001good evening everyone let like to call to order the Plano Vista Community Schools Board of Education meeting for June 12 2023 the first order of business rise for the Pledge of Allegiance please all right thank you very much roll call please here here thank you very much all right please uh call your attention to the open meetings law which is posted at the entrance to the the room here and uh second order here Communications first up we always like to do so we've got lots of recognitions tonight Dr rickley yes we do uh Mr Bailey uh and happy Monday everyone we usually don't do a lot in the way of recognitions in the summer months when things slow down with staff and students so our apologies to our tracksters that we didn't get to quite
002in the month of May but we're thrilled to invite them here with their coach tonight lots of individual performances as well as some team accomplishments as well and for those who that don't regularly tune into our board meetings we try to do this at least once a month where we highlight the accomplishments of our students and staff that have distinguished themselves in some type of an outstanding way and we have many of those individuals here this evening so without further Ado we have individuals from both Papillion Lavista high school as well as Papillion La Vista South along with several of their coaches we'll start with Monarch first first off we have Danica Reese Danica is a 12th grader State track meet girls discus coached By Dana Jansen and Josh cage I didn't see coaches when
003I walked in but if you're here we want to recognize your efforts too second athlete from Papillion La Vista High School Jesse Malone 11th grade boys 110 meter hurdles coached by Sean gray who's the head coach and the hurdles coach Danica and Jess you haven't distinguished yourself on the field of play as well as in your school district please be recognized by your community and Board of Education foreign [Applause] well done monarchs and you're obviously welcome to stay and hear your board of education but we also understand you probably have busy social lives as well but thank you for attending your Board of Education meeting uh the second group is from papilliona Vista South uh we have a couple of individuals as well as Team Championships here first off we've got Katie Shea for a
004ninth grader the the rare ninth grader that medals at the state track and field she the wine girls 400 meter dash coach by Ashley catrell I think I saw coach Kittrell when I walked in second honoree is Kaden Frederick 12th grader boys discus who is coached by Sean McLaughlin this is the second consecutive year of winning The discus by the way and third and by no means lease and I think maybe we'll split this up into individual and then we'll bring up the uh we'll bring up the team later but the girls were the team champions also coach Kittrell to win in class A it's so very competitive so to have our girls win the over all Championship is nothing short of remarkable Katie Caden and for our ladies please be recognized by your Board
005of Education foreign [Applause] oh my God [Applause] yeah that's right go enjoy your summary outstanding job ladies coaches thank you for being here coach H I didn't see you thank you for being here we really appreciate your leadership and all you do to support our student athletes and with that Mr Bailey I would conclude our recognitions for the evening all right thank you very much do we get chairs figured out we're good all right all right next up we have public comment for items not on the agenda we have a number of them tonight please let me remind you when I call you up please give your state your name and address once you get to the table once you finish that then we'll start the timer you have three minutes I think the first
006time it goes off I always get the strong I think it's two minutes and 15 seconds so you'll have about 45 seconds after that before you hear the timer so with that we'll go ahead and call our first and it's Mr Ralph Tate thank you seems only fitting after that recognition on the topic I'm going to talk about good evening my name is Ralph Tate and I live in Papillion in 2017 a scientific paper was published in BMC biology entitled the landscape of sex differential transcriptome and as consequence selection in human adults in case you're not familiar with what a transcriptome is like I wasn't it's a complete set of messenger RNA molecules or transcripts produced in a cell or a population of cells the paper identified that men and women have almost identical genomes
007but are distinctly dimorphic with dissimilar disease susceptibilities sexually dimorphic traits mainly result from differential expression of genes present in both sexes This research mapped the human sex differential genetic architecture across 53 different human tissues collected from 544 adults revealing thousands of genes differentially expressed between the two sexes these researchers made the following biological observations sex differential expression was tested in each of the 45 common tissues between men and women over 6 500 protein coding genes were with significant sex differential expression were identified the most sex differentiate differentiated tissue with over 6000 protein coding genes is the breast mammary glands this suggests major differences in the physiology and sex genetic architecture of this tissue between male and female we should also recognize how incredibly complex and unique this particular body part is in non-mammary gland tissues
008over 1100 genes were found to be sex differentially expressed the most differentiated of these tissues are skeletal muscles two types of skin tissue subcutaneous adipose a portion of the brain called anterior cigulate cortex and the left ventricle of the heart 15 out of 20 genes found to be associated with cardiomyopathy showed a women overexpressed bias in heart disease which is perhaps one of the reasons why women suffer the heart disease that they do the pituitary gland has 26 identify identified sex differentiated expressed genes women also have two enzymes that are uniquely expressed in the liver these enzymes are associated with how drugs are metabolized and might be involved in sex differential drug responses dozens of genes with no direct Association to reproduction were also identified as sex specific sex specific excuse me these observations are
009not political they're not social they are strictly biological we are male or female throughout our entire bodies in our livers in our hearts in our pituitary glands in our brains and how we metabolize sugars and store fat we can't get away from it we need to help our children learn to appreciate the bodies they have we are all fearfully and wonderfully made this is the message we need to communicate to our children as someone told me a long time ago when we decide to fight nature we will soon come to realize that nature always bats last thank you for your time all right thank you [Applause] all right next up is Sarah larotoni uh Sarah told me 8016 Granville Parkway La Vista I'm going to switch tracks a little bit I guess um so an
010article popped up in my Facebook feed this week about the prism prism Club at Bennington high school and it's recent application to become a school-sponsored club um there were the corresponding comments around it um whatnot um and one of them was um informed me that Papillion Livingston high school has its own GSA Club um regarding um the lgbtqia plus Community um it was one club on a list of 32 Student Life academic service cultural awareness and Performing Arts clubs and groups offered at the high school and this is one of the things that I love about our district um is that I feel like I'm continuously learning about what makes us great and um every time I'm online or I'm reading the news or the herald or whatever um there's always something about our district
011that just speaks to being known for greatness for the most part I would like to forget my middle and high school years um I thank God that social media was not around to document the awkward decade that was my 10 to 20 year old self um but one of the things that I do remember very fondly are my involvement with the clubs that I was in in drama and track cross country and a club called thymune which is the Hague International Model United Nations those groups afforded me the opportunity to find my community in the middle of my most awkwardness as a human being and trust me it was awkward um so I really enjoyed learning that Papillion La Vista High School has a GSA club that connects our LGBT students out allies and members
012of the school Community thus reaffirming that this district is great by the fact that it offers this our district is great not in just actions or not in just words but also in actions I had the same feeling last week when the district promoted its free summer breakfast and lunch program for all children and their accompanying parents during the summer hunger is not a nine month problem chronic hunger stems throughout the year I came back from vacation to see our school sign listing the summer Library hours and it was just so great to know that our schools were offering if only for one hour a week a safe space for our kids to go and just be our teachers are great miss plymail at Parkview Heights she created such an amazing end of school year
013experience that really showed how she paid attention to the individual students in her classrooms and she gave each student books that spoke to them thank you for your time and thank you guys for being great I really appreciate it all right thank you [Applause] next we have Miss uh Lisa kukenmeister I think you got it Mr Bailey uh Lisa cookenmeister uh La Vista resident so I don't have to say this these are pretty intense times here I can only imagine how thrilled five out of six of your board members are probably given that coming to these meetings given that you're accused of sexualizing our kids by the newest member Brittany and now you have to work with her I know a few teachers have come I don't know how many watch but it has to
014be extremely disheartening to hear in these meetings that you cannot be trusted in your classrooms and that you're a groomer again comments by Brittany our Librarians our curriculum staff they're really hearing it from Brittany and her friends and as parents it's infuriating to listen to these same people push lies in distress so I wanted to remind everyone about the plcs beliefs we believe in the worth of every individual in the building impacting impactful relationships that Foster empathy and kindness in the inclusion environment that honors diversity equality and access we believe that all students can learn and grow and we believe that supporting mental emotional social and physical well-being as a foundation for Student Success and to take a broader look at the US Department of Education it stress that every student deserves to learn in
015a safe supportive setting discrimination bullying and harassment based on sexual orientation or gender identity is strictly prohibited I am disgusted and by all the hurtful and quite honestly hateful things that are being said about are lesbian gay bisexual transgender queer students their family staff community members and I want you to know that you have a place in our schools and you have a place in our community so is it enough just to say that you love someone Brittany I think you testified in front of the legislator however your actions and who you surround yourself tells the real truth you are proud member of moms for Liberty and this group was featured in the 2022 year of hate and extremism report for pushing anti-student inclusion agenda they Advocate against School curriculum that mention LGBT rights CRT
016and campaign to ban books that address gender and sexuality Brittany I'm sure moms for Liberty is very proud and I think you've collected that you've done all of these however it goes against every belief so to anyone who continues to speak on the dangers of people who are different than them I'd like to know that your words are falling on deaf ears all students are welcome and will continue to be welcomed in our schools and anyone that has a problem with that I would say with the recent passing of lb753 which is a private school tax scheme I'm sure that you'll be welcomed with open arms to an to a few private schools that are happy to discriminate with you if you support keeping our public tax dollars for our Public Schools then please watch

019the issue of pornography in the Papillion list of school libraries there are definitions of what pornography and obscenity is that are found in the in U.S Supreme Court cases and in Nebraska statutes the term contemporary Community standards is a standard used to test descriptions or depictions of sexual matters which was first adopted by the United States Supreme Court in 1957 in Roth V United States 354 U.S 476 in the Roth case the court put forth its test for determining whether a work is obscene as quote whether to the average person applying contemporary Community standards the dominant theme of the material taken as a whole appeals to Pure interest unquote in the Nebraska statutes there are descriptions of what obscene means quote obscene shall mean a that an average person applying contemporary Community standards would find
020that the work material conduct or life performance taken as a whole predominantly appeals to the Peruvian interest or a shameful or morbid interest in nudity sex or excretion B the work material content or life performance depicts or describes in a patently offensive way sexual conduct specifically set out in sections 28 807 to 28 829 and see the work conduct material or live performance taken as a whole lacks serious literary artistic political or scientific value unquote a particular note is the definition of sexual conduct Nebraska statutes say quote sexual conduct shall mean acts of masturbation homosexuality sodomy sexual intercourse or prolonged physical contact with a person's clothed or unclothed genitals pubic area or buttocks or if such person is female breast unquote and quote harmful to minors shall mean that in that quality of any description
021or representation in whatever form of nudity sexual conduct sexual excitement or sadomasochistic abuse when it a predominantly appeals to the pure and shameful or morbid interest of minors B is patently offensive to prevailing standards in the adult community as a whole with respect to what is suitable material for minors and C is lacking in serious literary artistic political or scientific value for minors unquote since both U.S Supreme Court case law and Nebraska statutes made clear that books materials and electronic videos Etc that are harmful to minors shall be prohibited in school settings that are supported by tax dollars and that contempt contemporary Community standards shall reign in designating what is patently offensive obscene and pornographic I propose that the Papillion Lavista Community Schools make a policy to establish a community standards committee comprised of adults
022representing different professional Fields such as medicine Nebraska law psychology religion and law enforcement along with representative parents to review problematic books materials and videos and determine what is patently offensive to prevailing standards your community as a whole excuse me ma'am you're done thank you very much it's your three minutes and last up Mr Edward winegar Edward wenninger 1709 Ridgeview Drive so the previous speaker already went over the definition of obscene by ones who read from section 28 807 subsection 7 of our uh Nebraska state statutes to clarify that material does so I'll just read it material or work shall mean any book magazine newspaper comic Book pamphlet or other printed or written material or any picture drawing photo photograph figure and it goes on but the reason I think it's important is a lot of
023people look at the look of the books and obviously it's not a you know Playboy magazine or anything and so you know It Gets Lost in Translation sometimes that this truly is obscene material um the consequences for Distributing obviously material is uh in 28 813 of our Nebraska state statutes and it says literature or material prepares distributes promotes penalty for such it should be unlawful for a person knowingly to print copy manufacture or prepare produce or reproduce obscene material for the purpose of sale or distribution published circulate sell rent lend transport and Interstate Commerce distribute or exhibit any obscene material having his or her possession with intent to sell rent lend transport or distribute any obviously material or promote any obviously material or performance and then two sections later is 28 8 15 and uh
024which says it shall be a defense to a prosecution under Section 28 813 that such persons activities can it should be a defense you know such a person's activity consists of teaching in regular established and recognized educational institutions galleries or libraries unfortunately that statue was not meant for this conversation but it has been used or misapplied to absolve Librarians from uh prosecution for the offense of Distributing uh pornographic material but and we can we can disagree on on that I get that but the reality is we aren't looking for legal uh recourse right we're looking for the right thing to be done and for uh as uh Robbie already mentioned like the community standards are upheld this is not a book ban that that has been bantered abandoned around and and again we're we're not
025stopping anybody from going in purchasing these books they can go to Amazon they can go to the public library for that matter in downtown and they can get these books themselves there so this is we are merely wanting the our children to be shielded from some of this material that we as parents do not want them to have access to and it's a very reasonable request the school board itself previously in previous meetings identified this material is pornographic and um and I think that that's an important factor and some of these books are not explicit into the degree the the one that I read previously but some of them are innocuous and targeting uh small elementary school children so thank you [Applause] all right that concludes uh Item B uh continue on to item C
026superintendent's report thank you very much Mr Bailey members of the board uh again happy Monday everyone and for our community members who are joining us in person thank you for engaging with your board of education for those that are watching online uh we would like to welcome you as well thank you for being engaged with your school board I want to wish everybody a happy summer uh Summers off and running we have started Elementary summer school for example we do have new summer hours if you do have to transact any business with the district we still the central office stays open year round but we do adjust our hours slightly we open early in the morning at 7 30 and we start closing up about four o'clock so if you need anything call us stop
027by we're here to serve you but just wanted to remind you that we do have slightly abbreviated I'll restrain the summer months I also wanted to remind everyone that the Papillion Lavista Community Schools Foundation golf event is tomorrow this is a great event we've done this for years and years uh it's been a great opportunity to raise some dollars for a foundation which in turn supports many programs such as Outdoor Ed that are near and dear to our hearts and many other curriculum matters and it looks like it's going to be a beautiful day for golf so uh hopefully if you're at all interested I think there's still time to join us also wanted to call out Dr Deb Anderson our mental health liaison she's been doing some really outstanding work even during the summer
028months recently we held a session at the point La Vista High School where she had Educators from across the state learning about trauma-informed care which is a big part of making sure that we are supporting our students mental health needs she also replicated this discussion when she was in Kearney last week talking also about trauma-informed care something that we know is critically important for our staff and for our students I want to thank Mr Richards for his outstanding work in buildings and grounds we haven't given a building update in a while most of the 2018 Bond projects are effectively being wrapped up Monarch down to the punch list Rumsey station Liberty Middle School Lavista West Elementary those projects I believe should be wrapped up by the end of the summer and as this board is
029well aware we were able to get a couple of add-ons done as part of the Bond as well typically playground upgrades and some irrigation at several of our elementary buildings so not only are we thrilled about the 2023 Bond issuance but also wrapping up the work on 2018. also wanted to remind the board and community that the legislature has a reach officially reached signee di the last day of the legislative session we didn't tackle as many bills as we have in previous sessions for a variety of reasons but there was some important legislation that that was addressed we'll have a full briefing from Senator former state senator Tim Gay he'll be joining us later in the month of June and your Administration sat in on a webinar this morning it was a multi-hour webinar where
030we went over the nuts and bolts over many of these bills not only what's in them and how that's going to change things procedurally for the school district but also the implementation date some of them take effect immediately because of an e-clause and some will be 90 days after the gov Governor pillan provides his signature but more more details to come uh overall I think we had a good session and we had some definitely some wins I also wanted to remind the board that traditionally we have done a board retreat sometime in Late July or early August for purposes of talking about everything from the district strategic plan evaluation of the superintendent goals for the upcoming year most of our last two Retreats have focused on the bond and I suspect there'll be a little
031bit with the bond that we'll want to discuss with the board there as well but I'll have Kathy and Mr Bailey look at some possible dates in Late July early August and the board can choose a date and time that works for them just so our community is aware you are always welcome to attend our board Retreats we never transact business there solely for the purpose of discussing so there isn't an action item section on the agenda it's strictly to discuss matters for the upcoming year but regardless community members are always willing to willing and able to attend those Retreats and we'll share that information time date and location as it becomes available hope everyone enjoys the rest of their month of June it will be August before we know it and with that Mr
032Bailey I would turn it back to you end it with that with the good news right all right thank you very much all right next up uh board reports um we had met for the building grounds and finance but then I've also been talking with Kaylee I'm on the board for teammates so we've just been discussing like some possible fundraisers and just throwing out ideas with each other because I love to do that kind of stuff and one of them was possibly another golf one too so I know you love to go off and are very great at that Dr rickley and then another thing was my son went to the Monarch baseball camp last week and that was a blast and the the coaches were great with the kids and the I don't know
033if they were part of the varsity team or if they were like Junior seniors but they were pretty amazing with them and it was cool to see my son just like look up to them because to him I'm sure they just look huge so anyways they did a really good job with that and they had good weather and it was fun he did he played college uh yep he takes after me because I'm a kind of a good hitter I'm just kidding he's a pitcher but I was there okay uh similar to that I took the the boys did the Monarch basketball camp and being a basketball uh for four days at the beginning of the month um I think they did it last year or maybe last two years always a great turnout a
034lot of kids uh good use of the space in the summer uh the Monarch the competition gym and um the coaches there and all the all the high school players do such a great job with the little kids and and the boys uh really enjoyed it um and I know throughout all the a lot of the different teams do those such as a baseball team I think it's a good opportunity for them to raise a little bit of money for their activities uh and to give back uh and and just uh help out with the community for the next generation of talent that's coming up so I thank the team and the coaches for uh taking them for a few days yeah a few of the track coaches didn't get many days off from winning
035a State title to hosting uh what's pretty unique the last few years the Titan track coaches have put on a Speed camp teaching any sport athletes not just track and field athletes proper technique how to improve their speed and they used to stretch it out over a couple weeks this they did it in four days last week but it's it's always well done and it's it's great to just see how it applies to all sports and isn't Just Sports specific but uh yeah I love all the camps that they do right right away in the summer it gives some of the folks that the kids are at home a break to get them out during the day but uh yeah they my daughter did uh my son and daughter did the Speed camp and then
036Titan soccer hosted their Camp last week or two weeks ago so they did not luck out with weather one night where the storms rolled in but uh what can you do spring into spring early summer in Nebraska so but other than that yeah so we kind of hit a bunch of events around graduation and it's nice to get into the summer my kids are a little old to do camps but they did them a long time ago and then they helped out when they were in high school so I definitely appreciate all the the students that go and then the students that help so it's fantastic um last week last Wednesday and Thursday I was at the nasb leadership conference and so that was really good I wasn't sure what to expect but it was
037fantastic to go down to Lincoln and kind of be able to see talk with a number of different districts and people in districts from the very small I think to remember which district it was I think had 400 total students obviously up to you know talking to folks from Ops and Gretna and everything else but it was um it was fun I was talking to my wife about it and she's like so what what one word would you come up with and I was like I sat there and thought about it for a minute and I said affirming listening to all the things that they talk about it affirmed what we do not just the board but the assistant superintendents and the superintendents and everything how we run this District we do a very good
038job we follow you know we make policies we follow those policies we review those policies it's amazing how how many districts out there review them once a year all of them once a year maybe even once every two years something like that and the things that we have set up just the way that like I said the administrators the way they work with us and the way we work with them it's it's it was very affirming to know what we do and how well we do it so it was good I learned a lot um and so all good stuff but I just wanted to kind of let you all know what I found out well and can I embarrass one of my six bosses here for a minute so thank you for attending that
039and I shared this with Mr Bailey but um later on after the the conference had wrapped up I heard from no less than four or five other board members other districts from across the state as well as at least one or two superintendents that had the opportunity to meet our board president say skip Bailey is really a stand-up guy and I said yeah he's okay he's all right yeah he has his moments like we all do I suppose but truly I appreciate you attending on behalf of the school district clearly you made an impression with a lot of other educational leaders from across the state and it's always fun to be able to network and hear the great things other school districts are doing so thank you for doing that boss absolutely it was very
040good in network I enjoyed it like I said it's good opportunity all right thank you very much uh next item e committee reports first buildings grounds and finance yes we met uh was it last Friday this is this has been a busy week uh her last week was a busy week um we discussed uh obviously the uh 2023 Bond timeline uh and a mention of the items d e and f under action items uh the construction managers at risk we walked through how that might look how that might work what projects it would be more beneficial for which it may not be we would just do our traditional uh design build we went over I guess I missed item G as well an update on the city leases and our local agreements on the baseball
041and softball fields um Dr rickley mentioned some of the facility updates that are wrapping up with the 2018 Bond earlier we took our first kind of discussion on student fees what they may look like they're still waiting on some updates from certain clubs as well as what food prices are looking like obviously we all know what they are at the grocery store we shocked my seven-year-old yesterday with the the total at the grocery store and I was like yeah you guys eat a lot that's uh that's the problem mentioned the legislative update obviously Mr Gay is going to come in later in the month to discuss that and um I think that was about it so most things are on the agenda this evening fantastic thank you uh next human resources and student services we
042have not had a meeting but we do have the vote tonight on the policy 5000 updates which were reviewed at the last meeting thank you and last curriculum in americanism we have not met all right thank you very much before we move on to action items we do have some comment for items on the agenda they are all involving uh policy 6000 so as a reminder once we get down there I guess that'll be all the way down to the discussion items we will again have everybody come up and speak and I'll remind everybody that's speaking how long you have in the policies for that so moving on to action items number three uh action by consent letter A I'll make a motion to approve the action by consent as listed second all right I

046manager at risk CMR number one selecting the method of construction delivery Mr Richards a what's your show again yes so talking about the construction manager at risk um we kind of divided this into three steps uh statute is very specific on what needs to be done as we proceed with this process so CMR kind of the first thing on the CMR tonight is selecting the method of construction delivery you can kind of see in the summary what projects very generally are listed to do with this we are looking at actually splitting this up and we've run this through the buildings rounds on finance committee into two different construction manager at risks both doing around 45 million dollars worth of actual construction work which tends to be about 110 million probably of the 130 million dollar
047Bond the other projects we'll pull out do the same as we did in the previous bonds with design bid build those tend to be a little bit more of the simpler projects that we're looking at doing but these are pretty technical projects we'll get very experienced construction companies on board through this process one of the things you'll see in the motion is a letters of Interest waived on the last sentence so the reason we're able to do that through statute is we actually get more by waiving that letter of interest so what districts can do with statute is send out letters of interest to just the ones that you publicly go out for letters of interest from companies and then you send it to the ones you want to and then they send it back
048and then you select who gets the RFP from there we like to just go out directly with the RFP to all companies publicly so any company can bid on this project rather than being a little more tactfully selective in the process so that's that's what that is so this kind of gets us started on step one step two is the next item up and then step three will be back in July which will actually the board will approve the actual selection committee that we're going to use to select the companies so that's kind of where we're at at this point and I'll have Annette if she has the clicker for me I'll use that for the next item here thank you no problem no problem oop going away but that's for the next item yeah

051the need come up outside of the construction process itself if that makes any sense I just wanted to make sure that okay because we're being very specific here when we need the name um and I'm just I want to make sure I'm clearly understanding the split into one and two because I don't remember us discussing that before unless I just missed it but I want to make sure I understand that yeah and that's something we want to come back in July and kind of highlight everything talking through with the committee on the ways we want to do it right now we're looking at a two-prong process we think that's most practical talking with the Architects and some different construction companies on what they're able to handle Over a four-year period again our goal is to
052kind of get this done uh you know once we start construction over about a four or four and a half year period and making sure those construction companies can handle it we talked about maybe doing three uh to spread it out a little more and then that got a little tougher with communication and bidding against yourself that type of thing so going with the two-prong approach versus a three seemed to make more sense as we discussed that but again we want to come back in July and highlight all that nothing's been concrete decided in that process and still won't be until you know the board looks at that in July okay sounds great thank you for those answers and again this is just to initiate the process of the selection right any selection selecting would
053be we would have to vote on that at that correct and that's kind of up next here on the timeline I'll talk about a little bit on when the board gets involved yeah okay that type of thing great any other questions all right let's go ahead and do roll call on this one and then we'll get to the second part yes yes yes yes all right thank you all right now item F uh CMR number two adopting the selection Criterion evaluation Point evaluation Point values so what ends up happening uh through this process and it's all through statute uh you need to have the selection criteria that you're going to use to evaluate the companies that you end up bringing in for a particular interview um with your selection committee so as we look at
054this process and as we look at the things that are important within you know the CMR process you look at the items that we kind of put a little more emphasis on is performance quality time constraints and then of course the fees they charge for the maintenance of effort at the beginning those kind of have the highest weights within that table that you see there and that's kind of what a lot of districts use as weights when they use this process and with Perry Law Firm for example that's that's a standard table that you might see from a selection committee so if you have any preferences on that different than what we have listed there now would be a good time to get that amended but I think the building grounds and finance committee felt
055pretty good about those percentages within that table and that's what we recommend here tonight as we move forward if you look at the board up here uh tonight's the meeting to approve the CMR method for the project notice will go out later this week and be published in the Sarpy County Times next week we would send out an email to all the the CMR firms that have shown an interest so far maybe some that we'd like to have interest in to perform the projects otherwise it'll be publicly noticed as well and then during that period looks like the week of July 10th we'll be looking at a CMR pre-proposal conference where the Architects will be there our lawyer will be there and we'll answer any questions that those companies might have and getting involved with
056the district and then CMR Pro proposals would be at least 30 days after the RFP goes out and we're picking a date right around Tuesday July 25th a CMR selection committee meetings these will be held August 1st 2nd or 3rd that's the time when the selection committees kind of picked our top three to five companies maybe depending on how many kind of stick out to that committee is the number you bring them in interview uh go through the process after the interview of raiding it according to the table and then have a recommendation for the board to consider on August 14th so and then the second Board of Education meeting in August 28th would be to approve the CMR contract so that's kind of the process as a whole it takes a lot of time
057according to statute to go through but I think in the end it's a Well worthwhile process for everybody involved to go through to get the best companies involved in our projects questions I know you said you worked with Perry Law Firm on those percentages as they must have used those on other products that they've done or we also uh going to rely on them to help us get the information we need to be able to answer these questions from those that are submitting correct the proposals are pretty much broke out by that percentage so you'll see when they turn them in they'll have those as usually the categories that they want to highlight with their companies and then if you have any questions within those categories you're sure certainly well done and then they got
058to submit supporting documentation for those areas of the RFP that then and I would just say that the committee is spelled out uh right now we're looking the buildings around the finance committee is looking at the three site committee members or the buildings around finance committee members being involved on that committee uh of course Larry we're our director of buildings and grounds our Architects are by Statute to be on that committee Derek Aldridge from Perry Law Firm will run the committee and then we'll have two patrons community members involved on that committee one which has to have some background in construction so that's the whole upper right now in that particular we're gonna we gotta pick those two people that's July 7th whereas our next meeting for that with the buildings grounds finance committee and
059then we'll bring that to you on July 10th as a recommendation for that committee participation aren't you just Clairvoyant because that was my question who is serving on the CMR selection committee so thank you for answering in advance of my question thank you it's a lot I get it it's it's tough to juggle all this on who I whom I told this the committee or the board but uh yeah we'll get it we'll get it straightened out any questions that you may have if you're not on the building's grounds of finance committee please holler at me at any time you said this was two-pronged does that mean there could be two contracts with different cmrs that's what it's looking like right now that the building grounds a finance committee and I would recommend to the
060board is going with two two contractors yes I I think it's noteworthy too particularly for our viewers at home that may or may not have this cover sheet in front of them basically what your board of education is discussing is a scorecard to evaluate potential vendors to do business with us on construction of the bulk of the 2023 Bond three of the criteria uh come in at 20 those are your top three and I I want to draw your attention to one of them the ability of the construction manager to perform within the time specified hitting deadlines one of three that hit 20 percent and I think that's noteworthy in that this board of education has had many conversations and I think frankly expressed some displeasure with some contractors that we've used in the past
061using the old design bid build model and in many cases you get a low bid but in many cases you don't hit the deadline and unless there's a liquidated damages Clause you have no very little ability to hold that contractor accountable so I think this is a really big move for our district I'm I'm proud of the board for uh for going down this road obviously I'm sure there'll be bumps in the road anytime you use a new model there's going to be some some lessons learned but I think for maybe the first time since I've been here we have some tools in the selection criteria to make sure that we're picking somebody that can deliver a high quality project and just as importantly bring it in on time and that is something that we've
062certainly had some challenges with so just wanted to throw that out there uh Mr one more um key walk through and I I assume this was probably going to be similar to how we did our like Bond servicing contract uh the last time but how the committee is going to do the scoring of these I think is it going to be discussed out in the open uh and come to the conclusions or what is the expectations of everyone on the committee then to utilize the scorecard yeah great question Marcus we're so the committee would interview those firms that they select to interview the top companies that they think according to the proposal uh we bring them to the table they give a presentation usually about 20 minutes 10 minutes questions if you have three of
063them it does it's it's a big night you're looking at about an hour and a half of your time there and then we end up spending an hour to two hours depending on how long it goes uh discussing uh the scoring rubrics and any questions that you might have in scoring those companies and the lawyers that's why he's present the whole time to answer any questions that anybody has that's going to be scoring the companies and then at the end we total them all up that night and we kind of pick our top two to go present to the Board of Education if that is the way we end up going with two I was going to say I know at the meeting I had asked do you typically just do the two or do
064you did you what was it last time when you guys were doing the bond was it one you had one and now we're going to two right we were talking uh you talking about the last time we did this or right what we've always done design bid build so that means every project has its own contractor in bid right okay so this time we're looking at putting our projects under CMR over here one and some projects over here in cmr2 which will be about 110 million dollars worth of work uh 55 50 55 50 55 over here so this is different than any any way we've ever done it here at Papillion La Vista I've had experience with it for Springfield platview for example we did 28.5 million dollars we just did one company because
06528.5 million dollars is two projects we had uh pretty easy for one company to handle we're in this situation you know we have a decade's worth of work for one company and we want to try to split that up to where we can get it done yeah under that four and a half time your time period okay so the people that have previously done too it's been successful for them rather than just having like Springfield right I'm sorry do you get what I'm saying uh so like since there's two of them is this more beneficial is that why we're switching over is what I'm asking yeah I think you know the benefits were kind of discussed we're looking at um you know of course the quality of projects because you typically with this method get
066some higher top quality subcontractors uh you got time constraints or an issue these companies will vetted and seen that they've getting projects done on time for their clients okay and then of course their fees are reasonable and then you always get a lower bid too because you're still with us with the way we're doing the CMR you still get three subcontractors bidding for every project in every area of a project and they have to present those back to the board so you get that transparency piece with this even as well other than just the low bed does that make sense yeah yeah can these two different companies can they use like the same contractors sure you're going to see probably yeah you'll probably see some of the same subcontractors underneath each company okay but that
067won't be conflict of active right yes like too close okay okay yeah thank you no great questions I may have missed this I apologize if I did um would these two perhaps be working projects simultaneously is the intent right if I'm understanding correctly okay that I just want to make sure I would understood that yeah and you know and this is this is kind of pre-construction things but plans in July are to come out from the buildings grounds of finance committee and kind of say okay here's who we're recommending to be first out of the gate you know this company may have two or three projects that we want to kick off right away these companies may have two two or three projects that we want to kick off right away so you bet we'll

069once more you know it's amazing we're at this point we're to the point where we're approving City leases in an interlocal agreement so very very happy to be moving along at this at this pace here with the bond being passed in May um if approved tonight uh the local interlocal agreement to the city of La Vista and the least City uh Papillion we'll go back to each each of the cities for their Council approvals and there are waiting to see if that happens and taking it to their appropriate people in July I'll make the motion to enter into a series into a city lease with the city of Papillion for the use of freaky field and the interlocal agreement with the city of La Vista for the use of the city park as presented second

071that that use those fields for each of the programs so yes absolutely we want to continue to have a relationship uh with those particular programs okay so we'll like yep absolutely okay thank you that was a great question Brittany so that made me wonder what if the city wants to lease that to somebody who wants to use a pro tem for something do we have an obligation to honor that um we'd work together on those particular situations not that I would know of now like the city of Lavista for example there is some times when we're not using the field that they would still like to be able to do that that's going to be fine on our part our maintenance though we're required to maintain them what happens if they trash them yeah I
072mean that that'll be discussions just like just like happens now I mean with the two facilities if we happen to you know do some damage on the fields and we'll come and we require an insurance policy from the whoever's leasing the field to make sure that any damages done can be covered through those costs yeah through our facility use policy we do require Insurance of any outside groups that use the fields okay thanks yeah we have that we have that in place now with any outside groups that want to rent our facilities correct but then I mean technically we have first right of use so therefore the city would have to come and ask us to sublease if it was going to be something of symptoms substantive nature I understand that but if some group
073comes in and they're doing things that are damaging the material because it says we are responsible now for maintaining it that cost Falls to us so I want to make sure that we're covered financially if a outside group comes in and uses a facility that we're now responsible for that there's insurance to cover any damages that are done yes correct yeah it's not it's in our facility use agreement so if they would come to the city they would have to come to us to get fill out that which does require Insurance they're to host a outside group once a host a softball tournament for example we would have to approve that and they would have to fill out our use and abide by our policies my question is kind of a follow-up to that under
074this kind of lease agreement who's responsible for vandalism to the fields and what would cover that expense because I'd like to think it would never happen but we've all seen it yeah I would say vandalism um and this is something we haven't talked about but it's a good question I mean that usually rests with the owner of the facility in that particular situation so that would fall under the city's insurance policy to deal with on any yes I will clarify that but um you know just like if you were subleasing I mean leasing something out an apartment or a house if some vandalism occurred in those situations their insurance company would cover it with that one because I kind of feel like that is huge just because you know kids like even after hours they
075go to the parks and they can just do stuff um should we hold off on doing a vote until we figure that part out I I think if you read the contract it says we would be responsible for just the the general maintenance on it whereas if you then and that's under the building construction Improvement and maintenance but then if you go to the premise condition which probably fit some of those things um it talks about um oh wait where was I looking at it yeah like the Lisi which is us we shall keep the field in a neat and tidy condition um not promote or we can't put Pulsar signs and so on uh I thought I was just reading where the lease ore has to handle the um the like water and the
076electrical and any of the uh bigger issues that is not general maintenance to the fields oh yeah at least or so that's the city shall maintain at its cost restrooms drinking fans electrical systems uh and and any of those like those bigger items that would be outside any of I take that as any anything that's outside of just like General wear and tear maintenance on it and that's the top of Page Three or the second paragraph of Page Three I'm in section 13 it does dictate what like personal property that what we're responsible for and what they're they're responsible for so I mean that's addressed in the in the in the lease document itself it doesn't specify vandalism specifically but it does talk about damages occasion and then it gave some for example vandalism's not
077listed but certainly certainly can check into Brett um so to Ms holtmeyer's question about do we table it is there any urgency to this and uh this is a board decision not an Administration decision to whether take uh the voter to table it but is there any urgency to us getting to this sooner rather than later you know preferably we would get it done tonight I mean one of our insurance companies is going to cover vandalism whether it be the least or the lease or so we just need to get that clarified overall on that and get that information back to the board but one of our insurance companies is going to cover that yeah that's all I want to know for sure is that some insurance is going to cover so that the district

083very much uh Mr Bailey uh members of the board just as a matter of review because not everybody in the community probably follows this maybe as closely but by Nebraska State Statute the superintendent of schools must be evaluated twice in his or her first year of employment and not less than annually every year thereafter and I'm in my finishing up my 10th year so statutory we're only required to have this conversation once but as a matter of practice we have it at least twice in addition to the formal and informal conversations that the board has with me on an ongoing basis so just the way this timeline kind of works so that the community is aware going back to the board retreat that I mentioned in my superintendent's report typically we meet in July August
084and it's during those conversations that we start talking about goals for the upcoming year and specifically the goals for the superintendent and the manner in which the board wants to evaluate me so we settle on goals typically July August typically the board takes action no later than late August September and then I provide an update to the board in nov November December kind of a mid-year update here's the work that's happening here's the progress made here's the progress that hasn't been made and then typically in late May early June we provide an end of the year update and then the process continues and on it goes so uh the two pieces of information I'd like to share with the board and the community this evening first is an update on the six goals I certainly
085won't read this to you because it's a multi-page document but just to give the board and the community some highlights goal number one for the current school year was execute the district strategic plan we've made remarkable progress over the last five years typically the district adopts a strategic plan It's A Five-Year Plan big overarching goals rigor retention and recruitment as staff and supporting mental health are our three goals and in spite of the fact that kovid interrupted this process rather rudely we made some pretty nice progress and there's some specific bullet updates on that goal two was to develop an engagement plan for the district facility needs that largely revolved around not only finishing the Bond projects but certainly engaging the community on the 2023 Bond and again want to thank our community again for
086your outstanding support on the bond that will certainly be a goal I'll recommend to the board to continue that process as we continue the 2023 Bond goal number three was District climate culture and visibility uh there's a number of initiatives that are outlined there in terms of not only for myself but the administrative team getting out in the community getting out in our buildings and being visible that became doubly important after the pandemic when uh by necessity because of quarantining because of social distancing because of us shutting our buildings down largely to prevent the spread of the virus our visibility wasn't what it was in previous years so that's something we've really tried to accentuate goal number four update District Safety and Security protocols I think we can all agree that this is one of
087the most critical if not the most critical goal that we have the district is keeping our students and keeping our staff safe we've made some pretty remarkable progress not only with things like camera but building infrastructure and certainly the 2023 Bond will help us build on that goal number five five of six staff recruitment retention strategies Dr settles and her team have done some remarkable things there the staff recruitment retention bonuses we've done some things uh with with Peridot teacher ladder program obviously those negotiations is a big part of that and finally goal number six develop pandemic recovery plans to be perfectly blunt we did very little with Goal number six and I'm grateful that we didn't have to do any of that we built that in as a bit of a safety net that
088if heaven forbid uh Health Department have stepped back in and started reinstituting some safety protocols we didn't have to do that and with any luck at all none of us will ever have to go through that again so those are the the six goals uh I'd certainly take any questions one last piece of information before I uh open it up to the board every year that I've been superintendent we have done in addition to the formal evaluation that the board does of me typically they do that in November December I do a survey an anonymous survey of our entire administrative team so if you're an assistant principal a principal a director an assistant superintendent you have the ability to fill out this survey it is all done anonymously it is deployed by Ms barenko I
089do not see the results until they are compiled and we track this very carefully and and what we tend to find is sometimes my scores go up according to the team sometimes they go down and the point with doing it is so that if we have scores that are a little bit on the lower side that gives me something to shoot for for the following year uh we asked the same 10 questions every single year so that we can kind of see what's working and what's not where I'm hopefully doing better as well as where I need to improve those 10 questions are lumped into four categories visibility trust communication leadership teamwork I will tell you and so the board knows what they're looking at the SAA column strongly agree agree the N column shows
090the neutral responses and then the DSD is disagree or strongly disagree and you can see kind of where my scores fall out and what we've also provided is a table of results going back to 2014-15 so you can kind of see where the scores Trend up and where the scores Trend down as you can see at a glance question number 10 is one that's lowest scoring and that's one that certainly we'll be talking about in The Retreat it's one historically if you look at question 10 over the years it's traditionally the one that that requires the most attention and in some years we've made some good progress and in other years we've maybe not shown as much progress as we like I believe all plcs district administrators work together as a team so in any
091event I think that's just one more data set for this board to be aware of we'll also be having some results shared from the community survey soon and the staff survey Ms Ayman is in the process of finalizing that and we'll be sharing that with the board as well but this is specific to me your employee and I think that this is just important for you to be able to see where hopefully things are going okay and maybe where things need to get better so I would conclude with that and also conclude by saying I am grateful for this board for this community I'm grateful that you employ me I do not take this job for granted superintendents come and go all across this great country of ours every single year and to stay in
092a class A school district for 10 years is something I am incredibly grateful for and I will never take that for granted and with that I would happily answer any questions the board has about either the six goals or the um the survey from the administrative team I have no questions on the survey but I will say that it's an it's impressive to see that even if by a small amount all the way to a larger amount every single question saw an increase in the success rate over the previous one and I think some of that even the previous two and I think some of that has to do with work coming we've come out of covid where a lot there were a lot of uncertainties and things but it also speaks to the job
093that a superintendent is doing we know for example my superintendent is visible to my staff and in my school department we saw a decline in that during covet but we're seeing it come back up the way it has been before so for me this speaks volumes because these are people this is other people expressing their beliefs about these items that we all hold as very important to the superintendent in the job that he does every day so I'm pleased to see the outcome on this survey yeah I want to Echo uh as someone who's who's had to go through these on the other side too um you know it can you never know what's gonna what those results are going to be before you get them back especially with you know everything that we this
094we've had to do uh the last few years but like you said every score going up over the one year and nine out of ten up over the two years with the only one that wasn't was question three which was a hundred percent or a hundred percent two years ago 100 percent uh this year uh which was uh great to see and also um you know getting these results hopefully gives you the opportunity to really dive in too and then come up with uh you know additional action items and and how you know everyone can continue to get better and where to improve uh but also not you know uh led up on some of these that you've worked so hard to get to that level uh because you know uh if you pull back
095you know you don't want to also be following in the the wrong direction so keep doing what you're doing on these scores to be improving and keep taking that feedback to try to get just a little bit better every year so thanks looking at this is one of the things we talked about at the leadership conference was the uh reviewing the goals and going you know going over what the superintendent um how they're doing and how they're doing on those goals and and again it affirms what we do here because uh I know there are some districts that are asking questions that were there didn't really even know how to do the whole process and then not only do we do it once a year but we do it twice a year when we're not

099from obscene and pornographic material on the internet it should be equally important that we Shield our children from the same obscene and pornographic material that exists within School libraries this approach to the internet is not the same as the current policy with regard to books where the process is to consider the use of the material and its relevance as a whole rather than on passages or selections taken out of context if we are so convinced that books should be assessed based upon the material as a whole and not taken out of context why are these same standards not applied to material on the internet if pornographic passages of a book can be deemed acceptable by considering the material as a whole why draw a line on pornographic material on the internet in 1987 American Artist
100and photographer Andre Serrano displayed a photograph of a plastic crucifix submerged in a glass tank of urine entitled immersion piss Christ the piece was a winner of a competition sponsored by the National Endowment of the Arts if something like that can be deemed socially acceptable and even receive a reward how are you even able to draw any line for material on the internet do we actually think that school librarians hold the morally mantle for communication for communities and so whatever they choose to purchase must by default be acceptable to not only students but also parents Guardians and community members I hold Librarians in the highest regard but I do not grant them such a lofty position in the community given the recent comments and evidence provided concerning the existence of obscene and pornographic materials in

102be unhappy about every outcome and this is not because there's a problem with the policy but the problem is you pushing distrust in our in our schools sold was the first book challenge sold was published in 2006 so why 17 years later is this being challenged now for the first time all boys aren't blue is the second book now being reviewed just for the record there is one copy in plhs that has never been checked out by a student and there was one copy at South however it was checked out by a teacher over a year ago and never returned this challenge was never about protecting our children because they've never had access to it parents and committee and Community please do not be fooled into believing that books are dangerous just because this anti-book
103group believes if you throw the word porn around enough that you will get outraged into believing it's true the definition of pornography is material that is created to cause sexual assignment excitement well your child's first pornography experience come from a book are you kidding me of course not our kids have unlimited access to porn through a device that you've bought for them and they have access to 24 7. I also wanted to mention that this group this anti-book group is having a protect our kids from porn Workshop in July how kind for Brittany's Church to be hosting this they seem intent on pushing the narrative that books are porn and as a bonus at this meeting you can learn how to win a seat on this nice board here I'm going to spoil the secret
104and tell you that they're probably recommending that you start an outrage against someone or something and just keep pushing it and pushing it but as a parent I want to learn about how to protect our kids while using social media how to block access to porn and how to talk to our kids about the dangers of sexting these are real concerns to address to keep our kids safe I learned today that this anti-book group's next proposed scheme is to check out all the challenge books and then just not return them unbelievable this shows that they have zero respect for our district and this policy most importantly it speaks to their character if you can't win the honest way then you're going to lie and cheat until you get your desired outcome this current policy supports
105parental rights and determining access to materials for their child do not I repeat do not try to appease this small group but instead hold strong to the current procedures if they want to continue to challenge books or steal them please know that you have many parents and community members that will happily review or replace books as long as needed thank you okay thank you next Ms Kimberly Moore Kimberly Moore Alpine Village Apartments La Vista um I would like to talk about when I was in high school at Papillion La Vista I checked out every single VC Andrews book there was for those of you not familiar with VC Andrews she writes books that have incest in them they have sex in them they have all of those things um nobody ever was at a school
106board meeting protesting VC Andrews being in the Pavilion Livingston Library uh four five years ago my daughter in Elementary School uh checked out the Hunger Games which is a story about children killing each other no one protested The Hunger Games um so basically yesterday Donald Trump in a speech that he gave it might have been the day before said that it was amazing the amount of people that cheered when he talked about banning trans uh gender books from schools and he said it was amazing because five years ago none of you knew that this even existed um basically it's very concerning to me as a parent of a student at Papillion Lavista that so many community members that don't have children at a school are challenging books are speaking out against this and are super
107concerned with my daughter who is becoming an adolescent and her basically you know her knowledge about sex or something that is my job as a parent and is my job as a parent to monitor that so I would like to propose a change to policy 6405 that book challenges can only come from members that have children in the schools um because it's the parents that are the most relevant to their children that are in the schools and there are options for parents with children in the schools to off their child out of being able to check out books from the library you contact the school and you let them know our forefathers that form this country were very against censorship um anybody that knows anything about history can tell you that they would be very
108against this and they would be very against uh changing it in order and opening a door that could lead to significant more books being banned for little things thank you all right thank you next is Ms Sarah larotoni Sarah larotoni 8816 Granville Parkway I would like to address you guys address the board regarding policy 6401 and the selection maintenance and deselection of books or materials for the library um I'm not an eloquent person at the best of times and I've been struggling to get my thoughts on order on this one um so I'm going to I'll start by referring to um on your policies webpage under 6401 procedure the Board of Education recognizes the library Bill of Rights as drawn by the American Library Association as applicable to the Papillion Lavista school district and the
109district shall um and they list out six bullet points I'm only going to focus on the first one here number one provide materials that will enrich and support the curriculum taking into consideration the varied interests abilities and maturity levels of the pupils served um libraries are Super Rad places I think we all know that and by extension bookstores are just as rad as well and I think one of the reasons that they are so rad is because they have um a whole host of characters and viewpoints um that can be found within them um for everyone everyone can find themselves in a book um I was bullied very severely in Middle School something to which I did not tell my parents until I was a much much older adult and desperately trying to fit in
110in middle school I stayed as far away from my library as I possibly could because it wasn't cool and then I moved two weeks into my freshman year of high school to another high school that had already been in session for at least a month and that was enough time for social and friend groups to be solidified already and so I found my way to the library because I had nowhere else to go and that is where I found myself I found me in books through all the different characters there were varied characters um the plot lines were diverse the characters were diverse they had controversial subjects and they were written by controversial authors and my parents gave me that freedom to pick those books out and read them for myself and they gave me
111the openness with them to discuss what I was reading and if I had questions to ask them um I do hold our Librarians in the highest regard they went to school for this exact thing and I put my trust in my school librarians to pick out selections that are applicable to my child um if you don't want me telling you what your kid can't read then don't tell me what my kid can read leave that up to me as their parent don't take away everybody's choice because you don't agree with it can we can we please stop the booing please respect everybody's opinion that is not proper board to curb that will not be tolerated please stop booing no sir that's not proper we respect others opinions yeah he has in the last three okay

113via email but wanted to summarize a few of those points here for the board we need to disassociate ourselves from the American Library Association or ala they do not reflect Our Community Values or standards and their views and opinions on topics has zero relevance to protecting our children from pornography the proposed Community standards committee that was recommended by a previous speaker would be a much better solution closer to home and More in line with state laws what or who will be disciplined for the state we find ourselves in or for future failures in regards to our library materials somebody or somebody's allowed this to happen should be the superintendent the principal the librarian or all three of them we have layers of bureaucracy written into the policy but if there are clear disciplinary procedures for
114continuation I could not find them there should be an entire section of the plcs website designated to this topic specifically new books coming into the system either on teachers bookshelves or in the libraries should be listed somewhere or sent out in an email for monthly review and deselection if necessary our criteria should not be obfuscated in some PDF in the board policies that nobody ever looks at the review request form should be available to be completed online and as a PDF the lack of communication by the board and district is indicting do you know how few people watch these school board meetings and yeah this is the only real communication that's occurred on this topic the team couldn't stop communicating with me about the bond but where is that level of effort in regards to
115our books when it comes from to sucking money from taxpayers for pet products we seem to have unlimited time and resources but on the issue of exposing our children to moral depravity nobody seems to be everybody seems to be silent about how this is happening and how to fix it other than newspaper articles when and where is the training on how to use the library app or to restrict books have any mass emails gone out and I just missed them that's certainly possible how and where are we going to start training parents or making them aware of what materials in the libraries what their children and what their children are able to access imagine if we had only discussed the bond in board meetings and still expected it to pass parents on the review awards
