001I think we're ready is live, right? >> Yeah. Yeah, that's not a problem. Meeting starts. We're starting to have to speak. >> We're starting. >> Started. You all agree? >> Yes. Next Friday. >> Can I get people back to the Knicks game? >> [clears throat] >> I'll call to order the regular meeting of the Bagota Board of Education for Tuesday, December 16th, 2025. I'm sorry. Please stand for the flag salute to the flag of the United States of America to the stands one for all. >> Good evening everyone. They stand. Oh, the New Jersey open public's meeting law was enacted to ensure the right of the public to have advanced notice of and to attend the meetings of the public bodies at which any businesses affecting their interest is discussed or acted upon. In accordance

002with the provisions of this act, the Boda Board of Education has caused notice of this meeting to be published by having the date, time, and place thereof posted in the Bodora Burough Hall communicated by letter to the record file with the clerk of the Burrow of Bagota and posted on the Bora Board of Education website. Her file, >> Mrs. Alvarez absent. Mr. Alvarez absent. Mrs. Cruz >> present. >> Mr. Navaro >> present. >> Mrs. Olivo, Miss Ruckett absent. Mrs. Salom >> present. >> Mr. Chavez >> present. >> Mr. Miranda >> present. >> We have a quorum. >> For the record, Mrs. Ruckett had a work event. Uh, Mrs. Alvarez had a lastm minute um emergency and uh Mr. Alvarez should be coming in at any moment. Also, President Superintendent Damen Kennedy, our board attorney Thomas

003Coin, board secretary and administrator Von Epsil, board secretary Elizabeth, and our lovely student representatives, Himemena Vargas. >> Um, I'd like to open the floor uh to citizens on agenda items only. Do I have a motion to move? Motion. >> Okay, so that was Olivo for a motion. Chavez for a second. Any board discussion? All in favor? >> I. >> Any oppose? Is there any member? Please state your name. You have five minutes. There's no one here present other than an outstanding financial advisor. No one else. No one online. Yes, there is. No. Okay. I like to move I want to move closing agenda items. Uh discussion of agenda item. >> Motion. >> Chavez for a motion. >> Second. Cruz >> for second. All any discussion? All in favor? >> I. >> Any any opposed? No.

004Um before I move on to the superintendent's report, can we open up to follow student representatives? >> Yep. >> All right. Go ahead. >> Bota High School has had an exciting and successful month as we are halfway into the month of December, showcasing student achievement, school spirit, and growth across academics, athletics, and the arts. This month, the Bagota High School bowling team brought home an impressive win at the Parkway lanes, demonstrating dedication and teamwork. Their success sets a strong tone as winter sports officially begin with athletes across all programs working hard in preparation for a competitive and rewarding season. In the arts, the fall play Peter Pan was performed in our brand new auditorium. The production was a huge success and many students and community members expressed gratitude for the upgraded space, especially the more

005comfortable seating and improved atmosphere. The new auditorium marks an exciting step forward in Bagota High School and enhances the experience for both performers and audiences alike. Academically, Boot High School continues to shine. This Thursday, the National Honor Society will hold its induction ceremony, welcoming several hardworking and dedicated students into the organization. This event highlights the school's strong commitment to scholarship, leadership, service, and character. College acceptance season has also brought great pride to our community. Many seniors have begun receiving acceptances to various colleges and universities, proudly displayed in front in the front entrance of our school. So far, two seniors have officially committed. Anna Michelle to Boston College and Jason Alvarado to Georgian Court University. Their achievements reflect the determination and excellence of our senior class. Overall, Bagota High School is thriving. From athletic victories and

006artistic accomplishments to academic recognition and college success, the school continues to grow and excel with motivated students, supportive staff, and ongoing improvements to facilities. Bagota High School is well positioned to continue this positive momentum into the new year and beyond. Thank you. >> Thank you so much, man. Thank you so much. >> Very good. First up, I have uh HIV findings. We had one founded in the middle school and one unfounded in the high school. Also, the BHS media center is under renovation as we speak. They're literally working sec second shift and they are in there now. It's already cleared out. Um, so we are hoping to get that space back in April, which will be uh just about the end of our referendum projects. Uh, reorg meeting is scheduled for Tuesday, January 6th at

007700 p.m. right here. Please mark your calendars. I want to wish everyone a happy and healthy holiday. And now I'd like to have Mr. Wilcox come up to present our district financial audit. There should be a microphone there. just talking to it so the people at home can hear you and it's recorded. >> Victor, I hope you out. >> It's probably on Nice. >> Yeah, that's fine. Yeah, you can sit there. That's perfect. Actually, sit there. >> Sit there. All right. Can I >> make myself comfortable? >> Not too comfortable. You don't interfere. It's >> okay. [laughter] >> Why thank you, Mr. President. So kind of you. Well, >> good evening everyone. Uh, I'm here tonight to present to you the findings or results of the June 30th, 2025 annual audit of the board of

008ed. Um I'm happy to report that once again, uh we've issued an unqualified opinion, a clean opinion on the financial statements of the district for the year ended June 25. I'm also I guess I'm happy that for the second year in a row there's no audit findings. It's pretty pretty unusual that [clears throat] there continually consistently there are no findings during the course of the audit. That's a testament to your business administrator, to your board office, to your administration that that they they work in a very meticulous way in the way they handle all the transactions and all the funds that pass through the board of ed on an annual basis. And considering you're still finishing up the all the construction and referendum projects, it's pretty exceptional that again for the second year in a

009row, no findings in the management report. I think uh should be commended. He didn't he didn't even pay me to say that. >> And he's not going to. >> Mr. President, >> I just know her. Paul, >> you know what? You're right. You're right. Um, the district is in sound financial condition. Uh, you ended the year replenishing your capital reserve. You still have $900,000 in merchant in your uh emergency >> reserve I believe. maintenance reserve maintenance sorry maintenance reserve and you continue to operate consistently healthy and I we had a finance committee meeting earlier tonight and I just because I can't help myself imparted my personal knowledge to the committee that by by doing what you've been doing by budgeting correctly By making sure that the budget's fully funded on an annual basis, you continue

010to be able to generate excess funds to put in capital reserve to replace money that you have to withdraw during the year. And that's what keeps the district healthy. And what you're going to start reading, I believe, over [snorts] the course of the next few months about other districts around the state, they have not been so lucky. I mean, you've probably read articles or heard about the issue in Montlair where >> they're facing over a two-year period over a 20 almost a $25 million deficit. Um, it's it it's much more challenging these days than it has been in the past. So again, your your your your business administrator, your superintendent, your administration should be commended for job well done. And with that, if any of the board members have any questions, I'd be happy to

011try to answer. >> Anyone have any questions? >> No. >> Thank you, Mr. Wilcox. >> Frank, you have a question? I don't have a question but I will say that uh I do appreciate you know usually auditors are like one time a year thing but Mr. Wilcox's firm which I have a very um fond respect for because his sons are also taking care of the firm and they're moving on successive planning is is huge. Um I met with Mr. Wilcox um about 10 years ago or so down at at Burough Hall uh when I was a councilman and I will say that some of our healthiest moments u have been under his purview. Uh he's brutally honest, doesn't cut corners. Um and you can ask him almost any question at any given time and and

012I think Heron knows that. Everybody knows that. Very cookie cutter. U which I tend to joke because it's it's such a good thing. So, I I do want to commend your firm for consistently and it's been three years of great notes. I think even four, but I won't brag about it as much. >> You know what? I'm getting a little older. My memor is not so good anymore. >> And and I don't want to brag more, but I've been here six and he's got six. So, let's talk about that. But we have been outstanding. Now I have to change my script for that. >> I will say though that that is a testament to uh who I call money man because he doesn't pay what he shouldn't pay. He will not pay extra and there's

013no bells and whistles with an giggles. Uh it's really cookie cutter with him as well. He's extremely overly extremely responsible. If I had a way to take him to a private firm, I would because he is the kind of temperature you need in a financial room. Um, very well balanced, very uh just it's monotone at all times, consistently delivers uh what you're looking for, what you need, and the betterment of any financial institution or services. So, I can see how you guys uh jive together. Um, Lizzy, look at how she signs. Everything is colorcoded uh for individuals like myself who are very speedy in nature. Um everything is signed the entire process um and the process in the office. But you can't take that away from Kennedy, right? Kennedy, there's something very unique about Kennedy

014in leadership is that he allows everyone to do their job at their absolute best potential. There is no extreme micromanager. It's like if you mess up, you're an adult and we're going to figure this out. and that's when the heat turns on. Otherwise, he lets everybody be their maximum potential of a professional and you cannot take that away. U but I will say that this board is exceptional, right? I've seen it. I got to tell you guys, we're going to finish with like seven seven plus million dollars in capital reserve which the bod has never seen. So let's let's highlight that very quickly. Um but it's always about the less with more or more with less. So we have delivered to this town more than it's ever seen with less because when you end with

015these huge numbers that they've never seen, when you have that backing, when you put back 900 and some,000 and you still have the equitable services, you have the same level of service, you have more service, you have classroom teachers, we're not lacking in any area of our district. Um, you might have a problem with Robert behind you, but that's okay. But when you're simply not lacking, and I say this because look, yes, I'm part of certain messages. Yes, you know, Lizzy sends to the finance who's going to come sign the bills. All of that brings delivers this kind of um of success, right? So, thank you, Jose. you have spearheaded financial, BC, Robert, you guys all work together to sign those bills in a timely fashion because I know a lot of people don't understand

016that from an accounting standpoint, but if you're paying bills late, you're not making money on time. That's one business 101. So, when you pay bills on time, you sign things on time, you get the staff to put it in front of me on time, that it's just it's a teamwork. And I truly hope that if I'm not here one day, if we're not here one day, that sort of process continues because we know the past. We know what's occurred what before we got here, it was not like this. And this whole team was not like this, right? So this entire team for BOD's team, I call it the BOD team, we have deliver exceptionally from a huge capital reserve to putting back in our uh maintenance reserve to delivering fields, CTE buildings and everything we're

017delivering. It's just it's exceptional. It's exceptional. I'm proud of it, you know, and I I want to I definitely say I want to finish my tenure strong and with a team that matters. So Kennedy, thank you so much. Lizzie, >> thank you. Thank you, guys. Thank you so much. >> Thank you, sir. >> Happy holiday. >> He's good. Thank you. >> So, we're moving on. But before I move on, um, in in spirit and light of everything that is occurring, I do wanna I did want to bring something up because I, you know, I don't know what's going to happen next year. You know, I don't know who sits here next year and it's been in my heart searching and we've spoken about it publicly. Um, and we should bring it up again and I

018want to make sure we seal that, put a stamp on that today. So, we have a career technical building. How's it going? Has anyone been there? Thanksgiving was amazing there. the children cooked. I know we've all been there. Um, and wait, let me back up. I want to point something out to you because you hit me hard. All right, a good one. Um, >> you said something that struck me and it's beers thriving. >> You know, >> that was our slogan >> really >> for some of us. Yes. And you said that and that really because we've had three student representatives under my tenure here because we didn't have that we didn't have that u offering before and and and I can see gradually I pay a lot of attention. I don't forget anything I

019say or someone says and I watch gradually your statements and it just gets better and better from you know we're starting to look different. Wow, we're getting better. Wow, we're getting this. We're lucky to see this. We may not see it. And you said it's thriving. I mean, you just nailed it. It is an honor for me and I think this entire board to hear that, isn't it? Like >> it's what you guys are doing. >> It's who it's for you. And to hear that we're thriving, you know, as a resident of Bota. We're residents of Bota. And it's just it hits me. It drives it home. You know, just so you know, it's everything we were ventured out to do. We spoke about this. We met on this. We didn't violate any Oprah laws

020because we did it beforehand open public meeting before we decided we said what is our common goal and everyone said we're going to make BOD thrive and BOD today and its entire district is thriving not just school we partner up with Burough Hall. We we delivered [clears throat] to our town something they could not deliver for themselves at the time and we did it. We did it and we we did it in communion. We did it in partnership. We did it in in a family form to to just give everybody something. And I think bod as you see it in a lot of areas is coming up. And you know it's funny bod was once spoken about and and you know I've had the luxury and benefit and all of it to be part of

021almost every advancement that bod's made. So not for nothing from the redevelopment to the warehouse rebuild to the veterans park when I to the I mean Jose even too. even Jose on planning board. So almost every advancement beoders made I sat at that table and I can listen to the process the progress right when I sit here and say oh them and us before and after it's because I've actually sat there and I hear what people criticize and just the other day there was a minor incident u at one of the Christmas tree lighting we're still getting criticized from a school district about our sports and this no one gives us gives the district time to elevate right now we have new directors right? New sports people, new things. There's new going on, you got

022to give that some time to breed and become something >> and you know with the new wreck. So I think that the trial and error of we've surpassed that and now it's just basically start building. We're building again and bod has been building and it's thriving. And though that word is huge that word is so huge is thriving. Um, I had someone walk into the CTE building and said, "I could have never imagined that that would have occurred because the CTE building is another piece, a new auditorium that for a hundred years people have been complaining about air conditioners." Okay, new bathrooms. Mr. Mitchell tells me that back way when he was complaining about bathrooms. We have brand new bathrooms throughout our school. You know, not that the bathrooms are like fun, but I'm just

023saying they're new, right? There's so much new that's happening. And so I think Bod is striving and I want to give, you know, I I need to applaud you, this board, because you guys uh were so instrumental in this process. So thank you as well, Mr. Kennedy. You're going to hate this, but I have to bring this up. I have said over and over again that that career technical building. So the so and just so that everyone understands when we decided to go on on this referendum project and just so you all know I contacted Kennedy on my very um I had just gotten elected and it was December and I was heading to a lakehouse or whatever and he called me and he introduced himself as he does but every new board. a gentleman

024that and and I said to him, I want fields, but God doesn't have a park where kids could thrive and I and I really I need to get fields, please. And he said, you're going to meet her farm. We're going to sit down. We're going to talk about all of this. And I said, what would you like? And he said, I cannot wait for the day that I see a career technical building in our district. And I asked him all the reasons why. Because I was, you can only imagine, I was probably opposing it in my head. Oh my god, how much more is that? But when he explained all and all the details and what it does for the the the variation of education in children and the hands-on, it sprung to me that

025you know what, why not us? Why not us? And Mr. Kennedy pushed that and I thought, let's package it. Let's do it. We all talked about it. We all met on it. We all voted. We all went out and to get it with our residents. And Mr. Kennedy should have his name plastered on that CTE building. He should have it. I would like to put it in the forefront. I don't know what you can tell me what it takes. Is it a resolution we have to put forth? But I want to vote to put Mr. Kennedy's name >> on that center. >> And if you could deliver that and I'll tell you guys, Mr. Kennedy put a lot of personal time into this. I saw >> guys before you continue and I agree with you

026100%. Um Mr. Kennedy's leadership is bar none. >> But I do have to say something else. Um, you have also been there >> for all of us. I think, um, I've seen the countless meetings. I've seen how hard you've worked, how hard you've you've given it all to make sure that this happened. Um, and I also had something in my head and I was like, you know what, let's let's bring it up. and it's the first time I thought of it. But I would also like to name something after you. >> Oh, >> I think and especially because of the admiration that you have for the fields, the as you just said it, it was your first suggestion and I was right there with you because I remember us that's how we pretty much all

027got together in the fields >> way before. >> Correct. Even way before that because we we have all known each other for years. Um the heart that you put behind it, the thought, the fight, the grit. If you were not that person, things would have not gotten done and we would have never been a step ahead of everyone when it mattered and I really want that to happen. So if I would also like to put a motion to name the Rotunda in the field. Not the field, not the whole name of the field. No, >> just the Rotunda, >> not >> as Frank Miranda's rotunda because the way that he spearheaded this whole this whole thing was completely amazing. And not just that, but you brought us all together. Not only did you bring us

028together, but you brought a whole community together. me walking down there every afternoon just to take a walk and seeing the community walking on those fields just walking around with their families. Um we have our seniors that gathered together one day just to walk around and it this has been one of the biggest things that ever happened to Bota and I want to thank not only Mr. Kennedy, but also Frank Miranda and the team and our board because we all had a big part of it. But I think you two were the essential keys for this to happen. So I would like a motion for both for Mr. Kennedy to have his building the building under his name and for Frank Miranda to have the what's under under his name. >> We're going to decide

029right now. >> Oh, >> one thing I I want to check and uh I just want to make sure we don't have to give any prior notice to the Department of Ed. that that's the one I think it's just a resolution. >> Okay. >> Uh but I just want to make sure we don't have to give prior notice to department of ed on it. So I mean maybe it's something we could do at the reorg meeting would be >> I have that's perfectly fine. >> And uh so but that's one thing I'd want to just double check on. So >> perfect. >> Yeah. So whatever that takes. I mean I I really want this is a candidate date. Um um maybe even just the slogan matters, but for for Kennedy it has to be the

030CTE building. You know, I saw Kennedy coaches himself and you know, his mom was an educator, a runner, uh strong woman. And you know, he spent more time with us and and running back and forth to Pennsylvania to see mom during her illness. And there's no way that I can let that go by and not give him the credit he deserves and the leadership uh acknowledgement that he deserves. So I just want to put that forward and and I hope that it can come through. So do we need to like pass a vote for a resolution like just so that you can work on it? >> No, that's all right. >> No, we don't need to do that. We would just I would just double check there's no notice required >> and then we do

031a resolution at the meeting you guys want to do it at either >> we don't have to make a vote >> to get you to work on that resolution. >> All right. Okay. >> So that was all guys. Um thank you Jose. I'm scary but no thank you. >> They say there's enough faces in the world. [laughter] >> You'll kill me later. >> Um I want to hold on guys. Uh so I want to move on to the resolutions part. Okay. Someone am I at 41? >> Both of them are >> they can't even >> you guys. Okay. [laughter] >> Absolutely. >> Approval of November 18, 2025 regular open meeting minutes. Do I have a motion to move? >> Motion. So, a legal uh motion chavez a second. Um >> take a breath. >> Mr.

032Mr. Alvarez, >> yes. >> Mrs. Cruz, >> yes. >> Mr. Navaro, >> yes. >> Mr. Solivo, >> yes. >> Mrs. Salom. >> Mr. Chavez. >> Yes. >> Mr. Miranda. >> For the record, I've read it. I was absentee. So, that's a yes. >> Thank you. Motion carried. [clears throat] >> Moving on to 51 policy section which is to is to resend second reading in adoption of policy and regulation 5117. Do I have a motion to move 51? >> Motion approves. >> Cruz. Do I have a second? >> Olivo. Any board discussion? Roll call or phone. >> Mr. Alvarez. >> Yes. >> Mrs. Cruz. >> Yes. >> Mr. Navaro. >> Yes. >> Mrs. Olivo. >> Yes. >> Mrs. Salom. Mr. Chavez. >> Yes. >> Mr. Miranda. >> Yes. >> Motion carried. >> 616 education seational section

033which is approved agenda item 61 through 615. Do I have a motion to move 16? 616. >> Alivo. Do I have a second? >> Second. >> Chavez. Any board discussion? Her file. >> Mr. Alvarez. >> Yes. >> Mrs. Cruz. >> Yes. >> Mr. Navaro. >> Yes. >> Mr. Solivo. Mr. Salam. Mr. Mr. Chavez. >> Yes. >> Mr. Miranda. >> Yes. >> Motion carried. >> Uh moving on to 77 which is the personnel section which is approval of agenda item 71 through 76. Do you have a motion to move 77? >> Motion. >> Navaro. Do I have a second? >> Second. >> Olivo. Any board discussion? Roll call. >> Mr. Alvarez. >> Yes. >> Mrs. Cruz. >> Yes. >> Mr. Navaro. >> Yes. >> Mrs. Olivo. Mrs. Salam. Mr. Chavez. >> Yes. >> Mr. Miranda. >>

034Yes. >> Motion carried. >> Moving on to 811. Finance section. Approval of agenda items 81 through 810. Do I have a motion to move 81? >> Motion. >> Albert. >> Chavez. Mr. Alvarez. Any more discussion? Roll call if >> Mr. Alvarez. >> Yes. >> Mrs. Cruz. >> Yes. >> Mr. Navaro. >> Yes. >> Mrs. Olivo. >> Yes. >> Mrs. Salam. >> Mr. Chavez. >> Yes. >> Mr. Miranda. >> Yes. >> Motion carried. Moving on to 94, builders and grounds for approval of items 91 and 93 through 93. Do I have a motion to move 94? >> Motion. >> Navaro. Second. >> Alvarez. >> Mr. Alvarez. Any board discussion? Roll call. >> Mr. Alvarez. >> Yes. >> Mrs. Cruz. >> Yes. >> Mr. Navaro. >> Yes. >> Mrs. Olivo. Mrs. Salam. Mr. Chavez. >> Yes. >>

035Mr. Miranda. >> Yes. >> Motion carried. Moving on to our committee reports. Does anyone have any committee reports other than Jose's outstanding finance committee report? >> Correct. And uh I'm going to say it again because I like hearing it. Um as for our state of the union, we are good and healthy. So that's a great thing. Um I want to congratulate on Damian the administration. It's an amazing thing that we can do this over and over again and be in good standing and everything is healthy and $900,000 in maintenance reserves and over 7 million in in capital reserve is amazing. That didn't happen when we first got here. We were struggling back then. But I I really want to thank this group. I want to thank uh Frank for making me chair of the finance

036committee. I've learned a lot. Um, and I want to thank everyone, the board, for always being there. So, thank you very much. >> No, thank you, Jose. Uh, you know, when I look at you, I met Jose on the soccer field when our kids were like too clean to go. >> Yeah. >> Richfield Park. Not to name any doubts, but they often made fun of go to school district and his failing policies and his failing financials. For a while, RP was like a very thriving school. They were like, they used to brag about it. It was really hard. Like, I just come from New York City and you know, my wife pushed me in this direction and and I met Jose. I'm like, why are they talking about us? And that's how we sort of

037met. You remember? >> And today it's the other way around. So, that means that anything could change at any given time. It's totally the other way around, right? We've never had a state oversight. We've never So, let's never not say never, right? Yes, I still believe in them. But let's let's continue to do that. Whoever's here in the future, whoever is hearing us, just continue to do that, right? There's there's no hidden secrets. We're an extremely uh transparent school district. We're transparent with our policies. We're transparent with our processes. There is no uh there is no two-facing in this district, in this table. Nobody here. I mean, everything we've ever done is straight up forward and we talk about it and we're not we don't I've never seen someone act like they're smarter than everybody,

038you know, just simply working. >> I was just going to say that because I think that's one of the reasons why a lot of districts get into trouble because many things are volunteer on our side, that side, >> not so much. they are hired for it, but people are so scared to ask for help and that's a lot of where it goes wrong. And something like this, when you're responsible for a district, young minds, you know, a community, we should never be scared to ask for help. And that's one thing that we have not we are not lacking of here. asking for help, putting people in the right spots that know what to do and um and letting them shine when they're supposed to, not micromanaging it. And it's it's why we do so well.

039So, thank you all. You know, listening to them on Flare, yes, I knew of it, but hearing it over, it just scary. >> Not having someone from the state coming to watch us, that that has to be scary for those places, those districts that do have it. I really am grateful that we don't have to have that here. Um, as a parent, as a as a trustee, um, it is wonderful to know that with your owners, we are. So, thank you. >> Yeah, we're, you know, Trina, we're not isolated. Mr. Kennedy, one of the things we talked about is talked about leadership. Mr. Kennedy uh, sits on the board of superintendents. I think you're the president, right? Uh, I'm on the South Bergen jointure as a board president, but then I am the secretary of

040the Bergen County Superintendent Association. >> Yes. And and he's quiet about it. And I'll tell you, I remember when he was like thinking about it, he let's do it. Should I do it? Yeah, let's do it. Because I said, we're going to get access to information. We're going to compare it. You know, when you're there, there's the rich towns, the mediocre towns, you know, all these towns and they call these names and and then there's us, right? This little town. And anytime we went to do like everyone complained about turf about how this turf was going to Kennedy and I and I would ask Kenny can you go back and ask all the superintendents who got new ones and I would call the rec directors I would call right again we don't we're not afraid

041to ask for help so we would call to find out what other people are doing what are doing when we went to our BPD to talk about uh what is the do the cancos we asked every other school district that had it what have they done with their PD what they have. So to your point, we are so transparent that we ask for help. >> We go ask for help. We don't think we're better than anybody. And that has benefited go to our children in our district. And and this is a prime example um to right and your colleagues and your and your and your pupils next to you that you got to ask for help in life so that so that you can figure out and do it right the first time. So that

042just goes a big way that is we are leading by example. All right. So any other committee reports? No one. So do I move to uh Oh, I have to open the floor of citizen remarks. 131 uh for anything.
