e e e [Laughter] good evening at this time I'll call the meeting to order and we'll stand for the Pledge of Allegiance I pledge aliance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liy and justice for all thank you and let the record reflect that all board members are present uh first up we have audience with individuals do we have any of those okay thank you next moving to C1 superintendent update thank you Madame President and uh Happy New Year to everybody so our first week of school is now officially behind us and uh it's it's been a great start so I want to thank all of our faculty and staff our parents our teachers uh our students um everybody

for an awesome start uh the normal little hiccups that you have at the beginning of the school year but um everybody had Smiles on their faces and working hard um also want to thank our uh police force in both cities uh they were out very strong helping us out um with traffic flow and and getting everybody um into the pattern for the school year so we appreciate that their efforts in our neighborhoods and around our schools um and we really thank them for that um additionally last yesterday uh yesterday evening our PR department and Mr M's Department really Renee um and her Department Ryan everybody along with uh uh dsb live had our first ever um Galla for our football teams so media day and it was in these three rooms where we had media

show up um and interview our kids and Renee did a great job putting on kind of a media class for our kids so they brought their captains from all four high schools over there they had the photo shoot kind of like the glamour shots and Ryan pumped them up and did all those things over there with some awesome things and then they did some live commercials next door um so great job to both of those departments uh for everything you did and uh you you made a difference with our with our kids in our community so thank you and with that that's that's all I have thank you next we have governing board update um I just have a quick one I did attend the new educator orientation at the vista and there sure was

a lot of energy there and I think this year the furthest somebody moved to come to derer was New York isn't that right so that was nice so just welcome back everybody the school year has begun and this is it as you may have noticed or not noticed on the county school superintendent website is a current list of candidates who have filed for election for the 2024 election and I have chosen not to seek re-election at this time and I just wanted to say best of luck to all the candidates and I want to say thank you to the community for this opportunity to serve you the past four years all right thank you moving ahead to item D1 I move to approve consent agenda items as presented second motion carries okay moving to information

discussion item F1 Dr Coto thank you madam president uh tonight we have a special presentation um and a special guest uh with us tonight and I'll have Miss spidel introduce this item thank you Dr Cotto good evening Madam president members of the board cabinet and Community um tonight we are bringing information to the board related to what I know we've been hearing about quite a bit for the last few months and that's the casmar versus Maricopa County um judgment and so really this did have a a pretty significant impact to to taxing districts our district included and so um we asked Miss Heather mock with Maricopa County school superintendent to come provide a little bit more information because it is such a complex um in you know source of information so I know she's the

expert in that so with that I will turn that over to her all right thank you Dr Cotto members of the board guests it is not often that I get to come talk about school Finance although I usually like to talk something a little more positive than what we've been facing this year and this year the challenge for the past three months I think that all the districts and myself and several of the related agencies have been talking about is the class action lawsuit Casmir versus Maricopa County our office the school superintendent office actually has no statutory authority over the process for tax judgments or taxpayer refunds you might be wondering why I am here to talk about this specific issue then my job title is is actually assistant superintendent of economic management and a

major uh significant role of mine is to work with the school districts to establish the tax rate and so this judgment affects the tax rate and that's how I got to become an expert um not only do we assist with establishing the tax rate we are the Fiscal Agent for many non-pilot school districts daar is a pilot District so we are a little less involved in your finances than some other school districts and um the tax rates actually are officially approved they will be approved August 19th by the county Maricopa County Board of Supervisors so how did we get here exactly what is the kasmire lawsuit what is it about I take no responsibility for this slide I borrowed this from the good Folks at steel the bond Underwriters um because as I said I

am not an expert in tax judgments and resolutions but here is what I have learned and I'm going to try to make this as as simplified as possible from 2015 all the way to 2023 any time a property in Maricopa County changed from a um non-rental to a rental property there are two different ways that you can classify that and we like to say that it was an interpretation of Statute which happens all the time statutes are are approved and agencies interpret those the statute and how they apply them and and the way that this particular requirement was applied was when a property in Maricopa County from 15 to 23 changed from a res a rental to non-rental or vice versa that there was a choice to apply one of two rules either rule a

or rule B and the rule a or rule B depends on whether or not is a change of use a rental property to a non-rental property vice versa was still considered a single family property and so therefore the change in use was not applied and long story short that means that the change in The Limited property value for those properties from one year to the next from for those nine years um was on one of the rules instead of the other and property owner Casmir said no I don't think that is correct and filed a lawsuit and established it as a class action lawsuit it is unique as a class action lawsuit typically when we see right we've all received the flyers in the mail sign this go on you go online and register yourself

if you want to be a part of this class action lawsuit the casmar lawsuit was different every property that had that rule applied during those times was included and you didn't opt in you had to opt out and so I think that's why we're seeing some of the the Great Value in some of the judgments that have come it was uh estimated about $330 million in judgments from this class action lawsuit the lawsuit was filed in 2017 I think it was finally settled in 23 the good news is that the law was changed this year so this issue will not continue it is completely done however the I don't want to call it damage but really the damage has been done and again $330 Million worth of judgments need to be repaid to those tax

taxpayers some taxpayers during that time their property was valued lower than it should have been and so once the limited property value was reestablished at a higher rate they are held harmless they don't owe anything back for those years but starting this year those Property Owners will have to pay the higher tax based on their new limited property value the majority of the property owners their property valuations decreased for up to nine years as a result of the lawsuit and so they are therefore owed restitution for those years because they paid more in taxes than what they should have and because those taxes are deposited directly into the taxing districts including diart Unified School District that's where the treasurer's office is going to go in to process those refunds from it's kind of like the

bank accidentally deposits somebody else's money into your account and just comes and takes it back you don't really have any say in it um um the refunds are expected to be processed originally it was from July to December of this year it's a lot of parcels it's hundreds of thousands of parcels and I think we've seen a higher concentration of these parcels and the judgments in areas with the lot of growth which makes sense where you would have maybe a lot of those properties changing from um rental to non-rent non-rental Etc um but what does that mean for school districts the refunds actually began processing on Monday originally the treasurer thought that they would start proc processing them in July but districts and our office as well had lots of questions on what that looks

like um making sure that funds such as Debt Service fund where your bond payments are made from are protected so that school districts could maintain their Debt Service schedule so there was a slight delay in processing of those refunds despite the fact that there is an annual interest rate of 8 % that is accured monthly on these resolutions until they are paid we the Treasures Office still took that month back to not begin processing in order to make sure that taxing districts were were safe when it came to The Debt Service specifically um the refunds will show up in the Maricopa County treasurers account for each taxing district including the school districts as a negative Revenue the treasur office actually created a specific object code so that school districts and tax taxing districts will be

able to see exactly what they're recouping as they process those individual refunds and so it's not that a school district will see one lump sum coming out they will see monthly or or as as those files are processed they will see the individual or the aggregate amount of you know per month as those come out um there are options that school districts specifically have that not every taxing district have to help them as the treasur office recoups These funds it becomes an issue for school districts specifically because of the independent ways that a budget is established compared to how the tax and the cash are established they're they're kind of parallel but they're completely different processes your budget's established over here and your cash is established over here and in a perfect world they would

be even and a school district would be able to spend 100% of its budget because that would have enough cash without some of the r remedies such as being able to Levy this year when the treasur office would come and process those refunds a school district would face having a cash amount that was lower than the budget and not being able to operate the entire budget so iname House Bill 299 or Senate Bill 1747 which clarified and allowed us for fiscal year 25 uh to Levy for that cash deficit within this year this process happens all the time and legislation exists it is ARS 421 16-24 ARS 42-16 214 we operate on that all the time however those judgments and resolutions it's property owner a property owner Y and maybe it ends up in a

$100,000 judgment for a district of this size with $170 million uh budget and so being equalized every year we're always replacing those levies and it's not a big deal it doesn't affect that balance between the budget and the cash flow and so 4216 to14 really wasn't the things that are in place to handle these types of issues weren't meant to handle something of this volume and so that's where we saw this additional legislation it was session law just for this year specific to Casmir that uh not only allows to Levy this year to make sure that there is is Into Cash deficit it very clearly stated that districts can use inaccessible cash you will also hear it called Dead cash um and it's it's cash then that's the opposite where you've got a budget value

that is lower than the amount of cash and Treasurer and so the districts cannot legally spend it uh and the other thing that 2909 did was it requires the county to place an admonishment basically on every tax bill that says part of your tax bill is a result of this class action lawsuit so what does that mean for daart specifically the estimated uh judgment for daar as of June 30th was a little over $9.9 million so between now and probably December the treasurer's office is going to process almost $10 million worth of taxpayer refunds that will come directly out of the daart account at Treasurer putting it at risk for being able to spend that full $170 million budget this year um the revenue control Lim is1 170 million and so that estimated Judgment of

$9.9 million is about 5.8% so unless you didn't plan on spending 5.8% I mean we know that sometimes you'll have attrition or not every school or department will spend their full budget but you always plan for the most part that you're going to spend that entire budget but it would have put the district at risk for being able to not spend almost 6% of its budget now before last Thursday the estimated Levy for that full 9.9 million would have been an additional almost 46 cents to the primary tax rate for daart for this year uh one of the things that house bill 2909 also required was a state aid recalculation the easiest way to say that is that Mo for most school districts a portion of that 17 million is coming from your local taxpayers

and a portion of it is coming from the state general fund and so prior to 299 a district could request through statute that is already exists to have that state aid recalculated for those nine years and AD then would work with the joint legislative budget committee to make sure that that additional state aid was brought back into the district because what happened was the local taxpayers because they're limited property value was higher than it should have been bore more of the burden for uh the levies during this years I think it's important to mention that the district received the correct amount of money during those years the district had the correct budget during those years it really was just the distribution between taxpayers and the state that was off because of those values it's also

important to mention that not one taxing district had anything to do with this this is from no fault of any of the staff at Dart Unified School District or any school district in the county um but with the state aid and some of the other mechanisms we've been able to lessen the burden for daart and we received uh last Thursday an estimated state aid recalculation for the district and it was about five just under $5.7 million so a little over uh was it a little over 57% of that full $9.9 million estimated Levy or estimated judgment is actually being funded by the state general fund instead of the local taxpayers uh the district had a small amount of of cash between that difference between the budget limit and cash and treasure we applied that toward

the levy as well and what we didn't know when we submitted this presentation is that the new additional tax specific to the Casmir Levy is going to be one uh .16 almost uh 17 cents just under 17 cents on the primary rate for fiscal year 25 because state aid will not be finalized actually until December or until all of the refunds are completed and we won't know actually the full restitution uh until the refunds are completed these are all estimates so we will see a little bit of this carry forward into 26 with just a a Reconciliation where did your judgments really end where did your state aid really end and are you okay with the cash in between the two and with that I will take any questions thank you so much for all

this information um that was a lot um in the beginning of the presentation you you mentioned that daart is a pilot school district can you explain that uh governing board members yes I can there is uh in statute the Amica or each County School superintend attend office is the Fiscal Agent for a school district I don't know why they're still called pilot but it was a change to statute years years ago um as Fiscal Agent the county superintendent office actually print checks for school districts and they're not allowed to print their own checks uh with the pilot districts they are districts that Pro themselves fiscally responsible and were able to come off of that they can manage a little bit more of their finances without that County School superintendent's office um being right on top

of them so it's a good thing okay thank you you're welcome so if I understand correctly this legislation that passed gave us more state aid to offset this but it also raised the taxes correct uh governing board members that is correct uh and that was unfortunately the only way to meet the differen of the cash the total amount of judgments for school districts as a whole was about $130 million of the 330 million uh five of the top 10 judgments were actually school districts and so any District that did not have enough of that inaccessible cash or would need to make up that difference was going to have to Levy it um and there were some some other options such as 299 allowed if you wanted to issue tax anticipation notes tax anticip tax anticipation

notes are a cash management tool for school districts because um some of your money comes from state aid but some obviously some of it comes from taxes and we know tax collection is in October and in in the spring and so but school districts you know we heard from uh superintendent that school district just you know you just finished first week of school you've got payroll to make lots of big Supply orders come at the beginning of the year you might prepay Insurance there are bills the school district has to pay or many every school district has to pay before those tax payments come in normally a tax anticipation note has to be repaid within 13 months it's a short-term cash management solution so another option to spread the um Levy out over four years

was 299 allowed repayment of those tax anticipation notes up to 4 years and really most school districts have been able to manage the uh judgment without tax anticipation notes the districts that it was most difficult for are those that are non-state a districts where 100% of their budget comes from their local taxpayers so who made just clarify who made the decision to add this tax was that our state legislature or was that a governing board uh board member Chaffin I would say it's by Statute so ARS 4216 214 outlines the process by which district recoups cash for any of the judgments and resolutions 2909 allowed more flexibility to the districts on how they decided to do that since it was such a greater amount of money than what we typically have so it's the standard

procedure that we use every year um but just with that more flexibility requiring the state aid allowing the use of inaccessible cash so that it wasn't such a hit to local taxpayers and that was by means of the the legislature that was last minute legislation that was actually introduced on June 12th and approved on June 15th and the legislature um concluded on June 15th so they actually rushed some of those additional AIDS through to make it a little easier on districts and then is this tax levy only for a year is that written into legislation also um governing board members board member Chaffin that is correct it would the goal is there may be some reconciliation that happens in fiscal year 26 but it would be um we're expecting it would be dollars compared to

the millions and it would the every District should expect to see with that casmar um Levy coming off any District that had to Levy for it this year would expect to see a decrease in their tax rate next year the bulk of it will happen in fiscal year 26 or 25 excuse me so basically I'm paying taxes to pay somebody else's refund so uh board member chaff and governing board members that is correct however from 13 or from 2015 to 2023 each individual taxpayer should have had a greater distribution of that as well with these other properties who should have had lower so it's the same amount of cash it's just redistribution the way it should have been so I think if you weren't here in Maricopa County from 15 to 23 I think those

are the ones um those individuals are truly taking the burden for um you know a property they didn't own when this occurred Madam president if I could um Mel if you could talk a little bit to I think our overall tax rates estimated to still go down down even with this do you have those numbers with you yes um Dr C Madam president members of the board yes so last year's tax rate if I look combined um it's between the primary and the secondary it was $5.56 um this year with the casmar rate embedded with the 1668 we are still um estimating that tax rate for 2425 to be $5 $551 essentially so about a 6-cent decrease increase from fiscal year 24 and granted it would have been a bigger decrease that we would have

experienced without this in place um however it still at least is going to level out or at least kind of um minimize the any significant increase to the tax rate um so it having the state aid to offset a large portion of it has at least taken that burden off a large burden off the taxpayer that otherwise we would have born which you know initially the estimate was about a 46 Cent Levy rather than the 16 cents that we're seeing now thank you I do appreciate the information I understand that this was out of our control as a district this decision was made um we did not choose to over tax anybody we did not choose to to take anybody's money that you know shouldn't we shouldn't have but this is a very bothersome issue

that we've got such a socialist idea that our legislature is making us pay for a refund from somebody else when we didn't you know but it's neither here nor there um I do appreciate the state aid and I just I don't like taxes we all know that can ask a questions for clarification um first of all I want to thank Mary D spidel for taking the time to explain all this last week I you explain it in a very simplistic way for something that seems so complex so I do appreciate your time um but one thing that you mentioned that I want to make sure I understand you said something about um what kind of note did you call it was not anticipatory or is it anticipatory note or tax anticipation note tax ant okay

so that did you say that the legislature decided who uses that option and who uses the option we're using or that's a district decision that is correct uh governing board members that is the individual District decision so what the legislature did was allow a longer repayment term it's just that I haven't seen many districts using it but it was completely up to the district which of these methods they used whether they needed to Levy the entire amount in fiscal year 25 whether they used Tax anticipation notes whether they used inaccessible cash um and really that's what our office has been trying to do is help provide all of those different cash management strategies to make sure the district stays whole and to protect the district um four things I know lots of districts have agenda

or items on the ballot this November other than governing board seats they may have bonds overrides and additional tax for voters who aren't a fan of taxes that could jeopardize that and so that's why you saw all the agencies coming together trying to provide all different options so that every District wasn't having to Levy the entire amount so thank you for that and um so just again just to better understand can and whoever wants answer this question but how did our district come to the determination that this was the option we wanted to choose Madam president members of the board in looking at the different options that we had with once we we were considering the tax anticipation notes I know also the many boards are not necessarily look at that basically it's another short-term

debt some see that because you do have to pay that off within the year um so yes within statute you do have the ability now they've extended it to a repayment plan of four years um when we looked at the option of seeing what the state aid offset was going to be and seeing that to our taxpayers we were still going to have um not a significant Spike to the rates and that this can be accomplished and be done with in one fiscal year this seems to be the most fiscally responsible of just address the the the Judgment in this one year we do have the capacity to manage it in this this one year with what the cash flow situation we have for daart and so that's the route we went rather than going

towards short-term debt because with the with the short-term debt option then we wouldn't necessarily have used the extra cash flow to offset it it just all would have been floated over four years or however long to the taxpayer even though it would have been a a much lower tax rate though for those four years right and maybe perhaps you can speak a little bit to that Heather of how you've seen that typically flow Madam president Dr Coto I I think it's important to mention whether it's tax anticipation notes or even if you had a cash short the treasur would still process your checks they would just issue a line of credit all of those cost money as well and so you eventually would pass that on to the taxpayer no matter what you would be

paying interest on the Tans you would be paying interest on the line of credit or fees on the line of credit so it's just a matter of when and um and as far as I know I think we've only got one District that um has the tax anticipation notes under this particular statute approved most are choosing to um be done with it in in one year if they can okay thank you um one other question so you I know that the estimated judgment as of June was the 9.9 million with the state aid what does that drop it down to I didn't see that figure presented maybe you said it if you did I'm sorry um Madame President the with the estimated judgment 9.9 the stated recalculation is about 5.7 District cash towards it is

about 570,000 and so the total Levy portion is about 3.6 million that we would be bearing 3.6 okay yes which results in the1 1668 tax rate on the primary okay which again is a even with this it's it's a reduction from the previous year year what fiscal year 24's tax rates were that's correct okay any other questions I do I have a question and either one of you guys can answer it um after the state aid and the accessible cash we're down to 3.6 so when they start refunding and say we come into a deficit can we utilize the property taxes starting in October when we start getting those to cover and same with in March to cover the deficit if there is one are we allowed to do that Madam president Dr CTO that

is correct so as the levies are corrected you'll have two funds two pots of money coming in you will have your regular state aid for the current fiscal year 25 budget and then in October um once these levies are established after August 19th by the uh Maricopa County Board of Supervisors the so they will uh begin to collect the funds in October and as they're collected they will automatically be um posted in the account and D starts account uh at Maricopa County treasurers office now the one thing I haven't mentioned and I don't know the answer to Is when that five million um 5 point I just turn my Slide the addition yeah thank you 5.7 and state a is coming in um because ad needs the final change to the limited property value or

the net assess limited property value for all these partials before they can finalize that they're not going to be able to do that until all refunds are paid part of the reason is because since this lawsuit was an opt out not an optin as the treasurer's office goes and begins to process those refunds some of the parcels that they had identified originally may fall off you also then have that 8% annual interest that is recuring monthly so all the parcels that stay on until they are paid will tick up ever so slightly until they're paid so where does the 8% come from who who determined that was that the attorneys the eight the interest rate charged for Resolutions is in Arizona revised Statute 42-16 to14 okay and it basically it pretty much goes off of

the current rate okay and we just happen to be in an unfortunate time where rates are pretty high so my last question is these refunds start going out to the the the parcels that are affected well what if that person's moved or died what happened to those refunds Dr Coto Madam president um that I cannot answer but that's something that I can find out from the Treasure's office and report back to the district and they can give you an update okay thank you I just want to thank you for taking the time I know uh it's a tough it's very tough subject and just appreciate you taking the time to come and explain that and and help us out so thank you for doing that thank you for having me all right moving to item

F2 Dr Coto thank you Madame President we're here with an update from a previous board meeting on our uh exceptional student services and I'll have Dr asai introduce the subject good evening Madame President members of the board it is my pleasure to present Dr Cory mantel who will be presenting on exceptional student services updating on schedule and services accountability at the board request U president denmore members of the board cabinet and audience thank you um good evening I am here to present to you um kind of some answers to the question that you asked back in the spring when I was presenting so I do want to thank you for asking the question about how are we holding the site level um really the sites accountable for making sure that students have their um Services

scheduled correctly and that their minutes are being met per their IEP so um it did give us an opportunity to go back take a look at what was already in place and add some things just to tighten it up a little bit and ensure this so one of the first things that we did was kind of G I was given an opportunity to have some time with the administrators to really have them understand the the scope of what their role is with regard to um students with disabilities and so we did a five-hour training um for every administrator every single administrator in the district the principles and assistant principles did attend and we went over really disability law and regulations we went over all of the essential procedures and processes that we have in the

district which are in place to ensure that we are meeting all of our students needs and then we really did dive into the role of the administrator in looking at how we supervise the the services for students with disabilities and how we review schedules and then we check their services additionally we added a level of accountability with regard to the scheduling and checking for the service minutes and so we did um two things really we looked at making sure that they are checking that we have the right students in the right setting with the right services and we added an attestation form that ask them to ensure and tell us that they have um hand checked every single student and that their schedules have been reviewed and are correct and that is in conjunction with

case managers to make sure that case managers are working and kind of cross um checking those things as well um and then we added uh that we will be checking the minutes and so site level administrators so principles and assistant principles will be responsible for checking the classrooms and um referencing it with a schedule for every teacher on their campus at least once a month and then there will be an additional check done by either an ESS Specialist or a coordinator or myself really um to complete the checks therefore every teacher in the district would have two checks per month uh we addressed what happens if it's not as it should be so they could be a couple things and we wanted to make sure that we identify what the issue is there could be

variables in place that were unpreventable and we're going to you know be able to meet them next time we check um but it could be um something like a training issue so if that's the issue we'll go back we'll retrain and we'll address it uh if it becomes something where it's in place and we see that there is a problem then administrators would be able to follow the progressive discipline if it's occurring and work with HR in that process and that is what I have for you I will stand for any questions well I appreciate you taking the time to do this um it I think this is I don't think D's ever done this before yes and so um I'm thrilled to um just as someone that has always had special education like at

the core of my heart to then being in classrooms and actually seeing how sometimes minutes weren't being serviced the way their children weren't being service to their minutes the way they should be um and there was just no accountability at all and so I just thankful that it seems like this is pretty tight um with some extra safeguards in there as well as far as that two checks every month um I like also the way that you're having the administrators really take an active role because again sometimes it seems that i' I've never loved this but sometimes it seems like our special ed classrooms and and special ed staff are kind of off on their own little part of the building and sometimes feel forgotten about and like they're separate from the school and they're

really a part of that school like everybody else is so um if someone were in a building like that this actually ensures that no those administrators are also going to be um going in there and taking a part in making sure that their students are getting what they need so I appreciate that so it sounds like then at the end of the day though if there's ever a parent I mean because you know as board members we get emails and concerns from parents that their children are not getting their minutes or there's issues at the end of the day it sounds like the principal ultimately the buck stops with that person and then if I mean ultimately if that continues to happen then I understand that you're the director of that department but ultimately that

there should be never a time when the principal's unaware or okay so they're integral part of that whole process correct okay and if I may I will tell you that I was really excited that when we went through this process every administrator really did ask ask a lot of good questions and wanted to own it and I think it became um maybe out of fear or lack of knowledge of how to do that and so I think this was a good process for everyone to have that ownership that you were just describing okay so in a way it's also then too with these checks are they kind of like Fidelity checks then were they're actually going to see like okay this student is supposed to have like whatever and there maybe their behavior plan or

whatever and they're actually watching or seeing like are those things actually built in because since a behavior Plan used to go into or should still go into the I p is that also being monitored too so that is being monitored separately um I'm sure that administrators would be able to have some level of it this was primarily for making sure the right students with the right services at the right time and the right location so that's the heavy check we still do Fidelity checks from um the behavior team and so that is still ongoing and it is part of the process in in place to ensure that it's occurring okay I done some extra questions make sure I think I asked you all of them um you can you can go to someone else while

I try to scroll through my note thank you for that though yes um I just have a few questions um and I I really appreciate this presentation thank you it answered a lot of the questions I think that we kind of went over last time and fills in some of those gaps that that we had as far as our knowledge of it um one thing I wanted just to touch base on though you know especially now that we're starting a new year so maybe for established students that already had existing IEPs you know we're we're going to do those two Fidelity checks you know a month but what about like the the newer students who are maybe pending an IEP or have just started that process are we still doing those F Fidelity checks for

those students especially those that might you know have create a safety issue so I just want to make sure I understand your question are you referencing that that this that we talked about that we just put in place for schedule checks or are we talking about the behavior team checks on um Behavior Support plans or behavior intervention plans either one okay that's fine if you can answer both that'd be great so Behavior Support plans are what are in place before a student receives special education services and it's on the general education side and that is managed more by the RTI team um and the and the sorry the campus Administration once a student is eligible that moves to a behavior intervention plan and is that is more managed by the behavior team so both are

in place for the checks and then with regard to this it doesn't matter if they're a new student transferring to us or a new student on an IEP they would be added to the schedule and it would be checked and it would be part of that um plan sorry I'm [Laughter] rumbling and I had another question but the Thunder distra Ed me sorry problem um if you want to move to somebody yeah go ahead we'll tag team I remembered um so again just back to making sure that the students are getting what they need and I understand that like for our ESS students um you know it's a matter of making sure that we have their their accommodations or their modifications everything in place so they can be successful and safe but I also have

concern that sometimes when that's not monitored correctly irly and they're not getting what they need then sometimes it impacts the other children around them and creates a safety issue for our other students in the classroom and um I can even share a personal story actually when my oldest was five she was constantly being hit severely by another student and the principal at the time was like there's nothing we can do because the student that's hurting her is uh es is special education and so that's frustrating as a parent you know which obviously we know that that wasn't proper information to be sharing with a parent but that was my life then and um and but that still I think happens is that other students at no fault of the other the child who's on the

IP no fault of their own um they're either it's either needs to be tweaked or they're not getting their minute whatever is happening but it's still the reality of that other child or the other students in the classroom that when those things aren't in place and other students may not feel as safe either emotionally or physically so um I don't know I guess my point is again just not only making sure that our special education students can be successful which is very important to me but also making sure that in that process if we're not doing that then we're also posing a a possible safety risk to students and staff and I don't know if you can comment to that or speak to that but that's also my equal concern no thank you for that

question and I think it's a really important one because that is something that um our coordin orators and our Specialists and our admin along with the behavior team meet monthly and they review all of the students and one of the things that they do talk about are the students who are on behavior intervention plans or we're seeing any kind of behaviors and then that prompts us to be more active in making sure that we are doing those Fidelity checks that everything is being followed so I think there are things in place to make sure that there is no um uh opportunity for us to completely miss it um so because we are having these conversations talking about it if we see an increase any any students behaviors that's one of the first questions we ask

is are they receiving the services that they're supposed to so accommodations um you know the opportunities for the breaks are a big one things like that as well as the implementation of the behavior intervention plans so I do think that there are things in place to prevent um them from not occurring and that and we also have walkthroughs that we do the administrators um coordinators and Specialists also do walkthroughs where sometimes we are targeted and looking at we know certain students have Behavior plans and we will be looking for that okay thank you she covered everything I was going to ask so okay I just have a quick question um I know that you have protocols in in place um for the safety of the kids but what about the staff um well so when

we write a behavior intervention plan it's for the safety of everyone and so the intent is to keep everyone safe and so we have multiple levels I guess one is that if we have students who are have more significant behaviors where we think that there is a danger to the staff um we give opportunities for them to be trained so that they know how to safely manage a student prevent that from happening um and then when we are addressing the students behavior that is always considered so when we are writing the behavior um intervention plan it is specific to each student and so we are considering what is typical um and some students have behaviors that we know might it might not matter who it is that's around them and they might have those behaviors

or we there are students who might only um look to have more uh inappropriate behaviors with you know with teachers or staff versus students and so we just individ individualize it and provide the staff with what they need to know to be able to deescalate and to keep themselves safe okay thank you kind of a random comment but I just have to say as we're talking about Behavior stuff just want to give a huge shout out obviously to everybody in special education it's it's a very challenging job at times but specifically our um and I'm sorry if I'm using the wrong terminology PA professionals instructional AIDS one-on ones um you know they don't get paid as well as I'd like them to be no fault of not nothing against Dr crotto but the money is

what it is but I believe like they should be paid a heck of a lot more than what they should be because of what they have to endure and sometimes they get hit and kicked and spit on daily and they keep coming back and showing up for their love for that student and I just want to commend them and tell them that regardless of the pay doesn't reflect it I completely respect and appreciate all that hard work that they do and the impact they make on that child so thank you to all of them and please pass that on to yourself I will and I couldn't agree more so thank you for that all right thank you moving to item G1 request for future agenda items okay moving to H1 I move to adjourn the

meeting motion carries we are adjourned thank you
