001We're on 60. I'd like to get the meeting started here on time 5:30. Want to welcome everybody. This is the regular meeting of the North Oakland Transportation Authority. We're meeting today May 21st at Oxford Township. Thank you for hosting. With that, we'll go ahead with the our Pledge of Allegiance. >> I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. >> It's going to happen, Mike. You're going to say it. Stay standing. >> We have a quorum. We'll move on to the roll call, please. >> Sure. Mr. McDonald. >> Yes, here. >> Here. >> Mr. Moore. >> Here. >> Mr. Ferrari. >> Here. >> Mr. Curtis. >> Here. >> Mr. Bernardi is excused. Mr.
002Flood. >> Here. >> Ms. Kemp. >> Yes. >> Mr. Madole is excused. Ms. Waffle. >> Yep. >> Mr. Lang. >> All right, we do have a quorum. Every community represented, that's great. Okay, board has before it an agenda for today. Are there any questions, changes, etc.? >> I'll make a motion to approve the agenda as presented. >> I'll second. >> Are there any questions on the motion? >> This includes the change that you had on there. >> Yes. >> Thank you. >> Was that the monetary change, Chad? >> Yes, yes. >> All right. So, the next item are all in favor of the motion to approve the agenda, please say I. >> I. >> Opposed, please say no. Agenda is approved. We'll move on now to the consent agenda. >> I'll make a motion to
003approve the consent agenda as presented. >> I'll second it. >> Are there any questions on the motion or exceptions? Hearing none, um all in favor I guess we better do a >> Roll call cuz of bells. >> a roll call, right? >> Mr. McDonald >> Yes. >> Mr. Brickfield >> Yes. >> Mr. Moore >> Yes. >> Mr. Ferrari >> Yes. >> Mr. Curtis >> Yes. >> Mr. Flood >> Yes. >> Mr. Flood Yes. >> Yes. >> Okay. >> Motion carried. >> Moving on to number six, public items. Public comment on the items not on the agenda. Not seeing or hearing any public aside from our esteemed cameraman, we'll move on to uh >> [clears throat] >> the board uh board member comments. My misses? Yeah. What did Junior do with that? >> Okay. I think
004I saw that. >> The new one? >> Oh, okay. >> So, I think if we don't want to do that in the future, we can eliminate them. So, we >> Well, >> I can make a >> comment. Good job on the >> It's supposed to be public, huh? Audit. >> Yep. Thank you. >> Okay. Um Does the board want to have two public comments or do we want to have one at the end of the meeting? >> One at the end of the meeting. >> one at the end. >> Is that a motion or >> I'll make that as a motion. Do we have only >> I'll second it. >> Okay. >> I'll make the comment at the end of the meeting. >> Uh the board member comment or public comment? >> Public comment. >>
005Public. Okay. >> Well, actually, yeah, it should be Well, but >> And board member comments at the same. I'll make that motion board member comments at the >> We're still talking about item seven. Eliminating that. Is that what the motion >> We're not eliminating. We're moving it We keep We have it twice. >> That's what I'm saying. >> Eliminating seven and eliminating six. >> Okay. So, no public comment at the beginning? >> Wow. No, we don't we don't normally do that. >> We do it >> Twice. All all township board meetings you have one in the beginning and one in the end. >> That's how we >> The village does it as well. >> What happens is >> I don't think you can use the word all inclusively. >> Yes, I used it. All of
006our meetings at the our township all have a meeting public comment in the beginning and items start on the agenda. Then at the end of the meeting we have any comments from the public. >> What is the board's pleasure then on the motion uh before us? >> 17 >> could go. >> That's what I thought we were talking about. That's what the board extra put >> So my motion holds. I'd like to Hopefully somebody will second. >> So on this on the >> 6 and 11 are different. >> What What is the motion then? Is it public >> 6 was public. >> It's It's to have public comment and board member comments at the end of the agenda not in the middle where it shows currently. That's the same I don't understand. >> Yeah, I
007The public comment needs to be in the beginning so that people can talk about um like if they come and want to say something about they need to bring that up and then at the end of the meeting they usually speak again and about what happened. >> Okay, there's a motion on the floor. If you do If you want to change If you don't want the motion which is to move item 6 and 7 to the end of the agenda vote no vote no on the motion and then hopefully someone will come back immediately with the new motion of where we what changes we're going to make. So uh all in favor of the motion to have public public comment and board member comments at the beginning or near the beginning of the uh meeting
008please say I. >> Near the beginning or the end? >> Near the begin >> Are we just doing >> Your Your motion was near the near only at the end. >> Yeah. >> So we're looking at six and seven. Okay. All right. >> I I don't understand. >> We have a big audience here in these meetings. >> That doesn't mean you don't have a public comment in the beginning of the meeting and at the end of the meeting. >> I and I am aware most communities do have it at the beginning. So um like the board of commissioners does. So if you have a comment that's not pertaining to the agenda >> though you can be heard. >> Yes. >> Um that's the part of the reason they do it that way. So the motion
009was to only have public comment and board member comments at the end of the meeting. All in favor of that, please say I. >> I. >> Opposed, please say no. >> No. >> Okay. >> That hurt. >> All right. So the the motion did not carry. Is there an alternative motion? >> No, we'll just stay as as it is. >> Just leave it. >> Okay. So keep it in this this exact order as we have it on the current agenda. >> Yeah, that's fine. >> Is that fine with everybody? Then somebody make a motion. >> I I didn't know we had to do it this way. >> have to make a motion if we do nothing. >> So you can look at item number six that specifically and you can look at item number 11
010has open to whatever they want to say. >> There's somebody talking. >> I'm sorry, Mr. >> a motion to remove the duplicatus you know, board member comments at seven cuz we get to comment on every agenda item anyway. So why do we need a second you know, round of me chatting, you know, and hear me talk for twice if you get away. >> I can explain it. >> What? This ought to be good cuz we've Go ahead, Jack. >> What happens is a citizen comes in and says it's not on the agenda, but I don't like the buses to have no white wall tires. You can't comment on that in our meeting because it's not on the agenda. That's a violation of the open meetings act. So, what we do is have a board comment
011after that because we don't want our citizens coming in here talking about, "Hey, uh your roads are terrible and I want that road paved." They make that comment, then all of a sudden we have a board comment. A board member can go and say, "Uh you know, I just want to bring it bring it about the fact that uh in my comments we're paving this road in 2027." That gives the citizen an answer to their question or comment. It allows us an opportunity to do that without violating the open meetings act. >> If you elect to do that, that's fine. But, the law provides that you are only you only have to receive comment. You do not have to respond. >> That's right. That's right. >> So, so if if So, if That takes us
012to another policy change of what the board wants at a meeting. So, um >> Let me render opinion and then would just be that in this case that he described, it would be appropriate for the director to answer any of these relevant comments about these specific issues. If If the village we don't we don't respond back because we run the manager form of government. And so, the council members are generally ignorant >> Mhm. >> on items not addressed. So, I I'm not going to comment personally on any individual citizens when they come in. I would just direct them to the to the state. >> I think I'll second his motion to eliminate the public comment and just put it not to public, but the board comment and move it to the bottom. Is that what
013you made? >> Yeah, that's correct. >> You're removing removing item seven. >> Right. >> I agree. It's already on. >> And >> Okay, we have to disagree. Don't yell. >> We have We have a motion and a We a motion and a second. >> Got that. To remove uh board member comments on number seven and [clears throat] have it strictly uh at the bottom of the agenda before adjournment. All in favor of the motion, please say I. >> I. >> Opposed, please say no. >> No. >> Don't yell. It hurts, you know. >> Ready for new business? >> Is there any any other any other agenda >> As much as I love my new shirt, can we get to new business? >> Yeah. >> [clears throat] >> Okay. Uh there is no old business. Moving
014on to new business. Uh board should have received an audit uh from Lynn. I would ask if you had enough time to approve it or look at it. Uh is there a motion to receive and file or approve? >> I'll make a motion to receive and file the note of 2025 audit. >> Second. >> Okay. Seconded by Ed briefing. Are there any questions on the motion? Hearing none. Uh I think it's since it's fiduciary, we'll have a roll call. >> Yes. Uh Mr. McDonald. >> Yes. >> Mr. Breakfield. >> Yes. >> Mr. Moore. >> Yes. >> Mr. Ferrari. >> Yes. >> Mr. Curtis. >> Yes. >> Mr. Flood. >> Yes. >> Ms. Dow. >> Yes. >> Um Ms. Waffle. >> Yes. >> Mr. Lane. >> Yes. >> Okay. Item B under new business, approval of
015budget adjustments in the amount of $125,000, reducing total revenue and expenditures to a final total of $14,027,010. >> I'll make the motion to approve the budget adjustment in the amount of $125,000, reducing total revenue and expenditures to 14 million, 027010. >> Second. >> Okay, there's been a motion and a second. Are there any discussion on the motion? Hearing none, can we have a roll call, please, Lynn? >> Sure. Mr. McDonald? >> Yes. >> Mr. Brickfield? >> Yes. >> Mr. Moore? >> Yes. >> Mr. Ferrari? >> Yes. >> Mr. Curtis? >> Yes. >> Mr. Flood? >> Yes. >> Ms. Kemp? >> Yes. >> Ms. Wampler? >> Yes. >> Mr. Lamb? >> Yes. >> Okay, the motion carries. Um okay. Uh this item uh item C uh Lynn sent out a re- uh second agenda with a
016correction to the amounts. Um so just for the sake of uh accuracy the uh balance the balance and the uh building renovation are 22,977 and the balance in contingency is 132,464. >> 134,171. Is that Oh, it's on >> on this one here? >> Oh, yeah, must be. >> It's 134,171. My My apologies. >> Yes. >> And the contingency is 155,441? >> Yes. >> I'll make a motion to approve the change orders on building renovations, amount of 21,270, taken from contingency uh fund in the budget. 155,441 leaving a balance of 134,171 in the contingency fund. >> I'll second that. >> Okay, we have a motion and a second. Uh there are no questions on the motion. Uh can we have a roll call, please? >> Sure. Mr. McDonald? >> Yes. >> Mr. Brickfield? >> Yes. >>
017Mr. Moore? >> Yes. >> Mr. Ferrari? >> Yes. >> Mr. Curtis? >> Yes. >> Mr. Flood? >> Yes. >> Ms. Kemp? >> Yes. >> Ms. Wampler? >> Yes. >> Mr. Lamb? >> Yes. >> All right, motion carries. Thank you. Um item D, um, we did not have uh we have not received two of two we have not received two of the three quotes uh we requested. So, um >> Was there a due date on those, Michael? >> That would be Lynn would have to tell me. >> Bob, our contractor was trying to organize the quotes. They had gotten uh quotes, but it they weren't the same. They weren't 9 in of asphalt. They came back at 4 in and I wanted to have them all be the same. I wanted it to be road grade
018because we get a lot of traffic there. Uh the whole area just needs to be redone. So, um he said he couldn't get it back in time before the meeting. So, we'll probably have to postpone it or I mean, we just got the one [clears throat] >> meet our qualifications? >> Yes. Yes, they did. >> everything we need to have done. >> Yes, they they're the ones that did our existing parking lot. >> I'll make a motion to approve the asphalt removal placed at our front entrance to BSI uh for the 9 in paving for a total amount of 15,817. >> Fourth. >> Okay, we have a motion and a second. Are there any questions on the motion? >> one. >> Mr. Speaker. >> was no deadline on that, would we get in trouble to
019go ahead and passing it without the deadline? If there was a deadline of yesterday at 3:00, I could see it, but if there is no deadline, they could come back and say you didn't give me a chance to quote and why would be a problem. >> Just for clarification, the the the one that was submitted was for 9 in or >> Yes. >> Okay. >> Yes. >> And the others were 4 in correct? >> They did not they came back with one came back with a 4 in quote and the other one did not submit anything. >> Well, they told they requested 9 in. So, >> The second time around. Bob talked to him. I didn't talk to him. Bob our construction manager um was the one organizing the quotes for me. >> That's why
020I get on their docket cuz these guys are all quick. >> Yeah. >> And we wait another motion. >> legally. >> Okay. >> Did a big quote go out? Did Did were all contractors bid offering of offer to bid? >> No, it was just a verbal We needed We needed one >> I only asked his buddies who could bid this. >> Well, we knew BSI who was our existing to you know >> The question is did he send out on a mitten did he send out I to in the leader did he send out bid specs? >> We didn't but we didn't expect it to be over 20,000 because 20,000 is what we need an RFP you know or to go on the bid net. So, we expected it to be under that and for
021that we just asked for quotes. So >> To answer Mr. Brickfield's question, there is no concern about legality. >> Okay. >> Yeah, if there and you want to >> Well, that that brings it up because we didn't send anything out. >> We didn't send anything out. We it was hey, Mike can you cut my grass for 50 bucks? Oh, I wanted it 3 inches not 6. Oh, now it's changed. >> Mike was there >> There's no bid specs. >> Right. >> Joe's >> I thought there was. >> I'll be a second. >> That's somebody's second. >> Yeah, I did too. >> Who second it? >> He second it. >> Mike Mike Flaherty >> Oh, Mike Flaherty did. Mike second >> It doesn't count. >> Mike did. >> Do you want me to resend the >>
022He's the new new guy. >> What did you do, Joe? >> I made the motion to award it for BSI for 15,817. >> You didn't uh remove your motion, right? >> no. >> Okay. >> You're still the second. >> Yeah. >> I'll let that be a lesson learned to follow that there's a process we need to follow. >> Mhm. >> So, what what are you doing? >> giving BSI's bid. Now, it's 14. >> Yeah. Yeah. Now, you're talking. >> One of the One of the alternatives that Lynn and I talked about before the meeting was is not not bringing it up at all and just tabling it or um author pre-authorizing a set >> amount >> extreme you know top >> I I like Joe's just get it going. That was done. We got it
023something in writing. >> can't be wrong. >> We have a spending any spending rules for for administration. They can spend at their own discretion what's like >> The board did set them for this project. >> not obviously though 10 15 20 grand what's the >> Over 20 grand requires to go out to official bid. >> Yes, you're under that net limit and if >> Right. >> Yeah. >> I feel comfortable. >> Yeah. >> And we have a budget actually we have a budget line item for it. >> bid specs were sent out Well, you're going to get your in a ringer is you send that back out to J&J and say hey >> Every price is going to be less. >> 15 8 17 well I'm 15 8 16. >> Well, wait a minute mine's
02412 5 man. I can do that all >> Okay and we we can speculate all day on what should have worked. >> We're following our policy. That's that's the key. >> We do. >> Yeah. >> Thank you. >> So with that um can we have a roll call for the motion to approve uh BFI at 15,817? >> Sure. Uh Mr. McDonald? >> Yes. >> Mr. Brickfield? >> Yes. >> Mr. Moore? >> Yes. >> Mr. Ferrari? >> Yes. >> Mr. Curtis? >> Yes. >> Mr. Flood? >> Yes. >> Ms. Ham? >> Yes. >> Ms. Waffle? >> Yes. >> Mr. Lamb? >> Yes. >> Okay, motion carries. Thank you. Um no items were removed from the consent agenda so we can move on to public comment again. Hearing none, we'll move on to board member comments. Um
025I'll start with Tanya, please. >> I don't have any. >> Okay. Mike? >> I would agree with you. >> Mike? >> I would agree with Mike. >> Ed? >> I agree with Mike. >> Joe? >> I don't agree with anybody. >> [laughter] >> This is your Irish >> a great Memorial weekend and and keep in those thoughts that came before us who made this country, this great country, what it is. >> Curtis, no comments. Nelson. >> I just one quick thing. I want to agree with what Treasurer Curtis had said about if ASI and J&J were that interested, they would have submitted something. >> Would have hoped. >> You know, I mean, I know if it's if it's Joe's company, I'm interested in this project, you're getting a bid. >> And it's very valid that
026waiting a waiting a month could put us at the end of summer before >> Especially these guys are busy. >> Right. >> I might get on their docket. I'll make a motion to adjourn. >> I second. >> What time is it? >> That's too fast, Joe. >> 5:50. [laughter] 5:51. >> All in favor of Who was the second? >> You did. Okay. Thank you. All right. >> All in favor of the motion to disperse and adjourn. >> Aye. >> Opposed, please say no. >> No.
