002that [clears throat] I'd like to read um for the board on behalf of the board, excuse me. Uh ladies and gentlemen, fellow school board members, members of the district, administration and education staff, parents, students, and guests, we understand that some of you have questions or concerns about situations involving such issues as allegations of alleged weapons on school grounds. The district takes student safety very seriously, and we understand parents or other interested parties may think the school district should notify them immediately if a situation involving student safety arises. While that sounds simple enough, it's not a simple matter because it involves the rights of interested parties. [clears throat] First, when the district administration receives any complaint, an initial investigation occurs. In some cases, the school resource officer, who is a member of the Spearfish Police Department,

003may also be involved. The confidentiality and procedures that apply to the SRO are even stricter than those that apply to the school district. Whether or not an unauthorized firearm or weapon was or was not involved may not be certainly initially may not be certain initially and the investigation must be performed carefully and confidentially. Second, facts collected during the investigation ultimately become part of confidential evidence presented at a student disciplinary hearing. This hearing is conducted along the lines of a court trial. A public a public school student involved in a disciplinary hearing is entitled to confidentiality and due process rights under schoolboard policies and South Dakota and federal laws. The school board sits in a place of an unbiased juror to hear jury to hear the evidence at the hearing without advanced knowledge of the evidence.

004After the evidence is presented at a hearing and the school board makes its decision, the only public disclosure is a public motion by the school board to take action concerning an unnamed student. There is no public disclosure of the evidence or identification of the student involved. The school district is committed to the safety of all students and staff members, but where allegations involve the initial investigation by district administration and the SRO and lead to the conclusion, a student disciplinary hearing will be involved. The due process and procedural rights of the student must be addressed and public disclosure of the allegations in the investigation of the allegations in the investigation is not permitted. With [clears throat] that, uh, moving over to conflict considered a conflict of interest waiverss. We have none. Uh,formational items. Uh, superintendent update.

005>> Yep. Just really short here. Uh, we did receive notification and our certificate, if you will, from the South Dakota Department of Education. We did get our accreditation through the 2030 and 2031 school year. Again, all we needed to do was uh do the simple amendments to the teacher and administrative evaluation policies and we did that. Uh Lana submitted them and we received our accreditation. So again, I think a very successful accreditation and thanks again to uh Miss Maine for all her work on that. Uh very quickly, project updates as if you've been by the football field there, you'll see that they're well underway. Um the the initial track or the the prior track I should say uh was not an official size. So it is this one is a bit longer and a bit

006wider than normal. So uh it will fit but it is a bit bigger than our old track was. >> Feel like we asked that question a few times. >> Yep. And we were assured that it was the same but it was not. [laughter] you guys. Anyway, uh very excited about what the end product will be there. I think it will be really, really nice. So, uh and then if you've been by Mountain View, you'll see that the alley project is well underway down there. They got all the asphalt tore up and they're starting to do some of the underground utility work. So, Sarah's here tonight and we'll get to the easement for the water line down there a little bit later. Last thing is joint convention is August 6th and 7th in Sou Falls. If

007you wish to go, you really need to let uh Jill know so she can reserve some rooms. You're going to be stuck out on the north 40 somewhere if you don't you know we don't get reservations right away and try to get into the Sheran where the convention is at. Uh moving on to action items. Uh the first one action item A is final budget hearing and recommendation for adoption as a resolution to approve the school district budget for the 2627 school year. Mr. Crosswave, >> thank you. The [clears throat] only change that we had from our

008budget discussion in May is that we did receive some updated um valuations from Lawrence County as far as reappraisals and growth. Um, due to that change, we are recommending that we move the special education levy from 1.338 to 1.383. Um, not a huge difference there. Per $100,000 of assessed value on owner occupied, it's $450. Um, we use that $100,000 threshold just because it's ease of calculation that you can calculate it out. Certainly, we're not assuming that you can buy a house in Spearfish for $100,000. Um that $4.50 per $100,000 of value does go through commercial um egg um and through owner occupied. Um probably not a significant amount. Certainly, we take it seriously if there is an increase of any sort. Um but to the special education fund on the revenue side, it does match

009revenues and expenditures and it does generate $138,000 for the special education fund. Obviously, we're sitting here at almost $3.1 billion of valuation for the school district. So any increase, even if it is 510 of one cent, um is impactful for um for special education. Um, as we look through that word document, you can see we have the expenditures and revenues outlined and then the bottom one-third of the page um the levies including the change to special education of the 1.383 and the capital outlay dollar amount um that we're requesting the board adopt and then we will send it on to the county auditor um tomorrow. Um I didn't receive any questions from the board. Uh but certainly if you have some now we can address those before we go forward. >> Hearing none. So if

014one is policy recommendation for the first reading for revisions updates to the following policies. You do that? >> Yep. Okay. So the first one, sorry I got to get to it first. The first one is administering medicines to students. So uh on the front page of it, it was just cleaning up uh the language so it matches the form. So it is instead of uh request to administer medication release agreement to the spirit schools is we it's shortened and it's authorization for medic medication administration form. So, language cleanup and then on the back side uh we struck through number eight what was there and then we put in what isn't going to be in the new state law come July 1 where students can self-care for uh diabetes medication and equipment uh EpiPen or the

015uh epinephrine inhaler or and the third one was uh the asthma so inhalers for asthma so it's just to coincide with the new state law so That's 5130 I'm sorry 5310 5310 uh AR the administrative rule again is just uh so the form the name of the form is updated and then the epinephrine um you can get the epiens but they now have nasal spray so it covers both the extent of the policy issues. Okay, thank you. Uh, next is the first reading of activity handbook handbooks. >> Yeah, if you recall back in uh well, it would be April and May when we were looking at uh all the handbooks, uh I asked for a little bit of uh extra time for the activities handbook. Um unfortunately time got away from us a little bit.

016So there wasn't a complete revision. There was just clarifications put in there. >> [snorts] >> And for anybody listening or that's interested and certainly the board uh the biggest uh clarifications came under the student conduct. Uh so you'll see that we expounded upon that or provided more definition but a lot of the stuff whether it be the academic eligibility the activities association activi um u academic eligibility the train rules are the same that same for the violations. Uh but then yeah, you get into the student conduct. Again, this is where we provided clarification, but then uh yeah, from there on is pretty much what we have in our existing. I mean, it might look a little different just because we formatted everything the same, but uh the physicals and medical history to uh injuries, insurance,

017concussion protocols to return to play, uh attendance and participation, confidentiality, everything else is pretty much what we've had. There might have been a few minor language changes in some of these other things. Uh but for the most part, it is what is in our current handbook. So the plan is then next year that there'll be a complete uh I I'll say complete review. I won't say overhaul because they may keep some of the same stuff, but a complete review where coaches can be uh involved. Uh hopefully some parents can be involved and certainly all the admin that it pertain to. So that is the gist of the handbook. any questions on it? Certainly, you know, whether myself or Nick or Dalton or whomever, Mark, if you want to reach out if you have specific questions

018about it that you know, depending on the level, certainly reach out to them. And then uh just know that the middle schools will mirror this to some degree except for the areas that are just for middle school like their academic eligibility is different than the high school eligibility. Um, we were hired by the school district along with GLG Architects to do a study of West Elementary to try to determine um what's the next step

019in the life of that building or what's the next step in with that property. Um, we we've looked at this in the past um and so this is kind of a a refresher. I think several people have looked at it in the past. So the um I'm going to try to keep this very high level um because um we've been working on it uh for the last several months and have come up with multiple options. These are very high level sort of options. Nothing's been fully vetted, fully investigated, but we're trying to get the get it to a point where we can get a little bit of a direction. Are we are we doing nothing or are we building a new building or more than likely probably somewhere in between, but who knows? So, um

020hopefully you um received a board packet or a study packet that kind of addresses several options. Um the I'm going to go through that very quickly. Um there's a lot of there's a lot of information we've had to weed through on West Elementary. Um, and in fact, I'll probably cover um option number four first really quickly and then I'll and then I'll back up through some of the other options. Again, I'm going to go very quick and very high level and then we can decide where we need to go from here. Obviously, we're not expecting any sort of a decision at at this point. It's just moreformational where we're at at this point. Um, option number four is do nothing. Um the reason this option came up um is because we there the reason West

021Elementary hasn't been addressed before is because there's no easy solution as to what the property um there's a lot of challenges with it and for that um there's a lot of pros um to the to the property and to the to the building even itself. Um but there's a lot of challenges as well. So yeah. So if you if you want to go to page I think it's six or seven. Yeah, right there. So, I'll cover option number four and then we'll back bounce around a little bit. So, currently uh current capacity is roughly 400 students serves grades one and two. Um there's a lot of deficiencies with the building. Um structural deficiencies around the gym. Um this has to do with some newer code requirements that make you address drifting um when you have

022two buildings of a different height. Obviously, the gym is taller than the rest of the building, and alls I have to do is refer people to Wintertorm Atlas, and you understand why because um snow tends to drift when you have a a tall wall next to a a short wall. So, current code says we got to address some structural um issues in around that gym because of drifting. Uh the building's full of asbestous tile. Again, it's not hazard. It's not fryable asbestous but can't do anything with the building in terms of renovation without addressing what to do with it. Uh the HVAC system has old pneumatic controls. Um it's really old, really hard to work with, really difficult old infrastructure. Uh the building does not have uh fire protection system in it, which again um

023isn't, you know, it's a it's a compliant in terms of being an older building. But anything we do to that building, we have to address fire suppression based on newer codes. Uh lighting levels, lighting quality is subpar. Uh the exterior envelope is kind of subpar. It's got old single pane windows. It's kind of cold, radiates cold into a lot of the classrooms. The finishes are starting to feel pretty worn out. And the site has drainage problems. Um the city's in the process of doing a lot of um storm water work in that area and it runs right through the middle of this property. So um if we leave West Elementary alone, you can kind of leave most of these alone, although they need to be kind of picked at and maintained and controlled as issues

024come up, but you're you're living with a building that has several things that are on the verge of needing addressed. So option number four would would be to do nothing. Um option number one if you want to jump back a page. Um option number one is um well when we were when we were initially hired with JLG architects we we were the original RFP said there was kind of three general category projects. One was add a gym to the building. Another one was renovate the building and potentially add on to it. And a third option was what can we just do we just need to build a new building. So those were kind of the big spectrum sort of projects. Option number one is the gym project only. Um this also um you know the

025building right now functions from a space point of view. But if there's anywhere in that building that that is a challenge, it's it's the multi-purpose space which is everything. It's it's it's PE activities. It's lunchroom. It's used by the public for basketball practice. It's it's a small gym in the middle of the building that's used all the time. So, the idea of adding a gym to the building came up as an option. Um, it doesn't address it doesn't address the capacity of the building. It doesn't move kindergarten into the building. It's literally a 9,500 square foot addition to the building. Um, I list several things to consider at the bottom, and I'll go through these really quick. It doesn't it doesn't address building capacity. It meets some immediate needs with cafeteria and gym conflicts. It's

026um um it's the new gym, if we built it, would be positioned such that it would uh could be used for after hours use by the public um without without walking through the the school, which happens right now. You enter the school and so anybody can kind of get wherever you want to if you really wanted to inside the building. Um, if we if you add a gym, it implies a future long-term commitment to this site and to potentially the existing building or a new a new addition. Uh, you still have to deal with structural mitigation around the existing gym. And I throw out a a rough budget number of a total budget number. This includes not only construction, but the FFN and soft costs associated with construction projects, $8.8 million. Option two comes in

027the form of two um comes in the form of kind of two phases. And if you want to go back to page three, I believe it is, you can kind of see these two phases. So the the gym edition only that I just talked about an option one would be if you can see on the screen there that little yellow shaded area at the bottom wouldn't necessarily have to be exactly there but we studied several spots and that's kind of the general area that would be best. So if you go to this option option number two um is make sure I follow along with my notes. Option number two does a two-phaseed approach, and there's probably some FUD subfases in there. It builds a gym and a new classroom wing onto the existing building, which

028long-term wise allows you to bring kindergarten over from its current condition at or its current location at Mountain View. Um, so this is a a new gym, new classroom wing, new parking on the north end of the site, which allows us to separate the bus, traffic, bus, and teacher parking from parent drop off parking. And then it would also address site issues such as storm water. Um, the existing fourpod classroom that's on that end of the building would be demolished. Like I mentioned, we'd build new parking and bus lanes. We'd have a new um secure front entry to the building. We'd address storm water. Um um doesn't uh this first one wouldn't address any existing um phases to the to the uh or any existing renovation of the current building. Um but it also helps

029us to start identify kind of a new identity um to the whole project um to the whole West Elementary. If you go to the next slide, phase two of this then is to go back into the existing building and renovate um the rest of the building to bring it up to kind of current standards. It would have to be done in phases. We kind of move a classroom around as as we work on these phases so that eventually when the building's done, West Elementary can move over >> Mountain View. >> So, or Mountain View, sorry. Um, again, there's a lot of details in this [snorts] structural, mechanical, electoral, disruptive use, all that sort of stuff. Um, each of these phases, that first phase is around 16.4 million. The second pays around 18.2 million. You add

030them both together over time and we're roughly 34.5 million over over a fouryear time period if you if you kind of clip along at it pretty quickly. Um, option number three, um, so if you want to go to, um, page five, I believe it is, and then I'll read through my own notes there. Option number three says, "What if we what if we built new facilities at West Elementary and eventually demoed West Elementary, not deal with the structural deficiencies, not deal with the old HVAC systems, not deal with trying to insulate the outside walls better, asbestous, all that sort of stuff. Instead of trying to um spend money to fix those things, what if we just limp it along in its existing conditions while we build new?" So phase one of this would be to

031build a new class uh two uh classroom or two grade level building that's the yellow in this map and new parking um new parking new entry that would be the the west side of it that would also serve as parking for the softball field. Um that building although it's really really tight could be done while West Elementary um continues to operate in its existing condition. So you essentially build a replacement for West Elementary that that addresses two grades. When that first phase is done, you you demo West Elementary. Um you could stall there for a little while depending on budget and money and and everything else and people's appetite for more disruption in construction. or you can move right into phase two, which is the blue box up there, which puts a uh gets the

032kindergarten grade moved to this location so that Mountain View um could be moved to that location. We there's a there's a number of different variations to this. We could even continue to use the existing parking lot that's in the southeast corner or build a new parking lot for bus drop off. There's again there's a lot of variations to these. So, uh, this option has many different pros and cons, but that's the idea. When you're done, you have a new building on the existing site. Really rough numbers, again, total project, not just construction numbers, are around $50 million. 39.5 would be all phase one stuff. Another $10 million in phase two, minimum four years to work yourself through all these phases. Um, a couple more options to address that came up at our last meeting really

033quickly. If you want to go to the last page, um, options five and six. Um, option five is to keep the existing building, just renovate it, leave kindergarten in its current home at at Mountain View for a future phase. So, you still end up dealing with addressing all the deficiencies that were outlined in option four, which which which was do nothing, but you just renovate the building, make it make it look like a new building, bring it up to current standards. Really, really rough numbers on that one, is $20 million. Option number six, which was thrown around a few different times, is instead of messing around with all of the challenges of the site and the phasing and working in construction around kids and all that is to new building at a new location. There's

034a ton of unknowns to that. it when you compare it to the to option three which is a new building on the existing site it could be less expensive than that um because uh it it because you don't have the disruption of phase construction um so it's easier to build it goes faster um but it's only going to be less expensive if you don't have a bunch of site work and infrastructure so it's really dependent upon the property you If it's a if it's a property that's close to development, close to um city utilities and infrastructure, doesn't take a lot of um prep work to get the site ready, it's probably less than that 50 million project. If it's somewhere a little further out of town, needs infrastructure, needs utilities, needs a lot of site

035work, grading, stuff like that, you could easily climb north of that. So again, it's really, really big picture. new building either on site or somewhere else. Other end of the spectrum is do nothing, kick the can down the road a little bit longer, but eventually something's got to happen at least. So, just here to answer questions at this point and ask um feedback from the board and see what our next steps might be in this process. >> Questions? >> [clears throat] >> questions, comments. >> I will just, you know, thank Jason and the and the folks from JLG and uh Nathan and Alicia and Nick for being at the meeting, Craig being at the meeting, sharing the financial stuff. Um it's not an easy decision when you look at 39 millions for an addition and

036a renovation and then 50 million. I mean, you're you got threequarters of the cost of a new building in a renovation. So part of our discussion is at what point is your return on investment for that you're going to what you're going to invest in renovation that you invested in the building. Uh so that's where we went back to talking about do we you know option number four do nothing I mean do we just limp along. I will just tell you that there are systems in there like the HVAC you don't see pneumatic systems anymore run by an air compressor. They're all digital anymore. and and as Josh has said over time, finding the the thermostats is next to impossible. So, he just piece meals things together. So, there's stuff that needs to be done.

037So, is it again, is it picking and choosing? Are we saying that, you know, we're just going to redo the HVAC? Hard part about that is is if you're redoing the HVAC, well, you got to get in the ceiling. So, if you're in the ceiling, you're tearing the ceiling down, well, you might as well do something in the hallway with all the wallpaper. Well, you're doing that, the locker's going to come off the walls, and if you got removing the lockers, you might as well get rid of the asbestous tile while you're there. So, I mean, there's just where do where do you start? Where do you end? So, um that that's the hard part. I'm not trying to convince not do the renovation. It's just it's not an easy decision. It really isn't. >>

038The big thing too that was brought up now is the snow, the issues with the snow and I mean that that and I don't know the terminology or whatever adjacent but help me explain that a little bit more so we understand better. >> So the the newer codes have said hey you've got to you've got to account for snow drift. You can't just say based on your area you need to account for x amount of pounds per square foot for snow. You have to account for snow drift which is obviously we know that in this area when the wind blows we can get a lot of snow on one side of a roof and nothing on the other side. So this the the code makes you account for that. Newer buildings as we do them,

039we design them that way. Older buildings, and I deal with this all the time, we have to we end up going in and retrofitting existing buildings because they don't they don't count for that added snow load. So you even need to have uh you know, people ask is it a threat or not? And it's like, well, I I don't know. Was it was it a threat that you know, Atlas was going to come along? you know, it's it's bound to be a problem at some point. Um, so you probably should have bit of a snow mitigation plan in effect that says, hey, when it when it's really snowing, you're probably not in school anyways, but probably should have some sort of a, hey, we should evaluate what's going on up there. Shuffle the snow off

040the roof. I know they did that at Walmart for a long time before that was finally fixed. So, I I hate to be the bearer of such bad news, but that's that's just the current That's the current code we're living with right now. >> And the other thing that will weigh into this that you guys will have to think about um I mean is what we what you can afford. Our debt to income ratio at 50 million the last things that I've seen doesn't work. >> So you have to keep that in mind as well. Um obviously West needs something done to it. Um, but it it is going to be a difficult decision. So, >> yeah, a little bit on finance. It's a it's the one of the hardest things for us to do

041is predict. So, I I've reached out and in coming up with these numbers. Um, we've looked at past history. Uh, we've looked I've reached out to a couple contractors in the area who are doing school projects right now and got them to give me their numbers. Nothing's ever apples to apples. You know, that project's a little different this way. Our project's a little different that way. So we weigh that out. If if we take this farther, we'll have developed plans that we can get better and better estimates. But you have, you know, we have to start with a number throw throw a dart at the wall kind of start and then adjust accordingly. Based on the years that I've put down at the bottom, I've added inflation to these numbers. So these are, you know,

042two, three, four years inflated down the road. Whether my predicted inflation is accurate or not, you tell me. [laughter] Can anybody tell me what that is? So, we, you know, we try to do our best to accommodate that, but at this point without without defined plans, we're just we're trying to get you in the ballpark. >> Sure. >> I think it's one of those things as board, I mean, we have to definitely move forward. It's something that we've discussed for quite a while. So coming up with a plan and even if it's in the next couple months as a school board all of us getting together doing a little retreat or whatever and then getting the community involved I think is super important >> and that was part of the plan is to give you

043the basic information for right now the different options and then uh in likely in July to have a work session where the board sits down with the new superintendent business business manager and goes through uh and and I I would say even the administration, they should probably be a part of that as well, but just work through it and talk about pros and cons of everything. And yeah, we're open to we're available to assist, you know, that's that's that's our our initial contract was to try to narrow this down and assist in community involvement as much as or as little as you need us to.
