A couple of minutes back. one. You're live. >> Uh, good evening. I'd like to call the July 15th of the Ashland Board of Health to order. Uh, the first thing on our agenda is public comment. Do we have any public comment? >> Uh, yes. I'm not going to assume bombs. You don't have to worry about that. >> Box 7119 Main Street and um I haven't been on in a little while trying to trying to get through the uh summer that we had. I just wanted ask if there's been um any summer cool places for the town's elderly. Has there been any open? Mark, say that again. >> Has there been any cool spots open for this heat waves? We've been having a couple. Has there been any open any be open for this coming week,
end of the week? >> So, so during the day. So as always the during the day the comm community the community center is open and the library is open. >> Okay and um >> no that that's it. >> Okay. Um so the next thing on our agenda is um the health director's report. Raj >> and chief uh we have Mr. Curran who's going to brief us on the first two items. you know, he been working with both both both of the establishments. So, I'm going to give it Mr. Current to explain it to the board. Uh what's going on with the Ae House and 135 discount store. So, uh just just a background, right? We had two complaints about uh some sort of water leakage, you know, mold at 135 discount, you know, so we've
been working with them. uh the first one first complaint was kind of in February or around that time and then there was a recent one that uh we had you know so uh Mr. Kuran please if you can brief the board please. >> Sure. Um, so actually looking back through the inspection history, I realized that I did have a complaint regarding this issue back on uh December 30th of 24. And I responded to a complaint about water leaking into um 135 discount from a neighboring business being Ashland Ale House. Um it was determined um that it might be a lateral line under the business. Um, so we at that time the owners at 135 Discount had uh been in contact with their landlord being Market Basket. Um, they closed off the area that was affected,
the the two aisles closest to the right hand wall as you walk in the door. Um, they put some barriers around it so customers uh didn't go near it. um market basket assisted them with some remediation work um to to uh to control the environmental hazard. And it was determined at a follow-up visit on January 13th that uh this in fact was a lateral line underneath um Ashland Ale House which is in a in a crawl space that is um inaccessible because it's boxed in with cinder blocks and and it's um underneath a raised floor which is also a concrete slab. Um and it was determined that it was between a glass washer at the bar and a hand sink in the kitchen. So, um they the business made the decision at that point to
my knowledge to discontinue using those two units. Um they they worked with rapid flow plumbing due to the challenging nature of accessing the underneath there. They they uh injected a sealant into the line. Um and it was felt that it the issue was resolved um by March 1st um at a follow visit. Then at that point, market basket um had replaced carpeting, uh cut out um moist wall materials to um dissuade any, you know, uh growth of mold, remediated the area, repaired the drywall, installed new carpet tiles, cleaned it. Um and then unfortunately on June 5th, we received another complaint and it was it was for the very same issue. um again. So, um it it wasn't resolved. Um so, we've been in contact with the building department throughout this whole process. We've uh gotten
assistance from the plumbing inspector, uh Chuck the Brits, who's been working with them and kind of leaning on rapid flow as to why the issue uh wasn't resolved the first time. Um, I have uh an email from Chuck uh dated July 9th that he feels like this last round of sealants that has been put into the lateral um has taken and it it has solved the problem. Um I still have follow-up visits scheduled um with the business uh being 135 discount businesses in Ashland Ale House. Um it's important to note that during this whole scenario and and how this played out. I think at one point um it was conveyed to me that although I I don't know if they confirmed this or not that market baskets maintenance people may have drilled a hole into
the rear wall of Ashland a house to kind of let some of the water out from underneath which obviously is not an acceptable um solution being you know gray water um and waste water. uh that you know would leak into the adjacent wetlands. So we we did um Radget did instruct me to flag the conservation department on that which we did. Um and I've ordered the business to you know remediate all affected areas um and and provide us with uh invoices supporting that. and chief if any board member have any questions you know only other thing Dr. Jes. Yes. Uh but only other thing I met the owner of discount store like couple of weeks back right. Uh before that we we have put it on our inspection that you know this is this matter
now continuing uh for a good amount of time at least that we know right but uh the discount store owner told me this is going for at least five years you know. So and this is one other establishment like the state in 2018 2019 exempt them exempted them from from a permit from from board of health you know. So this is the second example after dollar tree right that we are dealing with uh with the facility that you know board of health have no permit you know but we still have jurisdiction based on complaints you know so I I just wanted to bring it to your attention you know what's going on and Dr. J, please go ahead, you know. So, >> thanks, Raj, and thanks, Tom. Um, so just to paint paint the picture
of what it looks like when you're in there, uh, because it's one thing to see it written out and but, you know, nice to hear your description of it. So, was there like a lot of water coming into 135 and where was it like coming up from the floor or >> Yeah, so it was it it was when you walked into the wall um on the right hand side of the store which is the barrier wall between 135 Discount and Ashlin A House. It was trickling in through the baseboards underneath on the floor. Um it it wasn't like torrents of water. It was kind of a slow continuous leak and it it it soaked into the the wall materials and it was enough to cause some significant damage. Um thankfully the landlord did, you know,
assist with 135 discount in replacing um floor and wall materials and unfortunately um it happened a second time and it it you know damage those materials yet again. So, I think they're working to get that fixed, but um as it stands now, hopefully um the the problem has been resolved. And you know, I think um they they might have opted for this type of solution with the sealant into the line because um you know, the alternative would would be extensive costs with you know concrete saring involved and you know just to access the crawl space. um you know uh this place was built long before any of us were working here. So I mean I I don't understand the rationale between behind you know boxing in utilities like that to render them inaccessible. Um you
know that's been referred to the building inspector but you would think that moving forward there would be some means to get under there to access you know utilities and pipes and whatnot. I mean, I think a more permanent viable solution would be to take the whole lateral out entirely. But I, you know, I've seen this material work and my other experiences. Um, sometimes, you know, municipalities use it to, um, patch, you know, wastewater lines and streets and things like that. So, it is, you know, something that, um, the plumbing inspector said is is is a viable solution to patch holes and lateral lines. So, and he seems to think that this time around it has worked. and and the in the hole that was that was drilled in the wall on the outside, how much
water is actually coming out of that and and how and where is it in proximity to the wetlands because isn't there sort of a parking lot or place to drop back? >> Yes. So, it it's very close to the wetlands. There is sort of a um I don't know to call it like a culvert or something like that with some I don't know if it's a stream or if it's just um you know channel for for waste water. I mean, it's rain water to collect. Um, it's it's getting a little too close for comfort to, you know, you know, and then all with the hard rains and things, it's it's kind of a continuous leak. Like, again, it's not like torrent, but it es and flows, no pun intended, um, depending on, you know, what
use that the units hooked up to it may get. Um, being that hands in the in the glass washer. Um and again they said they've been trying to monitor that and when it happens they they try to stop using those units to control the leak but hopefully um this patch has taken um and and it has solved the problem. >> Thanks >> and Dr. J just want to add another thing to it. Right. Myself and conservation department was supposed to go out this Monday but there certain other items popped up. you know we was not able to do that inspection or you know go go out with conservation that we should be doing later this week or you know early next you know so uh Becca Solomon who is our conservation agent you know I'm
going I'm going with her to look more into it you know so uh so we'll be updating the board you know at this point maybe by next if if if this is not resolved you know we will bring the parties to the boards uh in front of the board you know that that was the plan but uh in in favor of of the of the businesses, you know, we we have invoices that we shared with the board. One of the invoices over $100,000, you know, so they are definitely putting effort that the email that was sent to to you, right, by Lynn, you know, from from House, one of the invoices is over $100,000 and and other costs too, you know. So, uh they're they're spending substantial amount of money here, you know. So that's
why we are also kind of very patient with them, you know, to get this resolved, you know, but at this point we thought it's it's it's needed to bring it to board's attention. So that's why we are here. >> That's right. Um and I agree that Lynn has been very good at communicating with us throughout this entire ordeal as Rajett has stated and has cooperated with us immensely given the circumstances. And that uh $100,000 tab that is basically the cheap solution here. >> Um Mr. Kingsman don't know but like you know I I don't know like but they've been working you know but this is one of the invoice you know. So u I I hopefully market basket is some part of it given given they are landlords you know by early on last time
I had a uh talk I did speak to to one of the managers and at market basket you know and we had a conversation and we asked them to get this resolved though we don't directly don't want to engage with with the market basket given you know this problem is at a different establishment you know uh so I mean I I I don't know if that's a cheap solution, but like >> I I I guess what I mean to say is is that if this doesn't fix the problem, >> then future remediation will be more expensive. >> Absolutely. And and I guess they they have a cleaning car company also. Is is it clean harbors right who who are working with them, Tom? I guess I I saw one one of the companies, you know,
who will be assisting them with the cleaning part, you know. Uh I I I can pull that but I guess it was clean harbor so you >> I did see the rapid flow invoice but I haven't um seen the clean harbor one >> there there was definitely another one you know that I saw you know I and I can pull that >> yeah it was um it was actually stated in the letter I think okay reference to that >> thank you anybody any anybody Anybody else with any questions? >> Do we know like how far the wastewater actually spread into like if it did spread into the wetlands and if so, like how far? >> Um, last week I think I have a picture of it on my inspection report when I was out there.
It was, you know, it was in that back parking lot area, alleyway, so to speak. It was pretty close to being able to trickle down into that area, but it hadn't traveled that far yet. Um, thank God. But, you know, that's why I kind of um flagged it with the conservation agents, myself and Radget for her to take a closer look at that. Um, obviously we want to protect the environment, we want to protect the public, but we want to, you know, make sure that we're not, you know, polluting waterways or anything like that. So, >> and it's just is it just like um sewage water or is it food, oil, grease? Um it it appears to be what we would call gray water. I I wouldn't I would stop short of calling it like
raw sewage. It doesn't have um doesn't appear to have any fecal matter in it. Um it looks like it is kind of what they had said hooked up to a dishwasher and a hand sink. So it's probably you know slight oils and detergents and you know mix in with waste water. So um thankfully I don't think it's I wouldn't call it you know raw sewage so to speak. Um, it look it appears to be gray water. Yes. >> Thank you. >> You're welcome. >> Anybody else? We're good. All right. Thanks, Tom. >> Thank you. >> If he he he want to brief us on Sunnyside, too, please. Sorry about that. >> Right. Go ahead. >> Oh, sure. So, um, we I did have a routine inspection with, um, uh, Sunnyside on, uh, it was back
in April. I did give them some extra time because there was some repairs, um, that they had to complete. I I, uh, would have been back sooner, but, you know, with the farmers market and other things going on. Um, I did go end up back there on uh, July 5th and for a compliance inspection. Um, and there was there was numerous outstanding violations. Uh, cleaning and repair violations. Um, some, you know, buildup of filth underneath the the cook line equipment, food spatters on walls, uh, damaged baseboard surfaces that need to be replaced, shelving in the walk-in cooler that needs to be either cleaned and resurfaced or replaced, um, a door gasket on a on a freezer. They also didn't have um required certifications posted as they are supposed to be with with their with their
permit. Um so they has still yet to um post their allergen, their choke save and their current health permit in a visible area which is a requirement. So given the inspection history and past board appearances, I opted to issue them a $200 sign based on um town of Ashland bylaws for board of health. Um, so that was issued on July 5th. >> Yes, I >> Lara, has that been paid? >> Chief, we have not heard from the clerks department, you know. So, neither. Sorry, Laura. So, neither from them from the owner or or the clerk's department. No, we have no confirmation that it's paid. But I will in the morning tomorrow, I I will check again with the clerks department and I will let you know or the board know. >> Yeah, they usually let
us know. So Tom, what are the next steps? If if there's health violations, what's the next step? Um, so I'm I'm going to plan to be back in there again this weekend and I will certainly keep you posted and I think the next step, you know, if there's, you know, chronic non-compliance would be to have them appear again uh before this board and uh hopefully um the fine has coerced them to come into compliance and certainly we want to develop a long-term plan um to avoid this in the future. um maybe assist them with developing some cleaning schedules and um you know address any deferred maintenance and get that taken care of um expeditiously as possible. I mean I'll work with anybody u my last resort is to issue fines or or pull them in
front of the board. I try to work with businesses and as much as possible to you know to assist them but um again given the history here. >> Okay. So, when when will your next inspection be now that they've been issued a fine? So, you were there on July 5th. When when would the next day be that you would go? >> Um, I'll probably go Saturday morning. >> Okay. >> Um, >> just because of the hours of operation or I could reach out to the owner and maybe he can meet me there, you know, on Thursday or something like that. Um, I'll see if he can meet me earlier in the interest of, you know, getting this wrapped up. um if not at the latest Saturday morning. >> So um I think um I hope
I speak for the whole board. If there's still significant violations then this week when you go or if you go on Saturday um I think we um I think Raj I think then you need to um after you see his inspection report if um if there's still significant violations um I think you need to go there yourself and um and then they would definitely have to come in front of the board at our next meeting with a with with a plan. the chief. So, we we'll plan, you know. So, Tom, give me give me a call, you know, but if >> Okay. >> It's not working. I I'll come out there right away, you know, and then then we'll deal with it. Okay. >> All right. Sounds great. >> Thank you. >> You know, I
don't want to speak for the whole board, but is the board in agreement with what I'm saying? >> I Yeah, I And I have a just a a question. Um Tom, so I know that a couple years ago, I think it was a few years ago, we had them, you did the inspection, uh there was some violations, they came to the board meeting. >> How has it been since then? I mean, aside from what's going on right now, >> um >> how did they react to that? >> Ba based on uh based on this these recent visits, I think it's kind of more of the same, unfortunately. Um there have been some other things that they did improve upon like you know with the temperature abuse and the cooling methods and things like that. However,
they certainly need to concentrate on the the cleanliness, the frequency of cleaning. Um you know having someone there that can assume active managerial control. I think the owner is kind of touch and go when he's there and you know it's it is a family business. I certainly respect that. He has his sons in there. Um, but I I just think there needs to be some more cohesive and tangible training for the staff that's there so they can kind of take ownership of the business and, you know, avoid any of these issues from coming up in the future. >> Yeah. Yeah. I I agree. That makes sense. >> And I think you may have shadowed me on an inspection there at one point. >> I did. I did. That was actually my first the first one
I went to. And I did one with you if you remember. And then we caught the guy smoking. >> That's right. That's right. Yeah. Yeah. So, never a dull moment. >> All right. Thanks, Tom. So, Raj, can you um email the board once we come up with a plan? >> Clearly, chief. We'll we'll follow up, you know, for sure. >> Okay. Um and now I think we continue with your report Raj. >> Yes sir. Thank you. Uh so so the flu flu flu uh flu season is coming right. So we as of now we have four scheduled uh uh flu clinics right. This is in uh addition to what flu clinics we do you know from from the health department. Uh again these clinics are with the with the pineill pharmacy from Sherburn. Uh there
are three clinics that we have put it here. The fourth clinic uh was actually scheduled for the Columbus Day, October 13th. I'm not sure. I'm going to check with the management if uh they're okay, you know, hopefully they're okay to to have us do the clinic on a holiday and that might pull more more crowd or, you know, folks who work, you know, might be a convenience for them. So, uh I'm I'm going to check on that and make sure that that's feasible and we'll do that. So, for right now, four clinics are scheduled all Mondays. This is what the pharmacy have available for us this years. And once we are done with this, you know, we'll we'll we'll plan additional clinics with the with the house landfill. Uh our our contractor Langden did did
a annual inspection last month. I was with with the uh with the team, right? We did submit a report to D on that. And uh there was one item that that we have to do. There was some shrubs that was growing around the vents that the D our DPW have assisted us clearing that. So we are we are all good on that part. Uh we had two complaints uh regarding unpermitted chickens uh along with roosters. One was at 46 Fountain Street. Uh the owner was here late last week. you know, Donna have issued her three three tickets uh given non-compliance or not returning calls about the permitting of the chickens and the rooster. Uh they have since removed the rooster at 46 uh fountain. The owner have come in applied for it. She have paid
a fine of $50 and uh for the two first citations of 25 each and we are still waiting for the third fine of $50. So that's with 46 Fountain Street. And last week we got another complaint at 237 Pleasant Street again rooster un unpermitted chickens. Uh they have a fine of $50. I guess that that's been paid. I'm I'm going to confirm uh on that and uh in in this property the conservation need to be involved given the proximity uh to the wetlands or the water resource. So we are going to work with them. Uh the owner of 237 is working with Becca to have that filing. So I'll keep the board informed on that. Regarding the daycarees, Samanthina Magika, you know, last time I informed the board that they have submitted a copy of
a food safety manager certific certification as well as I'm still waiting for their plan review application uh for the food permit and I have uh asked for an update last late last week and I've not heard since then and I'll keep the posted again on this. We picked up uh a couple of cases uh one one at uh drive uh chestnut police department. We had a complaint uh a week and a half back regarding Roches. Uh some other structural things that I have confirmed and issued an order letter. This is the chestn plate apartments again. Uh 20 join drive number 35. uh I have the management have since informed me that the occupant have vacated the place so and I have advised the management not to reent the place or the unit till till it's
in compliance you know and this this has happened uh two last three cases right we had there that they reented but I have it in writing to them now and I'll follow up uh there's another case at 242 Main Street u this is a repeat is you know we had this I I guess Ani this year again roaches and some structural issues. I was there yesterday actually with with a with our case manager from from community center right to do inspection. We we have find some issues with the pest as well as a couple of structural issue that we have issued a new order to correct a letter to the owner and u I spoke to her yesterday they're working on it you know so that's that 137 pawn street again uh no update from
last time you know u I guess property sold now it's in between the property new property owner and the occupant uh Mr. Nasi is that they have asked access I don't know but it's in between them now open go permitting software still working uh again it's taking some time uh we are still working with a team to develop our inspectional software again Mr. Karan is also involved at this point. You know, we we we was trying to test the new inspectional software that they have developed for us and found some challenges with that or deficiencies that the team is working. Hopefully, we get this resolved and go live on open G medical reserve cops. you know we we do have our monthly meeting u u I'm I'm on their advisory board uh for the MRCR
middle MRC uh definitely the the group is active now we have a full-time coordinator for for the unit and another update that they they have taken a storage space in Ashland so they're shipping some supplies to us you know that uh the team then from from our office bring it to the storage you know for for the supplies for MRC and you remote area medical chief and m Dr. J you will know more about about this right but what I heard from Mr. Murphy uh from Framingham that they have cleared the issue now with the with the medical thing you know that was going on from the state you know so and they they are good to go on on the clinic uh on >> you mean surprise you mean I cleared it >> see
I I have no doubt but you know so I I was on a on a meeting with him last week you know with the MRC meeting you know but you know you know but I don't want to say too much here but I knew it, but I just wanted to update, you know. >> So, we'll see, you know, hopefully good stuff. >> I had to take the credit for that one. >> Oh, absolutely. And last two clinics, you know, um I was speaking to Laura, you know, I I wish we have more credit at least the board, you know, that for the work that was done for for the last two clinics. trust me you know uh but I can't speak too much here you know so but >> thank thank you for what what
you guys are doing you know anyways that that I appreciate you know Dr. Go ahead, please. >> I just wanted to know if you've been contacted about having a table at the clinic. >> I I don't know formally. I I guess, you know, we we've worked together a lot, you know, so but no formal conversation, you know, but like >> Okay. >> If we if we need to, we we can definitely, you know, given we do a lot of work together as a group, you know, lot of grants together, right? No. >> That's true. That's true. So, you may not even have to do anything um separate. And I only ask because it doesn't seem like this year they're really focusing too much on the the community resource tables. Um you know, Framingham will obviously
be there. Um right, >> but and LHIP and maybe Brace, but I don't think um I don't think there's going to be a lot a big representation from the community. And um so I just wondering if anyone reached out to you, but it makes sense if if Bill's there, you're going to be there. So >> I mean definitely whatever time I can spend, you know, of late we are a little busy with with our own work here, you know, with a lot going on. I have forwarded you another third 40 40 you know 40B that we got, you know. So we we have a lot going on on our on at our end, you know. So I mean and I'll definitely be there you know but I don't know how much time I'll be able
to spend you know with the clinic you know. So >> yep that makes sense. >> Thank you sir. And the last part is the our disease investigation. Currently we have two active TB cases that we are working and one neurovirus case that we picked up over the weekend. You know we are following up on that. And I'm open for any any questions please. >> Yeah. Does anybody have any questions for Raj? >> I do. garage the 40B project that's the one we were all expecting right >> the one on unit it's not >> no the third one is a new one you know so we have two going on uh one is on Main Street 1060 Main Street you know then then we have another one on West Union right uh and this is the
third one that that got filed you know on us I guess this is 169 units right uh came to me only a couple of days back you know I am still Uh I have not open opened the packet yet, you know. Last two day was crazy for me, you know, but uh this is the third one that uh that we got we got the application for. >> Okay. Because I I was obviously aware of the Main Street one and we talked about the one on West Union. Um but I I wasn't sure if we if this was on everybody's radar. So >> So this is a brand new sir. you know I I guess it was Friday or Thursday last week I came to know or Wednesday max you know I I was not aware
of this even you know so >> Got it okay >> this is a new one this is a third one new >> got it anybody else >> all right so the next thing on our agenda is the consent agenda do I have a motion to approve it as is anybody >> who would have a motion. >> Go ahead. I motion to approve it as is the consent agenda. >> Second. >> Okay. Anybody have any questions on it? All in favor? >> I. >> That's an unanimous. And the next thing on our agenda is uh oh so uh will be any future item tobacco regulation review. Raj you going to talk about that at all or Yes sir. So I'm meeting a tobacco control person you know who who again is in Frammingham right so we
are meeting this Thursday and I know Mr. kingsman last time he agreed you know to work with us and again this fallen through you know uh so we we are getting this back on here right hopefully uh do some work on the regulation that we need to and then I will send it to Mr. ings man first and then to the whole board you know to so we we the amendments we need to make you know uh that we can do another thing I have an email from from a Ashland resident uh now I I'll I'll share the email you know so u there's something called nicotine free generation you know uh I guess 12 communities have adopted this in Massachusetts Hopkin being the last one they adopted it last month you know that if
if if adopt this regulation is called in nicotine free generation right like if if we if the board decides right that the person who is not 21 uh on the date of uh when they adopt that regulation cannot buy tobacco products for the whole life you know so it's it's a newer thing right 12 communities have adopted I guess Brooklyn again was the first one to adopt I guess you know but Hopkin is the 12th one that that adopted that admission you know I will share some uh more information to the board on this. Uh there is a Ashland president who's interested, you know, to to speak to the board or, you know, assist if if the board decides to do something like that in Ashland. So, u we'll we'll bring this conversation on onto
the board. Another thing that uh for future is going to be 12 pawn street that they are there is a coffee shop that have applied for uh for a permit there or plan review right now. They'll be in front of the board. asking for a external grease tab waiver that we we got the request uh yesterday. So that'll be another item that we'll be bringing in front of the board for next meeting. >> Okay. Um so our next meeting right now is scheduled for August 19th. Um, unless we have anything urgent that comes up where we may have to schedule something, especially once we have the results from Sunnyside. Um, do anybody have anything else they'd like to bring up at today's meeting? >> Nope. >> Okay. With that being said, I will request a
motion to adjurnn. >> Motion to adjurnn. >> And I will second that. >> All in favor? I'll second it. >> Great. >> So, unless unless anything urgent, everyone, we'll see you. We'll have another meeting on August 19th.
