002the motion is approved Mr superintendent Dr SW yes sir thank you chairman hunt members of the board always good to see everyone uh just have some great updates to share with the board it's been a busy several weeks since we last met a lot of exciting things happening uh some of the most favorite things that I get to do with my job and you'll see in the updates here uh what you'll see here is agriculture day today at Freedom High School in East Burke um our local fifth graders were able to go to our um eastberg high school and Freedom High School and do tours and do Stations of the Agricultural FFA program over at freedom and eastburg high school our two high schools that have that program as you'll see in the slides uh

003just we had several staff members that participated as well um that brought animals their own livestock that they have and talk to the students about possible career um within the uh agriculture business as well um also um it was my pleasure to be a judge for the student ber County public school art show uh always a very fun experience to go over to the comma and see the artwork displayed by our local County students we've got some budding artists in our hands uh as you'll see I'm pictured here with three of our fantastic art teachers here across the county as well um and I I one of the quotes that I gave the newspaper the other day when I look at a piece of art it it may not make any sense to anyone but

004it made sense to me at the time so that's why I I selected that piece of art so uh there again one of the best parts of the job is to be able to go out and experience things like that and see folks um also as you'll see um we have Mr Gutierrez a Burke County Public School teacher of the year we'll recognize him at our April staff or our April board meeting and we'll hand him keys to a new car um yeah so we we're still continuing to do that uh that thanks to this uh partnership that we have with um Paramount Ford and VES um so once again great partnership there m Mr Gutierrez has been with Burke County public schools for over 25 years a phenomenal educator uh and to see the

005work that he does on a regular basis going into his classrooms uh he's one of our English language learners teachers um over at Freedom High School specifically uh and just to see the engagement that he does uh with those students is amazing uh so we just want to congratulate Mr Gutierrez on his recognition also I'd be remiss if I did not congratulate the lady Cavs on their uh Victory Run to the state championship it was a I was able to make it to one of the games a phenomenal um phenomenal attendance by our folks here in Burke County not just an Eastern uh and they were representing the entire Burke County um so it was great to uh to head down to Greensboro and cheer on the girls they they did a phenomenal job coach

006Bartlett and the girls just they amazing I looking forward to seeing them again there next year also last Saturday we had our Battle of the books Elementary at Patton high school and this is our winning team uh Maul Elementary School they they've figured out the special sauce over in our elementary land um when it comes to the bow of the books they they've got it going on I want want to say this is probably their third or fourth year uh winning Battle of the books so uh kudos to Maul Elementary School and also our Middle School Battle of the books team um there again this is our Liberty Middle School um uh Mrs hirs is the media coordinator over there so she does a phenomenal job with her Battle of the books as well uh

007and battle of the books is is a program that gets tries to engage our readers um and they they select certain books um that are given to them through the company um so there again it's it kind of gives those students that opportunity to kind of recite not everyone is an athlete not everyone is a construction person so this gives our students another Outlet to do rather than sport sometimes and speaking of construction Rodeo um our local high schools participated in a construction Rodeo over on the campus of Western peont Community College in their new industrial trade center um so that's a phenomenal facility that is our partnership with with Burke County public schools in Western Pont it gives our students the opportunity to go over so in this construction competition you you see the

008student in the top right he's framing in a window so they have a certain amount of time to frame in that window and they're they're being judged uh we had an overall winning team at Freedom High School and this is school systems from we had Kataba County I believe mcdal County had some schools there and then all four of our Traditional High Schools were there as well as um how Burton and I believe I saw the school for the deaf over there as well participating so uh once again our Educators do a phenomenal job they're again another pathway um to to get credentials for our students that we're very excited about all right read Across America we had several folks participate in read Across America uh Dr Seuss day uh it's always a fun time

009for folks to get out there and read um certain books I I always have my favorite books that I like to get out and read to the students here here again you'll see some some folks um out there reading to the schools also Dr Melanie Honeycut as I mentioned last week um she was recognized by the state as the North Carolina Tech director of the year so congratulations Dr Honeycut uh once again we gave you an Applause uh where are you um so here again Melanie has done a phenomenal job within Burke County Public Schools uh she is going to take a lot of knowledge with her when she retires in October um so there again we're we're very fortunate to have Melanie as honory um receiving the tech director of the Year award also

010I wanted to give the board some facility updates as you'll see here uh R shers restroom and concession stand um I I I will say to the board I was one of the first staff members at Ray chers I helped open up the campus back in 19 1999 when it was the very first fifth grade classroom and to see the improvements that they've done down there with the field uh the concession stand uh it's it's great to see the school and the community all come together for these types of projects also some good news on the Chesterfield property uh Dogwood um we've got an upcoming meeting with Dogwood a face Toof face a facility meeting coming up with Dogwood they've given us extra grant money to continue a deeper dive in our feasibility study um

011so they've got some real interest in partnering with Berke County Public Schools and seeing our project for Teacher housing if you if you recall in the newspaper I believe it was last Thursday or Friday um County Manager Epley was talking about the housing crisis in Burke County and what it takes to um to afford A3 to $400,000 house and that our Educators just don't have that um and and that's just this is another project that'll hopefully down the road help benefit our educ ators as well as benefit our First Responders as well that are coming in at that lower salary range um so we're very hopeful with this project that we'll get 33 units uh at Chesterfield elementary school so I'll continue to keep the board updated on that also wanted to give the board

012a uh book challenge update we have five titles that you'll see in front of you uh Perfect Chemistry America elor and park more happy than not in a Clash of Kings um and you'll see the challenge form date that was submitted to us we're currently working on um Perfect Chemistry at this time uh so once that book gets completed and the results get expressed to the um Challenger then they'll move on to the next um next in line which I believe would be America by ER Frank so um currently there again board we have five books that are currently being challenged you want to make mention of the table yes in the back um as as folks as our visitors come in there are there's a list our book policy on if anyone wants the

013challenge and there's actually the current list of books that already have been removed from our media centers uh on the back table as well and we'll continue to do that every meeting yes sir so folks that come in have reliable and updated information that is correct Dr Swan sorry I've got a um quick question I just want to make sure I understand what was on the clash of the Kings by George Martin yes what we're saying is that it was challenged previously correct it was removed but we've gotten another challenge that's that's what I understand Dr Honeycut could you speak to that yes so it was challenged in October and was taken off the shelf it is on the list of the ones that were removed um she sent they sent another challenge in I

014have informed them that this was already off of the sh and I'm hoping that will be the last for that part but I did inform the person that sent this that we didn't have it on four four books now it sounds like yes so that one's not we're not going to challenge that one because it's already make sure that we weren't trying to you know pull into another no impact or whatever put it through the process because it's already been correct yes so these These are books that were removed Dr honey cut and there are still challenges no ma'am the the books that you see up here miss sovich they they are being challenged at this point they're still um in the libraries right now okay in circulation yes Dr Swan can ma'am step back

015just a minute to the Chesterfield property yes do you have any timeline that we're looking at on this that you can give us so so we're meeting with Fern mckisic with mckisic Brothers um I believe Wednesday yes Wednesday at 11 10 or 11:00 in the morning and just go over some things that he wants to do a deeper dive into for example tax credits um that that we feel that we'll qualify for based on the historical aspect of the building uh that's what some more digging that Dogwood wants to do so I'm going to say we should have from Dogwood we should have within six to8 months I hope something to move us forward um and and we're meeting with um they're coming down to Chesterfield as well and doing a walk Walkabout of the

016property as well so it's six to eight months before there's a whole there's much movement yes yes the the grant Cycles um they do take time to go through all the process uh there again we had the we did the initial groundwork the feasibility study the initial feasibility study they said yes it is a viable option for Teacher housing or first responder housing uh we could get 31 units roughly in there one in two bedroom units um so now it's the next stages of the funding stream here again this is a dogwood funded project but still they want to do their due diligence and make sure that they get all their tax funding uh any and available tax credits that they would qualify for as well I think we were all just hoping it would

017move faster than this yep I agree I agree and there again that's a talking point that Mr Recker makes when he he goes and talks to our young teachers at career Affairs and he's been hitting the pavement hot and heavy over the last several weeks across different parts of the state um he's got one of the toughest jobs here I would agree mhm thank you than you and I'd also like to draw attention to here again we're not unlike any other system across the state or what I'd say the country uh we still need bus drivers uh we've gotten better um by the the uh the nice raise that uh our bus drivers have gotten and some of the the benefits that they've gotten over the years and actually just the I guess the education

018about what you can do to your retirement uh if you drive a bus and how that will impact your retirement over 30 years uh that has allowed us to to help offset some of the shortfalls but we will be having a bus driver class over at our Burke County central office over on East Parker Road April 22nd through the 24th um please if you're interested sign up um we'd love to see you there I I'd take time we go in and have a conversation what I like to when I see that a lot of the bus drivers I know them from the community or their teachers that decided to go back so it's always refreshing to go in and see uh some some bus drivers are going to drive again for us so all right

019chairman hunt those are my updates all right thank you any other questions or comments for one thank one Mr Lawson if you could come forward by the microphone sir and talk to us about the utilization you want to sit down or stand up good evening chairman hunt members of the board uh let me get this up on your screen okay I appreciate appreciate the opportunity to give you an update this evening on ner uh which is Elementary secondary schools emergency relief funding or otherwise known as covid money uh Burke County public schools has been granted over the course of the last four years uh$ 45.5 million and erra funds uh we to this point have expended 45.4 rating us I know I've I've uh informed you in previous meetings that we ranked second in the

020state unfortunately I come to you tonight to inform you we rank third in the state now in Esser utilization just behind Mitchell and Cleveland counties uh in order to protect my colleagues uh all the Cy that fell below Burke County I've erased uh their identities but out of5 school systems in the state of North Carolina we rank third uh we have a remain remaining 100 thank [Music] you I certainly can't uh can't take credit uh for that but I'll share with you uh the folks involved intimately with that momentarily um out of those 115 school systems public schools in North Carolina received six uh 6.2 billion in federal funding still remaining is $667 million unspent you have districts as you can see on this very last line that still have this one 16.8 the county

021just above 57.8 million not spent uh and they have until September 30 to spend those funds so I anticipate a substantial sum of money going back to the state I don't know what and how that will be managed or handled if that'll be reverted back to the federal government if there could be yet another round of funding back to the school systems that's a possibility on this slide what we have are the various program report codes as you can see on the first line I've highlighted summer learning program that's PRC or program report code 121 each of these report codes each of these 60 have their own purpose their own chart of accounts and the way that was managed you can see we've expended ours you see all the balances is that the person responsible

022for execution of the budget was first determined by the team if it was technology for instance it'd be Dr Honeycut secondary Ed be Miss Jennings Etc nurses of course Miss Michaels uh next a budget would be developed uh often with the team approach often with the leadership team uh involved and then Dr Alton for each of these 60 different pots of money Dr Alton would in turn write a narrative that would be submitted to DPI for their approval they would have to approve next Miss Michelle Meers would have to using our accounting Ledger codes submit monetarily by line item a budget that matched Dr Alton's narrative for its approval after that process is completed our recently retired Miss Kim deal did a phenomenal job she would keep the records she would monitor manage all the

023allowable expenditures by whoever was assigned to manage the budget and would submit to the DPI quarterly reports and maintain all records for our external audits so there's the folks responsible for putting us in the position of third be Dr Alton primarily Miss steal and Miss Myers next we have a report here which is our expenditures by object code which identifies more specifically how the money was spent for instance you can see on this line uh this was spent for nurses uh one area that we in Burke County were very very cautious and very careful approaching was not to encumber funds that were recurring we all knew that there was an end to these funds they were date sensitive uh so we were very careful to plan accordingly I I was let me ask you something

024real quick on that um there were several districts in the state that didn't do that am I not correct well there were so many districts in the state that didn't operate that way that DPI has a team that's designated and they're making their way around the state as a matter of fact we hosted region 7's meeting here that are managing What's called the erer funding Cliff at the meeting that we attended here that was for our region the eser team DPI team actually recognized Us in the meeting for one our efficiency in utilizing the funds and two for our foresight and diligence and not dedicating those resources to recurring expenditures so I'm happy to say Burke County Public Schools unlike a lot of districts in the state we're not facing that funding to live I

025know a couple of Finance officers that had left have left their districts and went to other districts because they were in the position not necessarily of their choosing but were put in the position and now have numerous positions unfunded they've gone to count County commissions who were saying you know you didn't plan carefully uh and uh diligently and and wisely we're not going to fund it uh uh there are a lot of counties in in a bad situation for for next year when it comes to budgets and I'm happy Burke County Public Schools is for you for that too because you you kept us honest yes you can see we spent 1.6 million on nurses uh that was to provide during particularly the height of Co a nurse in every school an additional $462,000 on

026ecaas and 10 on1 that's exceptional children 316,000 on attendance counselors retention and incentive bonuses 4.5 million certified bonus learning recovery and letters bonuses that all the elementary teachers are required to take over was it a 3year period two last year two-year period learning recovery of course 3.1 million on employer matching benefits that would be Social Security and retirement uh speech language engagement coordinators and nurses those are contract ed services which are all set to expire September 30 2024 exceptional children psychologist uh supplies and materials early on was spent primarily on PPE uh and then later uh for remote learning and then gravitated into uh air quality devices for the schools another 3 million on remote and learning recovery software 14 million again on air quality improvement projects 3.4 million on replacement of the devices that

027came in several different program codes that was for replacement devices to have more robust uh uh devices for students and staff in order to accommodate remote learning another almost 700,000 primary on air quality improvement projects and as I mentioned just a moment ago in response to you Mr Hunt uh we're not facing the SR funding Cliff that others are we do still have uh some positions to reduce but we have a plan for that and we plan for that as you can see right here these two lines called indirect cost restricted and unrestricted this these this is what we are able to charge the various program codes for our Administration and management of so we take that money and we build these erer codes we set it aside in another fund and then we're funding

028our nurses until we get back to our Target of 18 we're currently at 23 we have four of those set to expire September 30 then we have another retirement which will put us at our Target Two engagement coordinators one will continue to pay from this funding source Burke Council on alcoholism and contracted services for security assessments that's what resulted uh we had a a former retired Burke County Sheriff's department officer who has assessed over the course of uh I don't know the last year year and a half two two years uh that's led to things like additional cameras for the schools uh uh the the bulletproof or protective uh 3M coatings on glass surfaces and things of that nature so we have $3.5 million that's set aside that'll continue to fund some of these things

029until we're back to our normal operational levels uh that'll conclude my presentation I'm certainly more than happy to answer any questions uh you may have um what is your projection of um between now and the end of September will we utilize close to or every penny that we've been we'll utilize 100% the the $147,000 we have remaining is for math enrichment in summer school so we'll utilize those over the course of the summer so we'll get that to zero and then these continued efforts that I just went through we'll continue to fund those with the $3.5 million it's been set aside from essr funding right uh until we're back to normal operational levels in those areas okay thank you for the nursing tell me the nursing numbers again you said there were like 23 and

030we dropped to 18 at the height of covid we were at 26 plus we contracted services to a ify and Report covid statistics and all of all which Miranda Michaels Miss Michaels managed so at the height of Co we were at 26 we're currently at 23 we have four that were hired with knowing their expiration was September 30 of next year so that puts us at 19 and we have a retirement which puts us at 18 so next year we'll be back to our Target of 18 nurses we those additional four I mean are we losing those four are those nursing positions we need to maintain well uh a person could make the argument we need a nurse at every school ideally in in the perfect world we'd have one at every school unfortunately we

031don't have the financial resources to support that I will say at a level of 18 nurses preco we were at 15 so 18 nurses does result in a much lower ratio of nurse to student than recommended by the state the state recommends at least 1 to 750 they they also U Mr him Street Dr H Street they also uh have i' I've seen their reports to the legislators it's ideally they'd love to have the funding to provide us for a nurse for every school but that's just not the reality but so we stay at the 1 to 750 ratio with 18 nurses and our our ADM we're well below the 1 to 750 thank you did you say that one was retiring yes okay so we could possibly keep one of the teachers I mean

032one of the um nurses after the co money I think after the after the retirement and uh so we're at 23 we have four set to expire which takes us to 19 we have have uh or after the four covid expire that's 19 we have one retiring that puts us at our Target of 18 then I think later in the year there's another retirement or at the end of next year okay and then miss Michaels will actually although we're substantially over our Mark right at this moment uh in the next budget cycle we'll actually be posting a position for a Nur okay and this eser money ends September 30th of 24 yes ma'am September 30th of 24 again the only thing we have remaining is math enrichment and summer school funds 147,000 we'll support the

033other efforts through September 30 uh with the indirect cost that we've collected thank you yes what is our current ADM right under 12, 11,6 rough estim our total bodies yeah 11,6 116 thank you what is our cost for student State reimbursement no seven oh my I'm sorry I don't have these answers just close ready I I'm I'm thinking to hold me to this but I think our 13th month which is what it's called from DPI uh per pupil expenditures was $9,600 if I'm not mistaken but don't hold you to it don't hold me to you where' you come up with that yes sir okay any uh anything else from won doc there is a bill going around from my understanding they're trying to get more legislative support to have a nurse in every school um

034but it's going to take that type of action to get it get us there but it's going to take that's a legisl correct Financial Financial impact is the biggest thing once again please tell your team that we greatly appreciate all the work uh from their fearless leader and also the team you guys do an incredible job all of your people do thank you very phenomenal job I will be certain to pass that along thank you please absolutely thank you Miss law thank you thank you much Mr recer thank you discuss EAP and the Personnel report and requested action I appreciate Mr LW and I hear the conversations that are going on in the region and the state with that funding cliff and that's not fun I wanted to share a little bit of updated information

035in regards to our EAP and go through um a quick review of what we looked at at our last meeting then look at the results from the survey that we pushed out to all of our staff members so this is what we looked at at our last meeting two things that I really wanted to point out was since 201819 when we signed a contract with my group we have had 153 employees or a combination of employees and their children or who whoever is on their insurance reach out and utilize the services with our EAP and again that goes back to the 2018 2019 school year the second thing that stands out to me is that when we look at that middle section of our information by quarter from last year we can look and see

036that our numbers for folks that are on our our employees insurance those numbers go from 331 to zero throughout the year but our numbers increase as we go from um the first to fourth quarter from 16 and then we end up at 25 to finish out the year in December I highlighted in yellow some some of our higher numbers that stood out to me when I was looking at what was the impact of the potential problems that our employees were being seen for when they do contact my group um you can see there the highest consistently is are folks denying impact and when I asked the rep why that is he said really we could speculate all day long but there are a number of different answers either they just don't want take time to

037do that part of the survey they just don't care to share or they don't feel like the problems that they're experienced that they've called in for are having a direct impact at that time the second one would be pres ISM so that's folks capacity to operate at their highest level because of the problems that they're seen at the time it has diminished their workload and they're not able to work at that high capacity and and then the proe preventative side of it you can see that that's a straight two all the way across okay so the primary presenting problems this this surprised me a little bit with these results so our highest if we start down towards the bottom you're going to look at personal stress and this was a question that came up last

038time when we looked at stress everything was combined into one we really didn't delineate where was that stress coming from so we can see that it does come from from um primarily that personal stress that comes from the um the home and then relationship relationship concerns that come up um hypothetically that could be divorce separation and then the surprise that I I thought we would see a little bit different change in the numbers was going to be that workplace rest so I was pleasantly surprised to see that that was one two two and two across the board so I see that as POS Any teacher working conditions so staff survey results as we start to get into this I really want to do a good job of explaining that when folks call in our employees

039call in they really call into the my group and I see that as 911 dispatch they call in and that's where that Advocate speaks to them and they get that first initial intake of information of what's going on and then they take that and match that up with that next step which would be the clinicians so again our folks call in at the 91 911 Center The Advocate with my group they have that first initial intake and then it moves on to the clinicians so we subcontract with my group my group subcontracts with the clinicians that work together I hope that makes sense so with that said when we look at some of the information that we re that was returned in our survey 84% of folks that have sought Services through my group were

040our actual employees 16% were immediate family members of our employee when we look at years that they had reached out 4% in 2018 19 of course that was when we first initiated that contract with my group 1920 of the respondes we had zero and then you can see that going down to 2223 we had a spike and of course we know that that's when we were coming out of covid and then this past year we're looking at 28% so how were counseling sessions held and they offer many different Avenues aspir as that goes 6 % of our folks prefer face to face 14% were through the phone of a phone call and 26 was through either Zoom or Google meet we looking at the number of sessions that utilized 29% of our folks utilized at

041least um three sessions 53% continued that so with B count public schools and the contract we have with my group we offer three free initial sessions per problem that comes up with that said 53% of folks continue those sessions um after their first three were free 12% they sought their own provider so they didn't even bother going to my group they had um somebody either recommended or they sought out their own Services privately and then 6% made that first initial phone call but they did not continue any Services beyond that and then as far as how many problems folks saw 88% call for one problem one problem only and then 12% called for at least two problems so when we look at my group this was feedback specific to my group how satisfied were folks

042so 39% were satisfied with their first initial intake experience that's that first initial phone call that they make and they speak to that Advocate on the phone where they have um they fill out that survey with intake 30 39% very satisfied six satisfied 11 neutral 22 were unsatisfied and 22 very unsatisfied how would you rate communication between yourself and my group 33% very satisfied 177% neutral 177% unsatisfied and 33 very unsatisfied I was satisfied with your overall experience with interactions with my group very similar to communication and then after contacting my group how quickly were you contacted by the clinician 56% said within that first week they um may contact most of those were within 24 hours so that that was good to hear 31% were within 2 weeks 6% within a few months and

043then one responding said I've reached out multiple times and I still haven't heard back so I took this information and we'll we'll move on and look at our clinician data in a moment but I spoke to um the representative for my group that we work with and he was very informed I said hey within reason I shared him what these numbers were and I said help help me understand how do you interpret this and he said well first I I want to know why folks are not receiving phone calls back when they're reaching out and I said well that's question I have as well he said what I can tell you this Keith is we have policy and when they're folks don't follow policy there's repercussions for that I said I understand that but how

044do I know when that happens how do you know when that happens what feedback are you getting he said well we do do a pre-intake survey after that first initial contact phone call and then we do a post once folks finish services with my group said okay what are those post results showing you he said that's the thing once people finish services with my group they are not taking time to give us the feedback so we know what's going on I said okay so I'm giving you that feedback how can we work together so I have a plan for that so this is in regards to the clinicians so the clinicians work for um somebody such as ACA Focus behavioral um it could be in Hickory it could be in morgon it could be as

045far as Charlotte if they want to do um telecommunications so same questions were asked as far as Communications goes with the clinicians 53% very satisfied six satisfied 12 neutral six unsatisfied and 33 very unsatisfied that very unsatisfied column you'll see consistency of that same 33% I hate to speculate but I would assume it's probably the same individual or individuals how satisfied were you with the overall experience to the from the assign clinician very similar how many sessions did you utilize 50% 1 8% 2 46% 3 and then 31% stayed with that same clinician and then how do you feel the concerns were met 50% said yes 31% said no my concerns were not met and 19 at times they did I'm not going to read through all these you do have this in your board

046packet for review um this was very eye opening and enlightening to me um it tells me that our folks generally appreciate that this is afforded to them and they can call when they have some level of need that that's positive my takeaways from areas of improvement one of the big things was making sure that folks are being matched up our employees are being matched up with a counselor that can help best serve them in their needs so this was good feedback that within reason I shared with Greg Hunt who is that go-to and uh he said I appreciate you doing that he said I appreciate the fact that you're taking time to dig into this and give us some good quality feedback so we can improve how we move forward and not pick up phone

047to call me say Hey listen because there's some frustration um from some of our folks we're going to seize our contract with you at this time so he was very appreciative of that so as I stated the AP really serves as that 911 intake Center that dis Dispatch Center they then send those folks out to the clinicians um spoke to the policy said Keith it should not take more than 48 hours for a clinician to get in contact with one of your employees he said if that is taking place I folks are directed to call back into the advocate at my group and pick up that line of communication again so folks are held accountable so on the 10th of April my group is going to remote in in this room with all of our

048administrators and they're going to do a professional development and all the offerings that my group does have for our folks because I do generally believe we need to continue the heartbeat of our EAP and what it offers and we need to do we need to increase that sounding board and that marketing of that throughout our County that is one thing that was noted in um AAS of improvement continuing to let folks know what is afforded to them I share this in our monthly HR meeting our monthly HR newsletter that goes out to all of our folks um Greg mentioned a release form so that he can dig into areas when concerns come up he said other than that legally I can't do that Keith and I said I understand that I said help me process

049how we let folks know that if we want to go that route we can without sabotaging what the EAP offers he said yeah that's fine he said I think we can do that through our administrators that's what one of our communication points is going to be on the 10 and what that process looks like for our employees when concerns arise so that we can give the best to our folks and then finally I think the survey that we sent out gave us some great information I believe we need to continue that we plan to do that each semester so that we can continue to watch these numbers and hopefully see areas that we want to increase do so and drop in those other areas that we'd like to see as well that that is my

050presentation and updated numbers for our EAP I welcome any questions maybe this ought to be afforded to school boards yes sir is this well we're employees yeah we're employees some of that stuff sound pretty good maybe you don't think about expanding I probably should have said that but I it's been a good program and for what we pay you look at any anything that we can head off at the at the P from getting worse and growing legs um within an employee um it it helps it helps that's the unknown part you really will never know you know how how much this program has kept M um or or lessened your recidivism y um but so that's why you know like high utilization numbers never really concern me I mean I've been in many ways

051is I think that's a good thing I think you as right questions I'm glad you're on top of it asking those questions that's principales call the time or they'll they'll reach out to Miss Jennings and Dr Wilson and then we'll wrap our heads around how best to support and move forward with a game plan and one thing that we always include is the AP make sure that we're offering that to our folks because often times it stress is high and and there's other priorities going on in life the last thing we think about is the APAP that my employer provides Keith have questions comments Keith these numbers like the very unsatisfied in the staff survey results um you're going to I know you're going to you said you're going to continue working on these we'll

052track those yes ma'am and will you do you plan to report back to us at a particular time regarding your results as they go along yes ma'am my thought right now is before students leave in June that we push the survey back out very similar we'll make some changes okay so that we can start to track that data of course we'll do so again in December the these I mean we've got a lot of very satisfactory and satisfied people but the very unsatisfied are very concerning to me and I'd like to see those numbers go down y i I read the one comment and I just think you know that that was myself or one of our family members so I I agree well you know you just you don't know what's going on in

055our policy 2310 do you have any where are we right now on this policy we there's been so much said are we 3 minutes are we have 5 minutes plus an hour what where so the original policy had 5 minutes for 30 uh a total of 30 we um proposed a change of three minutes for up to 1 hour but the policy that's in effect right now is 5 minutes for a total of 30 minutes 30 correct so that still stands the 5 minutes for 30 minutes so that's what stands now right you know one of my concerns yet again is trying to plan for an unknown number of speakers that you're going to have on a regular meeting night you got know to gauged at policy allows us to and and Johnson has uh

056done a pretty good job in in in um um in the manner that he's had an opportunity to of of of um of um having spokesman for um same issue speakers and that still is is trying to like U heard cats at the last minute when you have a cut off um say at 6:00 p.m. for for speakers and Jane it was one is either the city or the county that had a cut off time to sign up of noon of the day of the meeting which one was that that was um the city council has a noon cut off that if you want to speak at the meeting that night you have to have an um the information to them by noon okay anybody else want to chime in I think that's a good

057idea you know know it gives you you know we come in here and all of a sudden you know we're having to make a decision on that it certainly gives people an ample time to think about it and do and it gives the board a little heads up exactly what's coming but you know when we come in here and sudden we look out here and we got a room full we want people to be heard but uh I think that that that's certainly something we ought to consider there's a cut off date before the meeting in which people can speak and I think that's a good idea what do yall think I don't agree I think that if how we have it sign up sheet people coming off of work things going on they may

058have forgot to sign up it's it's one day that we do public comment uh well they have several days that they can sign up and that's fine I don't see what the issue is with having a sign up sheet at the door why break precedents I think makes it a little easier on the board if they can see helps it to flow a little bit easier it's not you're not denying anybody the right to speak it just kind of lets the board get a little bit of form on what they're up against well it also it also lends I mean whether this room has to be full of chairs I mean tonight we had it full of chairs and we have a handful of people and before even our staff has had to stand out

059in the hallway because there hasn't been enough room for them to sit in here and the staff are here because there are things going on that they want to be aware of as well so I think if we have a cut off of noon as you suggested I think that that's fair I think a cut off they have several days to sign up to speak it's the way it's been in the past I mean you've got several days to sign up have a cut off at noon and take the list from there and then the room can be set up in a manner that it needs to be set up and I and I read on one of them if you can't get in that time you can speak the next time it's not denying

061the convenience of me I'm here to serve others and as far as the rules in them coming to speak on the back of this wall says Berke County this is Berke County's house that's what I believe and that's who should be able to come in and speak and I agree with what Tiana said that's who should come in speak not people from outside bur County and I don't know if that was your intention but um if you don't live pay taxes in this County you don't need to come up here and lambast us and there's been articles in the paper about it I've had people come to me privately and say things about it and um I just think that that might be need to go in our policy we might want to think about

062that and and I do philosophically I think I agree with you bottom line is from what I read from the College of government Mr Campbell that's probably unconstitutional the general statute talks about rules of deorum and procedure in the school of government uh one of the professors has given an opinion that trying to limit public comment taxpayers would be unconstitutional that's correct well and how would we police that would everyone who comes in have to furnish their ID to show that are a resident of bur County I'm not interested in doing that no I'm just asking how will we even police that I don't know and then you've got things to consider if you got somebody in here that maybe is not a resident of Brook County and by the way of transfer they got

063a child and one of our schools had do you square that I mean so you got all these different iterations that that's where I just go back to I really think and we've been talking about this two or three times already I think we're trying to we're trying to Corral something that you can't really Corral because first of all you don't know how many people are going to come so you're you know I think that's kind of the first fatal flaw you know um I like the policy the way it is I mean the policy allows you to change things up based on the situation at night we've done that we've extended times we you know so you're saying stick with the 5 minutes for 30 minutes well we I think the last thing we

066meetings and so they decided that they would not have recorded um the public comments that they would turn the camera off that's just some of the input I've gotten from people when I've spoken with them I think lesie makes a good point U I think that is I think here and you make a good point if we decide we want to go with that we've got staff that have been here all day and and to have people sit through an hour of situations that just is between the board and decisions that'll be made I think you know if we decide we want to go with that let them sign when they come in but I do think that needs to be you know at the end let our people go let them get home because

071it's a policy that we hope we never have to use but the realities of what our schools face and and knowing what our neighboring Counties have faced we felt like this was an important policy to bring before the board and have the Naran in our schools so if there's any discussion or questions I know we also have um a representative tonight from the Burke County Health Department um that's also here and we'll be happy to answer questions as well gamble do you wish to be heard on this just some additional information right now there's a standing order in the state of North Carolina which allows schools through Health departments to obtain Naran that standing order involves immunity also the general statute on allowing certain School Personnel to provide medical assistance to students also has immunity

072in it and I think the intent is that um trained medical personnel would be the ones to administer um rather than School Employees so I think that's the intent and some schools have adopted this as well out of a concern that a student may be in need of Naran because they're exposed to a drug and they they don't even know they're exposed to it that it it is now present in the schools in society so it's a concern that um regardless of how things may get there they could be anywhere in society right now so it's not just drug users it's also a concern that students may accidentally um be exposed or St we don't have a nurse at every or staff excuse me if we don't have a nurse at every school who administers

073it there not a nurse at this school The Who administers which is the Emergency Response Team at each school so it would be some staff members that would be trained in addition to the nurse because that stuff needs to be given pretty quick that's not a wait on somebody to come down road is this a self ejection prefill self injection not a self injection but do you want to speak to that Miranda it's a a nasal spray it's it's a spray yes okay so an excellent idea believe unfortunately right other questions comments um what are you requesting with this so I'd like to bring this back for a second reading at our next meeting um and then hopefully get consent to put this into policy very good any objection all right very good thank you

074thank you okay the next item on the agenda is um the board member issue is indicated with I believe there were two complaints against um Board of Education member sahovic that we had um um directed Mr Campbell and his Law Firm to inquire and come back and present us uh for action or not tonight um his results so how we're going to do this Mr Campbell would be passing out his this hard copy where we'll take a few moments and read it as long as long as you need um and then the board will full board will have the opportunity to ask um Mr Campbell any questions uh that he may wish uh to to have answered so Mr chairman let me if I could just review the order let me finish the order oh

075sorry two more quick things and then after that depending upon before there's any discussion there will need to be some sort of motion on the table if there's no motion on the table then we're moving on to other things so that's the process tonight so Mr C very good so Mr chairman just briefly for the board's benefit um the the report is divided into several sections first of all the factual allegations is the first section followed by the response from Miss sovich then there is a section on factual conclusions and then applying those factual conclusions to board policies and to Legal considerations so uh my suggestion is that the uh chair do declare a recess for a brief period of time to allow you board members to read uh the report after which we can

076uh discuss the particulars in it just briefly though before you begin the factual allegations you're reviewing tonight are uh put forward that mahovich was at the senior center in morgon and she was passing out sample ballots while wearing a school district name badge shirt and jacket uh that citizens stated to her that she was violating board policies and she quote responded with very inappropriate words according to that citizen the complaints go on to say that uh she was at the polling place working for specific candidates and that she was telling voters who to vote for um and informing them that she works for bur County schools and that she proceeded to use her office for political gain the complaints also involve an allegation uh that she used inappropriate disrespectful profanity language in a community meeting

077um at which other people were present so those are the basic allegations and again you've got the document in front of you to read after which I'll be happy to to answer any questions but I would recommend a recess to allow you board members to read the report all right very good and we shall shall be in recess if any of you would like to take up a few moments break we'll still stay up here and review what we need to review we'll be back in order shortly e thank you Mr chairman so board members you've had an opportunity uh to review the report at this point I think uh in the order of procedure set out by the chair I'll be happy to entertain any questions about the report itself could you say that

078again please I just at this point I'd be to answer any questions about the actual report I thought okay I do have a comment Mr campel um in page four under three factual conclusions number four listed there under a it said when confronted by Mr Tim buff about possible policy violations she used language considered inappropriate by Mr buff Mr buff and I never had a conversation okay regarding that and so for the record the only conversations I ever had with Mr buff were at the breakfast uh the Republican breakfast those are the only conversations in the last month or so that I've had with him I have not talked with him about policies at all okay and two Poss just for the record two possibilities there one is just um my uh I was incorrect

079when he said in his complaint about that that he was talking about policies he may have been referring to the breakfast and it may not have been about policies it may have been about the breakfast okay so yeah I don't consider that to be material but thank you for clarifying okay the only other um when I was campaigning at the senior center yes I was doing it for Seth and Wendy and Susan who were running for the three seats but I also was um promoting the County Commissioners okay certain candidates for County Commissioners as well uh yes the three County Commissioners Jeff Brittain Johnny Carswell and Scott Moy I was also campaign for them as well okay on their behalf any other questions Mr Campbell we have a complaint from the precinct um I guess

080manager judge what judge that was there there was no I I am not aware of any complaint whatsoever about a violation of election law by anyone correct there's a certain place that candidates are permitted to stand and campaign for themselves or others and there was never any information submitted that anybody violated any of the polling place regulations Mr Campbell um in regards to like page six at the top I know we kind of It kind of goes through um the code of ethics and the specific um comments and how it applies to policy 2120 correct correct um did you evaluate point 4 2120 B4 about modeling civility integrity and it says to students and all elements of the community let me pull it up so I policy 2120 which is the board code of ethics

081subsection B is specific board member commitments and again as we discussed in the previous meeting these are commitments to standards they're not uh statutory requirements B4 says to model Civility and integrity to students employees and all elements of the community by by encouraging the free expression of opinion by all board members engaging in respectful dialogue with fellow board members on matters being considered by the board and by complying with board policies that set out expectations for conduct regardless of whether the policies expressly require compliance by board members So reading that specifically again that is considered to be official conduct of board members and board meetings and engaging in dialogue with board meetings and complying with board policies regarding specific conduct so it doesn't necess necessarily apply to the behavior of board members at the grocery

082store is the easiest way to describe that the the code of ethics does relate back to your official actions not your individual actions as private citizens so you mean like only when we're meet our meeting is called to order or you're in some capacity uh meeting as a board and acting as a board correct with the Quorum with a quorum yes certainly with a quorum it applies completely yes yeah and if you were to be visiting a school as a board member I mean something that has a Nexus to your role as a board member and not as a private [Music] citizen any other questions to Kim all righty in order to have discussion there needs to be a proper motion and second so at this time what's the pleasure of the board for what

083are we trying to decide here the matter of censure that's the issue censure yes so we need to make that motion needs to be put on the floor before we can discuss second and yes before we can before there's discussion could we get a definition of censure you certainly can a censure is a formal expression of disapproval is what a censor is and a censor has to relate to some relationship to the position some Nexus to the position so but it's simply a formal statement of disagreement or disapproval is a better word of the conduct of a board member uh it does not implicate the First Amendment because it's not a disciplinary action uh went over what the law is in North Carolina as far as board member uh removal at the last meeting uh

084so it would not be a violation of anyone's first Amendment rights for the board to issue a censure as a formal statement of disapproval could it also I'm sorry I'm sorry I was just going to ask about um Miss Walker Bailey that was here before was that a complaint it was a rant but was it a complaint I I what I recall her saying in public comment was that she had brought something to someone's attention two years ago I don't recall a complaint being issued about anything two years ago and don't consider things that are said in in public comment to be a complaint I think her comment was that she had brought something to the attention of the school district two years ago or a year ago or something and nothing had ever been

085done certainly anytime a citizen brings forward a complaint regardless of when it happened it would come back to you to decide whether you wanted it looked into just like this I think she was talking about the books did she say something she brought up um the hate you give I'm sorry Wendy what two years ago she was talking when she referenced two years ago she was speaking about the books that she had brought forward her complaint as it stands right now is informal is that Miss sovich had visited her place of employment oh okay and requested her termination due to her being a danger to students and that is the first I'd ever heard of any allegation like that and again we would just follow the same procedure if a complaint comes to the board

086that a citizen once looked into we'd follow the same procedure Mr chairman is it appropriate at this point I mean you're looking for a motion can we hear from Mr sovi we we can once there's a proper motion and second on the table for for any sort of disposition if no motion is made what happens then this matter is concluded we move into um consent agenda items and then on to close session so there is with with what's in our packet on page six it says taken together the board could conclude that mich's actions gave the impression that she was acting in some official C capacity campaign for individual candidates and such action compromises the Integrity of the board as a whole okay is there a motion motion Le specific please what are what are

087you moving motion to censure based on the investigation performed by legal council to censure board member Jane sovich is there a second can I ask a question okay is there a second question no is is there a second and then we'll answer questions if I second I can answer ask a question second all right now ask you questions properly move and second thank you sorry Seth um when we say censure does it also mean that it's just a formal declaration or a formal statement that says one person's actions is not Viewpoint or representation of the board as a whole the censure is basically a disapproval of the actions of a board member in some way so I think in order for it to be an effective censure which again is just a statement of disapproval

088to a fellow board member I think it would be good for the board to specify exactly what it is that is being censured uh so the way to answer your question is I don't think you're censoring Miss sovich because of your Viewpoint I think that the censor um I I would just recommend that the the motion uh you consider revising the motion as to what specific act she took that you're censoring because I think that's fair to a board member for them to be able to respond to it to know exactly which act it is they're being censored for all right I amend the motion to um based on the investig ation conducted by legal councel to censure board member Jane sovich um for giving the impression that she was acting in some official capacity

089and it compromised the Integrity of the board as a whole you still agree to second that another second okay so M Taylor still agrees to second that okay now any further discussion comment I was not not acting on behalf of the Board of Education I was in public I was not acting if I'm asked if I am on the board of education I am going to honestly answer that the question was asked I answered it I had on a jacket that had Burke County public schools on it because I work for Burke County Public Schools I get a paycheck every month for that I was not acting on behalf of the Board of Education I do not act on the board of education unless I'm sitting in this room or in a school performing duties

090that I consider are mine so I was not acting on behalf of the Board of Education I do not do that except in this room and possibly in a school when I'm in the schools and I'm in a lot of schools I'm this is Stone it's a it's a rock and I'm not throwing rocks because I'm I'm not a judge and I'm not here to throw rocks at anybody but we have standards that are set for our employees and we have standards that are set for our students and if the standards aren't met aren't or uh broken there's consequences for that and I don't see how as a board we could sit and even though the precinct is not a boardroom we're still a reflection of this school district and I think with with what

091was stated as far as with you know the language used or um you know how the actions um this isn't our school day if a student or an employee were to act that way it would be a disruption to the school day with us having to do this and to go through this the actions Were A disruption to what is required of our board and that's to you know to work to to work through policy to um you know to make plans for for future things and so this this whole situation has been A disruption to that and so that's why I second a censure just to say that's not reflective of us as a whole and to separate what happened that day from our Viewpoint and what we want to do and what we

092want to accomplish going forward no there was no violation of any law is that correct no sir and and so Miss Jane what do you say did you learn anything from this and what has the board learned from what what have you learned from this process have you learned anything on this got anything you want to say well I've worked in the polls as a volunteer or paid person since 1978 um when I lived in a small community in Southern Indiana so I've done that for many many years maybe that's something I need to take a look at and not do anymore that's something I will have to reflect on did you think probably some stuff was said maybe that In the Heat of the Moment and things kind of there were lots of things

093that were not reported in here that things that Mr buff said to me in breakfast meetings that were pretty disgusting and outrageous that were not in the report because I didn't give it in the report I wasn't asked to give it in the report um I left it out because it was pretty disgusting what he said to me and I'm not going to repeat it here if another board member wishes to know what that was I will be happy to discuss it with them but that's the extent of it I will be happy to discuss it with councel I will be happy to discuss it with the superintendent but that's the extent of where I'll go with that yeah but I want you discussing it with me in the system now what do you think

094pardon me I want you to discuss it with me and the system now the system so we knew a lot went on and I don't know what goes on at these meetings and I know there's a lot of stuff said but this kind of comes out at a point so I want us to profit from this experience I want the board to profit from it I want you to profit from it I think it's a great learning it's a great learning well I can tell you I will not be going to the GOP breakfast anymore that you could take to the bank and put it in the vault okay that's all I'll say Mr chairman well I I'm voting no and I don't mind telling you why I have never seen in my life and

095and I've been in a bunch of Poli politics stuff for a long time the amount of vitriol and bitterness and pure hatred that I have witnessed from crowds that have come in here to to attempt to talk to us it's very disheartening it's very sad and it's certainly not productive throughout this whole thing with Mr hovic and um Miss sty and Mr buff I have yet to see or hear what the benefit children are this this has been a a um a very vile and bitter uh verbal exchange for quite frankly a number of years and damn it it's got to stop it's just got to stop you get nothing accomplished here doing these sorts of things now Jane sat here the other night and if that wasn't a censure or worse I don't know
