Um I would like to uh remind everyone that uh these board meetings are our business meetings that are held in public and they are not public board meetings. The board is governed by Idaho Code Title 74 and Title

00233, Chapter 5 of the Idaho Code and the Idaho Administrative Procedures Act or IDAPA. And we do follow district policies. First is public input. We have Bat Masterson uh regarding student safety on school buses. This will be pretty quick. Uh, my name is Bat Masterson. I live at 89 East Grimmington Road in Apple. I've been a driver for Lakeland for 7 years and I'm here tonight to direct your attentions to some frequent safety violations that occur on the school buses without correction. This has been the worst driving year for safety violations I've ever witnessed with no corrective action and I only drive the trips. So that kind of gives you a clue of what kind of audience I'm dealing with. This year I've had students on athletic trips with coaches on the buses walk around

003while driving down the highway. Students lay down on the buses to take a nap in the floor. Three or four weeks ago, I had a student jump out the emergency room door two days after the kid was killed on the highway from another bus that the door was left open. And that wasn't in our district, thank God, but mine was in our district. There's very strict rules about kids getting out of that door. Even when we do evacuation drills, we don't allow the kids to jump out. They have to be assisted. The bus is high enough that a kid could break their leg, break their ankle jumping out of there. One coach was standing probably 30 feet from another one was on the bus. No one did anything about it. No one would tell me

004who it was. The only reason I knew somebody did it is because when the door was open, it locked open and the kid couldn't figure out how to close it. I brought this to the attention of several people. Nobody did a thing about it. Well, the what you get out of the coaches, the athletic directors, the supervisor of the transportation department, and apparently the board cuz she at least that's where the blame goes. Um, well, it only happened this one time. We'll let it go. It only takes one time. It only takes one time. And if you're not going to hold these kids, these are adults, hold them accountable. The best kids you have on athletic trips are the little kids. you know, they think it's fun. They're going someplace new. The athletes don't. And

005if that's what's representing our school district, man, we've made some bad choices. Um, I was told by the supervisor of the transportation department that she can only do what's within her realm or scope of practice. Well, it's news to me that safety issues is not within the realm of a transportation supervisor. These issues need to be addressed. It's very clear that the school district will not support the drivers when something like this happens. I guarantee you that kid broke his leg coming off that bus, I'd have been held accountable. Not the district, not the board, and I'd have been subject to a lawsuit. And you know what? I'm 78 years old. I've lived my life. I did this as a favor to Jess Denhard because she used to work for me and when she asked

006me to come and help her, I was willing to do it years ago. But I am not going to be the subject of a lawsuit. I'm not going to be the defendant in a lawsuit against the school district. 007I did have one question I would like to ask. Um, well, I appreciate all the documentation. Can we kind of chunk it out? Like the um everything with re respect to the uh shy bond. Could that have been its own PDF and then the financials? Just it's a lot for a patron to have to scroll through when they're trying to figure out what we're presenting. Would that be an option for next time? >> Yes. Okay. I will work on how to do that for you. Jessica Grant, chief finance officer. Um, when I prepared these, would you would like it as a separate report because I've I've been told that I have to make sure that they're all numbered correctly and so I'm just trying to figure out how you would like them there. Um, I believe it's uh there wasn't a report on fund 27 242, which I believe is the literacy fund, and you said something that we're walking away from that or that it's it's no longer we're not going to have that. I was wondering if we have

010funding there this year, why are we not reporting on it? >> There's no funding there this year. There's nothing there. >> No, it was rocked into the general fund. Okay. Um the reason it was included in the board packet is there was activity in that fund in FY25. Um and so going forward after this year there won't be that activity. Um because we didn't [clears throat] have activity in FY26. We won't have activity in FY27. I prepare prepare like a three-year look at the district financials when I present the budget hearing. So next year it'll be FY26 with the FY27 budget and then proposed FY28. >> So it'll drop off. So, the same thing with the bond uh fund 310. That won't show next year either because we won't have a bond or any activity

I do need to point out that it wasn't heard at the May 20th meeting um that I appeared remotely on the one action item for the course for Tiger Stripes. Um, I abstained. I did not vote on that. And so I'm just calling that out because it wasn't called out in the meeting that I was abstaining. >> Oh, >> and but

[clears throat] Um this if you don't mind just shedding some light on this situation >> please. Um, this is a unique situation because this trip has taken place, I mean, in in my understanding, historically for years in the past at both high schools, uh, to various locations

018for skills camps in the summertime. >> It is privately fundraised for, as I think it's indicated in here. >> Um, one difference though is that in the past it has not been considered a kind of a quote unquote school sponsored trip as an official trip of the basketball team. Um, and so they did not use district transportation or seek approval for the travel because it was just all self-transport. The parents got together, they did not need our permission. Um, they do need district transportation for this trip or they at least are requesting it. And so we kind of find ourselves in this situation where we're not just approving the trip, we're also looking at a bigger situation of are we now approving and allowing travel for our sports teams outside of the season. Um because

019that is what we typically have. I don't want to use the word restricted, but that's typically how we've operated in the past and then they've just been on their own outside of those seasons. So, um I I think that's something that I would love the board's direction on. Um or I'd love to be a part of the conversation as well, but I'd love to hear what you all think about that. >> So, they want to use the activity bus. >> They do. >> So, they're paying for the gas >> and you don't need a driver, right? Correct. >> Correct. >> So, I don't have a problem with it. The other [clears throat] kind of complicating factor and um forgive me that I'm fuzzy on the details but I know earlier this year the board had

020a conversation about the range of the activity buses like for this particular trip. This is this is >> Portland. >> Yeah. >> Western. >> But they've taken them to Boise too. >> Correct. And so we just want some clarification on >> but at least that's instate. >> Yeah. And if they're going to Boise, it's usually because of a state tournament, not a outofstate. >> It was a summer. >> I forgot what it was last year because it was one of the first trips they took it and it was I can't remember what it was. It's a long time ago. >> So, the further we go, we do run into some considerations. Um, it's it's possible to do those longer trips, but our drivers, whether they're coaches or actual bus drivers, are held accountable to the

021same maximum number of drive hours, >> right? >> And so, we would probably need to develop some protocols and some systems around >> ensuring that coaches know that they have to tag out after a certain number of hours >> of hours on the road. >> Um, I'm I'm a little bit out of my depth here, so I'm going to look at Jess because she knows more about these rules. We're already in the process of including that in the activity bus um handbook that we have, the protocol that we have. Uh with these drivers being nonCDL holders, uh we've been advised by insurance to actually have them drive less than a CDL driver is allowed to drive. So a maximum of eight hours in a day um with the half an hour break every four hours.

022Um and so that's stuff that we're building into the protocol. We already have a protocol in place. We're just including this information in their um based on the advicement of our insurance agent. Um it's a little bit tricky um especially with it going out of state uh their stance on it is if the board has approved it, it's fine. Um another consideration with these activity buses, they're not allowed to go over 65 miles an hour. they're capable of going over 65 miles an hour, but per transportation guidelines for a vehicle of that type, especially if you're transporting students, um they're they should be going over 65 miles an hour. Um so that does make the trips take a little bit longer than if you were to drive it in your personal vehicle. Um and so

023that's another thing that we're putting into the protocol is just making sure they're trained on that, but to make sure that they're they're doing that. Um it'll be part of the trip sign off as well when they check the bus out and do their pre-trip that they're signing off on all of this as well. Um so insurance as as long as the board has approved the trip it it's allowed um they do recommend since it's not part of season and stuff just having um that acknowledgement from the students um that they're participating um in that trip since it's not part of a season. So >> yeah, and and even more so, it's not even within the school year. >> Y >> and those are not rostered students for the school district right now. >> Um

024and Trusty Quimby, I think you were thinking potentially about the softball trip. Um they had asked to take the buses to Utah. >> Yeah, >> the board decided because it was St. George, that was quite a drive. The board decided not to allow that activity that far. >> Um we've kind of been looking at it. It was 14 hours. Yeah. To St. George. Um, so we've been looking at kind of a 6 to 8 hour. >> Yeah. >> At 65 miles an hour >> um range for those is what we're recommending. Um, obviously anything that is an overnight trip and have a state trip gets approved by the board >> before anybody goes. So >> is Portland at 65 miles an hour with at least two half hour breaks? >> They can they can do

025>> six hours. six hours to Portland [clears throat] or >> seven hours to Boise. >> Yeah. So they they will it will take more than six hours to get there. Um but yes, with the two coaches on the bus, they should be within the threshold that we're setting in the protocol based on the the insurance recommendation and then what's in guidelines for public transportation. >> Right. So both coaches can drive >> both both of them have have their we require anybody who's driving the activity bus to get their DOT physical. >> Um so they do have the DOT physical and then they're trained by our transfer department >> and both of these coaches >> both of these coaches have that. Yes. >> Okay. So this would obviously set precedent moving forward. Um, I mean, the

026vast majority, if not all of our athletic teams have skills camps and trainings and things that they travel to out of season, but they usually just do it on their own. So, that's something to consider as well is that um we like to support those activities, but we also know that we might be inundated with right more of these trips. I >> I don't know. I think as long as they get preapproval, you know, kind of like an overnight trip or whatever. Yeah. Are they renting the bus from the school, the activity bus or from the district? >> Uh, I don't know if the agreement would be a rental agreement, but they would have access to it and they would reimburse the district for fuel out of their fundraised. >> Okay. >> Uh, amount of

027money >> because it would be if the board approves it, it is a school sponsored event, a district sponsored event, they would not have to rent it. Um, they're using it as um part of the district, >> but they're paying for gas and all that. >> Yeah. Yeah. Are they paying for gas or are they paying much? >> They're paying for gas. Um but that because it's not a rental and that's what we would do for any other sports team. Um is just the gas. >> It would just be like and I apologize. I don't want to say just the gas. There is a uh I believe the board I can bring it back just to remind you but the board had approved what we charge for sports trips and what we charge for field

028trips um based on the reimbursement we get from the state. We obviously get no reimbursement from activity bus usage um at all because it's sports trips and they don't reimburse that. But we have a formula that does include just a little bit more for um if they're if they're staying in town. It includes a little bit more than just the cost of the gas so that it covers [snorts] the wear and tear on the vehicle as well for potential replacement in the future. >> Does this open the district up for any form of liability? If you're telling me that these aren't um >> enrolled students or rostered students for this team. I think the way around that is it's a board approved trip as well as um having some sort of an agreement before the

029trip starts that these student athletes are signing off that they it's out of season and they're agreeing to certain standards and they understand that they're going to this camp with a permission slip like we would do for any other field trip. >> And we did get clarification specifically on that. That was one of the questions I did ask our insurance um person specifically like because it is summer um if the board approves it and the board is aware of it. Um, these coaches are technically district employees. Um, and the students are cars. It's just out of typical season. And so, as long as the board approves it, it is an approved trip. We would be okay. >> We would be covered under our district insurance for that trip. Are the are the students um age

030of majority can they can they sign a contract? >> No, it would be a parent on their behalf. >> I thought you said the students would >> Yeah. Yeah. I I misspoke. You're right. I should have clarified that it would really be for their parents. Okay. They didn't identify. So they didn't say how many chaperones are going, but they did list two names. Is the assumption that there's only two chaperones going. >> Okay. Two coaches. >> I believe that there are two coaches attending. >> Okay. Yeah. >> The boys are all It's all the same. 032or [snorts] not attentive to the fact that there is an actual application for this and so I apologize that that >> um I I did not realize to double back and require that of the student. >> Okay. Um otherwise looking at um looking at the board policy this did follow the chain of of command and protocol in every other way. Um so there there is a group of students here at Timberlake High School that would like to set up a boxing club. Um this is not a quote unquote school sponsored club with a faculty advisor. um it would just be a club associated with the school. Um I respect that the young men who were pursuing this club really really did some due diligence and put together some documents that I thought were were fairly

033thorough. Um the bottom line is that we are very concerned about liability to the school district just because of the nature of this activity. um in the fact that it is not a school sponsored club gets us even further away from um you know having having a coach or an expert that's on staff who would be able to guide this process. And so it is my recommendation after speaking with our insurance uh to not approve this club. Um, we certainly want to encourage these boys to pursue this in a safe way on their own and we can steer them could steer them towards our facility use policy even um and and certainly the the decision remains with the board, but it is not our recommendation to approve. >> Well, we can't even have smokers anymore

035if I am, was that there there is a category of just club that is not school sponsored. Um I don't think that that is very common at all. Um >> I believe that there is still the category in the >> in the policy. >> Well, it's the policy says club shall mean a sponsored club of students and then sponsored club shall mean a club which is directly under the sponsorship direction and control of the school. Um because we went to we went away from I mean everything has to be sponsored by the school district >> so that we have more say in >> right because >> the oversight of >> when the clubs came under review it was because buildings didn't even know what clubs were going on in their building >> because there was

036no procedure there were no applications although So the policy asked for applications, it just we we had to kind of rein it in. >> Sure. >> And in doing so, the board determined that it would be in the best interest of the district to have sponsored clubs. >> That makes a lot of sense. >> Yeah. >> Okay. Well, um it, you know, in that case, I I'm I'm glad that we worked that out. Uh >> yeah. So given that there is no sponsorship nor application um we would not I I just there's no action to be taken. >> Okay. Okay. Um I do want the board to know and hear from me that I'll follow up personally with these young men and Okay. I I take it seriously that they did a lot of work

Um, I have not been a part of any of the conversation to bring it back to the board. >> Um, and so if there is something that was missed there, I I am unaware of >> it never came before the board. The meeting it was supposed to come at, that meeting

038was cancelled and then it was it went into the [laughter] abyss either. And so >> uh the principal thought the club had been approved because that's what prior administration had said. Moving on to the supplemental materials. There is a lot of um concern for these books. Are these new books coming in or are these books that are um part of the because I thought we made it

039through all the curriculum books. So, these are new books coming into the district. >> No, these these are books that are I believe already in our school libraries. um but they have not been used as part of a like coursework at this point and so uh a couple of individuals are requesting access to these books for part of their syllabus um at the middle school level. >> Okay. any conversation we'd like to have on this? And it is your recommendation that the online safety presentation only be presented to the students by SRS. >> Correct. Okay. Um, one one other thing that I failed to put in the recommendation that I would like to include in that requirement is that those would be optin um courses. >> Yes. >> Yeah. >> Okay. >> And when would

040they be presented? I mean would it >> um so they would be presented an SRO would coordinate with their building principal to put together essentially like a special class or a program that would happen one time throughout the school year. Um, and so I don't want to say on an as needed basis because it would probably be annual, okay? >> But it's not like um I don't want to give the impression that it would be a regular course like the DARE program is a regular 8-week course that happens in the same sequence every year, >> right? >> Um, this would be a one presentation. >> Um, >> and would this be with the SRO's and the ADSS >> or just SRO's? >> The there are certain SRO's that are certified to teach this specifically. >>

I think that they are all great to add to our catalog just for access under those conditions that were already mentioned. Um, the only level that is actually planning to use the materials at this point is just high school so far. >> Okay. For the internet safety. >> Yes. >> Okay. just the high school. Is that what we said? >> Only the high school is actually planning to use it so far. But since we're asking for that piece, um I chose to include the whole all of the programming that was a part of that um program for lack of a better word. Do we have do we currently

042have um materials of this type for online safety for any of our students? Do we give them any kind of internet safety when they're using our Chromebooks or what are we what are we doing? >> We do give them internet safety. Um this is much much more in-depth than what we currently go to. >> Okay. >> Um right now the internet safety that we provide is uh tame and I think appropriately so it's it's much more broad. it's much more general. Whereas this and the reason why one SRO in particular feels very strongly about this is is he feels like our current coursework right now while it's quality it does not necessarily help students understand the actual gravity of some actions that kids are increasingly taking online. Some of the comments on the books um

043are a little concerning to me. I don't know why we feel that they would be good in our libraries.
