001cool configuration for you for our next meeting um and I'd like since we don't have officers yet I will go ahead and call our meeting to order for now until we have officers selected and I'd like to give a few minutes to our governing board president Sophia curio doll who would just like to greet you to the meeting hi everybody good evening for those of you who don't know me my name is Sophia carildon the governing board president and I just wanted to take the time to thank you guys for actually being here and contributing to this committee discipline policy is something that's been in the talk of the board for a few years so I'm glad that this is finally coming to fruitation and we will have your guys's input to better see how

002our policies can impact in a positive way for our students so thank you guys for being here thank you okay with that um because this is a board committee we are bound by open meeting law I think we did pretty good because I did a call to order and our board president did a welcome and that's what it says under number one on our agenda so we've been successful with that so far but to make certain that we're successful moving forward um we have with us this evening uh Jessica Sanchez who is um the attorney for the district and she is going to give us an overview of open meeting law so we all understand it so that way as we're proceeding forward with this process we're able to make certain that we're in compliance

003so with that I'm going to turn it over to you Jessica all right and I was told to try to keep it to 20 minutes so I have my clock in front of me and then I will all right I'm gonna give some overviews so um first of all thank you very much to the committee for what you do and for taking time out of your um schedules to take a look at these important policies so just um just as a visual before I talk about open meeting law it's important just to look at governing boards the administration and then whenever governing boards have a board committee you're really kind of an extension you know of the governing board but everything the district does we're governing board or Administration you're all operating in a fishbowl

004meaning that everything needs to be transparent and the public has the right to know everything that you're doing so this is this is a public institution it's paid with tax dollars and so the public has the right to know what is happening in the district and so the Arizona legislature has been very clear clear and courts have repeatedly upheld the intent that the public have access to the governmental process and so this is mainly accomplished in two ways when the governing board meets and then when any of their committees meet they're Bound by What's called the open meeting law so that the members of the public have the right to know how the official business of the board is Tran is is happening the documents they have a right to know what's going on they

005have a right to attend the meetings the administration is held accountable to the public by by the Arizona public records laws and so this just gives the public the right to access any public records that are created by the district so everything that the district does everything is pretty much open to the public with some exceptions and then there's of course some certain things that are kept private like certain investigations Student Records but for the most part everything the district does needs to be open so that fish bowl was just kind of a visual of again government is open and people have the right to know what's happening to question what happening to look at records so board committees when the governing board forms a committee that committee must follow open meeting law so you

006guys are obligated just like the governing board is to follow Arizona's open meeting law and I have a slide on here that pretty much sums up what the obligation is so the open meeting law basically boils down to four and a fifth major points the public has the right to know with some few and very narrow exceptions where you hold your meetings what you're going to be talking about what decision you make and the reason for your decision and the public should have equal access to this process so that's basically the open meeting some uh the public has the right to know where your meetings are what you're talking about what decisions you're making and then everybody should have equal access to that information and then I'm going to break it down in these next

007few slides okay so first of all notice we need to make sure that we're giving the public notice of where meetings um of where they can find information about the meeting so typically school districts will have a physical location where you know we advertise it on the website here's the physical location where we are going to post information about any future and upcoming meetings and we also include it on the website where's the physical location okay so that's usually on our website so the public always knows okay if I want information about where the meetings are going to be posted I go to this place and then when we have meetings notice that those meetings need to be posted in those locations where we've said the public can find that information at least 24 hours

008in 24 hours in advance um to the members of the public and to the general public that 24-hour period includes Saturdays if the public has access to that physical location but excludes Sundays so you can post on Saturday for a meeting on Monday but you can't post on Sunday for a meeting on Monday but the public needs to have 24 hours notice um for any agendas and upcoming meetings your agendas need to have notice of the topics and then that's the agenda that everybody has in front of them that agenda needs to clearly State what you're going to be talking about and so the public should be able to go to that physical location or look at that website take a look at an agenda and know okay I understand the board's going to talk

009about these issues or this committee is going to talk about these different issues any matter that's not specifically on the Gen on the agenda that's brought up during the meeting that needs that discussion needs to happen on a future agenda so you can only talk about things and take action on things that are listed on the agenda because again the public has the right to know what you're going to be talking about so that they can decide whether or not they want to attend there was a new um there was a bill that was signed into law that also just said that our agendas need to have um need to let the public know at what time they can access the oh and your agenda does that at what time people can access the room

010where the meeting is going to be held we also have to make sure that we're holding meetings in a room that has a large enough capacity to host the amount of people that we anticipate attending um let's see but anything that's not specifically on an agenda you cannot talk about it and then every member of the public has the right again to access that information so the district needs to provide note to come provide accommodations for anybody that needs an accommodation whether that's because they have a disability or because English is their is their second language or if they don't speak English at all so anybody should be able to contact the office and ask for a translation of an agenda or if somebody is visually impaired we need to make sure that we have

011in our website should be accessible to anybody who's visually impaired so that no matter what disability or language barrier everybody has the right to that information all of the meetings that you do um need to be open to the public so all meetings of any public body shall be public and all persons who desire to should be permission permitted to attend and listen to the deliberations and proceedings so you are a board committee you cannot have any secret meetings everything needs to happen in a public meeting sometimes you might have members of the public that attend sometimes you might not but the option needs to be there that if somebody wants to attend and hear the deliberations that they can and then all legal action has to occur during a public meeting and then just

012so you know a meeting is any kind of gathering of a quorum of the committee and that's in person or through technological advice devices and it includes anything that's discussing legal action proposing legal action or taking legal action or deliberating actions so a lot of times you'll see on an agenda that there's something called like an information item or a discussion item or an action item and that usually means sometimes you're just being presented with information sometimes you're discussing information sometimes you're making a decision all of that is considered quote legal action that happens that has to happen publicly so just because you're receiving information passively or just because you're only talking about something that's all still considered legal action in that it has to happen it has to be on an agenda 24 hours

013in advance and it has to be happening publicly so even just talking about you know these agenda items it all needs to be done in public at the committee meeting we talk about well actually I'm going to talk about it now meetings can also include a one-way electronic communication by one member that is sent to a quorum that proposes legal action or an exchange of electronic information what that means is is that if you're engaging in email conversations with each other or if maybe five of you are at you know a gathering somewhere and you just decide to talk about the the committee activities you're holding a meeting so anytime it's a quorum of you and even if it's just email discussions phone calls or in person that's considered a meeting and then if that

014quote meeting is not on an agenda 24 hours in advance and then happening in public it violates the open meeting law so that's kind of like the big part of this discussion today is understanding that meetings need to be on an agenda need to happen in public need to be on an agenda 24 hours in advance so that the public has the right to come and see and hear the discussions if they want to what that means is it violates the open meeting law like I said if a quorum of you are talking about any of these items outside of a meeting okay so especially if you're not used to dealing with open meeting law it's important that you understand that the work that you're doing on this committee all that discussion needs to happen

015here when you're at a meeting that's been on an agenda so you can't be um you can't be discussing among yourselves outside of these committee meetings the actions um you know or the issues that you're going to take up all of those discussions needs to happen here in public at a meeting that's been properly agendized and give and notice has been given to the public 24 hours in advance some people try to do and there's all different ways of violating the open meeting law some people try to What's called splintering the Quorum these three people talk and then these three people talk and then one of those people in the group you know kind of share information back and forth It's really just important to understand there's really just no getting around the open meeting

016law you have to have your conversations in a meeting that was on an agenda that was provided to the public 24 hours in advance if I sound like a broken record it's because that's basically the main point of open meeting law your discussions need to happen in a meeting that was properly agenda is that was given to the public 24 hours in advance anytime people try to basically get around this requirement you're creating liability for the district and the district can get in trouble for not following open meeting law so it's very under important that you understand your obligations you know again not to try to there's really no you know don't talk to these two people and then go talk to these two people and try to understand where people's heads are you know

017in terms of a decision the discussions just need to be saved for an open meeting that was on an agenda that was given to the public 24 hours in advance and there's all different ways let's see I have in the PowerPoint which you're going to get a copy of right okay and there's all like I said there's all different kinds of ways of violating open meeting law that's why it's just important to remember just take a conservative approach to this save your discussion save your ideas save your input for when you're all here at a meeting that was on an agenda that was provided to the public 24 hours in advance there are some exceptions to the public part of a meeting and then I'm just going to go over some of those quickly that

018might apply to you um boards and then now you're you know you guys as a committee you can have what are called executive sessions those still have to be on an agenda the public still has to know that you're going to be having an executive session but these kinds of executive sessions allow you to have conversations outside of the public ear so when the governing board is here typically they'll go into a separate conference room to hold their executive sessions and that's because they need to have a conversation that needs to be private um and then there's only certain reasons that you can do this and I'm going to go over that not all of these are going to apply to you but just so that you know the governing board will do this sometimes

019when they need to discuss confidential Personnel matters if they're reviewing confidential records for example Student Records if they're getting legal advice from their attorney if they're providing direction to their attorneys on certain you know negotiations or contracts for meet and confer um and that's just for the discussion of salary and benefits International Interstate negotiations and the purchase sale or lease of real property because obviously like if you're selling a piece of property you want to be able to have conversations privately about what you may or may not offer or what you may or may not you know accept um the one that will probably apply to this committee if it ends up being necessary at all might be legal advice and tip in this isn't allowable again executive session because anytime you get um advice

020from your from your legal counsel you know that's something that needs to be private confidential you don't we don't share legal advice publicly unless there's been authorization to do so that's really probably the only one that might apply to you is if you wanted to get legal advice on one of the specific aspects of the policy you could do that in an executive session if you do have an executive session there has to be minutes the minutes have to detail and we don't give these out to the public but we do have to have them in case the attorney general or someone else requests them later we have to take minutes that include who was there what was the subject what was the agenda item that we discussed and then any any specific directions that

021we're given if you have a legal advice executive session or any executive session but that's the one that's going to apply to you you cannot take action in that executive session that executive session is just for you to have a confidential discussion and it's just so that you can speak freely you know in terms of again like I said if you are asking your attorney questions you can ask questions in executive session that you may not wanted to have asked out in public but only the discussions are held in executive session any final action that this committee takes you know in terms of forming your recommendation to the governing board all of that action has to be public and then has to take place out here in public where other people can know what action

022you are taking there are some other things I had some common issues that come up um calls to the public this committee might decide at some point that they want to hear from the public and you can do what is called a call to the public where members of the public can come and and speak to the committee and give their input if you decide that you want to do a call to the public um if that you cannot discuss anything that's brought up from public comment that is not on the agenda because your committee is very specific likely members of the public are going to be you know talking about what you're talking about because you're looking at policies but still it's important to remember that this is not the time to have a

023back and forth discussion with the public this is just the time to hear the public and then you can go on with your meeting but typically you don't even respond unless um there is unless that matter is on the agenda okay we talked about email already but again email I mean I don't know if you guys are going to be emailing each other I just wouldn't suggest it again if you feel like there's um an issue that you need to discuss um could they let you know Hilda or who would they propose a proposed agenda item to probably you in the chair once they elect a chair and so you can propose to the chair I think this is an item that we should discuss but please don't be emailing each other because like I

024said then you're just putting the district in liability and you might violate the open meeting law all right I'm gonna see if there's anything else I want to highlight that are those are the main points that I want the committee to know sure yes Hilda's awesome at that so yeah typically when you're getting information from Hilder from the superintendent it'll come at you just one way in a manner that you're not able to reply all and say I really think we should do this I agree that this is you know again your conversations as a committee need to happen in a public meeting that was on the agenda I do have on here excuse me all kinds of examples of people getting in trouble with email and again my advice would just be don't respond

025on email passively receive that information from Hilda or information about the next meeting but save your input and your discussions for when you're here with the committee and conducting your business um all right if the open meeting law is violated um legal action any legal action that you take can be voided there are also civil penalties um of 500 up to two thousand five hundred dollars that's for a second and a third offense so typically you get one warning but please just don't even get there and just just don't do it just don't email each other don't talk to each other about these items just save it for your meeting and Miss Sanchez personal fine right and that is a personal find not one thank you not one that the district pays for the district

026cannot pay that fine for you so just don't put yourself in that situation you can also be removed from your committee assignment um and then the the Attorney General's office can order other things for the district in terms of um getting back into compliance these are some useful references you know if you feel like on a Friday night you want to take a look at the agency handbook for open meeting law all kinds of useful information that link is on this um PowerPoint there's a lot of other things in that PowerPoint that I just put in there because it applies to open meeting law I just wanted to hit the main points for you you can also reference the governing board policies for the district and then if you go to section B all of

027the basically open meeting law is put into all of all of the policies in section B there's a whole section on agendas on minutes on notice of meetings and so again on a Friday night if you're interested in the governing board's policies that implement the open meeting law you can take a look at those any questions or anything Hilda that you want me to point out okay that wouldn't address it's the policies and so and it's one thing if you're calling a colleague you know do you have some advice on some behavioral interventions I have this I have this issue at my school hey what kind of behavior plans have you done at your school I mean that's all specific to you trying to give a Student Assistance but hey what did you think about

028that change that was being proposed to the student conduct policy or hey what's your thought on the dress code policy all of that you should say for here okay I'll restate the question the question was um if you're a School employee and and you're talking to a colleague about just behavioral interventions is that still okay and my answer was yes because your specific committee charge is reviewing policies but save your input about the policies um you can talk to other colleagues who are not these colleagues but save your input on the policies and on the suggested revisions for when you're here because this is the place to have that discussion and the good thing about this committee I mean it's it's a big spectrum of different individuals from the community with different roles so all

029of those perspectives should be talked about but here so that any interested member of the public can hear that dialogue in that back and forth and that's the purpose of the open meeting law is that the decisions that you make and the reasons for those decisions that all happens in public and anybody who wants to attend can hear that any other questions that was 19 minutes exactly it was one of our governing type on here that works whatever means I'm just gonna open the word document I can't help with unlocking any doors ever so don't come to me for that special thank you yes I was gonna ask I didn't know what your name was hi Adam thank you so much for being here man thank you you could be having so much fun right

030now I'm sure at home how great are you in UNM thank you so much for being here man um all right I have this word document open because we don't have a like an easel to use right now and I know there's not that many of us but maybe if there's multiple nominees I will just yeah type things up here oh yeah let me do it right here already on mirror but maybe one maybe when I escaped yeah I was leaving PowerPoint my sorry no you're fine I just noticed it I also noticed it my bad there we go sweet yeah that should be a boardroom there we go oh now maybe it'll do it because now when it resets or something yeah thinking about it there it goes there we go all right so

031um I guess to kind of give you all an introduction to this agenda item as far as chair and a vice chair go essentially when it comes to committees and or the board the board has a board president and a board clerk that's essentially the chair and the vice chair of the board and so these committees are looking for a chair and advice chair the chair's main responsibilities um and this is like in statute somewhere and in Robert's Rules of Order but whatever um it's usually basically their main responsibilities are helping develop the agenda for every meeting and so if you're interested in being the chair I would say just count on that involving a little bit of extra leg work in communicating with Jay and me and Hilda in between meetings so we can

032discuss kind of what the agenda items might be for the following meeting and doing that in time to like comply with the open meeting law rules you just heard about so it takes a little extra work however the committee is not huge which is what also we were going for so hopefully you're not going to get inundated with like a million requests for agenda items and things like that um so there's a chair and then obviously the vice chair whenever the chair is unavailable and the other thing that the chair does is run the meetings so essentially you would be making sure we're staying on track for the agenda um that you've helped create and then also I think in the long run scheme of things making sure that the agendas are getting us to

033where we need to be at the end of the timeline that we voted on as the board so that being said I know we haven't like done introductions in here yet but I'm assuming most everybody knows who everybody is or no so we are missing two members right now Mr Diaz and we're missing three Josie Valenzuela James Diaz who's on his way oh okay and um and the parents okay so there are three members who aren't here yes I'm hoping to help with the Community member once we get done with the future dates discussion then I can go and coerce someone into joining this committee um then I'll have the I'll have all of my information to give them to be like you know you want to do this um yeah so knowing that those

034three folks aren't here I don't know are we wondering if Mr Diaz wants to be in leadership on this committee okay since we know he's on his way I just don't know if we should did he say he was like he said it'll take him less than 10 minutes I don't know yeah I think it'd be good for an introduction for sure yeah let's do let's do it was I was gonna say I've seen your faces but yeah um and then Jay's got the fun Mike there it's okay it's okay so you know who you possibly are nominating hi and ask what house are you in okay and then just reiterate the other three people and so Mr Diaz where is he at yeah this is a secret quiz for you Jay secret quiz thank

035you I remember the last name is involved sweet any questions about these two roles and or what would be required of you if you did in either of these things before we get to it sure and you know only the people here so you know [Laughter] um okay and then just to recap really quickly just so you also are aware before you commit to anything you know obviously we haven't had the discussion about future dates yet so you're committing kind of without the knowledge of how often we're meeting up until the final points and then I don't have it in front of me but there is a community council meeting in April April 11th that's correct it's my sororities founding day that's how I remembered what day the meeting was and so it's April 11th

036and that is where we are bringing our recommendations then there's a week in between that it is April 11th a seventh board meeting a couple weeks because it was different that's right that's right your birthday and so they're the cushion in between is for if we have to have a possible exact session like we had discussed to get advice from Jessica on all of the things we've then decided to possibly propose to the board um and or have an open meeting or both basically um so knowing that our timeline goes through basically April 11th we need to have our recommendations ready to present to the public on April 11th we don't know how frequently we're going to be meeting yet but you will need to be available to help set agendas and possibly help with

037um other things that go with the agenda details finer details there's all that I don't think there's any other information that's needed does anyone want to nominate anyone else or themselves for a chair go ahead Adriana just don't give the mic just don't give the mic back to Jay at this point I think Ryan would be our i-a-n okay um c-i-n-d-e-l-e-l-e okay sorry cool that's because I read my Kindle every day um any other nominations for chair wow okay all right well no one else is going to none Brian do you accept the nomination yes thank goodness okay all righty um do you have anything to say for yourself didn't know if you had anything to add about your interest or [Music] something yeah foreign fun I like it wow okay I'm not the only

038nerd in the room uh Mr Diaz is here welcome um we are currently taking uh nominations for chair right now Brian's the only nominee uh Brian's the vice principal at Gateway we did some introductions before you got here is there anyone here you don't know this is Adam he's a sixth grade student at Monte Vista other than that we're good and would you like to nominate yourself or chair of the committee chair of the committee okay okay I just wanted to give you an opportunity you know all right so Brian's been the only nominee he's accepted it um okay so are we at a second we need a second yeah somebody to move because we don't have we need to move and then okay me and Jay can't move or second anything or vote on

039anything so it's all up to you guys so somebody needs to move to approve Brian as the chair of the committee okay okay and then we just need a second okay all right then we don't have to do a roll call Vote for This I'm gonna have to do a roll call vote for this right I believe oh okay all right Brian Adriana we're going fast and I've already forgot Alan gosh okay James and I've forgotten your first name Megan okay Adam all right sweet congratulations Brian um you're welcome to come up here and decide who the vice chair is going to be if you don't so I can sit down thanks so now we need a nominee for vice chair does anybody have a nominee for vice chair uh chair is gonna run requires

040a little extra agenda um any nominations there we go any other nominations am I allowed to make the move a motion all right I moved that uh James Diaz be nominated for vice chair roll call vote yes yes all right we have a chair and we have a vice chair you have more energy than the rest of us Ryan so this is and tonight it was only because tomorrow there's a big meeting in here and it needed this setup so I just wanted to let you guys know so the next agenda item is agenda adjustments so around a little we could skip around does anybody want to move anything all right yes all right oh no well I was gonna exit out of here surprise so the next thing on our agenda is discussion on

041policies jic j i c a dash r j i c f j i h j k j k d a n j k e h someone request information just keep that I'd really like to uh you know that we can look at additionally essentially I think Sophia um I think she essentially trying to um as well so other than just and obviously the first one be pretty much anyone there has to be some these policies haven't been and that there's like a I understand we don't switch and that's really the impetus for all I plan for school I one of the and so so that's why see who's here Community counselor sure hello oh it's a lot louder than I thought it was going to be my name is Inigo Montoya no sorry okay um

042so it's actually two questions and a question slash request uh so the first question is you mentioned that these policies were collected policies are these Creighton School District policies or just policies from other places so that's a great question the policies listed and that are in the back that have the edits on them are actually Creighton District policies however I will add the caveat that most districts have adopted their policies from suggested policies that are given to them by the Arizona School Board Association or asva right we had we vote to adopt them as board members usually at the end of each policy if you're looking at it on board docs it'll tell you the lat when it was adopted and or the last time it was updated so you have an idea of how

043old something is I don't know if the print out in the back has that but the actual printouts from bordock should have it um so that gives you some idea there it also will list the related statutes some of those statutes will then tell you the more more details legally speaking of the requirements Behind These policies there are things in these policies that are not legally required um I didn't bring it tonight but I have I went through this entire packet um because I wasn't sure where this was going when we had it as an agenda item and I made lots of notations where I cross check things with statutes um so I will be walking a fine line of plainly explaining a statute and knowing everyone in here is intelligent enough to not think

044that I'm giving you legal advice on how something may apply to something okay because I'm not an education lawyer right um but hopefully I can lead you all to the water and you will drink it and you will see what is included in the statute and what is not so there are things in these and these policies that are not required by Statute or little things where shall or may have been switched out where we just have to see what do we want for our district you know it doesn't always have to be exactly what asba has required as long as we're still in compliance with the statute and that's where these discussions in these committee meetings are important but then also at the very end obviously advice from the council actual qualified counsel like

045Jessica who've practices in these areas a second question you mentioned I thought I heard you say that some of these were edited is the so is this the policy and then someone went and edited it in red to Mark things out that they decided shouldn't be there yeah so I think I think um Sophia two or three board meetings ago Sophia Kario doll had put this on an agenda item and she had brought this document as a proposed thing that the board could adopt as is um at that meeting there was discussion the whole board I think was there and discussed it um and discussed the fact that we thought that it would be best rather than adopting something that one person has kind of proposed that we create this committee to do what I

046just said and rambled on the microphone that wasn't getting picked up about basically it was getting because it just wasn't getting closed captioned oh okay great okay well and if I if I could add it just for clarity in our packets there's tab two behind tab two what you'll find are the current policies as they exist um in the in the district policy manual so those are the ones that Katie referenced earlier that are the ones that come to us via asba that have been adopted by the board at some place along the way and you know just to corroborate what she said not that she needs my corroboration but very often what we find I've worked with asba with policy for close to 20 years now it is rare that they send us anything

047that isn't a change to bring something into alignment with statues so when statute changes they send us changes if statute doesn't change typically they don't touch anything so there really is not a lot of work by way of asba looking at Trends in education like what's happening with student discipline you know things that that were mentioned earlier like if we're trying to have a restorative practices approach none of that's taken into account in any of their recommendations with the policies their policies are purely to create some form of compliance with statute based on whoever is currently their attorney's interpretation of what would align with statute and you know uh like any other three individuals you could put in a room if you put three attorneys in a room they won't perfectly agree so did you

048like the way I put that I didn't just like lay it on attorneys it's like any three individuals that was very nice yeah that was very nice um that second part as as Katie was explaining was that portion that our board president did bring forward and I believe um that she also reached out to some other groups and got some advice on you know what might be types of things that could be changes yeah and just to be transparent and specific I think specifically so if he is a member of an organization called School Board Partners she's in a cohort it's a fellowship across the country Nationwide of school board members across the country um and I believe this is something they've discussed in in that fellowship and so something she wanted to take on

049and that was kind of the launching point for that and getting advice from some of those folks so hopefully that was helpful and not distracting okay and then the last thing was and if this exists already and I just don't see it I'm sorry for asking but and I don't know how the rest of the group feels but in uh in I've been in committees like this before and it's really easy to go off in a lot of wild different directions it's really easy to get lost in the weeds um I personally uh since it's a governing board advisory committee I think it would be very helpful we always refer to them as governing board guidelines in other committees where you say this is these are the the four points that or three points or

050whatever uh that we would like you to think about as you approach your work so we can focus the work um like so the the expectation is by the at the end that it's somewhere in this ballpark not in outer space does that make sense and I don't know how other people feel but I know me personally it helps guide the process and just to be um trying to clarify there as far as guidelines what would be an example of like how concise are we talking here I'm curious the short answer is I'm not sure not not Norms I feel like Norms are something we can develop as a committee I'm thinking more like um I don't know I it's kind of like mission and vision type driven type stuff you know like these are

051the things that we want to by the end this is where the goals that you want to we want you to have accomplished certainly so um I this is something that I could definitely talk to Sophia about getting on an agenda so we can further discuss the guidelines I know time is critical um policy and the handbook certainly like what's the deliverable certainly so I definitely will bring that up at a for a future agenda item I can get that to Hilda and so we can discuss it I will say that I am not going to be at the next board meeting um so hopefully even if they discuss it without me there that's fine maybe we can try to get it on the next one so that it's just so that we're not skipping

052a beat with the committee because I'd hate to waste anyone's time so I'll figure that out so I just had a question about process because when it was first presented there was a lot of there was a lot of Crossing out and adding on so is our process to look at what has been provided as ideas as our Baseline and how we could move towards that in that direction almost kind of like what you were asking about guidelines or are we starting first with like a more organic discussion about each of the policies and how we see it playing out in Creighton because I feel like there's two paths that we could go and they're gonna end up a very different Road probably the same outcome but I'm just wondering like yeah yeah so from

053what I recall from our discussion I don't know that it made it an emotion but there was a discussion during that meeting about using that document as a guideline or a starting point that being said I would hate for it to limit you maybe their starting points for discussions right I don't think you're limited obviously there's nothing that we voted on or said specifically that limits you to starting with that it might be a good reference for when you're starting discussions about specific policies as far as like where this boat goes and which direction and how in which procedure you take this in I mean that's really like Brian's thing at this point and so um I would say you know this is a smaller group it's a lot easier to come to some consensus

054about certain things about you know how you want to do this um in my obviously in my experience I've been on two of these one at the city and one at Phoenix Union those were our giant committees and was a pain to figure out what consensus was for anything or what direction to move in so I think it's given that there's a smaller group um that that it might be easier to figure out like this is how we would work best as a group to kind of address these things um whether you know you take it and you're like we're addressing these two policies at the use meaning or we're having this discussion at the next meeting you know what I mean um and that might also be a good conversation for the chair and

055the vice chair to maybe even ahead of time kind of map out a big picture overview of how it might be best to like get through all of this by April 11th and it could be a discussion you have in a meeting and then you know it kind of just gets worked out as far as agenda planning with Brian and James or something like that but again that would be something you might want to agendize and another thing that we didn't agenda is tonight that we might want to put on the next one is I don't know if it's just assumed but I know in the other committees like kind of how the order is going to go generally speaking I don't know if you've noticed we take on we take a motion we take

056a second for things um so generally it's like a rough version of Robert's Rules of Order Robert's not the easiest person to work with um and so I think that's something that you all have the power and I know you all have the power to kind of decide but once you've decided what it is that works best for you all in terms of like whatever Rules of Order whatever you want to call them that work for this body then you just gotta stick to them so that's something that can be agendized in another meaning too if you want to have a discussion about that if you feel like how it works isn't conducive of getting this work done like as long as we're abiding by the laws that Jessica laid out everything else the sky's

057the limit okay so just keep that in mind because I hate for people to feel like they're in a box and I hate to for you all to feel that way with the with the um with the policies too in in that regard the very last thing I'll say to this point is that doesn't mean that you can't also create like a new policy or a new or like an entire handbook that you know like thinking outside the box into how can we add to this we're not just taking away we're adding or we're making a new policy whatever that looks like like let's just be as creative as possible with this right as long as we're in line with statute and we're feeling good about what we're doing you know and then the last

058thing I had and this is probably just for my own edification um when I was looking at some of the edits they were like great in I think like Theory but as somebody who was doing discipline and still is doing discipline logistically they didn't they were going to be much more difficult to follow through so what like when we talk about policy are we still considering like how the procedure of that policy would play out yeah 100 and so that's why when I saw this and I the night before I had been sitting at my kitchen island like looking through this not only looking at it for like a legal thing but having worked in schools before and assisted in this kind of stuff like I was like it's not gonna work well I'm like

059eating food and whatever like so um yeah no totally exactly so there's totally things in the in the suggestions that are illegal one and there's totally things in the suggestions that just aren't going to work practically too okay so just keep that in mind and as we get through them I'm happy to give you my opinion not my advice about what those things might be okay especially with the legal things I can just point those out what I my opinion might be um exactly as far as like how it would go on yeah exactly the Practical aspects and that's the whole point of having this community because I was like we can't be none of this pontificating and then like forcing things down people's throats yeah some of it was super easy it was like

060we were like these are the things we'll do if we go past 10 and then suddenly it dropped down to three and I was like the paperwork you know so yeah so I think kind of getting back to some of the things that I've heard and this one is we definitely need to come up with what is the purpose of the review and then once we have the purpose of that review then we can talk about next steps of how do we actually go about this there's one thing that we just heard that I think we should probably consider anytime we start any discussion which is what is in our policy that is legally required to remain in our policy because if that is there and it is a legal requirement there is no wiggle

061room around it that would have to stay and so I think then if we can start by saying okay this is what's legally required to be in here per all the statutes following the rules understanding there's a difference between shall and must and maybe sometimes we interpret it as must instead of shall but if we start with that realm I think we can start with that and then we can get into the discussion once we have those guidelines from the governing board James in terms of we start with the legalities then we look at okay the guidelines that we've been given on the purpose behind the work what are we trying to accomplish and then if we go back and look at the practicality piece and make sure before we make any recommendations that we

062run it through all three of those lenses I think that'll be kind of the work that's before us does that I'm seeing heads none does it [Music] and maybe it's more oh this is a strange process right here is the and and I would just see this as another component because I mean it it it's nice that it's a small Kitty but it's also a little dangerous that it's a small committee um I think feedback is wildly important um and uh stakeholder input is wildly important um and just you know I people always so the trying to trying to process this in a way that is not going to be coming off as confrontational sometimes sometimes there are initiatives that come down the pipe right and that's fine most of them are legal in nature

063and you have to go and do that sometimes there are initiatives that come down the pipe that people have no idea what they are and they become the the people that are responsible for implementing them I.E the people in the classroom or the people at the site levels they don't have the feedback a part of it they don't know what their role is they just know I'm supposed to do this and it makes it really really difficult to implement something when you don't have buy-in from the people that are supposed to implement I'm not talking just teachers I think people at the site level as well so I think that another component an important component is how how do we facilitate or is it our role to facilitate I don't know the answer to that

064question either maybe it's not it could be your role I think maybe I was wild and like just being like let's leave this pretty broad for you guys to figure out what you want to do one thing I will add is that we do have an upcoming agenda item I know we're running short on time but the agenda item is about public comments and it's coming up on number seven and so there's some suggested language there that Hilda pulled from Tucson um for a budget advisory committee they had in their committee they decided to only get public comment through written stuff ahead of time certainly you all can decide how you want to set up public comment for your meetings that's those are suggestions you could allow for people to come in person you could

065allow written things ahead of time um kind of whatever that looks like I think that's a good way to start the process for people being able to give feedback um again we can get to that at that agenda item but I just wanted to point to that as like something that might address what you just brought up and then from there anything else you all can think of as what you want to do so I think kind of looking at the agenda probably what we should be doing right now is we've got these policies these are the ones that have been recommended that we start with um and we can do uh related policies also but if we start with these policies is there anything anybody can already see that we would need to add

066to these policies sorry one thing I said to Jay that I didn't say on the microphone was I do have notes and so what I was depending on hopefully we're not planning on have a meeting next week since this is a board meeting next week but I'm trying to commit to um getting the related statute and highlighting things for you all to see so that you can see oh this corresponds to this spot in the statute so it's not really me giving you any advice I'm just pointing to things so that you can read that and then read in the statute so you know oh this oh the statute says shall but our policy says or vice versa that wouldn't be good the policy says maybe we've made it a shout like we have some

067room to change there right um so that sort of thing so that's what I would commit to trying to do depending on how quickly the next meeting is set obviously okay to hopefully help you all out with that starting point that you're looking for so does anybody have any thoughts on like we've talked about how we would approach it taking the legal view looking through the lens of the governing boards guidelines on the purpose of this um and then comparing it to the existing recommendations and kind of working through those parts looking also at practicality any thoughts on any more thoughts on this one before we kind of move on to meeting schedules and oh oh that's okay we're good um the only other thought I had is as when we do get um further

068guidance from the board about our purpose if as was suggested like one of our purposes as we're looking at these policies is to make sure we're not only legally combined but we're also aligning to our district initiatives it would be I think it would be helpful if if we received like here are all the initiatives in the district that might be impacted by this um so that we have some sense of what that scope really is in terms of alignment if it's a policy I see the policy I I it's like the tail wagging the dog I feel like the policy should come first and then the initiatives should align with the policy right or is that backwards you would think right however I think that sometimes in the past and people you know that's

069the problem when there's like a misalignment with um obviously I'm not do whenever I say this I'm not saying anything about any board numbers now or in the past right intentions are intentions or whatever people have certain backgrounds or perspectives my the thing is is like if boards are passing um policy or aren't in their entire tenure editing a policy right but also passing initiatives without looking at a Pilot like that's where that starts to happen right and so over the years initiatives have been approved without even considering how it affects a policy or vice versa right and so these two things have been happening kind of in isolation and I think now we're trying we're going to try our best to get these two things on track the best we can with without having

070to erase all the initiatives that we have going on right now so it's more like a symbiotic relationship yes one can affect the other yes if I could add you know there's there's a variety of things that all happen simultaneously and I don't know that there's always awareness of the intersection with policy so the best example I can give you is our strategic planning work that we've done over the last few years and one of the things that's come through both board guidance and the strategic planning work is the focus on Equity access and diversity right but our policies don't always lend themselves to equity access and diversity and that's Arizona State legislature right because the Arizona State Legislature doesn't really lend itself towards access equity and diversity so there is there may be some

071places where there's disconnects between statute and the direction that our governing board guides us we're fortunate to live in a state with local control and so our board has a lot of leeway to guide us the the issue that sometimes gets created is the bodies who provide us with the model policies are trying to ensure tight compliance with statute and I'm not suggesting we should be out of compliance with statute but for us to be able to have those board-guided initiatives or strategic plan components what we need to do is crosswalk that compliance with the desires of the community as to what they want to accomplish and so this is one of those opportunities to do that with the student discipline policies it may end up proving a model for looking through all of our

072policies with the same time of lens if that makes sense no that's okay I I I yeah I think when I start when as I've looked at some of these policies like it's particularly JK student discipline which is super focused on to what degree we can suspend kids for disciplinary violations that's really misaligned to our the philosophy and the practices of this District in terms of addressing a child is is a whole person which might include suspension but it's not limited to that and our policies really don't reflect that value so I think it's part so I agree with you James it's not about we want to write a policy that supports a particular initiative but I think it's that what is the intention of these initiatives and our policies allow those intentions to and

073reflect those intentions and the philosophy behind them one thing I was just asking Hilda about was we aren't agendized for an end time um in a previous committee I had Jennifer who was our old attorney as my attorney on that committee and she she would yell at me if I finished even one minute late but luckily we are not agendized for an end time so no one's going to yell at us except for the people that are here we can yell at ourselves or the folks who are helping us out in the back so I will just point out that I know part of this is my fault that it's 6 52 now um but obviously we need to figure out when our next meeting you know when y'all's next meeting is and uh what

074was that second thing the public comment thing we don't have to take action on that today but the next the future dates is obviously of importance for moving forward yeah I think we should definitely move on to the future dates because I don't want to keep Adam I was going to say yeah also we always have a lot longer in mind like I'm sorry buddy for you [Laughter] so moving on to the meeting schedule I think one we know we've got a definitive end date of April 11th we have to have whatever that final product is at this point we have questions about what that final product is and so it would be difficult for us to set the entire schedule I'm thinking because there's more information that's needed before we can get there um

075but maybe setting the next meeting date and putting like knowing we're going to intend on that agenda to set the remaining schedule to make sure that we can meet that date of April 11th being ready to present to community council so now comes the fun part where everybody has to look at calendars and figure out what day works and then just keep in mind there's a board meeting on October 3rd so obviously I know we're not meeting next week and then October 17th as well and I am out of the state window of time like two weeks three weeks I mean I I think you know as as we look at the agenda and some of the concerns and considerations that have come up um I don't know if we can I think um you

076mentioned Katie that you're not at the October 3rd meeting and I don't know if we can turn the agenda item around fast enough for October 3rd um I certainly can email Hilda and Hilda tonight if I have to just get that on the agenda and have that discussion at least that doesn't mean we're necessarily going to have the meeting you know the day after or whatever but at least we can try to get that addressed at the next meeting yeah it would just be nice to have the full board though for this discussion especially since you're acting as ex-officio with this group I'm sorry I'm going to the Foo Fighters no I I I both I'm both respectful and jealous of that but what I what I will say is that maybe October 17th would

077be the right date for that board conversation and if that's the case then it might be best to agendize the next meeting of this group for a week after that somewhere in that vicinity just to ensure that we're not pulling everyone together using taking your valuable time but we're still missing a key component we need to move forward certainly that also gives me more time to put together the document before you all okay so Tuesday meetings in between the board yeah I'm not here but I would be at that conference yeah but I'm going to be on his way to that conference yeah I don't know if he's not here if you're here if we can still have it here yeah yeah and I'm I'm you know I my goal to be here is to

078support everybody but I don't want to hold us up either so I think everyone's perfectly capable of moving on without me in the room and so as long as everyone's comfortable with that I'm fine with it being scheduled are you going to that conference no I'm not okay so I can be here because I'm not going October 24th works for me October 24th 5 30. it's 5 30 okay with folks tonight I will always be like 10 to 15 minutes late but that's okay yeah that's okay for you guys that's true I would want to make it earlier in case certainly yeah Adam you're okay with 5 30. all right thank you all right so it looks like our next meeting I'm getting a lot of head knots everybody's in agreement will be October 24th

0795 30. all right and then the last two things on our agenda the first one is the guidelines to address this committee do we want to discuss that now or do we want to wait until we have more guidelines from the governing board on what our work is going to be request but I'm personally okay with postponing it especially since it's 6 57. just throwing that out there but I do have a request you said that we can request information um I would be excited to see other districts if they have something similar to this that we could use as a comparison the only one I'm aware of is Scottsdale they have a student code of conduct um it's a pamphlet I think it's like 8 000 pages though um but Scottsdale has one I'd

080be curious if there were other similar districts that have something like this in place follow-up to that Scottsdale's huge right are you when you ask for similar are you looking for like similarly sized only an elementary school district me personally I since this really kind of cuts into the um Dynamic of the community I would personally like to see districts that have similar socioeconomic status a similar uh makeup of ethnicities cultures things like that if that's possible certainly um and then if this was a point of contention on a previous committee if those districts are like from another state no I mean to me it's just a data okay as long as the dad I don't know how everybody else feels but because it might be hard to find some of that here just to

081be honest because we are kind of doing this I don't know of other districts who've done this work on this specific topic in this state I can look for it um there might be other districts in others can I ask why somebody would be concerned if it was out of state because we do things no I'm just saying the other committee I was on people were always like wow there was comments about things not being exactly aligned like okay so and then they would say well this is invalid I'm not going to consider it because it's not exactly aligned the way I believe it should be that's a little pity okay I don't care ultimately but I think to avoid like a possible issue especially for like people who aren't part of conversation if the

082states in which we're getting it match like the political landscape that we have here like I don't know if yeah all Arizona families would like us to be modeling it after certain States so that would be if if we could find justifications telling me not to go back to my old employer Portland Public Schools yes okay good to know I'll take a look-see this is like the things I think are fun Brian Googling these things um okay um can I make a request just to please can we just do something where we say for the next for public comments for the next meeting that we just stick with that please email them to Hilda and then we can figure out a more formalized process in the next one is everyone good with that for now

083cool that works one thing I wanted to add was Adam we did like a whole bunch of rambling about those policies I'm very curious like the reason why we wanted a student on this committee is because like we believe that you're entirely capable of looking at these things and giving your opinion on them right you have to be the one that abides by all these rules right and so if you're if you're reading through the if you have sometimes like look through these policies and if things surprise you or you're like what the heck is this or that's not how that works at my school um don't worry that your principal is here but um please like just be as like don't don't be scared to speak up one and don't be afraid to like

084say what's on your mind that's why we want you here and that's why you're here okay I know it's easier said than done because it's a lot of adults just rambling a lot um but please whenever you feel moved to say something or you're thinking about something you know we're all ears that's why you're here because what you say is important okay yeah it's something Katie just because it wouldn't be breaking open meeting law he can talk to his principal okay okay so you too can talk okay so I was just gonna ask it would be okay if he and I sat down and I was like read this policy and tell me what you're not sure about before we come okay cool get ready buddy what did I get myself into yeah maybe there's

085some sort of incentive we can provide from me personally I'll figure it out Adam thank you okay I have all my to-do's I'm emailing the agenda item I'm making that document and I'm researching other districts and then you're looking at the initiatives or whoever you delegate that to anything else we missed that we're supposed to be getting for the next meeting and then our next meeting will be October 24th 5 30. we have agreed that any public comments need to be emailed to Hilda prior to the start of the meeting how early hello I believe it said noon on there all right prior to noon the day of the meeting and then we will review all of those and we'll have the agenda ready 24 hours beforehand when you make the agenda can we focus

086on perhaps like one policy or just give us enough time for him to get some information about what we're looking at ultimately sorry if you're reading the closed caption this might seem strange but it's very ironic to pass microphone right next to each other um is this being videotaped it can stream online that was a request of mine oh all right okay about the accessibility did not know that I I think and be aware people can watch the rest of the committee for Time and Eternity the rest of the committee just I think we can do the whole head nod thing for now because we seem to be working pretty well with that right now consensus is what we're calling consensus there we go so for the sake of making sure that we can actually

087talk coherently about the policies and keeping in mind Adam's going to have some really really boring reading to do before every one of these meetings that is going to need additional support because I know I need support sometimes in reading the policies um are we okay with limiting it to one maximum two policies per discussion as long as we can get through enough discussions to make it worthwhile in the end and still produce the product please all right it looks like we have consensus I think we have discussed everything on the agenda at this point last thing though I will hype this if you have staff meetings if you have Team meetings anywhere encourage people to watch these meetings if they're at home I'm sure it's thrilling um if give public comment obviously the public

088means people that work for this District right or parents or anybody right and so if we want what you're looking for James we're going to have to like let our colleagues know and let the community know that these meetings are happening to get some interest going on that um again you could decide in the future too that you have some other way you want to engage before the community council meeting that that can be agendized and you all can discuss that in the future as well so all right certainly yeah okay I think the only thing left is a motion to adjourn do I have consensus you can make them I make the motion to adjourn all in favor yes hi and bring them back to every meeting now you lose it before the
