when it comes to removing people from advisories. So on the MAY 13, thereof no ob yex to the process. No board member ob jected to the language this provided a process. This language was vetted by marilyn batista was vetted and tweaked and turned back. And this language never got shared with the school board. But the language this was vetted and revised by legal, the same women sitting up there. Because on MARCH 28th, right after the board approved the contract, they talked the committee into removing the language from the recommendations this legal had vetted. That's what you're at-risk

Nesia. Speaker: good morning. My name is is nasia I'm representing coconut creek high school community. I'm here on behalf of the students and teachers of coconut high school, a school that has served this nation for generations. Today's agenda includes dozens capital amendments from, you are approving millions dollars in extensions redid fines. But coconut creek high school nowhere on that list. Our concern simple, equity investment. Every child deserves to learn in a
069safe and safe place. The conditions at coconut creek are not just unsafe but demoralizing. We are bathrooms that should have been condemned years ago, and it smells really really bad. Yet, over 200,000 residents who's tax dollars help fund this district and they're can go one question, when will it be our turn? We're not here to criticize, we're here to collaborate. We understand today's agenda focuses on contracts. We ask that you acknowledge as a priority for capitol renewal and direct taffe for design studies. Let creek be the next name you see under item jj. Let this board make history by ensuring every corning receives its fair share. The students are watching. They're watching to see if the community matters. Thank you for your service and your attention on this urgent matr. -- matter. thank you very
070much. Are you going to speak? The last speaker? You have to be on the list. I'm getting to the last person, the last person is anthony. Speaker: hi I'm anthony, I have committed years of love, and trying to build a culture it school but it's hard with condition that the school has going. but we feel, that's on going thing. Before I even attended the school, I was helping out. You reached out to MS. Nora rupert and MS. Wanda. You feel with need to come out with a whole plan of redoing the cool as a whole and not just painting. They're achieving things that we are not done in years. And really part of the school. You get a lot inputs and I'm there physically myself. Look out to the bigger picture, we're trying to change
071this as present leaders. So we ask that you guys, we are proposals, we don't know who with reach out to, but we've been trying to talk to somebody. It very physical when that you are doing today. I think this they receive some sort remorse where they're attending every day. Thank you. thank you very much. MS. Raoup ther? -- MS. Rupert? yes, can you get somebody to meet with them. We will be discussing today. I think you'll be surprised. We've been all the program itself has been behind. We're getting to a super fast motion. I respect that I'm with you. My number 954 -- . Yeah, yf, 954-292-2270. And you look forward to this. DR. Hepburn? yes, we're going to talk about coconut creek. And there is a facility condition assessment. It's going to identify all
072of our issues when it comes to facilities for every school. And not just for coconut creek but every school. Just fyi on that? thank you. Next we'll have the superintendent report. good morning, board memebers and members of the community. As yesterday was veterans day, I would like to take a moment to thank all veterans. If we have any veterans in the room, I ask that they please stand and be recognized. [Applause] Can thank you, thank you. Got a pleasure working with special people. Yes, absolutely. Absolutely, we're grateful to the commitment and sacrifice with tud enters. Last week, I had the opportunity to tral to tallahassee and met with shareholders. I wunt to thank them for continued pore of bcps and all students. As this is the final meeting before the thanksgiving break, I hope you
073enjoy the holiday with their loved one, you do work them very hard. I'm thankful for the teachers and support staff and also our volunteers. Let's return from break, energized and trong. Thank you time I'm going to ask becon to roll the video. I also want to give a huge shout out to, visit the computer software ai classroom. Students are doing amazing things, they're creating a bot for our website. So amazing things going on. Thz the end my report. thank you very much. Next we're going to go to updates from proi' groups, bef. I will do bef because james couldn't come. I want everybody to know this hall of fame will be -- and you can go online to register for that. We got a report from pta, very exciting news. The council has been very
074busy. And they're work withing northeast high and the quest center to get their PTAs organized and they wanted to share the feeding our community program will be held on 19th and 20th at lauderdale and they would like to invite the superintendent, and board to join them. They'll be participating in the family fun day on NOVEMBER 16th from broward county. Next our employees union groups, btu. Speaker: I think we're still in morning, good morning. I'm here representing principals and association and with me all the employees labor union representatives here today. And you should have received a resolution this morning this came from myself but endorsed by these organizations as wellment we're here to explain to the board, we have a serious problem, you heard of it this morning. But it's the tip of the iceberg, you
075-- MR. Lozano, if you have a title, you're conducting an investigation. They're not trained, they don't know when they're doing and they're creating havoc. So what you're seeing today, is the employee group saying, we've had enough of the havoc. I myself have made every effort to try to resolve the situation. I believe we need the support of the board in order to do that. We need a deep and serious review of what is happening to your employees under this administration. DR. Lozano described a process where they have a right to the employee. Assuming that employee is not sent to siberia to sit out the entire school year only to not be renewed. This seems to be how administration has decided to handle situations they prefer go away. Not fair. That's never my experience with this
076board, in my 35 years, I have never had an administration that uses clear right to appoint or not reappoint employees as a means to get rid other problems, never. And now we do, and I can site chapters and I can bring my attorney in here to do same. So I'm here today to ask this board to please look into this matter. I have a principal sitting out, pulled out a week ago. Both unions went down to the school to find out the issue. And they didn't kiss cover one, and yet that principal is still sitting out, or when they were even accuse. Because they had p been kaous anything yet. So we need some help here. This needs to change can it needs to change quickly before more lives and more can -- careers are
077destroyed. I appreciate your time today. That is my report today. Thank you. Spker: hello,it's me lis a, I'm concerned about the state of affairs in the district and the strategies that are not transparent. I'm concerned about the current situation, where there was a principal removed, it's because it's so wrong. It's happening to all us now. The process is flawed, we would like to come together and discuss it. Now if we have a situation where the individual believes, it's going to be the same sour sandwich, is what we're being told. Nothing is going to change. Then it's up to the board to facilitate the change. Since secured contract seems to be okay with keeping its status quo. While people on annual renewal are being rushed out, tick, tick, tick, the thousand, we got the email about
078the thousand added on. Speaker: hello, I'm lo risa crawford from copa, we're the group that representative all non employees by unions and non union about the fair and equitable discipline when necessary. While copa employees have not experience major issues, we had complaints about unfair treatment and being denied due process when it comes to discipline. Copa asked this the board support this resolution. Speaker: ana fusco, I stand in unity with our bargaining groups and non bargaining groups. I hope you read it, and if you understand it, call us. We all had some input and we agree that there is situation, as we heard debbie hixon clearly say, and you yourself and MR. Cervera and we heard that from DR. Zeman that if somebody does intentionally does somebody and hurts somebody with level of abuse, I agree.
079I stand before my members this make mistakes and just wants the due process and we help them accept the consequence or help them out. I showed you videos chocking and slamming people down can you did nothing. Remember that? But we cannot compare when somebody is maliciously hurt when somebody is trying to protect a five-year-old autistic child and accidentally a person gets hurt. Every single due process is an individual situation. So I'm going to tell the public and the students and teachers, don't touch a kid. If they get diarrhea, you're going to have to get them out there. You felt your colleagues that took the kid happen, it was a mistake. It was not purposeful. Know the difference. Are people out there this MAY fall sleep on purpose and lose a child? Yet you're saying, treat
080all of them the same. No. I said I like the group, they're all just brand new to the department and they are. You don't know this? You should. I went in there with selfless intentions. I explained to lisa, I don't want to go to battle with her. I've come to you with several principals that are agrecious and they were not even told to stop. So I want to get the verbiage so I can bring it back. But when I got from over 40 people, they are perplexed. I know when is going on. The board member up there know what is going on. But you've got couple of people this are gripes and xwlaints because things changed. Nothing this I brought forward with several principals over years. And some are standing up there, because you got
081out of the classroom to become a board member because of a toxic principal. Our teachers are exhausted and working two or three jobs. I need you to get it together with whoever is dealing with budget, and I know it more than rowe and find the money. I have an individual for all you, you're breaking the contract coming forward on-demanding this middle and high schools change the schedule to your need. I don't know when attorney is working with you, I have the grievances and the lawsuits right here. But I think I'm going to talk to the media first before I talk to you. Can you're blatantly breaking the contract, bulldozing the parents to make an mandatory emergency meetings with staff and bulldozing them on what you want to change from a block schedule to 7th period.
082So you wunt to sit in doa hearing, you wasteful money. Lock at kelly services, the money it takes for this. All it this we brought brought money and you just said, we'll take them to court. You're going to bull dose our high schools. By the way parents, it does hurt your students. thank you very much for your report. Speaker: you're okay with grievances and lawsuits, I saw you shake your heads. we're going to move to h2 and h3. Is there any public comment on h3? no ma'am. I apologize, chair, let me just find my place on h3. The supplemental pay provision, that's somebody gone through this to make sure that none these individuals are more items not in their normal job descriptions? I know we had this conversation in the past. Help want to make
083sure how safeguards. there is an approval process, and ends up in the regional. thank you, all those of item h3 say aye. aye. any opposed say no. Motion passes unanimously. Next is h4. Can I have a motion and a second. so moved. moved and second. MS. Rupert. MAY I pull h4, 5, 6 and 7, it's same comment for all four. can I have a motion to pull all 4? so moved. moved by DR. Zeman and seconded by MS. Thompson. I got it. About the job revisions on job description. It's not per se, I've been here long enough to know that when with you get a job description, in my experience it usually has down the road, not very long down the road, a bonus bump up in their new position. They call it market ready,
084they call it making it an equitable for everybody on the outside and in the inside. What I'm saying, is we're doing this with ground equipments, sign makers and planter and growth, underneath as part this is, it says there is no financial impact. Within the background history, recommended revisions include updates to the position goal, performance responsibilities and qualifications. And when items like this come to the board, we get kind hemmed in, because they say it time, it been ten years, we need to do this. It's not fair, and I want to ask, when was the last time, the job description for being a professional educator, when was last time that job description came to this board? DR. Hepburn? I don't have that informing, I'm pretty sure one my team members can pull it up and for
085professional educator teacher? Okay, we'll have that after discussion. that is truly my comment as well as for 4, 5, 6, 7, what is the salary currently and any recommended salary amounts? It does say financial? we can provide. There is no financial impact. These job description as many, more about aligninging duties can responsibilities of today with actual job title. Because many these jobs haven't been updated for ten-plus years. So this is more of changing job description to align with the responsibilities. But we do have job description in double letter items that requiring an increase in compensation. and I appreciate that, but being a former school member, ends up higher. And I want to specifically talk to h6 where it says, middle of the background history on executive summary. Currently the monitoring position is vacant, following the
086regular -- resignation. I thought that if thereof a vacant position that has not been filled in a while, we were going to keep it that way. It says no salary, of course if you put something in there, you put a salary. I assume and correctly, I hope that when we were talking about, one thousand employees, that we were going to first hit the vacancies and this one has been two years. yes, and that's correct. Just to clear the record, for the public and I'm sure we copied that letter, that many of the speakers referenced. It was not about terminating or getting rid of a thousand employees. It was clear for when our mission is, and for staff, out in administrative offices to understand that central staff is putting together to identify cost saving, to depend
087on attrition and to give them the number goal of attrition. If we don't get to this number, there will have to be some difficult decisions. We don't want any MISS Characterization this letter. right, but my question is, this is been vacant for two years. yes, yes. So just to answering your questions, there are certain positions this are essential so we will fill those particularly focus on internal people first to depend on vacancy, to create a domino but if we can't find somebody internal, we will fill it. okay, I don't have the stomach for this. If I hear that a position has been empty for two years and we're not paying that salary out, I really, I rell' really have a major problem supporting these items today. Thank you. thank you. All those in favor of
088h4, 5, 6, 7. aye. no. motion passes with one opposition, with MS. Bulman not on the dais. Is there any public comment on b1? I'll start since it my item. i have proposed b1 because I think it is important base on audits that will come later in the meeting. It was recommended by a number of different entities this we do a policy around parking decal revenues because it causing some issues in auditing because it not clear. So my item is to ask the superintendent a policy this has guidelines and specifically to be treated as special revenue so it helps with some of the issues. I hope this you support the item. DR. Zeman? I have a question about the level of policy. Is this something that can be handled through standard business practice? Kind policy
089or is this a school board policy? all the recommendations were to make a school board policy in every thing of the audit. So an actual policy. I'm thinking of this in a school perspective, whether they use a c or use their own staff. Follow when the business suppororcenter se through h ththe what we call standard documents, they're written in the same format but to my knowledge, tell them where to put money and how to spend money. It our intend to write a school board policy for all those? How? I'm just worried that a school is not going to be aware our policy on this thing. And I'm I don't know if other format would be in place and if it duplicative. So that schools always know when to do with all sources money. Do we
090want to write one policy, that provides great clarity? How do we want to handle this? so I will differ to the auditor. What I read in the audits, it was specific to parking decal revenues, there is a lot misconception and it causing a lot audit exceptions. So, I read it from auditor recommending it, also outside source that recommended it was very specific to a policy about parking decal. MR. Rodes, if you can address what MR. Zeman is asking. this is asking how to treat funds that is special revenue as oppose to if fiduciary revenue. According to the book, there is an option for the boards to a dot a policy to clarify how they will be used. So standard practice bulletin can become policy if the board so chooses, which is, in this case, we'll
091be looking how special revenues will be used. Otherwise restricted funds. So that means that the board will have power and control over what those funds could be used for. And it would mitigate future findings, this the funds will be used for. help me understand, the options here then chair. If we write a school board policy on this amount of money, so it follows our will about how the school spends the money. What are the options? This item does not tell us how, we're just going to do it. What options are we allowed to give school leaders for spending these funds? so the example given on past trending, the funds being use were being used as fiduciary funds, this the long answer to your question is that if fiduciary funds get over report, special funds aren't
092properly reported. So with this in mind, the idea to repair to various not just golf carts, repair to various operational components, these funds could be use for that and it could be by identifying what these restricted are and when board decides flt so that's is open and policy would help to defend and define this with regard to how guidance is provoid by red bobing. And the red bobing is state's department education instructions for how these funds are to be collected can handled and expended. So that would be the guidance. but red book gives us options beyond current practice at some schools which they put at their ad hoc? with the board's approval, it gives the option for them to be spent as way -- audit exception. thank you. And chair, do we have a discussion
093to decide how we have funds? yes, it directing the superintendent to work with auditor to bring back a policy and it will go through process just like every policy. I think that's great. I'm resistant on having other policies. dr. Wanza knows it better than anyone. But it becomes a fran tien, I'm always hesitant to do another policy but if the red book says, we have decision to do this. I'm in favor of school leaders using a lot flexibility on how they use money from parking and other sources like that. Woel see when options with have. before we move forward, DR. Wanza, you good? I thought you had something to shir. -- share. All right. all those in favor of b1 say aye. Aye. Any opposed say no. 8-nothing, minus MR. Cervera on the dais. Next
094is e1. Can I have a motion and a second. Moved by DR. Zeman, second by MS. Rupert. DR. Holness? thank you, MADAM Chair. So for slide 2, this is for current year 25-26, we're in NOVEMBER and I do notice a number of schools inspected so far, appears to be six. And a number of unrespected schools with no safety requirement deficiency which is three which is out of the 6, it's 50 percent. I'm wondering when you look at the data from the prior year, it appears that the district, inspected, 95 schools, is that correct? just as a note, the state does the inspections, we don't do the inspections. okay. my other question, I notice charter compliance seems to be not as compliant as we are as far as district school. What is an obligation charter has
095to improve and what if any, you know, sort of monitoring do we have for the schools to comply? that's a great question. The schools have their own individual boards, so they're hopefully doing reports. Our sst team does a great job in supporting them, doing all the best practices but ultimately up to them to implement. And we talk about the conversation with h2 items earlier. One of the things that they look for is low hanging fruit is locked door. Some were around state requirement in locking doors so maybe sure that everybody can egress the classroom in an instance of active shooter. I know what kind of actions they take but for us, they take a long -- support. okay, so DR. Hepburn, the areas of improvement seem like they're quite easy to fix, right? Like id
096cards, you mention locked doors, safer space signs and so on. And, and I see the actions taken here. But how are we ensuring that moving forward this all this schools, have continual monitoring and training to make sure the basic things? If you think, even some of the uncomfort school shooting, one of them was because of an unlocked door. it seems simple, but when there is a consequence, it very serious. Leave one door unlocked, that seems like a minor mistake, that can be consequencetial to many areas. good question. They're broken up because this experience, starting in summer to have an arm of ACMs to do these inspections at the schools before the school safety team comes out can tb to iterate their process as if they have gaps. Second part accountability, and that's why we're taking
097strict measures, if anybody leaves the door open, people have to be held accountable in order to change behavior. We're not seeing change in behavior, if there no accountability, the simple thing of keeping the door locked can save lives. okay, so really quick. The security teams, is there a process where they randomly check doors? This kind of a thing and report this back to our security? yes, so school staff and security at schools have their protocols going through open doors and know and aware so they can work with the individuals. so checking doors is a priority? absolutely. thank you, MADAM Chair. MS. Alhadeff. thank you. And this board it something where we hold them accountable for this violation. So my question first is to the area security managers, are they randomly going around the district to
098check at different schools? that's correct, they are. thank you and through the happenings, happenings is an email this board receives, is the school receiving that? I don't know. yes. MR. Sullivan? yes, board memebers are on the email list. So anytime, each of the divisions have their own happenings, it also goes to the board. okay, so each department is putting out their own? each divisions, yes, they have their own happenings. and what is it called? we do have happenings, but in decision, we also send out you dates on our -- michael safety security officer, we have safety in hot toll -- topics and it goes out? every monday morning. okay, so the board does not receive the hot topics? no. got it. So for sure, the charter schools need to do better and we have a
099charter school coordinator this holding this will accountable. Ultimately this board is accountable. So, we have to just make sure that our charter school person is really holding them accountable and if there, DR. Hepburn this is not being done correctly or needs to be brought to our a ttention, please do that, because this board has the ability to shut them down if they're not having security. will do. thank you, any in favor? Say aye. aye. any opposed say no. Motion passes without MS. Leonardi on dais. Next is f2? so moved. moved and second. Any public comment? nathalie lynch walsh. Speaker: still good morning. So f2 changed, you've got a revise version. And I want to point out that there is something missing from second one this is not offered in the explanation in the executive summary.
100Back on JULY 29th, number 14, you approved the funding. Safety enhancement and improved restroom enhancement and necessary roof repairs. Now on the the original report in which they bury budget amendment, there is a capitol budget amendment number 1 to reroof those buildings. I don't know even know the buildings, but now it says reroof. So in the revise budget report, there is no budget amendment but they don't say that it there and now it not there. Question, what are you now approving? Are you approving just the revised or budget amendment? What is explanation for being there? What is scope, that the earlier center state is in or they're trying to reroof buildings. So this is about transparency and not misleading school board and for GOD's sakes knowing what you're voting for, which staff is making it
101difficult to do. I'm interested in an explanation. okay, next public speaker? Speaker: good morning, DR. Hepburn, MADAM Chair, and esteemed board leaders. I'm felicia from coconut creek, by the way. Over the course of three consecutive budget reports, a clear and troubling pattern has emerged. It's operating on borrowed time. In JULY, we were facing a 240 million deficient in the general fund and internal service funds were in the red. And inflating both revenue and expenditures. Forecast were optimist and reconciliation tables were missing. These were not just oversights, they are structural blind spots. By AUGUST the general fund appeared to show a surplus but built on a loan, not true revenue. The referendum fund was 45 llion. Can n pitotol project overdrn n with an negative ending balance. And then came SEPTEMBER, con tradicting early reports. Grants
102were oar spending with only 2 percent continue to drag internal funds until 27 million deficient. These are not isolate errors, these are systematic failures. Respectful low recommend the following immediate actions, freeze none essential spending and all deficient funds. Confirm the true amount. Revise revenue forecast can hault spending and end funds with under performing collections. Reveal true operational budget, audit capitol project can paul's new commitment until funding secured. The numbers are allowed, contradictions are clear can the public deserves clarity not confusion. Thank you. thank you. Board member discussion? DR. Zeman is not here, so DR. Holness? thank you, MADAM Chair. A member of the audience made comments regarding broward estates and reroofing. As opposed to a specific needing building, needing reroofed, it appears the reroofing general. DR. Hepburn, can you talk specific whether or not we're
103reroofing roofs that MAY expire or if they're necessary to reroof everything with respect to buildings that we'll use in the future. I'll turnover to MS. Paul, I'll have her with additional. Sorry I caught you with food in your mouth. yes, GOD morning. We allocate money for reroofing of the buildings occupied by students. And I can do a follow-up to give more specific information. so the reroofing will be for buildings this students occupy? correct. and another question, MS. Paul, I know the board had supported the smart bond allocation to be spent within that ecosystem for the reroofing, did we determine as yet how those funds are divided across the schools? yes, we did. so for the reroofing, what is the cost to do that as far as broward estates? I believe it was in the range
104of 800,000 but I can give you a exact number. thank you, DR. Hepburn, I appreciate it. DR. Zeman. your mic DR. Zeman. thank you, I want to talk about perception on page 1 and first several pages, we talk about a fund balance. I'm not sure everybody knows, this fund balance happens on one day of the year. On the last day the year. Le the board does know and the community knows if you fall below 3 percent, you're in the hurt locker, you don't want to go there. On our reports, it 8.7 percent or 9.7 percent and we need to educate public that that's a snap shot in time or we have to come up with a little different way to explain it. I don't think we want to communicate that we have 9 percent our
105cash sitting around that we have not allocate. I'm going to make a recommendation that we avoid that or we make it very clear in all our reports that fund balance we're reporting month to month is a, snap shot, I recommend using a different word altogether. So if wick do those two things, I think we would communicate better for the audience, is that all right? DR. Hepburn? noted. the second thing, are we out capital money? When which look at the figures, it looks like we've spent all our unallocated capital money. Thz important, because if somebody comes and screams about a cafeteria being insufficient, we should always know what unallocated dollars are. What is the unallocate capital balance right now? omar shim, director of capital budget. Yeah, we sent a memo and we have about 0 --
10650 million current capital balance? right now? correct. we borrowed 250 million dollars. And the way accountants work, that counts as money until we pay it back. I don't want anyone to be confused that they have allocation of funds that they have towards the allocation. We do pay interest on it can we also earn money on MR. Shim's money and we earn more than we have to pay. But there a lot information on these reports and I don't want anybody to take away from a fact that we have a big year-end balance because projected is dangerously low. And I want to keep this board informed. At this thank you very much, chair. thank you, all those in favor of f-2 say aye. Aye. Any opposed say no. Motion carries, unanimously. The next is item j1, can
107I have a motion and a second. so moved. second. moved by DR. Zeman, and seconded by MS. Rupert. Public comment? no chair. MR. Zeman. I would like us to discuss, we keep getting these one at a time and there are 30. They're agreements between municipality but I'm curious, how many we have, what cities have not entered into reciprocal and can we talk to those cities and see if we can get a systematic solution. I want to open up for a discussion and see where it goes. okay, if board memebers want to discuss that? MS. Rupert? yes, this for the superintendent, what would this entail? Will it facilitate better, understanding? I don't think there is a lot extra work with the task and talking it our municipal partners, to see if there is a need for
108it if they desire it. Maybe they have not reached out because of a lack desire. If we can do something where it's more comprehensive than piece by piece, I'm all for this, it makes the process, shared use of facility better if there is a desire about municipality. I know we can start with the managers group. that's great, thank you so much. thanks, and chair, is there more discussion? I didn't see anyone jumping out their seat. I just feel there is a miss opportunity. I know in the city ft. Lauderdale, they have been worked out in the years. But the residents this work there, get tremendous value and we get one these at a time. I feel like, we go talk to them with bad news. Or, about whether or not they're SROs are doing what
109we need to do in the like. I would like to reach out a hand. What I would prefer to do ask the superintendent if he can bring you this information, at a school board at any formal meeting that he thinks is appropriate in the JANUARY time frame? MR. A ca bezo can you make that happen? yes, can you repeat the question please. or the statement rather, and it's simply stated to come back at a future board meeting, possibly JANUARY, about the desire after meeting with municipality leaders to find out if a comprehensive reciprocal agreement will be resired. the intent is can we get data? And out reach data in the like can maybe so see if this would be interest. Again, I feel like we have these amazing a is he, 239 of them and
110if they're in a city that not aware of the opportunity. I feel we should find a good agreement with them. just for clarification, we have 22 agreements. And the reason you're getting them at a time, they have staggered dates can they're for five years at a time. So agree with the the superintendent and desire of the board, if you want to have a comprehensive to reach out to the cities, if they're interested, and then we can, we just had a city who just had a new one for the first time. So as we go to the meeting, we can take it from there. thank you, chir thz all I needed. okay, thank you. All those in favor of item j1 say aye. aye. any opposed say no. Motion passes 9-0. Our last consent agenda item
111is o-2, can I have a motion and a second. so moved. it been moved by MS. Leonardi seconded by MS. Thompson. New public comment? no ma'am. DR. Holness? Thank you, MADAM Chair. Okay, so for item 02, can DR. Hepburn, the information in item o-2 which is a report, this information will drive what kind of action? DR. Hepburn? I'll turn it over to MS. Paul. give me a moment to locate it. certified firms and making sure the firms are meeting expectations and have certifications to do it. that's correct. okay all right, I did notice that in the report it shows break down of data, as it pertains to different groups. i also did in the that it includes, well let me rephrase, I would love to see data on women in general. I did notice that
112it provided white women owned business enterprise. I would like to see data in the future and this report comes out again in 2028, DR. Hepburn? quarterly. so for the data, are we able to get information on the women in general, as far as certified types of firms? And then we can also have a break down of hispanic women, blacks, white women, is that possible? yes, the data capture. So you want a better table displaying that information? correct. I still don't have any idea in terms of all women in general, as far as the break down of the did at that and, you know, the kind of, whether or not there is any sort of concern in terms of women in general because it only provides a sub set women. understood. okay, thank you, MADAM Chair,
113that's it. thank you, all those in favor of o-2 say aye. aye. any opposed say no. Motion passes unanimously with every one on the dais. This is the part of the meeting where we'll consider all open agenda items, the following open items have been identified for discussion, oo1, o o-2, jj1, jj10, jj9, oo1, 2, 5, 8, 11, 12 and 1, -- 16. At this time MAY the chair have a motion and a second to close the items not pulled for discussion? Jj2, 3, 4, 5, 6, 7, 8, 13, ll1, 3, 4, 6, 9, 13, 15, 16, rr1, ss1 and ss2. so moved. second. moved by DR. Zeman, seconded by MS. Leonardi. I'm getting there. Are there any registered speakers on the items not pulled for discussion? yes, there is. We're going to start with DR.
114Nathalie lynch walsh for rr1. Speaker: and dd1 has a time certain to that has been pulled. Okay. that's why I called it. you read it as not called. all right, rr1 is the tsse and tsse annex. Which then just a few years ago, the then was bent on rehabing and moving the staff rock into. I sent you an email with that history lesson, because of course, right now, you have the problem where the current not executive director, not facilities chief but operations chief or somebody, brought you a lease which you then vote down for handy because it same staff from rock island and where do they go? I appreciate that you vote it down, but you never, you didn't actually do anything this would get you to answering the question, how did that lease get
115in front you in first place? So I'm about-way my email through general. We know, this there are people who are from loss instruction. please stay on item rr1. Speaker: okay. Tssc, facility task force was discussing taking tssc and getting no a partnership but this did not make it to the bobod her than us r reporng .. But I just wanted to let you know, don't worry about the handy lease te debacle, I'll be taking care of it. any other? yes, we have lisa, she does have nine minutes remaining so I'm going to put nine minutes on the clock. okay beinger MS. Shoeman. Speaker: good afternoon, superintendent, chair, esteemed board memebers. Okay for gg1. My name is felicia shoeman from coconut creek. This agreement exposes a deeper failure. Ex extensions were granted. And fees collected and
116thz laying the risk. Public funds said in escrow while the district had to sue from what should have been protect from start. The board wants to tronger terms, automatic triggers can realtime oversight. Settlement should never be our clean you strj dough. I urge you to approve this item but also to investigate how these deals was managed and what safeguards are now in place flt our community deserves transparent sew, being ability, and better. Thank you. So when other item? we have you down for gg1, jj1, jj8. Speaker: I want to skip the jj8 because the jj8 sums up all the other JJs. This requests 70, 148. i don't know how to pronounce this company, for 112 days construction oversight. They provided ar their contract end, why? Because the contract failed, poor supervision, bad coordination and delays
117that lead to termination for calls. Narco kept showing up ub paid can now we're patching the gaps. But this is be an isolate case, it part growing pattern, jj2, jj4, jj5, 6, 7 and 8 all showed the same issues. Designed omissions, timeline mismatches, reactive amendments can consultant work and unpaid until the board steps in. And all these falls under the same department, faculties and construction management, lead by MS. Wanda f paul. This department responsible for contract alignment, construction oversight, and vendor accountability. Yet, we're seeing the same mistakes repeated across campuses, I urge the board to approve this payment but also to demand a full review how faculties is managing their project. Patterns like this don't fix themselves. Thank you. So what other one I have remaining? that concludes these registered item you registered for. Speaker:
118what other JJs? jj2, 4, 5 and 8 flt Speaker: okay, let's talk about jj5. This amendment request 20 to compensation song and associates inc. For structural design, revision at cooper city high school. The issue arose during a assessment upgrades at an auditorium that revealed beams. While I support paying for our serviced rendered in GOD faith, this incident highlights a recurrent theme, design conflict discover amid construction. Why weren't these struck tower al deefficients discovered earlier. This is about ensuring our schools meet accessibility standards without costly prices. I urge the board to proof this amendment but will to review how constituents are is heing assistant conditions and how these oversights are tracked. He have MISS Being, every khrj order chips way at trust and our budgets. Let make sure our planning is as strong as our steel.
119Okay I want to talk about jj2. Discharge additional days for a project this was schedule for 400, thz more than triple the timeline. While I understand the delays behind the control including foyer alarms, certification issues of failed inspections. How did we get to nearly 6 years of construction for a single elementary school? Where was the accountability during permitting? Inspection and scheduling. Our schools deserve safe, moderate, learning environments, not indefinitely delays. You urge the board to approve this with a full review how these sit back security and when safeguards are now in place from preventing this from happening again. Okay, I want to talk about which one is left from the agenda this I have not spoken about? jj5. And 8. I'm sorry just jj5. Speaker: okay, jj5. Okay, I pass on this one. Thank you.
120thank you. Any other public speakers? Okay. All in favor of approving the open agenda items that have not been pulled for discussion, say aye. Aye, any opposed say no. All those motions carry. At this time, MAY the chair have a motion and a second on item hh1. so moved. it been moved and second and moved by DR. Zeman seconded by MS. Thompson. Any registered speaker? Speaker: MADAM Chair, point of order if I can ask about pp1. I would appreciate if you would give me my three minutes. I would have to pull it and then postpone it for us to come back to it. So I'm happy to do it after item at 1:00 o'clock. so right avenue after? right after item 1. Speaker: thank you, MADAM Chair, I appreciate it. any other public speakers on
121hh1? no ma'am. MS. Rupert? Hh1. unlike the other items that I was asking about when it came to finances and job descriptions, I want to say this is a positive thing. Hh1, hh2, these two items have a designated amount and the budget to pay for these changes. Thank you. and I pulled the item, as I said, these are large increases to the job. And I understand the job has more things, there is more to the job. would you consider laying this on the table and asking the staff to go back and present that. we did that already, this came back to us before. and did we receive the compensation? yes, it is on a follow-up, sorry. That came to us. MS. Rupert? what I wanted to say about these two items, it that, it in
122the budget already for their department as compared to the other ones that came forward beinger there was no designated funding. So that's why I'll be supporting these two. Thanks. thanks. Any other comments? All those in favor. Go ahead. I don't know which one this is. I think it's second. or just on hh1 the we didn't pull they will together. okay, never mind. all those in favor of hh1 say aye. aye. all those opposed say no. no. roll call. roll call on hh1. alhadeff. yes. bulman. yes. cervera. no. hixon. no. holness. no. thompson? Rupert? Zeman. Fails. 6-3. okay, next item is hh2 can I have a motion and a second. Tt been moved and second by MS. Leonardi. Any public comment? no ma'am. board member comment, MS. Rupert. I spoke on it already. and I have
123same comments on hh2. Any in favor? Say aye. Any oppose say no. no. roll call on hh2, bulman? yes. cervera? Hixon? Holness. no. leonardi. no. rupert. yes. thompson. no. zeman. alhadeff? yes. item fails 6-3. MADAM Chair. yes, ma'am. can DR. Hepburn can let us know the consequences of board voting no on the last two items? MR. Hepburn? good morning, I'm going to turn the question to joseph, he's over in the department of workmen's comp. good morning, director of compensation. I'm very disappointed to hear the vote. We take it seriously bringing double item and we would not bring it if it was not critical to operations. We brought this over 12 years ago, we made a lot changes. These job descriptions were not developed base on what we thought the program would look like. We made
124a lot changes, single letter items. For the betterment of five years, for those patients waiting for this. You brought this to prior chiefs and again the timing is bad. I understand that. However these positions are, we do have incomebents on them, and if any positions do become vacant in order to attract and hire qualified staff at their current levels. thank you. MS. Alhadeff. yep, I have just, I think sometimes, I understand we want to save money but we lose more money in the back end because of the decisions this we're making. okay. Anybody he will? MS. Bulman? I'd like to echo MS. Alhadeff's comment. we're not looking at a ton money here, tt not going to solve the problem and we have to have confident people in certain positions. So, I think we should keep
125that in mind being penny wise and pound foolish, and I think that MAY be the case in this instance. if we're going to editorialize, the staff is welcome to bring this back. They not compel majority of the board to just this position. Make a betr case can come to explain to us in a different way, and bring the item back. I lock forward to seeing it if there is a compelling case, the majority of the board didn't feel like there was. even though we already voted on item. So I don't want to prolong. And we have a attorney-client at 12:30. I just want the same opportunity as every one else. I echo DR. Zeman, if there is more compelling anterior to support this, then bring it back with a revision. I think the concern was
126the cost, the salary increase, as opposed to when we're proriding the employees. I think it, it MAY be sending the wrong message to others, if we're going to change the job description, increase the salary by 10,000 or more, if other groups. I suggest bringing it back with some revision and we'll revisit it. MADAM Chair, if I MAY. yes. I just want to say that we presented, before, we pulled this from last meeting in order to respond and beef up the executive summary, we worked with compensation with this. The result this program have been if phenomenal I have shared this with board memebers. And I can only, I think this is, where we've seen over the patience going on five years, the people have been doing this. And again, it is not about the people it
127about positions but wove seen so many these go through. And the frustration and again as I said, timing, is less than optimal but this is, the, there is, there is always been a very positive return on investment of the staffing and this excessive bringing in-house at the will of the board, 12 years ago, I don't know when else we can do. If we have to show result more, you know I shared them with DR. Holness on his visits, I'll be happy to do so. thank you. Okay. Thanks so much. The next item is double f f1. Can I have a motion can a second on f f1? so moved. second. any public comment? no ma'am. real quick, I like to share. Thank you so much to the grants department and different schools. We had a
128big grant from the national nas, so for 629,000. So thank you again to every one who has participated in writing grants and receiving grants, that's great money that keeps coming back to the district. all those in favor say aye. aye. any opposed say no. Motion passes unanimously. Next is jj1 can I have a motion and d second. Moveved byby DR. Zen anand second by MS. -- -- public comment? yes, shoeman. I'll pass. MR. Cervera. this is a substantial amount of time. I would like to some clarification, what exactly is going on that is justifying the additional four-year delays, other than the fire alarm permitting issues? I want it confirmation that we're not incurring financial destriment by this four-year second delay after change order was previously approved. DR. Hepburn. justify MS. Paul and MS. Mac entire
129and karp enterer are back there. le thank you, MR. Cervera has hit it in the nail, hit the head on the nail. Or hit the nail on head, whichever. Yes, it is substantial cost involved when you have program that start in 2020 can we're just now getting to substantial completion SEPTEMBER of 2026, so yes, we do incur cost associated with the length of time it takes us to close our projects. thank you for that, but first part of my question what is going on? Why is this taking so long? It can't be this good folks working in broward county for these alarms are really taking four years. If they are, that's a conversation for another day. But I think the public needs clarification why this is specific. And perhaps the students and parents at this
130elementary deserve answers. Thank you. so the issue in this case is fire devices and so forth. But if you look at the length of the project. This is indicative of the smart program where there were delays at the beginning of the projects. And so this is a constant cadence of trying to close out these project that have sat for a number years. Now I'm not saying that work is not being done but it's not being done at the rate that I'm accustomed to. So this is the part the last adoration of trying to close these proj he can. So again, if you, if you go out for a bond, you've got to, hit it at the very beginning, uno and that didn't happen throughout this smart program. As I said repeatedliment so our nebt is
131to close out these projects and we've worked to closing them out issues. They're a myriad issues. I'm not going to sugar coat it. This is one those old project that we're getting close to closing out. And these are the last, part of the last adoration of things that need to happen in order to close it out. MR. Cervera? nothing further for me. MS. Rupert? jj1? yes. Project completion is JANUARY, 2026, hold on before you answer. Current completion date is 9-27-26 are they been pushed any further? those are the numbers that we're work withing right now. And one of the things, changes that I've made is our master schedule is being managed by adkins now. I appreciate that, disproportionate amount of districts are being affected. I don't wait to see issues with fire alarms certification, that
132should be something that is really tight and I am looking forward to getting past this with all our facility. But every process, every department of smart bond and into adfp, there is no wiggle room anymore. It got to be done. Tt got to be clear and it has to be actually complete before, or at the date. I would take before. So looking forward to seeing that. They've all been terrific to be structured and they live motto. board memebers I'm in but the general council please exit the room at this time. MR. Cervera, do you want to make a statement? for the record, I'm recusing myself from m legal meeting. thank you, MADAM Chair, I would like to request the school board convene an attorney client session in order to discuss litigation pending the before the
13317th judicial circuit in the following matter. consulting engineers, the sign ink versus the school board of florida and kathleen, the school board of county florida hearing hearing international inc. 134in the board room on the first floor of the administration center, 600 east. The attorney-client will take approximately 30 minutes. At the conclusion of the business, regular school board meeting will reconvene. All persons not scheduled to attend, please exit the room at this time. The regular school board meeting is now -- sorry, is now session). welcome back, this regular school board meet ising reconvened. Can I have a motion and saekd on item dd1. It's been moved by DR. Zeman, seconds by MS. Leonardi. Any public comment on dd1 yes, DR. Natalie lynch-walsh. good afternoon, DR. Natalie lynch-walsh, plantation, florida, former audit committee member and chair and member of the facilities task force. So, since I don't go to audit committee meetings currently, there was no other vehicle by which to alert you to this or to
135comment. A lot of work went into staffing and making sure that the staffing levels matched the needs of the program. You guys had a discussion at the last meeting about whether you could cutback on some of the subs, the problem is that on JUNE 13, 2023, when legal, staff and ftf said don't do this, you guys reinforced the 45%mwbe commitment instead of the 29 that was the district goal, but 45 is what aecom agreed to and that was a red flag, so this report, because there's a requirement on a quarterly basis to provide a 12 month staffing plan that evaluates each team according to the projected status of individual projects and the overall program over the 12 month period, it would have been nice to see the mwbe and other non-mwbe sub bra ekdowns by
136position, cost, hour over the life of the program and certainly that should have been in each quarterly review, as it turns aecom wasn't doing it, I don't know why. Anyway n the future as far as staffing goes, because this report, it should inform future actions, who does the reporting? Is it the cmaor? Because a construction angering agent owner's rep is not the same as a program manager owner's rep. One is focused on a project and maybe projects and the other one is focused on programs. So, there was a financial capacity threshold that was written into the solicitation in 2020 that required a working capital ratio of 1.5, it is possible that's too high and needed to be lowered now but that was picked up and copied verbatim into this cmaor which by the way policy
1377003 requires the school board to approve standard rfp and rfq forms. That did not happen here. I sent you guys an e-mail letting you know that mid SEPTEMBER, a cmaor is not the same as a pmor which means you now have a solicitation out in thatmosphere thahat you didi't prove that haa valuatioion critereria that might be appropriate for a pmor but not necessarily a cmaor and why are they doing that, did you guys decide this is a direction you want to go. You didn't have this conversation. Where it leads you to in terms of staffing because the aecom contract will be ending in JANUARY is rejecting all bids and figuring out how to keep aecom, not rejecting all bids presents a problem because you're violating policy and probably state law. thank you. Any other public
138comment? no, MADAM Chair. MR. Cervera? I'm satisfied. DR. Zeman? chair, I'm just fascinated that we have done this work, there's a lot of great results in here. I would recommend everybody that is interested in our performance in construction to look at this and I really just appreciate all the auditor's efforts on this project. all those in favor of item dd1, say aye. Er aye. any opposed, say no. motion carries ewe nan nosily. The next item we're going to do is pp1, can I have a motion and a second on pp1? It's been moved by DR. Zeman, seconded by MRS. Rupert. any public comment on pp1? yes, and thank you. Terry lopez price, career educator and local business person. I want to thank you very much for bringing the item back in a timely fashion and
139I do want to say that I have been coming here probably longer than most of you have been on the chair I believe the only one that was on the chair when it was my job to be here every single tuesday is nora rupert and there are some things that maybe she can bring to light about how certain things were handled, n the past because one of the things you are going to talk about is the decorum and I understand that some of the people who are out here in the peanut gallery, I'll call them, because sometimes they don't really want the hear what we have to say. When we have an unusual amount of angst, hand movements, things that we're telling you are being said incorrectly, there used to be a way for us
140to be able to bring that forward, for the chair to at her pleasure to bring that forward, in addition to these changes you want to make, think about that because it would be a noble thing to do. In addition to that, I would agree with many of the things, for example, 8 hours, heck, yeah, you can't go past 8 hours, I've been here to after midnight in those first two years, probably two and a half. The other thing that I need to really state is about the 3 minute sharing time. It's absolutely unconscionable in my mind that we would be not allow today share our time when we have come here and it's still the same amount of time so, you are taking away from a person to give to another person, perfect example today,
141the individual who I was going to give my time to probably wouldn't have taken the entire three minutes but I was then forced to use my three minutes and use them, I did. So, I don't think it's a good policy and I think that you might want to absolutely think that because most tof people here would agree with me that we want to be heard and if we want to donate our time, we should. Think about the committee chairs, there's a lot of rules I have noticed, it encumbers them, it's hard to keep them, it's hard to find them in the community and hard to keep them, so all those extra red paragraphs, I would think about that. The other thing I didn't have time to read all of it, I have never seen in
142redlining the fact that the chair of the communications and the chief of staff is one and all. It used to be that was a very large job, I remember when MR. [Inaudible] Was doing it and past chief of staff, that's a very large job. I would ask you to consider to give that person one job and not two because some of these communication things that are happening obviously might be due to the fact that somebody is being stretched thin, certainly please make sure we give them the proper money. In addition, I would like to say that I would ask you in your conferences when you speak that you ask nora rupert how we would have our hand signals that when something was an absolute lie, we had a way to tell the board and you
143would let one of us come up to explain what the lie was or where you were being misled and I will remind you that other superintendents have left or have been fired or gone for a number of reasons because people below him, beneath him were telling him things that were not true. We have spoken to each and every new superintendent since MR. Munsy about this happen and is we're asking you to be aware, they are not being told the truth all the time, you are not being told the truth all the time and whoever gave me five minutes, thank you. next public speak ser DR. Natalie lynch-walsh followed by DR. Trudy jermanovich. natalie lynch-walsh, plantation, florida, I agree with terry, procedures related to advisories, take them out. You're referencing documents in there that nobody's ever
144going to follow because they're insufficient for the task and by your own admission, you shouldn't have procedures in a policy and these are thing that is are definitely procedural. And he venn if they weren't, they're cumbersome. The the sharing of the minutes, agreed totally, put that back in. I cannot tell you how many people offer me three minutes but I can't take them because we don't pool minutes anymore. What is the harm in it. You saw today that you then ended up having to listen to more speakers because of -- because you wouldn't let them pool their minutes and oftentimes when the person who is speaking on behalf of someone else is able to communicate and articulate the issue at hand better than the person they're speaking for and that is why they're given the
145three minutes, what would not be the goal of allowing that to happen, so you can be misled more easily. I agree the chief of staff and the communications chief should not be the same person , and then finally the addition of the superintendent shall maintain a follow-up list of board member's questions, progress monitoring and requests and share the list with a date with follow-up response within 48 hours of the school board workshop or meeting. I have language that would untangle that sentence and make it clear and I do not this think f this would cause you to go back, the superintendent shall maintain a follow-up list that includes for each item an initial target date for response or completion and subsequent progress monitoring related to school board member questions, requests for information or action, consensus
146or motions. The follow-up list shall be submitted to the school board within 48 hours of each school board workshop meeting or public hearing. That is clear and it specifies what the progress monitoring is or isn't. The way it's written now, they could give you progress monitoring for students or something because it's not clear that it's the progress that they're supposed to be reporting on the follow-up item. So, I hope you'll consider dinging that in. I have it typed out if anyone wants to make that as a motion. Thank you. before I start my time, mary furdic is running in the parking lot right mow and she'd like the speak on this item, so please hold off for her, thank you. Name is trudy jermanovich, I'm concerned for the sections on pages 13 and 14 regarding
147committees. Many of my comments, I could copy from the several other times we've looked at this particular policy. I would hope that the superintendent's task force recommendations would be followed, they specifically addressed most of the redline sections in policy 1070 except for the miep noer -- minor ones like the chief of staff. Regarding the many owner rules such as committee chair tos provide a report if they are not in attendance at the meeting. I believe they should just give you the minutes on a monthly basis just like you do to us. I don't think you should put a time limit on them. Also I think that you can't dictate what they're going to say and that's what that red line says and I thought we had taken that out. The second or the third time
148we talked about this. The school board often does not provide the public with their minutes until several months after the meeting, so why would you make the chairperson do it the day of the meeting. It just doesn't make any sense. Also it's good practice to have the template that you were supposed to attach to this but as is often the case, we don't get the apent seize, -- appendices, maybe you did, but we did not get it to the public. That should be changed especially if you are going to attach it to a policy. You could ask for the committee chairperson to let you know by 8 A.M. If they can't come but I don't think you should put anything in -- those are all procedural things, I don't know why you have that section.
149For the decorum section on pages 14 and 15, the redline in item 1 is redundant with the other parts of the section, so in other words, again, I think this policy is not ready to be passed because there are many things that I'm sure a lot of people if this would have been held a little late ner the meeting might have been here for because we had to inform some of the people, it wasn't clear that it was going to be brought up at 1:00 which is great that you did it but we need to kind of make it clear to the public that that's going to happen when it does. Thank you. and our last public speaker is mary furdic and jackie lescom. just to address why we changed it, we lad a request
150from someone in the public, so I guess we just can't make everybody happy. respectfully, others of us had to scramble several miles. And I have a handout that hopefully that hah reached to, jackie, ese advise have I chair and representing the steering committee. There were unaddressed issues in this draft that we'd like you to consider, a summary, page 1, and on page 2, it givers detail of that steering's feedback from last friday that was created by the chair. Because the board has not been looping policies through advisories as policy 1164 or 1920 allows when there is relevance or potential benefit to doing so, that's made it hard for stake hold teaser provide comprehensive feedback, this coupled with staff tweak and is errors, this is policy repeatedly come toing you in a fashion making the board
151look bad and denying open stakeholder input. Last week's polity 1070 workshop reversed unsanctioned staff proposals, error and is controversies. You're in a position of having to pull through content and detail when that needed to have already been better hashed out so you could be rubber stamping today and moving on. We strongly urge you take that charge of your rule making process, you decide when things get looped, you loop this one or workshop it again because it directly addresses issues of parent and community voice and involvement. That will allow it to go through a slick collaborative process and line by line decision, precision before it comes to you. Some of the issues to alert you, 1020 as you'll see nr the summary t the chaos in the executive summary. Let's just say this tl 's 2.6
152million reasons why executive summaries need to be correct. Sadly the main budget of the draft has incorrect references to them being quarterly and not monthly. Additionally page 14, section 8, part e, e-mail address is incorrect. The appendices were not reviewed with advisories and they weren't attached with the redline. Reviewing with advisories could have resulted in a mutually purposeful format, instead despite representation from the superintendent task force to which you folks all appointed, representatives, staff has just represented unworkable forms they drew up without us. There are other tenses listed on the summary I have given you, my time at the mic. Won't give you that but I think going through this now is not going to be a good use of volunteer or board time websinger would like to appeal to the end of this policy
153of bringing policy drafts of bringing errors, sloppy amendments by staff and a lack of collaboration. Your stake holders are not creating havoc, we're the ones objecting to it and wanting to pre-empt and panic it, let us assist the process. Thank you. thank you. And our last speaker, mary furdic. good morning, afternoon, whatever, I am here on behalf of the now sunsetted superintendent's task force, cynthia could not make it today and reached out to me and asked if I would mention the conversation we had at our last meeting on OCTOBER 30th and so we just want to make sure that in your final policy and I think this was expressed last week, we really would like to see the list of motions/recommendations/what are brought to you from committees just -- if there's a list somewhere where
154people can refer to it on your website and there's some type of a process for putting things on there and just letting the public know how they're resolved. The issue of -- and thank you for listening to us when we came previously and talked about monthly versus quarterly and there are a couple of places as jackie just referred where you still have -- you have monthly in some and quarterly in another, so specifically page 14, number f, you refer to written reports coming through f three days prior to the scheduled quarterly school board workshop so you MAY just want to change that to monthly, and on e, just before that, if you go back to the top of the page, you talk about -- you know, you mention in here that advisories can come to
155your meetings and give reports and is that's great because that's what we wanted to see, if we f they have the option for them to see that if they want to come, keeping mandatory for them to have to come. You have the written report and is you have underlined them here, each advisory committee shall electronically submit their written comments if they will not be present so that's contradictory to the -- they MAY come, so you have MAY in some and shall in others and I would ask that you crediting that so we know exactly what the intent is and we can make sure we do it. And of course our recommendation was you have them on the first workshop as you've been doing, na's been a great change, but it's not a mandatory if a
156committee doesn't have anything to share. So, I'm going to go back and look here. Yeah, you have MAY on a, shall on e, monthly on a, so if you would just reconcile all of those f you don't have time today, I think you see the suggestion was to bring it back a -- at another time and maybe have a time certain. Thank you. that con MADAM Chair, am I the only speaker on this item? i'll go last if you don't mind. DR. Zeman?Frjts sorry to blow DR. Sullivan's conditions, first is on page o of the redline, in letter h, we say both that the superintendent will select a pro tem and then in the next sentence, we say that the most recently served chair will preside over the meeting. My motion is to strike the
157second sentence of paragraph h on page 2 of the redline. I have a question. I think the clean version is the one that's -- we're voting on, so shouldn't we be making changes to the clean version of the redlined? I only brought the redline, so I'm sorry. not evading -- everything in the redline came across. Er I have asked for red loins na are really redlines 27 times and I still don't get them and I don't understand what I gotta do to get them. A redline is you take one document, you take another document and you hit microsoft word compare and a redline doses out and everything is marked out, this format costs us a lot of time and I'm wondering, chair, what do I need to get a redline rather than hand jammed documents
158with errors? DR. Hepburn? I'm looking at a redline version off the agenda right now so I'm trying to -- if you can specify. what is a redline document, my lawyer friend? if you can be specific t redline document that is on the agenda right now as there is discrepancies, issues, concerns with that line so staff can understand the specifics of what needs to be corrected. as far as what you just said, I'm ing to answer DR. Zeman's quqution because I don't t hahave y specifific commmments ye I ththink I I MAY,y, I think the frustration that we see as a board when we get these is traditionally if you're going the insert new language, it will be underlined and it will be in a different color font. What's happening here is it looks like someone's
159just opening a microsoft word document and just typing in a different color and not following the standard procedures that you would see in the editing process when you go back and forth in contract world. So, sometimes it's hard to follow with -- follow along and I share your frustration. I print out both and I look at them side by side so I have a better feel sometimes as to where we're going, but I think what DR. Zeman's frustration is we're not following the traditional editing format in contract world as far as the edits one would see when you have different versions of documents going back and forth. a redline version is like a real thing. It isn't going in and changing things by color and striking through other things, it's taking the original policy, taking
160the revised policy and hitting a magic button that produces a redline. There's never a mistake in that document. So, to the chair's point, whether you look at the clean version which I have got up online or my redline that I brought to the board meet tog prepare, they both say the opposite things, the second sentence in h is if the chair and vice chair are absent, superintendent shall select a pro tem. The third sentence is at the event of a chair and vice chair absent, the board member with the most served as chair will preside. Both thing cans not be true. What I think we decided last time is the person with the most experience as chair, most recent experience as chair would serve as the chair, so my motion is to -- it's already
161been seconded by MS. Leonardi I think, to strike the second line. agreed. any public comment on the motion? agreed. Natalie lynch-walsh, plantation, florida. We all remember DR. Zeman said that last time and you guys having a discussion and the second sentence and, yes, it should absolutely be struck through, so I support the motion but the larger issue is everybody just brought up issues that are more than scrivener's errors, do you really want to sit and go through this or do you want to send it to the advisories -- will you just speak on the motion. they're related, I'm trying to save you time, but okay. this is kind of on the motion, thank you for saying exactly where you are in the policy and, yes, e brought my redline and don't have the clean --
162I'm assuming that's okay, if you can state the page and the paragraph, thank you so much, DR. Zeman. thank you, DR. Furdic. yes, but just a warning, this is going to get incredible le tedious a workshop is the best place for this and looping and we can help you and help you crafting a whole thing. Er I'm speak tog the motion. no, you're not. all those in favor of the motion, say yea. aye. any opposed, say no. Moeg passess. Inger thanks, chair. On page of 18 on the redline, heading 7, public participation under a, I appreciate kind of the jep format of being very policy-like in this, but I'll tell you there's something missing from this document in my own view which is the school board encourages public attendance at our meetings and desires input
163from the public, period. And I appreciate everything that tells them what they can't do and how quickly they have to speak and how they could be interrupted and what they can't insult me and things like that, all this is about what they can't do and tightening up all the rules and I know why we need to do that but my view is the policy of broward county schools is we encourage the public to attend and encourage them to speak so, my motion is on the first sentence and a under 7 would be to add a sentence that >> MR. Seawards: says the school board of school board encourages public attendance at our meet advising desires input from the public, period. second. public comment on the motion? I'm sorry, could we get a pdf page number
164on that, please. er I apologize, do you want the redlined version or the clean version?Frjts I'll take the red font version pdf. red font veerbacker version, thank you, it's page 8, heading 7a. I'm trying to insert a sthaents says what our policy really is which we'd love people to come and talk. public comment? so, it's on 7a on page 8? yes. and you want to add the chair -- you're going to rewrite that? I think I agree with it. I'm just trying to see where it is in here. But I agree, if you're trying tog get rid of procedural stuff, it would seem to be appropriate. So, I agree with it. indeed I see you're heading your hands but we were urging a separate process to deal with this. I would also point out a
165school board doesn't have executive authority to determine deaf facing, that's judicial determination, so if you are talking about taking out language about that, I love DR. Zeman's proposal, thank you. thank you, board member discussion? DR. Holness? thank you, MADAM Chair, just from my understanding, in the red font, redlined version, whatever we call it, on page 8 for DR. Zeman, are you -- are we just adding your sentence, DR. Zeman, we're not taking away any of the red font that's there? yes, sir. okay, thank you. DR. Zeman, can you just repeat what your motion is. school board of broward county encourages public a ttendance at our meetings and desires input from the public. and that would be in a right above -- first sentence of a. okay. So, we're adding, not taking anything out. yes, before
166that sentence before the chair. thank you. Any other board member discussion? All those if favor, say aye. aye. any opposed, say no. Motion carries. thank you, chair. And to my colleagues and to people here, apologize for not bringing typed versions, I wish I had taken the time to do that and I'll continue to do it when I have this long list. On 9 of 17 in the red font version, we have an opportunity I think to carve out an exception for elected officials in broward county. I think if the property appraiser t mayor of danga beach, county commissioner, state rep, state senator want tos come and talk, I prefer to give them five minutes and i prefer them to speak first, so my motion is on page 9, new letter c under 7 a-2, so
167it will be c, broward county elected officials are encouraged to attend school board meetings. When they do, the school board will allow them to speak first for five minutes each, period. second. any public comment on the motion? thereafter second? -- there was a second? okay, natalie lynch-walsh, in theory I agree because it does look bad when I have seen pub loik officials sit here all day wait tog speak on something. And granted this is public speaking. However, it then gets to be a slippery slope because the same is not afforded to say committee chairs although if you go along with carving that out of the public comment section, I guess we have to take baby steps so I'm not vehemently oppose today hearing them speak, but yes, I support the motion. any other public comments?
168Board member comments? I don't mind, and really as a xhair, if someone like an elected official comes, we don't typically stop them when the buzzer goes off, I just wonder how that comes across to the general public speakers who are here and saying fo tha the elected officials should go first, so I'm not sure how I feel about it but we'll see how it goes. Okay. Anybody else? All those in favor of the motion, say aye. aye. any opposed, say no. no. do we need to do -- I don't think we need a roll call but go go ahead. roll call on the motion, school board member cervera? yes. Er hixon? no. holness? yes. leonardi? no. rupert? no. tofrn -- thompson? Zeman?Frjts yes. Er hall deaf? yes. bulman? no. fails 4-4. on page 10 of
169the 17, I think this is just a typo, I'm going do three things all in one motion because they're pretty straightforward, I mover that the number 4 become the number 3 because we struck everything in 3 before, so we need a new number there. On the sentence that says members of the public must access the portal registered to speak, I think that has to be a can because they can also come here and register to speak, I don't want to mislead them. And on the next sentence, two sentences later, the speaker's name, city and e-mail, I think to follow and be consistent with our policy, we need the ask for the name, lobbyist designation, city and e-mail when they register to speak. can you say that, so you're just adding lobbyist to that sentence? designation
170between line and city, the must is a a can because we have two way tos register to speak and then 4 is a 3 really. Page 10 of 17. okay. Any public comment on the motion? DR. Trudy jermanovich, yes, you agree with this, the portal often doesn't work, so we need get that working and then also it's -- I don't think it's clear to the public that they can come here and sign up to speak and so if you can somehow figure out thousand ---- had you to do that any time during the day, terry thought she had to come here at 8:00 this morning to speak, so there's some miscommunication. natalie lynch-walsh, I agree with the motion, you can't have a can for something that doesn't -- it should say can or MAY, not
171must, if it doesn't always work, and frankly e even when it does work, I have sign you had up to speak to not only have my name read. Related to this section is also -- and the 1 P.M. Failed to preregister by 1 P.M. Tha, presumes something hasn't been added so what do you do if they add something right before but you can't comment on it now? That's in here too. I'm just saying, so anyway, I support the motion but even with a MAY, it needs to work all the time and it does need to be clear how they go about if they come here and sign up, the whole process needs to be clear and of course this is starting to sound very procedural in here on this page. I support the motion, I
172think DR. See ma rn's suggestion regarding the portal is particularly important, not only because sometimes it isn't working, for folk that is are unfamiliar with it, I'm not sure if you tried getting in on it yourself, you click on how to sign up to submit public comment and you are taken to a 7 page pdf manual, walking you through 7 pages of steps in order do so, thank you. any other public comment? Board discussion? All those if favor of the motion, say aye. aye. any opposed? Motion passes. on page 11 of 17, chair, and the letter e, page 11 of 17, letter e, middle of the page, I have a question for a legal expert. We say that defamatory comments or personal insults against individual ares not permitted. Is this a violation of the first
173amendment or any other law that -- where it limits words that are spoken at a meeting like this? MS. Batista? no. thank you. Page 12 of 17, number 2, this is 2025, I think to have something like a two hour window is going to preclude people from being able to speak, so my motion is to switch the two hours to two minutes. If there's an item added within 24 hours, I would have preferred zero minutes, two minutes is plenty of time to get their name on a list that electronically shoes up with MR. Hill and allow people to talk. I'm always embarrassed when we add stuff that late, I don't think it's good policy to do that f we add something that late, we should open up the door and let people come and speak,
174my motion is to replace hours with minutes on page 12 of 17 on number 2. is there a second? second. public comment? trudy jermanovich, make sure the additions get put on to the website timely -- in a timely fashion as well. Thank you very much and thank you from all of us for putting that in, thank you. any board discussion? I just have a question. If they're sending written comments on agenda items, I would just say we used to get written comments, we haven't gotten them in a little while, so I think it would be important that you remember that you're supposed to send them to the board. But how would that get on -- there's no way within two minutes we would have that electronically. and if I MAY, I want to remind the
175board you have access to real-time written comments from the public within your legislate portal, if you want to legislate portals next to each item, there is a bubble and basically that updates in real-time taz public enters those written comments. Er I understand that but we yao u used to get an e-mail with them. it's also part of the minutes. it doesn't help us when we're in the middle, but -- the board doesn't want to use the I legislative feature, we can go back to do it the other way, it's within the I legislate. we sdrnt -- didn't have that feature. all tloez in favor -- MADAM Chair? I'm sorry, DR. Holness? so, staff mentioned that two minutes -- it MAY not be doable for them. So, I just wanted to get their feedback on how
176much time would be -- DR. Hepburn? MR. Sullivan? we can try an hour but -- I mean, so, we have never stopped anyone from signing up to speak. this is specifically about written comments. if it's written comments, then, yeah, I would say at least an hour, we would not be able to process that within two minutes of a meeting. the vice chair has a question. MS. Leonardi?Frjt I'm wondering so everyone can understand, what is the process of doing that because we hear some people in disbelief that it can't be done within two minutes, help walk us through that process so we can understand where you're coming from. gro xwo ahead. tluz the chair, the process basically to the timelines is within the granicus system, it sets the time limits as to how or when a
177member of the public can submit a written comment, we have to go in and set that timeline for the entire agenda. If an item is added after 24 hours, then we have to reset the entire system for just that one item and then pull the report and then close the system which staff needs time within granicus, it is a great system but it's not that quick to be able to accomplish those particular tasks in that amount of time. okay, thank you. MADAM Chair, I had one last question. DR. Holness? DR. Zeman, are you willing to modify your motion to reflect the concerns of the staff as it seems there's a concern. I would love this to be feasible. In reality, when we add agenda items one day before a meeting, we are surprising everybody in
178the public with what you're doing, our rule is to do it far greater than 24 hours. I want people to come to the meet hating walk in here that all of a sudden get susurirised, to ve the ability to leave a comment. It's a secondary concern to me is time, I I MAY read them after the fact, I MAY bring an item back, I feel it's disrespectful to spring items on people and then give them some deadline, we're going to read their comments two hours before anyway websinger ear in the middle of maybe debating and reading and getting things done up here so it's not about are we going to necessarily read it ahead, I want people to be able to come and leave their comment. They could lever it by the end of the
179meeting but I find it not a fair practice to jam them with an item and then we jam them with a two hour dead lao ib. If they come here at a time certain, at a 2:00 time certain and then all of a sudden something is added in the last 24 hours and is they have a life and they're raising their family and working, and he ear like, I came hire time certain sxit's combining up at an hour and minutes, I can't leave a comment, I'm going the leave it at two minutes. If that comment goes into the sxrord we see it laet -- late ner the meeting or the next day, at least the public has responded today what we've done and I'm averse to adding and making changes that late because it seems
180so unnecessary and just not the way that I would tliek treat my neighbors. okay, any other board comment? All those if favor of the item, say aye. aye. all those opposed, say no. no. roll call. I think it failed, I'm good. yeah, well, go ahead. school board members hixon? no. holness? no. leonardi? no. rupert? no. Er thompson? no. zeman? yes. alhadeff? yes. Er bulman? no. cervera? it's all good. 2-7. page 13 in the red font version, 8, capital letter b, the second sentence, the committee's verbal report shall be limited to five minutes. I think the chair always has discretion to allow if there's like a hot topic or a great presentation that needs to be made to do that so I don't feel like we need to have the words unless extended tat chair's discretion
181there because we don't have it in other places within the policy, lever the words unless extended at the chair's discretion. is there a second? okay, motion fails. great, page 14, 8, capital letter g, appointees of school board members must continue to regularly communicate, I'm not going to tell volunteers they must do anything, I want them to come and contribute but I'm not comfortable with the must word, so I would make that strongly encouraged, they're strongly encouraged to regularly communicate with his or her appointed school board members. second. Public comment on the motion? natalie lynch-walsh, if you read the very last four letters of that sentence, it's the number's 1070, so that's in 1070, so that means you would need to change it in 1070 about must continue, I totally agree that you should not --
182if you start telling volunteers what they must do, then you run the risk of calling them being your employees, how you do it, the definition of the employee and maybe b you have to pay them for what they're doing, so however just pay attention so you do not have two policies contradicting themselves just like we have sentences contradicting themselves. If you intend to change this, you then have to change it in 1070 for the two to be consistent. They should -- the idea was that they should xlaoun kate with each other because why else do you have an appointee to know what's going on in the a committee, but please pay attention to policy 1070. any other public comment? thank you, and aside from me, contradiction with 1070 that I won't repeat, the very purpose
183of your appointees is that they e are a bridge between the advisories and committees that they're appointed to and you folks. If they're not talking to you folks, this ear not serving a purpose, so I would strongly urge you to retain that. We need them to be communicating with you and you with them and we know that's not happening at the moment. It was nice to see it emphasized in policy 1070, we need to be re-emphasizing that so we have that mechanism working but absolutely I think they should, must, you can't must a volunteer when that's the purpose of their appointment. the MAY's and shall's in this entire section seem to be contradicting each other and I agree with you on this, as strongly encouraging people, what are you going to do when someone --
184when will l's an arbitrary judgment that someone hasn't necessarily kept you aware of tha efrg's been happen ining every single committee, so I would say go back to this entire section and get the MAY's where you know they should be and thank you. board member discussion, DR. Holness? thank you, MADAM Chair. So, DR. Hepburn, can you reiterate what would be the purpose of having committee appointees as school board members? DR. Hepburn? to reiterate why the board should have committee appointees? okay, and wouldn't that necessitate communication? yes, it does, but it is the board's committees, not mine, so I want to remind you. I understand, but the purpose of a committee appointee is to be able to for one, and there are other reasons, but to be able to communicate with board members as to information
185being discussed within the committee, so communication is the key part of that volunteer role. yes, I concur, there needs to be communication. for me as a board member, I meet with committee members formally through schedule at least once and then I encourage them to speak to me at any time so I believe the communication piece is essential so, I think must is important to be there because if I appoint you as a committee appointee and even though you are a volunteer, the essence of what you're doing is to communicate with me and then you MAY communicate means you don't have to, and that's not the purpose of you being appointed, so I believe b in this particular case, yes, we appreciate volunteers but this is a part of the requirement of volunteering, you know, so
186I would prefer we leave the word must. any board member discussion? All those in favor of the motion, say aye. aye. any opposed, say no. no. okay. It sounds like three no's. So, it passes 5-3. I just feed to know who the no's were for the minutes. MRS. Rupert, there's four, let's take roll call. roll call on the motion, school board member hixon? yes. leonardi? no. rupert? no. thompson? yes. zeman? yes. alhadeff? yes. bulman? Cervera? Just a yes or no. No. Hixon? yes. you asked me first though by the way. through the chair, you get two votes. the chair gets to vote for me. I didn't call -- I'm sorry, I didn't call holness? no. so, with that, it fails 4-4, sorry. chair, that's all I have, thank you. thank you, I will jump to
187mine since you've deferred, so I did type mine out so I have a couple of motions, no offense or anything, my first motion is on page 2 and I did mine on the clean version, so not to confuse anybody but I will stay with the red version, I think it's still on page 2. Yeah, section I where it talks about the superintendent, this is just a suggestion to clean up the wording because it is a little confusing in terms of when it says progress monitoring so I kind of took that part out all together and called it ongoing progress updates instead of progress monitoring, so that there was no confusion as to whether it was about student progress monitoring for this, so my suggestion is the superintendent shall maintain a follow-up log that records each
188school member's question, request for information or action, consensus item or a motion along with an initial target date for response or completion and ongoing progress updates. This follow-up log shall be provided today the school board within 48 hours following each school board workshop meeting or a public hearing. So, just wordsmithed that a little bit. second. Er it's been move and had seconded, any public comment. natalie lynch-walsh, that seems to capture if there's an initial completion date. an initial target date for response or completion on ongoing progress updates. and within 48 hours, yes, I obviously would support that motion and that clarifies because before it was unclear. Thank you. okay. Any other public comment? I just wanted to thank you, this is definitely responsive to what we had asked for as the task force for follow-up,
189thank you. Any other public comment? Board member comment? DR. Zeman? tell me about the consensus item or motion. so, when we're in a workshop setting, we have -- we could give consensus to the superintendent to do something or maybe there's a motion that's made during a board meeting and this is just all of the different things we could be asking -- in ways we could ask sk the superintendent to bring us back?Oftion I try today capture all of them so, that was really clear what the expectation was. okay. not just questions. sure, I understand. Thank you. okay. Anybody else? All those in favor of the motion, say aye. aye. any opposed, say no. Motion carries. The next motion is on page 12 of 15 which MAY or MAY not be the right number here. Let's
190see. section 15, no, section e on that page. So, no. It's not the right one. It's -- so, like I said, mine was the wrong page. If you go to -- I guess it's page -- page 14. 14 of 17. So, sorry about that. I worked on the clean version. Both e and f say scheduled quarterly school board workshops and we as a board agreed to keep them monthly, so on both e and f, it should say monthly, not quarterly. And also since we're on e, the e-mail address is incorrect in the policy, it has two I's instead ofp two e's on committee and there's a space in between the o&m, it doesn't look like it, when it gets cut off there, when you copy and paste it, it shows the space in between. is
191that all one motion, chair, second. Er aisle make 2 and 3 all one motion. Er I'll second your motion. any public comment on the motion? again, thank you, that cleans up the items we were speaking about on page 14 of the redline on e and f, thank you. okay. natalie lynch-walsh, again, this is very procedural, let say next superintendent develops a portal and now you're not sending an e-mail at all, you're able to submit motions through a portal. Now you have to change your policy strictly to get rid of that or you could strike the procedural language and just indicate that there is following the process in such and such manual or whatever, however, I do appreciate you fixing the quarterly to motherly -- monthly and the multiple scrivener's errors in here. I would also
192like to point out in here new york city wr in this meeting policy does it speak to the quarterly meetings advisory chairs have with the board. alright tha,'s not part of this. but it could be, there's limited place where is -- so, anyway, I support the motion and appreciate cleaning up some of this, I'm just pointing out a couple of other things. okay, any board discussion on the motion? all those if favor, say aye. any opposed, say no. Motion carries. Almost done. On page -- please don't make a comment. I was here to give public comment on that. I didn't see you standing there. it's kind of mute now, I wanted to -- wem, -- welt, I wanted to draw attention to the fact pursuant to what you have suggested, there is a next part
193of the process, the whole process for considering and getting back to advisory recommendations isn't just limited to that. I'm getting to that, that wasn't part of this. I'm sorry, I apologize, we're wringing off a list that's just been handed to us and it doesn't have any further part listed on it. It's very confusing. MRS. Rupert? I wanted to see if I could bring the item back. what item? well, bring the motion back, didn't we just vote on the motion? we did vote on it, yes. Er ye, we did. Thafrjts's why I -- it passed. yes. A motion to -- reconsider. Er reconsider this particular item. okay. is there a second? second. okay. Go ahead. what did you want to -- I'm sorry? all those in favor of bringing the item back, say aye. all those
194opposed, say no? no. wow. last time we thought that too and then it didn't, so if you don't mind. Roll call. roll call on the motion to reconsider the motion, school board members leonardi? no. Er rupert? yes. thompson? no. zeman? no. alhadeff? yes. Er bulman? Cervera? yes. Er hixon? no. Er holness? yes. 4-4, fails. okay. So, the next motion I would like to make is my number 4, my page numbers are wrong again, it's still page 14 of 17, so in section f, this one's pretty simple, under section a, there's no period at the end of the section, so it says by policy or resolution and there's no period, so, I would like to add a period to that and then I would like to add a section b which would read each committee MAY
195prepare a one page summary of any committee recommendation to be shared with the school board. This summary will include the recommendation and n&a brief explanation of its purpose. The summaries will be forward today the chief communication sxaufrs be included in the school board workshop agenda. Each committee's recommendations will be identified along with the corresponding summaries and available to the public and I would just say that's verbatim what was sent to the chairs in JANUARY, it is the process we already use but when we had the discussion last week about 1070, it referenced that the procedure would be or the process would be outlined in 1020 and it's not. So, that's why I'm recommending we add letter b. second. public comment on the motion? thank you, this was very thoughtful and well thought out, I appreciate
196you getting it in there, thank you. thank you. MADAM Chair? yes? in the motion, are you asking that the committee's report be attached as -- attached to the agenda. I don't think it would be appropriate -- it's not the report, it taoes recommendation and is that's what we do now, if they have a recommendation, it's attach today the agenda so the board members can read it. yes, so there is no issue with attaching it to the agenda, I want to make sure that the agenda is normally the superintendent's agenda of what is being proposed or recommended to the board member and is I just don't want to have any confusion between the two. yeah, and it's what we've been doing soit's just attached as I guess a backup. just clarifying. yes, thank you. the board
197was told about house visory cocommdations arhandleled is inin polic 20, it isnochunks are missing from 1020 and this whole process needs revising if it is to be made effective. Your proposal goes the first step towards that, MADAM Chair, but this was among the superintendent task force's recommendations that have been overo looked or ignored. Also at district advisory policy subcommittee last week, we crafted a proposed process based on the task force recommendations and the policy 1.7 committee recommendations from 2022 that could work for everybody, that is what I e-mailed last night, I think the chair also e-mailed and I also handed it in, thank you. thank you, any other public comment? natalie lynch-walsh, color me confused. I appreciate you adding this, but does that mean because this is on a workshop agenda I think -- yes.
198so, a school board workshop agenda, it's okay to have an attachment to the board item for committee reports that have any motions, bad word, recommend davies but not the committee report. I get this is adding a recommendation but are we saying you can't also add the reports from the committee? I'm just trying to clarify. first of all, I don't think -- we have not received a written report from a committee that I'm aware of since I've been chair, but we have received recommendations and attached them to the workshop, we ever been doing that since JANUARY. Er I get all that. this is just codifying what we have been doing. and I guess I heard what -- and remember MS. Batista is leveraging you, whatever advice she's giving you, the next person could change. It sounded
199like she was staining that recommendations can be attached but not reports. MS. Batista? no, I wanted to make sure that the recommendations of the committee were not actually part of the agenda proposals from the superintendent, so that there wouldn't be any confusion between what is being recommended by the committees versus the superintendent's recommendations on the agenda. correct, and they're always identified as -- and since this is happening at a workshop, then there shouldn't be any -- under a committee agenda item, it should be clear. thank you. Any other public comment? Board member discussion? All those in favor of the motion, say aye. aye. any opposed, say no. Motion carries. I have two more because one popped up while I was sitting here. The next incliner attachment b, the e-mail is again incorrect, it should be
200committee with two t's and no space in between the sxo, the m on dot com, soy mover that we correct that in attachment b. second. any public comment on the motion? natalie lynch-walsh, plantation familiar florida, we should be strike attaching tafpment b all together, these are procedures that nobody has any intention of following because they do not align with the committee's needs so, you can put them in here, it doesn't matter if the e-mail address is correct or it has six I's in it, the bigger issue is the attachment itself and you have an attachment a and b that are "templates" or direct I fevers but they are procedure that is you are notbacker now attach tog a policy which you don't want to do, vuld your procedure manuals separate, you can reference it but
201understand by attaching it, now it becomes part of policy. So, I'm pointing that out again. I apologize, I just received a text from the person I'm here representing. Can I read that to you? is it on the motion? it is. And I just want the make sure that what -- okay, so you can say that I was speaking. Here's language dac crafted for recommendations. Mitt tie recommendation process one, approve the committee recommendation shall be e-mail today the office of the chief of staff in acknowledgment of -- this is just on attachment b? yeah. The recommendation shall be placed on the next workshop, recommendations MAY be sent to relevant department do, you feel any of that? it has to be -- my motion is to correct the e-mail address on attachment b. okay, I'm sorry. thank
202you. okay. thank you, correcting the e-mail would be great but our case has been that getting rid of appendix b all together would be what one should strive to, appendices b and c re f recommend what advisory ares slivering for and they make us use appendices b and c would contradict the policies declared goal of ensuring greater structure, consistency and efficiency. any other public comment, board member comment? All those if favor, say aye. aye. any opposed, say no. The last one I just noticed on 14 of 17, number 9, decorum in letter a, it says in advance of receiving comment from the public, the chair shall read, the chair does not read that prior to the public comment anymore, so I think this a should just say the rules for expected decorum are as follows
203and then it states the the rules because chair doesn't read that. Any public comment on the motion? natalie lynch-walsh, that's fine, I thought you were going to remove the unnecessary comma after the word read, anyway, the whole decorum section is problematic but that's why we have state law that allows you to petition for rule making. any other public comment? Board member comment? All those in favor, say aye. aye. any opposed, say no. Motion carries. DR. Holness? MADAM Chair, all my concerns were addressed, thank you. MR. Cervera? very briefly, what seems like an hour and a half ago at this point, there was a comment made by a speaker regarding mrit tee reporters not being posted on our website. I feel like I've had this conversation before and I was told that the committee reports are
204in fact on the district website. Can I get some clarification on that, please. DR. Hepburn? MR. Sullivan?Frjts I don't believe we received any committee reports. The committee report ares typically done motherly -- monthly at the workshop verbally. we haven't received any committee reports or done verbally at the quarterly workshop. Or the motherly -- monthly workshop. they don't exist on our website, correct? correct, because we haven't received any. any other board member comment, all those if favor of item pp1 as amended and I'll ask staff, have you captured all of the changes? yes, ma'am. okay, all those in favor of pp1, as amended, say aye. aye. any opposed, say no. Pp1 passes ewe man nowsnosily. MADAM Chair, are any of those changes substantial? there are a couple that are, it's just going to be a notice
205of -- that has to be published. Er it will come back in DECEMBER. it MAY not depending on the notice, I'll work with staff on the notice. sorry, what does that mean? if all the changes that were made and there MAY have been one by MRS. Hixon that was never discussed before at any prior workshop, then when you do the notice of change tha, MAY not be sufficient, it MAY have to come back anyway, but if they were all discussed before during the rule making, you MAY not have to return to the board. I'm sorry, can you speak in the microphone, I can't hear you. I don't know how much closer I can get. has's -- that's better. if all the changes made here today were previously mentioned in rule making, I believe one of
206the changes, maybe all of them were, then all would be necessary, even though they're substantive would be a rule of change to be published but the policy would not come back because it would be done as of today, basically it would be completed. okay. and MR. Sullivan, I think the item she was talking about was the b that we added but if I'm not mistaken, we discussed that in the JANUARY workshop when we were -- so, if you could check and make sure, I think we did discuss it. we'll check. thank you. Okay, the next ie em is jj9, can I have a motion and a second. so moved. it's been moved by DR. Zeman, second by MS. Thompson, any public comment on jj9? no, ma'am. board member discussion, MRS. Rupert? I had my question
207answered about it, so thank you. great, all those in favor of jj9, say aye. aye. fully f any opposed, say no. Motion carries ewe nan nosily. The next item is jj10, can i have a motion second. Motion by DR. Zeman, second by MS. Thompson. Any public comment? no, ma'am. MR. Ver ver ra. Er I will be recusing myself for this vote during the course of my preparation for the meeting tonight, I discovered a a potential conflict of interest under 1 23143, therefore I will not be participate, I will be recusing myself and file the appropriate form 8b in due course. Thank you. thank you, MS. Rupert? thank you. C. Robert markham elementary school, the original service started in 2017, 8 years we're struggling with a litany of problems and still the work is being done.
208While the facility has been a work in progress, I want to thank our educator, staff, families and students for being so loyal and truly being the picture of what we want with every school and every community. This great gem of a school will have the facility that will truly be a wonderful, safe and healthy school for many years to come. Thank you. thank you. I pulled this item and ip that I already received a response but I just have to say out loud, very frustrated because the item came forward to us for 25 thousand 237 dollars which is not that much but 20 thousand 800 dollars is only for printing and that just seems astronomical. I know that there's a lot of things that have to be printed and all of those things but we
209have a printing department with becon, are we looking at ways to reduce that cost because although it's not a lot of money, it is a lot of paper and to me 20 thousand dollars just for printing is a lot of money. I don't want to spend a whole lot of time on this, but I just -- I got the response and it didn't make me feel any better looking at response that there's a lot of printing for 20 thousand dollars, I'm aware of that, but what are we doing to reduce that printing? Is there anything that could be done electronically as opposed to have it be printed? DR. Hepburn? MS. Paul or MR. Mcintyre, either/or. I mean, this is where we are right now on this project but we are looking into and are making
210transitions into digital electronic documents, so, it is our intent to reduce this over time but these are just the -- this was a very complex situation and we just needed to get this work done so we can mover forward with it, but yes, we're looking at all the options to have number one, electronic plan reviews, we're in the process of doing that, and so we will continue down that vain to not have to spend this kind of money. okay, because if I'm not mistaken, we have about 100 projects left, if we're spending that kind of money on printing times 100, it isn't just 20 thousand dollars, so like I said, I don't want to belabor the point, I appreciate it but I want to be clear that as one board member, I want to see
211us moving towards a more -- a less paper printed environment. DR. Zeman?Frjts thank you so much, chair, markham continues tos live in subhuman conditions. We have lots of students there, we don't have permanent capacity, we don't have a cafeteria that's worth talking about. Kids are going through and getting food that's prepared in other place and is we went to the city commission in pompano, we told them that that's the way it is but we're going to have this thing done and open for the first day of the 27-28 year so, will this th item delay the start of students going to markham elementary school on the 1st day of AUGUST, 2027? no, it will not. thank you. is that it? Apparently. Those in favor of jj10, say aye. any opposed, say no. Motion passes minus
212MR. Cervera because he recused himself. Next item is oo1, can I have a motion and a second? It's been moved by DR. Zeman, seconded by MS. Lee yard -- leonardi, any public comment on item 001? no, ma'am. thank you, chair x on the bus gps system issue here, how many buses operate in this district for our 326 plus schools? DR. Hepburn? go ahead, MS. Paul, if you know the number?Rjts I can follow up with the exact number, somewhere around a thousand -- over a thousand buses at this time. a thousand buses? yes. there's DR. Clair ra , she has the specific number if you need a specific, not approximate. hi, DR. Cla ris, through the board, can you raoe pete the question. how many bus dos we have in bro urtd county public school that
213is use this gps technology? so, currently, hack on, I have the exact number for you, I'm having technical difficulties, one second. So, about 1300. When this was written, we had an auction and the buses were auctioned off, so with the agreement and the 100 buses that will be arriving this year and next year, we'll be at 1300 total. I'm trying to get the exact number for you, for some reason, my tablet is asking crazy. in reviewing the contract, it looks like it calls for about 1360gps units to -- in which they're providing -- rather to justify the 1.4 million dollar bill that we're being asked to vote on here so, I guess what I'm really looking for is clarification as to do we have 1360 buses that are operational in this district on a daily
214basis transporting our student? S that's a resounding yes, I can answer that for you. yes. thank you for the clarification. thank you, next is DR. Holness? . thank you, MADAM Chair. So, DR. Hepburn, the buses that are utilizing this system, I guess my question is a different way. Are all the buses carrying students in broward county utilizing this system? yes. and I notice this contract is from MAY 2025 to MAY 2028, is that correct? correct. okay. And in 2019, we partnered with this company and currently we are providing a new contract, correct? that's correct. okay, what were we paying before as opposed to what we're paying now? I don't know if you have those numbers on you. I'll double check, but we are currently paying with the 20% discount that we're receiving, we're paying about
215120 thousand less annually. I can double check what last year's numbers were. I'm aware of the discount, but I still wanted to compare it as to what we were paying in the prior contract because the cost could go up significantly and we're saving 20%, I don't know what we paid before. I understand the question. And if you can give us some time, if you have any other questions, we'll give them some time to look for that. I see MS. Andreu back there. . Er I do have another question. Did we attempt to see if we can get better prices for this kind of system as opposed to continuing with the same company? this one is a little bit more complicated because it's so imbedded in the system, broward county public schools, that is with all
216the tangibles of monitoring bus location by parents, student and is families so, to ease -- to make it an easy transition to continue, we talked to this company during negotiations to negotiate discounts. so, I remember when we transitioned over for example to focus, we did it over a certain time period, so are there other companies out there that offer this kind of service that would -- whether it lends itself to time to transition into that particular system? yes, there are other companies that offer this service. One thing to think about when you think about other companies, they would have to come in and install new hardware for this to work appropriately which takes a lot of time to do for over a thousand buses so there's a lot of her tangle thgs to consnsererenen yoyore
217decidingtoto stayay a vendor we're with versus transitioning to another one. I understand that, but this contract was 2019 so we had ample time, we knew when this contract was going end so we had ample time to explore other options and I'm not saying other options would be better but the time factor knowing when this contract expires, you know, this could -- we could preplan as far as timely implementation should we resort to another system, so I guess I'm just trying to find out if there is anything better out there that is less costly and if not, then no problem, but I don't know if we have that information. no, we don't have that information, but I can tell you this is the gold standard for large school districts when it comes to this amount of
218buses on the road, so there MAY be other solutions but they MAY not be able to meet our capacity. If DR. Cla ris, if you have anything to add, feel free, but to f due o the volume of buses we have, this is one of the systems we know based on our recent use of it, it is not going the break down or have operational issue and is always available for staff and parent and family use. so, this particular system is being used by multiple large districts across the country? absolutely. okay. yes. and I don't know if you can get my information on the prior contract. any info yet?Frjts I do, 600 k is what MR. Hill just sent me. per year?Frjts per year, yes. Er so, we're saving. we're saving quite a bit, okay,
219thank you. thank you, and before I go to the next person which is MS. Thompson, DR. Hepburn, can you just for everyone to understand because I did ask this question, this item is about here comes the bus, is that correct? yes, this is the here comes the bus has we're all familiar with, this is the system we utilize across the whole entire district that all of our families are familiar with who have bus riders. thank you, because nowhere in the item did it say that, so thank you for that. MS. Thompson?. Er my questions have already been asked and answered, thank you. DR. Zeman. thanks so much, chair. I have spoken a lot about competitive solicitors and I'll say it again, you know, we have the legal authority to sole source. It's not the best
220general business practice to go with people you know and stick with them, if they're the best, they can win a competition. So, I'm going the keep say hating and hopefully we go away from the 10% of what we call competitive selection that is are not competitive at all, they're just given to people that we know. My second question is why doesn't here comes the bus work in the first few weeks of the school year? DR. Hepburn? I don't want to give you a long answer, I know why, let's see if they can articulate it better than I can. so, here comes the bus does not -- it's not that it does not work, it's not effective and does noted give the accurate information t first two week of school websinger are right sizing our route
221and is trying to make sure all the students who are registered are on the bus, all the student who is need transportation get them and we're stringing to ensure that the student that is are not eligible for the bus are not take ago seat a student bho is. Even driver behavior, the drivers are not use today the bus, the traffic is a little more chaotic, parent ares still taking their kids to school, parents rely on the reliability of that app, they want to know when the bus is going to be there within 15 minutes f we open it up the first two weeks, it is not correct, we ensure that we send additional buses to waoet stops to make sure all the kids get to school timely but those would not be reflected on here
222come it is bus torx air on the side of caution, this year we did here come it is bus earlier than last year, the first two week iss not recommended for any district. I'll say this, by the two districts we surveyed, there you go. if you want to go there, I'm happy to go there. no, sir. I talk -- talked to the vendor and that's not what they told me. Here's the problem and we do this way too often. okay. the parents want to know where the bus is, they want to know their kids got picked up, they want to know when the bus get tos the school. Does the system have that capability from the school day of school on. hate the capability to locate where the bus is, it will not accurately reflect
223the time of that bus though for that student or that stop. Right now the system here come it is bus does not track students, it track it is bus. does it track the buses accurately on day one of the school year? can you word it differently because it does track the bus but it doesn't rackety portray the correct information. so, this system that we're about to pay either 1.4 or 2.4 million dollars from, depend ifing you believe the executive summary or the financial work sheet, they have totally different number us cannot tell me what I can fwet off a cell phone of the driver or an air tag from the driver, that what you're telling me. No, I'm not done yet. We're going to pay this much money for a system that can't putbacker accurately
224put an air a tag or a map on someone. no, that's not what we're saying. To answer your question simply, yes, it can track the bus, what she's trying to explain is the accuracy of when that student is going to get to that stop, that is not accurate in the first two weeks because everything is being settled and all of that. The question is what do we want families to know during the first two weeks of school. Do we want them to know where the bus is or also where the bus and child is expecting them to be at this specific stop accurately within 15 minutes. The first two weeks of school, it doesn't happen than way. There is changes, there is all kinds of ebbs and flows, as new student ares being registered for
225the bus, it changes throughout the time, so I think the question for us as staff is -- and for the board if there's direction from the board to staffer, what do we want the families to know the first two week f it's where the bus is at that moment at time, that MAY be ina accurate from the drop off time we're given for routes. this is another case where we have a e an elected leader sitting on this board that make these hard decisions but we're not allowed to make this decision and I just don't understand this over and over again. Our parents want to know where the bus is, if there's a sign on here come it is bus that says the predicted time of getting to your bus stop is not accurate because
226we're figuring out how to get there, that's fine but they want to know the bus is coming, once their kids get on, that it gets to school. I'm not afraid to show them that buses are not doing perfect route and is afraid to say this is the first two week, it's time to get it together but the parents are not served when they don't have this expensive system, so, I would love the board to talk about this and make that decision because we represent the parents of those kids and I think we have the best position to kind of say this is what they want. They elect us, so that's that. Last thing, so I hope we have that discussion some day, I hope this board's enabled to make decisions about the people who live
227here tha, would be great. Second thing is 1.4 or 2.4 million dollars, am I supposed today believer the executive summary or the financial work sheet? are you asking me for the cost -- let me go to the executive summary. Go ahead, thank you. We've revised it. jennifer andreu, exec tier director, thereafter revised financial analysis work sheet that should have been provide today the board, the correct amount is 1 million 439, 424 dollars. I'm sorry, just to take that away, there was supposed to be one and not included. it's on there, it's there. okay. Thank you very much. I hope that we talk sometime as a school board about things that affect the parents of broward county because that's who we work for and we can represent them very well and we can find good balance
228and we're not incidental to the process, we're here for a reason. Thank you very much. thank you. MRS. Alhadeff? thank you. So, I concur with DR. Zeman in the sense of that we want parents to be able to know where their kids are when they're on the school bus at all times. I remember one year alyssa got ton wrong bus and I was waiting for her at the bus stop and she wasn't there so I was very frantic, so I understand the parents being upset, not knowing where their kids are at all times and to be able to track them. So, you know, I wonder if there is parts of this application that maybe we're not using. Maybe with the students id, can they scan when they get on the bus and that will help.
229So, I don't know but maybe there's parts of this that we can use to help to better the system and get parents the information that they need. that is a great question and go ahead, DR. Cla rbacker ris, I know we're moving towards that area. we are. Through the superintendent, yes, we are currently working on establishing a ridership pilot that will accurately tell the parents where their student is based on their I.D. Badge, so we're working with several schools, we are waiting for the contract to be approved first which hopefully today it will be, then we'll be reaching out to several school tos pilot it to see how it goes. We have spoken to MS. Molder and the schools and other vendors as far as the reprinting of the badges go to see how effective
230it is t timeliness of get thing badges the first two, three days of school, etcher, so we are hoping to move in that direction. . Er so, you will know where the bus is and who's scanned in to be on that bus tha,'s how you will know if your can kid is on that bus when you look at the gps for here comes the bus. Right now, the scenario you gave with your daughter is you wouldn't know where the bus is but you wouldn't necessarily know if she's on that bus but you know what bus she's supposed to be on. In the faou quhieshltion have the capability to understand that the student is actually on the bus. Er I wish she was on the bus. so, I know through the superintendent, we also are working
231on the ability for the schools to locate the students swem, that's a common request as well. Can the schools know, can they have access to here comes the bus websinger eve worked out a way for the schools to see where that bus is and the student as well. I'm sorry, chair, I have one more question whenever you're ready. Er MS. Alhadeff, are you done? Okay. . I heard we saved 600 thousand dollars per year on this canting by doing a three year stha, accurate? DR. Hepburn? no, that's not accurate, the last contract was 600 thousand dollars, approximately 600backer00 thousand dollars a year. This contract is toipt say like 475 per year. we're savoring 120 thousand per year by renewing this contract at the 20% discount rate. for three years? for three year, yes, with the
232option of renewals. thank you, chair. thank you. MR. Ser vaer ra? -- cervera, on that note. thank you for put it in there, these crack that is we constantly enter into as district, I feel we lose certain leverage in bargaining power when we do that and often ask why we are doing that and I see here this jumped off the page to me when I was reviewing this late last week about the savings per year that we're doing this by signing up for three years so I appreciate the information and also I appreciate the discount quite frankly, but thank you. thank you, all those in favor of item oo1, say aye. Er aye. any opposed, say no. Motion carries unanimously. The next item is oo2, can I have a motion and a second. Er it's
233been moved by DR. Zeman, second by MS. Rupert, any public comment? no, ma'am. MS. Leonardi? my questions were answered, thank you. All those in favor of oo2, say aye. any opposed, say no. no. motion carries 8-1. Next item is ork o5, can I have a motion and a second? It's been moved by DR. Zeman, seconded by MS. Rupert, any public comment? new york city ma'am. DR. Holness? thank you, MADAM Chair, I have a couple of questions, what is the process to determine what electrical supply items to store? DR. Hepburn? go ahead, MS. Paul. well, we definitely consider the work orders we have in the system. We look at the history of the type of item that is we need to support the district, so, that pretty much drives how we start. okay, so how do
234you gauge buying too much items or having excessive storage of items? well, part of that is inventory management, so you look and see what the load is or what the basic load is or minimal level of stockage. okay, so MS. Paul, would you say that at any time we have too many items stored, that as far as supplies? I would say in my experience that that typically is the case when you don't have -- if you don't have a robust management program. is that the case with these electrical supplies? I can't say that it is necessarily the case here but I know that buying equipment and electrical equipment can be very costly. okay, so -- our hvac and other equipment that we have, yes, the price is very expensive. okay, so as we store these
235expensive items, how do we ensure that these items are secured and not stolen, they're not borrowed, that kind of a thing? well, again it's inventory management. The cycle of inventory, you compare that with the work orders and what was used to repair something and come up with what your current status is. okay, so how does the board know for example if we order all these electrical supply and is any items that we store, how does staff report back to the board to -- in term of inventory management to make sure we're not losing items and money based upon being stolen or borrowed, that kind of a thing. I'm curious. I'm not aware we do report that to the board. I know periodically there are audits on our stock. so, that would come to us through
236auditing as far as any losses sm typically. okay, because this is a huge amount of money to store supplies so I'm curious to know as far as what is the history of losses and how much money that is for items that we're storing excessively in terms of costume thafrjts's something I would have to research and look at when the last audits were performed. okay, alright, thank you. thank you. DR. Zeman? yeah, all my questions having answered already, thank you, chair. MR. Cervera? aisle -- I'll second that, holness was able to ask a lot of inquiries I had on my sheet as well, thank you. all those in favor of oo5, say aye. aye. any opposed, say no. Motion passes unanimously. The next item is oo8, can I have a motion and a second. Er it's
237been moved by DR. Zeman, second by MS. Leonardi. Any public comment. yes, we have one public speaker, DR. Natalie lynch-walsh. good afternoon again, DR. Natalie lynch-walsh, plantation, florida, this item initially came to you OCTOBER 14 and it contained a paragraph that I highlighted, sent to you that had red flag language in it. However, it was soon discovered there was not enough fund to cover the projected cost as intended funds were being used by another department which was previously unaccounted for. The other department was utilizing the same funds to cover the costs they incur witched the use of the itb's, blah, blah, blah, all they did to bring it back to you echoing like the this morning's situation is they took out the troublesome language in the new executive summary. I do appreciate that they tried
238to provide you with a schedule, it taoes one with all the pretty colors on it, however, the problem there is that you cannot map the vendor to the scope. Call it the accountant in me and auditing habits die hard, but if you're going to have something that says breakdown, I should be able to map each vendor to each scope item. That's not possible here. Sometimes you can guess if there's only one vendor, when there are multiple vendor nrs the breakdown, they do not separate out the scope that's related to that vendor. That's a problem. On page 2, so you can't tell if you have staff augmentation or a staff duplication or staff being supplanted and this is a 4.5 million dollar additional spending authority. There's a complete lack of transparency here. It seem tos have
239pumped their problem child department to sscp, it begs the question, doesn't it use project management software so they should be able to tell you how each of these things map back to the scope but on the second page and I have no doubt that money is being wasted and there is mismanagement and then there's the third child, fraud. So, in the 2025 scope under safety and security who just inherited this problem, you have five line items, the first vendor, I can't tem what's different there, but it says in the scope, project managers and consultants to oversee projects in cyber and physical security under safety technology, esessentl for onngngeroperions inclcluding video surveillance and intercom systems and there are four tech army line item and is one vedaver, that's half a a million dollars. Does it make
240sense that you would have consultants overseeing district projects or would you have district staff overseeing consultants in this particular context? Again, is it staff augmentation, staff duplication or are you supplanting staff and how are they critical? So, this needs to be audited and if not, it can go to the ig. thank you. Any other public comment? no, MADAM Chair. board member DR. Holness? thank you, MADAM Chair. DR. Hepburn, there are 63 adepts on here, is that correct? that is correct. and from the 63, how many of these companies are mwbe firms, is that 7? I would have to -- give me a moment to dive into this or MS. Andreu, if you have that question, I see her head nodding. okay, 107 out of the 63 are mwbe firms, banded -- and based on the
2417, how many have received this kind of work under this particular contract? I am not sure, MS. Andreu can provide some details. through the superintendent, so, you will see tech army is a certified vendor and they have received the majority of work for this particular item. okay, so DR. Hepburn, I know I mentioned it before under financial analysis sheet that there's a category that says mwbe status, is there a reason -- it's good reference to just see it that we're not putting that status on the financial sheet? just a second. I think it's just been an oversight. They listed it on the executive summary and not on the financial analysis work sheet. I understand. so, we'll ensure going forward it's also listed on there. and I've been saying this for months, I have said it
242before within w the financial analysis sheet, why aren't we putting -- it's easy to put it, once you look at it, then you can see it in a flash, without having to search all over, so the category is there, the column is there to put the mwbe status, why aren't we just doing it? Because I said it like months ago and two or three times since then. it's just a manual process, DR. Holness, I will make sure going forward, swiller personally make sure we manually enter that. okay, and for the staffing, the majority of the staffing here are not in-house, correct, we're looking to contract the work, is that correct? that's correct, DR. Holness? why are we not having -- because it's a large amount of money. because these are very specific tasks and the
243skill set that's needed to perform these such as installing camera s, because it and also ssep utilize these services to harden our schools, also deal witching it issues and other safety and security issue sos it's a specific sales skill set that we need that with f we hired people for this, it would probably cost for. have you explored more to hire as posed to contracting out? at this scale, difficult to hire at this scale for the level of expertise that we need to do this type of work and I don't know, MR. Davis, if you want to just give a short quick synopsis of some of the things of the expertise that's needed for some of the work that needs to be done. Er trey davis, chief information officer, you're right on, superintendent, DR. Hepburn,
244some of the skills required here are project based, they aren't always long tenured, they're also very specialized in nature, for example, around sap development, the ip integration, too hire someone just for project based work, they MAY not last more than three months or what have you, it's far more costly. If it were long term or recurring year over year, then you would look at is your core competency enough, in this case this is why we use vendor ins this particular case the first two vendors you see mentioned there are disadvantaged businesses as well as you mentioned, DR. Holness. so, a majority of these are short term with the technical expertise that's required. Okay, thank you. thank you, MR. Cervera? thank you, chair. I share some of the concerns we've heard from the speaker. I mean,
245that is tremendous amount of money and as I'm going through this and the appendixes and the breakdown of who the vendors are, I'm not seeing enough specificity to make me comfortable here as to what these companies are doing and how are they justifying the amounts of money that are being suggested on here. I hate to keep coming back to this but I think it's a good example. Our lawn maintenance contracts, I had an issue with spending 11 million dollars on the landscaping companies initially. MS. Paul and her team had agree today provide a breakdown and post it online and we had conversations about that, after doing that, I felt better about where that 11 million dollars, where that's goipg and understood that landscaping can be pensive. My concern with seeing something like that, I'm seeing
246line item on a two page spreadsheet on appendix b that's not giving me enough comfort level high enough to be able to justify and the transparency here I think is also lacking. I would like to see a lot more of a financial breakdown as to where this money is going, to what specific vendor and perhaps more importantly, how is the vendor using the money other than saying we're giving tech a million dollars, hopefully they're going do a good job for us, I want to know how that million dollars is going and how it's being broken down. When we get into these multimillion dollar deals and I've been saying this by f since MAY, the more information you give to the public, the better. The more information you give to this board t better, then we
247won't have to keepingbacker having these conversations, where is the money going here, so I'm not comfortable with this as presented and I will not be supporting this today. thank you, MRS. Rupert? thank you, and thank you, MR. Cervera, you're quite on point there. I have a few questions. How many former tech army employees currently work for sbbc now? DR. Hepburn? I don't have that information unless staff has that. they would have it though because it's a quick number in your head. daryl diamond, director of program management officer, MS. Rupert, can you ask me the question more more time so I knower I'm giving you the right answer. in the last let's say two years, we've worked with tech army before, the district was satisfied with them but I know that over the last year because
248I have objected to some of these hires because they were coming on as former vendors back into our system getting paid more, so, I think DR. Zeman said show me the money or show me the proof, it is there, so I won't be support thirsting item but i'll tell you why. Too many people have come there from there. I understand if it's project based, then it's still a crazy amount of money and there's a lot going on behind the scenes and I'm not alining out of turn, am I, DR. Hepburn? we've received concerns from various board member, you have reviewed those and put certain controls in place. But I do want to caution the board about not approving certain items, and MR. Cervera talked tabt landscaping one, we started getting e-mails like crazy because grass
249was overgrowing, trees were overtrimmed so for this one, this is a little tougher because there's work being done right now essential to the district's operation in it, in safety and security that if it stops, it makes us very vulnerable and we can't finish essential things so I want to add that caution to this, so we're here to answer any questions that MAY be available if we need the take a pause and go get that information, we don't have it at our fingertip sos everybody can feel comfortable moving forward but this makes the district vulnerable in finish ing out certain tasks we have in progress right now. and I'm sensitive to that but I know that's not what's going to happen. I could spend a long time talking about this, what I believe it needs to
250be, inspector general looking at this as well as audit, they need to be audited and we need to follow the money and follow the hires and then let's talk about having a safe area to work and for our kids, I would never put that in jeopardy, never. I'm confident that my vote no today would not jeopardize any person's safety in this building at all, so it's no for me and I have talked about this privately with the superintendent in case people up here are like, I have, multiple, multiple times. MRS. Alhadeff? yes, my question on page 2 where it says the copy of the itb documents is available online and there's a link. When I click on the link, it's not available. It's an error. Can we get a clickable link? DR. Hepburn? yes, we'll
251update that link, it is clickable because I have clicked on it several times before, I don't know what happened between now and then, so we'll make sure the link is -- a broken link. Er yeah, so I don't know what happen ined the transition. maybe we can table this, I need the link to be able to vote. do you want to make a motion? I move to table to the end of our meeting. any public comment on motion? and if there is -- I'm sorry to interrupt, if there's any additional information that the board needs while we're tabling this, if you can speak now so we can gather that and bring it back. natalie lynch-walsh in favor of the motion, I think MR. Cervera was also pretty clear on what he needed. I don't know
252how they're going to get that today, so this sounds like something that's going to be deferred to the next meeting but I support at least tabling it for now. board member discussion? DR. Holness? MADAM Chair, I just want the know because MR. Cervera and board member alhadeff requested information that MAY be forthcoming as well as MAY not, is this an item that could be discussed at the special school board meeting should we need o do so? Would they be able to provide us with the information? DR. Hepburn? if there's going to be a special school board meeting next week, I don't think that delays it if MR. Davis or chief -- there is. there is, okay. Would that delay anything, mr. Davis? so, when would the meeting be? next week. we can do it next
253week. Er thank you. and I want to make sure you provide all the information the board needs because this seems essential to get past or to move -- absolutely. alright, thank you. any other board members? MRS. Bulman? do we know exactly what we're looking for here for what we will be relying on, is that decision clear too? the only thing I have so far is a working link and also the scoped out information per vendor that MR. Cervera. so, what we are going to be paying each vendor? yes, and MS. Rupert, if you can repeat what you asked for. yes, thank you, how many former tech army employees currently work for the school board and also if yes, I know the answer is yes, how many in last two years, what are they getting paid
254and what is the rate as long as the links backed up, I don't know what they're going to be paid, the company is going to be paid, but I really want to focus hard on this, so thank you. MRS. Bulman? I want to make sure we have the scope so we're not -- anybody else need to add what they would like to see come back? I think MR. Cervera mentioned his earlier. I have so many questions, I aoep not going to share them, I'll wait for them to come back. perhaps MR. Cervera can outline again quickly for us. Er us what my request is. yes. when you look at the appendix b, all it does in these columns for some of them, not all, prince I'm looking at page 2 on the 2025-26 breakdown for
255tech army, it's 23 thousand 40 dollars. okay, fantastic. I want to know what all these vendors are doing and how much they're being paid. For right now for this hypothetical, it looks in this category, tech army is getting 23 thousand dollars, fantastic, what is tech army doing? the last item with the electrical stuff, we had a breakdown about how much we were paying per light bulb to justify that ask, now here it's labelingbacker like double the amount or maybe a little less asking this board to approve 4 million dollars plus and I don't know where the money is going, how it's being utilized, what vendor is getting what. The hyperlink is broken which I think kind of supportsbackers -- supports my point on all of this. I need to know where wr the money is
256going, which company and what that company is doing to justify getting paid. T hyper link is working for some but it's not working for me either. We'll figure it out. I have a quick comment, million dollars dam chair. So, DR. Hepburn, you will try to provide for clarity this information by tend of this meeting, if you can't, it will be add today the special school board meeting next week? . Inger scope, I know we won't baibl to. Er so it's coming back for the special school board meeting. aisle change my motion to table toit the special school board meeting next week. Er second. okay. All nose in favor of tabling the item until next tuesday's NOVEMBER 18th, say aye. aye. any opposed, say no. Motion carries, so it will come back to us on the
25718th. chair, can I have a concluding comment before you mover to the next item. yes. all these contracts are important, all of them need to get done z I don't just as a board member appreciate the pressure the make decision ins the absence of good data or in the presence of serious doubts about our procurement process, so this is a balancing act but part of the job of school board member iss to make sure we have fidelity in our process and is make sure nights the best interest of broward count they, I want to be clear about that to everybody, if that means services get paused, it's not because of the school board, the school board is doing their job to make sure that we proceed with fidelity, both in policy and law, thank you.
258thank you. The next item is oo10, can I have a motion and a second. Er it's been moved by DR. Zeman, seconded by MS. Rupert, any public comment? no registered speakers for the remaining of the board ie steps, MADAM Chair. thank you, MS. Thompson? my questions were answered, thank you. Er thank you, DR. Holness? is it 0010? yes. no, I'm 0011, I'm sorry. I had you on both. sorry about that. thank you so much, chair do, you know if this was present today the board before it went out for solicitation? DR. Hepburn? I do know this, this was present today the board in MARCH, correct me if I'm wrong, MS. Paul, earlier this year. I'm not really sure, MS. Andreu? can you repeat the question. was this solicitation present today the board before it was
259released? through the superintendent, no, the solicitation was not presented to the board. thank you, does the solicitation quote anything the board thinks is not true? Fshlgts no, it does not. none thiem aware of. does this solicitation have any conditions that will be waived later on in the solicitation or were waived later in the solicitation process? DR. Hepburn? none that I'm aware of. terrific. I'll reserve the rest of my questions for a formal submit, thank you very much. okay. Anybody else? All those if favor of item 0010, say aye. aye. any opposed, say no. no. let's do a roll call. roll call, school board members rupert? no. thompson? no. zeman? no. alhadeff? yes. bulman? no. cervera? [Inaudible]. I'll take that as a no. Hixon? yes. holness? yes. leonardi? yes. fails 4-5. next item is oo11, can
260I have a hosing and a second? so moved. Er it's been moved by DR. Zeman second by MS. Bulman, no public comment, MS. Leonardi? I had asked for a follow-up on this and I think maybe I needed to be more specific. D I know can't base our r dedecisis solely on ct bubut wawowondining if there waa cost comparison between the three vendors that had been on this. DR. Hepburn? MR. Davis? trey davis, chief information officer, we did get compare tier data today I believe that per a vendor, i don't know if max, do you have any other info. We can get that to you as a board follow-up. okay, so we can't have that right now? I can send it over right now. okay. Thank you. thank you, next is DR. Holness? thank you, MADAM
261Chair, so, regarding cellular service, I know that we're looking to continue with -- and I'm just opening up the item, with at&t I believe, yup, at&t, so DR. Hepburn, I knower that I've been told that cities like new york city has basically hot spot check-out type programs for students or at least hot spot accessibility for students in need. So, for broward county with renewing this with at&t, are we able to have hot spot check out programs for students who are in need, I've been told that new york city when they distribute new laptops with connectivity that they also provide hot spot connectivity for the students, is that something we're considering here? DR. Hepburn? go ahead, MR. Davis sx, you're specifically taug about at&t with new york or just overall? just overall, we're looking to bring
262at&t, to continue with them. What are we getting, are we getting anything different, are we getting something enhanced? go ahead, MR. Davis. yes, trey davis, chief information officer, under the contract rkts the answer is no and something that certainly could be added from any of these co-vendor, there's going to be a cost involved. We have publish and had we keep up to date under student services up on the broward schools.Com website free to reduced internet ko frnlbacker coverage as well as the broward wi-fi model as well. okay so, MR. Davis, my interest that -- sx in what we have on the website in terms of reduced internet access and so on, my interest is we provide opportunities for all students in broward county regardless of where they live to be able to have access to
263some sort of an internet service and so on and so forth. So, are you able to provide what the cost would be to have a hot spot checkout program for student who is are in need or in general? so, I'm going the give it to you off the cuff algt bit, it would be maybe 15-17 dollars per student per month including device and warranty and all. If you look across the board given our student population, at a minimum tha,'s millions of dollars a year in cost of internet coverage. And it depends which vendor you're talking about, that's an average. Rj. for the current contract here, has prices changed since 2021, we had the original contract with at&t. Er max? yeah, I want today confirm with max, we're still locked in with that price, ye. so,
264I know that the market is competitive, so how are we ensuring we're getting the best services at the best price? we do constantly scan, what you will find is there will be different offerings from different vendors, for example, they'll say we'll give you a free case with cellular coverage but you have to still pay for the service. So, the reality is they all sort of work at different angles with regards to whether or not -- nothing's for free basically. okay, so would you say with this particular contract that we're get thing the best service for the best price based upon what you have explored? absolutely at this point. alright, thank you. thank you. Next, okay, that's everyone. Anybody else? MR. Cervera? just for clarification, I think DR. Holness, what you are alluding o and tell
265me if you are wrong, I know some of these major telecommunication companies in metropolitan cities have thaez hot spots that you can line up with as long as you're using their equipment. I understood that was free as long as you're using that provider. Xfinity cable, I always know there's a cable that I can log on to because I have that, so is that not the same thing with -- first of all, is that what you're referring to? that sounds correct, yes. . Inger is that not the same for at&t, we have to pay for that when other providers offer it for free?Frjts yeah, there are different options for connecting to wi-fi, for example, broward county has these municipal zones that allows for let's say if you use a student device that has capacity to connect
266to a wi-fi hot spot, it's not cellular but connect tog a data network that is free, if you go to a library, you can connect to their hot spots for free, they're not giving you the device like a cellular hot spot device for free and giving you the service for free. I think we're talking about two different things. I think if the infrastructure is set up for telecommunications company to have a free hot spot, like the comcast example that's set up, anybody with a comcast account can log into that f you're in that zone, you get it for free. It naoets an n ibl additional charge. I think you oar ie lewd tog a hot spot that needs to be create and had there's a service for that. I can pay to have a mobile
267hot spot, if I want to go to wherever, as long as I have a clear view of the sky, that you have to pay for, these are designed to get the free hot spots for free, there's no additional charge ifs the -- they still get it for free, correct. you have to have a capable device so, if you have a device for example like a student laptop which has the ability to connect to a wireless network, that MAY be accessible outside of our network, let's just assume, or other hot spot, you have to have something to connect to that hot spot that's available, whether it be a library or whether it be a n a metropolitan zone, we have some areas in parks where that's available, you can't do that unless you have a device
268to use to connect to that. and the account also. I know both of you are saying that -- I think the question that was answered before is the assumption that DR. Holness was talking about us giving a kid a hot spot, a a physical hot spot, but for the example that you gave, yes, I'm a comcast customer, if I go to the park, there's an xfinity hot spot, I can log in with my account and I have a device like MR. Davis said that can connect to it with my account, so at&t hot spots around town if you have an at&t service cell phone, you should be able to connect to that network. exactly, that's a bit like -- there's an xfinity hot spot ins metropolitan areas around the country, if I'm a comcast customer,
269I use it at home with my router, if I go out with my laptop and sit ining a public space and I see hot spot, I can connect to that singing my account for example but that's the key right there is there are some wi-fi-free zones that are open in the county tha,'s up on our website as well but you have to have a device to connect to it. thank you for the clarification. thank you. All those in favor of -- DR. Zeman? there's no such thing as free wi-fi, you're just paying for it through your comcast bill, thank you. all those in favor of item oo11, say aye. aye. any opposed, say no. Motion passes unanimously. Oo12, can I have a motion and a second? It's been moved by DR. Zeman, seconded by DR.
270Holness. No public comment. So, board member comment, MS. Thompson? my questions were answered, thank you. okay, all nose in favor of item oo12, say aye. aye. any oppose, say no. Motion carries ewe nan nosily. Oo16, can I have a motion and a second? so moved. Er it's been moved by MS. Thompson, seconded by DR. Zeman, there was no public comment. Board member discussion, DR. Zeman? thank you for being so fast, chair, you beat me to the item. Yeah, I had my question answered as well. Thank you. excellent. All those in favor of item oo16, say aye. Er aye. " f any oppose, say no. Motion carries ewe nan nosily. The last item on the agenda to be discussed today although we still have some more stuff is item pp2, can I have a motion and
271a second. Er so moved. I.Serbacker it's been moved by DR. Zeman, second by MRS. Leonardi, no public comment so, next is DR. Holness? okay. It's for pp2, correct? Okay. So, I just have a question on the charter school portion of it, let me just find it. So, again, we have a red line, repd -- red font version here tha,'s the one I'm on. DR. Hepburn, the information on the red lao irn version, this is all new information, this is all pretty much changes being reneged, DR. Fulton, I didn't see you, DR. Fulton, is there information all l new that reflects changes or is this just red font as opposed to redline. I'm pulling this up but the red line should be new information. in this case, this is all new changes that's reflected from the
272original policy, correct? DR. Fulton? typically, yes, I do apologize, I'm trying to pull it up. if it is all new, the majority of this policy then would be new so I am just suspicious that some of these red lines are part of the original. DR. Fulton, if I MAY. Is this the contract -- this entire policy is new. okay. so all of the language is new language, this is I think the third time the board is seeing this, fourth time. I understand. but just so you're aware, DR. Holness, the reason why all of it is red is because the entire policy -- all of it is not red, some of it is black and some of it is red. so, the part that is are black are the parts that were passed because I think
273the third time it's been at a board meet sog when portions were passed at previous board meetings and then at the last board meeting, the board asked for another change, so the portions that are red and mien staff is in the back and DR. [Inaudible] Or MR. Parker, correct me if I'm wrong, portions that are red now are changes that came as of the last time it was before the board at the last board meeting. okay, so, I you got it. So, the portions that we're looking at that are red, they were not approved in the past, is that correct? those are changes ta tha the board asked to be made in the last time it was here. okay, and that was in a pork shop? no, that was at the board meeting. okay. Well,
274aisle just ask my question on m which is number -- page 5 on -- o, on page 5, what are examples of premium service agreements for charter schools, what are some examples? premium services agreements are as you know each year, throughout the year, so charter schools ask for service that is are above and beyond the 5% that are included in the administrative fee that's held back, for example, if they want services, additional service from the athletics department, if they want mission service -- athletics is one of the main ones, but different services that are above and beyond what we're statutorily require today pay, that's why we have our venture design department where those premium service agreements come to the board, the board approves them but there's also like a payment fee of how much they're
275going to pay for those services that are above and beyond the 5% administrative fee. I understand, so DR. Wanza, what we're doing here in essence is approving this particular letter m, item m for the superintendent to have the latitude to make decisions on charter school premium services agreement without having to come to the board, is that correct? that is correct. okay. So, and these services as you mentioned are services that go above and beyond the requirement of the board to charter schools? that is correct. These are additional services to tha the charter school is contracting with the district to provide and they pay for those additional services. okay, and when the superintendent makes these decisions for charter school premium service agreements, it will only come to the board two days -- it will come to
276board members or provided to school board members two days after these decisions are made, can you explain that part. sure, so the way I understand is that when anything that the superintendent is giving the authority to exercise under his signature, then -- and someone correct me if I'm wrong, sofm the change orders thao tha the superintendent approves, that as the superintendent makes whatever decisions that are allotted to him under his authority, he will then advise the board, I think the policy says two days of the decisions that were made under his authority as granted in the policy. Er so, dra. Wanza, many the past, these agreements usually come o the board, correct? the approval of the agreement, yes, they come to the board. but in this case they would not. I have a concern with
277the charter school premium services agreements because they go -- these are agreement that is go beyond of what we require and I would prefer to see those come to the board. So I have a lot of questions, DR. Wanza, if you don't mind, DR. Hepburn. Charter school articulation agreements, can you expound on that? DR. Hepburn? DR. Wanza? hold on one second, I'm going to see if MS. Collins can come down, if you can get to your nester question and make sure we get them all. charter school articulation agreements, those normally come to the board prior to these changes, correct? correct. so I want to understand what's inclusive of charter schools articulation agreements to determine whether or not as a board we should give the superintendent latitude to make decisions on these agreements without us seining
278them eing -- seeing them first, so mad daem chair, can I make a -- I'm sorry, can I make a motion, you can go, MADAM Chair, MADAM Vice chair will be there. I would tliek -- like to make a motion to strike out m, that charter school premium service agreements come to the board because these are agreement that is go beyond what we're required and I personally would like to see them before the superintendent makes decisions on them. Alright, DR. Wanza, do you have any information on the articulation agreements? MS. Collins is on her way down and I don't know if there are going to be any other changes, I'm trying to make certain if there are, and I'm looking to MS. Jack adams what would be the process, we'll have to come back now
279in DECEMBER, if these are considered substantive so we understand the process. through the chair, it is considered as substantive change because you're deleting an entire section. if the charter school articulation agreement, I want to understand what those are to better understand what we are voting on. So, I don't know if we need to move to the next item, MADAM Vice chair, or if anyone else has comments on this, then I'm willing to forego my comments until later. DR. Wanza? so, I believe this it is last item, MS. Collins is in the elevator, as soon as the elevator can get her down here. . Er let let me go to someone else, MR. Cervera? thank you. I would like to know the role played by our general in house counsels in document in preparing this document.
280I know this has been a work in progress but this final version of 3820, I would like fo f to know how involved general counsel's office was in this process to date. through the chair, so whenever a policy comes to us, we legally review it. So, a lot of the business decisions as to what is placed within the policy, that's made by staff, we legally review it to ensure that the right disht's -- it's correct in term of the law, it references the correct law and says the the correct things from the law and just general, you know, grammar, etc.. So, this particular policy was legally reviewed by one of our counsel. DR. Hepburn, if I MAY add, additionally, and MR. Micnola was h efl -- heavily involved crafting e languagege nr the e lili.
281is that t accurate?? okayththank you. DR. Zeman? thank you, chair. I was a major advocate of this policy for a long time and now for I think some very justifiable reasons, I am not in favor of any word on this document. There has been things put in the public domain, many things of which I can verify that makes me pause about our entire acquisition system, our solicitations process and it MAY have been highlighting for one particular solicitation but so far, I have not been able to get any kind of response from the administration that I deem reasonable. So, in the public domain, there's an article in the florida daily, a group I have no idea who they are, it doesn't really matter, they have highlighted some things, several of which I can verify already. But
282it starts with us asking for the construction management agent, owner's rep contract to come to the board. At such a meeting, we could have debated how many vendors we wanted, we could have debated strategies, we could have debated a number of things that would have made sense, for some reason, it g efr came to the board even though our policy requires it and three board members asked for it, it didn't come. Then the solicitation says things that the school board says we didn't say. It says that we said there would only be two vendors selected. MADAM Chair, did we say that? I don't believe we discussed it. let me read from the solicitation t the school board has sderm determined that engaging the systems of a team is the most flexible cost effective means, I'm
283quite confident I would have remembered staining that but I did not. The solicitation required vendors to hop over a high hurdle with the financial requirement which I wouldn't say is wise at all, we would like lots of vendors to bid on thing sos we could get the best value. In general, when you buy thing, you want to have -- if you're going to buy a car, you're going to go to a lot of dealerships and like to look around, we would like to do that, that's a debatable and judgment issue, what's indefensible, that requirement was lifted during evaluations. Why is that a big deal? It eats a big deal because there were thousands of firms excluded from bidding. And then we took it away. And the general counsel's rep to the qsec said it was
284a technicality. That's not a technicality. That's really not a technicality and I appreciate the role of the general counsel, I'm not saying that their support to the staff wasn't appropriate but what they were told to do I don't think was wise. I have serious questions about one of the vendors being qualified that passed through and I pass hated on to the staff to verify, we'll see if in fact that's true or not. There are a number of other thing ins the article, my concern isn't to assess those things today, my concern is to say those things are in the public domain. Our job is to make sure that we have a fair, full and open competition process that things that happen here pass our standards, the things I've been able to verify already do not
285pass my standards. I don't like a lot of this and, you know, I have seen the documents, it's not something that I need to take out of some blog post. I have seen these things, and so I have no interest in considering this policy, I have no interest in extending the authorities of the superintendent or the staff and I intend at the end of this item to make a motion that will allow us to investigate the claims of this article in a ver raishs way -- ver ray shous board to make sure what's true is true. We need somebody to look at this and make sure we've done things well. Before I make that motion, I'm going to let people debate this and decide what their view of it, well, I'm one of nine, but
286I am somebody that has run a consulting company for the past 16 years that bids on contracts. I have lived hundreds of proposals that I have submitted so I knower that process. I'm also representing broward county in this role and I believe that what happened in terms of the construction management agent, owner's rep contract was not wise, did not exercise good judgment and is against our policy in addition to other decisions being made that were just not in the best interest of the school. I ask you the read this, think hard about this. We have a lot of options in front of us, we can table this, we can discuss it now, but when time permits, I have a motion to make before we get off this item. Thank you. okay, well, I think you
287were the last person to speak, so DR. Holness? thank you, MADAM Chair, so I would just like to hear from legal counsel for policy 3820, is there any legal concerns that board members should have with delegating any of these authority to the superintendent as far as approving contracts? MS. Jacques adams. that question doesn't focus on whether or not the policy is legally sufficient, the policy is legally sufficient, whether or not you want to provide the superintendent with delegated authority as indicated in this policy is a question that's up to the board, so I won't be able to opine as to whether it is a good business decision or not, it's just a choice of the board. In terms of the policy itself, it is legally sufficient. the policy is legal sufficient, but as board members
288and I hear you, MS. Adams, is there any legal ramification for this board to support this policy in delegating certain authority to the superintendent that we need to be aware of? Is there any cautionary suggestion to the board as far as any kind of state statute, anything that we need to be aware of should we support this item that can have legal consequences to individual or collective board members? I do not have any information that would suggest that. All I can state is the document itself is legally sufficient, there is nothing in the document that has any -- that gives me pause in terms of the legality. What you're asking is actually a question that goes towards the business decision as to whether you want to but there's nothing illegal about delegating specific authority to
289the superintendent as is indicated in this policy. . Inger is there any statute would limit us for specific delegation to the superintendent? no, sir. thank you, and I think we asked MS. Collins to come, right, and answer a question. So, if MS. Collins could come up. can you repeat the question, DR. Holness? yes, it mentions charter school articulation agreements on page 5, I just wanted more information and on what are considered articulation agreements. Give me examples. thank you for the question, DR. Holness. Good afternoon, dante collins, director of the support department. Articulation graoem ares agreement that is allow students who fall under the same umbrella of non-profit betty to move seamlessly between two charter schools. For example, many of our charter schools are co-located on one site, however, it's not a single k-8 pattern, it
290could be a student within one msid that's a k-5 and then a 6-8, so by having an articulation agreement between the two sails x it would allow the skaount students to transition between the two schools. It's illegal to move two f students between two hsid's without that, they would be able to mover with that because it is under one non-profit entity, that is the board go frping board with both locations and they wouldn't have to do that agreement because there is an articulation agreement in place. Er it would come to a board as sort of -- to approve it but we could not, not approve it. yes, it's formality. so, in this case, that would then just allow the superintendent to proceed. yes, sir. okay, thank you. thank you. MRS. Bulman? thank you, chair. Just
291to kind of frame what DR. Holness is asking about the legality, I think that the real question is when this came to us in the beginning of this year, it was brought to us with the understanding that we would have -- it would free up time and business would be conducted in a speedier manner because we wouldn't have the block of having to come to the board and approve everything and you could do things. But I would say at this point now that this is months later, we have -- so, you're looking at like 500 thousand dollars and below for this policy doesn't have to be approved by the board. Now that we have some serious budget concerns and there's also concerns brought up about procurement processes and thins -- things we've dealt with, the
292question is to DR. Zeman's point, is this the time to do this or is this something we want to wait to do until we have a little bit better understanding of our budget and how this is all going the play out. If we approve this, certain things will be taken out of our hands, we're giving up the power to control budget, which in this particular case now that we have a different situation from the beginning of the year when we talked about this, this is something we need seriously consider because the budget is our responsibility and we're responsible to the taxpayers to make sure we're using their money wisely. So I think that's -- it's not that it's not legal, if we approve it, it will be legal, but it f that's not the question,
293is how much power tobacker do you want to die vest yourself of when this is the power we're given as board members. Thanks. okay. MR. Cervera? one last point. There's a difference between something being legal and whether or not it's the best business practice of a board, right. I don't doubt, I looked at had and nothing jumped off the page in the two or three times I read it. I don't think these contractual terms are illegal. I don't think that we don't have the ability to delegate this to the superintendent if we so choose. I think what this board needs to consider is whether or not tiets best business practice for all of us. We are facing a lot of uncertain times in budgetary issue and is a lot of things we're doing right now
294and I agree with board member bulman about having some of that power taken away from us as a board, as the entity that is the public face of these decisions as the ones who have to go back to their district and is deal with their constituents, not just their districts, every time we're walking around the could -- county. I don't think we should be satisfied everything was properly vetted by our general counsel's office tha,'s fan taste -- fantastic, I'm not sure if this is the ester business practice given the uncertain times we're going through. MRS. Thompson? being this was the board's directive to make this policy, so I want to thank staff for all the time that you spent on this and I do think there's been a shift in at least the board's understanding
295of the current financial sbaition and na might be why this policy is voted down today but I do just really want to appreciate staff because you did exactly what we told you to do and that's where we are, but thank you guys so much. okay. Alright. All those in favor of item pp2, say aye. aye. any opposed, say no. no. I'm going to guess that failed, roll call?Frjts school board members thompson ?Frjts no. zeman? no. alhadeff? yes. bulman? no. cervera? no. hixon? yes. holness? no. leonardi? yes. rupert? no. falsest -- fails 3-6. okay, thank you. We have I believe exhauster a all of the items. I'm sorry, MS. Thompson would like to make a motion. I would like to make a motion to bring back oo10, so that the superintendent can clarify the impact of
296this not passing. second. yes, absolutely, and I'll have MS. Paul help out too. I want to remind the board this is work that's soreheaded with the defp, a lot of projects currently going on and a lot of projects slated baits based on our defp, project that is are up to 7.5 million dollars, so 7.5 million dollars and below, so, just want to reiterate that and MS. Paul, if there's anything you want to add because this stops all -- most of our work, not all but a majority of our projects around the district right now. superintendent, MS. Paul, can you expand on like examples of what that means. so, several of the vendors are roofers, so we talked about a roof for broward estates, that would be part of this csmp, maintenance, our preventative naints tha,
297would be part of this. The utilities work that we do in conjunction with the city, that would be part of it. Our routine maintenance, that would be part of it. So primarily we contract out a fair amount -- a large amount of work to these same contractors so it would be crippling not to have this project or this csmp pass. and just a reminder to the board on MARCH 11, this itb and the funding was approved. This is to approve all the agreements with the individual 18 vendors. Er so, just to clarify, if one of my elementary schools air conditioning goes out, would this -- would not passing this prevent the air conditioning from being fixed? it could because we also have electrical contractors on here, so it's not just the hvac when you think
298about an air conditioning, tiets electrical part of it that we have to call these people out to look at. Transformer blows, if it's on our side, we have to call them out along with fpl, so yes, this is a very important to our district that we have these pool of contractors to call. Not only in emergency situations but in our routine maintenance situations. I'm formulating one more question, it's already back on the table. MRS. Hixon, can you come back to me. sure, MS. Leonardi? how does this impact the five year playground plan and the painting schedule for our schools? DR. Hepburn? go ahead, MS. Paul. so, these are contractors so it's likely that we could ask them to do a part of that work wl, it's painting or roof repair, any of those type things,
299I can provide you a detailed list of how we've used these vendors in the past, but they're primary vendors, e didn't want to sij out one individual, we do business with them as matter of routine, we don't have staff to do all this work, that's how we leverage the vendor tos do this work. let me ask the question differently, if this item remains unpass, how does that impact the five year playground and painting. this is not just for playground, this is not just for painting. Er I'm asking specifically about those two. so, if there's any kind of electrical issues with painting, if we have to move something, if we have to adjust something, we use vendors to do that. If there are any kind of issues with the playgrounds, if it's something below ground, I
300think we had an incident where we had a pipe that was broken and we had to call one of these contractors in to repair it before we could anything with the playground, they're basically intertwine witched the work -- intertwined with the work that we do. DR. Zeman?Frjt thank you so much, chair, to the general counsel, if once we learn more information about the procurement, solicitation department and the nctions in o urtd county at dodo ththesththings, could briri thth baba in dememr r anand pass this same contractor -- contract work? MS. Adams? yes, you would be able to bring it back. to the chair, do we have vendors currently under contract that can do the work that's been reference ined the last few minutes. Wefrjt are a a size of a city, so we need all
301of these vendor tos do the work. We have a massive defp plan, we have construction projects that are going on, so we need all of these vendor tos do the work I appreciate that, but DR. Zeman's question was do the vendors we have now, would they be able to do the work that was being referenced? these are some of the vendors we currently use now. right now it's not passed so he's saying those vendors because right now we can't use those vendors on there, so based on that information, vendors that are available to use, would they be able to do the work I believe is the question. no, my question, I'm sorry, I MAY not have articulated websinger have a current csmp contract, when does that x pyre? DR. Hepburn? MS. An dry ewe, --
302andreu, I don't know if you have that specific contract for the contract? good afternoon, through the chair, this is the current csmp contract that was a warded in MARCH and goes until MAY of 2028. These are just the agreements before you today for the award that was made back in MARCH. terrific. So, do we have vendors that can do the type of work that we would normally do under the smsp and how long do we have them available to do work for us? DR. Hepburn? MS. Paul, I don't know with t we have all of that information or you have it, MS. Andrew f dre ewe, be sides the current smmp canting x, do we have other vendor that is are under contract? new york city these are the vendor that is are under the
303csmp. when do we run out of the ability to use these endorses, is that today if we do not pass this agreement? what's the end date for this particular itb? they're under agreement already, when does that agreement run out? that agreement is until MAY of 2028. terrific. So, tell me what the impact of not passing this today is on our ability to do work on playgrounds and other places. I'm try sog summarize -- trying to summarize what you're saying, we awarded the funding for this and we've negotiated all the agreements, correct, so what we have before us are agreements so, if we don't pass these agreement, we won't have any vendor tos do work because there's agreements with any other vendors because this is the csmp if I'm correct in summarize hating for you. correct,
304so the board already approved the 18 awardees as of MARCH and today you would be approving their agreements which were finalized for them to continue doing work with the district. If there's a question about agreements or the awards, I would be more than happy to answer that. I'm just trying to ask a practical question, we have a csmp contract that is doing work right now, is that correct? We ask people ton csmp contract even before we pass this agreement to do work, they can do work for us, they've been awarded a contract and we can ask them to do work, is that right? MS. Paul? let's me see if I can answer this, so the people that are on this current csmp, many of them prior to the authority the board approved or the previous
305agreement in MARCH, we do business with them and have done business with them. So, this is just a new csmp to cover the next three years I believe it is to 2028, but yes, we currently do business with them but that -- this is the new agreement that was approved in MARCH to continue to do business until 2028. and what I'm curious about is when does the prior csmp contract, when does that expire, when can we no longer use those vendors to do work? do you have that? there is no prior, that was already expired hence the MARCH new awardee. Er so, I think then in a business sense, if they were awarded contracts in MARCH before the previous contract agreement went out, they could finish doing the work up until now, is that correct?
306I would want to ask legal, that's not my domain. MS. Adams? can they do work without an agreement, is that the question? I'm just trying to understand the impact here because, you know, waiting until DECEMBER when we can learn a lot more about the allegations have been made about our solicitation and prao pro kaourment agreement is a wise thing if there's not a big impact. If there is a big impact, maybe we wait and come back and reconsider this in the other direction next month but what is the impact on our ability to do projects, small construction projects, that's what this is for, minor projects, csmp, what's our ability right now do minor projects twaoe between now and our school board meeting in DECEMBER that would be impacted by leaving this decision alone? through the
307chair? it appears as though from what I hear factually that there is no existing contract that exists, so if that is the casefinger it is not advisable for a vendor to move forward with work without a contract. and I appreciate the legal perspective on that, but I need to know from our cabinet member who's responsible for construction, if we need to do some work right now with a minor project, do we have a contract vehicle by which we can reach out to reach out to people and get work done. for a new minor project. do we have that abilitybacker ability right now? we have a set of vendors we can go the and contract now to dpo do a new contract. fe f if we have an existing agreement with -- I want to know
308if we can do a minor project and award it to a vendor to get work done. I'm going to use broward estates, probably not because the contractors on this csmp are who we normally use to do projects so even though we're -- that would be an example of a new project, you know, to get done, so the answer would be no. okay so, to initiate a new project that's a minor project, we couldn't use this vehicle? So, I get -- not without an agreement. I don't want there to be any caveats to this, I want to know black and white f we have a minor project and we want to perform a minor project, do we have an ability to do that without the csmp potashes being passed today? I'm hearing a no. I don't
309want to have any conditions on the answer, either we can do it or csmp has better vendors or they're easier to get to. If we have a broward estates like project, minor project, can we get it under contract and do it today? the simple answer to your question is no, the caveat to hawker answer is that that single vendor, without this vehicle, we would have to come to the board with an agreement with that vendor because of the dollar amount. we have no vendors under csmp to do work, is that the case? these are the vendors we use. these are the only vendors we use? we'd have to do another solicitation to get another vendor to do broward estates, you're asking additional money to that. I understand completely, thank you very much, chair. MRS. Bulman?
310so, we already passed this back in the spring, correct, we already passed it and now these are just the contracts we're pass, and all the contracts are expiring and we need to renew them? Is that my understanding? Okay. and I think we would benefit from continuing to have our buildings -- having work performed on them. And if it comes to our attention that there's something wrong with this procurement process, we have the termination clause and all these contracts? DR. Hepburn? that will be a question for legal. wem, I mean, this isn't coming out of the sky. thesebacker do these contracts have the termination clause? I'm goipg the ask the attorney that took a look at it to see if it has that and then I'll be able to respond to that. okay. Can I go
311to DR. Holness while we're waiting? sure. DR. Holness? thank you, MADAM Chair, so I just want to make sure I have clarity, so DR. Hepburn, in MARCH, we approved as far as I can recall 17 vendors, and the contract that we have is from what time period to what time period? DR. Hepburn? my apologies, it is from months from today. So, that would be 2028, NOVEMBER, 2028 if I'm correct, help me out here with the specific dates. What do you have? this will be from now until MAY, 19, 2028ment. The board approved this this on MARCH 11, 2025. we approved MARCH d 11, the contract starts in MAY of this year so, it has already started? I believe it's the exact terminology is at the beginning of the page 1 of the contract and it
312says this agreement is an open end agreement, so it's effective MARCH 2025 from the date of the previous board approval. okay, so here's my question, DR. Hepburn, because I'm a little confused. We approved this in MARCH, it says the the contract that we -- the contracts we're receiving today, they're effective since MARCH because that's when we approved it. So, why do we need a second approval, if we're receiving these contracts and I want to also mention, the only difference I see here is we added an additional company, is that wae we're trying to approve because we added an 18th company versus 17. no, let me clarify, in MARCH websinger approved in this specific itb17 vendors to be able to be funded through this itb for work, after that approval, the staff has to go and
313create individual agreements with each vendor. In the midst of that, an 18th vendor was added for this itb and also that agreement fwr that specific vendor so you're approving for all 18, the agreement ts were all 18 vendors, so you approved the funding for the itb, now you're approving the agreements -- so that's typically the process, the funding gets approved but it appear that is work has started since MARCH because it says the contract is from MARCH 2025 to 2028. correct me if I'm wrong, these vendors have start add project prior to that, they're finishing up their project, if we have the broward estates, we would have to approve this one to finish the other one. we approved the contract in MARCH and the contract is from MARCH 11, 2025 to 20258, -- 2028, so
314the contract and the work has already started but we're receiving contract agreement monthslarity. specific work for this itb has not started. . Ifer we didn't have an 18th company, it will, it would still come back to us. that's being added but the agreements for all 18. if this is voted down today sxit's not approved, then it negates what happened in MARCH, correct? no. You're voting down the agreements with these contractors, so in a sense, it's just funding that's already been approved. Er the funding is there but we're voting down all of the folks that would do the work? for new work to happen, this agreement needs to be in place f it's voted down, we won't be able to initiate new work or if there's an emergency situation, we won't be able to find the
315specific vendors we have use ined the past. Er this is not about the money, that was approved, this is about the vendor, correct? that iss correct. alright. MR. Cervera? a couple of thick, chair, it does appear there is a termination for convenience in all these agreements, all 18 of them. MS. Adams? through the chair, yes, that is correct. yes, okay. there is a termination with or without cause. there's -- I want to make sure I'm very clear here, tlas termination for convenience in all because there's legal significance to that, I don't have to tell you. There is a termination for convenience clause in all of these, all 18 of these agreements and it looks like it's section 10.06 in all of them, is that accurate? that is correct, section 10.06 entitled termination for convenience. fantastic,
316I think that answers a question that was asked by my colleague, there is a termination for convenience. I'm wondering, DR. Zeman brought up issues with the procurement process when this was initially going through. I don't remember the article that you cited to nor have I heard of it, but I guess twofold here, number one, I'm wondering if DR. Zeman would be kind fluff to expand upon the consultants he had and if there was a proposed investigation or inquiry that can be down between now and DECEMBER to alleviate those concerns just to make sure that all t's are crossed, all I's are dot and had nothing nefarious was going on during this process. happy to share some of it. Everybody can read the article and make sure there's more that will come out. can you cite
317to it or at least give the -- florida daily, as far as I can tell, this is a mrog -- blog post, not some mainstream media, they have cited all the documents. This is credible. I'll just tell you that. My review of the documents confirms several of the things they ever done and we told the superintendent to bring us the solicitation and the superintendent did not. We know from reading the solicitation it says the school board said we'd have two vendor t school board did not. We know that there was an audit requirement of bidders, that meant a small number, maybe ten nationwide could vote on this, the qsec waiver hated requirement and said it was a technicality, if anybody has work ined the proposal space and you say only ten can bid and you
318wipe that condition out, I said thousands but it's at least hundreds of other company that is could have done this work, would have been out of work. That's just no bueno, you don't do that. Unless you want to tell vendors don't ever come to work in broward county again, you don't do that. Is it legal, MS. Adams, sure, it's legal to do that. Is it wise? It is not wise. So, that's just the beginning of things. I'm pretty confident that the third vendor that was passed as minimally qualified was deceitful in their submission and that they are not minimally qualified. You know, we need an investigation, we need the chief auditor and the superintendent to look at this and to come back and tell us everything that went on with this solicitation. What really eats
319me up is this is the contract, closest related to the grand jury removing five me from this board for malfeasant and is not paying construction on the smart bond, five people got kicked off this board. This is solicitation that the administration should have been sensitive about doing everything by the book and everything wise and start framing the very bin, not bringing that solicitation to the board was step one and that's what you asked for, it's what I asked for and it never came here and those are just the confirmable facts right now, but I would desperately would like the chief auditor and the superintendent to look at this and report back by DECEMBER, there's going to be a lot of people looking at this going forward and all early indication iss there's substance to the
320allegations they're making. I want to point out the items he's discussing is not this item tha,'s something that's coming to us in DECEMBER, so I would like to focus because we are coming in on the time, so, the item for us is oo10. It failed, it was brought back to the board to discuss, but the article he's referring to does not focus on this particular -- t me cocoect the dots. This boars job is to make susu solilicitationanand procemenent are done wisely, not just legally, wisely. And this is another award that was made as a result of this division doing solicitation and is I don't have confidence that it was done or anything has been done to my standards. I'll just say it that way and I'm dying to get this investigation gone to put
321this aside, but the allegations of the other solicitation can be confirmed, several of them easily, and therefore I don't have confidence in going forward with solicitations in the construction space right now. chair, is this requested investigation or is this something that can be done between -- if I MAY, MR. Cervera, I will work with the chief auditor and I will send every document to have to whatever investigator because I know the team hasn't done anything nefarious, number one, number two -- which I wasn't suggesting. You're investigating to make sure that nothing nefarious happened. absolutely, I've read the same blog post that was reference and had there's some inaccuracy ins there. nonetheless when we see things like that, it raises eyebrow and is we take a thorough book any time a board member brings concerns to
322us, we have no problem work witching the chief auditor to come up with an expedited process to review and I'll talk to the chief auditor and also the general counsel about the item he's referring to that hasn't come to the board ye. We plan on bringing it to the board next month for a vote, so I know how that plays into a review which we're going do the rounds for the board members anyway to make sure you understand the whole process before you bring it, I know it's a sensitive but a needed topic when it comes to approving our facilities and is projects overall. So, I'll lever it at that, chair, we'll work with the chief auditor. and I have a quick question, just point of order, I'm not sure we voted on -- or
323directed any kind of investigation, so we're talking about an investigation but that really didn't even come to us as a decision. This item failed. That was what happened. So, all of these other things that are happening are not related to this item although I can understand how you're connecting the dots but we're specifically bringing this particular item back, so I don't know how -- I appreciate that you read an article and had concerns but I don't think this board has directed you as a board to do any investigation unless I missed something. I didn't hear a direction for that yet. MS. Alhadeff? my question is to DR. Hepburn on 0010, to the best of knowledge, has 0010 met every policy that we have procedure ethically and you are bringing forward as a question? yes, the
324district has been doing work with these vendors for quite some time, this has been renewed over the years, so yes, absolutely. MADAM Chair? DR. Holness? okay, to DR. Hepburn, on 0010, so, I guess and I appreciate you answering my questions, so we have the funding, we approved the funding, now what's in front of us is simply to approve the vendors who are going to do the work. Er correct. so the funding aspect is out of the way, that's not what we're focusing on. I'm not sure, I'm a little unclear because is there any specific concern by anyone with specific vendors that are here with anyone on this list? there is no concern with anybody on this list. I know what DR. Zeman is referring to so I was providing information on that but as far
325as this item, this list, there's no contractors on this list with any concerns that we're aware of. This is simply approving this to have these agreements approved so we know what vendors we have available moving forward for the amount of work that we have today. right, because I know we brought this item back and, you know, I guess I thought some board members have concerns with specific vendors because the money is already passed and allocated for the job that needs to be done so, what we're voting on is these 18 vendor, whether or not we want to approve them to do the work, is that correct? that is correct. chair, if nothing happens, where does this money go? DR. Hepburn? it goes back into the reserves aiz assume, but there is other consequences of things
326falling apart. And we're not getting done which we have a lot of old buildings with student and is staff in them and there is emergency work orders on a daily basis that our team can't fulfill and we utilize these vendors for such issues. Er. Er last and final comment, MRS. Bulman?Frjts I guess we're weighing -- I think that DR. Zeman's bringing up a broader concern but we are weighing wlrnt we're going to be have the ability to did the day-to-day work that we have o do out of the build advising they are separate, we do have the clauses if we find there is some problem with the procurement clauses moving forward so I'll change my vote to support it. we'll take a vote again. Er before they vote on the item, you have to vote
327to bring it back. we did. I don't believe thereafter vote, there was just a motion and a second but no vote. I thought we voted on it, okay. All those in favor of bringing the item back, say aye. aye. Er any opposed, say no. no. sorry for that. Okay. All those in favor -- sorry. I just had one quick question because I heard some -- again, some ambiguity about whether or not this -- these things would be investigated. I know the board did not give formal guidance or direction to the superintendent but I'm hearing from one of my colleagues that -- multiple colleagues they hope these things are investigated so that if we do need to terminate if something was done incorrectly, so I just want us to be clear about where we are with
328that before we vote. would you like to make a motion? I would like to make a motion to direct the superintendent to investigate allegations of nefariousness -- point of order, we have a motion already on the floor, don't we? no, we just had an item. Er we just have an item, the item is on the table. Er it's oo10, we don't have a specific motion. Er I'll reword my motion. I mover to direct the superintendent to work with the chief auditor to do a thorough review of the procurement methods regarding this item and the item that's been discussed today that's coming to us next month by DECEMBER 9. second. sorry, we're having a discussion here. New public comment on the motion? Board member discussion on the motion? DR. Holness? thank you, MADAM Chair, after voting
329on this motion websinger ear going back to the item to approve or not approve the item? Okay, thank you. yes. all those in favor of -- just a question. Iktsz -- I guess my question is the timing because I would like to see the investigation conclude with enough time to potentially bring this back if we're going to vote on it, is it DECEMBER 9? we're voting on it now. what I'm suggesting, if it doesn't pass, okay, MS. Leonardi's motion is to direct the superintendent to the investigation, so if it doesn't pass f it stay it is way it is, the investigation is done and everybody is clear, I would like the ablebacker ability for this to be brought back in DECEMBER in reliance on the investigation that the superintendent is going to do, so I
330want to make sure for clarification purposes with MS. Leonardi's motion, if the timing lines up, I want to have the investigative report back in time to potentially vote on this again in DECEMBER if everybody dish hate to use the word is cleared, if everybody was on the level and everybody did what they were supposed o do, if this doesn't pass now, I want the ability to vote back on it in DECEMBER, so can I get clarification on the motion, your investigation that you want concluded, are you asking that to be done with enough time to come back in DECEMBER for a regular school board meeting. I said DECEMBER 9, if that's not enough time to bring it back. when's the next meeting. DECEMBER 16. just to be clear on the motion, it's just to tie
331it to this item because there's some concern that it doesn't tie to this item. It wasn't about something else, it is about -- regarding this item, 0010, we'll direct the superintendent to do a review of this item 0010 with the chief auditor and legal by DECEMBER 9. did that motion -- I think it was about the process. I mean, the allegations are about the rfq. Er we can't discuss sd usz that in 0010. hold on a second. On what authority can we not make a motion about a procurement system that is directly relate today the procurement system that it was used for 0010 where the evidence come from 26059, there is nothing na stops us from doing it, it is directly related. MS. Adams? currently you're speaking to 0010 and you're in the middle of
332a motion with regards to oo10 and you stopped and made a separate motion with regards to investigation in general. So, I had a question with regards to, you know, a motion while another motion is at play and then that second motion has to do with something that did not appear on its face to be related to oo10. terrific, to be more careful, I'm recommending to the maker of the motion that the 26059 is thing that we wanted investigated and because that's the same solicitation system in the same department of broward county public school, it does pertain directly to 0010. thank you for that clarification. all those in favor of the motion, say aye. aye. any opposed, say no. Motion carries. Back -- yes? Go ahead. thank you very much. I would like to investigate the
333one that we have, evidence that warrants investigation, 0010, I know information about the procurement stationed around that, we have lots of information about 26059. we're only on 0010 websinger need to finish 0010 websinger ear on item 0010, so her motion centered around that, when we finish this, when we come to the other part, if you have something else, you can do that then. thank you. we have to watch our time. Because we're almost at our 8 hours. All those in favor of item 0 010 as amended, say aye. aye. any opposed, say no. no. roll call. roll call on the item, school board members thompson? yes. zeman? no. alhadeff? yes. bulman? yes. Er cervera? no. hixon? yes. holness? yes. leonardi? yes. rupert? no. item passes 6-3. thank you. We have cleared I believe all the
334items, so we have a public speaker and we apologize for the delay, so if cassandra tusant could come to the paoed yum. -- podium, thank you for your patience. can we stop the clock and reset it. She hasn't started yet. hello, members of the board, my name is cassandra, a proud yaj graduate of broward county public school and is I serve as the south florida organizing coordinator for the social equity through education alliance, I'm here speaking in regards to the finding initiatives taking place across the county, after speaking with parents and teachers directly impacted, there are some solutions I would like the board to consider before the committee votes on its recommendations, would it be possible to delay the meeting on the 18th to allow the community meetings additional time to meet with the board,
335have conversations with fellow -- and have conversations with fellow stakeholders. I would also like to ask when the final vote regarding phase 2 of the redefining initiative is scheduled to take place and has there -- because there has been confusion on when the final decision is being made. Lastly I would like to acknowledge this is a very difficult time for our community and the board is doing the best to support families as they make tough decisions but moving forward, please feel confident in going to the community when it comes to supporting our public schools. Thank you. thank you so much. and again, thank you for your patience. We now will hear from hr regarding the general counsel, an update, and then just to remind the board, we had said at our last meeting that at
336this meet websinger would get an update and decide whether we were going to continue with the internal or if we would want it to move to an external, so, once they give us an update, I will ask you for your input and then we'll move forward from there. alright. Good afternoon, school board members, superintendent, my name is susan from the talent management department and we are going to give you an update today. So, the ad has been posted, since we left you back in OCTOBER through monday 5 P.M., we have 8 candidates that have applied, we have six that are qualified out of the 8, so I'm going the give the director of town acquisition a moment, I want her to explain to you about the search we did to obtain these candidate and is
337then I can answer any questions. good afternoon, DR. Hepburn, community members, angine, starting on OCTOBER when we got the job description, we posted the position later that evening. The position was posted and we received our first applicant within 24 hours of posting. We then met with our marketing team to develop a comprehensive plan to market the position to individuals that would meet the qualifications in terms of the tenure and caliber of legal practice. With that, we developed a social media posting to target via linkedin individuals that would have the qualifications and MAY be interested in joining the bcps team. We further identified all of the individuals, the 46 education law certified individuals in addition to the 3 had00 plus governmental certified employees that are barred in the state of florida and with our marketing team
338developed targeted e-mail to address those individuals personally and to be sure those e-mails reached those individuals in a timely manner, our crm, our communication was first SEPTEMBER, a test, how are you e-mail to ensure when we sent the targeted communication, it would land with those 400 plus individuals. We were successful by the end of that week right around OCTOBER 24 to make contact via e-mail to all of those 400 plus individuals starting witching the following monday, we started personal calls to all of the education law certified individuals. We also sent our e-mail campaign to all outside counsel that work with bcps, miami-dade public schools and palm beach public schools because we wanted to target those attorneys that already have the experience of working with school board and dealing with all of the complexities of the
339work that we do here, so through targeted phone conversations, there were a small mini team of talent acquisition hr administrators that developed a comprehensive plan to make initial contact and then if contact wasn't made, a follow-up e-mail to change the messaging and then a second phone call. We've tracked all of our human contact through those, we had conversations with attorneys that welcomed the opportunity, appreciated the initiation and follow-up calls, some declined exploring the opportunity mostly because of the timing of the year, making a leap from whatever position they're in mid year, did not appeal to quite a few of the people we spoke to. For thaul we spoke to, we did get some additional leads on referrals of other attorneys that they thought might be interested in the opportunity and so we had a very
340systematic way to fofollowup on leadadand track alofofur dadata. So, we had quite a few conversations with thorps that were interested and excited. Some of those individuals were enticed enough and some of them did apply and they're a few of the six that qualify for the position. In addition, in our efforts to solicit and span as wide, as far, we also connected with law school alumni associations and creeper officers at our local schools to make sure we got the word out to more attorneys because we wanted to bring a breadth of applicants. Through our e-mail campaign websinger connected with a cup ofl hundred people websinger were also able to track our crm data to identify how many of the e-mails were opened, how many of the individuals actually went to our crm page and from there
341we also followed up on leads in that way so, we really built in quite a short amount of time a comprehensive recruitment effort that brought qualified applicants to the application process. In addition, MRS. Batista twoent a conference last weekend and we provided her with printed materials to share the recruitment efforts because the ad was not going to close until the end of her conference, she was able to bring that information to her conference and engage in individual conversations with attorneys that MAY have been interested, so the talent management and talent acquisition team really launched a comprehensive and detailed recruitment effort that led to 8 applications and 6 qualified individuals. thank you, and before we go further, I have to take a vote from the board to extend the time because we have reached our 8
342hour limit, all those in favor of extending the time for no more than an hour, say aye. any opposed, say no. Motion carries. I'm sorry, you can continue, I didn't want to -- it was good timing. we want today bring to you a summary of the efforts that we've made to enhance these 8 candidate and is that we do have 6 candidates available that are qualified and we wanted to get direction from you about if we should continue the process in moving forward and our next steps would be to take it to the special school board meeting on NOVEMBER 18 for the board to review the resumes and then make some determinations on what you would want to do next, hopefully from that group of six qualified candidates, you can then come up with a
343recommendation to decide if you want to move forward. okay, thank you so much for the update. Do I have any board discussion. MR. Cervera? first off, I want to commend my colleagues, leonardi, and our legal eagle on the board who are sit ining and agreeing to join the legal search committee. We had a nice and productive meeting on monday in which we went over all of these applications and I was pleased with the ones that I read. I just have one question, chair, if I can. Were we open, what happened? we did reopen it doctor we extended the timeframe for a day and we had one additional candidate, that brought you up to have six candidate tos consider. thank you. and just to clarify because when we left here last week, they were not going
344the meet until friday but time things worked out so they did meet on monday but because we had made an agreement on a specific timeline, we're not really going to go over with them -- we're going to pretend like they're meeting on friday so that we don't muck up what happened in terms of what we agreed to and nobody says we switched up the timeline or anything, so today is really just about are we going to go forward with the internal or do we want to look for an external and then that special school board meet ising when we will get their the input and have the discussion as was agreed upon when we had this discussion last week, so I want to clarify for everyone why they met but we're not talking about it
345because they've really technically, we're not supposed to meet until friday because that's what was agreed upon. So, -- . yeah, so as the chair of the legal services committee, I am a little bit frustrated and confused because I know we had a discussion about the legal services committee meeting and reviewing the applications and everything and due to people's schedules, we did meet monday. I was told by staff that that was okay. I know that staff also spoke with our legal counsel and said it was okay that we met on monday. So, I guess I'm -- we met on monday we caner did a lot of work, I'm very grail t -- grateful to my colleagues for the work that we put in so I'm wondering if we're pretending we did not meet on monday which
346we did and tafs recorded meeting, and we're pretending we're meeting on friday which we're not, what is is the goal -- what we were look tog see with the outcome of the meeting because we reviewed the applications and we came up with some recommendations and a timeline and a process so would you like that to be presented next week? right, and I guess pretending isn't the right word, when it was presented when staff called to say is it okay, unl, -- you mean, on the 10th, that na -- that's the only day you could meet but we as a board could -- there was no way to inform the rest of us, so, what you did is still valuable, the fact that you did on monday and not friday doesn't change what's coming to us
347and the bhoel agreement is it would come to us on a special school board meeting on the 18th so that's still the intention, nights that you did work for no reason, today what we had agreed upon was we would just get an update on how many people applied and decide as a board was that the number we were satisfied with or did we want to go to an external because remember you met on monday, there was a holiday yesterday, there would have not been enough time for us to get the information and review it to have that discussion today which is why we're having a special school board meeting next week. So, I know time-wise, there's no problem that you met on monday but just based on the timeline we made as a board, we're
348not changing the timeline I guess is what I'm trying to to say so I shouldn't say pretend, excuse me for that. DR. Holness? thank you, MADAM Chair, I have a couple of questions. I heard a comment saying we reopened and got an additional candidate would qualified. Wass there -- was there a close date x the process was opened for this person. The comment was made so I want to the get clarification on that. MS. Puente. the application window was anyone open who wanted to submit an application. I heard reopen, I assume there was a closed. can I elaborate on that, yeah. so, we were informed that a candidate had reacher out to our hr team because they were having some technical difficult ti, as a committee websinger agreed to reopen it for 24 hours for
349any additional applicants and like I know, I reached tout someone to apply, they didn't, but like it wasn't like a secret window of time that no one except that one individual knew, we opened it up for a whole 24 hours. got it, thank you, board member leonardi, I can't recall, as a board, did we set a specific end time to which we received applicants or it was just delegated to the committee? I can't remember either. it was sunday at midnight was the original deadline date. but was that set by the committee or was that set by the board? I can't recall what transpired. that was set as we discussed at the last meeting on the time for posting and when you wanted to hear a report on today so that decision was made at the
350last time we met. the additional applicant came after sunday. yes. okay, the committee agreed to have that reopen. Er okay, I wanted to understand. And also MADAM Chair, you know, I understand that we're just deciding whether or not we're moving ahead with the 6 or we're going to have a different process, but is there any way -- well, in order to move ahead, as an individual board member, you want to know the 6 is sort of -- you don't have to go into details but are these beyond -- are they excellent individuals who fulfill the min numberimum and parts of the preferred requirements sos we can kind of be confident we're moving ahead in this way without necessarily being too thorough? These individuals, can someone provide if -- I guess the committee, board member leonardi?
351so, I think the -- we had the opportunity to look at the resumes, we had the names were redacted so we were kind of doing -- doing an anonymous review, the committee -- we felt the caliber of candidates we had were of a high quality, we felt comfortable moving forward, we didn't feel. I don't want to speak for my colleagues, that was the consensus that we didn't feel likebacker like we would have to go back out. do you feel they went above and beyond the minimum requirement, the ones you have seen? yes. I don't know if my colleagues want to -- if memory serves correct, we were served with five at the time that met the qualifications. We had underlined a whole process, similar to a search we had done in the past with questions
352being submitted by DECEMBER 1. So we would likely have to schedule, I don't know, a special school board meeting for the week of DECEMBER 8th as well. I would recommend that as a board member that we use a revised version of a search. Than the nine people interviewing candidates alike. I'm putting any purpose that speed is important and going through the process after MS. Batista is gone and the speed and kind of this idea that we need to hire a lawyer that works for us is kind a high priority to me. sorry, I should have been more specific. And then a day, we could have a public interview with the board and candidates. We did not planned on recommending doing anything additional for that. le thank you for that clarification. Le at this time, do
353any of my colleagues have updates to bring four the board consideration? MS. Low nard'? Leonardi. I wanted to update something on an issue that DR. Zeman was discussing. In the past, we were given council that it was okay to foyer a superintendent based on audit item. This was extremely, -- at the time I wanted to flag that can be mindful that we need to be consistent in the counsel that we get with those items. Thank you. thank you, MS. Alhadeff? yes, I have two things. One is, I would like to see hh1 and hh2 be brought back to the special school board meeting. I know that some of the board memebers made some suggestions to possibly that item. And I think it's important this we value our employees and we make a better decision moving
354forward. So I would like to see those next special school board meeting. superintendent? next week? Is special school board meeting? yes. you mentioned with changes? yes, so there was some board memebers that wanted to see some changes on it, I was fine with the item so I would like to see it come back in a timely matter next week. and to that cause, I voted it down, so that MAY help. When I would like to see is for this will to bring options so we can get the capability that they need. If we're not going to get the extra money. so let me ask general counsel, the item was voted down, can, it has to be somebody who was on the prevailing side that asked for it to come back, is that correct? that's correct.
355okay. I think you have to -- you have to formal low. you have to formally and state that you're on the prevailing side. sure, I will restate that I was on the prevailing side and I would like to bring it back next week and that's dependent on staff to bring the options to create the capability that not just to come back with more data on salary. hh1 and hh2. second. I think it would be helpful. My understand being is that we took it in-house. Compare that against a 20,000 raise or why that's not a big of a deal. we're going to bring back some of the information. MS. Thompson. I'm good. DR. Holness. I have one more thing. Okay. One more item to bring up. On totoy, had d alall ofof r r ion n
356grououps come together. It was, the first time that I have seen this MS. Maxwell and MS. Fusco in the last seven years uniting together and on this resolution. So I think it behoove us to listen to them, take this seriously. And I could request if the superintendent can meet with all the union groups and discuss this resolution and come back to board with a memo and a better understanding on how we're going to move forward collaboratively. noted. MS. Thompson. I have a question. At 6:00 P.M. If you're able to attend I highly encourage it. It's going to be a blast. One of the proposal is k-8 instead of some elementary school options. And my understanding was that there is some state statute or in place that we legally are required to have bathrooms in every
357single classroom and I just want very clear communications because I've been called a liar about this and I can't personally find a state statute that it requires a bathroom. you're correct MS. Thompson. Yes, so we will find, yes I was just going to say that, the team will find that information and send it to you and the rest of the board, so you have it on hand, so if anybody wants to call you a liar. thank you, and also a follow-up on how much it costs on bathrooms. Thank you. before you go further, did we vote on the motion on hh1 and hh2? I don't know if we had to vote on it, you asked to bring it pack. doesn't it require a majority vote? I cannot just ask for it. As powerful as I
358would like to be, that's not the power that I have. so repeat, did you this morning, did you vote to table the next meeting? no, that was not this one. voting it down. o you're voting it down. In order to bring it back in the same meeting, the person from the prevailing side, you know, motions, and majority so now. and just to be clear, we're not bringing it back today so wore bringing it back next week. So I'm not sure the prevailing side will matter. What we're suggesting is to the superintendent is to bring it back. We can see if the people show you and get a pass, that's within his per view, what we're asking is to bring it back next week. through the chair, it good that you made it today, had you
359not done it, you would have needed a two-thirds vote rather than majority the next time. So in the next meeting, you stated that you were going to bring it to the next meeting, so you can approve it on majority. I apologize for skipping the vote, all those in favor of bringing back hh1 and hh2 say aye. any opposed say no. Two noes. okay, we got it. Okay, DR. Holness. thank you, MADAM Chair. So congratulations to all schools hon ard as 2025, florida behavioral interventions and support schools. [Applause] And special recognition goes to oryell and rock lake for their efforts. And second, I would like to thank every one in this county who has been supporting the hurricane relief effort in jamaica and haiti and parts of bahamas and he does not know that I'm doing
360this, but I would like to have a huge thumbs up to my son matthew who took his day off yesterday to fly to jamaica with irvin on a hurricane relief flight to help folks in jamaica and he came back last night. [Applause] So proud him. he took one of mine. So there is 23 schools that were recognized for positive behavior. Congratulations thank you for that. Also I want to congratulate, alice, he is the first state record holder in history for south broward high school. He has his 100 meter breaststroke is now a state record. So congratulations to him. [Applause] Congratulations! I know how exciting, I was the swim coach so I love that. Congratulations to msd and monarch for the, winning the state championship for the band competition, I think it was a week ago.
361[Applause] All right. The scheduled order of business. I'm sorry, staff didn't want to solidify for general counsel for the week of the 8th, they're womening DECEMBER 10 for one on one and DECEMBER 11 for the special school board meeting. what was the other one? the 9th is already a special workshop, so DECEMBER 10 would be one on one with the candidates and board memebers. that's fine. we'll make sure to bring cake. okay, we'll have to, we'll have to can we get about the specials. Every one will have to check their calendar. of course. so we'll have jessica. and chair, I know I'm a no on 11th but if you can give us three options and see if we can get nine on any one those. and a specific time. okay. The one on one and
362specials should be next to next each other due to the candidates being here in person. okay. So let's go back can figure out when we can do the special. go back from there the the candidates can take it. thank you. The scheduled order of business for for this regular school board meeting on the board of broward florida, is concluded. Can don't forget, we have a special meeting next week after our meeting. Thank you. And have a great night.
