have my email name. So, I want that duly note on his device. All right. Next is our first opportunity for visitors comments. At this time, you may make a comment about something that's on the agenda as you're a member of the public. All right. Moving next to our consent agenda. Items on the consent agenda this evening are the minutes of the June 9th, 2025 executive session, minutes of the June 9th, 2025 regular school meeting, minutes of the June 17th, 2025 executive session, personnel recommendations, the treasures report for the month of May, and claims. Do I have a motion to accept these? I'll make a motion. Right. Any further discussion or comments? Second. Oh, sorry. Bill seconded. Any further comments, questions? All those in favor signify by sign of I. I. All those opposed, same sign.
The motion passes. Mr. Report, if we could, you know, I sent an email out earlier today and I just want to make a request upon one of the board members. if you would just add or make a motion to add to the agenda tonight um a discussion and discussion regarding class action litigation associated with social media um issues and then I'll kind of provide an explanation when we get to that point if we want to do it after the action items that's fine do it now we got get a motion to add it okay I'll make a motion to add the uh class action litigation litigation discussion regarding the social media to the agenda. I'll second. Any further discussion? All those in favor signify by sign of I. I. All those opposed, same sign. The
motion passes. All right. So, the the long and the short of it is this. So, there is um there's a movement there. Of course, there are four or five law firms behind this, but there was a movement um from one kind of coast to the other um with some law firms to bring a class action lawsuit against Facebook, Instagram, Google, kind of the big players in the social media industry. And there I actually think there's a couple of different factions that are doing this. I think there's a group of people kind of on the west coast and then there's some that are more centrally located in terms of the law firms that are pushing this agenda. And what they're out there doing is they're trying to acquire schools to jump on board of course so
they can increase the size of their class which increases the size of the of course the the settlements that they're seeking um or prayers for relief that they're seeking. And there's an individual, an attorney by the name of Scott Yanover, that's reached out to me on a handful of occasions really. I mean, you kind of get these things via email requests. And you know, he's reached out to me a few times. And, um, he keeps kind of wanting us to get on board to this litigation. And so, um, the first time he reached out to me, of course, there weren't really any schools that were I mean, very few of them were on the ledger, but it seems to be growing and it seems to have some, uh, legs to it. I I think the
gist of the litigation is is is that they're really trying to hold these large tech companies responsible for the unintended um consequences of social media on students in the educational environment. And that's a pretty broad description, but you know, I think it's one of these things where we all know I think it's premised on the idea that our kids, even though they're in school, they're still connected with social media. And that the impact of that on the student psyche and, you know, even from a health and safety standpoint, just the safety standpoint has been um extremely damaging. and they're trying to build a case to prove this and I guess if you will redirect these companies to be held accountable and hold them responsible. I mean, it's kind of like cigarette litigation back in the
day in a way, you know? I mean, everybody was doing it for years and and then all of a sudden, you know, the carcinogenic circumstances were kind of discovered on the medical side and then the next thing you know, they're holding all the companies accountable, tobacco companies. And I mean, this is different obviously, um, but it's in some ways it's similar from a legal standpoint. And so, this uh this group of law firms is wanting us to jump on board. I shared with you a list of a resolution that I haven't vetted all the facts in the resolution. There's a lot of language in there about the attorney general is saying that this is damaging that school educational environment's been, you know, impacted significantly by social media um access to uh things like that. And
and I'm I haven't vetted that resolution to make sure that what's in there is really what the attorney general has said. Um, but it starts with a resolution and then essentially they want you to sign a retainer fee agreement which is a typical contingency fee arrangement where if they don't recover um there's really no expense borne by the school and I did spend some time looking at that and it is fairly normal. There's nothing in there that would require us to bear any expense. Um, you know, unless we were asking them to do something above and beyond the call of duty and we had an arrangement with them that, hey, we we want to branch off and file our own lawsuit in a state court or something, but this is generally intended to be a
federal court action from what I can see. Um, and then um, the third thing I sent you was a list of schools. And if you've noted, there are a lot of local schools. I think um Pioneer was on there if I recall you know Cast and then some of the big bigger players so to speak the caramel districts and I know there's a couple reputable firms that handle a lot of school-based litigation in the state that have kind of you know recommended to some of their um districts I guess that they get involved and so you know we're at the point where we need to start making some decisions. is not anything that's, you know, I mean, I don't think there's, if we don't do it today, we're going to be fine. We can put
it on the agenda for next month's meeting. And what I would like to do is there's a few more bits of information that I've asked for that I haven't gotten. Some of it is just send me the cause number and the caption of the case so I can vet the fact that there's litigation pending and that there's actually some movement on this. Um, and you know, then I'll be able to provide a little clear recommendation. But I I think at this point I'm pretty comfortable that this is a safe endeavor. But uh you know I was trying to kind of think through some of the pitfalls as I was reading the um service agreement. And the only thing that that you know I don't know that's covered in here and it just kind of popped
in my mind was you know normally when you get involved in litigation like this especially civil litigation where you've got multiple parties one of the things that you often see is or counter claims you know where you know people are fighting back and I'm pretty sure Google's going to fight back. I think we all know that, you know, they're not going to sit back and just take this. And I haven't really flushed out exactly what that will mean to all of us as parties. If there's some counter claims filed and somehow in those counter claims, our corporation is named, but maybe there are individuals named somehow. I don't know, maybe it's a superintendent, maybe it's a board member, and somehow there's a piercing of the corporate veil into kind of an individual capacity. then I'm
wondering, you know, who's coming to the rescue then kind of thing. And so I'll figure that out, but I just wanted to kind of um introduce you to this circumstance. I, you know, I think that um I don't know, last time I looked there, maybe there was 100 plus schools from Indiana on board. I didn't really count all the districts and all the separate schools, but um this same firm I think brought some litigation a few years ago. Um, and it was it had to do with vaping and they were able to settle that case and generate a I don't know 15 or 20 million dollar settlement. I want to say there were 30 or 40 schools in Indiana that were part of that. Receive some smaller um stipens. You know, they're trying to sell
some of this participation by talking about, you know, the the forthcoming property tax legislation and how we're all going to be broke and, you know, all that stuff. Um, so they're kind of trying to suggest that, oh, now's the time you need all this money. And I'm not saying that that there's not some truth to that, but I'm just it's I find it kind of interesting that they're using this property tax legislation stuff to try and encourage us to to get on board when we ought to be encouraged to get on board because we really believe the social media is a detriment to our educational environment. Like that's what my thoughts are, but you know, my thoughts aren't as important as yours. So, is the lawsuit the point of it besides getting financial backing or
whatever, is it does it also involve trying to get some change from these companies in how certain things are handled or is it just a financial lawsuit? Are we trying to make a change with these company? Are we by signing this are we trying to force them to do things differently? Yeah. So you're asking do do the lawyers care about the moral side of this of what should be the point of it? You know this is all lie. Yeah. Um well it the answer is I believe that they will be seeking some kind of injunctive relief as well which basically means we're enjoining companies from doing A, B, and C because of their conduct. I assume that's going to be part of this, but it would be kind of nice to see if they filed
a complaint because I don't know if there's been a complaint filed and see what kind of relief they are requesting in the complaint. And I've asked for those documents. I just haven't gotten them yet. So, um I don't know the exact answer to that, but my guess is it' be a little bit of both, but you know that the money's going to be on top of the priority list is this is all about punitive damages. You know, that's the way they see it. And they're obviously they're fighting companies that have bottomless pockets. You know, I mean, it is endless resources. So, that's a good question. I think since you haven't heard the case law and you haven't heard about the counter claims and we're not under a timeline, it's just best to table it. And
yeah, I think maybe if we can put this on the agenda for next month and I think by then I'll we can kind of fish or cut bait with this. Um, yeah, you know, I'm pretty confident that it's not a I mean, I think that there are enough reputable schools and enough reputable players involved here on the legal side locally that I'm familiar with that I trust that this is probably a a reasonable and, you know, legitimate endeavor, but I think we're just not quite there. There are also schools that are not on that list. It counter claim scares me. I mean, it is a thing because they have deeper pockets than Oh, yeah. Yeah. I don't see. Yeah, they're are going to fight back most likely. Oh, they're fighting back. So, yeah, I just
I don't understand that side of litigation that much. So, I'll give a few more answers and then we'll we'll proceed. Appreciate that. Sounds good. So, I will make a motion that we table this resolution until our next meeting. Is there a second? Second. Any further discussion? All those in favor of tableling signify by sign of I. I. All those opposed, same sign. Motion passes. Do you want it on the the meeting in July or the August? Uh, are we have a second meeting in July? Two weeks from now. I think the a what what day is our meeting in August? Does anybody know? [Music] 11. August 11th. So, it's either 28th of July or August 11. Um, yeah, let's just put it on August 11. And then if I need to move it up, I'll
just I'll ask Tammy to move it up and we can deal with it at the next meeting. Very good. Thank you. All right. Moving on now to the action items for this evening. The first one's consideration of recommendation to approve the student parent handbooks the school year of 2025 2026. Do I have a motion? I'll make the motion. I'd like Duke to come forward. here on his behalf. Oh, I'm okay. That's not as much fun. Is there a second? I'll second. Okay. Any further questions, comments, or concerns? All right. All those in favor signify by sign of I. I. I. All those post same sign. Motion passes. Next is a consideration recommendation to approve the elementary teacher handbook. Do I have a motion? So moved. Second. Any further discussion? All those in favor signify by
a sign of I. I. All those opposed, same sign. Motion passes. Next is a consideration recommendation to award dairy bids for the 2025 2026 school year. Any more information we need to I think he says it all in the in the proposal. um letter. Basically, it's they go with the um like the I call it a co-op, but a buying group, if you will. Okay. Uh do I have a motion? So moved. Is there a second? A second. Any further discussion? Second. Any further discussion? All those in favor signify by sign of I. I. All those opposed, same sign. The motion passes. Next is consideration recommendation to award food, commodity, and supplies bids for the 2025 2026 school year. Do I have a motion? So move. Is there a second? Second. Next is the consideration recommendation to approve the memorand of understanding regarding the reunification site uh the Berry Preschool to the Penman building. Is there a motion? I'll make a motion. Is there a second? Second. Any further
discussion or comments about it? All those in favor signify by sign of I. I. All those opposed, same sign. Motion passes. Next one. The consideration recommendation to approve the 2025 resolution to pursue capital improvements projects at male P foreign arts center. Is there a motion? So moved. Is there a second? I'll second. Any further discussion or you want to say anything? Um, no. Unless you have any questions for me. All right. Gosh milled. No questions. I had them answered previous sessions. All right. I forget. How long does the new structure with over the what do you call it? The pit pit. Like how long would that last? Is a that's that'd be a you know another 50year solution. Okay. Similar as far as I know. Michael still be on here. So the next one will
go through my room. Younger than springtime. Okay. Uh any other questions or comments? Okay. All those in favor signify by sign of I. I. All those opposed, same sign. The motion passes. Next we move on to a first reading and this is a consideration recommendation to approve the following policy changes. Number 5111 number 5610 number 6140 number 6250 number 7540.03 7540.04 and 7540.09. We have a motion to run. This is the motion. So this is the first reading. You can come by the administration building if anybody would like to uh get more details on these or to see what they are. in the general public that's watching us live. Um there'll be probably a crow you probably should stay later tonight to make sure there's nobody coming tonight to see that 75403 Tuesday. Yeah. Okay.
Moving on to department comments. Uh business report from Mr. Correct. A few items for your benefit tonight. Let's start with the junior high project. Couple highlights. Today it occurred. Cafeteria Terzo floor was completed today. Uh new serving line installation begins as early as tomorrow. So good news front there. Uh rooftop units. Uh we had rooftop units uh set today by crane over the cafeteria, the new a area, and one of two that'll help support the gymnasium. So, uh, again, good news report there on that. All areas remain on track in terms of completion prior to school starting on August 6th with the exception of the maker space that we've discussed previously. Um, Mr. Storm's aware of that. So, uh, this is kind of a spot that we unanimously picked to be a place that we
might carry into the school year. It's not as critical obviously as the classrooms. So that's where we're at with respect to the project. Any questions on the project outside of those items? Okay. Uh bus inspection was completed last week. Hats off to the team. All buses passed and new school year. It's a three-day endeavor for our 48 buses and uh was uh well done by the team. The state police were here and uh they take care of him and got through all 48 of them in three days. So team Yeah. So Mr. loss uh one mechanic. We have the one mechanic, but it really boils down to I mean we did it here in the garage and trying to get 48 buses in and out of the garage timely without incident and giving him time
to look at all of them is important and it takes a little bit of coordination. So that' be Tim and Laura, John and some of the drivers. We brought a couple drivers in to help with that. uh state reporting is underway for period ending uh 6:30 of 2025. So that prior 6 months is our form 9 reporting. You may have heard that term from us before, but we're deep into that process here in July and it's got to be done by the end of July. So we're we're into that now. And then lastly, the budget building season continues. So doing employment bargaining as we have a couple meetings coming up in September. We'll be getting some information from my office regarding what 2026 budget projects to look like. Outside of questions, that's my report for
tonight. Any questions? Right. Thank you very much. Next is the technology report with Mr. F. Just getting uh ready for school to start. got all of our laptops that we ordered are in and deployed out to the schools and going through the buildings making sure that we've got everything ready to go. That's all comments, questions. Thank you. Curriculum report from Mrs. Rosie. Um just a few things. Tomorrow we have our second professional development for our new K to5 reading series which you approved in the spring. So thank you for that. This year we were able to do two um initial initial professional developments for this new series. We normally only do one in the summer. Um so that was kind of nice for the teachers to be able to have a couple of options. Um
online registration opens tomorrow and I'm sure Mrs. Starky is probably going to touch on this. Online registration tomorrow and then in-person registration starts next Monday in the schools. So um here we go. Uh we have our summer technology professional development with Clara Gapon. That'll be happening at the end of this month, 25th, 28th, and 29th. And then we also have new teacher orientation for um July 30th, 31st, and August 1st. So just trying to get everybody ready for the new school year. Questions or comments? Thank you. Moving on to other comments, the superintendent's comments. Mrs. Tarky. Well, I was gonna talk. Um I would just say that uh summer school ended um and it was very successful. We'll have I shared earlier we have preliminary I would say preliminary I read pass rates um but
we'll wait till those are locked in for sure with what the state says because we always have a difference of how that comes out. Um and that just comes down to kids that they say may count that don't count and all kinds of different things. So, we'll look forward to having a presentation on that either in September or no later than October. Um, then um this is exciting to me, but it's been a while. It took probably would it take six or eight months to get the police cars here to we got a grant for those and so we have our we now own our own uh two white Durango police cars and one is completely done. Um, the other one is in the shop having the lights and sirens and all the the police
gadgets installed. So, um, I've never been inside a police car with the sirens on, but I had to go out and try it. And it is loud. It is loud. Those sirens and that horn are loud. Um, so anyway, uh, the um the the bus uh, inspector, state trooper was here and I asked him if I would get any trouble if I went out and tried him out on school grounds and he said no. and he says, "As a matter of fact, I think you should just go try and drive him as fast as you can." So Tim asked him to quit talking to me. Anyway, um and then um today we welcome back our administrators came back today. School secretaries all started here this morning at 9:00 a.m. with Griselda and doing their training.
And so um everybody's ready to roll. Like most assistants come back next week. Are you ready to roll or she just saying you're ready to roll? Look at it. Matt Storm's not sure where he's rolling from because it's his office is a little messy right now, but it's going to be good. You got nice tams. That'll quickly go away, by the way. And it was fun, too. When I came to work this morning, the football boys were out on the field. They had helmets on. No pad, but they're out there working out. So, I know. I'm sorry. That means summer's almost over. Moving on to public comments. Your second opportunity to address us in any way. No takers. Those of you watching us next month come you can you can comment. Um going to member
comments. Mrs. Bird. No comments. Mrs. Gra. I don't have any comments either. Mr. your ass. Welcome back everybody. Seems like just last meeting I was wishing you a a nice summer. But uh also we approved tonight in the personnel couple of people that you know more than two were on there but two that I can relate to. Genie Adair I don't know how many years Jeanie has put in. Anybody know for sure how long Jeanie 30 I think. So 31 31 years. So there's 31 years that is going to be gone at the end of the year. And she started when she was 12, she'll tell you. And then someone that I had more direct contact with on a somewhat regular basis in my radio days is Brian Vans. And I think he's been with
us 17 years. This his second goound as far as custodial duties. But I'm telling you, that guy lived at the Berry Bowl. you know, I don't even know how he found his way home if he does because he spent a lot of time at the Barry Bone and he is on anything that needs to be done right after it happens. And from radio standpoint, I'm working, he would always provide anything that I needed just like that. So Brian Strong will certainly miss Brian Van Seuss the corporation will wish um both Genie and Brian as well as other folks who are moving on well in their next endeavors. All right, Mr. Copy. I'm good. All I can say is that uh I also wish Genie Adair a good retirement. She has been my neighbor for 30ome
years right across the street. She tells me that there is another teacher moving into that house. So, we're keeping it in the corporation. So, I'm glad. Be my neighbor. Oh, there you go. She's already there. She is. Yeah. That they they've moved out. So, apparently someone someone new for the corporation's coming in and we're glad to have them. Okay. Now, it's time for board signatures. We are.
