so I'm you e I'm calling to order the governing board advisory committee to review policies thank you it's December 16 2024 and can I get an approval of the agenda please I move we approve the agenda as it is second second all those in favor say I I motion passes uh next thing is the call to the agenda or excuse me call to the audience is there anything about the okay and and the next one is the discussion on policies last time we were here uh we were going to uh review and comment on jii and then uh Katie was going to review uh several policies and then we were going to start with jii at this meeting at the very beginning and then uh the intention also was to bring something that we can
use for um uh incidents and complaints at your site that's what I have down here for notes so um I guess we can start with ji unless somebody has anything for the to talk about beforehand I don't did she do the I think she hasn't done the you done the stuff for J hi hello one second please sorry I have to walk away from people screaming um um okay so essentially I did I don't know what I was supposed to do with J because my my email didn't mention ji but I did do j i h jic c HR ji whatever hold on let me look at my email cron jic G jic Jr and jic e oh I might not have gotten to JK da but if you look on the folder if I
unless I put it in the wrong folder oh you know what I think I put it in the revisions folder I'm got confused with the folders probably I I In fairness to you I feel like we probably should talk real quick about the folders because we've got four that say nearly identical things yeah that's why I'm getting confused every time I go in there I can't tell what folder I'm supposed to be putting things into I thought it was all one folder and then I realized it was not yeah noing board policy I wonder if we just we the governing board's policy we just label it by work okay so then this is um these drafts hold on I'm gonna lab these so where it say the first one draft hold on maybe I can't
re [Music] track the track like previous edits and stuff I'm confused why there would even be a need for separate folder because the we have a folder for the I just relabeled it renamed it but the drafts those were ready to submit so that's like we're ready to show them to the lawyers so that's why that was there final review copies I think this is held in the wi you at those are our final final right like they're ready to go to the board that folder that's um and then governing board committee files and policy edits jih that's this current one we've been working on right okay so then um I'm going to rename this policy edits one 24 25 policy edits and then governing board I think this is just like our old all
of our old stuff so we could probably just make that like an archive folder now right yeah I think that's a good idea were we going over jii because we didn't I thought at the time and I I trying to remember the conversation but I thought at the time we were going over jii because there wasn't a need for Katie to look at it or is that am I making that up I can't remember she's right that that wasn't one of the policies that we asked her to review um I so I'm looking at the document hold on I just can't see which folders are on but I do see that you all have access to it is what I'm trying to determine right now I think let see this afternoon they're in the ready
to submit file I can see oh sorry oh you're fine I'm the the good news is is that these are pretty clearly like statuto confined and so there's not a whole lot of room to do much with these the only room and this is in some of the notes is like where things seem a little vague or Broad in determining like um what something kind of means in the internally for the district some of that stuff is a little bit more clarified in the regulation but then I figured it would be up to you all like how much more clar clarified you you might want it okay so for James and Nicole I just put those policies if you haven't opened it into the folder that says 2425 policy edits editing folder these are the
ones that like we're not ready for anyone to look at but they're ready so the drafts ready to submit that's one there's an archive what's final review cop oh final okay got it got it yeah okay so I think now we've got we know where all the work is so we have what's the difference between drafts ready to submit governing board policy and the final review is that like before the lawyer after the lawyer yeah um or laser for the me just I'm just going to rename it um moving to board approval that makees sense so these are your fin final reviewed I guess it's should be reviewed copies so they've gotten reviewed they're moving to the board for approval these are the drafts we're submitting to get approved archive just old working and then
our working folder got it here sorry to do this um my batter is about to die and I didn't bring my charger does anybody maybe have an extra you used my charger last time right yeah yeah okay let see I have 35% you want to just keep bouncing back and forth yeah over there oh yeah that okay okay cool thank you okay thank you so much okay so again what you want to see so we're we originally we were supposed to look at ji uh but there uh I I don't know if it was necessary for Katie to look at it ahead of time or if we can just kind of go into it or we can look at some of the stuff that uh Katie uh uh reviewed and start with that that might
be better because there's actual I think I remember from ji we had already been going over jii and that there was a piece that needed to be clarified or the language needed to be sorted out okay let me look I don't see anything in there but maybe it's because everything's been resolved I was all can you remind me J is the one we were working on last time right we did touch on it because I think just no last time we worked on jih yeah okay remind me what ji is then What's the title of it the student concerns complaints and grievances I think we were going to start with it today because we didn't really know what people were already doing so we were going to kind of talk correct okay yes I was
like yeahor starting that's what I recalled is that somebody else had this as homework and not me I recall I got Billy sent me what he has been using um for excellencia and then obviously I have manav vist do like what we use for like when kids have concerns or complaints um and then Lolinda told they have a like a basically like a uh they call it don't repost report and so it's reporting but it's more on an anonymous level like you know who the kids are but then it allows them to just put them through and then everyone just kind of seems to have like a general like here's my statement form but I didn't have oh yeah that don't repost report was like rolled out by mcao with all the police departments I'll
have to clarify because I don't know the the Deets and I don't think he actually sent it to me um but yeah that was the that was what they're using is like a Googled form and that makes sense for a lot of things but I don't know that I think that the student complains grievance is whatever is a lot broader than just something you see on social media you can hit a lot of other things too I think yeah what I don't think is happening or what I don't what I think we can approve upon is um and I can only like like qualify to say for monab Vista we really have like one form that we've been like blanket using for everything and so we went through and made some edits so that way
we could like clarify this is what its purpose is I don't think like when we look at it that people have different forms for different for all the different things so B everyone's using a statement form but we use that when the kids think they're being bullied we use it when they want to complain about a teacher we use it if they want to like tell us like we took away soccer for a while and our kids use that for their like want to bring back soccer um it's a catchall form it's like exact thank you that was a much faster way to say it um so we have a similar one at Gateway too so all we so what we did for ours to try to make sure that we were aligned to the
policy is we've just denoted at the top what the um statement is being what the form is being used for and we put those four categories um so that's my homework update for you everybody did you talk to any other schools besides um I was a part of the communication that I think Karina sent out uh asking for those things on there too I I she was was a no it was Evan sorry not Karina uh that Evan sent out asking for and so she was just kind of collecting things for us okay did you see what it said uh I'm not on that communication that's the AP responses people said no uh she said in the if I remember correctly in the message she had them respond directly to her it wasn't something that
was okay okay Post in here or talking here that kind of thing so but my suspicion is is that you're right that most schools kind of have there's no standard form uh for the district I don't know if there needs to be uh but there's I think everybody has a variation on what you described yeah I think the only the only thing I would suggest is if there's a school that's solely using a don't repost report thing you try to car it yeah okay very good um so if the school is solely using don't repost report then I would say that I would just want to make sure that that the students know that they can also file grievances regarding other things and so I would hope that that school would adopt something similar to
whatever you all are describing at your campuses which is why maybe having like a form districtwide that's similar that everyone can start with as a template maybe as an exhibit or something would be helpful um just so that we have that consistency and then also if there's like a handbook where we can make sure kids know that they can report Grievances and things and what that means go ahead I was just gonna say there is an existing um um exhibit that is a Complaint Form um the student doesn't fill it out I believe the district employee receiving the complaint fills it out for them although of course there's no reason they couldn't fill it out and then there is actually also exhibit B or j i c k EB Wait no that's I'm on the
I lost my place I apologize just so everybody um the school that's using that form they that's in addition to the statement form they're using so they're aligned to what everyone else is doing they just have this additional layer to try to catch other things that were getting missed but asking the kids to come down and fill out the form and I believe one or two other schools have adopted that as well so I know at Kennedy they have it also so um but there's also J EB I apologize for Miss speaking early earlier I touched the wrong portion of the screen um which is a student concerns complaints and griev grievances posting to be the included in the student handbooks um and when I checked with Emily she um confirmed that it is included
in the student handbooks so and I know they're going through the process of revising those so we'll make certain it's in the updated versions based on whatever this committee finalizes for it um but it goes through and explains to the student the various things they can file a complaint or a grievance about so that that's and I that appears to be the methodology to be used to ensure that they're aware of um the process and the form okay and is it uh just for my own clarification the uh a grievance and a complaint and a concern do mean different things right a grievance is like a violation of policy is that what is what maybe I don't understand yeah I mean it outlines that students May present a complaint or grievance regarding one of the
following violation of a student's constitutional rights denial of equal opportunity to participate in any program or activity for which the student qualifies not related to the student individual capabilities discriminatory treatment on the basis of race color religion sex age national origin or disability concern for the students personal safety and then um it also refers them back to policy jic if it's related to student violence harassment and intimidation or bullying so there are multiple methodologies depending upon the nature of the complaint if it's a violence harassment intimidation or bullying complaint it would fall under jik in the appropriate forms um if it fits those other four categories it would fit under this student concerns complaints and Grievances and then as Adriana so eloquently put it the additional process that's been implemented at some of the schools
was because sometimes students have a concern that really doesn't rise to sort of this level of process but needs to be able to be reported and um and the staff and Leadership of the site need to be able to engage with it and so that created a more streamlined uh methodology in order to capture those and and handle those concerns so Mr R why why do they why use both complaint or grievance because I mean my limited knowledge of these kinds of things is a grievance means something very different than like a concern or a complaint yeah so I I was not involved in the drafting of the original policy so I'm I can't tell you what the framers of this policy would say as to why they included both um my best interpretation of
it and based on you know the experience that I've had with these types of of items is sometimes it is very similar what Rises to the arena of a concern a complaint or a grievance and the difference could be either the severity or the difference could be the students desired outcome so sometimes someone will tell you and this happens a lot um I wanted to bring this to people's attention I have a concern about it I'm not requesting any specific you know uh um outcome I just want to make sure that it's brought to people's awareness or I'm unhappy with this I want to file a complaint but I'm not expecting some form of remuneration that would be related to a grievance um in the case of a grievance in that case there's it typically
is rising to the level of the student is hoping for some sort of intended you know mediation or remuneration of whatever's happening so and the best example I could give you um just kind of based on some prior experience is let's say um you know we have currently we have co-ed sports but there was a time when we didn't have co-ed Sports a student might come forward and say I I'm upset I would like to Lodge a concern or I would like to file a complaint that I don't believe that it's fair that girls can't play on the soccer team that person may be may not even be a girl right they may just have a concern about it and they want it noted I don't think this is right or I don't think it's
fair that would fall into the realm of a concern or a complaint now the person might be a young lady who would like to participate on the soccer team in that case it might rise to the level of AG grievance because the the district is being grieved for not providing that opportunity for her to play and we could split this into three separate forms they would fundamentally have a very similar format and it would be significantly more confusing because then you'd have to locate the correct form to some degree I'm even questioning whether having um the student violence harassment intimidation or bullying form separate in jik is an additional barrier that may isn't necessary but without looking at the two forms side by side there may be very specific reasons why they're separate in relation
to um the needs of the forms require very different uh components of information so that's that's my best explanation based on the experiences that I've had but I mean this could have been put together this way for for any number of other reasons yeah because I've seen it on the on the employee side I've never heard the word complaint it was always either concern or grievance and there's a whole separate form for employees for the employee concern form I think that's what it's called there are two there there is an employee concern form and I believe there is an employee grievance form and I believe they are separate so working from memory they mean two not two totally different things but one definitely has a lot more influence I guess is the word I'm looking
for yeah um and and that would be a grievance um a concern is exactly what it sounds like I have this concern so yeah I think the difference there is the grievance on the employee side the grievance has to be specific to policy right so you you you can't file you know let's say we had a district after school pickup softball team right and someone was denied access to that softball team I don't know that that's a grievable offense unless it falls under a policy right and it may not fall under policy but it could it could be something that you would complain about um you in the case of students we could separate those things but if you look at the list that's been provided here some of these items you know aren't necessarily
specific to District policy in fact none of them specify District policy which is interesting so I don't know if there's a concern there well um yeah it just seems like they use all three words interchangeably right and I mean for me that's confusing yeah so agree I and it could be separated out I would say either either eliminate two of those or find a way to differentiate between that's my opinion I would rather find a way to differentiate between them in like a progressive discipline s kind of way than to eliminate just because I feel like if it's like I don't know I I do think that we think of them differently yeah so I wouldn't want to like take one out and then all of a sudden we're like jumping to you know I
don't know if there's a specific reason why it's concerns complaints and grievances but one of the things that I note is interesting that you may want to consider is that as you read through it the title is student concerns complaints and grievances the word concern is not used throughout everything throughout indicates references a complaint or grievance so the word concern is never even referenced further end so I see it one other time under D there okay oh concerns about personal safety yeah but I would argue that that does that does not have the same meaning in D that it does up at the top correct and that's the only place I see oh well the first paragraph sufficient concern may present but I don't know I mean I I agree I feel like it should
definitely be uh what did you describe like a progressive type of thing and um I I would argue that it that it should be more in alignment with like the employee side and I mean correct me if I'm wrong but I don't think there is anything that that delineates complaints it's just concerns and grievances right I think it's complaints and grievances I don't believe there's a on the employee side I don't believe there's concerns but again I'm working from memory I can try to take a look at um I know I think that's right because I'm thinking about back to last year we had somebody who there was a complaint and then I thought they fill out an employee concern form though that may be I could be wrong taking a quick look to see
if I can loate it so there's staff grievances which is gbk and the related regulations and Exhibits so that's grievances let me see if I can find the other one real quick unfortunately the employee one is very long you'd think that they would be near each other but they're they don't appear to be to easy to complain I don't know if it's as much as that or if it you you can't make it too easy to organize a policy manual okay maybe it's earlier um let's see if grievance is references it I almost feel like the the title should be changed to be more something like reporting violation of student constitutional rights equal access discrimination and personal safety because myself as as like a parent or whatever I look at concerns complaints and Grievances and
that almost reads like it could be anything I think um because of this is specifically reporting you know in regards to one of these four things constitutional rights equal access to programs discrimination and personal safety I think that's kind of the the more important part of it um Can a non a nonemployee file a grievance um there are types of non-employees that can it would depend on the circumstances an example would be there are circumstances under which a parent can file a grievance yeah I think there's a whole other policy regarding that it does say down here a student or parent um compile a student or student's parent or Guardian May initiate complaint process that yeah most grievances are either tied back to policy or they're tied back to some form of right or um
you know federal statute State Statute because it looks like a a number of these things are like what she was saying constitutional rights equal of virginity those seem like National things I was just curious about that yeah and I am not seeing despite the fact that I know we have a staff Complaint Form or perhaps it's concern form I'm not seeing it anywhere in policy I just did a search and didn't come up with it either I only see the grievance and I looked through all of the grievance exhibits and they are all the various forms like supervisors receip of grievance and I think that was one of the issues that we've addressed as a board kind of with admin last year was making sure that that was accessible because that was an issue in
the past I think correct yes yeah that was a concern that came up I know some steps were made to make it more accessible and then um I know that um it got hung up in all the policy manual changes but prior to all that shifting and reshi thing um I know that um Jessica Sanchez was trying to help us draft a new policy that would create some clarity sort of a clearer pathway so that's probably something we need to dust off again now that we're shifted back so what do we want to [Music] do and then address concerns concerns or [Music] final although I do want to say I'm wondering though if it should be left really General so that way there's it's encompassed that you can about you can have a conern about
something that goes outside of your safety where I on the name changing just because I feel this is allows kids to have more rights in Sharing what their concerns are um if we keep it the keep it like that I just wonder if you put in the title it's about these things people will assume like oh it's these things where when you read it like it's like complaints are like I got plenty and then they look and see um okay so do we want to do like 10 minutes going through and putting in comments or did you not put in comments because you thought it was fine I'm gonna be honest again did not look at it ahead of time I okay let's do 10 minutes we could also I don't know if people want
to change gears but we could also look at some of the stuff Ka reviewed too she's got comments those other polies but I mean I don't want to Sidetrack us so maybe that's not a good idea the other JK da j i c c j i c jic g and jic H E that she looked at that my gosh I've had my mic on this whole time annoying you guys while I'm making myself some food I'm so sorry luckily my kids are outside and I'm watching them through the window so there's no screaming now but thank you for putting up with that yeah I I thought you were making for everyone I'm coming to deliver it now um what I was going to say is um all of those uh the ones that I looked
over today like I said I don't think they're going to take a lot of revisions just because they're so aligned with state and federal laws because of of the drugs and alcohol and all that stuff so and mandatory reporting let's do what you said then let's just go Ahad and look at those now because there probably will need to be more conversations so we can wait for Tim and um Evan to be with us okay so jic are you good with moving to that one yeah it's in the um 2024 25 policy edits folder oh so you moved it for me thank you I appreciate it yeah no problem uh or just jic we could look at them all that'd be great but I just opened up that one first I it is I it
I find it interesting that these are things that have to be actually written down it's like students shall not hit themselves with a hammer I also found that interesting you know just in case it needs to be stated so Katie did you highlight that last paragraph are we looking at jic yes and is my comment there or is it not there it might be I I okay hold on let me take a look again sorry one second vague and we should do a better job explaining it yeah so I put that one in there before I looked at the regulation now the regulation does do a better job of kind of explaining how that goes down obviously because it's a regulation but I just figured I'd leave it up to you all to see if
the what's in the regulation also satisfies you all especially those of you who've dealt with kind of dealing with this personally so that's a Jr obviously where that other polic where like kind of the procedure is at um are we going okay this com this question came came up at last year where it's like are we writing these policies for a K8 District or we writing them for like a k12 and I can't remember I know the question is like the marrying it came up when we were talking about like married yeah so the way these policies are given to us from asba or to work with a anyk through 12 District so obviously there's policies that we have that don't necessarily apply to us necessarily but when we're going through and editing these we're
making them our own so if we know that like there's certain things that are just never going to apply to our district it's certainly in our purview to discuss that we would I would just think remember you're always thinking of the weirdest possible situation or the worst possible scenario before taking something out okay well and I you probably can guess what I'm asking about but I'm like what why are we talking about medical marijuana because it's still like illegal I could be wrong I don't know but like it's do children have medical marijuana cards I think I don't think that our statute like allows like a under 18 person to get one no there is a certification form for Stu for minors who need medical Mar or who want medical marijuana so yes there is
a way for for children under the age of 18 to get a qualif to be a qualifying patient and get permission from their parents oh wow okay wow to know usually it's going to be treating like you know diseases and things that have the lots of chronic pain and that sort of thing okay because you know if you think about it this way also they're not necessarily always smoking there's you know gummies Edibles other ways to treat children that aren't like inhaling anything yeah I think oh sorry we're doing 10 minutes of just of just comment one other thing I'll throw out there while you're looking at this which is a little confusing too is you know it refers to medical marijuana and then in this statute and or I'm sorry in this policy and
then in also the regulation it talks about you know drugs for non-medical use so I think they're inferring in many places without being explicit to kids being in possession of prescription drugs as well that necessarily don't belong to them so so I think just keep that in mind as you're reading through this as well and if you think that things should be more explicit like what exactly are we talking about here then that's another place where I'm saying oh let's maybe list this stuff out so that everybody knows that we're speaking the same language for mayy for for what okay I have a lot of random questions but I'm done looking does anyone else want more time to go through I went through the policy I'm looking at the regulation in the exhibit right now
so we can move forward I think she's she's wrapping up so I'll do that then well and then you let us know when you're ready to look at it okay what does an E stand for again exhibit exhibit exhibit oh literally the first word on the page it's been a long day it's okay it has been a long time me trying to like add a comment to where somebody else already a comment oh you could you would just I guess you can comment on hers or reply yeah okay or you just you just pretend that it's not been commented on and then add it and it'll just like it won't double highlight it but it'll use same highlight for two different comments e ready yeah okay where we at all right so start at the
top um all right my I'm the first comment I think it might just be a comma issue to be honest but I feel like this is a little confusing where it's like shall not knowingly breathe inhale or drink a vapor releasing substance so how I read it is we're talking about Vapor releasing substances only and I'm like is that really because what about like pills and whatnot so I don't know if dummies exactly so that that was all I was I don't know if we just need to add like a Comm like like drink take out the vapor releasing and substance this could include Vapor releasing or I don't know or did we want it to yeah I certainly think that this was probably drafted at a time where they didn't contemplate all the ways
which you can consume yeah right yeah CU I'm thinking like why can't we just put shall not knowingly get high or intoxicate should not be should not use we could use the same language as the statute possess use or transport like whatever it is under the statute um THC which is marijuana so it's so maybe just take out the vapor any substance um I wouldn't do any substance what's the stat hold on let me open up the policy again I know you're is it one of these down here and this is drugs and alcohol and then that was my other Wonder Too is I put it down below for the enhance you could do like use possess transport whatever any any substance um that they're not legally allowed to possess or something like that cuz
that would include prescription that don't belong to them and all illegal substances under the statues okay K are you able to write in there because I I feel like I'm not looking where you're looking I'm one second yeah um okay so we're figuring that out so I'm just going to resolve it but and then my Wonder on top of like this section that we're going to like be looking at is like we had um we had a kid who took the like table cleaner like the Windex style table cleaner and he was just like he was just breathing it ining it um sort of uh it wasn't like he was attempting to so he didn't actually but you know he was threatening to like use it and so that was my only other thing was
like a lot of this is like these are drugs that kids use I'm wondering oh I'm sorry you're looking at inhalent like under the list well that I I put my I put my yes I put my comment there because inhalent made me think like one moment let me find you the statute on inhalence just a second yeah because I I think it's it's structured oddly but I think the first paragraph is referring to inhalence the second the second bulleted list or lettered list is everything else and my suspicion is and you know this is purely speculation is there was a time period where all of a sudden like students were huffing paint and glues and all these things and my guess is at that point in time it just got bolted on to the
front end of it without really clearly delineating that there yeah it's about the time that they started locking up the sprad pain I'm sure um it's 1 it's ARs 13343 and then I would assume 30 401 is the definition section where they'd have a definition of either impal or vapor releasing substance yeah so I I do not think that Windex is on that list just to be clear so there are going to be things that kids could do that aren't necessarily illegal and you just have to decide what to do my question is like we don't have something where it's like taking taking something's out out CAU of context of its purpose in order to get high so like should that be in here that's kind of what I was trying to get at yeah
white out white out thing white out us to be a thing I mean I don't know if we can go that far because then we're trying to make a scientific determination on whether anyone substance is going to get someone technically high right okay I think it's just a little little too far okay there's a long list on this statute of what so students on school property or at school events shall not knowingly breathe inhale or drink a substance and consume take or use a substance with the intent to get high with the intention to get high like I don't know is that not I think that's still taking you a step to too far right cuz you they could do that with the intent to get high and it not be the desired outcome you
know the desired outcome may not happen okay they still I think it's also difficult to define or identify whether students higher up exactly even and that's one of the things that I highlighted as being vague or hard to determine um I think if we stick to kind of the statutory language here is why we're gonna because the way they listed in jic right is sorry let me go back to that it says right drugs shall include but not be limited to all drugs controlled all dangerous Controlled Substances prohibited by law alcoholic beverages so they go through there right and so I think we just need to use the same vocabulary as as the statutes already using I totally agree but I don't know what that should look like like typing it in myself can you
just to give us your first stab at what that should look and sound like um because I'm I'm and which which section of the policy are we adding this to or where are we at sorry lit on the first paragraph okay because I was scrolling down further okay that's right we're making a lot of progress I was too far down that's where I was confused because I was actually looking at the definition of drugs further down okay so um students on school proud do not bu so off yeah that's so weird that this is the opening paragraph yeah I mean okay I didn't think about that before when I looked at this that it was so specific I think students on school property okay on school property or at school event shall not knowingly I
would say possess use sell or transfer drugs or alcohol and and I think what's helpful is further down Mommy I um I see that I'll fix it in a second if you just because because drugs is defined below so if you just use the word drugs and drugs is defined below then you're good okay cool obsess you sell transferred drugs and or alcohol okay cool we got take take okay taking out the like breathe inhale okay we pick it out so non-medical next one is you um so I just was my question was is there a need to define or elaborate on recreational marijuana or is that something just we leave out altogether um because now that it is legal uh obviously it's not legal for kids but I didn't know if there was a
need to address that or not unfortunately like okay so like had this discussion I was trying to recall our discussion very early on in this in this committee so like under 13 3411 which is the marijuana possession statute it leaves like no discretion in terms of mandatory reporting to authorities and that's because it's still that's still trying to comply with federal laws right we lived in Another Universe I imagine we could deal with recreational marijuana in the same way we would deal with underage alcohol use right like you don't have to call the cops if a kid is drinking vodka at school okay um but unfortunately the way the statutes are written you're still required to notify the principal or the superintend or whoever and then they call the police according to the statute so
we can't necessarily treat them differently at this time even though under state law they are technically the same marijuana and alcohol that answer my question I'm not sure uh I think I think she's basically saying that like in the eyes of our policy they're all one and the same so to delineate it in here would be kind of a moot point oh okay I mean technically alcohol is a little bit different because you don't have the mandatory reporting requirement for alcohol that you do with other drugs so I'm saying if Federal la were different there could be a possibility in the future where marijuana doesn't get reported the same way as other drugs but because the federal law hasn't changed and our state law is trying to be compliant with federal law we're still required
to report possession of marijuana to local police so it's no different than Al it's no different than other drugs even though under state law it is I I I hope this isn't confusing because what I'm trying to get across is that yes alcohol is different possession of alcohol on campus is different than possession of any other drug because you don't have to call the police if a student is you're not required by law to call the police if you find a student in possession of alcohol you are required to call the police if you find a student in possession of any illegal substance so then my followup question is do we need to Define non-medical I think you have to do non-medical because you'd have like I I here's what I'm thinking if the kid
brings like um Xanax or something like that in like a plastic bag that's not theirs that's also non-medical if they're using it for that reason then they don't have a prescription for it okay or they don't comply with the policies right and this is where you get into the weeds with the regulation because the whole point is like okay are we trying to stop a kid who's like got some xanes that they got from their friend they get high or are we really going to strictly enforce this policy when somebody just forgets to bring their medicine in their prescription pill bottle and violates the policy in that way right and so like that's kind of where the weed you get into the weeds when it comes down to this little section the non-medical issue there
yeah and it it could be any prescription over the counter drug because that's what's defined in C correct yeah yeah all right that answers my question thank you um okay next up so I'm next and um Katie kind of answered it because I apparently it's mandatory to call the cops but going back to what we had talked about um last last semester last before before the break um I know one of my big things is not wanting to get our kids um as much as possible keeping them out of the Criminal Just Criminal Justice System keeping them out of that prison school to prison pipeline so is there an alternate way to handle it if we find our kids like do we have to call the yeah so un unfortunately there is a um mandatory
reporting statute right for schools it this is not where that's contained the one that talks about serious offenses and other crimes committed on campus where this is actually contained is in the is in each actual drug statute itself so if you're looking at ars1 13- 3411 I I forget which subsection I think it might be subsection D or something like that or maybe further down it actually delineates like if a student on a school campus is found with marijuana you the you shall inform the principal and the the principal shall inform law enforcement so there's no way to get around shs under the law okay okay is there so what happens like so Katie like so if a kid gets caught with some weed on campus and we call the cops like do does the
school District in any way I guess like have to like press charges or how does that go from there nobody ever actually presses charges so once something's handed off to police they decide how they're going to submit charges to either the City attorney or the county attorney or if they're going to do that at all so if they have if the police think they have enough evidence to charge somebody which is probable cause they then take the information that they've gathered and submit that to either the City attorney or the county attorney now who they submit it to depends on likely the the the charge itself and in this case if somebody's possessing marijuana under the age of 21 it is a misdemeanor and I would assume that they would submit this to the city
attorney's office now any other drug is going to be a felony and that would be submitted to the county attorney's office the one thing um just in my experience and I actually don't know how it pertains but the police will ask us if we want to make um if we're making an incident report or a criminal complaint and so that is how like if we don't want to make a criminal complaint then like basically they're just like documenting that we like notified them um and so you can like say say that so that's like I think that is what the police have offered us as like an out or like a way to like determine where what path we want this to go on so I don't know if um so you could so I
think that's very nice I mean I'm not I'm not being sarcastic either that's very nice and also good change depending on operations orders and who's the police chief and who's the mayor and all that stuff right so we got to keep that in mind so that's what I was wondering do we want to like I guess if it changes it doesn't matter I'm GNA finish the thought even though it probably can be ended but like do we want to then put something in here about like delineating that that like we're going to require everybody does a an incident report versus a criminal complaint or is that too nuanced because it's like the police officer Vibes my my recommendation would be to put it in the regulation rather than in the policy okay because in regulation
you know we're typically providing the policy really should be tight to Statute in regulation where we have wiggle room we can you know indicate the preference to Lodge it as a report or we could even say this is how we will Lodge it and then that would protect us against how the department interprets it so if the current Department says oh when we receive these we just take it and log it then we're fine if a future Department determines well when you provide us with this we're going to take some other action but then at least we're compliant with the law and we're um through regulation we're in our staff to take the pathway that's most likely to prevent the criminal yeah you know um process to be invoked and I don't know this doesn't
need to be learning hour for Adriana but I also am not quite sure what the differen is when they because when it's drug related they call it a criminal complaint but then when it's like trespassing um we they've asked if we wanted to press charges so I don't know if it's because we're the victims and that's why it's press charges okay okay correct uh drug possession cases are not victim offenses so anything that has a victim now whether that's a business victim an entity victim or an individual victim those are going to be protected under the victim's Bill of Rights and there certain things in there on ation that the police have to do and it's not just learning I think it's important distinction so thank you for bringing that up no totally and that's
what the whole point of this committee is is like people are not familiar with all this stuffff you know okay so I resolved my comment to this as well um but I can add it to the regulations is just guidance on like when we want to do just what Jay said uh in instrum formal comp a criminal complaint um right because um you know you think kind of typically if you know if a kid is getting into drugs and and stuff there's there's kind of a deeper problem so how I guess this might would go under regulation then is you know not just handing that kid over and then when he comes back okay back to class but there needs to be kind of like followup steps whether it's I don't perhaps like restorative justice
but but something more along the lines like getting getting whatever the counseling or resources something to that kid to to kind of try to help them choose a better path I think any restorative practices would be tied to discipline around the incident rehabilitative yeah but as far as um providing support services for students um I mean that is a pretty normal pathway we have several Partnerships that that we would tap into I don't know that that's defined in policy because I don't think it's driven by statutory requirement I don't know that that means we couldn't put it in policy but who those partners are and how that works really changes depending on who's available to us so um it's it would be more of like an operating procedure in my mind because like right now
we have a partnership with not my kid that we didn't have 18 months ago so that's one of the pathways through which we can get support services for students okay so how about okay so I know we took it out then remember how at the beginning it's like the superintendent shall implement blah blah blah blah um but is there something that can be in the policies then about and and I'm thinking because you know like about utilizing District Partners to yeah so that you know say in the the future down the line we don't have someone as awesome as J Man and um you know to to kind of pre not helping them out on the back end if that makes sense would that be something that could be a part of the um never
mind I withraw that question it proba it would probably fit into regulation better than policy because I mean I'm not saying not to put it in policy but typically policy is backed up by Statute and there's not really statute attached to it well so for instance if we're hop back to ji student concerns complaints and grievances the first paragraph is the superintendent is directed to establish procedures whereby students so is that word it says is directed to establish procedures is that then something that is in statute no you you are correct that is not in stat I was going to say then we hop back to drug and alcohol the superintendent is directed to you know ensure that students who are found to be in possession of and use of blah blah blah are provided
with proper Follow You Know da services and um you know obviously after the cops have been called as per regulation um so that that that's my line of thinking for that if that's something that can be worked in here um again so that to kind of go along with um you know kind of our our mission and visions and stuff of you know loving the kids as our own and and um kind-hearted leaders all that I think it kind of puts some long-term meat behind all that um another um possibility I don't know that it encapsulates it in regulation or policy is that we have that behavior manual Matrix thing and it's it's part consequence but also part uh restorative elements too and like Mr Man was saying that some of that is in just
our our practice that we do as part of um the referral system and everything else that we're we're expected to do um one part of the discipline referral forms there's a there's a piece on there that is specifically you know what kind of uh restorative elements are you using and it's an expectation to have that on there it's embedded within the form um and then we also have the like I said the behavior manual that kind of lists some of the options in addition to like a library of a wide variety of different things for different consequences right uh some of which are drug and alcohol related to not I don't know that it's necessarily like going like exactly the way you're describing it um because it's not like codified in regulation and policy so
I guess theoretically it is subject to change yeah yeah and I think also you know obviously you know a fifth grader who gets caught with weed is for the first time is a lot different than an eighth grader who's been caught with fentanyl for the fourth time or something yeah I'm just making stuff up you know right um so internally that would be that would be a function of Progressive discipline legally it would be a function of what statute says yeah so I just want to do a time check it's 6:15 right now um and uh I don't my understanding is this is the the meeting that we've scheduled out the furthest so my assumption is at some point we're going to have to have a conversation about like at least the next meeting um
that we can go and schedule too so just to be mindful and throw that out there okay yeah uh I was thinking if you go to the second paragraph where you put your comment or the paragraph after it says the student attending the students attending school and the district are in violation Provisions this policy subjected to disciplinary actions in accordance with the provisions of school's rules and regulations we could put disciplinary actions and um like ther not therap support Supportive Services Supportive Services and then that could I just put it in as so we were doing it but we can we can still vote but and supportive services and then even if you want it to be like um no it'll go in the rules and regulations but then we have the Supportive Services in
there yeah no I'm that I'm happy with that good are you okay with putting and Supportive Services no I like that wants to click the check mark I did it sorry okay uh scrolling down um I'm the next comment on the district will not refuse to enroll a student um it says unless failure to do so would cause the school to lose monetary or licensing benefit under federal law regulations and I just was like well we probably know that or we don't know that so do we do we necessarily need that in there or is there a possibility does that make sense I think if you were to remove that phrase then it would read in the affirmative that it will not be refused okay which I don't know if that's good or bad you
know on the because what is the monetary and Licensing benefit I guess that's where I'm getting confused yes so monetary and Licensing benefit licensing benefits could be anything ranging from um we no longer qualify for title funds we no longer qualify for ID EA funds um a catch all it's not that like there's already like these are the these are the rules and you could lose funding for it but this phrase is a catch all like wait if at some point though correct okay then never mind and I believe there are I don't I'm not steeped them to know the specifics but there A lot of times there are levers that for the federal government wants schools to comply with certain things and so they build levers into the various funding source so if you
don't do certain things as an example like easiest examples with our nutrition and wellness if you don't comply with the nutrition and wellness um nutrition guidelines which I'm using the term loosely because some of the things in those guidelines aren't what our nutritionist would say is the best way to go but they're required by the federal government in order to be eligible so if we were to choose to ignore those we would no longer receive those millions of dollars that fund our free and reduced lunch program so that's a a simple example and really isn't necessarily tied to this particular policy but there could be and probably are similar things like that that are specified all right that sounds good um okay so then we go down to the bottom one where Katie it's your
comment about that last paragraph being really vague yes so I think that goes back to again and we're still on the policy not the regulation right correct um hold on let me reopen that okay um okay yeah if District officials have reasonable belief that a student may be under the influence for me under the influence I felt like uh was you know a pretty subjective thing and so I just wanted to um I think on I said this on the regulation like how are we making these determinations I guess is my question because it's also an issue in the regulation itself yeah I could tell you in practice I actually had I saw I have V vitals check Clarity was my comment on this too so as it stands right now if we like are
made aware that something might be going on we do we send them to the nurse um for a vitals check and she just does like their oxygen their heart rate and um like pupil dilation basically and then um if it's outside of the norm that's what like one way that we consider like they're under the influence uh the other thing that we like suspected Under the Influence is if they were like if we have enough evidence that like they were witnessed smoking by either an adult or like a peer um that powder under their nose yeah yeah so well this one paragraph I just want to clarify is all still in reference to medical marijuana right and so that's why I had a concern about under the uence because okay so let me go back
up here hold on yeah and my concern was under the reasonable belief because what constitutes that so I'm like well he's giggling too much I reasonably so yeah it says a student medical marijuana card holder shall not possess or engage in the use of marijuana on District property in a district vehicle or at a district sponsored event now so what I'm saying is like let's say they can consume it somewhere else oh yeah but now we're talking about Under the Influence being different than use which is what's referred to up there and so that's where I was kind of getting in the weeds of like okay if a student was treated because that's what you should call it right prior to coming to school are they now going to be like interrogated or you know
what I mean if they look like they're under the influence of something I guess that's where kind of I'm at with trying to cons like reconcile this par with the other paragraphs in this section about medical marijuana yeah and Katie I you know one of the things is this paragraph is all about whether law enforcement authorities are informed yeah exactly so my question to you would be and I just don't know the statute well enough is the under the influence component part of the statute or do we have leeway to disinclude that because I would rather not have it in there if we don't have to include it um you we we still have the leeway like if we observe that a student appears to be under the influence we still have the ability to
have them checked by the nurse because I think the primary concern there would be is the student safe right yeah exactly so so obviously we could still continue with a safety check for the kid but I you know I think our our preference would be to air on the side of not informing when possible so that case unless we are unless shall as you said earlier yeah like I'm going to the medical marijuana act now because that's separate from the criminal code it's in the Health and Human Services code so just one second sorry 2801 yeah I have a question too um uh and I'll start it with I am not a medical Authority but my understanding is that people uh that have medical marijuanas especially children like I was I was of the understanding
that children uh their type of medical marijuana is not hallucinogenic it does not in include the ingredient that would typically get people high so Under the Influence for me would be that they're um the implication would be that you're probably taking something that is not Medical marijuana for a child again not a medical Authority though the way medical marijuana works is that you literally just get a card that then entites you to certain amounts and tax-free benefits like you don't like there's no dispensary that's got a doctor that's dispensing it you know it's actually just regular dispensaries where you're buying this and you just get benefits of like tax breaks but also certain more amounts more frequently depending on you know just because you're a medical marijuana card holder I thought that was for adults
I thought it was different for children um not necessarily so there's a lot of like products that are CBD yeah that you can just buy without a medical marijuana because it's typically like in topicals like lotions or ointments for like your icky joints um bones bone joints um but no that is like yeah because anything you're going to use for medical Mar is going to have THC in it because that's that's the that's the drug that they're believing is causing the healing effect right I mean obviously CBD is a part of that but it's not the whole thing and that's why CBD you can just buy at the store um or on Amazon or whatever um and so so really it's the THC that's going to be providing the healing effects and so that would
be an any kind of marijuana consumed by a child or adult with a medical marijuana card now I'm looking at the um because there's a specific definition of marijuana and it doesn't go into like doesn't go into the chemical breakdown um but it basically talks about the plant and blah blah blah but there's more to that as far as like what we're talking about here in terms of under the influence um that's not something I'm seeing in these statutes yeah I'm not seeing we're going to be submitting this to an education attorney to review just remove it at this point for the committee's preference and then if it needs to be in there I would assume you know the other legal review would capture that for us yeah certainly I think that would we could
probably figure that out do we wanna do we want to St here yeah so I vote for the yeah let's just delete it and then wait and see just to wrap up that are you good with the delete wait see okay would you mind deleting it um I'm gonna click check Mar like cross it out or delete it I think we last time we did not I think you should cross it out because I think last time we started deleting we realized that was not the smartest so the whole paragraph strike through do a strike three yeah 3 I don't know that we can do the whole paragraph it's the it's the last Under the Influence yeah it's the I'm just kidding which part do you want me to scratch out a student maybe we
just we're just removing three words and a comma Under the Influence Under the Influence um so looking at the calendar uh I think that if we're sticking with Tuesdays we would probably need to be the 7th and 14th is a board meeting or um I feel like the first week back from the break is going to be feeling chaotic so I wanted to see would you guys be a open to a Monday or a Thursday the week of the 20th because the 21st I have letters training so I wouldn't be able to attend um when is our first day back you can't at that point huh uh we I have a question out to the attorney to verify but I haven't heard back yet yeah and I'm actually I've just recently applied for a cohort
and then also a real job so um no I I haven't heard back on those yet but you know that should be coming down the pipeline soon so yeah and I'm thinking I was thinking about it too and ultimately when this comes to the board then that'll be my opportunity to look at it again and throw in whatever ideas I have okay um okay at that point we come back on the sixth we come back on the sixth but the seventh so the 13th would be feasible if you on a Monday Adriana but the 20th is Martin Luther King holiday and I'm guess people wouldn't want to do that I didn't think that she'd want to do the you guys would want to do the 13th because the 14th is a board meeting so what
about the 23rd if you guys are okay with two I want to the board meeting I got I you're welcome to move on without me but I will be um I think I'm am out at a conference on the 23rd yeah I can do the 13th virtually my husband's just out of town all week the 13th for work in a different city oh oh okay so it sounds like the 13th it is yeah I'll just have to join you all virtually again since my husband will be out of town okay Monday the 13th the 23rd but we were GNA try to get Monday the 13th if you're coming with that work um Monday the 1th I'm not sure probably not that's GNA be the night before my my first board meeting um but there's nothing
else on the calendar I don't think uh Thursday the 16th we have a social event for the bond passing at with McCarthy on that day we count on the 16 the 20 January are we we're at the 28th then I mean we could do the 13th and then hopefully as long as Tim comes or somebody or Evan then you have Quorum yeah do the 13th and just yeah I hope the two of them can okay okay one of them can come yeah uh the 13th of January yes we can we um throw up uh invite for the 13th yeah throw up throw up and it may be for Nicole either way if he self- selects out because of other commitments or if the attorney says no it wouldn't be appropriate for a board member so
it it may not make a huge difference anyway and if you know I think having an parent on the committee is a good thing I can ask around I know quite a few that would I would really like having a parent on the committee and in fact I think regardless of whether you'll be returning we could use a few more yeah I can MERS put the word out do anything else with the good of the order nope can I get a motion to adjourn motion to adjourn I second all those in favor I meeting adjourned did we talk about what we're supposed to do next week I mean before the next meeting the reg like everybody look at the regulations maybe and have
