like to call to get like to call everybody's attention to the uh charter township of Oxford Planning Commission regular meeting for February 26, 2026. So, we'll start by looking at the agenda with calling the meeting to order. And then we want to have everybody stand. We'll say the pledge to the flag. >> I pledge algiance to the flag of the United States of America and to the republic for which it stands. One nation under God. indivisible with justice for all. >> Um Susan, would you note to roll please if we're >> There is a quorum. Chair Bailey and Commissioner Blokick are excused. All right. Um, can I have a motion to approve the agenda for tonight's meeting? >> Motion to approve the agenda. >> Second. >> Okay. Um, all those in favor of I approving

it. Okay. Uh I'm going to vote no >> because at this point we want to make a change in item 11. And Matteo, you want to come talk about that please? >> Yeah, good evening. Matteo Posa, Carly Wharton Associates. We're the planning consultants for the township. Um so it isn't so much um a proposed amendment to the agenda. It's really more or less a clarification based on some feedback we've gotten regarding tonight's agenda. So, we just wanted to kind of come up and clarify the items on the agenda tonight and kind of establish that they are they are separate items to be considered by the planning commission. So, the first items are public hearings for text amendments. One is for mixeduse zoning in the township. The other one is for allowing retail and office. The

third item is a final site plan review for Aldi. Those are all three separate items that are not related to each other. Uh in the essence that we there may have been some confusion regarding what you were discussing tonight and the site plans that were in front of you and the text amendments that were in front of you. We'll go through each one one at a time, discuss them, talk about what's on them, but they are not related to each other in any way. They're on three separate. So we just wanted to offer up that clarification for tonight's agenda. Okay, >> everybody comfortable with the agenda with that modification? >> Yes. >> Clarification. >> Okay. >> All right. Item five, conflict of interest. We have any anything to report? Okay, moving on. get a motion

to approve the minutes from the January 22nd meeting. >> So motion for approval of the minutes planning commission regular meeting January 22nd, 2026. >> I'll second. >> Okay. All those in favor say I. >> I. >> Okay. Minutes approved. All right. The next item is public comment on items not on the agenda that's scheduled for tonight. So, if there's someone that would like to speak from the audience, uh, this is your opportunity to come up to the podium here, state your name and address, and you will have up to three minutes to speak. >> Good evening and thank you for the time. Um, my name is Kitty Purz. I live 1032 Cedar Street in Oxford in the waterstone subdivision. I have a question uh pertaining to notification of zoning changes and things of that nature.

What is the distance of um notification to the residents closest to those parcels or areas that are up for zoning changes? Anybody know that? >> Ma'am, that you're not going to get feedback from board, but you are three minutes to talk. >> Okay. >> So, if maybe later in in their comments, they may answer it. >> Okay. >> Um but right now, you're not going to get back from >> Okay. Thank you. I just saw public books on faces, so I wonder um it's 300 ft. 300 ft is not very much distance between a reszoning parcel and a potential residential neighborhood. Um once upon a time I think it was maybe 500 or 800 ft. Um I personally feel that within the uh subdivisions and within the areas of Oxford, a lot of the areas

are more rural uh zoning changes and notifications of people who live within these zoning changes or potential zoning changes. Uh there should be at least 1,000 ft. Within 1,000 ft of those zoning changes, residents should be notified by mail of the potential zoning changes. That's that's my point tonight for now. Thank you. >> Thank you. >> Have anybody else? Okay. No one else is wanting to speak. and we'll move on to item nine which is a public hearing and we'll start out with uh Matteo. >> Yeah, Mr. Chair first commissioner comments if there are any. >> Oh, okay. Commissioners have any comment? >> No. So once again, good evening with Pasco Carlo Associates. Um so you have two public hearings tonight to hear two different text amendments to your zoning ordinance. >> Uh the first

being um a zoning ordinance uh text amendment to article 3 section 3.5 and to add section 5.40. Uh this all relates to mixed use planning. Uh so last year uh late summer the township adopted an updated master plan and in that master plan there was call for um uh future land use uh designations regarding mixed use zoning along the primarily along the M24 corridor. And so the ordinance review committee uh set a goal of incorporating mixed use regulations into the zoning ordinance. Um, we kind of went through this this staged process of doing our research, uh, getting feedback from township staff, getting feedback from the planning commission, um, getting feedback from the township board. And with that, the ORC has recommended the attached or the text amendments included in your packet tonight um, for consideration

by the planning commission, uh, which would then be sent to the township board for consideration if you vote in the affirmative this evening. Um, I know that the planning commission language prior and the RC is very familiar with it but just as kind of a bird's eye view of the kind of things that are proposed within it and actually my apologies let me backtrack that so the way in which we would accomplish this is that we would make mixed use of special land use in your office C1 and C2 districts and so being a special land use it would have to meet specific and general special land use criteria and meetings in which it would be proposed would have to be public hearings that would have to be duly noticed um you know per the

state requirements Um, kind of the neat way in which we did this is that we're really just amending text in the ordinance. We're not having to go through map changes, um, kind of this heavy list for writing this brand new section of your ordinance. We really just made had your ordinance modified to allow for these types of uses. So again, some of the bird's eye view changes that would be um that would be permissible and again as a special land use not permitted by right would be a height limit of four stories uh no required front or side setbacks vertical and horizontal mixeduse considerations. So either one building with multiple uses or a site with several buildings dedicated to different uses allowance for first floor residential and interior buildings. So not necessarily buildings that face

the major thorough affairs but buildings interior could have first floor residential. the first floor for major thoroughfare buildings would be retail or office uh architectural standards and then minimum dwelling sizes of 750 square feet. So kind of the availability of a studio style park. Uh so again being a public hearing uh the planning commission can vote to send the text amendments back to staff for further revision or vote to send the text amendments to township board with recommendation adoption. Um so with that I'm happy to have answer any questions that you may have. But again, kind of this is kind of the culmination of about six months worth of work with the OC. >> Mr. Chair, >> go ahead. >> So, Matteo, can you this might be hard to do, so I apologize in advance

if this is hard to do, but can you kind of speak to the spirit of the changes? Like what is it that the OC was looking to accomplish by modifying the ordinances? >> No. So, I think part of it is I think part of it is that the mixed terminology has been in the master plan and kind of floating around the planning department and the planning commission for the last 10 years and there was never really any kind of action on it. So when I took over OC meetings I kind of put in front of them and said we should either do this or get it off the work plan and after review of the master plan mixed use offers it offers a certain kind of critical mass to help support retail. It does offer

for there's a lot of initiative right now for what's called middle housing. You know, housing that can support folks who are middle to lower income uh because of the way the housing market is structured right now. Um and again kind of creates in some ways builds off a synergy with the village and kind of the authentic mixed use that they have and kind of having the township offer some some comp uh I guess I would call some contemporary versions of that. Um, but it really does kind of help bulk up the retail sector. It does offer a a more affordable housing dwelling to for support workers. Uh, and again kind of builds off the synergy from the village. That was kind of I would invite you to correct me if I was wrong, but that

was kind of the spirit of the language. >> Okay. Yeah. Thank you. That helps. >> Sure. Understand. >> Anybody else have a question? >> No. You're okay. All right. Uh with that, I need to have a motion to open the hearing. The public hearing. >> Motion to open start the public hearing. >> I'll second. >> Okay. We all in favor? >> I. >> Okay. Uh so now at this point uh this is the public's opportunity to speak. Um please come to the podium, state your name and address and uh make your comments and limit your time to three minutes. At the same time, if more than one person has the same thing to say, uh, we'd like to ask you to try to consolidate that just due to time. So, with that, our hearing is

open for item 9A and you're welcome to come. >> Good evening, Brian. Franklin Circle. >> Can we do something to >> I'm sorry. >> 175 Franklin Lake. >> Um question I have about 9A is kind of twof. Is there potential use of it already or we just providing this ability for future? Is there something lined up? And secondly, um, understanding what Matteo said that tonight if you pass it, it goes on to the township. Is that the final step in the approval process? Those are my questions. It'd be worth me explaining the process if you >> Go ahead. >> Y question. Yeah. >> No, my apologies. I typically wouldn't cut in, but that's a very valid question. So the process for text amendment adoption in the township is that the planning commission holds a public

hearing and then again can vote to either send it back to staff. You can vote to just be done with it. It's a straight denial. You can vote to send it back to staff with kind of guidance on tweaks you'd like to see or you can vote to recommend it to the township board. If you vote to send it to the township board, the township board at a regular meeting, not a public hearing would consider a first reading in which this would be presented to them in the same way. We would ask questions and then if they they can either vote to deny it, they can vote to send it back with tweets or they can vote to send it to a second reading. And so if it passes first reading, that's a very good

indicator that it's going to pass, but you still by law have to have a second reading. So this would go at the soonest to the board in March if you voted to recommend it to them. If they voted to conduct a second reading, it would go to the April meeting. At the April meeting, they would have a second reading and barring any massive changes or shifting concerns, they would vote to adopt it. 7 days after that meeting is when it would become effective. So midappril if these ordinances work their way to the board. And since you've gone that far with your explanation, can we answer the lady's question about how the public knows that it's been approved or denied? So, as far as it being approved or denied, you would need to either attend the

meeting, read the minutes, or again, seven days afterwards, the ordinance will be updated into your actual 450 page ordinance and put online. So, unless that there's local media that covers and and posts something about it, those would be the ways in which you would know it's effective. But if if things move at the next step process, the soonest these would be effective is midappril. Okay. And it also would be uh published in the Oxford leader, right? Yes. And it has been >> notice of adoption would be correct. >> Okay. Anybody else? Good evening. Maryanne Kes, 149 Stony Lake Drive. part of the uh Sony Lake Village condo association waterstone community. I'm very concerned about the modification in the addition of section 5.4 as it relates to special special land use being associated with C1, C2

and office reszoning. Special land use is a very odd category and it can include very unfavorable things such as data centers and to associate those with those other zoning and mixed use I think is very concerning. I look at my own community in Waterstone. We have undeveloped parcels with those zoning codes and there are many unfavorable things that I would look not to have in our community. The addition of section 5.4 I feel needs to be totally wiped out and denied. I can't see where we need a fourstory structure in a residential area. I mean, who wants office st or studio apartment residents looking into your bedroom windows. Um, that's excessive. I can understand having retail and having an apartment above twotory, but why do we need fourstory? I think it's very, very liberal in

the verbiage and what could come out of this. And I think it's excessive for the Oxford Township. We're not a village. We're not a main street. And taking these type of things and putting them in res areas is frightening to me and I feel that um right now the way it's written is very very liberal and I'd like to see it go back to staff. I'd like to see it eliminated. I don't think that we need this and I'm very concerned about some of the parcels and having a four-story development and this way if it's written into the ordinance we as residents would have no no say in it because if the ordinance allows it and some proposal comes in and it meets the ordinance requirements it's a done deal we have no input to

it no public hearings and I feel that really you need the input of residents to make this township what we want a place to live in. Thank you very much. >> Thank you very much. >> Deb Bishop, 1537 Glass Lake Circle, Waterstone. Um, I agree with the lady who just spoke. We moved out here for a small town. We wanted to for the city of state. >> Our concerns and I sorry Kitty who has a 1032 Cedar Street. Um my family's concern with this uh change would be uh four stories and we would have the potential of seeing a hotel built in the waterstone subdivision which is a residential subdivision and this change would allow that type of building to happen and that is not something that we want to see on top of the

other topic for this evening. Thank you. My name is Sarah Compton. I don't live in Oxford, but I have a business in Oxford 850 South of Pier. I can't speak so much to Arlay, but B, I think it would be an improvement at that end of Oxford in the O district as I am now to bring a little life with some retail in there. Right now, it's pretty dram. Um, but it's kind of sad. I would like to see hopefully some joy brought back into Oxford in that section. Someone else. If there's no one else that would like to speak, I'll take a motion to close the the hearing. >> So, a motion to close the public hearing on 9A. >> I'll second. >> All those in favor? >> I >> Okay. At this point,

uh are there any questions, comments from the board? Maybe Matteo, maybe you can address the ability to use this ordinance to put four-story buildings in residential areas. >> Sure. So, the way this ordinance is structured right now, excuse me, is that mixed uses would be special land uses in office C1 and C2. So there is not a permitted by right path for a mixeduse development in the township with this language. Uh if a project was proposed it would be it would require a public hearing and notice of every property within 300 ft of where it was being proposed would be served by mail notice of that meeting and posted online posted in public. Um C office C1 and C2 are prevalent along M24. uh per the reszonings that have taken place, I am not familiar

with those zoning districts being within the water stone community minus the frontage along M24. So this ordinance is not making for this. These types of developments would not be allowed in R1A, R1, R2, R3, any of your single family home districts. These would not be allowed where they are allowed via special land use which has some discretionary ability by the planning commission to say yes or no. It's not just hey if they meet the setbacks and if they meet the landscape requirements you have to say yes. It's how do we feel about this? What does our master plan say? Is it appropriate for the context of the area that's being proposed? We have a little bit of subjective discretion in those decisions but but it is only in office C1 uh O C1 and C2

which are predominantly found. >> Thank you for that clarification. Sure. >> Okay. Any other comments from the board? >> No. >> All right. Somebody make a motion. >> So I will move to recommend approval to the Oxford Township Board of Trustees of the above reference proposed amendments to update article 3 section 3.5 and to add article 3 section 5.40 40 of the township zoning ordinance to make mixeduse development a special land use in the C1 local commercial, C2 general commercial and O office zoning districts. Okay, >> second. >> We have that. Was it second? I heard Pat. >> Yes. >> Okay. Um, can we get a roll call for vote? >> Sure, >> please. >> Austin, >> yes. >> Dur. >> Yes. >> Wagner, >> yes. >> Blankenship, >> yes. >> Turner, >> yes. >>

Motion passed. >> Okay, that item is approved. Moving on to item 9B. So motion to open a public hearing for 9B. >> Okay. >> Second. All those in favor say I. >> I. >> All right. Now we're moving on to this 9B, the zoning or ordinance changes for article 3 3.4 four 3.5 as they appear. And Matteo, would you please? >> Yeah. So, the second public hearing item we have on tonight's agenda is the zoning ordinance text amendments update article 3 section 3.4 and 3.5 to allow ret uh retail uses um up to 10,000 square feet gross floor area in your office district. So, while separate from a this is also kind of an effort by the OC to kind of take the master plan that was adopted last year and really try to focus

on making more uses available in your zoning districts uh in your commercial zoning districts. So currently you have uh an office district that is for the most part found on South Lier Road on the west side of the road kind of nestled between some C1 and C2 zoning. And then I believe the McLaren site is owned office. Um and with the exception of a few sliver lots up north of Dunouth, that's all the office zone you have. Um you know, precoid office was stagnant. Postco struggled. Um and you really do not have any kind of traditional office park development in the community. I would say that most folks drive up and down 24 every day not knowing not knowing the difference between what is owned retail and what is owned office because the properties are

somewhat interchangeable in their appearance and even some of the way they function. Uh but your office standards are pretty stringent as it relates to retail being able to do any kind of retail in a business that would otherwise support that or a structure or property that would otherwise support it. So, kind of taking all of this into mind, again, the OC kind of looked at this and and with the intent of enacting certain policies and recommendations from the master plan, but also being very efficient in the way that we do it. Again, not reinventing the wheel, not coming up with some new zoning designation, not doing an overlay, so on and so forth. Really, it was what can we work with in the zoning to kind of free up some retail. So you have a

segment in your schedule of uses that says retail up to 10,000 you know square feet of a structure can be dedicated to retail uses. Simply all we did there was we that was not permitted in office. We made it permitted in office. So if this zoning uh if this text amendment was adopted uh any property or business within the office district could dedicate up to 10,000 square feet of their structure to retail sales. Um, for some buildings that's most of it. For others it might just be a portion. Um, but at least allows a little bit of flexibility in a district that we think could support retail as it's set up and offers those property owners a little bit more options for the viability of their property. So with that again, I'd be happy to

answer any questions that you may have. >> Go ahead. Is that for only permanent structures or is that for uh like uh structures that can be removed? >> That would be permanent structures. So it's it's permanent structures related to the principal use. We do have um like temporary sales permits that the township can that are typically associated with I'm not going to call it a temporary structure, but a temporary setup. Um and those are allowed in any district. Uh but this strictly relates to the the principal structure on the property. Now, someone could come in with a a site plan and say, "Now that I can do this, I'd like to build XYZ." Yeah. >> But then we would look at it the way we look at any district review. >> Any questions? >> Okay.

>> Yeah, I think I have a question. >> So, just completely super clear on this. This is really to open up the idea of right now we're really strict about got ahead. It's just office space, right? This allows some retail establishments to maybe move into the township, open a business, have some office space above it. The first floor would be retail. Is that how I understand this? >> Yeah, that's I mean I guess this that's fair. Um, it's likely more utilized in the existing structures. I don't know how much new construction interest we get out of it, but essentially you can do everything you could still do an office anyways, but then it opens up for 10,000 ft of retail uh within the structure as well. >> So, anywhere within the structure. >> Correct. Yes.

>> Okay. Thank you. >> Okay. Any more questions? Can uh we get a motion to close the hearing? >> You need to allow the public to speak. >> Oh, yeah. We got the public. >> Yep. >> Okay. Uh not trying to stop the public, but it certainly is your turn now to to speak concerning this item. >> It's me again, Maryann Kayes, 149 Stony Lake Drive. Uh Stony Lake Village condos waterstone community. I wanted to clarify something that was said a little bit earlier in regards to what Matteo had said about our parcels in Waterstone, the undeveloped ones, and how they're zoned. I think it's a little close-minded to look at the current zoning because there are two parcels that were commercial and then they were reszoned residential and ground has not been broken yet

for those residential developments. I've lived there long enough where I've seen those zonings go from residential to commercial, commercial to residential, and who knows, it could go back to commercial again. So, the previous voting that you were looking at and not saying there wouldn't be any kind of fourstory structure in someone's backyard is incorrect because there could be. And I just wanted to clarify that that things that are zoned today may be zoned differently tomorrow. And you folks know better than I do all about that. But I've lived enough in that community where I've seen it transition back and forth over the years. So you need to kind of take that um into um collective mind here when you vote on these type of issues. Thank you. I'd like to kitty as a 1032 Cedar

Street. I'd like to also um get clarification because my understanding of the parcels at the front of N24, the eight of almost nine acres that is currently sold and partitioned off was once a C1 and was then reszoneed a C2 for the um Aldi. So we do have those C and C2 zonings already within the water stone community. I I don't know clarification maybe from Matteo. Thank you. If you >> go ahead. Maybe easiest if we bring this map here. Snow. Okay. So, the essentially for I mean we're we're a little bit back at mixed use which is no problem but for clarification these these grayish areas are your office districts. So down here on south up here and McLaren site here and again I believe a little bit north. I thought we had a

few in here but it doesn't look like it. So those are the areas that we're saying we could open up. Um we do 10,000 square foot of retail as it relates to the mixed use conversation. The the dark red, the purplish pink I'll go with and the grayish office is where the do special land use um would be available for an application. So I know that a lot of the conversation is revolving around the water stone sites and so obviously you know this is the water stone development and so the only areas currently zoned as they are where the mixed use could go are again kind of this this reddish this pinkish purple this red this red. These would be the areas where you could do it. There's There is no zoning within the development

itself where this would be allowed under your current zoning and with the language as it's written today. I'll leave that tab there in case we need one second. Anyone else wish to speak? has something they want to comment on. >> Okay. >> Pardon? >> I can't. Go ahead. I I I can't hear. >> It's She wants to see the map one last time. And again, yeah, it's it is available on the township website. I know they just redid it, but if you search it, it'll come up. >> Thank you. >> Yep. >> Okay. Motion to close the public hearing for item 9B. >> I'll second. >> All in favor? All right. >> All right. >> Okay. Any uh comments? >> No. >> From the board? >> No. >> I have one. >> Okay. >> Thank

you, Matteo, for clarifying. It was uh I think helpful for members of the public and that are here tonight to understand that a little more thoroughly >> as we were voting on it. We sort of understood that, right? Because we had some time to look at this and review it and understand the zoning a bit. Um, but it was somewhat of a hesitation to to vote with so much opposition, right? But knowing that's where the areas were, that's why we voted the way we did, I feel. >> So, thanks for the clarification. >> Sure. >> Thank you, sir. >> Okay. I move to recommend approval of the Oxford Township Board of Trustees of the above referenced proposed amendments to update article 3 section 3.4 and section 3.5 of the township zoning ordinance to allow retail

use up to 10,000 square feet in gross floor area in the office O zoning district. >> I'll second. Okay, we have a second. Can we take a a vote, please? >> Wagner, >> yes. >> Durk, >> yes. >> Austin, >> yes. >> Blankenship, >> yes. >> Turner, >> yes. >> Motion passed. >> Okay. Both 9A and 9B will now be uh taken up to the township board for their review and approval before it becomes part of our plan. Number 10 on our agenda. I don't know of any unfinished business that anybody has. So, we'll move to item 11. And this is the desire or request by the applicant for the U Aldi grocery store to seek approval of final approval of their site plan so that they can uh go ahead with their their building.

So with that, Matta, do you have So give me one second here. We'll get to the uh set sheets. This is probably to work with at least to start. I know the applicants here can go into a little bit more detail about what they're proposing, but yeah, as you had stated, what you have in front of me tonight is the request for final site plan approval uh to construct a 20,000 foot Aldi grocery store on the 3.94 acre lot located at the southwest corner of Market Street in M24. Just kind of as a little bit of background, on May 8th, 2025, the planning commission held a public hearing uh for the resoning of parcel of the entire parcel uh which used to be about 8 acres from C1 to C2. Uh that in which they

recommended approval to the township board. The township board approved that request um at the July 9th, 2025 meeting. A lot split application was submitted thereafter and administratively approved and finalized with Oakland County July 31st of 2025, effectively turning the 8 uh 8 acre lot into two 4acre lots, both to zone C2. October 23rd, 2025, the planning commission held a regular meeting on the preliminary site plan and conditionally approved of the plan. Uh so with that, I've got a few kind of quick notes. Um but kind of big picture, the site plan is is substantially the same as what you saw in preliminary. No major features have moved or changed uh related to step from preliminary to final was just some additional information as related to lighting. um some different clarifications with some of the retaining

areas that they want to build ball-wise. Uh but for the most part, the plan is is substantially the same as what you saw back in October last year. Uh so with that, per those comments, uh the design does meet all the development standards for C2 general commercial. Uh there's just some clarification that we like we would like made regarding some reference to the south lot line and sideyards and rear yards. Again, that's those are clerical items that just need to be cleaned up and we get administratively review and approved. Uh for natural resources, uh the southeastern portion of the site contains some steep slopes, but that's partly due to the uh golf cart tunnel path that runs along the rear of the property. Um there are BMS and woodland clusters um that exist along the

eastern property line. U but as we had discussed at preliminary approximately 75 trees of the 89 mature trees on the site will be removed uh to accommodate proposed improvements um as they provided in their tree survey uh access and circulation. Uh again the site has the two drives or the two access points along Market Street uh including a 30 foot uh 34 foot wide western drive for two-way traffic and then an eastern drive which would be uh relegated to turn right only exit. uh they have still left notes indicating the cross connection with the site the neighboring site. We do promote cross connection uh when possible. Uh so if a site plan comes forward for that parcel, there would also need to be an amendment to this one. But that's something that we typically try

to promote to keep traffic off the roads. Um the driveway spacings from each other I'm 99.9% sure is compliant. It it's 105 foot standard. I believe they're somewhere around 300 feet. We just need the dimension added to the plan. Um, as we discussed at preliminary, they did provide a traffic impact assessment indicating the Gersh generate approximately 1,700 additional daily trips. Um, that study also modeled that that traffic would likely come either from northbound or southbound 24. Um, with the increase in traffic, you can see on the site plan that there still have the modified island uh boulevard differentiator uh which has been substantially a good substantial portion has been removed to allow for the left hand turn lanes in. Um again we were able to confirm with engineering and your process dictates that between preliminary

and final they have to get their third party approval. So RCOC has approved of this design um for access into the site and the removal of that portion of the boulevard. Um, safety paths do exist along Market Street and 24. Um, should the site plan be approved and the property be constructed, obviously all the and their affiliates will be responsible for those safety paths as it relates to maintenance. Um, again, we're just asking for those notes to be added to the plan just so that it's confirmed for parking and loading. Um, again, based on the usable square footage and the employee counts, the site would require 101 parking spaces. They're still proposing the 92. This is something we talked about preliminary. They do have 10 bank spaces off to the west of the site. However,

the planning commission did provide the waiver to allow for the 92 spaces based on the based on the information that the applicant provided about the amount of parking they typically see at their other stores. Uh for essential services and utilities, again, the project will connect up to township water and sanitary sewer mains along M24 and Market Street. Storm water is directed to a detention pond on the southwest corner with emergency overflows. Um we defer to obviously we defer to public safety for emergency vehicle circulation. Um the fire department did not site any concerns for landscaping and screening. Uh the project does propose uh removing some existing trees as well as the existing guard house and some of the retainer wall infrastructure at the front. Again, the applicant's been working with the master HOA association about

uh that infrastructure up front, what's to be removed, what's to be replaced, so on and so forth. Uh landscaping green belt and parking lot planting requirements have been met and the plant sizes and species comply with the ordinance standards. Um retaining walls uh near the golf cart path may require building permit depending on whether or not they're four feet or taller. Again, these are things where if the information is not on the plan and it is something detrimental to design. We just ask for the notes to be updated. For the lighting, uh the phototric plan and fixture specifications were provided. Lighting levels at the main entrance uh do exceed the 20 foot candle maximum, but that's allowed as long as the pictures are recessed into a canopy. Um light poles are proposed at 29 ft,

which is allowable in this district. And all outdoor lighting is supposed to be reduced to 50% uh between 11 p.m. and sunrise, but those hours are beyond their hours of operation anyway. So, we're not concerned about that. Uh, architecture really hasn't changed from preliminary. Again, the floor plans and elevations were provided. Uh, the building would be constructed primarily metal panels, uh, glazing, faux wood, aluminum paneling, brick, um, along, and they've included bike rack parking along Market Street. So, with that, we really only have some cleanup items for if the planning commission were to consider approval this evening, we would just recommend the following conditions. that any cited concerns from the township of engineering be addressed, any cited concerns from township public safety be addressed, that the south lot line be updated on the plan as

a rear lot line. Uh the distance between the drives be added to the plan. Um again, the note on the site indicating that obviously the applicant will be taking responsibility for the safety pass that if retaining walls are going to exceed 4t that they need to build, they need to obtain a building permit. And then again just confirmation that the where they're exceeding that 20 foot candle light when that those lights are recessed with canopy. Um but after that uh there really weren't any other issues at the site. With that I'd be happy to answer any questions you might have. >> And do we uh do we have a presenter from all Aldi or from their building? >> You do. I don't know if you want Jim to go. He's not that important. >> I

look for Jim, but if there's somebody representing Aldi the corporation. >> Yeah, whichever way >> wanted to present. >> Yeah, whichever way you wanted to go. I just want to make sure. >> Can I ask a question of Matt first before we get to the >> Sure. >> applicant. Thank you, sir. >> Um, as far as a a a site schedule, a building schedule. Do we did the township receive that schedule from the applicant? >> I don't believe so. I think obviously that's a question they could answer this evening. Um obviously with the timing of things, I would assume, you know, shovel in the ground in spring. >> Okay. Thank you, sir. >> Sure. >> Mr. Sharp. >> Anybody else have a question for Matt? Okay. Do we have anybody representing Aldi? I see we

have a drawing back there. Yes. Good evening. Christian, Design Engineers, 2183 Plus Drive, Brighton, Michigan. Uh we do have some drawings in the back. You have the drawings as well on the screen. Uh if there's anything particular we need to uh point out, we can certainly do that. Uh this development has changed just slightly since the last time we were here back in October and that was really just to address uh planning engineering review comments uh comments from the public. We went through and just did a little tweaking but other than that it's pretty much the same that you saw before. uh a 20,000 square foot singlestory commercial building and uh as pointed out uh it's going to be a masonry and metal panel finish on the building. Um some of the revisions that we

did make and I just want to point out there was concerns about traffic along Market Street. So we did add in crosswalk striping for Market Street as well as our driveways. uh modified signage location to provide better visibility of the uh pathway and then added in some regulatory signs along street uh indicating that U-turns are not permitted through that area. And so I just wanted to bring that up that those changes were made. Um outside of that, as we look at some of the comments received here, um we have received sign off by Jim take away this time, but uh already stolen all my funding. He has approved it from the engineering side. We have received approvals from Oakland County Road Commission and uh the couple of minor modifications that have been requested here from

the planner. Um we have actually already made those changes on our plan set. We're just waiting to get through this evening if there are any other changes we have to make uh prior to resubmitting. I'm assuming we'll have to resubmit before we go to the board. Uh but we have already made those changes. I will point out in regards to Market Street, we are actually removing and replacing the entire safety path along there. By the time we put in our driveways, the water lead, everything else, there's not much of that existing path left. So, as far as maintenance goes, that's being replaced all the way from the guard tower to the west property line. Um, and we did add notation in there to take care of any maintenance that would be necessary along 24 within

that existing path that is to remain. Our retaining walls are less than four feet. In fact, they're less than three feet tall. And also the canopy lighting is all recessed style lighting or actually Those are flush not they are fully resized up there. So I don't anticipate that to be an issue and those details are called out on the plans to button that up with the deal and make sure that that meets everything that if you have any particular questions about the proposal be happy to answer. >> Mr. Chair, it's me again. >> Go ahead. >> Can we scroll over to the landscaping plan, please? You should One more. There we go. >> I was hoping you could explain the the gaps in the trees here. Is it topography doesn't allow for trees? Because it's

a nice tree line, right? But I'm just wondering why the be a nice, right? >> Well, the main issue on the east end there is the topography. We get to that steep slope. We're we're up close to one on three slope there and so we're trying to get a tree planted on there and growing properly just as >> that's just uh the other side was just have a little bit of break up on that west end uh as we went through. I mean we more than exceed the requirements for plantings. We actually have more plantings than is required and so we had grouped different types of trees and just kind of broke those up uh to provide and not have just continuous tree grow. We wanted it to be broken up a little visual. See

a little bit of building in that aspect. See some landscaping. >> All right. I think the reason I asked I think was brought up in the preliminary site review. So I just wanted to give clarification on that. Again here the other question I have was around the the uh the drive-in on Market Street. So if we could go to the traffic the site that I had a few minutes ago. >> Um, well, there's another >> sheet. >> Yeah, there's one that shows the directional arrows coming into the site. >> I think that will probably help best illustrate the question. >> 54 >> right there. >> Yep, that's the one. Thank you. >> So, when we talked the first time, right, we were I had expressed some concern about making a left turn out of there.

Is that still going to be a feature of the exit at that entrance? And >> yes, that was approved by the road commission. >> It was approved by the road commission. Okay. I just wanted to make sure that they had reviewed that because I had that concern right about crossdirectional traffic and you know, >> they actually had us move the nose of the western side. Move that nose further out for that boulevard to accommodate those left hand turns. >> Okay. >> Excuse me. There's going to be a left turn allowed on market. >> Yes, Western Drive does allow for the Empire Island. >> Would you please come up to the podium? >> Give us your name. >> Mr. Chair, Mr. Chair, >> I I would wait until >> the applicant is done and then the

engineer is done and then allow for questions if you choose. >> That's fair. Okay. Yeah, that was my my question around that topic. So, thank you very much. >> Anybody else have a question? >> No. >> Okay. Mr. Jim, >> we love you. >> Jim Sharp Sharp Engineering Township Engineer. I don't know what else left to say. and the developer did a great job of explaining all the engineering items. So, um you should be in receipt uh or in the packet. You know, you have our letter. So, I'm just going to hit a couple quick things for those that don't want to. They can go on their phones and watch the Red Wings game while I reiterate what's already been said. Um but we did grant our uh the way your process works is they

the applicant receives preliminary site plan. Then they go um and get their engineering approvals, get everything ued out with us and then once they do that they apply for their permits and then they come back for their final plan. So that's the process just so people um in the audience are aware and we did grant our engineering approval back uh January 8th. Um so since that time they've been working with the necessary agencies to get their outside permits. Um the again road commission they did uh they did see these plans and they did grant their approval back on January 14th. Um for the members of the audience who wondered about that left turn lane that was just brought up. Yes, that was part of it. So there is a significant portion of that Boulevard Island

that is going to be removed um in order for left turns to be into the site and for those that want to uh that may live in the waterstone development, you know, want to shop there so they don't have to go do the Michigan lesson and everything. take an exit and go down. But there is a left turn that will be coming out of the uh western entrance that will go on to that will go on to uh I guess westbound market street there. Um the water man has been approved through our office through uh the WRC. It's at currently with Eagle. They needed a they need a permit from Eagle for the water just because of a fire line that they're putting in. And then they're running their domestic service and their fire protection

off of that. So that's in process right now. Um with regards to the sanitary sewer, this property was already set up, you know, anticipating development. So there's already an existing um sanitary sewer line that's on the property. So they're connecting to that. And the district has plenty of uh sanitary sewer capacity for this type of development. The same with the water line. There's 16inch water lines and 12in water lines. They're connecting to the 16 inch. And um again I already brought up the issue about the uh about the fire department connections and eagle permits. Um storm water again as brought up there's a pond in the one corner. Ultimately it discharges through the rest of the water stone development. It was set up that way back 20 years ago when water stone was developed to

accommodate storm water from this vacant property right now. Um, I think we've hammered out the Market Street portions real quick and the applicant mentioned about the uh the complete redoing of the safety path out in front of their property. >> So, I guess with that, I'd be happy to answer any engineering related questions that you may have. >> I have a good >> So, regarding the the the storm water runoff. >> Yes. >> So, we'll have the routes with the directional arrows for the storm water for tenure storms been added to the drive. Those >> So say that again. >> The flow routes with directional arrows for the storm water. Yes. From tenure storms. >> Yep. That's all been addressed. Y >> uh open space calculations and open space preservation instrument. Has that all been

received? So that is in relates to council's letter and actually upon further clarification from them that is actually they note that if applicable in which in this case it is not. >> Okay very good. Thank you for that clarification. I did forget to ask the applicant if you created a schedule and submitted that. Does anybody know that's been done? the applicant address that but um we haven't seen any any schedule yet in springtime. >> Okay. >> You know they still are waiting on an eagle permit right now. So that could come through that was submitted back in the last month I would say. I think applicable. >> Sure. Just wanted to make sure nothing in engineering was holding. >> No, we're all good with engineering. So they've been all of our concerns. >> Okay. Thank

you, sir. >> All right. Thank you. Anybody else? >> Can we Can we get the applicant to answer the schedule question, please? >> Would you mind having the applicant come back up and answering this question on the schedule? >> Thank you. >> So, the project was just released for bid this week. >> Okay. >> Uh we'll be going through that process here through the rest of February into March. Uh assuming permitting and when it comes out uh probably looking at a summer time. >> Okay. Thank you, sir. >> Okay. At this point, um we would like to give the public a chance to come up with any questions you might have. This is not a formal hearing per se, but since so many of you are here, we thought there might be some issues or

things that could be answered. So, we open the floor to you folks. >> Mr. Sure. If if I can just remind the public, if you come up and you have questions, the the board here is not going to engage in a back and forth. They will hold your questions and answer and the applicant is not going to engage in a back and forth. So, just so you know that it's your three minutes to say what you want to say. Uh, commissioners. My my name is Jason Ber. I live at 725 East Lake Trail um in the Washington neighborhood that uh I'm not opposed to the development, but I'm here under the the authority granted to the commission by the mission zoning and neighboring act spec specifically MCL uh 125.3501 which requires site plan to review

to ensure protection of public uh health, safety and welfare and compatibility with adjacent properties. And 24 under the jurisdiction of the road commission for open county association according to the RC uh it carries approximately 24,000 to 25,000 vehicles per day uh with peak hour volumes reaching approximately 20 2400 vehicles per hour. Um RC evaluates arterial uh access and intersection operations. However, diversion uh in onto residential subdivision streets is not regulated by the RCOC. That responsibility falls within the township site plan re uh review authority. When delay uh increases on a corridor operating near capacity, diversion behavior is whether residential diversion was evaluated. I'm asking if that was ever evaluated at all because when I look at the plans, it was only along within the near the golf course itself and not something that's coming off

the seaming lake road. Um the traffic impact analysis concludes that there's no significant impact. My question is whether residential diversion was evaluated. Um uh what was the division uh the adjacent streets were what was the diversion modeled after? Um sorry work in the basement. Uh was baseline traffic measured on the residential portion of market street? Uh what was the current ADT in the 85 percentile speed there? Uh without the baseline residential data, it's not possible to determine whether adjacent uh whether the adjacent was actually uh uh modeled correctly. Um this I also noticed that during this time the uh the the review by the ROC was done in July. Now I don't know how many of you guys have kids but in July people are on vacation. Okay the kids they're not in school. I

have two bus stops along East Lake Trail. Right now I have people coming down my road because I work at home. I get to see them. They cut off some They cut off the the corner right there at Marketplace and Waterstone. They come from Seymour Lake Road and they fly down my road because they don't have to stop. My daughter has epilepsy. I'm not This is not okay. Okay. You have a bunch of little kids. You have everything going through there. There's no I don't see anything within these rules that says what happens after this has been approved. How is that going to be governed? How is that speed limit 25 milesPH going to be governed? How is it going to be taken care of? Is there a 30 60 90 after this um after

the evaluation of the traffic? How is that going to be monitored? I'm really not happy about this. >> Thank you. >> Okay. >> Good evening. My name is Ed Romson. I live 457 Southshore Drive in Waterstone Shores. Um I just don't like all these being there. I think the left turn lane on the market is just a disaster waiting to happen. Don't think that there's any thought about why this building had to be there and that in our subdivision not happy that this is being built. I think it's going to be more of a traffic hassle. We're going to have more accidents and I don't think it's good for the community. It should be in the community but not in water in this area. Thank you for your time. >> Hi, I'm Gilbert Lipac. I

live on 1420 Glass Lake in Waterstone. I have One question about the entrance here. When the roads get destroyed and eventually has have to be replaced, who's responsible for that? Is it Waterstone? Is it the township? I think I heard the countyy's not responsible for it across the road from there, the entrance to Tim Hortons, there's always potholes in that road and it seems like it takes forever to get a pothole. So, I'm expecting the is going to happen here with all the traffic and the previous gentleman I have to agree with him in that I'll probably be avoiding this entrance living in glass lake and either going out Stony Creek Drive or South Waterstone and that's going to increase the traffic on those roads and don't know if you considered that this decision I

know. Three strikes. I'm out, but this is my third time up here. Marian Kes 149 Z Lake Drive, Oxford Township in the Waterstone community. Some of the questions I have at this point, and I brought this up previously at at the developmental meetings for this um this particular retailer coming in is Market Street traffic light. I've always asked why do we not have left turn capability at the Market Street traffic light? There is going to be a backup during rush hour, especially parents trying to get their children to school in the morning and depending when the retailers uh business hours may be. If they start at 8, it's going to be difficult. They start at 9 might be better, but there's going to be I don't think any parent's going to want to wait um

three lights to get out to make a righthand turn on the pier. So, I really see the capability of that traffic light need. And if they're taking the median out, we might as well make it a left turn lane so people can go right and left at Marcus Street onto the pier. So, food for thought, we still have time to make that happen. Um I'm just a little concerned, too. We just talked about the storm water drainage, but I didn't hear the outcome of where is that water going to drain to? Is it going to come to Need Lake DS? Is that going to go to Waterstone Lake? Um I'm concerned because we have a large 9-2 parking space retailer now. There's always, you know, debris. We get high winds by the water, so there's

always garbage and things blowing around. I'm just concerned where is this water where is it being drained to? Is it coming into one of our lakes in Waterstone? And if that causes an issue of algae growth or whatever, who's going to pay to have the lake treatments? Because it always comes down to the resident's pocket. Um they also mentioned about the right bike rack. I had mentioned this earlier at a meeting. I don't think having a bike rack along the um the safety path is a good idea. I think parking bikes there where people are going to be turning right and left and there's going to be trees in the median and trees. The landscaping looked beautiful. A lot of trees. But in the when the leaves start falling, who's going to clean all those

leaves up? Where are they going to end up? But I think having a encouraging children to ride their bikes and park them there on that rack right along um Mark Street just adds to the confusion, the congestion that's going to go there and I'm afraid a child is going to get hurt or even worse. And um again, the gentleman had spoken before. My concern was always enforcement. People don't go 25 miles per hour now on Mark Street. Everybody in here will agree it's it's very high and who is going to enforce all the traffic and and uh making sure because I had never heard that the speed limit was going to change from 25 that it was going to remain that. So if that's going to be who's going to enforce this and I still

have a concern too about fire engines can they get with those median cutouts can they maneuver around and what happens because I see them you know unfortunately Independence Village uh there's a lot of calls for and the fire engines, especially early in the morning, and they're constantly going down Market Street. What if there's a backup of people trying to get out to go to school, to work, and people coming to shop? How are those emergency vehicles going to get around there? So, those are my issues and my concerns. I still feel traffic's going to be an issue. Thank you. 1032 Cedar Street. Um members of the township board, I'm I'm asking you tonight to protect Waterstone. Okay. Um this isn't whether this isn't about whether Aldi is a good company or not. This is about

whether the hightra commercial entrance belongs inside of a residential subdivision. Uh it doesn't. It really doesn't. uh it doesn't fit within the visual and operational u status of a neighborhood of this type. Uh there's a golf course within it. Um the loss of neighborhood cohesion is going to happen. It just it it doesn't fit. It it's it's a it's like a puzzle piece that should have never been there and you just got it anyway. Uh the higher traffic volumes on the residential streets, they're not designed to hire commercial traffic. And we will get a lot of traffic coming from the Seymour Lake and Dunlop because if you're over on the west side outside of uh Waterstone, you're certainly not going to take Seymour Lake Road up to Berdick Street to sit at the light to

make a left turn on Washington to go over to uh the Pier Road and turn into this Aldi store. It's it's it's just ridiculous. So people will ultimately and always cut through water stone to get to the Aldi story. Okay. Uh more congestion, more noise, more air pollution diminishes the resident's quality of life. I mentioned already is the emergency access. Um the negative impact on home values. I was having an afternoon with my girlfriends and I had to, you know, hear their opinions about this project. What would what would you think about an Aldi store being built within your neighborhood and they their nose was like, "No, all of them shop Aldi, but they would not want that store within their neighborhood. It doesn't fit. It doesn't make sense. Uh, it reduces the buyer's appeal.

Quite frankly, if I'm a million dollar home shopper and we have million- dollar homes within Waterstone and I come into that subdivision and there's store there, I will probably say, "Oh, I don't think so." Perception of overdevelopment. Even if the store itself is located on a commercially zone lot, the physical connection to the neighborhood changes the character of the area. The perception matters in real estate and proximity to the heavy commercial use can suppress our property values. We didn't buy a home in Waterstone to have this uh commercial lot, which was once C1, turn into a C2 to allow this larger volume store. That's not what anybody was here for. I am very, very, very disappointed that the board made a decision to make this happen. Some of you live in this community. That's disappointing.

Very disappointing. So, we have long-term marketability perceptions problems that are going to come up as well. That is disappointing. It doesn't fit. >> Thank you. Hi, my name is Janet and I live in 1340 Glass Lake Circle in the Gulf Highlands of uh Waterstone. I um I think development is a must, but not in our subdivision. I totally object to the road change that they're going to do entering our subdivision. Um, I've lived there for many years and I don't know of any of my neighbors that were notified that there was going to be a store built interrupting the entrance to our subdivision. It's very dangerous. Everybody's talking about the the topic that we're going to have and it's not favorable for the people who live in in waterstone. I really object to the way

the entrance to the ali has been designed and I would really like to know how I can go about opposing officially the building and the destruction of the entrance to our subdivision. I would like to know where I have to go to request that that cannot be accepted. Thank you. My name is Alex Lamas and I live at 621 Zlake Trail. So I find it to be very disappointing the direction that is being taken in regards to our community. It seems that decisions are made too quickly to improve building structures rather than being selective and preserving the natural aesthetic of the community, which I feel is the biggest selling point for the area and the reason that most of us here in Oxford and that live in Waterstone choose to move there in the first

place. Perfect example are all of the cannabis shops that were approved, which are now mostly vacant buildings. Aldi will not drive down prices of the competition but will instead be placed in the neighborhood that will be dramatically affected due to traffic because Market Street is a main bus route for the neighborhood which I have three young children who take those buses. Um increased future upkeep of the road uh with the large delivery trucks and the increased traffic flow which I know was mentioned earlier. Um not to mention the value of the prices of the homes. I hate that this development is intruding into the waterstone community, but at this point I do feel like it's a development that is going to happen regardless. But I do wonder why not make all of the flow of

the traffic come off of Lepier Road? Why have it come in through Market Street? Or better yet, just move the Aldi to the opposite side of Leier Road. Why does it have to be the entrance of an actual subdivision where we all live? We've turned the roads of Dunlap, Market Street, Waterstone Drive, and Stony Lake Drive. They will be turned into main crossrough roadways because we know that surrounding areas will be cutting through the subdivision and not just taking the pier road. So again, knowing that the amount of children that reside in the neighborhood, knowing that people are already flying down Market Street as is, and it is not very well patrolled as is, it's just going to get that much worse. I did not move here in order to have a grocery store placed

in my subdivision. If I wanted that, I would have stayed on the east side of state. answer. Kitty has a 1032. You already know what it is. Um, I want to point out also that developers come in to areas and they own mass areas of land and of course it's in their best interest to develop those lands into you know neighborhoods, retail area, etc., etc. The big dream for Waterstone was it to was it to be something like um what is that residence in the Florida with all the >> the villages? The villages. That's it. So the big dream for Waterstone was it was for it to be like the villages. So, it's going to have housing and a coffee shops and little retail shops and all of this. Well, then, you know, the big

boom happened and uh things fell apart for the builders and whatnot. So, just because it's a developer's dream doesn't mean it's right for the for the neighborhood or for the community. working in real estate and new construction through the years. I've worked with a lot of people who come out here from the east side and they come out here from very congested areas. They come out here for the quiet part of Oxford. And if we fill that up with a bunch of commercial and everything repeating itself for where where they came from, we don't need more McDonald's. We don't we don't need more junk stores. We we we want peace and quiet out here. Guess what? It's okay to say no to these proposals. You work for us. You don't work for the developers. We

vote for you. Do we not? >> No, >> you don't. Oh, yes, we do. Because there are names on the petition on the ballots. Yep. Okay. >> Anyway, >> the planning commission is appointed by the township. >> Okay. your your commission. Yes. But your position, right? Or not right. Okay. Anyway, irregardless, you represent this community. You don't work for the developer. Use your heads when approving things for your own damn community. We have anybody else that would like to speak? My name is Dan Gallagher. I'm at 600 East Lake Trail, Oxford Waterstone. So, pretty much everyone that has come up here today, uh, I do agree with. Uh, I used to live in Rochester for many years. My wife and I moved out here seven years ago for the peace and quiet and we've been

very happy with it up until late. Uh no offense to Aldi whatsoever. I'm sure they're a great corporation uh grocery store chain, but again to the other point of of the lady that spoke it just doesn't fit our community across the street maybe. But when you put an Aldi into Market Street where the traffic already is a nightmare, it's just going to be a disaster. I mean, you have kids, you have people riding bikes, you have people walking their dogs, people just going for a walk. I live again on East Lake Trail and behind me is Seymour Seymour Lake right right there. So, I see the traffic. I see people cut through, go 50 miles an hour jamming their music and it's just the sheriff's having field day over there. All they have to do

is park literally in my backyard. They could hit their quota within an hour. It it's it's crazy. Point is is how this is structured, especially the in andout of market is it just isn't feasible. I understand they're trying to make adjustments and make it work, but at the end of the day, once it's all said and done, the structures up, trees are in, yeah, it looks great, but what happens afterwards? What happens, heaven forbid, if a child gets hit or someone's walking their dog and their dog gets run over or accidents and it's again, it's a nightmare. I'm against it a thousand%. I'm not against Aldi whatsoever. If they want to go elsewhere, great. I'll go there. But not where we live. It doesn't fit. So, I beg you please to decline it. Thank you

for your time. Bishop Lake Circle. I don't know if this makes a um doesn't feel like anybody's listening to any of the residents that live in this neighborhood. Anyway, I don't oppose Aldi, but I do oppose the location. When we all purchased our homes, it wasn't supposed to be this C2 stuff. It was supposed to be small walk, walkable, small little thing. A nice place to have a quiet come home and rest and be quiet. That's why we all moved here. We were also told at our homeowners association there would be no left turn on Market Street. Clearly, there is. And it's it's just it's not. It's it's going to be a thoroughare. It's going to be a main road. People are going to turn left because you're allowed it. But we were told it

wasn't going to be allowed. It doesn't fit with the neighborhood. It doesn't fit with the aesthetics. And I'm really frustrated because I feel like y'all don't care. We live here. And I just feel like y'all just don't care. We were told if we were going to turn left, we didn't want it here. It's here anyway, which I wish it's not. Again, on the other side of road be a better location. Turning left into a subdivision. It's It's just it's not right. It's just not right. Sorry for my nerves earlier, but um that's what happens when you work after CO. Um Jason Pler, 725 East Lake Trail. Uh if this goes through, I'm asking for requested conditions of approval. Um, pre-construction residential baseline study for 24-hour core uh counts. I want that speed study. Crash history

documentation. Uh, post occupancy monitoring six uh 6 months to 12 months. Uh, diversion trigger clause. If residential ADT increases by x% above baseline, uh, mitigation measures are automatically implemented. I'm asking for development funded mitigation escrow. uh radar radar speed signs, traffic u calming, uh turn restrictions if warranted, and enforcement and support if uh legally permissible. Uh and a written confirmation from our COC that uh projected delay that uh will not materially increase division or diversion when it comes from other streets. Again, you mentioned verdict. I I I cannot tell you how many times I've had verbal um uh ver verbal uh discussions, extremely loud ones, at people that drive down my street at 45, 50 miles an hour. It's it it's a it's a problem. It's a problem now and it's going to be even

worse. Thank you. Hi, my name is Michelle Culver. I'm at 450 East Peninsula Court. Um, I am a big fan of all the here before in support of them. But in hearing and in listening to my neighbors over the course of time since this plan has come into play, I am in agreement with the majority of the people here who spoken that it doesn't necessarily belong in this particular location in Oxford. We do need choice for grocery in Oxford. And with some of the changes that we talked about earlier in this meeting where you've um approved retail to be added to office zoning in other locations of town or down south of Drao Road. Perhaps there's an opportunity for the township to consider looking at placing this plan somewhere else that makes a a bigger

impact and has a lot less impact on the residents that moved into waterstone for all the reasons that have been mentioned including I think Mr. Austin. So I feel like over the course of time this plan has not been transparently shared with the residents of the waterstone community. It has been talked about in the Oxford leader but most of these people that are here today have not been at previous meetings that I've been at. So, I think as things transpired in the fall is when the word started to get out that Aldi was coming and there has been little time for community feedback and this meeting um with one notice in the paper was not well um well publicized either outside of social media channels. So again, no one in the neighborhood got mail about

this meeting. Um, and this site plan has not been shared broadly in the Waterstone community. And several of the concerns that have been brought up today relative to traffic turning out left into the neighborhood is concerning to me. We walk through there all the time with the dogs. It's not safe. Kids on their bikes through a area where people are turning in and out and they're not familiar is not safe. School bus routes up and down Market Street alongside commercial traffic are not safe. So, please reconsider. reconsider the plans for tonight and maybe put it on a a docket for discussion board. Perhaps one of these other locations that might be more suitable for retail traffic of this nature to bring such a great resource to our community but in a different location and not

in the residential district. Thank you. We have anybody else that would like to comment. My name is Dan Kasinski, 762 West Lake at Oxford. Um, I'm not going to say anything much different than what's already been communicated here. Moved here two years ago. Love that boulevard entrance. Looks beautiful. Particularly around the Christmas time. Um Aldi, great great store. No, no question about that. Um, when we looked at at 9 A and B earlier, I've never been to one of these before and it looked like I mean everything, you know, Robert's rules of order went along here, but after the public gave their feedback and I expected there to be some communication amongst the board and then the vote, it seemed like no matter what we said, it was just a rubber stamp, bing bang. And

that's all right. But the feedback that you've gotten on this particular uh quality. I do feel like we're your constituents and uh you know, I'll take a little softer approach. I mean, please do a little soularching. Um it apparently you can still say no to this and uh you know, we've got such a small representation here tonight, but I would suffice to say that you'd be hardressed to get one or two% residents in Waterstone that would say this is a good idea because of this, right? And so I'm not self-appointing myself for the other 99% of the folks that aren't here, but I really think that pretty much everybody thinks it's a poor idea where it's located. So appreciate the time. >> Anyone else that would like to comment? 252 Storm Lake Drive. Uh, nobody's

mentioned that the golf course opening driveway is 100 yards down the street and I've been told that they get 300 rounds of golf a day. So that's possibly 1,200 cars a day coming to the golf course. Doesn't that affect all these and the traffic jams and possible for accidents. It's just it's we know it's too far to turn back. I think the right side. >> Anybody here want to comment? >> No. I'll comment. >> I'm pretty uh disappointed in a couple of the the people that stood up here and verbally attacked me. Uh I live in Waterstone. Not once have I ever looked at anything in this community. Not once for the betterment of this community. I do a ton of stuff for this community. I own a local business here for this community. And

I always always do my due diligence to make sure I look at everything. To be honest with you, I'm disappointed in a lot of people. And the altercations here should have some ramifications because we're just doing our job. We're trying to do what's right. Our job is to make sure we uphold the master plan. Our job is not to emotionally decide if they can come in and they can come out. Our job is to make sure when they come in that they do everything right for you guys. We can't stop people from coming in if they do the bylaws the exact way. Okay. So, we've put a lot of work into this our our group up here. So, I'm speaking for myself, but I'm assuming they're agreeing with me. I'm very disappointed because this is

not an easy job. This is not an easy job. I live in Waterstone. You know how many people cut through my subdivision the from through through Dunlap on Westlake? Do you know that my kid almost got hit yesterday? 35 miles an hour in Westlake. You know what I did? I call Oakland County. Guess what happened? They came out there. That is our job to do it. We are not to facilitate everything. So I'm explaining this to you guys is it's facts, not emotions. Do you realize that when water stone came in there was people in this seat just like you guys saying we don't want water stone? Okay, I want you guys to think about that you are living in places that people told that didn't want. So just remember that we have to do

our job and our job is to make sure all the information that we get is best for the community and we have an upright to hold the master plan. I was on the master plan. I helped with 12 other individuals. There was 12 people. I wish some of you guys in here were on the master plan because then you guys could have understood what we go through on a day-to-day basis. I've been doing this for almost two and a half years now and it's a hard job. We go home and we read, we look at everything. I have a lot of construction background. So, I know the traffic laws. I know the traffic infrastructure and the stuff like that. A left turn is not going to make a big difference. What's going to happen is

everybody in the Waterstone community is the one that speed. I see it all the day. All the time. I see my neighbors speed. No, that's that's that's not true. >> You can I'm not going to argue with you. I I I'm Can I talk? It's my turn to talk. You already had your turn. >> I'm telling you right now that you can ask for studies that Oakland County pulls over most people that live in that sub. So, cutting through, we're going to get that no matter what. When we put that community up, we're going to get that. So, I'm telling you guys right now that we have a job to do and to get attacked by you guys, I think is uncalled for. >> You have a right to say no. That's the bottom line.

>> The type of zoning being changed. >> Of course. Of course. >> You Yeah, you you guys are going to talk to me when I have the floor. That's disrespectful. >> I didn't interrupt you. And the thing is is the HOA when they have a social media post, make sure the facts are right before you post something. And if you want people here, make sure you state the facts, not the not the non-truth. Because there's a lot of social media stuff going on that is not the truth. I always say there's consequences to things when people act. I I you guys telling us that we don't care and we're not listening to you. That is wrong. I've been in this community for 42 years. I've never once ever done anything to affect this community. I've

done everything to help it. And I'm voing voicing my opinion right now so you guys understand where my I'm at with this decision. It's the facts, not emotions. So you guys can be mad at me all you want, but I have a right to do what the community is. Now if there was 600 people in this room, we might be having a different conversation. >> I'm done. >> Okay. Anybody else? Thank you. >> Ma'am, there's no public comment right now. The board is the commission is discussing. >> Mr. Chair, I just like to echo Mr. Austin's statements and thank him for stating those facts. Well, my comments go back probably four years related to these parcels of property that we're talking about tonight. Plus, on the opposite side of Market Street in Waterstone, there's some

parcels there. Now those came up and a builder wanted to put some condos in there and those Oh, we can't do that. We can't do that. Now these come up all come. It's their property. They want to put store on it. Oh, we can't do that. We can't have that. If you folks want to ensure that those properties are used the way you want them, maybe you ought to buy them and do something with them. We have spent many hours on this particular subject and with respect to all these, it has been over a year since Aldi's came forward with their site plan for approve for for preliminary approval. That was approved tonight. They came back wanting final approval. And by the way, it's up to this board to decide whether they get it or

not. But the whole idea here is some things are going to happen whether we really want them to or not. Traffic I understand. And you're just part of the traffic. You built houses and you moved into this area and there's all kinds of traffic on M24 from your cars. And when they get done out on drainer road, you're going to have a lot more traffic. We try to do the best we can to get what is most reasonable for the community. And if you don't like it, maybe we can get you a position here on the planning commission to do it your way. And with that, uh, do we have a motion to vote on this? Okay. I move to approve the final site plan for PC-25-010 known by the project name Aldi number based

on a finding that the applicant's site plan meets the requirements to section 12.10 10 of the zoning ordinance to be eligible for for final site plan approval and conditioned upon position the submission of a development agreement to the township by applicant within 30 days of this approval. In addition, the following must be submitted for the applicant to a fine to obtain final site plan approval. One applicant providing the information required by the township zoning ordinance as set forth in the reports submitted by the township consultants, the township fire department, and the township administration. And two, applicants submittal of the revised plans addressing addressing stated deficiencies and reports submitted by township consultants, the township fire department, and township administration. I'll second. >> Okay, we have a second. Let's have a roll call vote. >> Blankenship, >>

yes. >> Dur. >> Yes. >> Austin, >> yes. >> Wagner, >> yes. >> Turner, >> yes. >> Motion passed. >> Okay, with that, we will move on to uh Ordinance Review Committee have a report really. >> Yeah, go ahead. Uh so yes, so the or met in their normal February meeting um obviously in preparation for some of the public hearing information that you had tonight related to those ordinances and then kind of looking at um the rest of what our calendar year would be which is around August um different projects that we want to finish out with the budget left at hand and then starting to consider what projects would be a part of the 26 27 uh work plan. So with that, we're just kind of rounding out the u the end of our

work plan for this calendar year and we'll be submitting a new work plan and budget to the board probably sometime in June or July. >> Right. Moving on. Item 13, the annual gravel report. Do we have anyone here that went on that tour? >> I did. You already reported out on that. >> Okay. So, we're all set there. >> Y. >> And then, uh, number 14. >> You have anything more? >> Any more? Um, I think Matteo forgot to put it in the packet. >> I'm sorry. >> No, it's if you go online, it it's there is one in there. Oh, >> two pages. >> So, I'm not sorry. >> Sorry. engineering report of you know projects that are happening in the community should be in your packet just questions here I am >> good

>> okay >> all right thank you >> what I got one is uh is there a reason why there's cones still out in the safety pass >> yeah because they didn't pick them up last fall because they got caught by the snow >> and there still is a little bit they have to do the restoration work which will be coming up but the full reason why there's cones there because they got caught by the winner and didn't pick them up. >> All right. >> I just thought they were free cones. I just thought they were free cones. So, >> we wanted everybody to know where we were. >> Anything else? >> Okay. Thank you. >> All right. I think that concludes our agenda. We have somebody >> motion to adjurnn. >> I'll second. >> We

have a motion. I'll second. >> We have a second. >> All in favor? >> I motion passed.
