Good evening. Welcome to the planning board meeting of Tuesday, March 3rd, 2026. Uh the meeting is on uh uh local TV. As always, uh there is no uh Zoom component to tonight's meeting. everything will be uh live at uh town hall. With that, I'll open up the meeting to the members and we first order of business is the meeting minutes from our last meeting of February 17th. >> We need to nominate a chairman for the evening. >> So, call for nominations for chair. >> I move that Joe Caljone serve as chair for this evening's meeting. >> Second. >> Motion's made and second. Any discussion? All in favor? >> I I >> Thank you very much, Matt. >> Awesome. >> With that, we'll go to the meeting minutes for 21726. >> Move to approve >> and
second made to approve and seconded. Any further discussion? Hearing none. All those in favor will signify by saying I. >> I. >> Opposed. That's unanimous at three. Uh we have 181P tonight. It's in our packet for industrial road one through three industrial road. You want to go over it, Matt? >> Nothing about that. >> I was expecting you to move into the center seat, >> so all my stuff over here. >> All right. >> I figured what the hell I'll just stay here. >> Yep. >> Perfect. >> One thing I need you to do is sign, please. So, the 81P is a land [clears throat] court decision. I haven't seen too many of these. Uh the one you have in front of you is a draft, but the one I have in the in the
office is the engineered stamp plan. Uh these were just sent by PDF, so they weren't the official ones yet. Identical otherwise? >> Yes, they are. Uh this is the one he sent over to verify everything was okay before they put the stamp on it. And this one's all good to go. Meets the frontage requirement, lot size of the zone. Uh it's a land court decision. So this is I recommend endorsement of the plan. Move to approve >> and seconded. Motion made and seconded to >> do we authorize? >> No, we I think we have to sign these, don't we, Matt? >> Not even for Lancut. Nope. Okay. Motion been made and seconded for Matt to have the 81P plans to sign the 81P plan. Any further discussion? Hearing not. All those in favor will signify
by saying I. I. >> Opposed. That's unanimous of three. That back down the mouth. Okay. All right. Um, we have the amended site plan for 10 to 12 beach street. >> I don't know if I'll need it to keep the crowd quiet at night, but >> you never know. I might get out of hands. [laughter] >> Sorry. I just had to for legal just wanted us to point out that we did have Zoom available on the agenda, but we had some technical difficulties. So, it is unavailable this evening. Okay. Say that all. >> Thank you. So for 1012 Peace Street, I did ask the applicant to attend. Again, we did see them earlier this week in the office and they gave us the revised plans that include the floor plan that confirms the square footage
that then matches the parking calculations. So the calculations are correct. And the one other thing that they added per the building inspector's recommendation was some ADA parking. That's right in the center of the plan in green. They're to service the other the other businesses [clears throat] owner is going to do that. Well, it's not necessarily the applicant. There is no kitchen that's proposed. That was a source of discussion at our last meeting. So, uh, that being said, I I recommend a favorable action taken on this project. Unfortunately, without the applicant here to answer questions, it's kind of >> unfortunate. We [clears throat] we had quite a discussion on this at the last meeting. Didn't we sense it? >> But [clears throat] everything that was discussed and concerns raised have all been addressed. >> Yes. It
was really [snorts] just parking that we were looking at in the first place and then the kitchen came up and whether or not sewer would be interested in the kitchen. But since there's no kitchen, there's no sewer interest. >> And [clears throat] one of the only other questions were the seating arrangements and obviously it's just in one half of the building >> and just whether or not >> you know would additional seating ever be >> put in and then how it changes from the parking calculations. >> Yeah, that was >> obviously it's a it's a very gray area, >> right? That was something we discussed was whether or not to do the calculations by seats or by square footage. So I asked them to provide both. So I don't think the seats as Liz brought
out previously. Here they are now. Great. The seat the seats um were not a calculation that we use in historically we use the square footage calculation which is provided in the floor plan. >> So and based on that square footage then the parking is adequate. >> Yes. >> Okay. So, >> so we we don't we don't have a letter from the sewer commission even I mean I know that there isn't an issue per se no kitchen so there's no grease trap issues or anything like that but were they >> were they did do we have anything in the file that says they're they're good with it >> I did not receive a letter from them but I know babe had talked to them previously and echo that their concern was only about a kitchen and
since there is no kitchen they shouldn't have any concern But we don't have anything in writing now. >> Do we did we have a discussion? I forget whether we had a discussion about the actually some of the parking being in the town right away. >> Didn't come up last time. >> Joe, you're referencing those three to four spots, five spots that are >> two right at the end. Well, it's eight, five, six. >> There's eight there, but I guess there's about five to six that are >> there's six that are actually in the town right away. >> Yep. >> And they don't have to be. It doesn't look like there's anything preventing them from being within the property. >> Even without those spaces, they still meet the calculation. >> I was I uh >> 80
existing spaces and 63 necessary. >> Uh 33 for the church with the square footage. >> May I ask the gentleman a question? on that because the chairman's usually sitting there. [laughter] >> Um, next time, well, actually, I should ask the members first. I was going to suggest that the next time they strike the lot, they bring the parking into their own all of the parking into their own. >> Well, the problem is I'm pretty sure that's curbed. >> Yeah. >> Right. That that front section curb. So, that's all that curb. They would have to go in and mark the curb. >> Yeah. >> And it's all existing, >> right? That is a curb, is it not? >> Yes. >> Well, gentlemen, what do you think? >> That's you guys. The applicants for Beach Street. >>
Come on. Yeah. >> Yeah. That that given that it's curbing that it's kind of a big deal. I mean, not a huge deal. >> Sopr0 Menon Road, North Bridge. We were having a It appears that some of the parking and and this has probably been existing for since the since the parcel was built, but it actually appears that part of the uh parking according to the plan is uh on the town right away for Beach Street. So this line is the right of way of Beach Street. this line here. But here's your parking. [clears throat] So your this curbing for the parking is in the beach street right ofway. Not the beach. This is the paved area here to here. But the right of way is here to here. >> Okay. >> Yeah. So you're
part [clears throat] of your curving is in the street right ofway. >> So it's not like it's proposed. It does exist as that's how it exists today. >> Yes. Right. Correct. >> So that's not >> Joe. As far as in history, have has there ever been that type of situation? >> We may move. We make signs that we're in the right away. >> Mhm. >> I mean, we have we have done that on Cape Road. >> Yeah. Was [clears throat] Cape Road. We've also done one on Barry Square >> at one point. >> This is harder. >> So there has been some Yeah. I and >> and I'm trying to figure out the easiest way of doing this, making note of I I I you know, again, you let it go once and then all
of a sudden, >> you know, everybody's building on town property. >> Question of clarity as the applicant, are you just renting or leasing that space or you don't own this property itself? >> No, we're just renting. >> So, I guess that that'd be the other part of it, right? So, they're just an applicant for >> one of the >> for one of the spots for one of the one of the tenants. >> Um, so does that fall back on to >> the um the owner of the property to for corrective action [clears throat] >> if if we choose that corrective action would have have to take place. >> Yeah, it would I mean because at the end of the day it's a site plan for the whole thing. >> Correct. the the fact that they're
submitting it is is because the owner put it on them to do the submitt, but it's still the owner's responsibility to have a site plan that meets the town's >> requirements. And the town's requirement is you don't build on the town's property, >> right? >> Yeah. >> Yep. Um I mean and and again I you know >> actually may I so I came just to do the application for the uh certificate of occupants and the lady said we need to do the actually the building inspector said oh you need to go to the planning and I went to talk to Matthew to >> to get the specifications to do the uh >> y application for the certificate of equipments. >> Yeah you you have to come to us. I mean, the problem is that again,
when when this was originally built, when the guy that bought this now, who isn't the original owner I know bought it, no one said to him at that point in time probably, you've got parking on town's property. It's a it's an ongoing issue. The only time we see it is when we get something like this. >> But to to then say, "Oh, we're not going to do anything about it," becomes an issue because we don't know what happens next when you let it go. That's That's the quandry. I'm not really into having you move five parking spaces, but I don't know what the option is. >> I mean, we could eliminate some, but it's still going to almost be the same. >> By that same rationale, Joe, it looks like the sign to the left
is also [laughter] >> and that curbing >> and that's a multiple business sign for all all the agencies. My personal inclination, and the my fellow board members and the town planner may disagree, is to let this to approve this proposal, but to have the building inspector or the appropriate person work with the property owner. Um my personal inclination is to not make these guys wait, but I am not sure that my fellow members will agree >> because those those eight spaces, you don't need them for your calculations. So that's definitely in your favor. >> Yeah. And I think to your point, if you look at, you know, it is intruding on the sidewalk, but if you look down at the the southern point of that >> sidewalk on the kind of the Google maps. >>
I don't think the sidewalk continues on. >> I don't believe it does. >> So >> there's only sidewalk from >> right >> the next >> basically the almost from the property corner and then heads kind of northwest. So it's kind of even a little bit irrelevant of from the standpoint of those parking spots intruding in. Um I do like your idea of Yeah. mother of saying, "Hey, let's move things forward for these tenants with the contingency of working that the property owner work with um work with our, you know, our town departments to uh kind of correct for some corrective actions. >> Might actually be the highway surveyor might be the appropriate person, but >> somewhere some somewhere." No, >> it won't be in have to be the building inspector. >> Yeah. So, So with
that, >> uh, >> I guess the only thing the only I I have no problem with that. The only thing that I would say is that I'd like to change the allowable the parking that's available on site >> Mhm. >> to be [snorts] six spaces less than what's shown in the calculation. So that if nothing ever happens and they come forward, we have a plan that's that's in file that says I'm not even saying mark them. I'm not saying they can't use them, but just saying they're not usable because they're not their property. >> They're they're not going to count in future calculation of >> So if anybody comes with a different use that requires more parking and they say they have it, no, they don't actually. And and we'll at least need to they'll
know about it. And I agree they should they should be proactive and work with the building department now to correct those two situations, but I'm just not sure where that's going to go at the end of the day. So at least at least we'll have a site plan in >> in file that correctly shows what they have for legal parking. >> I I think you've got a good idea to that those six spaces don't count count in any calculations. The trick will be will we all remember? Well, it'll be on the site plan that said file in in town offices, right? >> So, when they go to that when they go to that and go back to that, it's going to say the summon you got. So, when somebody counts it, I mean, it may
maybe you put maybe we haven't put a note on it that says the uh um the six spaces along Beach Street [clears throat] are not counted for parking calculation due to the fact that they're in uh uh town they're partially in town property. >> Okay. Okay. I'll leave that up to you, Matt, as to what we need. I that I, you know, we can we can approve it um subject to those conditions and and then, you know, we can sign it with a corrected plan. >> Yeah, I need a I need a signature block on here anyway. So, they needed to come back with that. >> So, it's saying these six spaces right up here. You guys want to come up here and take a look. saying these six. >> Mhm. >> From the overall
calculation here >> out this triangish. >> It's it's within the town [clears throat] right ofway. >> Yeah. >> And the your park the parking spaces are partly within that right ofway. So we're saying these six spaces don't count. >> I see. But you don't need >> for this calculation over here. So it doesn't that way we have it on file. That way we're making note of it. And we're also saying that the owner needs to outside of this discussion, the owner needs to have a discussion with the um with the building inspector in regards to the sign and these six spaces to try to come up with an idea as to how you make this legal because he's got he's got stuff in town property right now. >> I know they the building inspector address
some other things to do on these uh on this >> Yeah, he talked about handicap parking. Yeah. Yeah, >> that's a Yeah, that that you needed to do for us to approve it. >> This we're saying, okay, we're going to let it go. We, you know, it's an issue, but we'll let it go. But the owner, cuz it's not you guys, the owner needs to work to to to rectify this situation. [snorts] >> Okay. Move to approve with the provision that the six spaces that encroach upon Beach Street, the Beach Street right ofway do not count in the calculation and further provided that someone reach out to the property owner to correct that encroachment as well as the site the sign that's on the site which is also encroaching on the record. Motion to approve
the site plan uh sub subject to the u revision of the u parking calculations to show that the six parking spots that are partially located within the beach street waiteway are not included in the calculation for the required parking. Um and that outside of this approval that the um that the the property owner work with the uh building inspector and any other town um board to work to rectify the issue with the parking spaces and the sign which is also located in town property. That correct? >> That that's pretty much exactly what I said. >> Do I hear a second? Second. Any further discussion? >> Um, signature block. >> Oh, yeah. And also, uh, [snorts] modify that. You need to, you need to put a signature block on the >> I got it sketched out
for him. I'm just going to hand them >> when you when you bring in the plan to uh, it needs to have those corrections. You need to have a signature block so that we can sign it. So, uh, if Elliot did your work, he needs to add that signature block so it can be signed. >> Okay. It also needs a full size set. So, it should be a large set. >> Do I need just to read this first before we got the uh >> Yeah. Once you get that to me, I can then sign the decision. >> Yeah. We're still approval. >> You guys still have to vote. >> Assuming that our fellow member is on board [clears throat] with that. >> Well, I second. >> Any further discussion? >> Hearing not. All those in
favor will signify by saying I. I >> oppose. That's unanimous at three. All right. >> Okay. You should be all set. You need to get You'll need to get that >> first. Okay. >> Yeah. And then Matt can take care of it from that point once you get the plans in. >> Okay. >> Thank you very much. >> ZBA referral for 12 East Walnut Street. >> This is unbelievable. >> Yeah. The applicant requests a variance for relief of frontage and lot width for proposed new lot using backland combined with existing property at 12 Walnut Street. I guess that's 12 East Wal, correct, Matt? >> Yeah, East Walnut, sorry. Yeah. >> Um, this is uh this is actually Matt's letter that I'm reading. Specifically, the plan is to create a new lot with two with a
two family structure with a maximum frontage of 30 34.326 ft lot width of 34.326. The minimum for both criteria is 100 ft as according to section 2.4.9 lot shape factor residential district is barely met at 21. This is the lot shape factor is barely met at 21.98 with a maximum of 22. The board must consider the hardship of soil shaped topography as the application lists being unable to maximize value of the property as the hardship. Um therefore the uh town plan recommends it unfavorable be forwarded to the ZBA. Um to me this this is treading on the most dangerous >> I mean I I think we I think we know this and and and I don't know how many of them come before us that go to the ZBA >> and and perhaps get approved.
I won't even get into that dissertation. >> But to approve this one when somebody says my only my only hardship is the fact that I can't get as much possible money as possible, >> right? is is utterly dangerous. I I don't know how you stop anything going forward, you know. Right. So, I I I don't know how we do anything differently than what the town planner recommends as far as this goes. And and I I I think this is just dangerous precedent. And if it's approved, I I shut it to think what we're going to be seeing next. I mean, this is this is if I got if I got a lot of property out in my back but got no frontage, got no nothing. I want to put in, >> you know, I want
to put in a lot, you know, just let me do it cuz I cuz I can get more money for it. >> I had spoke to the attorney and he was going to argue shape at the uh at the ZBA meeting. >> Yeah, he's going to argue shape now, but the fact of the matter is the real reason is what's in the original application. So, he can argue whatever the hell he wants. >> There's no doubt that this is because of that meeting and it's got nothing to do with shape. I mean, you can't think that you have another lot when you have a frontage that's 30 ft and you required 100. >> That goes to somebody subdividing this long before and this was the most they could get and now we got somebody coming
back 10 12 years later and saying, "Oh, there's still some water land." They could have divided this up differently, but now we didn't want to do it. So now give us the land. >> That that to me is not a reason why you give somebody, you know, additional otherwise. And I mean, the state's well on their way to blowing zoning up anyways, but uh you know, it it just >> so >> it just throws zoning out the window. It doesn't mean anything. >> So the total frontage of the lot at this time is 100 ft. >> No, it's 34t. Yeah. The this this new one that they're trying to create. It's both combined. >> Yeah. >> Okay. So it's 134 whereas 100 is a requirement. >> Right. Right. Right. >> They couldn't get another lot
in. There was no way of getting extra lots when they when they subdivided it out. Now it's like, "Oh jeez, we got a lot of land back here." I mean, can't we do anything? >> The fact that they're going to keep the two existing structures that are there and trying to, you know, try to somehow gain access to the back those back lots like you said, Joe, it just kind of you're shoehorning things in. >> Yeah. It that doesn't work at all. >> No. >> So, the first way of measuring the shape factor, it did not come close. >> Yeah. Do the shape factor in the developable area. It was what 210 >> 200 short. So, >> yeah. Meanwhile, yeah, that front edge. >> Yeah. I mean, this, you know, this was this was somebody
was somebody was lazy or cheap a while ago when they subdivided this stuff up and didn't take it into account and said, what's the maximum 81ps we can get cuz we don't have to put any road in and okay, let's go with that. And and now, oh well, maybe we can get another lot out of it anyways just by coming back. And I I pray this doesn't get approved. Um but uh that's my feeling anyways. >> Yeah. No, that's >> So we're looking for a motion for an unfavorable recommendation to the ZBA due to lack of hardship. >> Yep. >> Well, I I shouldn't say that. I can't make that recommendation. >> I wonder how we can politely say an absurdity of the proposal. A 34 foot. How what was the frontage? Yeah, 34 ft.
>> Um Chris, you care to make the motion or you want me to >> go right ahead. you. >> So I'm I move that we send a rec >> I move that we recommend that this request be denied by the ZBA. There's probably a better way to say that. >> Unfavor. You got to send another >> unfavorable recommendation. >> Motion been made to send an unfavorable recommendation to the ZBA due to no apparent hardship. Do I hear a second? >> Yes, second. >> Any further discussion? Oh, I'm also sending uh sending Chris's letter with the uh with the motion. >> Oh, my letter. >> Matt's letter. >> Yeah, Matt's letter. Oh, because I was looking at Chris. >> I was like, >> what letter did I >> Matt's cover letter? We we always send a
copy of Matt's cover letter as part of the >> That's crazy. >> Yeah. >> Any other discussion? >> Hearing not. All those in favor of sending an unfavorable recommendation will signify by saying I. >> I opposed. That's unanimous at three. >> There's a signature, please. You wrote that one out. ZBA referral for 17 Water Street. Applicant requests a special permit pursuant to section 3.1.3 for the alteration of an existing non-conforming use within existing property at 17 Water Street. Specifically, the plan is to create a two family residence on the first floor basement level of a structure that currently exists as a non-conforming business on the main floor, first floor level with a residential apartment on the lower level. The main floor business is not changing, only the first floor proposed to convert to two family.
According to the zoning bylaw, the lot itself is non-conforming. It has 6,500 square ft of the required lot size of 12,000 square ft for two family and it has 67 ft of frontage of the required 100 ft. The structure is also non-conforming has setback encroachments in the front, rear and right side setbacks for parking. There are driveways on both sides, one presumably for the business and the other for the residents. Recently, a fence was constructed effectively shortening the residential driveway to a maximum of two cars. Given all the nonconformities and lack of parking, I recommend an unfavorable report be forwarded to the ZBA. >> Chris, do you know if this if this structure actually >> That's Matt. >> Chris, why do I keep saying that? Matt, do you know if this structure as far as
uh uh assesses and is is this actually a legal residence on the first floor? You know, >> in the basement apartment? >> Yes. I I do not know. though it's non-conforming one way or the other if it exists or how it was originally permitted. From what I understand in talking to Maria, this this has been like this for a long time. It's been there for a while. >> Yeah. It's a I don't know what this is. I just don't know when the apartment got put in. I get the feeling that that that itself may not have been may have not actually been permitted to begin with. >> The vinyl fence was put up right at the end of this little bump up and it's like right here. It's just blocking. So it's it's most you
get two maybe three cars if it covers part of the sidewalk >> and they are parking you know one in front of the other in front of the other >> stacking for stacking >> two families is you know knock on your neighbor's door when you need to get out >> I mean they're doing us no favors I mean there's a there's one in there they want a two family correct main floor business is not changing, >> right? They want to it's a single family and they want to add a two family and they've provided an egress off the back which doesn't currently exist today. >> There's there's no reason why this needs to be a three family. They want they want to put a residential in there maybe. Not that I even think that should
happen, but that that's a different story. But why should this be a two family? >> Right. >> So, I'm a little confused. So, there's currently a residential >> in the basement >> apartment in the basement level. And when you say basement, you mean do you mean this level? >> Yeah. It's kind of the first floor and I call the the main floor where the business is. >> Yep. >> Okay. >> It's the second floor. >> So, you don't mean underground. >> Yeah. Oh, it's like half separate. >> Yeah. It's >> You can see it's >> goes down probably three or four steps. >> That's the first floor. That's the basement. Yeah, I've actually been in that building a number of times. I do business with somebody there. >> Um, so again, there's a two family
residence in there. Excuse me, a one family resident >> in their residence, excuse me, in there already. >> Yes. >> And they're proposing >> more >> a two family residence >> if I and the >> they're proposing to make it a three family. Correct. If I'm correct. >> No, it's a two family total. Two family total. >> Yeah. Two units. >> Two units. And the business and the business would still stay above, >> right? >> So, and there's >> Oh, okay. >> Yeah. >> So, even if there wasn't a business above, >> this is this two family wouldn't fit in the zone and then we need a variance for because this is an extension of non-conforming. They're going for the special permit. >> It seems like there's a lot more needed. >> But we're talking
about three separate apartments. >> Two apartments and one business units. Two, >> two apartments and a business rental. >> Yep. >> Going [clears throat] forward, >> two family residence is two separate units, is it not? >> One on one in the basement, one on the first floor. >> Well, it's a two family residence then. >> This is >> Yes. Two. >> It will be going forward. That's what they want. >> Two separate [clears throat] units, two separate families, shall we say? >> Yes. >> And there's already one family residence in there. >> Yes. >> So, it's a total of three single family residences. >> No, no, no. There's one that exists and they're adding one. That's it. >> So, they're they're going to take >> they're removing the they're changing the upstairs to be business
and residence instead of all business. >> Can somebody define a two residence to me and tell me it's only one family? >> So, right now it exists as a single family with the business of above. >> Yeah. >> All right. >> So, they're trying to change it to a two family by adding another apartment unit to the basement to the basement. >> Two residences in the basement and then the business. >> Martha, if you look at this sheet here. >> Oh, I can turn the page and see the diagram. >> Okay. Yeah. So, so the existing existing lower level plan on the lefth hand side. All right. As you can see, it's let me double check on that. Right. Yeah, it has is that one? Cuz I look over at on the right hand side
and that's where I you can see where there's a there's a divide between the two properties. So it's basically or two apartments. Unit unit one being on the front half, unit two being on the back half. >> So if you look over on the kind of on the right hand side, you have bedroom one stacked on bedroom one. But there again, bedroom one goes to unit two and bedroom one goes to unit one. >> So again, it's it's already if they're saying it's existing, >> it's already [snorts] a five bedroomedroom single family. So, it looks like they're just going to >> going to uh construct a wall and make it >> two units. So, uh yeah, this thing's got >> I mean there's no parking for any >> no parking. Yeah. Right. Oh, yeah. This
>> for >> You think that they're putting up on the upper level? >> No, the upper level. They don't change. Second plan. >> Justing off space stays the same. Yeah. >> A two family residence. >> It is not a two family residence right Oh, >> yeah. It's >> a one family residence now. >> Okay. But they're trying to create >> trying to create two. >> I'm sorry. I think I got it. >> When you say to create a two family residence, you're in that word two, you're counting the one that's already there. >> Yes. >> Got it. Got it. >> Yeah. >> I mean, it's it's it's probably big downstairs, but that's not our problem. I'm sure this was a and I have no idea when this was approved. I mean, it's been there for
as long as I've lived in Milford, as far as I can remember. But >> I'm sure this was business upstairs and downstairs, >> right? >> And then and then they didn't have anybody to rent the downstairs and so they turned it into a residential unit. Whether that was legal or not back then, who knows? But now, you know, it's there. Now it's like, okay, now I want to turn it into another residence and it shouldn't be a residence to begin with. So, I'll I'll make a uh motion to send a unfavorable recommendation to the ZBA. Yeah. To the new Yeah. numerous nonconformities. Yeah. Um outlined basically in in our town planners letter to us and then also uh you know in regards to um parking situation. Second >> very inadequate parking motion. Motion has been
made and seconded to send an unfavorable recommendation to the ZBA regarding the special permit uh based on the uh the letter is written by the town planner and the lack of parking available to to all of the usage. Any further discussion? >> No. >> Hearing not. All those in favor will signify by saying I. >> I opposed. That's unanimous at three. >> There you go. scribble. Thank you. You're welcome. >> Planning board rules and regulations draft. Now, before that, we've got some zoning bylaw members discussion. >> Oh, yeah. Um, so, um, before Chris gets to his, um, this is actually I'll wait on town planner updates for mine. So, go ahead. All right. >> All right. No problem. Um, so last Friday morning, uh, February 27th, uh, had a meeting to discuss the um the
food truck kind of bylaw, right? So, section uh 3.2.5. um included where the town planner Matt was here, uh Liz from the town engineering office, John Ericson from the building commissioner office, uh Joan Clerico as the uh board of health inspector, and then all Paul also Paul Mazaki um was there from the board of health member. Uh we had a general discussion on the current bylaw. Um it was written 40 years ago to basically offset a taco truck that was that was permanently based here in Milford and it wasn't mobile. Um so just basically that general discussion all parties agree that a revision is needed. Um we kept you know the thought were is to keep it basic to start. Uh we'd like to center it around mobile food trucks or or uh food trucks
or uh trailers. You know looking at it to be only part of town uh approved events or private events. We would definitely come up with a defined window of operation. there would be no overnight parking allowed and all uh required uh permitting would have to go through the board of health, the building department, the fire department or the select board. So again, we haven't created all this language yet, but just kind of bringing everybody's ideas together again with all these multiple departments. Um, you know, looking at it from the standpoint of obtaining, you know, the proper warrant language for the, uh, May 18th town meeting, uh, we felt like we could get there. Uh, we', you know, submit a draft proposal or draft language to this board, um, on the March 17th meeting. Then we
would have to from there submit it to the select board and they would have to add it to their warrant. So, probably either on their March 23rd or March 30th. From there, we would need two weeks to uh publish that we were going to have a um a public hearing on that. So then probably that public hearing >> right around you know uh May 5th and that gives us time again to get to the May uh 18th town meeting. Um so and if you read you know the current bylaw the way it's it says it says no trailer or other vehicle may be utilized for commercial purposes or based for conduct of retail sales other than fixed location. So it it basically prohibits food trucks and we know that we've had various events around town
celebrate Milford um the Fourth of July event, the car show events where we you know different um you know kind of groups have had success with their food trucks or food trailers there. So again, I think it's it's just trying to catch up with the kind of the current usage. Um, it's actually funny right now, even though the bylaw does say that theoretically they're they're not allowed, they food trucks can go to the board of health and go through a a series of of of the permitting process and inspections and get the proper uh permits to allow it to operate. So again, I think the bylaw just needs to kind of catch up to those standards and uh we could work together with all these town departments and and uh you know come up with
some good language as a first pass to uh get it on the town warrant. So my thought is I just want to at least present those findings to this board, see if there is some uh consensus of some support and we'll keep moving forward with it. Martha. >> Um, a couple comments in the second paragraph of uh Paul Matthew Kelly's notes that were in front of us. >> The uh second paragraph references in the prohibited part um that residential neighborhoods that the trucks would be prohibited in residential neighborhoods. But the next paragraph talks about private events. >> Yeah. There's some cleanup that needs to be done >> because I do know of people that brought a food truck in. Yeah, we >> the one I I'm thinking of was wonderful, >> right? The concern the
concern was you don't want to have a private event food truck festival in in in on in a in a neighborhood, but if someone was hosting say a graduation party and they wanted a food truck there at their graduation party. So I think yeah there is language that is going to need to clarify those types of um scenarios. Mhm. Um I have a couple more. The second paragraph again about things you need to do the first sentence to obtain a permit. I don't know what a commissary documentation is. >> I think that's board of health. >> That's board of health. >> Okay. >> And the one two three fourth paragraph final sentence. Oh, the fourth paragraph is about should there be a committee to um review applications? And the last sentence says it could delay
the time it takes for a vendor to obtain a permit and also references aren't the department's already doing it. >> I wholly agree with that. No committee would be my thought. >> Correct. >> I guess my only issue not not that it needs to be a committee, but what I'm afraid of is >> depending on where these people go who gets to say, "Yeah, this this place is appropriate or not." And that needs to be addressed somehow in there. Whether it's whether it's they come to us with a site plan that shows it cuz if they're taking up parking in other places, >> right? >> You know, we at least have an idea whether that parking is is legitimate or not and and is there extra parking and and things like that or not. You
know, if someone came to me and said they wanted to put a food truck down, stop and shop, you know, I didn't tell them where I told them to go, but it >> Oh, back where there's extra parking. >> No, that's the only place you can put it is. Yeah. If you want to put it out back, you can because no one uses that parking anyways. But other than that, you know, but that's the thing that worries me and and how do we address that? >> I, you know, I've I've seen them up craft roots, but I've also seen craft roots where people can't park either. And I don't know it's a good situation. I don't know that it's a safe situation up there sometimes. And that's the thing that people Oh, you know, this
would be great. It would be great to have and stuff like that. If there's a fire or something up there, you can't even get a fire truck up there when there's when there's a food truck up there. >> Okay. So those types of issues are things that I think as a board or not as a board as a town we need to address. >> Sure. >> And somehow that needs to get addressed as is as is part of whatever you come up with in the regulations. >> Sure. >> Yep. I just want to add instead of it being a committee, I'd recommend like a technical review of building health fire where all the town department heads, they get to review these things before they go out. This way everyone gets to put their stamp on
it including planning. So I'll be able to look at it >> and and once and once it gets to some level where you've had a few of them it's going to be relatively easy. >> You know, okay, they they're coming to this location. Yeah, we've had it there before. It's been okay. They're coming, you know, this a new location. We got to take a look at it. That type of thing. >> Yeah. >> Could we stipulate that? What will this end up being? Will this eventually be a bylaw? This will be a well there might be something in the bylaw for this for it. There might and there'll be a change to our >> uh zoning bylaw but there might also be something in the town bylaw with the board of selectment depending on how
they handle it or not. And I guess that's the other issue is you know we had talked about this is if you're only doing it for a day does it just you know does it just go by or is there a financial implication to these people? They have to pay a certain amount to get a permit to do this that type of thing. >> Yeah definitely. Well, yeah. So, application for a temporary food establishment license. >> Uh, seasonal permit fee is 125. A one-day permit is $50. >> Um, what's what's a seasonal mean? >> Uh, I'll have to check with the board of health. Exactly. >> Oh, that that's their that's theirs for for them doing inspections, but the selectman want to do something to offset the taxes. >> Correct. That the regular business pays.
>> Certainly. >> That that's that's what I'd like to see addressed. >> Got you. >> Going forward. Yep. >> So, yeah, >> understandable. >> So, Paul, >> I'm sorry. I didn't mean to pop up. >> That's okay. >> Um, so perhaps said bylaw or what, wherever could say something like, um, let's assume for a moment the building commissioner is going to be the permitting entity. The building commissioner shall not issue a permit until he she has consulted with the board of health, the fire department and you know whatever blah blah blah blah blah and said >> um officials are in favor of the prop or you know have do have no objections. >> Something does currently they do a licensing review and they send it out to all department heads. We don't give our comments
by a certain point. you know, that kind of thing as opposed to a committee >> for something for something that's going to be, >> you know, and again, I think it needs to be a one day here, one day there. Even if it's a seasonal permit, it's still it can't be, okay, I'm going to be here July, August, and September every day. >> Correct. >> That Yeah, that what I would be against. And if they allow that, I would be against it at town meeting. >> That being said, this was originally put into to our regulations into the zoning regulations because there's no place to put it. If this is what they're going and they're going to allow it, it may be taking that one line out and it no longer becomes a planning board
issue. It's all done by other people, which is where I think it should be anyways. There's no reason for anybody why it should be in our stuff. Exactly. >> It's does the town alarm or not? If they alarm, then there should be a setup. >> Go to the selecting, go to the board of health, get your permits, and be done with it. You don't need to come back to us, >> right? Because there's no proper >> Again, technical staff, Liz or or Matt need to need to be part of that review process to say, "Oh, yes, this parking this parking lot we've had problems with." No, you can't put it there or things like that. But they know that as well as we do. >> Y I agree with that. >> I guess that's where
I would be with it. >> Okay. I'll see where we can take those notes and I can I'll I'll bring it to the, you know, my intention was that group that met, bring everybody together, let them know that whether or not I had planning board kind of support from this point forward. Um, and then again craft up the the language. But again, it may it may be just a strike through of the language and and push it on push it on to the a town bylaw as opposed to a uh zoning bylaw. >> So, we'll have that discussion. >> Okay. >> Good. >> Thank you. >> The other bylaws have public hearings advertised for our next meeting. First ad went out today for getting rid of the wetland piece in the zoning bylaw and adjusting
lot widths. So, those ads are out. They'll be on our next agenda. Okay. >> Planning board rules and regulations. >> Yeah. So, I >> I'll do that another time when I updates. Yeah. So, I made the changes that we talked about and the one piece about the mulling rule is something that I've got a placeholder on for town meter. Okay. >> That's on page four. So, uh, town council put together this draft and they they would like the planning board to consider sponsoring it kind of goes in. So, we can't finalize the rules and rags and unless the m rules adopted and then we have to change that. But still working on the in-house engineer piece on uh page five. But otherwise, everything else has been updated. The number of copies, I ended up finding
that we need five full-size sets from town departments. Otherwise, uh, town council's still yet to review this cuz they're doing all sorts of legal battles right now and hasn't the time to look at it, but I really want them to look at it at some point before we are to make a vote on it. But just unless anyone else has any other comments after spent some time with it, Yes, >> I have no problem if they want us to sponsor it. Um, >> so I could take that up under town planner updates unless there's anything else we want to discuss under rules and rep. >> I just would change that to miss not more than one. >> Yeah, >> the in the third line from the top. >> Yeah. >> Where it says commission members
to miss a meeting. I'd say not more than one. >> Are we under town planner updates? >> I don't know where we are. >> So >> yeah, same difference. We're on >> Okay. So yeah, um that's the draft letter from him. I'll uh I'll make a mention of that. Yeah. To miss not more than one meeting right there. Not more than one. >> Yeah, that's the way it reads on down below in the >> Yes, the actual >> I did pick up on that. I just refer. >> Yep. >> Suspenders. >> So, would the planning board be interested in sponsoring this article? >> Do we need >> We need a vote. I I would >> appreciate a vote be helpful. >> Move to sponsor the article relating to Mullen rule statute and >> send to
the select board for war consideration. >> Exactly. >> Okay. So motion been made to to send the uh Mullen rule statute to the board of selectmen for uh inclusion in the next town meeting. Do I hear a second? >> Seconded. >> Any further discussion? Hearing not. All those in favor will signify by saying I >> opposed. It's unanimous of three. >> Okay. >> Any other updates, Matt? Anything? >> I have no other updates. No, >> I guess we don't have town engineer updates. >> Yeah. >> And we don't have any chairman updates cuz I didn't know I was even going to be the chairman tonight. [snorts] >> Any member update? I could be the member updates, though. I could do that. >> Yes. things here. >> My only update on the member things is just
to keep those other things that we had talked about with the parking uh in line for the fall. Matt, I I want to see if we can get that to uh maybe make a decision for fall town meeting on uh parking behind the building and uh Andrew, what else do we Oh, and effectively the staging permits for uh for construction. >> Oh, yeah. So, kind of brings us back into the rules and rags. I want to add something about that about construction phasing in here. I also wanted to add something in here about us requesting bonds which is something we brought up in the first meeting that I had with you guys which we don't have the authority to do unless it's in here. So >> those are two things I need to add. >>
Okay. >> I'm sorry. What was the first one? >> Is that phase construction? >> Oh yeah. condition construction of parking in the rear of of buildings and then the bonds. Anybody got anything else? Our next meeting will be held on March 17th. March 17th, >> St. Patrick's Day weekend, >> that's okay. Um >> move. >> Pleasure of the board. >> Move to adjurnn. >> Make a motion to adjurnn. Do I hear a second? >> Second. Any further discussion? Hearing not. All those in favor of adjourning will signify by saying I. Opposed. That's unanimous at three. Thank you and good night. >> Well done, gentlemen.
