at this time i'd like to call this regular meeting of the dysart unified school district governing board to order let the record reflect that all board members are present please stand for the pledge of allegiance i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all okay next we move to item b executive session we have a call for executive session pursuant to ars section 38-431.03 a3 and a4 to obtain legal advice and provide direction to the attorney for the public body regarding the superintendent's resignation agreement and release i move that we adjourn to executive session drive a second second motion made by christine pritchard seconded by don densmore i would like to explain my

vote on the record that this executive session i do not approve there is no merit no foundation for this session and is totally unethical and immoral i will be voting no i'd like to get some clarification from our legal counsel there was an allegation of um unethical conduct i want to make sure we act in accordance with the law is there anything unethical about adjourning to executive session madam president members of the governing board the motion to go into an executive session is within the legal boundaries of the governing board of the district thank you we have a motion that's been made and seconded hers is not popping up no michelle we're done for a second session we'll reconvene at six starting the regular meeting with a public hearing so we're still in recess okay

at this time we'll reconvene the regular meeting right not yet all right so we will move to information discussion item c maintaining confidential information potential breach and board requirements and this was brought forward um regarding a recent concern with a breach of confidentiality and i felt it it was important that we had a statement prepared that i would like to share with the board regarding that incident each governing board member has taken an oath of office that specifically requires each of them to support and uphold the laws of the state of arizona in the execution of their roles this includes compliance with all aspects of the arizona open meeting law previously the board has met in closed session closed executive session regarding the contract negotiation with the district's chief executive officer dr quinn kalis as

is permitted by the open meeting law the open meeting law expressly forbids parties who attend the executive session or who receive confidential information as part of their duties from disseminating the confidential information discussed in executive session the arizona attorney general's office has the ability to seek penalties for violation of this confidentiality provision the news of the agenda item that the board will consider later this evening was leaked to the general public from the board's discussions in executive session this violated the board's trust and was not authorized further it has generated reckless speculation as to what the board may or may not do in the future this breach is a potential violation of the open meeting law and has been extremely detrimental to the board's ability to conduct its business governing board members are limited by

law and their ability to comment regarding executive session discussions and are limited in their ability to respond on social media or to request by the media for information the breach that occurred has hampered the board's ability to re to reach a fair and reasonable resolution with its superintendent the board respectfully requests that all those interested in the potential resolution between the board and dr kellis maintain all professional courtesies due to all the parties involved and understand the constraints imposed by law do any board members have any questions or concerns we also have our legal counsel here as well that can address any questions that you may have not hearing any i would assume everyone is clear that's we're going to move to item d public hearing there's a public hearing for fiscal year 2021 2022

expenditure budget revision dr dean good evening madam president members of governing board members of cabinet this evening mr hicks will provide information on a budget revision thank you good evening madam president members of the board colleagues and community members thank you very much it is a pleasure to be able to present our second and final revision of this fiscal year before i go through it very quickly because it is the smallest budget revision i've ever done in my in the history of my um career um i would just like to thank mary dell and her team and specifically mr robertson and miss pierce who put a lot of time and effort into this so first as we do above budget revision it is required to be done before the may 15th of every fiscal year

which means it has to be done by the 14th and any time that we're revised in our budget we're required to have a public hearing so here is the just a quick little summary looking at the four major categories identified by the auditor general in the arizona department of education you can see on the far right column our budget revision and the totals and the changes and you can see the net total from our mmo change is a 60 000 change our capital funds also looking at that is a small increase as well or this one is a small increase not a decrease of 60 000 a small increase but then also our emergency building renewal grant program that is i commonly refer to it as the arizona school facilities board program it has moved

on to the arizona department of administration i still continue to use sfb acronym with it we've moved the budget up on this as we've been approved various projects but we also understand that they are out of funds and so they're not funding any additional projects even though we've been awarded the projects there is supplemental appropriations requested in the current to the current legislature at this time um unless they come to a budget negotiations um before that time these will all probably a lot of these projects will move to july 1 and we're on the list for july 1 and will be approved at that time our classroom site fund is not changing from our december revision and is pretty normal and steady federal grants has the largest increase and that is mainly due to our

srn arp funds coming in and also emerging the emergency connectivity fund that our i.t department applied for and did receive state grants moved up ccip and our voc ed was the main driver of those going up and our food service fund as we're experiencing the largest number of meals ever provided for our students this year also goes with increased expenses so revenues increases and expenses increasing on both of those and so we've moved our food service fund those are major funds that i just did a really quick summary it is really almost extremely close to our december revision so there's very little just as a reminder as you know i always like to just put a cut sheet or a a copy of our website so that we post all of this information on our

website as well as additional information as well as um although i do the rainbow report and i sometimes talk extensively on the rainbow report as i said with only sixty thousand dollar change or twenty thousand dollar change uh it's really minor so i don't wanna go through the whole report just as it's very similar to our december revision and um i'll stand for any questions um and then we could open it up to the public hearing um and then i'll just remind the board that this agenda comes on for actual voting later on in the agenda but i'll have no additional information at this time for that so if there's any questions from the board thank you very much any questions or comments from the board and we'll have public hearing i would invite anyone

who has any questions uh regarding the expenditure budget to step forward to the podium not seeing anyone we will go ahead and continue on with our regular meeting item f audience with individuals miss schaffen this is this is the time for the the public to comment members of the board may not discuss items that are not specifically identified on the agenda pursuant to ars 3843.01 action taken as a result of public comment will be limited to directing staff to study the matter responding to any criticism or scheduling the matter for further consideration and decision at a later date in order to facilitate accomplishing the business of the district in a timely manner a time limit of two minutes will be imposed for each individual group addressing the board when you approach the podium please state

your name for the record and we will go through the comments in order of received our first individual is nicole king [Music] good evening president pritchard members of the board dr dean members of cabinet and guests my name is nicole king and i'm here to address the role of the board as a board you have an obligation to remember always at the board members first and greatest concern as it fulfills its obligation to the community must be the educational welfare of its students furthermore one of the district goals is that dysart unified school district's culture will be consistently reflective of a safe and secure environment for all stakeholders can you tell me how these duties and goals are being met when you are reducing school counselors on site thinking emotional intelligence is a bad thing

and saying that our teachers are indoctrinating our students by asking them to critically think and be empathetic towards others board policy gives teachers the opportunity to create in the classroom an atmosphere of freedom this atmosphere permits students to raise questions dealing with critical issues that that sorry dealing with critical issues at the time an atmosphere of freedom produces an environment conducive to the study investigation presentation and interpretation of facts do not trust the professional teachers and staff to make the best decisions for the students they care about they spend more time with other people's children children than their own they spend their own money making sure their students have what they need how can you assume that they do not have the best interest at heart of all the time your duties and responsibilities also

include supporting the employment of the of people best qualified to serve as board staff members and insist on a regular and partial evaluation of all personnel monitoring the superintendent performance based on district goals and policies dr kellis is more than qualified and there is no just cause to remove him his last evaluation was in 2019. can you tell us why dr kellis has done to deserve to be forcibly removed ethically you should be informed about current educational issues by individual study and through participation in programs needed for information such as sponsored by the state and national school board associations based on the questions asked during some of these meetings you are clearly not doing your own [Applause] she got here tina molika good evening madam president members of the board cabinet and guests my name

is tina molica and i have a parent of two students in the dysert school district i'm here tonight to address the governing board oath violations which i have witnessed at board meetings i'll keep this little short since our time has been shortened you have violated the district goals by creating a hostile environment towards dr kellis social workers administrators and anyone who supports them that at that hostile environment does not accurately reflect the goals of dysart on february 9th you cut hours for social workers at an 8 000 pay cut forcing many to leave the district including the one at my own son's school you have also violated code 2.0 on 4 13 april 13th you accused the district of sneaking crt into the curriculum the book was not a curriculum book and it was very

misrepresented to the public i purchased it i read it cover to cover the board stated that it was promoting a shift from individual behavior to everyone's fault saying that there's no more right and wrong suggesting that it was getting rid of behavior management and saying that students acting out were students of victims of injustice none of those words were in the book instead of basing decisions on facts you have chosen to support a personal political narrative i have other violations but i'm going to skip to the end the greatest issue facing dysart is not crt sel the contents of the books on its shelves false claims of brainwashing indoctrination or an effective superintendent who is well respected by the community in a state where 70 of our classrooms do not have certified teachers the issue

the greatest issue is attracting and retaining teachers in our classrooms by demonstrating a culture of respect and cooperation you have created an environment of hostility and distrust that does not serve the students of our district only the desires of a small community of politically driven individuals all right kathleen honey next up we have kathleen honey my name is kathleen o'neil i served dysart for over 10 years under different health circumstances it would be my honor to still serve alongside these educators here tonight and under the direction of dr quinn kellis my primary responsibilities was to reduce barriers to learning i did that through the implementation of programs like character counts a social emotional learning program and by reducing bullying my prime alveos defines bullying as ongoing such as accusations without foundation at multiple public meetings

unwelcome and most importantly involving an imbalance of power like a group of elected officials threatening the livelihood of employees they directly supervise the most effective recourse for bullying is for bystanders to step in and stop the negative behavior as governing board members duly elected to serve all of your constituents i was prepared to utilize a democratic process to vote you out of office at the appropriate time until last week during the past five months i have observed you systematically attempt to dismantle the fact fantastic work of educators across this district for example one of the schools was flooded with complaints after several administrators brought to your attention actual concerns and social workers are leaving this district in droves because they have a choice between a clear message of you're not valued here or feeding their

families so i'm here to inform you miss pritchard and miss chafin that i will recall you and miss densmore i will remove you in november thank you for your time next we have janet leblanc good evening my name is janet leblanc a tax paying dysart school resident and i'd like to address dr kellis's my request that i made twice not once but twice to post a draft agenda one week prior to the meeting his first response was that it would be too confusing or frustration for the public that was an insult to the public and i once again asked that the agenda be posted one week prior and justification as to why if not so for the third time i am asking once again that the agenda be posted one week prior to the meeting

and if not justification as to why you see according to chapter 7 section 765 of the arizona attorney general's handbook the general rule is for no less than 24-hour notice but that the best practice is for the public bodies to give as much notice as possible therefore my request stands whether it be with dr kellis or the interim superintendent and lastly i'd like to thank the board for the direction they are taking with the future of our children's education as a concerned grandma i applaud this is my time i applaud the board for eliminating our ties with nsba and asba thank you for visiting classrooms only to find out that the pledge of allegiance was not properly recited or respected thank you from the bottom of my heart for catching several curriculum approval requests that

were a definite form of crt teaching by the way are you aware of this thank you for taking the time to read through these materials and monitoring what is being placed into the minds of our children thank you for turning this ship in the right direction god bless you and may god bless america [Applause] before we move to the next speaker i want to again ask for your courtesy and respect as people speak not everyone in this room shares the same viewpoints but if we can all remain respectful because if we continue to yell out i mean no one would like that if that was done to them and i want to make sure that again it is a peaceful respectful environment if we can't adhere to those requests then we're going to have to

ask people to leave or conclude public comment we need to make sure we're peaceful and respectful thank you miss chatham can we also see who is leaning up against the lights and flicking them off and on thank you i don't know [Music] our next our next comment comes from larry leblanc good evening my name is larry leblanc and i'd like you i missed the national anthem i guess we didn't do it but i'd like everybody to note that the national anthem takes about 13 seconds to pledge allegiance to our nation what an honor mr kellis during these meetings when asked why we cannot pledge allegiance by standing and pledging in a high school his response was simply it takes too much time out of the curriculum 13 seconds thank you governing board for questioning the

absence of our duty in this matter and your willingness to follow resolution to the end of this to the end of this i wish to help in any way i can turn it up to quote kathleen hohn thank you dysart students parents and educators deserved governing board members that support the mission of the public education i couldn't agree more with that i would like to acknowledge this governing board for their consistent collective efforts in flagging unusual behavior being performed within the dysart school district management departments just recently 1.3 million dollars was spent to purchase school curriculum this governing board taken by surprise asked to authorize this these gentlemen right here excuse me these gentlemen right here transacted the purchase without the government's approval further on this because of the sharp awareness of our board members

items within this purchase qualified as crt teachings again thank you board for removing such damaging materials from our children's access mr kellis's response to this matter mr leblanc i'm sorry sorry mr leblanc we're gonna we're gonna have to move forward i'm sorry thank you mr leblanc yes sir thank you all right our next speaker is mr ryan eldridge good evening my name is ryan aldridge and i'm a resident of el mirage i'm here today as a concerned parent and citizen i'd like to thank the strong board members of this board for not being a rubber stamp to this administration and placing students and their families first it's clear the schools of this district are dangerously below average and they have dropped dangerously over the last few years some of the worst in the state that

we've seen it's refreshing to see board members holding people accountable for both action and inaction we need to hold our leadership accountable for the success and failures we've seen within our district and when leadership fails the only option is to find somebody who'll take the reins and get the job done i'd also like to express my gratitude for some of the courageous members of this board that stand up to the trend and creating ideal of ideal obviously such as crt seo and restorative justice that do nothing but harm our children and set them up for failure in their future i applaud you for standing up to the national and arizona school board associations for their damning language and calling for the dog to investigate parents who attend school board meetings calling concerned parents like myself

domestic terrorists our children are our future we need to teach the facts historical facts along with life skills so that they can be successful and prosper in our country without quality education they are doomed thank you thank you our next comment comes from jennifer drake so good evening president pritchard board my name is jennifer drake i am a community member of 20 years here in surprise and a taxpayer i'm calling i'm coming here because i want to support the board i have been attending board meetings now for over a year and i've noticed a lot of issues that have been brought to the board's attention from a lot of the schools that are attending at least each board meeting two schools attend and a lot of the issues are gaps between math and reading we

even have one elementary school where the principal expressed concerns about they have over 575 students that are in the red yellow zone for reading we have a lot of issues in this district and i'm glad that you guys are stepping up and and reviewing issues that are brought to your attention especially the title one the last meeting where they had the title one a lot of the schools are underperforming this is a huge issue our students deserve so much better and i'm glad that you guys are are questioning issues i'm glad you're bringing issues to the surface this is what we need to do to to rectify issues in the district and i just want to applaud you thank you thank you that concludes our call to the public thank you we have more if

you signed in to speak to a specific agenda item then you will have a chance to speak for that agenda item later in the board meeting next we'll move to superintendent governing board update uh starting with superintendent update dr dean good evening madam president members of the governing board members of cabinet and our community we are excited this is one week away from our high school graduation ceremonies we're excited to celebrate with our seniors next week graduation is scheduled for wednesday may 18th at the state farm stadium dicer high school will graduate at 10 a.m shadow ridge high school at 12 30 willow canyon high school at three and valley vista high school graduates will have their ceremony at 5 30 p.m so we're excited to celebrate with our seniors as they conclude their time

on april 28th i had the opportunity to attend the valley vista high school choir concert it was an amazing performance i felt like i was in one of the california competitions as far as our choreography our costuming and i just want to take a minute to recognize our vvhs choir director preston mcdonald he has done amazing work to transform this choir program and his efforts are truly commendable i also want to thank our fine arts director danae whose hard work and support extends i thought i saw her in the audience somewhere yes extends beyond the walls of valley vista and the work she does benefits all of our students in dysart and again it was just amazing to see the kids and their energy and he really did step in at a time of transition

and has just done a phenomenal job so thank you very much to mr preston mcdonald and then on may 4th i had an amazing afternoon with our el mirage mayor hermeso and vice mayor dorsey brave members of our air force as well as proud members of our el mirage police and fire department while i attended the leadership day at riverview elementary school it was an amazing day to watch our little student leaders facilitate tours through our school beaming with school pride i think they told me like at every turn welcome to riverview welcome to riverview it was just wonderful to see their faces and the pride that they had and for their school their presentations were driven by the leader in me program and they were great reminders of how good leadership is defined what

it takes to get there these students demonstrated what it takes to be a strong leader and it was just i was so fortunate to be a part of that day and was definitely inspired by all of them and i know um gail miller is going to do an amazing job helping that group just blossom even more than they already are so looking forward to that um and that concludes my board update see you all at graduation very excited about that so anyone else yes um i attended several events i attended the end of the year band concert for shadow ridge i forgot to mention that thank you mr forrest for combining the sonoran heights band with the shadow ridge band and especially for the star wars number that you had i also attempt accompanied state

representative joanne osborne as she toured four of our schools she was thir she thoroughly enjoyed uh the cte programs that we offer to our students so she really loved her time here with dysart i also attended the city of surprise council meeting in which dr kellis was acknowledged as the first recipient of the mayor's community leader quarterly award and the proclamation and the proclamation for his contributions to this community and dysart i accompanied dr dean to valley vista to present some extraordinary pins to four of our stuco students that have done an awesome job being student council representatives i also attended the leader leadership day at riverview and just like ms pritchard said it was an awesome day the students did a phenomenal job talking about the seven habits of what a leader should be

and uh honestly it was a great day especially when the principal ms lawrence sang the national anthem and she belted it out really well so congratulations there i was also asked to serve as a panel member for the napa it's the national aspiring principles academy explaining the role of the board member and of a school board member and the responsibilities this and how a school board fits into the districts and an organization this was with other leadership personnel a superintendent a central office person and a principal and this was for national aspiring principals and them finishing up their academy i was also asked to participate in marley park's shark tank experience where the 8th grade students presented their business ideas in a shark tank fashion just like the tv tv show awesome job thank you

all right well next we'll move to item h motion to approve the consent agenda items i move the board approve the consent agenda items as presented second motion made by christine pritchard seconded by tracy sorry sink bill motion carries next we're moving to information and discussion items j1 summary of meet and confer sessions dr dean thank you madam president members of the governing board mr hicks is here this evening to provide a summary of the meet and confer sessions which is conducted each year through our interest-based approach or iba mr hicks will present the recommendations from the iba team colleagues and community members thank you very much it's my pleasure to be presenting our iba recommendations for the 2223 fiscal year first i'd like to just start with all the people that dedicated their time

and efforts to make sure that we have the best process and best recommendations possible so thank you very much to everybody that stepped up and put in their time this time started over eight months ago so it's a long process as we're going through and as you can see the process is dynamic not linear so it's not a very step step we really do a lot of talking in there and one reminder is is that as we're going through the process and those at least two times that we did we'll stop and just double check to make sure that we're going through the standards that the board has adopted and this is something that's approved annually and we look at legal affordable affordable is normally what drives it from that standpoint can we afford it

and ends with judicious and equitable is it fair and impartial it doesn't always mean equal and then necessity this year was a big thing as well too it starts with telling the story so each group representative group shares their side of the story how the year is going what they're looking at moves on into interests what are their interests for this year we look at common ground this is all done with all groups in the same room at the same time and then after we're finding common interest we move into options which is the brainstorming process where we start identifying all the areas we do as you're well aware we come in to the governing board and talk about what your direction is and so we do try to layer and make sure that our

governing board proc voices are heard as well as well as everybody in the process we then evaluate again before we finish with the evaluating against all of our standards as i've mentioned previously and everything is consensus based so one person can hold up the whole process and they just have to make sure they're asking good clarifying questions and asking and drilling down more just as a reminder the governing board has already approved a retention stipend so five percent uh went to our certified and classified and four percent went to our administrators that was back in february in march the governing board has already approved our benefits package um so there was a cost related to that there were some changes to our rates tier structures hsa contributions and then for next year we have a

decrease in our arizona state retirement system so that also that with a decrease provides a little bit of savings that's allowed to be used in the process this unfortunately was not part of the iba process so i want to be very clear iba did not talk about this but this is something that's been in place for the last couple years which because of kovid and other challenges has made it very difficult for certain exempt an hourly staff to use their vacations because normally it would have to be used by june 30th we a couple years just ago started giving a little extension so they could go a little bit longer and since we did not talk about it i wanted to make sure it's added into this because uh if we went back to the

june 30th there could be some penalties because we have not communicated to our staff that they would have to use them by june 30th and i'm afraid there could be some people it's a casualty of not knowing and not scheduling vacation they would lose those days so um although this is in the iba presentation this was not talked about in iba and this is something that i put in just for continued operations continuity of operations the resolutions that we came up with um as we all discussed um we looked at a one percent increase to all of our certified positions one percent to our administrative positions and a six percent increase to all of our hourly and exempt positions so this goes into the necessity the equitable looking at where the greatest needs are and

some of our challenges and a lot of our vacant positions and so that shaped and formed our recommendation the next is also for new hire so that was for existing staff for new hires is we're recruiting and bringing in we for the last couple years we have had a model that whatever is given to the group half would go to the new higher placement schedules that recommendation continues for this recommendation as we were also looking there were still additional funds left over and as we were going through all the different options from it we landed on increasing the teaching and tutoring rate from twenty three dollars an hour to thirty dollars an hour and increasing the additional hours for homebound rate from 23 to 30 as well so there was lots of different options that

were looked at we looked at those where our teachers were interacting directly with students and prioritize that over other options just so you know this is an assumption so school districts years ago moved to current year funding which no longer meant that we knew exactly what our budget minimum would be there is assumptions in here and so we're looking at our demographic with a increase of about 110 students that did actually when we put in our staffing formulas did have a slight reduction in staff um just how it how it lands out our group b which is our special ed categories that generate revenue we assume that we have the same number of students for next year that we do this year so that we're holding that flat we increased our base support level that

we know is in law that we will get the two percent um and so we put that into our increase and we know that our federal funds are supporting capital spending which is mainly our technology component of it and there's the retention stipend that i spoke earlier of that is funded from our federal funds that we received other budget considerations this was not part of iba but just as our budget consideration is that our classroom site fund our estimate our budget amount comes out from the arizona jlbc at the end of march and they came out with i think it was 708 per student and so that calculated out that we had an increase and so there's a thousand dollar increase for our certified staff that are eligible for 301 funds 400 increase in the

pay performance from 45 up to 4 900 and a 600 increase in our other funds from uh 60 six thousand to sixty six hundred here's just a cut sheet of our summary our tracking document to make sure that we're um that it is affordable it does show a slight overspent so you can see the net revenues projected revenues so it is current your funding so we are doing projections and then our projected expenses going forward and so we're within eighteen hundred dollars um although it does show a little bit over um one special ed student um or just a couple more students and will exceed that in that sense and so we believe that that was um that we came to agreement on that just to show this is the capital side and although the

iba does not really deal with capital i'd like to show this slide all the time because as you can see we transfer some of our capital 1.7 million from capital into our mmo to support our emino budget and so this shows that transfer future consideration so we lived with a very what is on the books right now we know that the legislature and the state is sitting on 5 billion cash surplus from last year for next year we know there's lots of discussions i think i heard that they're working a budget right now there could be one that's presented in the next week or so i don't know what it looks like this is probably the tight most tight-lipped there is going on that i've heard in the last years last few years so we

know there could be some additional funds we know from the boyer grand compromise that could mean 800 million more to schools which could be uh 8 to 10 million for our district we don't know all the details of that and so we didn't spend a lot of time talking about what could be in in the past we knew exactly maybe there was a gifted or a special ed weight increase that we could put a recommendation on in lieu of uh if the legislature approves it because we have no idea what the legislature could be doing with that five billion dollars we made no recommendation um no priorities and were the group uh requested that the governing board utilize the iba team to come back at that time to make a recommendation then there were still

a lot of brainstorming ideas and options that were on the table and those would be probably re-looked at and readdressed at that time and this is an informational item so this is not a voting item but as you saw on the agenda there's lots of items already embedding all of these recommendations in there so dr croto will be going over some and so we are make we're going forward with um embedding all of this recommendations into the next few uh agenda items and as well as our proposed budget unless we hear any comments or concerns from the governing board tell us otherwise so i'll stand for any questions thank you any questions or comments from the board just had a quick one mr hicks and it wasn't a question it was more of a comment

to the iba team thank you for wanting to increase the tutor rate from 23 to 30 and also the homebound instruction to 30. it is appreciated okay thank you very much thank you next we move to information discussion item j2 staffing update dr dean thank you madam president members of the governing board this evening dr crota will present an update in terms of our staffing thank you dr dean madam president uh members of the board cabinet and guests uh tonight we'll give you a quick update on our staffing and where we're at um as many of you know there's a lot of opportunities for employment not only in our district but in every state in the united states and unfortunately our school districts were not immune to what they're calling the great resignation so i'm

going to share some numbers with you and then take so many questions so on march 11 2021 we had all our contracts turned back in we issued 1298 contracts for our administrative and certificated employees of that 1181 employees returned or on the flip side if you want that 117 employees did not return their contract so did not renew their contracts as of today this afternoon we currently have the following openings we have 55 certificated regular ed teaching positions open we have 35 certified special ed teacher openings we have 10 what i call student support positions certificated people and then 13 ess department positions slps ots and those things so with that just a quick overview of where we're at in the positions we have open and i'll stand if you have any questions so in

regard to retention rates how are we in regard to in comparison to last year and i know it's it's hard with kovid but um madame president i believe i have that here last year we had uh hold on just a second last year we had 1428 turned in and contracts issued and of that we had rejected 67 i believe on here so last year i have percentages last year we were at 95 return rate this year we're at 92 percent so we did drop a little bit this year um but we are still in the 90s so we are working hard to search for those employees and advertising everywhere we can and advertising to this group so please go out there and tell people to come work for this awesome district so so then just

for clarity um there's been recent community concern about staff like leaving in droves would you say 92 percent return i mean how would you respond to that um i do not think they're leaving in droves i think we are not immune as i said to the great resignation and people are finding other opportunities and there are a lot of opportunities out there um and not only in our community but in this state so there are a lot of jobs and and people are leaving for all various reasons they're not um i would say leaving in droves thank you for clarifying that any other questions from the board all right we'll move to action discussion items uh k-1 recommendation to approve the appointment of assistant principal dr dean thank you madam president members of the governing

board this evening administration is proud to recommend miss aaron burgess for the position of assistant principal at willow canyon high school for the 22-23 school year miss burgess received a master's degree in educational administration from eastern new mexico university she has 19 years of teaching experience as a math teacher someone after my own heart and one year as a teaching and learning specialist in the discharge school district miss burgess will is recommended to take the position of assistant principal at willow canyon high school and ms burgess is with us this evening [Laughter] any questions or comments from the board i move the board approve the appointment of aaron burgess as high school assistant principal for the 2022-2023 school year do i have a second second motion made by christine pritchard seconded by dawn densmore motion

carries welcome next we moved to item k2 recommendation for approval of employee referral program dr dean thank you madam president members of governing board dr croto will present information to the board regarding our con our recommendation for continuation of the employee referral program dr croto thank you dr dean madam president uh members of the board cabinet guests last year about this time you instituted an employee referral program in that current employees that recommend people for full-time employees full-time positions in this district after three months they received 250 and after six months of continuous employment that employee who referred them also received another 250 so there was a 500 incentive if that employee came to us was referred by the employee and stayed with us we said we would discuss it in a year bring it

back so i'm bringing back to you we've had in that program 64 total referrals right now of that the 35 have received the first the employees 35 of those people received the first 250 and 12 of them have received the additional second 12 of those 35 have received the 250 for that so that's a total of eleven thousand seven hundred fifty dollars uh we did gain 64 employee referrals which is excellent so i am here tonight to ask you to continue this program um where if an employee recommends an employee for this district then we ask right up the front on the application and we also ask them on onboarding to make sure that we have that clear that if they stay for three consecutive months we reward that employee with 250 and then if

they stay for another additional three months or six months total that they get another 250. so continue the program in the same manner for 500 500 so with that i'll stand for any questions any questions from the board that sounds like it's been successful we're getting a lot of individuals working we have and we need that at this time that's for sure wonderful okay i moved to approve the employee referral program as presented second motion made by christine pritchard seconded by tracy sorry sinkville first motion carries next move to k-3 recommendation to approve an employee salary increase and saw replacement schedules for the 2022-2023 school year dr dean thank you madam president members of the governing board administration is recommending that the governing board approve the salary increase for dysert's current certified licensed classified and

administrative employees as part of the iba recommendations presented by mr hicks earlier for the 2020 2022-2023 school year that's a tongue twister i have to say this recommendation reflects a monetary improvement in base pay for current employees of one percent for certified licensed and administrative employees and six percent for classified employees additionally this item addresses the placement salary schedules by half of each of those amounts increasing the base salary to the placement schedules as discussed by mr hicks i'd be happy to answer any questions or refer them to mr hicks as well administration recommends approval of this item any questions or comments from the board um can we talk about hang on i'm so sorry classified hourly salary schedule and specifically the employees that are called paraprofessionals in special ed the f's and h's um

are these and are the are the f and h's and we might as well throw in the u's are these hard to fill positions dr croto um asm president member grant when we speak of hard to fill we have compensation for hard to fill so compensation wise they are not considered hard to fill however we do have a lot of openings and they're very hard to fill so depending on what context you're taking that in the answer is yes or no yes um in the paraprofessional area of special ed how many do you know about how many of those positions are unfilled we looked at that for next year our noes go out this tomorrow actually um but currently we're looking we have a need of paraprofessionals for about 90 positions district-wide right now 9-0

for just the classified and these are people that support our kids in special ed with academics behavior daily living skills and mobility type is my understanding that is correct are any of the paraprofessionals and do we contract outside for any of these positions madam president member grant using outside contractors yes we try to obviously fill those positions so we try to go anywhere we can to get those positions so currently we do contract some of those positions outside so if we contract for f and h the range for f and f is 1422 to 24.57 and h is 1491-2580 what would be the rate we pay a contract agency for these employees um so the contract agencies obviously and anything that we contract with ess is a considerable more amount so off the top of

my head with that we would pay them upwards of 30 to 40 dollars somewhere in that range to contract them they charge more because they are service so it costs us more to go to these contracting agencies if that's what you're asking yeah it costs we pay more than that rate that you're asking because of their service that we're using and we pay that service to get them to come work they're working for a temporary employment agency per se madam president member grant i i would add to that piece that the contracted employee does not receive that hourly rate right but that's the hourly rate that the the contracting agency charges the school district it's anywhere from 28 to 32. can just look that up okay um do we know what other districts are paying

these paraprofessionals and these um slpas assistants are they paying them can you repeat that please do we know what the range is for the other districts what they're paying for the paraprofessionals and for the certified occupational therapy assistant the physical therapy assistants and the speech and language pathology assistants madam president member grant the answer to your question would be that we do monitor what other school districts are paying from a comparison perspective i'm not certain that we have those exact numbers this evening but we we do continually look at our salary schedules and compare them to what we consider comparison school districts but i'm not certain that we have those exact numbers this evening okay do we give years of service to these employees classified employees um do not receive years of service on our

salary schedules or when they come in as new employees they do not receive years of service um well since i would like for the board to consider giving years of service to these employees to try to attract recruit and maintain these positions both of these positions work directly with students of disabilities several of us visited the classrooms and saw first-hand the support that these students need and i can only imagine their educational experience would be like if they didn't have these paraprofessionals in their um in their classrooms so i would like as part of the motion or i make it a separate motion that we give these people years of service and hopefully we won't have to go out for contract for them and um we'll have some um continuity within within those classrooms i

just want to clarify i think it might likely be allowed but i just want to clarify with the attorney if we're approving salary schedules would would changing um the piece that ms grant is referring to be allowable the way this is agendized so it's my understanding madam president members of the governing board that ms grant is asking for an alteration that would not typically be a part of the salary schedule so you can definitely have the item that you're requesting added as a benefit of employment at a later date but it typically wouldn't you're asking for the if you want to repeat what you're asking for then i can address it more specifically but adding years of service to class right to right so not to all classified to a certain group of class well

they could do it all classified but um the ones where especially in in a special ed where he just said we have 90 openings if we can not go to contract and if we can recruit and uh i mean yeah recruit and maintain these employees maybe offering years of service will help okay so madam president members of the governing board when you're talking about adding years of service you're talking about where they're placed on the salary schedule not the approval of the salary schedule itself that's correct so what the benefit that you're asking for cannot be a part of the action item that's being presented to you so i could ask for a future action item where the board would consider um or adding years of service for when an individual is placed on the

salary schedule so it would be a future agenda it would have to be a future agenda correct is this a time sensitive item where ms grant's request to be accommodated at another meeting tabling this or is this time sensitive where this would have to be something discussed in addition to this motion madam president this evening's motion is based upon the iba team's recommendation and the planned and anticipated budget for next school year not making any kind of a judgment or value statement on the motion or on the request we would need to mr hicks would need the opportunity to evaluate the budget to determine what impact that would have and and make necessary adjustments if possible quickly thank you for mentioning that um although it's within the board's authority to um change what's presented out

of iba typically the board honors the work that's done on our buyer staff through the iba process so this would change that and i would recommend us honoring the iba process that we've had in this district for decades madam president if if the board's wish we could bring back a whole presentation at the next board meeting about the request remember grants requests if you'd like that that's a that's an action item me personally i mean i'm gonna i'm gonna make a motion just again because i feel like doing that would not give the honor of the process that we typically do with our iba groups if ms grant would like to request an agenda item separate i mean that's certainly within miss grant's right to do as a equal board member but honoring the iba

process i'm going to make a motion that the board approved the salary for certified licensed classified and administrative employees and the 2022 2023 style replacement schedules as presented hold on she had already she started emotion so her motion is still on the floor but that was outside of the agenda right so i'm just saying she started a motion so she needs to i'll just with her all the way thank you thank you i will second mrs motion made by christine pritchard seconded by crystal schaffen motion carries next we move to action discussion four recommendation to approve the substitute compensation structures for the 2022-2023 school year dr dean thank you madam president members of the governing board dr croto will present the information related to substitute confrontation structures thank you dr dean um madam president members

of board cabinet guests the administration recommends the governing board approve the compensation structures uh for certified classified administrative substitutes these are based off of the salary schedules that you just approved so it is adjusting our rates for our classified subs and our regular subs are on there those rates are not adjusting so with that i'll stand for any questions or comments entertain a motion i move the governing board approve the substitute compensation structures for the 20 2022-2023 school year as presented second motion made by tracy sorry singfel seconded by joe grant motion carries next wound action discussion item 5 recommendation to approve the district extracurricular supplemental assignment contract addenda pay schedules for the 2022-2023 school year dr dean thank you madam president members of the governing board administration is recommending approval of the district's extracurricular

supplemental assignment and contract addenda pay schedules with the changes for the 22 22-23 school year which were outlined by mr hicks in the iba presentation questions or comments from the board i moved the board approved the district extracurricular supplemental assignment contracted done to pay schedules for the 2022-2023 school year as presented second motion made by christine pritchard seconded by dawn dunsmore motion carries move to action k-6 recommendation to approve 2021-2022 revised expenditure budget dr dean madam president members of the governing board administration recommends approval of the revised expenditure expenditure budget with the information provided this evening during the public hearing by mr hicks any questions or comments from the board i moved the board approved the 2021-2022 revised expenditure budget second promotion made by christine pritchard second by tracy sourcing phil motion carries next we

move to action item k7 approval of superintendent's resignation agreement and release dr dean madam president i will defer to legal counsel for this item and we'll read it again madam president members of the governing board dr dean members of cabinet and ms brown tonight the board will consider the adoption of a resignation and agreement and release relating to the employment of dr quinn kellis dr kellis currently has an employment contract that is scheduled to end on june 30th 2023 under the terms of his existing contract there are five different ways in which the board or and or dr kellis may end the contract early one is a unilateral termination by the governing board which is an option that only the board can employ the second is a through resignation the third is due to incapacity

the fourth is by mutual agreement and the this is through death of the superintendent the item to be considered by the governing board this evening is not a unilateral termination by the governing board dr kellis has agreed to voluntarily voluntarily and irrevocably resign effective on june 30 2022 under the terms of the proposed agreement the item presented includes dr callus's resignation a release of claims and a mutual resolution with respect to a separation of employment for the 2022-2023 school year thank you i understand we have many people wishing to speak to this item madam president there are several who would like to speak to this item ms chapman has those requests at this time okay before macheffen reads that statement i just again want to remind everyone that we need to be respectful and if

it becomes disorderly in any way we're going to have to ask either individuals to leave or we're going to have to stop the public comment so please be respectful of all parties speaking this is the time for the public to comment members of the board may not discuss items that are not specifically identified on the agenda pursuant to ars 38-431.01 action taken as a result of public comment will be limited to directing staff to study the matter responding to any criticism or scheduling the matter for further consideration and decision at a later date in order to facilitate accomplishing the business of the district in a timely manner a time limit of two minutes will be imposed for each individual or group addressing the board when you when you approach the podium please state your name

for the record 32 individuals have filled out a request to speak to the governing board this evening again the board will strictly limit each speaker to two minutes speakers will be recognized in the order in which they submitted the request to speak again when you approach the podium please state your name for the record our first is nicole king president pritchard members of the board dr dean members of cabinet and guests my name is nicole king and i'm here to address the forced resignation of dr kellis i mother to three children in the district i have lived here for 15 years i'm a taxpayer and i'm a very active member of our community i'm dismayed at the thought that we would end dr kelly's contract early for absolutely no justifiable reason since you claim to

be fiscally conservative explain the reasoning behind wasting at nearly half a million dollars and requiring a national search as a board you're supposed to be the voice of the community for the past several years i have sat in this room and watched virtually as you have used this board room to grandstand and push a political agenda again and again education is nonpartisan yeah it seems like every meeting you're wasting time discussing political trigger words like crt and indoctrination none of which is actually happening in our schools instead of talking about the true needs of our students and staff what should you be talking about that's simple classroom sizes lack of funding equity inclusion staff and and student health and safety building community and fostering growth of students and staff that is the role of the

school board it is woefully clear that you are the ones who have been indoctrinated to the divisive rhetoric aimed at striking fear and distrust in the minds of our community should you go forth with this agenda item i will personally make it my mission to ensure your reign of terror on the board and comes to an end in november our community is watching and we will no longer sit by and watch you destroy our schools as a board you have a duty and an obligation to vote and act in the board meetings impartially for the good of our district as a whole you are absolutely not impartial and you are certainly not acting in the good of our district next we have chris judd good evening board members dr dean first i want to thank

you all for volunteering for this abuse this is a tough job you're in a tough spot and i appreciate that you've all come here and that you're that you're dedicating your time to make our community better and to dr croto's point this is an awesome district you can tell because there's so many people here that are concerned about our district i am here because dr kellis is a great man and an asset to our community and i think everybody in this room knows it he was superintendent of the year for 20 in 2020 and a little over a year later is being forced out he was recognized as an honorary commander for luke air force base in and the board's forcing him out the mayor surprise recently recognized him with a community leader award yet

he's being forced out he opens school facilities to residence residents when not used by schools why because he understands these are taxpayer-funded facilities and he believes that taxpayers deserve access to him yet he's being forced to resign losing callous will be bad for our kids that's bad for our community it's bad for community development if we have a bad school system it's harder to attract businesses and business owners to our community a good school system goes hand in hand with a good with a good community great cities cannot have a bad public school system it's not too late to vote no on kelly's forced resignation please vote no find a way to work with this great man and keep him around if you love surprise and really want us to live in a great community

i hope you'll do the right thing and save kellis next we have andrew simek madam president members of the board unfortunately not dr kellis here and members of the cabinet my name is andrew simek and i am a class of 2019 alumni of shadow ridge high school i'm here today because as a former student and an education advocate i am deeply disappointed with the decision this board is making the forced resignation of dr kellis is a bad move and a big mistake you the dysart override was passed in 2020 with the provisions that the funds used from the entire community's property taxes would be used to retain and attract high quality teachers lower class sizes and work to bridge the achievement gap instead we've seen that you're far too busy worrying about where people go

to the bathroom what books you can ban and removing social workers from our schools the final straw is that you want to remove dr kellis from his role as superintendent dr kellis has jumped through every hoop you've wanted him to even when you lit the hoop on fire by giving him a negative review you are failing the kids in this district those kids include my little brother and my cousins you have insulted teachers by raising the cost of benefits and eliminating any breathing room they may have had in their salaries and you have insulted the countless parents staff alumni and community members who supported the override in 2020. you are here to adhere to governing board policy and removing the superintendent and acting in this deluded and quite frankly strange political agenda is just the

wrong direction to go and i look forward to supporting the recall of of miss denz excuse me of miss pritchard and miss chaffin and i look forward to when missed it i'm losing my place sorry i get fired up i look forward to electing new leaders who are going to support this district and are going to support kids and restore common decency and common sense to this district thank you next we have lisa moberg hi i'm lisa moberg i'm employee days art unified i'm just looking at you guys i mean we have been through so much and it feels like a family reunion at a funeral today it really does and it's so sad so sad i was hoping to thank dr kellis for his inspiring positive and professional leadership especially in the past two

years while the world dealt with the pandemic and its impact on education he began his role immediately with branding us as extraordinary he took time to go to classrooms and to thank teachers for being extraordinary i'm not a crier so this is kind of big really not in public either so this is really big he began super in 60 media media posts to showcase extraordinary people he's an active participant in our days our hero awards taking time to pass out our infamous balloons 48 seconds um he's purposeful with being uplifting thoughtful and kind he's patient during these board meetings in response to criticism and negativity with kindness always kindness we have one goal to do what's best for children that's all it is it's about the kids thank you next up we have matt smith

hello my name is matt smith i'm a parent of four dysart students or graduates and and proud to be part of the dysart school district which is awesome i'm here to support dr kellis as well um i appreciate the responses that i got in in emails from mrs sawyer sink bell and also sis miss prichard i appreciate your responses um ms pritchard did tell me something that i really appreciated and she said do not believe everything you read on facebook and i completely agree with that i was taught when i was young that you will know them by their fruits and that is to say that you'll know somebody by their actions and the results of their actions some of the fruits that i've seen from dr kellis are his total support for the kids

in this district having four kids go through this school system i've seen dr kellis at plays choir concerts band concerts awards assemblies track and cross-country meets basketball games volleyball games football games i've been amazed at how many things i've seen him at i have seen the joy that it brings a young athlete to have the superintendent the district superintendent come up to them and congratulate them on winning a meet or a race or congratulating them on a job well done if they didn't win i've heard stories from other young adults about dr kellis attending uh student council meetings to help them feel heard and trying to figure out what he what he can do to help and implement programs to help them i've been part of an interfaith breakfast that dr kellis has led to

bring community faith leaders together with principals and school administrators he made it very clear to us that although there is a legal obligation keep the separation of church and state that does not make it so that we cannot talk to each other and team up to help students and families in crisis these are the kind of actions that i have seen dr kellis and i've seen him do and and the things that will make a difference in the lives of our kids too short of time i was planning on three minutes here the i uh i'm proud of the the district and i and i'm and i appreciate everything that dr kellis has done and we need more people like him next up we have jen tanner good evening my name is jennifer tanner i

served on the governing board for 12 years i have a lot of history with dysart with its policies and with two separate superintendents i know during this item you're going to talk about that you've made a lot of or had a lot of conversations in executive sessions that need to be remain confidential and that as a public we are not privy to that information so since i cannot speak to what i don't know i will speak to what i do know i've been through executive sessions where evaluations and end-of-year reviews were held for dr kellis much of that information was again echoed when we would come back out and share with the public how the efforts of transparency as we shared progression towards district goals 18 months ago i left the governing board and at

that time i left and there were great working conditions between the board and the superintendent and cabinet i would say the ship was sailing just fine and one month later you discontinued policy governance and it's been a slippery slope since then something to me doesn't sit right and when you choose to respond to the public and i've seen some of these responses and being half truths i've always been a governing board member who was about seeking truth so in order to make sense of this i've sent a public records request for board emails and exchanges with one another and the superintendent myself as well as prior governing board members are ready and determined to find answers lastly for being public school advocates you must think we are really uneducated to believe dr kellis voluntarily resigned

[Applause] he has i have i've never seen another superintendent put so much heart and soul into his his work and to the students of of this district he is in all these schools he was still out visiting schools today and still pinning extraordinary pins on people [Applause] thank you our next speaker is kevin cowell [Applause] hello you all um my name is kevin cop been in surprise since 2004. um i'm a parent of two kids at uh who are at shadow ridge high school one's graduating here in a couple days and the other one is finishing his freshman year i'm also a previous uh pto treasurer at sunset hills for three years and i'm currently the treasurer at willow canyon high school's theater booster program yes my kids get their shadow when i'm over there

my wife calls me a traitor i'm just here to support dr kellis because i work in the corporate world and i'm just going to tell you guys when you have someone who has that extraordinary amount of leadership we don't ask for the resignation we celebrate them and in this role we'd give them a contract extension we wouldn't ask them to leave that is just the way the corporate world works so unless there is a valid reason which i have yet to hear one of them it would be it just doesn't really jive with my corporate mindset of letting go such a great leader and i think it's a big mistake thank you next we have aubrey sims [Music] [Applause] good evening governing board members my name is aubry sims and i'm a senior at valley

vista high school i would like to express my support for dr kellis and all he has done for this school district from a student's perspective because that's what we should all be here for prior to dr kelly's employment as superintendent at dysart i did not know who the superintendent was in fact i never saw her or knew of her the year dr kellis became superintendent everyone knew who he was not because he was demanding but because he took the time to speak to us to get to know us learn with us and teach us how to lead with empathy i have been heavily involved in my school for the past four years and i've worked very closely with dr kellis on multiple occasions i can confidently say that he cares about the students and making

our experience extraordinary and that is exactly what he has done dr kellis has focused heavily on communication with students staff parents and the community he has made an effort to meet with students at all dysart high schools at least once every semester he asked students for feedback and what he can do to make our experience extraordinary he explains situations to students and is very transparent with us at every meeting he asks students two questions how do you lead with empathy and how do you lead by example these questions have stuck stuck with every student he meets and will continue to do so for the rest of our lives leading with empathy is the ability to understand and share the feelings of others doing what can benefit them rather than yourself he has made my experience

extraordinary and gives my gives me the ability to lead others in ways i never knew possible so i leave you all with two questions how do you lead with empathy and how do you lead by example because the way you vote tonight will impact every student in the dysart district we have been gifted an extraordinary experience with dr kellis as superintendent for the past four years and i would hope the board would want students students to continue to have an involved and caring superintendent as they are not easy to come by dr kellis has made a huge impact on my life and my student experience i along with many other students across the district would hate to see him go thank you next [Music] okay next we have jackie fabry jackie fabry good evening my

name is jackie edmonds aubrey that was beautiful those very brave congratulations for being an advocate for yourself and for education that was wonderful i am a pto pta um local unit leader i am the regional director for the arizona state pta um i am a child activist i am not a political activist i don't know a whole lot about this process what i do know is i spend countless hours raising money for my school along with my team and my unit and when you see something as frivolous as buying out a contract for somebody who is doing an amazing job uh it's a slap in the face because the year that we've spent working so hard is making a fraction of the amount that will be spent on this nonsense and it's it's disheartening to

feel that i appreciate you letting us speak to you to let you know how we feel it would have been better to be a democratic process to allow the voters to decide whether or not to vote in somebody who would like to propose dr kellis be resigned as their campaign and led us to vote on whether or not we approve of that it is not being put into our control and that's disheartening i hope that we will all persuade you to know on this and if not i hope we can fix it thank you thank you ms edmonds i do apologize it took me a while to find your name so thank you um next we have she sheila kaiser [Applause] hello my name is sheila kaiser i'm the mother of three dysart graduates amazing

graduates i've also worked for the district for over 13 years now so i'm here to talk to you today about trans your trans of translating what you're doing in private to the public you are the one who controls what happens in an executive session you have the ability to let the public know what's going on and you have yet to do that you've heard the amazing uh comments about dr kellis and how well he's done so that leads me to believe that there has to be another reason of why you are asking him to step down and believe me we know that he's being asked to be set down so i would ask you i've sent all of you emails with a a post that had been made from a a group here in arizona

that mentioned the three of you as part of their group they have used words to describe our parents our students and our teachers as leftists commun that is a quote intimidating violent rabble-rousing leftist and marxist this is the same group our part of them who surrounded our school banged on the doors and called our police officers nazis and then in the very next situation ms schafen actually commented your name in person as on their side so i'm here today as a teacher and as a parent to ask you to quit being on the side of a political agenda it is time that you're on our side we are the parents we are the teachers we are the taxpayers and we are the students of this district you work for us not a political agenda and

so i'm asking you today to not vote yes on this uh item that you would stand up against this group that you have refused in my emails to tell me that you do not belong to a part except for you miss chapin thank you for your response and i would also ask that you make it public next we have mayor skip hall [Applause] mayor skip hall madam president and the rest of the board and assistant superintendent jimmy dean uh i appreciate the opportunity to speak this evening albeit i'm saddened to do so given the circumstances there is not enough time to articulate how much dr quinn kellis means to surprise his list of accomplishments and awards speak for themselves just to name a few the arizona school of public relations association award superintendent for contributions

to public education in 2020 honorary commander of luke air force base focus on providing dysart extraordinary experiences within the district can surprise advisory groups for staff parents students and community weekly super and super in 60 seconds videos for community education open the vista center for the arts 2020 open the asante preparation preparatory academy and freedom traditional academy to accommodate rapid growth and community needs in 2019 launched the annual festival of arts for the community in 2019 as 19 or excuse me has nine a-plus schools of excellence from arizona's educational foundation over the past 10 years there's a 92 percent graduation rate the state average is 79 and so much more dr kellis's role is very similar to a city manager's role he is the ceo of operations for the school and the dis as the

community as the city manager is the ceo of the operations of the city it is our job as elected officials to make policy it's a school board's job to do the same for the district dr kellis demonstrates you have done it that he has done a job extremely next we have lisa fowler madam president members of the board dr dean members cabinet my name is lisa fowler and i'm a wife and mom of five two graduates at shadow ridge i have been a dicer volunteer since moving to surprise in 2012. during this time i've had the opportunity to work with dr quinn kellis his servant leadership style has been an inspiration i serve on the superintendent parent advisory council where we get to meet with admin and the cabinet and parent support group leaders and

he asks us what can we do what how can i be better how can i help you and all we can do is sing as praises because we're so proud michelangelo said that greatest the great danger for most of us lies in setting and not in setting our aim too high and falling short but in setting our aim too low and achieving our mark when you talk about his goals dr kellis didn't set low easily achievable goals in order to secure bonus instead he set large lofty goals to inspire himself and everyone around us to exceed expectations extraordinary you know i can go on and on about the virtues of dr kellis but that's not going to save his job today so let's address the elephant in the room that has this has nothing to

do with dr callus's performance or his accomplishments this has to do with three rogue board members who've been trying to gain power and control of this district and unfortunately they have the support from an extremist special interest group that also funded their elections chrissy don and crystal you know you have the majority you decide the outcomes of agenda items this has been obvious in several meetings with how joe and tracy have been treated with unprofessional condoms you're so condescending to them it's hard to watch it's as if their ideas don't matter tonight is the perfect example of what the three of you have been working together on it's an extremely dysfunctional board that is not working in the best interests of the most important people affected which is our kids you want to talk about

violating trust you violated our trust so i'm calling for the immediate resignation of christine fracherdon next we have teresa delong theresa delonge valuable dysart board members my name is theresa delong i am a dysart parent and teacher i implore you to reconsider exiting dr kalis before his contract time first what an incredible waste of taxes if the board chooses to buy out dr kelly's contract early there would have to be a very good reason and i know of absolutely no good reason to exit an award-winning humble humble superintendent early at taxpayer expense dr kellis has shown a spine of steel in these times when other districts were refusing to open their doors out of fear of a virus dr kellis stood strong in getting us back into our classrooms and guiding us towards as close

to normalcy as we could get dr kellis comes to campuses he speaks to teachers students and he actually answers emails even from me and staff and community members i've been employed by this district since 2005 and i will tell you from experience that is not always the way it has been dr kellis is not a contemptible politician type at all he doesn't easily bend the way that the wind blows on sensitive social trends he is a person who stops to say hello brings school staff ice cream talks to students works hard to put his voice out to all the dysart community please do the right thing not the political thing keep dr kellis [Applause] next we have katie mccarthy good evening madam president members of the board cabinet and community my name is katie mccarthy

and i come to you today as a proud dysart parent and staff member the pride i have and where my child receives her education and where i work is directly related to the extraordinary leadership from dr kellis under the leadership of dr kellis my daughter has been able to experience the middle school model which has prepared her more for high school than i could have imagined in addition to receiving high school credits she's developed organization and time management skills that will be vital to her success in a dysart high school having worked under many different leadership styles over the years i can tell you that one thing that makes a great leader is visibility as a staff member i am so grateful to have an involved and present superintendent dr kellis is visible to the

staff and the community in a variety of ways you've heard about the super n60 video that's put out every friday and highlights the amazing things we have going on across district in a way that is accessible to community members dr kellis has also found a way to highlight the amazing staff we have across the district the extraordinary pin is delivered to staff personally by dr kellis as you heard he was out on campuses today doing just that these are just two of many examples of what dr kellis has done to be president for the district that he obviously cares so deeply about i could list all the awards accolades and achievements dr kellis has received or that the district has received because of his leadership but that would go way beyond this two minutes a

resignation would be a devastating loss to dysart students staff parents and community partners it is unlikely to find a replacement with the expertise and dedication that dr kellis has demonstrated during his tenure it would be in the district's best interest for everyone involved to develop a solution that allows dr kellis to complete his contractual obligation i know i speak for many when i say the true dysart hero is dr kellis next we have a mr looks like team william is it gayam madam president uh members of the board my name is william conium a dicer parent two kids attend dinosaur schools um as mayor hall said today's a sad day um as lisa said it feels like we're attending a funeral we're worried about what's happening to our district um but the thing is you

know we're worried about this ax that's about to fall that we can just we see it's about to fall right we're worried you look around this room everyone here is worried the thing is though and i'm looking to you madam president you have that power you have the courage i know you can do this okay please stay that axe vote no this doesn't have to happen that's all i have to say thank you thank you next we have mr ryan eldridge okay thank you next we have shiloh freeman good evening i'm a parent and a staff member and community member first they came for the socialists and i did not speak out because i was not a socialist then they came for the trade unionist and i did not speak out because i was not

a trade unionist then they came for the jews and i did not speak out because i was not a jew then they came for me and there was no one left to speak for me these are powerful words of martin niemoller during world war ii my name is shiloh freeman i have lived in surprise 14 years and have taught all these years in dysart prior to moving here i loved living in my hometown community a rural very conservative community where my scholars knew our superintendent and all board members faces because they had a constant presence on our school campuses they were spectators at sporting events and at arts performances decisions from our board were always created with our staff and scholars in mind we were also giving great input my experience in dysart was very

different i didn't feel like a valued employee until dr kellis arrived he instantly surveyed staff to seek our input he's a face on campus my scholars know i genuinely believe he cares for all of us and that is needed in our current climate as i wrote to you in the emails i sent all five of you i am a conservative who attended george bush's second inauguration in january 2005. i come from a long line of conservatives and married a conservative i was an advocate for returning to schools in january 2021 during covet for a myriad of reasons and also hoped the decisions would have been made to remove mass before the end of the last school year all that said i also come from a long line of educators starting with a great grandma who

taught during the spanish flu pandemic my family has always been pro-public education and we have always loved and value our scholars dedicating ourselves fiscally and physically to enriching their emotional or their educational experiences i'm gonna skip down um although my mom did pass away in 2020 my son needed scl for grief and in closing i have to say i'm frightened by your ability to force our wonderful superintendent to resign if you're so easily able thank you next we have johnny v melton hi madam president board members dr dean how are you uh my name is johnny melton i have a i've had three kids go through dysert great schools and happy to be here i'm here to talk uh because i'm actually supporting the board here um the board makes decisions that you're voted you're

elected to make tough decisions financial governance sometimes hiring decisions and because this is the way the system works we we don't know all the inner workings we're not privy to to what you are always discussing so we're left with conjecture a lot of there's been tonight there's i've heard a lot of speculation on why and questioning your motivations and and i i don't do that i give but people benefit out i give this board the benefit of the doubt i i know a lot of you on that stage i know a lot of you behind me i'm a known political actor so i know a lot of people here and i choose to give you the benefit of the doubt and i i hope the community will learn uh what transpired and and and why

you took this course um i just hope we all have patience to let the process play out thank you board appreciate it [Applause] thank you next we have alexis anderson hi i'm short so this was okay um i am a proud parent of four kids one graduated dysart last year i have three that are still in thanks to dr kellis i have now asante that school has opened up because i like the idea of having school choices my kids now have school choices to attend a traditional middle school something that is well liked and hopefully it continues um i also have a i don't have a say in your positions because i am an open enrollment for my kids because we don't have a great school district from where we live but if you guys

accept his resignations i will be boots on the ground helping my neighbors across the street where they are voters in this disart dysart district recall you i just want to put that up there also from the financial point of view looking at tonight's financials uh it does not seem the best fiscal responsibility of the board to spend this money when it is not warranted on to buy out a superintendent who is phenomenal if if he wasn't phenomenal we wouldn't have the community relationships that we do our mayor is here speaking on him i mean if that doesn't say wow what is going on with us then take off the blinders because this is ridiculous go callous next we have bill pupo or puppo i'm not quite sure good evening governing board members and staff i'm

bill pupal i'm a 22-year resident in the city of surprise i'm a grandparent to two students within the dysart district and a third to come in a year i'm a retired city manager and one of the things i was taught as a as a city manager early on in my career was as a city manager to discuss the undiscussables economic development requires a tight partnership with the school district businesses looking to locate in a district needs certainty stability and vision this governing board transmits an image of dysfunctional policy making your behavior and actions potentially impact economic development it creates an embarrassment to the district the employees and the region i told three business leaders today that represent about three thousand employees they're not located in surprise and they were frankly shocked at the agenda item

that appeared they were wondering why this dr kellis is being forced to resign dr kellis they said has assembled one of the greatest staffs in the state of arizona for the district these staff people came to dysart district because of dr kellis not because of a great board most of them probably don't even know you frankly the voters in 2015 and 2020 placed trust in you by approving the override they trusted you to put that money into the classroom now tonight you're taking a forced resignation with an undisclosed amount of money that the attorney did not apparently disclose or discuss you're taking that money that belongs in the classroom thank you thank you jason laubermeyer good evening my name is jason loebmeyer it's everybody makes a mistake don't worry about it i just want to

say thank you for all of you being here i know that this is an unpaid position and i appreciate your service we have a lot of fantastic people in the room we have a lot of fantastic people in surprise and i agree that dysart is an awesome district i want to urge you to vote no on accepting dr kelsey's resignation i've got a lot of personal stories that i could tell but i feel there's so many other people that are doing such a better job than i could do so i plead with you to please hear what they're saying i did want to share a couple of things the main argument that i think we've heard is some sort of financial piece to it we've talked about it tonight there is a great resignation going

on it's hard to find quality people if we take this action of accepting a resignation when we have him for at least another year we're putting ourselves in a very difficult position to fill his spot along with the referral program we talked about not losing people in droves but the referral program only retains 30 of people who actually tried out dysart so so we need to retain our leadership and strengthen that i want to leave you with uh two quick things i i'll strike it to one uh yesterday i was at a choir concert for one of my students who attends canyon ridge and the lyrics were in a time full of war be peace in a world full of hate be a light when you do somebody wrong make it right i urge you

to vote no next we have crystal rogers hi madam president and board members my name is crystal rogers and i am a member of this community i am one of the parents that stay in the back i don't pay attention to a lot of the drama and things that go on i've had kids in the ice art district for 16 years during that time i've often considered moving my kids to charter schools or moving out of the area because of struggles i had in the schools from ieps and 504 plans and poor administration and the way they treated the kids i've had three kids graduate from dysart high school and i currently have a child in elementary a child in middle school and a child in high school and i can tell you as a

mom for the last three years my kids have excelled further than they have ever in their entire career in school and i attribute a lot of this to dr kalas because when i did have problems i was able to go and voice my concern and they were addressed my kids come home and they tell me about dr callus they have a personal relationship with him i have never in my life heard of a district where kids know who their superintendent is who love their superintendent who care about their superintendent and know that their superintendent cares about their success i have many teachers they're my friends i have many and had many conversations with them about wanting to leave the district because of things that were going on in the last few years we don't have

those conversations anymore they people have talked about the super in 60 seconds i look forward to that every friday to see what's going on with these kids in this area and how they're excelling and he's the one that brings that out for them i don't believe any of this is coincidental i love the transparency dr kalas has truly been a light to this district and i believe that he has the kids and teachers best interest at heart my kids know him my family knows him and this entire community knows him and i urge you to vote no thank you next we have candace rudolph good evening um i have been a member of the surprise community for 15 years i have three children two in high school one currently in junior high we are very

active in sports in the community and with our school that being said dr kellis has been a huge uh supporter of that we've seen that come through over the last few years we've seen a lot of support for the special ed services support with iep issues that we've had where the schools are now getting more staff and more help with that that has been huge and has hugely impacted my family having a senior at willow canyon i can tell you this was not a great year for her one of the highlights was talking with dr kellis and him talking to her about what's your empathy helping her see that even though there were some horrible things going on that were directed towards her that she should still have empathy and continue to move forward and

be positive and i think that that has been incredibly helpful for her and i'm very grateful for him doing that um other than that i'm not too sure that there's anything else i could say that other people haven't already said tonight probably far better than i could i do really ask and pray that you will vote no and not accept his resignation again having been here for 15 years and having had a lot of issues i can tell you that the last three years the impact on the attitudes in the schools on how the teachers feel has been incredibly changed for the better if you are not willing to vote no tonight then i ask that you table it that you listen to the community that you listen to everything that everybody here is saying

because as a whole it sounds like thank you next we have laura wellman hi my name is laura wellman and as a parent in the dysart school district i wanted to voice my support for dr kellis and tell you my experience with him um i sent him an inquiry about an issue that one of my children was having at school and that was hard for us we were struggling with and he directed me the person that i should contact to work with to resolve the issue and then i later found out that he went with that person to the school the next day to look into my concern and i i was touched by his his personal support for me and my concerns and my experience illustrates that he places a great priority on student

and family experience in our district um and i think that's invaluable and my teachers of all my children's teachers have all told me that they have felt a lot of support from dr kellis his focus on students family and school staff is exactly what i want from a superintendent and he should stay and continue the good work that he's doing thank you [Applause] next we have meredith sierra good evening madam president fellow board members and i want to acknowledge all the great leaders in this room and our community i am i have been a member of the dysart boundaries since long time um i have been a member of or part of the surprise wonderful community since 2006. that's when my children began to start school and i want to start that i'm also a

very proud educator but in another school district but as my children started school within the dysart district i quickly learned this was not the place for my children i quickly learned that the board that the superintendent did not have the best interest in my education of the future and unfortunately i tried to turn to a charter school it hurt me as an educator as in the public school to do that in the last few years i have watched dr kellis i have heard him i have heard the comments in the community and i finally said it is time to be a proud member of the dysart school district my children started this year and have flourished and have loved it and i know it was under his leadership even my children my daughter was here

and staying in front of you guys a couple of months ago shyla seatta and i could see the passion of your eyes and the love for the children that you guys serve and i don't know what the issue is because it's being done in private but i encourage you please work together please have the best interest of all of our children and keep dr kellis thank you next we have michelle dillard hi my name is michelle dillard i don't usually do this but i want to thank you for allowing me to participate in the open meeting today without violating my constitutional rights and trying to have me arrested but i guess that's because dr kellis isn't here so i'll be able to speak which is good because i'm here to thank the board and to

recognize the board for the courageous decisions that you have made over this past school year you have removed the mask mandate you open the schools you're putting the kids and the community first and the parents you disassociated with the arizona school boards association and i've heard a lot of great things being said about dr kellis what i haven't heard about this evening in relation to him is the district ranking and the achievement academic achievement of the students and that is what education is about it's how the kids are performing i understand that everybody might have a nice story because he came to a football game but we need the kids to learn the achievement gaps to be decreased and that's what education is so i say to the board i appreciate you being courageous and

putting the kids first and the community first and it sounds to me from what i understand from what the attorney said that this is a mutual agreement he's not being terminated he's offered his residency he's offered his resignation and if you don't know what it's about you ask yourself this why didn't he tell you why you're only talking about what the board is and isn't telling you what about him why isn't he here tonight to defend himself he quit he's not even here thank you [Applause] [Music] [Applause] thank you next we have mark demmer okay i'm going to remind everyone to be respectful even if it's something you don't want to hear or will end comment no there is no we'll try there is we will be respectful that is the end thank you madam

president member of the board my name is mark demers i live in el mirage i'm also a proud dysart unified school district parent a grandparent and then a parent again my wife and i adopted our granddaughter i've lived here since 2011 and there's a lot of talk going on about the whole dysart unified school district is 187 700 people that's 40 000 people more than the city of surprise it's a lot more than city of el mirage it encompasses 140 square miles that's bigger than surprise it's a huge district less than 30 percent of the people in this district are directly involved with the public school system that's students parents teachers administration social workers the other 70 of this community like myself are not involved with public school i have my daughter over there she

attends a different school i'm not involved in public school by choice because of the statistics because of the i'm into facts and the state of arizona has had a d-plus rating from the department of education since the early 90s in 2018 when dr kellis took over here in the dysart unified school district they had a rating in a top 40 percent today it's 37.7 percent so he might be a wonderful person i don't know i don't know him personally but i just look at stats and facts and evidence my daughter's not en enrolled in this school because i am interested in education and she's enrolled in a school where she actually gets an education i'm here to show my support for the three members of the board crystal christine and don who understand what the

entire district thank you next next we have kelsey royer i'd like to first thank the board for volunteering in your positions i recognize that it takes a lot of time and effort and that it's voluntary on behalf of the community i also want to express the wish that the board be transparent with parents as a parent finding out that a superintendent was suddenly resigning and finding that out like just through a facebook group was jarring i wish that i had been informed in a different way on that note i'd urge everyone to consider the costs associated with this kind of change setting aside differences of opinion about curriculum etc what cost can we expect our children to undergo as a result of this sudden change i believe it's safe to assume the district will incur

a significant monetary cost and that will be taxpayer funded certainly there will be less tangible costs as well will there be items of business that are put off until a permanent placement is secured will the new superintendent be as proactive in communicating with parents lots of questions and concerns i asked the board if the many positive qualities associated with dr kellis that we've heard tonight are not what the board is looking for what is the board looking for is what you're looking for specific to your own personal beliefs or does it benefit the community as a whole you agreed to represent all of us all of the students and i ask you and urge you to please consider whether terminating your contract with dr kellis is truly in the best interest of our children i

foresee next year a lot of turmoil as we go through different changes a national search for a new superintendent and um my concern is that the new superintendent that's put in place is not going to represent my values as a mother of very young children who still have many years in the dysart district thank you thank you next we have marissa elder good evening thank you for the opportunity to speak my name is marissa elder and i'm an occupational therapist in the district um i would like to point out that the staff retention rates in the 90s are directly related to dr kellis and his leadership in this district based on the lack of evidence of misconduct his forceful resignation is unethical and detrimental to the students who are charged to service education is more

than numbers it's more than rankings or letter grades it's about treating children as a whole and bettering them and preparing them for a future and dr kellis has done that he just demonstrates an effort to connect with staff and student students community at large and he cares about students on an individual level as an occupational therapist i work with students with emotional disabilities and i've seen it firsthand how trauma and abuse can impact their ability to access their educational curriculum dr kelly's support for social workers and the emotional needs of our students is one of the reasons i've loved working in this district and he's being punished for that i've recently read a book approved by the arizona council for exceptional student services for continuation credit on the need for empathy in our children it

states that failure to understand and cultivate empathy however could lead to a society in which no one would want to live a cold violent chaotic and terrifying war against all as it's a culture that could be inadvertently developed throughout america if we do not address current trends in childbearing education economic inequality and our core values social emotional learning is learning fostering empathy compassion integrity and self-esteem in our students doesn't take away from their instruction in more traditional academic areas like math reading science and social studies dr kellis understands his importance and is it is a shame that he is being displaced because he demonstrates empathy and emotional intelligence in regard to our students thank you thank you next we have jay leonard my name is jay leonard and regardless of what you may think i

appreciate each one of you and i pray for you often i understand what you're going through when i asked our friend what i should say because i'm not good with words and this is really a tough situation we didn't agree on anything our friend shot down every idea i had our friend told us what what are you going to prove by getting up there angry she asked me one question she said why are we even here and i know you can't answer questions but i would pose that to you and jokingly i said if you don't want me to talk so long because she would never get up here and speak i said i'll yield you half of my time tonight our friend is represented by an empty chair that has never been empty before

and a set of flowers in her honor i yield the end of my time to hurt and will not end with anything negative she told me i could say three words we are dysart [Applause] thank you next we have brent cobb hi brent cobb thank you madam president on the board for the time that you spend here and dr kellis i appreciate your service i've been listening to a lot of testimony today uh in your favor sir and there is a conservative group we're here i'm here because there was one officer supporting these boards typically and now there's five there was a risk and a concern for the ability to conduct business and the only time that business should be conducted with the borders either through the ballot box or through this podium and i

was very concerned about the lack of discretion and the lack of a civility that i have witnessed so my daughter was in this school my son was also in the school district and i did not like the low performing scores i did not like the the things that i was seeing and as you know parents have an opportunity to put their children in private school charter school home school online school they have a lot of opportunities and every time they do that they take money away from the students that are in the public schools which most parents rely upon so when i put my daughter in private school it was an absolute disaster it had the best academic rating in the state and she hated it so the next year i put her back in

public school now i'm a staunch conservative i care about results i don't care about social emotional learning i don't care about touchy-feely stuff i don't care about hugs i don't care about snapping i don't care about any of that but what i do care about is the compassion that you've displayed in the testimonies that i've heard with the students and i think if you choose to resign or if the board goes forward perhaps you should take a 20 to 30 position as an educator where it really matters in the classroom where the future is and if you choose to let the doctor go we want to know what your plan is going forward for success thank you [Applause] thank you our last one of the evening of the evening is heather brooks is miss rooks

here she's not okay if miss rooks is not here then that concludes our comment on the agenda item thank you everyone who took the time out of your evening to speak [Music] miss mccollin before we move to take action there was one there's a couple com several comments made um they're a little bit concerning and i'd like your clarification on legally one of the earlier comments in regard and was in regard to executive session and implication that the board has a choice in regard to what they share um implying and i think i've heard through various emails and just in listening to our community members tonight that there's this feeling that the board is withholding purposely withholding just providing reason or explanation for particular feelings or in relating to this item can you please uh

reiterate where the board's the confidentiality piece that's tied to executive session whether or not the board truly does have any say on what they can disclose and not disclose and then also speak briefly to the allegation of any any force or coercion in regard to this proposed acceptance of dr kallis's resignation madam president members of the governing board the governing board has engaged and as i said in my earlier presentation of this item has engaged in a series of executive sessions related to dr kelly's contract of employment the matters discussed in those executive sessions are confidential by law there is no ability for any member of the governing board or any individual whether that be a staff member or your attorney or any other individual who is entitled to receive information from those executive session

all parties are prohibited from disclosing and that's a part of ars 38 431.03 specifically it's section e of that statute so there is a expressed prohibition against disclosing information from the executive session with regard to the the agreement that is being presented for your consideration it is a resignation agreement and release it has already been signed by dr kellis it was negotiated between the parties thank you all right um so we have a as we are on k7 approval of superintendent's resignation agreement and release do i have a motion i move that we accept and approve the superintendence resignation agreement and release second motion made by crystal chapman seconded by don dunsmore i would like to go on the record stating that i will not accept this this resignation agreement i have not had any

i have always been respectful of dr kellis and he has been respectful of me we may not always agree but we respect each other and the last time we had a dark day in dysart was in january 2014 where we had to lay off 143 employees due to an override not being passed i also want to state that dysart was a contentious board several years ago approximately 2006 2007. we're now a contentious board again and there's been one common denominator i will be voting no [Applause] [Music] so is that the motion that i entered except that's not the wording the governing board may take action that's not the motion i made it's okay that's okay i just want to clarify we're good okay i'd like to also explain my vote for the record um thank

you all for coming tonight i had a whole lot to say but i just i can't do it um the decision to remove dr kellis is wrong it's wrong for dysart and it's wrong for the community this is also fiscally irresponsible when dr kellis only has one year left on his contract this is not in what is the best interest of the students in the dysart district and i vote no [Applause] motion carries next we move to the request for future agenda items yeah i'm just waiting to see if anybody else does yeah i do i'd like a future agenda item please and dr croto dr carter dr croto dr croto keegan is [Music] we're still in a public meeting yeah [Music] okay we're still in the we're still in the midst of a meeting
