Three, two. >> Good evening. I'd like to call the August 19th meeting of the board, Ashland Board of Health to order. Um, the first thing on our agenda is citizen participation. Do we have anybody for citizen participation? >> Okay. No one for citizen. So, the next thing on our agenda is for an external grease trap waiver um for 12 Pond Street. Uh Raj do you want to start us with that? >> Uh thank you chief. So we have Tida right who is the consultant for for this uh >> coffee shop that's coming at 12point street. I'll give you tida. Yeah please go ahead please. >> Yes. Yes. This is a brand new place and in Brazil it's a franchising and in Brazil they own more than 1,000 franchisee stores and this is the first store

outside Brazil. They're very happy and excited to do it. And they do not have any fried food, nothing. All their food, it's more coffees and sandwiches that is ready to eat and they come frozen to my clients and they only heat up in the microwave. That's all they do. It's no cooking, nothing. It's just not even preparation. only the only preparation they will have is to unwrap and put in a microwave and serve to the client. That's all. >> So any any board member have any questions? Uh chief go ahead please chief. >> Yes. So um so tell that uh >> so and Raj they'll someone in the they'll have to have serve safe and everything. Correct? They I am a certified service safe instructor and proctor. They already did with me also Red Cross

and uh serve safe allergens and everything they need >> and choking. >> Yeah, Red Cross. We do. >> Okay. Do Do any other board members have any questions? >> How do you pronounce the um name of the establishment? >> Oh, yeah. That's a challenge. It's a shading bound. Say that one more time. >> It It means it smells good because their main thing is coffee. >> So it's shading bound >> shading >> bound. Yes. >> Oh, okay. Got it. >> And and and this is this going to be in the Market Basket Plaza or the plaza next door? >> It's before Market Basket if I'm not mistaken. Right now, right? >> It's across across from Market Basket, Chief. It's a it's a building residential building, you know, but and then there was some on the

on the ground floor >> based on commercial. >> Okay. >> Yes. >> Um Maurice Barbara, any questions? >> Okay. So, I I'll make a motion that we grant the external grease trap grease trap waiver and I'll try it. Sharen Bow um Ashland LLC at 12 Pond Street. >> Thank you. >> Second. >> And okay. And we I have a motion and a second. Any other additional questions? All in favor? >> I That's unanimous. Congratulations. When do you plan on opening? >> As soon as possible. >> Okay. >> Need to get the building permit. I believe they already did because I don't deal with that part. And as soon as we get it done, maybe a month or two, they'll be opening. >> Okay, great. >> All right. Thank you. Thank you. >> Thank you. >>

Have a good night. >> Thanks. >> Thank you. >> All right. The next thing on our agenda is the fee schedule to add pastry and beverage permit application fees. Raj. So chief what we are doing here for for the residents or you know people who apply permits with us for their convenience you know or just to ease right now the temporary food permit application we have right uh that have a fee of $40 now coffee and pastries also fit in fit in that application. So what we are doing is uh reducing the fee to $10 just for coffee and pastries you know. So that's what we are doing. And if somebody wants uh uh a 10-day permit up to 10day permit that we have right now with temporary foods, I guess that we kept at

$25. So this is just, you know, we see sometime kids applying for laminate, you know, or if somebody's bringing coffee and pastries to the to the library, they still need the permit. But here we are just reducing the fee and calling it as a coffee and pastry permit, you know. So that's that's what we want to add add to the fee schedule. Thank you. >> Okay. And and Raj, do you need a motion for that or >> or something you can do? >> It's it's a fee schedule, right? It's a regulation, you know. So we making the changes to the regulation. I guess we should the board should pass it, you know. So >> and at some point we'll need signatures too because it has to get signed. >> Okay. >> Regulation. >> Okay. Anyone

>> want to make a motion for that? >> Yeah, I'll make the motion. Has everybody had a chance to think about this and before I make the motion or any discussion? >> No. Okay, then I'll make the motion to add uh to to make the um changes to the fee schedule that we just discussed to add pastry and beverage permit application fees. Um >> and I'll second it. >> Okay. Um, and >> no, >> you're frozen. >> Favor. >> I >> How's that? I >> Good. >> I >> As you can tell, I'm in my car. Um, right. >> I didn't get home in time. All right. Um, next thing. >> You're not driving. >> No, I'm pulled over. Um next thing on the agenda is uh Raj's report. >> Thank you chief. So uh

first on the agenda is the shadow shelter. Uh this was uh in July we we did had a complaint on the shelter with some concerns. you know, there was a past resident that called, you know, so we me and uh deputify chief went in, you know, we we found some violations and we have sent them a order to correct and and I did uh get a chance to do a reinspection where some of the items was addressed, you know. So yesterday I saw Mr. David who who looks like he's also on on the call today. Uh and Lesie Lee is the from the senior management from from Smok who owned this building. We had a good discussion, you know, that they they are looking into rectifying the violations, you know, and hopefully I hear back

from them soon and we we close this, you know. So, this is where we are with with that complaint. >> Uh, >> so, so as far as you're concerned, things are progressing. >> That is correct, sir. Yes. >> Okay. All right. And I know just so we don't have to keep David on. Um, does any of the board members have any questions? I'm sure he doesn't want to sit through the rest of our meeting. >> No. David, thank you for joining us in case we had any questions. >> Thank you very much. Has my information and we want to get this resolved as quickly as possible. >> Thank you. Thank you for your time for joining us. >> Good night. Good night. All right. So uh with the arvirus report right uh unfortunately today uh

we we had a report where we have our first westnile mosquito sample positive in Ashland. Uh so just just to be a little on the cautious side we we do have mosquito sample positive for Ashland. Uh today that came through. Last week we had Framingham and I guess a week before we had Holliston. So we definitely have uh positive mosquitoes you know for for West Nile and I just want to have our residents be a little cautious. We will be sending information out uh in the social media through our newsletter for from Mr. managers report and and so far right in the state we had 240 Westnile positive moscos samples as well as 13 mosquito samples positive for triple E. Uh besides that we have one animal case for Westnile virus that that was found

in a goat I guess last month. Uh, next one is uh our swimming pool inspections as chief you mentioned last time, right? To to inspect uh all our pools uh for the summer one more time, right? I did spot checks uh at all our pools, all four of them. And you can hear me, right? Correct. >> Yes. >> Sorry. Yeah. I just want to make sure you know. So, uh, three of the pools did good. Uh, one pool I I found, you know, at the pool we have the new pool at Asher, uh, 9200 Chestnut Street, right? When I went in, uh, yesterday, the pool door was open. Um, and the the door for the chemicals where this where they do have the pool pump that was open as well. uh there was a guard

you know who came to the pool couple of minutes after I was there and I've informed them that hey this door need to be closed all time and today I had an email exchange with the ownership that you know this need to be taken care you know but I just wanted to bring it to board's attention other three pools was okay I did with the hazard mitigation plan we did had a meeting the person who who's writing this plan for us he was in front of the select board a couple of weeks back. Um and I did forward the board the report you know the or the draft we have for hazard mitigation plan. If any board member have any questions please let me know you know and hopefully I guess within next three or

three to six months we will we'll have the plan ready for the town. Uh I guess uh first they have to once once it's drafted drafted and finalized uh it's going to go to MIMA and then to FEMA and once it's approve approved by both MIMA and FEMA then we'll have it in place. U a week and a half back or two weeks back we had a table at the farmers market. We distributed tickets you know tick removal kits. I we are seeing a lot of cases that are tick related uh this season you know in in the whole Midwest area there are increasing tickborn diseases you know so we we distributed that uh with the situation at alouse 135 discount you know that wastewater issue uh looks like it's resolved we are watching over

uh Tom Tom was there uh maybe three weeks back or couple of weeks back you know uh he didn't observe any water. Uh but we're still watching uh the situation. If if anything else is found, I'll bring it to board's attention. Sunny said restaurant also uh passed the inspection. Uh I guess I forward that to the board or if not, I'll I'll check and forward it to the to the board. Uh but we still have that $400 fine. That's that Tom have issued them two tickets of 200 each. uh that's pending with the fall flu clinics. We have scheduled four four clinics uh with the Sherborn Pinehill Pharmacy. Uh out of which one of the clinic is falling on October 30 and 13th uh that's Columbus Day. We have purposefully kept that you know just

just for have the residents you know on a off day that they can come to the clinic. All four clinics are on Monday at this time. And besides that, you know, we'll be doing our weekly uh Wednesday and Thursday clinics where flu clinic flu flu doses will be available to the residents who don't have insurance or or they are underinsured. So we'll be getting some supply. Uh our public health nurse and told me today that you know that she got an email from the state that we can order the flu vaccines. uh that comes to us free of cost you know and we give it to our non-insured uh residents you know so that that that'll be coming through shortly we had a case of un unpermitted chickens uh roosters there was complaint that Donna

been addressing this is at 237 Pleasant Street uh there was two citations issued by Donna that the the occupant have paid so far uh they are dealing with the conservation ation commission uh about their requirements and they have submitted us our application. So we'll be we'll be following up on that with the housing cases uh 137 Pawn Street as I mentioned in the email all the hires have I guess they should have received their money by now uh four highest got 88,000 from the sale of the property and two children of the fifth hire got 44,000 each. So that's with 137 pawn. Uh I did a reinspection at join drive uh 20 join drive number 35. Uh that was partially passed. You know we still have some roach activity there and uh we picked up

another case at 20 join drive number 10 that is still pending. Um I will be following up with the management regarding 242 Main Street. This this is a case going on with uh with us for some time now. U I guess I bring it to board's attention before also little complicated case. Uh the resident who who is at 242 earlier was on Pleasant Street. I guess you know had some issues there too. Uh she she have some issues going on here to the we we did couple of reins inspections right but there is some problems with the sanitation at at the place as well. She she do have a bunny uh that that last two inspections I've seen lot of feces that's not cleaned you know uh that's that and then you know she she

have lot of stuff in her unit that might be making it difficult you know for for the pest control to be uh to be successful. So I have asked her to remove that you know or declutter all that all the stuff that's that's lined up on the sides and all that and to have a better sanitation uh where the bunny's house you know so hopefully uh that that get resolved but it's a little difficult case that's been pending for some time now with our open go permitting software we are live and on for all our permitting Dr. J thank you you know for testing testing the animal uh permit you know or for the chickens right uh so that that's going on fine we have some glitches you know we me and Laura counted we

have 26 applications so far right and then when when we got uh the software they did develop one application for us and Laura did great work you know getting all these applications squared away we did transport some applications from other municipalities. But like then still there is lot of work to be done you know to get those uh applications accustomed to us you know with our fee schedule and all that but so she she did a lot of work on that. Hopefully we we that smoons it you know. The second part of that was the inspectional software that we're still working with the team uh that is not ready yet you know. So we we will be doing the permitting through open gooff for right now and if if the inspectional software get ready and

work according to our needs we'll use that as well. Uh most of you know remote remote area medical was a very successful clinic you know thanks again I guess what I got from Framingham that they saw 372 patients this time you know almost similar what we have seen last year I guess was at 360 or something. So a successful clinic you know hopefully and moving forward we again do it again you know Framingham or us you know as the board members or the other folks in the town decide with the disease investigations uh we we've been busy on that front we have picked uh from the last meeting two cases of uh human human granular cyclic alasmosis. This is a disease that we get from pigs. We had two cases of that. We had one

case of Leginella, one case of neurovirus and we have two active TB cases at this point and I'm ready for any questions now for the both. >> I have a question for you. >> Please um and maybe it's a question for Laura too, but I was on the national website trying to look for the select board meeting that um through Wacka TV that had that hazard mitigation plan presentation and I couldn't find it. Is that uh but that was a few days back. Um is that something that somebody could forward to me if it's easy enough to find? >> Yeah, I can send you the link for that meeting. >> Okay, great. Thanks. >> No problem. >> Y maybe send it to all of us, Laura. >> Sure. >> Yeah. Thanks. >> Good idea. Thanks.

>> Can anybody else have any questions for >> Raj about pool? Oh, go ahead. >> The at the Asher um you said that the pool gate was open. Is it not like an automatically closing gate? I feel like when we originally had said about the lifeguard situation, they had assured us that they had a fancy lock. Um I just feel like the lock situation is not really useful if the gates not going to be closed. >> Mr. Maurice, a very good question. Right. So that's why I have specifically bring it to board's attention because that that that was discussed. So what has happened there was definitely a guard at that time when I went yesterday right she purposefully because you know they have to put the code in or something. This is my understanding that

she kept the door open you know uh the door do lock you know she might have kept something to you know keep the door unlocked you know that's my understanding but uh again you know when I entered I I closed the I closed the door right that it did close you know and when I saw she coming she have to enter the code or something you know I guess it it's a fob or something >> but yes I'll I'll keep an eye on this you know maybe do another quick spot check, you know. So, >> was the gate just like unlocked or was it propped open or >> It was little open, you know. So, I I don't know if was purposefully kept open, right? So, this is the door to the pool, but the

other door where the pool pump is and chemicals was, you know, wide open, you know. >> But my my recollection was they were not going to have a lifeguard. >> Uh Dr. I I guess you know there was just a guard not not a lifeguard right I guess there was somebody manning the pool right so we definitely need somebody anyways to do the chemicals every every four hours that's a code requirement right uh so I guess that that person was for that you know was wearing a shirt with guard on it you know so I I don't know if I didn't check like it's probably not a lifeguard it was just a guard you know to to do all those chemicals and all that stuff, you know. >> Yeah. >> But again, I'll I'll keep

an eye, you know, so just that doesn't happen and I did send an email to the to the ownership this today that to make sure that that's been addressed, you know. >> Okay. Thank you. And then um I did have a another question just about um the ale house and 135 discount. We talked about that there it abotss like a um lagging on the word >> Wetlands. Thank you. Um did we ever hear from uh about like an environmental report at all? >> Mr. Maurice. No, I I didn't but uh I will check on this and get back to you, you know. Uh let me let me check on it. We Tom did go out a couple of weeks back, you know, to reinspect, right? Uh but uh we we'll get into this there's definitely

a company working with them, you know, on on that side, right? And I'll make sure that it uh we look into this and get back to you. >> Okay. Thank you. >> Thank you. >> So the next thing on our agenda is the consent agenda. review and approve the fiscal year 26 year-to- date budget report and approval of the meeting minutes of July 15, 2025. Do I have a motion? >> I'll make a motion to approve the consent agenda. >> I'll second it. >> Okay. Any discussion on either item? Okay. All in favor? >> I >> Okay, that's unanimous. Uh discuss future agenda items. Tobacco Tobacco regulation review Raj >> uh chief. So again um our tobacco control person from Frammingham right so we we have made the addit to our current regulation I am

currently re reviewing it so once that's done or I'm going to have our nurse an also look at it once that's done we're going to send it to Mr. things man because he he offered to help us on that. Right. Once that's review is completed, we'll send it to the board and we'll bring it on probably next meeting, you know, to to to adopt it. >> Go ahead, >> Zach. Oh, hold on. >> No, I was just letting you know, Zachary, >> I was wondering if I'm I'm Zachary Rich. I'm a a physician at Boston Medical Center and part of the nicotine free generation group. And I was wondering if the board would be interested in hearing either from myself or Ashlin residents uh in support of nicotine-free generation in Ashland. And if so, that

would be something I'd be happy to facilitate. >> So, um so what we could probably do is get you on for one of our next agendas. And how much time would you need? >> We'll we'll take whatever um whatever you'll give us. I I'm happy to talk or we have Ashlin residents that are also feel passionately about this and would be willing to come and talk as well. So 5 minutes, 10 minutes or we'll we'll fill up your evening if you let us. So >> sure. So Laura, could you coordinate with um him to get him on uh one of our next meetings? >> Sure. Um so I think what's the the next date? So, we have we have a tenative meeting scheduled for September 2nd and the one after that is September 16th. Would

either one of those dates work for you? >> I I could be at either one. >> Laura, um does Laura have your email or >> if you go on to the board of health website, you can um find uh me and Raj's emails. >> No, I have his information, you know. Oh, okay. >> I've been in touch with him, you know, so far. >> All right, great. >> Yeah, cuz it it cuz obviously we don't have you on the agenda tonight and I if it's good to have you on the agenda for another meeting that way if there's any other residents that want to listen and you know that look at our agendas prior to our meetings. So, why don't we try to get him scheduled for September 2nd. Laura easier. >> Great. Perfect. Thank

you. Um, so now, oh, that we're at the end. That's good. So, um, does anybody have any new business or old business or >> No. >> So, I will look for a motion to adjurnn. >> I will make the motion to adjurnn. >> I'll second that. >> Great. All in favor? Hi. >> Hi. >> Sorry. Good night everybody. >> Good night. Thank you. >> Have a good night.
