001okay that was the last thing um the the last visit everything was fine and they understand they have to preview every year something like that so okay all right um so a question for Raj um that come the manure handling is that are they going to compos it on site or they going to dispose it off on site so according to our conversation it'll be on site onite okay all right thank you thank you Jay so I I just have a a question so given I know it wasn't a major issue with the animals before and they decreased the flock size and it looked like there might have been some bullying some maybe health related issues which probably not present anymore but given the proximity to the wetlands and and some you know we've been

002uh trying to work through this for a while um in granting a variance is it possible to Grant it with some sort of um stipulation or even outside of the variance itself where we got permission from the owners just to go in and do like a check um occasionally or you know more more than the annual inspection is that something that's done is that even feasible does it even make any sense um I'm just you know I can answer that we we definitely have the authority right if we have any concerns right with the health of the birds or even even with the maintenance of the coupe we we can do that you know so u i mean if you if you want us to keep keep an eye on this we we can certainly

003do that you know should that should not be a problem um I I would just throw it out to the rest of the board and see what you folks think about that um you because it sounds like they have everything that they need right now you know unlike the food inspection where we schedule twice a year or something normally and then whenever that complaint happens but on the inspection of uh animal uh Sheltering do they do it regularly or they do only when there's a complaint comes in Mr Nar there is a requirement of one one inspection a year you know from the state you know so okay um I mean besides Ashland right we we submit all our reports to the state of the inspections for with with our uh you know animal permits

004okay so yes at least one inspection a year you know right if we do more of them keeping it are we isolating these people or we there a reason for us to to add more to them that's just the concerns with with the health of the chickens right like I mean when when we went this time uh though the the smaller chickens have grown up you know like in a month you know they they're bigger now but there's still some further loss you know that they had right again if the bo wants it's not you know but like for us to check just want just to make sure you know given what we have seen and it's approximately I guess six months we have been working on this property you know sure as situation you

005know as long as they're not overburdened by extra visits there is a purpose for us to make sure that it's a healthy community of birds there so that's fine with me thank you so what would it look like um you know instead of the the annual inspection that maybe somebody goes out there just you know one time in six months from now or something like that yeah because I agree too I I wouldn't want to over burden anybody either and I wouldn't want to treat anybody any differently than anybody else right um but you know I'm still um kind of new to the you know I have a chicken coup we have you know fortunately had not had any problems but um I know that some people can have issues with them right da any

006thoughts on that I I totally agree with you because basically we need to make sure that you have a healthy population of the birds there and then they're being taken care of out that's all yeah I second that I I you know I think it's worth checking in on the um the the well-being of the animals but also given the location of the or the the close proximity of the wetlands and the the decision by the owners to compost the the uh the manure um I think it's it's probably in this particular case warrants you know a semian ual um inspection if only on just those two issues there' be any other issues that but that's my opinion okay Barbara do you have anything to add um no I just agree with um what you

007guys are are talking about like you know more frequent checks like you know twice a year not just annually just in case you know just making sure like with the the health of the birds and just making sure that the amount is they have is still enough for the space they have right Raj I have one more question do we know whether we have have any other Chicken cops in the similar situation here with close to the wetlands are there any existing Mr we are dealing with another one right so uh this is on West Union you know we this is the first one that we giving a way over to is it for within the 100 foot for zone or whatever that I mean is I guess we might have another few vienes you

008know but I'm not sure I'm sorry you know we can check that and get back to you no I I don't need this but I just wanted to make sure that whatever we are imposing here similar rules may have to be applied for others to make sure but in this in this case there is a prior history of how the birds have been it's more with the health of the birds right that's all we are concerned you know yeah in the short run short run I think there shouldn't be an issue for that yes so it sounds to me like what we're saying is maybe you know we Grant the variance and within six months um we go out and just do one more inspection but that doesn't necessarily mean it's going to continue like

009that into perpetuity when re up the variance uh the the permit next year you know would be the same as every body else does that sound about right that's fine that sounds good that sounds good to me also okay so so uh Mariana can I explain to you what what we just went through so that you're clear yes go ahead okay so what we're talking about is granting the variance with an annual with the a typical annual inspection would be of course once a year um Animal Control will come out and inspect be because of some of the issues that they've had on that property which were not huge but there are some uh for this first year we'd like to inspect twice we'd like to go out within six months and do one inspection

010and then do the onee inspection um and I'm sure things will be fine but just I think that will make everybody feel better is that okay and at the same time sorry we did I'm sorry I just to be clear we did the yearly inspection through the state um the one we were there last week so we would need one more not two more we just did the inspection okay so so it would just be one in six months from now and then um yes okay and then and then if if the your inspection reveals that you need more then that'll be added on based on what the conditions are correct yeah okay okay so I'm I'm good with uh giving the way so do we need to explore explicitly State the waver or we

011can just say that the waiver from 100 foot is enough I think that it would be you'd be granting let me just if you can elaborate on the exact law I will move that one so the the uh waiver um let's see the waiver would be for the um for distance from the property line so um under 25 ft they're actually 12 feet and then distance from the wetlands they're 68 ft it should be 100 feet so they're they're waving property line and distance from wetlands and then we're also putting in that stipulation of an inspection in six months from now so if somebody would like to take that I move that okay a second anyone I'll second that okay all in faor hi kg hi hi barara all right good so that passes um

012so Marana I think you're you're all set we are all set okay so anything just let us know okay okay thank you all right have a good night um all right thanks everyone so now um it is time to review and approve the 2025 board of health permits pending receipt of all required documentation and Raj do you want to just let us know if all the required documentation uh that's something that we need to discuss or um how you would like us to go through doing this I know they're in groups of types of permits and and I myself need to abstain from the animal permit and I think kg you have to abstain from another one of the votes so correct um Raj I'll I'll give you the floor offer to yes thank you

013for that and and we we can do you know columnwise or all together you know um either is fine you know we we can do retail permits you know um and then once we have the every documents right uh we will issue permits according to that you know that there's still and we still have time right they due uh December 31st you know our permits don't expire till 31st you know so uh we'll we'll we'll give issue permits once we have everything from from our establishment you uh just about uh about approving it it's it's your call you know if you're going to do it single single you know with or you want to do it together I I I I may suggest that we group the food ones together are the the G grease

014strap is that it's there also the greas strap is coming too or no grease straps will be coming next month or next next all all the food ones we do first and excluding New England Hindu temple and then whoever is allowed to vote go ahead and vote on it then we'll do the animal one except your chicken CP I guess that's what you worried about uh Jay yeah yeah and where where is yours that you are it's it's under New England Hindu temple it's in in the end I guess oh it's at the end okay yeah no the end so we can just group that all the food permits together except the New England Hindu temple okay so the food and then and then all four of us can vote on that if we need

015to and then uh you take up the New England Hindu temple separately and then vote on it and then I will obain on that one okay so then the food the food permits are including the retail food permits the food establishments um not the and then were we doing tobacco license es separately um so what I would say is we uh we approve the retail food permits the food establishments the residential kitchens is on the next page that's um all in one Fell Swoop does anybody want to do take that so that's retail food permits food establishments and residential kitchens do that one first all three of those is that newly Hindu temple included in it or excluded in it I thought you said that was at the end no no that's also part of

016it part of the food establishment so if you going to include include on that I cannot even participate on it I can't even move on it so okay let me let me find where it is here it's uh under n well it's yeah so it's under food establishments um in N but we we have a quorum Without You kg so I think that's fine that's true let's do these with kg okay um and get them out of the way so if it it would just be you know Dave me and Barbara voting on retail food permits food establishments and uh residential kitchens does someone want to make a motion to approve those per I will make a motion that we approve the retail food per food establishments and uh residential kitchens as as listed okay

017we I'll second that okay all in favor I I all right I three votes that passes okay I'm recused myself from that okay so kg recuses himself from that next is the animal shelter permit right well we have tobacco licenses too and septic installer permits sure yeah so let's why don't we do um the three of those three more we'll do tobacco licenses septage huler permits and scepter installer permits and we can all vote on that see I I move that okay excellent do we have a second I second all right all in favor I I I I all right great that is all four of us um and then I am going to abstain from animal and ecoin permits so if someone would like to make a motion to accept those permits please do

018I move that second okay we have a second all in favor yep I I okay that's three votes and I think that we are I think that's it right permits okay all right great um okay so araj you are up with the health director's agenda thank you Mr chair so uh first was the state inspection for our vaccine program uh this was on November 20th the state came out uh to check check our vaccine program right uh they they do this uh two years you know every two years they do inspection you know so there's couple of items we need to address one was uh uh there was a u Ice uh accumulated in in our freezer so they they asked us to defrost it you know so that's what we did we have to

019transport our vaccines to Hopkin that's our sty site U there was there for like 3 4 days you know so we defrosted our freezer bring them back Dr Ron kindly uh signed again our documentation because he he's still our medical director for for our vaccine program so he did that you know so that was one more requirement uh we have gotten new data loggers uh from the state that we are in the process to install uh I guess we have a virtual call with the with the state tomorrow to install them so that's just just we keep the temperature locks you know every morning and evening we we check the temperatures of our vaccines both the refrigerator ones and the frozen ones you know so that was it uh mom taste at H restaurant we

020have granted uh AOS sharing permit to Mom taste they going to be making some sauces uh at the at the hter restaurant so we we granted that and Santo from last uh time they was on the board meeting you know they they have submitted two audits inspections by private contractor and they're going to do another one at this month uh the next item is the Dollar Tree we we do had a complaint about uh um mice rodents at the Dollar Tree though currently we don't have a food permit at Dollar Tree given the exemption by the state you know I guess this was like 3 four years back a little before maybe the state uh or the food program has come up where commercially packed food is sold right they W they're not going to

021need a permit from from us right so the Dollar Tree was exempt under that but based on the complaint we have to go in and uh uh the the management voluntarily closed the food section for Dollar Tree they was closed for almost a week and Tom went back and then we reopened them you know but that was voluntarily Closer by them so that that that is now solved uh similarly we do have some pest issues on Speedway you know that's again at Pawn Street or War 126 that we call right uh definitely some some radent activities on on Pawn Street uh or 126 um one one reason might be the the construction there so but uh with Speedway we have some other issues also uh couple of times we went in the food manager was

022not present uh we have still working with them uh we have a fine of $600 to them so far uh but uh still there are a couple of items that are still pending that we have to verify me either me or Tom will get going on this week or next you know so I'll keep the board posted on that regarding the housing cases uh Chestnut Place Apartments uh they are definitely better at the dumpster area um I do have a $200 fine once after the board meeting uh that we have we have them last time here uh a month or so back uh but after that it's it's better uh but uh I did uh got an email from them uh I didn't have an update on the three pending housing cases uh the email

023stated that they're still working or looking uh into those matters and they they'll be updating us so that'll be pending item uh for those three housing cases at uh at the just just Place Apartment 137 Pawn Street uh we was back at the wer courthouse uh myself uh along with our Building Commissioner Doug uh Our receiver for the property uh Mr James cter Main Street we the 40b project with the town have received an application so we did had an internal meeting you know with the our Consultants the town that the town have hired for the project I have submitted uh uh our comments right that we discussed last time uh the comments that came from uh D EPA along with you know uh we have asked for an IPM report uh that's integrated Pest

024Management report given uh given the growing rent population in the town right then uh s best abatement lead abatement and uh a uh dust mitigation plan while they're going to be demoing once once the project get going so that's the update for 1060 Main Street that we have from har no and um last thing uh I we missed that it's not on the agenda right the communicable diseases uh usually we we update the board on that so we currently have four TV cases open uh meeting it was there and then we have submitted our comments to our Consultants you know not too much time I will say but yes you know little bit here and there yes all right thanks two questions if you don't mind no no please one is I I'm sure probably

025137 there's nobody living there right Mr n that was the problem right so there are two gentlemen you know uh leaving one one one Mr Gary right he's in the camper and he's he's living there from the time we have condemned the property December 2022 right and one of the Elder Brothers Mr William nasio right he habitated one of the Vans there's a blue blue van right there right he been in that in the van for approximately 6 months now you know so uh when last month we got the receiver right we have this concern because there was a uh power line that they have got it in from the property to the van right that definitely condemned building you know very unstable building we had concerns you know and that's why uh the judge

026have issued you know of the background probably probably goes back year before P arrival into the board I guess probably that's why I'm not aware of it so much true I guess it's it was December 28th 2022 when we have to condemn the building you wow wow wow wow wow where are these people being housed these two are they being moved out or they mean so what has happened right so the gentlemen uh uh Mr Gary is living on the property you know so he's trespassing it he have no rights to the property right so but Mr William nasus and his brother Jorge nasus when we condemned the property we provided them accommodation uh in Red Roof in in Framingham you know from from the town side uh okay it was over two weeks that

027we we paid for it and then uh Mr William nasos who is the elder brother he's uh eligible to get accommodation from the from the state uh dmh uh but they we it was I guess Dr J you Dr J you was there too right when we went to the Red Roof in so that they're safely accommodated somewhere else that's good that's good I mean so not right now I will I won't want to give you wrong information right or to the public but it'll be more with the receiver right so it's going to be taking care of that part you know Mr James cter who is an attorney right because right now he he he is the or of the property you know so but like their safety is very very important you know

028so all that is done because of that you know so right the other thing is the road in population is up because of the climate change everywhere so that needs to be that needs to be addressed quite uh whether there is the temperature goes up then everybody everybody has this issue so it'll be more frequent for you to find out that there'll be more radent so I agree you 100% you know but like we we have not seen this in Ashland you know definitely new thing in Ashland right I mean though I'm I'm with the town almost four years you know but like I came from Watertown Watertown have one person just for Road and control right now in the health department right so they they hired somebody last year just just for radent issues

029you know so that like one of my concerns like I don't want like you know asland to be to be like that you know so you can't help teach the rodents we have to manage it true we we need to control it right I mean given given the construction and all that right like I mean climate change itself produces more population of it so it's it's more of that absolutely sir 100% you know so beyond that but we definitely seeing more and more of it is you know so right I guess I have four open cases on Route 126 you know so uh uh maybe four yeah four right now right so they have opened in yeah Tom Tom should be more cautious about it to to make sure that he monitors these things in

030the food establishments no he he do he we do a wonderful job you know so yes thank you thank you all right any other questions please no no other questions Raj okay uh thanks Raj next agenda item is the consent agenda hope everybody had a chance to just look at that it's only budget reports no no minutes um this week so does anyone want to make a motion to so moved to um move to um approve the consent agenda thank you kg any seconds I'll second it okay all in favor I I all right that's four thank you um future agenda items I know I have one and um Laura if you could put this uh on the next agenda just I could give a ram a ram Clinic update for 2025 it won't take

031more than five minutes said that last sorry it didn't get oh no no no no problem in fact it's better I think to wait until um Ed burman's here because then we can both kind of chime in so it it worked out well okay anybody else have a future agenda item no okay uh um the next meeting date it is stated here to be January 7th 2025 and if there's nothing else I'm assuming there's nothing else um does anyone want to make a motion to adjourn so mood okay any seconds second all in favor hi hi hi all right excellent thank you Jay done sure was a colorful meeting you did a good job thank you very much Yeah by bye thank you happy holidays everybody happy holiday happy holidays to all you know thank
