002violate any board policy good evening Mr chairman and board members uh the direct answer to that question is no you did not the board policy tracks the open meetings law and the op meetings law requires multiple different types of notices for different meetings both the law and the policy concern themselves with the calling of meetings not the cancellation of meetings or rescheduling of meetings that's not specified in law or policy and the policy talks generally about scheduling meetings what we call special called meetings but it's under the heading It generally so your policy does say that that's typically business that has to be done in between regular meetings but that's not a legal requirement and it's not specifically policy requirement because it is under the heading that says general requ at that time so the

007Mo in the back our our C principal congratulations nice to see um and we we'll have something later to say but I very on Dr Melanie honey Chief Information officer is the North Carolina Public Department of Public construction technology director of the year we recognize last month is the regional director of the year and found out last week that she beat out the six other regional directors for the State honor this honor is voted on by School Technology professionals from around the state so this deserving award came from pear we want to thank Dr hone for her leadership in our district region and State leveraging Technology to enhance learning experiences for all of our students and we'll officially recognize her at the April meeting but I head thank [Applause] you all right um next item

010that we table a discussion on policy 2310 public participation and board meetings until we've had the appropriate amount of time time to do our due diligence prior to changing this policy we've heard from many of our constituents citizens and Educators that are seriously concerned about past Board of Education meetings we've actually had to request for additional law enforcement to be present at our meetings and physically escort us to our cars at night to secure our safety Burke County citizens and Educators have voiced their concerns regarding people from outside of Burke County like Winston Salem and Gastonia utilizing this policy while not being stakeholders in B County this board has always welcomed public input been respectful as well as extending policy time allotment for those wanting to speak at our board meetings we have a responsibility
011not only to our citizens but most importantly the safety of our young children who are present at many of our meetings because they are being recognized and receiving Awards with my years of experience as a volunteer in schools since 1978 and my experience serving on many boards since 1978 I will be happy to take down this resp responsibility and report back to the board based on what I've stated this evening it would be in Bur County's best interest as well as the safety of our children to table this discussion all right anyone else mightly her um where I'm not for limiting you know comment I am open to you know tabling it the second reading if you need to to have F discussion at our work session um you know if we need to look

016so we have two concerns um regarding the actions of a sitting board member uh which uh must be de with in in concession at this point U I'll turn the explanation over to our attorney thank you Mr chairman so board members couple of uh ground rules before we get started first of all discussion any discussion of the conduct of an elected offish or elected board member is always an open session top as far as the's discussion uh you can receive your legal advice on procedural matters things of that nature we can do that in close session but any discussion of the actual facts conduct the board member is always opening session discuss number two there's no action required by this board whatsoever and that is going to relate heavily into your decision as to whether
017or not you want there to be investigation you unlike a individual that holds a specific office like the sheriff none of you have the authority to bind or act on behalf of the Bo and that is in the general statutes that is understood so none of you unless you preport to act on behalf of the board can act on behalf of the board you can't find the board you can't speak for the board whether or not you allegedly speak for the board attempt to speak for the board can be an issue and legally speaking you cannot speak for the board you only act as a board there is no action required when a board member is accused of some type of misconduct that someone alleges relates to their office from the Board of Education years
018ago the general assembly removed the process for board member removal from Boards of Education that was taken away from Board of educations it is now part of a criminal statute 14-23 that talks about the failure to fulfill duties or to act um outside of your official SC and that statute very specifically says that the board member must act willfully and corruptly and then they can be removed from office so that is the vehicle now in general across the state of North Carolina for board member removal which means the district attorney has to want to prosecute that to see if there's more evidence for acting willly or corruptly and then a judge makes the ultimate decision part of that statute to board member the other another option available still in Burke County Burke County only as
019far as I know from 2011 is a voter recall law and that voter recall law is still on the books it starts with 15% of the registered electorate actually notorized a petition in favor of a recall election so it takes about 15% of electorate to even bring it to a possible recall election for to be voted upon and that statute talks about being used within the last six months of someone's tur in office and that's very important for you board members because if the Board of Elections has to go out and investigate signatures and addresses and make sure that all these are legitimate voters that signed a petition you bear the cost the board of election will give you a bill for all of that to have a special election is expensive and guess who
020Bears the bill for that you bear the bill for that so that is also a provision that is in law now obviously it is a vehicle by which voters can move forward but it has some constraints it has some restrictions and also some cost board at that particular time so what then why would you investigate a board member how could you investigate board member really the only vehicle left to the board for allege misconduct by a board member in general is the censure provision and all a censure is is a rebuke a censure is a statement from the board to of own that you do not the conduct or you feel like conduct was not appropriate now certainly if you thought a board member acting illegally let's say that you thought a board member and
021buled school funds you can conduct an investigation and turn that information over to the district attorney so certainly we can sit here and play what if all night and y'all know me well I don't answer hypotheticals I deal with facts not hypotheticals but you could think of a Contin everything from a board member acting inappropriate at a restaurant or in the grocery store that you would probably do absolutely nothing about whatsoever to a board member in buling funds in which you might want to conduct your own investigation if law enforcement wasn't otherwise with so you have got as a board at least four of you have got to want to spend the time the energy the legal expense into looking into a particular issue and we'll certainly be happy to do it the other thing
022to keep in mind um as we think through these issues is the first amendment none of you lose your First Amendment rights when you're sworn into office and become board members you continue to have your first amendment rights to outside of board meetings except when you sit in these chairs outside of this room you have the ability to campaign you have the ability to uh encourage others to vote for specific candidates you have the First Amendment right to speak against who you think should not be on the Town Council on the County Commission on the board of education in Congress you do not lose any of those rights you are not more constrained by virtue of being ordin and I'll just have one issue right now so that you can think through it merely wearing
023a shirt or a jacket that identifies some relationship to the Burke County schools in my opinion is not giving someone the immediate impression that you speak for the Board of Education there would have to be evidence that you represented to someone that you speak for the Board of Education otherwise you would be subject to an allegation of censur if you said something in the grocery store and you will wear in your Burke County shirt that the chairman has to be wearing tonight so you've got to be very practical about this as well not persuading you at all happy to do an investigation and find out all of the specific facts because it is not my decision whatsoever and I take that very seriously it's your decision so if you wanted issues looked into we would
024do the best to get the exact specific facts for your consideration But ultimately the effort would be culminating in a decision as to whether or not you wanted to look at a particular centure the last point I'll make is again I think it's important for your deliberations to think through these things I know one of the allegations or reports was that the particular activity may have been for political gain your policy which is not in statute your policy talks about not using your position for partisan game and the reason that's important a couple things first of all think back to again are you doing something to try to benefit a specific political party if this board were to vote to take out an ad in favor of the Republican Party candidates or in favor of
025Democratic party candidates that would be using your position to further partisan game in addition to a whole host of other issues with you using political positions to actually Advocate as a board and extending money to advocate for political position in order to to move that forward but in the particular election that was just held for Board of Education all of the candidates were Republicans all of the candidates were Republicans so there could be that we on the ballot at that particular time is my understanding the ones being talked about were all Republicans so whether or not there was anything that even could be a partisan game is is obviously you don't need a lock very questionable when it was all inner party in terms of making those decisions so you know again whether you like
026what somebody does or what somebody says or whether you think it's appropriate and that is your personal opinion but as a board you're charged with looking into conditional misconduct it relates to the office and some action down that that discussion happy to answer any questions I can right now if ier the session that's because it's specifically that's the that's kind of again no action is required so after we have this discussion if no one makes a motion of the understanding that we have to complaint one and that's my understanding too and again there is no formal complaint process so complaints with a little C I mean there is no form of grievance process against a board member certainly all board policies apply again I'll give you this example it's a board member were used of
027sexual harassment against the school district employee we have policies that the entire board is subject to that so here it would be looking at the code of ethics illegality there issues of partisan gain or representing that the person is actually speaking for the Board of Education and not and and are the I don't know how are the are the complainants is the name of the complainants public information yes anything about a board member is public information board member and the complaintant as well yes and and so to to finish the thought if you did want something look into then what I would propose is to bring it to you at the next work session so that you would have time because one of the issues as well too is does the board member want to
028speak to the entire board and it is only fair that the board member have an opportunity to do that after hearing whatever facts have been determined if any as well so it would make sense to revisit it the into the next work session that would then leave the possibility of something at a legate meeting or not would it be proper though to um if the board was so inclined to to to direct you at this meeting to inquire yes I would think so yes it be it would simply be a motion to look into the facts alleged in the discussion I am struggling this is Tiana to understand why we have a code of ethics if it absolutely means nothing I think the the first point is was the C of Ethics even violated um
029and you've got to look into that and then the remedy for that is whether or not a law was violated and I talked about how you could defer things to the attorney general at that point or excuse me to the district attorney and then there is censur uh M beer you make a very valid point and some argue that that ability of boards to remove one of their R should not have been taken away but in a society where the voters elect public officials a lot of folks will disagree reasonable people will disagree whether people sitting in office all over the United States right now should be removed or not and it's up to the voters and that's why your remedy is understood um I just I correct me if I'm wrong when we are
030sworn in we have our first meeting we sign a code of ethics statement saying that we would abide by it however what weight does that carry if there is essentially no weight behind it we would have to violate a general statute and or law um so what is it purpose is what I'm saying I I think the purpose is very straightforward that you are all pledging to each other that you will conduct business in a certain way as elected officials but the remedy is a is a completely separate academic issue uh and again you are you are speaking to an issue that not only impacts the school board it really impacts every governmental office in the United States of America so essentially it's a promise to each other that we will abide okay cond for
031any change or consideration to change for that we would need to approach our NCGA for that and have them change the law yes and I think one of the issues that you will find is again the line between recommended ethical conduct and illegal conduct can be a pretty different pretty difficult line to draw and you know I've always said you don't draft policy one act that you disagreed with I think the general assembly kind of takes that position too is it's very hard to legislate specific behavior it's easy to legislate illegal activities but it's hard to legislate what someone consider good behavior so yes that would be your remedy but there are always going to be ethical POS ethical requirements some that do have teeth in law and some that don't have LA and that's
032true in every profession and so to have any remedy towards any complaint made towards any board member the district attorney would have to pick that up choose to to pick that up um who would bring that before the district attorney anybody can bring it for thect was any law broken in this process this that happened Mr stre I can't answer that question because I as your attorney I'm not going to spend money looking into something unless the majority of the board wants so I don't know but I don't know of any direct allegation that invol the accusations deal with political gain the accusations deal with improperly trying to find some personal Advantage but again from the very big picture if all of you walked out in November wearing your shirts and told folks who you
033individually thought would be a good candidate that violates no M AC again the first amendment is no political gain was given because it was only one party involved right no political game was involved no partisan game speaks be heard I'm inclin to make a motion that we goep forward and just see see where this lands we're not going to know you got two people that have like a better term complain for me Sor I said I would be inclined to consider making a motion to go forward and have Mr cble Miss Campbell's firm U inquire into the two complaints that have been made and bring us back what they believe to be a set of facts not to be Sinister and I'm all for what the board votes to do I I support that 100%
034but at this juncture with the information we just receiv received I don't see the point there's I mean we're we're going to spend money I'm can be candid we're going to spend money to investigate something that nothing is going to come up other than a public review I I just don't I'm struggling with that I mean if we want to go ahead and pursue it just to hear what the facts of the case are for alleged case then I mean sure but what what what we what's the end goal other than to hear the facts or alleged facts that are found personally I don't like dismissing formal complaints if there's formal complaints I think that we go to stakeholders to follow through information I'm for I'm for I just I just Mr Campbell any idea

040the armor of life let us work honestly as in the day not in riting and drunkenness not in chambering and Wess not in stri and envying but put ye on the Lord Jesus Christ and make not provision for the flesh to fulfill the lust of the flesh these verses say it in very say it very plainly you're asleep and oblivious to what is going on in your schools or should I say our schools Satan has blinded your eyes and darken your hearts I cannot judge whether you I cannot judge whether or not you are saved by God's grace or not but I can be a fruit inspector and the fruit that I'm inspecting is rotten and it stinks don't uh don't you think it's time to throw the rotten fruit off the board and bring
041back the good things that like reading good Godly books writing Godly book reports doing open reading in classrooms out of with Godly books and more put God in your lives and then put God back in schools you are acting like the ostrich and burying your head in the sand or should I say the governor's back pocket and in doing so can say that this problem doesn't exist this problem does exist no matter what who says it does exist my question is why don't why don't you turn in your resignations and get off the board if you're not going to do what you should be doing we need to stand strong and we need to stand stand firm for our children it doesn't make any difference what we want as individuals our children is the next
042generation and without the Next Generation being educated to the point where they need to be and not with books that speaks of sexual imp perversion with books that suggest growth honor and righteousness we are going to fight a Los battle and that battle is coming down on everybody's shoulders that is in charge it doesn't make any difference who it is it's coming down on your shoulders we need to stand strong for what this book says not what what people say this book is inherent it's infallible it's righteous and regardless of what board me members may say this book is honored throughout the Nations this book is fulfilled that prophecy will be fulfilled one day when Christ comes back we need to stand strong that our kids don't have to worry about where where they're going
043to be we can tell them we can train them and we can teach teach them the right way The Honorable way but we have to get off of our better than do THS and do it thank [Applause] you our next speaker Dr jerryson Nelson I came to speak regarding the books pornographic books in the library schools I don't have much in length to speak of but I only speak about what just stuck my heart about my own life I'll say it quickly I just have to say I honor what has been spoken it's I can't add to that but it struck me in my little way in my little mind that there is a decision to be made and it's entirely clear what the answer ought to be and I'm I have conundrum why something
044has not been done and I I think about my own career I spent maybe 20 years chasing after the God particle I spent time with astrophysicists and astronomers heads of the of the national Research Laboratories in this country and foreign uh correspondence to that I was fortunate to be able to understand what the chase after the God particle was the data that was hunted for since Einstein proved that there was a beginning in the universe scientists then begin to say we got to find the beginning so I was struck by that and I spent my good part of my career and I here's the conundrum I don't I don't want to speak long about that but here's the conundrum I have I was able to speak to leaders and cosmologists from all over the world

047deceit and fraud we heard some of that uh from one of the board members Psalm 9 thou givest thy mouth to evil and thy tongue framethe many of you on this board um have been very deceptive in how I say many of you some of you not all of you have been deceptive in how that you've conducted yourselves in the manner of handling the pornographic material in our school libraries then slow to say the least but even more so is the idea that you as a known liberal those of you you'll know who you are would pose as a conservative in order to be elected that is deceit as well that's deception so when we when you uh look at that and you think about that itself then you have to realize that um uh
048a board member uh should not be able to bring uh uh any kind of accusations against an individual um that they would not be able to prove um I saw this uh at our at our elections I saw some video you might even have some of that I don't know but if you don't you probably will have before it's over with as far as that goes but here's the here's the thing that bothers me is that we can stand we can speak and we can talk about different people we can wear our shirts of Burke County schools and we can wear our coats but then we can also be able to say that I work for B Burke County schools and that so that we can talk to the voters and ask them to do
049that I'll move on I won't stay on that when our governor visited with us this really bothered me right here because um I think most of you really loved up on him except for one he didn't love back on one of you uh but when our governor visited Burke County he stated that these pornographic books were a myth um I'll tell you that I'll tell you the truth about a myth a myth is when several of our current liberal board members who lost their election say that they are conserved with in fact I watched and heard one board member tell a voter that they didn't need the the Christian voter guide or the ballot uh that was uh their her ballot was the only one that needed that's not that's not a myth that is

100all Tim Buff's people she and the the person said who is that Tim buff was on the board in ' 09 he took $960,000 out of our school system he almost bankrupt our school system so I'm asking I'm asking Dr Swan and I'm asking Keith Lawson I'd like to know when Mr Bug or anyone took between 963 and $970,000 from this school system primarily Mr buff because if you all have let that slide and he's walked away with almost a million dollars they need to be looking for new people at the top of B County [Applause] public [Music] thank you Dana thank you for the opportunity that I could speak to you um I just want to say uh attorney thank you for explaining everything you did I am familiar with the school with the
101uh court systems to know that hearsay doesn't stand up in court but I'll tell you facts to and I wasn't going to mention the name of the board member but others have this evening and so I feel it would be correct for myself to mention Miss sohovich is the topic of discussion and I am very short and sweet tonight I will say that leadership has responsibilities Miss sohovich I've been a leader for many years at this moment I am part of the Burke County GOP and I have been present and a witness in the meetings so it is not here say that I've witnessed some things uh I have witnessed them but I will say that has also consequences leadership and one thing as far as our children on the school board you know it's
102extremely important we have the opportunity to either um uh we can uh edify them we can protect them or we can infect them unfortunately with things that we say our actions and especially if others are stumbled by it and so those in Authority have profound effects such as pastors teachers board members adults we are all adults and we need to have these influences be protecting our children I will say that the pastor who uh was up earlier this evening spoke about deception and attorney you did speak about that in order for things to be investigated it has to be willfully or corruptly and um excuse me I'm just going to run again get this one little thing that's on my phone to [Music] say um I'll very short with this the last thing that I
103want to say really is we are going to be held accountable for our actions if not in the present if just a little slap happens and if just the discipline comes to not one area we cannot we cannot uh ignore and that is the Lord God Almighty and he says in his word and I will say this is from a great leader actually who wrote this and this is from the Psalms can unjust leaders claim that God is on their side leaders whose decrees permit Injustice they gang up against their the righteous and condemn the innocent to death but the Lord is my Fortress my God is the mighty rock where I hide God will turn the sins of evil people back on them and that was by a great leader King David and I
104will close with this I was present and a witness with the public conduct from Miss sovich in a meeting um just February 23rd and March 1st and at one of those meetings she had left and directed it to our member of our board F you Fu F you yes three times and then one more time on her way out the door and I know for a fact also that at the uh March 5th election day um when the policies were presented to her that they felt were incorrect what she was doing her voice said policies be damned so one thing I will say is when we have an infection in our skin in our bodies and we let those infections go and we don't take care of them they're going to get worse until they're

107electronic expert two one two good I want to thank you for making that exception uh tonight Dr batty and I earlier had had a conversation with the lieutenant governor Mark Robinson and um he sent me a statement a while ago that he would like to share with the board and this is straight from the lieutenant governor last M last month the Democrat Governor made a PR stop at the school and called criticisms inappropriate materials in our state classrooms a myth this is sad and pathetic the politicians who shut down our schools and kept our kids locked out of the classroom for far too long are trying to cover their tracks to Gaslight the voters it is long past time to get the radical politics inappropriate materials out of the classroom when I first took office
